Mínithe.

1.—(1) San Acht so—

cialluíonn an abairt “an tAire” an tAire Tailte agus Iascaigh;

[EN]

foluíonn an focal “iasc” iasc sliogáin ach ní fholuíonn sé bradáin ná eascoin fíor-uisce;

[EN]

cialluíonn an abairt “iascaireacht mhara” iascaireacht do dhéanamh no iasc do thógaint in uiscí taoide;

[EN]

cialluíonn an abairt “bád iascaireachta mara” aon long, bád no árthach eile de shaghas ar bith a húsáidtear i gcóir iascaireachta mara;

[EN]

nuair a húsáidtear an abairt “an máistir” maidir le bád iascaireachta mara cialluíonn sí an máistir, an scibire no an duine eile bheidh i bhfeighil an bháid sin de thurus na huaire;

foluíonn an abairt “gléas iascaireachta” aon líon, dol, dorugha no fearas eile de shaghas ar bith a húsáidtear no is féidir d'úsáid chun breith ar iasc, agus aon rópa, téad tarraicthe, cuaille no rud eile de shaghas ar bith ar n-a cheangal den líon, den dol, den dorugha no den fhearas eile sin no is féidir d'úsáid leis an gcéanna.

(2) Is bád iascaireachta mara de chuid Shaorstáit Éireann chun crícheanna an Achta so gach bád acu so leanas, sé sin le rá :—

(a) bád iascaireachta mara ar n-a chlárú i Saorstát Éireann fé sna hAchtanna Loingis Cheannaíochta, 1894 go 1933,

[EN]

(b) aon bhád iascaireachta mara go bhfuil a únaer no, i gcás níos mó ná únaer amháin do bheith ann, a únaer bainistí ina chomhnaí i Saorstát Éireann no gur i Saorstát Éireann atá a phríomh-áit ghnótha aige.

Achar aon-chirt iascaigh Shaorstáit Éireann.

2.—San Acht so cialluíonn an abairt “achar aon-chirt iascaigh Shaorstáit Éireann” an chuid sin den fhairrge gur laistigh di atá an t-aon-cheart iascaireachta ag saoránaigh de Shaorstát Éireann do réir dlí eadarnáisiúnta, agus i gcás teoranta na coda san do bheith leagtha amach i dtéarmaí aon chonvensiúin, connartha no socruithe ar n-a dhéanamh idir Saorstát Éireann agus aon Stát eile agus a bheidh i bhfeidhm de thurus na huaire foluíonn an abairt sin, maidir le báid iascaireachta mara agus géilliúnaigh an Stáit sin, an chuid sin go leagtar amach a teoranta amhlaidh.

3.—(1) Ní beidh sé dleathach d'aon bhád iascaireachta mara, nách bád iascaireachta mara de chuid Shaorstáit Éireann, teacht isteach in achar aon-chirt iascaigh Shaorstáit Éireann ach amháin—

(a) chun críche ar n-a ceadú ag dlí eadarnáisiúnta; no

[EN]

(b) chun críche ar n-a ceadú ag aon chonvensiún, connradh, no socrú bheidh i bhfeidhm de thurus na huaire idir Saorstát Éireann agus an tír gur léi an bád san; no

[EN]

(c) chun aon chríche eile is críoch dhleathach.

[EN]

(2) Má thagann aon bhád iascaireachta mara, nách bád iascaireachta mara de chuid Shaorstáit Éireann, isteach in achar aon-chirt iascaigh Shaorstáit Éireann chun aon chríche dá luaidhtear sa bhfo-alt san roimhe seo beidh éifeacht ag na forálacha so leanas, sé sin le rá :—

(a) fágfaidh an bád san an t-achar san an túisce bheidh an chríoch san cólíonta;

[EN]

(b) éinne bheidh ar bord an bháid sin ní dhéanfaidh iascaireacht ná ní thabharfaidh fé iascaireacht do dhéanamh le linn don bhád san bheith san achar san;

[EN]

(c) cólíonfar go cuibhe aon rialacháin a bheidh déanta fén alt so agus a bheidh i bhfeidhm de thurus na huaire.

(3) Féadfaidh an tAire, le hordú, rialacháin do dhéanamh maidir le dea-riar do bheith idir báid iascaireachta mara, nách báid iascaireachta mara de chuid Shaorstáit Éireann, a bheidh de thurus na huaire in achar aon-chirt iascaigh Shaorstáit Éireann, agus idir na daoine bheidh ar bord na mbád san.

