1.—(1) Féadfar an tAcht Carthanas, 1961, a ghairm den Acht seo.
(2) Tiocfaidh an tAcht seo i ngníomh an 1ú lá d'Iúil, 1961.
Léiriú.
2.—San Acht seo—
ciallaíonn “an Bord” Coimisinéirí na dTabhartas agus na dTiomnachtaí Carthanúla d'Éirinn;
ciallaíonn “bronntanas carthanúil” bronntanas chun críocha carthanúla;
folaíonn “ciste” aon leas, láithreach nó todhchaí, in aon stoc, scaireanna nó blianachtaí nó in aon urrúis nó ábhair i gcaingean eile, agus folaíonn sé airgead freisin;
ciallaíonn “bronntanas” tabhartas, réadtiomnú nó tiomnacht;
ciallaíonn “an Rúnaí” Rúnaí an Bhoird;
forléireofar tagairtí d'iontaobhaí carthanais mar thagairtí a fholaíonn tagairtí do dhuine agus é ag gníomhú ag riaradh nó ag bainistí carthanais;
folaíonn “uacht” codaisíl.
Costais
3.—A mhéid a cheadóidh an tAire Airgeadais é, is amach as airgead a sholáthróidh an tOireachtas a íocfar na costais uile faoina rachaidh an Bord ag riaradh an Achta seo agus nach bhfuil socrú eile déanta lena n-aghaidh.
Aisghairm.
4.—(1) Déantar leis seo na hachtacháin a luaitear sa Sceideal a aisghairm a mhéid a shonraítear sa tríú colún.
(2) Gach scéim, ordú nó ní a rinne agus gach fógra, cinneadh, tuairim nó comhairle a thug an Bord faoi achtachán aisghairthe, leanfaidh sé de bheith bailí, d'ainneoin na haisghairme sin, ionann agus dá mba faoin Acht seo a rinneadh nó a tugadh é.
(3) Tá fo-alt (2) gan dochar d'alt 21 den Acht Léiriúcháin, 1937.

Caibidil I
An Bord
An Bord do leanúint de bheith ann.
5.—D'ainneoin na haisghairme a dhéantar leis an Acht seo, leanfaidh Coimisinéirí na dTabhartas agus na dTiomnachtaí Carthanúla d'Éirinn (dá ngairtear an Bord san Acht seo) de bheith ann mar chomhlacht corpraithe le comharbas suthain agus gnáthshéala agus féadfaidh siad agairt a dhéanamh, agus beidh siad inagartha, faoina n-ainm corpraithe.
Cumhacht chun talamh a theachtadh.
6.—Beidh cumhacht ag an mBord agus measfar go rabih cumhacht riamh acu faoina n-ainm corpraithe talamh a fháil, a theachtadh agus a dhiúscairt.
Comhdhéanamh an Bhoird.
7.—Aon chomhalta dhéag ar a mhéid a bheidh ar an mBord.
Comhaltas.
8.—(1) Ceapfaidh an Rialtas daoine chun bheith ina gcomhaltaí den Bhord ó am go ham de réir mar is gá.
(2) Sealbhóidh gach comhalta den Bhord oifig go dtí go n-éagfaidh sé, go n-éireoidh sé as oifig nó go gcuirfear as oifig é.
(3) Féadfaidh an Rialtas aon chomhalta den Bhord a chur as oifig.
(4) Déanfar ceapadh comhalta den Bhord nó a chur as oifig a fhoilsiú san Iris Oifigiúil.
(5) A luaithe is féidir tar éis tosach feidhme an Achta seo, agus de réir mar is gá ina dhiaidh sin, ceapfaidh an Bord comhalta den Bhord chun bheith ina Chathaoirleach ar an mBord agus sealbhóidh an Cathaoirleach oifig go ceann cibé tréimhse a chinnfidh an Bord nuair a bheidh siad á cheapadh.
(6) Na daoine is comhaltaí den Bhord díreach roimh thosach feidhme an Achta seo leanfaidh siad in oifig ionann agus dá mba faoin alt seo a ceapadh iad.
Nós imeachta.
9.—(1) Ag cruinniú den Bhord, má bhíonn Cathaoirleach an Bhoird as láthair, is é an comhalta is sinsearaí san ord ceaptha nó cibé comhalta eile a roghnóidh an Bord a bheidh ina chathaoirleach.
(2) Is de réir dáta a chéadcheaptha a bheidh céimíocht ag comhalta a leanfaidh in oifig ar thosach feidhme an Achta seo.
(3) Déanfar gach ceist ag cruinniú den Bhord a chinneadh le tromlach vótaí na gcomhaltaí a bheidh i láthair agus a vótálfaidh ar an gceist agus, i gcás comhionannas vótaí, beidh an dara vóta nó vóta cinniúna ag cathaoirleach an chruinnithe.
(4) Ag cruinniú den Bhord is córam triúr comhalta, má bhítear tar éis fógra cuí i dtaobh an chruinnithe sin a thabhairt do na comhaltaí uile.
Oifigigh agus seirbhísigh.
10.—(1) Déanfaidh an tAire Dlí agus Cirt, le toiliú an Aire Airgeadais, ó am go ham de réir mar is gá rúnaí don Bhord a cheapadh agus féadfaidh sé, leis an toiliú céanna, aon oifigigh eile agus aon seirbhísigh is gá chun críocha an Achta seo a cheapadh.
(2) Sealbhóidh an Rúnaí agus oifigigh eile agus seirbhísigh an Bhoird oifig ar cibé téarmaí agus gheobhaidh siad cibé luach saothair a chinnfidh an tAire Airgeddais.
(3) An Rúnaí agus na hoifigigh eile agus na seirbhísigh don Bhord a bheidh i seilbh oifige díreach roimh thosach feidhme an Achta seo leanfaidh siad in oifig ionann agus dá mba faoin Acht seo a ceapadh iad.
Séala.
11.—(1) Ní ghreamófar séala an Bhoird ach le hordú ón mBord agus fianófar a ghreamú le síniú bheirt chomhalta den Bhord nó chomhalta amháin den Bhord agus an Rúnaí.
(2) Tabharfar aird bhreithiúnach ar shéala an Bhoird agus déanfar gach doiciméad a airbheartóidh a bheith séalaithe le séala an Bhoird agus a bheith fianaithe de réir an ailt seo a ghlacadh i bhfianaise gan a thuilleadh cruthúnais mura gcruthófar a mhalairt.
Miontuairiscí na n-imeachtaí.
12.—(1) Déanfaidh an Rúnaí nó oifigeach éigin eile don Bhord miontuairiscí d'imeachtaí an Bhoird ag gach cruinniú agus coimeádfaidh sé leabhar (dá ngairtear Leabhar na Miontuairiscí san alt seo) ina dtaifeadfaidh sé—
(a) cóip dhílis de na miontuairiscí sin, agus
(b) ainmneacha na gcomhaltaí a bhí i láthair ag an gcruinniú sin.
(2) Léifear miontuairiscí na n-imeachtaí ag cruinniú den Bhord, mar a bheidh siad taifeadta i Leabhar na Miontuairiscí, ag an gcéad chruinniú eile don Bhord agus, má ghlactar go bhfuil siad cruinn, déanfaidh cathaoirleach an chruinnithe ag a léifear amhlaidh iad iad a shíniú.
Ní bheidh Breitheamh is comhalta den Bhord dícháilithe chun cásanna carthanais a éisteacht.
13.—Ní bheidh Breitheamh d'aon Chúirt coiscthe ná éagumasach de dhroim amháin é a bheith ina chomhalta den Bhord chun aon chás a bhainfidh le carthanas nó aon chás a éireoidh faoin Acht seo a éisteacht agus a chinneadh, ach féadfaidh sé é a éisteacht agus a chinneadh ionann agus nár chomhalta den Bhord é.
Na cuntais a iniúchadh.
14.—(1) San alt seo—
ciallaíonn “an tAire” an tAire Rialtais Áitiúil;
ciallaíonn “an t-iniúchóir”, maidir le haon iniúchadh faoin alt seo, an t-iniúchóir a cheapfaidh an tAire chun an t-iniúchadh sin a dhéanamh;
ciallaíonn “na cuntais” cuntais an Bhoird.
(2) Déanfar suas na cuntais go dtí an 31ú lá de Nollaig gach bliain i cibé foirm a cheadóidh an tAire ó am go ham.
(3) Déanfaidh an t-iniúchóir sin don Aire a cheapfaidh an tAire ó am go ham na cuntais a iniúchadh uair amháin gach bliain.
(4) Beidh feidhm ag na forálacha seo a leanas maidir le hiniúchadh faoin alt seo—
(a) chun críocha an iniúchta, tabharfaidh an Bord don Aire, roimh dheireadh mí Mheithimh gach bliain, achomaireacht ar chuntais an Bhoird i cibé foirm a cheadóidh an tAire ó am go ham;
(b) tabharfaidh an t-iniúchóir fógra sé lá don Rúnaí sula ndéanfar an t-iniúchadh in oifig an Bhoird;
(c) féadfaidh an t-iniúchóir, trí fhógra chuige sin i scríbhinn a thabhairt do dhuine ar bith, a cheangal ar an duine sin teacht i láthair in oifig an Bhoird cibé am a luafar san fhógra chun fianaise faoi mhionn a thabhairt maidir le haon ábhar a bheidh i gceist san iniúchadh, agus aon leabhair, gníomhais, cuntais, deimhnithe nó doiciméid eile a bheidh ina sheilbh, ina choimeád nó faoina urláimh agus a bhainfidh le haon ábhar den sórt sin a thabhairt ar aird, agus—
(i) aon duine dá mbeidh fógra tugtha faoin mír seo agus a dhiúltóidh nó a mhainneoidh go toiliúil teacht i láthair de réir an fhógra nó a dhéanfaidh go toiliúil aon doiciméad lena mbainfidh an fógra a athrú, a shochtadh, a cheilt nó a dhíothú nó a thiocfaidh i láthair amhlaidh agus a dhiúltóidh fianaise a thabhairt nó a dhiúltóidh nó a mhainneoidh go toiliúil aon doiciméad lena mbainfidh an fógra a thabhairt ar aird, beidh sé ciontach i gcion agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná fiche punt a chur air, agus
(ii) aon duine a dhéanfaidh go toiliúil agus é ag tabhairt fianaise den sórt sin faoi mhionn ráiteas is eol dó a bheith bréagach nó míthreorach in aon phonc ábhartha beidh sé ciontach i gcion agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná cúig phunt is fiche a chur air nó, de rogha na Cúirte, príosúnacht ar feadh aon téarma nach faide ná sé mhí nó an fhíneáil sin agus an phríosúnacht sin le chéile;
(d) ar an iniúchadh a bheith críochnaithe, deimhneoidh an t-iniúchóir an achomaireacht sin;
(e) déanfaidh an t-iniúchóir, laistigh de cheithre lá dhéag tar éis an achomaireacht sin a dheimhniú, í a chur chun an Aire maraon le tuarascáil i dtaobh na gcuntas;
(f) déanfaidh an tAire cóip de thuarascáil an iniúchóra agus an achomaireacht sin a chur chun an Rúnaí agus cuirfidh sé cóip den tuarascáil sin chun an Aire Dlí agus Cirt.
Tuarascáil.
15.—(1) Déanfaidh an Bord, uair amháin ar a laghad gach bliain agus fairis sin aon uair a éileoidh an Rialtas é, tuarascáil ar a n-imeachtaí faoin Acht seo a thabhairt don Rialtas.
(2) Déanfar cóip de gach tuarascáil a thabharfar faoin alt seo a leagan faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis í a thabhairt.

