fínithe.
1.—San Acht seo, ach amháin mar a n-éilíonn an comhthéacs a mhalairt—
folaíonn “tréigthe”, i ndáil le feithicil, fágtha in imthosca nó ar feadh an oiread sin ama gur réasúnach a mheas go bhfuil an fheithicil tréigthe, agus forléireofar focail ghaolmhara dá réir sin;
folaíonn “feidhmeanna” cumhachtaí agus dualgais agus folaíonn tagairt do chomhlíonadh feidhme, maidir le cumhachtaí, tagairt d'fheidhmiú cumhachtaí;
ciallaíonn “comhaontú fruiltiomána”, i ndáil le feithicil inneallghluaiste, comhaontú faoina bhfruilítear an fheithicil óna húinéir cláraithe, seachas—
(a) comhaontú fruilcheannaigh,
(b) comhaontú arb é a aon-aidhm daoine nó earraí a iompar, nó
(c) comhaontú faoina dtiomáineann úinéir cláraithe na feithicle an fheithicil, nó faoina gcuireann sé tiománaí ar fáil don fheithicil;
folaíonn “talamh” aon déanmhas agus aon talamh faoi uisce;
ciallaíonn “maor bruscair” duine atá fostaithe ag údarás áitiúil agus atá údaraithe ag an údarás áitiúil chun feidhmeanna mhaor bruscair faoin Acht seo a chomhlíonadh;
ciallaíonn “údarás áitiúil”—
(a) i gcás contae seachas aon bhuirg nó ceantar uirbeach ann, comhairle an chontae,
(b) i gcás contae-bhuirge nó buirge eile, bardas na buirge, agus
(c) i gcás ceantair uirbigh, comhairle an cheantair,
agus forléireofar aon tagairt do limistéar údaráis áitiúil dá réir sin;
ciallaíonn “an tAire” an tAire Comhshaoil;
folaíonn “áititheoir”, i ndáil le haon talamh, duine atá i dteideal an talamh sin a áitiú agus forléireofar focail ghaolmhara dá réir sin;
ciallaíonn “forordaithe” forordaithe le rialacháin arna ndéanamh ag an Aire;
ciallaíonn “áit phoiblí” aon sráid, bóthar, cladach farraige nó áit eile ar a bhfuil rochtain ag an bpobal de cheart nó le cead faoi réir táille nó saor ó tháille;
tá le “úinéir cláraithe” an bhrí a shanntar dó leis an Acht um Thrácht ar Bhóithre, 1961;
folaíonn “feithicil”—
(a) cuid d'fheithicil,
(b) ní atá deartha mar fheithicil ach nach bhfuil in ann, tráth a thréigthe faoi alt 10 den Acht seo nó a aistrithe faoi alt 11 nó 12 den Acht seo, feidhmiú mar fheithicil,
(c) scib atá deartha nó a úsáidtear lena hiompar ar fheithicil,
(d) lód ar fheithicil.
Dualgas údarás áitiúil bruscar a chosc.
2.—(1) Déanfaidh údarás áitiúil bearta chun déanamh bruscair a chosc, agus chun iardraí dochrach bruscair a chosc agus a shárú, ina limistéar agus chun bruscar a dhiúscairt agus féadfaidh sé, chun na gcríocha sin, socruithe a dhéanamh le daoine eile nó cabhrú le daoine eile (lena n-áirítear údaráis áitiúla eile) chun na bearta sin a dhéanamh nó ag déanamh na mbeart sin dóibh, thar ceann an údaráis.
(2) Ar na bearta a dhéanfar de bhun fho-alt (1) den alt seo féadfar iad seo a leanas a áireamh—
(a) bearta chun bruscar a bhailiú agus a dhiúscairt,
(b) bearta chun an pobal a spreagadh le bheith páirteach i mbailiú agus i ndiúscairt bruscair agus chun iardraí dochrach bruscair a chosc agus a shárú,
(c) bearta chun athchúrsáil iarmhair a éascú agus a spreagadh, agus
(d) oibreacha a ghlacadh de láimh agus saoráidí agus seirbhísí a sholáthar lena n-áirítear seirbhísí poiblíochta, comhairle agus oideachais.
Déanamh bruscair a hoirmeasc.
3.—(1) Ní dhéanfaidh duine—
(a) aon substaint, ábhar nó rud a leagan in aon áit, bíodh sé i ngabhdán nó ná bíodh, lena bhailiú ag údarás áitiúil nó thar a cheann, nó
(b) aon substaint, ábhar nó rud
(i) a chur, nó a fhágáil ar dhóigh eile, in aon áit, nó
(ii) a chaitheamh síos, in aon áit,
sa chaoi go ndéanfar nó gur dóigh go ndéanfar bruscar in áit phoiblí nó bruscar is infheicthe ó áit phoiblí.
(2) Ní dhéanfaidh duine aon substaint, ábhar nó rud a luchtú, a iompar, a dhíluchtú ná a láimhsiú ná a phróiseáil ar dhóigh eile, ná ní sheolfaidh trádáil, ar shlí go ndéanfar nó gur dóigh go ndéanfar bruscar in áit phoiblí nó bruscar is infheicthe ó áit phoiblí.
(3) Duine a sháróidh fo-alt (1) nó (2) den alt seo beidh sé ciontach i gcion.
(4) Ní fhorléireofar aon ní san alt seo nó in alt 4 den Acht seo mar ní a thoirmisceann—
(a) aon substaint, ábhar nó rud a leagan i ngabhdán a sholáthraítear don leagan sin in aon áit,
(b) gabhdán ina bhfuil aon substaint, ábhar nó rud a leagan in aon áit lena bhailiú ag údarás áitiúil nó thar a cheann,
(c) aon substaint, ábhar nó rud a leagan i ngabhdán in aon áit lena athchúrsáil,
(d) iarmhar a dhiúscairt—
(i) in áit a bheidh curtha ar fáil ag údarás áitiúil chun na críche sin, nó
(ii) de réir chead faoi Chuid IV den Acht Rialtais Áitiúil (Pleanáil agus Forbairt), 1963, faoi Rialacháin na gComhphobal Eorpach (Iarmhar), 1979 (I.R. Uimh. 390 de 1979), faoi Rialacháin na gComhphobal Eorpach (Iarmhar) (Uimh. 2), 1979 (I.R. Uimh. 388 de 1979), nó faoi Rialacháin na gComhphobal Eorpach (Iarmhar Tocsaineach agus Contúirteach), 1982 (I.R. Uimh. 33 de 1982),
ar choinníoll go nglacfar cúram réasúnach chun déanamh bruscair a chosc.
(5) Má úsáidtear feithicil inneallghluaiste (seachas feithicil seirbhíse poiblí) ag déanamh cion faoi fho-alt (3) den alt seo—
(a) beidh úinéir cláraithe na feithicle,
(b) beidh fruilitheoir na feithicle, má bhíonn an fheithicil faoi réir chomhaontú fruiltiomána tráth an chiona a dhéanamh, agus
(c) beidh an duine a mbeidh an fheithicil á húsáid aige tráth an chiona a dhéanamh, murab é úinéir cláraithe nó fruilitheoir na feithicle an duine a mbeidh an fheithicil á húsáid aige an tráth sin,
ciontach i gcion i dteannta aon duine a bheidh ciontach sa chion chéadluaite.
(6) I gcás arb é úinéir cláraithe na feithicle áirithe duine a bheidh cúisithe i gcion faoi fho-alt (5) den alt seo, is cosaint dó a shuíomh go raibh an fheithicil á húsáid, tráth an chiona a dhéanamh, ag duine eile agus—
(a) gur úsáid neamhúdaraithe an úsáid sin, nó
(b) go raibh an fheithicil faoi réir chomhaontú fruiltiomána an tráth sin.
(7) I gcás ar duine a raibh an fheithicil ar fruiliú aige faoi chomhaontú fruiltiomána tráth an chiona a dhéanamh an duine a bheidh cúisithe i gcion faoi fho-alt (5) den alt seo, is cosaint dó a shuíomh go raibh an fheithicil á húsáid, tráth an chiona a dhéanamh, ag duine eile agus gur úsáid neamhúdaraithe an úsáid sin.
(8) San alt seo tá le “feithicil inneallghluaiste” agus le “feithicil seirbhíse poiblí” na bríonna a shanntar dóibh leis an Acht um Thrácht ar Bhóithre, 1961.
Dualgas áititheoirí talún i ndáil le bruscar.
4.—(1) Déanfaidh an duine is áititheoir ar aon talamh (nach bóthar poiblí ná foirgneamh ná déanmhas eile) is áit phoiblí an talamh a choimeád saor ó bhruscar.
(2) Déanfaidh an duine is áititheoir ar aon talamh (seachas foirgneamh nó déanmhas eile) nach áit phoiblí an talamh a choimeád saor ó bhruscar is infheicthe ó áit phoiblí.
(3) Féadfaidh údarás áitiúil, ar cibé téarmaí agus coinníollacha ar a gcomhaontóidh sé féin agus an duine is áititheoir ar aon talamh ina limistéar ar a bhfuil bruscar, más dealraitheach don údarás áitiúil gur chóir, ar mhaithe le taitneamhacht nó le timpeallacht limistéir, an bruscar a aistriú as nó bearta eile a dhéanamh i ndáil leis—
(a) trína sheirbhísigh nó a ghníomhairí, an bruscar a aistriú as agus a dhiúscairt, nó bearta eile a dhéanamh i ndáil leis, agus
(b) chun na gcríocha sin, trína sheirbhísigh nó a ghníomhairí, dul isteach ar an talamh.
