2.—Féadfaidh an tAire, le hordú, lá do cheapadh chun bheith ina lá ceaptha chun críocha an Achta so.

3.—Na daoine is comhaltaí den Bhord Iontaobhaithe díreach roimh an lá ceaptha scoirfid ar an lá ceaptha de bheith i seilbh oifige.

An Bord Iontaobhaithe d'athchóiriú.

4.—(1) Amhail ar an lá ceaptha agus ón lá san amach beidh an Bord Iontaobhaithe comhdhéanta—

(a) de chúigear comhalta (dá ngairmtear comhaltaí do chathair na Gaillimhe san Acht so) arna dtoghadh ag Bárdas na Gaillimhe,

[EN]

(b) de bheirt chomhalta (dá ngairmtear comhaltaí do chontae na Gaillimhe san Acht so) arna dtoghadh ag Comhairle Chontae na Gaillimhe agus

[EN]

(c) de chomhalta amháin (dá ngairmtear an comhalta do Mhuigheo san Acht so) arna thoghadh ag Comhairle Chontae Mhuigheo.

(2) Féadfaidh an Bord Iontaobhaithe gníomhú d'ainneoin folúntas nó folúntais a bheith ina gcomhaltas.

An Bord Iontaobhaithe do bheith ina gcomhchomhlucht chun críocha an Achta um Bainistí Chontae, 1940.

5.—Is comh-chomhlucht chun críocha an Achta um Bainistí Chontae, 1940 (Uimh. 12 de 1940), an Bord Iontaobhaithe.

Comhaltaí den Bhord Iontaobhaithe do dhícháiliú.

6.—(1) Beidh feidhm ag Airteagal 12 den Sceideal a ghabhas leis an Local Government (Application of Enactments) Order, 1898, arna leasú le haon achtachán ina dhiaidh sin, maidir leis an mBord Iontaobhaithe agus le comhaltaí an bhuird sin fé mar atá feidhm aige maidir le comhairlí contae agus lena gcomhaltaí.

(2) Beidh duine dícháilithe chun a thofa ina chomhalta den Bhord Iontaobhaithe ag údarás áitiúil ranníocach más rud é nach toghthóir Rialtais Áitiúil do líomatáiste feidhmiúcháin an údaráis áitiúil sin é.

(3) I gcás comhalta den Bhord Iontaobhaithe a bheas ceaptha ag údarás áitiúil ranníocach do scor de bheith ina thoghthóir Rialtais Áitiúil do líomatáiste feidhmiúcháin an údaráis áitiúil sin, beidh sé dícháilithe chun bheith ina chomhalta.

(4) Ní shealbhóidh duine ar bith aon oifig nó fostaíocht ar páigh faoin mBord Iontaobhaithe faid is comhalta den Bhord Iontaobhaithe é ná laistigh de dhá mhí dhéag tar éis é do scor de bheith ina chomhalta den bhord san.

(5) Aon uair a thiocfas comhalta den Bhord Iontaobhaithe chun bheith dícháilithe ó bheith ina chomhalta, dearbhóidh an Bord Iontaobhaithe láithreach a oifig a bheith folamh agus is tuigthe an folúntas a thárlachtain ar an dearbhú san a dhéanamh.

Toghadh agus téarma oifige comhaltaí do chathair na Gaillimhe.

7.—(1) Comórfar an chéad toghchán comhaltaí do chathair na Gaillimhe pé lá, nach déanaí ná mí roimh an lá ceaptha, a cheapfaidh an tAire chuige sin, agus toghfaidh Bárdas na Gaillimhe cúigear comhalta do chathair na Gaillimhe sa toghchán san.

(2) Déanfaidh Bárdas na Gaillimhe gach bliain toghcháin cúigear comhalta do chathair na Gaillimhe do thoghadh ag an gcéad chruinniú ráithiúil de Chomhairle Bhuirge na Gaillimhe a tionólfar tar éis an 22ú lá de Mheitheamh sa bhliain sin, agus beidh an toghchán san ina chuid den ghnó a bheas le déanamh ag gach cruinniú ráithiúil den tsórt san.

(3) Gach comhalta a toghfar ag an gcéad toghchán comhaltaí do chathair na Gaillimhe, tosnóidh a théarma oifige an lá ceaptha.