(4) Más rud é—

[EN]

(a) go dtiocfaidh aon bhád iascaireachta mara, nách bád iascaireachta mara de chuid Shaorstáit Éireann, isteach in achar aon-chirt iascaigh Shaorstáit Éireann contrárdha d'fho-alt (1) den alt so, no

(b) tar éis d'aon bhád iascaireachta mara den tsórt san teacht isteach go dleathach in achar aon-chirt iascaigh Shaorstáit Éireann, go dtárlóidh sárú maidir leis an mbád san (pe'ca tré ghníomh no tré fhaillí é) ar aon cheann d'fhorálacha fo-ailt (2) den alt so,

beidh máistir an bháid sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga púnt do chur air má sé an chéad chionta fén alt so aige é agus fíneáil ná raghaidh thar céad púnt má sé an dara cionta no aon chionta ina dhiaidh sin fén alt so aige é, agus i gceachtar cás féadfaidh an Chúirt freisin aon iasc a gheobhfar sa bhád san maraon le haon ghléas iascaireachta bheidh inti do gheallbhruideadh.

Cosc ar mhodhanna áirithe trálaerachta.

4.—(1) Féadfaidh an tAire o am go ham, le fo-dhlithe, cosc do chur (amuich is amach no mara ndeintear do réir pé coinníollacha is oiriúnach leis an Aire do chur sna fo-dhlithe sin, pe'ca saghas coisc is rogha leis an Aire agus a luadhfar sna fo-dhlithe sin) le haon mhodh trálaerachta no saighncoireachta (ar a n-áirmhítear iascaireacht le haon tsaghas lín ar n-a tharrac fan grinnill na fairrge ag bád ar gluaiseacht no ag aon fhearas meicniúil i mbád ar ancoire) d'úsáid, in uiscí aon líomatáiste áirithe (is líomatáiste in achar aon-chirt iascaigh Shaorstáit Éireann), i mbád ar bith no i mbád ar bith de shaghas áirithe, fé mar a luadhfar sna fo-dhlithe sin, no ón gcéanna agus féadfar fo-dhlithe deifriúla do dhéanamh maidir le saghsanna deifriúla bád agus le modhanna deifriúla iascaireachta.

(2) Gach duine dhéanfaidh gníomh no thabharfaidh fé ghníomh do dhéanamh is sárú ar aon fho-dhlí bheidh déanta fén alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar dhá chéad púnt do chur air má sé an chéad chionta fén alt so aige é, agus fíneáil ná raghaidh thar cúig céad púnt má sé an dara cionta no aon chionta ina dhiaidh sin fén alt so aige é.

(3) I gcás duine do chiontú i gcionta fén alt so déanfaidh an chúirt, i dteanta aon phionóis eile do ghearradh, a ordú go ngeallbhruidfear aon ghléas iascaireachta do húsáideadh no do tugadh fé n-a úsáid contrárdha don fho-dhlí gurbh é a shárú san an cionta san.

(4) I gcás—

[EN]

(a) an tríú cionta, no aon chionta ina dhiaidh sin, fén alt so do dhéanamh sa bhád chéanna, pe'ca isé an duine céanna ciontófar gach tráth no nách é, agus

[EN]

(b) an bád san do bheith, le linn an chionta san do dhéanamh, ar únaeracht no ar pháirt-únaeracht ag duine dob únaer no ba páirt-únaer ar an mbád san tráth na gciontaí roimhe sin do dhéanamh,

féadfaidh an chúirt, i dteanta pionóis no pionós ar bith eile do ghearradh fén alt so, a ordú an bád san do gheallbhruideadh.

(5) Beidh feidhm ag forálacha fo-alt (3), (4) agus (5) d'alt 28 den Acht Iascaigh, 1925 (Uimh. 32 de 1925), maidir le fo-dhlithe déanfar fén alt so.

(6) Ní léireofar éinní atá san alt so no bheidh in aon fho-dhlithe déanfar fén alt so mar ní dheineann deifir d'oibriú no chuireann teora le hoibriú aon fho-dhlithe ar n-a ndéanamh fén Steam Trawling (Ireland) Act, 1889.

Ciontaí eile maidir le báid iascaireachta mara.

5.—(1) I gcás—

(a) aon bhád iascaireachta mara le n-a mbaineann Cuid IV den Merchant Shipping Act, 1894, d'fháil in achar aon-chirt iascaigh Shaorstáit Éireann gan na páipéirí oifigiúla tugadh amach do réir an Achta san alos an bháid sin do bheith ar bord aice, no

(b) aon bhád iascaireachta mara eile d'fháil in achar aonchirt iascaigh Shaorstáit Éireann gan páipéirí oifigiúla ag cur náisiúntachta an bháid sin in úil do bheith ar bord aice,

beidh máistir an bháid sin ciontach i gcionta fén alt so agus beidh sé ionphionósuithe dá réir sin.

[EN]

(2) Má thagann aon bhád iascaireachta mara le n-a mbaineann Cuid IV den Merchant Shipping Act, 1894, isteach in achar aonchirt iascaigh Shaorstáit Éireann gan í bheith fé leitreacha agus fé uimhir do réir rialachán a bhaineann le báid iascaireachta mara do leitriú agus d'uimhriú agus a bheidh déanta fén Acht san agus is infheidhmithe maidir leis an mbád san, beidh máistir an bháid iascaireachta mara san ciontach i gcionta fén alt so agus beidh sé ionphionósuithe dá réir sin.

