AN tACHT UM GHNÍOMHAIREACHT AIRGEADAIS DO THITHE (LEASÚ), 1982

Léiriú.

1.—San Acht seo ciallaíonn “an Príomh-Acht” an tAcht um Ghníomhaireacht Airgeadais do Thithe, 1981.

Leasú ar ailt 10 agus 11 den Acht um Ghníomhaireacht Airgeadais do Thithe. 1981.

2.—(1) I gcás ina bhfaighidh an Ghníomhaireacht airgead ar iasacht ar scór banna nó urrús eile a bhunaigh agus a d'eisigh sí agus faoi réir coinníll go mbeidh, tráth fuascailte an urrúis, méid, arb é a bheidh ann méid de bhreis ar an méid a fuair an Ghníomhaireacht ar iasacht iarbhír agus é arna ríomh ag féachaint don treoir-uimhir praghsanna do thomhaltóirí nó i cibé slí eile a shonrófar sa choinníoll, iníoctha ag an nGníomhaireacht ar dhóigh seachas i gcuntas úis, beidh feidhm ag na forálacha seo a leanas:

(a) ní chuirfear an méid i gcuntas chun críocha alt 10 (3) den Phríomh-Acht, agus

(b) maidir le haon ráthaíocht faoi alt 11 den Phríomh-Acht a bheidh i bhfeidhm de thuras na huaire i ndáil leis an airgead, déanfar na tagairtí don phríomhshuim i bhfo-alt (1) den alt sin agus, nuair is iomchuí é, an tagairt do phríomhshuim i bhfo-alt (7) (a) den alt sin, a fhorléiriú mar thagairtí a fholaíonn tagairt don méid.

(2) San alt seo ciallaíonn “an treoir-uimhir praghsanna do thomhaltóirí” An Treoir-Uimhir Praghsanna do Thomhaltóirí—Gach Ítim, a thiomsaíonn an Phríomh-Oifig Staidrimh.

Gearrtheideal, comhlua agus forléiriú.

3.—(1) Féadfar an tAcht um Ghníomhaireacht Airgeadais do Thithe (Leasú), 1982, a ghairm den Acht seo.

(2) Féadfar na hAchtanna um Ghníomhaireacht Airgeadais do Thithe, 1981 agus 1982, a ghairm den Phríomh-Acht agus den Acht seo le chéile.

(3) Forléireofar an Príomh-Acht agus an tAcht seo le chéile mar aon Acht amháin.

HOUSING FINANCE AGENCY (AMENDMENT) ACT, 1982

Interpretation.

1.—In this Act “the Principal Act” means the Housing Finance Agency Act, 1981.

Amendment of sections 10 and 11 of Housing Finance Agency Act, 1981.

2.—(1) Where the Agency borrows money on foot of a bond or other security created and issued by it and subject to a condition whereby, on the redemption of the security, an amount, being both in addition to the money actually borrowed by the Agency and calculated by reference to the consumer price index number or in such other manner as is specified in the condition, is payable by the Agency otherwise than on account of interest, the following provisions shall apply:

(a) the amount shall not be taken into account for the purposes of section 10 (3) of the Principal Act, and

(b) as respects any guarantee under section 11 of the Principal Act which is for the time being in force in relation to the money, the references to the principal in subsection (1) of that section and, where appropriate, the reference to principal in subsection (7) (a) of that section shall each be construed as including a reference to the amount.

(2) In this section “the consumer price index number” means the All Items Consumer Price Index Number compiled by the Central Statistics Office.

Short title, collective citation and construction.

3.—(1) This Act may be cited as the Housing Finance Agency (Amendment) Act, 1982.

(2) The Principal Act and this Act may be cited together as the Housing Finance Agency Acts, 1981 and 1982.

(3) The Principal Act and this Act shall be construed together as one Act.