(4) Gach comhalta do chathair na Gaillimhe (seachas comhalta a toghfar sa chéad toghchán comhaltaí do chathair na Gaillimhe), tosnóidh a théarma oifige an lá a toghfar é.

(5) Mura dtárlaí roimhe sin é d'éag nó d'éirí as nó do theacht faoi dhícháilíocht, beidh gach comhalta do chathair na Gaillimhe i seilbh oifige go dtí deireadh an lae díreach roimh an lá a déanfar an chéad toghchán eile comhaltaí do chathair na Gaillimhe do chomóradh do réir fo-ailt (2) den alt so.

(6) Aon uair a thárlós corr-fholúntas i measc na gcomhaltaí do chathair na Gaillimhe déanfaidh Bárdas na Gaillimhe, a luaithe is caothúil, duine do thoghadh chun an folúntas san a líonadh.

(7) I gcás duine a toghfar chun bheith ina chomhalta do chathair na Gaillimhe de bhun fo-ailt (1) den alt so d'fháil bháis roimh an lá ceaptha is tuigthe, chun críocha an ailt seo, an duine sin d'fháil bháis an lá ceaptha.

8.—(1) Comórfar an chéad toghchán comhaltaí do chontae na Gaillimhe pé lá, nach déanaí ná mí roimh an lá ceaptha, a cheapfaidh an tAire chuige sin, agus toghfaidh Comhairle Chontae na Gaillimhe beirt chomhalta do chontae na Gaillimhe sa toghchán san.

9.—(1) Déanfaidh Comhairle Chontae Mhuigheo pé lá, nach déanaí ná mí roimh an lá ceaptha, a cheapfaidh an tAire chuige sin, an comhalta do Mhuigheo do thoghadh, agus tosnóidh téarma oifige an duine a toghfar amhlaidh an lá ceaptha.

(2) Déanfaidh Comhairle Chontae Mhuigheo gach bliain toghcháin an comhalta do Mhuigheo do thoghadh ag an gcéad chruinniú bliantúil de Chomhairle Chontae Mhuigheo a tionólfar tar éis an 22ú lá de Mheitheamh sa bhliain sin, agus beidh an toghchán san ina chuid den ghnó a bheas le déanamh ag gach cruinniú bliantúil den tsórt san.

(3) An comhalta do Mhuigheo a toghfar ag aon chruinniú bliantúil de Chomhairle Chontae Mhuigheo de bhun fo-ailt (2) den alt so, tosnóidh a théarma oifige an lá a toghfar é.

(4) Mura dtárlaí roimhe sin é d'éag nó d'éirí as nó do theacht faoi dhícháilíocht, beidh an comhalta do Mhuigheo i seilbh oifige go dtí deireadh an lae díreach roimh an lá a déanfar an chéad toghchán eile don chomhalta do Mhuigheo do chomóradh do réir fo-ailt (2) den alt so.

(5) Aon uair a thárlós folúntas imeasc comhaltaí an Bhuird Iontaobhaithe de bhíthin an comhalta do Mhuigheo d'éag nó d'éirí as nó do theacht faoi dhícháilíocht, déanfaidh Comhairle Chontae Mhuigheo, a luaithe is caothúil, duine do thoghadh chun an folúntas san a líonadh.

(6) I gcás an duine a toghfar chun bheith ina chomhalta do Mhuigheo de bhun fo-ailt (1) den alt so d'fháil bháis roimh an lá ceaptha is tuigthe, chun críocha an ailt seo, an duine sin d'fháil bháis an lá ceaptha.

Comhaltaí den Bhord Iontaobhaithe d'éirí as oifig.

10.—Féadfaidh comhalta den Bhord Iontaobhaithe éirí as a oifig tráth ar bith trí litir arna díriú chun an Bhuird Iontaobhaithe agus beidh éifeacht ag gach éirí as den tsórt san i dtosach an chéad chruinnithe a bheas ag an mBord Iontaobhaithe tar éis an litir sin d'fháil.

Folúntais a chur in iúl d'údaráis áitiúla ranníocacha.

11.—Déanfaidh an Bord Iontaobhaithe, a luaithe is féidir tar éis folúntas a thárlachtain de bhíthin comhalta den Bhord Iontaobhaithe d'éag nó d'éirí as nó do theacht faoi dhícháilíocht, an folúntas san a chur in iúl dá réir sin don údarás áitiúil ranníocach do thoigh an comhalta.