(4) Féadfaidh údarás áitiúil le fodhlíthe a cheangal ar dhaoine is áititheoirí ar aon talamh ina limistéar nó ar thalamh ina limistéar is de chineái sonraithe nó de chineálacha sonraithe nó ar thalamh i limistéar sonraithe nó i limistéir shonraithe dá limistéar—
(a) aon chosán nó pábháil atá tadhlach leis an talamh, agus ar bóthar poiblí é nó ar cuid de bhóthar poiblí é, agus aon ródgháitéar ar aon chosán nó pábháil, nó le taobh aon chosáin nó pábhála den sórt sin, agus is cuid de bhóthar poiblí,
(b) aon ródgháitéar atá tadhlach leis an talamh agus is cuid de bhóthar poiblí, agus
(c) aon limistéar talún is cuid de bhóthar poiblí idir aon chosán nó pábháil den sórt sin agus carrbhealach (más ann) an bhóthair phoiblí agus aon ródgháitéar atá tadhlach leis an limistéar talún sin agus is cuid de bhóthar poiblí,
a choimeád saor ó bhruscar.
(5) Duine a sháróidh fo-alt (1) nó (2) den alt seo nó fodhlí faoi fho-alt (4) den alt seo beidh sé ciontach i gcion.
(6) In ionchúiseamh mar gheall ar chion faoin alt seo, is cosaint é a shuíomh go ndearnadh bearta réasúnacha chun an talamh lena mbaineann an t-ionchúiseamh a choimeád saor ó bhruscar.
(7) Bainfidh forálacha ailt 221 agus 223 den Public Health (Ireland) Act, 1878, le fodhlíthe arna ndéanamh faoin alt seo mar a bhaineann siad le fodhlíthe arna ndéanamh faoin Acht sin.
(8) Féadfaidh fodhlíthe faoin alt seo cibé forálacha teagmhasacha, forlíontacha agus iarmhartacha a bheith iontu is dealraitheach don údarás áitiúil a bheidh ag déanamh na bhfodhlíthe a bheith riachtanach chun críocha na bhfodhlíthe.
(9) San alt seo tá le “bóthar poiblí” an bhrí a shanntar dó leis an Acht Rialtais Áitiúil (Bóithre agus Mótarbhealaí), 1974.
Forálacha maidir le cionta áirithe i ndáil le bruscar.
5.—(1) I gcás forais réasúnacha a bheith ag maor bruscair chun a chreidiúint go bhfuil cion á dhéanamh nó déanta ag duine faoi alt 3 den Acht seo, féadfaidh sé fógra a thabhairt don duine sin san fhoirm fhorordaithe nó i bhfoirm sa chéill chéanna á rá—
(a) go líomhnaítear go bhfuil an cion déanta ag an duine,
(b) go bhféadfaidh an duine, i rith na tréimhse 21 lá dar tosach dáta an fhógra, íocaíocht £5, agus an fógra ag gabháil léi, a thabhairt don údarás áitiúil a bheidh sonraithe san fhógra,
(c) nach dtionscnófar ionchúiseamh maidir leis an gcion líomhnaithe i rith na tréimhse a bheidh sonraithe san fhógra agus, má dhéantar an íocaíocht a bheidh sonraithe san fhógra a thabhairt i rith na tréimhse sin, nach dtionscnófar aon ionchúiseamh maidir leis an gcion líomhnaithe.
(2) I gcás ina dtabharfar fógra faoi fho-alt (1) den alt seo—
(a) féadfaidh duine lena mbaineann an fógra, i rith na tréimhse a bheidh sonraithe san fhógra, an íocaíocht a bheidh sonraithe san fhógra, agus an fógra ag gabháil léi, a thabhairt don údarás áitiúil a bheidh sonraithe san fhógra,
(b) féadfaidh an t-údarás áitiúil sin an íocaíocht a fháil, admháil a eisiúint ina leith agus an t-airgead a íocadh amhlaidh a choinneáil lena dhiúscairt de réir an Achta seo, agus ní fhéadfaidh an duine a thug aon íocaíocht a fuarthas amhlaidh an íocaíocht sin a fháil ar ais in imthosca ar bith,
(c) ní thionscnófar ionchúiseamh maidir leis an gcion líomhnaithe i rith na tréimhse a bheidh sonraithe san fhógra, agus, má dhéantar an íocaíocht a bheidh sonraithe san fhógra a thabhairt i rith na tréimhse sin, ní thionscnófar aon ionchúiseamh maidir leis an gcion líomhnaithe.
(3) In ionchúiseamh mar gheall ar chion faoi alt 3 den Acht seo, is ar an gcosantóir a bheidh sé a shuíomh gur tugadh íocaíocht de bhun fógra faoin alt seo.
(4) Féadfaidh an tAire le rialacháin an méid a bheidh sonraithe de thuras na huaire i bhfo-alt (1) (b) den alt seo a athrú agus beidh éifeacht leis an bhfo-alt sin (1) (b) de réir théarmaí aon rialachán den sórt sin.
Forálacha i ndáil le maoir bhruscair.
6.—(1) Duine a bhacfaidh nó a choiscfidh maor bruscair ag gníomhú dó i gcomhlíonadh na bhfeidhmeanna a thugtar dó leis an Acht seo beidh sé ciontach i gcion.
(2) I gcás forais réasúnacha a bheith ag maor bruscair chun a chreidiúint go bhfuil cion á dhéanamh nó déanta ag duine faoi alt 3 nó 7 (seachas cion faoin alt sin 7 lena mbaineann fo-alt (2) den alt sin) den Acht seo, nó faoi fho-alt (1) den alt seo, féadfaidh sé a iarraidh ar an duine sin a ainm agus a sheoladh a thabhairt, agus féadfaidh sé a iarraidh go ndéanfar an fhaisnéis a tugadh a fhíorú.
(3) Duine a n-iarrfar air faoin alt seo a ainm agus a sheoladh a thabhairt agus a dhiúltóidh nó a mhainneoidh a ainm nó a sheoladh a thabhairt, nó a thabharfaidh ainm nó seoladh atá bréagach nó míthreorach, beidh sé ciontach i gcion.
(4) Ní bheidh de cheangal ar dhuine géilleadh d'iarraidh ó mhaor bruscair faoin alt seo mura dtabharfaidh an maor ar aird, ar an duine á iarraidh, barántas a cheaptha mar mhaor bruscair.
(5) Más é tuairim comhalta den Gharda Síochána go bhfuil cion faoin alt seo á dhéanamh nó déanta ag duine, féadfaidh sé an duine a ghabháil gan bharántas.
Nithe agus fógráin ar dhéanmhais áirithe etc., agus aghlot déanmhas áirithe etc., a thoirmeasc.
7.—(1) I gcás aon déanmhas nó aon talamh eile, doras, geata, fuinneog, crann, cuaille nó post a bheith in aon áit phoiblí nó ar aghaidh áit phoiblí amach, ní dhéanfaidh duine nach é úinéir ná áititheoir an chéanna é ná nach é an duine é atá i bhfeighil an chéanna—
(a) aon ní ná aon fhógrán a thaisealbhadh, ná a chur faoi deara é a thaisealbhadh, ar an gcéanna, ná
(b) aon aghlot a dhéanamh, ná a chur faoi deara é a dhéanamh, le scríbhneoireacht nó le marcanna eile,
mura mbeidh sé údaraithe sin a dhéanamh ag an úinéir sin nó ag an áititheoir sin nó ag an duine i bhfeighil amhlaidh nó le haon achtachán nó faoi aon achtachán.
(2) Gan dochar do dhliteanas aon duine eile faoi fho-alt (1) den alt seo, má dhéantar sárú ar an bhfo-alt sin, measfar—
(a) i gcás fógrán i dtaobh cruinniú nó teagmhas eile, maidir leis an duine atá ag tionscnamh nó ag socrú an chruinnithe nó an teagmhais, agus
(b) i gcás aon fhógráin eile, maidir leis an duine ar thar a cheann a taisealbhadh an fógrán,
an fo-alt sin a bheith sáraithe aigesean freisin.
(3) Féadfaidh údarás áitiúil, ar cibé téarmaí agus coinníollacha ar a gcomhaontóidh sé féin agus an t-áititheoir áirithe, i gcás ní, fógrán nó aghlot ina limistéar a bhfuil sárú i ndáil leis ar fho-alt (1) den alt seo—
(a) trína sheirbhísigh nó a ghníomhairí, an ní nó an fógrán sin a aistriú as nó, de réir mar a bheidh, an t-aghlot sin a dhíchur nó a leigheas ar shlí eile, agus
(b) chun na gcríocha sin, trína sheirbhísigh nó a ghníomhairí, dul isteach sa déanmhas nó ar an talamh áirithe eile nó sa déanmhas nó ar an talamh eile ar a bhfuil an doras, an geata, an fhuinneog, an crann, an cuaille nó an post áirithe.
(4) In ionchúiseamh mar gheall ar chion faoin alt seo i ndáil le sárú ar fho-alt (1) den alt seo, ní gá don ionchúiseamh a shuíomh, agus toimhdeofar nó go suífidh an cosantóir a mhalairt, nárbh é an cosantóir úinéir ná áititheoir an déanmhais nó na talún eile, an dorais, an gheata, na fuinneoige, an chrainn, an chuaille nó an phoist ná nárbh é a bhí i bhfeighil an chéanna agus nach raibh sé údaraithe mar atá ráite i bhfo-alt (1) den alt seo.
(5) Duine a sháróidh fo-alt (1) den alt seo nó a meastar an fo-alt sin a bheith sáraithe aige nó a bhacfaidh nó a choiscfidh údarás áitiúil nó seirbhísigh nó gníomhairí údaráis áitiúil ag gníomhú dó nó dóibh i gcomhlíonadh na bhfeidhmeanna a thugtar d'údarás áitiúil le fo-alt (3) den alt seo, beidh sé ciontach i gcion.
