ACHT PRÍNTÍSEACHTA, 1931.

Mínithe.
1.—San Acht so—
cialluíonn an abairt “an tAire” an tAire Tionnscail agus Tráchtála;
foluíonn an focal “ceárd” aon tionnscal, slí bheatha, no gnó, agus foluíonn sé freisin aon bhrainse fé leith de chéird;
cialluíonn an abairt “bord céirde” bord céirde do bunuíodh fé sna Trade Boards Acts, 1909 and 1918;
cialluíonn an abairt “ceárd go mbord céirde” ceárd go mbeidh bord céirde ann di de thurus na huaire;
cialluíonn an abairt “ceárd gan bhord céirde” ceárd nách ceárd go mbord céirde;
cialluíonn an abairt “coiste céirde ceanntair” coiste céirde ceanntair do bhunuigh bord céirde fé sna Trade Boards Acts, 1909 and 1918;
cialluíonn an abairt “ceárd ainmnithe” ceárd go mbeidh sé dearbhuithe de thurus na huaire fén Acht so gur ceárd ainmnithe í chun crícheanna an Achta so, déanfar tagairtí do chéird ainmnithe do bheith ar siúl, más ceárd í ná beidh ina céird ainmnithe ach i gcuid de Shaorstát Éireann, do léiriú mar thagairtí don chéird sin do bheith ar siúl sa chuid sin de Shaorstát Éireann agus do san amháin;
foluíonn an abairt “oifigeach údaruithe” aon duine go n-údarás i scríbhinn (go generálta no chun críche speisialta) ón Aire chun gach comhachta no aon chomhachta dá mbeidh bronnta agus chun gach dualgais no aon dualgais dá mbeidh curtha ar oifigeach údaruithe fén Acht so d'fheidhmiú agus do chólíonadh;
cialluíonn an focal “orduithe” orduithe le rialacháin a dhéanfaidh an tAire fén Acht so.
Ceárda ainmnithe.
2.—(1) Fé réir forálacha an ailt seo, féadfaidh an tAire le hordú (dá ngairmtear ordú speisialta san Acht so) éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) a dhearbhú gur ceárd ainmnithe aon cheárd áirithe chun crícheanna an Achta so ar fuaid Shaorstáit Éireann no in aon chuid áirithe de Shaorstát Éireann; no
(b) aon ordú bheidh déanta aige cheana fén bhfo-alt so do cheiliúradh no do leasú.
(2) Is fé sna rialacha atá sa Sceideal a ghabhann leis an Acht so agus dá réir a déanfar gach ordú speisialta agus is do réir na rialacha so bheidh an nós-imeachta leanfar nuair a bheidh na horduithe sin á ndéanamh.
(3) Foillseofar gach ordú speisialta san Iris Oifigiúil agus fós i pé slí eile is dóich leis an Aire is fearr chun an orduithe speisialta san do chur in úil do dhaoine go mbainfe sé leo.
(4) Tiocfaidh gach ordú speisialta i ngníomh ar pé dáta, tar éis an orduithe sin d'fhoillsiú san Iris Oifigiúil, a luadhfar chuige sin san ordú san no, mara luaidhtear amhlaidh aon dáta den tsórt san, ar dháta an fhoillsithe sin.
(5) Leagfar gach ordú speisialta fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a dhéanta, agus má dheineann ceachtar Tigh acu san, laistigh den lá is fiche shuidhfidh an Tigh sin tar éis an orduithe sin do leagadh fé n-a bhráid, rún do rith ag cur an orduithe sin ar nea-mbrí, beidh an t-ordú san curtha ar nea-mbrí dá réir sin ach beidh san gan dochar do dhleathacht éinní do rinneadh roimhe sin fén ordú san.
Ceanntair phríntíseachta agus coistí príntíseachta.
3.—(1) Pé uair a dhéanfaidh an tAire ordú speisialta á dhearbhú gur ceárd ainmnithe i líomatáiste áirithe (pe'ca is ionann an líomatáiste sin agus iomlán Shaorstáit Éireann no nách eadh) aon cheárd áirithe beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) déanfaidh an tAire láithreach, le hordú eile, ceanntar príntíseachta chun crícheanna na céirde ainmnithe sin do dhéanamh den líomatáiste sin no dhá cheanntar phríntíseachta no níos mó chun crícheanna na céirde ainmnithe sin do dhéanamh den líomatáiste sin;
(b) bunófar agus coimeádfar ar bun i ngach ceanntar príntíseachta den tsórt san coiste príntíseachta don chéird ainmnithe sin chun na bhfeidhmeanna ceaptar leis an Acht so do choistí príntíseachta d'fheidhmiú sa cheanntar san agus maidir leis an gcéird sin.
(2) Sara ndéanfa sé ordú fén alt so ag déanamh ceanntair phríntíseachta, no ag déanamh dhá cheanntar phríntíseachta no níos mó, chun crícheanna céirde ainmnithe is ceárd go mbord céirde, de líomatáiste raghaidh an tAire i gcomhairle leis an mbord céirde don chéird sin.
(3) Léireofar tagairtí san Acht so do cheanntar choiste phríntíseachta mar thagairtí don cheanntar phríntíseachta ina mbunófar an coiste sin leis an alt so.
Ballra coistí príntíseachta.
4.—(1) Beidh éifeacht ag na forálacha so leanas maidir le gach coiste príntíseachta bunófar leis an Acht so do chéird ainmnithe is ceárd gan bhord céirde, sé sin le rá:—
(a) beidh an coiste sin có-dhéanta—
(i) de bhaill (dá ngairmtear baill ionadathacha san Acht so) is ionadaithe leath má leath d'fhostóirí agus d'fhostaithe bhíonn ag gabháil don chéird sin sa cheanntar san, agus
(ii) mara n-orduítear a mhalairt, de bhaill (dá ngairmtear baill cheaptha san Acht so) a cheapfaidh an tAire;
(b) isé líon na mball n-ionadathach ná pé uimhir chothrom a hordófar agus isé líon na mball gceaptha (más ann dóibh) ná pé líon, nách mó ná triúr, a hordófar;
(c) is do réir mar a hordófar a bheidh am agus modh ceaptha na mball n-ionadathach;
(d) beidh baill an choiste sin i seilbh oifige ar feadh pé téarma a hordófar.
(2) Lasmuich de chás dá bhforáltar a mhalairt leis an alt so, beidh éifeacht ag na forálacha so leanas maidir le gach coiste príntíseachta bunófar leis an Acht so do chéird ainmnithe is ceárd go mbord céirde, sé sin le rá:—
(a) beidh an coiste sin có-dhéanta—
(i) de bhaill ex-officio, agus
(ii) mar n-orduítear a mhalairt, de bhaill (dá ngairmtear baill cheaptha san Acht so) a cheapfaidh an tAire;
(b) isiad a bheidh ina mbaill ex-officio den choiste sin ná—
(i) má bhíonn an ceanntar san có-theoranta le Saorstát Éireann, na daoine is baill ionadathacha de thurus na huaire, do réir bhrí an Trade Boards Act, 1909, den bhord chéirde don chéird sin, agus
(ii) mara mbeidh sa cheanntar san ach cuid de Shaorstát Éireann agus má bhíonn sé có-theoranta le líomatáiste feidhmiúcháin choiste chéirde cheanntair (más ann do) an bhúird chéirde don chéird sin, na daoine (seachas duine no daoine cheapfaidh an tAire fén Trade Boards Act, 1909, chun bheith ina bhall no ina mbaill den bhord chéirde sin) a bheidh de thurus na huaire ina mbaill den choiste chéirde cheanntair sin;
(c) isé líon na mball gceaptha (más ann dóibh) ná pé líon, nách mó ná triúr, a hordófar;
(d) beidh na baill cheaptha (más ann dóibh) i seilbh oifige ar feadh pé téarma a hordófar.
(3) Mara mbeidh i gceanntar phríntíseachta choiste phríntíseachta do chéird go mbord céirde ach cuid de Shaorstát Éireann agus ná beidh ann don chéird sin de thurus na huaire aon choiste céirde ceanntair go mbeidh a líomatáiste feidhmiúcháin cótheoranta leis an gceanntar san, bunófar an coiste príntíseachta don cheanntar san fén alt so ar gach slí díreach fé is dá mba cheárd gan bhord céirde an cheárd san agus leanfa sé de bheith bunuithe amhlaidh mara ndeintear agus go dtí go ndéanfar coiste céirde ceanntair den tsórt san do bhunú.
(4) Féadfaidh an tAire, le rialacháin, socrú do dhéanamh i dtaobh éinní no aon ruda bhaineann le coistí príntíseachta no le haon tsaghas áirithe coistí príntíseachta do bhunú agus ná deintear socrú ina thaobh leis an alt so, agus féadfaidh, leis na rialacháin sin, socruithe deifriúla den tsórt san do dhéanamh maidir le saghsanna deifriúla coistí príntíseachta.
Cathaoirleach agus rúnaí coistí príntíseachta.
5.—(1) Isé bheidh mar chathaoirleach ar gach coiste príntíseachta ná pé ball den choiste sin a cheapfaidh an tAire agus beidh sé i seilbh oifige faid is toil leis an Aire é.
(2) Isé an tAire cheapfaidh rúnaí gach coiste príntíseachta, agus beidh gach rúnaí den tsórt san i seilbh oifige ar pé téarmaí agus ar pé coinníollacha agus gheobhaidh sé pé luach saothair agus pé liúntaisí cheapfaidh an tAire le ceadú an Aire Airgid.
An nós-imeachta leanfar ag cruinnithe de choistí príntíseachta.
6.—(1) Isé is quorum do chruinniú de choiste phríntíseachta ná trian de líon iomlán na mball n-ionadathach no na mball ex-officio den choiste sin (pe'ca aca é) agus, má bhíonn aon bhaill cheaptha ar an gcoiste sin, ball ceaptha amháin den choiste sin.
