CUID I

Réamhráiteach agus Ginearálta

Gearrtheideal agus tosach feidhme.

1.—(1) Féadfar an tAcht um Chaomhnú Fostaíochta, 1977, a ghairm den Acht seo.

(2) Tiocfaidh an tAcht seo i ngníomh cibé lá a cheapfaidh an tAire le hordú.

[EN]

Léiriú.

2.—(1) San Acht seo—

[EN]

ciallaíonn “oifigeach údaraithe” duine arna cheapadh ag an Aire le bheith ina oifigeach údaraithe chun críocha an Achta seo;

[EN]

ciallaíonn “conradh fostaíochta” conradh seirbhíse nó printíseachta;

[EN]

ciallaíonn “fostaí” duine a rinne conradh fostaíochta, nó a oibríonn (nó, i gcás conradh a bheith foirceanta, a d'oibrigh) faoi chonradh fostaíochta le fostóir, cibé acu is conradh é le haghaidh obair láimhe, obair chléireachais nó eile, atá sainráite nó intuigthe, agus a rinneadh de bhriathra béil nó i scríbhinn, agus forléireofar dá réir sin “fostóir” agus tagairtí d'fhostaíocht;

ciallaíonn “comhlachas foirne” comhlacht daoine a bhfuil a chomhaltaí go léir fostaithe ag an bhfostóir céanna agus a dhéanann caibidlíocht chun pá nó coinníollacha eile fostaíochta a shocrú dá chomhaltaí féin agus dóibhsean amháin;

ciallaíonn “ceardchumann” ceardchumann is sealbhóir ceadúnas margántaíochta a deonaíodh faoi na hAchtanna Ceardchumann, 1941 agus 1971.

(2) Aon tagairt san Acht seo d'alt is tagairt í d'alt den Acht seo mura gcuirtear in iúl gur tagairt d'achtachán éigin eile atá beartaithe.

(3) Aon tagairt san Acht seo d'fho-alt is tagairt í don fho-alt den alt ina bhfuil an tagairt mura gcuirtear in iúl gur tagairt d'alt éigin eile atá beartaithe.

Rialacháin agus orduithe.

3.—(1) Féadfaidh an tAire rialacháin a dhéanamh chun éifeacht a thabhairt don Acht seo.

(2) (a) Féadfaidh an tAire aon fhoráil den Acht seo a leasú le hordú le go gcomhlíonfar aon oibleagáidí idirnáisiúnta a bhaineann le comhiomarcaíocht a chinn an Stát a ghlacadh air féin.

(b) Féadfaidh an tAire, le hordú, ordú faoin alt seo a leasú nó a chúlghairm.

[EN]

(3) Féadfaidh cibé forálacha teagmhasacha, forlíontacha agus iar mhartacha a bheith i rialacháin faoin alt seo a mheasfaidh an tAire is gá chun críocha na rialachán.

Orduithe agus rialacháin a leagan faoi bhráid Thithe an Oireachtais.

4.—(1) Déanfar gach ordú agus rialachán faoin Acht seo (seachas ordú faoi alt 3, alt 6 nó alt 7 (3)) a leagan faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus, má dhéanann ceachtar Teach, laistigh den 21 lá a shuífidh an Teach sin tar éis an t-ordú nó an rialachán a leagan faoina bhráid, rún a rith ag neamhniú an ordaithe nó an rialacháin, beidh an t-ordú nó an rialachán ar neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin ordú nó faoin rialachán.

(2) I gcás a mbeartófar ordú a dhéanamh faoi alt 3, alt 6 nó alt 7 (3), leagfar dréacht den ordú faoi bhráid gach Tí den Oireachtas agus ní dhéanfar an t-ordú go dtí go mbeidh rún ag ceadú an dréachta rite ag gach Teach.

Caiteachais.

5.—Déanfar na caiteachais a thabhófar ag riaradh an Achta seo a íoc, a mhéid a cheadóidh an tAire Airgeadais, as airgead a sholáthróidh an tOireachtas.

An bhrí atá le comhiomarcaíocht.

6.—(1) Chun críche an Achta seo, ciallaíonn “comhiomarcaíocht” dífhostú ar chúis a shonraítear i bhfo-alt (2) (seachas cúis a bhaineann leis na fostaithe féin ar leith a dhífhostófar) i gcás arb é, in aon tréimhse 30 lá comhleanúnach, an líon a dhífhostófar amhlaidh—

(a) cúigear ar a laghad i mbunaíocht a fhostaíonn de ghnáth líon is mó ná 20 agus is lú ná 50 fostaí,

[EN]

(b) deichniúr ar a laghad i mbunaíocht a fhostaíonn de ghnáth líon nach lú ná 50 ach is lú ná 100 fostaí,

[EN]

(c) deich faoin gcéad ar a laghad den líon fostaithe i mbunaíocht a fhostaíonn de ghnáth líon nach lú ná 100 ach is lú ná 300 fostaí, agus

[EN]

(d) 30 ar a laghad i mbunaíocht a fhostaíonn de ghnáth 300 fostaí nó níos mó.

