ACHT NA SÉADCHOMHARTHAÍ NÁISIÚNTA (LEASÚ), 1987
[An tiontú oifigiúil]
Mínithe.
1.—(1) San Acht seo—
ciallaíonn “na hAchtanna” Achta na Séadchomharthaí Náisiúnta, 1930 agus 1954;
ciallaíonn “limistéar seandálaíochta” limistéar a measfaidh na Coimisinéirí tábhacht seandálaíochta a bheith leis ach ní fholaíonn sé limistéar séadchomhartha stairiúil a bheidh arna thaifeadadh sa Chlár;
folaíonn “séadchomhartha stairiúil” séadchomhartha réamhstairiúil agus aon séadchomhartha a bhaineann le stair thráchtála, chultúrtha, eacnamaíoch, thionsclaíoch, mhíleata, chreidimh nó shóisialta na háite ina bhfuil sé suite nó na tíre agus folaíonn sé freisin gach séadchomhartha a bhí ann roimh 1700 A.D. nó cibé dáta is déanaí ná sin a cheapfaidh an tAire le rialacháin;
ciallaíonn “ordú oidhreachta fomhuirí” ordú faoi alt 3 den Acht seo;
ciallaíonn “an Príomh-Acht” Acht na Séadchomharthaí Náisiúnta, 1930;
ciallaíonn “an Clár” an Clár um Shéadchomharthaí Stairiúla a bhunófar faoi alt 5 den Acht seo;
ciallaíonn “limistéar srianta” limistéar a bheidh arna ainmniú in ordú oidhreachta fomhuirí;
folaíonn “farraige” aon limistéar a bheidh báite ag lán mara gnáth-thaoidí rabharta, inbhear nó ascaill den fharraige agus uiscí taoide aon chainéil, crompáin, bá nó abhann, agus forléireofar “grinneall na farraige” dá réir sin;
ciallaíonn “uiscí teorann an Stáit” farraigí teorann an Stáit chun críocha an Achta um Dhlínse Mhuirí, 1959, agus uiscí inmheánacha an Stáit chun críocha an Achta sin;
ciallaíonn “raic”, soitheach, nó cuid de shoitheach, atá ina luí ina raic ar ghrinneall, i ngrinneall nó faoi ghrinneall na farraige nó ar thalamh nó i dtalamh atá clúdaithe le huisce agus aon rudaí atá sa soitheach nó ar an soitheach agus aon rudaí a bhí tráth i soitheach nó ar shoitheach agus atá ina luí ar ghrinneall, i ngrinneall nó faoi ghrinneall na farraige nó ar thalamh nó i dtalamh atá clúdaithe le huisce.
(2) Is tagairtí don táille a fhorordaítear faoi alt 24 den Acht seo na tagairtí in ailt 2 agus 3 den Acht seo don táille fhorordaithe.
Srian le feistí braite a úsáid.
2.—(1) Faoi réir fhorálacha an ailt seo ní cead do dhuine—
(a) feiste bhraite a úsáid ná seilbh a bheith aige ar fheiste bhraite—
(i) i séadchomhartha, nó ag láithreán séadchomhartha, arb iad na Coimisinéirí nó údarás áitiúil na húinéirí nó na caomhnóirí air nó a mbeidh ordú buanchoimeádta i bhfeidhm ina leith nó a bheidh arna chlárú sa Chlár, nó
(ii) i limistéar seandálaíochta a bheidh arna chlárú sa Chlár, nó
(iii) i limistéar srianta,
ná
(b) feiste bhraite a úsáid in áit seachas áit a shonraítear i mír (a) den fho-alt seo chun rudaí ársa a chuardach, ná
(c) díol nó úsáid feistí braite a chur chun cinn, cibé acu trí fhógraíocht nó ar shlí eile, is feistí braite chun rudaí ársa a chuardach.
(2) (a) Ar iarratas a bheith déanta air sin ag duine ar bith i scríbhinn chuig na Coimisinéirí agus ar cibé faisnéis a theastóidh uathu go réasúnach a bheith tugtha ag an duine sin dóibh agus ar an táille fhorordaithe (más ann) a bheith íoctha leo ag an duine sin, féadfaidh na Coimisinéirí, dá rogha féin, faoi réir mhír (b) den fho-alt seo, a dtoiliú i scríbhinn a dheonú nó a dhiúltú do dhuine—
(i) á údarú don duine sin nó don duine sin agus dá sheirbhísigh agus dá ghníomhairí (de réir mar a bheidh sonraithe sa toiliú) úsáid a bhaint as (de réir mar a bheidh sonraithe sa toiliú) feiste bhraite amháin nó feiste bhraite shonraithe amháin nó feiste bhraite amháin d'aicme, de chineál nó de shaghas sonraithe, chun rudaí ársa a chuardach in áit shonraithe (nach áit a shonraítear i bhfo-alt (1) (a) den alt seo), nó
(ii) á údarú don duine sin nó don duine sin agus dá sheirbhísigh agus dá ghníomhairí (de réir mar a bheidh sonraithe sa toiliú) úsáid a bhaint as feiste, agus a bheith i seilbh feiste, is feiste bhraite amháin nó feiste bhraite shonraithe amháin nó feiste bhraite amháin d'aicme, de chineál nó de shaghas sonraithe, (de réir mar a bheidh sonraithe sa toiliú) in áit a bheidh sonraithe sa toiliú (ar áit é a shonraítear san fho-alt sin (1) (a)).
(b) Maidir le cinneadh a dhéanamh toiliú a dheonú nó a dhiúltú faoin bhfo-alt seo i ndáil le séadchomhartha náisiúnta arb údarás áitiúil na húinéirí nó na caomhnóirí air, is iad na Coimisinéirí agus an t-údarás le chéile a dhéanfaidh é agus is iad a dheonóidh nó a dhiúltóidh an toiliú.
(c) Fanfaidh toiliú faoin bhfo-alt seo i bhfeidhm ar feadh cibé tréimhse a shonrófar sa toiliú.
(d) Maidir le toiliú faoin bhfo-alt seo—
(i) féadfar é a dhéanamh faoi réir cibé coinníollacha a mheasfaidh na Coimisinéirí nó na Coimisinéirí agus an t-údarás áitiúil lena mbaineann, de réir mar is iomchuí, a bheith cuí agus a shonróidh siad sa toiliú, agus
(ii) féadfaidh na Coimisinéirí nó na Coimisinéirí agus an t-údarás áitiúil lena mbaineann, de réir mar is iomchuí, é a chúlghairm i scríbhinn tráth ar bith agus tiocfaidh an chúlghairm in éifeacht nuair a chuirfear in iúl í don duine a bheidh ainmnithe sa toiliú.
(3) I gcás go ndéanfar iarratas chuig na Coimisinéirí ar thoiliú faoi fho-alt (2) den alt seo—
(a) déanfaidh na Coimisinéirí nó na Coimisinéirí agus an t-údarás áitiúil lena mbaineann, de réir mar is iomchuí, laistigh de thrí mhí tar éis dóibh an t-iarratas a fháil—
(i) an t-iarratas a dheonú nó diúltú é a dheonú, agus
(ii) a gcinneadh a chur in iúl i scríbhinn don duine a rinne an t-iarratas,
agus
(b) mura gcuirfear a gcinneadh in iúl mar adúradh don duine a rinne an t-iarratas, measfar gur dheonaigh na Coimisinéirí nó na Coimisinéirí agus an t-údarás áitiúil lena mbaineann, de réir mar is iomchuí, an toiliú gan choinníollacha.
(4) Déanfar iarratas chuig na Coimisinéirí faoi fho-alt (2) den alt seo a chur chucu leis an bpost cláraithe nó a sheachadadh de láimh ar oifigeach do na Coimisinéirí ag príomhoifig na gCoimisinéirí.
(5) Duine a sháróidh fo-alt (1) den alt seo nó coinníoll maidir le toiliú faoin alt seo beidh sé ciontach i gcion.
(6) Más rud é in ionchúiseamh mar gheall ar chion faoin alt seo go gcruthófar go raibh feiste bhraite á húsáid, toimhdeofar go dtí go suífear a mhalairt go raibh an fheiste á húsáid chun rudaí ársa a chuardach.
(7) Beidh sé ina chosaint do dhuine a chúiseofar i gcion faoi fho-alt (5) den alt seo a thaispeáint maidir leis an ngníomh arb é an cion é—
(a) go raibh sé ina ábhar toilithe faoin alt seo is toiliú a deonaíodh dó nó do dhuine a raibh sé ag gníomhú mar sheirbhíseach nó mar ghníomhaire i ndáil leis tráth déanta an ghnímh agus a bhí i bhfeidhm an tráth sin, agus nár shárú é ar choinníoll den toiliú, nó
(b) gur údaraíodh é le ceadúnas lorgaireachta arna dheonú faoi Chuid II den Acht Forbairte Minearál, 1940.
(8) San alt seo ciallaíonn “feiste bhraite” feiste a bheidh deartha nó oiriúnaithe chun go mbraithfeadh sí nó go n-aimseodh sí aon mhiotal nó mianra ar thalamh nó i dtalamh, ar ghrinneall, i ngrinneall nó faoi ghrinneall na farraige nó ar thalamh nó i dtalamh a bheidh clúdaithe le huisce ach ní fholaíonn sé ceamara.
Láithreáin raice stairiúla a chosaint.
3.—(1) Más deimhin leis na Coimisinéirí maidir le haon áit ar ghrinneall, i ngrinneall nó faoi ghrinneall na farraige d'uiscí teorann an Stáit nó ar ghrinneall, i ngrinneall, nó faoi ghrinneall na farraige lena mbaineann alt 2 (1) den Acht um an Scairbh Ilchríochach, 1968, nó ar thalamh nó i dtalamh atá clúdaithe le huisce—
(a) gur láithreán é, nó go bhféadfadh gur láithreán é, ina luíonn raic nó rud ársa nó ar luigh raic nó rud ársa tráth, agus
(b) gur chóir an láithreán a chosaint mar gheall ar thábhacht stairiúil, seandálaíochta nó ealaíonta na raice nó an ruda,
féadfaidh siad le hordú (dá ngairtear “ordú oidhreachta fomhuirí” san alt seo) limistéar de ghrinneall na farraige nó talamh atá clúdaithe le huisce timpeall ar an láithreán agus an láithreán san áireamh a ainmniú mar limistéar srianta.
