ACHTAÍTEAR AG AN OIREACHTAS MAR A LEANAS:
Léiriú.
1.—(1) San Acht seo—
folaíonn “bád” aon bháirse, soitheach nó dobharárthach eile;
ciallaíonn “na Coimisinéirí” Coimisinéirí na nOibreacha Poiblí in Éirinn agus folaíonn tagairtí do na Coimisinéirí tagairtí dá gcuid seirbhíseach agus gníomhairí;
folaíonn “talamh” aon talamh atá clúdaithe le huisce;
ciallaíonn “an tAire” an tAire Airgeadais;
ciallaíonn “an cainéal uiscebhealaigh” na codanna d'uiscebhealach na Sionainne dá dtagraítear i mír (a) den mhíniú ar “uiscebhealach na Sionainne” san fho-alt seo, na canálacha agus na loic dá dtagraítear i mír (b) den mhíniú sin agus na codanna atá sorochtana ag báid de na cuanta dá dtagraítear sa mhír sin;
ciallaíonn “Acht na Sionainne” an Act of the British Parliament 2 & 3 Vict., c. 61 arna leasú nó arna leathnú;
ciallaíonn “uiscebhealach na Sionainne”—
(a) abhainn na Sionainne, na lochanna óna ritheann nó trína ritheann sí agus cibé de na haibhneacha sin a ritheann isteach inti nó isteach sna lochanna sin a bhfuil nó a mbeidh feabhas curtha orthu nó atá nó a bheidh curtha i riocht inseolta ag na Coimisinéirí nó ag daoine eile faoi chumhachtaí a thugtar le reacht, laistigh de na teorainneacha atá socraithe agus cinntithe de thuras na huaire faoi alt 39 d'Acht na Sionainne, agus
(b) na canálacha, na loic, na cuanta, na calaí, na lamairní, na piaraí, na céanna, na coraí agus na hoibreacha agus an talamh eile a bheidh déanta ag na Coimisinéirí nó dílsithe dóibh, cibé acu roimh an Acht seo a rith nó dá éis, chun críche úsáide nó feabhsaithe aon cheann de na haibhneacha nó de na lochanna sin, laistigh de na teorainneacha réamhráite, nó loingseoireacht an chéanna, nó chun aon chríche eile a údaraítear le hAcht na Sionainne;
ciallaíonn “an lá dílseacháin” an lá a cheaptar faoi alt 9 mar lá dílseacháin.
(2) Aon tagairt san Acht seo d'alt is tagairt í d'alt den Acht seo. mura gcuirtear in iúl gur tagairt d'achtachán éigin eile atá beartaithe.
(3) Aon tagairt san Acht seo d'fho-alt nó do mhír is tagairt í d'fho-alt nó do mhír den fhoráil ina bhfuil sí, mura gcuirtear in iúl gur tagairt d'fhoráil éigin eile atá beartaithe.
(4) Déanfar aon tagairt san Acht seo d'aon achtachán a fhorléiriú mar thagairt don achtachán sin arna leasú nó arna oiriúnú le haon achtachán dá éis sin nó faoi.
Cumhachtaí na gCoimisinéirí i ndáil le huiscebhealach na Sionainne.
2.—Beidh na cumhachtaí sin go léir is gá ag na Coimisinéirí chun a bhfeidhmeanna a chomhlíonadh faoi Acht na Sionainne agus, gan dochar do ghinearáltacht an méid sin roimhe seo agus dá gcumhachtaí faoin Acht sin, beidh acu an chumhacht chun cúram, caomhnú, bainisteoireacht, rialú, cothabháil, athchóiriú, deisiú, feabhsú, fadú agus forbairt uiscebhealach na Sionainne a ghabháil de láimh agus chun an méid seo a leanas a dhéanamh—
(a) aon uisce is gá chun críocha an chainéil uiscebhealaigh a tharraingt ó aon fhoinse nádúrtha ar bith,
(b) dreideáil, leathnú, doimhniú, athrú cúrsa nó deisiú nó feabhsú thairis sin a dhéanamh ar an gcainéal uiscebhealaigh nó an soláthar uisce don chainéal uiscebhealaigh a fheabhsú nó aon fharasbarr uisce uaidh a dhiúscairt agus, chun na críche sin, aon sruthán, abhainn, draein nó cainéal a iompraíonn aon uisce chuig an gcainéal uiscebhealaigh nó uaidh a dhéanamh, a athrú, a dheisiú, a fheabhsú, a dhreideáil, a leathnú nó a dhoimhniú agus aon phíopa a iompraíonn aon uisce den sórt sin a mhalartú nó a dheisiú nó aon stáisiún caidéil is gá le haghaidh an uisce sin a thógáil, a dheisiú nó a fheabhsú,
(c) aon déanmhas nó aon rud eile a thógáil chun bealaigh a bhacann nó is dóigh a bhacfaidh an cainéal uiscebhealaigh, nó an déanmhas nó an rud a athrú sa chaoi go ndíothófar an bac nó an dóchúlacht sin,
(d) toirmeasc a chur ar thógáil droichead, coraí nó déanmhas eile ar an gcainéal uiscebhealaigh, ann nó os a chionn, nó ar chaidhséir, píopaí nó draenacha faoi, gan toiliú na gCoimisinéirí,
(e) aon loc, cé, cuan, duga tirim, cora, bealach éisc, fánán, áis loingseoireachta, stáisiún caidéil, stáisiún hidrileictreach agus oibreacha coimhdeacha, foirgneamh, cosán tarraingthe, droichead, uiscerian, claífort, caidhséar, píopa nó draein nó bóthar (seachas bóthar poiblí de réir bhrí an Achta Rialtais Áitiúil (Bóithre agus Mótarbhealaí), 1974), ar an gcainéal uiscebhealaigh, os a chionn, ina aice nó faoi a dhéanamh, a athrú, a fho-thacú, a dheisiú nó a fheabhsú,
(f) aon talamh is gá, chun críocha uiscebhealach na Sionainne, agus aon cheart, éasúint, teideal nó leas d'aon chineál sa talamh sin, thairis nó ina leith, a fháil, trí chomhaontú nó go héigeantach, de réir an Sceidil a ghabhann leis an Acht seo,
(g) gan dochar do cheart aon duine chun uisce ón gcainéal uiscebhealaigh a úsáid nó a thógáil, leibhéil uisce an chainéil uiscebhealaigh a athrú,
(h) aon chuid den chainéal uiscebhealaigh nach bhfuil riachtanach le haghaidh loingseoireachta a dhúnadh ar loingseoireacht nó aon chuid den chéanna a dhúnadh go sealadach agus aon chuid den chainéal uiscebhealaigh a bhí dúnta roimhe sin ar loingseoireacht a oscailt nó a athoscailt agus a dhearbhú go bhfuil an chuid sin inseolta,
(i) le comhaontú aon duine atá i dteideal aon íocaíochta i leith fála faoi mhír (f) nó aon íocaíochta faoi alt 4 (3) (a), oibreacha feabhsúcháin nó oibreacha eile a chur i gcrích i ndáil le huiscebhealach na Sionainne nó le haon mhaoin de chuid an duine, in ionad na híocaíochta go léir nó in ionad aon chuid di.
Cumhacht na gCoimisinéirí fodhlíthe a dhéanamh i ndáil le huiscebhealach na Sionainne.
3.—(1) Féadfaidh na Coimisinéirí fodhlíthe a dhéanamh chun uiscebhealach na Sionainne a aireachasú, a chaomhnú, a bhainisteoireacht, a rialú agus a chothabháil agus chun úsáid uiscebhealach na Sionainne a rialáil, agus i ndáil le hathchóiriú, deisiú, feabhsú, fadú agus forbairt ar an gcéanna agus, gan dochar do ghinearáltacht an méid sin roimhe seo, i ndáil le haon cheann nó níos mó de na nithe seo a leanas:
(a) rialáil a dhéanamh ar na coinníollacha (lena n-áirítear coinníollacha maidir le sábháilteacht) faoinar féidir báid a úsáid sa chainéal uiscebhealaigh,
(b) aon chuid den chainéal uiscebhealaigh a dhúnadh ar loingseoireacht cibé acu go sealadach nó go buan,
(c) aon chuid den chainéal uiscebhealaigh nach bhfuil oscailte do loingseoireacht a oscailt nó a athoscailt,
(d) leibhéil uisce an chainéil uiscebhealaigh a athrú,
(e) snámh sa chainéal uiscebhealaigh a rialáil,
(f) toirmeasc a chur ar thógáil droichead, coraí nó déanmhas eile ar an gcainéal uiscebhealaigh, ann nó os a chionn, agus ar chaidhséir, píopaí nó draenacha faoi, gan toiliú na gCoimisinéirí,
(g) toirmeasc a chur ar uiscebhealach na Sionainne, nó ar aon chuid de, a úsáid, seachas faoi réim agus de réir ceadúnais a thabharfaidh na Coimisinéirí chuige sin agus ina mbeidh cibé coinníollacha (más ann) is dóigh leo is gá nó is fóirsteanach,
(h) gan dochar do chearta aon duine chun uisce ón gcainéal uiscebhealaigh a úsáid nó a thógáil, rialáil nó toirmeasc a dhéanamh ar úsáid uisce, nó ar thógáil uisce, ón gcainéal uiscebhealaigh,
(i) faoi réir fho-alt (4), iascaireacht a rialáil sa chainéal uiscebhealaigh,
(j) damáiste d'uiscebhealach na Sionainne, nó bacadh ar an gcainéal uiscebhealaigh, a chosc,
(k) tógáil chun bealaigh aon bháid nó ruda as an gcainéal uiscebhealaigh, nó pasáiste tríd an gcainéal sin ag aon bhád nó rud, nó úsáid an chéanna ann, nó úsáid aon saoráidí nó suiteálacha de chuid uiscebhealach na Sionainne ag aon bhád nó rud, a thoirmeasc i gcás gur bád nó rud é atá, nó a d'fhéadfadh a bheith, ina dhainséar do bheatha, sláinte, loingseoireacht nó stoc éisc nó a d'fhéadfadh cur isteach ar shlí eile ar úsáid chuí uiscebhealach na Sionainne nó nach mbeidh táille, dola nó muirear atá dlite agus iníoctha faoi na fodhlíthe íoctha i ndáil leis nó nach mbeidh socruithe is inghlactha ag na Coimisinéirí déanta faoi chomhair a íocaíochta,
(l) táillí, dolaí agus muirir a shocrú, a athrú, a mhuirearú agus a ghnóthú—
(i) maidir le húsáid an chainéil uiscebhealaigh, nó saoráidí nó suiteálacha uiscebhealach na Sionainne, ag báid cibé acu chun críche a bpasáiste tríd an uiscebhealach nó chun iad a fhágáil ar ancaire, a fheistiú, a cheangal suas nó a tharraingt suas nó chun críche ar bith eile, nó
(ii) maidir le húsáid uisce nó tógáil uisce ón gcainéal uiscebhealaigh,
agus toirmeasc a chur leis an úsáid dá dtagraítear i bhfomhír (i) nó leis an úsáid nó leis an tógáil uisce dá dtagraítear i bhfomhír (ii) d'éagmais aon táille, dola nó muirear a íoc is iníoctha faoin mír seo ina leith nó d'éagmais aon socruithe is inghlactha ag na Coimisinéirí faoi chomhair a íocaíochta.
