2.—(1) Féadfaidh an tAire, faoi réir an Achta seo agus cibé coinníollacha a fhorchuirfidh an tAire tar éis dó dul i gcomhairle leis an Aire Airgeadais, deontas a thabhairt do dhuine a sheolann gnó, nó a bheartaíonn gnó a sheoladh, sa Stát ar deontas é faoi chomhair caiteachais chaipitil cheadaithe a thabhófar ag soláthar loinge nua nó páirte nó trealaimh nua do long, nó long a chomhshó, le haghaidh úsáide chun críocha an ghnó sin.

(2) Ní fholaíonn an tagairt i bhfo-alt (1) do long a sholáthar tagairt d'í a sholáthar trína cairtfhostú ó dhuine eile.

(3) Íocfar deontais faoin Acht seo as airgead a sholáthróidh an tOireachtas.

3.—(1) Ní thabharfar aon deontas faoin Acht seo—

4.—Déanfaidh an tAire, le toiliú an Aire Airgeadais, méid deontais faoin Acht seo a chinneadh ó am go ham ach ní mó a bheidh sé in aon chás ná fiche a cúig faoin gcéad den chaiteachas caipitil ceadaithe ar faoina chomhair a thabharfar é.

Forálacha ilghnéitheacha maidir le deontais faoin Acht seo.

5.—(1) Féadfar deontas faoin Acht seo a thabhairt faoi chomhair—

(a) caiteachais chaipitil cheadaithe a tabhaíodh nó a thabhófar an 1ú lá d'Aibreán, 1967, nó dá éis, agus

[EN]

(b) caiteachais chaipitil cheadaithe a tabhaíodh roimh an dáta sin a mhéid is aon suim é a íocadh tar éis an dáta sin.

(2) Féadfar deontas faoin Acht seo a thabhairt faoi chomhair caiteachais chaipitil cheadaithe i leith loinge i gcúrsa a déanta má mheasann an tAire go mbeidh forálacha an Achta seo comhallta maidir leis an long nuair a bheidh sí críochnaithe.

Coinníollacha a fhorchuirfear nuair a thabharfar deontas faoin Acht seo.

6.—(1) Le linn don Aire deontas a thabhairt faoin Acht seo forchuirfidh sé cibé coinníollacha is oiriúnach leis chun a áirithiú go leanfar d'aon sócmhainn ar tugadh deontas, nó a bhfuil sé beartaithe deontas a thabhairt, ina leith a úsáid mar a cheanglaíonn na coinníollacha sin agus chun srian a chur le cairtfhostú aon loinge lena mbainfidh, agus féadfaidh na coinníollacha sin a cheangal go n-aisíocfar an deontas nó cuid de in imthosca sonraithe.

(2) Féadfaidh an tAire trí fhógra i scríbhinn a cheangal ar dhuine ar bith a fuair deontas faoin Acht seo, agus ar aon duine a bheidh ag gníomhú thar ceann an duine sin, go dtabharfaidh sé cibé eolas don Aire, nó go dtabharfaidh ar aird le hiniúchadh thar ceann an Aire, cibé leabhair, taifid nó doiciméid eile a shonrófar san fhógra chun a chumasú don Aire a chinneadh an bhfuil aon choinníoll ar ar tugadh an deontas comhallta nó á chomhlíonadh nó an bhfuil an deontas tagtha chun bheith inaisíoctha go hiomlán nó go páirteach de réir aon choinníll den sórt sin.

(3) Féadfaidh fógra faoi fho-alt (2) a cheangal go ndéanfar an t-eolas lena mbainfidh sé a thabhairt laistigh de cibé am a shonrófar san fhógra agus féadfaidh sé a cheangal go dtabharfar doiciméid ar aird cibé tráth agus áit a shonrófar amhlaidh.

Cumhacht chun dul isteach agus áitreabh agus sócmhainní a iniúchadh.