Costais an Bhuird Iontaobhaithe de bhreis ar ioncam an bhuird.

12.—(1) Amhail ar an lá ceaptha agus ón lá san amach—

(a) sa mhéid go mbaineann cinneadh 1859 um an uiscebhealach leis an tslí ina ndéanfar na costais uile a bhainfeas agus a ghabhfas le cothabháil agus caomhnadh an Uisce-bhealaigh (a mhéid ná glanfar na costais sin as ioncam an Uisce-bhealaigh) do mhuirearú, d'iompar agus d'íoc, scoirfe sé d'éifeacht a bheith aige,

(b) na costais uile faoina raghaidh an Bord Iontaobhaithe maidir le cothabháil agus caomhnadh an Uisce-bhealaigh (lena n-áirítear airgead is iníoctha ag an mBord Iontaobhaithe faoi fho-alt (3) d'alt 14 den Acht so), a mhéid ná glanfar na costais sin as ioncam an Uiscebhealaigh, beidh a muirear, a n-iompar agus a n-íoc ar na húdaráis áitiúla ranníocacha, faoi réir fo-ailt (2) den alt so, sna cionúireachta so leanas—

(i) seasca faoin gcéad ar Bhárdas na Gaillimhe,

[EN]

(ii) tríocha faoin gcéad ar Chomhairle Chontae na Gaillimhe, agus

[EN]

(iii) deich faoin gcéad ar Chomhairle Chontae Mhuigheo.

[EN]

(2) Féadfaidh an tAire ó am go ham, le hordú (arna dhéanamh tar éis dul i gcomhairle leis an Aire Rialtais Áitiúil agus Sláinte Poiblí), a ordú maidir leis na costais dá bhforáltar faoi fho-alt (1) den alt so go ndéanfar, in ionad iad do mhuirearú, d'iompar agus d'íoc sna cionúireachta atá leagtha amach sa bhfo-alt san, a muirear, a n-iompar agus a n-íoc do chur, amhail ar an dáta agus ón dáta a sonnrófar chuige sin san ordú, ar na húdaráis áitiúla ranníocacha (nó ar aon dá údarás acu ag eisceadh an tríú údaráis) i pé cionúireachta is oiriúnach leis an Aire agus a shonnró sé san ordú, nó a muirear, a iompar agus a n-íoc a chur go hiomlán ar aon cheann áirithe de na húdaráis sin ag eisceadh na n-údarás eile, agus faid a bheas aon ordú den tsórt san i bhfeidhm beidh éifeacht ag an bhfo-alt san faoi réir forál an ordaithe sin.

(3) Féadfaidh an tAire aon ordú a bheas déanta aige faoi fho-alt (2) den alt so do chúlghairm.

[EN]

(4) Gach ordú a déanfar faoi fho-alt (2) den alt so leagfar é faoi bhráid gach Tighe den Oireachtas a luaithe is féidir tar éis a dhéanta agus, má dhéanann ceachtar Tigh acu san, laistigh den lá is fiche a shuífidh an Tigh sin tar éis an t-ordú do leagadh faoina bhráid, rún a rith ag cur an ordaithe ar neamhbhrí, beidh an t-ordú arna chur ar neamhbhrí dá réir sin ach beidh san gan dochar do bhailíocht éinní do rinneadh roimhe sin faoin ordú.

Cuid den Uisce-bhealach do thréigean nó d'aistriú.

13.—(1) D'ainneoin éinní dá bhfuil in alt 45 den Railway and Canal Traffic Act, 1888, féadfaidh an tAire, ar an mBord Iontaobhaithe nó duine ar bith ag á mbeidh leas sa scéal dá iarraidh sin, a údarú, le hordú, aon chuid den Uisce-bhealach nó de na hoibreacha ann do thréigean nó d'aistriú chun údaráis siltin nó chun údaráis áitiúil ranníocaigh.

(2) Ní déanfar aon aistriú chun údaráis siltin faoin alt so mura dtoilí an t-údarás siltin sin roimh ré leis an aistriú.

[EN]

(3) Sar a ndéana an tAire ordú ag údarú aon tréigin nó aistrithe faoin alt so, deimhneoidh sé go ndeighleálfar leis na hoibreacha tréigthe nó aistrithe, nó go n-úsáidfear iad, i slí a bheas chun a shástachta.