(3) Má theipeann ar aon bhád iascaireachta mara in achar aonchirt iascaigh Shaorstáit Éireann bheith do réir na bhforálacha, i dtaobh na soillsí atá le n'iompar agus le taisbeáint, atá sna rialacháin a bhaineann le hiombualadh ar muir do sheachaint agus do rinneadh fé alt 418 den Merchant Shipping Act, 1894, agus is infheidhmithe maidir leis an mbád san, beidh máistir an bháid sin ciontach i gcionta fén alt so agus beidh sé ionphionósuithe dá réir sin.

(4) I gcás gníomh no faillí do bheith ina chionta fén alt so agus fós fén Merchant Shipping Act, 1894, féadfar neach déanta an chionta do chúiseamh agus do phionósú fén alt so no fén Merchant Shipping Act, 1894, ach ní féadfar é do phionósú dhá uair mar gheall ar an gcionta céanna.

(5) Gach duine bheidh ciontach i gcionta fén alt so dlighfear ar a chiontú ann ar an slí achmair fíneáil ná raghaidh thar céad púnt do chur air.

Oifigigh Chaomhanta Iascaigh Mhara.

6.—Chun crícheanna an Achta so, is oifigeach caomhanta iascaigh mhara gach duine acu so leanas, sé sin le rá :—

(a) gach oifigeach don Aire go n-údarás chuige sin ón Aire;

[EN]

(b) gach ball d'Fhórsaí Cosanta Shaorstáit Éireann go n-údarás chuige sin ón Aire;

[EN]

(c) gach ball den Ghárda Síochána;

[EN]

(d) gach oifigeach Custum agus Máil go n-údarás chuige sin o sna Coimisinéirí Ioncuim;

[EN]

(e) gach oifigeach don Aire Tionnscail agus Tráchtála go n-údarás chuige sin ón Aire.

[EN]

Comhachta Oifigeach Caomhanta Iascaigh Mhara.

7.—(1) Féadfaidh gach oifigeach caomhanta iascaigh mhara, chun an Achta so no aon fho-dhlithe no rialachán a bheidh déanta fé do chur i bhfeidhm, gach ní no éinní acu so leanas do dhéanamh maidir le haon bhád iascaireachta mara in achar aon-chirt iascaigh Shaorstáit Éireann agus (fé réir rialacha an Dlí Eadarnáisiúnta) maidir le haon bhád den tsórt san lasmuich den achar san, sé sin le rá :—

(a) féadfaidh a ordú an bád san do stopadh chun a haithinte no chun leigint do dul ar bord uirthi;

[EN]

(b) féadfaidh dul ar bord an bháid sin;

[EN]

(c) féadfaidh a cheangal ar únaer no ar mháistir no ar fhuirinn an bháid sin, no ar éinne acu san, aon deimhnithe clárathachta, ceadúnaisí, leabhair turuis, páipéiri, no scríbhinní eile, bhaineann leis an mbád san no leis an bhfuirinn no le haon bhall den fhuirinn, agus a bheidh i seilbh no fé chúram fé seach an únaera no an mháistir no éinne den fhuirinn sin, do thabhairt i láthair, agus féadfaidh aon deimhnithe, ceadúnaisí, leabhair turuis, no páipéirí den tsórt san no aon scríbhinní eile den tsórt san d'iniúchadh agus sleachta do thógaint asta no cóipeanna do dhéanamh díobh;

(d) féadfaidh a cheangal ar mháistir an bháid sin míniú do thabhairt uaidh i dtaobh an bháid sin agus i dtaobh na ndeimhnithe clárathachta, na gceadúnaisí, na leabhar turuis, na bpáipéirí no na scríbhinní eile sin;

(e) féadfaidh an bád san do chuardach;

[EN]

(f) féadfaidh ainm agus seoladh duine ar bith ar bord an bháid sin d'éileamh agus do thógaint;

[EN]

(g) má bhíonn amhrus aige go ndearna duine ar bith ar bord an bháid sin sárú ar fhorálacha an Achta so féadfaidh, gan gairm, barántas ná próiseas eile, an bád san agus na daoine uile ar bord an bháid sin do thógaint go dtí an port is comhgaraighe no is caothúla agus an bád san agus na daoine sin do choimeád fé choinneáil faid a bheidh na nithe is gá do réir an chéad ailt ina dhiaidh seo á ndéanamh aige;

(h) féadfaidh, chun comhachta ar bith dá mbronntar air le haon mhír acu san roimhe seo den fho-alt so d'fheidhmiú, pé fórsa is dóich leis is gá d'úsáid agus go sonnrách, más rud é go n-ordóidh don bhád san sa tslí bheidh orduithe le rialacháin ar n-a ndéanamh ag an Aire fén alt so stad agus ná déanfar do réir an orduithe sin uaidh no ná tabharfar áird air, féadfaidh, tar éis do a chur fé ndeár ar dtúis urchar do chaitheamh mar rabhadh, urchair do scaoileadh leis an mbád san no isteach inti.