(m) na Coimisinéirí do bhunú agus do chothabháil cláir ina gceanglófar iontrálacha ina mbeidh faisnéis shonraithe a dhéanamh in aghaidh na bliana nó ag tráthanna sonraithe eile, ar iarratas chuige sin óna n-úinéirí, maidir le báid nó le haicmí sonraithe bád a úsáideann uiscebhealach na Sionainne, íoc táillí ag úinéirí na mbád lena mbaineann maidir leis na hiontrálacha agus úsáid uiscebhealach na Sionainne a thoirmeasc ar bháid a gceanglaítear iad a bheith, ach nach bhfuil, cláraithe sa chlár.
(2) Féadfaidh cibé forálacha teagmhasacha, foghabhálacha agus coimhdeacha is dóigh leis na Coimisinéirí is gá nó is fóirsteanach chun críocha na bhfodhlíthe a bheith i bhfodhlíthe faoin alt seo.
(3) Féadfaidh na Coimisinéirí, le fodhlíthe faoin alt seo, na cumhachtaí a thugtar dóibh le halt 39 d'Acht na Sionainne a fheidhmiú ó am go ham de réir riachtanas na hócáide, chun teorainneacha abhainn na Sionainne agus na n-aibhneacha a ritheann isteach inti a gcuirtear feabhas orthu faoi Acht na Sionainne a shocrú agus a chinneadh, ar cumhachtaí iad a bhféadfar na cumhachtaí eile a thugtar do na Coimisinéirí le hAcht na Sionainne a fheidhmiú laistigh díobh.
(4) Ní dhéanfar fodhlíthe faoin alt seo i ndáil le haon ábhar a bhféadfar rialacháin nó fodhlíthe a dhéanamh ina leith faoi na hAchtanna Iascaigh, 1959 go 1983.
(5) Beidh duine a sháróidh fodhlí faoin alt seo ciontach i gcion agus dlífear—
(a) ar é a chiontú go hachomair, fíneáil nach mó ná £1,000 (agus ina theannta sin, i gcás sárú leanúnach, fíneáil nach mó ná £100 in aghaidh gach lae a leanfar den sárú agus nach mó san iomlán ná méid is comhionann le £1,000 nuair a chuirtear é le haon fhíneáil eile faoin mír seo i ndáil leis an sárú lena mbaineann) nó príosúnacht ar feadh aon téarma nach faide ná 6 mhí, nó iad araon, a chur air,
(b) ar é a chiontú ar díotáil, fíneáil nach mó ná £5,000 (agus ina theannta sin, i gcás sárú leanúnach, fíneáil nach mó ná £500 in aghaidh gach lae a leanfar den sárú) nó príosúnacht ar feadh aon téarma nach faide ná 2 bhliain, nó iad araon, a chur air.
(6) I gcás comhlacht corpraithe do dhéanamh ciona lena mbaineann fo-alt (5) agus go gcruthófar go ndearnadh é le toiliú nó le cúlcheadú, nó gur inchurtha é i leith aon fhaillí ar thaobh, aon duine is stiúrthóir ar an gcomhlacht corpraithe nó arb é bainisteoir nó rúnaí an chomhlachta é, nó aon duine a d'airbheartaigh bheith ag gníomhú in aon cháil den sórt sin, beidh an duine sin, chomh maith leis an gcomhlacht corpraithe, ciontach i gcion agus dlífear imeachtaí a shaothrú ina choinne agus é a phionósú amhail is dá mbeadh sé ciontach sa chion céadluaite.
(7) (a) Féadfaidh na Coimisinéirí imeachtaí a thionscnamh mar gheall ar chion achomair faoin alt seo.
(b) D'ainneoin alt 10 (4) den Petty Sessions (Ireland) Act, 1851, féadfar imeachtaí achoimre mar gheall ar chion lena mbaineann fo-alt (5) nó (6) a thionscnamh laistigh de 12 mhí ó dháta an chiona.
Cumhacht na gCoimisinéirí chun oibreacha a chur i gcrích i ndáil le huiscebhealach na Sionainne agus chun dul isteach ar thalamh.
4.—(1) (a) Féadfaidh na Coimisinéirí chun críocha a bhfeidhmeanna faoin Acht seo—
(i) dul isteach ar aon talamh agus obair a chur i gcrích ar an talamh i ndáil le huiscebhealach na Sionainne nó le maoin a dhílsítear dóibh chun críche an uiscebhealaigh,
(ii) dul isteach ar aon talamh agus é a áitiú nó é a úsáid ar shlí eile chun obair a chur i gcrích ar thalamh eile i ndáil le huiscebhealach na Sionainne nó leis an maoin réamhráite,
(iii) dul isteach ar aon talamh chun bealach rochtana a fháil chuig uiscebhealach na Sionainne, chuig an maoin a dúradh nó chuig talamh a shonraítear i mír (a) nó (b) nó chun scrúdú nó suirbhé a dhéanamh ar an gcéanna,
agus na nithe eile sin go léir a dhéanamh ar aon talamh den sórt sin atá, ina dtuairim, coimhdeach nó riachtanach go réasúnta chun na gcríoch réamhráite.
(b) Déanfaidh na Coimisinéirí, 14 lá ar a laghad sula bhfeidhmeoidh siad aon chumhacht faoi mhír (a) (seachas fomhír (iii)), fógra i scríbhinn go bhfuil sé ar intinn acu dul isteach ar an talamh agus i dtaobh na gcríoch dá mbeartaítear dul isteach air, agus a shonróidh na cumhachtaí eile a bheartaítear a fheidhmiú, a thabhairt d'aon úinéir nó áititheoir de chuid na talún i gceist, a bhféadann na Coimisinéirí a chéannacht agus a sheoladh a fhionnadh trí bhearta réasúnacha a ghlacadh.
(c) Féadfaidh duine dá dtugtar fógra faoin bhfo-alt seo, tráth nach déanaí ná 14 lá tar éis an fógra a thabhairt, iarratas a dhéanamh, ar fhógra a thabhairt do na Coimisinéirí, chuig an mbreitheamh den Chúirt Dúiche a bhfuil dlínse aige sa dúiche Chúirte Dúiche ina bhfuil an talamh suite, ar ordú chun an dul isteach a thoirmeasc agus, ar an iarratas a éisteacht, féadfaidh an breitheamh, más cuí leis amhlaidh, an dul isteach a thoirmeasc nó coinníollacha a shonrú a bheidh le comhlíonadh ag an duine a bheidh ag dul isteach.
(d) Má thoirmisceann breitheamh den Chúirt Dúiche faoin bhfo-alt seo aon dul isteach atá beartaithe ar an talamh, ní dleathach do dhuine ar bith dul isteach faoi mhír (a) ar an talamh agus i gcás go sonraíonn breitheamh den Chúirt Dúiche coinníollacha faoin alt seo a bheidh le comhlíonadh ag duine a bheidh ag dul isteach ar thalamh, déanfaidh gach duine a rachaidh isteach ar an talamh faoi mhír (a) na coinníollacha a bheidh sonraithe amhlaidh a chomhlíonadh.
(2) (a) Más rud é, i dtuairim na gCoimisinéirí—
(i) go bhfuil feidhmiú cumhachta a thugtar dóibh le fo-alt (1) á éileamh go práinneach chun díobháil, caillteanas nó damáiste do dhaoine nó do mhaoin a chosc nó a íoslaghdú, agus
(ii) nach féidir go réasúnta, i ndáil leis an bhfeidhmiú sin, mír (b) den fho-alt sin a chomhlíonadh,
féadfaidh na Coimisinéirí an chumhacht a fheidhmiú gan an mhír sin a bheith comhlíonta acu i ndáil leis an bhfeidhmiú sin.