(2) Ag cruinniú de choiste phríntíseachta—
(a) isé cathaoirleach an choiste sin a bheidh ina chathaoirleach ar an gcruinniú má bhíonn sé i láthair;
(b) mara mbeidh cathaoirleach an choiste sin i láthair, no má bhíonn oifig an chathaoirligh folamh, déanfaidh na baill den choiste bheidh i láthair duine dá líon do cheapadh chun bheith ina chathaoirleach ar an gcruinniú.
(3) Ní bheidh imeachta coiste phríntíseachta gan éifeacht de dheascaibh aon fholúntais imeasc ballra an choiste sin ná de dheascaibh aon lochta i gceapadh, i dtogha, no in ainmniú aon bhaill de.
(4) Fé réir forálacha an Achta so féadfaidh an tAire, le rialacháin a dhéanfa sé fén Acht so, a ordú cadé an nós-imeachta leanfar ag cruinnithe de choistí príntíseachta.
Tuarasgabhála agus cuntaisí o choiste phríntíseachta.
7.—Bhéarfaidh gach coiste príntíseachta don Aire pé tuarasgabhála agus cuntaisí agus fós pé eolas éileoidh sé o am go ham.
Rialacha dhéanfaidh coistí príntíseachta.
8.—(1) Déanfaidh gach coiste príntíseachta na rialacha so leanas, sé sin le rá:—
(a) rialacha (dá ngairmtear rialacha aicmithe príntíseachta san Acht so) á dhearbhú gurb ionann aon aicme áirithe daoine do bheith ar fostú in aon tslí áirithe sa chéird ainmnithe dá mbeidh an coiste sin bunuithe agus fostú príntíseachta sa chéird sin;
(b) rialacha (dá ngairmtear san Acht so rialacha i dtaobh na tréimhse príntíseachta) maidir leis an tréimhse (agus aon tréimhse thástála d'áireamh) a caithfear ar fostú príntíseachta sa chéird sin i gceanntar an choiste sin;
(c) rialacha (dá ngairmtear san Acht so rialacha i dtaobh na rátaí minimum páigh) maidir leis na rátaí minimum páigh (seachas págh as aimsir bhreise) a híocfar le daoine bheidh ar fostú príntíseachta sa chéird sin sa cheanntar san;
(d) rialacha (dá ngairmtear san Acht so rialacha i dtaobh na n-uaireanna maximum oibre) maidir le méid maxi mum na n-uaireanna (lasmuich d'aimsir bhreise) fhéadfaidh daoine bheidh ar fostú príntíseachta sa chéird sin sa cheanntar san a chaitheamh ag obair aon tseachtain, ach ní i slí go méadófar méid maximum na n-uaireanna san a bheidh ceaptha le haon achtachán eile no fé.
(2) Féadfaidh gach coiste príntíseachta gach riail no aon riail acu so leanas do dhéanamh, sé sin le rá:—
(a) rialacha (dá ngairmtear san Acht so rialacha i dtaobh cáilíochtaí oideachais príntíseach) maidir le cáilíochtaí oideachais daoine bheidh ag dul ar fostú príntíseachta, sa chéird ainmnithe dá mbeidh an coiste sin bunuithe, le daoine go mbíonn an cheárd san ar siúl acu i gceanntar an choiste sin;
(b) rialacha (dá ngairmtear san Acht so rialacha i dtaobh aois tosnuithe na príntíseachta) maidir leis na teoranta aoise gur laistigh díobh a féadfar tosnú ar fostú príntíseachta sa chéird sin sa cheanntar san;
(c) rialacha (dá ngairmtear san Acht so rialacha i dtaobh oiliúna príntíseach) á cheangal ar fhostóirí go mbíonn an cheárd san ar siúl acu sa cheanntar san príntísigh a bhíonn ar fostú acu d'oiliúint agus do mhúineadh i slí áirithe;
(d) rialacha (dá ngairmtear san Acht so rialacha i dtaobh líon na bpríntíseach) á shocrú, maidir le haon fhostóir áirithe go mbíonn an cheárd san ar siúl aige sa cheanntar san, cadé an líon príntíseach (dá ngairmtear an riail-líon san Acht so) is dóich leis an gcoiste sin ba cheart do bheith ar fostú ag an bhfostóir sin sa chéird sin sa cheanntar san agus, más oiriúnach leis an gcoiste príntíseachta san é, féadfar an líon san do chur in úil mar chion den líon daoine d'aon aicme no aicmí bheidh ar fostú o am go ham sa chéird sin sa cheanntar san ag an bhfostóir sin;
(e) rialacha (dá ngairmtear san Acht so rialacha i dtaobh prémium príntíseachta)—
(i) á thoirmeasc aon táille, prémium no comaoine eile (dá ngairmtear prémium príntíseachta san Acht so) do thógaint alos duine do bheith ar fostú príntíseachta sa chéird sin sa cheanntar san, no
(ii) á cheadú prémium príntíseachta do thógaint alos na fostaíochta san agus ag socrú méid an phrémium phríntíseachta san;
(f) rialacha (dá ngairmtear san Acht so rialacha i dtaobh na rátaí minimum páigh aimsire breise) maidir leis na rátaí minimum páigh a híocfar as aimsir bhreise le daoine ar fostú príntíseachta sa chéird sin sa cheanntar san.
(3) Féadfaidh coiste príntíseachta o am go ham, tré rialacha do dhéanamh fén alt so, aon rialacha do rinneadar roimhe sin fén alt so agus a bheidh i bhfeidhm de thurus na huaire do chur ar neamhní no do leasú no cur leo.
(4) Ní dhéanfaidh coiste príntíseachta rialacha ar bith fén alt so mara ndeintear ná go dtí go ndéanfar, do réir rialachán a dhéanfaidh an tAire, fógra míosa do thabhairt go bhfuiltear chun na rialacha san do dhéanamh, ná go dtí go mbreithneoid aon chúis i dtaobh na rialacha san a pléidhfear roimh dheireadh na tréimhse sin.
(5) Gach riail a dhéanfaidh coiste príntíseachta fén alt so leagfar fé bhráid an Aire í chó luath agus is féidir é tar éis a déanta agus ní bheidh feidhm ná éifeacht ar bith ag aon riail den tsórt san mara ndeintear ná go dtí go ndéanfar í do dhaingniú le hordú ón Aire, ach ar bheith daingnithe amhlaidh di tiocfa sí i ngníomh pé dáta (nách luaithe ná dáta an orduithe sin) a luadhfar chuige sin san ordú san no, mara luaidhtear amhlaidh aon dáta den tsórt san, ar dháta an orduithe sin.
Rialacha do dhaingniú.
9.—(1) Féadfaidh an tAire, maidir le haon riail a leagfaidh coiste príntíseachta fé n-a bhráid fén Acht so, le hordú an riail sin do dhaingniú no diúltú don riail sin do dhaingniú.
(2) Pé uair a dhiúltóidh an tAire do riail a dhéanfaidh coiste príntíseachta fén Acht so do dhaingniú, ansan, i gcás gur riail an riail sin go gceangailtear ar an gcoiste príntíseachta san leis an Acht so í dhéanamh, déanfaidh an coiste príntíseachta san riail nua agus, in aon chás eile, féadfaid a leithéid do dhéanamh, agus bainfidh an t-alt so leis an riail nua san sa tslí chéanna ina mbaineann sé leis an mbun-riail.
Cruthú ar na rialacha.
10.—Féadfar fianaise prima facie ar aon rialacha dhéanfaidh coiste príntíseachta agus a daingneofar le hordú ón Aire fén Acht so do thabhairt i ngach Cúirt Bhreithiúnais agus i ngach imeacht dlí tré chóip de sna rialacha agus den ordú san do clóbhuaileadh fé mhaoirseacht no fé údarás Oifige an tSoláthair agus d'fhoillsigh Oifig an tSoláthair do thaisbeáint.
Míniú ar “fostú príntíseachta”agus ar“príntíseach.”
11.—(1) Má bhíonn rialacha aicmithe príntíseachta do rinne coiste príntíseachta i bhfeidhm de thurus na huaire, ansan, an fostú san go ndearbhuítear leis na rialacha san gur fostú príntíseachta é sa chéird ainmnithe dá mbeidh an coiste sin bunuithe beidh sé, chun crícheanna an Achta so, ina fhostú príntíseachta sa chéird sin i gceanntar an choiste sin.
(2) San Acht so cialluíonn an focal “príntíseach” duine ar fostú príntíseachta sa chéird ainmnithe agus sa cheanntar phríntíseachta gur ina dtaobh a húsáidtear an focal san.
Tréimhse phríntíseachta.
12.—(1) Má bhíonn rialacha i dtaobh na tréimhse príntíseachta do rinne coiste príntíseachta i bhfeidhm de thurus na huaire, ansan, maidir le gach duine bheidh ar fostú príntíseachta sa chéird ainmnithe dá mbeidh an coiste sin bunuithe agus san i gceanntar an choiste sin, tuigfear, más le linn na rialacha san do bheith i bhfeidhm a thosnóidh an fostú san agus d'ainneoin aon chó-aontuithe contrárdha dho san, é bheith ar fostú fé chó-aontú do shighnigh an duine sin agus a fhostóir agus tré n-a n-aontuíonn an fostóir sin an duine sin d'fhostú agus tré n-a n-aontuíonn an duine sin seirbhís do dhéanamh don fhostóir sin ar feadh na tréimhse príntíseachta luaidhtear sna rialacha san, ach féadfaidh an coiste sin, más oiriúnach leis é, an dá pháirtí do scaoileadh o sna hoblagáidí bheidh ortha fé seach fén gcó-aontú bheidh le tuiscint as an alt so, no an có-aontú san d'atharú no, le toiliú an phríntísigh, i gcás ocht mblian déag do bheith slán ag an bpríntíseach, agus, le toiliú tuismitheora an phríntísigh (más ann do), i gcás gan an t-aos san do bheith slán ag an bpríntíseach, sochar agus oblagáidí an fhostóra san fén gcó-aontú san d'aistriú go dtí fostóir eile go mbíonn an cheárd san ar siúl aige sa cheanntar san.
