ACHT LEICTREACHAIS (SOLÁTHAR) (LEASÚ), 1930.
Mínithe.
1.—San Acht so cialluíonn an abairt “an Príomh-Acht” an tAcht Leictreachais (Soláthar), 1927 (Uimh. 27 de 1927), agus cialluíonn an abairt “Acht 1929” an tAcht Leictreachais (Airgead), 1929 (Uimh. 26 de 1929).
An Príomh-Acht agus an tAcht so do léiriú.
2.—Léighfear agus léireofar an Príomh-Acht agus an tAcht so mar aon Acht amháin, agus dá réir sin tá ag abairtí agus ag focail a húsáidtear san Acht so agus a húsáidtear leis sa Phríomh-Acht na brigheanna céanna san Acht so atá acu fé seach sa Phríomh-Acht ach amháin go bhfoluíonn an abairt “údarás áitiúil” san Acht so aon chólucht daoine ag á bhfuil comhacht fé Acht de Pháirlimint na hÉireann no fé aon Acht áitiúil no pearsanta de Pháirlimint na Ríochta Aontuithe no fé aon Acht príobháideach den Oireachtas chun ráta do mheas agus do ghearra ar thalamh no ar dhaoine maidir le talamh do bheith ina seilbh.
Oibreacha do dhéanamh in ionad chúitimh.
3.—(1) I gcás duine do bheith i dteideal cúitimh, láithreach no ar ball, maidir le héinní do rinne an tAire no a bheidh fé a dhéanamh go dleathach fé Acht Leictreachais na Sionainne, 1925 (Uimh. 26 de 1925), féadfaidh an tAire pé oibreacha do dhéanamh ar mhaithe leis an duine sin is dó leis an Aire is ceart agus a aontóidh an duine sin a ghlaca mar shásamh no mar shásamh leathrannach ina éileamh ar an gcúiteamh san.
(2) Féadfaidh an tAire a ordú go mbeidh ag gabháil le hoibreacha do dhéanamh fén alt so pé téarmaí agus coiníollacha (ar a n-áirítear téarmaí maidir le húnaereacht, le seilbh, agus le cúram na n-oibreacha) ar a gcó-aontóidh an tAire agus an duine gur ar mhaithe leis a déanfar na hoibreacha amhlaidh.
(3) Tuigfear, chun crícheanna Acht Leictreachais na Sionainne, 1925, oibreacha do dhéanamh fén alt so do bheith ar cheann de sna rudaí go bhfuil údarás ag an Aire le fo-alt (1) d'alt 3 den Acht san a dhéanamh agus beidh feidhm ag an Acht san dá réir sin.
(4) Aireofar airgead a caithfear in oibreacha do dhéanamh fén alt so ar na suimeanna dá ngairmtear “na roimh-íocanna san” in alt 15 den Phríomh-Acht ach ní bheidh na hoibreacha san mar chuid d'oibreacha na Sionainne do réir bhrí an Phríomh-Achta.
(5) Féadfaidh an tAire, le hordú a dhéanfa sé le toiliú an Aire Rialtais Áitiúla agus Sláinte Puiblí, a dhearbhú go mbeidh aon oibreacha áirithe a déanfar fén alt so saor, go buan no go ceann tréimhse teoranta, o ráta dealbhais do ghearra ortha agus fós o aon ráta eile do ghearra ortha a dhéanfaidh údarás áitiúil, agus pé uair a déanfar ordú ar bith den tsórt san beidh na hoibreacha le n-a mbainfidh an t-ordú san saor o rátaí do réir an orduithe sin.
(6) Beidh éifeacht ag an alt so agus tuigfear éifeacht do bheith aige ón 4adh lá d'Iúl, 1925.
Alt 12 den Phríomh-Acht do leasú.