(2) Má chuireann duine ar bith bac no cosc le haon oifigeach caomhanta iascaigh mhara agus eisean ag feidhmiú comhachta ar bith dá mbronntar ar an oifigeach san leis an alt so no má dheineann diúltadh no má thugann faillí maidir le cólíonadh aon éilimh a dhéanfaidh no aon orduithe bhéarfaidh an t-oifigeach san go dleathach, no maidir le freagra do thabhairt ar aon cheist a chuirfidh an t-oifigeach san go dleathach, do réir an ailt seo, beidh an duine sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga púnt do chur air no príosúntacht, i dteanta no d'éamais daor-oibre, ar feadh aon téarma nách sia ná trí mhí.

(3) Ní déanfar aon aicsean ná aon imeachta dlí eile ar bith, síbhialta no coiriúil, do bhunú in aon chúirt i Saorstát Éireann maidir le héinní do dhéanamh a húdaruítear d'oifigeach caomhanta iascaigh mhara a dhéanamh fén alt so, pe'ca oifigeach caomhanta iascaigh mhara dhéanfaidh an ní sin no duine bheidh ag gníomhú fé orduithe oifigigh chaomhanta iascaigh mhara.

(4) Féadfaidh an tAire, le hordú, rialacháin do dhéanamh i dtaobh éinní dá dtagartar san alt so mar ní bheidh orduithe le rialacháin ar n-a ndéanamh ag an Aire fén alt so.

Bád agus daoine do choimeád fé choinneáil faid a bheidh cúiseamh á bhunú.

8.—I gcás oifigeach caomhanta iascaigh mhara agus é ag feidhmiú na gcomhacht a bronntar air leis an alt deiridh sin roimhe seo do bheith tar éis báid ar bith agus na daoine ar bord an bháid sin do thógaint go dtí port déanfaidh, chó luath agus is féidir é, máistir an bháid sin agus éinne eile ar bord an bháid sin go bhfuiltear tar éis imeachta no chun imeachta mar gheall ar aon chionta fé aon alt den Acht so do bhunú ina aghaidh do thabhairt os cóir Breithimh den Chúirt Dúithche no, mara mbíonn aon Bhreitheamh den tsórt san ar fáil láithreach, os cóir Feadhmannaigh Shíochána, agus ansan déanfaidh an Breitheamh no an Feadhmannach Síochána san (pe'ca aca é), más deimhin leis na himeachta san do bheith bunuithe no le bunú in aghaidh an mháistir no an duine eile sin, déanfaidh, tré ordú do dhíriú chun oifigigh no chun oifigeach caomhanta iascaigh mhara, a cheangal ar an oifigeach no ar na hoifigigh sin an bád san agus gach duine ar bord an bháid sin do choimeád fé choinneáil ag port áirithe i Saorstát Éireann go dtí go mbeidh Breitheamh den Chúirt Dúithche tar éis breithe do thabhairt ar na himeachta san, agus déanfar an bád san agus na daoine sin do choimeád fé choinneáil dá réir sin.

Costaisí cúisimh.

9.—I gcás duine do chiontú i gcionta fé aon alt den Acht so, féadfaidh an chúirt a chiontóidh an duine sin a ordú dho costaisí an chúisimh d'íoc.

Freagarthacht mháistir báid.

10.—I gcás duine ar bith ar bord báid iascaireachta mara do dhéanamh aon chionta fé aon alt den Acht so, beidh éifeacht ag na forálacha so leanas, sé sin le rá:—

[EN]

(a) tuigfear máistir an bháid sin, maran é féin neach déanta an chionta san ach gan dochar d'fhreagarthacht neach a dhéanta, do bheith ciontach sa chionta san agus féadfar imeachta do bhunú ina aghaidh dá réir sin;

[EN]

(b) má deintear máistir báid do chúiseamh amhlaidh sa chionta san do dhéanamh beidh sé ina chosaint mhaith dho a chruthú—

[EN]

(i) go ndearna sé dícheall cuibhe chun cosc do chur le déanamh na ngníomhartha adeirtear isiad an cionta ann; agus

[EN]

(ii) nách é féin a rinne na gníomhartha adeirtear isiad an cionta san ann; agus

[EN]

(iii) nách le n-a chead ná tré n-a fhaillí thoiliúil ná tré é dá scaoileadh thairis a rinneadh na gníomhartha san; agus

[EN]

(iv) ar an gcionta do chur ina leith go dtug sé don duine do chur ina leith é gach eolas a bhí ar a chumas i dtaobh an duine do rinne na gníomhartha san.

Dlighinse na Cúirte Dúithche.

11.—Féadfaidh aon Bhreitheamh den Chúirt Dúithche cionta ar bith fé aon alt den Acht so d'éisteacht agus a bhreith ina thaobh do thabhairt.

