ACHT UM GHIÚISTÍSÍ DÚITHCHE (FORÁLACHA SEALADACHA), 1923
Giúistisí Dúithche do cheapa.
1.—(1) Beidh sé dleathach do Sheanascal Shaorstáit Éireann ar chomhairle na hArd-Chomhairle daoine cearta oiriúnacha, a bheidh 'na n-Abhchóidí Dlí i Saorstát Éireann le dhá bhliain ar a luighead roimhe sin no 'na n-Atúrnaethe de Chúirt Uachtaraigh Shaorstáit Éireann, do cheapa ó am go ham chun bheith 'na Máistreoirí fén dteideal “Giúistísí Dúithche” agus chun cólíonta na ndualgaisí agus chun sealbhuithe na gcomhacht a leagtar amach leis an Acht so.
(2) Gach duine a ceapfar chun bheith 'na Ghiúistís Dúithche féadfar é do bhrise no do chur chun siúil ar chomhairle na hArdchomhairle aon uair is maith le Seanascal Shaorstáit Éireann é.
(3) Gach duine a ceapfar mar sin chun bheith 'na Ghiúistis Dúithche, déanfar, faid a bheidh an oifig sin aige, tuarastal agus liúntaisí d'íoc leis as airgead a sholáthróidh an t-Oireachtas agus do réir scála a órdóidh an t-Aire le toil an Aire Airgid.
(4) Le linn aon duine do bheith i seilbh oifige Giúistís Dúithche ní bheidh ar a chumas aon oifig ná aon bheart eile sochair a bheith ar seilbh aige agus ní féadfar é do thogha, ná ní fhéadfa sé bheith, 'na bhall d'aon Tigh den Oireachtas.
(5) Gach duine a ceapfar mar sin chun bheith 'na Ghiúistís Dúithche déanfa sé, sara dtosnóidh sé ar ghnó a oifige, faisnéis sholamanata do shighniú agus do thabhairt sa bhfuirm atá sa Chéad Sceideal a ghabhann leis an Acht so.
Dualgaisí Giúistísí Dúithche.
2.—(1) Beidh sé de dhualgas ar gach Giúistís Dúithche a ceapfar fén Acht so Cúirteanna Dúithche do choinneáil laistigh den Dúthaigh a ceapfar do, sna háiteanna san agus ar na huaire sin a leagfaidh an t-Aire amach.
(2) Le linn Giúistís Dúithche do bheith, do réir an Achta so, ina shuidhe i gCúirt Dúithche agus á coinneáil, beidh gach comhacht agus údarás aige do bhí, díreach roimh an 6adh lá de Mhí na Nodlag, 1922, do réir reachta no éinní eile, ag Giúistís Síochána ina shuidhe i nGearr-Shiosón.
(3) Gach ordú, aithne no breith a dhéanfaidh no a thabharfaidh Giúistís Dúithche le linn é do bheith, do réir an Achta so, 'na shuidhe i gCúirt Dúithche agus á coinneáil, beid nocht d'aithéisteacht (má iarrtar san) díreach mar a bheadh ordú, aithne no breith den tsaghas chéanna a dhéanfadh no a thabharfadh Giúistís Síochána agus é 'na shuidhe i nGearr-Shiosón roimh an 6adh lá de Mhí na Nodlag, 1922.
(4) Laistigh dá Dhúthaigh, nuair ná beidh sé 'na i nGearr-Shiosón beidh ag Giúistís Dúithche gach comhacht, údarás agus dualgas a bhí, díreach roimh aimsir rithte an Achta so, bronnta no curtha ar Ghiúistís Síochana.
(5) Aon ghníomh, rud no ní 'na raibh sé riachtanach no údaruithe, do réir aon reachta, riala no ordú díreach roimh aimsir rithte an Achta so, é do dhéanamh i lathair no i bhfianuise Giúistís Síochána no é do sheirbheáil air, beidh sé riachtanach no údaruithe (fé mar a bheidh) é do dhéanamh i láthair no i bhfianuise Giúistís Dúithche, no é do sheirbheáil air ó aimsir rithte an Achta so agus dá héis (gan dochar d'aon chomhacht no údarás a bronntar leis an Acht so ar Choimisinéir Shíochána).
Ath-shocrú na nDúithchí Gearr-Shiosóin.
