ACHT UM CHLÁRÚ TITHE MAITHREACHAIS, 1934.
Mínithe.
1.—San Acht so—
cialluíonn an abairt “an tAire” an tAire Rialtais Áitiúla agus Sláinte Puiblí;
cialluíonn an abairt “an t-údarás áitiúil” an cólucht gurb é atá, in aon líomatáiste gur ina thaobh a húsáidtear an abairt, mar údarás áitiúil maoirseachta chun crícheanna an Midwives (Ireland) Act, 1918, sa líomatáiste sin;

An lá ceaptha.
2.—(1) Féadfaidh an tAire, le hordú, lá do cheapadh chun bheith mar lá cheaptha chun crícheanna an Achta so.
(2) San Acht so cialluíonn an abairt “an lá ceaptha” an lá cheapfaidh an tAire chun bheith mar lá cheaptha chun crícheanna an Achta so.
Cláir tithe máithreachais.
3.—Cuirfidh gach údarás áitiúil fé ndeár go ndéanfar clár (ar a dtabharfar mar ainm agus mar theideal clár na dtithe máithreachais agus dá ngairmtear an clár san Acht so) do choimeád sa bhfuirm orduithe agus iontrálfar sa chlár san na nithe is gá do réir an Achta so d'iontráil ann agus fós pé nithe eile bheidh orduithe.
Iarrataisí ar chlárú agus clárú.
4.—(1) Duine ar bith bheidh ar aigne gnó tighe mháithreachais do bheith ar siúl aige, an lá ceaptha no dá éis sin, i líomatáiste feidhmiúcháin údaráis áitiúla féadfaidh, tráth ar bith tar éis an Achta so do rith, a iarraidh sa tslí orduithe ar an údarás san é do chlárú sa chlár a bheidh á choimeád ag an údarás san.
(2) Beidh éifeacht ag na forálacha so leanas maidir le hiarrataisí ar dhaoine do chlárú sa chlár a bheidh á choimeád ag údarás áitiúil, sé sin le rá:—
(a) más mian leis an iarratasóir go gclárófaí é alos dhá thigh mháithreachais no níos mó déanfaidh an t-iarratasóir iarratas ar leithligh alos gach tighe mháithreachais fé leith acu san,
(b) beidh gach iarratas sa bhfuirm orduithe agus cuírfear síos ann seoladh an iarratasóra agus mion-innste i dtaobh an áitreibh i líomatáiste feidhmiúcháin an údaráis áitiúla san ina bhfuil an t-iarratasóir ar aigne an gnó tighe mháithreachais do bheith ar siúl aige gur ina thaobh a bheidh an t-iarratasóir á iarraidh go gclárófaí é sa chlár san agus cuirfear síos ann fós pé mioninnste eile bheidh orduithe.
(3) Ar an údarás áitiúil d'fháil iarratais fén alt so agus dá réir, cuirfid fé ndeár, fé réir forálacha an chéad ailt ina dhiaidh seo—
(a) ainm agus seoladh an iarratasóra, agus
(b) mion-innste i dtaobh an tighe mháithreachais a bheidh luaidhte san iarratas san agus gur ina thaobh a bheidh an t-iarratasóir á iarraidh go gclárófaí é sa chlár san,
d'iontráil sa chlár a bheidh á choimeád acu.
Diúltadh do chlárú do dhéanamh.
5.—(1) Má hiarrtar ar údarás áitiúil clárú do dhéanamh sa chlár a bheidh á choimeád acu, féadfaidh an t-údarás áitiúil sin, más deimhin leo—
(a) nách duine ceart oiriúnach chun gnótha tighe mháithreachais do bheith ar siúl aige an t-iarratasóir, no
(b) go bhfuil an t-áitreabh ina bhfuil an t-iarratasóir ar aigne an gnó tighe mháithreachais do bheith ar siúl aige gur ina thaobh atá an clárú á iarraidh, go bhfuil san neamhoiriúnach chun é d'úsáid i gcóir gnótha tighe mháithreachais, no
(c) i gcás tighe mháithreachais ná raibh ar bun le linn an Achta so do rith, nách banaltra cháilithe ná bean chabhartha dheimhnithe príomh-bhanaltra an tighe,
féadfaid, le hordú (dá ngairmtear ordú diúlta san alt so) diúltadh do ghéilleadh don iarratas san.