(6) Ní thionscnófar ionchúiseamh i gcás ina líomhnófar cion faoin alt seo a bheith déanta i ndáil le fógrán más rud é—
(a) gur forbairt dhíolmhaithe de réir bhrí an Achta Rialtais Áitiúil (Pleanáil agus Forbairt), 1963, an fógrán, nó
(b) gur fógrán é—
(i) a fhógraíonn cruinniú poiblí, nó
(ii) a bhaineann le toghchán uachtaráin de réir bhrí Acht Toghachán an Uachtaráin, 1937, le holltoghchán nó le corrthoghchán, de réir na brí atá, i ngach cás, le “toghachán ginearálta” agus “toghachán corra” san Acht Timpeal Toghachán, 1923, le toghchán áitiúil, le reifreann, de réir bhrí Acht an Reifrinn, 1942, nó le toghchán ionadaithe chun Tionól na gComhphobal Eorpach,
mura mbeidh an fógrán in ionad ar feadh seacht lá nó níos faide tar éis an lae a bheidh sonraithe san fhógrán don chruinniú nó tar éis an lae is déanaí ar ar tógadh an vótaíocht don toghchán, don chorrthoghchán nó don reifreann áirithe.
(7) D'ainneoin alt 19 den Acht seo, ní bheidh feidhm ag alt 80 den Acht Rialtais Áitiúil (Pleanáil agus Forbairt), 1963, i ndáil le cion faoin alt seo.
(8) San alt seo agus in alt 8 den Acht seo—
ciallaíonn “áititheoir”, i ndáil le doras, geata, fuinneog nó crann, an duine is áititheoir ar an déanmhas nó an talamh eile ar a bhfuil an doras, an geata, an fhuinneog nó an crann, de réir mar a bheidh, agus, i ndáil le cuaille nó post, ciallaíonn sé úinéir an chuaille nó an phoist;
tá le “déanmhas” an bhrí a shanntar dó leis an Acht Rialtais Áitiúil (Pleanáil agus Forbairt), 1963.
Cumhachtaí údarás áitiúil i ndáil le nithe agus fógráin ar dhéanmhais áirithe etc. agus i ndáil le haghlot déanmhas áirithe etc.
8.—(1) I gcás aon déanmhas nó aon talamh eile, doras, geata, fuinneog, crann, cuaille nó post i limistéar aon údaráis áitiúil a bheith in aon áit phoiblí nó ar aghaidh áit phoiblí amach agus gur dealraitheach don údarás sin gur chóir, ar mhaithe le taitneamhacht nó le timpeallacht limistéir, aon ní nó fógrán atá ar taisealbhadh air a aistriú as nó aon aghlot air le scríbhneoireacht nó le marcanna eile a dhíchur nó a leigheas ar shlí eile nó gur chóir bearta sonraithe eile a dhéanamh i ndáil leis an ní, leis an bhfógrán nó leis an aghlot, de réir mar a bheidh, féadfaidh an t-údarás áitiúil fógra san fhoirm fhorordaithe nó i bhfoirm sa chéill chéanna a sheirbheáil ar an áititheoir áirithe á cheangal air an ní nó an fógrán a aistriú as, nó an t-aghlot a dhíchur nó a leigheas ar shlí eile, nó bearta sonraithe eile a dhéanamh i ndáil leis an ní, leis an bhfógrán nó leis an aghlot, de réir mar a bheidh, laistigh de thréimhse a bheidh sonraithe san fhógra ach nach lú ná mí—
(a) tar éis dáta an fhógra a sheirbheáil, nó
(b) má dhéantar achomharc i gcoinne an fhógra faoi fho-alt (2) den alt seo, tar éis dáta an achomhairc a chinneadh, nó
(c) má dhéantar achomharc den sórt sin agus go dtarraingeofar siar é, tar éis dáta an achomhairc a tharraingt siar.
(2) Duine ar a seirbheálfar fógra faoin alt seo, féadfaidh sé, laistigh de 21 lá ó dháta an fhógra a sheirbheáil, achomharc a dhéanamh chun na Cúirte Dúiche i gcoinne an fhógra agus féadfaidh an Chúirt Dúiche an fógra a dhaingniú, modhnaithe nó gan mhodhnú, nó féadfaidh sí an fógra a chealú.
(3) I gcás ina seirbheálfar fógra ar dhuine faoin alt seo—
(a) mura ndéanfaidh an duine achomharc i gcoinne an fhógra faoi fho-alt (2) den alt seo, comhlíonfaidh sé téarmaí an fhógra laistigh den tréimhse a bheidh sonraithe san fhógra, agus
(b) má dhéanann an duine achomharc i gcoinne an fhógra faoin bhfo-alt sin agus go ndaingneoidh an Chúirt Dúiche an fógra, modhnaithe nó gan mhodhnú, comhlíonfaidh sé téarmaí an fhógra, nó a théarmaí arna modhnú ag an gCúirt Dúiche, de réir mar a bheidh, laistigh den tréimhse a bheidh sonraithe san fhógra tar éis dáta an achomhairc a chinneadh, agus
(c) má dhéanann an duine achomharc i gcoinne an fhógra agus go dtarraingeoidh sé an t-achomharc siar, comhlíonfaidh sé téarmaí an fhógra laistigh den tréimhse a bheidh sonraithe san fhógra tar éis dáta na tarraingthe siar.
(4) Nuair a bheidh fógra á dhaingniú ag an gCúirt faoi fho-alt (2) den alt seo, féadfaidh sí, más deimhin léi nárbh é an t-áititheoir áirithe a rinne nó nach le toiliú uaidh a rinneadh—
(a) an ní nó an fógrán áirithe a thaisealbhadh, nó
(b) an t-aghlot áirithe a chur i gcrích,
a ordú gurb é an t-údarás áitiúil áirithe a íocfaidh an caiteachas go léir, nó cuid den chaiteachas, a tabhaíodh le réasún ag cur an fhógra i ngníomh.
(5) Más rud é, i ndáil le fógra faoin alt seo, go sárófar fo-alt (3) den alt seo, féadfaidh an t-údarás áitiúil áirithe, faoi réir fhorálacha an ailt seo, trína sheirbhísigh nó a ghníomhairí—
(a) éifeacht a thabhairt do théarmaí an fhógra, agus
(b) i gcás ar gá sin chun na críche sin, dul isteach, trína sheirbhísigh nó a ghníomhairí, sa déanmhas nó ar an talamh áirithe eile nó sa déanmhas nó ar an talamh eile ar a bhfuil an doras, an geata, an fhuinneog, an crann, an cuaille nó an post áirithe.
agus féadfaidh sé cibé cuid (más aon chuid í) den chaiteachas a thabhaigh sé le réasún á dhéanamh sin agus nach mbeidh ordaithe a bheith le híoc ag an údarás le hordú faoi fho-alt (4) den alt seo a ghnóthú ón áititheoir áirithe mar fhiach conartha shimplí in aon chúirt dlínse inniúla.
(6) Sula bhfeidhmeoidh údarás áitiúil aon fheidhmeanna a thugtar dó le fo-alt (5) den alt seo, déanfaidh sé, 7 lá ar a laghad roimh dháta an fheidhmithe sin, fógra san fhoirm fhorordaithe nó i bhfoirm sa chéill chéanna a sheirbheáil ar an duine áirithe is áititheoir ar aon déanmhas nó talamh eile nó ar aon doras, geata, fuinneog, crann, cuaille nó post lena mbaineann an fógra, á rá go bhfuil ar intinn aige sin a dhéanamh.
(7) Féadfaidh údarás áitiúil, ar cibé téarmaí agus coinníollacha ar a gcomhaontóidh sé féin agus an t-áititheoir áirithe, maidir le ní, fógrán nó aghlot lena mbaineann fo-alt (1) den alt seo—
(a) trína sheirbhísigh nó a ghníomhairí, an ní nó an fógrán a aistriú as nó an t-aghlot a leigheas nó, de réir mar is iomchuí, bearta eile a dhéanamh i ndáil leis sin, agus
(b) chun na gcríocha sin, trína sheirbhísigh nó a ghníomhairí, dul isteach sa déanmhas nó ar an talamh áirithe eile nó sa déanmhas nó ar an talamh eile ar a bhfuil an doras, an geata, an fhuinneog, an crann, an cuaille nó an post áirithe.
(8) Duine a sháróidh fo-alt (3) den alt seo nó a bhacfaidh nó a choiscfidh—
(a) údarás áitiúil nó a sheirbhísigh nó a ghníomhairí ag gníomhú dó nó dóibh i gcomhlíonadh na bhfeidhmeanna a thugtar d'údarás áitiúil le fo-alt (5) nó (7) den alt seo, nó
(b) duine nó a sheirbhísigh nó a ghníomhairí ag gníomhú dó nó dóibh i gcomhlíonadh téarmaí fógra faoin alt seo,
beidh sé ciontach i gcion.
(9) In ionchúiseamh mar gheall ar chion i leith sárú ar fho-alt (3) den alt seo, is cosaint é a shuíomh—
(a) go raibh taisealbhadh an fhógráin áirithe de réir chead faoi Chuid IV den Acht Rialtais Áitiúil (Pleanáil agus Forbairt), 1963, nó
(b) go ndearnadh bearta réasúnacha chun forálacha an fho-ailt sin a chomhlíonadh, nó
(c) in imthosca uile an cháis—
(i) go mbeadh costas nó deacracht as cuimse ag gabháil le comhlíonadh na bhforálacha sin, nó
(ii) go mbeadh sé míréasúnach a cheangal go gcomhlíonfaí na forálacha sin.
(10) Is forbairt dhíolmhaithe, de réir bhrí an Achta Rialtais Áitiúil (Pleanáil agus Forbairt), 1963, aon fhorbairt, de réir bhrí an Achta sin, a dhéanfar de bhun fógra faoi fho-alt (1) den alt seo nó faoi fhógra den sórt sin arna mhodhnú faoi fho-alt (2) den alt seo.
Dualgas údarás áitiúil áiteanna a sholáthar chun feithiclí agus dramh-mhiotal a thréigean.
