Léiriú.
1.—San Acht seo—
ciallaíonn an abairt “an tAire” an tAire Rialtais Áitiúil;
folaíonn an abairt “déanmhas buan” bóithre, droichid, tithe, foirgintí, ballaí, agus cladhphoirt;
ciallaíonn an focal “bóthar” aon bhóthar, poiblí nó príobháideach, agus folaíonn sé aon droichead, píopa, áirse, líntéar, cosán, pábháil, fál, ráille nó balla is cuid den chéanna;
folaíonn an focal “uisce-chúrsa” aibhneacha, srutháin, agus uisce-chúrsaí aiceanta eile, agus fós canála, silteáin, agus uiscechúrsaí saorga eile.
An t-údarás áitiúil do dhéanamh oibreacha.
2.—(1) Baineann an t-alt seo leis na húdaráis áitiúla seo a leanas:
(a) bardas contae-bhuirge nó buirge eile,
(b) comhairle chontae nó cheantair uirbigh.
(2) Más é tuairim údaráis áitiúil lena mbaineann an t-alt seo—
(a) i dtaobh aon talún is leo, nó
(b) i dtaobh aon déanmhais bhuain a thógadar nó a ceangaltar orthu le dlí a chothabháil,
go ndearnadh nó gur dóigh go ndéanfar damáiste dó ó thuiliú, sleamhnú talún, ísliú talún, nó teagmhas eile dá samhail sin, féadfaidh an t-údarás áitiúil pé oibreacha a dhéanamh a mheasfaid a bheith réasúnach chun faoiseamh nó caomhna a thabhairt ón damáiste.
(3) Más é tuairim údaráis áitiúil lena mbaineann an t-alt seo—
(a) i dtaobh aon talún ina líomatáiste feidhme, nach talamh is leo, nó
(b) i dtaobh aon déanmhais bhuain ina líomatáiste feidhme, nach déanmhas buan a thógadar nó a ceangaltar orthu le dlí a chothabháil,
go ndearnadh nó gur dóigh go ndéanfar damáiste dó ó thuiliú, sleamhnú talún, ísliú talún nó teagmhas eile dá samhail sin agus gurb é leas an phobail é faoiseamh nó caomhna a thabhairt ón damáiste, féadfaidh an t-údarás áitiúil pé oibreacha a dhéanamh a mheasfaid a bheith réasúnach chun an faoiseamh nó an caomhna sin a thabhairt.
(4) Ar na hoibreacha dá dtagartar i bhfo-ailt (2) agus (3) den alt seo áirítear, go sonrach—
(a) silteáin a dhéanamh,
(b) substaintí nó nithe a dhéanas bacainn in uisce-chúrsaí a thógáil astu,
(c) uisce-chúrsaí a leathnú nó a dhoimhniú,
(d) ballaí nó cladhphoirt a dhéanamh nó a dheisiú,
(e) uisce a shraonadh isteach in uisce-chúrsaí.
(5) Nuair a tógfar aon tsubstaint nó ní as uisce-chúrsa faoin alt seo, féadfar é a leagadh ar thalamh le hais an uisce-chúrsa nó féadfaidh an t-údarás áitiúil é a thabhairt chun bealaigh, é d'úsáid nó é a dhiúscairt ar shlí eile mar is oiriúnach leo.
An t-údarás áitiúil a bheith neamhchumasach nó neamhthoilteanach ar oibreacha a dhéanamh, etc.
3.—(1) Más deimhin leis an Aire—
(a) gur cóir d'údarás áitiúil oibreacha áirithe a dhéanamh de bhun an Achta seo, agus
(b) go bhfuil an t-údarás áitiúil neamhchumasach nó neamhthoilteanach ar na hoibreacha sin a dhéanamh, agus
(c) go bhfuil sé riachtanach na hoibreacha sin a dhéanamh ar mhaithe le héifeachtúlacht oibreacha eile a bhfuil aon údarás áitiúil nó údaráis áitiúla eile cumasach agus toilteanach ar iad a dhéanamh de bhun an Acht seo,
féadfaidh an tAire, tar éis dul i gcomhairle leis an údarás áitiúil céad-luaite, a údarú le hordú don údarás áitiúil eile nó do cheann de na húdaráis áitiúla eile (mar is iomchuí) na hoibreacha céadluaite a dhéanamh thar ceann an údaráis áitiúil chéad-luaite, agus air sin féadfaidh an t-údarás áitiúil a bheas údaraithe amhlaidh na hoibreacha sin a dhéanamh amhlaidh.