(2) San alt so cialluíonn an focal “tuismitheoir” maidir le príntíseach ná fuil ocht mbliana déag slán aige an té go bhfuil an príntíseach san ina choinneáil dhlíthiúil agus, i gcás gan an príntíseach san do bheith ina chomhnaí i dteanta an duine sin ná ina choinneáil toisc an duine sin do bheith ar iarraidh no ar aon réasún eile, foluíonn an focal an té gur ina theanta atá an príntíseach san ina chomhnaí no gur ina choinneáil atá an príntíseach san.
Toirmeasc ar phágh fé bhun rátaí minimum d'íoc.
13.—(1) Má bhíonn aon rialacha i dtaobh na rátaí minimum páigh do rinne coiste príntíseachta i bhfeidhm de thurus na huaire, ansan, gach fostóir go mbíonn ar siúl aige i gceanntar an choiste sin an cheárd ainmnithe dá mbeidh an coiste sin bunuithe, íocfa sé le gach príntíseach a bheidh ar fostú aige págh do réir ráta no rátaí nách lugha ná an ráta no na rátaí is iníoctha fé sna rialacha san, agus chun críche aon imeacht síbhialta chuirfidh aon phríntíseach den tsórt san ar bun i gcoinnibh an fhostóra san chun páigh do bhaint amach tuigfear connradh dleathach éifeachtúil do bheith déanta ag an bhfostóir sin págh d'íoc leis an bpríntíseach san do réir ráta no rátaí nách lugha ná an ráta no na rátaí is iníoctha fé sna rialacha san.
(2) Má theipeann ar aon fhostóir déanamh do réir an ailt seo beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air, agus ar dhéanamh an chiontuithe sin féadfaidh an chúirt a ordú don fhostóir sin pé suim a dheallróidh a bheith ag dul don duine ar fostú mar phágh d'íoc i dteanta na fíneála san agus is do réir an ráta no na rátaí minimum is iníoctha fé sna rialacha i dtaobh na rátaí minimum páigh a bhaineann leis an duine sin a háireofar an págh, ach an chomhacht chun a ordú fén bhfo-alt so go n-íocfaí págh ní bhainfe sí o aon cheart a bheidh ag an duine ar fostú chun páigh do bhaint amach tré imeachta ar bith eile.
(3) San alt so agus sa chéad alt ina dhiaidh ní fholuíonn an focal “págh” págh as aimsir bhreise.
Cuntaisí ar phágh a híoctar le príntísigh.
14.—(1) Má bhíonn aon rialacha i dtaobh na rátaí minimum páigh do rinne coiste príntíseachta i bhfeidhm de thurus na huaire, ansan, gach fostóir go mbíonn ar siúl aige i gceanntar an choiste sin an cheárd ainmnithe dá mbeidh an coiste sin bunuithe agus go mbeidh aon phríntíseach ar fostú aige sa chéird sin, beidh sé de dhualgas air cuntaisí do choimeád, ar an bpágh a híoctar agus ar an am a caithtear ag obair, pé cuntaisí is gá chun a thaisbeáint go bhfuiltear ag cólíonadh na rialacha san maidir leis an bpríntíseach san.
(2) Más rud é—
(a) go dteipfidh ar aon fhostóir na cuntaisí sin do choimeád is gá do réir an ailt seo do choimeád, no go dtabharfa sé faillí ina gcoimeád; no
(b) go gcuirfidh aon fhostóir sna cuntaisí sin, go toiliúil no tré fhaillí, aon iontráil a bheidh bréagach no míthreorach in aon phonc táchtach,
beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar sé púint do chur air agus fós, i gcás é theip air na cuntaisí sin do choimeád no é do thabhairt faillí ina gcoimeád, fíneáil ná raghaidh thar trí púint in aghaidh gach lae leanfaidh an teip no an fhaillí sin tar éis a chiontuithe.
Toirmeasc ar dhuine do choimeád ag obair ar feadh níos mó ná an líon maximum uaireanna.
15.—(1) Má bhíonn aon rialacha i dtaobh na n-uaireanna maximum oibre do rinne coiste príntíseachta i bhfeidhm de thurus na huaire, ansan, éinne (dá ngairmtear fostóir san alt so) go mbíonn ar siúl aige i gceanntar an choiste sin an cheárd ainmnithe dá mbeidh an coiste sin bunuithe, ní bheidh sé dleathach do a chur fé ndeár d'aon phríntíseach a bheidh ar fostú aige sa chéird sin ná a cheangal air obair do dhéanamh ar feadh níos mo uaireanna (lasmuich d'aimsir bhreise) aon tseachtain ná mar a bheidh curtha síos sna rialacha san.
(2) Má dheineann fostóir ar bith éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air.
Cuntaisí ar uaireanna oibre.
16.—(1) Má bhíonn aon rialacha i dtaobh na n-uaireanna maximum oibre do rinne coiste príntíseachta i bhfeidhm de thurus na huaire, ansan, gach fostóir go mbíonn ar siúl aige i gceanntar an choiste sin an cheárd ainmnithe dá mbeidh an coiste sin bunuithe agus go mbeidh aon phríntíseach ar fostú aige sa chéird sin, beidh sé de dhualgas air pé cuntaisí do choimeád is gá chun a thaisbeáint go bhfuiltear ag cólíonadh na rialacha san maidir leis an bpríntíseach san.
(2) Más rud é—
(a) go dteipfidh ar aon fhostóir na cuntaisí sin do choimeád is gá do réir an ailt seo do choimeád, no go dtabharfa sé faillí ina gcoimeád; no
(b) go gcuirfidh aon fhostóir sna cuntaisí sin, go toiliúil no tré fhaillí, aon iontráil a bheidh bréagach no míthreorach in aon phonc táchtach,
beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar sé púint do chur air agus fós, i gcás é theip air na cuntaisí sin do choimeád no é do thabhairt faillí ina gcoimeád, fíneáil ná raghaidh thar trí púint in aghaidh gach lae leanfaidh an teip no an fhaillí sin tar éis a chiontuithe.

17.—(1) Má bhíonn rialacha i dtaobh cáilíochtaí oideachais príntíseach do rinne coiste príntíseachta i bhfeidhm de thurus na huaire, ansan, éinne (dá ngairmtear fostóir san alt so) go mbíonn ar siúl aige i gceanntar an choiste sin an cheárd ainmnithe dá mbeidh an coiste sin bunuithe, ní bheidh sé dleathach do duine ar bith do ghlacadh ar fostú príntíseachta sa chéird sin mara mbeidh ag an duine sin na cáilíochtaí oideachais a bheidh curtha síos sna rialacha san.
(2) Má dheineann fostóir duine ar bith do ghlacadh ar fostú príntíseachta contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air.
Toirmeasc ar dhuine fé bhun na haoise orduithe do ghlacadh mar phríntíseach.
18.—(1) Má bhíonn rialacha i dtaobh aois tosnuithe na príntíseachta do rinne coiste príntíseachta i bhfeidhm de thurus na huaire, ansan, éinne (dá ngairmtear fostóir san alt so) go mbíonn ar siúl aige i gceanntar an choiste sin an cheárd ainmnithe dá mbeidh an coiste sin bunuithe, ní bheidh sé dleathach do duine ar bith do ghlacadh ar fostú príntíseachta mara mbeidh an duine sin laistigh de sna teoranna aoise bheidh luaidhte sna rialacha san.
(2) Má dheineann fostóir duine ar bith do ghlacadh ar fostú príntíseachta contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air.
Fostóirí do mhúineadh na bpríntíseach.
19.—(1) Má bhíonn rialacha i dtaobh oiliúna príntíseach do rinne coiste príntíseachta i bhfeidhm de thurus na huaire, ansan, gach fostóir go mbíonn ar siúl aige i gceanntar an choiste sin an cheárd ainmnithe dá mbeidh an coiste sin bunuithe agus go mbeidh aon phríntíseach ar fostú aige sa chéird sin sa cheanntar san beidh sé de dhualgas air déanamh do réir na bhforálacha san de sna rialacha san a bhaineann leis an bpríntíseach san.
(2) Má theipeann ar aon fhostóir den tsórt san déanamh do réir an ailt seo no má thugann sé faillí i ndéanamh do réir an ailt seo beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air.

20.—(1) Má bhíonn aon rialacha i dtaobh líon na bpríntíseach do rinne coiste príntíseachta i bhfeidhm de thurus na huaire agus go mbeidh riail-líon socair leis na rialacha san maidir le haon fhostóir áirithe, ní bheidh sé dleathach don fhostóir sin duine ar bith do ghlacadh ar fostú príntíseachta i gceanntar an choiste sin sa chéird dá mbeidh an coiste sin bunuithe maran rud é—
(a) ná beidh duine ar bith ar fostú ag an bhfostóir sin an uair sin mar phríntíseach sa chéird sin sa cheanntar san no gur lugha ná an riail-líon san an líon daoine bheidh ar fostú amhlaidh an uair sin; agus
(b) go dtiocfadh as an duine sin do ghlacadh ar fostú amhlaidh an líon iomlán de phríntísigh a bheidh ar fostú ag an bhfostóir sin amhlaidh do dhéanamh cóionann leis an riail-líon san.
(2) Má dheineann aon fhostóir den tsórt san duine ar bith do ghlacadh ar fostú príntíseachta contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air.
Oblagáid ar fhostóir príntísigh d'fhostú.
21.—(1) Más rud é go mbeidh aon rialacha i dtaobh líon na bpríntíseach do rinne coiste príntíseachta i bhfeidhm de thurus na huaire agus go mbeidh riail-líon socair leis na rialacha san maidir le haon fhostóir áirithe, ansan, má bhíonn agus pé uair a bheidh an fostóir sin gan aon phríntíseach no gan ach líon príntíseach is lugha ná an riail-líon san ar fostú aige i gceanntar an choiste sin sa chéird dá mbeidh an coiste sin bunuithe, féadfaidh an coiste sin ordú do dhéanamh sa bhfuirm orduithe á cheangal air oiread daoine do ghlacadh ar fostú príntíseachta sa cheanntar san sa chéird sin agus dhéanfaidh an líon iomlán de phríntísigh ar fostú aige sa cheanntar san sa chéird sin có-ionann leis an riail-líon san.
