AN tACHT CUMHACHTAÍ PRÁINNE, 1976

Ré feidhme alt 2.
1.—(1) Ní fhanfaidh alt 2 den Acht seo i bhfeidhm ach amháin go dtí críoch na tréimhse dhá mhí dhéag dar tosach dáta an Achta seo a rith, mura rud é go gcoimeádfar i bhfeidhm é nó go dtabharfar i bhfeidhm arís é le hordú faoin alt seo.
(2) Féadfaidh an Rialtas le hordú a fhoráil:—
(a) aon uair a bheidh alt 2 den Acht seo i bhfeidhm, go bhfanfaidh an t-alt sin i bhfeidhm go ceann tréimhse nach faide ná dhá mhí dhéag ó thosach feidhme an ordaithe,
(b) aon uair a bheidh alt 2 den Acht seo i bhfeidhm, go scoirfidh an t-alt sin de bheith i bhfeidhm ar dháta a shonrófar san ordú agus ón dáta sin, nó
(c) aon uair nach mbeidh alt 2 den Acht seo i bhfeidhm go dtiocfaidh an t-alt sin i bhfeidhm arís agus go bhfanfaidh sé i bhfeidhm go ceann tréimhse nach faide ná dhá mhí dhéag ó thosach feidhme an ordaithe.
(3) Gach ordú a dhéanfar faoin alt seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta, agus má dhéanann ceachtar Teach acu sin, laistigh den 21 lá a shuífidh an Teach sin tar éis an t-ordú a leagan faoina bhráid, rún a rith ag neamhniú an ordaithe, beidh an t-ordú ar neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin ordú.
Daoine faoi amhras i dtaobh cionta áirithe a ghabháil, a choimeád agus a cheistiú.
2.—(1) Féadfaidh comhalta den Gharda Síochána (ar a chárta aitheantais a thabhairt ar aird, má éilítear sin, mura in éide dó), gan bharántas, aon duine a stopadh, a chuardach, a cheistiú agus a ghabháil, nó aon ní nó nithe acu sin a dhéanamh i dtaobh aon duine, má bhíonn amhras aige ar chúis réasúnach go bhfuil cion faoin Acht um Chiontaí in Aghaidh an Stáit, 1939, nó cion is cion sceidealta de thuras na huaire chun críocha Chuid V den Acht sin déanta nó á dhéanamh nó ar tí a dhéanta ag an duine sin, nó má bhíonn amhras aige ar chúis réasúnach go bhfuil aon doiciméad nó aon earra nó ní eile á iompar ag an duine sin, nó go bhfuil faisnéis aige, a bhaineann leis an gcion a dhéanamh nó lena bheith beartaithe é a dhéanamh.
(2) Féadfaidh comhalta den Gharda Síochána (ar a chárta aitheantais a thabhairt ar aird, má éilítear sin, mura in éide dó), chun aon chumhacht dá dtugtar le fo-alt (1) den alt seo a fheidhmiú, aon fheithicil nó soitheach a stopadh agus a chuardach a bhfuil amhras aige ar chúis réasúnach go bhfuil duine inti a gcumhachtaítear dó leis an bhfo-alt sin é a ghabháil gan bharántas.
(3) Aon uair a ghabhfar duine faoin alt seo, féadfar é a thabhairt go dtí stáisiún Garda nó príosún nó áit chaothúil eile agus é a choinneáil i gcoimeád ansin go ceann tréimhse 48 n-uaire a chloig ó am a ghabhála agus féadfar, má ordaíonn oifigeach den Gharda Síochána nach ísle céim ná ard-cheannfort amhlaidh, é a choinneáil sa choimeád sin go ceann tréimhse breise nach faide ná cúig lá.
(4) Duine a bheidh i gcoimeád faoi fho-alt (3) den alt seo féadfar, tráth ar bith le linn an choimeádta sin, é a chúiseamh i gcion os comhair na Cúirte Dúiche nó os comhair cúirte speisialta arna bunú faoi Airteagal 38.3.1° den Bhunreacht nó é a scaoileadh saor ar ordú ó chomhalta den Gharda Síochána nach ísle céim ná ceannfort, agus, mura gcúiseofar nó mura scaoilfear saor é amhlaidh, scaoilfear saor é nuair a bheidh deireadh leis an gcoimeád.
(5) Ní bheidh na cumhachtaí a thugtar le halt 30 den Acht um Chiontaí in Aghaidh an Stáit, 1939, infheidhmithe i gcaitheamh tréimhse a mbeidh an t-alt seo i bhfeidhm.
Éag an Achta.
3.—D'ainneoin aon fhorála eile den Acht seo, aon uair a bheartóidh gach Teach den Oireachtas le rún nach ann a thuilleadh don staid phráinne náisiúnta ar bheartaigh gach Teach acu sin é a bheith ann le rún an chéad lá de Mheán Fómhair, 1976, éagfaidh an tAcht seo ar dháta an rúin chéadluaite sin agus beidh sé in éag ón dáta sin.

Duration of section 2.
1.—(1) Section 2 of this Act shall remain in force only until the expiry of the period of twelve months beginning with the passing of this Act, unless it is continued in force or is again brought into force by an order under this section.
(2) The Government may by order provide :—
(a) at any time when section 2 of this Act is in force, that that section shall continue in force for a period not exceeding twelve months from the commencement of the order,
(b) at any time when section 2 of this Act is in force, that that section shall cease to be in force on and from a date specified in the order, or
(c) at any time when section 2 of this Act is not in force, that that section shall come into force again and remain in force for a period not exceeding twelve months from the commencement of the order.
(3) Every order made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling the order is passed by either such House within the next 21 days on which that House has sat after the order has been laid before it, the order shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Arrest, custody and questioning of persons suspected of certain offences.
2.—(1) A member of the Garda Síochána (on production of his identification card, if demanded, where he is not in uniform) may without warrant stop, search, question and arrest any person, or do any one or more of those things in respect of any person, if he suspects with reasonable cause that that person has committed, is committing or is about to commit an offence under the Offences against the State Act, 1939, or an offence which is for the time being a scheduled offence for the purposes of Part V of that Act, or if he suspects with reasonable cause that that person is carrying any document or other article or thing, or is in possession of information, relating to the commission or intended commission of the offence.
(2) A member of the Garda Síochána (on production of his identification card, if demanded, where he is not in uniform) may, for the purpose of the exercise of any of the powers conferred by subsection (1) of this section, stop and search any vehicle or vessel which he suspects with reasonable cause to contain a person whom he is empowered by that subsection to arrest without warrant.
(3) Whenever a person is arrested under this section, he may be removed to and kept in custody in a Garda station, prison, or other convenient place for a period of 48 hours from the time of his arrest and may, if a member of the Garda Síochána not below the rank of chief superintendent so directs, be kept in such custody for a further period not exceeding five days.
(4) A person in custody under subsection (3) of this section may, at any time during such custody, be charged before the District Court or a special court established under Article 38.3.1° of the Constitution with an offence or be released by direction of a member of the Garda Síochána not below the rank of superintendent, and shall, if not so charged or released, be released at the expiration of the custody.
(5) The powers conferred by section 30 of the Offences against the State Act, 1939, shall not be exercisable during a period when this section is in force.
Expiry of Act.
3.—Notwithstanding any other provision of this Act, whenever each of the Houses of the Oireachtas resolves that the national emergency resolved to exist by each such House on the first day of September, 1976, has ceased to exist, this Act shall, on and from the date of such first-mentioned resolution, expire.
Short title.
4.—This Act may be cited as the Emergency Powers Act, 1976.
