ACHT DIÚITÉTHE CUSTUM (GEARRADH SEALADACH), 1931.
Comhacht don Ard-Chomhairle diúitéthe custum do ghearradh no d'atharú.
1.—Pé uair a bheidh an Ard-Chomhairle sásta ar fháil tuarasgabhála ón Aire Tionnscail agus Tráchtála, gur gá diúité custum do ghearradh no d'atharú láithreach ar aon tsaghas áirithe earraí chun cosc do chur le hearraí den tsaghas san go mbeidh coinne leo do scaoileadh isteach no le hearraí den tsaghas san go mbeidh coinne leo d'iomportáil, sé sin, scaoileadh isteach no iomportáil a thiocfadh de dheascaibh nithe do thárlachtaint i gcúrsaí airgeadais no eile i dtíortha eile agus a thárlóidh i slí do dhéanfadh díobháil do thionnscal, féadfaidh an Ard-Chomhairle—
(a) mara mbeidh aon diúité custum i bhfeidhm an uair sin maidir le hearraí den tsaghas áirithe sin, le hordú, diúité custum, de pé méid is dóich leo is ceart do luadh san ordú san, agus maille le coinníollacha, srianta, no saoirsí no dá n-éamais, do ghearradh ar gach earra den tsaghas áirithe sin a hiomportálfar isteach i Saorstát Éireann ar lá luadhfar san ordú san no dá éis (lá nách túisce ná lá déanta an orduithe sin) agus (más oiriúnach leis an Ard-Chomhairle a luadh) ar gach earra den tsaghas áirithe sin a cuirfear i dtír i Saorstát Éireann an lá san no dá éis; no
(b) má bhíonn diúité custum i bhfeidhm an uair sin maidir le hearraí den tsaghas áirithe sin, atharú do dhéanamh, le hordú, maidir le hearraí a hiomportálfar isteach i Saorstát Éireann ar lá luadhfar san ordú san no dá éis (lá nách túisce ná lá déanta an orduithe sin) agus (más oiriúnach leis an Ard-Chomhairle a luadh) maidir le hearraí cuirfear i dtír i Saorstát Éireann an lá san no dá éis, ar an diúité custum san ar gach slí no ar aon tslí acu so leanas, sé sin le rá, tré ráta an diúité sin do mhéadú pé méid no tré pé coinníollacha no srianta d'fhorchur no tré dheireadh do chur le pé saoirsí is dóich leis an Ard-Chomhairle i ngach cás fé leith is ceart do luadh san ordú san.
Eifeacht ag orduithe déanfar fén Acht so.
2.—(1) Ordú dhéanfaidh an Ard-Chomhairle fén Acht so beidh éifeacht aige láithreach tar éis a dhéanta agus scuirfidh d'éifeacht do bheith aige má thárlann no nuair a thárlóidh pé ní acu so leanas is túisce thárlóidh, sé sin le rá:—
(a) más rud é ná déanfaidh Dáil Éireann rún, ag ceadú an orduithe sin, go n-atharú no gan atharú, do rith laistigh den deich lá shuidhfidh Dáil Éireann tar éis lá déanta an orduithe sin;
(b) más rud é ná déanfaidh Dáil Éireann Bille ina mbeidh forálacha ag a mbeidh an éifeacht chéanna (go n-atharú no gan atharú) bheidh ag forálacha an orduithe sin do léigheamh an dara huair laistigh den fhiche lá shuidhfidh Dáil Éireann tar éis do Dháil Éireann rún ag ceadú an orduithe sin (go n-atharú no gan atharú) do rith;
(c) má dhiúltuíonn Dáil Éireann do sna forálacha san den Bhille sin le linn an Bhille sin do bheith ag gabháil tríd an Oireachtas;
(d) Acht den Oireachtas ina mbeidh forálacha ag a mbeidh an éifeacht chéanna (go n-atharú no gan atharú) bheidh ag forálacha an orduithe sin do theacht i ngníomh;
(e) tréimhse de cheithre mhí do bheith caithte o lá déanta an orduithe sin.
(2) Más rud é, laistigh den deich lá shuidhfidh Dáil Éireann tar éis don Ard-Chomhairle ordú do dhéanamh fén Acht so, go rithfidh Dáil Éireann rún ag ceadú an orduithe sin go n-atharuithe, déanfaidh an rún san an t-ordú san d'atharú do réir an rúin sin, agus beidh éifeacht ag an ordú san agus é atharuithe amhlaidh o am rithte an rúin sin go dtí go scuirfidh an t-ordú san fén Acht so d'éifeacht do bheith aige.