3.—(1) Díreach tar éis rithte an Achta so no chó luath agus a bheidh caothúil 'na dhiaidh sin déanfaidh an t-Aire Saorstát Éireann (lasmuich de Chontae Chathrach Bhaile Atha Cliath agus den mhéid sin de Chontae Bhaile Atha Cliath atá laistigh d'údarás Máistreoirí Roinne Cathrach Bhaile Atha Cliath) do roinnt 'na Dhúithchí Cúirte caothúla agus aon áit chaothúil amháin do cheapa i ngach Dúthaigh den tsórt san no laistigh de mhíle ó theorainn na Dúithche sin, áit ina gcoinneofar an Chúirt Dúithche don Dúthaigh sin.
(2) Beidh sé dleathach don Aire atharú do dhéanamh ó am go ham fé mar is oiriúnach leis ar gach ceann no ar aon cheann de sna Dúithchí Cúirte a ceapfar fén alt so agus atharú do dhéanamh ar gach ceann no ar aon cheann de sna háiteanna a ceapfar fén alt so chun Cúirteanna Dúithche do choinneáil ionta.
(3) Díreach tar éis leaga amach na nDúithchí Cúirte fén alt so do chríochnú, ansan, chun gach críche, beidh na Dúithchí Cúirte sin in áit agus in ionad na nDúithchí Gearr-Shiosón ina raibh Saorstát Éireann rointe le linn rithte an Achta so agus déanfar an Chúirt Dúithche i ngach Dúithche agus i gcóir gach Dúithche den tsórt san do choinneáil san áit a cheapfaidh an t-Aire fén alt so agus ní coinneofar a thuille Gearr-Shiosón i Saorstát Éireann.
(4) Ceapfaidh an t-Aire mar Dhúthaigh do gach Giúistís Dúithche pé Dúithchí agus pé méid Dúithchí is oiriúnach leis de sna Dúithchí Cúirte a leagfar amach fén alt so (pe'ca in aon chontae amháin dóibh no i níos mó ná san) agus féadfa sé ó am go ham mar is oiriúnach leis atharú do dhéanamh ar na Dúithchí Cúirte do ceapadh do sna Giúistísí go léir no d'éinne aca agus aon Ghiúistís Dúithche d'aistriú ón nDúthaigh a ceapadh do mar sin go dtí aon Dúthaigh eile.
Coimisinéirí Siochána do cheapa.
4.—(1) Feadfaidh an t-Aire ó am go ham le barántas fé na láimh pé daoine cearta oiriúnacha agus pé méid díobh is oiriúnach leis, daoine ar a nglaofar “Coimisinéirí Síochána,” do cheapa i ngach Contae chun na dualgaisí agus na comhactanna a leagtar amach leis an Acht so do chó-líona agus d'fheidhmiú laistigh den Chontae sin agus féadfa sé ar an gcuma gcéanna iad do chur chun siúil.
(2) Beidh ag Coimisinéir Síochána gach comhacht agus údarás a bhí ag Giúistís Síochána díreach roimh aimsir rithte an Achta so, i dtaobh na rudaí uile seo leanas, sé sin le rá:—
(a) sighniú Gairmeacha;
(b) sighniú Barántas;
(c) Cur fé mhóid agus faisnéisí, deimhniúcháin agus finéachtaí do thógaint;
(d) geilteanna agus amadáin dainséaracha do chur go Gealtlanna fé alt10 den Acht um Ghealtacht (Éirinn), 1867 (30 & 31 Vict., ch. 118);
(e) sighniú teisteas chun geilteanna agus amadáin do leigint isteach i nGealtlanna;
(f) sighniú an teistis a éilítear le hAlt 2 den Reacht dá ngoirtear an t-Acht um Chlárú Cleobanna (Éirinn), 1904:
Ach is Giúistís Dúithche a shighneoidh aon ghairm i gcoinnibh aon bhaill den Ghárda Síochana.
