An Príomh-Acht.
1.—San Acht so cialluíonn an focal “an Príomh-Acht” an tAcht Cúirteanna Breithiúnais, 1924 (Uimh. 10 de 1924).
Tagairtí don Chuaird Ard-Chúirte d'athghairm.
2.—Athghairmtear leis seo na mínithe atá in alt 3 den Phríomh-Acht ar na Coimisinéirí den Chuaird Ard-Chúirte agus ar an gCúirt den Chuaird Ard-Chúirte agus fós gach tagairt atá sa Phríomh-Acht do sna Coimisinéirí sin no don Chúirt sin.
Breitheamh den Ard-Chúirt do cheapa don Phríomh-Chúirt Choiriúil.
3.—(1) Is ag Uachtarán na hArd-Chúirte amháin a bheidh comhacht chun a chur de dhualgas ar bhreitheamh den Ard-Chúirt gníomhú mar an Phríomh-Chúirt Choiriúil de thurus na huaire.
(2) Beidh sé dleathach d'Uachtarán na hArd-Chúirte i bhfeidhmiú na comhachta san an dualgas san do chur air féin.
Údarás na Príomh-Chúirte Coiriúla.
4.—Beidh ag an bPríomh-Chúirt Choiriúil gach údarás a bheidh ag an Ard-Chúirt de thurus na huaire i gcúrsaí coiriúla agus féadfa sí an t-údarás san d'fheidhmiú, agus gach éinne a tabharfar os cóir na Príomh-Chúirte Coiriúla go dleathach chun a thrialta i bhfeidhmiú aon údaráis den tsórt san féadfar é do dhíotáil os cóir na Cúirte sin agus féadfidh an Chúirt sin é do thriail agus do dhaora, pé áit ina mbeidh sí ina suidhe, ar gach slí díreach fé is dá mba sa chontae no sa chontae-bhuirg ina bhfuil an Chúirt sin ina suidhe a déanfí an choir ina bhfuil an duine sin cúisithe.
Tráthanna agus áiteanna suidhte na Príomh-Chúirte Coiriúla.
5.—(1) Athghairmtear clás (iv.) d'alt 36 den Phríomh-Acht leis seo agus achtuítear leis seo ina ionad go gcomórfar suidheanna na Príomh-Chúirte Coiriúla (suidheanna le n-a mbainfidh comhacht ghenerálta chun iad do chur ar ath-ló agus a bheidh fé réir na comhachta san) pé tráthanna agus i pé áiteanna a ordóidh Uachtarán na hArd-Chúirte o am go ham.
(2) Gach iarratas chun na Príomh-Chúirte Coiriúla i dtaobh ní atá no a bhí tráth ar feitheamh sa Chúirt sin, féadfar, mara mbeidh agus nuair ná beidh an Chúirt sin ina suidhe, é do dhéanamh chun aon Bhreithimh den Ard-Chúirt agus féadfidh seisean é d'éisteacht agus deighleáil leis.

6.—Athghairmtear leis seo an dara províso a ghabhann le mír B d'alt 77 den Phríomh-Acht agus achtuítear leis seo ina ionad, i ngach cás coiriúil nár dheighleáil Breitheamh den Chúirt Dúithche leis ar an slí achmair go ndéanfidh an Breitheamh, más coir atá laistigh d'údarás na Cúirte Cuarda gach coir 'na bhfuil an duine cúisithe á chur ar aghaidh ina taobh, an duine cúisithe do chur ar aghaidh chun a thrialta chun an Bhreithimh Chuarda no chun duine de sna Breithimh Chuarda (a toghfar amach ag an mBreitheamh san den Chúirt Dúithche) 'na bhfuil aige, fé alt 53 den Phríomh-Acht, údarás chun an cás do thriail agus, i ngach cás eile, go gcuirfe sé an duine cúisithe ar aghaidh chun a thrialta chun na Príomh-Chúirte Coiriúla.

