Bainistí agus cúram na Páirce.

2.—Leanfidh bainistí agus cúram na Páirce de bheith dílsithe sna Coimisinéirí ach is fé réir agus do réir orduithe generálta an Aire a chó-líonfidh agus a fheidhmeoidh na Coimisinéirí an bhainistí agus an cúram san agus gach dualgas agus comhacht eile a cuirtar ar na Coimisinéirí no a dílsítear ionta leis an Acht so, no ar aon tslí eile, maidir leis an bPáirc.

An Pháirc do choinneáil i dtreo mar pháirc phuiblí.

3.—(1) Déanfidh na Coimisinéirí an Pháirc do choinneáil i dtreo mar pháirc phuiblí chun na críche generálta, caitheamh aimsire agus aoibhneas na puiblíochta, agus féadfid codacha áirithe den Pháirc do choinneáil i dtreo chun aon chrícheanna speisialta chun a bhfuil na codacha céanna no codacha eile den Pháirc á n-úsáid go dtí so, no chun crícheanna den tsórt chéanna fé mara cheadóidh an tAire.

(2) Féadfidh na Coimisinéirí o am go ham atharuithe agus feabhsuithe do dhéanamh ar shocrú, ar leaga amach, ar phlandú, ar dhréineáil, agus ar dhaingniú na Páirce fé mar is dó leo is ceart chun gach críche no aon chríche acu san adubhradh, agus go sonnrách féadfid o am go ham bóithre agus casáin nua do dhéanamh, d'oscailt, agus do choinneáil i dtreo sa Pháircs agus, o am go ham, bóithre agus casáin a bheidh sa Pháirc an uair sin do dhúna agus do bhrise ar fad, fé mar is dó leo is ceart.

(3) Le toil an Aire féadfidh na Coimisinéirí aon uair pé lóistí geata, lóistí dóirseoirí, siopaí oibre, tithe stórais, agus foirgintí eile do thógaint a chífar do sna Coimisinéirí a bheith riachtanach no oiriúnach chun an Pháirc do choinneáil i dtreo chun na gcrícheanna roimhráite.

Ceadúnaisí chun aon-tseilbh do ghlaca i gcodacha den Pháirc.

4.—(1) Fé réir tola an Aire agus fé réir forálacha an ailt seo, féadfidh na Coimisinéirí ceadúnas do dheona d'éinne á údarú don duine sin aon chuid den Pháirc do dhaingniú dho féin agus aontseilbh do bheith aige inti chun aon chríche áirithe, agus an phuiblíocht do chimeád amach as an gcuid den Pháirc le n-a mbaineann an ceadúnas san, agus an phuiblíocht do leigint isteach sa chuid sin no in aon pháirt áirithe dhi ar íoc pé táille no ar chó-líona pé coiníoll eile is dó le sealbhóir an cheadúnais is ceart a éileamh no a chur ortha.

(2) Gach ceadúnas a deonfar fén alt so deonfar amhlaidh é fé réir pé coiníollacha is dó leis na Coimisinéirí is ceart a fhorchur, agus beidh gach ceadúnas den tsórt san incheiliúrtha ag na Coimisinéirí aon uair le toil no le hordú an Aire.

(3) Ní dhéanfidh na Coimisinéirí, le haon cheadúnas a dheonfid fén alt so, a údarú d'éinne, ar feadh aon tréimhse no tréimhsí is sia ar fad ná trí lá in aon bhliain amháin áirithe, aon daingniú ná déanmhacht eile do thógaint a chimeádfadh an phuiblíocht gan féachaint ar aon chluiche, taisbeántas, no siamsa eile, ná táillí d'éileamh ar dhaoine do leigint isteach in aon pháirt den Pháirc maran rud é—

(a) gur ceaduíodh deona an cheadúnais sin le rún o gach Tigh den Oireachtas; no

[EN]

(b) gur leagadh dreacht an cheadúnais sin fé bhráid gach Tighe den Oireachtas agus nár dhin aon Tigh acu, laistigh den deich lá a shuidh an Tigh sin tar éis leaga an dreachta san fé n-a bhráid, rún do rith ag neacheadú deona an cheadúnais.