9.—(1) Tar éis d'údarás áitiúil an t-ábhar a scrúdú, soláthróidh sé nó cuirfidh sé faoi deara go soláthrófar (trí údarás áitiúil eile nó ar dhóigh eile) cibé áit nó áiteanna ina bhféadfar feithiclí nó dramh-mhiotal a thréigean is dealraitheach dó a bheith riachtanach agus réasúnach.
(2) Féadfaidh údarás áitiúil táille a fhorchur ina mbeidh cibé méid a mheasfaidh sé is réasúnach agus a shocróidh sé ó am go ham i leith feithiclí nó dramh-mhiotal a ghlacadh i gcóiríocht a bheidh curtha ar fáil aige faoin alt seo is feithiclí nó dramh-mhiotal a tugadh go dtí an chóiríocht lena dtréigean ansin.
(3) Ar fheithicil nó dramh-mhiotal a bheith fágtha in áit a bheidh curtha ar fáil ag údarás áitiúil nó thar ceann údaráis áitiúil faoin alt seo, measfar an céanna a bheith tréigthe agus féadfaidh an t-údarás áitiúil an fheithicil nó an dramh-mhiotal a dhiúscairt nó a ndiúscairt a thabhairt chun críche.
Toirmeasc ar fheithiclí a thréigean.
10.—(1) Ní thréigfear feithicil ar aon talamh.
(2) I gcás ina sárófar fo-alt (1) den alt so beidh—
(a) an duine a chuir an fheithicil san áit ar tréigeadh í, agus
(b) má bhíonn úinéir cláraithe ar an bhfeithicil agus murab é an duine réamhráite a húinéir cláraithe, an t-úinéir cláraithe,
araon, ciontach i gcion.
(3) In ionchúiseamh mar gheall ar chion faoin alt seo i ndáil le talamh is cosaint é a shuíomh gur le toiliú ó áititheoir na talún a tréigeadh an fheithicil.
(4) I gcás arb é úinéir cláraithe na feithicle áirithe duine a bheidh cúisithe i gcion faoin alt seo, is cosaint dó a shuíomh nár údaraigh seisean tréigean na feithicle.
Cumhachtaí údarás áitiúil i ndáil le feithiclí tréigthe.
11.—(1) I gcás ar dealraitheach d'údarás áitiúil gur tréigeadh feithicil ar aon talamh ina limistéar, de shárú ar alt 10 den Acht seo, féadfaidh an t-údarás, faoi réir fhorálacha an ailt seo, trína sheirbhísigh nó a ghníomhairí, dul isteach ar an talamh agus an fheithicil a aistriú as.
(2) Déanfaidh údarás áitiúil, sula n-aistreoidh sé feithicil ó thalamh áitithe faoin alt seo, fógra san fhoirm fhorordaithe nó i bhfoirm sa chéill chéanna a sheirbheáil ar áititheoir na talún á rá go bhfuil ar intinn aige an fheithicil a aistriú as.
(3) Ní dhéanfaidh údarás áitiúil feithicil ar seirbheáladh fógra ina leith faoi fho-alt (2) den alt seo a aistriú as aon talamh—
(a) mura dtoileoidh áititheoir na talún leis an aistriú as, nó
(b) mura rud é nach mbeidh agóid déanta ag an áititheoir in aghaidh an aistrithe as agus go mbeidh 14 lá ar a laghad caite ón dáta ar sheirbheáil an t-údarás fógra air faoi fho-alt (2) den alt seo i ndáil leis an bhfeithicil.
(4) Féadfaidh údarás áitiúil feithicil a d'aistrigh sé as faoin alt seo a stóráil, nó a stóráil a thabhairt chun críche (trí údarás áitiúil eile nó ar dhóigh eile).
(5) Duine a bhacfaidh nó a choiscfidh údarás áitiúil nó a sheirbhísigh nó a ghníomhairí ag gníomhú dó nó dóibh i gcomhlíonadh na bhfeidhmeanna a thugtar d'údarás áitiúil leis an alt seo beidh sé ciontach i gcion.
(6) Ní bheidh feidhm ag an alt seo i ndáil le feithicil (seachas scib) a tréigeadh ar bhóthar poiblí de réir bhrí an Achta um Thrácht ar Bhóithre, 1961, nó i gcarrloc arna sholáthar faoi alt 101 den Acht sin.
Cumhachtaí údarás áitiúil i ndáil le feithiclí agus nithe áirithe ar thalamh.
12.—(1) I gcás ar dealraitheach d'údarás áitiúil gur chóir ar mhaithe le taitneamhacht nó le timpeallacht limistéir aon fheithiclí nó nithe eile (ar nithe iad atá as úsáid) a choimeádtar ar aon talamh ina limistéar lena ndíchóimeáil, lena n-athchóiriú, lena ndeisiú, lena stóráil nó lena ndíol, a aistriú as nó gur chóir bearta eile a dhéanamh i ndáil leo, féadfaidh sé fógra san fhoirm fhorordaithe nó i bhfoirm sa chéill chéanna a sheirbheáil ar an duine (más ann) is áititheoir ar an talamh nó ar an duine a mbeidh na feithiclí nó na nithe sin á gcoimeád aige á cheangal air na feithiclí nó na nithe a aistriú as an talamh nó bearta sonraithe eile a dhéanamh i ndáil leo laistigh de thréimhse a bheidh sonraithe san fhógra ach nach lú ná mí—
(a) tar éis dáta an fhógra a sheirbheáil, nó
(b) má dhéantar achomharc i gcoinne an fhógra faoi fho-alt (2) den alt seo, tar éis dáta an achomhairc a chinneadh, nó
(c) má dhéantar achomharc den sórt sin agus go dtarraingeofar siar é, tar éis dáta an achomhairc a tharraingt siar.
(2) Duine ar a seirbheálfar fógra faoin alt seo, féadfaidh sé, laistigh de 21 lá ó dháta an fhógra a sheirbheáil, achomharc a dhéanamh chun na Cúirte Dúiche i gcoinne an fhógra agus féadfaidh an Chúirt Dúiche an fógra a dhaingniú, modhnaithe nó gan mhodhnú, nó féadfaidh sí an fógra a chealú.
(3) I gcás ina seirbheálfar fógra ar dhuine faoin alt seo—
(a) mura ndéanfaidh an duine achomharc i gcoinne an fhógra faoi fho-alt (2) den alt seo, comhlíonfaidh sé téarmaí an fhógra laistigh den tréimhse a bheidh sonraithe san fhógra tar éis dáta an fhógra a sheirbheáil, agus
(b) má dhéanann an duine achomharc i gcoinne an fhógra faoin bhfo-alt sin agus go ndaingneoidh an Chúirt Dúiche an fógra, modhnaithe nó gan mhodhnú, comhlíonfaidh sé téarmaí an fhógra nó a théarmaí arna modhnú ag an gCúirt Dúiche, de réir mar a bheidh, laistigh den tréimhse a bheidh sonraithe san fhógra tar éis dáta an achomhairc a chinneadh, agus
(c) má dhéanann an duine achomharc i gcoinne an fhógra agus go dtarraingeoidh sé an t-achomharc siar, comhlíonfaidh sé téarmaí an fhógra laistigh den tréimhse a bheidh sonraithe san fhógra tar éis dáta na tarraingthe siar.
(4) Más rud é, i ndáil le fógra faoin alt seo, go sárófar fo-alt (3) den alt seo, féadfaidh an t-údarás áitiúil áirithe, faoi réir fhorálacha an ailt seo, trína sheirbhísigh nó a ghníomhairí—
(a) éifeacht a thabhairt do théarmaí an fhógra, agus
(b) i gcás ar gá sin chun na gcríocha sin, dul isteach, trína sheirbhísigh nó a ghníomhairí, ar an talamh lena mbaineann an fógra, agus na feithiclí áirithe nó na nithe áirithe eile a aistriú as agus a stóráil, nó a stóráil a thabhairt chun críche (trí údarás áitiúil eile nó ar dhóigh eile),
agus féadfaidh sé an caiteachas a thabhaigh sé le réasún á dhéanamh sin a ghnóthú ón duine ar ar seirbheáladh an fógra mar fhiach conartha shimplí in aon chúirt dlínse inniúla.
(5) Sula bhfeidhmeoidh údarás áitiúil aon fheidhmeanna a thugtar dó le fo-alt (4) den alt seo, déanfaidh sé, 7 lá ar a laghad roimh dháta an fheidhmithe sin, fógra san fhoirm fhorordaithe nó i bhfoirm sa chéill chéanna a sheirbheáil ar an duine (más ann) is áititheoir ar an talamh áirithe nó ar an duine atá ag coimeád na bhfeithiclí áirithe nó na nithe áirithe eile ar an talamh áirithe á rá go bhfuil ar intinn aige sin a dhéanamh.
(6) Féadfaidh údarás áitiúil, ar cibé téarmaí agus coinníollacha ar a gcomhaontóidh sé féin agus an duine (más ann) is áititheoir ar aon talamh ar a gcoimeádtar feithiclí nó nithe eile lena mbaineann fo-alt (1) den alt seo nó an duine a mbeidh na feithiclí nó na nithe á gcoimeád aige amhlaidh, más dealraitheach don údarás áitiúil gur chóir, ar mhaithe le taitneamhacht nó le timpeallacht limistéir, iad a aistriú as nó gur chóir bearta eile a dhéanamh i ndáil leo—
(a) trína sheirbhísigh nó a ghníomhairí, na feithiclí nó na nithe a aistriú as agus a dhiúscairt nó a stóráil nó, de réir mar is iomchuí, bearta eile a dhéanamh i ndáil leo, agus
(b) chun na gcríocha sin, trína sheirbhísigh nó a ghníomhairí, dul isteach ar an talamh.
