Acht 1946.
1.—San Acht seo ciallaíonn an abairt “Acht 1946” an tAcht Cúirteanna Breithiúnais (An Chúirt Dúiche), 1946 (Uimh. 21 de 1946).
Cumhacht chun aois scoir Breithiún áirithe d'ardú.
2.—(1) (a) San alt seo ciallaíonn an abairt “an Coiste” coiste ar a mbeidh—
(i) an Príomh-Bhreitheamh,
(ii) Uachtarán na hArd-Chúirte, agus
(iii) an tArd-Aighne.
(b) Féadfaidh an Coiste gníomhú trí thromlach dá chomhaltaí agus is leor de dhílse-dheimhniú ar bharántas faoin alt seo é a bheith sínithe ag beirt chomhaltaí den Choiste.
(2) I gcás—
(a) Breitheamh den Chúirt Dúiche, ar cúig bliana seascad a aois scoir faoi alt 15 d'Acht 1946, a bheith ar tí an aois sin a shlánú, agus
(b) é do chruthú chun sástachta an Choiste nach bhfuil sé faoi aon mhíchumas a bhéarfadh go mbeadh sé neamhoiriúnach chun leanúint de dhualgais a oifige a chomhlíonadh go héifeachtúil,
féadfaidh an Coiste, más cuí leo é tar éis dul i gcomhairle leis an Aire Dlí agus Cirt, trí bharántas a déanfar sar a slánóidh an Breitheamh sin an aois sin, é a choimeád in oifig ar feadh bliana dar tosach an dáta a shlánós sé an aois sin.
(3) I gcás—
(a) Breitheamh den Chúirt Dúiche lena mbainfidh barántas faoi fho-alt (2) den alt seo nó faoin bhfo-alt seo a bheith ar tí sé bliana seascad, seacht mbliana seascad, ocht mbliana seascad nó naoi mbliana seascad (do réir mar bheas) d'aois a shlánú, agus
(b) é do chruthú chun sástachta an Choiste nach bhfuil sé faoi aon mhíchumas a bhéarfadh go mbeadh sé neamhoiriúnach chun leanúint de dhualgais a oifige a chomhlíonadh go héifeachtúil,
féadfaidh an Coiste, más cuí leo é tar éis dul i gcomhairle leis an Aire Dlí agus Cirt, trí bharántas a déanfar sar a slánóidh an Breitheamh sin an aois sin, é a choimeád in oifig ar feadh bliana dar tosach an dáta a shlánós sé an aois sin.
(4) Beidh éifeacht ag forála an ailt seo d'ainneoin aon ní in alt 15 d'Acht 1946.

3.—In Acht 1946, cuirfear an t-alt seo a leanas in ionad ailt 16—
16. “Ní raghaidh líon na mBreithiún thar a dó ceathrachad tráth ar bith.”

4.—Déantar leis seo na hachtacháin a sonraítear i gcolún (2) den Sceideal a ghabhas leis an Acht seo d'athghairm a mhéid a sonraítear in colún (3) den Sceideal sin.

5.—(1) Féadfar an tAcht Cúirteanna Breithiúnais (An Chúirt Dúiche), 1949, a ghairm den Acht seo.
(2) Féadfar na hAchta Cúirteanna Breithiúnais, 1924 go 1949, a ghairm de na hAchta Cúirteanna Breithiúnais, 1924 go 1947, agus den Acht seo le chéile.

COURTS OF JUSTICE (DISTRICT COURT) ACT, 1949.
The Act of 1946.
1.—In this Act the expression “the Act of 1946” means the Courts of Justice (District Court) Act, 1946 (No. 21 of 1946).
Power to extend retiring age of certain Justices.
2.—(1) (a) In this section the expression “the Committee” means a committee consisting of—
(i) the Chief Justice,
(ii) the President of the High Court, and
(iii) the Attorney General.
(b) The Committee may act by a majority of its members and a warrant under this section shall be sufficiently authenticated if signed by two members of the Committee.
(2) Where—
(a) a Justice of the District Court, whose age of retirement under section 15 of the Act of 1946 is sixty-five years, is about to reach that age, and
(b) he satisfies the Committee that he is not suffering from any disability which would render him unfit to continue to discharge efficiently the duties of his office,
the Committee may, if they so think proper after consultation with the Minister for Justice, by warrant made before such Justice attains the said age, continue him in office for one year commencing on the date on which he will attain the said age.
(3) Where—
(a) a Justice of the District Court to whom a warrant under subsection (2) of this section or under this subsection relates is about to reach the age of (as the case may be) sixty-six, sixty-seven, sixty-eight or sixty-nine years, and
(b) he satisfies the Committee that he is not suffering from any disability which would render him unfit to continue to discharge efficiently the duties of his office,
the Committee may, if they so think proper after consultation with the Minister for Justice, by warrant made before such Justice attains the said age, continue him in office for one year commencing on the date on which he will attain the said age.
(4) The provisions of this section shall have effect notwithstanding anything contained in section 15 of the Act of 1946.
Maximum number of Justices.
3.—In the Act of 1946, the following section shall be substituted for section 16—
16. “The number of Justices at any time shall not exceed forty-two.”
Repeals.
4.—The enactments specified in column (2) of the Schedule to this Act are hereby repealed to the extent specified in column (3) of the said Schedule.
Short title and collective citation.
5.—(1) This Act may be cited as the Courts of Justice (District Court) Act, 1949.
(2) The Courts of Justice Acts, 1924 to 1947, and this Act may be cited together as the Courts of Justice Acts, 1924 to 1949.