(2) Beidh feidhm ag na forálacha seo a leanas i ndáil le hordú oidhreachta fomhuirí (agus beidh feidhm ag míreanna (c) agus (d) den fho-alt seo i ndáil le hordú lena gcúlghairtear ordú den sórt sin):
(a) sonrófar an limistéar srianta san ordú agus beidh cibé méid ann is dóigh leis na Coimisinéirí is gá chun an láithreán lena mbaineann a chosaint,
(b) tiocfaidh an t-ordú i ngníomh an lá a bheidh sonraithe chuige sin ann, nó, mura mbeidh aon lá den sórt sin sonraithe, an seachtú lá i ndiaidh an lae a ndéanfar é,
(c) a luaithe is féidir tar éis an t-ordú a dhéanamh, foilseofar é san Iris Oifigiúil agus i nuachtán amháin nó níos mó a léitear sa cheantar ina bhfuil an limistéar srianta réamhráite suite, nó i gcás gur limistéar de ghrinneall na farraige an limistéar srianta lena mbaineann, sa cheantar is gaire don limistéar srianta lena mbaineann,
(d) déanfar a luaithe is féidir tar éis a dhéanta cóip den ordú a thaisceadh—
(i) leis an gcláraitheoir contae d'aon chontae nó d'aon chontaebhuirg ina bhfuil an limistéar srianta réamhráite, nó aon chuid de suite nó, i gcás gur limistéar de ghrinneall na farraige an limistéar srianta sin, leis an gcláraitheoir contae don chontae nó don chontaebhuirg is gaire don limistéar srianta sin,
(ii) leis an gCléireach Cúirte Dúiche d'aon dúiche Cúirte Dúiche ina bhfuil an limistéar srianta réamhráite, nó aon chuid de suite nó, i gcás gur limistéar de ghrinneall na farraige an limistéar srianta sin, leis an gCléireach Cúirte Dúiche don dúiche is gaire don limistéar srianta sin, agus
(iii) i ngach stáisiún Garda Síochána atá suite sa dúiche Cúirte Dúiche réamhráite,
agus déanfar cóip a taisceadh amhlaidh a chur ar fáil lena iniúchadh agus féadfaidh baill den phobal cóip den sórt sin a iniúchadh le linn gnáthuaireanta oifige,
(e) féadfaidh na Coimisinéirí le hordú an t-ordú a chúlghairm.
(3) Faoi réir fhorálacha an ailt seo, ní dhéanfaidh duine i limistéar srianta aon ní díobh seo a leanas, is é sin le rá:
(a) baint le haon chuid de raic nó le haon rud ársa, ná an céanna a dhamáistiú ná a aistriú,
(b) oibríochtaí tumtha, suirbhéireachta nó tarrthálais a dhéanamh a bheidh dírithe ar raic nó ar rud ársa a bhrath, a aimsiú nó a thaiscéaladh nó ar an gcéanna nó ar chuid den chéanna a aisghabháil ó ghrinneall na farraige nó ó faoi ghrinneall na farraige nó ó thalamh atá clúdaithe le huisce, de réir mar a bheidh, nó trealamh a úsáid a bheidh déanta nó curtha in oiriúint chun aon chríche a bhaineann le hoibríochtaí tumtha, suirbhéireachta, nó tarrthálais, nó
(c) aon rud a thaisceadh, ionas go dtitfeadh sé agus go luífeadh sé tréigthe ar ghrinneall na farraige nó ar thalamh atá clúdaithe le huisce, de réir mar a bheidh, agus go dtarlódh, i gcás é do thitim ar láithreán raice nó ruda ársa (cibé acu a thiteann sé amhlaidh nó nach dtiteann) go scriosfadh sé an láithreán go hiomlán nó go páirteach nó go gcoiscfeadh sé rochtain chuige nó go ndéanfadh sé damáiste d'aon chuid den raic nó den rud.
(4) Faoi réir fhorálacha an ailt seo, ní dhéanfaidh duine ag láithreán raice (is raic is sine ná 100 bliain d'aois) nó ag láithreán ruda eile (is rud ársa) atá ina luí ar ghrinneall, i ngrinneall nó faoi ghrinneall na farraige nó ar thalamh nó i dtalamh atá clúdaithe le huisce—
(a) baint le haon chuid den raic nó den rud ársa ná an céanna a dhamáistiú ná a aistriú,
(b) oibríochtaí tumtha, suirbhéireachta nó tarrthálais a dhéanamh a bheidh dírithe ar an raic nó ar an rud ársa a thaiscéaladh nó ar an gcéanna nó ar chuid den chéanna a aisghabháil ó ghrinneall na farraige nó ó faoi ghrinneall na farraige nó ó thalamh atá clúdaithe le huisce, de réir mar a bheidh, nó trealamh a úsáid a bheidh déanta nó curtha in oiriúint chun aon chríche a bhaineann le hoibríochtaí tumtha, suirbhéireachta nó tarrthálais, nó
(c) aon rud a thaisceadh, ionas go dtitfeadh sé agus go luífeadh sé tréigthe ar ghrinneall na farraige nó ar thalamh atá clúdaithe le huisce, de réir mar a bheidh, agus go dtarlódh, i gcás é do thitim ar an láithreán (cibé acu a thiteann sé amhlaidh nó nach dtiteann), go scriosfadh sé an láithreán go hiomlán nó go páirteach nó go gcoiscfeadh sé rochtain chuige nó go ndéanfadh sé damáiste d'aon chuid den raic nó den rud.
(5) (a) Ar iarratas a bheith déanta air sin ag duine ar bith chuig na Coimisinéirí agus ar cibé faisnéis a theastóidh uathu go réasúnach a bheith tugtha aige dóibh i ndáil leis an iarratas agus ar an táille fhorordaithe (más aon táille) a bheith íoctha leo ag an duine sin, féadfaidh na Coimisinéirí, dá rogha féin, tar éis dul i gcomhairle (i gcás iarratais a bhaineann le grinneall na farraige) le hAire na Mara agus le cibé daoine eile (más ann) a bhfuil eolas speisialta acu ar an ábhar nó leas speisialta acu ann agus a gceapann siad gur chóir dul i gcomhairle leo, ceadúnas i scríbhinn a dheonú nó diúltú é a dheonú, do dhuine, á údarú don duine sin nó don duine sin agus dá sheirbhísigh agus dá ghníomhairí (de réir mar a bheidh sonraithe sa cheadúnas) faoi réir cibé coinníollacha is cuí leis na Coimisinéirí agus a shonróidh siad sa cheadúnas—
(i) na gníomhartha a shonraítear i míreanna (a), (b) agus (c) d'fho-alt (3) den alt seo, nó cibé gníomh díobh a bheidh sonraithe, a dhéanamh i limistéar srianta sonraithe nó i gcuid shonraithe de limistéar den sórt sin, nó
(ii) na gníomhartha a shonraítear i míreanna (a), (b), agus (c) d'fho-alt (4) den alt seo, nó cibé gníomh díobh a bheidh sonraithe, a dhéanamh ag láithreán sonraithe lena mbaineann fo-alt (4) den alt seo nó ag cuid shonraithe de láithreán den sórt sin.
(b) Fanfaidh ceadúnas faoin bhfo-alt seo i bhfeidhm ar feadh cibé tréimhse a bheidh sonraithe sa cheadúnas.
(c) Maidir le ceadúnas faoin bhfo-alt seo—
(i) féadfar é a dhéanamh faoi réir cibé coinníollacha (más ann) is cuí leis na Coimisinéirí agus a shonróidh siad sa cheadúnas, agus
(ii) féadfaidh na Coimisinéirí é a chúlghairm tráth ar bith agus beidh éifeacht leis an gcúlghairm an tráth a gcuirfear an chúlghairm in iúl don duine a bheidh ainmnithe sa cheadúnas nó cibé tráth ina dhiaidh sin a bheidh sonraithe sa chúlghairm.
(d) I gcás go ndéanfar iarratas chuig na Coimisinéirí ar cheadúnas faoin bhfo-alt seo—
(i) déanfaidh siad, laistigh de thrí mhí tar éis dóibh an t-iarratas a fháil—
(I) an t-iarratas a dheonú nó diúltú é a dheonú, agus
(II) a gcinneadh a chur in iúl i scríbhinn don duine a rinne an t-iarratas,
agus
(ii) mura gcuirfear a gcinneadh in iúl mar adúradh don duine a rinne an t-iarratas measfar gur dheonaigh na Coimisinéirí an ceadúnas gan choinníollacha.
(e) Déanfar iarratas chuig na Coimisinéirí ar cheadúnas faoin bhfo-alt seo a chur chucu leis an bpost cláraithe nó a sheachadadh de láimh d'oifigeach do na Coimisinéirí ag príomhoifig na gCoimisinéirí.
(6) Aon duine a thiocfaidh ar raic (is raic is sine ná 100 bliain d'aois) nó rud eile (is rud ársa) atá ina luí ar ghrinneall, i ngrinneall nó faoi ghrinneall na farraige nó ar thalamh nó i dtalamh atá clúdaithe le huisce, ní mór dó, laistigh de 4 lá tar éis an raic sin a fháil, tuarascáil go bhfuair sé í a thabhairt do chomhalta den Gharda Síochána nó do na Coimisinéirí agus ní mór dó, nuair a bheidh sé ag tabhairt na tuarascála, a ainm agus a sheoladh a thabhairt don chomhalta nó do na Coimisinéirí, an cineál raice nó ruda eile a lua agus an t-am agus an áit a bhfuair sé í agus na toscaí ina bhfuair sé í agus tabharfaidh sé freisin (agus cibé acu ar thug sé an tuarascáil sin mar a dúradh nó nár thug agus is cuma cé hé an duine ar thug sé an tuarascáil sin (más ann) dó) aon fhaisnéis a bheidh ar eolas aige i ndáil leis an raic nó an rud eile d'aon chomhalta den Gharda Síochána nó d'oifigeach do na Coimisinéirí má iarrtar air é.
(7) Aon duine a sháraíonn fo-alt (3), (4) nó (6) den alt seo nó coinníoll maidir le ceadúnas faoi fho-alt (5) den alt seo beidh sé ciontach i gcion.
(8) Beidh sé ina chosaint do dhuine a chúiseofar i gcion faoin alt seo a thaispeáint maidir leis an ngníomh arb é an cion é go raibh sé ina ábhar ceadúnais faoin alt seo is ceadúnas a deonaíodh dó, nó do dhuine a raibh sé ag gníomhú mar sheirbhíseach nó mar ghníomhaire i ndáil leis tráth déanta an ghnímh agus a bhí i bhfeidhm an tráth sin.
(9) Beidh sé ina chosaint do dhuine a chúiseofar í gcion faoin alt seo a shuíomh go ndearna sé an gníomh arb é an cion é —
(a) le linn dó aon bheart a dhéanamh chun déileáil d'aon toisc le héigeandáil d'aon sórt, nó
(b) de dhroim riachtanais de bharr doininne nó guaiseacha loingseoireachta.
(10) Más rud é go mbeidh raic is rud ársa agus a aistríodh ó limistéar srianta i seilbh an ghlacadóra raice d'aon cheantar agus nach gcruthaíonn aon duine go bhfuil teideal aige faoin Merchant Shipping Act, 1894, chuig úinéireacht na raice laistigh de bhliain amháin tar éis di teacht i seilbh an ghlacadóra sin, ní mór don ghlacadóir sin, de réir mar a iarrfaidh Stiúrthóir Ard-Mhúsaem na hÉireann—
(a) an raic a sheachadadh ar Stiúrthóir Ard-Mhúsaem na hÉireann agus déanfaidh seisean a luaithe is féidir tar éis an tseachadta sin—
(i) an raic a choimeád thar ceann an Stáit, agus
(ii) (I) aon chaiteachas a thabhaigh an glacadóir sin, agus a chuid táillí, i ndáil leis an raic, a íoc leis, agus
(II) cibé méid tarrthálais is dóigh le Stiúrthóir Ard-Mhúsaem na hÉireann a bheith réasúnach sna himthosca go léir a íoc le haon tarrthálaithe ar an raic,
nó
(b) an raic a dhíol agus fáltais an díola (tar éis costais an díola agus aon chostais eile a thabhaigh sé agus a chuid táillí i ndáil leis an raic a asbhaint astu agus tar éis cibé méid tarrthálais a íoc le haon tarrthálaithe ar an raic is dóigh le Stiúrthóir Ard-Mhúsaem na hÉireann a bheith réasúnach sna himthosca go léir) a íoc leis an Aire Airgeadais.
