ACHT UM FHIAILE DHÍOBHÁLACH, 1936.
Mínithe.
1.—(1) San Acht so—
cialluíonn an abairt “an tAire” an tAire Talmhaíochta;
cialluíonn an focal “cigire” duine ar bith go n-údarás i scríbhinn ón Aire chun na gcomhacht a bronntar ar chigire leis an Acht so d'fheidhmiú.
(2) Chun crícheanna an Achta so beidh gach duine acu so leanas ina dhuine fhreagarthach maidir le talamh, sé sin le rá:—
(a) duine ar bith is únaer ar an talamh san,
(b) duine ar bith is sealbhaire ar an talamh san,
(c) duine ar bith go mbeidh teideal aige de thurus na huaire chun úsáide an tailimh sin,
(d) duine ar bith a bheidh freagarthach, mar mhaor no mar bháille, i gcúram no i mbainistí an tailimh sin,
(e) más bóthar puiblí an talamh san, an t-údarás áitiúil go mbeidh cothabháil an bhóthair sin mar chúram ortha,
agus is dá réir sin a léireofar an abairt “duine freagarthach” nuair a húsáidtear í maidir le haon talamh áirithe.
Fiaile dhíobhálach.
2.—(1) Pé uair is deimhin leis an Aire plandaí d'aon chineál no gné áirithe bheidh ag fás, no go measfaidh an tAire gur deallrathach go mbuanóid iad féin, in aon líomatáiste áirithe do bheith ina bhfiaile dhíobhálach sa líomatáiste sin féadfaidh an tAire ordú do dhéanamh á dhearbhú gur fiaile dhíobhálach sa líomatáiste sin, mar a luaidhtear é san ordú san, na plandaí sin.
(2) An líomatáiste luadhfar in aon ordú déanfar fén alt so féadfaidh iomlán Shaorstáit Éireann no aon chuid de bheith ann agus féadfa sé bheith ina aon líomatáiste leanúnach amháin no ina dhá líomatáiste no níos mó ar leithligh ná beidh buailte le n-a chéile.
(3) Pé uair a dhéanfaidh an tAire ordú fén alt so féadfaidh, le hordú ina dhiaidh sin, an t-ordú san do cheiliúradh no do leasú.
(4) Pé uair a bheidh ordú déanfar fén alt so i bhfeidhm de thurus na huaire, ansan, aon phlandaí dearbhófar leis an ordú san do bheith ina bhfiaile dhíobhálach sa líomatáiste le n-a mbainfidh an t-ordú san beid, chun crícheanna an Achta so, ina bhfiaile dhíobhálach sa líomatáiste sin.
(5) Gach ordú dhéanfaidh an tAire fén alt so leagfar é fé bhráid Dháil Éireann chó luath agus is féidir é tar éis a dhéanta agus má dheineann Dáil Éireann, laistigh den lá is fiche shuidhfidh Dáil Éireann tar éis an orduithe sin do leagadh fé bhráid dháil Éireann amhlaidh, rún do rith ag cur an orduithe sin ar nea-mbrí beidh an t-ordú san curtha ar nea-mbrí dá réir sin ach beidh san gan dochar do dhleathacht éinní do rinneadh roimhe sin fén ordú san.
Daoine freagarthacha do bheith freagarthach maidir le fiaile dhíobhálach.
3.—Má bhíonn aon fhiaile dhíobhálach ag fás ar aon talamh beidh an té is duine freagarthach maidir leis an talamh san no, má bhíonn beirt no níos mó den tsórt san ann, beidh gach duine acu ar leithligh ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air.
Comhacht chun dul isteach ar thalamh agus iniúchadh do dhéanamh.
4.—Féadfaidh aon bhall den Ghárda Síochána agus aon chigire dul isteach gach tráth réasúnta ar thalamh ar bith in aon líomatáiste, le n-a mbainfidh ordú ar bith a déanfar fén Acht so agus a bheidh i bhfeidhm de thurus na huaire, chun a fháil amach an bhfuil fiaile dhíobhálach ag fás ar an talamh san.
Fógra chun fiaile dhíobhálach do dhíthiú.
5.—(1) Féadfaidh aon bhall den Ghárda Síochána agus aon chigire gheobhaidh fiaile dhíobhálach ag fás ar thalamh ar bith fógra do sheirbheáil ar dhuine ar bith, is duine freagarthach maidir leis an talamh san, á cheangal ar an duine sin an fhiaile dhíobhálach san (a luadhfar sa bhfógra san) do dhíthiú sa tslí, agus fé cheann na haimsire, a luadhfar sa bhfógra san.