4.—(1) In ainneoin éinní atá i bhfo-alt (3) d'alt 12 den Phríomh-Acht mar a leasuítear é le hAcht 1929, féadfaidh méid iomlán na suimeanna a roimh-íocfar leis an mBord aon leathbhliain áirithe fén alt san mar a leasuítear amhlaidh é chun aon chríche, seachas chun glanta an fhiachais agus na gcostaisí luaidhtear i bhfo-alt (2) den alt san mar a leasuítear amhlaidh é, féadfa sé dul thar an teorainn de cheithre chéad míle púnt a forchuirtear le fo-alt san (3) aon leath-bhliain áirithe gurb é tuairim an Aire Airgid ina taobh go bhfuil sé oiriúnach, mar gheall ar nithe speisialta bhaineann leis an leath-bhliain sin, dul thar an teorainn sin.
(2) Beidh éifeacht ag an alt so agus tuigfear éifeacht do bheith aige ar an 1adh lá d'Eanar, 1930, agus as san amach.
Alt 13 den Phríomh-Acht do leasú.
5.—Léireofar alt 13 den Phríomh-Acht agus beidh éifeacht aige, agus tuigfear go raibh éifeacht riamh aige, fé is—
(a) dá bhfágtaí na focail “am an roimh-íoctha” ar lár i bhfo-alt (1) de; agus
(b) dá gcuirtí an fo-alt so leanas leis, sé sin le rá:—
“(5) Féadfaidh an tAire Airgid o am go ham an ráta gur dá réir a bheidh ús is iníoctha fén alt so le n'íoc d'atharú.”

6.—Féadfaidh an tAire Airgid o am go ham an ráta gur dá réir a bheidh ús is iníoctha fé alt 14 den Phríomh-Acht le n'íoc d'atharú.
Alt 15 den Phríomh-Acht do leasú.
7.—Léireofar alt 15 den Phríomh-Acht mar a leasuítear é le hAcht 1929, agus beidh éifeacht aige, agus tuigfear éifeacht do bheith aige ar an 25adh lá de Mhárta, 1929, agus as san amach, fé is—
(a) dá bhfágtaí na focail “an uair a thosnóidh an t-ús san ar rith” atá i bhfo-alt (3) dhe ar lár sa bhfo-alt san; agus
(b) dá bhfágtaí fo-alt (6) dhe ar lár agus an fo-alt so leanas de chur isteach ann in ionad fo-alt san (6), sé sin le rá:—
“(6) An t-ús go léir a bheidh dlite ar na roimhíocanna san no ar aon chuid díobh an uair a thiocfaidh an Bord, fén alt so, fé fhiachas aisíoctha na roimh-íoc san no na coda san díobh íocfar leis an Aire Airgid é laistigh de thréimhse shé mhí no de pé tréimhse is sia ná san ordóidh an tAire sin in aon chás áirithe tar éis an Bord do theacht fé fhiachas an aisíoctha san amhlaidh, agus má theipeann ar an mBord aon ús den tsórt san d'íoc laistigh den tréimhse sin íocfaidh an Bord leis an Aire sin ús do réir an ráta bheidh ceaptha ag an Aire sin, ar an ús san a bheidh dlite amhlaidh, o dheire na tréimhse sin go dtí go n-íocfar an céanna;” agus
(c) dá gcuirtí an dá fho-alt so leanas leis, sé sin le rá:—
“(10) Féadfaidh an tAire Airgid, tar éis do dul i gcomhairle leis an Aire Tionnscail agus Tráchtála, aon tsuim do shocruigh sé roimhe sin fé fho-alt (2) den alt so mar chuid chothromúil de sna roimh-íocanna san agus den ús ortha agus go dtiocfaidh an Bord fé fhiachas a n-aisíoctha fén bhfo-alt san d'atharú, ach ní déanfar aon atharú den tsórt san maidir le haon tsuim den tsórt san tar éis an dáta a ceapfar fé fho-alt (4) den alt so chun na híocaíochtaí leath-bhliantúla do thosnú maidir leis an tsuim sin agus pé uair a dhéanfaidh an tAire Airgid aon atharú den tsórt san fén bhfo-alt so déanfa sé pé ceartú ar na híocaíochtaí a rinne no a dhéanfaidh an Bord fé fho-ailt (3) agus (6) den alt so is ceart agus is cothrom dar leis do dhéanamh mar gheall ar an atharú san.
