ACHT AIRGID REATHA (LEASÚ), 1930.
Miniú agus léiriú.
1.—(1) San Acht so cialluíonn an abairt “an Príomh-Acht” an tAcht Airgid Reatha, 1927 (Uimh. 32 de 1927).
(2) Léireofar an tAcht so mar éinní amháin leis an bPríomh-Acht agus dá réir sin tá le focail agus le habairtí a húsáidtear san Acht so agus a húsáidtear, leis, sa Phríomh-Acht na brigheanna céanna san Acht so atá leo, fé seach, sa Phríomh-Acht.
Ciste na nótaí dlí-thairgthe do shúncáil.
2.—Leasuítear leis seo fo-alt (3) d'alt 61 den Phríomh-Acht tré sna focail “a bheidh in ionbhadh a n-íoctha laistigh de bhliain” do scriosa amach as mír (d) de agus beidh éifeacht ag an bhfo-alt san dá réir sin.

3.—(1) Má dheineann agus pé uair a dhéanfaidh an Coimisiún a iarraidh ar an Aire d'aon aonta aon urrús áirithe no aon tsaghas áirithe urrús, no aon airgead reatha, iarmhéid no fuirm eile sócmhainne do chur leis na fuirmeacha in ar féidir ciste na nótaí dlí-thairgthe no cúl-chiste na nótaí no an dá chiste sin do chimeád fén bPríomh-Acht, féadfaidh an tAire ordú do dhéanamh á dhearbhú do réir an iarratais sin go ndéanfar, agus go ndeintear leis sin, an fhuirm no na fuirmeacha áirithe sócmhainne a luaidhtear san iarratas san do chur (fé mar is gá sa chás) leis an liost d'fhuirmeacha atá i bhfo-alt (3) d'alt 61 den Phríomh-Acht no leis an liost d'fhuirmeacha atá i bhfo-alt (2) d'alt 62 den Phríomh-Acht no leis an dá liost san.
(2) Ar a iarraidh sin don Choimisiún d'aon aonta féadfaidh an tAire le hordú, aon tráth, ordú rinne sé fén bhfo-alt san roimhe seo den alt so do chur ar neamh-ní, d'atharú no do leasú do réir an iarratais sin.
(3) Ní bheidh feidhm ná éifeacht ag ordú ar bith a déanfar fé cheachtar de sna fo-ailt sin roimhe seo mara ndeintear ná go dtí go ndéanfar é leaga fé bhráid gach Tighe den Oireachtas agus aontú leis tré rún do rith do gach Tigh acu san.
(4) Pé uair a dhéanfaidh an tAire ordú fé fho-alt (1) den alt so déanfar, faid a bheidh an t-ordú san i bhfeidhm ach fé réir aon atharuithe no leasuithe déanfar air fén alt so, an Príomh-Acht agus go háirithe alt 61 no alt 62 dhe no an dá alt san (do réir mar bheidh) do léiriú agus beidh éifeacht acu fé is dá ndeintí an Príomh-Acht do leasú do réir an orduithe sin.

4.—(1) Pé uair a thiocfaidh brabús, i rith leath-bhliana ar bith, as airgead do dhéanamh de shócmhainn chaipitail ar bith bhain le ciste na nótaí dlí-thairgthe (pe'ca tré n-a díol é no tré n-a bheith in ionbhadh a híoctha), ansan, tar éis pé méid is oiriúnach leo do lomháil in aghaidh aon laigheaduithe tháinig o thosach na leath-bhliana san ar luach sócmhainne caipitail ar bith bhaineann leis an gciste sin, féadfaidh an Coimisiún socmhainn chaipitail, in aon cheann no cinn de sna fuirmeacha luaidhtear i bhfo-alt (2) d'alt 62 den Phríomh-Acht, d'aistriú o chiste na nótaí dlí-thairgthe go dtí cúl-chiste na nótaí, sócmhainn is có-ionann luach le linn an aistrithe sin leis an méid den bhrabús san fhanfaidh tar éis na lomhála san (más ann di) do dhéanamh in aghaidh laigheaduithe luacha.
(2) Pé uair a thiocfaidh cailliuint, i rith leath-bhliana ar bith, as airgead do dhéanamh de shócmhainn chaipitail ar bith do bhain le ciste na nótaí dlí-thairgthe (pe'ca tré n-a díol é no tré n-a bheith in ionbhadh a híoctha), féadfaidh an Coimisiún socmhainn chaipitail, in aon cheann no cinn de sna fuirmeacha luaidhtear i bhfo-alt (3) d'alt 61 den Phríomh-Acht mar a leasuítear leis an Acht so é, d'aistriú o chúl-chiste na nótaí go dtí an ciste sin, sócmhainn is có-ionann luach le linn an aistrithe sin le méid na cailliúna san.

