ACHT NA nÚDARÁS nÁITIÚIL (OIFIGIGH AGUS FOSTAITHE), 1926.

Mínithe.
1.—(1) San Acht so cialluíonn agus foluíonn an focal “údarás áitiúil” na cóluchtaí agus na daoine seo a leanas sé sin le rá:—
(a) comhairle chontae, chontae-bhuirge, bhuirge, bhailecheanntair, no thuathcheanntair, bord caomhnóirí, údarás sláintíochta puirt, agus coimisinéirí baile, agus
(b) aon chólucht, daoine, no duine a bunuíodh no a ceapadh le reacht no fé reacht chun feidhmeanna no aon cheann d'fheidhmeanna aon chomhairle, búird, no coimisinéirí den tsórt san do chólíona, agus
(c) coiste no có-choiste d'aon cheann no níos mó no a ceapadh ag aon cheann no níos mó de sna comhairlí, de sna búird, de sna coimisinéirí, de sna cóluchtaí no de sna daoine sin, agus
(d) coiste freastail scoile a ceapadh fén Acht Freastal Scoile, 1926 (Uimh. 17 de 1926).
(2) San Acht so cialluíonn an focal “an tAire”—
(a) an tAire Tailte agus Talmhaíochta nuair a tráchtar ar choiste no ar chó-choiste a ceapadh ag comhairle no ag comhairlí contaethe no bailecheanntar fé sna Technical Instruction Acts, 1889 and 1891, no fé alt 14 den Agriculture and Technical Instruction Act, 1899, chun dualgaisí do dhéanamh chun crícheanna talmhaíochta agus tuathcheárdaisí eile, no nuair a tráchtar ar aon oifigeach no seirbhíseach a ceapadh ag aon choiste no có-choiste den tsórt san, agus

(d) an tAire Rialtais Áitiúla agus Sláinte Puiblí nuair a tráchtar ar aon údarás áitiúil eile no ar aon oifigeach a ceapadh ag aon údarás áitiúil eile den tsórt san.
Oifigí le n-a mbaineann an tAcht.
2.—(1) San Acht so cialluíonn agus foluíonn an focal “oifig le n-a mbaineann an tAcht so”—
(a) an phríomh-oifig fheidhmiúcháin fé gach údarás áitiúil, agus
(b) gach oifig agus gach fostaíocht (nách oifig ná fostaíocht mhúinteora) fé údarás áitiúil gur cáilíochta gairme no teicniciúla i bpáirt no go hiomlán na cáilíochta ina cóir, agus
(c) gach ceann de pé oifigí agus fostaíochtaí eile fé údarás áitiúil a fhaisnéisfidh an tAire o am go ham le haontú na gCoimisinéirí a bheith ina n-oifigí le n-a mbaineann an tAcht so.
(2) Socróidh an tAire tar éis do dul i gcomhairle leis na Coimisinéirí gach ceist no aighneas i dtaobh ce'ca is oifig le n-a mbaineann an tAcht so no nách ea aon oifig no fostaíocht áirithe, agus ní bheidh dul thar an mbreith sin.
Coimisinéirí um Cheapacháin Áitiúla do cheapa.
3.—(1) Beidh sé dleathach don Ard-Chomhairle o am go ham daoine cearta oiriúnacha do cheapa chun bheith ina gCoimisinéirí um Cheapacháin Áitiúla (dá ngairmtear “na Coimisinéirí” san Acht so) chun na feidhmeanna a ceaptar do sna Coimisinéirí sin leis an Acht so do chólíona,
(2) Ní bheidh duine neamh-incheaptha mar Choimisinéir fén Acht so de bhrí a bheith ina Choimisinéir Stát-Sheirbhíse fé Acht Rialuithe na Stát-Sheirbhíse, 1924 (Uimh. 5 de 1924) agus dá bhrí sin amháin.
(3) Ní bheidh thar triúr Coimisinéirí ann aon uair.
(4) Gach éinne a ceapfar fén alt so chun bheith ina Choimisinéir um Cheapacháin Áitiúla beidh sé i seilbh oifige faid is toil leis an Ard-Chomhairle é.
(5) Gach uair a déanfar Coimisinéir a cheapa no a chur as oifig fén alt so foillseofar láithreach san Iris Oifigiúil an ceapa no an cur-as-oifig sin.
Luach saothair agus fuireann na gCoimisinéirí.
4.—(1) Gheobhaidh gach éinne a ceapfar chun bheith ina Choimisinéir fén Acht so pé luach saothair a chinnfidh an tAire Airgid.
