Cé leis go mbaineann an tAcht so.

1.—Baineann an tAcht so le gach comhairle, bord coimisinéirí, bord caomhnóirí, no cólucht áitiúil eile gur cuireadh toghachán reachtúil a mball ar ath-ló leis an Acht chun Toghacháin Áitiúla do chur ar Ath-ló, 1922 (Uimh. 4 de 1922), no fén Acht san, mar a leasuíodh le reachtúchán ina dhiaidh sin é.

2.—Cuirtar ar ath-ló leis seo go dtí an bhliain 1928 gach toghachán reachtúil do bhaill de chólucht áitiúil le n-a mbaineann an tAcht so agus a comórfí sa bhliain 1926 mara mbeadh an tAcht so.

Aireamh tréimhsí oifige no ama.

3.—Athghairmtear leis seo alt 7 den Acht chun Toghacháin Áitiúla do chur ar Ath-ló, 1922 (Uimh. 4 de 1922) agus ina ionad san, maidir le gach tréimhse oifige no tréimhse eile ama (lasmuich de thréimhsí a bhaineann leis an gcéad chruinniú tar éis toghacháin reachtúla) is gá, do réir dlí, a áireamh o dháta no tré dhul siar go dtí dáta toghacháin reachtúla a cuireadh ar ath-ló leis an Acht chun Toghacháin Áitiúla do chur ar Ath-ló, 1922, no fén Acht san, mar a leasuíodh le reachtúchán ina dhiaidh sin é, achtuítear leis seo, i gcás gach cóluchta áitiúla le n-a mbaineann an tAcht so, gur ón dáta ar ar comóradh an toghachán san a háireofar an tréimhse sin agus nách ón dáta ar a gcomórfí an toghachán san dá mba ná rithfí an tAcht san.

Toghacháin mhéaraí buirgí.

4.—(1) I rith na tréimhse o am rithte an Achta so go dtí go gcomórfar na toghacháin reachtúla a cuirtar ar ath-ló leis an Acht so, ní bhainfidh fo-ailt (10) agus (11) d'alt 94 den Local Government (Ireland) Act, 1898, le comhairle bhuirge le n-a mbaineann an tAcht so, agus in ionad na bhfo-alt san bainfidh na forálacha so a leanas den alt so le gach comhairle den tsórt san ar feadh na tréimhse sin.

(2) Comórfar cruinniú cinn ráithe de gach comhairle den tsórt san um nóin gach 30adh lá de Mheitheamh i rith na tréimhse sin agus fós pé uair ar pé trí laetheanta eile roimh an 15adh lá den chéad Mheitheamh ina dhiaidh sin a shocróidh an chomhairle ag an gcruinniú cinn ráithe an 30adh lá de Mheitheamh.

(3) Sé céad ghnó a déanfar ag gach cruinniú cinn ráithe den tsórt san an 30adh lá de Mheitheamh ná an méara do thogha, agus an méara a bheidh le dul as oifig imeoidh sé as oifig agus tiocfidh an méara nua-thofa in oifig an 30adh lá san de Mheitheamh no chó luath ina dhiaidh sin agus dhéanfidh an méara nua-thofa faisnéis ag glaca na hoifige.

LOCAL ELECTIONS POSTPONEMENT ACT, 1925.


AN ACT TO POSTPONE UNTIL THE YEAR 1928 THE NEXT STATUTORY ELECTIONS TO LOCAL BODIES IN RESPECT OF WHICH THE LAST STATUTORY ELECTIONS WERE POSTPONED BY OR UNDER THE LOCAL ELECTIONS POSTPONEMENT ACT, 1922, AS AMENDED BY SUBSEQUENT LEGISLATION, AND TO MAKE CERTAIN PROVISIONS CONSEQUENTIAL ON SUCH POSTPONEMENT. [29th December, 1925.] BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:— [GA]

Application of Act.

1.—This Act applies to every council, board of commissioners, board of guardians, or other local body the statutory election of the members of which was postponed by or under the Local Elections Postponement Act, 1922 (No. 4 of 1922), as amended by subsequent legislation.

Postponement of elections due in 1926.

2.—Every statutory election of members of a local body to which this Act applies which but for this Act would have been held in the year 1926 is hereby postponed until the year 1928.

Computation of periods of office or time.

3.Section 7 of the Local Elections Postponement Act, 1922 (No. 4 of 1922), is hereby repealed and in lieu thereof it is hereby enacted that in the case of every local body to which this Act applies every period of office or other period of time required by law to be computed from or by reference to the date of a statutory election postponed by or under the Local Elections Postponement Act, 1922, as amended by subsequent legislation (other than periods relating to the first meeting after a statutory election) shall be computed from the date on which such election was actually held and not from the date on which such election would have been held if the said Act had not been passed.

Elections of mayors of boroughs.

4.—(1) During the period from the passing of this Act until the holding of the statutory elections postponed by this Act, sub-sections (10) and (11) of section 94 of the Local Government (Ireland) Act, 1898, shall not apply to the council of a borough to which this Act applies, and in lieu of those sub-sections the following provisions of this section shall apply to every such council during the said period.

(2) A quarterly meeting of every such council shall be held at noon on every 30th day of June during the said period and also at such hour on such other three days before the 15th day of June next following as the council at the quarterly meeting on the 30th day of June decide.

(3) The first business transacted at every such quarterly meeting on the 30th day of June shall be the election of the mayor, and the outgoing mayor shall retire and the newly elected mayor shall come into office on the said 30th day of June or as soon thereafter as the newly elected mayor has made a declaration accepting the office.