(7) Duine a sháróidh fo-alt (3) den alt seo nó a bhacfaidh nó a choiscfidh údarás áitiúil nó a sheirbhísigh nó a ghníomhairí ag gníomhú dó nó dóibh i gcomhlíonadh na bhfeidhmeanna a thugtar d'údarás áitiúil le fo-alt (4) nó (6) den alt seo beidh sé ciontach i gcion.
(8) In ionchúiseamh mar gheall ar chion i leith sárú ar fho-alt (3) den alt seo, is cosaint é a shuíomh go raibh úsáid na talún áirithe chun na feithiclí áirithe nó na nithe áirithe eile a choimeád de réir chead faoi Chuid IV den Acht Rialtais Áitiúil (Pleanáil agus Forbairt), 1963.
(9) Is forbairt dhíolmhaithe, de réir bhrí an Achta Rialtais Áitiúil (Pleanáil agus Forbairt), 1963, aon fhorbairt, de réir bhrí an Achta sin, a dhéanfar de bhun fógra faoi fho-alt (1) den alt seo nó faoi fhógra den sórt sin arna mhodhnú faoi fho-alt (2) den alt seo.
(10) San alt seo ciallaíonn “as úsáid” i ndáil le ní, é a bheith sa riocht nach bhfuil sé oiriúnach, mar gheall ar fhaillí, damáiste, meathlú, easpa deisiúcháin nó aon chúis eile, lena úsáid le haghaidh na críche dár dearadh an ní sin.
Údaráis áitiúla do dhiúscairt feithiclí, etc., a aistríodh as faoi ailt 11 agus 12.
13.—(1) (a) I gcás inar féidir leis an údarás áitiúil áirithe, trí fhiosrú réasúnach, ainm agus seoladh an duine is úinéir ar fheithicil a aistríodh as agus a stóráladh faoi alt 11 den Acht seo a fhionnadh, seirbheálfaidh an t-údarás fógra san fhoirm fhorordaithe nó i bhfoirm sa chéill chéanna ar an úinéir á chur in iúl dó go ndearnadh an t-aistriú as agus an stóráil agus cad é seoladh na háite inar féidir an fheithicil a éileamh agus a aisghabháil agus á cheangal air í a éileamh agus a aisghabháil laistigh de dhá sheachtain ó dháta an fhógra a sheirbheáil agus á chur in iúl dó cad iad na hiarmhairtí reachtúla a bheidh ann má mhainníonn sé sin a dhéanamh.
(b) I gcás ina ndéanfar feithicil nó ní eile a aistriú as aon talamh agus a stóráil faoi alt 12 (4) den Acht seo, seirbheálfaidh an t-údarás áitiúil áirithe fógra san fhoirm fhorordaithe nó i bhfoirm sa chéill chéanna ar an duine (más ann) is áititheoir ar an talamh as ar aistríodh an fheithicil nó an ní eile agus ar aon duine eile a choimeád an fheithicil nó an ní ar an talamh agus arb eol don údarás áitiúil cé hé féin, á chur in iúl dóibh go ndearnadh an stóráil agus cad é seoladh na háite inar féidir an fheithicil nó an ní a éileamh agus a aisghabháil, agus á cheangal orthu an céanna a éileamh agus a aisghabháil laistigh de dhá sheachtain ó dháta an fhógra a sheirbheáil agus á chur in iúl dóibh cad iad na hiarmhairtí reachtúla a bheidh ann má mhainníonn siad sin a dhéanamh.
(2) Déanfar feithicil nó ní eile a aistríodh as agus a stóráladh faoin alt sin 11 nó 12 a thabhairt do dhuine a éileoidh an fheithicil nó an ní, má dhéanann sé, agus ar an gcoinníoll amháin go ndéanfaidh sé, dearbhú san fhoirm fhorordaithe nó i bhfoirm sa chéill chéanna á rá gurb eisean úinéir na feithicle nó an ní nó go bhfuil údarás aige ó úinéir na feithicle nó an ní an céanna a éileamh agus go n-íocfaidh sé méid an chaiteachais a thabhaigh an t-údarás áitiúil áirithe le réasún faoin Acht seo i leith na feithicle nó an ní.
(3) Féadfaidh an t-údarás áitiúil áirithe feithicil a aistríodh as agus a stóráladh faoi alt 11 den Acht seo a dhiúscairt nó a diúscairt a thabhairt chun críche—
(a) mura ndéanfaidh úinéir na feithicle an fheithicil a éileamh agus a aistriú as an áit ar stóráladh í laistigh de dhá sheachtain ón dáta ar ar seirbheáladh fógra air faoi fho-alt (1) (a) den alt seo, nó
(b) mura féidir leis an údarás áitiúil ainm agus seoladh úinéir na feithicle a fhionnadh trí fhiosrú réasúnach.
(4) Féadfaidh an t-údarás áitiúil áirithe feithicil nó ní eile a aistríodh as agus a stóráladh faoi alt 12 (4) den Acht seo a dhiúscairt nó a ndiúscairt a thabhairt chun críche mura ndéanfaidh an duine (más ann) is áititheoir ar an talamh as ar aistríodh an fheithicil nó an ní nó an duine a choimeád an fheithicil nó an ní ar an talamh an fheithicil nó an ní a éileamh agus a aistriú as an áit ina bhfuil sí nó sé stóráilte laistigh de dhá sheachtain ón dáta ar ar seirbheáladh fógra air faoi fho-alt (1) (b) den alt seo.
(5) Ní dhéanfar feithicil nó ní eile a dhiúscairt faoin alt seo laistigh de mhí ón dáta ar a ndéanfar an céanna a aistriú as faoi alt 11 nó 12 den Acht seo.
(6) (a) Más rud é—
(i) i ndáil le feithicil a d'aistrigh údarás áitiúil as faoi alt 11 nó 12 den Acht seo, nó
(ii) i ndáil le feithicil (is feithicil a bheidh tréigthe nó feithicil a dhealraíonn a bheith tréigthe) a d'aistrigh údarás bóithre as, nó a aistríodh as ar údarás ó údarás bóithre, faoi alt 97 (a cuireadh isteach leis an Acht um Thrácht ar Bhóithre, 1968) den Acht um Thrácht ar Bhóithre, 1961,
gur deimhin leis an údarás áitiúil nó leis an údarás bóithre, de réir mar a bheidh, go bhfuil an fheithicil sa riocht nach féidir í a úsáid mar fheithicil agus nach féidir, trí mhéid réasúnach airgid a chaitheamh, í a chur i gcóir lena húsáid amhlaidh, féadfaidh an t-údarás áitiúil nó an t-údarás bóithre, de réir mar a bheidh, d'ainneoin aon ní san Acht seo nó in aon Acht eile, an fheithicil a dhiúscairt aon uair tar éis í a aistriú as mar a dúradh gan í a bheith stóráilte agus gan fógra i ndáil leis an bhfeithicil a bheith seirbheáilte ar aon duine ná foilsithe.
(b) I mír (a) den fho-alt seo tá le “tréigthe” agus “údarás bóithre” na bríonna céanna atá leo san Acht um Thrácht ar Bhóithre, 1961.
(7) Duine a dhéanfaidh dearbhú faoi fho-alt (2) den alt seo a bheidh bréagach nó míthreorach beidh sé ciontach i gcion.
Airgead a fhaibhreoidh chuig údaráis áitiúla faoin Acht a dhiúscairt.
14.—Airgead a fhaibhreoidh chuig údarás áitiúil faoin Acht seo diúscrófar é de réir rialacháin arna ndéanamh ag an Aire.
Pionóis.
15.—Duine a bheidh ciontach i gcion faoin Acht seo dlífear, ar é a chiontú go hachomair, fíneáil nach mó ná £800 a chur air.
Foráil i ndáil le cionta.
16.—(1) Féadfaidh an t-údarás áitiúil ar ina limistéar a rinneadh cion faoin Acht seo (seachas alt 10 den Acht seo) an cion a ionchúiseamh.
(2) I gcás comhlacht corpraithe do dhéanamh cion faoin Acht seo agus go gcruthófar go ndearnadh é le toiliú nó le cúlcheadú, nó gur inchurtha é i leith aon fhaillí ar thaobh, aon duine is stiúrthóir ar an gcomhlacht nó arb é bainisteoir nó rúnaí an chomhlachta é nó ar oifigeach eile den sórt sin don chomhlacht é, nó aon duine a d'airbheartaigh bheith ag gníomhú in aon cháil den sórt sin, beidh an duine sin, chomh maith leis an gcomhlacht, ciontach sa chion agus dlífear imeachtaí a shaothrú ina choinne agus é a phionósú dá réir sin.
(3) Féadfaidh an t-údarás áitiúil ar ina limistéar a rinneadh cion faoi alt 10 den Acht seo nó an duine is áititheoir ar an talamh ar ar tréigeadh an fheithicil is ábhar don chion an cion a ionchúiseamh.
Fógraí a sheirbheáil.
17.—(1) I gcás ina gceanglaíonn nó ina n-údaraíonn an tAcht seo fógra a sheirbheáil ar dhuine, díreofar chuige é nó seirbheálfar air é ar shlí éigin díobh seo a leanas:
(a) trína sheachadadh dó,
(b) trína fhágáil ag an seoladh ag a bhfuil gnáthchónaí air,
(c) trína chur leis an bpost i litir chláraithe réamhíoctha a bheidh dírithe chuige ag an seoladh ag a bhfuil gnáthchónaí air,
(d) i gcás nach féidir an seoladh ag a bhfuil gnáthchónaí air a fhionnadh trí fhiosrú réasúnach agus go gceanglaítear nó go n-údaraitear amhlaidh an fógra a thabhairt nó a sheirbheáil i leith aon talún, nó i leith feithicle nó ní ar aon talamh nó a aistríodh as aon talamh, trína sheachadadh do dhuine éigin os cionn sé bliana déag d'aois a bheidh ina chónaí nó fostaithe ar an talamh sin nó trína dhaingniú in áit fheiceálach ar an talamh sin nó ina aice.
