1.—San Acht seo tá leis an abhairt “údarás bóthar” an bhrí atá léi in alt 2 den Acht Rialtais Áitiúil, 1946 (Uimh. 24 de 1946).

Alt 25 den Acht Rialtais Áitiúil, 1925, a leasú.

2.—(1) D'ainneoin aon ní contrártha dhó sin in alt 25 den Acht Rialtais Áitiúil, 1925 (Uimh. 5 de 1925), nó in aon achtachán eile, cumhachtaítear leis seo d'údarás bóthar a dhearbhú gur bóthar poiblí aon bhóthar a bhfuil ceart slí poiblí air ag lucht siúil, ag ainmhithe agus ag feithiclí agus nach bóthar poiblí, más deimhin leis an údarás bóthar sin gur bóthar é a fhónas don phobal i gcoitinne, agus gach bóthar a ndearbhófar amhlaidh é a bheith ina bhóthar poiblí beidh sé ina bhóthar poiblí chun gach críche ar an dearbhú sin a dhéanamh.

(2) Mí ar a laghad sara ndéanfaid aon dearbhú den tsórt a luaitear sa bhfo-alt roimhe seo, foilseoidh an t-údarás bóthar, i dhá nuachtán ar a laghad a léitear ina líomatáiste feidhmiúcháin, fógra go bhfuil ar intinn acu déanamh an dearbhuithe sin a bhreithniú agus beidh sa bhfógra sin pé sonraí a bheas ordaithe.

(3) Beidh déanamh dearbhuithe faoi fho-alt (1) den alt seo nó faoi fho-alt (1) d'alt 25 den Acht Rialtais Áitiúil, 1925 (Uimh. 5 de 1925), ina fheidhm fhorcoimeádta do réir bhrí na nAcht um Bainistí Chontae, 1940 agus 1942.

Gearrtheideal, comhlua agus forléiriú.

3.—(1) Féadfar an tAcht Rialtais Áitiúil, 1953, a ghairm den Acht seo.

(2) Féadfar na hAchta Rialtais Áitiúil, 1925 go 1953, a ghairm de na hAchta Rialtais Áitiúil, 1925 go 1946, agus den Acht seo le chéile.

(3) Forléireofar na hAchta Rialtais Áitiúil, 1925 go 1946, agus an tAcht seo le chéile mar aon Acht amháin.

LOCAL GOVERNMENT ACT, 1953.

Definition.

1.—In this Act the expression “road authority” has the same meaning as in section 2 of the Local Government Act, 1946 (No. 24 of 1946).

Amendment of section 25 of Local Government Act, 1925.

2.—(1) Notwithstanding anything to the contrary contained in section 25 of the Local Government Act, 1925 (No. 5 of 1925) or in any other enactment a road authority is hereby empowered to declare any road over which a public right of way for foot passengers, animals and vehicles exists and which is not a public road to be a public road, if such road authority is satisfied that the road is of general public utility, and every road so declared to be a public road shall thereupon for all purposes be a public road.

(2) Not less than one month before making any such declaration as is mentioned in the foregoing subsection the road authority shall publish in at least two newspapers circulating in their functional area notice of their intention to consider the making of such declaration and such notice shall contain such particulars as may be prescribed.

(3) The making of a declaration under subsection (1) of this section or under subsection (1) of section 25 of the Local Government Act, 1925 (No. 5 of 1925), shall be a reserved function within the meaning of the County Management Acts, 1940 and 1942.

Short title, collective citation and construction.

3.—(1) This Act may be cited as the Local Government Act, 1953.

(2) The Local Government Acts, 1925 to 1946, and this Act may be cited together as the Local Government Acts, 1925 to 1953.

(3) The Local Government Acts, 1925 to 1946, and this Act shall be construed together as one Act.