7.—(1) Aon duine a bheidh cuí-údaraithe i scríbhinn ag an Aire féadfaidh sé, chun críocha alt 6 (2) agus gach tráth réasúnach, du isteach in, agus iniúchadh a dhéanamh ar, aon áitreabh ina mbeidh aon sócmhainn ar tugadh deontas ina leith faoin Acht seo (nó ina cheart, de réir aon choinníll a ghabhann leis an deontas, di a bheith agus féadfaidh sé a cheangal ar aon duine a dhealraíonn dó a bheith bhfeighil an áitribh sin an tsócmhainn a thabhairt ar aird nó a thaispeáint chun a hiniúchta.

(2) Tabharfar deimhniú ar a údarás do gach duine a chuí-údarófar faoin alt seo agus, nuair a bheidh aon chumhacht dá dtugtar dó leis an alt seo á feidhmiú aige, déanfaidh sé, má cheanglaítear air é, an deimhniú sin a thabhairt ar aird don duine a dhealraíonn dó a bheith i bhfeighil an áitribh.

8.—(1) Aon duine, agus é á airbheartú aige bheith ag déanamh de réir fógra faoi alt 6, a dhéanfaidh aon ráiteas, nó a thabharfaidh aon doiciméad ar aird, go feasach nó go meargánta, a bheidh bréagach i bponc ábhartha beidh sé ciontach i gcion agus ar a chiontú go hachomair dlífear fíneáil nach mó ná céad punt nó príosúnacht ar feadh téarma nach faide ná trí mhí nó an fhíneáil sin agus an phríosúnacht sin le chéile, nó ar a chiontú ar díotáil, fíneáil nach mó ná míle punt nó príosúnacht ar feadh téarma nach faide ná dhá bhliain, nó an fhíneáil sin agus an phríosúnacht sin le chéile, a chur air.

(2) Aon duine a mhainneoidh, gan leithscéal réasúnach, déanamh de réir fógra faoi alt 6 beidh sé ciontach i gcion agus ar a chiontú go hachomair dlífear fíneáil nach mó ná caoga punt nó, ar a chiontú an dara huair nó aon uair ina dhiaidh sin, céad punt, a chur air.

(3) Aon duine a choiscfidh go toiliúil aon duine a bheidh ag feidhmiú cirt dul isteach agus iniúchta faoi alt 7 nó a mhainneoidh, gan leithscéal réasúnach, déanamh de réir cheanglais faoin alt sin beidh sé ciontach i gcion agus ar a chiontú go hachomair dlífear fíneáil nach mó ná caoga punt a chur air.

(4) Aon duine a mhainneoidh, gan leithscéal réasúnach, aon choinníoll a chomhlíonadh ar ar tugadh deontas faoin alt seo dó, is coinníoll a cheangail air aon teagmhas, a thugann gurb iníoctha go hiomlán nó go páirteach an deontas, a chur in iúl don Aire beidh sé ciontach i gcion agus ar a chiontú go hachomair dlífear fíneáil nach mó ná céad punt nó, ar a chiontú ar díotáil, fíneáil nach mó ná mí le punt nó trí oiread an mhéid is inaisíoctha amhlaidh, cibé acu is mó, a chur air.

9.—Aon duine a dhéanfaidh aon ráiteas nó a thabharfaidh ar aird aon doiciméad d'fhonn deontas a fháil faoin Acht seo agus a dhéanfaidh an ráiteas sin nó a thabharfaidh ar aird an doiciméad sin go feasach meargánta agus an ráiteas nó an doiciméad sin bréagach in aon phonc ábhartha beidh sé ciontach i gcion agus ar a chiontú go hachomair dlífear fíneáil nach mó ná céad punt nó príosúnacht ar feadh téarma nach faide ná trí mhí, nó an fhíneáil sin agus an phríosúnacht sin le chéile, nó, ar a chiontú ar díotáil, fíneáil nach mó ná míle punt nó príosúnacht ar feadh téarma nach faide ná dhá bhliain, nó an fhíneáil sin agus an phríosúnacht sin le chéile, a chur air.