(2) Is iad na cúiseanna dá dtagraítear i bhfo-alt (1)—

[EN]

(a) go bhfuil scortha ag an bhfostóir áirithe, nó go bhfuil ar intinn aige scor, den ghnó a sheoladh ar chuige a bhí na fostaithe áirithe ar fostú aige, nó go bhfuil scortha aige, nó go bhfuil ar intinn aige scor, den gnó sin a sheoladh san áit a raibh na fostaithe sin ar fostú amhlaidh,

(b) go bhfuil riachtanais an ghnó a thug gur ghá d'fhostaithe obair de chineál áirithe a dhéanamh san áit a raibh na fostaithe áirithe ar fostú amhlaidh imithe i léig nó i laghad nó go gceaptar go n-imeoidh siad i léig nó i laghad,

(c) go bhfuil cinnte ag an bhfostóir áirithe an gnó a sheoladh le líon níos lú fostaithe nó gan aon fhostaithe tríd an obair a raibh na fostaithe áirithe fostaithe chuici (nó a bhí á déanamh acu sular dífhostaíodh iad) a chur á déanamh ag fostaithe eile nó ar shlí eile,

(d) go bhfuil cinnte ag an bhfostóir áirithe maidir leis an obair ar chuici a bhí na fostaithe áirithe fostaithe (nó a bhí á déanamh acu sular dífhostaíodh iad) go ndéanfaí feasta í ar mhodh eile nach bhfuil na fostaithe sách cáilithe ná sách oilte chuige,

(e) go bhfuil cinnte ag an bhfostóir áirithe maidir leis an obair ar chuici a bhí na fostaithe áirithe fostaithe (nó a bhí á déanamh acu sular dífhostaíodh iad) go ndéanfaí feasta í ag daoine atá inniúil ar obair eile a dhéanamh nach bhfuil na fostaithe sin sách cáilithe ná sách oilte chuici.

(3) (a) San alt seo ciallaíonn “bunaíocht”—

[EN]

(i) i gcás fostóir a bheith ag seoladh gnó in ionad áirithe, an t-ionad sin, nó

[EN]

(ii) i gcás an fostóir a bheith ag seoladh gnó i mbreis agus ionad amháin, gach ionad den sórt sin.

[EN]

(b) Chun críocha an mhínithe i mír (a) den fho-alt seo, measfar gur ionad ar leithligh gach áit oibre, monarcha, mianach, cairéal, dugchlós, caladh, cé, earralann, láthair tógála, láthair foirgníochta innealtóireachta, stáisiún leictreachais, oibreacha gáis, oibreacha uisce, oibreacha diúscartha séarachais, oifig, siopa mórdhíola nó miondíola, óstán, bialann, caife, feirm, gairdín nó fáschoill.

(c) Le linn an líon iomlán fostaithe atá fostaithe i mbunaíocht a bheith á fhionnadh chun críocha an ailt seo, áireofar na fostaithe sin arb í an bhunaíocht a mbunáit ach a chomhlíonann cuid dá ndualgais in ionad eile.

(d) Féadfaidh an tAire, chun forálacha an ailt seo a leathnú, mír (a), (b) nó (c) den fho-alt seo a leasú le hordú agus féadfaidh sé an t-ordú sin a leasú nó a chúlghairm le hordú.

(4) Chun críocha an ailt seo, folaíonn “gnó” trádáil, tionscal, gairm nó gnóthas, nó aon ghníomhaíocht a sheolann duine nó comhlacht daoine, corpraithe nó neamhchorpraithe, nó a sheolann údarás poiblí nó údarás áitiúil nó Roinn Stáit, agus folaíonn sé comhlíonadh a fheidhmeanna ag údarás poiblí nó ag údarás áitiúil nó ag Roinn Stáit.

Feidhmiú agus neamhfheidhmiú an Achta.

7.—(1) Faoi réir fho-alt (2), baineann an tAcht seo le gach duine i bhfostaíocht ar dháta thosach feidhme an Achta seo nó dá éis i mbunaíocht a fhostaíonn breis agus 20 duine de ghnáth.

