ACHT RIALTAIS ÁITIÚLA, 1931.
Mínithe.
1.—(1) San Acht so—
cialluíonn an abairt “an tAire” an tAire Rialtais Áitiúla agus Sláinte Puiblí;
cialluíonn an abairt “Acht 1923” an tAcht um Rialtais Áitiúil (Forálacha Sealadacha), 1923 (Uimh. 9 de 1923);
cialluíonn an abairt “Acht 1925” an tAcht Rialtais Áitiúla, 1925 (Uimh. 5 de 1925);
tá an brí céanna leis an abairt “údarás áitiúil” atá léi in Acht 1925;
cialluíonn an focal “fo-chólucht” corparáid, coiste, bord, no cólucht eile is gá do réir dlí do bheith có-dhéanta i bpáirt no go hiomlán de dhaoine d'ainmneodh údarás áitiúil no dhá údarás áitiúla no níos mó.
(2) I gcás duine i seilbh oifige áirithe in údarás áitiúil no fé do bheith do réir dlí ina bhall d'aon chólucht eile de bhuadh a bheith i seilbh na hoifige sin, tuigfear, chun crícheanna an Achta so, gur ball den chólucht san d'ainmnigh an t-údarás áitiúil sin an duine sin.
Na comhachta generálta bheidh ag an Aire nuair a scuirfear údarás áitiúil.
2.—Pé uair a scuirfidh an tAire údarás áitiúil fé alt 72 d'Acht 1925 no do scuir sé údarás áitiúil, roimh an Acht so do rith, fén alt san no fé alt 12 d'Acht 1923, féadfaidh an tAire, le hordú, pé socrú do dhéanamh is dóich leis is gá no is ceart chun a chur in áirithe go ndéanfaidh an cólucht, na daoine, no an duine ceapfar fén alt san 72 no fén alt san 12 (pe'ca aca é) chun dualgaisí an údaráis áitiúla san do chólíonadh, comhachta, dualgaisí, agus gnó an údaráis áitiúla san do choimeád ar siúl go héifeachtúil, agus i gcás údaráis áitiúla do scuireadh amhlaidh roimh an Acht so do rith (pe'ca tá an t-údarás áitiúil sin scurtha fós le linn an Achta so do rith no ná fuil) tuigfear go raibh comhacht ag an Aire riamh an socrú san do dhéanamh amhlaidh.
Comhachta maidir le fo-chóluchtaí.
3.—Pé uair a scuirfidh an tAire údarás áitiúil fé alt 72 d'Acht 1925 no do scuir sé údarás áitiúil, roimh an Acht so do rith, fén alt san no fé alt 12 d'Acht 1923, beidh comhacht ag an Aire agus, i gcás údaráis áitiúla do scuireadh amhlaidh roimh an Acht so do rith (pe'ca tá an t-údarás áitiúil sin scurtha fós le linn an Achta so do rith no ná fuil), tuigfear go raibh comhacht ag an Aire riamh chun socruithe do dhéanamh, le hordú, maidir le fo-chólucht ar bith do cheap an t-údarás áitiúil sin i bpáirt no go hiomlán, pé socrú is dóich leis an Aire is gá no is ceart chun a chur in áirithe go ndéanfaidh an fo-chólucht san a chomhachta agus a dhualgaisí d'fheidhmiú agus do chólíonadh go cuibhe d'ainneoin an údaráis áitiúla san do bheith scurtha, agus go háirithe comhacht chun gach ní no éinní acu so leanas do dhéanamh le hordú, sé sin le rá:—
(a) más gá do réir dlí an fo-chólucht san do bheith códhéanta go hiomlán de dhaoine d'ainmneodh an t-údarás áitiúil sin—
(i) comhachta, dualgaisí, agus maoin an fho-chóluchta san d'aistriú chun an chóluchta, na ndaoine, no an duine chun a mbeidh comhachta agus dualgaisí an údaráis áitiúla san aistrithe de thurus na huaire fé cheachtar de sna hailt sin agus socrú do dhéanamh chun go ndéanfadh an cólucht, na daoine, no an duine sin féin na comhachta agus na dualgaisí sin d'fheidhmiú agus do chólíonadh, no