(2) Más rud é—
(a) gur dóigh le húdarás áitiúil gur cóir dóibh oibreacha áirithe a dhéanamh de bhun an Achta seo, ach gur caothúla údarás áitiúil eile do dhéanamh na n-oibreacha sin, agus
(b) go bhfuil an t-údarás áitiúil eile cumasach agus toilteanach ar na hoibreacha sin a dhéanamh,
féadfaidh an t-údarás áitiúil céad-luaite agus an t-údarás áitiúil eile comhaontú a dhéanamh chun an t-údarás áitiúil eile do dhéanamh na n-oibreacha sin thar ceann an údaráis áitiúil chéad-luaite, agus air sin, ach tar éis an comhaontú a chur in iúl don Aire, féadfaidh an t-údarás áitiúil eile na hoibreacha sin a dhéanamh amhlaidh.
Cumhacht chun dul isteach ar thalamh.
4.—(1) Féadfaidh údarás áitiúil a bheas ag déanamh oibreacha de bhun an Achta seo nó de bhun orduithe nó comhaontuithe arna dhéanamh faoi, nó féadfaidh aon oifigeach, seirbhíseach nó gníomhaire don údarás sin, faoi réir forál an ailt seo, dul isteach ar aon talamh chun na hoibreacha a dhéanamh.
(2) Sar a raghaid isteach ar thalamh faoin alt seo chun críche seachas chun oibreacha práinne a dhéanamh, déanfaidh údarás áitiúil a bheas ag déanamh oibreacha de bhun an Achta seo, nó de bhun orduithe nó comhaontuithe arna dhéanamh faoi, toiliú an áititheora (i gcás talún áitithe), nó an únaera (i gcás talún neamh-áitithe), d'fháil, nó fógra cheithre lá dhéag ar a laghad a thabhairt i scríbhinn go bhfuil ar intinn acu dul isteach ar an talamh amhlaidh.
(3) Féadfar an fógra dá dtagatar i bhfo-alt (2) den alt seo a thabhairt do dhuine in aon tslí acu seo a leanas:—
(a) trína sheachadadh don duine sin,
(b) trína fhágaint ag an seoladh mar a mbíonn gnáthchónaí ar an duine sin,
(c) trína sheoladh leis an bpost i litir chláraithe réamhíoctha chun an duine sin faoi sheoladh na háite a mbíonn gnáth-chónaí air, nó
(d) trína phostáil ag an talamh nó in aice na talún a bheas i gceist.
(4) Aon duine dar tugadh faoin alt seo fógra go bhfuiltear ar intinn dul isteach ar thalamh, féadfaidh sé, cheithre lá dhéag ar a dhéanaí i ndiaidh an fógra sin a thabhairt, iarratas a dhéanamh chun an bhreithimh den Chúirt Dúiche ag a bhfuil dlínse sa dúthaigh ina bhfuil, an talamh sin, ach é dá fhógairt sin don údarás áitiúil ar tugadh an fógra sin uathu nó thar a gceann, ag iarraidh orduithe chun an dul isteach sin ar an talamh sin a thoirmeasc, agus, ar an iarratas sin d'éisteacht, féadfaidh an breitheamh sin, más cuí leis, an dul isteach sin ar an talamh sin a thoirmeasc go hiomlán nó coinníollacha a shonrú a bheas le comhlíonadh ag an duine a dhéanfas an dul isteach sin.
(5) Má dhéanann breitheamh den Chúirt Dúiche dul isteach a beartófar a dhéanamh ar thalamh a thoirmeasc faoin bhfo-alt deiridh roimhe seo den alt seo ní dleathach d'aon duine dul isteach ar an talamh sin faoin alt seo, agus má dhéanann breitheamh den Chúirt Dúiche coinníollacha a shonrú faoin bhfo-alt deiridh roimhe seo den alt seo a bheas le comhlíonadh ag daoine a bheas ag dul isteach ar thalamh faoin alt seo, chomlíonfaidh gach duine a raghas isteach amhlaidh ar an talamh sin na coinníollacha a sonrófar amhlaidh.