(2) Más rud é, i gceann na haimsire luadhfar i bhfógra seirbheálfar fén alt so maidir le talamh ar bith, go mbeidh aon fhiaile dhíobhálach a bheidh luaidhte sa bhfógra san gan díthiú do réir an fhógra san, beidh feidhm ag na forálacha so leanas, sé sin le rá:—
(a) gach duine ar ar seirbheáladh an fógra san fén alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air i dteanta aon phionóis eile dlighfear a chur air fén Acht so mar gheall ar an bhfiaile dhíobhálach san agus i dteanta aon íocaíochta eile dlighfear a bhaint de fén alt so,
(b) féadfaidh duine ar bith go n-údarás ón Aire dul isteach ar an talamh san i dteanta no d'éamais fear oibre, capall, no meaisíní agus féadfaidh an fhiaile dhíobhálach le n-a mbainfidh an fógra san do dhíthiú,
(c) féadfaidh an tAire méid na gcostas agus na gcaiteachas fé n-a raghfar ag díthiú na fiaile díobhálaighe sin do bhaint de dhuine ar bith, ar ar seirbheáladh fógra fén alt so maidir leis an talamh san, mar fhiacha gnáth-chonnartha in aon chúirt dlighinse inniúla.
(3) Na costaisí agus na caiteachaisí uile bhainfidh an tAire amach fén bhfo-alt deiridh sin roimhe seo déanfar iad d'íoc isteach sa Stát-Chiste no do chur chun tairbhe don Stát-Chiste ar pé slí ordóidh an tAire Airgid.
Fógraí.
6.—(1) Fógra ar bith a húdaruítear d'aon bhall den Ghárda Síochána no d'aon chigire a sheirbheáil fén Acht so, is leor mar dhílse-dheimhniú air é bheith sighnithe ag an mball den Ghárda Síochána no ag an gcigire sheirbheálfaidh é.
(2) Fógra ar bith a féadfar a sheirbheáil fén Acht so ar dhuine ar bith maidir le fiaile dhíobhálach a bheidh ag fás ar thalamh ar bith, féadfar é sheirbheáil ar aon tslí acu so leanas, sé sin le rá:—
(a) tré n-a sheachadadh don duine sin,
(b) tré n-a fhágaint ag an seoladh ina gcomhnuíonn an duine sin de ghnáth,
(c) tré n-a chur tríd an bpost agus é dírithe chun an duine sin ag an seoladh ina gcomhnuíonn sé de ghnáth,
(d) nuair nach féidir a fháil amach, tré fhiosrú réasúnta, cá gcomhnuíonn an duine sin de ghnáth, tré n-a sheachadadh do dhuine éigin os cionn sé mblian déag d'aois a bheidh ina chomhnaí no ar fostú ar an talamh san no tré n-a ghreamú in áit fheiceálach ar an talamh san.

7.—Duine ar bith, ar aon talamh no ina thimpeal, a dhiúltóidh d'fhaisnéis a bheidh aige, maidir le húnaeracht no sealbhaireacht no úsáid an tailimh sin, do thabhairt d'aon bhall den Ghárda Síochána no d'aon chigire, no do bhéarfaidh d'aon bhall no cigire den tsórt san faisnéis is eol dó bheith bréagach maidir le húnaeracht no sealbhaireacht no úsáid an tailimh sin, no dhéanfaidh aon bhall no cigire den tsórt san no aon duine bheidh ag gníomhú fé ordú an Aire fén Acht so do chosc agus é ag feidhmiú aon chomhachta dá mbronntar no ag cólíonadh aon dualgaisí cuirtear ar aon bhall, cigire no duine den tsórt san leis an Acht so, beidh sé ciontach i gcionta fén Acht so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air.
Cúisimh.
8.—(1) Ní bunófar imeachta i dtaobh cionta fé aon alt den Acht so ach amháin ag an Aire no le toiliú an Aire.
(2) Féadfaidh an tAire no féadfar ar agra an Aire cúiseamh do dhéanamh i gcionta fé aon alt den Acht so.
(3) Maran féidir ainm únaera no sealbhaire aon tailimh (pe'ca aca é) d'fháil amach tré fhiosrú réasúnta féadfar fógra ar bith seirbheálfar fén Acht so do dhíriú chun “an t-únaer” no “an sealbhaire” (fé mar is gá sa chás) gan é d'ainmniú.
(4) Chun crícheanna an ailt seo tuigfear i dtaobh cuideachtan a bheidh cláruithe fé sna hAchtanna Cuideachtan, 1908 go 1924, gur ina n-oifig chláruithe chomhnuíd de ghnáth agus tuigfear gur ina bpríomh-oifig no ina bpríomh-áit ghnótha bhíonn gnáth-chomhnuí ar gach cólucht corpruithe eile agus ar gach cólucht neamhionchorpruithe.
Costaisí.
9.—Sa mhéid go gceadóidh an tAire Airgid é, is amach as airgead a sholáthróidh an tOireachtas a híocfar gach costas fé n-a raghfar chun an Achta so do chur i bhfeidhm.

NOXIOUS WEEDS ACT, 1936.
Definitions.
1.—(1) In this Act—
the expression “the Minister” means the Minister for Agriculture;
the word “inspector” means any person authorised in writing by the Minister to exercise the powers conferred on an inspector by this Act.
(2) Each of the following persons shall, for the purposes of this Act, be a responsible person in relation to land, that is to say:—
(a) any person who is the owner of such land,
(b) any person who is the occupier of such land,
(c) any person who is for the time being entitled to the use of such land,
(d) any person who as steward or bailiff is responsible for the care or management of such land,
(e) in case such land is a public road, the local authority charged with the maintenance of such road,
and the expression “responsible person” when used in relation to any land shall be construed accordingly.