(3) I gcás ball den Ghárda Síochána do ghabháil aon duine a bheidh cúisithe i gcoir indíotálta do dhéanamh, déanfar mara mbeidh Giúistís Dúithche ar fáil díreach le na linn sin an duine sin do thabhairt gan mhoill os cóir Coimisinéara Shíochána agus tar éis pé fianuise a tairgeofar d'éisteacht, déanfa sé sin an duine sin do chur siar fé choimeád no fé pé bannaí is oiriúnach leis an gCoimisinéir Síochána agus an chúis do chur chun éisteachta os cóir Giúistís Dúithche ar dháta nách déanaí ná an chéad Chúirt Dúithche eile a coinneofar sa Dúthaigh Chúirte inar gabhadh an duine sin.
(4) Aon uair a tabharfar i láthair Giúistís Dúithche aon duine a bheidh cúisithe i gcoir indíotálta do dhéanamh, beidh sé dleathach don Ghiúistís Dúithche sin an duine sin do chur siar go dtí dáta nách déanaí ná an chéad Chúirt Dúithche eile a choinneoidh sé sa Dúthaigh Cúirte inar gabhadh an duine sin.
Cléirigh Chúirteanna Dúithche do cheapa.
5.—(1) O aimsir rithte an Achta so agus dá héis beidh deire leis na sean-oifigí Cléirigh Ghearr-Shiosóin agus scuirfidh gach sean-Chléireach Gearr-Shiosóin den oifig atá aige do shealbhú.
(2) O aimsir rithte an Achta so agus dá héis déanfaidh agus féadfaidh an t-Aire ó am go ham do réir mar a bheidh gá leis daoine cearta oiriúnacha do cheapa ina gCléirigh Chúirte Dúithche sna Dúithchí Cúirte sin uile a bunófar fén Acht so agus féadfa sé gach duine den tsórt san do cheapa ina Chléireach Cúirte Dúithche in aon cheann amháin no i mbreis agus aon cheann amháin de sna Dúithchí Cúirte sin.
(3) Gach Cléireach Cúirte Dúithche a ceapfar fén alt so sealbhóidh sé a oifig do réir na sealbhuíochta san a órdóidh an t-Aire agus íocfar leis tuarastal do réir scála a órdóidh an t-Aire le toil an Aire Airgid.
(4) Na Cléirigh Chúirte Dúithche a ceapfar fén alt so íocfar a dtuarastail as na cistí céanna as a bhfuil tuarastail na sean-Chléireach Gearr-Shiosóin á ndíol go dtí so agus maran leor na cistí sin chun na tuarastail sin d'íoc déanfar suas oiread den easnamh agus a cheadóidh an t-Aire Airgid as airgead a sholáthróidh an t-Oireachtas: Ach ní dhéanfaidh éinní sa bhfo-alt so dochar don chomhacht chun luíoduithe a bronntar le hAlt 2 den Acht um Chléirigh Ghearr-Shiosóin (Éirinn), 1881.
(5) Gach Cléireach Cúirte Dúithche a ceapfar fén Acht so, có-líonfa sé i dtaobh a Dhúithche no a Dhúithchí na dualgaisí céanna do bhí á gcó-líona go dtí so ag na sean-Chléirigh Ghearr-Shiosóin i dtaobh na sean-Dúithchí Gearr-Shiosóin agus có líonfa sé leis na dualgaisí eile sin a cheapfaidh an Giúistís Dúithche do ó am go ham.
(6) Gach Cléireach Cúirte Dúithche a ceapfar fén Acht so beidh aige i ngach Contae ina mbeidh aon chuid dá dhúthaigh no dá dhúithchí an chomhacht agus an t-údarás céanna san chun Gairmeacha Cúirte Dúithche do shighniú a bronntar leis an Acht so ar Choimisinéir Shíochána sa Chontae sin.
(7) O aimsir rithte an Achta so agus dá héis glaofar “Cláradóir na gCléireach Cúirte Dúithche” ar shean-oifig Chláradóra na gCléireach Gearr-Shiosóin, agus co-líonfaidh an Cláradóir sin i dtaobh na gCléireach Cúirte Dúithche a ceapfar fén alt so na dualgaisí céanna a bhí aige á chó-líona go dtí so i dtaobh na sean-Chléireach Gearr-Shiosóin.
(8) San alt so cialluíonn an focal “sean” bheith ann ar an 6adh lá de Mhí na Nodlag, 1922.
Comhacht chun am do shíne i gcásanna áirithe.