(2) Luadhfar i ngach ordú diúlta na fáthanna atá leis an ordú san do dhéanamh.
(3) Má dheineann údarás áitiúil ordú diúlta maidir le hiarratas, beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) seirbheálfaidh an t-údarás áitiúil cóip den ordú san ar an iarratasóir;
(b) féadfaidh an t-iarratasóir, laistigh de lá is fiche tar éis na cóipe sin do sheirbheáil air, athchomharc do dhéanamh sa tslí orduithe chun an Aire i gcoinnibh an orduithe dhiúlta san;
(c) i gcás an athchomhairc sin do dhéanamh go cuibhe, déanfaidh an tAire, tar éis an chúrsa do bhreithniú, déanfaidh, fé mar is dóich leis is ceart, ordú ag daingniú an orduithe dhiúlta san no ordú á ordú don údarás áitiúil an t-iarratasóir do chlárú do réir an iarratais.
Toirmeasc ar ghnó tighe mháithreachais do bheith ar siúl ag duine nea-chláruithe no in áitreabh neachláruithe.
6.—(1) Fé réir forálacha an ailt seo ní bheidh sé dleathach do dhuine ar bith, an lá ceaptha ná dá éis sin, gnó tighe mháithreachais do bheith ar siúl aige i líomatáiste feidhmiúcháin údaráis áitiúla maran rud é—
(a) go mbeidh an duine sin cláruithe alos an tighe mháithreachais sin sa chlár a bheidh á choimeád ag an údarás áitiúil sin, no
(b) gur tigh máithreachais saortha do réir bhrí an chéad ailt ina dhiaidh seo an tigh máithreachais sin de thurus na huaire.
(2) Má dheineann duine ar bith aon ghníomh is sárú ar an alt so beidh an duine sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga púnt do chur air agus, i gcás cionta leanúnaigh fén alt so, fíneáil bhreise ná raghaidh thar deich bpúint in aghaidh gach lae leanfar den chionta.
(3) I gcás duine bheidh cláruithe alos tighe mháithreachais d'fháil bháis, beidh sé dleathach d'ionadaí phearsanta an duine sin no do bhall de líntighe an duine sin gnó an tighe mháithreachais sin do choimeád ar siúl go ceann tréimhse nách sia ná sé mhí o dháta an duine sin d'fháil bháis d'ainneoin gan an t-ionadaí pearsanta san no an ball san do bheith cláruithe sa chlár san alos an tighe mháithreachais sin.
Comhacht chun fundúireachtaí áirithe do shaoradh.
7.—(1) Féadfaidh an tAire, más oiriúnach leis é, saoirse o fhorálacha an ailt deiridh sin roimhe seo do dheonadh d'aon óspidéal no fundúireacht is tigh máithreachais ach nách chun sochair phríobháidigh a bhíonn gnó tighe mháithreachais ar siúl ann.
(2) Féadfaidh an tAire saoirse deonfar fén alt so do tharrac siar tráth ar bith.
(3) An tagairt atá san alt deiridh sin roimhe seo do thigh mháithreachais shaortha léireofar í mar thagairt do thigh mháithreachais go mbeidh saoirse fén alt so deonta ina thaobh agus ná beidh san tarraicthe siar.
Deimhnithe clárathachta.
8.—(1) Nuair a chláróidh údarás áitiúil duine alos tighe mháithreachais sa chlár a bheidh á choimeád acu, déanfaidh an t-údarás áitiúil sin deimhniú (dá ngairmtear deimhniú clárathachta san alt so) sa bhfuirm orduithe, ar an gclárú san, do thabhairt amach don duine sin.