Bád do choimeád fé choinneáil go ndéanfar athchomharc i gcoinnibh ciontuithe do bhreithniú.

12.—(1) I gcás Breitheamh den Chúirt Dúithche do chiontú duine i gcionta fé aon alt den Acht so agus do ghearradh íoca aon fhíneála air, agus an bád le n-a mbaineann an duine sin do choimeád fé choinneáil fe sna forálacha den Acht so bhaineann le bád agus le daoine do choimeád fé choinneáil faid a bheadh cúiseamh á bhunú, déanfaidh an Breitheamh san, tré ordú do dhíriú chun oifigigh no oifigeach caomhanta iascaigh mhara, a cheangal ar an oifigeach no ar na hoifigigh sin, i gcás athchomharc do dhéanamh i gcoinnibh an chiontuithe sin, an bád san do choimeád fé choinneáil ag port áirithe i Saorstát Éireann tamall eile go dtí go mbeidh breith tugtha ar an athchomharc san, agus déanfar, fé réir forálacha an chéad fho-ailt ina dhiaidh seo, an bád san do choimeád fé choinneáil dá réir sin.

(2) I gcás ordú do dháanamh fén bhfo-alt deiridh sin roimhe seo á cheangal bád ar bith do choimeád fé choinneáil go dtí go mbeidh breith tugtha ar athchomharc i gcoinnibh ciontuithe féadfaidh Breitheamh den Chúirt Dúithche, má tugtar urraíocht, a bheidh sásúil dar leis an mBreitheamh san, go ndéanfar, i gcás an chiontuithe sin do dhaingniú ar an athchomharc san, íoc i suim a shocróidh an Breitheamh san agus is leor chun méid na fíneála do ghlanadh maraon leis na costaisí (más ann dóibh) a moladh ar an gciontú san agus costaisí an chúisitheora ar an athchomharc san, féadfaidh a ordú an bád san do scaoileadh, agus scaoilfear an bád san dá réir sin.

Fíneála do bhaint amach.

13.—Beidh éifeacht ag na forálacha so leanas i dtaobh fíneála, alos cionta fe aon alt den Acht so, agus na gcostaisí (más ann dóibh), a bheidh le n'íoc ag an té ciontófar sa chionta san, do bhaint amach, sé sin le rá:—

(a) socróidh an chúirt an t-am gur laistigh de bheidh an fhíneáil sin agus na costaisí sin (más ann dóibh) le n'íoc;

[EN]

(b) i gcás an bháid le n-a mbaineann an duine sin do bheith á choimeád fé choinneáil fén Acht so le linn na n-imeacht mar gheall ar an gcionta san d'éisteacht, déanfaidh an chúirt, tré ordú do dhíriú chun oifigigh no oifigeach caomhanta iascaigh mhara, a cheangal ar an oifigeach no ar na hoifigigh sin an bád san do choimeád fé choinneáil ag port áirithe i Saorstát Éireann tamall eile go dtí go ndéanfar an fhíneáil sin agus na costaisí sin (más ann dóibh) d'íoc, agus coimeádfar an bád san fé choinneáil dá réir sin;

(c) mara ndeintear an fhíneáil sin agus na costaisí sin (más ann dóibh) d'íoc laistigh den am san, féadfar an fhíneáil sin agus na costaisí sin (más ann dóibh) do bhaint amach tríd an mbád san do ghabháil agus do dhíol;

[EN]

(d) ní choiscfidh éinní sna míreanna san roimhe seo an fhíneáil sin agus na costaisí sin (más ann dóibh) do bhaint den duine sin tré ghnáth-oibriú dlí.

Bád, gléas iascaigh agus iasc a geallbhruidfear do chur de láimh.

14.—(1) I gcás cúirte do gheallbhruideadh aon bháid, gléis iascaigh no éisc fén Acht so, déanfaidh an tAire an bád, an gléas iascaigh, no an t-iasc san do chur de láimh i pé slí is oiriúnach leis.

(2) Aon airgead a gheobhfar as aon bhád, gléas iascaigh, no iasc do chur de láimh fén alt so déanfar é d'íoc isteach sa Stát-Chiste no do chur chun tairbhe don Stát-Chiste i pé slí ordóidh an tAire Airgid.

SEA FISHERIES PROTECTION ACT, 1933.


AN ACT TO MAKE FURTHER AND BETTER PROVISION FOR THE PROTECTION OF THE SEA FISHERIES OF SAORSTÁT EIREANN. [16th December, 1933.] BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:— [GA]

Definitions.

1.—(1) In this Act—

the expression “the Minister” means the Minister for Lands and Fisheries;

[GA]

the word “fish” includes shell-fish but does not include salmon or fresh water eels;

[GA]

the word “sea-fishing” means fishing for or taking fish in tidal waters;

[GA]

the expression “sea-fishing boat” means any ship, boat or other vessel of whatsoever kind used for sea-fishing;

[GA]

the expression “the master” when used in relation to a sea-fishing boat means the master, skipper or other person for the time being in charge of such boat;

[GA]

the expression “fishing gear” includes any net, trap, line or other apparatus of whatsoever kind used or capable of being used for catching fish, and any rope, warp, pole or other thing of whatsoever kind fastened to or capable of being used with such net, trap, line or other apparatus.

