Orduithe toirmeascacha
2.—(1) Féadfaidh an Ard-Chomhairle, aon am agus o am go ham, le hordú (dá ngairmtear ordú toirmeascach san Acht so) a thoirmeasc siúicre ná dearnadh ná nár táirgeadh i Saorstát Éireann d'iomportáil isteach i Saorstát Éireann le linn tréimhse áirithe (a thosnóidh tar éis dáta an orduithe sin) ach amháin fé cheadúnas agus do réir cheadúnais ar n-a dheonadh chuige sin fén Acht so.
(2) Féadfaidh an Ard-Chomhairle, le hordú pé uair is ceart san dar leo, ordú toirmeascach do leasú no do cheiliúradh.
Eifeacht agus ré orduithe toirmeascacha.
3.—(1) Fé réir forálacha an chéad fho-ailt ina dhiaidh seo den alt so scuirfidh gach ordú toirmeascach d'éifeacht do bheith aige ar shé mhí do bheith caithte o dháta an orduithe sin mara n-aontuighidh Dáil Éireann leis tré rún a rithfear roimh an sé mhí sin do bheith caithte.
(2) Pé uair a thárlóidh, maidir le hordú toirmeascach—
(a) go gceiliúrfaidh an Ard-Chomhaírle é sara n-aontuighidh Dáil Éireann leis, no
(b) go mbeidh sé tar éis scur, de bhuadh an fho-ailt deiridh sin roimhe seo den alt so, d'éifeacht do bheith aige,
ní bheidh feidhm ná éifeacht ar bith ag aon ordú toirmeascach a déanfar laistigh de shé mhí tar éis an cheiliúrtha no an scurtha san (pe'ca aca é) mara n-aontuítear ná go dtí go n-aontófar leis tré rún ar n-a rith ag Dáil Éireann, agus, má haontuítear agus nuair a haontófar leis amhlaidh, ní bheidh éifeacht aige ach an lá a haontófar leis amhlaidh agus ón lá san amach no pé dáta agus o pé dáta is déanaí ná san (más aon dáta é) a bheidh luaidhte chuige sin san ordú san.
Toirmeasc ar iomportáil do dhéanamh contrárdha d'ordú toirmeascach.
4.—(1) Ní bheidh sé dleathach do dhuine ar bith aon tsiúicre d'iomportáil isteach i Saorstát Éireann contrárdha d'ordú toirmeascach.
(2) Tuigfear siúicre go mbeidh a iomportáil nea-dhleathach de bhuadh an ailt seo do bheith ar n-a hearraí a háirmhítear agus a tuairiscítear ar Chlár na dToirmeasc agus na Srian maidir le hEarraí do Theacht Isteach, atá in alt 42 den Customs Consolidation Act, 1876, agus na forálacha den Acht san (mar atá san leasuithe no leathnuithe le hAchtanna ina dhiaidh sin) a bhaineann le hearraí d'iomportáil a toirmeasctar no sriantar beidh feidhm acu dá réir sin.
A mbeidh in ordú toirmeascach.
5.—Féadfaidh an Ard-Chomhairle, in ordú toirmeascach agus leis, gach ní no éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) siúicre d'aon tsaghas áirithe do shaoradh ón toirmeasc a deintear leis an ordú san, pe'ca tré thagairt do cháilíocht, do chineál no d'airdhe eile d'airdheana an tsiúicre sin a tuairisceofar é no tré thagairt do sna crícheanna gur chúcha déanfar no don tslí no do sna cúrsaí ina ndéanfar an siúicre sin d'iomportáil, no tré thagairt d'éinní no d'aon rud eile;
(b) aon tsaoirse den tsórt a luaidhtear sa mhír deiridh sin roimhe seo den alt so do thabhairt go díreach no tré údarás don Aire no do sna Coimisinéirí Ioncuim;
(c) aon teora no coinníoll áirithe, maidir le caindíocht, am, cruthúnas, no eile, do chur ag gabháil le haon tsaoirse den tsórt san, agus go sonnrách coinníoll á cheangal an tAire no na Coimisinéirí Ioncuim do bheith sásta i dtaobh nithe áirithe sara dtéighidh an tsaoirse in éifeacht;
(d) comhacht no dlighinse do thabhairt don Aire no do sna Coimisinéirí Ioncuim chun a chinneadh no a chur mar dhualgas air no ortha a chinneadh an mbeidh caind íochtaí no saghsanna áirithe siúicre i dteideal sochair aon tsaoirse áirithe den tsórt san no ná beidh;
(e) a údarú don Aire no do sna Coimisinéirí Ioncuim coinniollacha (pe'ca roimh-choinníollacha no iar-choinníollacha iad) d'fhorchur a bheidh le cólíonadh ag daoine bheidh ag éileamh no ag fáil sochair aon tsaoirse den tsórt san.