(4) Gach ceadúnas a dheon na Coimisinéirí go dtí so chun aontseilbh do ghlaca in aon chuid den Pháirc agus atá i bhfeidhm le linn rithte an Achta so, leanfa sé i bhfeidhm do réir na dtéarmaí atá ann, ach beidh sé incheiliúrtha ag na Coimisinéirí aon uair le toil no le hordú an Aire.

5.—Féadfidh na Coimisinéirí o am go ham inníor aon choda den Pháirc do chur chun éinne ar feadh pé tréimhse fé bhun bliana, agus fé réir pé cíos d'íoc agus pé coiníollacha do chó-líona, is dó leis na Coimisinéirí is ceart le cead an Aire.

Constáblaí páirce, cimeádaithe lóiste, etc., do cheapa.

6.—(1) Féadfidh na Coimisinéirí pé constáblaí páirce, cimeádaithe lóiste, geatóirí, oifigigh, fir oibre, agus seirbhísigh agus pé méid acu, do cheapa a mheasfidh na Coimisinéirí, le cead an Aire, a bheith riachtanach chun có-líona agus feidhmiú ceart do dhéanamh ar na dualgaisí agus na comhachta a cuirtar no a bronntar ortha, leis an Acht so no ar aon tslí eile, maidir leis an bPáirc.

(2) Gach éinne a cheapfidh na Coimisinéirí fén alt so ceapfar é amhlaidh ar pé téarmaí agus coiníollacha, agus fé n-a réir, agus ar pé luach saothair a shocróidh na Coimisinéirí le haontú an Aire.

Ciontathóirí sa Pháirc do chur amach agus do ghabháil.

7.—(1) Má dhineann éinne sa Pháirc agus i radharc constábla pháirce aon ghníomh atá ina chionta fé aon alt den Acht so no fé aon fho-dhlí a dineadh fén Acht so, no atá contrárdha d'aon fho-dhlí den tsórt san, féadfidh an constábla páirce sin, más in éide dho, an dá ní seo a leanas no ceachtar acu do dhéanamh, sé sin le rá:—

(a) ainm agus seola an duine sin d'éileamh air, no

(b) a ordú don duine sin an Pháirc d'fhágaint.

(2) Má dhineann éinne den tsórt san roimhráite diúltú dá ainm do thabhairt no diúltú dá sheola do thabhairt do chonstábla pháirce ar a éileamh san air don chonstábla pháirce sin mar adubhradh, no má thugann sé uaidh ainm no seola gurb eol don chonstábla pháirce no go bhfuil amhrus réasúnta aige é bheith fallsa no bréagach, féadfidh an constábla páirce an duine sin do ghabháil agus do thógaint ina chimeád gan barántas.

(3) Má dhineann éinne den tsórt san roimhráite diúltú no faillí maidir leis an bPáirc d'fhágaint nuair a hiarrfar san air mar adubhradh, feadfidh aon chonstábla páirce an duine sin do chur amach as an bPáirc le héigean no féadfa sé, gan barántas, an duine sin do ghabháil agus do thógaint i gcimeád.

(4) Má dhineann constábla páirce éinne do ghabháil fén alt so déanfa sé láithreach an duine sin do bhreith leis agus do thabhairt suas i gcimeád do chonstábla phóilíneachta chun go ndeighleálfar leis do réir dlí.

(5) Gach éinne a dhiúltóidh dá ainm do thabhairt uaidh, no a dhiúltóidh dá sheola do thabhairt uaidh, no a thabharfidh ainm no seola fallsa no bréagach uaidh, nuair a dhéanfidh constábla páirce, ag gníomhú fén alt so dho, a iarraidh air a ainm agus a sheola do thabhairt uaidh, no a dhéanfidh diúltú no faillí maidir leis an bPáirc d'fhágaint nuair a dhéanfidh constábla páirce, ag gníomhú fén alt so dho, a ordú dho an Pháirc d'fhágaint no, tar éis an Pháirc d'fhágaint no tar éis a churtha amach aisti, a thiocfidh thar n-ais chun na Páirce an la céanna, beidh, sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair féadfar fíneáil ná raghaidh thar cúig púint do chur air.