(2) Each of the following boats shall be a Saorstát Eireann sea-fishing boat for the purposes of this Act, that is to say:—

(a) a sea-fishing boat registered in Saorstát Eireann under the Merchant Shipping Acts, 1894 to 1933,

[GA]

(b) any sea-fishing boat the owner or, if there is more than one owner, the managing owner of which resides or has his principal place of business in Saorstát Eireann.

Exclusive fishery limits of Saorstát Eireann.

2.—In this Act the expression “the exclusive fishery limits of Saorstát Eireann” means that portion of the seas within which citizens of Saorstát Eireann have, by international law, the exclusive right of fishing and where such portion is defined by the terms of any convention, treaty or arrangement for the time being in force made between Saorstát Eireann and any other State includes as regards the sea-fishing boats and subjects of such State the portion so defined.

Restriction on sea fishing boats entering exclusive fishery limits.

3.—(1) It shall not be lawful for any sea-fishing boat, which is not a Saorstát Eireann sea-fishing boat, to enter within the exclusive fishery limits of Saorstát Eireann except for—

(a) a purpose recognised by international law; or

[GA]

(b) a purpose recognised by any convention, treaty, or arrangement for the time being in force between Saorstát Eireann and the country to which such boat belongs; or

[GA]

(c) any other lawful purpose.

[GA]

(2) If any sea-fishing boat, which is not a Saorstát Eireann sea-fishing boat, enters within the exclusive fishery limits of Saorstát Eireann for any purpose mentioned in the foregoing sub-section the following provisions shall have effect, that is to say:—

(a) such boat shall return outside of the said limits so soon as such purpose has been answered;

[GA]

(b) no person on board such boat shall fish or attempt to fish while such boat remains within the said limits;

[GA]

(c) any regulations made under this section and for the time being in force shall be duly observed;

[GA]

(3) The Minister may by order make regulations in relation to the maintenance of good order amongst sea-fishing boats, which are not Saorstát Eireann sea-fishing boats, for the time being within the exclusive fishery limits of Saorstát Eireann, and the persons on board such boats.

[GA]

(4) If—

[GA]

(a) any sea-fishing boat, which is not a Saorstát Eireann sea-fishing boat, enters within the exclusive fishery limits of Saorstát Eireann in contravention of sub-section (1) of this section, or

[GA]

(b) any such sea-fishing boat having lawfully entered within the exclusive fishery limits of Saorstát Eireann there has been a contravention in relation to such boat (whether by commission or omission) of any of the provisions of sub-section (2) of this section,

[GA]

the master of such boat shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section to a fine not exceeding fifty pounds and, in the case of a second or any subsequent offence under this section, to a fine not exceeding one hundred pounds, and in either case the court may also forfeit any fish found on such boat and any fishing gear thereon.

Prohibition of certain methods of trawling.

4.—(1) The Minister may from time to time by bye-laws prohibit (at the option of the Minister either, as may be specified in such bye-laws, absolutely or unless such conditions as the Minister thinks fit to insert in such bye-laws are complied with) the use, within the waters of any specified area (being an area within the exclusive fishery limits of Saorstát Eireann), in or from either, as may be specified in such bye-laws, any boat or any boat of a specified class, of any method of trawling or seining (including fishing by means of any kind of net hauled along the bottom of the sea whether by a moving boat or by any mechanical appliance in an anchored boat), and different bye-laws may be made in respect of different classes of boats and different methods of fishing.

(2) Every person who acts or attempts to act in contravention of any bye-law made under this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section, to a fine not exceeding two hundred pounds, and, in the case of a second or any subsequent offence under this section to a fine not exceeding five hundred pounds.

(3) Where a person is convicted of an offence under this section the court shall, in addition to any other penalty, order any fishing gear used or attempted to be used in contravention of the bye-law, the contravention of which constituted such offence, to be forfeited.

[GA]

(4) Where—

[GA]

(a) a third or any subsequent offence under this section has been committed on board the same boat, whether the person convicted is or is not the same person on each occasion, and

[GA]

(b) such boat is at the time of the commission of such offence owned or part owned by a person who was the owner or part owner of such boat on the occasion of the commission of the previous offences,

[GA]

the court may, in addition to any other penalty or penalties under this section, order such boat to be forfeited.

[GA]

(5) The provisions of sub-sections (3), (4) and (5) of section 28 of the Fisheries Act, 1925 (No. 32 of 1925), shall apply in respect of bye-laws made under this section.

[GA]

(6) Nothing in this section or in any bye-laws made thereunder shall be construed as affecting or limiting the operation of any bye-laws made under the Steam Trawling (Ireland) Act, 1889.

Other offences in relation to sea-fishing boats.