(b) Sula bhfeidhmeoidh siad cumhacht de bhua an fho-ailt seo, déanfaidh na Coimisinéirí fógra go bhfuil sé ar intinn acu dul isteach ar an talamh, agus i dtaobh na gcríoch dá mbeartaítear dul isteach air, agus i dtaobh na gcumhachtaí eile a bheartaítear a fheidhmiú, a thabhairt d'aon úin éir nó áititheoir de chuid na talún i gceist, a bhféadann na Coimisinéirí a chéannacht agus a sheoladh a fhionnadh trí bhearta réasúnacha a ghlacadh.
(c) Más rud é, i dtuairim na gCoimisinéirí, nach féidir go réasúnta déanamh de réir mhír (b), féadfaidh na Coimisinéirí an chumhacht lena mbaineann a fheidhmiú gan déanamh de réir na míre sin amhlaidh agus déanfaidh siad, a luaithe is féidir dá éis sin, fógra i scríbhinn a shonróidh na cumhachtaí a feidhmíodh agus na críocha dár feidhmíodh iad, a thabhairt d'aon úinéir nó áititheoir de chuid na talún i gceist, a bhféadann na Coimisinéirí a chéannacht agus a sheoladh a fhionnadh trí bhearta réasúnacha a ghlacadh.
(3) (a) Más rud é go mbainfidh caillteanas, díobháil nó damáiste do dhuine (seachas duine a bhfaightear a chuid talún faoi alt 2 (f)) nó go dtabhóidh sé caiteachas de dhroim na Coimisinéirí d'fheidhmiú cumhachta a thugtar dóibh leis an alt seo nó le halt 2, íocfaidh an Coimisinéirí cúiteamh leis i leith an chaillteanais, na díobhála, an damáiste nó an chaiteachais agus, d'éagmais chomhaontaithe, cinnfear méid an chúitimh le headráin faoi réim agus de réir Achtanna na gClásanna Talmhan agus, chun críocha na nAchtanna sin, measfar gurb iad na Coimisinéirí tionscnóir an ghnóthais agus gurb é an Acht seo, agus an t-ordú dílseacháin lena mbaineann, an tAcht speisialta; agus, chun críocha an chinnidh sin, beidh feidhm ag na hAchtanna sin fara aon mhodhnuithe eile is gá agus déantar iad a chorprú leis an Acht seo (ach amháin a mhéid atá siad ar neamhréir le, agus faoi réir, aon leasuithe nó modhnuithe, sainráite nó intuigthe, a dhéantar orthu leis an Acht seo).
(b) Nuair a bheidh an cúiteamh is iníochta le duine faoi mhír (a) á mheasúnú, tabharfar aird ar aon tairbhe d'aon mhaoin de chuid an duine a thagann as, nó a d'fhéadfaí a bheith ag súil go réasúnach a thiocfadh as, feidhmiú na cumhachta lena mbaineann nó aon chumhachta eile faoin alt seo nó faoin alt sin 2 ag na Coimisinéirí agus, go sonrach ach gan dochar do ghinearáltacht an méid sin roimhe seo, tabharfar aird, i gcás éilimh ar chúiteamh i ndáil le cearta uisce, ar a mhéid a feidhmíodh na cearta uisce sa tréimhse 20 bliain díreach roimh fheidhmiú na cumhachta lena mbaineann ag na Coimisinéirí agus ar aon soláthar eile uisce a chuireann na Coimisinéirí ar fáil don duine.
Uiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill a aistriú chuig na Coimisinéirí agus feidhmeanna áirithe a thabhairt dóibh i ndáil le huiscebhealach na hÉirne agus Loch Uachtair.
5.—(1) Ar an lá dílseacháin—
(a) déanfar an oiread sin d'uiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill atá suite sa Stát agus an mhaoin (lena n-áirítear ábhair i gcaingean), na sócmhainní, na cumhachtaí, na cearta, na ceadúnais, na pribhléidí agus na dliteanais a dhílsítear d'iontaobhaithe an uiscebhealaigh nó a shealbhaíonn, a theachtann nó a thabhaíonn siad i dtaca leis sin, nó a bhaineann leis sin, a aistriú de bhua an fho-ailt seo chuig na Coimisinéirí ach sin faoi réir a n-aistrithe i gcás ar gá sin i leabhair aon bhainc, corparáide nó cuideachta,
(b) an oiread sin de thalamh an uiscebhealaigh sin atá suite sa Stát dílseoidh sé, de bhua an ailt seo, do na Coimisinéirí go feadh eastát, ceart, teideal agus leas uile iontaobhaithe an uiscebhealaigh, agus
(c) measfar, chun críocha Acht na Sionainne agus an Achta seo, gur cuid d'uiscebhealach na Sionainne agus d'Abhainn na Sionainne an t-uiscebhealach a dúradh agus uiscebhealach na hÉirne agus Loch Uachtair agus beidh feidhm agus éifeacht dá réir sin ag an Acht sin agus ag an Acht seo i ndáil le huiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill agus le huiscebhealach na hÉirne agus Loch Uachtair fara na modhnuithe—
(i) maidir leis na feidhmeanna a thugtar do na Coimisinéirí leis na hAchtanna sin nó fúthu, gurb iad a chomhlíonfaidh iad i ndáil le huiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill agus le huiscebhealach na hÉirne agus Loch Uachtair nó, cibé uair agus a mhéid a tharmligfear iad chuig duine faoi fho-alt (9), gurb é an duine sin a chomhlíonfaidh amhlaidh iad sa Stát nó lasmuigh de,
(ii) go bhforléireofar tagairtí san Acht seo don chainéal uiscebhealaigh mar thagairtí—
(I) d'uiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill seachas na calaí, na lamairní na piaraí, na céanna, na coraí agus na hoibreacha agus an talamh eile dá dtagraítear sa mhíniú ar an uiscebhealach i bhfo-alt (12) agus na codanna de na cuanta dá dtagraítear sa mhíniú sin nach bhfuil sorochtana ag báid, agus
(II) d'uiscebhealach na hÉirne agus Loch Uachtair seachas an ché dá dtagraítear sa mhíniú ar an uiscebhealach i bhfo-alt (12),
agus fara aon mhodhnuithe eile is gá.
(2) Faoi réir fhorálacha an Achta seo, féadfaidh na Coimisinéirí, an lá dílseacháin agus dá éis, na cumhachtaí, na cearta agus na pribhléidí réamhráite go léir a theachtadh, a fheidhmiú agus a fhorfheidhmiú agus beidh siad faoi réir na ndliteanas réamhráite go léir agus, dá réir sin, gach fiach agus gach dliteanas eile i ndáil le huiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill a bhí, díreach roimh an lá dílseacháin, dlite de iontaobhaithe an uiscebhealaigh agus gan íoc acu nó tabhaithe agus gan ghlanadh acu, tiocfaidh sé, an lá dílseacháin, chun bheith agus beidh sé ina fhiach nó ina dhliteanas ar na Coimisinéirí agus íocfaidh nó glanfaidh na Coimisinéirí é agus féadfar é a ghnóthú ó na Coimisinéirí agus a fhorfheidhmiú ina n-aghaidh dá réir sin.
(3) Chun rochtain dóthanach agus sábháilte a chur ar fáil do shoithí i Loch Éirne Uachtair chuig uiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill agus chuig uiscebhealach na hÉirne agus Loch Uachtair agus do shoithí sna huiscebhealaí sin chuig Loch Éirne Uachtair, féadfaidh na Coimisinéirí cibé dreideáil, tochailt agus obair eile a dhéanamh i Loch Éirne Uachtair agus ar Abhainn na hÉirne is dóigh leo is gá nó is fóirsteanach.
(4) (a) Gach conradh a rinne iontaobhaithe an uiscebhealaigh i ndáil le huiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill agus a bheidh i bhfeidhm díreach roimh an lá dílseacháin leanfaidh sé i bhfeidhm an lá dílseacháin agus dá éis amhail is dá mba iad na Coimisinéirí a rinne é agus forléireofar é agus beidh éifeacht leis agus beidh sé infhorfheidhmithe ag na Coimisinéirí nó ina n-aghaidh dá réir sin.
(b) Gach ceadúnas a thug iontaobhaithe an uiscebhealaigh i ndáil le huiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill agus a bheidh i bhfeidhm díreach roimh an lá dílseacháin leanfaidh sé i bhfeidhm an lá dílseacháin agus dá éis amhail is dá mba iad na Coimisinéirí a thug é agus forléireofar é agus beidh éifeacht leis agus beidh sé infhorfheidhmithe ag na Coimisinéirí nó ina n-aghaidh dá réir sin.
(c) Gach doiciméad eile a dheonaigh iontaobhaithe an uiscebhealaigh, nó a rinne siad, i ndáil le huiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill agus a bheidh i bhfeidhm díreach roimh an lá dílseacháin leanfaidh sé i bhfeidhm an lá dílseacháin agus dá éis amhail is dá mba iad na Coimisinéirí a dheonaigh é nó a rinne é agus forléireofar é agus beidh éifeacht leis agus beidh sé infhorfheidhmithe ag na Coimisinéirí nó ina n-aghaidh dá réir sin.
(5) Gach ábhar i gcaingean a aistrítear leis an alt seo féadfaidh na Coimisinéirí, an lá dílseacháin nó dá éis, agairt ina leith, é a ghnóthú nó é a fhorfheidhmiú ina n-ainm féin agus ní gá do na Coimisinéirí fógra faoin aistriú a dhéantar leis an alt seo a thabhairt do na daoine a bheidh faoi cheangal ag aon ábhar i gcaingean den sórt sin.