(6) I dteanta aon chomhachta eile atá dílsithe ann do réir dlí, beidh ag ball den Ghárda Síochána, a bheidh ar diúité sa Pháirc, na comhachta a tugtar do chonstáblaí páirce leis an alt so agus féadfa sé iad d'fheidhmiú.

8.—Gach éinne a bhacfidh no a choiscfidh aon chonstábla páirce agus é ag feidhmiú aon cheann dá dhualgaisí no dá chomhachta go dleathach mar chonstábla páirce den tsórt san, pe'ca fén Acht so é no fé aon fho-dhlí a dineadh fé, agus gach éinne a ionnsóidh constábla páirce agus é ag feidhmiú aon dualgaisí no comhachtanna den tsórt san go dleathach, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair féadfar é chur fé fhíneáil ná raghaidh thar fiche punt no, más rogha leis an gcúirt é, fé phríosúntacht ar feadh aon téarma nách sia ná sé mhí.

Fostú agus comhachta póilíní sa Pháirc.

9.—(1) Beidh sé dleathach do bhaill den Ghárda Síochána bheith i mbun diúitéthe póilíneachta sa Pháirc mar atáid go dtí so.

(2) Féadfidh Coimisinéir an Ghárda Síochána rialacháin do dhéanamh i dtaobh na mbealach a gheobhaidh gluaisteáin, caráistí, cairteanna, agus feithiclí eile, agus capaill agus daoine, sa Pháirc go generálta no ar ócáidí speisialta, agus féadfa sé fós treoracha do thabhairt do bhaill an Ghárda Síochána chun ordathacht sa Pháirc, có-líona rialachán a dhin an Coimisinéir sin fén alt so, agus cólíona fo-dhlithe a dhin na Coimisinéirí fén Acht so, do chur i bhfeidhm.

(3) Gach éinne a dhéanfidh aon ghníomh no rud is brise no is sárú ar rialachán a dhin Coimisinéir an Ghárda Síochána fén alt so beidh sé ciontach i gcionta fén rialachán san agus ar a chiontú ann ar an slí achmair féadfar fíneáil ná raghaidh thar cúig púint do chur air.

(4) Athghairmtear leis seo alt 28 den Dublin Carriage Act, 1853.

Féadfidh na Coimisinéirí fo-dhlithe do dhéanamh.

10.—(1) Féadfidh na Coimisinéirí, fé réir cheadú an Aire, fo-dhlithe do dhéanamh chun gach críche no aon chríche acu so a leanas, sé sin le rá:—

(a) regleáil agus stiúra do dhéanamh maidir leis an bpuiblíocht no aon chuid díobh do bhaint úsáide agus aoibhnis as an bPáirc,

[EN]

(b) na tráthanna d'ordú go mbeidh an Pháirc no aon chuid áirithe dhi ar oscailt don phuiblíocht,

[EN]

(c) na modhanna agus na crícheanna d'ordú gur dá réir agus chúcha a fhéadfidh daoine a thagann ann an Pháirc no aon chuid di d'úsáid,

[EN]

(d) údarú agus regleáil do dhéanamh ar tháillí d'éileamh ag na Coimisinéirí no ag éinne eile ar dhaoine do leigint isteach sa Pháirc no in aon chuid áirithe dhi ar aon ócáid no ócáidí áirithe nách sia ná trí lá ar fad in aon bhliain,

(e) na téarmaí do regleáil ar a ndeonfidh na Coimisinéirí ceadúnaisí chun aon-tseilbh do ghlaca ar chodacha den Pháirc, agus na coiníollacha do regleáil a chó-líonfidh daoine dá ndeonfar na ceadúnaisí sin,

(f) ordú agus dea-iompar do chimeád imeasc daoine a thagann isteach sa Pháirc no a úsáideann í,

[EN]