(11) Féadfaidh an tAire Airgid o am go ham an ráta gur dá réir a bheidh aon ús is iníoctha fén alt so le n'íoc d'atharú.”

8.—Folóidh an abairt “údarás áitiúil” san áit ina bhfuil sí in alt 96 den Phríomh-Acht aon chólucht daoine ag á bhfuil comhacht fé Acht de Pháirlimint na hÉireann no fé aon Acht áitiúil no pearsanta de Pháirlimint na Ríochta Aontuithe no fé aon Acht príobháideach den Oireachtas chun ráta do mheas agus do ghearra ar thalamh no ar dhaoine maidir le talamh do bheith ina seilbh, agus léireofar an t-alt san agus beidh éifeacht aige dá réir sin.
An Chéad Sceideal a ghabhann leis an bPríomh-Acht do leasú.
9.—(1) Leasuítear leis seo mír 1 den Chéad Sceideal a ghabhann leis an bPríomh-Acht tré sna focail “d'fháil ón ngnóthaire údaruithe no ón ngnóthaire reachtúil sin” do chur isteach tar éis na bhfigiúirí “1927.”
(2) Beidh éifeacht ag an alt so agus tuigfear éifeacht do bheith achtuítear leis seo mar leanas, sé sin le rá:—
Freagarthacht ghenerálta an Bhúird maidir le rátaí.
10.—(1) Chun deire do chur le hamhrus dearbhuítear agus achtuítear leis seo mar leanas, sé sin le rá:—
(a) chun freagarthacht an Bhúird do shocrú maidir le haon ráta is inghearrtha ag údarás áitiúil d'íoc ní hionann agus níorbh ionann riamh aon ionoighreachta, tionóntachán no áitreabh do bheadh ionchurtha fé ráta mara mbeadh san do bheith á úsáid no i seilbh ag an mBord agus an ionoighreachta, an tionóntachán no an t-áitreabh san do bheith á úsáid no i seilbh ag an Stát no ag Roinn Stáit agus ní bhronnann an úsáid ná an sealbh san agus níor bhronnadar riamh na saoirsí a ghabhann le húsáid no le seilbh ag an Stát; agus
(b) ní hionann ionoighreachta, tionóntachán, no áitreabh do bheith á úsáid no i seilbh ag an mBord agus é bheith in úsáid no i seilbh de shaghas puiblí no chun críche puiblí do réir bhrí alt 63 den Poor Relief (Ireland) Act, 1838, no do réir bhrí alt 16 den Valuation (Ireland) Act, 1852, no do réir bhrí alt 2 den Valuation (Ireland) Act, 1854, no do réir aon achtacháin eile (ach amháin alt 96 den Phríomh-Acht) a bhronnann saoirse o ráta is inghearrtha ag údaráis áitiúla go generálta no ag aon údarás áitiúil áirithe no saghas áirithe údarásanna áitiúla.
(2) Ní dhéanfaidh éinní san alt so an tsaoirse o rátaí a bronntar ar an mBord le halt 96 den Phríomh-Acht mar a leasuítear é leis an Acht so do chur ar ceal ná dochar ná deifir do dhéanamh di.
An Bord do rátú maidir le gnóthaí do tógadh.