5.—(1) If—

[GA]

(a) any sea-fishing boat to which Part IV of the Merchant Shipping Act, 1894, applies is found within the exclusive fishery limits of Saorstát Eireann without having on board the official papers issued in pursuance of the said Act in respect of such boat, or

[GA]

(b) any other sea-fishing boat is found within the exclusive fishery limits of Saorstát Eireann without having on board official papers evidencing the nationality of such boat,

[GA]

the master of such boat shall be guilty of an offence under this section and shall be punishable accordingly.

[GA]

(2) If any sea-fishing boat to which Part IV of the Merchant Shipping Act, 1894, applies which is not lettered and numbered in accordance with regulations for lettering and numbering sea-fishing boats made under the said Act and applicable to such boat enters within the exclusive fishery limits of Saorstát Eireann, the master of such sea-fishing boat shall be guilty of an offence under this section and shall be punishable accordingly.

(3) If any sea-fishing boat within the exclusive fishery limits of Saorstát Eireann fails to observe the provisions, relating to lights to be carried and exhibited, of the regulations for the prevention of collisions at sea made under section 418 of the Merchant Shipping Act, 1894, and applicable to such boat, the master of such boat shall be guilty of an offence under this section and shall be punishable accordingly.

(4) Where an act or omission constitutes an offence under this section and also under the Merchant Shipping Act, 1894, the offender may be prosecuted and punished under this section or under the Merchant Shipping Act, 1894, but shall not be liable to be punished twice for the same offence.

(5) Every person guilty of an offence under this section shall be liable on summary conviction thereof to a fine not exceeding one hundred pounds.

Sea Fisheries Protection Officers.

6.—Each of the following persons shall, for the purposes of this Act, be a sea fisheries protection officer, that is to say:—

(a) every officer of the Minister authorised in that behalf by the Minister;

[GA]

(b) every member of the Defence Forces of Saorstát Eireann authorised in that behalf by the Minister;

[GA]

(c) every member of the Gárda Síochána;

[GA]

(d) every officer of Customs and Excise authorised in that behalf by the Revenue Commissioners;

[GA]

(e) every officer of the Minister for Industry and Commerce authorised in that behalf by the Minister.

[GA]

Powers of Sea Fisheries Protection Officers.

7.—(1) Every sea fisheries protection officer may, for the purpose of enforcing this Act, or any bye-laws or regulations made thereunder, do with respect to any sea-fishing boat within the exclusive fishery limits of Saorstát Eireann and (subject to the rules of International Law) outside those limits all or any of the following things, that is to say:—

(a) he may order such boat to be stopped for the purpose of identification or of allowing him to go on board it;

[GA]

(b) he may board such boat;

[GA]

(c) he may require the owner, master, or crew of such boat, or any of them, to produce any certificates of registry, licences, log-books, papers, or other documents relating to such boat, or to the crew, or to any member thereof, which are in the respective possession or control of any of them, the said owner, master, and crew, and inspect and take extracts from or copies of any such certificates, licences, log-books, papers or other documents;

(d) he may require the master of such boat to give an explanation concerning such boat, and the said certificates of registry, licences, log-books, papers or other documents;

[GA]

(e) he may search such boat;

[GA]

(f) he may demand and take the name and the address of any person on board such boat;

[GA]

(g) if he suspects that there has been a contravention by any person on board such boat of the provisions of this Act he may without summons, warrant or other process take such boat and all persons on board such boat to the nearest or most convenient port and, pending the taking by him of the steps required by the next following section, detain such boat and such persons;

(h) he may for the purpose of exercising any of the powers conferred on him by any of the foregoing paragraphs of this sub-section use such force as he may consider necessary and in particular, if an order given by him to such boat in the manner prescribed by regulations made by the Minister under this section to stop is disobeyed or disregarded, he may after first causing a gun to be fired as a signal, fire at or into such boat.

(2) If any person obstructs or impedes any sea fisheries protection officer in the exercise of any of the powers conferred on such officer by this section, or refuses or neglects to comply with any requisition or direction lawfully made or given by such officer or to answer any question lawfully asked by such officer in pursuance of this section, such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds or to imprisonment, with or without hard labour, for any term not exceeding three months.

(3) No action or other legal proceedings whatsoever, whether civil or criminal, shall be instituted in any court in Saorstát Eireann in respect of the doing of anything authorised to be done by a sea fisheries protection officer under this section, whether such thing is done personally by a sea fisheries protection officer or by a person acting under the orders of a sea fisheries protection officer.

(4) The Minister may by order make regulations in relation to any thing referred to in this section as prescribed by regulations made by the Minister under this section.

Detention of boat and persons pending prosecution.