(g) cráitisí sa Pháirc do chosc agus go sonnrách cosc na mbóthar agus na gcosán sa Pháirc do chosc,

(h) regleáil do dhéanamh ar iompar, dualgaisí, agus comhachtanna na gconstáblaí páirce agus oifigeacha agus seirbhíseacha eile na gComisinéirí maidir le daoine a thagann isteach sa Pháirc no a úsáideann í, ach ní i slí is go dtabharfí d'aon chonstábla, oifigeach no seirbhíseach den tsórt san aon chomhacht ghabhála ná phríosúntachta,

(i) na fíneála d'ordú a féadfar a ghearra mar gheall ar bhrise no ar shárú na bhfo-dhlithe uile fé seach, ach san i slí is ná raghaidh aon fhíneáil den tsórt san thar cúig púint agus déanfar fíneáil mhaximum agus san amháin, agus ní déanfar aon fhíneáil mhinimum, d'ordú amhlaidh,

(j) go generálta chun an Pháirc do choinneáil i dtreo agus do chimeád mar pháirc phuiblí chun na gcrícheanna a luaidhtear san Acht so.

(2) Gach éinne a dhéanfidh aon ghníomh no rud is brise no is sárú ar fho-dhlí a dineadh fén alt so beidh sé ciontach i gcionta fén bhfo-dhlí sin agus ar a chiontú ann ar an slí achmair féadfar pé fíneáil a luaidhtear chuige sin sa bhfo-dhlí sin do chur air no, mara luaidhtear aon fhíneáil den tsórt san, fíneáil ná raghaidh thar cúig púint.

(3) Déanfar cóipeanna de sna fo-dhlithe uile a déanfar fén alt so agus a bheidh i bhfeidhm de thurus na huaire do phostáil sa Pháirc i pé slí agus áiteanna so-fheicse is dó leis na Coimisinéirí is fearr a thabharfidh fógra i dtaobh na bhfo-dhlithe sin do sna daoine a úsáideann an Pháirc.

(4) Gach fo-dhlí a déanfar fén alt so leagfar í fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a déanta, agus má dhineann ceachtar de dhá Thigh an Oireachtais, laistigh den lá is fiche a shuidhfidh an Tigh sin tar éis leaga na fo-dhlí sin fé n-a bhráid, rún do rith ag cur na fo-dhlí sin ar nea-mbrí beidh an fho-dhlí sin ar nea-mbrí dá réir sin, ach beidh san gan dochar do dhleathacht éinní a dineadh roimhe sin fén bhfo-dhlí sin.

PHŒNIX PARK ACT, 1925.


AN ACT TO MAKE PROVISION FOR CONTINUING THE MAINTENANCE AND REGULATION OF THE PHŒNIX PARK, DUBLIN, AS A PUBLIC PARK, AND THE PRESERVATION OF ORDER THEREIN, AND FOR OTHER PURPOSES CONNECTED THEREWITH. [11th July, 1925.] BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:— [GA]

Definitions.

1.—In this Act—

the word “Park” means the Phoenix Park in the County of Dublin;

[GA]

the word “Commissioners” means the Commissioners of Public Works in Ireland;

[GA]

the expression “the Minister” means the Minister for Finance;

[GA]

the expression “park constable” means a person appointed by the Commissioners under this Act to be a park constable.

[GA]

Management and control of the Park.

2.—The management and control of the Park shall continue to be vested in the Commissioners, but such management and control and all other duties and powers imposed on or vested in the Commissioners in relation to the Park by this Act or otherwise shall be performed and exercised by the Commissioners subject to and in accordance with the general directions of the Minister.

Park to be maintained as a public park.

3.—(1) The Commissioners shall maintain the Park as a public park for the general purpose of the recreation and enjoyment of the public, and may maintain particular portions of the Park for any special purposes for which the same or other portions of the Park have heretofore been used, or such like purposes as the Minister shall sanction.

(2) The Commissioners may from time to time make such alterations and improvements in the arrangement, laying out, planting, draining, and fencing of the Park as they think proper for all or any of the purposes aforesaid, and in particular may from time to time make, open, and maintain such new roads and paths in the Park, and from time to time close and break-up such then existing roads and paths in the Park, as they think proper.