6.—(1) Féadfaidh aon Ghiúistís Dúithche, más dó leis agus nuair is dó leis gur rud ceart réasúnta le déanamh é, féadfa sé gan dochar do sna teoranta a marcáltar leis an alt so, sine do dhéanamh ar an am a teoruítear le haon reacht, riail no rialachán chun aon imeachta i nGearr-Shiosón no i gCúirt Dhúithche do thionnscnamh, no chun aon fhógra do thabhairt, chun aon scribhinn do sheirbheáil no chun aon ghníomh, rud no ní do dhéanamh i dtaobh aon imeachta den tsórt san no mar roimhchoiníoll d'aon imeachta den tsórt san.
(2) An chomhacht um shíne ama a bronntar leis an alt so féadfar í d'fheidhmiú pe'ca bheidh deire an ama san tagaithe roimh dáta feidhmithe na comhachta san no ná beidh, ach ní feidhmeofar an chomhacht san ach i dtaobh ama gur tháinig no go dtiocfaidh a dheire tar éis an 31adh lá de Mhí na Nodlag, 1920, agus roimh an 1adh lá d'Iúl, 1923.
(3) Ní sínfear aon am fén alt so go dtí aon dáta tar éis an 31adh lá de Mhí na Nodlag, 1923.
Gníomhóidh an Gárda Síochána in ionad Constábluíochta Ríogdha na hÉireann.
7.—Gach gníomh, rud no ní go raibh do réir dlí ar an 6adh lá de Mhí na Nodlag, 1922, gá no údarás le n-a dhéanamh ag Cigire, Sáirsint, Constábla no ball eile de Chonstábluíocht Ríogdha na hÉireann no le n-a dhéanamh i bhfianaise an chéanna no le n-a sheirbheáil air in aon Ghearr-Shiosón no 'na thaobh no mar gheall air beidh, ó aimsir rithte an Achta so, gá no údarás le n-a dhéanamh ag Cigire, Sáirsint, Constábla no ball eile (fé mar a éileoidh an cás) den Ghárda Síochána, no le n-a dhéanamh i bhfianaise an chéanna no le n-a sheirbheáil air i gCúirt Dhúithche no 'na taobh no mar gheall uirthi.
Táillí Gearr-Shiosóin do mhéadú.
8.—Na táillí uile atá le linn rithe an Achta so iníoctha do réir dlí i nGearr-Shiosón no mar gheall ar Ghearr-Shiosón, no atá iníoctha leis an gCléireach Gearr-Shiosóin no atá ionbhailithe aige no a teasbántar no íoctar le Stampaí Gearr-Shiosóin (ar a n-áirítear an Ghadhar-Cháin), leanfaid de bheith iníoctha ar na huaire céanna agus sa tslí chéanna 'na rabhadar iníoctha go dtí so ach go mbeid atharuithe i dtreo go ndéanfar, ó aimsir rithte an Achta so agus dá héis, na táillí uile sin ach an Ghadhar-Cháin d'éileamh agus d'íoc ar dúbailt an ráta ar ar dineadh an céanna d'éileamh agus d'íoc go dtí so agus go ndéanfar an Chúirt Dúithche, an Cléireach Cúirte Dúithche agus Stampaí Cúirte Dúithche do chur fé seach in ionad Gearr-Shiosón, an Cléireach Gearr-Shiosóin agus Stampaí Gearr-Shiosóin.
Ceapa agus gníomhartha na nGiúistísí Dúithche atá ann do dhaingniú.
9.—(1) De bhrí gur ceapadh fén Acht Constábluíochta (Éirinn), 1836, (6 & 7 Will. iv. ch. 13), ag Seanascal Shaorstáit Éireann chun bheith ina Mháistreoir fén Acht san gach duine dá bhfuil ainmnithe sa Treas Sceideal a ghabhann leis an Acht so tuigfear gach duine dhíobh do bheith ceaptha agus do bheith ina Ghiúistís Dúithche fén Acht so.
