ACHT NA SÉADCHOMHARTHAÍ NÁISIÚNTA (LEASÚ), 1954.

An Príomh-Acht.
1.—San Acht seo ciallaíonn “an Príomh-Acht” Acht na Séadchomharthaí Náisiúnta, 1930 (Uimh. 2 de 1930).
Údarás áitiúil d'aistriú caomhnóireachta nó únaerachta séadchomhartha náisiúnta chun na gCoimisinéirí.
2.—Leasaítear leis seo alt 7 den Phríomh-Acht tríd an méid seo a leanas a chur in ionad fo-ailt (1)—
“(1) I gcás—
(a) údarás áitiúil a bheith ceaptha le gníomhas faoin Acht seo nó faoi aon Acht eile ina gcaomhnóirí ar shéadchomhartha náisiúnta, nó
(b) údarás áitiúil a bheith ina n-únaerí ar shéadchomhartha náisiúnta,
féadfaid, le toiliú na gCoimisinéirí agus le toiliú an únaera más caomhnóirí an t-údarás áitiúil, an chaomhnóireacht nó an únaeracht sin d'aistriú le gníomhas chun na gCoimisinéirí agus ar bheith aistrithe amhlaidh don chaomhnóireacht sin, beidh éifeacht faoin Acht seo ag an ngníomhas lenar ceapadh an t-údarás áitiúil sin ina gcaomhnóirí amhail is dá mba iad na Coimisinéirí a ceapadh leis ina gcaomhnóirí ar an séadchomhartha sin.”
Orduithe buan-choimeádta.
3.—Leasaítear leis seo alt 8 den Phríomh-Acht tríd an méid seo a leanas a chur in ionad fo-alt (1) agus (2):—
“(1) Má chítear do na Coimisinéirí, de bharr tuaraisce ón gComhairle Chomhairlitheach nó eile, séadchomhartha ar dóigh leo gur séadchomhartha náisiúnta é a bheith i mbaol a scriosta, a dhíobháluithe nó a aistrithe nó go bhfuil sé iarbhír á scrios, á dhíobháladh nó á aistriú, nó go bhfuil sí ag dul i léig trí fhaillí, féadfaidh na Coimisinéirí le hordú (dá ngairmtear ordú buan-choimeádta san Acht seo) buanchoimeád an tséadchomhartha sin a ghabháil de láimh.
(2) Féadfaidh na Coimisinéirí tráth ar bith, le hordú a dhéanfaid tar éis dóibh dul i gcomhairle leis an gComhairle Chomhairlitheach, ordú buan-choimeádta a chúlghairm.”

4.—(1) Má chítear do na Coimisinéirí go bhfuil séadchomhartha ar dóigh leo gur séadchomhartha náisiúnta é i ndlúth-bhaol a dhíobháluithe nó a scriosta, féadfaidh na Coimisinéirí, le hordú (dá ngairmtear ordú buan-choimeádta sealadach san Acht seo), buan-choimeád an tséadchomhartha sin a ghabháil de láimh.
(2) Mura gcúlghairmtear roimhe sin é le hordú ó na Coimisinéirí, fanfaidh ordú buan-choimeádta sealadach i bhfeidhm go ceann tréimhse sé mhí agus raghaidh in éag ansin.
(3) Ní ghabhfaidh ordú buan-choimeádta sealadach ionad orduithe bhuan-choimeádta, ná ní chuirfidh cosc lena dhéanamh.
(4) Déanfar tagairtí in alt 9 (seachas míreanna (2) agus (3)) agus in alt 14 den Phríomh-Acht d'orduithe buan-choimeádta d'fhorléiriú mar thagairtí a fholaíos tagairtí d'orduithe buanchoimeádta sealadacha.