(2) Chun críocha an ailt seo, measfar gnáthchónaí a bheith ina hoifig chláraithe ar chuideachta a cláraíodh faoi Achtanna na gCuideachtaí, 1963 agus 1977, agus measfar gnáthchónaí a bheith ina phríomh-oifig nó ina phríomh-áit ghnó ar gach comhlacht corpraithe eile agus ar gach comhlacht neamhchorpraithe.
(3) Duine a dhéanfaidh, tráth ar bith, gan údarás dleathach, fógra, a daingníodh faoi fho-alt (1) (d) den alt seo, a aistriú as, a dhamáistiú nó a aghlot—
(a) sula mbeidh an tréimhse a bheidh sonraithe san fhógra caite, nó
(b) sula gcomhlíonfar an fógra,
cibé acu is túisce a tharlóidh, beidh sé, murab eisean an duine a bhfuil an fógra dírithe chuige, ciontach i gcion.
Rialacháin.

LITTER ACT, 1982
Definitions.
1.—In this Act, save where the context otherwise requires—
“abandoned”, in relation to a vehicle, includes left in such circumstances or for such a period that it is reasonable to assume that the vehicle has been abandoned, and cognate words shall be construed accordingly;
“functions” includes powers and duties and a reference to the performance of a function includes, with respect to powers, a reference to the exercise of powers;
“hire-drive agreement”, in relation to a mechanically propelled vehicle, means an agreement under which the vehicle is hired from its registered owner, other than—
(a) a hire-purchase agreement,
(b) an agreement merely for the carriage of persons or goods, or
(c) an agreement under which the registered owner of the vehicle drives, or provides a driver for, the vehicle;
“land” includes any structure and any land covered with water;
“litter warden” means a person employed by a local authority and authorised by it to perform the functions of a litter warden under this Act;
“local authority” means—
(a) in the case of a county other than any borough or urban district therein, the council of the county,
(b) in the case of a county or other borough, the corporation of the borough, and
(c) in the case of an urban district, the council of the district,
and any reference to the area of a local authority shall be construed accordingly;
“the Minister” means the Minister for the Environment;
“occupier”, in relation to any land, includes a person entitled to occupy that land and cognate words shall be construed accordingly;
“prescribed” means prescribed by regulations made by the Minister;
“public place” means any street, road, seashore or other place to which the public have access whether as of right or by permission and whether subject to or free of charge;
“registered owner” has the meaning assigned to it by the Road Traffic Act, 1961;
“vehicle” includes—
(a) part of a vehicle,
(b) an article designed as a vehicle but not at the time of abandonment under section 10 of this Act or removal under section 11 or 12 of this Act capable of functioning as a vehicle,
(c) a skip designed or used for carriage on a vehicle,
(d) a load on a vehicle.
Duty of local authorities to prevent litter.
2.—(1) A local authority shall take measures for the prevention of the creation, and for the prevention and overcoming of the harmful effects, of litter in its area and for the disposal of litter and, for those purposes, may enter into arrangements with, or assist, other persons (including other local authorities) for or in the taking of such measures on behalf of the authority.
(2) Measures taken pursuant to subsection (1) of this section may include—
(a) measures for the collection and disposal of litter,
(b) measures to encourage participation by the public in the collection and disposal of litter and in preventing and overcoming the harmful effects of litter,
(c) measures to facilitate and encourage the recycling of waste, and
(d) the undertaking of works and the provision of facilities and services including publicity, advisory and educational services.
Prohibition of creation of litter.
3.—(1) A person shall not—
(a) deposit anywhere, whether in a receptacle or not, any substance, material or thing for collection by or on behalf of a local authority, or
(b) (i) otherwise place or leave, anywhere, or
(ii) throw down, anywhere,
any substance, material or thing,
so as to create or tend to create litter in a public place or litter that is visible from a public place.
(2) A person shall not load, transport, unload or otherwise handle or process any substance, material or thing, or carry on a trade, in a manner that creates or tends to create litter in a public place or litter that is visible from a public place.
(3) A person who contravenes subsection (1) or (2) of this section shall be guilty of an offence.
(4) Nothing in this section or in section 4 of this Act shall be construed as prohibiting—
(a) the deposit of any substance, material or thing in a receptacle provided for such deposit in any place,
(b) the deposit in any place of a receptacle containing any substance, material or thing for collection by or on behalf of a local authority,
(c) the deposit of any substance, material or thing in a receptacle in any place for recycling,
(d) the disposal of waste—
(i) in a place provided by a local authority for the purpose, or
(ii) in accordance with a permission under Part IV of the Local Government (Planning and Development) Act, 1963, or the European Communities (Waste) Regulations, 1979 (S.I. No. 390 of 1979), the European Communities (Waste) (No. 2) Regulations, 1979 (S.I. No. 388 of 1979), or the European Communities (Toxic and Dangerous Waste) Regulations, 1982 (S.I. No. 33 of 1982),
provided that reasonable care is taken to prevent the creation of litter.
(5) Where a mechanically propelled vehicle (other than a public service vehicle) is used in the commission of an offence under subsection (3) of this section—
(a) the registered owner of the vehicle,
(b) if the vehicle is the subject of a hire-drive agreement at the time of the commission of the offence, the hirer of the vehicle, and
(c) if the person using the vehicle at the time of the commission of the offence is not the registered owner or the hirer of the vehicle, the person using the vehicle at that time,
shall be guilty of an offence in addition to any person guilty of the first-mentioned offence.
(6) Where a person charged with an offence under subsection (5) of this section is the registered owner of the vehicle concerned, it shall be a defence for him to show that, at the time of the commission of the offence, the vehicle was being used by another person and that—
(a) such use was unauthorised, or
(b) the vehicle was at that time the subject of a hire-drive agreement.
(7) Where a person charged with an offence under subsection (5) of this section is the person to whom the vehicle concerned stood hired at the time of the commission of the offence under a hire-drive agreement, it shall be a defence for him to show that, at that time, the vehicle was being used by another person and that such use was unauthorised.
(8) In this section “mechanically propelled vehicle” and “public service vehicle” have the meanings assigned to them by the Road Traffic Act, 1961.
Duty of occupiers of land in relation to litter.
4.—(1) The occupier of any land (not being a public road or a building or other structure) that is a public place shall keep the land free of litter.
(2) The occupier of any land (other than a building or other structure) that is not a public place shall keep the land free of litter that is visible from a public place.
(3) A local authority may, upon such terms and conditions as may be agreed upon by it and the occupier of any land in its area on which there is litter, if it appears to the local authority that, in the interests of amenity or of the environment of an area, it should be removed or other steps should be taken in relation to it—
(a) by its servants or agents, remove and dispose of, or take other steps in relation to, the litter, and
(b) for those purposes, by its servants or agents enter on the land.
(4) A local authority may by bye-laws require the occupiers of any land in its area or of land in its area of a specified class or specified classes or of land in a specified area or specified areas of its area to keep free of litter—
(a) any footpath or pavement adjoining the land, and forming, or forming part of, a public road and any road gutter on or at the side of any such footpath or pavement and forming part of a public road,
(b) any road gutter adjoining the land and forming part of a public road, and
(c) any area of land forming part of a public road between any such footpath or pavement and the carriageway (if any) of the public road and any road gutter adjoining such an area of land and forming part of a public road.
(5) A person who contravenes subsection (1) or (2) of this section or a bye-law under subsection (4) of this section shall be guilty of an offence.
(6) In a prosecution for an offence under this section, it shall be a defence to show that reasonable steps were taken to keep free of litter the land to which the prosecution relates.
(7) The provisions of sections 221 and 223 of the Public Health (Ireland) Act, 1878, shall apply to bye-laws made under this section as they apply to bye-laws made under that Act.
(8) Bye-laws under this section may contain such incidental, supplementary and consequential provisions as appear to the local authority making the bye-laws to be necessary for the purposes of the bye laws.
(9) In this section “public road” has the meaning assigned to it by the Local Government (Roads and Motorways) Act, 1974.
Provisions regarding certain offences in relation to litter.
5.—(1) Where a litter warden has reasonable grounds for believing that a person is committing or has committed an offence under section 3 of this Act, he may give to the person a notice in the prescribed form or in a form to the like effect stating—
(a) that the person is alleged to have committed the offence,
(b) that the person may during the period of 21 days beginning on the date of the notice, make to the local authority specified in the notice a payment of £5 accompanied by the notice,
(c) that a prosecution in respect of the alleged offence will not be instituted during the period specified in the notice and, if the payment specified in the notice is made during that period, no prosecution in respect of the alleged offence will be instituted.
(2) Where a notice is given under subsection (1) of this section—
(a) a person to whom the notice applies may, during the period specified in the notice, make to the local authority specified in the notice the payment specified in the notice, accompanied by the notice,
(b) that local authority may receive the payment, issue a receipt for it and retain the money so paid for disposal in accordance with this Act, and no payment so received shall in any circumstances be recoverable by the person who made it,
(c) a prosecution in respect of the alleged offence shall not be instituted in the period specified in the notice, and, if the payment specified in the notice is made during that period, no prosecution in respect of the alleged offence shall be instituted.
(3) In a prosecution for an offence under section 3 of this Act, the onus of showing that a payment pursuant to a notice under this section has been made shall lie on the defendant.
(4) The Minister may by regulations vary the amount standing specified for the time being in subsection (1)(b) of this section and the said subsection (1)(b) shall have effect in accordance with the terms of any such regulations.
Provisions relating to litter wardens.
6.—(1) A person who obstructs or impedes a litter warden acting in the exercise of the functions conferred on him by this Act shall be guilty of an offence.
(2) Where a litter warden has reasonable grounds for believing that a person is committing or has committed an offence under section 3 or 7 (other than an offence under the said section 7 to which subsection (2) of that section relates) of this Act or under subsection (1) of this section, he may request of the person his name and address, and may request that information given be verified.