(2) Ní bhaineann an tAcht seo—

[EN]

(a) le dífhostú fostaithe atá fruilithe faoi chonradh fostaíochta go ceann téarma shocraithe nó chun críche sonraithe (is críoch de chineál go raibh teorainn ama le ré an chonartha ach nárbh fhéidir, tráth an chonartha a dhéanamh, a ré a chinntiú) i gcás ar amháin mar gheall ar an téarma éag nó deireadh a bheith leis an gcríoch an dífhostú,

(b) le duine ar fostú ag an Stát nó faoin Stát seachas daoine atá ainmnithe de thuras na huaire faoi alt 17 den Acht Caidrimh Thionscail, 1969,

[EN]

(c) le hoifigigh do chomhlacht is údarás áitiúil de réir brí an Achta Rialtais Áitiúil, 1941,

[EN]

(d) le fostaíocht faoi chomhaontú fostaíochta de bhun Chuid II nó IV den Merchant Shipping Act, 1894,

[EN]

(e) le fostaithe i mbunaíocht a bhfuil deireadh á chur leis an ngnó inti de dhroim imeachtaí féimheachta nó foirceanta nó ar aon chúis eile de thoradh breith ó chúirt dlínse inniúla.

(3) (a) Féadfaidh an tAire a dhearbhú le hordú nach mbainfidh an tAcht seo le haicme fostaithe a shonrófar san ordú agus ní bhainfidh an tAcht seo leis an aicme sin ó thosach feidhme an ordaithe.

(b) Féadfaidh an tAire a dhearbhú le hordú go mbainfidh an tAcht seo le haicme shonraithe fostaithe agus bainfidh an tAcht seo leis an aicme sin ó thosach feidhme an ordaithe.

[EN]

(c) Féadfaidh an tAire, le hordú, ordú faoin bhfo-alt seo a leasú nó a chúlghairm.

[EN]

(4) I gcás fógra dífhostaithe de bhíthin iomarcaíochta a tugadh roimh thosach feidhme an Achta seo do dhul in éag tar éis an tosach feidhme sin, ní bhainfidh alt 9, 10, 12 ná 14 leis an dífhostú áirithe, ach beidh fógra den sórt sin ar comhréir leis an Acht um Fhógra Iosta agus Téarmaí Fostaíochta, 1973, agus leis an gconradh fostaíochta iomchuí.

(5) San alt seo tá le “bunaíocht” an bhrí chéanna atá leis in alt 6.

Gnáthlíon fostaithe a ríomh.

8.—Chun críocha an Achta seo, glacfar gurb é an líon fostaithe a fhostaítear de ghnáth i mbunaíocht (de réir brí alt 6) meánuimhir an lín a bhí ar fostú amhlaidh gach mí den 12 mhí roimh dháta an chéad dífhostaithe do ghlacadh éifeachta.

CUID II

Comhairle agus Fógra

Oibleagáid ar fhostóir dul i gcomhairle le hionadaithe fostaithe.

9.—(1) I gcás a mbeartóidh fostóir comhiomarcaiocht a bhunú, rachaidh sé, d'fhonn teacht ar chomhaontú, i ndáil chomhairle le hionadaithe fostaithe atá ionadaitheach do na fostaithe lena mbaineann an iomarcaíocht bheartaithe.

(2) Folóidh comhchomhairliúchán faoin alt seo na nithe seo a leanas—

[EN]

(a) féachaint arb fhéidir an iomarcaíocht atá beartaithe a sheachaint, an líon fostaithe lena mbainfeadh an iomarcaíocht sin a laghdú nó a deascaí a mhaolú ar dhóigh eile,

[EN]

(b) an bonn ar a gcinnfear cé hiad na fostaithe áirithe a dhéanfar iomarcach.

[EN]

(3) Tionscnófar comhchomhairliúchán faoin alt seo a luaithe is féidir agus ar aon chor 30 lá ar a laghad sula nglacfaidh an chéad dífhostú éifeacht.

Oibleagáid ar fhostóir faisnéis áirithe a thabhairt.

10.—(1) Tabharfaidh an fostóir áirithe, chun críche comhchomhairliúchán faoi alt 9, an fhaisnéis iomchuí go léir a bhaineann leis an iomarcaíocht bheartaithe d'ionadaithe na bhfostaithe.

(2) Gan dochar do ghinearálacht fho-alt (1), beidh an méid seo a leanas ar áireamh na faisnéise a thabharfar faoin alt seo, agus tabharfar sonraí i scríbhinn ina thaobh—

[EN]

 (a) na fáthanna atá leis an iomarcaíocht atá beartaithe,

[EN]

(b) an líon, agus na cineálacha nó na hearnálacha, fostaithe a bheartaítear a dhéanamh iomarcach,

[EN]

(c) an líon fostaithe a fhostaítear de ghnáth, agus

[EN]

(d) an tréimhse ar lena linn a bheartaítear an iomarcaíocht bheartaithe a dhéanamh.