11.—(1) Chun crícheanna aon ráta is inghearrtha ag údarás áitiúil do mheas agus do ghearra tuigfear gurb ionann luacháil aon ionoighreachta no tionóntacháin is ionchurtha fén ráta san agus a thiocfaidh chun bheith dílsithe sa Bhord de bhua ordú dílsiúcháin a rinneadh no a déanfar (roimh an Acht so do rith no dá éis sin) fé alt 39 den Phríomh-Acht no de bhua leithlithe a rinneadh no a déanfar (roimh an Acht so do rith no dá éis sin) do réir có-aontú a rinneadh fé fho-alt (2) d'alt 38 den Phríomh-Acht, tuigfear gurb ionann an luacháil sin, faid fhanfaidh an ionoighreachta no an tionóntachán san i seilbh an Bhúird, agus pé ceann de sna luachála so leanas a bhaineann leis an gcás, sé sin le rá:—
(a) i gcás an t-ordú dílsiúcháin no an leithliú gur dá bhua tháinig an ionoighreachta no an tionóntachán san chun bheith dílsithe sa Bhord do dhéanamh roimh an Acht so do rith, an luacháil fé sna hAchtanna Luachála a bhí i bhfeidhm maidir leis an ionoighreachta no leis an tionóntachán san ar dháta an ordú dílsiúcháin no an leithlithe sin (pe'ca aca é); agus
(b) i gcás an t-ordú dílsiúcháin no an leithliú le n-a dtiocfaidh an ionoighreachta no an tionóntachán san chun bheith dílsithe sa Bhord do dhéanamh tar éis an Acht so do rith, an luacháil fé sna hAchtanna Luachála a bhí i bhfeidhm maidir leis an ionoighreachta no leis an tionóntachán san in aghaidh na bliana dar thosach an 1adh lá d'Abrán, 1929.
(2) Pé uair a scuirfidh aon ionoighreachta no tionóntachán a thagann chun bheith dílsithe sa Bhord de bhua ordú dílsiúcháin a rinneadh no a déanfar (roimh an Acht so do rith no dá éis sin) fé alt 39 den Phríomh-Acht no de bhua leithlithe a rinneadh no a déanfar (roimh an Acht so do rith no dá éis sin) do réir có-aontú a rinneadh fé fho-alt (2) d'alt 38 den Phríomh-Acht do bheith i seilbh an Bhúird, déanfaidh an Bord ón gcéad 1adh lá d'Abrán tar éis an scurtha san blianacht shíorraí d'íoc le gach údarás áitiúil a rinne rátaí do ghearra maidir leis an áitreabh san in aghaidh na bliana bhí ag rith an uair sin a bheidh có-mhéid leis na rátaí do ghearr an t-údarás áitiúil sin ar an ionoighreachta no ar an tionóntachán san in aghaidh na bliana dar chríoch an 31adh lá de Mhárta roimh dháta an scurtha san, agus beidh gach blianacht den tsórt san iníoctha ina híocaíochtaí có-ionanna leathbhliantúla roimh ré ar gach 1adh lá d'Abrán agus ar gach 1adh lá de Dheire Fomhair agus féadfaidh an t-údarás áitiúil sin iad do bhaint den Bhord mar fhiacha síbhialta.
Maoin áirithe is leis an mBord do shaora o rátaí.
12.—(1) Bainfidh alt (2) den Valuation (Ireland) Act, 1854, le hionoighreachtaí agus le tionóntacháin le n-a mbaineann an t-alt so agus leis na cíosa bliantúla a gheobhfar asta díreach fé is dá n-áirítí na hionoighreachtaí agus na tionóntacháin sin ar na hionoighreachtaí agus ar na tionóntacháin a luaidhtear in alt san 2.
(2) Baineann an t-alt so le gach ionoighreachta no tionóntachán a bheidh de thurus na huaire—
(a) gan bheith ina chuid d'oibreacha na Sionainne; agus
(b) in aon-tseilbh an Bhúird; agus
(c) á úsáid ar fad mar stáisiún geiniúna no mar chóir iompair no mar chuid de chóir iompair no mar chóir roinneacháin no mar chuid de chóir roinneacháin; agus
(d) gan bheith tagtha chun bheith dílsithe sa Bhord (pe'ca roimh an Acht so do rith é no dá éis sin) de bhua ordú dílsiúcháin do rinneadh no a déanfar fé alt 39 den Phríomh-Acht no de bhua leithlithe do rinneadh no a déanfar do réir có-aontú do rinneadh fé fho-alt (2) d'alt 38 den Phríomh-Acht.