Údaráis áitiúla ranníocacha do dhéanamh agus do chothabháil oibreacha áirithe.

14.—(1) Má chítear d'údarás áitiúil ranníocach, tar éis dul i gcomhairle leis an mBord Iontaobhaithe, gur gá nó gur inmhianaithe ar mhaithe leis an bpobal oibreacha nua maidir leis an Uisce-bhealach do dhéanamh laistigh de líomatáiste feidhmiúcháin an údaráis áitiúil sin nó oibreacha láithreacha de chuid an Uisce-bhealaigh do leathnú, d'fheabhsú nó do chothabháil, is dleathach don údarás áitiúil sin, le toiliú an Aire Rialtais Áitiúil agus Sláinte Poiblí agus faoi réir ailt 50 den Acht Siltin Airtéirigh, 1945 (Uimh. 3 de 1945), déanamh nó cothabháil na n-oibreacha san a ghabháil orthu féin, d'ainneoin nach gá an déanamh nó an chothabháil sin, nó gach gá go hiomlán é, chun críche an Uisce-bhealaigh.

(2) An costas a bhainfeas le húdarás áitiúil ranníocach do dhéanamh aon oibreacha nua nó do chothabháil aon oibreacha láithreacha faoi fho-alt (1) den alt so, beidh ar an údarás áitiúil sin é d'iompar.

(3) (a) I gcás údarás áitiúil ranníocach do dhéanamh oibreacha nua nó do leathnú nó d'fheabhsú oibreacha láithreacha faoi fho-alt (1) den alt so, beidh éifeacht ag na forála so leanas—

(i) má thagann de sin go méadóidh ar luach an Uiscebhealaigh, íocfaidh an Bord Iontaobhaithe cúiteamh leis an údarás áitiúil sin,

[EN]

(ii) má thagann de sin go laghdóidh ar luach an Uiscebhealaigh, íocfaidh an t-údarás áitiúil sin cúiteamh leis an mBord Iontaobhaithe.

(b) I gcás aon oibreacha láithreacha do bheith á gcothabháil ag údarás áitiúil ranníocach faoi fho-alt (1) den alt so, féadfaidh an t-údarás áitiúil sin pé cuid den chostas d'aisghabháil ón mBord Iontaobhaithe ba ghá chun an obair láithreach a choimeád sa staid ba ghá chun críche an Uisce-bhealaigh.

(4) Má éiríonn aon cheist i dtaobh cúiteamh a bheith iníoctha ag údarás áitiúil ranníocach nó leo faoi mhír (a) d'fho-alt (3) den alt so nó i dtaobh méid an chúitimh sin nó i dtaobh aon tsuim a bheith ionaisghabhála ag údarás áitiúil ranníocach faoi mhír (b) den fho-alt san nó i dtaobh méid na suime sin, cuirfear an cheist faoi bhráid an Aire Rialtais Áitiúil agus Sláinte Poiblí agus ní bheidh dul thar a bhreith sin.

(5) Amhail ar an lá ceaptha agus ón lá san amach scoirfidh an Bord Iontaobhaithe de bheith freagarthach i gcothabháil an róid, é Bharr an Chalaidh go dtí an bóthar poiblí, a luaitear i Sceideal B a ghabhas le cinneadh 1859 um an Uisce-bhealach agus is tuigthe chun críocha an Achta san agus aon ordaithe den tsórt san gur bóthar baile-cheantair an ród san.

(b) i gcás Comhairle Contae na Gaillimhe tríd an ráta dealúis mar mhuirear ar chontae na Gaillimhe go hiomlán (gan buirg na Gaillimhe d'áireamh),

(c) i gcás Comhairle Contae Mhuigheo, tríd an ráta dealúis mar mhuirear ar chontae Mhuigheo go hiomlán.

AN ACT TO MAKE FURTHER AND BETTER PROVISION IN RELATION TO THE LOUGH CORRIB NAVIGATION. [20th December, 1945.] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:— [GA]

Definitions.

