Léiriú.
1.—(1) San Acht seo—
ciallaíonn “an Príomh-Acht” an tAcht Liúntaisí Leanaí, 1944 (Uimh. 2 de 1944) ;
ciallaíonn “Acht 1946” an tAcht Liúntas Leanaí (Leasú), 1946 (Uimh. 8 de 1946).
(2) Forléireofar an tAcht seo agus an Príomh-Acht agus Acht 1946 mar aon ní amháin.
Alt 3 d'Acht 1946 a scor.
2.—Scoirfidh alt 3 d'Acht 1946 (a dhéanas foráil i dtaobh dátaí cáilitheacha chun críocha an Achta sin) d'éifeacht a bheith aige i leith aon aicme daoine pé lá a cheapfas an tAire le hordú i leith na haicme sin.
Eifeacht a bheith ag leasuithe ar Acht 1946 an lá a scoirfeas alt 3 den Acht sin agus ón lá sin amach.
3.—Nuair a déanfar ordú faoi alt 2 den Acht seo i leith aicme daoine, beidh éifeacht ag Acht 1946, an lá a ceapfar leis an ordú agus ón lá sin amach, maidir leis an aicme sin daoine faoi réir na leasuithe seo a leanas :
(a) in alt 4 scriosfar “ar dháta cáilitheach” agus “ar an dáta cáilitheach sin” ;
(b) cuirfear an fo-alt seo a leanas in ionad fo-ailt (1) d'alt 5 :
“(1) Duine a mbeidh beirt leanaí nó níos mó is leanaí cáilithe ina gcónaí go rialta leis, beidh sé cáilithe le haghaidh liúntais leanaí i leith na leanaí sin.” ;
(c) cuirfear an fo-alt seo a leanas in ionad fo-alt (1) go (4) d'alt 6 :
“(1) Faoi réir forál na nAcht Leasa Shóisialaigh (Liúntais Leanaí), 1944 go 1952, agus na rialachán fúthu, aon duine a fionnfar a bheith cáilithe le haghaidh liúntais leanaí i leith leanaí cáilithe, íocfar leis, fad a bheas sé cáilithe amhlaidh, as airgead a sholáthrós an tOireachtas, liúntas míosúil do réir—
(i) aon scilling déag i leith an dara linbh cháilithe, agus
(ii) má bhíonn agus fad a bheas níos mó ná beirt leanaí cáilithe ann, seacht scillinge déag agus sé pingne i leith an tríú linbh cháilithe agus gach linbh cháilithe ina dhiaidh sin.”

4.—(1) I gcás duine a bheith i dteideal liúntais leanaí in aghaidh tréimhse íoca ina bhfuil an lú lá d'Iúil, 1952—
(I) déantar leis seo an tréimhse íoca d'fhaidiú go dtí an lá deiridh den mhí ina bhfuil an lá ar a gcríochnódh an tréimhse íoca mura mbeadh an mhír seo,
(II) beidh éifeacht ag fo-alt (1) d'alt 6 d'Acht 1946 maidir leis an duine sin i gcás na tréimhse íoca sin amhail is dá ndéantaí—
(i) “liúntas in aghaidh na tréimhse íoca a bheas ceaptha dhó faoi alt 7 den Acht seo agus íocfar an liúntas sin, maidir leis an gcuid den tréimhse roimh an lú lá d'Iúil, 1952, in aghaidh na seachtaine do réir dhá scilling agus sé pingne i leith gach linbh cháilithe den tsórt sin de bhreis ar bheirt agus, maidir leis an gcuid eile den tréimhse, in aghaidh na míosa do réir aon scilling déag i leith an dara linbh cháilithe den tsórt sin agus do réir seacht scillinge déag agus sé pingne i leith an tríú linbh cháilithe agus gach linbh cháilithe ina dhiaidh sin den tsórt sin” a chur in ionad “liúntas seachtainiúil in aghaidh na tréimhse íoca a bheas ceaptha dhó faoi alt 7 den Acht seo do réir dhá scilling agus sé pingne i leith gach linbh cháilithe den tsórt sin de bhreis ar bheirt” i mír (a),
(ii) “i leith na seachtaine nó na míosa céanna (do réir mar is iomchuí)” a chur in ionad “i leith na seachtaine céanna” i mír (b).