5.—Déanfar cumhacht na gCoimisinéirí faoi alt 11 den Phríomh-Acht chun séadchomhartha náisiúnta a thógaint chucu d'fhorléiriú, i gcás maoine a bheas dílsithe iontu faoi alt 25 den Irish Church Act, 1869, mar chumhacht a fholaíos cumhacht chun pé talamh a thógaint chucu a bheas ag teastáil chun bealach isteach go dtí an séadchomhartha sin a chur ar fáil nó chun an mhaoin sin d'fhálú nó a chlúdach nó chun í a chaomhaint ar shlí eile ó dhíobháil nó chun a taitneamhachta a chaomhaint.

6.—Chun deireadh a chur le hamhras achtaítear leis seo go bhfuil aon eaglais nó aon fhoirgneamh nó déanmhas eaglasta a raibh sé sainráite é do dhílsiú i Rúnaí na gCoimisinéirí le hordú faoi fho-alt (1) d'alt 25 den Irish Church Act, 1869, dílsithe sna Coimisinéirí agus gur séadchomhartha náisiúnta é do réir bhrí an Príomh-Achta.
Cumhacht chun fógraí a chur suas.
7.—Féadfaidh na Coimisinéirí a chur faoi deara go gcuirfear suas ag séadchomhartha náisiúnta is ábhar d'ordú buan-choimeádta nó d'ordú buan-choimeádta sealadach fógra á rá go bhfuil an t-ordú sin ann, agus chuige sin féadfaidh aon oifigeach do na Coimisinéirí a bheas údaraithe go cuí acu chuige sin dul isteach sa séadchomhartha sin agus in aon talamh nó áitreabh eile.
Liostaí de shéadchomharthaí náisiúnta d'fhoilsiú.
8.—(1) Cuirfidh na Coimisinéirí faoi deara ó am go ham go bhfoilseofar san Iris Oifigiúil liostaí—
(a) de na séadchomharthaí a dtabharfaidh an Chomhairle Chomhairlitheach tuairisc fúthu agus ar dóigh leis na Coimisinéirí gur séadchomharthaí iad a bhfuil tábhacht náisiúnta ag baint lena mbuan-choimeád, agus
(b) de pé séadchomharthaí eile is oiriúnach leis na Coimisinéirí.
(2) Má beartaítear séadchomhartha a chur ar liosta faoi fho-alt (1) den alt seo, bhéarfaidh na Coimisinéirí fógra d'únaer an tséadchomhartha á rá go bhfuil sin beartaithe agus ag lua na bpionós a dlífear a chur ar dhuine a bheas ciontach i gcion faoin alt seo.
(3) I gcás únaer séadchomhartha a bheas ar liosta faoi fho-alt (1) den alt seo dá bheartú, tar éis dó fógra faoi fho-alt (2) den alt seo d'fháil, an séadchomhartha a scartáil nó d'aistriú go hiomlán nó go páirteach, nó a dhéanmhas d'athrú nó breis a chur leis, nó tochailt a dhéanamh ina chomharsanacht, bhéarfaidh sé fógra do na Coimisinéirí go bhfuil sin beartaithe aige, agus ní thosnóidh sé, mura mbíonn dianghá leis agus toiliú na gCoimisinéirí faighte aige, ar aon tsaothar scartála, aistrithe, athruithe, breisithe ná tochailte go ceann dhá mhí tar éis dó an fógra sin a thabhairt.
(4) Gach duine a shárós fo-alt (3) den alt seo beidh sé ciontach i gcion faoin alt seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná caoga punt a chur air nó, de rogha na Cúirte, príosúntacht ar feadh aon téarma nach sia ná sé mhí nó an fhíneáil sin agus an phríosúntacht sin le chéile.

9.—Más iad na Coimisinéirí is únaerí ar shéadchomhartha náisiúnta, mar mínítear sin i bhfo-alt (1) d'alt 13 den Phríomh-Acht, féadfaid, más inmholta leo sin a dhéanamh, an séadchomhartha d'aistriú go dtí láthair pé séadchomhartha náisiúnta eile is oiriúnach agus is cead leo.