13.—(1) Pé uair a scuirfidh an Bord no inar scuir sé, roimh an Acht so do rith, ar fad no go leathrannach d'aon stáisiún geiniúna a tháinig chun bheith dílsithe ann (pe'ca roimh an Acht so do rith é no dá éis sin) de bhua ordú dílsiúcháin do rinneadh fé alt 39 den Phríomh-Acht no de bhua leithlithe do rinneadh do réir có-aontú do rinneadh fé fho-alt (2) d'alt 38 den Phríomh-Acht d'úsáid mar stáisiún geiniúna bainfidh an Chéad Sceideal a ghabhann leis an bPríomh-Acht agus (más roimh an Acht so do rith do thárla an scur san) tuigfear gur bhain sé riamh le gach duine bhí ar fostú ag an mBord sa stáisiún geiniúna san ar dháta an scurtha san.
(2) Chun crícheanna an Chéad Sceideal a ghabhann leis an bPríomh-Acht do chur i mbaint le daoine le n-a mbaineann an Sceideal san de bhua an ailt seo beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) tuigfear gur gnóthaire údaruithe an Bord, agus
(b) tuigfear gur do réir ordú, do rinneadh fén bPríomh-Acht an lá do thárla an scur, á éileamh ar an mBord scur (ar fad no go leathrannach pe'ca aca is gá sa chás) den stáisiún geiniúna d'úsáid mar stáisiún geiniúna do scuir an Bord (pe'ca ar fad é no go leathrannach) den stáisiún geiniúna san d'úsáid mar stáisiún geiniúna, agus

14.—(1) Pé uair a scuirfidh gnóthaire údaruithe, gnóthaire reachtúil, no gnóthaire ceaduithe no inar scuir sé roimh an Acht so do rith, ar fad no go leathrannach de stáisiún geiniúna d'úsáid mar stáisiún geiniúna toisc soláthar leictreachais d'fháil ón mBord bainfidh an Chéad Sceideal a ghabhann leis an bPríomh-Acht agus (más roimh an Acht so do rith do thárla an scur san) tuigfear gur bhain sé riamh le gach duine bhí ar fostú ag aon ghnóthaire den tsórt san sa stáisiún geiniúna san ar dháta an scurtha san.
(2) Chun crícheanna an Chéad Sceideal a ghabhann leis an bPríomh-Acht do chur i mbaint le daoine le n-a mbaineann an Sceideal san de bhua an ailt seo beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) tuigfear gur do réir ordú, do rinneadh fén bPríomh-Acht an lá do tharla an scur, á éileamh ar an ngnóthaire scur (ar fad no go leathrannach pe'ca aca is gá sa chás) den stáisiún geiniúna d'úsáid mar stáisiún geiniúna do scuir an gnóthaire sin (pe'ca ar fad é no go leathrannach) den stáisiún geiniúna san d'úsáid mar stáisiún geiniúna, agus

15.—(1) Féadfar an tAcht Leictreachais (Soláthar) (Leasú), 1930, do ghairm den Acht so.
(2) Féadfar na hAchtanna Leictreachais (Soláthar). 1927 go 1930, do ghairm den Phríomh-Acht, d'Acht 1929, agus den Acht so le chéile.

ELECTRICITY (SUPPLY) (AMENDMENT) ACT, 1930.
Definitions.
1.—In this Act the expression “the Principal Act” means the Electricity (Supply) Act, 1927 (No. 27 of 1927), and the expression “the Act of 1929” means the Electricity (Finance) Act, 1929 (No. 26 of 1929).