16.—Ní íocfaidh an Bord aon suim le haturnae a bheidh ar fostú acu i modh agus i leith costais nó caiteachais a bheidh le glanadh as airgead arna sholáthar ag an Oireachtas, mura mbeidh an tsuim ceadaithe ag an Aire Airgeadais agus, sula gceadóidh an tAire Airgeadais an tsuim sin, ní foláir sonraí na gcostas agus na gcaiteachas a bheith faoina bhráid.
Slánaíocht don Bhord agus do dhaoine a bheidh ag gníomhú faoi threorú uathu.
17.—Aon ní nó rud a dhéanfaidh an Bord nó aon duine ag gníomhú faoi threorú ón mBórd ní chuirfidh sé, más bona fide i gcomhalladh an Achta seo a dhéanfar é, aon chomhalta den Bhord ná aon duine a bheidh ag gníomhú faoina dtreorú faoi dhliteanas aon imeachtaí a thionscnamh ina choinne go pearsanta.
Fógraí a sheirbheáil ar an mBord.
18.—Féadfar fógra a sheirbheáil ar an mBord—
(a) trí chóip de a fhágáil ag an Rúnaí in oifig an Bhoird, nó
(b) trí chóip de a chur leis an bpost cláraithe i gclúdach faoi sheoladh an Bhoird san oifig sin.
Costais an Bhoird a bheith le híoc ag carthanas.
19.—Aon chostais nó caiteachais faoina rachaidh an Bord ag bainistí nó ag riaradh aon mhaoine a bheidh dílsithe don Bhord nó chun aon mhaoin den sórt sin a shlánchoimeád nó a aisghabháil nó ar aon slí eile i gcomhalladh an Achta seo, féadfaidh an Bord é a íoc agus é a asbhaint as eastát agus cistí an charthanais ar ina leith a chuathas faoi na costais agus na caiteachais sin.
Caibidil II
Dlinse agus cumhachtaí an Bhoird
Cumhacht chun díolúine a thabhairt ón oibleagáid chun fógráin a fhoilsiú i dtaobh réadtiomnuithe agus tiomnachtaí carthanúla.
20.—Féadfaidh an Bord, as a gcomhairle féin, ag féachaint do mhéid aon réadtiomnaithe charthanúil nó aon tiomnachta carthanúla nó d'aon imthosca speisialta eile, aon duine a dhíolmhú, go hiomlán nó sa mhéid agus ar na téarmaí is oiriúnach leo, ón oibleagáid a chuirtear air le halt 52.
Cumhacht chun comhairle a thabhairt d'iontaobhaithe carthanais maidir le hiontaobhais a riaradh.
21.—(1) I gcás ina n-iarrfaidh iontaobhaithe carthanais a dtuairim nó a gcomhairle ar an mBord maidir leis an gcarthanas nó lena riaradh nó lena mhaoin nó le cur na maoine chun feidhme nó maidir le haon cheist nó díospóid a bhainfidh leis an gcarthanas nó i gcás ina n-iarrfaidh seiceadóirí uachta ina mbeidh réadtiomnú carthanúil nó tiomnacht charthanúil a dtuairim nó a gcomhairle ar an mBord maidir leis an réadtiomnú nó an tiomnacht nó lena riaradh nó lena chur chun feidhme nó le haon cheist nó díospóid a bhainfidh leis, breithneoidh an Bord an t-iarratas agus, más oiriúnach leo, féadfaidh siad cibé tuairim nó comhairle a thabhairt a mheasfaidh siad a bheith fóirsteanach.
(2) Is faoi shéala an Bhoird a thabharfar tuairim nó comhairle an Bhoird.
(3) I gcás ina dtabharfaidh an Bord a dtuairim nó a gcomhairle maidir le haon ábhar, ansin, aon iontaobhaí nó seiceadóir nó aon duine eile a ghníomhóidh de réir na tuairime nó na comhairle i rith aon tréimhse (nach tréimhse tar éis cúirt dlínse inniúla do dhéanamh ordú maidir leis an ábhar) measfar, maidir le hé do ghníomhú amhlaidh i rith na tréimhse sin, agus chomh fada agus a bhainfidh lena fhreagracht féin, é a bheith tar éis gníomhú de réir a iontaobhais.
(4) Ní bheidh ag aon ordú a dhéanfaidh Cúirt na dhiaidh sin aon éifeacht chúlghabhálach a chuirfeadh isteach nó a laghdódh ar an tslánaíocht a thugann an t-alt seo d'iontaobhaí, do sheiceadóir nó do dhuine eile a ghníomhaigh de réir na tuairime nó na comhairle sin.
(5) Ní shlánóidh an t-alt seo iontaobhaí ná duine eile i leith aon ghníomh a dhéanfaidh sé de réir tuairim nó comhairle an Bhoird, má bhí sé ciontach i gcalaois, i gceilt thoiliúil nó i mífhaisnéis chun an tuairim nó an chomhairle a fháil.
Comhréiteach éilithe ó charthanas nó i gcoinne carthanais.
22.—(1) Más dóigh le hiontaobhaithe carthanais, i gcás aon éileamh i gcoinne duine maidir leis an gcarthanas, gur féidir comhréiteach a dhéanamh agus gur bhuntáiste don charthanas é nó gur ceart, in imthosca speisialta an cháis, comhréiteach a dhéanamh, féadfaidh na hiontaobhaithe nó féadfaidh an duine sin, le toiliú na n-iontaobhaithe, ráiteas agus togra maidir le comhréiteach a chur faoi bhráid an Bhoird.
(2) Más dóigh le hiontaobhaithe carthanais, i gcás aon éileamh ó aon duine i gcoinne an charthanais nó ina gcoinne féin, gur féidir comhréiteach a dhéanamh agus gur bhuntáiste don charthanas é nó gur ceart, in imthosca speisialta an cháis, comhréiteach a dhéanamh, féadfaidh na hiontaobhaithe nó féadfaidh an duine sin, le toiliú na n-iontaobhaithe, ráiteas agus togra maidir le comhréiteach a chur faoi bhráid an Bhoird.
(3) I gcás inarb é tuairim an Bhoird, tar éis cibé fiosrú a dhéanamh is dóigh leo is gá, gur togra cuí oiriúnach, agus togra chun tairbhe don charthanas, an togra arna mhodhnú nó gan modhnú, féadfaidh an Bord cibé ordú is cuí leo a dhéanamh maidir leis an gcomhréiteach.
(4) Más dóigh leis an mBord, i gcás aon éilimh uathu féin nó ina gcoinne maidir le haon mhaoin darb iontaobhaithe iad gur féidir comhréiteach a dhéanamh agus gur bhuntáiste don charthanas é, nó gur ceart, in imthosca speisialta an cháis, comhréiteach a dhéanamh, féadfaidh an Bord comhréiteach a dhéanamh maidir leis an éileamh.
(5) Má údaraítear nó má dhéantar comhréiteach faoin alt seo maidir le héileamh, ansin, tar éis téarmaí agus coinníollacha an chomhréitigh a chomhlíonadh go cuí, ní bheidh aon ábhar caingne ann maidir leis an éileamh.
Cumhacht chun agra a dhéanamh le bronatannis charthanúla a bheidh á gcoimeád siar go mícheart, á gceilt nó á mí-úsáid a aisghabháil.
23.—(1) Féadfaidh an Bord, le toiliú roimh ré ón Ard-Aighne, agra a dhéanamh chun aon bhronntanas carthanúil a aisghabháil a beartaíodh a chur chun feidhme sa Stát agus a bheidh á choimeád siar go mícheart, á cheilt nó á chur chun mífheidhme.
(2) Déanfaidh an Bord gach bronntanas carthanúil a aisghabhfaidh siad faoin alt seo a chur chun feidhme chun críocha carthanúla de réir intinn an bhronntóra.
(3) Féadfaidh an Bord na costais, na muirir agus na caiteachais uile faoina rachaidh siad ag aisghabháil aon bhronntanais charthanúil a aisghabhfaidh siad faoin alt seo a bhaint as an mbronntanas carthanúil sin.
Brontannais charthanúla a aisghabháil.
24.—Aon uair a bheidh aon suim iníoctha le haon chríocha carthanúla nó lena n-aghaidh, féadfaidh an Bord nó féadfaidh iontaobhaithe an charthanais, le toiliú an Bhoird, agra a dhéanamh ina leith agus í a ghnóthú ón duine a mbeidh sí dlite de de thuras na huaire nó arb é a dhualgas í a íoc, mar fhiach conartha shimplí in aon chúirt dlínse inniúla gan toiliú an Ard-Aighne a fháil.
Cumhacht an Bhoird chun imeachtaí dlíthiúla a údarú nó a ordú maidir le carthanas.
25.—Más dóigh leis an mBord é a bheith inmhianaithe go ndéanfadh duine ar bith seachas an tArd-Aighne imeachtaí dlíthiúla a thionscnamh maidir le haon charthanas, féadfaidh an Bord a údarú nó a ordú na himeachtaí dlíthiúla sin a thionscnamh agus cibé treoracha a thabhairt ina dtaobh is dóigh leo is cuí agus, air sin, féadfar na himeachtaí dlíthiúla sin a thionscnamh.
Cumhacht an Bhoird chun cásanna áirithe carthanais a dheimhniú don Ard-Aighne.
26.—(1) Más dóigh leis an mBord in aon chás áirithe é a bheith inmhianaithe go ndéanfadh an tArd-Aighne imeachtaí dlíthiúla a thionscnamh maidir le haon charthanas, féadfaidh an Bord an cás a dheimhniú, i scríbhinn faoi láimh an Rúnaí, don Ard-Aighne, maraon le cibé ráitis agus sonraí is gá, ina dtuairim, chun an cás a mhíniú.
(2) Nuair a dheimhneofar cás amhlaidh don Ard-Aighne, féadfaidh sé, más oiriúnach leis, cibé imeachtaí dlíthiúla a thionscnamh is dóigh leis is cuí in imthosca an cháis.
Cumhacht an Bhoird chun stiúradh agraí riaracháin, agus agraí chun iontaobhais uachtanna, a chur i gcrích a iarraidh i gcás moille.
27.—I gcás—
(a) duine a bheith tar éis aon mhaoin a réadtiomnú nó a thiomnú le huacht chun críocha carthanúla, agus
(b) ionadaí pearsanta an duine sin a bheith tar éis agra a thionscnamh chun na sócmhainní nó iontaobhais na huachta a riaradh nó a chur i gcrích,
féadfaidh an Bord (cé nach páirtithe san agra iad), ar fhoras moille, iarratas a dhéanamh chun an Cúirte ina mbeidh an t-agra ar feitheamh á iarraidh go n-aistreofaí stiúradh an agra chun an Bhoird, agus, air sin, féadfaidh an Chúirt más é a tuairim gur bhain moill mhíchuí nó mhícheart leis an agra a chur ar aghaidh—
(a) stiúradh an agra a thabhairt don Bhord, nó
(b) cibé téarmaí is dóigh léi is gá chun an t-agra a chríochnú go luath a fhorchur ar an bpáirtí ag a mbeidh stiúradh an agra,
agus féadfaidh an Chúirt cibé orduithe is oiriúnach léi a dhéanamh maidir leis an iarratas.
Cumhacht an Bhoird a iarraidh go n-aistreofar ciste carthanais a bheidh sa Chúirt agus nach mbeidh curtha chun feidhme.
28.—I gcás ina bhfágfar gur cur chun feidhme aon chiste a bheidh chun creidiúna ar leithligh in aon ábhar laistigh de dhlínse na Cúirte agus is ciste chun tairbhe charthanais nó ciste faoi chuing iontaobhais charthanúil, féadfaidh an Bord a iarraidh ar an gCúirt sin an ciste a aistriú chucu, chun é a bheith ar teachtadh acu ar an iontaobhas carthanúil a bhainfidh leis an gciste, agus, air sin, féadfaidh an Chúirt cibé ordú a dhéanamh maidir leis an gciste a aistriú chun an Bhoird nó ar shlí eile (lena n-áirítear costais a íoc as an gciste) is oiriúnach leis an gCúirt.

29.—(1) Chun críocha an ailt seo—
(a) measfar gurb é luach talún a luacháil inrátaithe arna iolrú faoi chaoga,
(b) measfar gurb é luach aon íocaíochta tréimhsiúla a mbeidh talamh faoina réir méid bliantúil na híocaíochta sin arna iolrú faoi chúig déag, agus
(c) measfar gurb é luach aon íocaíochta tréimhsiúla eile méid bliantúil na híocaíochta sin arna iolrú faoi fhiche.
(2) Aon uair—

(3) I gcás—
(a) inar tugadh luach suime ar bith de bhronntanas carthanúil d'fhéichiúnaithe bochta a bhí i bpríosún roimhe seo in Éirinn, agus
(b) go bhfuil aon imthosca dá sonraítear i bhfo-alt (1) d'alt 47 ann maidir leis an mbronntanas carthanúil,
féadfaidh an Bord más oiriúnach leo, le hordú, scéim a chumadh chun an mhaoin a bheidh ar áireamh sa bhronntanas carthanúil a chur chun feidhme cy-près.
(4) I gcás—
(a) ina mbeidh scéim chun bronntanas carthanúil a chur chun feidhme cumtha le hordú ó Chúirt, agus
(b) go mbeidh imthosca ann maidir leis an scéim a dtiocfadh de bharr iad a bheith ann maidir le bronntanas carthanúil go bhféadfaí an mhaoin a bheidh ar áireamh sa bhronntanas a chur chun feidhme cy-près, agus
(c) nach mó ná cúig mhíle punt luach an bhronntanais charthanúil,
féadfaidh an Bord más oiriúnach leo, le hordú, an scéim a chúlghairm agus scéim nua a chumadh ina hionad chun an mhaoin a bheidh ar áireamh sa bhronntanas carthanúil a chur chun feidhme cy-près.
(5) I gcás—
(a) ina mbeidh an Bord tar éis scéim chun bronntanas carthanúil a chur chun feidhme a chumadh—
(i) faoi alt 6 den Charitable Donations and Bequests Act (Ireland) 1871,
(ii) faoin alt sin 6, mar atá a ionad gafa ag alt 1 d'Acht na dTabhartas agus na dTiomnacht Carthanúla (Leasú), 1955,
(iii) faoi alt 58 den General Prisons (Ireland) Act, 1877, nó
(iv) faoin alt seo (lena n-áirítear an fo-alt seo), agus
(b) go mbeidh imthosca ann maidir leis an scéim a dtiocfadh de bharr iad a bheith ann maidir le bronntanas carthanúil go bhféadfaí an mhaoin a bheidh ar áireamh sa bhronntanas a chur chun feidhme cy-près,
féadfaidh an Bord más oiriúnach leo, le hordú, an scéim a chúlghairm agus scéim nua a chumadh ina hionad chun an mhaoin a bheidh ar áireamh sa bhronntanas carthanúil a chur chun feidhme cy-près.
(6) Ní dhéanfar ordú ag cumadh scéime faoin alt seo go ceann míosa tar éis fógra poiblí go bhfuil beartaithe é a dhéanamh a bheith tugtha i cibé slí is dóigh leis an mBord is éifeachtúla chun poiblíocht a thabhairt dó agus chun a chur in iúl do dhaoine leasmhara go bhfuil sé sin beartaithe.
(7) San fógra a thabharfar—
(a) beidh (a mhéid is caothúil sin) leor-shonraí i dtaobh an ordaithe a bheidh beartaithe, agus
(b) ordófar tréimhse réasúnach ina bhféadfar aon agóid ina aghaidh nó aon mholtaí ina thaobh a dhéanamh chun an Bhoird,
agus breithneoidh an Bord aon agóidí agus aon mholtaí a dhéanfar chucu agus féadfaidh siad gníomhú ina leith mar is fóirsteanach leo.
(8) Má mhodhnaíonn an Bord aon ordú a bheidh beartaithe, ní gá dóibh fógra i dtaobh an ordaithe mhodhnaithe sin a thathairt de réir fho-ailt (6) agus (7) mura dóigh leis na mBord gurb inmhianaithe tuilleadh fógra a thabhairt.