10.—Féadfaidh baint a bheith ag ordú faoi alt 17 den Phríomh-Acht le pé cuid de shéadchomhartha náisiúnta a sonrófar san ordú, agus sa chás sin ní bhainfidh forála an ailt sin ach leis an gcuid sin den tséadchomhartha.
Séadchomharthaí náisiúnta a scrúdú.
11.—(1) Féadfaidh na Coimisinéirí a chur faoi deara go ndéanfaidh a n-oifigigh pé scrúduithe, agus go dtabharfaid pé tuairiscí, a ordós na Coimisinéirí (go ginearálta nó go sonrach) maidir le séadchomharthaí náisiúnta agus le háiteanna a bhfuil cúis ag na Coimisinéirí a chreidiúint go bhfuil séadchomharthaí náisiúnta iontu.
(2) Chun séadchomhartha náisiúnta ar bith a scrúdú faoin alt seo, féadfaidh aon oifigeach do na Coimisinéirí dul isteach in aon talamh agus áitreabh agus gach ní a dhéanamh ann a mheasfas sé a bheith riachtanach chun críche an scrúduithe.
(3) Gach duine a chuirfeas bac, nó a chuirfeas isteach ar shlí eile, ar oifigeach do na Coimisinéirí agus é ag feidhmiú aon cheann dá chumhachta faoin alt seo, beidh sé ciontach i gcion faoin alt seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó na cúig puint a chur air.
(4) Athghairmtear leis seo alt 20 den Phríomh-Acht.

12.—Leasaítear leis seo alt 22 den Phríomh-Acht tríd an méid seo leanas a chur in ionad fo-ailt (2):—
“(2) Is iad a bheas ar gach coiste comhairlitheach áitiúil pé líon daoine, nach lú ná triúr ná nach mó ná deichniúr, a ndéanfaidh an t-údarás áitiúil a bhunós é iad a cheapadh ina gcomhaltaí dhe.”

13.—In ionad na dtagairtí atá in alt 23 den Phríomh-Acht do Choimeádaí Sean-sheod Éireann sa Mhusaem Náisiúnta, cuirfear tagairtí do Stiúrthóir an Mhusaeim Náisiúnta.

14.—Leasaítear leis seo alt 24 den Phríomh-Acht tríd an bhfo-alt seo a leanas a chur leis—
“(4) (a) Féadfaidh an tAire Oideachais ó am go ham, le hordú, a dhearbhú gur rud lena mbaineann an t-alt seo aon, rud ar dóigh leis gur rud ársa é agus féadfaidh aon ordú den tsórt sin a chúlghairm.
(b) Aon rud a ndearbhóidh ordú a bheas i bhfeidhm do thuras na huaire gur rud é lena mbaineann an t-alt seo, glacfar leis go deimhneach gur rud ársa é chun críocha an ailt seo gan a thuilleadh cruthúnais.”

15.—(1) Ar pé dáta agus ó pé dáta a cheapfas an tAire le hordú is iad a bheas ar an gComhairle Chomhairlitheach—
(a) oifigeach don Roinn Oideachais, a ainmneos an tAire Oideachais chuige sin, agus oifigeach do na Coimisinéirí, a ainmneos an tAire chuige sin, agus
(b) pé líon de dhaoine eile (ar a n-áireofar ionadaithe do na comhluchta seo a leanas, is é sin le rá, Acadamh Ríoga na hÉireann, Cumann Ríoga Seanchaí na hÉireann agus Institiúid Ailtirí Éireann) a ainmneos an tAire ina gcomhaltaí dhi.
(2) Beidh comhaltas na Comhairle Comhairlithí le hainmniú i gceann gach cúig mblian.
(3) Féadfar aon chomhalta den Chomhairle Chomhairlitheach d'athainmniú.
(4) Más rud é, ar chúis ar bith, nach féidir go sealadach le comhalta den Chomhairle Chomhairlitheach a bheas ainmnithe faoi mhír (a) d'fho-alt (1) den alt seo gníomhú, féadfar duine d'ainmniú sa tslí chéanna le gníomhú ina ionad.
(5) Athghairmtear leis seo fo-ailt (2) agus (3) d'alt 21 den Phríomh-Acht ar an dáta agus ón dáta a cheapfas an tAire faoi fho-alt (1) den alt seo.
Alt 26 den Phríomh-Acht a mhodhnú.
16.—Ní bhainfidh aon ní in alt 26 den Phríomh-Acht le rómhar ná tochailt in aon talamh ná faoi, ná ní bhéarfaidh go mbeidh sin neamhdhleathach, más chuige amháin a déantar é chun séadchomhartha nó rud ársa a choimeád slán atá i ndlúth-bhaol a scriosta nó a dhulta i léig.