(11) (a) Féadfar imeachtaí mar gheall ar chion faoin alt seo a rinneadh i limistéar ar cuid de ghrinneall na farraige é a thionscnamh in aon áit sa Stát agus féadfar a mheas chun gach críche teagmhasaí go ndearnadh an cion in aon áit sa Stát.
(b) Féadfar imeachtaí mar gheall ar chion faoin alt seo a rinneadh i limistéar ar talamh é atá clúdaithe le huisce agus atá suite in dhá dhúiche Cúirte Dúiche nó níos mó a thionscnamh in aon cheann de na dúichí sin agus féadfar a mheas chun gach críche teagmhasaí go ndearnadh an cion in aon cheann de na dúichí sin.
(12) Ní bheidh feidhm ag alt 2 (1) den Acht seo ná ag fo-ailt (3) agus (4) den alt seo maidir le comhalta den Gharda Síochána, ná comhalta d'Óglaigh na hÉireann, ar dualgas, ná maidir le duine fad a bheidh sé ag gníomhú ar threoracha ó na Coimisinéirí.
Comhairle na Séadchomharthaí Stairiúla.
4.—(1) Bunóidh an tAire le hordú comhairle ar a dtabharfar “Comhairle na Séadchomharthaí Stairiúla” agus dá ngairtear “an Chomhairle” san alt seo.
(2) Is í an fheidhm a bheidh ag an gComhairle comhairle a chur ar na Coimisinéirí agus cuidiú leo i ndáil le haon ábhar a bhaineann le forálacha Achtanna na Séadchomharthaí Náisiúnta, 1930 go 1987, a chur i ngníomh nó le haon ábhar eile a fhearann ar shéadchomharthaí stairiúla nó ar limistéir nó ar raiceanna seandálaíochta eile agus i ndáil lena gcosaint agus lena gcaomhnú agus déanfaidh an Chomhairle, má iarrann na Coimisinéirí uirthi déanamh amhlaidh, comhairle a chur orthu i ndáil le haon ábhar sonraithe den sórt sin mar a dúradh.
(3) Ceapfaidh an tAire comhaltaí na Comhairle ó am go ham de réir mar is gá agus is iad a bheidh ar an gComhairle—
(a) ionadaí don Taoiseach a bheidh ainmnithe ag an Taoiseach,
(b) ionadaí d'Aire na Mara a bheidh ainmnithe ag Aire na Mara,
(c) ionadaí don Aire Comhshaoil a bheidh ainmnithe ag an Aire Comhshaoil,
(d) ionadaí do na Coimisinéirí a bheidh ainmnithe ag na Coimisinéirí,
(e) ionadaí do gach ceann de na comhlachtaí seo a leanas a bheidh ainmnithe ag an gcomhlacht arb eisean an t-ionadaí dó, is é sin:
(i) Coláiste na Tríonóide, Baile Átha Cliath,
(ii) Coláiste na hOllscoile, Baile Átha Cliath,
(iii) Coláiste na hOllscoile, Corcaigh,
(iv) Coláiste na hOllscoile, Gaillimh,
(v) Ollscoil na Ríona, Béal Feirste,
(vi) Bord Fáilte Éireann,
(vii) Acadamh Ríoga na hÉireann,
(viii) Cumann Ríoga Ársaíochta na hÉireann,
(ix) Institiúid Ríoga Ailtirí Éireann,
(x) Foras Muirí na hÉireann,
agus
(f) cibé daoine eile nach mó ná cúigear a líon a chinnfidh an tAire ó am go ham.
(4) (a) Beidh cathaoirleach ar an gComhairle.
(b) Déanfaidh an tAire ó am go ham de réir mar is gá cathaoirleach na Comhairle a cheapadh as measc chomhaltaí na Comhairle.
(5) (a) Faoi réir mhír (b) den fho-alt seo, sé bliana a bheidh i dtéarma oifige chomhalta den Chomhairle ach beidh comhaltaí den Chomhairle, ar dhul in éag dá dtéarmaí oifige, in-athcheaptha ar an gComhairle ó am go ham.
(b) Trí bliana a bheidh i dtéarma oifige ochtair (a thoghfaidh an Chomhairle trí chrannchur as measc chomhaltaí na Comhairle seachas an cathaoirleach) de chomhaltaí na Comhairle a cheapfar i gcéad uair tar éis bhunú na Comhairle.
(6) Más rud é go bhfaighidh comhalta den Chomhairle bás, go n-éireoidh sé as nó nach mbeidh sé go sealadach in ann gníomhú mar chomhalta den sórt sin féadfaidh an tAire duine eile a cheapadh le bheith ina chomhalta den Chomhairle ina áit ar feadh cibé tréimhse a chinnfidh an tAire agus más rud é gur ag duine a shonraítear i bhfo-alt (3) den alt seo a ainmníodh an comhalta céadluaite lena cheapadh ar an gComhairle, déanfaidh an duine a shonraítear amhlaidh an duine a cheapfar faoin bhfo-alt seo a ainmniú lena cheapadh ar an gComhairle.
(7) Féadfaidh an Chomhairle gníomhú d'ainneoin folúntais amháin nó níos mó i líon a comhaltaí.
(8) Féadfaidh an tAire cibé méideanna a chinnfidh sé maidir le taisteal agus cothú nó le caiteachais eile a thabhaigh comhaltaí na Comhairle agus iad ag comhlíonadh a bhfeidhmeanna mar chomhaltaí den sórt sin, a íoc le comhaltaí na Comhairle as airgead a sholáthróidh an tOireachtas.
(9) Rialálfaidh an Chomhairle, le rialacha nó ar shlí eile, nós imeachta agus gnó na Comhairle.
(10) Déanfar tagairtí in aon Acht eile nó in aon ionstraim arna déanamh faoi do Chomhairle Chomhairleach na Séadchomharthaí Náisiúnta a fhorléiriú mar thagairtí do Chomhairle na Séadchomharthaí Stairiúla.
Clár na Séadchomharthaí Stairiúla.
5.—(1) Cuirfidh na Coimisinéirí faoi deara clár de shéadchomharthaí stairiúla a bhunú agus a chothabháil ar a dtabharfar “Clár na Séadchomharthaí Stairiúla” agus dá ngairtear “an Clár” san Acht seo.
(2) Cuirfidh na Coimisinéirí faoi deara ainm agus láthair na nithe seo a leanas, agus tuairisc ghearr orthu, a thaifeadadh sa Chlár—
(a) na séadchomharthaí stairiúla sa Stát a bhfuil eolas acu orthu ar thosach feidhme an ailt seo,
(b) na limistéir sheandálaíochta eile sa Stát a bhfuil eolas acu orthu ar an tosach feidhme sin, agus
(c) aon séadchomharthaí stairiúla, nó aon limistéir sheandálaíochta eile, a gcuirfidh siad eolas orthu tar éis an tosach feidhme sin
agus ar cheart, ina dtuairim, iad a thaifeadadh amhlaidh.
(3) Féadfaidh na Coimisinéirí taifeadadh sa Chlár a leasú nó a scriosadh.
(4) Faoi réir fho-alt (6) den alt seo, cuirfidh na Coimisinéirí faoi deara, a luaithe is féidir tar éis an Clár a bhunú, liosta a fhoilsiú san Iris Oifigiúil a shonróidh na séadchomharthaí stairiúla agus na limistéir sheandálaíochta a bheidh taifeadta sa Chlár an uair sin agus cibé sleachta, más ann, ón gClár i ndáil leis na séadchomharthaí agus na limistéir is iomchuí leo.
(5) Cuirfidh na Coimisinéirí faoi deara, a luaithe is féidir tar éis breis a chur leis an gClár, nó tar éis é a leasú nó ábhar a scriosadh as, fógra faoin mbreis, faoin leasú nó faoin scriosadh a fhoilsiú san Iris Oifigiúil.
(6) Déanfar ainm agus láthair séadchomhartha a bhí ar áireamh i liosta a foilsíodh san Iris Oifigiúil de bhun alt 8 d'Acht na Séadchomharthaí Náisiúnta (Leasú), 1954, agus tuairisc ghearr ar an séadchomhartha sin a thaifeadadh sa Chlár ach ní bheidh feidhm ag fo-alt (4) den alt seo i ndáil leis an séadchomhartha.
(7) Más rud é—
(a) go ndéantar taifead sa Chlár maidir le séadchomhartha stairiúil, nó le limistéar seandálaíochta eile, nó
(b) go ndéantar taifead sa Chlár maidir le séadchomhartha nó le limistéar seandálaíochta eile a leasú nó a scriosadh,
cuirfidh na Coimisinéirí faoi deara, a luaithe is féidir go dtabharfar scéala i scríbhinn d'úinéir ainme agus (murab é an t-úinéir an t-áititheoir) d'áititheoir ainme an tséadchomhartha nó an limistéir faoin taifead, faoin leasú nó faoin scriosadh de réir mar a bheidh agus, i gcás lena mbaineann mír (a) den fho-alt seo, faoi na pionóis a thabhóidh duine a bheidh ciontach i gcion faoin alt seo nó faoi alt 2 den Acht seo.
(8) I gcás go mbeartaíonn úinéir nó áititheoir (nach iad na Coimisinéirí iad) séadchomhartha stairiúil nó limistéir seandálaíochta a bheidh taifeadta sa Chlár, nó go mbeartaíonn aon duine eile, aon obair a dhéanamh nó go gcuireann sé faoi deara nó go gceadaíonn sé aon obair a dhéanamh ag an séadchomhartha nó sa limistéar nó i ndáil leo, tabharfaidh sé fógra i scríbhinn do na Coimisinéirí faoina bhfuil beartaithe aige agus ní dhéanfaidh sé, ach amháin i gcás fíorphráinne agus le toiliú na gCoimisinéirí, an obair a thosú go ceann tréimhse dhá mhí tar éis an fógra a bheith tugtha.
(9) Déanfar scéala faoi fho-alt (7) den alt seo a chur leis an bpost cláraithe chuig an duine lena mbaineann nó seachadfaidh oifigeach, seirbhíseach nó gníomhaire do na Coimisinéirí air é de láimh.
(10) Ní dhéanfaidh duine, seachas de réir fho-alt (8) den alt seo nó de réir thoiliú faoi alt 14 (2) den Phríomh-Acht, séadchomhartha stairiúil a bheidh taifeadta sa Chlár a scartáil nó a aistriú ar fad nó go páirteach ná é a chur ó dhealramh, a aghlot, a athrú ná baint leis in aon slí.
(11) Aon duine a sháróidh an t-alt seo beidh sé ciontach i gcion.