[EN]

(3) Tabharfaidh fostóir don Aire, a luaithe is féidir, cóipeanna den fhaisnéis go léir a tugadh i scríbhinn faoi fho-alt (2).

Pionós mar gheall ar alt 9 nó 10 a shárú.

11.—Fostóir a mhainneoidh comhchomhairliúchán a thionscnamh faoi alt 9 nó a mhainneoidh alt 10 a chomhlíonadh beidh sé ciontach i gcion agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná £500 a chur air.

Oibleagáid ar fhostóir fógra a thabhairt don Aire i dtaobh iomarcaíocht atá beartaithe.

12.—(1) I gcás a mbeartóidh fostóir comhiomarcaíocht a bhunú, tabharfaidh sé don Aire, a luaithe is féidir agus, ar aon chor, 30 lá ar a laghad sula nglacfaidh an chéad dífhostú éifeacht, fógra i scríbhinn i dtaobh sin a bheith beartaithe aige.

(2) Féadfaidh an tAire na sonraí a fhorordú a bheidh le tabhairt i bhfógra faoin alt seo.

[EN]

(3) Déanfaidh an fostóir lena mbainfidh cóip d'fhógra faoin alt seo a thabhairt a luaithe is féidir d'ionadaithe na bhfostaithe lena mbainfidh agus féadfaidh na hionadaithe sin aon chonnsuithe a bheidh acu i dtaobh an fhógra a chur i scríbhinn chun an Aire.

Pionós mar gheall ar alt 12 a shárú.

13.—Beidh fostóir a sháróidh alt 12 ciontach i gcion agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná £500 a chur air.

CUID III

Tosach Comhiomarcaíochta

[EN]

Ní ghlacfaidh comhiomarcaíocht éifeacht go ceann 30 lá.

14.—(1) Ní ghlacfaidh comhiomarcaíocht éifeacht roimh éag don tréimhse 30 lá dar tosach dáta an fhógra iomchuí faoi alt 12.

[EN]

(2) I gcás a ndéanfaidh fostóir comhiomarcaíocht roimh éag don tréimhse 30 lá a luaitear i bhfo-alt (1) beidh an fostóir ciontach i gcion agus ar é a chiontú ar díotáil dlífear fíneáil nach mó ná £3,000 a chur air.

Tuilleadh comhairle a ghlacadh leis an Aire.

15.—(1) D'fhonn fuascailt a fháil ar na fadhbanna a leanfaidh as an iomarcaíocht a bheidh beartaithe, rachaidh an fostóir áirithe i gcomhairle leis an Aire nó le hoifigeach údaraithe ar an Aire á iarraidh sin.

(2) Tabharfaidh fostóir don Aire nó d'oifigeach údaraithe, chun críche comhchomhairliúchán faoin alt seo, cibé faisnéis i ndáil leis an iomarcaíocht a bheidh beartaithe a theastóidh le réasún ón Aire nó ón oifigeach.

Cosaint do chearta fostaithe chun fógra, etc.

16.—Ní dhéanfaidh aon ní san Acht seo difear do cheart aon fhostaí chun tréimhse fógra dífhostaithe nó chun aon teideal eile faoi aon Acht eile nó faoina chonradh fostaíochta.

Forálacha a bhaineann le hoifigigh údaraithe.

17.—(1) Féadfaidh oifigeach údaraithe—

[EN]

(a) dul isteach gach tráth réasúnach in aon áitreabh nó áit a mbeidh cúis réasúnach aige lena cheapadh go bhfuil aon fhostaí fostaithe ann,

[EN]

(b) scrúdú nó fiosrú ar bith a dhéanamh ansin is gá lena fhionnadh ar comhlíonadh nó an gcomhlíontar an tAcht seo,

[EN]

(c) a cheangal ar fhostóir nó ar a ionadaí aon taifid a thabhairt ar aird a cheanglaítear leis an Acht seo ar an bhfostóir a choimeád, agus iontrálacha sna taifid sin a iniúchadh agus cóipeanna a dhéanamh díobh,

[EN]

(d) aon duine a mbeidh cúis réasúnach aige a chreidiúint gur fostóir nó gur fostaí nó gurbh fhostóir nó gurbh fhostaí é a scrúdú maidir le haon ábhair faoin Acht seo agus a cheangal air freagra a thabhairt ar aon cheisteanna (seachas ceisteanna a d'ionchoireodh é) a chuirfidh an t-oifigeach air i ndáil leis na hábhair sin agus dearbhú ar fhírinne na bhfreagraí a shíniú.