17.—(1) Más iad na Coimisinéirí, nó más údarás áitiúil, is únaerí ar shéadchomhartha náisiúnta, féadfaidh na Coimisinéirí, ach toiliú (ginearálta nó sonrach) an Aire d'fháil, agus féadfaidh údaráis áitiúil, ach toiliú na gCoimisinéirí d'fháil, léasa agus ceadúnais a thabhairt maidir leis an séadchomhartha sin chun pé críocha agus go ceann pé téarma agus faoi réir pé coinníoll, lena n-áirítear íoc cíosa, is oiriúnach leis na Coimisinéirí nó leis an údarás áitiúil, do réir mar bheas.
(2) Ní dhéanfaidh feidhmiú na gceart a bheirtear le fo-alt (1) den alt seo do na Coimisinéirí nó d'údarás áitiúil iad a shaoradh ó na dualgais a cuirtear orthu leis an bPríomh-Acht agus leis an Acht seo mar únaeraí séadchomhartha náisiúnta.
(3) Déanfar an t-airgead uile a gheobhas na Coimisinéirí faoin alt seo d'íoc isteach sa Stát-Chiste nó a chur chun tairbhe don Stát-Chiste i pé slí a threorós an tAire.
Fianaise.
18.—(1) Beidh deimhniú faoi shéala na gCoimisinéirí gurb iad na Coimisinéirí únaerí nó caomhnóirí séadchomhartha náisiúnta shonraithe ina fhianaise prima facie ar an únaeracht nó ar an gcaomhnóireacht sin.
(2) Beidh doiciméad a mbeidh deimhnithe faoi shéala na gCoimisinéirí gur cóip é d'ordú a rinne na Coimisinéirí faoin bPríomh-Acht, nó faoin Acht seo, ina fhianaise prima facie ar an ordú sin.

19.—D'ainneoin fo-ailt (4) d'alt 10 den Petty Sessions (Ireland) Act, 1851, féadfar imeachta achomaire i leith ciona faoin bPríomh-Acht nó faoin Acht seo a thionscnamh laistigh de thrí mhí ón dáta a fuair na Coimisinéirí fios an chiona.

20.—(1) Féadfar Acht na Séadchomharthaí Náisiúnta (Leasú), 1954, a ghairm den Acht seo.
(2) Déanfar an Príomh-Acht agus an tAcht seo d'fhorléiriú le chéile mar aon Acht amháin.
(3) Féadfar Achta na Séadchomharthaí Náisiúnta, 1930 agus 1954, a ghairm den Phríomh-Acht agus den Acht seo le chéile.