(2) Pé uair a déanfar ordú go cuibhe fén bhfo-alt san roimhe seo maidir le fostóir agus a seirbheálfar an t-ordú san ar an bhfostóir sin féin, beidh sé de dhualgas ar an bhfostóir sin déanamh do réir an orduithe sin laistigh de mhí tar éis na seirbheála san, agus má theipeann san air beidh sé ciontach i gcionta fén alt so, mara gcuire sé ina luighe ar an gCúirt gur chúis éigin dhó-sheachanta fé ndeár an teip sin, agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air.

22.—(1) Má bhíonn rialacha i dtaobh prémium príntíseachta do rinne coiste príntíseachta i bhfeidhm de thurus na huaire beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) má thoirmeascann na rialacha san prémium príntíseachta do thógaint alos duine do bheith ar fostú príntíseachta sa chéird ainmnithe dá mbeidh an coiste sin bunuithe i gceanntar an choiste sin, ansan ní bheidh sé dleathach d'éinne (dá ngairmtear fostóir san alt so) go mbíonn an cheárd san ar siúl aige sa cheanntar san prémium príntíseachta do thógaint ná do ghlacadh alos na fostaíochta san; agus
(b) má cheaduíonn na rialacha san prémium príntíseachta do thógaint alos na fostaíochta san, ansan ní bheidh sé dleathach d'fhostóir prémium príntíseachta is mó ná an prémium príntíseachta socruítear leis na rialacha san do thógaint ná do ghlacadh alos na fostaíochta san.
(2) Má dheineann fostóir ar bith go mbíonn ar siúl aige i gceanntar coiste príntíseachta an cheárd ainmnithe dá mbeidh an coiste sin bunuithe prémium príntíseachta ar bith do thógaint no do ghlacadh contrárdha don alt so, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air, agus ar dhéanamh an chiontuithe sin féadfaidh an chúirt a ordú don fhostóir sin íoc do dhéanamh leis an té d'íoc an prémium príntíseachta san i suim is có-ionann le méid an phrémium phríntíseachta tógadh no glacadh amhlaidh, i gcás ina dtoirmeascann rialacha i dtaobh prémium príntíseachta do rinne an coiste sin prémium príntíseachta ar bith do thógaint, agus, i gcás ina gceaduíonn rialacha i dtaobh prémium príntíseachta do rinne an coiste sin prémium príntíseachta do thógaint, i suim is có-ionann leis an méid atá an prémium príntíseachta tógadh no glacadh amhlaidh de bhreis ar an bprémium príntíseachta socruítear leis na rialacha san.

23.—(1) Má bhíonn aon rialacha i dtaobh na rátaí minimum páigh aimsire breise do rinne coiste príntíseachta i bhfeidhm de thurus na huaire, ansan, gach fostóir go mbíonn ar siúl aige i gceanntar an choiste sin an cheárd ainmnithe dá mbeidh an coiste sin bunuithe, íocfa sé le gach príntíseach a bheidh ar fostú aige ar aimsir bhreise págh aimsire breise do réir ráta no rátaí nách lugha ná an ráta no na rátaí is iníoctha fé sna rialacha san agus chun críche imeacht síbhialta chuirfidh aon phríntíseach den tsórt san ar bun chun páigh aimsire breise do bhaint amach tuigfear connradh dleathach éifeachtúil do bheith déanta ag an bhfostóir sin págh aimsire breise d'íoc leis an bpríntíseach san do réir ráta no rátaí nách lugha ná an ráta no na rátaí is iníoctha fé sna rialacha san pé uair a bheidh an príntíseach san ar fostú ar aimsir bhreise.
(2) Má theipeann ar aon fhostóir déanamh do réir an ailt seo beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air agus ar dhéanamh an chiontuithe sin féadfaidh an chúirt a ordú don fhostóir sin, pé suim a dheallróidh a bheith ag dul don duine ar fostú mar phágh aimsire breise d'íoc i dteanta na fíneála san agus is do réir an ráta no na rátaí minimum is iníoctha leis an duine sin fé sna rialacha i dtaobh na rátaí minimum páigh aimsire breise bhaineann leis an duine sin a háireofar an págh aimsire breise, ach an chomhacht chun a ordú fén bhfo-alt so go n-íocfaí págh aimsire breise ní bhainfe sí o aon cheart a bheidh ag an duine ar fostú chun an pháigh sin do bhaint amach tré imeachta ar bith eile.

24.—(1) Má bhíonn aon rialacha i dtaobh na rátaí minimum páigh aimsire breise do rinne coiste príntíseachta i bhfeidhm de thurus na huaire, ansan, gach fostóir go mbíonn ar siúl aige i gceanntar an choiste sin an cheárd ainmnithe dá mbeidh an coiste sin bunuithe agus go mbeidh aon phríntíseach ar fostú aige sa chéird sin, beidh sé de dhualgas air cuntaisí do choimeád ar an bpágh aimsire breise a híoctar agus ar an am a caithtear ag obair ar aimsir bhreise, pé cuntaisí is gá chun a thaisbeáint go bhfuiltear ag cólíonadh na rialacha san maidir leis an bpríntíseach san.
(2) Más rud é—
(a) go dteipfidh ar aon fhostóir na cuntaisí sin do choimeád is gá do réir an ailt seo do choimeád, no go dtabharfa sé faillí ina gcoimeád; no

25.—(1) Má bhíonn aon rialacha do rinne coiste príntíseachta fén Acht so i bhfeidhm de thurus na huaire ní bheidh sé dleathach do dhuine ar bith aon ghníomh ná ní do dhéanamh chun bac no cosc no toirmeasc do chur ar fhostóir, go mbíonn ar siúl aige i gceanntar an choiste sin an cheárd ainmnithe dá mbeidh an coiste sin bunuithe, déanamh do réir na rialacha san.
(2) Má dheineann duine ar bith éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air.
Oideachas príntíseach.
26.—(1) Féadfaidh coiste príntíseachta cúis do phlé leis an Aire Oideachais d'fhonn go ndéanfadh an coiste oideachais ghairme beatha go bhfuil a líomatáiste feidhmiúcháin có-theoranta le ceanntar an choiste phríntíseachta san no ina chuid de, no gur cuid dá líomatáiste feidhmiúcháin an ceanntar san, cúrsaí teagaisc i bhfuirm cheárd-oideachais do chur ar bun, cúrsaí de shaghas a bheidh oiriúnach do phríntísigh a bheidh ag gabháil don chéird ainmnithe dá mbeidh an coiste príntíseachta san bunuithe, agus más dóich leis an Aire sin, tar éis do gach taobh den scéal do bhreithniú, gur cheart géilleadh don chúis sin a pléidheadh no d'aon chuid di, féadfa sé an chúis sin do chur chun an choiste oideachais ghairme beatha san chun í do bhreithniú.
(2) I gcás cúrsa teagaisc i bhfuirm cheárd-oideachais a chur coiste oideachais ghairme beatha ar bun do bheith le fáil ag aon phríntíseach a bheidh ar fostú i gceanntar príntíseachta i gcéird ainmnithe agus an cúrsa san do bheith ar siúl le linn gnáthuaireanna oibre an phríntísigh sin agus in áit a bheidh laistigh de thrí mhíle ón áitreabh ina mbeidh an príntíseach san ar fostú amhlaidh, ar n-a dtomhas do réir na slí is giorra is féidir don phríntíseach san do ghabháil go dleathach agus gan ceataí dho féin, féadfaidh an coiste príntíseachta don cheanntar san chun crícheanna na céirde sin, más oiriúnach leo é, ordú (dá ngairmtear ordú freastail san alt so) do dhéanamh sa bhfuirm orduithe á cheangal ar an bpríntíseach san an cúrsa san do fhreastal.
(3) Pé uair a déanfar ordú freastail go cuibhe maidir le príntíseach agus a seirbheálfar an t-ordú san ar an bpríntíseach san féin, beidh sé de dhualgas ar an bpríntíseach san déanamh do réir an orduithe sin agus má theipeann san air beidh sé ciontach i gcionta fén alt so mara gcuire sé ina luighe ar an gCúirt gur bhreoiteacht no cúis dho-sheachanta eile fé ndeár an teip sin.
(4) Pé uair a déanfar ordú freastail go cuibhe maidir le príntíseach agus a seirbheálfar an t-ordú san ar fhostóir an phríntísigh sin féin, ansan, má bhíonn an príntíseach san ag freastal an chúrsa teagaisc a cheanglann an t-ordú san air do fhreastal, no más mian leis é do fhreastal, beidh sé de dhualgas ar an bhfostóir sin am agus saoire do thabhairt don phríntíseach san chun an chúrsa teagaisc sin do fhreastal gan éinní do bhaint o n-a phágh ná do chur leis na huaireanna fostaíochta ná gan an t-am san d'áireamh mar am caillte, agus má theipeann ar an bhfostóir sin déanamh do réir a n-éilítear leis an bhfo-alt so no má thugann sé faillí sa ní sin beidh sé ciontach i gcionta fén alt so.
(5) Gach éinne bheidh ciontach i gcionta fén alt so dlighfear, ar a chiontú ann ar an slí achmair, fíneáil ná raghaidh thar fiche scilling do chur air má sé an chéad chionta aige é agus fíneáil ná raghaidh thar dachad scilling má sé an dara cionta aige é no aon chionta ina dhiaidh sin.
(6) Aon táillí bheidh iníoctha ag príntíseach le coiste oideachais ghairme beatha maidir le cúrsa teagaisc a bheidh aige á fhreastal de bhuadh orduithe fhreastail déanfaidh an coiste príntíseachta do rinne an t-ordú san iad d'íoc thar ceann an phríntísigh sin.
Feidhmeanna eile coistí príntíseachta.