Noxious weeds.
2.—(1) Whenever the Minister is satisfied that plants of any particular species or variety growing, or in the opinion of the Minister likely to become established, in any area are in that area noxious weeds, the Minister may make an order declaring such plants to be noxious weeds in that area as specified in such order.
(2) The area specified in any order made under this section may comprise the whole or any part of Saorstát Eireann and may be one continuous area or two or more separate non-contiguous areas.
(3) Whenever the Minister makes an order under this section he may by a subsequent order revoke or amend such order.
(4) Whenever an order made under this section is for the time being in force any plants which are by such order declared to be noxious weeds in the area to which such order relates shall for the purposes of this Act be noxious weeds in that area.
(5) Every order made by the Minister under this section shall be laid before Dáil Eireann as soon as may be after it is made, and if a resolution annulling such order is passed by Dáil Eireann within the next subsequent twenty-one days on which Dáil Eireann has sat after such order is so laid before Dáil Eireann, such order shall be annulled accordingly but without prejudice to the validity of anything previously done under such order.
Liability of responsible persons in respect of noxious weeds.
3.—Where any noxious weeds are growing on any land the responsible person in respect of such land or if there are two or more such persons, each of them severally, shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
Power of entry and inspection.
4.—Any member of the Gárda Síochána and any inspector may at all reasonable times enter upon any land situated in any area to which any order made under this Act and for the time being in force relates for the purpose of ascertaining whether any noxious weeds are growing on such land.
Notice to destroy noxious weeds.
5.—(1) Any member of the Gárda Síochána and any inspector who finds any noxious weeds growing on any land may serve on any person who is in respect of such land a responsible person a notice requiring such person to destroy such noxious weeds (which shall be specified in such notice) in such manner and within such time as may be specified in such notice.
(2) If, after the expiration of the time specified in a notice served under this section in respect of any land, any noxious weeds specified therein have not been destroyed in accordance with such notice, the following provisions shall apply, that is to say:—
(a) every person on whom such notice was served under this section shall be guilty of an offence under this section and on summary conviction thereof shall, in addition to any other penalty to which he may be liable under this Act in respect of such noxious weeds, and in addition to any other payment to which he may be liable under this section, be liable to a fine not exceeding twenty pounds,
(b) any person authorised by the Minister may enter upon such land with or without workmen, horses, or machines and may destroy the noxious weeds to which such notice relates,
(c) the Minister may recover from any person on whom a notice has been served under this section in respect of such land as a simple contract debt in any court of competent jurisdiction the amount of the costs and expenses incurred in the destruction of such noxious weeds.
(3) All costs and expenses recovered by the Minister under the immediately preceding sub-section shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance may direct.
Notices.
6.—(1) Any notice which any member of the Gárda Síochána or any inspector is authorised to serve under this Act shall be sufficiently authenticated if signed by the member of the Gárda Síochána or the inspector by whom such notice is served.
(2) Any notice which may be served under this Act on any person in relation to noxious weeds growing on any land, may be served in any of the following ways, that is to say:—
(a) by delivering it to such person,
(b) by leaving it at the address at which such person ordinarily resides,
(c) by sending it by post addressed to such person at the address at which he ordinarily resides,
(d) when the address at which such person ordinarily resides cannot be ascertained by reasonable inquiry, by delivering it to some person over sixteen years of age resident or employed on such land, or by affixing it in a conspicuous position on such land.
Obstruction.
7.—Any person on or about any land who refuses to furnish to any member of the Gárda Síochána or to any inspector information in his possession as to the ownership, occupation, or use of such land, or who knowingly gives to any such member or inspector false information as to the ownership, occupation, or use of such land, or who obstructs any such member or inspector or any person acting on the direction of the Minister under this Act in the exercise of any of the powers vested in or in the performance of any duties imposed on any such member, inspector, or person by this Act, shall be guilty of an offence under this Act and shall on summary conviction thereof be liable to a fine not exceeding twenty pounds.
Prosecutions.
8.—(1) Proceedings for an offence under any section of this Act shall not be instituted except by or with the consent of the Minister.
(2) A prosecution for an offence under any section of this Act may be brought by or at the suit of the Minister.
(3) Where the name of the owner or occupier (as the case may be) of any land cannot be ascertained by reasonable inquiry any notice served under this Act may be addressed to “the owner” or “the occupier” (as the case may require) without naming him.
(4) For the purposes of this section a company registered under the Companies Acts, 1908 to 1924, shall be deemed to be ordinarily resident at its registered office, and every other body corporate and every unincorporated body shall be deemed to be ordinarily resident at its principal office or place of business.
Expenses.
9.—All expenses incurred in carrying this Act into execution shall to such extent as may be sanctioned by the Minister for Finance be paid out of moneys provided by the Oireachtas.
Repeal.
10.—The Weeds and Agricultural Seeds (Ireland) Act, 1909, is hereby repealed.
Short title and commencement.
11.—(1) This Act may be cited as the Noxious Weeds Act, 1936.
(2) This Act shall come into operation on the 1st day of January, 1937.