(2) Féadfidh an tAire Airgid pé daoine agus pé méid daoine is dó leis is gá do cheapa chun bheith ina n-oifigigh do sna Coimisinéirí, agus beidh na daoine sin i seilbh oifige ar pé téarmaí agus tabharfar luach saothair dóibh do réir pé rátaí agus ar pé slí a ordóidh an tAire Airgid.
Ceapacháin a fhéadfidh údaráis áitiúla a dhéanamh.
5.—(1) Gan mola d'iarraidh ná d'fháil o sna Coimisinéirí fé sna forálacha ina dhiaidh seo den Acht so, féadfidh údarás áitiúil, fé réir chead an Aire, duine do cheapa chun oifig le n-a mbaineann an tAcht so do líona i gcás, ach ní ach i gcás, go ndéanfar an ceapa laistigh de ráithe tar éis folmhuithe na hoifige sin no (i gcás ceapa chun oifige nua) tar éis a bunuithe agus, an té a ceapfar amhlaidh, gur duine é a bhí, le linn folmhuithe no bunuithe (pe'ca aca é) na hoifige sin—
(a) i seilbh oifige inphinsin fén údarás áitiúil sin no fé aon údarás áitiúil eile no fé aon dá údarás áitiúla no níos mó, oifig gur bhain a dualgaisí leis na nithe céanna le n-a mbaineann dualgaisí na hoifige folmha no le nithe cosúil leo, no
(b) ag fáil liúntais ón údarás áitiúil sin no o aon údarás áitiúil eile, no o aon dá údarás áitiúla no níos mó, mar gheall ar gur scuir sé de bheith i seilbh oifige fén údarás áitiúil sin no fé aon údarás áitiúil eile no fé aon dá údarás áitiúla no níos mó, oifig gur bhain a dualgaisí leis na nithe céanna le n-a mbaineann dualgaisí na hoifige folmha no le nithe cosúil leo.
(2) Má dintar oifig le n-a mbaineann an tAcht so d'fholmhú no (i gcás oifige nua) í do bhunú, ansan, más deimhin leis an údarás áitiúil gur gá é sa chás, féadfid, le toil an Aire agus gan mola d'iarraidh ná d'fháil o sna Coimisinéirí fé sna forálacha ina dhiaidh seo den Acht so, éinne do cheapa chun an oifig sin do líona go sealadach, agus gach duine a ceapfar amhlaidh beidh sé i seilbh oifige go dtí go gceapfar duine chun na hoifige sin fé fhorálacha an Achta so (lasmuich den bhfo-alt so) no go dtí go mbeidh sé mhí caithte o folmhuíodh an oifig sin, pe'ca aca is túisce thárlóidh.
Ceapacháin a fhéadfidh an tAire a dhéanamh.
6.—(1) Ach amháin i gcás ina n-údaruítear a mhalairt leis an Acht so, déanfidh gach údarás áitiúil, sara ndinid ceapa chun oifige le n-a mbaineann an tAcht so, a iarraidh ar na Coimisinéirí duine do mhola dhóibh le ceapa chun na hoifige sin.
(2) Más rud é, laistigh de ráithe tar éis folmhuithe oifige le n-a mbaineann an tAcht so no (i gcás oifige nua) tar éis a bunuithe, na hiarrfidh údarás áitiúil ar na Coimisinéirí duine do mhola dhóibh le ceapa chun na hoifige sin ná ná déanfid ceapa (nách ceapa sealadach) chun na hoifige sin fé agus do réir foráil den Acht so le n-a gceaduítear déanamh in éamais an iarratais sin, féadfidh an tAire, thar cheann an údaráis áitiúla san, a iarraidh ar na Coimisinéirí duine do mhola don údarás áitiúil sin le ceapa chun na hoifige sin.
(3) Ar fháil iarratais den tsórt san roimhráite dhóibh ón údarás áitiúil no ón Aire (pe'ca aca é) toghfidh na Coimisinéirí amach do réir an Achta so agus molfid don údarás áitiúil duine amháin le ceapa chun na hoifige sin no, más dó leo gur ceart é, toghfid amach do réir an Achta so agus molfid don údarás áitiúil beirt no níos mó don cheapachán san.
(4) Ar fháil mola na gCoimisinéirí o sna Coimisinéirí fén alt so dhóibh, ceapfidh an t-údarás áitiúil chun na hoifige sin an té do moladh ag na Coimisinéirí no, más mó ná éinne amháin do moladh amhlaidh, pé duine de sna daoine do moladh amhlaidh is dó leo is ceart.
Cáilíochta i gcóir ceapachán.