(2) Má thárlann do dhuine ar bith a bheidh cláruithe alos tighe mháithreachais sa chlár a bheidh á choimeád ag údarás áitiúil go dteipfidh air no go dtabharfaidh faillí, an lá ceaptha no dá éis sin, maidir leis an deimhniú clárathachta bheidh tugtha amach alos an tighe mháithreachais sin do choimeád ar taisbeáint in áit so-fheicse sa tigh máithreachais sin, beidh an duine sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar dhá phúnt do chur air.
Clárú do chur ar nea-mbrí.
9.—(1) Más deimhin le húdarás áitiúil—
(a) maidir le duine ar bith bheidh cláruithe sa chlár a bheidh á choimeád acu, nách duine ceart oiriúnach an duine sin a thuilleadh chun gnótha tighe mháithreachais do bheith ar siúl aige, no
(b) maidir le duine bheidh cláruithe sa chlár san, go bhfuiltear tar éis an duine sin do chiontú i gcionta fé aon alt den Acht so,
féadfaidh an t-údarás áitiúil sin, le hordú (dá ngairmtear ordú nea-mbríochainte san alt so), clárú no cláruithe uile agus fé seach an duine sin sa chlár san do chur ar nea-mbrí.
(2) Más deimhin le húdarás áitiúil—
(a) maidir leis an áitreabh ina bhfuil gnó tighe mháithreachais ar siúl go mbeidh duine cláruithe ina thaobh sa chlár a bheidh á choimeád ag an údarás áitiúil sin, ná fuil an t-áitreabh san oiriúnach a thuilleadh chun é d'úsáid i gcóir gnótha tighe mháithreachais, no
(b) go ndearnadh, tar éis dáta an Achta so do rith, duine nách banaltra cháilithe ná bean chabhartha dheimhnithe do cheapadh mar phríomh-bhanaltrain do thigh máithreachais go bhfuil duine cláruithe sa chlár san ina thaobh,
féadfaidh an t-údarás áitiúil sin, le hordú (dá ngairmtear freisin ordú nea-mbríochainte san alt so), clárú an duine sin alos an tighe mháithreachais sin do chur ar nea-mbrí.
(3) Luadhfar i ngach ordú nea-mbríochainte na fáthanna atá leis an ordú san do dhéanamh.
(4) Má dheineann údarás áitiúil ordú nea-mbríochainte maidir le duine ar bith a bheidh cláruithe sa chlár a bheidh á choimeád acu beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) seirbheálfaidh an t-údarás áitiúil cóip den ordú san ar an duine sin, agus, mara ndeintear aon athchomharc i gcoinnibh an orduithe sin fén gcéad mhír ina dhiaidh seo, tiocfaidh an t-ordú san i bhfeidhm ar an aonú lá fichead, tar éis dáta seirbheála na cóipe sin, do bheith caithte;
(b) féadfaidh an duine sin, sara mbeidh an t-aonú lá fichead san caithte, athchomharc do dhéanamh sa tslí orduithe chun an Aire i gcoinnibh an orduithe nea-mbríochainte sin;
(c) i gcás an athchomhairc sin do dhéanamh go cuibhe, beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(i) déanfaidh an tAire, tar éis an chúrsa do bhreithniú, déanfaidh, fé mar is dóich leis is ceart, ordú (dá ngairmtear ordú daingniúcháin san alt so) ag daingniú an orduithe nea-mbríochainte sin no ordú ag ceiliúradh an orduithe nea-mbríochainte sin;
(ii) ní thiocfaidh an t-ordú nea-mbríochainte sin i bhfeidhm mara ndeinidh an tAire ordú daingniúcháin, agus sa chás san tiocfaidh an t-ordú neambríochainte sin i bhfeidhm an seachtú lá tar éis dáta an orduithe dhaingniúcháin.
Breacacháin a bheidh le coimeád i dtithe máithreachais.