Construction of the Principal Act and this Act.
2.—The Principal Act and this Act shall be read and construed as one Act, and accordingly expressions and words used in this Act which are also used in the Principal Act have the same meanings in this Act as they respectively have in the Principal Act, save that in this Act the expression “local authority” includes any body of persons having power under an Act of the Parliament of Ireland or any local or personal Act of the United Kingdom Parliament or any private Act of the Oireachtas to assess and levy a rate on land or on persons in respect of their occupation of land.
Execution of works in lieu of compensation.
3.—(1) Where a person is entitled, actually or prospectively, to compensation in respect of anything lawfully done or intended to be done by the Minister under the Shannon Electricity Act, 1925 (No. 26 of 1925), the Minister may execute for the benefit of such person such works as the Minister thinks proper, and such person agrees to accept in satisfaction or partial satisfaction of his claim for such compensation.
(2) The Minister may attach to the execution of any works under this section such terms and conditions (including terms as to the ownership, possession, and control of the works) as may be agreed upon by him and the person for whose benefit the works are so executed.
(3) For the purposes of the Shannon Electrcitiy Act, 1925, the execution of works under this section shall be deemed to be one of the things which the Minister is authorised by sub-section (1) of section 3 of that Act to do and that Act shall apply accordingly.
(4) Moneys expended on the execution of works under this section shall be included in the sums referred to in section 15 of the Principal Act as ‘the said advances,’ but such works shall not be Shannon works within the meaning of the Principal Act.
(5) The Minister may by order made with the consent of the Minister for Local Government and Public Health declare that any particular works executed under this section shall be exempt, either permanently or for a limited time, from assessment for poor rate and also from assessment for any other rate made by a local authority, and whenever any such order is made the works to which such order relates shall be exempt from rates in accordance with such order.
(6) This section shall have effect and be deemed to have had effect as from the 4th day of July, 1925.
Amendment of section 12 of the Principal Act.
4.—(1) Notwithstanding anything contained in sub-section (3) of section 12 of the Principal Act as amended by the Act of 1929, the total amount of the sums advanced in any one half-year to the Board under that section as so amended for any purpose, other than to meet the liability and expenses mentioned in sub-section (2) of that section as so amended, may exceed the limit of four hundred thousand pounds imposed by the said sub-section (3) in any particular half-year in respect of which the Minister for Finance is of opinion that, owing to special circumstances affecting that half-year, it is expedient that the said limit should be exceeded.
(2) This section shall have and be deemed to have had effect as on and from the 1st day of January, 1930.
Amendment of section 13 of the Principal Act.
5.—Section 13 of the Principal Act shall be construed and have effect and be deemed always to have had effect as if—
(a) the words “at the time of the advance” were omitted from sub-section (1) thereof; and
(b) the following sub-section were added thereto, that is to say:—
“(5) The Minister for Finance may from time to time vary the rate at which interest payable under this section is to be paid.”
Amendment of section 14 of the Principal Act.
6.—The Minister for Finance may from time to time vary the rate at which interest payable under section 14 of the Principal Act is to be paid.
Amendment of section 15 of the Principal Act.