1.—(1) In this Act—

the expression “the Act of 1856” means the Drainage (Ireland) Act, 1856;

[GA]

the expression “the appointed day” means the day appointed by the Minister to be the appointed day for the purposes of this Act;

[GA]

the expression “the Board of Trustees” means the Lough Corrib Navigation Trustees;

[GA]

the expression “contributing local authority” means a body being—

[GA]

(a) the Galway Corporation, or

[GA]

(b) the Galway County Council, or

[GA]

(c) the Mayo County Council;

[GA]

the expression “election year” in relation to a contributing local authority means a year, other than the year 1945, in which is held an election of all the members of that authority;

[GA]

the expression “the functional area” means—

[GA]

(a) in relation to the Galway Corporation, the borough of Galway,

[GA]

(b) in relation to the Galway County Council, the county of Galway (exclusive of the borough of Galway),

[GA]

(c) in relation to the Mayo County Council, the county of Mayo;

[GA]

the expression “the Galway Corporation” means the Mayor, Aldermen and Burgesses of the borough of Galway;

[GA]

the expression “the Galway County Council” means the council of the county of Galway;

[GA]

the expression “the Mayo County Council” means the council of the county of Mayo;

[GA]

the expression “the Minister” means the Minister for Industry and Commerce;

[GA]

the expression “the Navigation” means the Navigation, in the District of Loughs Corrib, Mask, and Carra in the borough of Galway and counties of Galway and Mayo, by the River and Lake Corrib and Loughs Corrib, Mask and Carra from the sea at Galway to the northern extremity of the said Loughs Mask and Carra, and to Cloon Lough in the River Aill;

the expression “the navigation award of 1859” means the award made on the 30th day of June, 1859, by the Commissioners of Public Works in Ireland in relation to the Navigation.

(2) References in this Act to any enactment shall be construed as references to that enactment as amended or adapted by any subsequent enactment.

The appointed day.

2.—The Minister may by order appoint a day to be the appointed day for the purposes of this Act.

[GA]

Termination of period of office of existing members of the Board of Trustees.

3.—The persons who immediately before the appointed day are members of the Board of Trustees shall on the appointed day cease to hold office.

Re-constitution of the Board of Trustees.

4.—(1) As on and from the appointed day the Board of Trustees shall consist of—

(a) five members (in this Act referred to as Galway city members) elected by the Galway Corporation,

[GA]

(b) two members (in this Act referred to as Galway county members) elected by the Galway County Council, and

[GA]

(c) one member (in this Act referred to as the Mayo member) elected by the Mayo County Council.

[GA]

(2) The Board of Trustees may act notwithstanding one or more vacancies in their membership.

[GA]

Board of Trustees to be a joint body for the purposes of the County Management Act, 1940.

5.—The Board of Trustees shall be a joint body for the purposes of the County Management Act, 1940 (No. 12 of 1940).

Disqualification of members of the Board of Trustees.

6.—(1) Article 12 of the Schedule to the Local Government (Application of Enactments) Order, 1898, as amended by any subsequent enactment, shall apply to the Board of Trustees and the members thereof in like manner as it applies to councils of counties and their members.

(2) A person shall be disqualified from being elected a member of the Board of Trustees by a contributing local authority if he is not a Local Government elector for the functional area of that local authority.

[GA]

(3) Where a member of the Board of Trustees appointed by a contributing local authority ceases to be a Local Government elector for the functional area of that local authority he shall be disqualified from being a member.

[GA]

(4) No person shall hold any paid office or employment under the Board of Trustees while he is or within twelve months after he has ceased to be a member of the Board of Trustees.

[GA]

(5) Whenever a member of the Board of Trustees becomes disqualified from being a member the Board of Trustees shall forthwith declare his office to be vacant and the vacancy shall be deemed to have occurred on the making of such declaration.

Election and term of office of Galway city members.

7.—(1) The first election of Galway city members shall take place on such day, not being less than one month before the appointed day, as the Minister may fix for the purpose, and the Galway Corporation shall at the said election elect five Galway city members.

(2) The Galway Corporation shall in every election year elect five Galway city members at the quarterly meeting of the Galway Borough Council held next after the 22nd day of June in that year, and such election shall be included in the business to be transacted at every such quarterly meeting.

(3) The term of office of every member elected at the first election of Galway city members shall commence on the appointed day.

[GA]

(4) The term of office of every Galway city member (other than a member elected at the first election of Galway city members) shall commence on the day of his election.