10.—(1) An lá ceaptha agus dá éis sin beidh sé de dhualgas ar gach duine bheidh cláruithe alos tighe mháithreachais fén Acht so breacacháin sa bhfuirm orduithe do choimeád no a chur fé ndeár iad do choimeád, sa tigh máithreachais sin, i dtaobh—
(a) gach duine glacfar isteach sa tigh sin;
(b) gach duine scaoilfear amach as an tigh sin;
(c) gach luighe seola thárlóidh ann;
(d) gach mí-bhreithe thárlóidh ann;
(e) gach breithe thárlóidh ann;
(f) gach báis a thárlóidh ann;
(g) gach leinbh a haistreofar as an tigh sin agus i dtaobh ainme an duine aistreoidh agus an tseolta chun a n-aistreofar an leanbh san;
agus, laistigh de dhá uair déag a' chluig tar éis gach glactha isteach, scaoilte amach, luighe seola, mí-bhreithe, breithe, báis no aistrithe den tsórt san, na mion-innste orduithe i dtaobh an chéanna d'iontráil sna breacacháin sin.
(2) Gach breacachán a bheidh á choimeád do réir an ailt seo féadfaidh aon oifigeach údaruithe don údarás áitiúil, gur laistigh dá líomatáiste feidhmiúcháin a bheidh an tigh máithreachais in ar gá an breacachán san do choimeád, féadfaidh seisean an breacachán san d'iniúchadh gach tráth réasúnta, agus an duine dhlighfidh fén alt so an breacachán san do choimeád beidh sé de dhualgas air, ar san d'éileamh, an breacachán san do thabhairt i láthair chun go n-iniúchfadh an t-oifigeach san é.
(3) Gach breacachán a bheidh á choimeád do réir an ailt seo féadfaidh aon chigire é d'iniúchadh gach tráth réasúnta, agus an duine dhlighfidh fén alt so an breacachán san do choimeád beidh sé de dhualgas air, ar san d'éileamh, an breacachán san do thabhairt i láthair chun go n-iniúchfadh cigire é.
(4) Má thárlann d'éinne—
(a) maidir leis an mbreacachán san go gceangailtear air leis an alt so é do choimeád no a chur fé ndeár é do choimeád, go dteipfidh air san do choimeád no a chur fé ndeár é do choimeád; no
(b) maidir le haon iontráil go gceangailtear air leis an alt so í do dhéanamh sa bhreacachán san, go dteipfidh air san do dhéanamh no a chur fé ndeár san do dhéanamh ann laistigh den am a ceaptar leis an alt so; no
(c) maidir le haon bhreacachán go gceangailtear air leis an alt so é do thabhairt i láthair chun go n-iniúchfadh oifigeach údaruithe d'údarás áitiúil é, go dteipfidh air san do thabhairt i láthair no a chur fé ndeár san do thabhairt i láthair chun go n-iniúchfadh an t-oifigeach san é no go gcuirfidh cosc le haon oifigeach den tsórt san agus é ag déanamh an iniúchta san; no
(d) maidir le haon bhreacachán go gceangailtear air leis an alt so é do thabhairt i láthair chun go n-iniúchfadh cigire é, go dteipfidh air san do thabhairt i láthair no a chur fé ndeár san do thabhairt i láthair chun go n-iniúchfadh an cigire sin é no go gcuirfidh cosc leis an gcigire sin agus é ag déanamh an iniúchta san; no
(e) go ndéanfaidh no go gcuirfidh fé ndeár go ndéanfar aon iontráil a bheidh bréagach no mí-threorach in aon phone táchtach do chur sa bhreacachán san;
beidh an duine sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air agus, i gcás cionta leanúnaigh fén alt so, fíneáil bhreise ná raghaidh thar púnt in aghaidh gach lae leanfar den chionta.
Básanna i dtithe máithreachais do chur in úil.
11.—(1) Pé uair, an lá ceaptha no dá éis sin, a thárlóidh bás i dtigh máithreachais go mbeidh duine cláruithe ina thaobh sa chlár a bheidh á choimeád ag údarás áitiúil, bhéarfaidh an duine sin fógra i scríbhinn do phríomh-oifigeach fheidhmiúcháin an údaráis áitiúla san i dtaobh an bháis sin agus i dtaobh cad ba thrúig leis tríd an bhfógra san do sheachadadh don phríomhoifigeach fheidhmiúcháin sin, no tré n-a chur chuige tríd an bpost cláruithe, laistigh de dhá uair déag a' chluig tar éis an bháis sin.