(12) Maidir le fianaise prima facie i dtaobh an fhíorais go bhfuil séadchomhartha stairiúil nó limistéar seandálaíochta taifeadta sa Chlár féadfar é a thabhairt in aon chúirt trí chóip den Iris Oifigiúil a thabhairt ar aird a airbheartaíonn go bhfuil inti liosta foilsithe de bhun fho-alt (4) den alt seo nó alt 8 d'Acht na Séadchomharthaí Náisiúnta (Leasú), 1954, nó go bhfuil inti fógra foilsithe de bhun fho-alt (5) den alt seo, ar liosta nó fógra é ina sonraítear an séadchomhartha nó an limistéar seandálaíochta, de réir mar a bheidh, a dúradh.
Na Coimisinéirí d'fháil séadchomharthaí náisiúnta etc.
6.—(1) Féadfaidh na Coimisinéirí le toiliú an Aire, na nithe seo a leanas a fháil trí chomhaontú nó go héigeantach—
(a) aon séadchomhartha ar séadchomhartha náisiúnta é, ina dtuairim,
(b) cuid de shéadchomhartha den sórt sin, nó
(c) aon talamh i gcomharsanacht an tséadchomhartha sin a bheartaíonn siad a úsáid chun saoráidí a chur ar fáil do dhaoine a mbeidh rochtain acu chun an tséadchomhartha faoi Achtanna na Séadchomharthaí Náisiúnta, 1930 go 1987,
agus féadfaidh na Coimisinéirí aon séadchomhartha nó talamh den sórt sin a fháil cibé acu an iadsan nó údarás áitiúil caomhnóirí an tséadchomhartha nó nach iad agus cibé acu an bhfuil ordú buanchoimeádta i bhfeidhm maidir leis an séadchomhartha nó leis an talamh sin nó nach bhfuil.
(2) D'éagmais comhaontú, déanfar méid an phraghais nó na gcúiteamh a bheidh le híoc ag na Coimisinéirí ar aon mhaoin a gheobhaidh siad faoin alt seo a shocrú faoi réim agus de réir an Acquisition of Land (Assessment of Compensation) Act, 1919, agus beidh feidhm ag an Acht sin dá réir sin fara aon mhodhnuithe is gá.
(3) Beidh feidhm, fara aon mhodhnuithe is gá, ag ailt 69 go 83 den Lands Clauses Consolidation Act, 1845 (arna n-oiriúnú nó arna leasú le haon nó faoi aon achtachán ina dhiaidh sin), maidir le haon phraghas nó cúiteamh is iníoctha faoin alt seo agus maidir le haon mhaoin a fuarthas faoin alt seo a thíolacadh do na Coimisinéirí agus, chun críocha an iarratais, measfar gurb iad na Coimisinéirí tionscnóirí an ghnóthais agus measfar gurb é an tAcht seo an tAcht speisialta.
(4) Déanfar an praghas nó an cúiteamh is iníoctha ar mhaoin a fháil faoin alt seo, a íoc go feadh cibé méid a bheidh ceadaithe ag an Aire, as airgead a sholáthróidh an tOireachtas.
(5) Ní dhéanfaidh na Coimisinéirí gan toiliú Choimisiún Talún na hÉireann aon mhaoin ar thalamh nó aon mhaoin atá ina cuid de thalamh, a fháil faoin alt seo, ar talamh é a bheidh faoi réir blianachta talamh-cheannaigh nó is ábhar comhaontaithe talamh-cheannaigh nó ar talamh é a bheidh dílsithe nó i gcúrsa a bheith dílsithe do Choimisiún Talún na hÉireann.
(6) Más rud é maidir le haon mhaoin a fhaightear faoin alt seo, go mbeidh sí, go haonaránach nó i dteannta talaimh eile, faoi réir blianachta talamh-cheannaigh, faoi réir íocaíochta in ionad cíosa nó faoi réir suime eile is iníoctha go tréimhsiúil (agus nach cíos is iníoctha faoi chonradh tionóntachta agus faoi sin amháin) is iníoctha le Coimisiún Talún na hÉireann—
(a) amhail ón dáta a bhfaighidh na Coimisinéirí an talamh, nó a rachaidh siad isteach air agus a nglacfaidh siad seilbh air, cibé dáta is túisce, tiocfaidh siad chun bheith agus beidh siad faoi dhliteanas cibé suim thréimhsiúil nó cibé cuid di a bheidh cionroinnte ag an gCoimisiún sin ar an maoin, a íoc leis an gCoimisiún sin, amhail is dá mba gur aistrigh úinéir na maoine an mhaoin chuig na Coimisinéirí ar an dáta sin,
(b) beidh na Coimisinéirí i dteideal, más cuí leo, an tsuim thréimhsiúil nó an chuid di a dúradh a fhuascailt, agus
(c) beidh sé d'oibleagáid ar na Coimisinéirí má cheanglaíonn an Coimisiún sin orthu déanamh amhlaidh an tsuim thréimhsiúil nó an chuid di a dúradh a fhuascailt.
Séadchomharthaí náisiúnta a aistriú chuig músaeim, etc.
7.—(1) Más rud é gurb iad na Coimisinéirí nó údarás áitiúil úinéirí séadchomhartha náisiúnta, féadfaidh na Coimisinéirí nó an t-údarás (de réir mar a bheidh) más é a dtuairim gur féidir leo déanamh amhlaidh gan díobháil mhíchuí don séadchomhartha agus gur inmhi anaithe déanamh amhlaidh chun an séadchomhartha á ohosaint nó a chaomhnú nó ar mhaithe le seandálaíocht nó ar aon chúis eile, agus, i gcás gurb é an t-údarás úinéirí an tséadchomhartha, le toiliú na gCoimisinéirí, an séadchomhartha nó aon chuid de a aistriú agus an séadchomhartha nó an chuid a thaisceadh agus a choimeád taiscthe i músaem poiblí, nó áit eile sa Stát a bheidh ceadaithe chun na críche ag an Aire de thuras na huaire.
(2) Aon séadchomhartha a thaiscfear faoin alt seo i músaem, beidh sé fad a bheidh sé arna thaisceadh amhlaidh, ar fáil lena iniúchadh ag an bpobal ar an dóigh chéanna agus go feadh an méid céanna leis na rudaí eile sa mhúsaem.
Séadchomharthaí stairiúla a iniúchadh.
8.—(1) Féadfaidh na Coimisinéirí a chur faoi deara dá n-oifigigh, dá seirbhísigh, dá ngníomhairí nó do dhaoine eile a bheidh údaraithe go cuí acu chuige sin cibé iniúchtaí, imscrúduithe agus tuarascálacha a dhéanamh a ordóidh siad (go ginearálta nó go sonrach)—
(a) maidir le séadchomharthaí stairiúla agus le háiteanna a mbeidh cúis ag na Coimisinéirí a chreidiúint go bhfuil séadchomharthaí stairiúla iontu, agus,
(b) maidir le limistéir agus láithreáin shrianta a mbeidh cúis ag na Coimisinéirí a chreidiúint gur láithreáin raice nó rudaí ársa iad.
(2) Féadfaidh na Coimisinéirí, a gcuid oifigeach, seirbhíseach nó gníomhairí nó daoine eile a bheidh údaraithe go cuí ag na Coimisinéirí chuige sin, dul isteach ar aon tailte nó áitribh chun a gcuid feidhmeanna a chomhlíonadh faoin alt seo agus cibé nithe a dhéanamh ansin is gá go réasúnach chun críocha na bhfeidhmeanna sin.
Cumhacht na gCoimisinéirí agus údarás áitiúil chun fodhlíthe a dhéanamh.
9.—(1) Féadfaidh na Coimisinéirí le ceadú an Aire, nó údarás áitiúil le ceadú na gCoimisinéirí, de réir mar a bheidh, chun críocha a gcuid feidhmeanna faoin Acht seo, fodhlíthe a dhéanamh i ndáil le haon séadchomhartha náisiúnta arb iad na húinéirí nó na caomhnóirí air iad.
(2) Duine a sháróidh fodhlí faoin alt seo beidh sé ciontach i gcion.
(3) Déanfar cóipeanna d'fhodhlí faoin alt seo a chur ar taispeáint ag aon séadchomhartha náisiúnta lena mbaineann sé, nó ina chomharsanacht, ar cibé slí agus i cibé áit is fearr, i dtuairim na gCoimisinéirí nó an údaráis áitiúil lena mbaineann, de réir mar a bheidh, a dhíreoidh aird na ndaoine sin ag an séadchomhartha nó ina chomharsanacht ar an bhfodhlí.
Síntiúis shaorálacha a ghlacadh.
10.—Féadfaidh na Coimisinéirí nó údarás áitiúil síntiúis shaorálacha a ghlacadh faoi chomhair an chostais a bhaineann le haon cheann dá gcuid feidhmeanna, nó cúnamh saorálach a ghlacadh i bhfeidhmiú aon cheann acu, faoi Achtanna na Séadchomharthaí Náisiúnta, 1930 go 1987, nó i ndáil le tochailt seandálaíochta a dhéanamh arna húdarú ag na Coimisinéirí le ceadúnas faoi alt 26 den Phríomh-Acht más rud é nach mbeidh na coinníollacha (más ann) a chuirfidh an deontóir ag gabháil leis an nglacadh síntiús sin ar neamhréir leis na feidhmeanna sin nó leis an tochailt a dhéanamh.
Leasú ar alt 2 den Phríomh-Acht.
11.—Leasaítear leis seo alt 2 den Phríomh-Acht—
(a) tríd an míniú seo a leanas a chur in ionad an mhínithe ar “séadchomhartha”:
“folaíonn ‘séadchomhartha’ na nithe seo a leanas, cibé acu ar dhromchla na talún nó an uisce nó fúthu agus cibé greamaithe den talamh nó gan a bheith—
(a) aon tógáil, déanmhas nó foirgneamh saorga nó páirtsaorga nó aon ghrúpa de na foirgnimh, de na déanmhais nó de na tógálacha sin,
(b) aon uaimh, cloch nó táirge aiceanta eile, cibé acu is cuid den talamh é nó nach ea, a snoíodh, a dealbhaíodh nó a oibríodh go saorga nó (murar cuid é den áit ina bhfuil sé) a ndealraíonn sé gur cuireadh nó gur socraíodh in ionad é d'aon ghnó,
(c) (i) aon tuama, uaigh nó taisce adhlacain réamhstairiúil nó seanda, nó aon chuid díobh sin, nó
(ii) aon láithreán, nó aon chuid d'aon láithreán, réamhstairiúil nó seanda is láithreán deasghnátha, tionsclaíoch nó cónaithe,
agus
(d) aon áit arb é atá ann iarsmaí nó rianta d'aon tógáil, déanmhas nó foirgneamh den sórt sin, aon uaimh, cloch nó táirge aiceanta den sórt sin nó aon tuama, uaigh, taisce adhlacain nó láithreán deasghnátha, tionsclaíoch nó cónaithe den sórt sin,
atá suite ar thalamh nó in uiscí teorann an Stáit, ach ní fholaíonn sé aon fhoirgneamh, ná cuid d'aon fhoirgneamh atá i ngnáthúsáid chun críocha eaglasta;”,
(b) tríd an míniú seo a leanas a chur in ionad an mhínithe ar “úinéir”:
“ciallaíonn ‘úinéir’, nuair a úsáidtear é i ndáil le séadchomhartha nó limistéar seandálaíochta, an duine a bhfuil cibé eastát nó leas aige de thuras na huaire sa séadchomhartha nó sa limistéar seandálaíochta a thugann teideal dó seilbh iarbhír a bheith aige ar an séadchomhartha nó ar an limistéar seandálaíochta agus áitiú iarbhír a dhéanamh ar an gcéanna;”,
agus
(c) tríd an míniú seo a leanas a chur isteach:
“folaíonn ‘talamh’ talamh atá clúdaithe le huisce;”.