(2) I gcás tréimhse íoca a bheas ceaptha faoi alt 7 d'Acht 1946 a bheith le tosnú an lú lá d'Iúil, 1952, nó dá éis sin, beidh éifeacht ag fo-alt (1) d'alt 6 d'Acht 1946 maidir leis an duine áirithe i gcás na tréimhse íoca sin amhail is dá ndéantaí—
(I) “liúntas míosúil in aghaidh na tréimhse íoca a bheas ceaptha dhó faoi alt 7 den Acht seo, do réir aon scilling déag i leith an dara linbh cháilithe den tsórt sin agus seacht scillinge déag agus sé pingne i leith an tríú linbh cháilithe agus gach linbh cháilithe ina dhiaidh sin den tsórt sin” a chur in ionad “liúntas seachtainiúil in aghaidh na tréimhse íoca a bheas ceaptha dhó faoi alt 7 den Acht seo do réir dhá scilling agus sé pingne i leith gach linbh cháilithe den tsórt sin de bhreis ar bheirt”,
(II) “míosa” a chur in ionad “seachtaine” i mír (b).
Alt 20 den Phríomh-Acht a leasú.
5.—Déantar leis seo fo-alt (1) d'alt 20 den Phríomh-Acht (a shonraíos na nithe a bhféadfaidh an tAire rialacháin a dhéanamh ina dtaobh) a leasú trí na míreanna seo a leanas a chur leis :
“ (h) chun a ordú cad é an tslí ina ndéanfar éilimh ar liúntais leanaí ;
(i) chun a ordú cad iad na dátaí ar a dtosnóidh liúntais leanaí, mar dámhadh i dtosach iad, ar fhaibhriú ;
(j) chun a ordú cad iad na dátaí ar a dtiocfaidh liúntais leanaí, arna n-athscrúdú ó am go ham mar gheall ar athruithe ar na himthosca, chun éifeachta, d'ainneoin aon ní in alt 9 den Acht seo ;
(k) chun aon chuid d'fhorála alt 29 agus 41 go 48 den Acht Leasa Shóisialaigh, 1952, nó d'fhorála arna ndéanamh faoi na hailt sin, a chur i bhfeidhm maidir le liúntais leanaí, pé acu feidhm mhodhnaithe nó feidhm gan mhodhnú í agus pé acu i dteannta nó in ionad aon fhorál de na hAchta Leasa Shóisialaigh (Liúntais Leanaí), 1944 go 1952, é.”
Leasuithe iarmartacha agus mionleasuithe ar an bPríomh-Acht.
6.—(1) Leasaítear leis seo fo-alt (1) d'alt 9 den Phríomh-Acht trí “nó má chítear dó, i gcás ina raibh liúntas leanaí iníoctha, go dtáinig aon athrú ábhartha ar na himthosca” a chur isteach roimh “agus na forálacha den Acht seo”.
(2) Leasaítear leis seo fo-alt (2) d'alt 9 den Phríomh-Acht trí “nó mura rud é, i gcás a thiocfas faoi réim míre (c) den fho-alt seo, go bhfeictear don oifigeach breithiúnachta, i gcás ina raibh liúntas leanaí iníoctha, go dtáinig aon athrú ábhartha ar na himthosca” a chur i ndeireadh an fho-ailt.
(3) Leasaítear leis seo fo-mhír (i) de mhír (a) d'fho-alt (4) d'alt 9 den Phríomh-Acht trí “lú lá den mhí tar éis na míosa ina raibh an” a chur isteach roimh “dáta ar ar hiarradh athscrúdú”.
(4) Leasaítear leis seo fo-alt (2) d'alt 15 den Phríomh-Acht trí “deich scillinge” a chur in ionad “cúig scillinge”.