7.—Section 15 of the Principal Act as amended by the Act of 1929 shall be construed and have effect and be deemed to have had effect as on and from the 25th day of March, 1929, as if—
(a) the words“at the time when such interest commences to run” contained in sub-section (3) thereof were omitted from that sub-section; and
(b) sub-section (6) thereof were omitted therefrom and the following sub-section were inserted therein in lieu of the said sub-section (6), that is to say:—
“(6) All interest due on the said advances or any part thereof at the time when the Board becomes liable under this section for the repayment of the said advances or such part thereof shall be paid to the Minister for Finance within the period of six months or such longer period as the said Minister shall in any particular case direct after the time at which the Board so becomes liable for such repayment, and, if the Board fails to pay any such interest within such period, the Board shall pay to the said Minister interest at the rate appointed by the said Minister on such interest so due from the expiration of such period until the same is paid;” and
(c) the following two sub-sections were added thereto, that is to say:—
“(10) The Minister for Finance may, after con sultation with the Minister for Industry and Com merce, vary any sum previously fixed by him under sub-section (2) of this section as a proportionate part of the said advances and the interest thereon for the repayment of which the Board is to become liable under that sub-section, but no such variation shall be made in respect of any such sum after the date fixed under sub-section (4) of this section for the commencement of the half-yearly payments in respect of such sum, and whenever the Minister for Finance makes any such variation under this sub-section he shall make such adjustments of payments made or to be made by the Board under sub-sections (3) and (6) of this section as he shall think just and equitable in consequence of such variation.
(11) The Minister for Finance may from time to time vary the rate at which any interest payable under this section is to be paid.”
Interpretation of section 96 of the Principal Act.
8.—The expression “local authority” where the same occurs in section 96 of the Principal Act shall include any body of persons having power under an Act of the Parliament of Ireland or any local or personal Act of the United Kingdom Parliament or any private Act of the Oireachtas to assess and levy a rate on land or on persons in respect of their occupation of land, and the said section shall be construed and have effect accordingly.
Amendment of First Schedule to the Principal Act.
9.—(1) Paragraph 1 of the First Schedule to the Principal Act is hereby amended by the insertion of the words “receive from such authorised undertaker or statutory undertaker” after the words “entitled to.”
(2) This section shall have and be deemed to have had effect as from the commencement of the Principal Act.
General liability of the Board for rates.
10.—(1) In order to remove doubts it is hereby declared and enacted as follows, that is to say:—
(a) for the purpose of determining the liability of the Board for the payment of any rate leviable by a local authority, the use or occupation by the Board of any hereditament, tenement, or premises otherwise rateable to such rate is not and never was in use or occupation by the State or a Department of State and does not and never did confer the exemptions arising by reason of use or occupation by the State; and
(b) the use or occupation of a hereditament, tenement or premises by the Board is not use or occupation of a public nature or for a public purpose within the meaning of section 63 of the Poor Relief (Ireland) Act, 1838, or section 16 of the Valuation (Ireland) Act, 1852, or section 2 of the Valuation (Ireland) Act, 1854, or any other enactment (other than section 96 of the Principal Act) conferring exemption from a rate leviable by local authorities generally or by any particular local authority or class of local authorities.
(2) Nothing in this section shall remove, prejudice, or affect the exemption from rates which is conferred on the Board by section 96 of the Principal Act as amended by this Act.
Rating of the Board in respect of acquired undertakings.
11.—(1) For the purposes of the assessment and levying of any rate leviable by a local authority, the valuation of any hereditament or tenement rateable to such rate which becomes vested in the Board by virtue of a vesting order made (whether before or after the passing of this Act) under section 39 of the Principal Act or by virtue of a conveyance made (whether before or after the passing of this Act) in pursuance of an agreement entered into under sub-section (2) of section 38 of the Principal Act shall, so long as such hereditament or tenement continues in the occupation of the Board, be deemed to be whichever of the following valuations is applicable, that is to say:—
(a) where the vesting order or conveyance by virtue of which such hereditament or tenement became vested in the Board was made before the passing of this Act, the valuation under the Valuation Acts of such hereditament or tenement which was in force at the date of such vesting order or conveyance (as the case may be); and
(b) where the vesting order or conveyance by which such hereditament or tenement becomes vested in the Board is made after the passing of this Act, the valuation under the Valuation Acts of such hereditament or tenement which was in force for the year beginning on the 1st day of April, 1929.