(2) Má thárlann do dhuine ar bith go dteipfidh air no go dtabharfaidh faillí maidir le déanamh do réir forálacha an ailt seo, beidh an duine sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air.
Tithe máithreachais d'iniúchadh.
12.—(1) Beidh duine is oifigeach údaruithe d'údarás áitiúil i dteideal dul isteach gach tráth réasúnta in aon tigh máithreachais a bheidh laistigh de líomatáiste feidhmiúcháin an údaráis áitiúla san agus an tigh máithreachais sin d'iniúchadh.
(2) Beidh cigire i dteideal dul isteach gach tráth réasúnta in aon tigh máithreachais agus an tigh máithreachais sin d'iniúchadh.
(3) Má chuireann duine ar bith cosc no bac le haon oifigeach údaruithe no le haon chigire agus é ag feidhmiú na gcomhacht a bronntar air leis an alt so beidh an duine sin ciontach i gcionta fen alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar cúig púint do chur air.
Scríbhinní do sheirbheáil.
13.—Aon scríbhinn is gá do réir an Achta seo do sheirbheáil ar dhuine féadfar í do sheirbheáil tré n-a seachadadh don duine sin no tré n-a cur tríd an bpost cláruithe chun an duine sin fé sheoladh na háite comhnaithe is déanaí is eol do bheith ag an duine sin.
Rialacháin.
14.—Féadfaidh an tAire o am go ham, le hordú, rialacháin do dhéanamh i dtaobh éinní no aon ruda dá dtagartar san Acht so mar ní no mar rud atá orduithe.
Costaisí údarásanna áitiúla.
15.—Déanfar na costaisí uile fé n-a raghaidh údarás áitiúil fén Acht so do chruinniú agus d'íoc fé mar a deintear costaisí fé n-a dtéigheann an t-údarás áitiúil sin fén Midwives (Ireland) Act, 1918, do chruinniú agus d'íoc.

REGISTRATION OF MATERNITY HOMES ACT, 1934
Definitions.
1.—In this Act—
the expression “the Minister” means the Minister for Local Government and Public Health;
the expression “the local authority” means the body which is, in any area in relation to which the expression is used, the local supervising authority for the purposes of the Midwives (Ireland) Act, 1918, in that area;
the expression “maternity home” means any premises which are, either wholly or partly, used or intended to be used for the reception of pregnant women or of women immediately after child-birth;
the expression “authorised officer” means an officer of the local authority in relation to whom such expression is used authorised by such local authority with the approval of the Minister to exercise the powers conferred by this Act on an authorised officer;
the word “inspector” means a person authorised by the Minister to exercise the powers conferred by this Act on an inspector;
the expression “qualified nurse” means a nurse registered in the general part of the register kept under the Nurses Registration (Ireland) Act, 1919;
the expression “superintendent nurse” means the person having
the superintendence of the patients in the maternity home in relation to which the expression is used;
the word “prescribed” means prescribed by regulations made by the Minister under this Act.
The appointed day.
2.—(1) The Minister may by order appoint a day to be the appointed day for the purposes of this Act.
(2) In this Act the expression “the appointed day” means the day appointed by the Minister to be the appointed day for the purposes of this Act.
Registers of maternity homes.
3.—Every local authority shall cause to be kept in the prescribed form a register (to be called and known as the register of maternity homes and in this Act referred to as the register) and there shall be entered therein the matters required by this Act to be entered therein and such other matters as may be prescribed.
Applications for registration and registration.
4.—(1) Any person who proposes to carry on, on or after the appointed day, in the functional area of a local authority a maternity home may at any time after the passing of this Act apply in the prescribed manner to such authority to be registered in the register kept by such authority.
(2) The following provisions shall have effect in relation to applications for registration in the register kept by a local authority, that is to say:—
(a) where the applicant desires to be registered in respect of two or more maternity homes the applicant shall make a separate application in respect of each of the said homes,
(b) every application shall be in the prescribed form and shall state the address of the applicant and particulars of the premises situate in the functional area of such local authority where the applicant proposes to carry on the maternity home in respect of which the applicant seeks to be registered in such register and such other particulars as may be prescribed.