(6) Aon tagairtí d'iontaobhaithe an uiscebhealaigh a bhí, díreach roimh an lá dílseacháin, in aon reacht nó ionstraim a rinneadh faoi reacht nó i meabhrán comhlachais nó in airteagail chomhlachais aon chuideachta forléireofar iad an lá dílseacháin agus dá éis, a mhéid a bhaineann siad le haon ní a aistrítear leis an alt seo, mar thagairtí do na Coimisinéirí.
(7) Ní bheidh feidhm ag alt 12 den Finance Act, 1895, maidir le dílsiú aon mhaoine nó ceart faoin alt seo.
(8) Ní chuirfidh aon ní san alt seo faoi deara go nglacfar leis na Coimisinéirí mar ghnóthóir canála ná mar chuideachta chanála chun críocha an achtacháin seo nó aon achtacháin eile.
(9) (a) Feidhmeanna nó feidhmeanna sonraithe na gCoimisinéirí faoin Acht seo (seachas ailt 2 (f) agus 3 agus an Sceideal a ghabhann leis an Acht seo) i ndáil le hathchóiriú, deisiú, feabhsú, fadú agus forbairt uiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill nó aon chuid den chéanna, féadfaidh an tAire le hordú iad a tharmligean ar feadh tréimhse sonraithe chun cibé duine nó daoine a bheidh sonraithe san ordú.
(b) Beidh éifeacht leis an bhforáil seo a leanas i ndáil le feidhm a tharmligean chun duine faoi mhír (a):
(i) déanfaidh an duine an fheidhm a chomhlíonadh ina ainm féin ach sin faoi réir mhaoirseacht agus rialú ginearálta an Aire;
(ii) oibreoidh an tarmligean, fad a bheidh sé i bhfeidhm, chun an fheidhm a thabhairt don duine agus a dhílsiú dó;
(iii) leanfaidh an fheidhm, d'ainneoin an tarmligin, de bheith dílsithe do na Coimisinéirí ach dílseofar í amhlaidh i gcomhthráth don duine agus sin sa chaoi go mbeidh sí inchomhlíonta ag na Coimisinéirí nó ag an duine;
(iv) ní chuirfidh an tarmligean deireadh le freagracht an Aire, ná ní mhaolóidh sé í, i leith Dháil Éireann nó mar chomhalta den Rialtas maidir le comhlíonadh na feidhme ag na Coimisinéirí.
(c) Féadfaidh an tAire ordú faoin bhfo-alt seo a chúlghairm nó a leasú.
(d) Féadfaidh cibé forálacha coimhdeacha nó foghabhálacha is dóigh leis an Aire is gá nó is fóirsteanach, lena n-áirítear forálacha ag oiriúnú forálacha den Acht seo, a bheith in ordú faoin bhfo-alt seo.
(e) Féadfaidh na Coimisinéirí, le toiliú an Aire, íocaíochtaí de cibé méideanna is dóigh leo is iomchuí a dhéanamh, as airgead a sholáthróidh an tOireachtas, le duine dá dtarmligtear feidhmeanna faoi mhír (a) in aghaidh caiteachais a thabhóidh an duine ag comhlíonadh na bhfeidhmeanna sin.
(10) Rachaidh na Coimisinéirí i gcomhairle le hAire na Mara i ndáil le haon ábhair a fhearann, nó a d'fhéadfadh fearadh, ar iasc, beathra éisc, stoic éisc nó iascaireacht in uiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill nó in uiscebhealach na hÉirne agus Loch Uachtair.
(11) Aisghairtear leis seo ailt 6, 16 go 25, 27 agus 29 go 36 d'Acht 1856 a mhéid a bhaineann siad le huiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill nó le hiontaobhaithe an uiscebhealaigh.
(12) San alt seo—
ciallaíonn “Acht 1856” an Drainage (Ireland) Act, 1856;
ciallaíonn “uiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill” an t-uiscebhealach a nascann Abhainn na Sionainne ag pointe in aice le Liatroim i gContae Liatroma agus Loch Éirne Uachtair ag béal Abhainn na Graine in aice le Béal Tairbirt i gcontae an Chabháin agus a théann trí Bhéal an Átha Móir i gcontae Liatroma agus Bhéal Átha Conaill i gcontae an Chabháin mar aon leis na loic, na cuanta, na calaí, na lamairní, na piaraí, na céanna, na coraí agus na hoibreacha eile agus an talamh iontu nó i gceangal leo a bhí, díreach roimh an lá dílseacháin, dílsithe d'iontaobhaithe an uiscebhealaigh faoi alt 2 d'Acht 1856;
ciallaíonn “uiscebhealach na hÉirne agus Loch Uachtair”—
(a) Gearradh na bhFualach a nascann Loch Éirne Uachtair le hAbhainn na hÉirne,
(b) an chuid sin de Loch Éirne Uachtair atá suite siar ó thuaidh ó Ghearradh na bhFualach agus idir Gearradh na bhFualach agus talamh-theorainn an Stáit, agus
(c) Abhainn na hÉirne suas an sruth ó Loch Éirne Uachtair agus an ché ar an abhainn sin ag Cill Connaidh, Béal Tairbirt i gcontae an Chabháin;
folaíonn “feidhmeanna” cumhachtaí agus dualgais agus folaíonn tagairtí do chomhlíonadh feidhmeanna, maidir le cumhachtaí, dualgais agus oibleagáidí, tagairtí d'fheidhmiú na gcumhachtaí agus do chomhlíonadh na ndualgas agus na n-oibleagáidí;
ciallaíonn “iontaobhaithe an uiscebhealaigh” Iontaobhaithe Uiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill a chorpraítear faoi Acht 1856 agus dár dílsíodh uiscebhealach Bhéal an Átha Móir agus Bhéal Átha Conaill faoi alt 2 den Acht sin.
An tAcht Siltin Airtéirigh, 1945, a chur i bhfeidhm maidir le ceantar siltin Bhéal an Átha Móir agus Bhéal Átha Conaill.
6.—(1) Beidh feidhm ag an Acht i ndáil le ceantar siltin Bhéal an Átha Móir agus Bhéal Átha Conaill amhail is dá mba cheantar siltin láithreach an ceantar sin agus faoi réir an mhodhnaithe go measfar gurb é an lá díreach roimh an lá dílseacháin an lá ceaptha agus faoi réir aon mhodhnuithe eile is gá.
(2) San alt seo—
ciallaíonn “an tAcht” an tAcht Siltin Airtéirigh, 1945;
tá le “an lá ceaptha”, faoi réir fho-alt (1), an bhrí chéanna atá leis i gCuid III den Acht;
tá le “ceantar siltin láithreach” an bhrí chéanna atá leis i gCuid III den Acht;
ciallaíonn “ceantar siltin Bhéal an Átha Móir agus Bhéal Átha Con aill” na tailte i gceantair Bhéal an Átha Móir i gcontae Liatroma agus Bhéal Átha Conaill i gcontae an Chabháin—
(a) a ndearna na Coimisinéirí, faoin Act of the British Parliament 5 & 6 Vict., c. 89, arna leasú, oibreacha le haghaidh a siltin agus a bhfeabhsaithe a chur i gcrích i ndáil leo, agus
(b) arb iad is ábhar don dámhachtain a rinne na Coimisinéirí faoin Acht sin an 6ú lá de Mhárta, 1860.
Cumhacht chun deacrachtaí a réiteach.
7.—(1) Más rud é i gcás ar bith go mbíonn deacracht ann aon fhoráil den Acht seo a thabhairt i ngníomh, féadfaidh an tAire le rialacháin aon ní a dhéanamh is dóigh leis is gá nó is fóirsteanach chun an deacracht sin a réiteach, chun an fhoráil sin a thabhairt i ngníomh nó chun a oibriú a áirithiú nó a éascú agus féadfaidh aon rialacháin den sórt sin forálacha an Achta seo nó aon achtacháin eile a mhodhnú a mhéid is gá nó is fóirsteanach chun na gcríoch réamhráite.
(2) Ní dhéanfar aon rialacháin faoin alt seo tar éis 5 bliana a bheith imithe in éag ón lá dílseacháin.
Orduithe, rialacháin agus fodhlíthe a leagan faoi bhráid Thithe an Oireachtais.
8.—Gach ordú, seachas ordú faoi alt 9, agus rialachán a dhéanfaidh an tAire agus gach fodhlí a dhéanfaidh na Coimisinéirí faoin Acht seo, leagfar iad faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus má dhéanann ceachtar Teach acu sin, laistigh den 21 lá a shuífidh an Teach sin tar éis an t-ordú, an rialachán nó an fodhlí a leagan faoina bhráid, rún a rith ag neamhniú an ordaithe, an rialacháin nó an fhodhlí, beidh an t-ordú, an rialachán nó an fodhlí ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin gcéanna.
An lá dílseacháin.
9.—Déanfaidh an tAire le hordú lá a cheapadh chun bheith ina lá dílseacháin chun críocha an Achta seo.
Airgead is iníoctha faoin Acht a bhailiú agus a dhiúscairt.
10.—(1) Déanfar na táillí agus an t-airgead eile go léir is iníochta leis na Coimisinéirí faoin Acht seo a bhailiú agus a thógáil i cibé slí a ordóidh an tAire ó am go ham agus a íoc isteach sa Státchiste nó a chur chun tairbhe don Státchiste de réir orduithe an Aire.
(2) Ní bheidh feidhm ag an Public Offices Fees Act, 1879, maidir le táillí a luaitear i bhfo-alt (1).
Caiteachais.