Leasú ar alt 12 den Phríomh-Acht.
12.—Leasaítear leis seo alt 12 den Phríomh-Acht tríd an bhfo-alt seo a leanas a chur isteach i ndiaidh fho-alt (2):
“(3) I gcás go mbeidh na Coimisinéirí nó údarás áitiúil ina n-úinéirí ar shéadchomhartha náisiúnta, féadfaidh na Coimisinéirí nó an t-údarás, de réir mar a bheidh, de bhreis ar an séadchomhartha a chothabháil, cibé obair eile agus cibé rudaí eile a dhéanamh is cuí leo ar an séadchomhartha nó aige agus chun na gcríoch sin beidh saor-rochtain chun an tséadchomhartha acu féin agus ag a gcuid oifigeach, ag a gcuid fear oibre, ag a ngníomhairí agus ag a gceadúnaithe agus féadfaidh siad chun na gcríoch sin agus chun críche na cothabhála sin innealra, feithiclí, trealamh agus ábhair a thabhairt isteach agus a úsáid ar aon talamh.”.

13.—Leasaítear leis seo alt 14 den Phríomh-Acht tríd an mír seo a leanas a chur isteach i bhfo-alt (1) tar éis mhír (b):
“(bb) séadchomhartha náisiúnta a athnuachan nó a athchóiriú d'éagmais an toilithe a luaitear anseo ina dhiaidh seo nó ar shlí seachas de réir an toilithe sin, nó”.

14.—Leasaítear leis seo alt 22 den Phríomh-Acht trí “Stairiúla” a chur in ionad “Náisiúnta” i bhfo-alt (1) agus tá an fo-alt sin, arna leasú amhlaidh, leagtha amach sa Tábla a ghabhann leis an alt seo.

“(1) Aon duine a thiocfaidh ar rud ársa, ní mór dó laistigh de 4 lá tar éis teacht air, tuarascáil a thabhairt maidir leis do chomhalta den Gharda Síochána a bheidh ar dualgas sa cheantar inar thángthas ar an rud nó do Stiúrthóir Ard-Mhúsaem na hÉireann nó do sheirbhíseach nó do ghníomhaire dá chuid agus ní mór dó, le linn dó an tuarascáil a thabhairt, a ainm agus a sheoladh féin, cineál nó carachtar an ruda sin agus an t-am ar thángthas air agus an áit agus na himthosca inar thángthas air a lua agus ní mór dó freisin, cibé acu a bheidh an tuarascáil sin a dúradh tugtha aige nó nach mbeidh, agus is cuma cé hé an duine dá mbeidh an tuarascáil (más ann) tugtha aige, aon fhaisnéis a bheidh ar eolas aige i ndáil leis an rud nó lena theacht air a thabhairt d'aon chomhalta den Gharda Síochána nó don Stiúrthóir sin nó do sheirbhíseach nó do ghníomhaire dá chuid nuair a iarrtar air é agus—
(a) ceadóidh sé d'aon chomhalta den Gharda Síochána nó don Stiúrthóir sin nó do sheirbhíseach nó do ghníomhaire dá chuid an rud a iniúchadh, a scrúdú nó grianghraf a thógáil de, agus
(b) ceadóidh sé don Stiúrthóir sin nó do sheirbhíseach nó do ghníomhaire dá chuid seilbh a ghlacadh ar an rud.

18.—(1) Aon oifigeach, seirbhíseach nó gníomhaire do na Coimisinéirí, nó aon duine eile a bheidh údaraithe go cuí acu chuige sin, agus a bheidh ag gníomhú i bhfeidhmiú cumhachtaí nó i gcomhlíonadh feidhmeanna nó dualgas, faoi Achtanna na Séadchomharthá Náisiúnta, 1930 go 1987, déanfaidh na Coimisinéirí a údarú i scríbhinn dó gníomhú amhlaidh agus déanfaidh sé má iarrann aon duine ar a bhfearann a ghníomhú amhlaidh air é an t-údarú a thabhairt ar aird lena iniúchadh ag an duine sin.
(2) Aon duine a chuirfidh bac nó a chuirfidh treampán thairis sin ar oifigeach, ar sheirbhíseach nó ar ghníomhaire do na Coimisinéirí nó ar aon duine eile a bheidh cuí-údaraithe acu chuige sin agus a bheidh ag gníomhú i bhfeidhmiú cumhachtaí nó i gcomhlíonadh feidhmeanna nó dualgas faoi Achtanna na Séadchomharthaí Náisiúnta, 1930 go 1987, beidh an duine sin ciontach i gcion.

(a) séadchomhartha stairiúil nó limistéar seandálaíochta atá suite ar an talamh a thaifeadadh sa Chlár,

20.—(1) Más rud é, i gcás comhalta den Gharda Síochána—

(b) go bhfaigheann sé aon duine i seilbh rud ársa,
(c) go bhfuil cúinsí réasúnacha aige lena chreidiúint gurb é an rud ársa dá dtagraítear i mír (b) den fho-alt seo an rud ársa dá dtagraítear i mír (a) den fho-alt seo,
féadfaidh sé a cheangal ar an duine cuntas a thabhairt dó ar cé mar a tháinig sé ar an rud, agus má mhainníonn nó má dhiúltaíonn an duine, gan leithscéal réasúnach, déanamh amhlaidh nó má thugann sé faisnéis is eol dó a bheith bréagach nó míthreorach, beidh sé ciontach i gcion.

21.—(1) I gcás go mbeidh drochamhras ar chomhalta den Gharda Síochána go ndearna duine cion sonraithe faoi Achtanna na Séadcho mharthaí Náisiúnta, 1930 go 1987, agus go líomhnaíonn sé é sin leis an duine, féadfaidh an comhalta ainm agus seoladh an duine sin a iarraidh air agus féadfaidh sé, má dhiúltaíonn an duine a ainm agus a sheoladh a thabhairt nó má thugann sé ainm nó seoladh a mbeidh cúinsí réasúnacha ag an gcomhalta lena chreidiúint go bhfuil siad bréagach nó míthreorach, an duine a ghabháil gan bharántas.
(2) Má dhiúltaíonn duine nó má mhainníonn sé, nuair a iarrfar a ainm agus a sheoladh air faoin alt seo, a ainm agus a sheoladh a thabhairt nó má thugann sé ainm agus seoladh atá bréagach nó míthreorach, beidh sé ciontach i gcion.

22.—(1) Más deimhin le breitheamh den Chúirt Dúiche, trí fhaisnéis ar mhionn agus i scríbhinn a thabharfaidh comhalta den Gharda Síochána, go bhfuil cúinsí réasúnacha ann lena chreidiúint go bhfuil fianaise a bhaineann le cion a bheith déanta faoi Achtanna na Séadchomharthaí Náisiúnta, 1930 go 1987, le fáil in aon fhoirgneamh, nó cuid d'fhoirgneamh nó in aon fheithicil, soitheach, aerárthach nó sciorrárthach nó in aon áit eile ar bith, féadfaidh sé barántas cuardaigh a eisiúint chuig an gcomhalta i ndáil leis an áit sin.

24.—(1) Féadfaidh na Coimisinéirí, le toiliú an Aire, táillí a fhorordú le rialacháin chun críocha ailt 2 agus 3 den Acht seo agus alt 26 den Phríomh-Acht.

NATIONAL MONUMENTS (AMENDMENT) ACT, 1987
Definitions.
1.—(1) In this Act—
“the Acts” means the National Monuments Acts, 1930 and 1954;
“archaeological area” means an area which the Commissioners consider to be of archaeological importance but does not include the area of a historic monument standing entered in the Register;
“historic monument” includes a prehistoric monument and any monument associated with the commercial, cultural, economic, industrial, military, religious or social history of the place where it is situated or of the country and also includes all monuments in existence before 1700 A.D. or such later date as the Minister may appoint by regulations;
“underwater heritage order” means an order under section 3 of this Act;
“the Principal Act” means the National Monuments Act, 1930;
“the Register” means the Register of Historic Monuments established under section 5 of this Act;
“restricted area” means an area standing designated in an underwater heritage order;
“sea” includes any area submerged at high water of ordinary spring tides, an estuary or an arm of the sea and the tidal waters of any channel, creek, bay or river, and "sea bed" shall be construed accordingly;
“territorial waters of the State” means the territorial seas of the State for the purposes of the Maritime Jurisdiction Act, 1959, and the internal waters of the State for the purposes of that Act;
“wreck” means a vessel, or part of a vessel, lying wrecked on, in or under the sea bed or on or in land covered by water, and any objects contained in or on the vessel and any objects that were formerly contained in or on a vessel and are lying on, in or under the sea bed or on or in land covered by water.
(2) References in sections 2 and 3 of this Act to the prescribed fee are references to the fee prescribed under section 24 of this Act.
Restriction on use of detection devices.
2.—(1) Subject to the provisions of this section a person shall not—
(a) use or be in possession of a detection device—
(i) in, or at the site of, a monument of which the Commissioners or a local authority are the owners or guardians or in respect of which a preservation order is in force or which stands registered in the Register, or
(ii) in an archaeological area that stands registered in the Register, or
(iii) in a restricted area,
or
(b) use, at a place other than a place specified in paragraph (a) of this subsection, a detection device for the purpose of searching for archaeological objects, or
(c) promote, whether by advertising or otherwise, the sale or use of detection devices for the purpose of searching for archaeological objects.
(2) (a) Upon application in writing therefor to the Commissioners by any person and upon being furnished by him with such information as they may reasonably require and upon payment to them by the person of the prescribed fee (if any), the Commissioners may, at their discretion, subject to paragraph (b) of this subsection, grant or refuse to grant their consent in writing to a person—
(i) authorising the use by (as may be specified in the consent) either that person or that person and his servants and agents of (as may be specified in the consent) one detection device or one specified detection device or one detection device of a specified class, kind or type, for the purpose of searching for archaeological objects at a specified place (not being a place specified in subsection (1) (a) of this section), or
(ii) authorising the use and possession by (as may be specified in the consent) either that person or that person and his servants and agents of (as may be specified in the consent) one detection device or one specified detection device or one detection device of a specified class, kind or type, at a place specifiedin the consent (being a place specified in the said subsection (1) (a)).
(b) A decision to grant or refuse to grant a consent under this subsection in relation to a national monument of which a local authority are the owners or the guardians shall be made, and the consent shall be granted or refused, jointly by the Commissioners and the authority.