(3) Upon receipt of an application under and in accordance with this section, the local authority shall, subject to the provisions of the next following section, cause to be entered in the register kept by them—
(a) the name and address of the applicant, and
(b) particulars of the maternity home specified in such application in respect of which the applicant seeks to be registered in the said register.
Refusal of registration.
5.—(1) Where an application is made to a local authority for registration in the register kept by them, such local authority if they are satisfied—
(a) that the applicant is not a fit and proper person to carry on a maternity home, or
(b) that the premises where the applicant proposes to carry on the maternity home in respect of which the registration is sought are unsuitable for use for a maternity home, or
(c) in the case of a maternity home which was not in existence at the date of the passing of this Act, that the superintendent nurse of the home is not a qualified nurse or a certified midwife,
may, by order (in this section referred to as a refusal order) refuse such application.
(2) Every refusal order shall state the grounds on which such order is made.
(3) Where a local authority make in relation to an application a refusal order, the following provisions shall have effect, that is to say:—
(a) the local authority shall serve on the applicant a copy of such order;
(b) the applicant may within twenty-one days after the service of such copy appeal in the prescribed manner to the Minister against such refusal order;
(c) in the event of such appeal being duly made, the Minister shall, after considering the matter, make, as he thinks proper, either an order confirming such refusal order or an order directing the local authority to register the applicant in accordance with the application.
Prohibition of carrying on maternity home by unregistered person or in unregistered premises.
6.—(1) Subject to the provisions of this section, on and after the appointed day, it shall not be lawful for any person to carry on a maternity home in the functional area of a local authority unless—
(a) such person is registered in respect of such home in the register kept by such local authority, or
(b) such home is for the time being an exempted maternity home within the meaning of the next following section.
(2) If any person acts in contravention of this section such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds and, in the case of a continuing offence under this section, to a further fine not exceeding ten pounds for every day during which the offence is continued.
(3) Where a person who is registered in respect of a maternity home dies, it shall be lawful for the personal representative or a member of the family of such person to carry on such maternity home for a period not exceeding six months from the date of the death of such person notwithstanding that such personal representative or member is not registered in the said register in respect of such maternity home.
Power to exempt certain institutions.
7.—(1) The Minister may, if he so thinks fit, grant exemption from the provisions of the immediately preceding section to any hospital or institution which is a maternity home but is not carried on for private profit.
(2) An exemption granted under this section may at any time be withdrawn by the Minister.
(3) The reference in the immediately preceding section to an exempted maternity home shall be construed as a reference to a maternity home in respect of which an exemption under this section has been granted and is not withdrawn.
Certificates of registration.
8.—(1) Where a local authority have registered a person in respect of a maternity home in the register kept by them, such local authority shall issue to such person a certificate (in this section referred to as a certificate of registration) in the prescribed form of such registration.
(2) If any person who is registered in respect of a maternity home in the register kept by a local authority fails or neglects on or after the appointed day to keep exhibited in a conspicuous place in such maternity home the certificate of registration issued in respect of such maternity home, such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding two pounds.
Cancellation of registration.
9.—(1) Where a local authority are satisfied that—
(a) any person registered in the register kept by them is no longer a fit and proper person to carry on a maternity home, or
(b) that a person registered in such register has been convicted of an offence under any section of this Act,
such local authority may, by order (in this section referred to as a cancellation order) cancel the registration or the several registrations of such person in such register.
(2) Where a local authority are satisfied that—
(a) the premises, where a maternity home in respect of which a person is registered in the register kept by such local authority is carried on, are no longer suitable for use for a maternity home, or
(b) that after the date of the passing of this Act an individual, who is neither a qualified nurse nor a certified midwife, has been appointed superintendent nurse of a maternity home in respect of which a person is registered in such register,
such local authority may, by order (in this section also referred to as a cancellation order) cancel the registration of such person in respect of such maternity home.