(3) Where a person whose name and address is requested of him under this section refuses or fails to give his name or address, or gives a name or address which is false or misleading, he shall be guilty of an offence.
(4) A person shall not be bound to comply with a request of a litter warden under this section unless the warden produces, if requested by the person, a warrant of his appointment as a litter warden.
(5) Where a member of the Garda Síochána is of the opinion that a person is committing or has committed an offence under this section, he may arrest the person without warrant.
Prohibition of articles and advertisements on and defacement of certain structures, etc.
7.—(1) Where any structure or other land, door, gate, window, tree, pole or post is in or fronts any public place, a person who is not the owner, occupier or person in charge thereof shall not—
(a) exhibit or cause to be exhibited thereon any article or advertisement, or
(b) carry out or cause to be carried out any defacement thereof by writing or other marks,
unless he is authorised so to do by such owner, occupier or person in charge or by or under any enactment.
(2) Without prejudice to the liability of any other person under subsection (1) of this section, where there is a contravention of that subsection—
(a) in the case of an advertisement relating to a meeting or other event, the person who is promoting or arranging the meeting or event, and
(b) in the case of any other advertisement, the person on whose behalf the advertisement is exhibited,
shall be deemed also to have contravened that subsection.
(3) A local authority may, upon such terms and conditions as may be agreed upon by it and the occupier concerned, in the case of an article, advertisement or defacement in its area in relation to which there is a contravention of subsection (1) of this section—
(a) by its servants or agents, remove the said article or advertisement or, as the case may be, remove or otherwise remedy the said defacement, and
(b) for those purposes, by its servants or agents enter on the structure or other land concerned or the structure or other land on which is situated the door, gate, window, tree, pole or post concerned.
(4) In a prosecution for an offence under this section in relation to a contravention of subsection (1) of this section, it shall not be necessary for the prosecution to show and it shall be assumed until the contrary is shown by the defendant, that the defendant was not the owner, occupier or person in charge of the structure or other land, door, gate, window, tree, pole or post and was not authorised as referred to in subsection (1) of this section.
(5) A person who contravenes or is deemed to have contravened subsection (1) of this section or who obstructs or impedes a local authority or its servants or agents acting in the exercise of the functions conferred on a local authority by subsection (3) of this section shall be guilty of an offence.
(6) A prosecution shall not be brought in a case in which an offence under this section is alleged to have been committed in relation to an advertisement if—
(a) the advertisement is exempted development within the meaning of the Local Government (Planning and Development) Act, 1963, or
(b) the advertisement—
(i) advertises a public meeting, or
(ii) relates to a presidential election within the meaning of the Presidential Elections Act, 1937, a general election or a bye-election, within the meaning, in each case, of the Electoral Act, 1923, a local election, a referendum, within the meaning of the Referendum Act, 1942, or an election of representatives to the Assembly of the European Communities,
unless the advertisement has been in position for seven days or longer after the day specified in the advertisement for the meeting or the latest day upon which the poll was taken for the election, bye-election or referendum concerned.
(7) Notwithstanding section 19 of this Act, section 80 of the Local Government (Planning and Development) Act, 1963, shall not apply in relation to an offence under this section.
(8) In this section and in section 8 of this Act—
“occupier”, in relation to a door, gate, window or tree, means the occupier of the structure or other land on which the door, gate, window or tree, as the case may be, is situated and, in relation to a pole or post, means the owner of the pole or post;
“structure” has the meaning assigned to it by the Local Government (Planning and Development) Act, 1963.
Powers of local authorities in relation to articles and advertisements on and defacement of certain structures, etc.
8.—(1) Where any structure or other land, door, gate, window, tree, pole or post situated in the area of any local authority is in or fronts any public place and it appears to that authority that it is in the interests of amenity or of the environment of an area that any article or advertisement exhibited thereon should be removed or any defacement thereof by writing or other marks should be removed or otherwise remedied or that other specified steps should be taken in relation to the article, advertisement or defacement, as the case may be, it may serve a notice in the prescribed form or in a form to the like effect on the occupier concerned requiring him to remove the article or advertisement, or remove or otherwise remedy the defacement, or to take other specified steps in relation to the article, advertisement or defacement, as the case may be, within a period specified in the notice that is not less than one month after—
(a) the date of the service of the notice, or
(b) if there is an appeal against the notice under subsection (2) of this section, the date of the determination of the appeal, or
(c) if there is such an appeal and it is withdrawn the date of the withdrawal.
(2) A person upon whom a notice under this section is served may, within 21 days of the date of the service of the notice, appeal to the District Court against the notice and the District Court may confirm the notice with or without modifications or annul the notice.
(3) Where a notice is served upon a person under this section—
(a) if the person does not appeal against the notice under subsection (2) of this section, he shall comply with its terms within the period specified in the notice, and
(b) if the person appeals against the notice under the said subsection and the notice is confirmed with or without modifications by the District Court, he shall comply with its terms, or its terms as modified by the District Court, as the case may be, within the period specified in the notice after the date of the determination of the appeal, and
(c) if the person appeals against the notice and withdraws the appeal, he shall comply with its terms within the period specified in the notice after the date of the withdrawal.
(4) In confirming a notice under subsection (2) of this section the Court may, if it is satisfied that—
(a) the article or advertisement concerned was not exhibited, or
(b) the defacement concerned was not carried out,
by or with the consent of the occupier concerned, direct that the whole or part of the expenditure reasonably incurred in implementing the notice shall be met by the local authority concerned.
(5) Where, in relation to a notice under this section, there is a contravention of subsection (3) of this section, the local authority concerned may, subject to the provisions of this section, by its servants or agents—
(a) give effect to the terms of the notice, and
(b) where necessary for that purpose, by its servants or agents enter on the structure or other land concerned or the structure or other land on which is situated the door, gate, window, tree, pole or post concerned,
and may recover such part (if any) of the expenditure reasonably incurred by it in so doing as has not been directed by an order under subsection (4) of this section to be paid by the authority from the occupier concerned as a simple contract debt in any court of competent jurisdiction.
(6) Before exercising any functions conferred on it by subsection (5) of this section, a local authority shall, not less than 7 days before the date of such exercise, serve a notice in the prescribed form or in a form to the like effect upon the occupier concerned of any structure or other land, or of any door, gate, window, tree, pole or post to which the notice relates stating its intention to do so.
(7) A local authority may, upon such terms and conditions as may be agreed upon by it and the occupier concerned, in the case of an article, advertisement or defacement to which subsection (1) of this section applies—
(a) by its servants or agents remove the article or advertisement or remedy the defacement or, as may be appropriate, take other steps in relation to it, and
(b) for those purposes, by its servants or agents, enter on the structure or other land concerned or the structure or other land on which is situated the door, gate, window, tree, pole or post concerned.
(8) A person who contravenes subsection (3) of this section or who obstructs or impedes—
(a) a local authority or its servants or agents acting in the exercise of the functions conferred on a local authority by subsection (5) or (7) of this section, or
(b) a person or his servants or agents while engaged in complying with the terms of a notice under this section,
shall be guilty of an offence.
(9) In a prosecution for an offence in respect of a contravention of subsection (3) of this section, it shall be a defence to show—
(a) that the exhibition of the advertisement concerned was in accordance with a permission under Part IV of the Local Government (Planning and Development) Act, 1963, or
(b) that reasonable steps were taken to comply with the provisions of that subsection, or
(c) that, in all the circumstances of the case—
(i) compliance with those provisions would have been unduly costly or difficult, or
(ii) it would have been unreasonable to require compliance with those provisions.
(10) Any development, within the meaning of the Local Government (Planning and Development) Act, 1963, carried out pursuant to a notice under subsection (1) of this section or under such a notice as modified under subsection (2) of this section shall be exempted development, within the meaning of that Act.
Duty of local authorities to provide places for abandoning vehicles and metal scrap.
9.—(1) A local authority, having made an examination of the matter, shall provide or procure the provision (whether by another local authority or otherwise) of such place or places where vehicles or metal scrap may be abandoned as appears to it to be necessary and reasonable.
(2) A local authority may impose a charge of such amount as it may consider reasonable and fix from time to time in respect of the acceptance at accommodation provided by it under this section of vehicles or metal scrap brought to the accommodation for abandonment there.
(3) A vehicle or metal scrap shall, upon being left in a place provided by or on behalf of a local authority under this section, be deemed to be abandoned and the local authority may dispose or procure the disposal of such vehicle or metal scrap.
Prohibition of abandonment of vehicles.
10.—(1) A vehicle shall not be abandoned on any land.
(2) Where there is a contravention of subsection (1) of this section—
(a) the person who placed the vehicle at the place where it was abandoned, and
(b) if there is a registered owner of the vehicle and the person aforesaid is not its registered owner, the registered owner,
shall each be guilty of an offence.
(3) In a prosecution for an offence under this section in relation to land it shall be a defence to show that the vehicle was abandoned with the consent of the occupier of the land.
(4) Where a person charged with an offence under this section is the registered owner of the vehicle concerned, it shall be a defence for him to show that the abandonment of the vehicle was unauthorised by him.
Powers of local authorities in relation to abandoned vehicles.
11.—(1) Where it appears to a local authority that a vehicle has been abandoned on any land in its area, in contravention of section 10 of this Act, the authority may, subject to the provisions of this section, by its servants or agents, enter on the land and remove the vehicle therefrom.
(2) Before removing a vehicle from occupied land under this section, a local authority shall serve a notice in the prescribed form or in a form to the like effect on the occupier of the land stating its intention to remove the vehicle.
(3) A local authority shall not remove from any land a vehicle in respect of which a notice has been served under subsection (2) of this section unless—
(a) the occupier of the land consents to the removal, or
(b) the occupier of the land has not objected to the removal and not less than 14 days have elapsed since the date of the service on him by the authority of a notice under subsection (2) of this section in relation to the vehicle.