30.—(1) San alt seo—
ciallaíonn “an tAcht” an Educational Endowments (Ireland) Act, 1885;
ciallaíonn “scéim” scéim arna cumadh agus arna ceadú faoin Acht;
ciallaíonn “an clásal cumasaithe”, maidir le scéim, an clásal (á chumasú don Bhord an scéim a athrú) a cuireadh isteach sa scéim i bhfeidhmiú na gcumhachtaí a thugtar le halt 18 de Acht;
déanfar tagairtí do scéim, i gcás ina mbeifear tar éis an scéim a athrú faoin gclásal cumasaithe, a fhorléiriú mar thagairtí don scéim arna hathrú amhlaidh.
(2) Chun deireadh a chur le hamhras, dearbhaítear leis seo, faoi réir fho-alt (3),—
(a) go bhfolaíonn an chumhacht a thugtar don Bhord leis an gclásal cumasaithe chun scéim a athrú in aon ábhar nó in aon slí cumhacht chun na hathruithe uile sin a dhéanamh a iarrfaidh an duine nó na daoine ar de bharr iarratas uaidh nó uathu atá cumhacht ag an mBord, faoin gclásal cumasaithe, athruithe a dhéanamh san ábhar nó sa tslí sin;
(b) go bhféadfaidh na nithe seo a leanas a bheith ar na hathruithe a dhéanfar ar an scéim—
(i) foráil i dtaobh aon ábhair dá luaitear in alt 6 den Acht, agus
(ii) más áitreabh scoile an dearlaic uile nó aon chuid di, forálacha á údarú an t-áitreabh a dhíol agus an t-airgead as an díol sin a chur chun feidhme chun aon chríche a chuirfidh, i dtuairim an Bhoird, oideachas chun cinn;
(c) go measfar nach bhfuil aon athruithe a dhéanfar amhlaidh contrártha d'aon ní atá san Acht.
(3) Ní dhéanfaidh an Bord faoi chlásal cumasaithe scéime an scéim a athrú ar shlí go mbeadh aon dearlaic is inchurtha chun feidhme faoin scéim inchurtha chun feidhme chun aon chríocha seachas críocha a chuirfidh, i dtuairim an Bhoird, oideachas chun cinn.
(4) I gcás aon athruithe a rinneadh ar scéim roimh thosach feidhme an Achta seo i bhfeidhmiú airbheartaithe na gcumhachtaí a thugtar leis an gclásal cumasaithe, measfar, más ar iarratas an duine nó na ndaoine a bhfuil cumhacht ag an mBord faoin gclásal cumasaithe athruithe a dhéanamh de bharr iarratas uaidh nó uathu a rinneadh iad, iad a bheith déanta go cuí.
(5) Murab é tuairim an Bhoird gur athruithe foirmiúla nó mion-athruithe iad, ní dhéanfar athruithe ar scéim faoin gclásal cumasaithe go ceann míosa tar éis fógra go bhfuil beartaithe é a dhéanamh a bheith tugtha i cibé slí is dóigh leis an mBord is éifeachtúla chun poiblíocht a thabhairt dó agus chun a chur in iúl do dhaoine leasmhara go bhfuil sé sin beartaithe.
(6) San fhógra a thabharfar—
(a) beidh (a mhéid is caothúil sin) leor-shonraí dóthaineacha i dtaobh na n-athruithe a bheidh beartaithe, agus
(b) ordófar tréimhse réasúnach ina bhféadfar aon agóid ina aghaidh nó aon mholtaí ina thaobh a dhéanamh chun an Bhoird,
agus breithneoidh an Bord aon agóidí agus aon mholtaí a dhéanfar chucu agus, faoi réir fho-alt (7), féadfaidh siad gníomhú ina leith mar is fóirsteanach leo.
(7) Ní dhéanfaidh an Bord, de dhroim aon agóidí nó moltaí a dhéanfar chucu, na hathruithe a bheidh beartaithe a dhéanamh ar scéim a mhodhnú ach amháin le toiliú an duine nó na ndaoine ar de bharr iarratas uaidh nó uathu a bheidh cumhacht ag an mBord faoin gclásal cumasaithe athruithe a dhéanamh ar an scéim.
(8) Má mhodhnaíonn an Bord aon athruithe a bheidh beartaithe, ní gá fógra i dtaobh na n-athruithe modhnaithe sin a thabhairt de réir fho-ailt (5) agus (6) mura dóigh leis na mBord gurb inmhianaithe tuilleadh fógra a thabhairt.
An Bord do ghlacadh bronntanais chun críocha carthanúla.
31.—(1) San alt seo folaíonn “talamh” aon íocaíocht thréimhsiúil a bhfuil talamh faoina réir.
(2) Féadfaidh an Bord, más oiriúnach leo, aon talamh nó ciste a ghlacadh de bhronntanas ar iontaobhas chun aon chríche carthanúla.
(3) (a) Faoi réir mhíreanna (b) agus (c), aon duine a mbeidh aon talamh nó ciste dílsithe dó ar iontaobhas chun aon chríche carthanúla, féadfaidh sé, le cead roimh ré i scríbhinn ón mBord, é go léir nó aon chuid de a aistriú chun an Bhoird chun iad dá theachtadh chun na críche sin.
(b) I gcás ina ndearnadh bronntanas carthanúil a dhílsiú i gcéadóir do níos mó ná iontaobhaí amháin agus do sheisear iontaobhaí ar a mhéid, ní dhéanfar aistriú faoin bhfo-alt seo an fad is lú líon na n-iontaobhaithe ná an líon bunaidh a ceapadh chun gníomhú in iontaobhais nó i bhforghníomhú an bhronntanais charthanúil ná gan toiliú na n-iontaobhaithe uile a bheith curtha in iúl ar dtús i scríbhinn faoina láimh agus an scríbhinn sin a thaisceadh leis an mBord.
(c) I gcás ina ndearnadh bronntanas carthanúil a dhílsiú i gcéadóir do níos mó ná seisear iontaobhaí, ní dhéanfar aistriú faoin bhfo-alt seo gan toiliú dhá thrian de na hiontaobhaithe (nach lú ná seisear a líon) a bheith curtha in iúl ar dtús i scríbhinn faoina láimh agus an scríbhinn sin a thaisceadh leis an mBord.
(4) Aon talamh nó ciste a dhílseofar don Bhord de réir an ailt seo teachtfaidh an Bord é feasta ar na hiontaobhais ar ar dílsíodh, agus chun na gcríocha chun ar dílsíodh, an talamh nó an ciste amhlaidh nó cibé cinn de na hiontaobhais agus na críocha sin a bheidh ar marthain, nó ar féidir leo éifeacht a ghlacadh, de thuras na huaire.
(5) Féadfaidh an Bord le hordú ó am go ham cibé daoine is cuí leo a ainmniú chun an talamh nó an ciste nó na brabúis nó an t-ioncam as a riaradh, a dháileadh nó a chur chun feidhme faoina dtreoracha agus féadfaidh siad ó am go ham le hordú aon daoine den sórt sin a chur as oifig agus daoine eile a ainmniú ina n-ionad.
Ciste carthanais a infheistiú.
32.—(1) Féadfaidh an Bord, as a gcomhairle féin, aon chiste a bheidh ar teachtadh acu ar aon iontaobhas carthanúil a infheistiú in aon slí is cuí leo.
(2) Féadfaidh an Bord, más oiriúnach leo, ar iarratas ó iontaobhaithe aon chiste a bheidh ar teachtadh ar aon iontaobhas carthanúil, cumhacht a thabhairt, le hordú, do na hiontaobhaithe, i gcoitinne nó in aon chás áirithe, chun an ciste a infheistiú i cibé slí, ar cibé téarmaí agus faoi cibé coinníollacha is cuí leis an mBord.
(3) (a) D'ainneoin aon ní atá in aon achtachán (lena n-áirítear an tAcht seo) nó in aon riail dlí, ní dhéanfaidh Cúirt ná an Bord ná ní ordóidh, ní chumasóidh, ní thoileoidh ná ní cheadóidh Cúirt ná an Bord, aon chiste a bheidh ar teachtadh ar aon iontaobhas carthanúil a infheistiú i slí seachas mar a leanas, is é sin le rá:
(i) in infheistíochtaí a bheidh údaraithe le téarmaí an iontaobhais nó a bheidh údaraithe de thuras na huaire le dlí mar infheistíochtaí do chistí iontaobhais,
(ii) in aon bhintiúir, stoc bintiúir nó stoc nó scaireanna ráthaithe nó tosaíochta nó gnáthstoc nó gnáthscaireanna de chuid aon chuideachta tionscail nó tráchtála a corpraíodh sa Stát nó a mbeidh clár dá scairshealbhóirí a chónaíonn sa Stát á choimeád aici an tráth a bheidh beartaithe an t-infheistiú a dhéanamh, ar choinníoll go luaitear gnáthstoc nó gnáthscaireanna aon chuideachta den sórt sin ar Stocmhargadh Bhaile Átha Cliath nó ar Stocmhargadh Chorcaí,
(iii) ag ceannach talamh ruílse nó talamh léasach sa Stát.
(b) D'ainneoin aon ní atá i mír (a), féadfaidh an t-iomlán nó aon chuid de chiste a bheidh ar teachtadh ar aon iontaobhas carthanúil a bhí, díreach roimh thosach feidhme an Achta seo, infheistithe ar shlí seachas mar a shonraítear i mír (a) leanúint de bheith infheistithe amhlaidh agus, más infheistiú é in aon urrúis a dtairgfear urrúis eile den chineál céanna dá sealbhóirí ar théarmaí buntáisteacha, féadfar, cibé acu a bheidh nó nach mbeidh an ciste ar staid infheistíochta an tráth sin, an ciste a infheistiú, comhoiread le méid na tairisceana a bheidh déanta i leith a mbeidh ag an gciste de na hurrúis sin, sna hurrúis eile.
(c) Ní dhéanfar ciste a bheidh ar teachtadh ar aon iontaobhas carthanúil a infheistiú, de bhua mhír (a), in aon slí a thoirmisctear go sainráite le téarmaí an iontaobhais.
(d) Féadfaidh Cúirt nó an Bord ó am go ham infheistiú a bheidh déanta sa tslí a shonraítear i mír (a) a athrú nó ordú, cumhacht, toiliú nó ceadú a thabhairt lena athrú.
(e) Ní chuireann an fo-alt seo srian le cumhacht an Bhoird chun údaráis a thabhairt maidir le talamh faoi na forálacha ina dhiaidh seo den Chuid seo.
(4) Ní bhaineann fo-alt (2) le ciste a mbaineann alt 33 leis de thuras na huaire.
Cead chun ciste carthanais a infheistiú a bheidh ar teachtadh faoi réir leasa theoranta tosaíochta.
33.—I gcás—
(1) aon chiste a bheidh ar teachtadh ar iontaobhas, tar éis foirceannadh nó faoi réir aon leasa thosaíochta saoil nó aon leasa theoranta eile, chun aon chríocha carthanúla, agus
(2) gur mian leis na hiontaobhaithe an ciste a infheistiú, nó infheistiú an chiste a athrú trína infheistiú in infheistíochtaí a shonraítear i bhfomhír (ii) nó (iii) de mhír (a) d'fho-alt (3) d'alt 32 ach nach mbeidh údaraithe le téarmaí an iontaobhais agus nach mbeidh údaraithe de thuras na huaire le dlí mar infheistíochtaí do chistí iontaobhais,
beidh feidhm ag na forálacha seo a leanas—
(a) sula ndéanfaidh na hiontaobhaithe amhlaidh, tabharfaidh siad fógra i scríbhinn don Bhord i dtaobh a dtogra;
(b) breithneoidh an Bord an togra agus cuirfidh siad in iúl i scríbhinn do na hiontaobhaithe cé acu atá nó nach bhfuil siad ag cur i gcoinne an togra;
(c) má chuireann an Bord in iúl do na hiontaobhaithe go bhfuil siad ag cur i gcoinne an togra, féadfaidh na hiontaobhaithe iarratas a dhéanamh chun na hArd-Chúirte ag iarraidh cead chun an t-infheistiú a dhéanamh nó a athrú agus tabharfaidh siad fógra i dtaobh an iarratais don Bhord agus do cibé daoine eile a threoróidh an Chúirt, agus féadfaidh an Chúirt cibé ordú a dhéanamh i leith an iarratais sin is oiriúnach leis an gCúirt;
(d) má chuireann an Bord in iúl do na hiontaobhaithe nach bhfuil siad ag cur i gcoinne an togra, is dleathach do na hiontaobhaithe an t-infheistiú a dhéanamh nó a athrú sa tslí a bheidh sonraithe sa togra.
Cumhacht an Bhoird chun a údarú talamh carthanais a dhíol nó chun é a dhíol nó a mhalartú nó chun léas air a thabhairt suas.
34.—(1) San alt seo, ciallaíonn “diúscairt”, maidir le talamh, an talamh a dhiúscairt—
(a) trína dhíol, nó
(b) trína mhalartú ar thalamh eile, nó
(c) trí léas air a thabhairt suas.
(2) I gcás ina ndéanfar iarratas chun an Bhoird ó iontaobhaithe aon charthanais a bhfuil talamh ar áireamh ann á chur in iúl gur féidir diúscairt shonraithe a dhéanamh ar an talamh ar théarmaí a bheadh buntáisteach don charthanas, féadfaidh an Bord, más oiriúnach leo, fiosrú a dhéanamh ar na himthosca, agus más deimhin leo tar éis an fhiosraithe gur bhuntáiste don charthanas an diúscairt a bheidh beartaithe, féadfaidh siad a údarú do na hiarratasóirí an diúscairt sin a dhéanamh agus treoracha a thabhairt i dtaobh na diúscartha sin agus chun a áirithiú go ndéanfar an t-airgead as a infheistiú go cuí, chun tairbhe an charthanais, de réir mar is oiriúnach leo.
(3) Féadfaidh an Bord, más cuí leo, diúscairt shonrach a dhéanfar gan an t-údarás sin a údarú le héifeacht chúlghabhálach.
(4) Más dóigh leis an mBord maidir le haon charthanas a bhfuil talamh ar áireamh ann agus darb iontaobhaithe iad gur thairbhe don charthanas aon diúscairt áirithe ar an talamh, féadfaidh siad an diúscairt sin a dhéanamh ar an talamh agus déanfar an t-airgead as a infheistiú chun tairbhe don charthanas i cibé slí is oiriúnach leis an mBord.
Cumhacht an Bhoird chun a údarú íocaíocht thréimhsiúil a dhíol a bhaineann le carthanas agus is iníoctha as talamh.
35.—(1) I gcás—
(a) ina mbeidh aon talamh faoi réir íocaíochta tréimhsiúla is iníoctha le carthanas nó chun tairbhe carthanais nó is inchurtha chun feidhme chun críocha carthanúla, agus
(b) go ndéanfaidh iontaobhaithe an charthanais iarratas chun an Bhoird á chur in iúl gur bhuntáiste don charthanas é an íocaíocht thréimhsiúil a dhíol le húinéir na talún,
féadfaidh an Bord, más oiriúnach leo, fiosrú a dhéanamh ar na himthosca, agus más deimhin leo, tar éis an fhiosraithe, gur féidir an díol a bheidh beartaithe a dhéanamh ar théarmaí a bheadh buntáisteach don charthanas, féadfaidh siad a údarú do na hiarratasóirí an íocaíocht thréimhsiúil a dhíol le húinéir na talún ar cibé téarmaí agus coinníollacha is dóigh leo a bheith tairbhiúil don charthanas agus treoracha a thabhairt chun a áirithiú go ndéanfar an t-airgead as an díol sin a infheistiú go cuí chun tairbhe an charthanais nó chun a áirithiú go gcuirfear chun feidhme go cuí é chun tairbhe cibé críocha carthanúla is oiriúnach leo.
(2) Más dóigh leis an mBord maidir le haon charthanas a bhfuil talamh ar áireamh ann agus darb iontaobhaithe iad gur bhuntáiste don charthanas aon íocaíocht thréimhsiúil atá de mhuirear ar an talamh agus iníoctha leis an gcarthanas nó chun tairbhe dó nó is inchurtha chun feidhme chun críocha carthanúla a dhíol le húinéir na talún, féadfaidh an Bord an íocaíocht thréimhsiúil a dhíol leis an úinéir sin ar cibé téarmaí agus coinníollacha is dóigh leo a bheith tairbhiúil don charthanas, agus treoracha a thabhairt chun a áirithiú go ndéanfar an t-airgead as an díol sin a infheistiú go cuí chun tairbhe an charthanais nó chun a áirithiú go gcuirfear chun feidhme go cuí é chun tairbhe cibé críocha carthanúla is oiriúnach leo.
Cumhacht an Bhoird chun a údarú íocaíocht thréimhsiúil is iníoctha as talamh carthanais a cheannach.
36.—(1) I gcás—
(a) ina mbeidh aon talamh le carthanas faoi réir íocaíochta tréimhsiúla, agus
(b) go ndéanfaidh iontaobhaithe an charthanais iarratas chun an Bhoird á chur in iúl gur bhuntáiste don charthanas na hiarratasóirí do cheannach na híocaíochta tréimhsiúla,
féadfaidh an Bord, más oiriúnach leo, fiosrú a dhéanamh ar na himthosca, agus más deimhin leo, tar éis an fhiosraithe, gur bhuntáiste don charthanas an ceannach a bheidh beartaithe, féadfaidh siad a údarú do na hiontaobhaithe an íocaíocht thréimhsiúil a cheannach ar cibé téarmaí is dóigh leis an mBord a bheith tairbhiúil don charthanas.
(2) I gcás—
(a) carthanas a bhfuil talamh ar áireamh ann agus darb iontaobhaithe an Bord a bheith faoi réir íocaíochta tréimhsiúla, agus
(b) gurb é tuairim an Bhoird gur bhuntáiste don charthanas an íocaíocht thréimhsiúil a cheannach,
féadfaidh an Bord an íocaíocht thréimhsiúil a cheannach as aon chistí de chuid an charthanais.
Cumhacht an Bhoird nó iontaobhaithe carthanais, le húdarás an Bhoird, chun léasanna foirgníochta, etc., a dheonú, deisiúchán, etc., a dhéanamh agus airgead a bhailiú chun na gcríocha sin.
37.—(1) San alt seo, ciallaíonn “gníomh lena mbaineann an t-alt seo”, maidir le carthanas a bhfuil talamh ar áireamh ann, aon ní acu seo a leanas—
(a) an talamh a ligean ar léasanna foirgníochta, deisiúcháin, feabhsúcháin nó léasanna eile, nó a ligean ar léasanna chun aon mhianach a oibriú,
(b) clocha, cré, gairbhéal nó mianraí eile a thochailt nó a bhaint ar an talamh,
(c) adhmad a ghearradh ar an talamh,
(d) aon bhóthar nua nó sráid nua a dhéanamh nó a leagan amach tríd an talamh,
(e) silteáin nó séaracha a dhéanamh tríd an talamh,
(f) aon fhoirgneamh nua a thógáil ar an talamh,
(g) aon fhoirgneamh atá ar an talamh a dheisiú, a athrú, a athfhoirgniú nó a thabhairt as ar fad,
(h) aon fheabhsuithe nó athruithe eile a dhéanamh ar staid nó ar bhail na talún.
(2) Más dóigh le hiontaobhaithe aon charthanais a bhfuil talamh ar áireamh ann gur thairbhe don charthanas aon ghníomh lena mbaineann an t-alt seo a dhéanamh, féadfaidh siad ráiteas agus togra maidir leis an ngníomh sin a dhéanamh a leagan faoi bhráid an Bhoird, agus air sin—
(a) féadfaidh an Bord, más dóigh leo gur thairbhe don charthanas an gníomh lena mbainfidh an ráiteas agus an togra a dhéanamh (le modhnuithe nó athruithe nó dá n-éagmais), cibé ordú a dhéanamh le haghaidh nó i leith an gníomh a dhéanamh agus aon imthosca a bhainfidh leis, de réir mar is oiriúnach leo, bíodh is nach n-údaraíonn nó nach gceadaíonn an t-iontaobhas an gníomh;
(b) féadfaidh an Bord leis an ordú sin a údarú aon airgead leis an gcarthanas a úsáid le haghaidh an ghnímh, agus, más gá, féadfaidh siad a údarú do na hiontaobhaithe aon suim airgid a chruinniú trí thalamh uile an charthanais nó aon chuid de a mhorgáistiú.
(3) Más dóigh leis an mBord maidir le haon charthanas a bhfuil talamh ar áireamh ann agus darb iontaobhaithe iad gur thairbhe don charthanas aon ghníomh lena mbaineann an t-alt seo a dhéanamh—
(a) féadfaidh siad an gníomh sin a dhéanamh, agus