(6) San alt seo ciallaíonn an abairt “oibreacha práinne” oibreacha ar dóigh leis an údarás áitiúil a bheas ag déanamh na n-oibreacha go bhfuil sé riachtanach iad a dhéanamh láithreach chun nach mbainfeadh díobháil mhór d'aon duine, d'aon talamh nó d'aon déanmhas buan.
(7) Duine ar bith a dhéanfas bacainn nó cur isteach ar fheidhmiú na cumhachta a bheirtear le fo-alt (1) den alt seo, beidh sé ciontach i gcion faoin alt seo, agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná deich bpunt a chur air.
Cúiteamh.
5.—(1) Aon duine dá mbainfidh damáiste mar gheall ar aon chur isteach, a thiocfas d'oibreacha a dhéanamh de bhun an Achta seo nó de bhun orduithe nó comhaontuithe arna dhéanamh faoi, ar aon talamh atá ar únaeracht nó á áitiú aige nó ar aon éasúint, profit-a-prendre, nó aon cheart eile atá aige, beidh sé, faoi réir forál an Achta seo, i dteideal cúiteamh d'íoc leis i leith an damáiste sin ón údarás áitiúil a rinne na hoibreacha nó má rinne an t-údarás áitiúil na hoibreacha thar ceann údaráis áitiúil eile de bhun comhaontuithe arna dhéanamh faoin Acht seo, ón údarás áitiúil eile sin.
(2) Ní foláir gach éileamh ar chúiteamh faoin alt seo a dhéanamh i scríbhinn chun an údaráis áitiúil a bheas i gceist roimh dheireadh na tréimhse a thosnós ar dháta tosnuithe na n-oibreacha dá dtáinig an cur isteach lena mbaineann an t-éileamh agus a chríochnós dhá bhliain ina dhiaidh sin nó bliain amháin tar éis na hoibreacha sin a chríochnú (pé acu sin is déanaí).
(3) D'éagmais comhaontuithe ar mhéid aon chúitimh is iníoctha ag údarás áitiúil faoin alt seo, cinnfidh an Chúirt Dúiche a mhéid mura mó ná fiche punt an tsuim a héileofar, nó, in aon chás eile, cinnfear é trí eadráin faoin Acquisition of Land (Assessment of Compensation) Act, 1919 (arna leasú le hachtacháin ina dhiaidh sin) amhail is dá mba é a bhí sa chúiteamh an praghas ar thalamh a tógadh go héigeantach, agus beidh dlínse ag an gcúirt nó ag an eadránaí, pé acu é, chun a chinneadh an bhfuil aon chúiteamh iníoctha i gcúrsaí an cháis.
(4) Nuair a beifear ag cinneadh cúitimh faoin alt seo bhéarfar aird ar aon chosaint nó tairbhe a bheas ag sroicheadh don éilitheoir de chionn na hoibreacha a dhéanamh a mbaineann an t-éileamh leo.
(5) Nuair a bheas breitheamh den Chúirt Dúiche ag déanamh orduithe faoin alt seo, féadfaidh sé, faoina rogha, a ordú na costais, go dtí trí ghiní ar a mhéid, faoina raghaidh aon pháirtí sna himeachta maidir leis na himeachta (maille le pé caiteachais finnéithe is réasúnach leis an mbreitheamh) a bheith le n-íoc ag aon pháirtí eile sna himeachta.
(6) Más rud é, i gcás iarratais chun na Cúirte Dúiche chun an cúiteamh a chinneadh a bheas le n-íoc ag údarás áitiúil faoin alt seo, nach mó an cúiteamh a chinnfeas an Chúirt ná an cúiteamh a thairg an t-údarás áitiúil go neamhchoinníollach sar a ndearnadh an t-iarratas, féadfaidh an Chúirt a ordú na costais sin agus na caiteachais finnéithe sin, de chuid an údaráis áitiúil, is réasúnach leis an gCúirt, a bhaint den chúiteamh a chinnfeas an Chúirt.