(ii) pé socrú is dóich leis is ceart do dhéanamh chun ball an fho-chóluchta san do cheapadh agus fós chun daoine áirithe do cheapadh chun bheith ina mbaill den tsórt san, chun líon ball agus quorum an fho-chóluchta san do laigheadú, agus chun aon achtacháin reachtúla no eile do chur ar fiunraoi gur gá dá réir baill an fho-chóluchta san do bheith ina mbaill den údarás áitiúil sin; agus

4.—Pé uair a scuirfidh an tAire comhairle chontae fé alt 72 d'Acht 1925 no do scuir sé comhairle chontae, roimh an Acht so do rith, fén alt san no fé alt 12 d'Acht 1923 (pe'ca tá an chomhairle sin scurtha fós le linn an Achta so do rith no ná fuil), ansan, gach bord sláinte puiblí, bord sláinte agus conganta phuiblí agus coiste bainistí óspidéil mheabhar-ghalar seachas có-choiste) gur ghá do réir dlí, mara mbeadh an scur san, go gceapfadh an chomhairle sin iad, scuirfear iad no tuigfear gur scuireadh iad le linn na comhairle sin do scur amhlaidh mara socruighidh no marar shocruigh an tAire a mhalairt agus tuigfear maoin, comhachta, agus dualgaisí an bhuird no an choiste sin do bheith aistrithe chun an chóluchta, na ndaoine, no an duine chun a mbeidh comhachta agus dualgaisí na comhairle sin aistrithe de thurus na huaire fén alt san 12 no fén alt san 72 agus iad do bheith dílsithe ionta no ann, agus fós iad do bheith infheidhmithe acu no aige.
Comhachta ceadmhacha chun coistí do cheapadh.
5.—(1) Pé uair a scuirfidh an tAire údarás áitiúil fé alt 72 d'Acht 1925 no do scuir sé údarás áitiúil, roimh an Acht so do rith, fén alt san no fé alt 12 d'Acht 1923 agus pé uair a tuigfear bord sláinte puiblí no bord sláinte agus conganta phuiblí do bheith scurtha de bhuadh an Achta so, ansan, an cólucht, na daoine, no an duine go mbeidh no go dtuigfear go mbeidh comhachta agus dualgaisí an údaráis áitiúla san no an bhuird sin (pe'ca aca é) aistrithe chucha no chuige de thurus na huaire fé cheachtar de sna hailt sin no de bhuadh an Achta so, beidh gach comhacht ceadmhach acu no aige, agus féadfa siad no sé gach comhacht cheadmhach d'fheidhmiú, chun coiste do cheapadh chun críche ar bith, do bheadh infheidhmithe ag an údarás áitiúil sin no ag an mbord san, pe'ca aca é, mara mbeadh an scur san agus, i gcás scurtha do thárla no a tuigfear do thárlachtaint roimh an Acht so do rith (pe'ca bheidh an t-údarás áitiúil no an bord san scurtha fós le linn an Achta so do rith no ná beidh), tuigfear go raibh na comhachta san riamh acu no aige agus go raibh siad no sé ábalta riamh ar iad d'fheidhmiú.
(2) Pé uair agus faid a bheidh comhacht cheadmhach chun coiste do cheapadh infheidhmithe no a tuigfear go raibh sé infheidhmithe ag aon chólucht, daoine, no duine de bhuadh an ailt seo, scuirfidh aon fhoráil reachtúil no eile le n-a bhforáltar baill uile an choiste sin no cuid acu do bheith ina mbaill d'údarás áitiúil áirithe, scuirfe sí d'éifeacht do bheith aici agus tuigfear go raibh sí riamh gan éífeacht.
Socrú speisialta i dtaobh Coiste Ospideul Meabhar-ghalar Ghráinseach Ghormáin.