27.—(1) Cuirfidh gach coiste príntíseachta fiosrúchán ar siúl i dtaobh aon aighnis eireoidh idir fostóir go mbíonn ar siúl aige i gceanntar an choiste sin an cheárd ainmnithe dá mbeidh an coiste sin bunuithe agus aon phríntíseach a bheidh ar fostú aige sa chéird sin sa cheanntar san agus a chuirfidh an fostóir no an príntíseach san fé bhráid an choiste sin agus féachfaidh le haon aighneas go ndéanfar fiosrúchán ina thaobh amhlaidh do shocrú agus bhéarfaidh tuarasgabháil don Aire ar thoradh an fhiosrúcháin sin.
(2) Bhéarfaidh gach coiste príntíseachta tuarasgabháil don Aire ar éinní bhaineann le príntíseacht sa chéird ainmnithe dá mbeidh an coiste sin bunuithe agus a chuirfidh an tAire fé n-a mbráid chun a dtuarasgabhála d'fháil air.
Fógra i dtaobh duine do ghlacadh ar fostú príntíseachta.
28.—(1) Gach fostóir go mbíonn ar siúl aige i gceanntar choiste phríntíseachta an cheárd ainmnithe dá mbeidh an coiste sin bunuithe agus a ghlacfaidh éinne ar fostú príntíseachta sa chéird sin sa cheanntar san déanfa sé, laistigh de dhá sheachtain tar éis an duine sin do ghlacadh ar fostú amhlaidh, an t-eolas orduithe i dtaobh an duine sin do chur chun an choiste phríntíseachta san.
(2) Má theipeann ar aon fhostóir den tsórt san déanamh do réir an ailt seo no má thugann sé faillí sa ní sin beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air agus, i gcás cionta leanúnaigh, fíneáil bhreise de dheich bpúint in aghaidh gach lae leanfar den chionta.
Fógra go bhfuil deireadh le príntíseacht.
29.—(1) Gach fostóir go mbíonn ar siúl aige i gceanntar choiste phríntíseachta an cheárd ainmnithe dá mbeidh an coiste sin bunuithe agus a scuirfidh d'éinne do bheith ar fostú príntíseachta aige sa chéird sin sa cheanntar san, déanfa sé, laistigh de dhá sheachtain tar éis scur den duine sin do bheith ar fostú aige amhlaidh, an t-eolas orduithe i dtaobh an duine sin do chur chun an choiste phríntíseachta san.
(2) Má theipeann ar aon fhostóir den tsórt san déanamh do réir an ailt seo no má thugann sé faillí sa ní sin beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air agus, i gcás cionta leanúnaigh, fíneáil bhreise de dheich bpúint in aghaidh gach lae leanfar den chionta san.
Clár de phríntísigh.
30.—(1) Cuirfidh gach coiste príntíseachta fé ndeár clár dá ngairmfear an clár de phríntísigh do choimeád.
(2) Cuirfidh gach coiste príntíseachta fé ndeár go n-iontrálfar sa chlár de phríntísigh a bheidh á choimeád acu eolas ar na daoine glacfar ar fostú príntíseachta no scuirfidh de bheith ar fostú príntíseachta sa chéird ainmnithe dá mbeidh an coiste sin bunuithe agus i gceanntar an choiste sin, an t-eolas a chuirfidh fostóirí na ndaoine sin chucha do réir an Achta so.
(3) Gach clár de phríntísigh a bheidh á choimeád ag coiste príntíseachta beidh sé ar nochtadh gach tráth réasúnta le hiniúchadh ag oifigeach údaruithe agus fós ag éinne go mbíonn ar siúl aige i gceanntar an choiste sin an cheárd ainmnithe dá mbeidh an coiste sin bunuithe.
Ceart éisteachta ag cruinnithe de choistí príntíseachta.
31.—(1) Beidh teideal ag oifigeach údaruithe bheith i láthair ag aon chruinniú de choiste phríntíseachta agus labhairt leis an gcruinniú san ach ní bheidh teideal aige vóta do thabhairt ar éinní bheidh le socrú ag an gcruinniú san.
(2) Beidh ag oifigeach don Aire Oideachais go n-údarás chuige sin i scríbhinn ón Aire sin teideal bheith i láthair ag aon chruinniú de choiste phríntíseachta agus labhairt leis an gcruinniú san ach ní bheidh teideal aige vóta do thabhairt ar éinní bheidh le socrú ag an gcruinniú san.
Fostóirí do thabhairt eolais uatha.
32.—(1) Gach éinne go mbíonn ceárd ainmnithe ar siúl aige déanfa sé, má ceangailtear air é le fógra i scríbhinn sa bhfuirm orduithe sheirbheálfaidh oifigeach údaruithe air no fhágfa sé dho ag a áit ghnótha, an t-eolas a luadhfar sa bhfógra san, i dtaobh gach príntísigh no aon phríntísigh áirithe bheidh ar fostú aige, do thabhairt don oifigeach san laistigh den am agus sa tslí luadhfar sa bhfógra san.
(2) Gach éinne go mbíonn ceárd ainmnithe ar siúl aige agus go dteipfidh air gach colas no aon eolas do thabhairt uaidh do réir an ailt seo a ceanglófar air go cuibhe fén alt so do thabhairt uaidh amhlaidh no do bhéarfaidh uaidh amhlaidh aon eolas den tsórt san is eol do a bheith bréagach no mí-threorach in aon phonc táchtach, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche scilling do chur air.
Comhachta breise oifigeach údaruithe.
33.—(1) Féadfaidh oifigeach údaruithe gach ní no éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) dul isteach gach tráth réasúnta in aon áitreabh ina mbíonn ceárd ainmnithe ar siúl má bhíonn cúis réasúnta aige chun a chreidiúint go bhfuil éinne ar fostú san áitreabh san;

34.—Bhéarfaidh an tAire do gach oifigeach údaruithe deimhniú sa bhfuirm orduithe á rá go bhfuil sé ceaptha mar oifigeach údaruithe den tsórt san agus nuair a bheidh an t-oifigeach san ag feidhmiú aon chomhachta dá mbronntar air leis an Acht so, déanfa sé, má ceangailtear air é, an deimhniú san do thaisbeáint d'éinne le n-a mbaineann sé.
Ciontaí do chúiseamh.
35.—(1) Ní dhéanfaidh éinne ach an tAire no oifigeach údaruithe no duine éigin le cead o cheachtar acu san imeachta do bhunú mar gheall ar chionta fén Acht so.
(2) Féadfaidh an tAire no oifigeach údaruithe no féadfar ar agra ceachtar acu mar chúisitheoir gach cionta fén Acht so do chúiseamh.

36.—(1) Déanfaidh an tAire rialacháin mar gheall ar an bhfógra bheidh le tabhairt i dtaobh éinní fén Acht so, d'fhonn an ní go mbeidh fógra le tabhairt ina thaobh do chur in úil chó fada agus is féidir é do dhaoine le n-a mbaineann sé i gceanntair phríntíseachta.

APPRENTICESHIP ACT, 1931.
Definitions.
1.—In this Act—
the expression “the Minister” means the Minister for Industry and Commerce;
the word “trade” includes any industry, occupation, or business, and also includes any distinct branch of a trade;
the expression “trade-board” means a trade-board established under the Trade Boards Acts, 1909 and 1918;
the expression “trade-board trade” means a trade in respect of which a trade-board is for the time being in existence;
the expression “non-trade-board trade” means a trade which is not a trade-board trade;
the expression “district trade committee” means a district trade committee established by a trade-board under the Trade Boards Acts, 1909 and 1918;
the expression “designated trade” means a trade which is for the time being declared under this Act to be a designated trade for the purposes of this Act, references to the carrying on of a designated trade shall, in the case of a trade which is a designated trade in part only of Saorstát Eireann, be construed as referring only to the carrying on of such trade in that part of Saorstát Eireann;
the expression “authorised officer” includes any person authorised in writing (either generally or for a special purpose) by the Minister to exercise all or any of the powers and perform all or any of the duties conferred or imposed on an authorised officer under this Act;
the word “prescribed” means prescribed by regulations made by the Minister under this Act.
Designated trades.
2.—(1) Subject to the provisions of this section, the Minister may by order (in this Act referred to as a special order) do any of the following things, that is to say:—
(a) declare any particular trade to be a designated trade for the purposes of this Act either throughout Saor-stát Eireann or in any specified part of Saorstát Eireann; or
(b) revoke or amend any order previously made by him under this sub-section.
(2) Every special order shall be made under and in accordance with the rules contained in the Schedule to this Act and those rules shall regulate the procedure to be followed in making such orders.
(3) Every special order shall be published in the Iris Oifigiúil and also in such other manner as the Minister shall consider to be the best adapted for bringing such special order to the notice of persons affected thereby.
(4) Every special order shall come into operation on such date, subsequent to the publication of such order in the Iris Oifigiúil as is specified in that behalf in such order or, where no such date is so specified, on the date of such publication.
(5) Every special order shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution is passed by either such House within the next subsequent twenty one days on which such House has sat after such order is laid before it annulling such order, such order shall be annulled accordingly but without prejudice to the validity of anything previously done under such order.
Apprenticeship districts and apprenticeship committees.
3.—(1) Whenever the Minister makes a special order declaring a trade to be a designated trade in any area (whether such area does or does not extend to the whole of Saorstát Eireann) the following provisions shall have effect, that is to say:—
(a) the Minister shall by another order forthwith either constitute such area to be an apprenticeship district for the purposes of such designated trade or divide such area into two or more apprenticeship districts for the purposes of such designated trade;
(b) there shall be established and maintained in every such apprenticeship district an apprenticeship committee for such designated trade to perform in such district and in relation to such trade the functions assigned by this Act to apprenticeship committees.
(2) Before making an order under this section constituting an area to be an apprenticeship district or dividing an area into two or more apprenticeship districts for the purposes of a designated trade which is a trade-board trade, the Minister shall consult the trade-board for such trade.
(3) References in this Act to the district of an apprenticeship committee shall be construed as referring to the apprenticeship district in which such committee is established by this section.
Constitution of apprenticeship committees.