(2) Ní bheidh na cumhachtaí a thugtar d'oifigeach údaraithe le fo-alt (1) (a) infheidhmithe maidir le teach cónaí príobháideach mura ndeimhneoidh an tAire (nó oifigeach don Aire arna cheapadh ag an Aire chun na críche) go bhfuil cúis réasúnach aige lena chreidiúint go ndearna an fostóir cion faoin alt seo i ndáil le fostaí ar fostú sa teach, agus go dtabharfaidh an t-oifigeach údaraithe an deimhniú ar aird nuair a bheidh cead isteach sa teach á iarraidh aige.

(3) Aon duine—

[EN]

(a) a chuirfidh bac nó bacainn le hoifigeach údaraithe a bheidh ag feidhmiú aon chumhachta a thugtar leis an alt seo,

[EN]

(b) a dhiúltóidh aon taifead a thabhairt ar aird a cheanglóidh oifigeach údaraithe go dleathach air a thabhairt ar aird,

[EN]

(c) a thabharfaidh ar aird, nó a chuirfidh faoi deara nó a cheadóidh go feasach go dtabharfar ar aird, d'oifigeach údaraithe aon taifead atá bréagach in aon phonc ábhartha agus a fhios aige é a bheith bréagach,

[EN]

(d) a choiscfidh nó a fhéachfaidh lena chosc ar aon duine teacht i láthair oifigigh údaraithe, nó a cheistiú ag oifigeach údaraithe, nó

[EN]

(e) a mhainneoidh go toiliúil nó a dhiúltóidh aon cheanglas dleathach ó oifigeach údaraithe faoi fho-alt (1) (d) a chomhlíonadh

beidh sé ciontach i gcion agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná £500 a chur air.

[EN]

(4) Tabharfar d'oifigeach údaraithe deimhniú ar a cheapadh agus, nuair a bheidh cead isteach in aon áitreabh nó áit á iarraidh aige, tabharfaidh sé an deimhniú ar aird, má iarrtar sin air, don áititheoir agus d'aon duine a bheidh á scrúdú aige.

CUID IV

Ilghnéitheach

Taifid a choimeádfaidh fostóirí.

18.—(1) Coimeádfaidh fostóir cibé taifid is gá lena chumasú don Aire nó d'oifigeach údaraithe a fhionnadh an bhfuil nó nach bhfuil forálacha an Achta seo á gcomhlíonadh agus comhlíonta.

(2) Taifid a choimeádfar faoin alt seo coinneoidh fostóir iad go ceann trí bliana ar a laghad ó dháta a ndéanta.

[EN]

(3) Beidh fostóir a sháróidh fo-alt (1) nó (2) ciontach i gcion agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná £500 a chur air.

[EN]

(4) I gcás a mainneoidh fostóir taifid a choimeád nó a choinneáil faoin alt seo is air féin a bheidh a chruthú go bhfuil an tAcht comhlíonta nó á chomhlíonadh aige.

Forálacha áirithe a bheith ar neamhní.

19.—Is foráil ar neamhní aon fhoráil in aon chomhaontú (cibé acu is conradh fostaíochta nó eile é) a airbheartaíonn oibriú aon fhorála de chuid an Achta seo a eisiamh nó a theorannú.

Fógraí, etc. don Aire.

20.—Is i scríbhinn a bheidh aon fhógra nó doiciméad eile a gceanglaítear nó a n-údaraítear leis an Acht seo go dtabharfaidh fostóir don Aire é agus cuirfear é leis an bpost cláraithe dírithe go dtí ceannoifig na Roinne Saothair nó, mura féidir sin, seachadfar don oifig sin é.

Imeachtaí faoin Acht.

21.—(1) Féadfaidh an tAire cion faoin Acht seo a ionchúiseamh.

(2) Féadfar imeachtaí maidir le cion faoin Acht seo a thionscnamh laistigh de bhliain ó dháta an chiona.

[EN]

PROTECTION OF EMPLOYMENT ACT, 1977


AN ACT TO PROVIDE FOR THE IMPLEMENTATION OF THE DIRECTIVE OF THE COUNCIL OF THE EUROPEAN COMMUNITIES DONE AT BRUSSELS ON THE 17th DAY OF FEBRUARY, 1975, REGARDING THE APPROXIMATION OF THE LAWS OF MEMBER STATES OF THOSE COMMUNITIES RELATING TO COLLECTIVE REDUNDANCIES, AND TO PROVIDE FOR OTHER MATTERS RELATING TO THAT MATTER. PART I

Preliminary and General

[GA]

Short title and commencement.

1.—(1) This Act may be cited as the Protection of Employment Act, 1977.