NATIONAL MONUMENTS (AMENDMENT) ACT, 1954.
The Principal Act.
1.—In this Act “the Principal Act” means the National Monuments Act, 1930 (No. 2 of 1930).
Transfer by local authority of guardianship or ownership of national monument to Commissioners.
2.—Section 7 of the Principal Act is hereby amended by the substitution for subsection (1) of the following—
“(1) Where a local authority—
(a) have been appointed by deed under this or any other Act to be the guardians of a national monument, or
(b) are the owners of a national monument,
they may, with the consent of the Commissioners and with the consent of the owner in cases where the local authority are the guardians, transfer by deed such guardianship or ownership to the Commissioners and upon such guardianship being so transferred the deed appointing such local authority to be guardians shall have effect under this Act as if it appointed the Commissioners to be the guardians of such monument.”
Preservation orders.
3.—Section 8 of the Principal Act is hereby amended by the substitution for subsections (1) and (2) of the following:—
“(1) Where it appears to the Commissioners, on a report made by the Advisory Council or otherwise, that a monument which in their opinion is a national monument is in danger of being or is actually being destroyed, injured or removed, or is falling into decay through neglect, the Commissioners may by order (in this Act referred to as a preservation order) undertake the preservation of such monument.
(2) The Commissioners may at any time, by order made after consultation with the Advisory Council, revoke a preservation order.”
Temporary preservation orders.
4.—(1) Where it appears to the Commissioners that a monument which in their opinion is a national monument is in immediate danger of injury or destruction the Commissioners may by order (in this Act referred to as a temporary preservation order) undertake the preservation of such monument.
(2) A temporary preservation order shall, unless previously revoked by order of the Commissioners, remain in force for a period of six months and shall then expire.
(3) A temporary preservation order shall not be in substitution for or operate to prevent the making of a preservation order.
(4) References in section 9 (other than paragraphs (2) and (3)) and in section 14 of the Principal Act to preservation orders shall be construed as including references to temporary preservation orders.
Construction of section 11 of Principal Act.
5.—The power of the Commissioners under section 11 of the Principal Act to acquire a national monument shall, in the case of property vested in them under section 25 of the Irish Church Act, 1869, be construed as including power to acquire such land as may be required in order to provide means of access thereto or to fence, cover in or otherwise preserve from injury such property or to preserve the amenities thereof.
Effect of orders vesting ecclesiastical structures.
6.—For the removal of doubt, it is hereby enacted that any church, ecclesiastical building or structure, expressed to vest in the Secretary of the Commissioners by order made under subsection (1) of section 25 of the Irish Church Act, 1869, is vested in the Commissioners and is a national monument within the meaning of the Principal Act.
Power to erect notices.
7.—The Commissioners may cause to be erected at a national monument which is the subject of a preservation order or a temporary preservation order a notice of the existence of such order and for that purpose any officer of the Commissioners, duly authorised by them in that behalf, may enter on such monument and any other lands or premises.
Publication of lists of national monuments.
8.—(1) The Commissioners shall from time to time cause to be published in Iris Oifigiúil lists of—
(a) such monuments as are reported by the Advisory Council and as the Commissioners consider to be monuments the preservation of which is of national importance, and
(b) such other monuments as the Commissioners think fit.
(2) When it is intended to include a monument in a list under subsection (1) of this section, the Commissioners shall notify the owner of the monument of that intention and of the penalties which may be incurred by a person guilty of an offence under this section.
(3) Where the owner of a monument which is included in a list under subsection (1) of this section, having received notice under subsection (2) of this section, proposes to demolish or remove in whole or in part, alter structurally or make additions to the monument, or make excavations in the neighbourhood thereof, he shall give notice of his intention to the Commissioners and shall not, except in the case of urgent necessity and with the consent of the Commissioners, commence any work of demolition, removal, alteration, addition or excavation for a period of two months after having given such notice.
(4) Every person who acts in contravention of subsection (3) of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds or, at the discretion of the Court, to imprisonment for any term not exceeding six months or to both such fine and such imprisonment.
Removal of monuments to sites of other monuments.
9.—Where the Commissioners are the owners of a national monument as defined in subsection (1) of section 13 of the Principal Act they may, if they think it desirable to do so, remove the monument to the site of such other national monument as they may think fit and approve.
Burials in specified part of national monument.