4.—(1) The following provisions shall have effect in relation to every apprenticeship committee which is established by this Act for a designated trade which is a non-trade-board trade, that is to say:—
(a) such committee shall consist of—
(i) members (in this Act referred to as representative members) representing in equal proportions employers and employees engaged in such trade in such district, and
(ii) unless it is otherwise prescribed, members (in this Act referred to as appointed members) appointed by the Minister;
(b) the number of representative members shall be such even number as shall be prescribed and the number of appointed members (if any) shall be such number, not exceeding three, as shall be prescribed;
(c) the time and method of selection of representative members shall be such as shall be prescribed;
(d) the members of such committee shall hold office for such term as may be prescribed.
(2) Save as is otherwise provided by this section, the following provisions shall have effect in relation to every apprenticeship committee established by this Act for a designated trade which is a trade-board trade, that is to say:—
(a) such committee shall consist of—
(i) ex-officio members, and
(ii) unless it is otherwise prescribed, members (in this Act referred to as appointed members) appointed by the Minister;
(b) the ex-officio members of such committee shall—
(i) where such district is co-terminous with Saorstát Eireann, be the persons who for the time being are the representative members within the meaning of the Trade Boards Act, 1909, of the trade-board for such trade, and
(ii) where such district is part only of Saorstát Eireann and is co-terminous with the functional area of the district trade committee (if any) of the trade-board for such trade, be the persons (other than a person or persons appointed by the Minister under the Trade Boards Act, 1909, to be a member or members of such trade-board) who for the time being are the members of such district trade committee;
(c) the number of appointed members (if any) shall be such number, not exceeding three, as shall be prescribed;
(d) the appointed members (if any) shall hold office for such term as may be prescribed.
(3) Where the apprenticeship district of an apprenticeship committee for a trade-board trade is part only of Saorstát Eireann and there is for the time being no district trade committee for such trade whose functional area is co-terminous with such district, the apprenticeship committee for such district shall be constituted under this section in all respects as if such trade were a non-trade-board trade and shall continue to be so constituted unless and until such a district trade committee is established.
(4) The Minister may by regulations make provision for any matter or thing relating to the constitution of apprenticeship committees or of any class of such committees which is not provided for by this section, and may by such regulations make different such provision in respect of different classes of such committees.
Chairman and secretary of apprenticeship committees.
5.—(1) The chairman of every apprenticeship committee shall be such member of such committee as the Minister may appoint and shall hold office during the pleasure of the Minister.
(2) The secretary of every apprenticeship committee shall be appointed by the Minister, and every such secretary shall hold office on such terms and on such conditions and shall receive such remuneration and allowances as the Minister, with the sanction of the Minister for Finance, shall appoint.
Procedure at meetings of apprenticeship committees.
6.—(1) The quorum for a meeting of an apprenticeship committee shall be one-third of the whole number of (as the case may be) the representative members or the ex-officio members of such committee and, if such committee includes any appointed members, one appointed member of such committee.
(2) At a meeting of an apprenticeship committee—
(a) the chairman of such committee shall, if he is present, be chairman of the meeting;
(b) if the chairman of such committee is not present, or the office of chairman is vacant, the members of the committee who are present shall choose one of their number to be chairman of the meeting.
(3) The proceedings of an apprenticeship committee shall not be invalidated by any vacancy in the membership of such committee or by any defect in the appointment, election or nomination of any member thereof.
(4) Subject to the provisions of this Act, the Minister may by regulations made by him under this Act prescribe the procedure to be observed at meetings of apprenticeship committees.
Reports and returns by apprenticeship committee.
7.—Every apprenticeship committee shall make to the Minister such reports and returns and furnish to the Minister such information as he may from time to time require.
Rules by apprenticeship committees.
8.—(1) Every apprenticeship committee shall make the following rules, that is to say:—
(a) rules (in this Act referred to as apprenticeship classification rules) declaring that employment in the designated trade for which such committee is established of any specified class of persons in any specified manner shall constitute employment by way of apprenticeship in such trade;
(b) rules (in this Act referred to as rules regulating the period of apprenticeship) in relation to the period (including any probationary period) of employment by way of apprenticeship in such trade in the district of such committee;
(c) rules (in this Act referred to as rules regulating the minimum rates of wages) in relation to the minimum rates of wages (other than wages for overtime) to be paid to persons employed by way of apprenticeship in such trade in such district;
(d) rules (in this Act referred to as rules regulating the maximum hours of work) in relation to the maximum number of hours (exclusive of overtime) which may be worked in any week by persons employed by way of apprenticeship in such trade in such district, but not so as to increase the maximum number of such hours appointed by or under any other enactment.
(2) Every apprenticeship committee may make all or any of the following rules, that is to say:—
(a) rules (in this Act referred to as rules regulating the educational qualifications of apprentices) in relation to the educational qualifications of persons entering on employment by way of apprenticeship in the designated trade for which such committee is established with persons carrying on such trade in the district of such committee;
(b) rules (in this Act referred to as rules regulating the age of entry on apprenticeship) in relation to the age limits within which employment by way of apprenticeship may commence in such trade in such district;
(c) rules (in this Act referred to as rules regulating the training of apprentices) requiring employers carrying on such trade in such district to train and instruct apprentices employed by them in a specified manner;
(d) rules (in this Act referred to as rules regulating the number of apprentices) fixing in relation to any specified employer carrying on such trade in such district the number (in this Act referred to as the standard number) of apprentices whom such committee considers should be employed by such employer in such trade in such district, and such number may, if such apprenticeship committee thinks fit, be expressed as a proportion of the number of persons of any class or classes employed from time to time in such trade in such district by such employer;
(e) rules (in this Act referred to as rules regulating apprenticeship premiums) either—
(i) prohibiting the taking of any fee, premium, or other consideration (in this Act referred to as an apprenticeship premium) in respect of the employment of a person by way of apprenticeship in such trade in such district, or
(ii) permitting the taking of an apprenticeship premium in respect of such employment and fixing the amount of such apprenticeship premium;
(f) rules (in this Act referred to as rules regulating the minimum rates of overtime wages) in relation to the minimum rates of wages for overtime to be paid to persons employed by way of apprenticeship in such trade in such district.
(3) An apprenticeship committee may from time to time by rules made under this section rescind, amend, or add to any rules previously made by them under this section and for the time being in force.
(4) An apprenticeship committee shall not make any rules under this section unless and until one month's notice of the intention to make such rules has been given in accordance with regulations made by the Minister and until they have considered any representations made in relation to such rules received before the expiration of the said period.
(5) Every rule made by an apprenticeship committee under this section shall be submitted to the Minister as soon as may be after it is made and no such rule shall be of any force or effect unless or until it is confirmed by order of the Minister, but on being so confirmed shall come into force on such date (not earlier than the date of such order) as shall be specified in that behalf in such order or, if no such date is so specified, on the date of such order.
Confirmation of rules.
9.—(1) The Minister may, in respect of any rule submitted to him by an apprenticeship committee under this Act, either by order confirm such rule or refuse to confirm such rule.
(2) Whenever the Minister refuses to confirm a rule made by an apprenticeship committee under this Act, such apprenticeship committee shall, in case such rule is a rule which such apprenticeship committee is required by this Act to make, and may, in any other case, make a new rule and this section shall apply to such new rule in like manner as it applies to the original rule.
Proof of rules.
10.—Prima facie evidence of any rules made by an apprenticeship committee and confirmed by order of the Minister under this Act may be given in all Courts of Justice and in all legal proceedings by the production of a copy of such rules and order printed under the superintendence or authority of and published by the Stationery Office.
Definition of “employment by way of apprenticeship” and “apprentice.”
11.—(1) Where apprenticeship classification rules made by an apprenticeship committee are for the time being in force such employment as is declared by such rules to constitute employment by way of apprenticeship in the designated trade for which such committee is established shall for the purposes of this Act be employment by way of apprenticeship in that trade in the district of that committee.
(2) In this Act the word “apprentice” means a person employed by way of apprenticeship in the designated trade and in the apprenticeship district in relation to which the said word is used.
Period of apprenticeship.
12.—(1) Where rules regulating the period of apprenticeship made by an apprenticeship committee are for the time being in force, every person who is employed by way of apprenticeship in the designated trade for which such committee is established and in the district of such committee shall, where such employment commences while such rules are in force and notwithstanding any agreement to the contrary, be deemed to be employed under an agreement signed by such person and his employer whereby such employer agrees to employ such person and such person agrees to serve such employer for the period of apprenticeship specified in such rules, but such committee may, if it so thinks fit, release both parties from their respective obligations under the agreement implied by this section or modify such agreement or with the consent of, in case the apprentice has attained the age of eighteen years, the apprentice, and, in case the apprentice has not attained such age, the parent (if any) of the apprentice transfer the benefits and obligations of such employer under such agreement to another employer carrying on in such district such trade.
(2) In this section the expression “parent” in relation to an apprentice who has not attained the age of eighteen years means the individual having the legal custody of such apprentice and, where owing to the absence of such individual or for any other reason such apprentice is not living with or in the actual custody of such individual, includes the individual with whom such apprentice is living or in whose actual custody such apprentice is.
Prohibition of payments of wages below minimum rates.
13.—(1) Where any rules regulating the minimum rates of wages made by an apprenticeship committee are for the time being in force, every employer carrying on in the district of such committee the designated trade for which such committee is established shall pay to every apprentice employed by him wages at not less than the rate or rates payable under such rules, and for the purpose of any civil proceedings by any such apprentice against such employer to recover wages there shall be deemed to be a valid and effective contract by such employer to pay to such apprentice wages at a rate or rates not less than the rate or rates payable under such rules.
(2) If any employer fails to comply with this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds, and on such conviction the court may order such employer to pay, in addition to such fine, such sum as appears to be due to the person employed on account of wages, the wages being calculated on the basis of the minimum rate or rates payable under the rules regulating the minimum rates of wages applicable to such person, but the power to order payment of wages under this sub-section shall not be in derogation of any right of the person employed to recover wages by any other proceedings.
(3) In this and the next succeeding section the word “wages” does not include wages for overtime.
Records of wages paid to apprentices.