7.—(1) Gach éinne—
(a) a cuireadh ar aghaidh chun a thrialta ar chúiseamh ná fuil laistigh d'údarás na Cúirte Cuarda no ar roinnt chúiseamh 'na bhfuil aon cheann no cinn acu no gach ceann acu gan bheith laistigh d'údarás na Cúirte Cuarda, no
(b) gur dhin Breitheamh Cuarda, i bhfeidhmiú na comhachta a tugtar do chuige sin le halt 54 den Phríomh-Acht, é do chur ar aghaidh chun Cúirte den Chuaird Ard-Chúirte chun a thrialta,
agus atá le linn rithte an Achta so, ag feitheamh le n-a thriail dá réir sin, tuigfar é do bheith curtha ar aghaidh chun a thrialta go dtí an chéad shuidhe a bheidh ag an bPríomh-Chúirt Choiriúil tar éis rithte an Achta so agus trialfar é dá réir sin.
(2) Na coruíochtaí (má tá aon cheann acu ann) atá tugtha mar bhannaí o dhuine no i dtaobh duine le n-a mbaineann an fo-alt san roimhe seo beidh éifeacht acu fé is dá gcuirtí isteach ionta tagairtí don Phríomh-Chúirt Choiriúil in ionad na dtagairtí atá ionta don chúirt no do sna cúirteanna a luaidhtear no a tuairiscítear ionta.
Cásanna go bhféadfidh an Phríomh-Chúirt Choiriúil deighleáil leo.
8.—Ar na cásanna go bhféadfidh an Phríomh-Chúirt Choiriúil deighleáil leo ag aon tsuidhe áirithe de shuidheanna na Cúirte beidh gach cás ina mbeidh an duine cúisithe, i dtosach no aon uair le linn an tsuidhe sin, i gcimeád sa chontae no sa chontaebhuirg ina mbeidh an suidhe sin ar siúl agus é ag feitheamh go dtrialfidh an Chúirt Chuarda é.
Gearr-theideal, léiriú agus luadh.
9.—(1) Féadfar an tAcht Cúirteanna Breithiúnais, 1926, do ghairm den Acht so.
(2) Léireofar an tAcht so mar éinní amháin leis an bPríomh-Acht, agus féadfar na hAchtanna Cúirteanna Breithiúnais, 1924 agus 1926, do ghairm den Phríomh-Acht agus den Acht so le chéile.

COURTS OF JUSTICE ACT, 1926.
The Principal Act.
1.—In this Act the expression “the Principal Act” means the Courts of Justice Act, 1924 (No. 10 of 1924).
Repeal of references to High Court Circuit.
2.—The definitions contained in section 3 of the Principal Act of the Commissioners of the High Court Circuit and the Court of the High Court Circuit and also all references contained in the Principal Act to those Commissioners or that Court are hereby repealed.
Assignment of High Court Judge to Central Criminal Court.
3.—(1) The power of assigning to a judge of the High Court the duty of acting as the Central Criminal Court for the time being shall be vested in the President of the High Court alone.
(2) It shall be lawful for the President of the High Court in the exercise of the said power to assign the said duty to himself.
Jurisdiction of Central Criminal Court.
4.—The Central Criminal Court shall have and may exercise every jurisdiction in criminal matters for the time being vested in the High Court, and every person lawfully brought before the Central Criminal Court for trial in exercise of any such jurisdiction may be indicted before and tried and sentenced by that Court wherever it may be sitting in like manner in all respects as if the crime with which such person is charged had been committed in the county or county borough in which the said Court is sitting.
Times and sittings of Central Criminal Court.
5.—(1) Clause (iv.) of section 36 of the Principal Act is hereby repealed and in lieu thereof it is hereby enacted that the sittings of the Central Criminal Court shall be held (with and subject to a general power of adjournment) at such times and in such places as the President of the High Court shall from time to time direct.
(2) Every application to the Central Criminal Court in relation to a matter pending or formerly pending in that Court may, if and when that Court is not sitting, be made to and heard and disposed of by any Judge of the High Court.
Sending forward of accused persons for trial.
6.—The second proviso to paragraph B of section 77 of the Principal Act is hereby repealed and in lieu thereof it is hereby enacted that in all criminal cases not disposed of summarily by a Justice of the District Court, the Justice shall, if all the offences in respect of which the accused person is being sent forward are within the jurisdiction of the Circuit Court, send the accused person forward for trial to the Circuit Judge or one of the Circuit Judges (to be selected by the Justice) who under section 53 of the Principal Act has jurisdiction to try the case and in every other case shall send the accused person forward for trial to the Central Criminal Court.

7.—(1) Every person who, having been sent forward for trial either—
(a) on a charge which is not within the jurisdiction of the Circuit Court or on a number of charges any one or more or all of which is or are not within the jurisdiction of the Circuit Court, or
(b) to a Court of the High Court Circuit by a Circuit Judge in exercise of the power in that behalf conferred on him by section 54 of the Principal Act,
is at the passing of this Act awaiting trial accordingly shall be deemed to have been sent forward for trial to the sitting of the Central Criminal Court next ensuing after the passing of this Act and shall be tried accordingly.
(2) The recognizances by way of bail (if any such there be) given by or in respect of a person to whom the foregoing sub-section applies shall have effect as if references to the Central Criminal Court were inserted therein in lieu of the references contained therein to the court or courts actually mentioned or described therein.
Cases which may be disposed of by the Central Criminal Court.
8.—The cases which may be disposed of by the Central Criminal Court at any particular sitting of the Court shall include all cases in which the accused person is, at the beginning of or at any time during that sitting, in custody in the county or county borough in which the sitting is being held and is awaiting trial by the Circuit Court.
Short title, construction and citation.
9.—(1) This Act may be cited as the Courts of Justice Act, 1926.
(2) This Act shall be construed as one with the Principal Act, and the Principal Act and this Act may be cited together as the Courts of Justice Acts, 1924 and 1926.