39.—(1) I gcás—

41.—I gcás—

42.—(1) Féadfaidh an Bord a iarraidh ar dhuine ar bith a mbeidh faoina choimeád aon doiciméid a bhainfidh le haon charthanas cibé cóipeanna de na doiciméid sin nó cibé sleachta astu a shonróidh an Bord a thabhairt don Bhord agus déanfaidh an duine sin de réir an iarratais.
(2) Féadfaidh an Rúnaí nó aon oifigeach eile don Bhord a bheidh údaraithe chuige sin ag an mBord scrúdú agus cuardach a dhéanamh ar chláir agus taifid aon Chúirte, agus aon chlárlainne agus oifige taifead poiblí agus cóipeanna d'aon doiciméad a bheidh taifeadta nó cláraithe nó taiscthe ansin agus sleachta as aon doiciméad den sórt sin a thógáil gan íocaíocht.

43.—(1) Más dóigh leis an mBord ar chúis ar bith gur gá iontaobhaí nua nó iontaobhaithe nua a cheapadh d'aon charthanas, féadfaidh an Bord—
(a) ar iarratas ó iontaobhaí nó ó iontaobhaithe an charthanais, nó
(b) mura bhfuil aon iontaobhaithe ann don charthanas, nó mura féidir teacht orthu, ar iarratas ó aon duine a bhfuil leas aige ann, nó
(c) in aon chás, as a dtreoir féin,
na horduithe seo a leanas a dhéanamh—
(i) ordú faoi shéala an Bhoird ag ceapadh iontaobhaí nua nó iontaobhaithe nua don charthanas in ionad nó i dteannta aon iontaobhaí nó iontaobhaithe atá ann cheana, nó bíodh nach bhfuil aon iontaobhaí ann cheana, agus

(4) Déanfaidh an Bord—
(a) tráth nach lú ná mí roimh an dáta ar a mbeidh beartaithe acu ordú a dhéanamh faoin alt seo, fógra poiblí a thabhairt i dtaobh an ordaithe atá beartaithe, agus
(b) an lá díreach i ndiaidh dháta an ordaithe a dhéanamh, fógra poiblí a thabhairt ag insint go ndearnadh an t-ordú agus an dáta ar a ndearnadh é,
i cibé slí is dóigh leis an mBord is éifeachtúla chun poiblíocht a thabhairt don ní atá beartaithe nó don ordú, agus chun é a thabhairt faoi amhail daoine a mbeidh leas acu ann.
(5) (a) Féadfaidh aon duine a mbeidh leas aige ann, laistigh de lá is fiche tar éis an dáta ar a ndéanfar ordú faoin alt seo, achomharc a dhéanamh chun na hArd-Chúirte i gcoinne an t-ordú a dhéanamh agus, ar an achomharc sin, féadfaidh an Ard-Chúirt ordú ag daingniú, ag neamhniú nó ag athrú an ordaithe faoin alt seo, agus ordú maidir le costais a dhéanamh de réir mar is oiriúnach léi.
(b) Beidh teideal ag an mBord agus ag iontaobhaithe (más ann) an charthanais chun duine a bheith acu ag feidhmiú ar a son agus chun éisteacht a fháil ar aon achomharc faoin bhfo-alt seo.
(c) Tiocfaidh ordú faoin alt seo, mura ndéanfar aon achomharc ina choinne, i ngníomh ag deireadh na tréimhse lá is fiche a luaitear i mír (a) den fho-alt seo, agus tiocfaidh ordú a ndéanfar achomharc ina choinne i ngníomh—
(i) má dhaingníonn agus a mhéid a dhaingneoidh an Chúirt é, ón dáta a chinnfear go críochnaitheach an t-achomharc, agus

(9) I gcás aon talamh a mbeidh a úinéireacht cláraithe faoi na hAchtanna um Chlárú Teidil, 1891 agus 1942, a theacht chun bheith dílsithe, le hordú faoin alt seo, d'aon duine nó daoine, déanfaidh an t-údarás cláraitheachta faoi na hAchtanna sin, ar chóip faoi shéala an Bhoird den ordú a thabhairt ar aird agus an táille iomchuí a bheith íoctha, an duine sin nó na daoine sin a chlárú sa chlár iomchuí a choimeádtar faoi na hAchtanna sin mar úinéir (de réir bhrí nAchtanna sin) na talún.

46.—(1) Féadfaidh an Ard-Chúirt nó an Bord, le hordú, scéimeanna a dhéanamh agus a chur in éifeacht chun comhchistí infheistíochta (dá ngairtear scéimeanna san alt seo) a bhunú ar théarmaí ina mbeidh foráil—
(a) chun maoin a aistreofar chun an chiste ó charthanas, nó thar ceann carthanais, a bheidh rannpháirteach sa scéim a infheistiú faoi chúram iontaobhaithe a bheidh ceaptha chun an ciste a bhainistí; agus
(b) chun teideal a bheith (faoi réir fhorálacha na scéime) ag na carthanais rannpháirteacha chun caipiteal agus ioncam an chiste ina scaireanna a chinnfear faoi threoir méid nó luach na maoine a bheidh aistrithe chuige ag gach carthanas acu nó thar ceann gach carthanais acu agus faoi threoir luach an chiste le linn an aistrithe.
(2) Féadfaidh an Ard-Chúirt nó an Bord scéim a dhéanamh ar iarratas ó dhá charthanas nó níos mó: ar choinníoll go bhféadfaidh an Bord scéim a dhéanamh as a dtreoir féin i gcás aon dá charthanas nó níos mó darb iontaobhaithe an Bord.
(3) Féadfar scéim a dhéanamh i dtéarmaí a cheadóidh d'aon charthanas a bheith rannpháirteach, nó a chuirfidh srian i slí ar bith leis an gceart chun bheith rannpháirteach.
(4) Féadfaidh foráil a bheith i scéim le haghaidh, agus le haghaidh gach ní i dtaobh, an comhchiste infheistíocha a bhunú, a infheistiú, a bhainistí agus a fhoirceannadh, agus féadfaidh, go sonrach, foráil a bheith inti—
(a) chun luach saothair a thabhairt do dhaoine a bheidh ceaptha ina n-iontaobhaithe chun an ciste nó aon chuid de a theachtadh nó a bhainistí, i dteannta nó d'éagmais forála á údarú do dhuine an luach saothair a ghlacadh d'ainneoin é a bheith freisin ina iontaobhaí carthanais, nó ina iontaobhaí, do charthanas rannpháirteach;

(c) chun go bhféadfar ioncam a choimeád siar gan a dháileadh d'fhonn nach mbeidh neamhionannais sna suimeanna a dháilfear, agus, i gcoitinne, chun dáileadh ioncaim a rialú;
(d) chun go bhféadfar airgead a fháil ar iasacht go sealadach faoi chomhair íocaíochtaí as an gciste;

(6) Ach amháin a mhéid go bhforálfar a mhalairt i scéim, ní fhéadfar na cearta faoin scéim a bheidh ag carthanas rannpháirteach a shannadh ná a mhuirearú, ná ní bheidh aon iontaobhaí ná duine eile a mbeidh baint aige le bainistí an chomhchiste infheistíochta a bheidh arna bhunú leis an scéim faoi cheangal ná i dteideal cuntas a thógáil ar aon iontaobhas nó cothromas eile a bhainfidh le carthanas rannpháirteach nó lena mhaoin nó lena chearta.
(7) Féadfar maoin a bheidh ar teachtadh ar aon iontaobhas carthanúil a aistriú chun comhchistí infheistíochta a bheidh arna mbunú faoin alt seo mura mbeidh an chumhacht chun sin a dhéanamh eisiata le foráil a dhéanfaidh tagairt shonrach do scéimeanna i dtéarmaí an iontaobhais.
(8) Measfar chun gach críche gur comhchiste infheistíochta carthanas.
(9) Féadfaidh an Ard-Chúirt, le hordú, téarmaí scéime a leasú nó a athrú nó scéim a fhoirceannadh agus féadfaidh an Bord, le hordú, téarmaí scéime a rinneadh le hordú ón mBord a leasú nó a athrú nó scéim den sórt sin a fhoirceannadh.

(b) i gcás nach bhforálann na críocha bunaidh úsáid ach amháin le haghaidh cuid den mhaoin a bheidh ar fáil de bhua an bhronntanais; nó
(c) i gcás inar féidir an mhaoin a bheidh ar fáil de bhua an bhronntanais agus maoin eile is inchurtha chun feidhme chun críocha den sórt céanna a úsáid níos éifeachtúla i dteannta a chéile agus gur féidir go hiomchuí chuige sin, ag féachaint do spiorad an bhronntanais, iad a chur chun feidhme chun comhchríocha; nó

(2) Ní dhéanfaidh fo-alt (1) difir do na coinníollacha nach mór a bheith comhlíonta ionas go bhféadfar maoin a bheidh tugtha chun críocha carthanúla a chur chun feidhme cy-près, ach amháin sa mhéid go gceanglaíonn na coinníollacha sin go mbeadh teipthe ar na críocha bunaidh.
(3) Déanfar tagairtí sna fo-ailt sin roimhe seo do chríocha bunaidh bronntanais a fhorléiriú, i gcás cur na maoine chun feidhme a bheith arna athrú nó arna rialú le scéim nó i slí eile, mar thagairtí do na críocha a mbeidh an mhaoin inchurtha chun feidhme chucu de thuras na huaire.
(4) Dearbhaítear leis seo go gcuireann iontaobhas chun críocha carthanúla de dhualgas ar iontaobhaí, nuair a cheadaíonn agus a cheanglaíonn an cás go gcuirfear an mhaoin nó cuid éigin di chun feidhme cy-près, a áirithiú go n-úsáidfear go héifeachtúil le haghaidh carthanais í trí bhearta a dhéanamh chun go bhféadfar í a chur chun feidhme.
(5) Bainfidh an t-alt seo le maoin a tugadh chun críocha carthanúla, d'ainneoin gur roimh thosach feidhme an Achta seo a tugadh amhlaidh í.