6.—(1) Ní oibreoidh éinní san Acht so chun dleathachta ná éifeachta do thabhairt d'aon ghníomh do rinne Có-Choiste Bainistí Ospideul Meabhar-ghalar Ghráinseach Ghormáin (dá ngairmtear an Coiste sin san alt so) agus go dtug Cúirt Bhreithiúnais de bhreith go speisialta air, roimh an Acht so do rith, é do bheith nea-dhleathach no gan éifeacht.
(2) Beidh sé dleathach don Choiste sin gach ní no éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) íoc do dhéanamh le haon oifigeach don Choiste sin in aon riaráiste tuarastail go dtí an 17adh lá d'Iúl, 1929, agus in airgead eile is iníoctha leis an oifigeach san fé ordú do rinne Cúirt ar bith mar gheall ar bhreith do thug an Chúirt sin no an Chúirt Uachtarach ná raibh éifeacht le rún ón gCoiste sin á thabhairt le tuisgint gur laigheaduigh sé tuarastal an oifigigh sin;
(b) íoc do dhéanamh le haon oifigeach don Choiste sin do bhí ar fostú ag an gCoiste sin ar an 12adh lá d'Iúl, 1925, in aon riaráiste tuarastail go dtí an 17adh lá d'Iúl, 1929, go mbeadh teideal ag an oifigeach san chuige dá mba rún gan éifeacht maidir leis an oifigeach san rún ón gCoiste sin á thabhairt le tuisgint gur laigheaduigh sé a thuarastal, rún gur chinn an Chúirt Uachtarach, roimh an Acht so do rith, é do bheith gan éifeacht maidir le hoifigigh eile don Choiste sin;
(c) íoc do dhéanamh le haon oifigeach don Choiste sin do bhí ar fostú ag an gCoiste sin ar an 12adh lá d'Iúl, 1925, i dtuarastal ón 17adh lá d'Iúl, 1929, amach, do réir an ráta gur dá réir a bheadh an tuarastal san iníoctha dá mba ná rithfí an rún san ón gCoiste sin ag laigheadú an tuarastail sin no á thabhairt le tuisgint gur laigheaduíodh é.
(3) Lasmuich dá n-údaruítear leis an alt so, ní bheidh sé dleathach d'aon oifigeach don Choiste sin aon airgead do ghlacadh ón gCoiste sin ná don Choiste sin aon airgead d'íoc leis adéarfar do bheith ag dul do toisc gur chinn an Chúirt Uachtarach ná raibh éifeacht le rún ón gCoiste sin á thabhairt le tuisgint gur laigheaduíodh tuarastail gach duine no aon duine d'oifigigh an Choiste sin.
(4) Chun crícheanna ailt 68 den Acht Rialtais Áitiúla (Baile Atha Cliath), 1930 (Uimh. 27 de 1930), beidh na nithe seo leanas ina gcrícheanna eiscithe do réir bhrí an ailt sin, eadhon, an Coiste sin d'íoc aon airgid do réir orduithe do rinne Cúirt Bhreithiúnais roimh an Acht so do rith agus a bhí bunuithe ar rún ón gCoiste sin á thabhairt le tuisgint gur laigheaduíodh tuarastail aon oifigeach d'oifigigh an Choiste sin do bheith nea-dhleathach no gan éifeacht, agus na costaisí agus na caithteachaisí fé n-a ndeaghaidh an Coiste sin sna himeachta ina ndearnadh aon ordú den tsórt san d'íoc, agus aon íocaíocht eile d'íoc a dearbhuítear leis an alt so do bheith dleathach, agus aisíoc airgid agus íoc úis ar airgead do fuarthas ar iasacht chun íoctha na n-íocaíocht san no aon íocaíochta acu.
(5) Beidh feidhm ag fo-alt (7) d'alt 51 den Local Government (Ireland) Act, 1898, maidir le haon airgead do bhí dlite roimh an 30adh lá de Mheitheamh, 1931, agus go n-údaruítear don Choiste sin leis an alt so é d'íoc, díreach fé is dá mb'ar an 30adh lá de Mheitheamh, 1931, do tháinig an t-airgead san chun bheith dlite agus iníoctha.
Orduithe do cheiliúradh agus do leasú.