(2) Whenever any hereditament or tenement which becomes vested in the Board by virtue of a vesting order made (whether before or after the passing of this Act) under section 39 of the Principal Act or by virtue of a conveyance made (whether before or after the passing of this Act) in pursuance of an agreement entered into under sub-section (2) of section 38 of the Principal Act ceases to be in the occupation of the Board, the Board shall as from the 1st day of April next following such cesser pay a perpetual annuity to every local authority by whom rates were assessed in respect of such premises for the year then current equal to the rates assessed by such local authority on such hereditament or tenement for the year ending on the 31st day of March prior to the date of such cesser, and every such annuity shall be payable by equal half-yearly payments in advance on every 1st day of April and 1st day of October and shall be recoverable by such local authority from the Board as a civil debt.
Exemption of certain property of the Board from rates.
12.—(1) Section 2 of the Valuation (Ireland) Act, 1854, shall apply to hereditaments and tenements to which this section applies and to the annual rents derived therefrom as if those hereditaments and tenements were included in the hereditaments and tenements mentioned in the said section 2.
(2) This section applies to every hereditament or tenement which, for the time being—
(a) is not part of the Shannon works; and
(b) is in the exclusive occupation of the Board; and
(c) is used exclusively as a generating station or as a transmission system or part of a transmission system or as a distribution system or part of a distribution system; and
(d) did not become vested in the Board (either before or after the passing of this Act) by virtue of a vesting order made under section 39 of the Principal Act or by virtue of a conveyance made in pursuance of an agreement entered into under sub-section (2) of section 38 of the Principal Act.
Compensation of employees of the Board in generating stations.
13.—(1) Whenever the Board ceases or has, before the passing of this Act, ceased wholly or partly to use as a generating station any generating station which became vested in it (whether before or after the passing of this Act) by virtue of a vesting order made under section 39 of the Principal Act or by virtue of a conveyance made in pursuance of an agreement entered into under sub-section (2) of section 38 of the Principal Act, the First Schedule to the Principal Act shall apply and (where such cesser occurred before the passing of this Act) be deemed always to have applied to every person who, at the date of such cesser, was employed by the Board in such generating station.
(2) For the purposes of the application of the First Schedule to the Principal Act to persons to whom that Schedule applies by virtue of this section, the following provisions shall have effect, that is to say:—
(a) the Board shall be deemed to be an authorised undertaker, and
(b) the cesser (whether complete or partial) by the Board to use the generating station as a generating station shall be deemed to have taken place in pursuance of an order, made under the Principal Act on the date on which such cesser occurred, requiring the Board to cease (wholly or partly, as the case may require) to use such generating station as a generating station, and
(c) references in the said Schedule to ceasing to use a generating station as a generating station shall be construed as including ceasing in part only to use a generating station as a generating station.
Compensation of employees of undertakers in generating stations.
14.—(1) Whenever an authorised undertaker, a statutory undertaker, or a permitted undertaker, in consequence of obtaining a supply of electricity from the Board, ceases or has, before the passing of this Act, ceased wholly or partly to use a generating station as a generating station, the First Schedule to the Principal Act shall apply and (where such cesser occurred before the passing of this Act) be deemed always to have applied to every person who, at the date of such cesser, was employed by any such undertaker in such generating station.
(2) For the purposes of the application of the First Schedule to the Principal Act to persons to whom that Schedule applies by virtue of this section, the following provisions shall have effect, that is to say:—
(a) the cesser (whether complete or partial) by the undertaker to use the generating station as a generating station shall be deemed to have taken place in pursuance of an order, made under the Principal Act on the date on which such cesser occurred, requiring such undertaker to cease (wholly or partly, as the case may require) to use such generating station as a generating station, and
(b) references in the said Schedule to ceasing to use a generating station as a generating station shall be construed as including ceasing in part only to use a generating station as a generating station.
Short title and citation.
15.—(1) This Act may be cited as the Electricity (Supply) (Amendment) Act, 1930.
(2) The Principal Act, the Act of 1929, and this Act may be cited together as the Electricity (Supply) Acts, 1927 to 1930.