14.—(1) Where any rules regulating the minimum rates of wages made by an apprenticeship committee are for the time being in force, it shall be the duty of every employer who carries on in the district of such committee the designated trade for which such committee is established and employs any apprentice in such trade to keep such records of wages paid and time worked as are necessary to show that such rules are being complied with in relation to such apprentice.
(2) If any employer—
(a) fails or neglects to keep such records as are required by this section to be kept; or
(b) wilfully or negligently makes in such records any entry which is false or misleading in any material particular,
he shall be guilty of an offence under this section and be liable on summary conviction thereof to a fine not exceeding six pounds and also, in case of failure or neglect to keep such records, to a fine not exceeding three pounds for every day during which such failure or neglect continues after conviction.
Prohibition of employment above maximum number of hours.
15.—(1) Where any rules regulating the maximum hours of work made by an apprenticeship committee are for the time being in force, it shall not be lawful for any person (in this section referred to as an employer) carrying on in the district of such committee the designated trade for which such committee is established to cause or require any apprentice employed by him in such trade to work for a greater number of hours (exclusive of overtime) in any week than the number laid down in such rules.
(2) If any employer acts in contravention of this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
Records of hours of work.
16.—(1) Where any rules regulating the maximum hours of work made by an apprenticeship committee are for the time being in force, it shall be the duty of every employer who carries on in the district of such committee the designated trade for which such committee is established and who employs any apprentice in such trade to keep such records as are necessary to show that such rules are being complied with in relation to such apprentice.
(2) If any employer—
(a) fails or neglects to keep such records as are required by this section to be kept; or
(b) wilfully or negligently makes in such records any entry which is false or misleading in any material particular,
he shall be guilty of an offence under this section and be liable on summary conviction thereof to a fine not exceeding six pounds and also, in case of failure or neglect to keep such records, to a fine not exceeding three pounds for every day during which such failure or neglect continues after conviction.
Prohibition of apprenticeship of person not possessing prescribed educational qualifications.
17.—(1) Where rules regulating the educational qualifications of apprentices made by an apprenticeship committee are for the time being in force, it shall not be lawful for any person (in this section referred to as an employer) carrying on in the district of such committee the designated trade for which such committee is established to employ by way of apprenticeship in such trade any person unless such person possesses the educational qualifications laid down in such rules.
(2) If an employer employs by way of apprenticeship any person in contravention of this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
Prohibition of apprenticeship of person under prescribed age.
18.—(1) Where rules regulating the age of entry on apprenticeship made by an apprenticeship committee are for the time being in force, it shall not be lawful for any person (in this section referred to as an employer) carrying on in the district of such committee the designated trade for which such committee is established to employ by way of apprenticeship any person unless such person is within the age limits specified in such rules.
(2) If an employer employs by way of apprenticeship any person in contravention of this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
Instruction of apprentices by employers.
19.—(1) Where rules regulating the training of apprentices made by an apprenticeship committee are for the time being in force, it shall be the duty of every employer who carries on in the district of such committee the designated trade for which such committee is established and who employs any apprentice in such trade in such district to comply with such of the provisions of such rules as are applicable to such apprentice.
(2) If any such employer fails or neglects to comply with this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
Restriction on number of apprentices.
20.—(1) Where any rules regulating the number of apprentices made by an apprenticeship committee are for the time being in force and such rules fix a standard number in relation to any specified employer, it shall not be lawful for such employer to take into his employment by way of apprenticeship in the district of such committee in the trade for which such committee is established any person unless—
(a) either no person is then employed by such employer as an apprentice in such trade in such district or the number of persons then so employed is less than such standard number; and
(b) such taking into employment would have the effect of making the total number of apprentices so employed by him equal to such standard number.
(2) If any such employer employs by way of apprenticeship any person in contravention of this section he shall be guilty of an offence under this section and be liable on summary conviction thereof to a fine not exceeding ten pounds.
Obligation to employ apprentices.
21. (1) Where any rules regulating the number of apprentices made by an apprenticeship committee are for the time being in force and such rules fix a standard number in relation to any specified employer, if and whenever such employer employs in the district of such committee in the trade for which such committee is established either no apprentice or a number of apprentices less than such standard number, such committee may make an order in the prescribed form requiring him to take into his employment by way of apprenticeship in such district in such trade such number of persons as will make the total number of apprentices employed by him in such district in such trade equal to such standard number.
(2) Whenever an order is duly made under the foregoing sub-section in relation to an employer and such order is personally served on such employer, it shall be the duty of such employer to comply with such order within one month after such service, and if he fails so to do he shall, unless he satisfies the Court that such failure was due to some unavoidable cause, be guilty of an offence under this section and be liable on summary conviction thereof to a fine not exceeding ten pounds.
Restriction on taking apprenticeship premiums.
22.—(1) Where rules regulating apprenticeship premiums made by an apprenticeship committee are for the time being in force the following provisions shall have effect, that is to say:—
(a) if such rules prohibit the taking of an apprenticeship premium in respect of the employment of a person by way of apprenticeship in the designated trade for which such committee is established in the district of such committee, then it shall not be lawful for any person (in this section referred to as an employer) carrying on in such district such trade to take or receive in respect of such employment an apprenticeship premium; and
(b) if such rules permit the taking of an apprenticeship premium in respect of such employment, then it shall not be lawful for an employer to take or receive in respect of such employment an apprenticeship premium in excess of the apprenticeship premium fixed by such rules.
(2) If any employer carrying on in the district of an apprenticeship committee the designated trade for which such committee is established takes or receives any apprenticeship premium in contravention of this section, he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds, and on such conviction the court may order such employer to pay to the person by whom such apprenticeship premium was paid, in case rules regulating apprenticeship premiums made by such committee prohibit the taking of any apprenticeship premium, a sum equal to the amount of the apprenticeship premium so taken or received and, in case rules regulating apprenticeship premiums made by such committee permit the taking of an apprenticeship premium, a sum equal to the amount by which the apprenticeship premium so taken or received exceeds the apprenticeship premium fixed by such rules.
Prohibition of payment of overtime wages below minimum rates.
23.—(1) Where any rules regulating the minimum rates of overtime wages made by an apprenticeship committee are for the time being in force, every employer carrying on in the district of such commmittee the designated trade for which such committee is established shall pay to every apprentice employed on overtime by him overtime wages at not less than the rate or rates payable under such rules and for the purpose of civil proceedings by any such apprentice to recover overtime wages there shall be deemed to be a valid and effective contract by such employer to pay to such apprentice whenever such apprentice is employed on overtime overtime wages at a rate or rates not less than the rate or rates payable under such rules.
(2) If any employer fails to comply with this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds, and on such conviction the court may order such employer to pay, in addition to such fine, such sum as appears to be due to the person employed on account of overtime wages, the overtime wages being calculated on the basis of the minimum rate or rates payable to such person under the rules regulating the minimum rates of overtime wages applicable to such person, but the power to order payment of overtime wages under this sub-section shall not be in derogation of any right of the person employed to recover such wages by any other proceedings.
(3) In this and the next succeeding section the words ‘overtime wages’ mean wages for overtime.
Records of overtime wages paid to apprentices.
24.—(1) Where any rules regulating the minimum rates of overtime wages made by an apprenticeship committee are for the time being in force, it shall be the duty of every employer who carries on in the district of such committee the designated trade for which such committee is established and employs any apprentice in such trade to keep such records of overtime wages paid and of time worked on overtime as are necessary to show that such rules are being complied with in relation to such apprentice.
(2) If any employer—
(a) fails or neglects to keep such records as are required by this section to be kept; or
(b) wilfully or negligently makes in such records any entry which is false or misleading in any material particular,
he shall be guilty of an offence under this section and be liable on summary conviction thereof to a fine not exceeding six pounds and also, in case of failure or neglect to keep such records, to a fine not exceeding three pounds for every day during which such failure or neglect continues after conviction.
Interference with employers.
25.—(1) Where any rules made by an apprenticeship committee under this Act are for the time being in force it shall not be lawful for any person to do any act or thing for the purpose either of preventing or obstructing or impeding an employer carrying on in the district of such committee the designated trade for which such committee is established from complying with such rules.
(2) If any person acts in contravention of this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.
Education of apprentices.
26.—(1) An apprenticeship committee may make representations to the Minister for Education with a view to the provision by the vocational education committee whose functional area is co-terminous with or included in or includes the district of such apprenticeship committee of courses of instruction in the nature of technical education of a type suitable for apprentices engaged in the designated trade for which such apprenticeship committee is established, and that Minister may, if having regard to all the circumstances he considers that effect should be given to such representations or any part thereof, forward such representations to such vocational education committee for its consideration.
(2) Where a course of instruction in the nature of technical education provided by a vocational education committee is available for any apprentice employed in an apprenticeship district in a designated trade and such course is held within the normal working hours of such apprentice and at a place within a distance of three miles from the premises at which such apprentice is so employed measured according to the shortest way lawfully and conveniently available for him, the apprenticeship committee for such district for the purposes of such trade may, if it considers such course suitable, make an order (in this section referred to as an attendance order) in the prescribed form requiring such apprentice to attend such course.
(3) Whenever an attendance order is duly made in relation to an apprentice and such order is personally served on such apprentice, it shall be the duty of such apprentice to comply with such order and if he fails so to do he shall, unless he satisfies the Court that such failure was due to sickness or other unavoidable cause, be guilty of an offence under this section.
(4) Whenever an attendance order is duly made in relation to an apprentice and such order is personally served on the employer of such apprentice, it shall be the duty of such employer, if such apprentice is attending or desires to attend the course of instruction which he is required by such order to attend, to afford,such apprentice time and liberty to attend such course of instruction without any deduction from wages or any addition to the hours of employment or reckoning such time as lost, and if such employer fails or neglects to comply with the requirements of this sub-section he shall be guilty of an offence under this section.
(5) Every person guilty of an offence under this section shall be liable on summary conviction thereof in the case of a first offence to a fine not exceeding twenty shillings, and in the case of a second or any subsequent offence to a fine not exceeding forty shillings.
(6) Any fees which may be payable to a vocational education committee by an apprentice in respect of a course of instruction which he is attending in pursuance of an attendance order shall be paid on behalf of such apprentice by the apprenticeship committee by which such order was made.