7.—Gach ordú dhéanfaidh an tAire fén Acht so agus gach ordú do rinne sé roimh an Acht so do rith agus atá dleathach agus éifeachtúil de bhuadh an Achta so féadfaidh an tAire é do cheiliúradh no do leasú le hordú ina dhiaidh sin agus tuigfear go bhféadfadh sé san do dhéanamh riamh.

LOCAL GOVERNMENT ACT, 1931.
Definitions.
1.—(1) In this Act—
the expression “the Minister” means the Minister for Local Government and Public Health;
the expression “the Act of 1923” means the Local Government (Temporary Provisions) Act, 1923 (No. 9 of 1923);
the expression “the Act of 1925” means the Local Government Act, 1925 (No. 5 of 1925);
the expression “local authority” has the same meaning as it has in the Act of 1925;
the expression “subsidiary body” means a corporation, committee, board, or other body which is required by law to be composed wholly or partly of persons nominated by a local authority or by two or more local authorities.
(2) Where the person holding a particular office in or under a local authority is by law a member of any other body by virtue of his holding such office, such person shall for the purposes of this Act be deemed to be a member of such body nominated by such local authority.
General powers of the Minister when a local authority is dissolved.
2.—Whenever the Minister dissolves a local authority under section 72 of the Act of 1925 or has before the passing of this Act dissolved a local authority under that section or under section 12 of the Act of 1923, the Minister may make and, in the case of a local authority so dissolved before the passing of this Act (whether such local authority is or is not still dissolved at the passing of this Act), shall be deemed always to have had power to make by order such provision as he thinks necessary or proper for securing the effective carrying on of the powers, duties, and business of such local authority by the body, persons, or person appointed under the said section 72 or the said section 12 (as the case may be) to perform the duties of such local authority.
Powers in relation to subsidiary bodies.
3.—Whenever the Minister dissolves a local authority under section 72 of the Act of 1925 or has before the passing of this Act dissolved a local authority under that section or under section 12 of the Act of 1923 the Minister shall have power, and in the case of a local authority so dissolved before the passing of this Act (whether such local authority is or is not still dissolved at the passing of this Act), shall be deemed always to have had power to make by order such provision in relation to any subsidiary body wholly or partly appointed by such local authority as the Minister thinks necessary or proper for securing the due exercise and performance by such subsidiary body of its powers and duties notwithstanding the dissolution of such local authority and, in particular, to do by order all or any of the following things, that is to say:—
(a) where such subsidiary body is required by law to be composed wholly of persons nominated by such local authority either—
(i) to transfer the powers, duties, and property of such subsidiary body to the body, persons, or person to whom the powers and duties of such local authority are for the time being transferred under either of the said sections and to make provision for the exercise and performance of such powers and duties directly by such body, persons, or person, or
(ii) to make such provision as he thinks proper for the appointment of the members of such subsidiary body, including the appointment of particular persons to be such members, reducing the number of the members and the quorum of such subsidiary body, and suspending any statutory or other enactment requiring the members of such subsidiary body to be members of such local authority; and
(b) where such subsidiary body is required by law to be composed in part only of persons nominated by such local authority, to make such provision as he thinks proper for filling all or any of those places in the membership of such subsidiary body which are required by law to be filled by persons nominated by such local authority, including appointing particular persons to fill such places, suspending any statutory or other provision requiring all or any of such places to be filled by persons who are members of such local authority, and reducing the number of such places and, in consequence of such reduction, reducing the total number of members and the quorum of such subsidiary body.
Consequential dissolution of certain boards and committees.
4.—Whenever the Minister dissolves the council of a county under section 72 of the Act of 1925 or has before the passing of this Act dissolved the council of a county under that section or under section 12 of the Act of 1923 (whether such council is or is not still dissolved at the passing of this Act) every board of public health, board of health and public assistance and committee (other than a joint committee) of management of a mental hospital which but for such dissolution would be required by law to be appointed by such council shall, unless provision to the contrary is or was made by the Minister, be or be deemed to have been dissolved at the same time as such council is or was so dissolved, and the property, powers, and duties of such board or committee shall be deemed to be or to have been transferred to and to be or have been vested in and exercisable by the body, persons, or person to whom the powers and duties of such council are for the time being transferred under the said section 12 or the said section 72.