(5) Leasaítear leis seo alt 18 den Phríomh-Acht trí “(nó, más cuí leis an Aire, sé mhí)” a chur isteach tar éis “trí mhí”.
(6) Leasaítear leis seo fo-mhír (i) de mhír (e) d'fho-alt (1) d'alt 20 den Phríomh-Acht trí “(nó, más cuí leis an Aire, de shé mhí)” a chur isteach tar éis “de thrí mhí”.

7.—Chun críocha na nAcht Leasa Shóisialaigh (Liúntais Leanaí), 1944 go 1952, measfar nach bhfuil sé bliana déag d'aois slán ag duine go dtí tosach an lae atá cothrom sé bliana déag ón lá a rugadh é, agus mar sin do gach aois eile.

8.—I gcás leanbh d'uchtáil faoi aon Acht a dhéanas socrú i dtaobh leanaí d'uchtáil (arna rith roimh an Acht seo nó dá éis) déanfar, chun críocha na nAcht Leasa Shóisialaigh (Liúntais Leanaí), 1944 go 1952, an leanbh d'áireamh feasta amhail is dá mba é leanbh an uchtóra nó na n-uchtóirí é a rugadh dó, di nó dóibh de phósadh dleathach agus nár leanbh dhuine ar bith eile é.
Gearrtheideal agus comhlua.
9.—(1) Féadfar an tAcht Leasa Shóisialaigh (Liúntais Leanaí), 1952, a ghairm den Acht seo.
(2) Féadfar na hAchta Leasa Shóisialaigh (Liúntais Leanaí), 1944 go 1952, a ghairm den Phríomh-Acht, d'Acht 1946 agus den Acht seo le chéile.

SOCIAL WELFARE (CHILDREN'S ALLOWANCES) ACT, 1952.
Interpretation.
1.—(1) In this Act—
“the Principal Act” means the Children's Allowances Act, 1944 (No. 2 of 1944);
“the Act of 1946” means the Children's Allowances (Amendment) Act, 1946 (No. 8 of 1946).
(2) This Act shall be construed as one with the Principal Act and the Act of 1946.
Cesser of section 3 of Act of 1946.
2.—Section 3 of the Act of 1946 (which provides for qualifying dates for the purposes of that Act) shall cease to have effect for a category of persons on such day as the Minister appoints by order with respect to that category.
Amendments of Act of 1946 to have effect on and after cesser of section 3 of that Act.
3.—Where an order is made under section 2 of this Act with respect to a category of persons, the Act of 1946 shall, on and after the day appointed by the order, have effect in relation to that category of persons subject to the following amendments:
(a) in section 4 “on a qualifying date” and “on the said qualifying date” shall be deleted;
(b) the following subsection shall be substituted for subsection (1) of section 5:
“(1) A person with whom two or more children who are qualified children normally reside shall be qualified for a children's allowance in respect of those children.”;
(c) the following subsection shall be substituted for subsections (1) to (4) of section 6:
“(1) Subject to the provisions of the Social Welfare (Children's Allowances) Acts, 1944 to 1952, and of the regulations thereunder, a person who is found to be qualified for a children's allowance in respect of qualified children shall, so long as he remains so qualified, be paid, out of moneys provided by the Oireachtas, a monthly allowance at the rate of—
(i) eleven shillings for the second qualified child, and
(ii) if and so long as there are more than two qualified children, seventeen shillings and sixpence for the third and each subsequent qualified child.”
Transitional provisions.
4.—(1) Where a person is entitled to a children's allowance for a payment period which includes the 1st day of July, 1952—
(I) the payment period is hereby extended to the last day of the month which includes the day on which the payment period would terminate apart from this paragraph,
(II) subsection (1) of section 6 of the Act of 1946 shall have effect in relation to that person as respects that payment period as if—
(i) for “a weekly allowance for the payment period appointed for him under section 7 of this Act, at the rate of two shillings and sixpence for each such qualified child in excess of two” in paragraph (a) there were substituted “an allowance for the payment period appointed for him under section 7 of this Act, such allowance being, as respects the part of the period before the 1st day of July, 1952, weekly at the rate of two shillings and sixpence for each such qualified child in excess of two and, as respects the remainder of the period, monthly at the rate of eleven shillings for the second such qualified child and seventeen shillings and sixpence for the third and each subsequent such qualified child”,
(ii) for “week” in paragraph (b) there were substituted “week or month (as may be appropriate)”.