[GA]

(2) This Act shall come into operation on such day as may be appointed by order of the Minister.

[GA]

Interpretation.

2.—(1) In this Act—

[GA]

authorised officer” means a person appointed by the Minister to be an authorised officer for the purposes of this Act;

[GA]

contract of employment” means a contract of service or of apprenticeship;

[GA]

employee” means a person who has entered into or works under (or, in the case of a contract which has been terminated, worked under) a contract of employment with an employer, whether the contract is for manual labour, clerical work or otherwise, is express or implied, oral or in writing, and “employer” and references to employment shall be construed accordingly;

[GA]

employees' representatives” means officials (including shop stewards) of a trade union or of a staff association with which it has been the practice of the employer to conduct collective bargaining negotiations;

[GA]

the Minister” means the Minister for Labour;

[GA]

prescribed” means prescribed by regulations under this Act;

[GA]

staff association” means a body of persons all the members of which are employed by the same employer and which carries on negotiations for the fixing of the wages or other conditions of employment of its own members only;

[GA]

trade union” means a trade union which is the holder of a negotiation licence granted under the Trade Union Acts, 1941 and 1971.

[GA]

(2) In this Act a reference to a section is to a section of this Act unless it is indicated that reference to some other enactment is intended.

[GA]

(3) In this Act a reference to a subsection is to the subsection of the section in which the reference occurs unless it is indicated that reference to some other section is intended.

Regulations and orders.

3.—(1) The Minister may make regulations for the purpose of giving effect to this Act.

[GA]

(2) (a) The Minister may by order amend any provision of this Act so as to comply with any international obligations relating to collective redundancies that the State has decided to assume.

[GA]

(b) The Minister may by order amend or revoke an order under this section.

[GA]

(3) Regulations under this section may contain such incidental, supplementary and consequential provisions as appear to the Minister to be necessary for the purposes of the regulations.

Laying of orders and regulations before Houses of Oireachtas.

4.—(1) Every order and regulation under this Act (other than an order under section 3, section 6 or section 7 (3)) shall be laid before each House of the Oireachtas as soon as possible after it is made and, if a resolution annulling the order or regulation is passed by either House within the next 21 days on which that House has sat after the order or regulation is laid before it, the order or regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done under it.

(2) Where an order is proposed to be made under section 3, section 6 or section 7 (3), a draft of the order shall be laid before both Houses of the Oireachtas and the order shall not be made until a resolution approving of the draft has been passed by each House.

Expenses.

5.—The expenses incurred in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.

Meaning of collective redundancies.

6.—(1) For the purpose of this Act, “collective redundancies” means dismissals which are effected for a reason specified in subsection (2) (other than a reason related to the individual employees dismissed) where in any period of 30 consecutive days the number of such dismissals is—

(a) at least five in an establishment normally employing more than 20 and less than 50 employees,

[GA]

(b) at least ten in an establishment normally employing at least 50 but less than 100 employees,

[GA]

(c) at least ten per cent. of the number of employees in an establishment normally employing at least 100 but less than 300 employees, and

[GA]

(d) at least 30 in an establishment normally employing 300 or more employees.

[GA]

(2) The reasons referred to in subsection (1) are—

[GA]

(a) that the employer concerned has ceased, or intends to cease, to carry on the business for the purposes of which the employees concerned were employed by him, or has ceased or intends to cease, to carry on that business in the place where those employees were so employed,

[GA]

(b) that the requirements of the business for employees to carry out work of a particular kind in the place where the employees concerned were so employed have ceased or diminished or are expected to cease or diminish,

[GA]

(c) that the employer concerned has decided to carry on the business with fewer or no employees, whether by requiring the work for which the employees concerned had been employed (or had been doing before their dismissal) to be done by other employees or otherwise,

[GA]

(d) that the employer concerned has decided that the work for which the employees concerned had been employed (or had been doing before their dismissal) should henceforward be done in a different manner for which those employees are not sufficiently qualified or trained,

[GA]

(e) that the employer concerned has decided that the work for which the employees concerned had been employed (or had been doing before their dismissal) should henceforward be done by persons who are also capable of doing other work for which those employees are not sufficiently qualified or trained.

[GA]

(3) (a) In this section “establishment” means—

[GA]

(i) where an employer carries on business at a particular location, that location, or

[GA]

(ii) where an employer carries on business at more than one location, each such location.

[GA]

(b) For the purposes of the definition in paragraph (a) of this subsection, each workplace, factory, mine, quarry, dockyard, wharf, quay, warehouse, building site, engineering construction site, electricity station, gas works, water works, sewage disposal works, office, wholesale or retail shop, hotel, restaurant, café, farm, garden or forest plantation shall be taken to be a separate location.