(c) A consent under this subsection shall remain in force for such period as may be specified in the consent.
(d) A consent under this subsection may—
(i) be made subject to such conditions as the Commissioners, or the Commissioners and the local authority concerned, as may be appropriate, think fit and specify in the consent, and
(ii) be revoked in writing at any time by the Commissioners or the Commissioners and the local authority concerned, as may be appropriate, and the revocation shall take effect at the time when the person named in the consent is notified of the revocation.
(3) Where an application is made to the Commissioners for a consent under subsection (2) of this section—
(a) the Commissioners or the Commissioners and the local authority concerned, as may be appropriate, shall, within three months of the receipt by them of the application—
(i) either grant or refuse to grant the application, and
(ii) notify in writing the person who made the application of their decision,
and
(b) if the person who made the application is not notified as aforesaid of their decision, the Commissioners, or the Commissioners and the local authority concerned, as may be appropriate, shall be deemed to have granted the consent without conditions.
(4) An application to the Commissioners under subsection (2) of this section shall be sent to the Commissioners by registered post or delivered by hand to an officer of the Commissioners at the head office of the Commissioners.
(5) A person who contravenes subsection (1) of this section or a condition of a consent under this section shall be guilty of an offence.
(6) Where in a prosecution for an offence under this section it is proved that a detection device was being used, it shall be presumed until the contrary is proved that the device was being used for the purpose of searching for archaeological objects.
(7) It shall be a defence for a person charged with an offence under subsection (5) of this section to show that the act constituting the offence—
(a) was the subject of a consent under this section granted to him, or to a person in relation to whom he was acting asservant or agent at the time of the commission of the act, and in force at that time and was not a breach of a condition of the consent, or
(b) was authorised by a prospecting licence granted under Part II of the Minerals Development Act, 1940.
(8) In this section “detection device” means a device designed or adapted for detecting or locating any metal or mineral on or in the ground, on, in or under the sea bed or on or in land covered by water, but does not include a camera.
Protection of sites of historic wrecks.
3.—(1) Where the Commissioners are satisfied in respect of any place on, in or under the sea bed of the territorial waters of the State or on, in or under the sea bed to which section 2 (1) of the Continental Shelf Act, 1968, applies or on or in land covered by water that—
(a) it is or may prove to be the site where a wreck or an archaeological object lies or formerly lay, and
(b) on account of the historical, archaeological or artistic importance of the wreck or the object, the site ought to be protected,
they may by order (in this section referred to as “an underwater heritage order”) designate an area of the sea bed, or land covered by water, around and including the site as a restricted area.
(2) The following provisions shall apply in relation to an underwater heritage order (and paragraphs (c) and (d) of this subsection shall apply in relation to an order revoking such an order):
(a) the restricted area shall be specified in the order and shall be of such size as the Commissioners think necessary for the protection of the site concerned,
(b) the order shall come into operation on the day specified in that behalf therein, or, if no such day is specified, on the seventh day after the day on which it is made,
(c) the order shall, as soon as may be after it is made, be published in Iris Oifigiúil and in one or more newspapers circulating in the district in which the restricted area aforesaid is situated or, in case the restricted area concerned is an area of the sea bed, which is nearest to the restricted area concerned,
(d) a copy of the order shall, as soon as may be after it is made, be deposited—
(i) with the county registrar for any county or county borough in which the restricted area aforesaid, or any part of it, is situated or, in case the said restricted area is an area of the sea bed, with the county registrar for the county or county borough which is nearest to the said restricted area,
(ii) with the District Court Clerk of any District Court district within which the restricted area aforesaid, or any part of it, is situated or, in case the said restricted area is an area of the sea bed, which is nearest to the said restricted area, and
(iii) in every Garda Síochána station situated in the District Court district aforesaid,
and a copy so deposited shall be made available for inspection, and may be inspected by members of the public during ordinary office hours,
(e) the Commissioners may by order revoke the order.
(3) Subject to the provisions of this section, a person shall not, in a restricted area, do any of the following, that is to say:
(a) tamper with, damage or remove any part of a wreck or any archaeological object,
(b) carry out diving, survey or salvage operations directed to the detection, location or exploration of a wreck or archaeological object or to recovering it or a part of it from, or from under, the sea bed or from land covered by water, as the case may be, or use equipment constructed or adapted for any purpose of diving, survey or salvage operations, or
(c) deposit, so as to fall and lie abandoned on the sea bed or land covered by water, as the case may be, anything which, if it were to fall on the site of a wreck or archaeological object (whether it so falls or not), would wholly or partly obliterate the site or obstruct access to it, or damage any part of the wreck or object.
(4) Subject to the provisions of this section, a person, shall not, at the site of a wreck (being a wreck which is more than 100 years old), or of another object (being an archaeological object), that is lying on, in or under the sea bed or on or in land covered by water—
(a) tamper with, damage or remove any part of the wreck or archaeological object,
(b) carry out diving, survey or salvage operations, directed to the exploration of the wreck or archaeological object or to recovering it or a part of it from, or from under, the sea bed or from land covered by water, as the case may be, or use equipment constructed or adapted for any purpose of diving, survey or salvage operations, or
(c) deposit, so as to fall and lie abandoned on the sea bed or land covered by water, as the case may be, anything which, if it were to fall on the site (whether it so falls or not) would wholly or partly obliterate the site or obstruct access to it, or damage any part of the wreck or object.
(5) (a) Upon application therefor to the Commissioners by any person and upon being furnished by him with such information in relation to the application as they may reasonably require and upon payment to them by the person of the prescribed fee (if any), the Commissioners may, at their discretion, after consultation with (in the case of an application relating to the sea bed) the Minister for the Marine and with such other (if any) persons having a special knowledge of or interest in the matter as they consider ought to be consulted, grant or refuse to grant a licence in writing to a person authorising the doing by (as may be specified in the licence) that person or that person and hisservants and agents, subject to such conditions as the Commissioners may think fit and specify in the licence—
(i) in a specified restricted area or a specified part of such an area of the acts specified in paragraphs (a), (b) and (c) of subsection (3) of this section or of such of them as may be specified, or
(ii) at a specified site to which subsection (4) of this section applies or at a specified part of such a site of the acts specified in paragraphs (a), (b) and (c) of subsection (4) of this section or of such of them as may be specified.
(b) A licence under this subsection shall remain in force for such period as may be specified in the licence.
(c) A licence under this subsection may—
(i) be made subject to such conditions (if any) as the Commissioners think fit and specify in the licence, and
(ii) may be revoked at any time by the Commissioners and the revocation shall take effect at the time when the person named in the licence is notified of the revocation or at such later time as may be specified in the revocation.
(d) Where an application is made to the Commissioners for a licence under this subsection—
(i) they shall, within three months of the receipt by them of the application—
(I) either grant or refuse to grant the application, and
(II) notify in writing the person who made the application of their decision,
and
(ii) if the person who made the application is not notified as aforesaid of their decision, the Commissioners shall be deemed to have granted the licence, without conditions.
(e) An application to the Commissioners for a licence under this subsection shall be sent to the Commissioners by registered post or delivered by hand to an officer of the Commissioners at the head office of the Commissioners.
(6) A person who finds a wreck (being a wreck which is more than 100 years old) or other object (being an archaeological object) that is lying on, in or under the sea bed or on or in land covered by water, shall, within 4 days after such finding, make a report of the finding to a member of the Garda Síochána or to the Commissioners and shall, when making the report, give to the member or to the Commissioners his name and address, state the nature of the wreck or other object and the time and place at which and the circumstances in which it was found by him and shall also (and whether he has or has not made such report as aforesaid and irrespective of the person to whom he has made such report (if any)) give to any member of the GardaSíochána or to an officer of the Commissioners on request any information within his knowledge in relation to the wreck, or other object.
(7) A person who contravenes subsection (3), (4) or (6) of this section or a condition of a licence under subsection (5) of this section, shall be guilty of an offence.
(8) It shall be a defence for a person charged with an offence under this section to show that the act constituting the offence was the subject of a licence under this section granted to him, or to a person in relation to whom he was acting as servant or agent at the time of the commission of the act, and in force at that time.
(9) It shall be a defence for a person charged with an offence under this section to show that the act constituting the offence was done by him—
(a) in the course of any action taken by him for the sole purpose of dealing with an emergency of any description, or
(b) out of necessity due to stress of weather or navigational hazards.
(10) If wreck that is an archaeological object and was removed from a restricted area is in the possession of the receiver of wreck for any district and no person establishes a claim under the Merchant Shipping Act, 1894, to the ownership of the wreck within one year after it came into the possession of the said receiver, the said receiver shall, as the Director of the National Museum may request, either—
(a) deliver the wreck to the Director of the National Museum who, as soon as may be after such delivery, shall—
(i) retain it on behalf of the State, and
(ii) pay—
(I) to the said receiver, any expenses incurred by him, and his fees, in relation to the wreck, and
(II) to any salvors of the wreck, such amount of salvage as appears to the Director of the National Museum to be reasonable in all the circumstances,
or
(b) sell the wreck and pay the proceeds of the sale (after deducting therefrom the expenses of the sale and any other expenses incurred by him, and his fees, in relation to the wreck and paying to any salvors of the wreck such amount of salvage as appears to the Director of the National Museum to be reasonable in all the circumstances) to the Minister for Finance.
(11) (a) Proceedings for an offence under this section committed in an area consisting of part of the sea bed may be taken, and the offence may for all incidental purposes be treated as having been committed, in any place in the State.
(b) Proceedings for an offence under this section committed in an area consisting of land that is covered by water and is situated in two or more District Court districts, may be taken, and the offence may for all incidental purposes betreated as having been committed, in any one of those districts.
(12) Section 2 (1) of this Act and subsections (3) and (4) of this section shall not apply to a member of the Garda Síochána, or a member of the Defence Forces, on duty, or to a person while acting on the instructions of the Commissioners.
The Historic Monuments Council.
4.—(1) The Minister shall establish by order a council which shall be known as “the Historic Monuments Council” and is in this section referred to as “the Council”.
(2) It shall be the function of the Council to advise and assist the Commissioners in relation to any matter respecting the carrying into execution of the provisions of the National Monuments Acts, 1930 to 1987, or any other matter affecting historic monuments or other archaeological areas or wrecks, and their protection and preservation and the Council shall, if requested by the Commissioners to do so, advise them in relation to any specified such matter as aforesaid.
(3) The members of the Council shall be appointed from time to time as occasion requires by the Minister and shall consist of—
(a) a representative of the Taoiseach nominated by the Taoiseach,
(b) a representative of the Minister for the Marine nominated by the Minister for the Marine,
(c) a representative of the Minister for the Environment nominated by the Minister for the Environment,
(d) a representative of the Commissioners nominated by the Commissioners,
(e) a representative of each of the following bodies nominated by the body of which he is the representative, namely:
(i) Trinity College, Dublin,
(ii) University College, Dublin,
(iii) University College, Cork,
(iv) University College, Galway,
(v) Queen's University, Belfast,
(vi) Bord Fáilte Éireann,
(vii) the Royal Irish Academy,
(viii) the Royal Society of Antiquaries of Ireland,
(ix) the Royal Institute of the Architects of Ireland,
(x) the Maritime Institute of Ireland,
and
(f) such other persons not exceeding five in number as the Minister may determine from time to time.