10.—I gcás ina gcruthófar maidir le cion faoin Acht seo ag comhlacht corpraithe go ndearnadh é le toiliú nó le cúlcheadú, nó gurb inchurtha é i leith aon fhaillí de chuid, aon stiúrthóra, bainisteora, rúnaí, nó oifigigh eile dá shamhail sin de chuid an chomhlachta chorpraithe nó aon duine a d'airbheartaigh a bheith ag gníomhú in aon fheidhmeanas den sórt sin beidh sé féin agus an comhlacht corpraithe ciontach sa chion sin agus dlífear imeachtaí a thionscnamh ina gcoinne agus iad a phionósú dá réir sin.

11.—Déanfar na caiteachais a thabhóidh an tAire ag riaradh an Achta seo a íoc, a mhéid a cheadóidh an tAire Airgeadais é, as airgead a sholáthróidh an tOireachtas.

12.—(1) Féadfar an tAcht um Dheontais Infheistíochta Loingis, 1969, a ghairm den Acht seo.

SHIPPING INVESTMENT GRANTS ACT, 1969


AN ACT TO PROVIDE FOR THE MAKING BY THE MINISTER FOR TRANSPORT AND POWER OF GRANTS TOWARDS CAPITAL EXPENDITURE INCURRED IN PROVIDING CERTAIN NEW SHIPS OR PARTS OR EQUIPMENT THEREFOR, AND TO PROVIDE FOR MATTERS CONNECTED WITH THE MATTERS AFORESAID. [20th May, 1969.] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:— [GA]

Definitions.

1.—In this Act—

approved capital expenditure” means expenditure which in the opinion of the Minister is of a capital nature and which has been approved by him for the purposes of a grant under this Act;

[GA]

asset” means any ship, part of a ship or equipment for a ship, in respect of which a grant under this Act has been made;

[GA]

the Minister” means the Minister for Transport and Power.

[GA]

Grants towards capital expenditure incurred in providing ships, etc.

2.—(1) The Minister may, subject to this Act and to such conditions as may be imposed by the Minister after consultation with the Minister for Finance, make to a person carrying on or proposing to carry on a business in the State a grant towards approved capital expenditure incurred in providing, for use for the purposes of that business, a new ship or a new part or equipment for a ship, or in converting a ship for such use.

(2) The reference in subsection (1) to providing a ship does not include a reference to providing it by chartering it from another person.

(3) Grants under this Act shall be paid out of moneys provided by the Oireachtas.

Restriction on making of grants under this Act.

3.—(1) No grant shall be made under this Act to—

[GA]

(a) an individual who is not both a citizen of and ordinarily resident in the State,

[GA]

(b) a body corporate which is not both incorporated and resident in the State, or

[GA]

(c) a partnership, if any of the members thereof is either an individual who is not both a citizen of and ordinarily resident in the State or a body corporate which is not both incorporated and resident in the State.

[GA]

(2) No grant shall be made under this Act in respect of a ship or the provision of a part of, or equipment for, a ship, which—

[GA]

(a) is not registered in the State under Part II of the Mercantile Marine Act, 1955,

[GA]

(b) is of less than 100 tons gross tonnage, or

[GA]

(c) is not self-propelled.

[GA]

(3) No grant shall be made under this Act in respect of—

[GA]

(a) a fishing vessel,

[GA]

(b) a tug, or

[GA]

(c) a vessel (including a dredger) used primarily as a floating platform for working machinery and not employed in normal shipping operations.

Determination and maximum amount of grant under this Act.

4.—The amount of a grant under this Act shall be determined from time to time by the Minister with the consent of the Minister for Finance, but shall not in any case exceed twenty-five per cent. of the approved capital expenditure towards which it is made.

Miscellaneous provisions regarding grants under this Act.