11.—Déanfar na caiteachais a thabhóidh na Coimisinéirí ag riaradh an Achta seo a íoc, a mhéid a cheadóidh an tAire, as airgead a sholáthróidh an tOireachtas.
Gearrtheideal.
12.—Féadfar Acht Uiscebhealach na Sionainne, 1990, a ghairm den Acht seo.
AN SCEIDEAL
Talamh A Fháil Go hÉigeantach
1. (1) I gcás go mbeartaíonn na Coimisinéirí aon talamh a fháil go héigeantach faoin Acht seo, déanfaidh siad—
(a) léarscáil nó plean den talamh a thaisceadh i stáisiún an Gharda Síochána sa cheantar ina bhfuil an talamh agus an léarscáil nó an plean a chur ar fáil lena iniúchadh ansin ag daoine den phobal gach tráth réasúnach,
(b) fógra a fhoilsiú i nuachtán a léitear sa cheantar sin á rá go mbeartaíonn siad an talamh a fháil go héigeantach faoin Acht seo,
(c) sula bhfoilseoidh siad an fógra a dúradh, fógra á rá go bhfuil sé beartaithe acu an talamh a fháil go héigeantach a chur in airde ar an talamh nó gar don talamh, i gcás an talamh go léir a bheartaítear a fháil a bheith ar áitiú ag an duine céanna nó ag na daoine céanna, agus, in aon chás eile, an fógra sin a chur in airde ar thalamh gach áititheora nó gar don talamh sin, agus
(d) cóip den fhógra dá dtagraítear i bhfomhír (c) a thabhairt—
(i) do gach áititheoir (más ann) ar an talamh, agus
(ii) do gach úinéir (más ann) ar an talamh,
ar féidir leis na Coimisinéirí a ainm agus an seoladh ag a bhfuil gnáthchónaí air a fhionnadh le fiosrúcháin réasúnacha.
(2) Maidir leis na fógraí dá dtagraítear i bhfomhír (1)—
(a) beidh siad san fhoirm fhorordaithe,
(b) mura mbeidh léarscáil nó plean iontu den talamh dá dtagraíonn siad, déarfar iontu go bhfuil léarscáil nó plean den talamh taiscthe i stáisiún an Gharda Síochána mar a dúradh agus gur féidir le daoine den phobal é a iniúchadh ansin gach tráth réasúnach,
(c) déarfar iontu gur féidir agóid a dhéanfaidh aon áititheoir nó úinéir ar an talamh i gcoinne an talamh a fháil a chur faoi bhráid na gCoimisinéirí, agus
(d) déarfar iontu cad é an tréimhse ama inar féidir agóid mar a dúradh a chur faoi bhráid na gCoimisinéirí.
2. (1) Aon talamh a mbeidh fógra faoi mhír 1 (1) (b) foilsithe ina leith, féadfaidh áititheoir na talún sin nó aon úinéir ar an talamh sin, laistigh de dhá mhí tar éis dháta an fhoilsithe sin, agóid i scríbhinn a chur faoi bhráid na gCoimisinéirí i gcoinne na fála éigeantaí beartaithe dá dtagraítear san fhógra.
(2) Féadfaidh an duine a mbeidh agóid faoi fhomhír (1) curtha faoi bhráid na gCoimisinéirí aige an agóid a tharraingt siar trí fhógra i scríbhinn a chur chuig na Coimisinéirí nó chuig an Aire.
(3) (a) Más rud é, i ndáil le talamh a bheartaítear a fháil go héigeantach faoin Acht seo, go gcuirfear agóid faoi bhráid na gCoimisinéirí de réir fhomhír (1) agus nach dtarraingeofar siar í, breithneoidh an tAire an agóid agus ní dhéanfar an talamh a fháil go héigeantach gan toiliú an Aire.
(b) I gcás go mbeidh ceart slí poiblí ann thar thalamh a bheartaítear a fháil go héigeantach faoin Acht seo, ní dhéanfar an talamh a fháil go héigeantach gan toiliú an Aire.
(4) Beidh—
(a) cóip d'aon agóid lena mbaineann faoi fhomhír (1).
(b) cóip den nuachtán ina bhfuil an fógra atá sonraithe i mír 1 (1) (b),
(c) cóip den fhógra atá sonraithe i mír 1 (1) (c), agus
(d) cóip den léarscáil nó den phlean den talamh a taisceadh de bhun mhír 1 (1) (a),
ag gabháil le hiarratas ó na Coimisinéirí chun toiliú an Aire a fháil le talamh a fháil go héigeantach faoin Acht seo agus tabharfaidh na Coimisinéirí don Aire cibé faisnéis eile a theastóidh ón Aire i ndáil leis an bhfáil.
(5) Ar iarratas a bheith déanta faoi fhomhír (4) i ndáil le talamh—
(a) i gcás gurb é tuairim an Aire nach bhfuil forálacha mhír 1 comhlíonta i ndáil leis an talamh nó le cuid den talamh, diúltóidh sé a thoiliú a thabhairt leis an talamh a fháil go héigeantach nó, de réir mar a bheidh, diúltóidh sé a thoiliú a thabhairt leis an gcuid sin den talamh a fháil go héigeantach agus tabharfaidh sé a thoiliú leis an gcuid eile den talamh a fháil,
(b) in aon chás eile, tabharfaidh an tAire a thoiliú leis an talamh a fháil go héigeantach.
3. (1) Más rud é, maidir le haon talamh a mbeidh forálacha mhír 1 comhlíonta i ndáil leis—
(a) nach gcuirfear aon agóid faoi bhráid na gCoimisinéirí de réir mhír 2,
(b) go ndéanfar aon agóid a chuirfear faoi bhráid na gCoimisinéirí mar a dúradh a tharraingt siar ina dhiaidh sin, nó
(c) go dtabharfaidh an tAire a thoiliú leis na Coimisinéirí d'fháil na talún go héigeantach,
féadfaidh na Coimisinéirí le hordú (dá ngairtear “ordú dílseacháin” sa Sceideal seo) an talamh a fháil.
(2) I gcás go dtagann na Coimisinéirí, sula ndéanann siad ordú dílseacháin, ar an eolas go bhfuil an talamh (go haonarach nó i dteannta talún eile) atá le fáil leis an ordú faoi réir aon bhlianachta nó íocaíochta eile a íoctar le Coimisiún Talún na hÉireann nó faoi réir aon mhuirir i leith dleachta eastáit, dleachta comharbais nó cánach oidhreachta is iníoctha leis na Coimisinéirí Ioncaim ar bhás aon duine, cuirfidh na Coimisinéirí in iúl láithreach do Choimisiún Talún na hÉireann nó, de réir mar a bheidh, do na Coimisinéirí Ioncaim, go mbeartaítear an t-ordú a dhéanamh.
(3) Aon uair a dhéanfaidh na Coimisinéirí ordú dílseacháin, déanfaidh siad, laistigh de 14 lá tar éis an t-ordú a dhéanamh—
(a) i gcás an talamh go léir atá i gceist san ordú dílseacháin a bheith ar áitiú ag an duine nó ag na daoine céanna, fógra ina mbeidh cóip den ordú a chur in airde ar an talamh nó gar don talamh agus, in aon chás eile, an fógra sin a chur in airde ar thalamh gach áititheora nó gar don talamh sin, agus
(b) cóip den ordú a thabhairt—
(i) do gach áititheoir (más ann) ar an talamh, agus
(ii) do gach úinéir (más ann) ar an talamh,
ar féidir leis na Coimisinéirí a ainm agus an seoladh ag a bhfuil gnáthchónaí air a fhionnadh le fiosrúcháin réasúnacha.
4. (1) Beidh ordú dílseacháin san fhoirm fhorordaithe agus beidh sé sainráite agus oibreoidh sé chun an talamh lena mbaineann sé a dhílsiú do na Coimisinéirí i bhfeo simplí saor ó eirí agus ó gach eastát, ceart, éasúint, teideal agus leas d'aon chineál thar an talamh nó maidir leis ar dháta sonraithe nach luaithe ná 21 lá tar éis an t-ordú a dhéanamh.

5. SHANNON NAVIGATION ACT, 1990
Interpretation.
1.—(1) In this Act—
“boat” includes any barge, vessel or other water-craft;
“the Commissioners” means the Commissioners of Public Works in Ireland and references to the Commissioners include references to their servants and agents;
“land” includes any land covered by water;
“the Minister” means the Minister for Finance;
“the navigation channel” means the parts of the Shannon navigation referred to in paragraph (a) of the definition of “the Shannon navigation” in this subsection, the canals and locks referred to in paragraph (b) of that definition and the parts accessible to boats of the harbours referred to in that paragraph;
“the Shannon Act” means the Act of the British Parliament 2 & 3 Vict., c. 61, as amended or extended;
“the Shannon navigation” means—
(a) the river Shannon, the lakes from or through which it flows, and such of the rivers which flow into it or into those lakes as are or have been improved or made navigable by the Commissioners or by other persons under powers conferred by statute, within the limits standing fixed and determined for the time being under section 39 of the Shannon Act, and
(b) the canals, locks, harbours, wharfs, landing places, piers, quays, weirs and other works and land constructed by or vested in the Commissioners, whether before or after the passing of this Act, for the purpose of the use or improvement of any of those rivers or lakes, within the limits aforesaid, or the navigation thereof or any other purpose authorised by the Shannon Act;
“the vesting day” means the day appointed under section 9 to be vesting day.
(2) A reference in this Act to a section is to a section of this Act, unless it is indicated that reference to some other enactment is intended.
(3) A reference in this Act to a subsection or paragraph is to a subsection or paragraph of the provision in which it occurs, unless it is indicated that a reference to some other provision is intended.