Other functions of apprenticeship committees.
27.—(1) Every apprenticeship committee shall hold an investigation into any dispute between an employer carrying on in the district of such committee the designated trade for which such committee is established and any apprentice employed by him in such trade in such district which may be referred to it by such employer or apprentice and shall endeavour to effect a settlement of any dispute so investigated and shall report to the Minister the result of such investigation.
(2) Every apprenticeship committee shall report to the Minister on any matter relating to apprenticeship in the designated trade for which such committee is established which the Minister may refer to it for its report.
Notification of employment by way of apprenticeship.
28.—(1) Every employer carrying on in the district of an apprenticeship committee the designated trade for which such committee is established who employs by way of apprenticeship any person in such trade in such district shall, within two weeks after so employing such person, send to such apprenticeship committee the prescribed particulars in relation to such person.
(2) If any such employer fails or neglects to comply with this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds and in the case of a continuing offence a further fine of ten pounds for every day during which the offence is continued.
Notification of termination of apprenticeship.
29.—(1) Every employer carrying on in the district of an apprenticeship committee the designated trade for which such committee is established who ceases to employ by way of apprenticeship any person in such trade in such district shall, within two weeks after ceasing to so employ such person, send to such apprenticeship committee the prescribed particulars in relation to such person.
(2) If any such employer fails or neglects to comply with this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds and in the case of a continuing offence to a further fine of ten pounds for every day during which the offence is continued.
Register of apprentices.
30.—(1) Every apprenticeship committee shall cause to be kept a register, to be known as the register of apprentices.
(2) Every apprenticeship committee shall cause to be entered in the register of apprentices kept by it such particulars of persons employed or ceasing to be employed by way of apprenticeship in the designated trade for which such committee is established and in the district of such committee as may be sent to it in pursuance of this Act by the employers of such persons.
(3) Every register of apprentices kept by an apprenticeship committee shall at all reasonable hours be open for inspection by an authorised officer and also by any person carrying on in the district of such committee the designated trade for which such committee is established.
Right of audience at meetings of apprenticeship committees.
31.—(1) An authorised officer shall be entitled to be present at any meeting of an apprenticeship committee and to address such meeting, but shall not be entitled to vote on any matter to be decided at such meeting.
(2) An officer of the Minister for Education authorised in that behalf in writing by that Minister shall be entitled to be present at any meeting of an apprenticeship committee and to address such meeting, but shall not be entitled to vote on any matter to be decided at such meeting.
Employers to furnish particulars.
32.—(1) Every person carrying on a designated trade shall, if required so to do by notice in writing in the prescribed form served on or left for him at his place of business by an authorised officer, furnish to such officer, within the time and in the manner specified in such notice, the particulars specified in such notice of all apprentices or any specified apprentice employed by him.
(2) Every person carrying on a designated trade who fails to furnish in accordance with this section all or any particulars which he is duly required under this section so to furnish or who so furnishes any such particulars which are to his knowledge false or misleading in any material respect, shall be guilty of an offence under this section and shall on summary conviction thereof be liable to a fine not exceeding twenty shillings.
Additional powers of authorised officers.
33.—(1) An authorised officer may do all or any of the following things, that is to say:—
(a) at all reasonable times enter upon any premises in which a designated trade is carried on where he has reasonable cause to believe any person is employed in such premises;
(b) require the person carrying on a designated trade in any premises upon which he is entitled to enter under the foregoing paragraph and in which any person is employed, to produce wages sheets, time sheets, and other records of wages to him and inspect and examine the same and take copies or extracts thereof;
(c) enter any premises in an apprenticeship district in which courses of instruction in the nature of technical education provided by a vocational education committee are being given where he has reasonable cause to believe any apprentice in a designated trade is attending such courses;
(d) examine either alone or in the presence of any other person, as he thinks fit, with respect to matters under this Act, every person whom he finds in any premises upon which he is entitled under this section to enter and require such person to answer such questions as he may put touching such matter, and to sign a declaration of the truth of the answers to such questions.
(2) If any person—
(a) refuses, neglects, or fails to produce for inspection any documents which he is required by an authorised officer under this section to produce, or obstructs any authorised officer in the making of such inspection or the taking of copies or extracts of such documents, or
(b) prevents or attempts to prevent any person from appearing before an authorised officer, or
(c) wilfully refuses to answer any questions lawfully asked of him by an authorised officer under this section, or
(d) refuses to sign a declaration which he is lawfully required by an authorised officer to sign under this section, or
(e) in any other manner obstructs or impedes an authorised officer in the exercise of any of the powers conferred upon an authorised officer by this section,
such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding five pounds.
Certificates of authorised officers.
34.—Every authorised officer shall be furnished by the Minister with a certificate in the prescribed form of his appointment as such authorised officer and when exercising any of the powers conferred on him by this Act shall, if so required, produce such certificate to any person affected.
Prosecution of offences.
35.—(1) Proceedings for an offence under this Act shall not be instituted except by or with the consent of the Minister or an authorised officer.
(2) Every offence under this Act may be prosecuted by or at the suit of the Minister or an authorised officer as prosecutor.
Regulations as to mode of giving notice.
36.—(1) The Minister shall make regulations as to the notice to be given of any matter under this Act, with a view to bringing the matter of which notice is to be given so far as practicable to the knowledge of persons affected in apprenticeship districts.
(2) Every occupier of any premises in which a designated trade is carried on shall in the manner directed by regulations made under this section fix any notice in his premises which he may be required to fix by such regulations, and shall give notice in any other manner, if required by such regulations, to the persons employed by him of any matter of which he is required to give notice under such regulations.
(3) If any person fails or neglects to comply with this section, he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding forty shillings.
Non-application of Trade Boards Acts, 1909 and 1918.
37.—Whenever rules made by an apprenticeship committee for a trade-board trade are for the time being in force the provisions of the Trade Boards Acts, 1909 and 1918, in relation to any matters the subject of such rules shall cease to have effect in the district of such committee.
Regulations.
38.—(1) The Minister may make regulations in relation to any matter or thing referred to in this Act as prescribed or to be prescribed.
(2) Any regulations made by the Minister under this Act may relate to several matters in respect of which the power to make regulations is conferred by different sections of this Act.
(3) Every regulation made by the Minister under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution is passed by either such House within the next subsequent twenty-one days on which such House has sat after such regulation is laid before it annulling such regulation, such regulation shall be annulled accordingly but without prejudice to the validity of anything previously done under such regulation.
Expenses of members of apprenticeship committees.
39.—(1) There shall be paid out of moneys provided by the Oireachtas to members of apprenticeship committees appointed by the Minister under this Act such remuneration and expenses as may be sanctioned by the Minister for Finance.
(2) There shall be paid out of moneys provided by the Oireachtas to members of apprenticeship committees (other than members appointed by the Minister under this Act) any expenses (including compensation for loss of time) up to an amount sanctioned by the Minister for Finance which may be incurred by them as such members.
Expenses of apprenticeship committees and Minister.
40.—(1) All expenses incurred with the approval of the Minister by apprenticeship committees under this Act shall, to such extent as shall be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
(2) All expenses incurred by the Minister and by the Minister for Education respectively under this Act shall, to such extent as shall be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Short title.
41.—This Act may be cited as the Apprenticeship Act, 1931.
SCHEDULE.
Procedure for Making Special Orders.
1. Before making a special order the Minister shall cause a draft (in this Schedule referred to as the original draft) of such order to be prepared and shall publish in the Iris Oifigiúil, and in such other manner as he thinks best adapted for informing persons who would, if such special order were made, be affected thereby, notice of his intention to make such special order, of the place where copies of the original draft of such order may be obtained and of the time (in this Schedule referred to as the time limited for making objections) within which any objection with respect to such original draft may be made, and the time limited for making objections to be so specified in such notice shall not in any case be less than forty days after the day of publication in the Iris Oifigiúil of such notice.
2. Every person objecting to the making of a special order may within the time limited for making objections to such proposed special order send notice in writing to the Minister of his objection and such notice shall state—
(a) the specific grounds of objection to the making of such special order, and
(b) the amendments (if any) to the original draft of such order which such person desires to have incorporated therein.
3. If no objection to the making of a special order is made in accordance with the foregoing rule or if an objection to the making of a special order is so made but the Minister considers such objection frivolous, he may, at the expiration of the time limited for making objections to such proposed special order, make such special order in terms of the original draft thereof.
4. If no objection to the making of a special order is made in accordance with Rule 2 of this Schedule, the Minister may, if he so thinks fit, amend the original draft of such order, and in such case the original draft as so amended shall be deemed for the purposes of the foregoing provisions of this Schedule to be a new original draft of such special order and the said provisions shall apply to such original draft as so amended accordingly.
5. If an objection to the making of a special order is made in accordance with Rule 2 of this Schedule and the Minister does not amend the original draft of such special order under the foregoing rule, he shall before making such special order, unless he considers such objection frivolous, cause an inquiry to be held into the making of such special order.
6. The Minister may appoint a fit and proper person to hold an inquiry into the making of a special order and to report to him thereon.
7. Every inquiry held under this Schedule shall be held in public and any officer of the Minister and any persons who appear to the person holding any such inquiry to be persons who, if the special order the subject of such inquiry was made, would be affected thereby may appear at such inquiry either in person or by agents duly authorised in writing, or by counsel or solicitor and may adduce evidence.
8. Any person appointed by the Minister to hold an inquiry under this Schedule shall have power to take evidence on oath and for that purpose may administer oaths to persons attending before him as witnesses.
9. Subject to the foregoing rule of this Schedule an inquiry under this Schedule and proceedings preliminary and incidental thereto shall be conducted in accordance with regulations made by the Minister.
10. There shall be paid to persons holding inquiries under this Schedule such remuneration and allowances as the Minister, with the sanction of the Minister for Finance, shall appoint.
11. On receipt of a report of an inquiry held under this Schedule in relation to the making of a special order, the Minister shall consider such report and may after such consideration make such special order in terms of the original draft thereof or with such modifications in such original draft as he may think proper.