(4) (a) There shall be a chairman of the Council.
(b) The chairman of the Council shall be appointed from time to time as occasion requires by the Minister from amongst the members of the Council.
(5) (a) Subject to paragraph (b) of this subsection, the term of office of a member of the Council shall be six years but members of the Council shall, upon the expiry of their terms of office, be eligible for re-appointment to the Council from time to time.
(b) The term of office of eight (who shall be chosen by the Council by lot from amongst the members of the Council other than the chairman) of the members of the Council first appointed after the establishment of the Council shall be three years.
(6) Where a member of the Council dies, resigns or is temporarily unable to act as such member, the Minister may appoint another person to be a member of the Council in his place for such period as the Minister may determine and where the first-mentioned member was nominated for appointment to the Council by a person specified in subsection (3) of this section, the person appointed under this subsection shall be nominated for appointment to the Council by the person so specified.
(7) The Council may act notwithstanding one or more vacancies among its members.
(8) There may be paid to members of the Council by the Minister, out of moneys to be provided by the Oireachtas, such amounts in respect of travelling and subsistence or other expenses incurred by members of the Council in the performance of their functions as such members as the Minister may determine.
(9) The Council shall regulate, by rules or otherwise, the procedure and business of the Council.
(10) References in any other Act or instrument made thereunder to the National Monuments Advisory Council shall be construed as references to the Historic Monuments Council.
Register of Historic Monuments.
5.—(1) The Commissioners shall cause to be established and maintained a register of historic monuments which shall be known as “the Register of Historic Monuments” and is referred to in this Act as “the Register”.
(2) The Commissioners shall cause to be entered in the Register the name, location and a brief description of—
(a) the historic monuments in the State which are known to them upon the commencement of this section,
(b) the other archaeological areas in the State which are known to them upon such commencement, and
(c) any historic monuments, or other archaeological areas, which become known to them after such commencement
and which, in their opinion, should be so entered.
(3) The Commissioners may amend or delete an entry in the Register.
(4) Subject to subsection (6) of this section, the Commissioners shall, as soon as may be after the establishment of the Register, cause to be published in Iris Oifigiúil a list specifying the historic monuments and archaeological areas then entered in the Register and such extracts, if any, from the Register in relation to those monuments and areas as they think appropriate.
(5) The Commissioners shall, as soon as may be after the making of an addition to, amendment of, or deletion from the Register, cause notice of the addition, amendment or deletion to be published in Iris Oifigiúil.
(6) The name, location and a brief description of a monument that was included in a list published in Iris Oifigiúil pursuant to section 8 of the National Monuments (Amendment) Act, 1954, shall be entered in the Register, but subsection (4) of this section shall not apply in relation to the monument.
(7) Where—
(a) an entry is made in the Register in respect of a historic monument, or other archaeological area, or
(b) an entry made in the Register in respect of a monument or other archaeological area is amended or deleted,
the Commissioners shall, as soon as may be, cause the reputed owner and (if the owner is not the occupier) the reputed occupier of the monument or area to be notified in writing of the entry, amendment or deletion as the case may be and, in a case to which paragraph (a) of this subsection applies, of the penalties which may be incurred by a person guilty of an offence under this section or section 2 of this Act.
(8) Where the owner or occupier (not being the Commissioners) of a historic monument or archaeological area that is entered in the Register or any other person proposes to carry out, or to cause or permit the carrying out of, any work at or in relation to the monument or area, he shall give notice in writing of his proposal to the Commissioners and shall not, except in a case of urgent necessity and with the consent of the Commissioners, commence the work for a period of two months after having given the notice.
(9) A notification under subsection (7) of this section shall be sent to the person concerned by registered post or be delivered to him by hand by an officer, servant or agent of the Commissioners.
(10) A person shall not, otherwise than in accordance with subsection (8) of this section or a consent under section 14 (2) of the Principal Act, demolish or remove wholly or in part or disfigure, deface, alter or in any manner interfere with a historic monument that is entered in the Register.
(11) A person who contravenes this section shall be guilty of an offence.
(12) Prima facie evidence of the fact that a historic monument or archaeological area is entered in the Register may be given in any court by the production of a copy of Iris Oifigiúil purporting to contain a list published therein pursuant to subsection (4) of this section or section 8 of the National Monuments (Amendment) Act, 1954, or a notice published therein pursuant to subsection (5) of this section, being a list or notice in which is specified the monument or archaeological area, as the case may be, aforesaid.
Acquisition of national monuments etc., by Commissioners.
6.—(1) The Commissioners may, with the consent of the Minister, acquire by agreement or compulsorily—
(a) any monument that is, in their opinion, a national monument,
(b) part of such a monument, or
(c) any land that is in the vicinity of such a monument and is intended to be used by them for the provision of facilities for persons having access to the monument under the National Monuments Acts, 1930 to 1987,
and the Commissioners may so acquire any such monument or land whether they or a local authority are or are not the guardians of the monument and whether a preservation order is or is not in force in regard thereto.
(2) The amount of the price or compensations to be paid by the Commissioners for any property acquired by them under this section shall, in default of agreement, be fixed under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919, and that Act shall apply accordingly with any necessary modifications.
(3) Sections 69 to 83 of the Lands Clauses Consolidation Act, 1845 (as adapted or amended by or under any subsequent enactment), shall apply, with any necessary modifications, to any price or compensation payable under this section and to the conveyance to the Commissioners of any property acquired under this section and, for the purposes of the application, the Commissioners shall be deemed to be the promoters of the undertaking and this Act shall be deemed to be the special Act.
(4) The price or compensation payable on the acquisition of property under this section shall, to such extent as may be sanctioned by the Minister, be paid out of moneys provided by the Oireachtas.
(5) The Commissioners shall not acquire under this section without the consent of the Irish Land Commission any property on or forming part of land subject to a land purchase annuity or the subject of a land purchase agreement or vested or in the course of being vested in the Irish Land Commission.
(6) Where any property acquired under this section is subject, either alone or in conjunction with other land, to a land purchase annuity, payment in lieu of rent or other sum payable periodically (and not being merely rent payable under a contract of tenancy) payable to the Irish Land Commission—
(a) the Commissioners shall as from the date on which they acquire, or enter on and take possession of, the land, whichever date is the earlier, become and be liable for payment to the said Commission of such periodical sum, or such portion thereof as shall be apportioned by the said Commission on the property, as if the property had been transferred to the Commissioners by the owner thereof on that date,
(b) the Commissioners shall be entitled, if they so think fit, to redeem the periodical sum or the portion thereof aforesaid, and
(c) the Commissioners shall be obliged, if required by the saidCommission so to do, to redeem the periodical sum or the portion thereof aforesaid.
Removal of national monuments to museums, etc.
7.—(1) Where the Commissioners or a local authority are the owners of a national monument, the Commissioners or the authority (as the case may be) may, if in their opinion they can do so without undue injury to the monument and it is desirable for the protection or preservation of the monument or in the interests of archaeology or for any other reason to do so, and with, in case the authority are the owners of the monument, the consent of the Commissioners, remove the monument or any part of it, and deposit it and keep it deposited in a public museum, or other place, in the State approved of for the time being for the purpose by the Minister.
(2) A monument deposited under this section in a museum shall while so deposited be open to inspection by the public in like manner and to the like extent as the other objects in the museum.
Inspection of historic monuments.
8.—(1) The Commissioners may cause such inspections, investigations and reports as they may direct (either generally or particularly) to be made by their officers, servants, agents or other persons duly authorised by them in that behalf in regard to—
(a) historic monuments and places where the Commissioners have reason to believe that historic monuments exist, and
(b) restricted areas and sites that the Commissioners have reason to believe to be the sites of wreck or archaeological objects.
(2) The Commissioners, their officers, servants or agents, or other persons duly authorised by the Commissioners in that behalf, may for the purpose of performing their functions under this section enter on any lands or premises and there do all such things as may reasonably be necessary for the purposes of those functions.
Power of Commissioners and local authorities to make bye-laws.
9.—(1) The Commissioners with the approval of the Minister, or a local authority with the approval of the Commissioners, as the case may be, may, for the purposes of their functions under this Act, make bye-laws in relation to any national monument of which they are the owners or the guardians.
(2) A person who contravenes a bye-law under this section shall be guilty of an offence.
(3) Copies of a bye-law under this section shall be displayed at, or in the vicinity of, any national monument to which it relates in such manner and place as, in the opinion of the Commissioners or the local authority concerned, as the case may be, are best calculated to bring the bye-law to the attention of those at or in the vicinity of the monument.
Acceptance of voluntary contributions.
10.—The Commissioners or a local authority may accept voluntary contributions towards the cost of, or voluntary assistance in the performance of, any of their functions under the National Monuments Acts, 1930 to 1987, or in relation to the carrying out of an archaeological excavation authorised by the Commissioners by licence under section 26 of the Principal Act if the conditions (if any) attached by the donor to the acceptance thereof are not inconsistent with those functions or the carrying out of the excavation.
Amendment of section 2 of Principal Act.
11.—Section 2 of the Principal Act is hereby amended—
(a) by the substitution of the following definition for the definition of “monument”:
“‘monument’ includes the following, whether above or below the surface of the ground or the water and whether affixed or not affixed to the ground—
(a) any artificial or partly artificial building, structure or erection or group of such buildings, structures or erections,
(b) any cave, stone or other natural product, whether or not forming part of the ground, that has been artificially carved, sculptured or worked upon or which (where it does not form part of the place where it is) appears to have been purposely put or arranged in position,
(c) any, or any part of any, prehistoric or ancient—
(i) tomb, grave or burial deposit, or
(ii) ritual, industrial or habitation site,
and
(d) any place comprising the remains or traces of any such building, structure or erection, any such cave, stone or natural product or any such tomb, grave, burial deposit or ritual, industrial or habitation site,
situated on land or in the territorial waters of the State, but does not include any building, or part of any building, that is habitually used for ecclesiastical purposes;”,
(b) by the substitution of the following definition for the definition of “owner”:
“‘owner’, when used in relation to a monument or archaeological area, means the person for the time being having such estate or interest in the monument or archaeological area as entitles him to the actual possession and occupation thereof;”,
and
(c) by the insertion of the following definition:
“‘land’ includes land covered by water;”.
Amendment of section 12 of Principal Act.
12.—Section 12 of the Principal Act is hereby amended by the insertion of the following subsection after subsection (2):
“(3) Where the Commissioners or a local authority are the owners of a national monument, the Commissioners or the authority, as the case may be, may, in addition to maintaining the monument, carry out such other work and do such other things as they think fit to or at the monument and for thosepurposes they and their officers, workmen, agents and licensees shall have free access to the monument and may for those purposes and for the purpose of such maintenance bring onto and use on any land machinery, vehicles, equipment and materials.”.
Amendment of section 14 of Principal Act.
13.—Section 14 of the Principal Act is hereby amended by the insertion in subsection (1) of the following paragraph after paragraph (b):
“(bb) to renovate or restore a national monument without or otherwise than in accordance with the consent hereinafter mentioned, or”.