8.—Where a sea fisheries protection officer has in exercise of the powers conferred on him by the immediately preceding section taken any boat and the persons on board such boat to a port he shall, as soon as may be, bring the master of such boat and any other person on board such boat against whom proceedings for any offence under any section of this Act have been or are about to be instituted before a Justice of the District Court or, where no such Justice is immediately available, a Peace Commissioner, and thereupon such Justice or Peace Commissioner (as the case may be) shall, if he is satisfied that such proceedings have been or are about to be instituted against such master or other person, by order directed to a sea fisheries protection officer or officers require such officer or officers to detain at a specified port in Saorstát Eireann such boat and all persons on board such boat until such proceedings have been adjudicated upon by a Justice of the District Court, and such boat and persons shall be detained accordingly.

Costs of prosecution.

9.—Where a person is convicted of an offence under any section of this Act, the court by whom such person is convicted may order him to pay the costs of the prosecution.

Liability of master of boat.

10.—Where any offence under any section of this Act has been committed by any person on board a sea-fishing boat, the following provisions shall have effect, that is to say:—

(a) the master of such boat shall, if not the actual offender, but without prejudice to the liability of such offender, be deemed to be guilty of such offence and may be proceeded against accordingly;

[GA]

(b) where the master of a boat is so charged with having committed such offence it shall be a good defence for him to prove—

[GA]

(i) that he used due diligence to prevent the commission of the acts alleged to constitute the offence; and

[GA]

(ii) that the acts alleged to constitute such offence were not done by him personally; and

[GA]

(iii) that the said acts were done without his consent, connivance, or wilful default; and

[GA]

(iv) that on being charged with the offence he gave to the person charging him all information in his power with respect to the person who did the said acts.

[GA]

Jurisdiction of the District Court.

11.—Any offence under any section of this Act may be heard and determined by any Justice of the District Court.

[GA]

Detention of boat pending appeal against conviction.

12.—(1) Where a person is convicted by a Justice of the District Court of an offence under any section of this Act and sentenced to pay any fine, and the boat to which such person belongs has been detained under the provisions of this Act relating to detention of boat and persons pending prosecution, such Justice shall, by order directed to a sea-fisheries protection officer or officers, require such officer or officers in the event of an appeal being lodged against such conviction, to detain further, pending the determination of such appeal, at a specified port in Saorstát Eireann such boat, and such boat shall, subject to the provisions of the next following sub-section, be detained accordingly.

(2) Where an order is made under the immediately preceding sub-section requiring any boat to be detained pending the determination of an appeal against a conviction a Justice of the District Court may, if security, which in the opinion of such Justice is satisfactory, is given for payment, in the event of such conviction being affirmed on such appeal, of a sum to be fixed by such Justice sufficient to cover the amount of the fine and costs (if any) awarded on such conviction and the costs of the prosecutor on such appeal, direct such boat to be released, and such boat shall be released accordingly.

Recovery of fines.

13.—The following provisions shall have effect in relation to the recovery of a fine for an offence under any section of this Act and the costs (if any) ordered to be paid by the person convicted of such offence, that is to say:—

(a) the court shall fix a time within which such fine and costs (if any) are to be paid;

[GA]

(b) where the boat to which such person belongs is at the time of the hearing of the proceedings for such offence detained under this Act, the court shall by order directed to a sea fisheries protection officer or officers require such officer or officers to detain further, until such fine and costs (if any) are paid, at a specified port in Saorstát Eireann such boat, and such boat shall be detained accordingly;

(c) in the event of such fine and costs (if any) not being paid within the said time, such fine and costs (if any) may be recovered by distress and the sale of such boat;

[GA]

(d) nothing in the foregoing paragraphs shall prevent such fine and costs (if any) being recovered from such person by ordinary process of law.

Disposal of forfeited boat, fishing gear, and fish.

14.—(1) Where any boat, fishing gear or fish is forfeited by a court under this Act, such boat, fishing gear, or fish shall be disposed of by the Minister in such manner as he thinks fit.

(2) Any moneys arising on the disposal of any boat, fishing gear, or fish under this section shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance shall direct.

Adaptation of Trawling in Prohibited Areas Prevention Act, 1909.

15.—References in the Trawling in Prohibited Areas Prevention Act, 1909, to the United Kingdom shall be construed as references to Saorstát Eireann and the said Act shall be construed and have effect accordingly.

Prosecution of offences.

16.—Any offence under any section of this Act may be prosecuted by or at the suit of the Minister as prosecutor.

Laying of regulations before Houses of Oireachtas.

17.—Every regulation made by the Minister under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling such regulation is passed by either such House within the next subsequent twenty-one days on which such House has sat after such regulation is so laid before it, such regulation shall be annulled accordingly but without prejudice to the validity of anything previously done under such regulation.

Expenses.

18.—All expenses of carrying this Act into execution shall, to such extent as shall be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.

Repeal of the Fishery (Ireland) Act, 1888.

19.—The Fishery (Ireland) Act, 1888 is hereby repealed.

Short title and citation.

20.—(1) This Act may be cited as the Sea Fisheries Protection Act, 1933.

(2) This Act and the Fisheries Acts, 1842 to 1925, may be cited together as the Fisheries Acts, 1842 to 1933.