(2) Gach gníomh, rud agus ní do dineadh tar éis an 28adh lá de Dheire Foghmhair, 1922, ag éinne de sna daoine sin atá ainmnithe sa Treas Sceideal a ghabhann leis an Acht so má dhin sé é i bhfeidhmiú no le hintinn a dhéanta i bhfeidhmiú aon údaráis a tuigeadh a bheith aige le linn do an gníomh, rud no ní sin do dhéanamh, toisc gur ceapadh no gur tuigeadh gur ceapadh é ag Rialtas Sealadach na hÉireann a bhí ann le déanaí, no ag aon Aire dhe, chun bheith ina Ghiúistís Dúithche, beid, in ainneoin aon teipe i gcó-líona aon reachta, riala no orduithe (pe'ca le gníomh no le faillí é) agus in ainneoin aon mhírialtachta eile beid chó stóinsithe agus chó héifeachtach is dá ndintí an céanna go rialta ag Máistreoir a ceapadh go cuibhe fén Acht Constábluíochta (Éirinn) 1836 (6 & 7 Will. iv. ch. 13), no (i gcás gníomhartha, rudaí agus nithe go n-éilíonn an dlí iad do dhéanamh ag beirt Mháistreoirí 'na suidhe le chéile) ag beirt Mháistreoirí den tsórt san.
(3) Ní luighfidh aon aicsean i gcoinnibh éinne de sna daoine sin atá ainmnithe sa Treas Sceideal a ghabhann leis an Acht so ná ní bheidh sé i mbaol aon phionós do chur air a' los ná i dtaobh ná i leith aon ghnímh ruda ná ní do dhin aon duine den tsórt san tar éis an 22adh lá de Dheire Foghmhair, 1922, i bhfeidhmiú no le hintinn a dhéanta i bhfeidhmiú aon údaráis den tsórt a luaidhtear sa bhfo-alt san roimhe seo ná a' los ná i dtaobh ná i leith aon teipe (pe'ca le gníomh no le faillí é) i gcó-líona téarmaí aon reachta, riala no orduithe ná a' los ná i dtaobh ná i leith aon mhí-rialtachta eile i ndéanamh an ghnímh, an ruda no an ní sin.
Oiriúnú Achtanna.
10.—(1) Gach luadh no tagairt atá in aon Reacht Briotáineach no in aon ordú, riail no rialachán, a dineadh fé aon Reacht Briotáineach, d'aon oifigigh, chúirteanna, dúithchí no nithe atá luaidhte sa Chéad Cholún den Dara Sceideal a ghabhann leis an Acht so, léireofar agus feidhmeofar é i dtaobh aon ghníomh, rud no ní do dhéanamh no d'fhágaint gan déanamh i Saorstát Éireann tar éis rithte an Achta so, mar thagairt don oifigeach, don chúirt, don dúthaigh no don ní atá ainmnithe sa Dara Cholún den Dara Sceideal roimh-ráite os coinne ainme an oifigigh, na cúirte, na dúithche no an ní atá sa Chéad Cholún.
(2) San alt so cialluíonn an abairt “Reacht Briotáineach” Acht a dhin Páirlimint Ríochta Aontuithe na Breataine Móire agus na hÉireann a bhí ann le déanaí agus go raibh feidhm aige ar an 6adh lá de Mhí na Nodlag, 1922, sa líomatáiste gurb é Saorstát Éireann anois é.

11.—San Acht so beidh ar na habairtí seo leanas, nuair a cheaduíonn an có-théacs é, na mínithe a tugtar ortha fé seach leis an alt so, sé sin le rá:—Cialluíonn “An t-Aire” an t-Aire um Ghnóthaí Dúithche; cialluíonn agus foluíonn “Giúistís Síochána” gach n-aon díobh so leanas, eadhon:—
(a) aon Ghiúistís Síochána amháin 'na shuidhe no ag gníomhú in' aonar;
(b) beirt no níos mó Giúistísí Síochána 'na suidhe no ag gníomhú le chéile;
(c) aon Mháistreoir amháin dar ceapadh fén Acht Constábluíochta (Éirinn), 1836 (6 & 7 Will. iv., ch. 13);
(d) beirt Mháistreoirí den tsórt san 'na suidhe no ag gníomhú le chéile:
Sé rud a chialluíonn “Gárda Síochána” ná an Fórsa Póilíní i Saorstát Éireann ar a nglaotar de ghnáth le linn rithte an Achta so an Gárda Síochána agus a aithnítear de ghnáth mar sin.
Gearrtheideal agus Buaine.
12.—(1) Féadfar an t-Acht um Ghiúistísí Dúithche (Socruithe Sealadacha), 1923, do ghairm den Acht so.