(a) na fáltais as bailiúcháin airgid a rinneadh le boscaí bailiúcháin nó trí mheáin eile nach raibh ceaptha chun bronntanais a idirdhealú ó chéile;
(b) na fáltais as aon chrannchur, comórtas, siamsa, díolachán nó gníomhacht dá sórt sin chun airgead a chruinniú, tar éis lamháltas a dhéanamh i leith maoin a tugadh chun duaiseanna nó earraí lena ndíol a sholáthar nó ar bhealach eile ionas go bhféadfaí an ghníomhacht a ghabháil de láimh.
(3) Féadfaidh Cúirt dlínse inniúla a threorú, le hordú, go ndéanfar chun críocha an ailt seo (gan aon fhógrán ná fiosrúchán) maoin nach dtagann faoi réim fho-alt (2) a áireamh mar mhaoin le deontóirí nach féidir a dhéanamh amach cé hiad, más dóigh leis an gCúirt—
(a) go mba rud míréasúnach é, ag féachaint do na méideanna ba dhócha a thabharfaí ar ais do na deontóirí, dul faoi chaiteachas d'fhonn an mhaoin a thabhairt ar ais; nó
(b) go mba rud míréasúnach é, ag féachaint don saghas bronntanais atá iontu, do na himthosca a bhaineann leo agus dá méid, agus don fhad aimsire atá caite ó tugadh na bronntanais, go mbeadh súil ag na deontóirí go dtabharfaí an mhaoin ar ais.
(4) I gcás ina gcuirfear maoin chun feidhme cy-près de bhua an ailt seo, measfar gur scar an deontóir lena leas uile an tráth a tugadh an bronntanas; ach i gcás ina gcuirfear maoin chun feidhme amhlaidh mar mhaoin le deontóirí nach féidir a dhéanamh amach cé hiad nó nach féidir teacht orthu, agus nach gcuirfear chun feidhme amhlaidh í de bhua fho-alt (2) nó (3)—
(a) sonróidh an scéim méid iomlán na maoine sin; agus
(b) beidh deontóir aon chuid den mhéid sin i dteideal, má dhéanann sé éileamh tráth nach déanaí ná dhá mhí dhéag tar éis an dáta ar a ndearnadh an scéim, chun suim is comhionann leis an gcuid sin, lúide aon chaiteachas faoina ndeachaigh iontaobhaithe an charthanais go cuí tar éis an dáta sin maidir le héilimh a bhain lena bhronntanas, a aisghabháil ón gcarthanas a gcuirfear an mhaoin chun feidhme chuige; agus
(c) féadfaidh treoracha a bheith sa scéim maidir leis an socrú a dhéanfar chun freastal d'aon éileamh den sórt sin.
(5) Chun críocha an ailt seo, measfar gur chlis críocha i gcás ina dtiocfaidh d'aon deacracht a bhainfidh le maoin a chur chun feidhme chun na gcríocha sin go mbeidh an mhaoin sin, nó, i gcás maoin a bheidh le cur chun feidhme chun críocha carthanúla, an chuid nach inchurtha chun feidhme cy-près faoi alt 47, ar fáil le tabhairt ar ais do na deontóirí.
(6) San alt seo, ach amháin a mhéid a éilíonn an comhthéacs a mhalairt, folaíonn tagairtí do dheontóir tagairtí do dhaoine a bheidh ag éileamh tríd an deontóir bunaidh nó faoi, agus folaíonn tagairtí do mhaoin a tugadh tagairtí don mhaoin a bheidh de thuras na huaire in ionannas leis an maoin a tugadh i gcéadóir nó maoin a chin ón maoin sin.
(7) (a) Mura mó ná míle punt luach na maoine, féadfaidh an Bord na cumhachtaí a fheidhmiú a thugtar leis an alt seo do Chúirt dlínse inniúla maidir le maoin a tugadh chun críocha carthanúla sonracha agus, chun críocha an fheidhmithe sin, forléireofar tagairtí atá sna fo-ailt sin roimhe seo den alt seo do Chúirt dlínse inniúla mar thagairtí a fholaíonn tagairtí don Bhord.
(b) Chun críocha mhír (a)—
(i) measfar gurb é luach talún a luach inrátaithe arna iolrú faoi chaoga,
(ii) measfar gurb é luach aon íocaíochta tréimhsiúla a mbeidh talamh faoina réir méid bliantúil na híocaíochta sin arna iolrú faoi chúig déag, agus
(iii) measfar gurb é luach aon íocaíochta tréimhsiúla eile méid bliantúil na híocaíochta sin arna iolrú faoi fhiche.
(8) Bainfidh an t-alt seo le maoin a tugadh chun críocha carthanúla nó neamhcharthanúla d'ainneoin gur roimh thosach feidhme an Achta seo a tugadh amhlaidh í.
Forléiriú bronntanas chun críocha measctha.
49.—(1) I gcás ina bhfolaíonn, nó ina bhféadfaí a mheas go bhfolaíonn, aon cheann de chríocha bronntanais cuspóirí carthanúla agus cuspóirí neamhcharthanúla le chéile, forléireofar téarmaí an bhronntanais agus tabharfar éifeacht dóibh i slí a eisiafaidh na críocha neamhcharthanúla, agus déileálfar, dá réir sin, leis an gcríoch mar chríoch charthanúil.
(2) Ní bheidh feidhm ag fo-alt (1)—
(a) má bhíonn feidhm ag an mbronntanas roimh an lú lá d'Eanáir, 1960, nó
(b) (i) má dhéanann téarmaí an bhronntanais cionroinnt, nó má bhíonn foráil iontu chun cionroinnt a dhéanamh, idir na cuspóirí carthanúla agus na cuspóirí neamhcharthanúla, agus
(ii) más féidir na cuspóirí neamhcharthanúla a aithint ó thuairisc shainráite nó ó thuairisc intuigthe.
(3) Ní dhéanfaidh an t-alt seo, trína oibriú ar aon bhronntanas maidir leis an tréimhse ón 1ú lá d'Eanáir, 1960, go dtí an 24ú lá de Mheán Fómhair, 1960, teideal a thabhairt d'aon duine chun aon cháin nó dleacht a íocadh nó a iompraíodh i rith na tréimhse sin a aiséileamh ná (ach amháin maidir le cáin nó le dleacht) a cheangal go ndéanfar na cuspóirí a dearbhaíodh sa bhronntanas a áireamh mar chuspóirí carthanúla ionas go gcuirfí ó bhail aon ní a rinneadh nó aon chinneadh a tugadh i rith na tréimhse sin.
Bronntanais le haghaidh uanna agus cuimhneachán.
50.—(1) Gach bronntanas a thabharfar tar éis tosach feidhme an Achta seo chun tuama, lusca nó uaigh nó leac uaighe nó aon chuimhneachán eile ar dhuine marbh nó ar dhaoine marbha a chur ar fáil, a chothabháil nó a fheabhsú, agus nach mbeadh carthanúil ar shlí eile, is bronntanas carthanúil a bheidh ann a mhéid a fhoráiltear leis an alt seo.
(2) Is bronntanas carthanúil bronntanas den sórt sin an fad nach rachaidh sé—
(a) i gcás gan ach bronntanas ioncaim a bheith ann, tharseasca punt sa bhliain,
(b) in aon chás eile, thar míle punt ó thaobh méide nó luacha.
Cumhacht chun treoracha a iarraidh ar an Ard-Chúirt.
51.—(1) I ngach cás is sárú nó sárú barúlach ar aon iontaobhas chun críocha carthanúla nó aon uair a mheasfar gur gá treoir nó ordú ón Ard-Chúirt chun aon iontaobhas chun críocha carthanúla a riaradh, féadfaidh an Bord, nó, le toiliú an Ard-Aighne, féadfaidh duine ar bith, iarratas a dhéanamh chun na Cúirte ar cibé faoiseamh is gá de réir nádúir an cháis agus féadfaidh an Chúirt cibé ordú is oiriúnach leis an gCúirt a dhéanamh ina thaobh sin.
(2) I gcás aon imthosc dá sonraítear i bhfo-alt (1) d'alt 47 a bheith ann maidir bronntanas carthanúil is ábhar d'iarratas faoin alt seo, féadfaidh an Chúirt, más oiriúnach léi, ar an iarratas sin a fháil, scéim a chumadh chun an mhaoin a bheidh ar áireamh sa bhronntanas carthanúil a chur chun feidhme cy-près.
Dualgas ar sheiceadóirí, mura mbeidh siad díolmhaithe faoi alt 20, fógráin i dtaobh réadtiomnaithe agus tiomnachtaí carthanúla a fhoilsiú.
52.—(1) Aon uair a bheidh réadtiomnú carthanúil nó tiomnacht charthanúil in aon uacht, ansin an duine (dá ngairtear an t-ionadaí pearsanta san alt seo) dá ndeonófar probháid na huachta nó litreacha riaracháin maille leis an uacht, déanfaidh sé, faoi réir na díolúine a dheonóidh an Bord faoi alt 20, na nithe seo a leanas—
(a) laistigh de thrí mhí tar éis probháid nó litreacha riaracháin a dheonú, na sonraí seo a leanas a fhoilsiú, uair amháin san Iris Oifigiúil agus trí huaire go comhleanúnach i nuachtán éigin a léitear sa cheantar a n-ordaítear an réadtiomnú nó an tiomnacht nó an chuid is mó de sin a chaitheamh nó a chur chun feidhme ann nó, mura mbeidh aon treoir ann maidir le haon cheantar den sórt sin, i nuachtán maidine éigin a fhoilsítear gach lá seachtaine i mBaile Atha Cliath—
(i) an réadtiomnú nó an tiomnacht atá san uacht,
(ii) ainm an tiomnóra,
(iii) dáta na huachta,
(iv) ainm an duine dar tugadh an réadtiomnú nó an tiomnacht,
(v) ainm an duine a cheap an tiomnóir chun an réadtiomnú nó an tiomnacht a bhainistí agus a stiúradh; agus
(b) laistigh de cheithre mhí tar éis probháid nó litreacha riaracháin a dheonú, trí pháipéar (seachas an Iris Oifigiúil) ina mbeidh na foilseacháin chomhleanúnacha de bhun mhír (a) a sheachadadh in oifig an Bhoird nó a chur chucu leis an bpost.
(2) Má mhainníonn ionadaí pearsanta déanamh de réir mhír (a) d'fho-alt (1), beidh sé ciontach i gcion agus ar a chiontú go hachomair dlífear fíneáil nach mó ná caoga punt a chur air.
(3) Má mhainníonn ionadaí pearsanta déanamh de réir mhír (b) d'fho-alt (1), beidh sé ciontach i gcion agus ar a chiontú go hachomhair dlífear fíneáil nach mó ná deich bpunt a chur air.
(4) Féadfaidh an Bord inchúiseamh a dhéanamh maidir le cion faoi fho-alt (2) nó (3).
(5) Is amach as an eastát nó as na cistí a réadtiomnaíodh nó a tiomnaíodh don charthanas a bheidh i gceist a íocfaidh ionadaí pearsanta na costais faoina rachaidh sé ag déanamh de réir fho-alt (1) dó.

53.—(1) Sula dtionscnóidh aon duine seachas an tArd-Aighne aon imeachtaí dlíthiúla (ach amháin imeachtaí dlíthiúla a thionscnófar le húdarás nó faoi threoir ón mBord faoi alt 25) maidir le haon charthanas, cuirfidh an duine sin fógra i scríbhinn chun an Bhoird i dtaobh na n-imeachtaí dlíthiúla a bheidh beartaithe, maraon le haon eolas is gá nó is cuí nó a iarrfaidh an Bord ó am go ham, chun a mhíniú cad é an saghas imeachtaí iad agus cad iad na cúspóirí atá leo.
(2) Ní thabharfaidh aon ní i bhfo-alt (1) go mbeidh aon ordú in aon imeachtaí nach ndearnadh páirtithe iontu den Bhord ina cheangal agus ina ordú críochnaitheach i gcoinne an Bhoird.
Féadfaidh iontaobhaithe carthanais gníomhais, etc., a thaisceadh i nglacadán a chuirfidh an Bord ar fáil.
54.—Is dleathach d'iontaobhaithe nó do dhaoine eile a mbeidh ina gcoimeád acu aon ghníomhais nó munúintí i leith nó i dtaobh carthanas iad a thaisceadh lena slánchoimeád i nglacadán a chuirfidh an Bord ar fáil, faoi réir aon rialachán a dhéanfaidh an Bord faoin Acht seo.

55.—(1) San alt seo, ciallaíonn “diúscairt”, maidir le maoin, aon díol, malartú, idir-roinnt, morgáistiú, léasadh nó diúscairt eile a dhéanfar ar an maoin.
(2) I gcás cumhacht a bheith ag iontaobhaithe carthanais cinneadh ar dhiúscairt ar aon mhaoin de chuid an charthanais, beidh ag tromlach dhá thrian de na hiontaobhaithe i dtionól dá gcomhlacht a bheidh comhdhéanta go cuí cumhacht dhlíthiúil, thar a gceann féin agus thar ceann a gcomhiontaobhaithe, na gníomhartha, na gníomhais, na conarthaí agus na forchinntithe sin uile a dhéanamh, a shnaidhmeadh agus a fhorghníomhú, is gá chun éifeacht dlí a thabhairt d'aon diúscairt ar an maoin, agus beidh an éifeacht dhlíthiúil ag na gníomhartha, na gníomhais, na conarthaí nó na forchinntithe sin a bheadh acu dá mbeidís, faoi seach, arna ndéanamh, arna snaidhmeadh, nó arna bhforghníomhú ag na hiontaobhaithe gníomhacha uile de thuras na huaire.

56.—I gcás ina ndearnadh, roimh thosach feidhme an Achta seo, comhlacht corpraithe a cheapadh mar iontaobhaí aonair d'iontaobhas carthanúil, ansin, i gcaitheamh na tréimhse sin roimh an tosach feidhme sin agus dá éis a bhí an comhlacht corpraithe sin agus a leanfaidh sé de bheith i seilbh oifige—
(a) measfar gur foráladh agus gur ceanglaíodh i dtéarmaí an iontaobhais agus go bhforáiltear agus go gceanglaítear iontu aon iontaobhaí amháin a cheapadh, agus
(b) measfar nach ndearnadh ach aon iontaobhaí amháin don iontaobhas a cheapadh i gcéadóir faoi théarmaí an iontaobhais.

58.—Tabharfaidh an tOifigeach Probháide, idir an lú lá d'Iúil agus an lú lá de Shamhain gach bhliain, tuairisceán don Bhord ina mbeidh—
(a) sonraí faoi gach réadtiomnú carthanúil nó tiomnacht charthanúil in aon uacht a taifeadadh san Oifig Phrobháide nó ar cuireadh cóip di ar aghaidh chuige ó oifig aon duine de na cláraitheoirí probháide ceantair atá sa Stát nó ó aon fhoinse eile i rith na bliana roimh an lú lá sin d'Iúil,