(3) The Commissioners may with the consent of the Minister at any time erect such gate-lodges, porters' lodges, workshops, store-houses, and other buildings as shall appear to the Commissioners to be necessary or convenient for the maintenance of the Park for the purposes aforesaid.

Licences for exclusive occupation of portions of the Park.

4.—(1) The Commissioners may, subject to the consent of the Minister and to the provisions of this section, grant to any person a licence authorising such person to fence-off and have the exclusive occupation of any portion of the Park for any particular purpose, and to exclude the public from the portion of the Park to which such licence relates, and to admit the public to such portion or any particular part thereof on payment of such fee or compliance with such other condition as the holder of the licence shall think proper to charge or impose.

(2) Every licence granted under this section shall be so granted subject to such conditions as the Commissioners shall think proper to impose, and every such licence shall be revocable at any time by the Commissioners with the consent or by the direction of the Minister.

(3) The Commissioners shall not by any licence granted under this section authorise any person, during any period or periods exceeding in the whole three days in any one year, either to erect any fence or other structure so as to preclude the public from viewing any game, exhibition, or other entertainment, or to charge fees for admission to any part of the Park unless either—

[GA]

(a) the grant of such licence has been approved by resolution of each House of the Oireachtas; or

[GA]

(b) the draft of such licence has been laid before each House of the Oireachtas and neither House has, within the next ten days on which the House has sat after such draft was laid before it, passed a resolution disapproving of the grant of the licence.

(4) Every licence heretofore granted by the Commissioners for the exclusive occupation of any portion of the Park and in force at, the passing of this Act shall continue in force according to the terms thereof, but shall be revocable at any time by the Commissioners with the consent or by the direction of the Minister.

Letting of the grazing in the Park.

5.—The Commissioners may from time to time let the grazing of any portion of the Park to any person for such period less than one year and subject to the payment of such rent and the observance of such conditions as the Commissioners shall, with the approval of the Minister, think proper.

Appointment of park constables, lodge keepers, etc.

6.—(1) The Commissioners may appoint such and so many park constables, lodge-keepers, gate-keepers, officers, workmen, and servants as the Commissioners shall, with the approval of the Minister, think necessary for the proper execution of the duties and exercise of the powers imposed or conferred on them in relation to the Park by this Act or otherwise.

(2) Every person appointed by the Commissioners under this section shall be so appointed upon and subject to such terms and conditions and at such remuneration as the Commissioners shall, with the sanction of the Minister, determine.

Removal and arrest of offenders in the Park.

7.—(1) If any person in the Park and within the view of a park constable does any act which is an offence under any section of this Act or any bye-law made under this Act, or is in contravention of any such bye-law, such park constable, if in uniform, may do both or either of the following things, that is to say:—

(a) demand from such person his name and address, or

[GA]

(b) order such person to leave the Park.

[GA]

(2) If any such person as aforesaid refuses to give his name or refuses to give his address to a park constable upon demand by such park constable as aforesaid, or gives a name or address which is known to or reasonably suspected by the park constable to be false or fictitious, the park constable may without warrant arrest and take into his custody such person.

(3) If any such person as aforesaid, on being so required as aforesaid, refuses or fails to leave the Park, any park constable may either remove such person from the Park by force or may without warrant arrest and take into custody such person.

[GA]

(4) Whenever a park constable arrests any person under this section he shall forthwith bring and deliver such person into the custody of a police constable to be dealt with according to law.

[GA]

(5) Every person who on being required by a park constable acting under this section to give his name and address, refuses to give his name or refuses to give his address, or gives a false or fictitious name or address, or who on being ordered by a park constable acting under this section to leave the Park, refuses or fails to leave the Park, or having left or been removed from the Park returns thereto on the same day, shall be guilty of an offence under this section, and shall be liable on summary conviction thereof to a penalty not exceeding five pounds.