5.—(1) Ní bheidh sé dleathach do dhuine ar bith éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) nóta dlí-thairgthe no nóta bainc có-dhlúite do ghearra, do straca, no do mhille ar aon tslí eile; no
(b) aon litir, figiuir, pátrún no marc eile do scríobha, do chlóbhuala, do tharrac, do stampáil, do mhúnlú, no do ghreana ar aon tslí eile ar nóta dhlí-thairgthe no ar nóta bainc chó-dhlúite; no
(c) nóta dlí-thairgthe no nóta bainc có-dhlúite do pholla pe' ca dhéanfaidh na puill aon litir, figiuir, no pátrún eile no ná déanfaid; no
(d) aon mhemorandum, fógra, no scríbhinn eile do cheangal no do ghreamú de nóta dhlí-thairgthe no de nóta bainc chó-dhlúite.
(2) Gach duine a dhéanfaidh aon ghníomh, maidir le nóta dlíthairgthe no le nóta bainc có-dhlúite, is sárú ar an alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneail ná raghaidh thar cúig púint do chur air.
(3) Má deintear maidir le nóta dlí-thairgthe gníomh is sárú ar an alt so ní dhéanfaidh san dochar ná deifir d'aon oblagáid a cuirtear ná d'aon chomhacht a bronntar ar an gCoimisiún leis an bPríomh-Acht an nóta san d'íoc no d'athcheannach ná d'aon chomhacht a bronntar amhlaidh ar an gCoimisiún diúlta don nóta san d'athcheannach.
(4) Má deintear maidir le nóta bainc có-dhlúite gníomh is sárú ar an alt so ní dhéanfaidh san deifir ná dochar don oblagáid a cuirtear sa Phríomh-Acht ar an mBanc Scair-shealbhach dar tugadh amach an nóta san suim an nóta san d'íoc ar a thíolaca ná d'aon cheart ná comhacht a bheidh ag an mBanc san, fén bPríomh-Acht no fé rialacháin ar n-a ndéanamh fé, an nóta san do chur ar ceal.
(5) Ní bhainfidh an t-alt so le ní ar bith a dhéanfaidh an Coimisiún no a déanfar thar a gceann chun nóta dlí-thairgthe do chur i nea-mbrí no chun nóta bainc có-dhlúite do chur ar ceal no do chur i nea-mbrí.

CURRENCY (AMENDMENT) ACT, 1930.
Definitions and construction.
1.—(1) In this Act the expression “the Principal Act” means the Currency Act, 1927 (No. 32 of 1927).
(2) This Act shall be construed as one with the Principal Act and accordingly words and expressions used in this Act which are also used in the Principal Act have the same meanings in this Act as they respectively have in the Principal Act.
Investment of legal tender note fund.
2.—Sub-section (3) of section 61 of the Principal Act is hereby amended by the deletion from paragraph (d) thereof of the words “maturing within twelve months,” and that sub-section shall have effect accordingly.
Amendment of Sections 61 & 62 of the Principal Act.
3.—(1) If and whenever the Commission shall unanimously request the Minister to add any particular security or class of securities, currency, balance, or other form of assets to the forms in which the legal tender note fund or the note reserve fund or both those funds may be held under the Principal Act, the Minister may make an order declaring in accordance with such request that the particular form or forms of assets specified in such request shall be and is or are thereby added (as the case may require) to the list of forms contained in sub-section (3) of section 61 of the Principal Act or to the list of forms contained in sub-section (2) of section 62 of the Principal Act or to both those lists.
(2) The Minister may at any time upon the unanimous request of the Commission by order rescind, vary, or amend in accordance with such request an order made by him under the foregoing sub-section of this section.
(3) No order made under either of the foregoing sub-sections shall be of any force or effect unless or until it has been laid before each House of the Oireachtas and has been approved by resolution of each such House.
(4) Whenever an order is made by the Minister under sub-section (1) of this section, the Principal Act and in particular section 61 or section 62 thereof or both those sections (as the case may be) shall, so long as such order is in force but subject to any variation or amendment thereof, under this section, be construed and have effect as if the Principal Act were amended in accordance with such order.
Interim transfers between the legal tender note fund and the note reserve fund.
4.—(1) Whenever during any half-year a profit arises on the realisation (whether by sale or maturity) of any capital asset of the legal tender note fund, the Commission may, after making such allowance as it thinks proper for any depreciation which may have occurred since the beginning of such half-year in any capital asset of that fund, transfer from the legal tender note fund to the note reserve fund capital assets in any one or more of the forms mentioned in sub-section (2) of section 62 of the Principal Act equal in value at the time of such transfer to the amount of such profit remaining after making such allowance (if any) for depreciation.
(2) Whenever during any half-year a loss arises on the realisation (whether by sale or maturity) of any capital asset of the legal tender note fund, the Commission may transfer to that fund from the note reserve fund capital assets in any one or more of the forms mentioned in sub-section (3) of section 61 of the Principal Act as amended by this Act equal in value at the time of such transfer to the amount of such loss.
Defacement, etc., of legal tender notes and consolidated bank notes.
5.—(1) It shall not be lawful for any person to do any of the following things, that is to say:—
(a) to cut, tear, or otherwise mutilate a legal tender note or a consolidated bank note; or
(b) to write, print, draw, stamp, emboss, or in any other way impress on a legal tender note or a consolidated bank note any letter, figure, design, or other mark; or
(c) to perforate a legal tender note or a consolidated bank note, whether the perforations do or do not form or represent any letter, figure, or other design; or
(d) to attach or affix to a legal tender note or a consolidated bank note any memorandum, advertisement or other writing.
(2) Every person who commits any act in relation to a legal tender note or a consolidated bank note which is a contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding five pounds.
(3) The fact that a legal tender note has been the subject of an act which is a contravention of this section shall not prejudice or affect any obligation imposed or power conferred on the Commission by the Principal Act to pay or redeem such note nor any power so conferred on the Commission to refuse to redeem such note.
(4) The fact that a consolidated bank note has been the subject of an act which is a contravention of this section shall not prejudice or affect the obligation imposed by the Principal Act on the Shareholding Bank to which such note was issued to pay the amount of such note on presentation nor any right or power which such Bank may have under the Principal Act or regulations made thereunder to retire such note.
(5) This section shall not apply to anything done by or on behalf of the Commission for the purpose of the cancellation of a legal tender note or the retirement or cancellation of a consolidated bank note.
Short title and citation.
6.—(1) This Act may be cited as the Currency (Amendment) Act, 1930.
(2) The Principal Act and this Act may be cited together as the Currency Acts, 1927 and 1930.