(2) Leanfaidh an t-Acht so i bhfeidhm ar feadh bliana caileandair tar éis a rithte agus raghaidh sé in éag ansan.

1.—(1) It shall be lawful for the Governor-General of the Irish Free State on the advice of the Executive Council from time to time to appoint fit and proper persons being Barristers-at-Law in Saorstát Eireann of at least two years' standing or Solicitors of the Supreme Court i Saorstát Eireann to be Magistrates with the title of “District Justices” and to perform the duties and have the powers prescribed by this Act.
(2) Every person appointed to be a District Justice may be dismissed or removed at the pleasure of the Governor-General of the Irish Free State on the advice of the Executive Council.
(3) Every person so appointed to be a District Justice shall while he holds that office be paid out of moneys provided by the Oireachtas a salary and allowances in accordance with a scale to be prescribed by the Minister with the concurrence of the Minister for Finance.
(4) No person shall while holding the office of District Justice be capable of holding any other office or position of emolument or of being elected to or of being a member of either House of the Oireachtas.
(5) Every person so appointed to be a District Justice shall before entering on his office subscribe and make a solemn declaration in the form contained in the First Schedule to this Act.
Duties of District Justices.
2.—(1) It shall be the duty of each District Justice appointed under this Act to hold District Courts at such places within the District allotted to him and at such times as shall be prescribed by the Minister.
(2) A District Justice sitting in and holding a District Court pursuant to this Act shall have all the powers, jurisdiction and authority which were immediately before the 6th day of December, 1922, vested by statute or otherwise in a Justice of the Peace sitting in Petty Sessions.
(3) Every order, decree or judgment made or pronounced by a District Justice sitting in and holding a District Court pursuant to this Act shall be subject to the same appeal (if any) as a similar order, decree or judgment made or pronounced by a Justice of the Peace sitting in Petty Sessions would have been subject to previous to the 6th day of December, 1922.
(4) A District Justice shall within his District when not sitting at Petty Sessions have all the powers, authorities and duties which were immediately before the passing of this Act vested in or imposed on a Justice of the Peace.
(5) Any act, matter or thing which immediately before the passing of this Act was by any statute, rule or order required or authorized to be done before or in the presence of or to be served on a Justice of the Peace shall from and after the passing of this Act (without prejudice to any power or jurisdiction conferred by this Act on a Peace Commissioner) be required or authorized (as the case may be) to be done before or in the presence of or to be served on a District Justice.
Re-arrangement of Petty Sessions Districts.
3.—(1) Immediately upon the passing of this Act or as soon as conveniently may be thereafter the Minister shall divide Saorstát Eireann (except the County of the City of Dublin and so much of the County of Dublin as is within the jurisdiction of the Divisional Magistrates of the City of Dublin) into convenient Court Districts and shall appoint one convenient place in each such District or within one mile from the boundary of such District at which the District Court shall be held for such District.
(2) It shall be lawful for the Minister from time to time as he shall consider expedient to vary all or any of the Court Districts created under this section and to alter all or any of the places appointed under this section for the holding of District Courts.
(3) Immediately upon the completion of the division into Court Districts under this section such Court Districts shall for all purposes take the place of and be substituted for the Petty Sessions Districts into which Saorstát Eireann was divided at the passing of this Act and the District Court in and for each such District shall be held at the place appointed by the Minister under this section and Petty Sessions shall cease to be holden in Saorstát Eireann.
(4) The Minister shall allot to each District Justice as his District such and so many Court Districts constituted under this section (whether situate in the same or different counties) as the Minister shall think expedient and may from time to time as he shall think expedient vary the allotment of Court Districts to all or any of the District Justices and transfer any District Justice from the District so allotted to him to any other District.
Appointment of Peace Commissioners.
4.—(1) The Minister may from time to time by warrant under his hand appoint and remove such and so many fit and proper persons as he shall think expedient in each County to be called “Peace Commissioners” and to perform and exercise within such County the duties and powers prescribed by this Act.
