Srian le himeachta dlí i dtaobh tóiteán teagmhasach.

1.—(1) I gcás damáiste do dhéanamh d'aon duine (dá ngairmtear an duine díobhálta san alt so) de dheascaibh tóiteáin teagmhasaigh (do thárla roimh dháta an Achta so do rith no thárlóidh dá éis sin) i bhfoirgint no ar thalamh le duine eile, ansan, d'ainneoin aon rialach dlí, beidh éifeacht ag na forálacha so leanas, sé sin le rá:—

(a) ní dhéanfaidh an duine díobhálta, ná aon duine bheidh ag éileamh tríd no fé no mar árachóir dó, aon imeachta dlí do bhunú, tar éis dáta an Achta so do rith, in aon chúirt i gcoinnibh an duine eile sin mar gheall ar an damáiste sin;

(b) más rud é i gcás an tóiteán do thárlachtaint roimh dháta an Achta so do rith, gur hunuíodh aon imeachta dlí den tsórt san tar éis an 16adh lá de Mhí na Samhna, 1942, agus roimh dháta an Achta so do rith, agus go bhfuilid ar feitheamh ar dháta a rithte, cuirfear na himeachta dlí sin ar neamhní agus ar neambrí, ach san fé réir pé orduithe i dtaobh costas is oiriúnach leis an gcúirt ina mbeidh na himeachta dlí sin ar feitheamh no le breitheamh den chúirt sin do dhéanamh.

(2) Ní léireofar éinní atá i bhfo-alt (1) den alt so mar ní a dhéanann deifir d'imeachta dlí d'fhoirfheidhmiú aon chumhnaint no có-aontuithe bheidh in aon léas no cíoschur foirginte no tailimh.

(3) San alt so foluíonn an focal “foirgint” déanmhas ar bith, pé abhar ar de é agus pé críoch chun a n-úsáidtear é.

2.—Athghairmtear leis seo an reacht Éireannach réamh-Aondachta do ritheadh sa bhliain 1715 agus dar teideal “An Act for preventing Mischief that may happen by fire” (2 Geo. 1, c. 5).

ACCIDENTAL FIRES ACT, 1943.

Restriction on legal proceedings in respect of accidental fires.

1.—(1) Where any person (in this section referred to as the injured person) has suffered damage by reason of fire accidentally occurring (whether before or after the passing of this Act) in or on the building or land of another person, then, notwithstanding any rule of law, the following provisions shall have effect, that is to say:—

(a) no legal proceedings shall, after the passing of this Act, be instituted in any court by the injured person or any person claiming through or under him or as his insurer against such other person on account of such damage;

(b) if, in case the fire occurred before the passing of this Act, any such legal proceedings were instituted after the 16th day of November, 1942, and before the passing of this Act, and are pending at such passing, such legal proceedings shall be discharged and made void, subject to such order as to costs as the court in which such legal proceedings are pending or a judge thereof thinks fit to make.

(2) Nothing contained in sub-section (1) of this section shall be construed as affecting legal proceedings for the enforcement of any covenant or agreement contained in any lease or letting of a building or land.

(3) In this section the word “building” includes any structure of whatsoever material or for whatever purpose used.

Repeal.

2.—The pre-Union Irish statute passed in the year 1715 and entitled “An Act for preventing Mischief that may happen by fire” (2 Geo. 1, c. 5) is hereby repealed.

Short title.

3.—This Act may be cited as the Accidental Fires Act, 1943.
