ACHT NA nÚDARÁS nÁITIÚIL (COSTAS BEATHA), 1940.

Údaráis áitiúla.

1.—Chun crícheanna an Achta so is údarás áitiúil gach cólucht agus duine aca so leanas, sé sin le rá:—

(a) bárdas chontae-bhuirge, comhairle chontae no bhuirge no bhailecheanntair, bord caomhnóirí, coimisinéirí baile, agus údarás sláintíochta puirt, agus

(b) duine ar n-a cheapadh le reacht no fé chun feidhmeanna no aon chuid d'fheidhmeanna aon bhárdais, chomhairle, bhúird, choimisinéirí, no údaráis den tsórt san do chólíonadh, agus

(c) coiste no có-choiste no bord no có-bhord (corparuithe no neamh-ionchorparuithe) d'aon cheann no níos mó de sna bárdais, de sna comhairlí, de sna búird, de sna coimisinéirí, de sna húdaráis, no de sna daoine sin, no bheidh ceaptha ag aon cheann no níos mó dhíobh san, agus

(b) coiste freastal scoile, coiste oideachais ghairme beatha, agus coiste talmhaíochta.

2.—(1) I gcás cuid de luach saothair oifigigh no seirbhísigh d'údarás áitiúil, a bhí i seirbhís no i bhfostaíocht an údaráis áitiúil sin an 30adh lá de Mheitheamh, 1940, do bheith ina bhonus, a atharuíonn fé mar atharuíonn an costas beatha agus a deintear amach chuige sin do réir fhigiúra sheasuíonn don chostas bheatha no bheireann le tuigsint í do sheasamh don chostas bheatha, ní déanfar amach an bonus san, alos aon tréimhse dar tosach an 1adh lá d'Iúl, 1940, no dáta dá éis sin, do réir fhigiúra is aoirde ná an fhigiúir gur dá réir a rinneadh amach é díreach roimh an dáta san agus, dá réir sin, scuirfidh an bonus san, sa mhéid sin, agus amhail ar an 1adh lá d'Iúl, 1940, agus ón lá san amach, d'atharú fé mar atharóidh an costas beatha.

(2) I gcás cuid de luach saothair oifigigh no seirbhísigh d'údarás áitiúil, a chuaidh no raghaidh isteach i seirbhís an údaráis áitiúil sin tar éis an 30adh lá de Mheitheamh, 1940, do bheith ina bhonus, a atharuíonn fé mar atharuíonn an costas beatha agus a deintear amach chuige sin do réir fhigiúra sheasuíonn don chostas bheatha no bheireann le tuigsint í do sheasamh don chostas bheatha, ní déanfar amach an bonus san do réir aon fhigiúra is aoirde ná an fhigiúir gur dá réir a déanfaí amach é díreach roimh an 1adh lá d'Iúl, 1940, dá mbeadh an t-oifigeach no an seirbhíseach san i seirbhís no i bhfostaíocht an údaráis áitiúil sin an tráth san agus, dá réir sin, ní bheidh an bonus san, sa mhéid sin, ionatharuithe fé mar atharóidh an costas beatha.

(3) I gcás luach saothair uile, no an chuid a híoctar in airgead de luach saothair, oifigigh no seirbhísigh d'údarás áitiúil d'atharú fé mar atharuíonn an costas beatha agus é dhéanamh amach chuige sin do réir fhigiura sheasuíonn don chostas bheatha no bheireann le tuigsint í do sheasamh don chostas bheatha, beidh feidhm, maidir leis an luach saothair sin no leis an gcuid sin de adubhradh, ag an bhfo-alt san aca san roimhe seo den alt so bhaineann leis an gcás (ag féachaint do dháta an oifigigh no an tseirbhísigh sin do dhul i seirbhís no i bhfostaíocht an údaráis áitiúil sin) fé is dá mb’ é bheadh sa luach saothair sin no sa chuid sin de adubhradh ná an bonus san a luaidhtear sa bhfo-alt san.

(4) Beidh feidhm agus éifeacht ag na forálacha san roimhe seo den alt so, maidir le gach aois-liúntas is iníoctha ag údarás áitiúil, fé is dá mba luach saothair an t-aois-liúntas san agus, chun crícheanna na feidhme sin, déanfar gach tagairt atá sna forálacha san do dhuine do bheith i seirbhís no i bhfostaíocht údaráis áitiúil, no do dhuine do dhul isteach i seirbhís no i bhfostaíocht an chéanna, do léiriú, agus beidh éifeacht aici, mar thagairt do dhuine do bheith tar éis eirghe, no do dhuine d'eirghe, as an seirbhís no as an bhfostaíocht gur ina taobh a bheidh an liúntas san iníoctha.

LOCAL AUTHORITIES (COST OF LIVING) ACT, 1940.

Local authorities.

1.—For the purposes of this Act every of the following bodies and persons shall be a local authority, that is to say:—

(a) the corporation of a county borough, the council of a county, a borough, or an urban district, a board of guardians, the commissioners of a town, and a port sanitary authority, and

(b) a person appointed by or under statute to perform the functions or any of the functions of any such corporation, council, board, commissioners, or authority, and

(c) a committee or joint committee or a board or joint board (whether incorporated or not incorporated) of or appointed by any one or more of such corporations, councils, boards, commissioners, authorities, or persons, and

(d) a school attendance committee, a vocational education committee, and a committee of agriculture.

Calculation of variable remuneration and superannuation allowances.

2.—(1) Where the remuneration of an officer or servant of a local authority who is in the service or employment of such local authority on the 30th day of June, 1940, consists in part of a bonus varying with the cost of living and calculated for that purpose by reference to a figure representing or purporting to represent the cost of living, such bonus shall not, in respect of any period beginning on or after the 1st day of July, 1940, be calculated by reference to a figure greater than the figure by reference to which it was calculated immediately before that date, and accordingly such bonus shall, as on and from the 1st day of July, 1940, cease to that extent to vary with the cost of living.

(2) Where the remuneration of an officer or servant of a local authority who enters the service of such local authority after the 30th day of June, 1940, consists in part of a bonus varying with the cost of living and calculated for that purpose by reference to a figure representing or purporting to represent the cost of living, such bonus shall not be calculated by reference to any greater figure than the figure by reference to which it would have been calculated immediately before the 1st day of July, 1940, if such officer or servant had then been in the service or employment of such local authority, and accordingly such bonus shall to that extent not be variable with the cost of living.

(3) Where the whole of the remuneration or so much of the remuneration as is paid in money of an officer or servant of a local authority varies with the cost of living and is calculated for that purpose by reference to a figure representing or purporting to represent the cost of living, whichever of the foregoing sub-sections of this section is applicable (having regard to the date on which such officer or servant entered the service or employment of such local authority) shall apply to such remuneration or so much thereof as aforesaid as if it were such bonus as is mentioned in that sub-section.

(4) The foregoing provisions of this section shall apply and have effect in relation to every superannuation allowance payable by a local authority as if such allowance were remuneration, and for the purposes of such application all references in those provisions to being in or entering the service or employment of a local authority shall be construed and have effect as references to having retired or retiring from the service or employment in respect of which such allowance is payable.

Short title.

3.—This Act may be cited as the Local Authorities (Cost of Living) Act, 1940.