CHARITIES ACT, 1961.
PART I.
Preliminary and General.
Short title and commencement.
1.—(1) This Act may be cited as the Charities Act, 1961.
(2) This Act shall come into operation on the 1st day of July, 1961.
Interpretation.
2.—In this Act—
“the Board” means the Commissioners of Charitable Donations and Bequests for Ireland;
“charitable gift” means a gift for charitable purposes;
“fund” includes any interest, present or future, in any stock, shares, annuities or other securities or choses in action, and also includes money;
“gift” means a donation, devise or bequest;
“the Secretary” means the Secretary of the Board;
references to the trustee of a charity shall be construed as including references to a person acting in the administration or management of a charity;
“will” includes codicil.
Expenses.
3.—All expenses incurred by the Board in the administration of this Act and not otherwise provided for shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Repeals.
4.—(1) The enactments mentioned in the Schedule are hereby repealed to the extent specified in the third column.
(2) Every scheme or order made, notice, decision, opinion or advice given or thing done by the Board under a repealed enactment shall remain valid notwithstanding such repeal as if made, given or done under this Act.
(3) Subsection (2) is without prejudice to section 21 of the Interpretation Act, 1937.
PART II.
The Commissioners of Charitable Donations and Bequests for Ireland and their Jurisdiction.
Chapter I.
The Board.
Continuance of Board.
5.—The Commissioners of Charitable Donations and Bequests for Ireland (in this Act referred to as the Board) shall continue in being, notwithstanding the repeals effected by this Act, as a body corporate with perpetual succession and a common seal and may in their corporate name sue and be sued.
Power to hold land.
6.—The Board shall in their corporate name have and be deemed always to have had power to acquire, hold and dispose of land.
Constitution.
7.—The Board shall consist of not more than eleven members.
Membership.
8.—(1) The Government shall appoint persons to be members of the Board from time to time as occasion requires.
(2) Each member of the Board shall hold office until his death, resignation or removal from office.
(3) The Government may remove from office any member of the Board.
(4) The appointment or removal of a member of the Board shall be published in Iris Oifigiúil.
(5) As soon as may be after the commencement of this Act, and thereafter as occasion requires, the Board shall appoint a member of the Board to be the Chairman of the Board and the Chairman shall hold office for such period as the Board determine when appointing him.
(6) The persons who are members of the Board immediately before the commencement of this Act shall continue in office as if appointed under this section.
Procedure.
9.—(1) At a meeting of the Board, if the Chairman of the Board is absent, the senior member in order of appointment or such other member as the Board may select shall be chairman.
(2) A member who continues in office on the commencement of this Act shall take rank according to the date of his original appointment.
(3) Every question at a meeting of the Board shall be determined by a majority of the votes of the members present and voting and, in the case of an equal division of votes, the chairman of the meeting shall have a second or casting vote.
(4) At a meeting of the Board three members shall form a quorum, if due notice of that meeting was given to all the members.
Officers and servants.
10.—(1) The Minister for Justice, with the consent of the Minister for Finance, shall from time to time as occasion requires appoint a secretary of the Board and may, with the like consent, appoint such other officers and such servants as may be necessary for the purposes of this Act.
(2) The Secretary and the other officers and servants of the Board shall hold office on such terms and receive such remuneration as the Minister for Finance determines.
(3) The Secretary and the other officers and servants of the Board holding office immediately before the commencement of this Act shall continue in office as if appointed under this section.
Seal.
11.—(1) The seal of the Board shall be affixed only by order of the Board and its affixation shall be attested by the signatures of two members of the Board or of a member of the Board and the Secretary.
(2) The seal of the Board shall be judicially noticed and every document purporting to be sealed with the seal of the Board and to be attested in accordance with this section shall, unless the contrary is shown, be received in evidence without further proof.
Minutes of proceedings.
12.—(1) The Secretary or some other officer of the Board shall make minutes of the proceedings of the Board at each meeting and shall keep a book (in this section referred to as the Minute Book) in which he shall enter—
(a) a fair copy of those minutes, and
(b) the names of the members present at that meeting.
(2) The minutes of the proceedings at a meeting of the Board, as entered in the Minute Book, shall be read at the next meeting of the Board and, if approved as correct, shall be signed by the chairman of the meeting at which they are so read.
Membership of Board not to disqualify Judge from hearing charity cases.
13.—A Judge of any Court shall not be prevented or disabled by reason solely of his being a member of the Board from hearing and determining any case relating to a charity or any case arising under this Act, but may hear and determine it as if he were not a member of the Board.
Audit of Accounts.
14.—(1) In this section—
“the Minister” means the Minister for Local Government;
“the auditor” means, in relation to an audit under this section, the auditor appointed by the Minister to hold that audit;
“the accounts” means the accounts of the Board.
(2) The accounts shall be made up to the 31st day of December in each year in such form as the Minister may from time to time approve.
(3) The accounts shall once in each year be audited by such auditor of the Minister as the Minister may from time to time appoint.
(4) The following provisions shall apply in relation to an audit under this section—
(a) for the purposes of the audit, the Board shall furnish to the Minister, before the end of the month of June in each year, an abstract of the accounts of the Board in such form as shall be approved by the Minister from time to time;
(b) the auditor shall give to the Secretary six days' notice prior to the holding of the audit at the office of the Board;
(c) the auditor may, by giving notice in that behalf in writing to any person, require that person to attend at the office of the Board at such time as is specified in the notice to give evidence on oath in relation to any matter in question at the audit and to produce any books, deeds, accounts, vouchers or other documents in his possession, custody or control which relate to any such matter, and—
(i) any person to whom a notice has been given under this paragraph who refuses or wilfully neglects to attend in accordance with the notice or who wilfully alters, suppresses, conceals or destroys any document to which the notice relates, or who, having so attended, refuses to give evidence or refuses or wilfully fails to produce any document to which the notice relates shall be guilty of an offence and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds, and
(ii) any person who in giving such evidence on oath wilfully makes a statement which is to his knowledge false or misleading in any material respect shall be guilty of an offence and shall be liable on summary conviction thereof to a fine not exceeding twenty-five pounds or, at the discretion of the Court, to imprisonment for any term not exceeding six months or to both such fine and such imprisonment;
(d) on the completion of the audit, the auditor shall certify the said abstract;
(e) the auditor shall, within fourteen days after certifying the said abstract, send it to the Minister together with a report upon the accounts;
(f) the Minister shall transmit a copy of the auditor's report and the said abstract to the Secretary and shall transmit a copy of the said report to the Minister for Justice.
Report.
15.—(1) The Board shall, once at least in every year and also whenever the Government so require, report to the Government their proceedings under this Act.
(2) A copy of each report made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made.
Restriction on payment by Board of solicitor's costs.
16.—The Board shall not pay any sum to a solicitor employed by them as and for costs or expenses to be defrayed out of moneys provided by the Oireachtas unless the amount thereof has been approved by the Minister for Finance, who shall before approving thereof have particulars of the costs and expenses laid before him.
Indemnity of Board and persons acting under their direction.
17.—No matter or thing done by the Board or by any person acting under their direction shall, if done bona fide in the execution of this Act, render any member of the Board or person acting under their direction personally liable to any proceedings.
Service of notices on Board.
18.—A notice may be served on the Board—
(a) by leaving a copy thereof with the Secretary at the office of the Board, or
(b) by sending a copy thereof by registered post in an envelope addressed to the Board at that office.
Costs of Board to be borne by charity.
19.—Any costs or expenses incurred by the Board in the management or administration or for the preservation or recovery of any property vested in the Board or otherwise in the execution of this Act may be borne by and deducted by the Board from the estate and funds of the charity in respect of which those costs and expenses were incurred.
Chapter II.
Jurisdiction and powers of the Board.
Power to grant exemption from obligation to publish advertisements of charitable devises and bequests.
20.—The Board may, in their discretion, having regard to the amount of any charitable devise or bequest or other special circumstances, exempt any person from the obligation imposed on him by section 52 either wholly or to such extent and upon such terms as they think fit.
Power to advise charity trustees as to administration of trusts.
21.—(1) Where the trustees of a charity apply to the Board for their opinion or advice respecting the charity or the administration thereof or the property thereof or the application of the property or any question or dispute relating thereto or where the executors of a will containing a charitable devise or bequest apply to the Board for their opinion or advice respecting the devise or bequest or the administration thereof or the application thereof or any question or dispute relating thereto, the Board shall consider the application and may, if they think fit, give such opinion or advice as they think expedient.
(2) The opinion or advice of the Board shall be given under the seal of the Board.
(3) Where the Board give their opinion or advice in relation to any matter, a trustee, executor or any other person who during any period (not being a period after the making of an order in relation to the matter by a Court of competent jurisdiction) acts on or in accordance with the opinion or advice shall, in respect of his so acting during that period, be deemed, so far as respects his own responsibility, to have acted in accordance with his trust.
(4) No order made subsequently by a Court shall have any such retrospective effect as to interfere with or impair the indemnity given by this section to a trustee, executor or other person who has acted on or in accordance with such opinion or advice.
(5) This section shall not indemnify a trustee or other person for any act done in accordance with an opinion or advice of the Board, if he has been guilty of fraud, wilful concealment or misrepresentation in obtaining the opinion or advice.
Compromise of claims by or against a charity.
22.—(1) If it appears to the trustees of a charity that any claim against a person in relation to the charity may, with advantage to the charity, or should, in the special circumstances of the case, be compromised, the trustees or that person, with the consent of the trustees, may submit to the Board a statement and proposal for a compromise.
(2) If it appears to the trustees of a charity that any claim by any person against the charity or them may, with advantage to the charity, or should, in the special circumstances of the case, be compromised, the trustees or that person, with the consent of the trustees, may submit to the Board a statement and proposal for a compromise.
(3) Where the Board, after such inquiry as they think necessary, are of opinion that the proposal, with or without modification, is fit and proper and for the benefit of the charity, the Board may make such order in relation to the compromise as they think fit.
(4) If it appears to the Board that any claim by or against them in respect of any property of which they are trustees may, with advantage to the charity, or should, in the special circumstances of the case, be compromised, the Board may compromise the claim.
(5) Where a claim is authorised to be or is compromised under this section, then, upon due performance of the terms and conditions of the compromise, no action shall lie in respect of the claim.
Power to sue for recovery of charitable gifts improperly withheld, concealed, or misapplied.
23.—(1) The Board may, with the previous consent of the Attorney General, sue for the recovery of any charitable gift intended to be applied in the State which is improperly withheld, concealed or misapplied.
(2) The Board shall apply every charitable gift recovered by them under this section to charitable purposes according to the intention of the donor.
(3) The Board may deduct from any charitable gift recovered by them under this section all costs, charges and expenses incurred by them in such recovery.
Recovery of charitable gifts.
24.—Whenever any sum is payable to or for any charitable purposes, the Board or the trustees of the charity, with the consent of the Board, may sue for and recover it, from the person for the time being liable therefor or whose duty it is to pay it, as a simple contract debt in any Court of competent jurisdiction without obtaining the consent of the Attorney General.
Power of Board to authorise or direct institution of legal proceedings in a charity matter.
25.—If it appears to the Board desirable that legal proceedings should be instituted with respect to any charity by any person, other than the Attorney General, the Board may authorise or direct those legal proceedings to be instituted and give such directions in relation thereto as they think proper, and thereupon such legal proceedings may be instituted.
Power of Board to certify certain charity cases to the Attorney General.
26.—(1) If in any case it appears to the Board desirable that legal proceedings with respect to any charity should be instituted by the Attorney General, the Board may certify the case, in writing under the hand of the Secretary, to the Attorney General, with such statements and particulars as may in their opinion be required for the explanation of the case.
(2) Where a case is so certified to the Attorney General, he may, if he thinks fit, institute such legal proceedings as he considers proper in the circumstances of the case.
Power of Board to apply for conduct of administration suits and suits for carrying out trusts of wills in case of delay.
27.—Where—
(a) a person has by will devised or bequeathed any property for charitable purposes, and
(b) a suit for the administration of the assets or carrying out the trusts of the will has been instituted by the personal representative of that person,
the Board (though not parties to the suit) may, on the ground of delay, apply to the Court in which the suit is pending to have the conduct of the suit transferred to the Board, and thereupon the Court, if of opinion that there has been undue or improper delay in proceeding with the suit, may—
(a) give the conduct of the suit to the Board, or
(b) impose on the party having conduct of the suit such terms as it deems necessary for bringing the suit to a speedy termination,
and may make such orders on the application as the Court thinks fit.
Power of Board to apply for transfer of unapplied charity fund in Court.
28.—Where any fund, standing to a separate credit in any matter within the jurisdiction of a Court, for the benefit of a charity or impressed with a charitable trust remains unapplied, the Board may apply to that Court for the transfer to them of the fund, to be held by them upon the charitable trust affecting the fund, and thereupon the Court may make such order as to the transfer of the fund to the Board or otherwise (including the payment of costs out of the fund) as the Court thinks fit.
Power of Board to frame schemes applying property cy-près.
29.—(1) For the purposes of this section—
(a) the value of land shall be taken to be fifty times the rateable valuation thereof,
(b) the value of any periodical payment to which land is subject shall be taken to be fifteen times the annual amount thereof, and
(c) the value of any other periodical payment shall be taken to be twenty times the annual amount thereof.
(2) Whenever—
(a) any of the circumstances specified in subsection (1) of section 47 exist in relation to any charitable gift, and
(b) the charitable gift does not exceed five thousand pounds in value,
the Board, if they think fit, may by order frame a scheme for the application cy-près of the property comprised in the charitable gift,
(3) Where—
(a) a charitable gift of any value has been made for the benefit of poor debtors formerly imprisoned in Ireland, and
(b) any of the circumstances specified in subsection (1) of section 47 exist in relation to the charitable gift,
the Board, if they think fit, may by order frame a scheme for the application cy-près of the property comprised in the charitable gift.
(4) Where—
(a) a scheme for the application of a charitable gift has been framed by order of a Court, and
(b) circumstances exist in relation to the scheme, being circumstances whose existence in relation to a charitable gift would enable the property comprised in the gift to be applied cy-près, and
(c) the charitable gift does not exceed five thousand pounds in value,
the Board, if they think fit, may by order revoke the scheme and frame, in lieu thereof, a new scheme for the application cy-près of the property comprised in the charitable gift.
(5) Where—
(a) a scheme for the application of a charitable gift has been framed by the Board under—
(i) section 6 of the Charitable Donations and Bequests Act (Ireland), 1871,
(ii) the said section 6, as replaced by section 1 of the Charitable Donations and Bequests (Amendment) Act, 1955,
(iii) section 58 of the General Prisons (Ireland) Act, 1877, or
(iv) this section (including this subsection), and
(b) circumstances exist in relation to the scheme, being circumstances whose existence in relation to a charitable gift would enable the property comprised in the gift to be applied cy-près,
the Board, if they think fit, may by order revoke the scheme and frame, in lieu thereof, a new scheme for the application cy-près of the property comprised in the charitable gift.
(6) An order framing a scheme under this section shall not be made until the expiration of one month after public notice of the proposal to make it has been given in such manner as the Board consider most effectual for ensuring publicity thereof and for bringing the proposal to the attention of persons interested.
(7) The notice shall—
(a) contain (so far as conveniently may be) sufficient particulars of the proposed order, and
(b) prescribe a reasonable time within which any objection thereto or suggestions thereon may be made to the Board,
and the Board shall consider any objections and suggestions so made to them and may act in reference thereto as they think expedient.
(8) If the Board modify any proposed order, it shall not be necessary for them to give notice of such modified order in accordance with subsections (6) and (7), unless the Board think further notice desirable.
Alteration of schemes under Educational Endowments (Ireland) Act, 1885.
30.—(1) In this section—
“the Act” means the Educational Endowments (Ireland) Act, 1885;
“scheme” means a scheme framed and approved under the Act;
“the enabling clause” means, in relation to a scheme, the clause (which empowers the Board to alter the scheme) inserted in the scheme in exercise of the powers conferred by section 18 of the Act;
references to a scheme shall, where the scheme has been altered under the enabling clause, be construed as references to the scheme as so altered.
(2) For the avoidance of doubt, it is hereby declared that, subject to subsection (3),—
(a) the power of altering a scheme in any matter or manner conferred on the Board by the enabling clause includes power to make in the scheme all such alterations as may be requested by the person or persons upon whose application the Board are, under the enabling clause, empowered to make alterations in that matter or manner;
(b) the alterations in the scheme may include—
(i) provision for any of the matters mentioned in section 6 of the Act, and
(ii) where the endowment consists in whole or in part of school premises, provisions authorising the sale of the premises and the application of the moneys arising therefrom for any purpose which in the opinion of the Board is in furtherance of education;
(c) any alterations so made shall be deemed not to be contrary to anything contained in the Act.