(4) A local authority may store, or procure the storage (whether by another local authority or otherwise) of a vehicle removed by it under this section.
(5) A person who obstructs or impedes a local authority or its servants or agents acting in the exercise of the functions conferred on a local authority by this section shall be guilty of an offence.
(6) This section does not apply in relation to a vehicle (other than a skip) abandoned on a public road within the meaning of the Road Traffic Act, 1961, or at a car park provided under section 101 of that Act.
Powers of local authorities in relation to vehicles and certain articles on land.
12.—(1) Where it appears to a local authority that it is in the interests of amenity or of the environment of an area that any vehicles or other articles (being disused articles) kept on any land in its area for the purpose of being dismantled, reconditioned, repaired, stored or sold, should be removed or that other steps should be taken in relation to them, it may serve a notice in the prescribed form or in a form to the like effect on the occupier (if any) of the land or the person so keeping the vehicles or articles requiring him to remove the vehicles or articles from the land or to take other specified steps in relation to them within a period specified in the notice that is not less than one month after—
(a) the date of the service of the notice, or
(b) if there is an appeal against the notice under subsection (2) of this section, the date of the determination of the appeal, or
(c) if there is such an appeal and it is withdrawn, the date of the withdrawal.
(2) A person upon whom a notice under this section is served may, within 21 days of the date of the service of the notice, appeal to the District Court against the notice and the District Court may confirm the notice with or without modification or annul the notice.
(3) Where a notice is served upon a person under this section—
(a) if the person does not appeal against the notice under subsection (2) of this section, he shall comply with its terms within the period specified in the notice after the date of the service of the notice, and
(b) if the person appeals against the notice under the said subsection and the notice is confirmed with or without modifications by the District Court, he shall comply with its terms, or its terms as modified by the District Court, as the case may be, within the period specified in the notice after the date of the determination of the appeal, and
(c) if the person appeals against the notice and withdraws the appeal, he shall comply with its terms within the period specified in the notice after the date of the withdrawal.
(4) Where, in relation to a notice under this section, there is a contravention of subsection (3) of this section, the local authority concerned may, subject to the provisions of this section, by its servants or agents—
(a) give effect to the terms of the notice, and
(b) where necessary for those purposes, by its servants or agents enter on the land to which the notice relates, remove and store, or procure the storage (whether by another local authority or otherwise) of, the vehicles or other articles concerned,
and may recover the expenditure reasonably incurred by it in so doing from the person upon whom the notice was served as a simple contract debt in any court of competent jurisdiction.
(5) Before exercising any functions conferred on it by subsection (4) of this section, a local authority shall, not less than 7 days before the date of such exercise, serve a notice in the prescribed form or in a form to the like effect upon the occupier (if any) of the land concerned or the person keeping the vehicles or other articles concerned on the land concerned stating its intention to do so.
(6) A local authority may, upon such terms and conditions as may be agreed upon by it and the occupier (if any) of any land where vehicles or other articles to which subsection (1) of this section applies are kept or the person so keeping the vehicles or articles, if it appears to the local authority that, in the interests of amenity or of the environment of an area, they should be removed or other steps should be taken in relation to them—
(a) by its servants or agents, remove and dispose of or store or, as may be appropriate, take other steps in relation to, the vehicles or articles, and
(b) for those purposes, by its servants or agents, enter on the land.
(7) A person who contravenes subsection (3) of this section or who obstructs or impedes a local authority or its servants or agents acting in the exercise of the functions conferred on a local authority by subsection (4) or (6) of this section shall be guilty of an offence.
(8) In a prosecution for an offence in respect of a contravention of subsection (3) of this section, it shall be a defence to show that the use of the land concerned for the purposes of keeping the vehicles or other articles concerned was in accordance with a permission under Part IV of the Local Government (Planning and Development) Act, 1963.
(9) Any development, within the meaning of the Local Government (Planning and Development) Act, 1963, carried out pursuant to a notice under subsection (1) of this section or under such a notice as modified under subsection (2) of this section shall be exempted development, within the meaning of that Act.
(10) In this section “disused”, in relation to an article, means being in such condition because of neglect, damage, deterioration, lack of repair or other cause, as to be unsuitable for use for the purpose for which the article was designed.
Disposal by local authorities of vehicles etc. removed under sections 11 and 12.
13.—(1) (a) Where the name and address of the owner of a vehicle removed and stored under section 11 of this Act can be ascertained by the local authority concerned by reasonable inquiry, the authority shall serve a notice in the prescribed form or in a form to the like effect upon the owner informing him of the removal and storage and of the address of the place where the vehicle may be claimed and recovered, requiring him to claim and recover it within two weeks of the date of the service of the notice and informing him of the statutory consequences of his failure to do so.
(b) Where a vehicle or other article is removed from any land and stored under section 12 (4) of this Act, the local authority concerned shall serve a notice in the prescribed form or in a form to the like effect upon the occupier (if any) of the land from which the vehicle or other article was removed and any other person who kept the vehicle or article on the land and whose identity is known to the local authority informing them of the storage and of the address of the place where the vehicle or article may be claimed and recovered, requiring them to claim and recover it within two weeks of the date of the service of the notice and informing them of the statutory consequences of their failure to do so.
(2) A vehicle or other article removed and stored under the said section 11 or 12 shall be given to a person claiming the vehicle or article if, but only if, he makes a declaration in the prescribed form or in a form to the like effect stating that he is the owner of the vehicle or article or is authorised by its owner to claim it and pays the amount of the expenditure reasonably incurred by the local authority concerned under this Act in respect of the vehicle or article.
(3) The local authority concerned may dispose or procure the disposal of a vehicle removed and stored under section 11 of this Act if—
(a) the owner of the vehicle fails to claim the vehicle and remove it from the place where it is stored within two weeks of the date on which a notice under subsection (1) (a) of this section was served on him, or
(b) the name and address of the owner of the vehicle cannot be ascertained by the local authority by reasonable inquiry.
(4) The local authority concerned may dispose or procure the disposal of a vehicle or other article removed and stored under section 12 (4) of this Act if the occupier (if any) of the land from which the vehicle or article was removed or the person who kept the vehicle or article on the land fails to claim the vehicle or article and remove it from the place where it is stored within two weeks of the date on which a notice under subsection (1) (b) of this section was served on him.
(5) A vehicle or other article shall not be disposed of under this section within one month of the date of its removal under section 11 or 12 of this Act.
(6) (a) Where, in relation to—
(i) a vehicle removed by a local authority under section 11 or 12 of this Act, or
(ii) a vehicle (being an abandoned vehicle or a vehicle which appears to have been abandoned) removed by or on the authority of a road authority under section 97 (inserted by the Road Traffic Act, 1968) of the Road Traffic Act, 1961,
the local authority or the road authority, as the case may be, is satisfied that the condition of the vehicle is such that it is incapable of being used as a vehicle and cannot by the expenditure of a reasonable amount of money be rendered capable of being so used, the local authority or the road authority, as the case may be, may, notwithstanding anything in this or any other Act, dispose of the vehicle at any time after the removal aforesaid without having stored it and without having served upon any person, or published, a notice in relation to the vehicle.
(b) In paragraph (a) of this subsection “abandoned” and “road authority” have the same meanings as in the Road Traffic Act, 1961.
(7) A person who makes a declaration under subsection (2) of this section that is false or misleading shall be guilty of an offence.
Disposal of moneys accruing to local authorities under Act.
14.—Moneys accruing to a local authority under this Act shall be disposed of in accordance with regulations made by the Minister.
Penalties.
15.—A person guilty of an offence under this Act shall be liable on summary conviction to a fine not exceeding £800.
Provision in relation to offences.
16.—(1) An offence under this Act (other than section 10 of this Act) may be prosecuted by the local authority in whose area the offence was committed.
(2) Where an offence under this Act is committed by a body corporate and the offence is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of, any director, manager, secretary or other similar officer of the body or any person who was purporting to act in any such capacity, he, as well as the body, shall be guilty of the offence and shall be liable to be proceeded against and punished accordingly.
(3) An offence under section 10 of this Act may be prosecuted by the local authority in whose area the offence was committed or by the occupier of the land on which the vehicle the subject of the offence was abandoned.
Service of notices.
17.—(1) Where a notice is required or authorised by this Act to be served on a person, it shall be addressed to him and shall be served on him in some one of the following ways:
(a) by delivering it to him,
(b) by leaving it at the address at which he ordinarily resides,
(c) by sending it by post in a prepaid registered letter addressed to him at the address at which he ordinarily resides,
(d) where the address at which he ordinarily resides cannot be ascertained by reasonable inquiry and the notice is so required or authorised to be given or served in respect of any land, or a vehicle or article on or removed from any land by delivering it to some person over sixteen years of age resident or employed on such land or by affixing it in a conspicuous position on or near such land.
(2) For the purposes of this section, a company registered under the Companies Acts, 1963 and 1977, shall be deemed to be ordinarily resident at its registered office, and every other body corporate and every unincorporated body shall be deemed to be ordinarily resident at its principal office or place of business.
(3) A person who, at any time, without lawful authority, removes, damages or defaces a notice affixed under subsection (1) (d) of this section—
(a) before the period specified in the notice expires, or
(b) before the notice is complied with,
whichever should first happen, shall, unless he is the person to whom the notice is addressed, be guilty of an offence.
Regulations.
18.—(1) The Minister may make regulations prescribing any matter or thing referred to in this Act as prescribed or to be prescribed.
(2) Every regulation made under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the regulation is passed by either such House within the next twenty-one days on which that House has sat after the regulation is laid before it, the regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Repeal.
19.—Sections 52 and 53 of the Local Government (Planning and Development) Act, 1963, are hereby repealed.
Short title and commencement.
20.—(1) This Act may be cited as the Litter Act, 1982.
(2) This Act shall come into operation on such day as the Minister may appoint by order.