Eifeacht orduithe thoirmeascaigh maidir le hordú quota.
6.—(1) San alt so—
cialluíonn an abairt“ an tAcht san ”an tAcht chun Iomportálanna do Rialú, 1934 (Uimh. 12 de 1934);
cialluíonn an abairt“ ordú quota ”ordú ar n-a dhéanamh ag an Ard-Chomhairle fén Acht san agus is ordú quota do réir bhrí an Achta san.
(2) Oibreoidh gach ordú toirmeascach agus beidh éifeacht aige chun ceiliúradh do dhéanamh, o thosach na tréimhse le n-a mbainfidh an toirmeasc ar iomportáil a déanfar leis an ordú toirmeascach san, ar gach ordú quota bheidh i bhfeidhm le linn tosach na tréimhse sin i dtaobh siúicre le n-a mbainfidh an toirmeasc san ar iomportáil, ach ní dhéanfaidh an ceiliúradh san—
(a) dochar ná deifir d'aon cheadúnas a bheidh tugtha amach fén Acht san roimh dháta an orduithe thoirmeascaigh sin, ná
(b) d'ainneoin éinní atá san Acht san, a chosc ar an Ard-Chomhairle ordú quota do dhéanamh tráth ar bith alos an tsiúicre sin chun teacht in éifeacht tar éis na tréimhse sin do bheith caithte.
An tAire do thabhairt deimhnithe amach.
7.—(1) Pé uair a déanfar ordú toirmeascach féadfaidh an tAire, más ceart agus pé uair is ceart dar leis déanamh amhlaidh agus ar n-a iarraidh sin air don Chuideachtain, ceadúnas do thabhairt amach don Chuideachtain chun iomportáil do dhéanamh, i rith na tréimhse le n-a mbaineann an toirmeasc ar iomportáil a deintear leis an ordú toirmeascach san, ar chaindíocht áirithe de shaghas áirithe siúicre le n-a mbaineann an toirmeasc san ar iomportáil.
(2) Féadfaidh an tAire pé coinníollacha do chur ag gabháil le haon cheadúnas a bhéarfar amach fén alt so is dóich leis is ceart agus a luadhfaidh sa cheadúnas san agus go sonnrách coinníollacha i dtaobh gach ní no éinní acu so leanas, sé sin le rá:—
(a) na tráthanna gur laistigh díobh a féadfar agus na háiteanna ina bhféadfar siúicre d'iomportáil fén gceadúnas san;
(b) ag teorannú an cheadúnais sin chun ná bainfidh ach le siúicre déanfar no táirgfear i dtír áirithe;
(c) ag teorannú an cheadúnais sin chun ná bainfidh ach le siúicre consighneofar o thír áirithe;
(d) an tslí ina ndéanfar agus na bealaigh tré n-a ndéanfar siúicre a hiomportálfar fén gceadúnas san do thabhairt go dtí Saorstát Éireann.
(3) Gach ceadúnas a bhéarfar amach fén alt so oibreoidh sé chun a údarú don Chuideachtain siúicre d'iomportáil isteach i Saorstát Éireann do réir téarmaí an cheadúnais sin, ach san fé réir na Cuideachtan do dhéanamh go cuibhe do réir na dlí bheidh i bhfeidhm de thurus na huaire maidir le siúicre d'iomportáil agus go sonnrách maidir le híoc diúitéthe custum (más aon diúité é) is inéilithe ar an iomportáil sin.
(4) Eileoidh an tAire agus íocfaidh an Chuideachta leis an Aire ar gach ceadúnas a bhéarfar amach fén alt so pé táillí a cheapfaidh an tAire o am go ham, le toiliú an Aire Airgid, agus féadfaidh an tAire táillí deifriúla do cheapadh alos ceadúnaisí bhainfidh le saghsanna deifriúla no caindíochtaí deifriúla siúicre.
Ceadúnaisí do cheiliúradh.
8.—(1) Féadfaidh an tAire, tráth ar bith, aon cheadúnas a bheidh tugtha amach aige fén Acht so do cheiliúradh.
(2) Pé uair a cheiliúrfaidh an tAire ceadúnas a bheidh tugtha amach aige fén Acht so déanfaidh an tAire—
(a) mara ndearnadh aon tsiúicre d'iomportáil fén gceadúnas san roimh é cheiliúradh, aisíoc do dhéanamh leis an gCuideachtain in iomlán na táille d'íoc an Chuideachta ar an gceadúnas san do thabhairt amach, agus
(b) má rinneadh cuid den tsiúicre le n-a mbaineann an ceadúnas san d'iomportáil fén gceadúnas san roimh é cheiliúradh, aisíoc do dhéanamh leis an gCuideachtain sa chuid sin den táille d'íoc an Chuideachta ar an gceadúnas san do thabhairt amach a bheidh, dar leis an Aire, cothromúil leis an méid siúicre le n-a mbaineann an ceadúnas san agus a bheidh coiscithe leis an gceiliúradh san a iomportáil fén gceadúnas san.