10.—An order under section 17 of the Principal Act may relate to such part of a national monument as may be specified in the order and in that event the provisions of that section shall apply only to that part of the monument.
Inspection of national monuments.
11.—(1) The Commissioners may cause such inspections and reports as they may direct (either generally or particularly) to be made by their officers in regard to national monuments and places where the Commissioners have reason to believe national monuments exist.
(2) An officer of the Commissioners may for the purpose of carrying out an inspection under this section enter on any lands and premises and there do all such things as he may consider necessary for the purpose of the inspection.
(3) Every person who obstructs or otherwise interferes with an officer of the Commissioners in the exercise of any of his powers under this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding five pounds.
(4) Section 20 of the Principal Act is hereby repealed.
Amendment of section 22 of Principal Act.
12.—Section 22 of the Principal Act is hereby amended by the substitution for subsection (2) of the following:—
“(2) Every local advisory committee shall consist of such number of persons, not less than three nor more than ten, as the local authority by whom the same is established shall appoint to be members thereof.”
Amendment of section 23 of Principal Act.
13.—For the references in section 23 of the Principal Act to the Keeper of Irish Antiquities in the National Museum there shall be substituted references to the Director of the National Museum.
Amendment of section 24 of Principal Act.
14.—Section 24 of the Principal Act is hereby amended by the addition of the following subsection—
“(4) (a) The Minister for Education may from time to time by order declare any object, which is in his opinion an archæological object, to be an object to which this section applies and may revoke any such order.
(b) An object declared to be an object to which this section applies by an order for the time being in force shall be conclusively assumed to be an archæological object for the purposes of this section without further proof.”
Constitution of the Advisory Council.
15.—(1) The Advisory Council shall, on and after such date as the Minister may by order appoint, consist of—
(a) an officer of the Department of Education, nominated for the purpose by the Minister for Education, and an officer of the Commissioners, nominated for the purpose by the Minister, and
(b) such number of other persons (including representatives of the following bodies, namely, the Royal Irish Academy, the Royal Society of Antiquaries of Ireland and the Royal Institute of the Architects of Ireland) as the Minister nominates to be members thereof.
(2) The Advisory Council shall be reconstituted after the expiration of every five years.
(3) Every member of the Advisory Council shall be eligible for re-nomination.
(4) If a member of the Advisory Council nominated under paragraph (a) of subsection (1) of this section is, for any reason, temporarily unable to act a person may be nominated, in like manner, to act in his stead.
(5) Subsections (2) and (3) of section 21 of the Principal Act are hereby repealed on and from the date appointed by the Minister under subsection (1) of this section.
Modification of section 26 of Principal Act.
16.—Nothing in section 26 of the Principal Act shall apply to or render unlawful digging or excavation in or under any land solely for the purpose of securing the safety of a monument or archæological object which is in imminent danger of destruction or decay.
Making of leases and granting of licences by Commissioners or local authority.
17.—(1) Where the Commissioners or a local authority are the owners of a national monument they may, subject, in the case of the Commissioners, to the consent (either general or particular) of the Minister, and, in the case of a local authority, to the consent of the Commissioners, make leases and grant licences in respect thereof for such purposes and for such term and subject to such conditions, including the payment of rent, as the Commissioners or the local authority, as the case may be, think fit.
(2) The exercise of the rights conferred by subsection (1) of this section on the Commissioners or a local authority shall not relieve them of the duties imposed on them as the owners of a national monument by the Principal Act and this Act.
(3) All moneys received by the Commissioners under this section shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister shall direct.
Evidence.
18.—(1) A certificate under the seal of the Commissioners that the Commissioners are the owners or guardians of a specified national monument shall be prima facie evidence of such ownership or guardianship.
(2) A document certified under the seal of the Commissioners to be a copy of an order made by the Commissioners under the Principal Act or this Act shall be prima facie evidence of such order.
Time for commencement of proceedings for offences.
19.—Notwithstanding subsection (4) of section 10 of the Petty Sessions (Ireland) Act, 1851, summary proceedings for an offence under the Principal Act or this Act may be instituted within three months from the date when the offence came to the knowledge of the Commissioners.
Short title, construction and collective citation.
20.—(1) This Act may be cited as the National Monuments (Amendment) Act, 1954.
(2) The Principal Act and this Act shall be construed together as one Act.
(3) The Principal Act and this Act may be cited together as the National Monuments Acts, 1930 and 1954.