(3) The Board shall not under the enabling clause of a scheme so alter the scheme that any endowment applicable under the scheme would become applicable for any purposes other than such as are, in the opinion of the Board, in furtherance of education.
(4) Any alterations made in a scheme before the commencement of this Act in purported exercise of the powers conferred by the enabling clause shall, if made at the request of the person or persons upon whose application the Board are under the enabling clause empowered to make alterations, be deemed to have been duly made.
(5) Alterations of a scheme under the enabling clause shall, unless the Board are of opinion that the alterations are of a formal or minor nature, not be made until the expiration of one month after public notice of the proposal to make the alterations has been given in such manner as the Board consider most effectual for ensuring publicity thereof and for bringing the proposal to the attention of persons interested.
(6) The notice shall—
(a) contain (so far as conveniently may be) sufficient particulars of the proposed alterations, and
(b) prescribe a reasonable time within which any objection thereto or suggestions thereon may be made to the Board,
and the Board shall consider any objections and suggestions so made to them and may, subject to subsection (7), act in reference thereto as they think expedient.
(7) The Board shall not, as the result of any objections or suggestions made to them, modify the proposed alterations of a scheme except with the consent of the person or persons upon whose application the Board are under the enabling clause empowered to make alterations of the scheme.
(8) If the Board modify any proposed alterations, it shall not be necessary to give notice of such modified alterations in accordance with subsections (5) and (6), unless the Board think further notice desirable.
Acceptance by Board of gift for charitable purposes.
31.—(1) In this section “land” includes any periodical payment to which land is subject.
(2) The Board may, if they think fit, accept a gift of any land or fund in trust for any charitable purpose.
(3) (a) Subject to paragraphs (b) and (c), any person in whom any land or fund is vested in trust for any charitable purpose may, with the previous consent in writing of the Board, transfer all or any part thereof to the Board to be held by them for that purpose.
(b) Where a charitable gift was originally vested in more than one trustee and not more than six trustees, a transfer shall not be made under this subsection so long as there are fewer trustees than the original number appointed to act in the trusts or execution of the charitable gift or without the consent of all the trustees having first been signified in writing signed by them, such writing to be deposited with the Board.
(c) Where a charitable gift was originally vested in more than six trustees, a transfer shall not be made under this subsection without the consent of two-thirds of the trustees (not being less than six in number) having been first signified in writing signed by them, such writing to be deposited with the Board.
(4) Any land or fund vested in the Board in accordance with this section shall thenceforth be held by the Board upon and for the trusts and purposes upon and for which the land or fund was so vested or such of those trusts and purposes as are for the time being subsisting or capable of taking effect.
(5) The Board may by order from time to time nominate such persons as they think proper to administer, distribute or apply the land or fund or the profits or income thereof under their directions and from time to time by order remove any such persons and nominate! others in their place.
Investment of charity fund.
32.—(1) The Board may, in their discretion, invest any fund held by them upon any charitable trust in such manner as they think proper.
(2) The Board may, if they think fit, on the application of the trustees of any fund held upon any charitable trust, by order confer upon the trustees, either generally or in any particular instance, power to invest the fund in such manner, on such terms and subject to such conditions as the Board may think proper.
(3) (a) Notwithstanding anything contained in any enactment (including this Act) or rule of law, a Court or the Board shall not invest or order, empower, consent to or approve of the investment of any fund held upon any charitable trust in manner other than the following, that is to say :
(i) in investments authorised by the terms of the trust or for the time being authorised by law as investments for trust funds,
(ii) in any debentures, debenture stock or guaranteed or preference or ordinary stock or shares of any industrial or commercial company incorporated in the State or maintaining in the State at the time of the proposed investment a register of its share-holders resident in the State, provided the ordinary stock or shares of any such company are quoted on the Dublin Stock Exchange or the Cork Stock Exchange,
(iii) in the purchase of freehold or leasehold land in the State.
(b) Notwithstanding anything contained in paragraph (a), the whole or any part of a fund held upon any charitable trust which immediately before the commencement of this Act stood invested in a manner other than that specified in paragraph (a) may continue to stand so invested and, where the investment is in any securities to the holders of which other securities of the same kind are offered on advantageous terms, the fund may, whether at the time in a state of investment or not, be invested, to the extent of the offer made in respect of the fund's holding of such securities, in the other securities.
(c) A fund held upon any charitable trust shall not by virtue of paragraph (a) be invested in any manner expressly forbidden by the terms of the trust.
(d) A Court or the Board may from time to time vary or order, empower, consent to or approve of the variation of an investment made in the manner specified in paragraph (a).
(e) This subsection does not restrict the power of the Board to grant authorisations in relation to land under the subsequent provisions of this Part.
(4) Subsection (2) does not apply to a fund to which section 33 for the time being applies.
Leave to invest charity fund held subject to prior limited interest.
33.—Where—
(1) any fund is held upon trust, after the determination of or subject to any prior life interest or other limited interest, for any charitable purposes, and
(2) the trustees desire to invest the fund, or vary the investment of the fund by investing it, in investments specified in subparagraph (ii) or (iii) of paragraph (a) of subsection (3) of section 32 but not authorised by the terms of the trust and not for the time being authorised by law as investments for trust funds, the following provisions shall have effect—
(a) the trustees shall, before doing so, give notice in writing to the Board of their proposal;
(b) the Board shall consider the proposal and inform the trustees in writing whether or not they object to the proposal;
(c) if the Board inform the trustees that they object to the proposal, the trustees may apply to the High Court for leave to make or vary the investment and shall give notice of the application to the Board and to such other persons as the Court may direct, and the Court may make such, order thereon as the Court thinks fit;
(d) if the Board inform the trustees that they do not object to the proposal, it shall be lawful for the trustees to make or vary the investment in the manner specified in the proposal.
Power of Board to authorise or make sale, exchange or surrender lease of charity land.
34.—(1) In this section “disposition”, in relation to land, means a disposition of the land by—
(a) selling it, or
(b) exchanging it for other land, or
(c) surrendering a lease of it.
(2) Where an application is made to the Board by the trustees of any charity comprising land representing that a specified disposition of the land can be effected on terms which would be advantageous to the charity, the Board may, if they think fit, inquire into the circumstances, and if, after inquiry, they are satisfied that the proposed disposition would be advantageous to the charity, they may authorise the applicants to make that disposition and give such directions in relation thereto and for securing the due investment of the money arising therefrom, for the benefit of the charity, as they think fit.
(3) The Board may, if they think proper, authorise, with retrospective effect, a specific disposition made without such authority.
(4) If it appears to the Board in respect of any charity comprising land of which they are trustees that any disposition of the land would be beneficial to the charity, they may make that disposition of the land and the money arising therefrom shall be invested for the benefit of the charity in such manner as the Board think fit.
Power of Board to authorise sale of periodical payment belonging to a charity and payable out of land.
35.—(1) Where—
(a) any land is subject to a periodical payment payable to or for the benefit of a charity or applicable to charitable purposes, and
(b) an application is made to the Board by the trustees of the charity representing that a sale of the periodical payment to the owner of the land would be advantageous to the charity,
the Board may, if they think fit, inquire into the circumstances, and if, after inquiry, they are satisfied that the proposed sale can be effected on terms which would be advantageous to the charity, they may authorise the applicants to sell the periodical payment to the owner of the land on such terms and conditions as they deem beneficial to the charity and give such directions for securing the due investment of the money arising from such sale for the benefit of the charity or for securing the due application thereof to such charitable purposes as they think fit.
(2) If it appears to the Board in respect of any charity comprising land of which they are trustees to be advantageous to the charity to make a sale to the owner of the land of any periodical payment charged upon the land and payable to or for the benefit of the charity or applicable to charitable purposes, the Board may sell the periodical payment to the said owner upon such terms and conditions as they deem beneficial to the charity, and give such directions for securing the due investment of the money arising from such sale for the benefit of the charity or for securing the due application thereof to such charitable purposes as they think fit.
Power of Board to authorise purchase of periodical payment payable out of charity land.
36.—(1) Where—
(a) any land belonging to a charity is subject to a periodical payment, and
(b) an application is made to the Board by the trustees of the charity representing that a purchase by the applicants of the periodical payment would be advantageous to the charity,
the Board may, if they think fit, inquire into the circumstances, and if, after inquiry, they are satisfied that the proposed purchase would be advantageous to the charity, they may authorise the trustees to purchase the periodical payment on such terms and conditions as the Board deem beneficial to the charity.
(2) Where—
(a) a charity comprising land of which the Board are trustees is subject to a periodical payment, and
(b) the Board are of opinion that the purchase of the periodical payment would be advantageous to the charity,
the Board may purchase, out of any funds belonging to the charity, the periodical payment.
Power of Board or trustees of charity, with authority of Board, to grant building, etc., leases, do repairs, etc., and raise money for those purposes.
37.—(1) In this section “act to which this section applies” means, in relation to a charity comprising land, any of the following—
(a) the letting of the land on building, repairing, improving or other leases, or on leases for working any mine,
(b) the digging or raising of stone, clay, gravel or other minerals on the land,
(c) the cutting of timber on the land,
(d) the forming or laying out of any new road or street through the land,
(e) the making of drains or sewers through the land,
(f) the erection of any new building on the land,
(g) the repair, alteration, rebuilding or total removal of any existing building on the land,
(h) the making of any other improvements or alterations in the state or condition of the land.
(2) If it appears to the trustees of any charity comprising land that the doing of any act to which this section applies would be for the benefit of the charity, they may lay before the Board a statement and proposal in relation to the doing of that act, and thereupon—
(a) the Board, if they think that the doing of the act to which the statement and proposal relate (with or without modifications or alterations) would be beneficial to the charity, may make such order for or in relation to the doing of the act and any circumstances connected therewith, as they think fit, though the act is not authorised or permitted by the trust;
(b) the Board may by that order authorise the application of any moneys belonging to the charity for the act, and, if necessary, may authorise the trustees to raise any sum of money by mortgage of all or any part of the land of the charity.
(3) If it appears to the Board in respect of any charity comprising land of which they are trustees that the doing of any act to which this section applies would be for the benefit of the charity—
(a) they may do that act, and
(b) they may for that purpose, if necessary, raise any sum of money by mortgage of all or any part of the land belonging to the charity.
(4) Every mortgage made under subsection (2) or (3) shall provide for—
(a) the payment of the principal money by annual instalments,
(b) the redemption and reconveyance of the mortgaged land within a period of not more than thirty years.
(5) The Board may, if they think proper, authorise, with retrospective effect, any act to which this section applies done without such authority.
Investment of proceeds of sale, etc., in name of Board.
38.—The Board may, in relation to money arising from any transaction to which, section 34, 35 or 37 applies, direct the trustees to pay the money to the Board and, in that case, the money shall be invested by the Board for the benefit of the charity in such manner as the Board think fit.
Power of Board or trustees of charity to purchase sites for buildings from owners under disability according to Lands Clauses Consolidation Act, 1845.
39.—(1) Where—
(a) any land is required for the erection or construction of any house or building, with or without garden, playground, or other appurtenances for the purpose of any charity, and
(b) the Board or the trustees of the charity are authorised to purchase the land, but by reason of the disability of any person having an estate or interest therein or of any defect of title, a valid and perfect assurance of that land cannot be made to the Board or the trustees in the ordinary manner,
the Board or the trustees (with the consent of the Board, certified under the hand of the Secretary), as the case may be, may take and purchase the land according to the provisions of the Lands Clauses Consolidation Act, 1845.
(2) For the purposes of subsection (1), the following clauses of the Lands Clauses Consolidation Act, 1845, namely—
(a) the clauses with respect to the purchase of lands by agreement,
(b) the clauses with respect to the purchase money or compensation coming to parties having limited interests, or prevented from treating, or not making title,
(c) the clauses with respect to conveyances of land,
shall be incorporated in this Act subject to the following modifications—
(i) “the special Act” shall mean this Act,
(ii) “the promoters of the undertaking” shall mean the Board or the trustees of the charity in question (as the case may be).
Validity of sales, etc., authorised by Board.
40.—All sales, leases, exchanges and other transactions authorised by the Board under this Act shall have the like effect and validity as if they had been authorised by the express terms of the trust affecting the charity.
Power of Board to give effectual receipt of payments for charitable purposes where no person available or competent to do so.
41.—Where—
(a) a person is liable to make any payment to or for any charitable purposes, and
(b) difficulty arises in making the payment by reason of the death, absence, incapacity or non-existence of a person competent to give an effectual discharge,
the Board may, if they think fit, accept the payment (to be applied by them according to the trusts affecting it) and the receipt of the Board shall be an effectual discharge to the person making the payment.
Power of Board to require copies of public documents relating to charities and to examine and search records.
42.—(1) The Board may request any person having the custody of any documents relating to any charity to furnish such copies or extracts of or from those documents as the Board may specify and that person shall comply with the request.
(2) The Secretary or any other officer of the Board authorised in that behalf by the Board may, without payment, examine and search the registers and records of any Court, and any public registry and office of records and take copies of and extracts from any document recorded or registered or deposited therein.
Power of Board to appoint new trustees of charity.
43.—(1) Where for any reason the appointment of a new trustee or new trustees of any charity appears to the Board to be necessary, the Board—
(a) on the application of the trustee or trustees of the charity, or
(b) if there are no trustees of the charity, or they cannot be found, on the application of any person having an interest, or
(c) in any case, of their own motion,
may make—
(i) an order under the seal of the Board appointing a new trustee or new trustees of the charity either in substitution for or in addition to any existing trustee or trustees, or although there is no existing trustee, and
(ii) an order under the seal of the Board vesting the property of the charity for such estate as the Board may direct in the persons who on the appointment are the trustees, and the order shall have the same effect as if the persons who before the appointment were the trustees (if any) had duly executed all proper conveyances of the land for such estate as the Board direct, or if there is no such person, or no such person of full capacity, then as if such person had existed and been of full capacity and had duly executed all proper conveyances of the land for such estate as the Board direct.
(2) Every trustee of a charity appointed under this section shall, as well before as after the property of the charity becomes by law vested in him, have the same powers, authorities and discretions, and may in all respects act as if he had been originally appointed a trustee by the instrument (if any) creating the trust.
(3) The Board may order the costs and expenses of and incidental to any application or order under this section to be paid or raised out of the property of the charity or the income thereof or to be borne and paid in such manner and by such persons as the Board may consider just.
(4) The Board shall—
(a) not less than one month before the date on which they propose to make an order under this section, give public notice of the proposed order, and
(b) on the day immediately following the date of the making of the order, give public notice of the making, and of the date of the making, of the order,
in such manner as the Board consider most effectual for ensuring publicity for the proposal or order, as the case may be; and for bringing it to the attention of persons interested.
(5) (a) Any person having an interest may, within twenty-one days after the date of the making of an order under this section, appeal to the High Court against the making of the order and on such appeal the High Court may make such order confirming, annulling or varying the order under this section and such order as to costs as it thinks fit.
(b) The Board and the trustees (if any) of the charity shall be entitled to be represented and heard on any appeal under this subsection.
(c) An order under this section shall, if no appeal is brought against it, become operative on the expiration of the period of twenty-one days mentioned in paragraph (a) of this subsection, and an order against which an appeal is brought shall become operative—
(i) if and so far as it is confirmed by the Court, from the date of the final determination of the appeal, and
(ii) if the appeal is withdrawn, from the date of the withdrawal.
(6) An order under this section shall not operate further or otherwise as a discharge to any former or continuing trustee than an appointment of new trustees under any power for that purpose contained in any instrument would have operated.
(7) Nothing in this section shall give power to appoint an executor or administrator.
(8) Where a body corporate is appointed by order under this section to be, or a body corporate appointed under this section becomes, sole trustee of a charitable trust the terms of which provide for or require the appointment of more than one trustee, then during such time as the body corporate holds the office of trustee of the trust—
(a) the terms of the trust shall be deemed to provide for or require the appointment of one trustee only, and
(b) one trustee only shall be deemed to have been originally appointed under the terms of the trust.