(4) A reference in this Act to any enactment shall be construed as a reference to that enactment as amended or adapted by or under any subsequent enactment.
Powers of Commissioners in relation to Shannon navigation.
2.—The Commissioners shall have all such powers as are necessary for the performance of their functions under the Shannon Act and shall, without prejudice to the generality of the foregoing and to their powers under that Act, have power to undertake the care, conservation, management, control, maintenance, restoration, repair, improvement, extension and development of the Shannon navigation and to—
(a) draw any water necessary for the purposes of the navigation channel from any natural source whatsoever,
(b) dredge, widen, deepen, alter the course of or otherwise repair or improve the navigation channel or improve the supply of water for, or dispose of surplus water from, the navigation channel and for that purpose construct, alter, repair, improve, dredge, widen or deepen any stream, river, drain or channel carrying any water to or from the navigation channel and replace or repair any pipe carrying any such water or construct, repair or improve any pumping station required for such water,
(c) remove any structure or other thing that is obstructing or is likely to obstruct the navigation channel or so alter it as to eliminate the obstruction or the likelihood of obstruction,
(d) prohibit the building of bridges, weirs or other structures on, in or over, or culverts, pipes or drains under, the navigation channel without the consent of the Commissioners,
(e) construct, alter, underpin, repair or improve any lock, quay, harbour, dry dock, weir, fish pass, slipway, navigation aid, pumping station, hydroelectric station and ancillary works, building, towpath, bridge, aqueduct, embankment, culvert, pipe or drain or road (other than a public road within the meaning of the Local Government (Roads and Motorways) Act, 1974) on, over, beside or under the navigation channel,
(f) acquire, by agreement, or compulsorily in accordance with the Schedule to this Act, any land required for the purposes of the Shannon navigation and any right, easement, title or interest of any kind in, over or in respect of such land,
(g) without prejudice to the right of any person to use water of or abstract water from the navigation channel, alter the water levels of the navigation channel,
(h) close to navigation any part of the navigation channel not required for navigation or close temporarily any part thereof and open or reopen and declare navigable any part of the navigation channel previously closed to navigation,
(i) with the agreement of any person entitled to any payment in respect of an acquisition under paragraph (f) or any payment under section 4 (3) (a), carry out remedial or other works in relation to the Shannon navigation or any property of the person in lieu of the whole or part of the payment.
Power of Commissioners to make bye-laws in relation to Shannon navigation.
3.—(1) The Commissioners may make bye-laws for the care, conservation, management, control and maintenance and the regulation of the use of the Shannon navigation and in relation to the restoration, repair, improvement, extension and development thereof and, without prejudice to the generality of the foregoing, in relation to any one or more of the following matters:
(a) the regulation of the conditions (including conditions as to safety) under which boats may be used in the navigation channel,
(b) the closing to navigation either temporarily or permanently of any part of the navigation channel,
(c) the opening or reopening to navigation of any part of the navigation channel not open to navigation,
(d) the alteration of water levels of the navigation channel,
(e) the regulation of bathing in the navigation channel,
(f) the prohibition of the building of bridges, weirs or other structures on, in or over, or culverts, pipes or drains under, the navigation channel without the consent of the Commissioners,
(g) the prohibition of the use, save under and in accordance with a licence in that behalf granted by the Commissioners and containing such (if any) conditions as they consider necessary or expedient, of the Shannon navigation or any part of it,
(h) without prejudice to the rights of any person to use water of or abstract water from the navigation channel, the regulation or prohibition of the use of water of, or the abstraction of water from, the navigation channel,
(i) subject to subsection (4), the regulation of fishing in the navigation channel,
(j) the prevention of damage to the Shannon navigation or the obstruction of the navigation channel,
(k) the removal from or the prohibition of the passage through or use in the navigation channel of, or the use of any of the facilities or installations of the Shannon navigation by, any boat or thing which is or may become a danger to life, health, navigation or fish stocks or would otherwise interfere with the proper use of the Shannon navigation or in relation to which a fee, toll or charge due and payable under the bye-laws has not been paid or arrangements for its payment, acceptable to the Commissioners, have not been made,
(l) the fixing, altering, charging and recovery of fees, tolls and charges in respect of—
(i) the use by boats of the navigation channel or the facilities or installations of the Shannon navigation, whether for the purposes of their passage through the navigation or for the purposes of their being anchored, moored, tied up or laid up or for any other purpose, or
(ii) the use of water of or the abstraction of water from the navigation channel,
and the prohibition of the use referred to in subparagraph (i) or the use or abstraction referred to in subparagraph (ii) without payment of any fee, toll or charge payable under this paragraph in respect thereof or the making of arrangements, acceptable to the Commissioners, for its payment,
(m) the establishment and maintenance by the Commissioners of a register in which entries containing specified information will be required to be made annually or at other specified times, on application in that behalf by their owners, in respect of boats or specified classes of boats using the Shannon navigation, the payment of fees by the owners of the boats concerned in respect of the entries and the prohibition of the use of the Shannon navigation by boats required to be, but not, registered in the register.
(2) Bye-laws under this section may contain such incidental, subsidiary and ancillary provisions as the Commissioners consider necessary or expedient for the purposes of the bye-laws.
(3) The Commissioners may, by bye-laws under this section, exercise from time to time as occasion requires the powers conferred on them by section 39 of the Shannon Act to fix and determine the limits of the river Shannon, and the rivers flowing into it that are improved under the Shannon Act, within which the other powers conferred on the Commissioners by the Shannon Act may be exercised.
(4) Bye-laws under this section shall not be made in relation to any matter in respect of which regulations or bye-laws may be made under the Fisheries Acts, 1959 to 1983.
(5) A person who contravenes a bye-law under this section shall be guilty of an offence and shall be liable—
(a) on summary conviction, to a fine not exceeding £1,000 (together with, in the case of a continuing contravention, a fine not exceeding £100 for every day on which the contravention is continued and not exceeding in total an amount which, when added to any other fine under this paragraph in relation to the contravention concerned, equals £1,000) or to imprisonment for any term not exceeding 6 months or to both,
(b) on conviction on indictment, to a fine not exceeding £5,000 (together with, in the case of a continuing contravention, a fine not exceeding £500 for every day on which the contravention is continued) or to imprisonment for any term not exceeding 2 years or to both.
(6) Where an offence to which subsection (5) relates is committed by a body corporate and is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of, any person being a director, manager or secretary of the body corporate, or a person who was purporting to act in any such capacity, that person, as well as the body corporate, shall be guilty of an offence and shall be liable to be proceeded against and punished as if he were guilty of the first-mentioned offence.
(7) (a) The Commissioners may bring proceedings for a summary offence under this section.
(b) Notwithstanding section 10 (4) of the Petty Sessions (Ireland) Act, 1851, summary proceedings for an offence to which subsection (5) or (6) relates may be instituted within 12 months from the date of the offence.
Power of Commissioners to carry out works in relation to Shannon navigation and to enter land.
4.—(1) (a) The Commissioners may, for the purposes of their functions under this Act—
(i) enter on any land and carry out on the land work in relation to the Shannon navigation or property vested in them for the purpose of the navigation,
(ii) enter on any land and occupy it or otherwise make use of it for the purpose of carrying out work on other land in relation to the Shannon navigation or the property aforesaid,
(iii) enter on any land for the purpose of gaining access to, inspecting or surveying the Shannon navigation, the said property or land specified in paragraph (a) or (b),
and do on any such land all such other things as are, in their opinion, ancillary or reasonably necessary for the purposes aforesaid.
(b) Not less than 14 days before exercising any power under paragraph (a) (other than subparagraph (iii)) the Commissioners shall give to any owner or occupier of the land concerned whose identity and whereabouts can be ascertained by the Commissioners by the taking of reasonable steps a notice in writing stating their intention to enter on the land and the purposes for which the entry is intended to be made and specifying the other powers proposed to be exercised.
(c) A person to whom a notice has been given under this subsection may, not later than 14 days after the giving of the notice, apply, on notice to the Commissioners, to the justice of the District Court having jurisdiction in the District Court district in which the land is situated for an order prohibiting the entry and, upon the hearing of the application, the justice may, if he so thinks proper, either prohibit the entry or specify conditions to be complied with by the person making the entry.
(d) Where a justice of the District Court prohibits under this subsection a proposed entry onto land, it shall not be lawful for any person to enter under paragraph (a) onto the land, and where a justice of the District Court specifies under this subsection conditions to be complied with by a person entering onto land, every person who enters onto the land under paragraph (a) shall comply with the conditions so specified.
(2) (a) Where, in the opinion of the Commissioners—
(i) the exercise of a power conferred on them by subsection (1) is urgently required for the purpose of preventing or minimising injury, loss or damage to persons or property, and
(ii) it is not reasonably possible to comply, in relation to such exercise, with paragraph (b) of that subsection,
the Commissioners may exercise the power without having complied in relation to such exercise, with that paragraph.
(b) Before exercising a power by virtue of this subsection, the Commissioners shall give to any owner or occupier of the land whose identity and whereabouts can be ascertained by the Commissioners by the taking of reasonable steps notice of their intention to enter on the land, of the purposes for which the entry is intended to be made and of the other powers proposed to be exercised.
(c) Where, in the opinion of the Commissioners, it is not reasonably possible to comply with paragraph (b), the Commissioners may exercise the power concerned without having complied therewith and, as soon as may be thereafter, shall give to any owner or occupier of the land concerned whose identity and whereabouts can be ascertained by the Commissioners by the taking of reasonable steps a notice in writing specifying the powers exercised and the purposes of such exercise.