(2) A Peace Commissioner shall have all the powers and authorities which immediately before the passing of this Act were vested in a Justice of the Peace in respect of the several matters following, that is to say:—
(a) signing Summonses;
(b) signing Warrants;
(c) Administering oaths and taking declarations, affirmations and informations;
(d) committing dangerous lunatics and idiots to Lunatic Asylums under Section 10 of the Lunacy (Ireland Act, 1867 (30 & 31 Vict., ch. 118);
(e) signing certificates for the admission of lunatics and idiots to Lunatic Asylums;
(f) signing the certificate required by Section 2 of the Statute entitled the Registration of Clubs (Ireland) Act, 1904:
Provided always that any summons against any member of the Civic Guard shall be signed by a District Justice.
(3) Whenever any person charged with having committed an indictable offence shall be arrested by a member of the Civic Guard such person shall unless a District Justice is immediately available forthwith be brought before a Peace Commissioner who after hearing such evidence as may be offered shall remand such person either in custody or in such bail as the Peace Commissioner shall think fit and remit the case for hearing before a District Justice on a date not later than the next District Court to be held in the Court District where such person was arrested.
(4) Whenever any person charged with having committed an indictable offence is brought before a District Justice it shall be lawful for such District Justice to remand such person to a date not later than the next District Court to be held by him in the Court District where such person was arrested.
Appointment of Clerks of District Courts.
5.—(1) From and after the passing of this Act the existing offices of Clerk of Petty Sessions shall cease to exist and every existing Clerk of Petty Sessions shall cease to hold his office.
(2) From and after the passing of this Act the Minister shall and may from time to time as occasion requires appoint fit and proper persons to be District Court Clerks in the several Court Districts constituted under this Act and may appoint each such person to be District Court Clerk in one or in any greater number of such Court Districts.
(3) Each District Court Clerk appointed under this section shall hold his office by such tenure as the Minister shall prescribe and shall be paid a salary in accordance with a scale to be prescribed by the Minister with the concurrence of the Minister for Finance.
(4) The salaries of the District Court Clerks appointed under this section shall be paid out of the same funds as those out of which the salaries of the existing Clerks of Petty Sessions have been heretofore paid and any deficiency in such funds to meet the amounts of such salaries shall to such extent as the Minister for Finance may sanction be made good out of moneys provided by the Oireachtas: Provided that nothing in this sub-section shall prejudice the power of deduction conferred by Section 2 of the Petty Sessions Clerks (Ireland) Act, 1881.
(5) Each District Court Clerk appointed under this Act shall perform in respect of his District or Districts the like duties as have heretofore been performed by the existing Clerks of Petty Sessions in respect of the existing Petty Sessions Districts and shall also perform such other duties as shall from time to time be allotted to him by the District Justice.
(6) Each District Court Clerk appointed under this Act shall have in each County in which any part of his district or districts is situate, the same power and authority to sign District Court Summonses as is by this Act conferred on a Peace Commissioner in that County.
(7) The existing office of Registrar of Petty Sessions Clerks shall from and after the passing of this Act be called “The Registrar of District Court Clerks” and such Registrar shall perform in relation to the District Court Clerks appointed under this section the like duties as he has heretofore performed in relation to the existing Clerks of Petty Sessions.
(8) In this section the word “existing” means existing on the 6th day of December, 1922.
Power to extend time in certain cases.
6.—(1) Any District Justice, if and whenever he thinks it just and reasonable so to do, may, subject to the limitations imposed by this section, extend the time limited by any statute, rule or regulation for the institution of any proceedings at Petty Sessions or in a District Court, or for giving any notice, serving any document, or doing any act, matter or thing, in relation or as a condition precedent to any such proceedings.
(2) The power of extension of time conferred by this section may be exercised, whether such time has or has not expired at the date of the exercise of such power, but such power shall only be exercised in respect of a time which has expired or will expire after the 31st day of December, 1920, and before the 1st day of July, 1923.
(3) No time shall be extended under this section to any date after the 31st day of December, 1923.
Civic Guard to act in place of Royal Irish Constabulary.
7.—Every act, matter and thing which was on the 6th day of December, 1922, required or authorized by law to be done by or in the presence of or to be served on an Inspector, Sergeant, Constable or other member of the Royal Irish Constabulary at or in connection with or in relation to any Petty Sessions shall from and after the passing of this Act be required or authorized to be done by or in the presence of or to be served on an Inspector, Sergeant, Constable or other member (as the case may require) of the Civic Guard at or in connection with or in relation to a District Court.