(7) An dlínse a bheirtear leis an alt seo don Chúirt Dúiche, feidhmeofar í ag an mbreitheamh ar laistigh dá dhúthaigh a rinneadh na hoibreacha nó aon chuid díobh, nó ag an mbreitheamh ar laistigh dá dhúthaigh a tharla an cur isteach nó aon chuid den chur isteach, pé acu sin is rogha leis an eilitheoir.
Caomhaint Iascaigh.
6.—(1) Ní bheidh d'oblagáid ar údarás áitiúil nuair a bheid ag déanamh oibreacha de bhun an Achta seo, nó de bhun orduithe nó comhaontuithe arna dhéanamh faoi, na hAchta Iascaigh, 1842 go 1944, a chomhlíonadh.
(2) D'ainneoin na díolúine a bheirtear le fo-alt (1) den alt seo, nuair a bheas údarás áitiúil ag déanamh oibreacha de bhun an Achta seo, nó de bhun orduithe nó comhaontuithe arna dhéanamh faoi, glacfaid pé forchúraim agus déanfaid pé socruithe chun iascach a chaomhaint a chomhairleos an tAire Talmhaíochta dóibh go ginearálta nó i gcásanna áirithe.

LOCAL AUTHORITIES (WORKS) ACT, 1949.
Interpretation.
1.—In this Act—
the expression “the Minister” means the Minister for Local Government;
the expression “permanent construction” includes roads, bridges, houses, buildings, walls and embankments;
the word “road” means any road whether public or private and includes any bridge, pipe, arch, gully, footway, pavement, fence, railing or wall forming part thereof;
the word “watercourse” includes rivers, streams and other natural watercourses, and also canals, drains, and other artificial watercourses.
Execution of works by local authority.
2.—(1) This section applies to the following local authorities:
(a) the corporation of a county or other borough,
(b) the council of a county or an urban district.
(2) Where a local authority to whom this section applies are of opinion that—
(a) any land owned by them, or
(b) any permanent construction which was constructed by them or which they are required by law to maintain,
has sustained or is likely to sustain damage from flooding, landslide, subsidence or other similar occurrence, the local authority may execute such works as they consider reasonable for the purpose of affording relief or protection from the damage.
(3) Where a local authority to whom this section applies are of opinion that—
(a) any land in their functional area, not being land owned by them, or
(b) any permanent construction in their functional area not being a permanent construction which was constructed by them or which they are required by law to maintain,
has sustained or is likely to sustain damage from flooding, landslide, subsidence or other similar occurrence and that it is in the public interest to afford relief or protection from the damage, the local authority may execute such works as they consider reasonable for the purpose of affording such relief or protection.
(4) The works referred to in subsections (2) and (3) of this section shall include, in particular—
(a) the making of drains,
(b) the removal of substances or things causing obstructions in watercourses,
(c) the widening or deepening of watercourses,
(d) the making or repairing of walls or embankments,
(e) the diversion of water into watercourses.
(5) Where any substance or thing is removed under this section from a watercourse, it may be deposited on land adjacent to the watercourse or the local authority may remove it, use it or dispose of it otherwise as they think fit.
Local Authority unable or unwilling to execute works, etc.
3.—(1) Where the Minister is satisfied—
(a) that particular works should be executed pursuant to this Act by a local authority, and
(b) that the local authority are unable or unwilling to execute such works, and
(c) that the execution of such works is essential for the efficiency of other works which any other local authority or local authorities are able and willing to execute pursuant to this Act,
the Minister may, after consultation with the first-mentioned local authority, by order authorise the other local authority or one of the other local authorities (as may be appropriate) to execute the first-mentioned works on behalf of the first-mentioned local authority and thereupon the local authority so authorised may so execute those works.
(2) Where—
(a) a local authority are of opinion that particular works should be executed by them pursuant to this Act, but that it is more convenient that such works should be executed by another local authority, and
(b) the other local authority are able and willing to execute such works,
the first-mentioned local authority and the other local authority may enter into an agreement for the execution of such works by the other local authority on behalf of the first-mentioned local authority and thereupon, but after notification of the agreement to the Minister, the other local authority may so execute such works.
Power of entry on land.
4.—(1) A local authority executing works pursuant to this Act or an order or agreement made thereunder, or any officer, servant or agent of such authority, may, subject to the provisions of this section, enter on any land for the purposes of the execution of the works.