(9) Where any land of which the ownership is registered under the Registration of Title Acts, 1891 and 1942, becomes vested, by order under this section, in any person or persons, the registering authority under those Acts shall, upon production of a copy under the seal of the Board of the order and upon payment of the appropriate fee, register that person or those persons in the appropriate register maintained under those Acts as owner (within the meaning of those Acts) of the land.
Taxation of solicitor's costs.
44.—The Board may order the bill of costs claimed by a solicitor on account of business conducted or transacted by him on behalf of a charity, or the trustees thereof, to be taxed and ascertained by a Taxing Master, and where costs which are the subject of an order under this section will fall to be paid out of a fund, the Taxing Master shall have regard to that fact in taxing and ascertaining them.
PART III.
Miscellaneous Provisions in Relation to Charities.
Gifts for the advancement of religion.
45.—(1) In determining whether or not a gift for the purpose of the advancement of religion is a valid charitable gift it shall be conclusively presumed that the purpose includes and will occasion public benefit.
(2) For the avoidance of the difficulties which arise in giving effect to the intentions of donors of certain gifts for the purpose of the advancement of religion and in order not to frustrate those intentions and notwithstanding that certain gifts for the purpose aforesaid, including gifts for the celebration of Masses, whether in public or in private, are valid charitable gifts, it is hereby enacted that a valid charitable gift for the purpose of the advancement of religion shall have effect and, as respects its having effect, shall be construed in accordance with the laws, canons, ordinances and tenets of the religion concerned.
(3) The foregoing subsections shall not apply in the case of a gift which takes effect before the 1st day of January, 1960.
Schemes to establish common investment funds.
46.—(1) The High Court or the Board may by order make and bring into effect schemes for the establishment of common investment funds (in this section referred to as schemes) upon terms which provide—
(a) for property transferred to the fund by or on behalf of a charity participating in the scheme to be invested under the control of trustees appointed to manage the fund; and
(b) for the participating charities to be entitled (subject to the provisions of the scheme) to the capital and income of the fund in shares determined by reference to the amount or value of the property transferred to it by or on behalf of each of them and to the value of the fund at the time of the transfers.
(2) The High Court or the Board may make a scheme on the application of any two or more charities: provided that, in the case of any two or more charities of which the Board are trustees, the Board may make a scheme of their own motion.
(3) A scheme may be made in terms admitting any charity to participate, or restricting the right to participate in any manner.
(4) A scheme may make provision for, and for all matters connected with, the establishment, investment, management and winding up of the common investment fund, and may in particular include provision—
(a) for remunerating persons appointed trustees to hold or manage the fund or any part of it, with or without provision authorising a person to receive the remuneration notwithstanding that he is also a charity trustee of or trustee for a participating charity;
(b) for restricting the size of the fund, and for regulating as to time, amount or otherwise the right to transfer property to or withdraw it from the fund, and for enabling sums to be advanced out of the fund by way of loan to a participating charity pending the withdrawal of property from the fund by the charity;
(c) for enabling income to be withheld from distribution with a view to avoiding fluctuations in the amounts distributed, and generally for regulating distributions of income;
(d) for enabling moneys to be borrowed temporarily for the purpose of meeting payments to be made out of the fund;
(e) for enabling questions arising under the scheme as to the right of a charity to participate, or as to the rights of participating charities, or as to any other matter, to be conclusively determined by the decision of the trustees managing the fund or in any other manner;
(f) for regulating the accounts and information to be supplied to participating charities.
(5) A scheme, in addition to the provision for property to be transferred to the fund on the basis that the charity shall be entitled to a share in the capital and income of the fund, may include provision for enabling sums to be deposited by or on behalf of a charity on the basis that (subject to the provisions of the scheme) the charity shall be entitled to repayment of the sums deposited and to interest thereon at a rate determined by or under the scheme; and where a scheme makes any such provision it shall also provide for excluding from the amount of capital and income to be shared between charities participating otherwise than by way of deposit such amounts (not exceeding the amounts properly attributable to the making of deposits) as are from time to time reasonably required in respect of the liabilities of the fund for the repayment of deposits and for the interest on deposits, including amounts required by way of reserve.
(6) Except in so far as a scheme provides to the contrary, the rights under it of a participating charity shall not be capable of being assigned or charged, nor shall any trustee or other person concerned in the management of the common investment fund established by the scheme be required or entitled to take account of any trust or other equity affecting a participating charity or its property or rights.
(7) Property held upon any charitable trust may be transferred to common investment funds established under this section unless the power to do so is excluded by a provision specifically referring to schemes in the terms of the trust.
(8) A common investment fund shall be deemed for all purposes to be a charity.
(9) The High Court may by order amend or vary the terms of, or wind up, a scheme and the Board may by order amend or vary the terms of, or wind up, a scheme made by order of the Board.
Occasions for applying property cy-près.
47.—(1) Subject to subsection (2), the circumstances in which the original purposes of a charitable gift may be altered to allow the property given or part of it to be applied cy-près shall be as follows:—
(a) where the original purposes, in whole or in part—
(i) have been as far as may be fulfilled; or
(ii) cannot be carried out, or cannot be carried out according to the directions given and to the spirit of the gift; or
(b) where the original purposes provide a use for part only of the property available by virtue of the gift; or
(c) where the property available by virtue of the gift and other property applicable for similar purposes can be more effectively used in conjunction, and to that end can suitably, regard being had to the spirit of the gift, be made applicable to common purposes; or
(d) where the original purposes were laid down by reference to an area which then was but has since ceased to be a unit for some other purpose, or by reference to a class of persons or to an area which has for any reason since ceased, either to be suitable, regard being had to the spirit of the gift, or to be practical in administering the gift; or
(e) where the original purposes, in whole or in part, have, since they were laid down—
(i) been adequately provided for by other means; or
(ii) ceased, as being useless or harmful to the community or for other reasons, to be in law charitable; or
(iii) ceased in any other way to provide a suitable and effective method of using the property available by virtue of the gift, regard being had to the spirit of the gift.
(2) Subsection (1) shall not affect the conditions which must be satisfied in order that property given for charitable purposes may be applied cy-près, except in so far as those conditions require a failure of the original purposes.
(3) References in the foregoing subsections to the original purposes of a gift shall be construed, where the application of the property given has been altered or regulated by a scheme or otherwise, as referring to the purposes for which the property is for the time being applicable.
(4) It is hereby declared that a trust for charitable purposes places a trustee under a duty, where the case permits and requires the property or some part of it to be applied cy-près, to secure its effective use for charity by taking steps to enable it to be so applied.
(5) This section shall apply to property given for charitable purposes, notwithstanding that it was so given before the commencement of this Act.
Application cy-près of gifts of donors unknown or disclaiming.
48.—(1) Property given for specific charitable or non-charitable purposes which fail shall be applicable cy-près by a Court of competent jurisdiction as if given for charitable purposes generally, where it belongs—
(a) to a donor who, after such advertisements and inquiries as are reasonable, cannot be identified or cannot be found; or
(b) to a donor who has executed a written disclaimer of his right to have the property returned,
but in applying cy-près property given for specific non-charitable purposes regard shall be had to the wishes of the trustees or other persons in charge of the property.
(2) For the purposes of this section property shall be conclusively presumed (without any advertisement or inquiry) to belong to donors who cannot be identified, in so far as it consists—
(a) of the proceeds of cash collections made by means of collecting boxes or by other means not adapted for distinguishing one gift from another; or
(b) of the proceeds of any lottery, competition, entertainment, sale or similar money-raising activity, after allowing for property given to provide prizes or articles for sale or otherwise to enable the activity to be undertaken.
(3) A Court of competent jurisdiction may by order direct that property not falling within subsection (2) shall for the purposes of this section be treated (without any advertisement or inquiry) as belonging to donors who cannot be identified, where it appears to the Court either—
(a) that it would be unreasonable, having regard to the amounts likely to be returned to the donors, to incur expense with a view to returning the property; or
(b) that it would be unreasonable, having regard to the nature, circumstances and amount of the gifts, and to the lapse of time since the gifts were made, for the donors to expect the property to be returned.
(4) Where property is applied cy-près by virtue of this section, the donor shall be deemed to have parted with all his interest at the time when the gift was made; but where property is so applied as belonging to donors who cannot be identified or cannot be found, and is not so applied by virtue of subsection (2) or (3)—
(a) the scheme shall specify the total amount of that property; and
(b) the donor of any part of that amount shall be entitled, if he makes a claim not later than twelve months after the date on which the scheme is made, to recover from the charity for which the property is applied a sum equal to that part, less any expenses properly incurred by the charity trustees after that date in connection with claims relating to his gift; and
(c) the scheme may include directions as to the provision to be made for meeting any such claim.
(5) For the purposes of this section, purposes shall be deemed to fail where any difficulty in applying property to those purposes makes that property, or, in the case of property to be applied for charitable purposes, the part not applicable cy-près under section 47, available to be returned to the donors.
(6) In this section, except in so far as the context otherwise requires, references to a donor include references to persons claiming through or under the original donor, and references to property given include references to the property for the time being representing the property originally given or property derived from it.
(7) (a) The powers conferred by this section on a Court of competent jurisdiction in relation to property given for specific charitable purposes may, where the property does not exceed one thousand pounds in value, be exercised by the Board, and, for the purposes of such exercise, references in the preceding subsections of this section to a Court of competent jurisdiction shall be construed as including references to the Board.
(b) For the purposes of paragraph (a)—
(i) the value of land shall be taken to be fifty times the rateable valuation thereof,
(ii) the value of any periodical payment to which land is subject shall be taken to be fifteen times the annual amount thereof, and
(iii) the value of any other periodical payment shall be taken to be twenty times the annual amount thereof.
(8) This section shall apply to property given for charitable or non-charitable purposes, notwithstanding that it was so given before the commencement of this Act.
Construction of gifts for mixed purposes.
49.—(1) Where any of the purposes of a gift includes or could be deemed to include both charitable and non-charitable objects, its terms shall be so construed and given effect to as to exclude the non-charitable objects and the purpose shall, accordingly, be treated as charitable.
(2) Subsection (1) shall not apply where—
(a) the gift takes effect before the 1st day of January, 1960, or
(b) (i) the terms of the gift make, or provide for the making of, an apportionment between the charitable and the non-charitable objects, and
(ii) the non-charitable objects are identifiable from an express or implied description.
(3) This section shall not, by its operation on any gift as respects the period from the 1st day of January, 1960, to the 24th day of September, 1960, entitle any person to reclaim any tax or duty paid or borne during that period, nor (save as respects tax or duty) require the objects declared by the gift to be treated as having been charitable so as to invalidate anything done or any determination given during that period.
Gifts for graves and memorials.
50.—(1) Every gift made after the commencement of this Act for the provision, maintenance or improvement of a tomb, vault or grave or of a tombstone or any other memorial to a deceased person or deceased persons which would not otherwise be charitable shall, to the extent provided by this section, be a charitable gift.
(2) Such a gift shall be charitable so far as it does not exceed—
(a) in the case of a gift of income only, sixty pounds a year,
(b) in any other case, one thousand pounds in amount or value.
Power to apply to High Court for directions.
51.—(1) In every case of a breach or supposed breach of any trust for charitable purposes or whenever the direction or order of the High Court is considered necessary for the administration of any trust for charitable purposes, the Board or, with the consent of the Attorney General, any person may apply to the Court for such relief as the nature of the case may require and the Court may make such order thereon as the Court thinks fit.
(2) Where any of the circumstances specified in subsection (1) of section 47 exist in relation to a charitable gift which is the subject of an application under this section, the Court may, if it thinks fit, on such application, frame a scheme for the application cy-près of the property comprised in the charitable gift.
Duty of executors to publish, unless exempted under section 20 advertisements of charitable devises and bequests.
52.—(1) Whenever there is contained in any will a charitable devise or bequest, the person (in this section referred to as the personal representative) to whom probate of the will or letters of administration with the will annexed is granted shall, subject to any exemption granted by the Board under section 20, do the following things—
(a) within three months after the grant of probate or letters of administration, publish once in Iris Oifigiúil and three times successively in some newspaper circulating in the locality where the devise or bequest or the greater part thereof is directed to be expended or applied, or if there is no direction as to any such locality, then in some morning newspaper published on every week-day in Dublin, the following particulars—
(i) the devise or bequest contained in the will,
(ii) the name of the testator,
(iii) the date of the will,
(iv) the name of the person to whom the devise or bequest is given,
(v) the name of the person appointed by the testator for the management and direction of the devise or bequest; and
(b) within four months after the grant of probate or letters of administration, deliver at the office of the Board or forward to them by post three papers (other than Iris Oifigiúil) containing the successive publications pursuant to paragraph (a).
(2) If a personal representative fails to comply with paragraph (a) of subsection (1), he shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding fifty pounds.
(3) If a personal representative fails to comply with paragraph (b) of subsection (1), he shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding ten pounds.
(4) An offence under subsection (2) or (3) may be prosecuted by the Board.
(5) The expenses incurred by a personal representative in complying with subsection (1) shall be paid by him out of the estate or funds devised or bequeathed to the charity concerned.
Notice of legal proceedings to be given to Board.
53.—(1) Before any legal proceedings (except legal proceedings instituted with the authority of or by the direction of the Board under section 25 in relation to any charity are commenced by any person except the Attorney General, that person shall transmit to the Board notice in writing of the proposed legal proceedings and such information as may be requisite or proper or may be required from time to time by the Board, for explaining the nature and objects thereof.
(2) Nothing contained in subsection (1) shall make any order in any proceedings in which the Board have not been made parties binding and final as against the Board.
Deeds, etc., may be deposited by trustees of charity in repository provided by Board.
54.—It shall be lawful for trustees or other persons having the custody of any deeds or muniments of or relating to a charity to deposit them for security in a repository which may be provided by the Board, subject to any regulations made by the Board under this Act.
Power of majority of two-thirds of trustees to deal with charity property.
55.—(1) In this section “disposition”, in relation to property means any sale, exchange, partition, mortgage, lease or other disposition of the property.
(2) Where the trustees of a charity have power to determine on a disposition of any property of the charity, a majority of two-thirds of the trustees assembled at a meeting of their body duly constituted shall have legal power, on behalf of themselves and their co-trustees, to do, enter into, and execute all such acts, deeds, contracts and assurances as may be requisite for carrying into legal effect any disposition of the property, and all those acts, deeds, contracts or assurances shall have the same legal effect as if they were respectively done, entered into, or executed by all the acting trustees for the time being.
Provision in relation to bodies corporate acting as sole trustees in certain cases.
56.—Where, before the commencement of this Act, a body corporate has been appointed sole trustee of a charitable trust, then, during such time before and after such commencement as the body corporate has held and continues to hold the office of trustee of the trust—
(a) the terms of the trust shall be deemed to have provided for and required and to provide for and require the appointment of one trustee only, and
(b) one trustee only of the trust shall be deemed to have been originally appointed under the terms of the trust.
Resignation of member of governing body of charitable foundation and filling of vacancy.
57.—The following provisions shall apply in relation to a corporation established by Act or charter as the governing body of a charity—
(a) a member of the corporation may resign his membership by giving to the corporation not less than one month's notice in writing of his intention to do so;
(b) the corporation may appoint another person to be a member of the corporation in place of a member so resigning.
Probate Officer to make annual return to Board of charitable devises and bequests.
58.—The Probate Officer shall, between the 1st day of July and the 1st day of November in every year, make to the Board a return containing—
(a) particulars of every charitable devise or bequest contained in any will entered in the Probate Office or of which a copy has been forwarded to him from the office of any of the district probate registrars in the State or from any other source during the year preceding the said 1st day of July,
(b) the name of the testator,
(c) the name of the person to whom probate of the will or letters of administration with the will annexed was granted,
(d) the date of the will and the date of the probate or letters of administration.
Power to meet a particular deficit.
59.—The Board are hereby authorised to pay into their general account out of the accruing income of the Embezzled Charities Recovery Fund, kept by them, the sum of seventeen pounds thirteen shillings and five pence, being the amount of a deficit appearing in their annual accounts since the year 1873.