Feidhm ag achtacháin ghenerálta.
3.—(1) Pé uair a gearrfar diúité custum le hordú dhéanfaidh an Ard-Chomhairle fén Acht so, ansan, na hachtacháin do bhí i bhfeidhm maidir le diúitéthe custum i gcoitinne díreach roimh an ordú san do dhéanamh, beidh feidhm agus éifeacht acu, maidir leis an diúité custum a gearrfar amhlaidh, faid a bheidh éifeacht ag an ordú san, pe'ca go n-atharú no gan atharú dho.
(2) Pé uair a hatharófar diúité custum le hordú dhéanfaidh an Ard-Chomhairle fén Acht so, ansan, na hachtacháin uile do bhí i bhfeidhm maidir leis an diúité custum san díreach roimh an ordú san do dhéanamh, beidh feidhm agus éifeacht acu maidir leis an diúité custum san, agus é atharuithe amhlaidh, faid a bheidh éifeacht ag an ordú san, pe'ca go n-atharú no gan atharú dho.
Aisíoca do dhéanamh nuair a scuirfidh orduithe d'éifeacht do bheith acu no nuair a hatharófar iad.
4.—(1) Pé uair a scuirfidh ordú do rinne an Ard-Chomhairle fén Acht so d'éifeacht do bheith aige (seachas tré theacht i ngníomh d'Acht den Oireachtas ina mbeidh forálacha ag a mbeidh an éifeacht chéanna, go n-atharú no gan atharú, bheidh ag forálacha an orduithe sin) déanfar gach airgead do híocadh do réir an orduithe sin d'aisíoc no cúiteamh do thabhairt ann.
(2) Pé uair a bheidh éifeacht ag ordú do rinne an Ard-Chomhairle fén Acht so agus atharú air do rinneadh air le rún do rith Dáil Éireann, déanfar gach airgead do híocadh (pe'ca roimh an rún san do rith no dá éis sin é) do réir an orduithe sin agus ná beadh iníoctha fén ordú san agus é atharuithe amhlaidh d'aisíoc no cúiteamh do thabhairt ann.
(3) Pé uair a thiocfaidh Acht den Oireachtas i ngníomh agus forálacha ann ag a mbeidh an éifeacht chéanna, go n-atharú, bheidh ag forálacha orduithe do rinne an Ard-Chomhairle fén Acht so agus a scuirfidh an t-ordú san, de bhuadh an Achta san do theacht i ngníomh, d'éifeacht do bheith aige, déanfar gach airgead do híocadh do réir an orduithe sin agus ná beadh iníoctha fén Acht san d'aisíoc no cúiteamh do thabhairt ann.

5.—Féadfaidh an Ard-Chomhairle, más oiriúnach agus pé uair is oiriúnach leo é, aon chúrsa no ceist a bhaineann le buanú no atharú diúité chustum do gearradh no do hatharuíodh le hordú ón Ard-Chomhairle fén Acht so, no le deireadh do chur leis, do chur fé bhráid Choimisiúin na nDleacht fé alt 2 den Acht um Choimisiún na nDleacht, 1926 (Uimh. 40 de 1926), agus déanfaidh Coimisiún na nDleacht gach cúrsa no ceist a cuirfear fé n-a mbráid amhlaidh do bhreithniú agus tuarasgabháil do thabhairt air fé is dá mba chúrsa no ceist é do cuirfí fé n-a mbráid fé alt 2 den Acht um Choimisiún na nDleacht (Leasú), 1930 (Uimh. 31 de 1930).

6.—(1) Féadfar an tAcht Diúitéthe Custum (Gearradh Sealadach), 1931, do ghairm den Acht so.

CUSTOMS DUTIES (PROVISIONAL IMPOSITION) ACT, 1931.
Power of Executive Council to impose or vary customs duties.