(3) (a) Where a person (other than a person whose land is acquired under section 2 (f)) suffers loss, injury or damage or incurs expenditure in consequence of the exercise by the Commissioners of a power conferred on them by this section or section 2, the Commissioners shall pay to him compensation in respect of the loss, injury, damage or expenditure and the amount of the compensation shall, in default of agreement, be determined by arbitration under and in accordance with the Lands Clauses Acts and, for the purposes of those Acts, the Commissioners shall be deemed to be the promoter of the undertaking and this Act and the vesting order concerned shall be deemed to be the special Act; and, for the purposes of such determination, those Acts shall apply with any other necessary modifications and are incorporated (except insofar as they are inconsistent with and subject to any amendments or modifications, express or implied, thereof effected by this Act) with this Act.
(b) In assessing the compensation payable to a person under paragraph (a), regard shall be had to any benefit to any property of the person that arises or may reasonably be expected to arise from the exercise of the power concerned or any other power under this section or the said section 2 by the Commissioners and, in particular but without prejudice to the generality of the foregoing, shall, in the case of a claim for compensation in relation to water rights, have regard to the extent of the exercise of the water rights during the period of 20 years immediately before the exercise of the power concerned by the Commissioners and to any alternative water supply provided for the person by the Commissioners.
Transfer to Commissioners of Ballinamore and Ballyconnell navigation and conferral on them of certain functions in relation to Erne and Lough Oughter navigation.
5.—(1) On the vesting day—
(a) so much of the Ballinamore and Ballyconnell navigation as is situated in the State and the property (including choses-in-action), assets, powers, rights, licences, privileges and liabilities vested in, held, enjoyed or incurred by the navigation trustees in connection therewith or appertaining thereto shall, by virtue of this section but subject where necessary to transfer in the books of any bank, corporation or company, be transferred to the Commissioners,
(b) so much of the land of the said navigation as is situated in the State shall, by virtue of this section, vest in the Commissioners for all the estate, right, title and interest of the navigation trustees, and
(c) the said navigation and the Erne and Lough Oughter navigation shall be deemed, for the purposes of the Shannon Act and this Act, to be part of the Shannon navigation and the River Shannon and that Act and this Act shall apply and have effect accordingly in relation to the Ballinamore and Ballyconnell navigation and the Erne and Lough Oughter navigation with the modifications that—
(i) the functions conferred on the Commissioners by or under the said Acts may be performed in relation to the Ballinamore and Ballyconnell navigation and the Erne and Lough Oughter navigation by them or, if, whenever and in so far as they are delegated to a person under subsection (9), by the person either in or outside the State,
(ii) references in this Act to the navigation channel shall be construed as references to—
(I) the Ballinamore and Ballyconnell navigation other than the wharfs, landing places, piers, quays, weirs and other works and land referred to in the definition of the navigation in subsection (12) and the parts of the harbours referred to in that definition not accessible to boats, and
(II) the Erne and Lough Oughter navigation other than the quay referred to in the definition of the navigation in subsection (12),
and with any other necessary modifications.
(2) Subject to the provisions of this Act, the Commissioners may, on and after the vesting day, enjoy, exercise and enforce all the powers, rights and privileges aforesaid and shall be subject to all the liabilities aforesaid and, accordingly, every debt and other liability in relation to the Ballinamore and Ballyconnell navigation that, immediately before the vesting day, is owing and unpaid or has been incurred and is undischarged by the navigation trustees shall, on the vesting day, become and be the debt or liability of the Commissioners and shall be paid or discharged by and may be recovered from and enforced against the Commissioners accordingly.
(3) For the purpose of providing adequate and safe access for vessels in Upper Lough Erne to the Ballinamore and Ballyconnell navigation and to the Erne and Lough Oughter navigation and for vessels in those navigations to Upper Lough Erne, the Commissioners may carry out such dredging, excavation and other work in Upper Lough Erne and the River Erne as they consider necessary or expedient.
(4) (a) Every contract made by the navigation trustees in relation to the Ballinamore and Ballyconnell navigation that is in force immediately before the vesting day shall continue in force on and after the vesting day as if it had been made by the Commissioners and shall be construed and have effect and be enforceable by or against the Commissioners accordingly.
(b) Every licence given by the navigation trustees in relation to the Ballinamore and Ballyconnell navigation that is in force immediately before the vesting day shall continue in force on and after the vesting day as if it had been given by the Commissioners and shall be construed and have effect and be enforceable by or against the Commissioners accordingly.
(c) Every other document granted or made by the navigation trustees in relation to the Ballinamore and Ballyconnell navigation that is in force immediately before the vesting day shall continue in force on and after the vesting day as if it had been granted or made by the Commissioners and shall be construed and have effect and be enforceable by or against the Commissioners accordingly.
(5) Every chose-in-action transferred by this section may, on or after the vesting day, be sued upon, recovered or enforced by the Commissioners in their own name and it shall not be necessary for the Commissioners to give notice to the persons bound by any such chose-in-action of the transfer effected by this section.
(6) References to the navigation trustees contained, immediately before the vesting day, in any statute or instrument made under statute or in the memorandum or articles of association of any company shall, insofar as they relate to anything transferred by this section, be construed on and after the vesting day as references to the Commissioners.
(7) Section 12 of the Finance Act, 1895, shall not apply to the vesting of any property or rights under this section.
(8) Nothing in this section shall cause the Commissioners to be regarded as a canal undertaker or a canal company for the purposes of this or any other enactment.
(9) (a) The functions or specified functions of the Commissioners under this Act (other than sections 2 (f) and 3 and the Schedule to this Act) in relation to the restoration, repair, improvement, extension and development of the Ballinamore and Ballyconnell navigation or any part thereof may be delegated for a specified period by the Minister by order to such person or persons as may be specified in the order.
(b) The following provision shall have effect in relation to the delegation of a function to a person under paragraph (a):
(i) the function shall be performed by the person in his own name but subject to the general superintendence and control of the Minister;
(ii) the delegation shall operate, while it is in force, to confer the function on and vest it in the person;
(iii) the function shall, notwithstanding the delegation, continue to be vested in the Commissioners but shall be so vested concurrently with the person and so as to be capable of being performed by the Commissioners or the person;
(iv) the delegation shall not remove or derogate from the responsibility of the Minister to Dáil Éireann or as a member of the Government for the performance of the function by the Commissioners.
(c) The Minister may revoke or amend an order under this subsection.
(d) An order under this subsection may contain such ancillary or subsidiary provisions as the Minister considers necessary or expedient including provisions adapting provisions of this Act.
(e) The Commissioners may, with the consent of the Minister, out of moneys provided by the Oireachtas, make payments of such amounts as they consider appropriate to a person to whom functions are delegated under paragraph (a) in respect of expenditure incurred by the person in the performance of those functions.
(10) The Commissioners shall consult with the Minister for the Marine in relation to any matters which affect or could affect fish, fish life, fish stocks or fishing in the Ballinamore and Ballyconnell navigation or the Erne and Lough Oughter navigation.
(11) Sections 6, 16 to 25, 27 and 29 to 36 of the Act of 1856 are hereby repealed in so far as they relate to the Ballinamore and Ballyconnell navigation or the navigation trustees.
(12) In this section—
“the Act of 1856” means the Drainage (Ireland) Act, 1856;
“the Ballinamore and Ballyconnell navigation” means the navigation connecting the river Shannon at a point near Leitrim in the county of Leitrim and Upper Lough Erne at the mouth of the Woodford River near Belturbet in the county of Cavan and passing through Ballinamore in the county of Leitrim and Ballyconnell in the county of Cavan together with the locks, harbours, wharfs, landing places, piers, quays, weirs and other works and land therein or connected therewith that, immediately before the vesting day, stood vested in the navigation trustees under section 2 of the Act of 1856;
“the Erne and Lough Oughter navigation” means—
(a) the Foalies Cut connecting Upper Lough Erne with the River Erne,
(b) that part of Upper Lough Erne that is situated north west of the Foalies Cut and between the Foalies Cut and the land frontier of the State, and
(c) the River Erne upstream from Upper Lough Erne and the quay on that river at Kilconny, Belturbet in the county of Cavan;
“functions” includes powers and duties and references to the performance of functions include, as respects powers, duties and obligations, references to the exercise of the powers and the carrying out of the duties and obligations;
“the navigation trustees” means the Ballinamore and Ballyconnell Navigation Trustees incorporated under the Act of 1856 and in whom the Ballinamore and Ballyconnell navigation was vested under section 2 of that Act.
Application of Arterial Drainage Act, 1945, to Ballinamore and Ballyconnell drainage district.
6.—(1) The Act shall apply in relation to the Ballinamore and Ballyconnell drainage district as if that district were an existing drainage district and subject to the modification that the appointed day shall be deemed to be the day immediately preceding the vesting day and any other necessary modifications.
(2) In this section—
“the Act” means the Arterial Drainage Act, 1945;
“the appointed day” has, subject to subsection (1), the same meaning as in Part III of the Act;
“existing drainage district” has the same meaning as in Part III of the Act;
“the Ballinamore and Ballyconnell drainage district” means the lands in the districts of Ballinamore in the county of Leitrim and Ballyconnell in the county of Cavan—
(a) in relation to which works for their drainage and improvement were carried out by the Commissioners under the Act of the British Parliament 5 & 6 Vict., c. 89, as amended, and
(b) which are the subject of the award made by the Commissioners under that Act on the 6th day of March, 1860.
Power to remove difficulties.