(c) In ascertaining for the purposes of this section the total number of employees employed in an establishment, account shall be taken of those employees who are based at the establishment but who also perform some of their duties elsewhere.

[GA]

(d) The Minister may, for the purpose of extending the provisions of this section by order amend paragraph (a), (b) or (c) of this subsection and may by order amend or revoke such an order.

[GA]

(4) For the purposes of this section, “business” includes a trade, industry, profession or undertaking, or any activity carried on by a person or body of persons, whether corporate or unincorporate, or by a public or local authority or a Department of State, and the performance of its functions by a public or local authority or a Department of State.

Application and non-application of Act.

7.—(1) Subject to subsection (2), this Act applies to all persons in employment on or after the commencement of this Act in an establishment normally employing more than 20 persons.

[GA]

(2) This Act does not apply to—

[GA]

(a) dismissals of employees engaged under a contract of employment for a fixed term or for a specified purpose (being a purpose of such a kind that the duration of the contract was limited but was, at the time of its making, incapable of precise ascertainment) where the dismissals occurred only because of the expiry of the term or the cesser of the purpose,

[GA]

(b) a person employed by or under the State other than persons standing designated for the time being under section 17 of the Industrial Relations Act, 1969,

[GA]

(c) officers of a body which is a local authority within the meaning of the Local Government Act, 1941,

[GA]

(d) employment under an employment agreement pursuant to Part II or IV of the Merchant Shipping Act, 1894,

[GA]

(e) employees in an establishment the business carried on in which is being terminated following bankruptcy or winding-up proceedings or for any other reason as a result of a decision of a court of competent jurisdiction.

[GA]

(3) (a) The Minister may by order declare that this Act shall not apply to a class of employees specified in the order and from the commencement of the order this Act shall not apply to that class.

[GA]

(b) The Minister may by order declare that this Act shall apply to a specified class of employee and from the commencement of the order this Act shall apply to that class.

[GA]

(c) The Minister may by order amend or revoke an order under this subsection.

[GA]

(4) Where a notice of dismissal by reason of redundancy which was given before the commencement of this Act expires after such commencement, sections 9, 10, 12 and 14 shall not apply to the dismissal concerned, but such a notice shall be in accordance with the Minimum Notice and Terms of Employment Act, 1973, and with the relevant contract of employment.

(5) In this section “establishment” has the same meaning as in section 6.

[GA]

Calculation of normal number of employees.

8.—For the purposes of this Act, the number of employees normally employed in an establishment (within the meaning of section 6) shall be taken to be the average of the number so employed in each of the 12 months preceding the date on which the first dismissal takes effect.

PART II

Consultation and Notification

[GA]

Obligation on employer to consult employees' representatives.

9.—(1) Where an employer proposes to create collective redundancies he shall, with a view to reaching an agreement, initiate consultations with employees' representatives representing the employees affected by the proposed redundancies.

[GA]

(2) Consultations under this section shall include the following matters—

[GA]

(a) the possibility of avoiding the proposed redundancies, reducing the number of employees affected by them or otherwise mitigating their consequences,

[GA]

(b) the basis on which it will be decided which particular employees will be made redundant.

[GA]

(3) Consultations under this section shall be initiated at the earliest opportunity and in any event at least 30 days before the first dismissal takes effect.

[GA]

Obligation on employer to supply certain information.

10.—(1) For the purpose of consultations under section 9, the employer concerned shall supply the employees' representatives with all relevant information relating to the proposed redundancies.

[GA]

(2) Without prejudice to the generality of subsection (1), information supplied under this section shall include the following, of which details shall be given in writing—

[GA]

(a) the reasons for the proposed redundancies,

[GA]

(b) the number, and descriptions or categories, of employees whom it is proposed to make redundant,

[GA]

(c) the number of employees normally employed, and

[GA]

(d) the period during which it is proposed to effect the proposed redundancies.

[GA]

(3) An employer shall as soon as possible supply the Minister with copies of all information supplied in writing under subsection (2).

[GA]

Penalty for contravention of section 9 or 10.

11.—An employer who fails to initiate consultations under section 9 or fails to comply with section 10 shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £500.

Obligation on employer to notify Minister of proposed redundancies.

12.—(1) Where an employer proposes to create collective redundancies, he shall notify the Minister in writing of his proposals at the earliest opportunity and in any event at least 30 days before the first dismissal takes effect.

[GA]

(2) The Minister may prescribe the particulars to be specified in a notification under this section.

[GA]

(3) A copy of a notification under this section shall be supplied as soon as possible by the employer affected to the employees' representatives affected who may forward to the Minister in writing any observations they have relating to the notification.