5.—(1) A grant under this Act may be made towards—

[GA]

(a) approved capital expenditure incurred on or after the 1st day of April, 1967, and

[GA]

(b) approved capital expenditure incurred before that date in so far as it consists of any sum paid after that date.

[GA]

(2) A grant under this Act may be made towards approved capital expenditure in respect of a ship in the course of construction if it appears to the Minister that the provisions of this Act will be satisfied in relation to the ship when it is completed.

Conditions imposed in making of grant under this Act.

6.—(1) In making a grant under this Act the Minister shall impose such conditions as he thinks fit for securing that any asset in respect of which a grant has been, or is proposed to be, made will continue to be used as required by those conditions and for restricting the chartering of any ship concerned, and such conditions may require the repayment in specified circumstances of the grant or part thereof.

(2) The Minister may by notice in writing require any person who has received a grant under this Act, and any person acting on that person's behalf, to furnish to the Minister such information, or to produce for examination on behalf of the Minister, such books, records or other documents as may be specified in the notice for the purpose of enabling the Minister to determine whether any condition subject to which the grant was made has been satisfied or is being complied with or whether the grant has become repayable in whole or in part in accordance with any such condition.

(3) A notice under subsection (2) may require the information to which it relates to be furnished within such time as may be specified in the notice and may require documents to be produced at such time and place as may be so specified.

Power to enter and inspect premises and assets.

7.—(1) Any person duly authorised in writing by the Minister may, for the purposes of section 6 (2) and at all reasonable times, enter and inspect any premises where any asset in respect of which a grant under this Act has been made is, (or, in accordance with any condition attached to that grant, should be) and may require any person appearing to him to have charge of those premises to produce or identify the asset for inspection.

(2) Every person duly authorised under this section shall be furnished with a certificate of his authorisation and, when exercising any of the powers conferred on him by this section shall, if so required, produce the said certificate to the person appearing to him to have charge of the premises.

Offences.

8.—(1) Any person who, in purported compliance with a notice under section 6, knowingly or recklessly makes any statement or produces any document which is false in a material particular shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding one hundred pounds or to imprisonment for a term not exceeding three months, or to both such fine and such imprisonment, or, on conviction on indictment, to a fine not exceeding one thousand pounds or to imprisonment for a term not exceeding two years, or to both such fine and such imprisonment.

(2) Any person who without reasonable excuse fails to comply with a notice under section 6 shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding fifty pounds or, on a second or subsequent conviction, one hundred pounds.

(3) Any person who wilfully obstructs a person in the exercise of a right of entry and inspection under section 7 or who without reasonable excuse fails to comply with a requirement under that section shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding fifty pounds.

(4) Any person who without reasonable excuse fails to comply with any condition subject to which a grant under this Act was made to him, being a condition requiring him to inform the Minister of any event whereby the grant becomes repayable in whole or in part, shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding one hundred pounds or, on conviction on indictment, to a fine not exceeding one thousand pounds or three times the amount so repayable, whichever is the greater.

Fraudulent applications for grants under this Act.

9.—Any person who, for the purpose of obtaining a grant under this Act, knowingly or recklessly makes any statement or produces any document which is false in any material particular shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding one hundred pounds or to imprisonment for a term not exceeding three months, or to both such fine and such imprisonment or, on conviction on indictment, to a fine not exceeding one thousand pounds or to imprisonment for a term not exceeding two years, or to both such fine and such imprisonment.

Offences by bodies corporate.

10.—Where an offence under this Act committed by a body corporate is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of, any director, manager, secretary, or other similar officer of the body corporate or any person who was purporting to act in any such capacity, he as well as the body corporate shall be guilty of that offence and shall be liable to be proceeded against and punished accordingly.

Expenses of Minister.

11.—The expenses incurred by the Minister in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.

Short title and commencement.

12.—(1) This Act may be cited as the Shipping Investment Grants Act, 1969.

(2) This Act shall come into operation on such day as the Minister shall by order appoint.