7.—(1) If in any respect any difficulty arises in bringing any provision of this Act into operation, the Minister may by regulations do anything which appears to him to be necessary or expedient for the purposes of removing that difficulty, for bringing that provision into operation or for securing or facilitating its operation and any such regulations may modify the provisions of this Act or any other enactment so far as may be necessary or expedient for the purposes aforesaid.
(2) No regulations shall be made under this section after the expiration of 5 years from the vesting day.
Laying of orders, regulations and bye-laws before Houses of the Oireachtas.
8.—Every order, other than an order under section 9, and regulation made by the Minister and every bye-law made by the Commissioners under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling the order, regulation or bye-law is passed by either such House within the next 21 days on which that House has sat after the order, regulation or bye-law is laid before it, the order, regulation or bye-law shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Vesting day.
9.—The Minister shall by order appoint a day to be the vesting day for the purposes of this Act.
Collection and disposal of moneys payable under Act.
10.—(1) All fees and other moneys payable to the Commissioners under this Act shall be collected and taken in such manner as the Minister may from time to time direct and shall be paid into or disposed of for the benefit of the Exchequer in accordance with the directions of the Minister.
(2) The Public Offices Fees Act, 1879, shall not apply in respect of fees mentioned in subsection (1).
Expenses.
11.—The expenses incurred by the Commissioners in the administration of this Act shall, to such extent as may be sanctioned by the Minister, be paid out of moneys provided by the Oireachtas.
Short title.
12.—This Act may be cited as the Shannon Navigation Act, 1990.
SCHEDULE
Compulsory Acquisition of Land
1. (1) Where the Commissioners propose to acquire any land compulsorily under this Act, they shall—
(a) deposit in a Garda Síochána station in the district in which the land is situated a map or plan of the land and make the map or plan available there for inspection by members of the public at all reasonable times,
(b) publish a notice stating their intention to acquire the land compulsorily under this Act in a newspaper circulating in that district,
(c) before publishing the notice aforesaid, in case all the land proposed to be acquired is in the occupation of the same person or persons, post a notice stating their intention to acquire the land compulsorily on or near the land and, in any other case, post such notice on or near the land of each occupier, and
(d) give a copy of the notice referred to in subparagraph (c) to—
(i) every (if any) occupier of the land, and
(ii) every (if any) owner of the land,
whose name and the address at which he ordinarily resides can be ascertained by the Commissioners by reasonable inquiries.
(2) The notices referred to in subparagraph (1)—
(a) shall be in the prescribed form,
(b) shall, if they do not contain a map or plan of the land to which they refer, state that a map or plan of the land is deposited in a Garda Síochána station aforesaid and may be inspected there by members of the public at all reasonable times,
(c) shall state that an objection by any occupier or owner of the land to the acquisition of the land may be submitted to the Commissioners, and
(d) shall state the time within which an objection aforesaid may be submitted to the Commissioners.
2. (1) The occupier or any owner of land in respect of which a notice under paragraph 1 (1) (b) has been published may, within two months after the date of such publication, submit to the Commissioners an objection in writing to the proposed compulsory acquisition referred to in the notice.
(2) An objection under subparagraph (1) may be withdrawn by the person who submitted it by notice in writing sent to the Commissioners or to the Minister.
(3) (a) Where, in relation to the proposed compulsory acquisition of land under this Act, an objection is submitted to the Commissioners in accordance with subparagraph (1) and is not withdrawn, the objection shall be considered by the Minister and the land shall not be acquired compulsorily without the consent of the Minister.
(b) Where a public right of way exists over land proposed to be compulsorily acquired under this Act, the land shall not be acquired compulsorily without the consent of the Minister.
(4) An application by the Commissioners for the consent of the Minister to the compulsory acquisition of land under this Act shall be accompanied by—
(a) a copy of any objection concerned under subparagraph (1),
(b) a copy of the newspaper containing the notice specified in paragraph 1 (1) (b),
(c) a copy of the notice specified in paragraph 1 (1) (c), and
(d) a copy of the map or plan of the land deposited in pursuance of paragraph 1 (1) (a),
and the Commissioners shall furnish to the Minister such other information in relation to the acquisition as the Minister may require.
(5) On an application under subparagraph (4) in relation to land—
(a) in case the Minister is of opinion that the provisions of paragraph 1 have not been complied with in relation to the land or part of the land, he shall refuse to grant his consent to the compulsory acquisition of the land or, as the case may be, refuse to grant his consent to the compulsory acquisition of the part and grant his consent to the acquisition of the remainder of the land,
(b) in any other case, the Minister shall grant his consent to the compulsory acquisition of the land.
3. (1) Where, in relation to any land in respect of which the provisions of paragraph 1 have been complied with—
(a) no objection is submitted to the Commissioners in accordance with paragraph 2,
(b) any objection which is submitted as aforesaid is subsequently withdrawn, or
(c) the Minister gives his consent to the compulsory acquisition thereof by the Commissioners,
the Commissioners may by order (in this Schedule referred to as “a vesting order”) acquire the land.
(2) Where the Commissioners, before making a vesting order, become aware that the land to be acquired by the order is subject (whether alone or in conjunction with other land) to any annuity or other payment to the Irish Land Commission or to any charge for estate duty, succession duty or inheritance tax payable to the Revenue Commissioners on the death of any person, the Commissioners shall forthwith inform the Irish Land Commission or the Revenue Commissioners, as the case may be, of the intention to make the order.
(3) Whenever the Commissioners make a vesting order, they shall within 14 days after making the order—
(a) in case all the land comprised in the vesting order is in the occupation of the same person, or persons, post a notice containing a copy of the order on or near the land and, in any other case, post such notice on or near the land of each occupier, and
(b) give a copy of the order to—
(i) every (if any) occupier of the land, and
(ii) every (if any) owner of the land,
whose name and the address at which he ordinarily resides can be ascertained by the Commissioners by reasonable inquiries.
4. (1) A vesting order shall be in the prescribed form and shall be expressed and shall operate to vest the land to which it relates in the Commissioners in fee simple free from encumbrances and all estates, rights, easements, titles and interests of any kind over or in respect of the land on a specified date not earlier than 21 days after the making of the order.
(2) Notwithstanding anything contained in subparagraph (1), where the Commissioners acquire by a vesting order land which is subject, either alone or in conjunction with other land, to a purchase annuity, payment in lieu of rent, or other annual sum (not being merely a rent under a contract of tenancy) payable to the Irish Land Commission, the Commissioners shall become and be liable, as from the date on which the land is vested in them by the vesting order, for the payment to the Irish Land Commission of the purchase annuity, payment in lieu of rent or annual sum or such portion thereof as shall be apportioned by the Irish Land Commission on the land as if the land had been transferred to the Commissioners by the owner thereof on that date.
(3) When the Commissioners make a vesting order in relation to land, they shall send the order to the registering authority under the Registration of Title Act, 1964, and thereupon the registering authority shall cause the Commissioners to be registered under that Act as owners of the land in accordance with the order.
5. (1) Where, immediately before a vesting order is made by the Commissioners, any person has any estate, right, easement, title or interest of any kind in, over or in respect of the land acquired by the order, the person may apply to the Commissioners at any time after the making of the order for compensation in respect of the estate, right, easement, title or interest and the Commissioners shall, subject to subparagraph (3), thereupon pay to the person compensation in respect of the estate, right, easement, title or interest together with interest at such rate as the Minister may determine from time to time, on the amount from that date to the date of payment thereof.
(2) The amount of any compensation to be paid under this paragraph shall be determined under and in accordance with the Lands Clauses Acts and, for the purposes of these Acts, the Commissioners shall be deemed to be the promoter of the undertaking and this Act and the vesting order concerned shall be deemed to be the special Act; and, for the purposes of such determination, those Acts shall apply with any other necessary modifications and are incorporated (except in so far as they are inconsistent with and subject to any amendments or modification, express or implied, thereof effected by this Act) with this Act.
(3) In assessing the compensation payable to a person under this paragraph, regard shall be had to any benefit to any property (whether or not it is the property in respect of which such compensation is claimed) of the person that arises, or may reasonably be expected to arise, from the carrying out of any works in relation to the Shannon navigation by the Commissioners and, in particular—
(a) in the case of compensation in respect of water rights, have regard to any alternative water supply provided for the person by the Commissioners, and
(b) in the case of compensation in respect of interference with water or a watercourse intended to provide power for any purpose, have regard to the extent to which power was so provided during the period of 20 years immediately before the date of the making of the vesting order concerned and shall also have regard to any alternative source of power provided for the person by the Commissioners.
(4) (a) The Minister may by regulations, in such cases (if any) and to such extent as he considers necessary for the purposes of section 4 (3) apply all or any of the provisions of sections 69 to 83 of the Lands Clauses Consolidation Act, 1845, as if compensation under the said section 4 (3) were purchase money or compensation under the said Act, as if the Commissioners were the promoter of the undertaking and with any other necessary modifications.
(b) Where money is paid into court under the said section 69, as applied by this section, by the Commissioners, no costs shall be payable by them to any person in respect of any proceedings for the investment, payment of income or payment of capital of such money.
6. A document in writing referred to in paragraph 1 (1) (d) or 3 (3) (b) and a notice in writing under section 4 may be given to the person concerned—
(a) by delivering it to him,
(b) by leaving it at the address at which the person ordinarily resides, or
(c) by sending it by post in a prepaid registered letter addressed to the person at the address at which he ordinarily resides or, in the case of a company (within the meaning of the Companies Act, 1963) at its registered office or, in the case of any other body, at its principal office or place of business.
7. In this Schedule—
“owner”, in relation to land, includes a reputed owner of the land;
“prescribed” means prescribed by regulations made by the Minister.