9.—Más deimhin leis an Aire, maidir le haon tsiúicre do hiomportáladh fé cheadúnas ar n-a thabhairt amach fén Acht so, go ndearnadh tar éis na hiomportála san lé d'easportáil as Saorstát Éireann no é d'úsáid chun aon earra eile bídh do dhéanamh i Saorstát Éireann a heasportáladh ina dhiaidh sin, féadfaidh an tAire, más oiriúnach leis é agus fé réir an easportálaí do chólíonadh pé coinníollacha is oiriúnach leis d'fhorchur, íoc do dhéanamh le heasportálaí an tsiúicre no na hearra san (do réir mar bheidh) sa chuid sin den táille, d'íoc an Chuideachta ar an gceadúnas san do thabhairt amach, a bheidh, dar leis an Aire, cothromúil leis an méid a heasportáladh no a húsáideadh amhlaidh den tsiúicre le n-a mbaineann an ceadúnas san.

10.—Má dheineann duine ar bith éinní (tré ghníomh no tré fhaillí) is sárú ar choinníoll—
(a) a forchuirfear le hordú toirmeascach, no
(b) a fhorchuirfidh an tAire no na Coimisinéirí Ioncuim fé údarás chuige sin ar n-a bhronnadh le hordú toirmeascach, no
(c) a bheidh ag gabháil le ceadúnas ar n-a dheonadh fén Acht so no le saoirse fé ordú toirmeascach,
beidh an duine sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga púnt do chur air.
Táillí do bhailiú agus do chur de láimh.
11.—(1) Na táillí uile is iníoctha fén Acht so baileofar agus glacfar iad i pé slí ordóidh an tAire Airgid o am go ham agus déanfar iad d'íoc isteach sa Stát-Chiste no do chur chun tairbhe don Stát-Chiste do réir ordú an Aire sin.
(2) Ní bheidh feidhm ag an Public Offices Fees Act, 1879, maidir le haon táillí is iníoctha fén Acht so.

12.—Sa mhéid go gceadóidh an tAire Airgid é, is amach as airgead a sholáthróidh an tOireachtas a híocfar gach costas fé n-a raghaidh an tAire chun an Achta so do chur i bhfeidhm.

SUGAR (CONTROL OF IMPORT) ACT, 1936.
Definitions.
1.—In this Act—
the expression “the Minister” means the Minister for Industry and Commerce;
the expression “the Company” means Cómhlucht Siúicre Eireann, Teoranta.
Prohibition orders.
2.—(1) The Executive Council may, at any time and from time to time, by order (in this Act referred to as a prohibition order) prohibit the importation into Saorstát Eireann during a specified period (beginning after the date of such order) of sugar, not manufactured or produced in Saorstát Eireann, save under and in accordance with a licence in that behalf granted under this Act.
(2) The Executive Council may, by order, whenever they so think proper, amend or revoke a prohibition order.
Effect and duration of prohibition orders.
3.—(1) Subject to the provisions of the next following sub-section of this section, every prohibition order shall cease to have effect at the expiration of six months from the date thereof unless it is approved of by Dáil Eireann by resolution passed before the expiration of the said six months.
(2) Whenever a prohibition order has either—
(a) been revoked by the Executive Council before it has been approved of by Dáil Eireann, or
(b) has ceased, by virtue of the foregoing sub-section of this section, to have effect,
any prohibition order made within six months after such revocation or cesser (as the case may be) shall have no operation or effect unless or until it has been approved of by resolution passed by Dáil Eireann, and shall, if and when so approved of have effect only as on and from the day on which it is so approved of or such later date (if any) as may be specified in that behalf in such order.
Prohibition of importation contrary to a prohibition order.
4.—(1) It shall not be lawful for any person to import into Saorstát Eireann any sugar in contravention of a prohibition order.
(2) Sugar the importation of which is unlawful by virtue of this section shall be deemed to be included among the goods enumerated and described in the Table of Prohibitions and Restrictions Inwards contained in section 42 of the Customs Consolidation Act, 1876, and the provisions of that Act (as amended or extended by subsequent Acts) relating to the importation of prohibited or restricted goods shall apply accordingly.
Contents of prohibition order.