7.—(1) Má iarrann údarás áitiúil no an tAire ar na Coimisinéirí duine do mhola le ceapa chun oifige le n-a mbaineann an tAcht so ordóidh na Coimisinéirí le toil an Aire, na cáilíochta, maidir le haois, sláinte, oideachas, tréineáil, taithí, agus (má sé tuairim na gCoimisinéirí go n-éilíonn dualgaisí na hoifige é) innscin, i gcóir na hoifige sin.
(2) Le toil an Aire agus tar éis dul i gcomhairle mar is féidir no is caothúil dóibh le pé comhlachaisí no cóluchtaí is dó leis an Aire Rialtais Áitiúla agus Sláinte Puiblí do bheith ionadathach d'údaráis áitiúla, féadfidh na Coimisinéirí aon uair, más oiriúnach leo é, na cáilíochta d'ordú go generálta i gcóir na n-oifigí uile a háirítear ar aon tsaghas no aicme no grád áirithe d'oifigí le n-a mbaineann an tAcht so agus féadfid a ordú amhlaidh go generálta aon cháilíocht d'fhéadfidís a ordú go speisialta fé fho-alt (1) den alt so i gcóir aon oifige áirithe a háirítear ar an saghas, ar an aicme no ar an ngrád san.
(3) Sara molaid duine d'údarás áitiúil le ceapa chun oifige le n-a mbaineann an tAcht so déanfidh na Coimisinéirí deimhin de dhóibh féin ar pé slí is dó leo is ceart go bhfuil ag an duine sin na cáilíochta a horduítear fén alt so i gcóir na hoifige sin.
Daoine do thogha amach tré scrúdú chomórtais.
8.—(1) Fé réir pé eisceachtaí a diutar leis an Acht so no a déanfar fé, is tré scrúdú chomórtais a stiúrófar do réir rialachán a dhéanfidh na Coimisinéirí a thoghfidh na Coimisinéirí amach gach éinne a bheidh acu le mola d'údarás áitiúil fén Acht so agus sa tslí sin amháin.
(2) Beidh gach scrúdú comórtais den tsórt san ar oscailt do gach éinne le n-ar mian dul fé agus ag á mbeidh no adéarfidh go bhfuil aige na cáilíochta a horduítear leis an Acht so no fé i gcóir na hoifige 'na ndéanfar an scrúdú ina cóir agus a íocfidh na táillí a ordóidh na Coimisinéirí i gcóir an scrúduithe sin.
(3) Féadfidh na Coimisinéirí, tar eis dul i gcomhairle leis an Aire, rialacháin do dhéanamh i gcóir stiúra (le n-a n-áirítear am agus áit agus abhair) scrúduithe comórtais a dhéanfid chun críche an ailt seo, agus féadfidh na rialacháin sin bheith i dtaobh na scrúdúithe sin go generálta no i dtaobh aicme no aicmí áirithe de sna scrúduithe sin no i dtaobh scrúdú no scrúduithe áirithe.
Daoine do thogha amach do cheapacháin gur gá gairmthaithí ina gcóir.
9.—Má iarrann údarás áitiúil no an tAire ar na Coimisinéirí duine do mhola dhóibh le ceapa chun oifige le n-a mbaineann an tAcht so agus, mar gheall ar nádúir dhualgaisí na hoifige sin, ar an eolas agus ar an taithí is gá chun na dualgaisí sin do chólíona go héifeachtúil, agus ar na cáilíochta a horduíodh fén Acht so i gcóir na hoifige sin, gur dó leis na Coimisinéirí, le haontú an Aire, nách féidir an duine no na daoine a molfar le ceapa chun na hoifige sin do thogha amach go sásúil tré scrúdú chomórtais, féadfidh na Coimisinéirí déanamh in éamais an scrúduithe chomórtais a héilítear leis an Acht so agus an duine no na daoine a bheidh acu le mola don údarás áitiúil don thogha amach tré pé meáin agus ar pé slí is dó leo is ceart.
Na Coimisinéirí d'éileamh táillí.
10.—(1) Féadfidh na Coimisinéirí, tar éis dóibh dul i gcomhairle leis an Aire, pé táillí is dó leo is ceart d'éileamh ar gach éinne a ofrálfidh é féin do sna Coimisinéirí mar iarrthóir le togha amach (pe'ca tré scrúdú chomórtais no ar aon tslí eile é) chun a mholta fén Acht so.
(2) Ar pé slí a ordóidh an tAire Airgid íocfidh na Coimisinéirí isteach sa Stát-Chiste no socróid chun tairbhe dho gach táille a bhaileoidh na Coimisinéirí fén alt so.
Oifigigh agus seirbhísigh do chur ar fionnraí.