(3) Every cancellation order shall state the grounds on which such order is made.
(4) Where a local authority make in relation to any person registered in the register kept by them a cancellation order the following provisions shall have effect, that is to say:—
(a) the local authority shall serve on such person a copy of such order, and such order shall, if no appeal against such order is made under the next following paragraph, come into force at the expiration of the twenty-first day after the date of the service of such copy;
(b) such person may before such expiration appeal in the prescribed manner to the Minister against such cancellation order;
(c) in the event of such appeal being duly made the following provisions shall have effect, that is to say:—
(i) the Minister shall, after considering the matter, make, as he thinks proper, either an order (in this section referred to as a confirming order) confirming such cancellation order or an order revoking such cancellation order;
(ii) such cancellation order shall not come into force unless the Minister makes a confirming order, and in that event such cancellation order shall come into force on the seventh day after the date of the confirming order.
Records to be kept at maternity homes.
10.—(1) On and after the appointed day it shall be the duty of every person who is registered in respect of a maternity home under this Act to keep or cause to be kept at such maternity home records in the prescribed form—
(a) every reception into such home;
(b) every discharge from such home;
(c) every confinement therein;
(d) every miscarriage therein;
(e) every birth therein;
(f) every death therein;
(g) every removal of a child therefrom and of the name of the person by whom and the address to which such child is removed;
and within twelve hours after every such reception, discharge, confinement, miscarriage, birth, death or removal to enter in the said records the prescribed particulars thereof.
(2) Every record kept in pursuance of this section may be inspected at all reasonable times by any authorised officer of the local authority within whose functional area the maternity home at which such record is required to be kept is situate, and it shall be the duty of the person liable under this section to keep such record to produce for inspection of such officer on demand such record.
(3) Every record kept in pursuance of this section may be inspected at all reasonable times by any inspector, and it shall be the duty of the person liable under this section to keep such record to produce for inspection of an inspector on demand such record.
(4) If any person—
(a) fails to keep or cause to be kept such record as is required by this section to be kept or caused to be kept by him; or
(b) fails to make or cause to be made in such record within the time fixed by this section any entry required by this section to be made by him therein; or
(c) fails to produce or cause to be produced for inspection by an authorised officer of a local authority any record which he is required by this section to produce to such officer or obstructs any such officer in the making of such inspection; or
(d) fails to produce or cause to be produced for inspection by an inspector any record which he is required by this section to produce to such inspector or obstructs such inspector in the making of such inspection; or
(e) makes or causes to be made in such record any entry which is false or misleading in any material particular;
such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds and, in the case of a continuing offence under this section, to a further fine not exceeding one pound for every day during which the offence is continued.
Notification of deaths at maternity homes.
11.—(1) Whenever on or after the appointed day a death occurs in a maternity home in respect of which a person is registered in the register kept by a local authority, such person shall give in writing to the chief executive officer of such local authority notice of such death and the cause thereof by delivering or by despatching by registered post, within twelve hours after such death, to such chief executive officer such notice.
(2) If any person fails or neglects to comply with the provisions of this section, such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.
Inspection of maternity homes.
12.—(1) An authorised officer of a local authority shall be entitled at all reasonable times to enter any maternity home within the functional area of such local authority and inspect such maternity home.
(2) An inspector shall be entitled at all reasonable times to enter any maternity home and inspect such maternity home.
(3) If any person obstructs or impedes any authorised officer or any inspector in the exercise of the powers conferred on him by this section such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding five pounds.
Service of documents.
13.—Any document required by this Act to be served on a person may be served by delivering it to such person or by sending it by registered post to such person at the last known place of abode of such person.
Regulations.
14.—The Minister may from time to time by order make regulations in relation to any matter or thing referred to in this Act as prescribed.
Expenses of local authorities.
15.—All expenses incurred by a local authority under this Act shall be raised and defrayed in the like manner as expenses incurred by such local authority under the Midwives (Ireland) Act, 1918, are raised and defrayed.
Short title.
16.—This Act may be cited as the Registration of Maternity Homes Act, 1934.