5.—The Executive Council may, in and by a prohibition order, do all or any of the following things, that is to say:—
(a) exempt from the prohibition effected by such order sugar of any particular description, whether identified by reference to the quality, nature, or other characteristic of such sugar or by reference to the purposes for which or the manner or the circumstances in which such sugar is imported, or by reference to any other matter or thing;
(b) effect any such exemption as is mentioned in the next preceding paragraph of this section either directly or by way of an authorisation to the Minister or to the Revenue Commissioners;
(c) attach to any such exemption any specified limitation or condition, whether as to quantity, time, proof, or otherwise, and in particular a condition requiring the Minister or the Revenue Commissioners to be satisfied of specified matters before the exemption takes effect;
(d) give to the Minister or to the Revenue Commissioners power, duty, or jurisdiction to determine whether particular quantities or descriptions of sugar are or are not entitled to the benefit of any particular such exemption;
(e) authorise the Minister or the Revenue Commissioners to impose conditions (whether precedent or subsequent) to be complied with by persons claiming or receiving the benefit of any such exemption.
Effect of prohibition order on quota order.
6.—(1) In this section—
the expression “the said Act” means the Control of Imports Act, 1934 (No. 12 of 1934);
the expression “quota order” means an order made by the Executive Council under the said Act which is a quota order within the meaning of the said Act.
(2) Every prohibition order shall operate and have effect to revoke, as from the commencement of the period to which the prohibition of importation effected by such prohibition order applies, every quota order which is in force at the commencement of the said period and relates to sugar to which the said prohibition of importation applies, but such revocation shall not—
(a) prejudice or affect any licence issued under the said Act before the date of such prohibition order, or
(b) notwithstanding anything contained in the said Act, prevent the Executive Council from making at any time a quota order in respect of such sugar to take effect after the expiration of the said period.
Issue of licences by the Minister.
7.—(1) Whenever a prohibition order has been made, the Minister may, if and whenever he thinks proper so to do, on the application of the Company, issue to the Company a licence to import, during the period to which the prohibition of importation effected by such prohibition order applies, a specified quantity of a specified kind of sugar to which such prohibition of importation applies.
(2) The Minister may attach to any licence issued under this section such conditions as he shall think proper and shall specify in such licence and in particular conditions relating to all or any of the following matters, that is to say:—
(a) the times within which and the places at which sugar may be imported under such licence;
(b) limiting such licence to sugar manufactured or produced in a specified country;
(c) limiting such licence to sugar consigned from a particular country;
(d) the manner in which and the routes by which sugar imported under such licence shall be brought to Saorstát Eireann.
(3) Every licence issued under this section shall operate to authorise the Company to import into Saorstát Eireann sugar in accordance with the terms of such licence, but subject to due compliance by the Company with the law for the time being in force in relation to the importation of sugar and, in particular, to the payment of duties of customs (if any) chargeable on such importation.
(4) There shall be charged by the Minister and paid by the Company to the Minister on every licence issued under this section such fees as the Minister may from time to time with the consent of the Minister for Finance appoint, and different fees may be fixed by the Minister in respect of licences relating to different descriptions or quantities of sugar.
Revocation of licences.
8.—(1) The Minister may, at any time, revoke any licence issued by him under this Act.
(2) Whenever the Minister revokes a licence issued by him under this Act the Minister shall—
(a) if no sugar has been imported under such licence before the revocation thereof, repay to the Company the whole of the fee paid by the Company on the issue of such licence, and
(b) if part of the sugar to which such licence relates has been imported under such licence before the revocation thereof, repay to the Company such part of the fee paid by the Company on the issue of such licence as is, in the opinion of the Minister, proportionate to the amount of sugar to which such licence relates which is prevented by such revocation from being imported under such licence.
Repayment of licence fee on exported sugar.
9.—Where the Minister is satisfied that any sugar imported under a licence issued under this Act has, subsequent to such importation, either been exported from Saorstát Eireann or been used in the manufacture in Saorstát Eireann of any other article of food which is subsequently exported, the Minister may, if he so thinks fit and subject to compliance by the exporter with such conditions as he may think fit to impose, pay to the exporter of such sugar or article (as the case may be) such part of the fee paid by the Company on the issue of such licence as is, in the opinion of the Minister, proportionate to the amount of the sugar to which such licence relates which is so exported or used.
Penalty for contravention of conditions.
10.—If any person does any act (whether of commission or omission) which is a contravention of a condition—
(a) imposed by a prohibition order, or
(b) imposed by the Minister or the Revenue Commissioners under an authority in that behalf conferred by a prohibition order, or
(c) attached to a licence granted under this Act or to an exemption under a prohibition order,
such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds.
Collection and disposal of fees.
11.—(1) All fees payable under this Act shall be collected and taken in such manner as the Minister for Finance shall from time to time direct and shall be paid into or disposed of for the benefit of the Exchequer in accordance with the direction of the said Minister.
(2) The Public Offices Fees Act, 1879, shall not apply in respect of any fees payable under this Act.
Expenses.
12.—All expenses incurred by the Minister in the execution of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Short title.
13.—This Act may be cited as the Sugar (Control of Import) Act, 1936.