(2) Where a payment period appointed under section 7 of the Act of 1946 is to commence on or after the 1st day of July, 1952, subsection (1) of section 6 of the Act of 1946 shall have effect in relation to the person concerned as respects that payment period as if—
(I) for “weekly allowance for the payment period appointed for him under section 7 of this Act, at the rate of two shillings and sixpence for each such qualified child in excess of two” there were substituted “monthly allowance for the payment period appointed for him under section 7 of this Act, at the rate of eleven shillings for the second such qualified child and seventeen shillings and sixpence for the third and each subsequent such qualified child”,
(II) for “week” in paragraph (b) there were substituted “month”.
Amendment of section 20 of principal Act.
5.—Subsection (1) of section 20 of the Principal Act (which specifies the matters with respect to which regulations may be made by the Minister) is hereby amended by the addition thereto of the following paragraphs:
“(h) for prescribing the manner in which claims for children's allowances are to be made;
(i) for prescribing the dates on which children's allowances, as awarded originally, are to commence to accrue;
(j) for prescribing the dates on which children's allowances, as revised from time to time on account of changes of circumstances, are, notwithstanding anything contained in section 9 of this Act, to take effect;
(k) for applying any of the provisions of or made under sections 29 and 41 to 48 of the Social Welfare Act, 1952, to children's allowances, whether such application is with or without modifications and whether in addition to or in substitution for any provisions of the Social Welfare (Children's Allowances) Acts, 1944 to 1952.”
Consequential and minor amendments of Principal Act.
6.—(1) Subsection (1) of section 9 of the Principal Act is hereby amended by the insertion of “or if it appears to him in a case where a children's allowance has been payable that any relevant change of circumstances has occurred,” before “and the provisions of this Act”.
(2) Subsection (2) of section 9 of the Principal Act is hereby amended by the addition at the end of the subsection of “or unless, in a case falling within paragraph (c) of this subsection, it appears to the deciding officer in a case where a children's allowance has been payable that any relevant change of circumstances has occurred”.
(3) Subparagraph (i) of paragraph (a) of subsection (4) of section 9 of the Principal Act is hereby amended by the insertion of “the 1st day of the month following the month including” before “the date on which the application for revision was made”.
(4) Subsection (2) of section 15 of the Principal Act is hereby amended by the substitution of “ten shillings” for “five shillings”.
(5) Section 18 of the Principal Act is hereby amended by the insertion of “(or, where the Minister so thinks fit, six months)” after “three months”.
(6) Subparagraph (i) of paragraph (e) of subsection (1) of section 20 of the Principal Act is hereby amended by the insertion of “(or, where the Minister so thinks fit, six months)” after “three months”.
Attainment of age.
7.—For the purposes of the Social Welfare (Children's Allowances) Acts, 1944 to 1952, a person shall be deemed not to have attained the age of sixteen years until the commencement of the sixteenth anniversary of the day of his birth, and similarly with respect to any other age.
Adopted child.
8.—Where a child becomes adopted under any Act providing for the adoption of children (whether passed before or after the passing of this Act), the child shall thereafter be treated for the purposes of the Social Welfare (Children's Allowances) Acts, 1944 to 1952, as if he were the child of the adopter or adopters born to him, her or them in lawful wedlock and were not the child of any other person.
Short title and collective citation.
9.—(1) This Act may be cited as the Social Welfare (Children's Allowances) Act, 1952.
(2) The Principal Act, the Act of 1946 and this Act may be cited together as the Social Welfare (Children's Allowances) Acts, 1944 to 1952.