1.—Whenever the Executive Council is satisfied, on the report of the Minister for Industry and Commerce, that the immediate imposition or variation of a customs duty on any particular description of goods is necessary to prevent an expected dumping of goods of that description or an expected importation of goods of that description, in either case arising out of financial or other events in other countries and occurring in circumstances which would occasion industrial injury, the Executive Council may—
(a) if no customs duty is then in force in respect of goods of the said particular description, by order impose, whether with or without qualifications, restrictions, or exemptions, a customs duty of such amount as they think proper to specify in such order on all goods of the said particular description imported into Saorstát Eireann on or after a day (not being prior to the day on which such order is made) specified in such order and (if the Executive Council thinks fit so to specify) on all goods of the said particular description landed in Saorstát Eireann on or after the said day; or
(b) if a customs duty is then in force in respect of goods of the said particular description, by order vary, in respect of goods imported into Saorstát Eireann on or after a day (not being prior to the day on which such order is made) specified in such order and (if the Executive Council thinks fit so to specify) in respect of goods landed in Saorstát Eireann on or after the said day, the said customs duty in all or any of the following ways, that is to say, by increasing the rate of the said duty by such amount, or by imposing such conditions or restrictions or by terminating such exemptions as the Executive Council shall in each case think proper to specify in such order.
Effect of orders under this Act.
2.—(1) An order made by the Executive Council under this Act shall have effect immediately upon the making thereof and shall cease to have effect in or upon the happening of whichever of the following events first occurs that is to say:—
(a) if a resolution approving of such order, with or without modification, is not passed by Dáil Eireann within the next ten days on which Dáil Eireann sits after the day on which such order is made;
(b) if a Bill containing provisions to the same effect (with or without modification) as such order is not read a second time by Dáil Eireann within the next twenty days on which Dáil Eireann sits after the passing by Dáil Eireann of a resolution approving (with or without modification) of such order;
(c) if the said provisions of the said Bill are rejected by Dáil Eireann during the passage of such Bill through the Oireachtas;
(d) the coming into operation of an Act of the Oireachtas containing provisions to the same effect (with or without modification) as such order;
(e) the expiration of a period of four months from the day on which such order is made.
(2) If, within the next ten days on which Dáil Eireann sits after an order is made by the Executive Council under this Act, Dáil Eireann passes a resolution approving of such order with modifications, such resolution shall operate to modify such order in accordance with such resolution, and as from the passing of such resolution such order shall, until it ceases under this Act to have effect, have effect subject to such modifications.
Application of general enactment.
3.—(1) Whenever a customs duty is imposed by an order made by the Executive Council under this Act, the enactments which were, immediately before the making of such order, in force in relation to customs duties generally shall apply to and have effect in respect of the customs duty so imposed so long as such order continues to have effect, whether with or without modification.
(2) Whenever a customs duty is varied by an order made by the Executive Council under this Act, all enactments which were in force in respect of such customs duty immediately before the making of such order shall apply to and have effect in respect of such customs duty as so varied so long as such order continues to have effect, whether with or without modification.
Repayments on cesser or modification of orders.
4.—(1) Whenever an order made by the Executive Council under this Act ceases to have effect (otherwise than by the coming into operation of an Act of the Oireachtas containing provisions to the same effect, with or without modification, as such order), all moneys paid in pursuance of such order shall be repaid or made good.
(2) Whenever an order made by the Executive Council under this Act has effect with modifications made therein by a resolution passed by Dail Eireann, all moneys paid (whether before or after the passing of such resolution) in pursuance of such order which would not be payable under such order as so modified shall be repaid or made good.
(3) Whenever an Act of the Oireachtas comes into operation containing provisions to the same effect with modifications as an order made by the Executive Council under this Act and such order ceases, by virtue of such coming into operation, to have effect, all moneys paid in pursuance of such order which would not be payable under such Act shall be repaid or made good.
Power of reference to Tariff Commission.
5.—The Executive Council may, if and whenever they think fit so to do, refer to the Tariff Commission under section 2 of the Tariff Commission Act, 1926 (No. 40 of 1926), any matter or question relating to the continuance, variation, or termination of a customs duty imposed or varied by an order of the Executive Council under this Act, and the Tariff Commission shall consider and report on every matter or question so referred to them as if it were a matter or question referred to them under section 2 of the Tariff Commission (Amendment) Act, 1930 (No. 31 of 1930).
Short title and duration.
6.—(1) This Act may be cited as the Customs Duties (Provisional Imposition) Act, 1931.
(2) This Act shall continue in force for nine months from the passing thereof and shall then expire.