(6) In addition to any other power vested in him by law, a member of the Gárda Síochána on duty in the Park shall have and may exercise the powers conferred on park constables by this section.

Obstruction of and assaults on park constables.

8.—Every person who shall obstruct or impede any park constable in the lawful execution of any of his duties or powers as such park constable whether under this Act or any bye-law made thereunder and every person who shall assault a park constable while engaged in the lawful execution of any such duties or powers shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds or, at the discretion of the court, to imprisonment for any term not exceeding six months.

Employment and powers of police in the Park.

9.—(1) It shall be lawful for members of the Gárda Síochána to be employed on police duties in the Park as heretofore.

(2) The Commissioner of the Gárda Síochána may make regulations for the routes to be observed by motor-cars, carriages, carts, and other vehicles, and by horses and persons in the Park either generally or on special occasions, and may also give directions to the members of the Gárda Síochána for enforcing the preservation of order in the Park, the observance of regulations made by the said Commissioner under this section, and the observance of bye-laws made by the Commissioners under this Act.

(3) Every person who shall do any act or thing which is a breach or in contravention of a regulation made by the Commissioner of the Gárda Síochána under this section shall be guilty of an offence under such regulation and shall be liable on summary conviction thereof to a penalty not exceeding five pounds.

(4) Section 28 of the Dublin Carriage Act, 1853, is hereby repealed.

Commissioners may make bye-laws.

10.—(1) The Commissioners may, subject to the approval of the Minister, make bye-laws for all or any of the purposes following, that is to say:—

(a) regulating and controlling the use and enjoyment of the Park by the public or any section thereof,

[GA]

(b) prescribing the times during which the Park or any particular portion thereof shall be open to the public,

[GA]

(c) prescribing the modes and purposes in or for which the Park or any part thereof may be used by persons frequenting the same,

[GA]

(d) authorising and regulating the charging of fees by the Commissioners or any other person for admission to the Park or any particular part thereof on any particular occasion or occasions not exceeding in the whole three days in any one year,

[GA]

(e) regulating the terms on which licences for the exclusive occupation of portions of the Park will be granted by the Commissioners, and the conditions to be observed by persons to whom such licences are granted,

[GA]

(f) preserving order and good conduct amongst persons frequenting or making use of the Park,

[GA]

(g) preventing nuisances in the Park and in particular preventing the obstruction of the roads and paths in the Park,

[GA]

(h) regulating the conduct, duties, and powers of the park constables and other officers and servants of the Commissioners in relation to persons frequenting or making use of the Park, but not so as to confer on any such constable, officer, or servant any power of arrest or imprisonment,

[GA]

(i) prescribing the penalties which may be inflicted for breaches or contraventions of the several bye-laws respectively, but so that no such penalty shall exceed five pounds and a maximum penalty only and no minimum penalty shall be so prescribed,

[GA]

(j) generally for the maintenance and preservation of the Park as a public park for the purposes mentioned in this Act.

(2) Every person who shall do any act or thing which is a breach or in contravention of a bye-law made under this section shall be guilty of an offence under such bye-law and shall be liable on summary conviction thereof to such penalty as is mentioned in that behalf in such bye-law or where no such penalty is mentioned to a penalty not exceeding five pounds.

(3) Copies of all bye-laws made under this section and for the time being in force shall be posted in the Park in such conspicuous manner and places as the Commissioners may deem best calculated to give notice thereof to the persons using the Park.

(4) Every bye-law made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made, and if either such House shall within twenty-one days on which that House has sat next after the bye-law was laid before it pass a resolution annulling such bye-law such bye-law shall be annulled accordingly, but without prejudice to the validity of anything previously done under such bye-law.

Saving for State Lands Act, 1924.

11.—Nothing in this Act shall preclude the making or granting under the State Lands Act, 1924 (No. 45 of 1924) of any such lease or licence as is authorised by that Act in respect of any house, barracks, or other building in the Park, with the out-offices and enclosed lands usually occupied therewith, now or formerly used as an official residence or for any other official or public purpose.

Short title.

12.—This Act may be cited as the Phoenix Park Act, 1925.