[GA]

(5) Every Galway city member shall, unless he sooner dies, resigns or becomes disqualified, hold office until the expiration of the day immediately preceding the day on which the next election of Galway city members is held in accordance with subsection (2) of this section.

(6) Whenever a casual vacancy occurs amongst the Galway city members the Galway Corporation shall, as soon as conveniently may be, elect a person to fill such vacancy.

[GA]

(7) If a person elected to be a Galway city member in pursuance of subsection (1) of this section dies before the appointed day, such person shall for the purposes of this section be deemed to have died on the appointed day.

Election and term of office of Galway county members.

8.—(1) The first election of Galway county members shall take place on such day, not being less than one month before the appointed day, as the Minister may fix for the purpose, and the Galway County Council shall at the said election elect two Galway county members.

(2) The Galway County Council shall in every election year elect two Galway county members at the annual meeting of the Galway County Council held next after the 22nd day of June in that year, and such election shall be included in the business to be transacted at every such annual meeting.

(3) The term of office of each member elected at the first election of Galway county members shall commence on the appointed day.

[GA]

(4) The term of office of every Galway county member (other than a member elected at the first election of Galway county members shall commence on the day of his election.

[GA]

(5) Every Galway county member shall, unless he sooner dies, resigns or becomes disqualified, hold office until the expiration of the day immediately preceding the day on which the next election of Galway county members is held in accordance with subsection (2) of this section.

(6) Whenever a casual vacancy occurs amongst the Galway county members the Galway County Council shall, as soon as conveniently may be, elect a person to fill such vacancy.

[GA]

(7) If a person elected to be a Galway county member in pursuance of subsection (1) of this section dies before the appointed day, such person shall for the purposes of this section be deemed to have died on the appointed day.

Election and term of office of the Mayo member.

9.—(1) The Mayo County Council shall, on such day, not being less than one month before the appointed day, as the Minister may fix for the purpose, elect the Mayo member, and the term of office of the person so elected shall commence on the appointed day.

(2) The Mayo County Council shall in every election year elect the Mayo member at the annual meeting of the Mayo County Council held next after the 22nd day of June in that year, and such election shall be included in the business to be transacted at every such annual meeting.

(3) The term of office of the Mayo member elected at any annual meeting of the Mayo County Council in pursuance of subsection (2) of this section shall commence on the day of his election.

[GA]

(4) The Mayo member shall, unless he sooner dies, resigns or becomes disqualified, hold office until the expiration of the day immediately preceding the day on which the next election of the Mayo member is held in accordance with subsection (2) of this section.

(5) Whenever a vacancy occurs amongst the members of the Board of Trustees by reason of the death, resignation or disqualification of the Mayo member the Mayo County Council shall, as soon as conveniently may be, elect a person to fill such vacancy.

(6) If the person elected to be the Mayo member in pursuance of subsection (1) of this section dies before the appointed day, such person shall for the purposes of this section be deemed to have died on the appointed day.

Resignation of members of the Board of Trustees.

10.—A member of the Board of Trustees may at any time resign his office by letter sent to the Board of Trustees and every such resignation shall take effect at the commencement of the meeting of the Board of Trustees held next after the receipt of such letter.

Notification of vacancies to contributing local authorities.

11.—The Board of Trustees shall as soon as may be after the occurrence of a vacancy by reason of the death, resignation or disqualification of a member of the Board of Trustees notify accordingly the contributing local authority by which the member was elected.

Expenses of the Board of Trustees in excess of income.

12.—(1) As on and from the appointed day—

(a) the navigation award of 1859, in so far as it relates to the manner in which all expenses of and incident to the maintenance and conservancy of the Navigation (so far as those expenses are not defrayed out of the income thereof) shall be charged, borne and paid, shall cease to have effect,

[GA]

(b) all expenses incurred by the Board of Trustees in respect of the maintenance and conservancy of the Navigation (including moneys payable by the Board of Trustees under subsection (3) of section 14 of this Act) so far as those expenses are not defrayed out of the income thereof, shall, subject to subsection (2) of this section, be charged on, borne and paid by the contributing local authorities in the following proportions—

(i) sixty per cent. by the Galway Corporation,

[GA]

(ii) thirty per cent. by the Galway County Council, and

[GA]

(iii) ten per cent. by the Mayo County Council.