Amendment of section 22 of Principal Act.
14.—Section 22 of the Principal Act is hereby amended by the substitution of “Historic” for “National” in subsection (1) and the said subsection, as so amended, is set out in the Table to this section.
TABLE
(1) A local authority may establish an advisory committee (in this Act referred to as a local advisory committee) to perform the functions mentioned in this section and every such committee shall be styled and known by the name of the functional area of the local authority by whom it is established followed by the words “Historic Monuments Advisory Committee”.
Amendment of section 23 of Principal Act.
15.—Section 23 of the Principal Act is hereby amended by the substitution of the following subsections for subsection (1):
“(1) A person who finds an archaeological object shall, within 4 days after the finding, make a report of it to a member of the Garda Síochána on duty in the district in which the object was found or the Director of the National Museum or a servant or agent of his and shall when making the report state his own name and address, the nature or character of the said object and the time and place at which and the circumstances in which it was found, and shall also, and whether he has or has not made such report as aforesaid, and irrespective of the person to whom he has made the report (if any), give to any member of the Garda Síochána or to the said Director or a servant or agent of his on request any information within his knowledge in relation to the object or the finding thereof and shall permit—
(a) any member of the Garda Síochána or the said Director or a servant or agent of his to inspect, examine or photograph the object, and
(b) the said Director or a servant or agent of his to take possession of the object.
(1A) A member of the Garda Síochána to whom a report under subsection (1) of this section is made shall, without undue delay, notify the said Director, or a servant or agent of his, of the finding to which the report relates and the said Director, or a servant or agent of his duly authorised by him in that behalf, may take possession of the object to which a report under the said subsection (1) relates and the said Director may retain possession of it until the expiration of the period of 6 weeks from the time when the said Director or a servant or agent of his was informed in pursuance of this section of the finding and the Director shall then return the object to the person from whom possession of it was taken under this subsection.”.
Amendment of section 26 of Principal Act.
16.—Section 26 of the Principal Act is hereby amended by the substitution in subsection (2) for “The Commissioners” of “Upon application therefor by any person to the Commissioners and upon being furnished by him with such information in relation to the application as they may reasonably require and after payment to them by the person of such fee (if any) as may be prescribed under section 24 of the National Monuments (Amendment) Act, 1987, for the purposes of this section, the Commissioners”, and the said subsection, as so amended, is set out in the Table to this section.

(2) Upon application therefor by any person to the Commissioners and upon being furnished by him with such information in relation to the application as they may reasonably require and after payment to them by the person of such fee (if any) as may be prescribed under section 24 of the National Monuments (Amendment) Act, 1987, for the purposes of this section, the Commissioners may at their discretion issue to any person a licence to dig or excavate in or under any specified land for any specified archaeological purpose and may insert in any such licence such conditions and restrictions as they shall think proper.
Increase of certain penalties under Principal Act.
17.—(1) Sections 14 (4), 24 (3) and 25 (3) of the Principal Act are hereby amended by the substitution of:
“shall be liable—
(a) on summary conviction, to a fine not exceeding £1,000 or, at the discretion of the Court, to imprisonment for a term not exceeding 6 months or to both the fine and the imprisonment, or
(b) on conviction on indictment, to a fine not exceeding £50,000 or, at the discretion of the Court, to imprisonment for a term not exceeding 12 months or to both the fine and the imprisonment”
for “shall be liable on summary conviction thereof to a fine not exceeding fifty pounds or, at the discretion of the Court, to imprisonment for any term not exceeding six months or to both such fine and such imprisonment”.
(2) Section 17 (4) of the Principal Act is hereby amended by the substitution of “a fine not exceeding £300” for “a fine not exceeding twenty pounds”.
(3) Section 23 (2) of the Principal Act is hereby amended by the substitution of “a fine not exceeding £1,000” for “a fine not exceeding ten pounds”.
(4) Section 26 (3) of the Principal Act is hereby amended by the substitution of:
“shall be liable—
(a) on summary conviction, to a fine not exceeding £1,000 or, at the discretion of the Court, to imprisonment for a term not exceeding 6 months or to both the fine and the imprisonment, or
(b) on conviction on indictment, to a fine not exceeding £50,000 or, at the discretion of the Court, to imprisonment for a term not exceeding 12 months or to both the fine and the imprisonment”
for “shall be liable on summary conviction thereof to a fine not exceeding twenty-five pounds”.
Provisions in relation to officers, servants and agents of Commissioners.
18.—(1) An officer, servant or agent of the Commissioners, or other person duly authorised by them in that behalf, acting in the exercise of powers or the performance of functions or duties, under the National Monuments Acts, 1930 to 1987, shall be authorised in writing by the Commissioners so to act and shall, if so requested by any person affected by his so acting, produce the authorisation for inspection by the person.
(2) A person who obstructs or otherwise interferes with an officer, servant or agent of the Commissioners, or any other person duly authorised by them in that behalf, acting in the exercise of powers, or the performance of functions or duties, under the National Monuments Acts, 1930 to 1987, shall be guilty of an offence.
Registration as burdens affecting registered land of certain matters.
19.—There may be registered under the Registration of Title Act, 1964, in the appropriate register maintained under that Act as a burden affecting registered land (within the meaning of that Act) any of the following, namely:
(a) the entry in the Register of a historic monument or an archaeological area situated on the land,
(b) a preservation order in respect of a national monument situated on the land,
(c) a deed of a kind referred to in section 5 or 6 of the Principal Act appointing the Commissioners or a local authority to be the guardians of a national monument situated on the land,
(d) an order under section 9(2) of the Principal Act appointing the Commissioners to be guardians of a national monument situated on the land.
Withholding information regarding archaeological objects.
20.—(1) Where a member of the Garda Síochána—
(a) has reasonable grounds for believing that an offence under the National Monuments Acts, 1930 to 1987, involving an archaeological object has been committed,
(b) finds any person in possession of an archaeological object,
(c) has reasonable grounds for believing that the archaeological object referred to in paragraph (b) of this subsection is the archaeological object referred to in paragraph (a) of this subsection,
he may require the person to give him an account of how he came by the object, and if the person fails or refuses, without reasonable excuse, to do so or gives information that he knows to be false or misleading, he shall be guilty of an offence.
(2) Subsection (1) of this section shall not have effect unless the accused when required to give the account was told in ordinary language by the member of the Garda Síochána concerned what the effect of the failure or refusal might be.
(3) Any information given by a person in compliance with a requirement under subsection (1) of this section shall not be admissible in evidence against that person or his spouse in any proceedings, civil or criminal, other than proceedings for an offence under that subsection.
Duty to give name and address to member of Garda Síochána.
21.—(1) Where a member of the Garda Síochána suspects that a person has committed a specified offence under the National Monuments Acts, 1930 to 1987, and so alleges to the person, the member may demand of the person his name and address and may, if the person refuses to give his name and address or gives a name or address that the member has reasonable grounds for believing to be false or misleading, arrest the person without warrant.
(2) Where a person, when his name and address is demanded of him under this section, refuses or fails to give his name and address or gives a name and address which is false or misleading, he shall be guilty of an offence.
Powers of search and seizure.
22.—(1) If a justice of the District Court is satisfied, by information on oath and in writing furnished by a member of the Garda Síochána, that there are reasonable grounds for believing that evidence relating to the commission of an offence under the National Monuments Acts, 1930 to 1987, is to be found in any building or part of a building or in any vehicle, vessel, aircraft or hovercraft or in any other place whatsoever, he may issue to the member a search warrant in relation to such place.
(2) A search warrant under this section shall operate to authorise the member of the Garda Síochána named in the warrant, accompanied by any other members of the Garda Síochána, to enter, within one week from the date of the warrant, and if necessary by the use of force, any building or part of a building or any vehicle, vessel, aircraft or hovercraft or any other place named in the warrant, and to search it and any person found there, and to seize anything found there or on any such person that may be such evidence as aforesaid.
(3) A member of the Garda Síochána acting under the authority of a search warrant under this section may—
(a) demand of a person found at the place of search his name and address, and
(b) if the person refuses to give his name and address or gives a name and address that the member has reasonable grounds for believing to be false or misleading, arrest the person without warrant.
(4) Any person who obstructs or attempts to obstruct a member of the Garda Síochána acting under the authority of a search warrant under this section or who, when his name and address is demanded of him pursuant to subsection (3) of this section, fails or refuses to give his name or address or gives a name or address that is false or misleading shall be guilty of an offence.
Penalties, etc.
23.—(1) A person guilty of an offence under section 2 (other than an offence consisting of a contravention of subsection (1) (c)), 3 (other than an offence consisting of a contravention of subsection (6)) or 5 of this Act shall be liable—
(a) on summary conviction, to a fine not exceeding £1,000 or, at the discretion of the Court, to imprisonment for a term not exceeding 6 months or to both the fine and the imprisonment, or
(b) on conviction on indictment, to a fine not exceeding £50,000or, at the discretion of the Court, to imprisonment for a term not exceeding 12 months or to both the fine and the imprisonment.
(2) A person guilty of an offence under section 2 (being an offence consisting of a contravention of subsection (1) (c)), 3 (being an offence consisting of a contravention of subsection (6)), 9 or 18 of this Act shall be liable, upon summary conviction, to a fine not exceeding £1,000.
(3) A person guilty of an offence under section 20, 21 or 22 of this Act shall be liable on summary conviction to a fine not exceeding £1,000 or, at the discretion of the court, to imprisonment for a period not exceeding 3 months or to both the fine and the imprisonment.
(4) A summary offence under the National Monuments Acts, 1930 to 1987, may be prosecuted by the Commissioners.
Fees.
24.—(1) The Commissioners may, with the consent of the Minister by regulations prescribe fees for the purposes of sections 2 and 3 of this Act and section 26 of the Principal Act.
(2) Regulations under this section may prescribe different fees for different circumstances and for different classes of persons, and may prescribe fees for some circumstances only or for all circumstances or for some classes of persons only or for all classes of persons.
(3) Fees paid to the Commissioners under this Act shall be paid by them to the Minister for Finance.
(4) The Public Offices Fees Act, 1879, shall not apply in respect of any fees payable under this Act.
Laying of orders, regulations and bye-laws before Houses of Oireachtas.
25.—Every order, regulation and bye-law made under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the order, regulation or bye-law, as the case may be, is passed by either such House within the next twenty-one days on which that House has sat after the order, regulation or bye-law, as the case may be, is laid before it, the order, regulation or bye-law, as the case may be, shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Repeals.
26.—Sections 11, 13, 20 and 21 of the Principal Act and sections 8, 11 and 15 of the National Monuments (Amendment) Act, 1954, are hereby repealed.
Short title, construction, collective citation and commencement.
27.—(1) This Act may be cited as the National Monuments (Amendment) Act, 1987.
(2) The Acts and this Act shall be construed together as one Act.
(3) The Acts and this Act may be cited together as the National Monuments Acts, 1930 to 1987.
(4) This Act shall come into operation on such day or days as, by order or orders made by the Minister under this section, may be fixed therefor either generally or with reference to any particular purpose or provision and different days may be so fixed for different purposes and different provisions.