Permissive powers of appointing committees.
5.—(1) Whenever the Minister dissolves a local authority under section 72 of the Act of 1925 or has before the passing of this Act dissolved a local authority under that section or under section 12 of the Act of 1923 and whenever a board of public health or a board of health and public assistance is deemed by virtue of this Act to be or to have been dissolved, the body, persons, or person to whom the powers and duties of such local authority or such board (as the case may be) are for the time being transferred or deemed to be transferred under either of the said sections or by virtue of this Act shall have and may exercise and, in the case of a dissolution which occurred or is deemed to have occurred before the passing of this Act (whether such local authority or board is or is not still dissolved at the passing of this Act) shall be deemed always to have had and been capable of exercising every permissive power of appointing a committee for any purpose which but for such dissolution would have been exercisable by such local authority or such board, as the case may be.
(2) Whenever and so long as a permissive power of appointing a committee is exercisable or deemed to have been exercisable by any body, persons, or person by virtue of this section, any statutory or other provision restricting the membership of such committee in whole or in part to members of a particular local authority shall cease, and be deemed always to have ceased, to have effect.
Special provision for Grangegorman Mental Hospital Committee.
6.—(1) Nothing in this Act shall operate to make lawful or valid any act done by the Joint Committee of Management of the Grangegorman Mental Hospital (in this section referred to as the said Committee) which was before the passing of this Act specifically adjudged by a Court of Justice to have been unlawful or invalid.
(2) It shall be lawful for the said Committee to do all or any of the following things, that is to say:—
(a) to pay to any officer of the said Committee any arrears of salary up to the 17th day of July, 1929, and other moneys payable to such officer under an order made by any Court in consequence of a decision by such Court or by the Supreme Court that a resolution of the said Committee purporting to reduce the salary of such officer was invalid;
(b) to pay to any officer of the said Committee who was in the employment of the said Committee on the 12th day of July, 1925, any arrears of salary up to the 17th day of July, 1929, to which he would be entitled if a resolution of the said Committee purporting to reduce his salary, which was decided by the Supreme Court before the passing of this Act to be invalid in respect of other officers of the said Committee, were invalid in respect of him;
(c) to pay to any officer of the said Committee who was in the employment of the said Committee on the 12th day of July, 1925, salary as from the 17th day of July, 1929, at the rate at which such salary would be payable if the said resolution of the said Committee reducing or purporting to reduce such salary had not been passed.
(3) Save as is authorised by this section, it shall not be lawful for any officer of the said Committee to receive from or be paid by the said Committee any moneys alleged to be due to him on account of a resolution of the said Committee purporting to reduce the salaries of all or any of the officers of the said Committee having been decided by the Supreme Court to be invalid.
(4) The payment of any moneys by the said Committee in pursuance of an order made by a Court of Justice before the passing of this Act and grounded on the illegality or invalidity of a resolution of the said Committee purporting to reduce the salaries of any of the officers of the said Committee and the payment of the costs and expenses incurred by the said Committee in the proceedings in which any such order was made and the making of any other payment which is declared by this section to be lawful and the repayment of moneys and the payment of interest on moneys borrowed for making the said payments or any of them shall, for the purposes of section 68 of the Local Government (Dublin) Act, 1930 (No. 27 of 1930), be excepted purposes within the meaning of that section.
(5) Sub-section (7) of section 51 of the Local Government (Ireland) Act, 1898, shall apply in respect of any moneys which accrued due before the 30th day of June, 1931, and which the said Committee is authorised by this section to pay as if such moneys became due and payable on the 30th day of June, 1931.
Revocation and amendment of orders.
7.—Every order made by the Minister under this Act and every order made by the Minister before the passing of this Act which is lawful and valid by virtue of this Act may be and shall be deemed always to have been capable of being revoked or amended by the Minister by a subsequent order.
Short title.
8.—This Act may be cited as the Local Government Act, 1931.