[GA]

(2) The Minister may from time to time by order (made after consultation with the Minister for Local Government and Public Health) direct that the expenses provided for under subsection (1) of this section, in lieu of being charged, borne and paid in the proportions set out in the said subsection, shall, as on and from the date specified in that behalf in the order, be charged on, borne and paid by the contributing local authorities (or any two of them to the exclusion of the third) in such proportions as the Minister thinks fit and specifies in the order or be wholly charged on, borne and paid by any one of the said authorities to the exclusion of the others, and the said subsection shall, so long as any such order is in force, have effect subject to the provisions of such order.

(3) The Minister may revoke any order made by him under subsection (2) of this section.

(4) Every order made under subsection (2) of this section shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the order is passed by either such House within the next twenty-one days on which that House has sat after the order is laid before it, the order shall be annulled accordingly but without prejudice to the validity of anything previously done thereunder.

Abandonment or transfer of portion of the Navigation.

13.—(1) Notwithstanding anything contained in section 45 of the Railway and Canal Traffic Act, 1888, the Minister may, on the application of the Board of Trustees or of any interested person, by order authorise the abandonment, or the transfer to a drainage authority or a contributing local authority, of any portion of the Navigation or works forming part thereof.

(2) Any transfer to a drainage authority under this section shall be subject to the prior consent of that drainage authority.

(3) Before making an order authorising any abandonment or transfer under this section, the Minister shall satisfy himself as to the manner in which the abandoned or transferred works will be dealt with or the use to which they shall be put.

Execution and maintenance of certain works by contributing local authorities.

14.—(1) Where it appears to a contributing local authority, after consultation with the Board of Trustees, to be necessary or desirable in the public interest to execute, within the functional area of the said local authority, new works in connection with the Navigation or to extend, improve or maintain existing works of the Navigation, it shall be lawful for the said local authority, with the consent of the Minister for Local Government and Public Health and subject to section 50 of the Arterial Drainage Act, 1945 (No. 3 of 1945), to undertake the execution or maintenance of such works, notwithstanding that such execution or maintenance is not necessary, or is not wholly necessary, for the purpose of the Navigation.

(2) The cost of the execution of any new works or the maintenance of any existing works by a contributing local authority under subsection (1) of this section shall be borne by that local authority.

(3) (a) Where a contributing local authority executes new works or extends or improves existing works under subsection (1) of this section the following provisions shall have effect—

[GA]

(i) if an appreciation of the Navigation is thereby brought about, compensation shall be paid by the Board of Trustees to that local authority,

[GA]

(ii) if a depreciation of the Navigation is thereby brought about, compensation shall be paid by that local authority to the Board of Trustees.

[GA]

(b) Where any existing works are maintained by a contributing local authority under subsection (1) of this section, that local authority may recover from the Board of Trustees such portion of the cost as would have been necessary to maintain the existing work in a condition necessary for the purpose of the Navigation.

[GA]

(4) If any question arises whether compensation is payable by or to a contributing local authority under paragraph (a) of subsection (3) of this section or as to the amount of such compensation or whether any sum is recoverable by a contributing local authority under paragraph (b) of the said subsection or as to the, amount, of such sum, the question shall be referred to the Minister for Local Government and Public Health, whose decision shall be final.

(5) As on and from the appointed day the Board of Trustees shall cease to be liable for the maintenance of the roadway from Woodquay to the public road, mentioned in Schedule B to the Navigation Award of 1859, and the said roadway shall be regarded, for the purposes of the said Act and any such order, as being an urban road.

Expenses of contributing local authorities.

15.—Subject to section 27 (which relates to the expenses of maintaining, constructing and abandoning roads) of the Local Government Act, 1925 (No. 5 of 1925), the expenses incurred by a contributing local authority under this Act shall be raised—

(a) in the case of the Galway Corporation, by means of the poor rate,

[GA]

(b) in the case of the Galway County Council, by means of the poor rate as a county at large charge over the whole of the county of Galway (excluding the borough of Galway),

[GA]

(c) in the case of the Mayo County Council, by means of the poor rate as a county at large charge over the whole of the county of Mayo.

[GA]

Cesser of application of certain provisions of the Act of 1856.

16.—Sections 9, 10 and 25 of the Act of 1856 shall, as on and from the appointed day, cease to apply in respect of the Navigation.

Short title.

17.—This Act may be cited as the Lough Corrib Navigation Act, 1945.
