ACHT CÚIRTEANNA BREITHIÚNAIS (UIMH. 2), 1931.
An la ceaptha.
1.—San Acht so cialluíonn an abairt “an lá ceaptha” an lá thiocfaidh Rialacha Cúirte Cuarda i ngníomh do rinneadh fé Chuid II den Acht Cúirteanna Breithiúnais, 1924 (Uimh. 10 de 1924), agus le n-a socruítear scála de chostaisí don Chúirt Chuarda.

2.—Pé uair agus pé áit go mbeidh no go raibh dlighinse ag Breitheamh den Chúirt Chuarda, roimh an Acht so do rith no dá éis sin agus roimh an lá ceaptha, chun costaisí agus caiteachaisí ar bith no ceachtar acu do dheonadh (pe'ca le n'íoc ag duine no daoine é no le n'íoc as estát no ciste) beidh agus tuigfear go raibh riamh aige dlighinse chun méid na gcostas agus na gcaiteachas san no ceachtar acu (pe'ca aca é) do shocrú no a ordú cé'n tslí ina ndéanfaí agus cadiad na prínsiobail gur dá réir a déanfaí an méid sin d'fháil amach, pe'ca cúrsa acu san is rogha leis.

3.—(1) Pé uair agus pé áit gur gá no gur ghá do réir dlí no do réir orduithe ón Ard-Chúirt, roimh an Acht so do rith no dá éis sin agus roimh an lá ceaptha, costaisí aon pháirtí in aon imeachta sa Chúirt sin do mheas no d'fháil amach fé is dá mba chostaisí fé n-a raghfaí sa Chúirt Chuarda iad, beidh agus tuigfear go raibh riamh, ag an Máistir Measaireachta ar a mbeidh sé de dhualgas na costaisí sin do mheas, dlighinse chun na gcostas san do mheas do réir an phrínsiobail gur cheart méid na gcostas san do bheith có-ionann le dhá dtrian na suime do bheadh sna costaisí sin dá meastaí iad fé is dá mba chostaisí fé n-a raghfaí san Ard-Chúirt iad no do réir pé prínsiobail eile is dóich leis an Máistir Measaireachta san is ceart dar leis in aon chás áirithe, pe'ca cúrsa acu san is rogha leis.
(2) Ní bhainfidh éinní san alt so le costaisí ar bith gur orduigh an Chúirt Uachtarach ina dtaobh, roimh an Acht so do rith, iad do mheas do réir aon phrínsiobail áirithe do cheap an Chúirt sin i gcóir na gcostas áirithe sin.

4.—Pé uair agus pé áit go ndearna no go ndéanfaidh an Ard-Chúirt, roimh an Acht so do rith no dá éis sin agus roimh an lá ceaptha, costaisí do dheonadh in athchomharc i gcoinnibh breithe Cúirte Cuarda (pe'ca ag duine no daoine atáid iníoctha no as estát no ciste), beidh agus tuigfear go raibh riamh, ag an Máistir Measaireachta ar a mbeidh sé de dhualgas na costaisí sin do mheas, dlighinse chun pé méid de sna costaisí sin a bhaineann le himeachta sa Chúirt Chuarda do mheas do réir an phrínsiobail gur cheart méid na gcostas san do bheith có-ionann le dhá dtrian na suime do bheadh sna costaisí sin dá meastaí iad fé is dá mba chostaisí fé n-a raghfaí san Ard-Chúirt iad no do réir pé prínsiobail eile is dóich leis an Máistir Measaireachta san is ceart dar leis in aon chás áirithe, pe'ca cúrsa acu san is rogha leis.

5.—(1) Féadfar an tAcht Cúirteanna Breithiúnais (Uimh. 2), 1931, do ghairm den Acht so.
(2) Chun go bhféadfar iad do luadh i dteanta a chéile folóidh an abairt “na hAchtanna Cúirteanna Breithiúnais, 1924 go 1931” an tAcht so.

The appointed day.
1.—In this Act the expression “the appointed day” means the day on which Rules of the Circuit Court made under Part II of the Courts of Justice Act, 1924 (No. 10 of 1924), and providing a scale of costs for the Circuit Court come into operation.
Costs in Circuit Court cases.
2.—Whenever and wherever, either before the passing of this Act or after such passing and before the appointed day, a Judge of the Circuit Court has or had jurisdiction to award any costs and expenses or either of them (whether to be paid by a person or persons or out of an estate or fund) he shall have and be deemed always to have had jurisdiction at his discretion either to fix the amount of such costs and expenses or either of them (as the case may be), or to direct the manner in which and the principles on which such amount is to be ascertained.
Costs in High Court cases within the jurisdiction of the Circuit Court.
3.—(1) Whenever and wherever either before the passing of this Act or after such passing and before the appointed day, the costs of any party to any proceedings in the High Court are required by law or by an order of that Court to be taxed or ascertained as if they were costs incurred in the Circuit Court, the Taxing Master charged with the duty of taxing such costs shall have and be deemed always to have had jurisdiction to tax such costs either, at his discretion, on the principle that the amount of such costs should be two-thirds of the sum to which such costs would amount if taxed as if they were costs incurred in the High Court, or on such other principle as such Taxing Master thinks proper to adopt in any particular case.
(2) Nothing in this section shall apply to any costs which before the passing of this Act were directed by the Supreme Court to be taxed on any particular principle appointed by that Court in respect of those particular costs.
Costs in appeals from the Circuit Court.
4.—Whenever and wherever, before the passing of this Act or after such passing and before the appointed day, costs are awarded (whether payable by a person or persons or out of an estate or fund) by the High Court in an appeal from the Circuit Court, the Taxing Master charged with the duty of taxing such costs shall have and be deemed always to have had jurisdiction to tax so much of such costs as relate to proceedings in the Circuit Court either, at his discretion, on the principle that the amount of such costs should be two-thirds of the sum to which such costs would amount if taxed as if they were costs incurred in the High Court, or on such other principle as such Taxing Master thinks proper to adopt in any particular case.
Short title and citation.
5.—(1) This Act may be cited as the Courts of Justice (No. 2) Act, 1931.
(2) For the purposes of collective citation the expression “the Courts of Justice Acts, 1924 to 1931” shall include this Act.