Increase of Petty Sessions Fees.
8.—All fees which are at the passing of this Act payable by law at or in connection with Petty Sessions or are payable to or collectable by the Clerk of Petty Sessions or are denoted or paid by Petty Sessions Stamps (including the Dog Tax) shall continue to be payable at the like times and in the like manner as heretofore but with the modifications that all such fees except the Dog Tax shall from and after the passing of this Act be charged and paid at double the rate at which same were heretofore charged and paid and that the District Court, the District Court Clerk and District Court Stamps shall be substituted respectively for Petty Sessions, the Clerk of Petty Sessions and Petty Sessions Stamps.
Confirmation of appointments and acts of existing District Justices.
9.—(1) Each of the persons named in the Third Schedule to this Act having been appointed under the Constabulary (Ireland) Act, 1836 (6 & 7 Will. IV., ch. 13), by the Governor-General of the Irish Free State to be a Magistrate under that Act shall be deemed to have been appointed and to be a District Justice under this Act.
(2) Every act, matter and thing done after the 28th day of October, 1922, by any of the said persons named in the Third Schedule to this Act in exercise or purported exercise of any authority purported to have been at the time of his doing such act, matter or thing vested in him by reason of his having been appointed or purported to have been appointed by the late Provisional Government of Ireland or any Minister thereof to be a District Justice shall notwithstanding any failure (whether by way of commission or omission) to comply with any statute, rule or order or any other irregularity be as valid and effective as if the same had been regularly done by a Magistrate duly appointed under the Constabulary (Ireland) Act, 1836 (6 & 7 Will. IV., ch. 13), or (in the case of acts, matters and things which are by law required to be done by two Magistrates sitting together) by two such Magistrates.
(3) No action shall lie against and no penalty shall be incurred by any of the said persons named in the Third Schedule to this Act for or on account or in respect of any act, matter or thing done by any such person after the 28th day of October, 1922, in exercise or purported exercise of any such authority as is mentioned in the preceding sub-section or any failure (whether by way of commission or omission) to comply with the terms of any statute, rule or order or any other irregularity in the doing of such act, matter or thing.
Adaptation of enactments.
10.—(1) Every mention or reference contained in any British Statute or in any order, rule or regulation made under any British Statute of or to any of the officials, courts, districts or things mentioned in the First Column of the Second Schedule to this Act shall in respect of the doing or not doing of any act, matter or thing in Saorstát Eireann after the passing of this Act be construed and take effect as a reference to the official, court, district or thing named in the Second Column of the said Second Schedule opposite the name of the official, court, district or thing in the First Column.
(2) In this section the expression “British Statute” means Act of the Parliament of the late United Kingdom of Great Britain and Ireland which was on the 6th day of December, 1922, in force in the area now comprised in Saorstát Eireann.
Definitions.
11.—In this Act the following expressions shall where the context so admits have the meanings respectively assigned to them by this section, that is to say:—“The Minister” means the Minister for Home Affairs; “Justice of the Peace” means and includes all the following persons, namely:—
(a) one Justice of the Peace sitting or acting alone;
(b) two or more Justices of the Peace sitting or acting together;
(c) one Magistrate appointed under the Constabulary (Ireland) Act, 1836 (6 & 7 Will. IV., ch. 13);
(d) two such Magistrates sitting or acting together:
“Civic Guard” means the Police Force in Saorstát Eireann which is at the passing of this Act commonly called or known as the Civic Guard.
Short Title Duration.
12.—(1) This Act may be cited as The District Justices (Temporary Provisions) Act, 1923.
(2) This Act shall continue in force for one calendar year after the passing thereof, and shall then expire.
FIRST SCHEDULE.
“I ___________________________ do swear that I will well and truly serve the Irish Free State (Saorstát Eireann) in the office of District Justice without favour or affection, malice or ill-will; that I will see and cause the peace to be kept and preserved; that I will prevent to the best of my power all offences against the same; that while I shall continue to hold the said office I will to the best of my skill and knowledge discharge all the duties thereof in the execution of Warrants and otherwise faithfully according to law, and that I do not now belong to, and that while I shall hold the said office I will not join or belong to any political society whatsoever or any secret society whatsoever.
So help me God.”