(2) Before entering on land under this section for a purpose other than the execution of urgent works, a local authority executing works pursuant to this Act or an order or agreement made thereunder, shall either obtain the consent (in the case of occupied land) of the occupier, or (in the case of unoccupied land) of the owner or shall give not less than fourteen days' notice in writing of the intention, to make such entry.
(3) The notice referred to in subsection (2) of this section may be given to a person in any of the following ways:—
(a) by delivering it to such person,
(b) by leaving it at the address where such person ordinarily resides,
(c) by sending it by post in a prepaid registered letter addressed to such person at the address where he ordinarily resides, or
(d) by posting it at or near the land concerned.
(4) Any person to whom a notice of intention to enter on land has been given under this section may, not later than fourteen days after the giving of such notice, apply to the justice of the District Court having jurisdiction in the district in which such land is situate, on notice to the local authority by whom or on whose behalf such notice was given, for an order prohibiting the said entry on such land, and, upon the hearing of such application, such justice may, if he so thinks proper, either wholly prohibit such entry on such land or specify conditions to be observed by the person making such entry.
(5) Where a justice of the District Court prohibits under the next preceding subsection of this section a proposed entry on land, it shall not be lawful for any person to enter on such land under this section, and where a justice of the District Court specifies under the said next preceding subsection of this section conditions to be observed by persons entering on land under this section, every person who so enters on such land shall observe the conditions so specified.
(6) In this section the expression “urgent works” means works the immediate execution of which is, in the opinion of the local authority executing the works, necessary to prevent serious injury to any person, land or permanent construction.
(7) A person who obstructs or interferes with the exercise of the power conferred by subsection (1) of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.
Compensation.
5.—(1) Any person who suffers damage by reason of any interference, caused by the execution of works pursuant to this Act or an order or agreement made thereunder, with any land owned or occupied by him or any easement, profit-a-prendre or other right belonging to him shall, subject to the provisions of this Act, be entitled to be paid compensation in respect of such damage by the local authority who executed the works or, if that local authority executed the works on behalf of another local authority pursuant to an agreement made under this Act, by such other local authority.
(2) Every claim for compensation made under this section shall be made in writing to the local authority concerned before the expiration of the period beginning on the commencement of the works which caused the interference to which the claim relates and ending either two years thereafter or one year after the completion of such works (whichever is the later).
(3) In default of agreement, the amount of any compensation payable by a local authority under this section shall, if the amount claimed in respect thereof does not exceed twenty pounds, be determined by the District Court or, in any other case, be determined by arbitration under the Acquisition of Land (Assessment of Compensation) Act, 1919 (as amended by subsequent enactments) as if the compensation were the price of land compulsorily acquired and the court or the arbitrator, as the case may be, shall have jurisdiction to determine whether compensation is, in the circumstances, payable at all.
(4) In determining compensation under this section, regard shall be had to any protection or benefit enuring to the claimant by reason of the execution of the works to which the claim relates.
(5) A justice of the District Court when making an order under this section may at his discretion order the costs, to an amount not exceeding three guineas, incurred in relation to the proceedings by any party thereto (together with such witnesses' expenses as the justice considers reasonable) to be paid by any other party thereto.
(6) Where, in the case of an application to the District Court to determine the compensation to be paid under this section by a local authority, the compensation determined by the Court does not exceed that offered unconditionally by the local authority before the application was made, the Court may order that such costs and witnesses' expenses of the local authority as the Court considers reasonable shall be deducted from the compensation determined by the Court.
(7) The jurisdiction conferred by this section on the District Court shall be exercised, at the election of the claimant, by the justice within whose district the works or any part thereof were executed or by the justice within whose district the interference or any part thereof occurred.
Protection of Fisheries.
6.—(1) It shall not be obligatory on a local authority when executing works pursuant to this Act or an order or agreement made thereunder, to comply with the Fisheries Acts, 1842 to 1944.
(2) Notwithstanding the exemption conferred by subsection (1) of this section, a local authority shall, when executing works pursuant to this Act or an order or agreement made thereunder, take such precautions and make such provisions for the protection of fisheries as the Minister for Agriculture either generally or in particular cases may advise.
Short title.
7.—This Act may be cited as the Local Authorities (Works) Act, 1949.