[GA]

Penalty for contravention of section 12.

13.—An employer who contravenes section 12 shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £500.

PART III

Commencement of Collective Redundancies

[GA]

Collective redundancies not to take effect for 30 days.

14.—(1) Collective redundancies shall not take effect before the expiry of the period of 30 days beginning on the date of the relevant notification under section 12.

[GA]

(2) Where collective redundancies are effected by an employer before the expiry of the 30-day period mentioned in subsection (1) the employer shall be guilty of an offence and shall be liable on conviction on indictment to a fine not exceeding £3,000.

Further consultations with Minister.

15.—(1) For the purpose of seeking solutions to the problems caused by the proposed redundancies, the employer concerned shall, at the Minister's request, enter into consultations with him or an authorised officer.

[GA]

(2) For the purpose of consultations under this section, an employer shall supply the Minister or an authorised officer with such information relating to the proposed redundancies as the Minister or the officer may reasonably require.

[GA]

Saver for employees' rights to notice, etc.

16.—Nothing in this Act shall affect the right of any employee to a period of notice of dismissal or to any other entitlement under any other Act or under his contract of employment.

Provisions relating to authorised officers.

17.—(1) An authorised officer may—

[GA]

(a) enter at all reasonable times any premises or place where he has reasonable grounds for supposing that any employee is employed,

[GA]

(b) there make any examination or enquiry necessary for ascertaining whether this Act has been or is being complied with,

[GA]

(c) require an employer or his representative to produce any records which the employer is required by this Act to keep, and inspect and take copies of entries in the records.

[GA]

(d) examine with regard to any matters under this Act any person whom he has reasonable cause to believe to be or to have been an employer or employee and require him to answer any questions (other than questions tending to incriminate him) which the officer may put relating to those matters and to sign a declaration of the truth of the answers.

[GA]

(2) The powers conferred on an authorised officer by subsection (1) (a) shall not be exercisable in respect of a private dwelling house unless the Minister (or an officer of the Minister appointed by the Minister for the purpose) certifies that he has reasonable grounds for believing that an offence under this section in relation to an employee employed in the house has been committed by the employer, and the authorised officer in applying for admission to the house produces the certificate.

(3) Any person who—

[GA]

(a) obstructs or impedes an authorised officer in the exercise of any power conferred by this section,

[GA]

(b) refuses to produce any record which an authorised officer lawfully requires him to produce,

[GA]

(c) produces, or causes to be produced or knowingly allows to be produced, to an authorised officer any record which is false in any material respect knowing it to be false,

[GA]

(d) prevents or attempts to prevent any person from appearing before or being questioned by an authorised officer, or

[GA]

(e) wilfully fails or refuses to comply with any lawful requirement of an authorised officer under subsection (1) (d)

[GA]

shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £500.

[GA]

(4) An authorised officer shall be furnished with a certificate of his appointment and, on applying for admission to any premises or place, shall, if so required, produce the certificate to the occupier and to any person being examined by him.

PART IV

Miscellaneous

[GA]

Records to be kept by employers.

18.—(1) An employer shall keep such records as may be necessary to enable the Minister or an authorised officer to ascertain whether or not the provisions of this Act are being and have been complied with.

(2) Records kept under this section shall be retained by an employer for a period of not less than three years from the date on which they were made.

[GA]

(3) An employer who contravenes subsection (1) or (2) shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £500.

[GA]

(4) Where an employer fails to keep or retain records under this section the onus of proving that he has complied or is complying with this Act shall lie on him.

[GA]

Certain provisions to be null and void.

19.—Any provision in any agreement (whether a contract of employment or otherwise) purporting to exclude or limit the operation of any provision of this Act shall be null and void.

Notices, etc. to Minister.

20.—Any notice or other document which is required or authorised by this Act to be given by an employer to the Minister shall be in writing and shall be sent by registered post addressed to the head office of the Department of Labour or, where that is not practicable, shall be delivered to that office.

Proceedings under Act.

21.—(1) An offence under this Act may be prosecuted by the Minister.

[GA]

(2) Proceedings for an offence under this Act may be commenced within one year from the date of the offence.

[GA]

(3) Where an offence under this Act committed by a body corporate is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of, any director, manager, secretary or other officer of the body corporate or any person who was purporting to act in any such capacity, he as well as the body corporate shall be guilty of that offence and shall be liable to be proceeded against and punished accordingly.

Mitigation of penalty for certain offences.

22.—Where an employer is convicted of an offence under section 11 or 14, he may plead in mitigation of the penalty for that offence that there were substantial reasons related to his business which made it impracticable for him to comply with the section under which the offence was committed.