11.—(1) Má bhíonn, dar le haon údarás áitiúil no leis an Aire, cúis chun a chreidiúint, maidir le hoifigeach no le seirbhíseach don údarás áitiúil sin, nár chólíon sé dualgaisí a bhirte go sásúil no gur dhin sé é féin do mhí-iompar i leith na ndualgaisí sin no go bhfuil sé neamh-oiriúnach ar aon tslí eile chun bheith i seilbh na birte sin, féadfidh an t-údarás áitiúil sin no an tAire (pe'ca aca é) an t-oifigeach no an seirbhíseach san do chur ar fionnraí o chólíona a dhualgaisí faid a beifear ag féachaint isteach sa neachólíona, sa mhí-iompar no sa neamh-oiriúnacht san a cuirtar ina leith agus á shocrú cadé an gníomh smachta (más aon cheann) a déanfar ina thaobh.
(2) Má dhineann údarás áitiúil no an tAire fén alt so oifigeach no seirbhíseach do chur ar fionnraí leanfidh an fionnraí sin go dtí go gcuirfidh an tAire deire leis.
(3) Ní bhfuighidh oifigeach a cuirfar ar fionnraí fén alt so aon luach saothair ón údarás áitiúil faid a leanfidh a fhionuraí agus nuair a bheidh deire le n-a fhionnraí geallbhruidfar i bpáirt no go hiomlán, no íocfar leis, no socrófar ar shlí éigin eile, fé mar a ordóidh an tAire, an luach saothair do gheobhadh sé i rith tréimhse an fhionnraí dá mba ná cuirfí ar fionnraí é.
Forálacha airgeadais.
12.—(1) Is amach as airgead a sholáthróidh an tOireachtas a híocfar, sa mhéid go gceadóidh an tAire Airgid é, luach saothair na gCoimisinéirí agus a n-oifigeach agus gach costas fé n-a raghaidh na Coimisinéirí no fé n-a raghfar ar aon tslí eile ag cur an Achta so in éifeacht.
(2) Laistigh de mhí tar éis deire gach bliana airgeadais áitiúla deimhneoidh na Coimisinéirí don Aire Rialtais Áitiúla agus Sláinte Puiblí—
(a) cá mhéid ar fad do caitheadh an bhliain airgeadais áitiúil roimhe sin ag íoc luach saothair na gCoimisinéirí agus na gcostaisí fé n-ar chuaidh na Coimisinéirí ag cur an Achta so in éifeacht, agus
(b) cá mhéid ar fad a fuair na Coimisinéirí an bhliain air geadais áitiúil roimhe sin i riocht táillí do híocadh leo fén Acht so, agus
(c) cadé an bhreis (más ann di) (dá ngairmtear “an bhreis sin” ina dhiaidh seo anso) atá ag an méid sin ar fad do caitheadh ar an méid sin ar fad do fuarthas.
(3) Le hordú fé n-a shéala leagfidh an tAire Rialtais Áitiúla agus Sláinte Puiblí an bhreis sin ar na contaethe agus ar na contae-bhuirgí uile agus fé seach i Saorstát Éireann mar ráta do réir luach bliantúil glan na maoine is ionrátuithe i gcóir ráta dhealbhais sna contaethe agus sna contae-bhuirgí sin fé seach agus cuirfe sé cóip den ordú san chun comhairle gach contae agus contae-bhuirge acu.
(4) Cruinneoidh comhairle gach contae agus contae-bhuirge tríd an ráta dealbhais mar mhuirear ar an gcontae iomlán an cion den bhreis sin a leagfar ar a gcontae no ar a gcontae-bhuirg leis an ordú san agus ar bheith cruinnithe dho íocfid an cion san isteach sa Stát-Chiste ar pé slí a ordóidh an tAire Airgid.

LOCAL AUTHORITIES (OFFICERS AND EMPLOYEES) ACT, 1926.
Definitions.
1.—(1) In this Act the expression “local authority” means and includes the following bodies and persons that is to say:—
(a) the council of a county, county borough, borough, urban district, or rural district, a board of guardians, a port sanitary authority, and the commissioners of a town, and
(b) any body, persons, or person established or appointed by or under a statute to perform the functions or any of the functions of any such council, board, or commissioners, and
(c) a committee or joint committee of or appointed by any one or more of such councils, boards, commissioners, bodies, or persons, and
(d) a school attendance committee appointed under the School Attendance Act, 1926 (No. 17 of 1926).
(2) In this Act the expression “the Minister”—
(a) in relation to a committee or joint committee appointed by one or more councils of counties or urban districts under the Technical Instruction Acts, 1889 and 1891 or under section 14 of the Agriculture and Technical Instruction Act, 1899 to perform duties for the purposes of agriculture and other rural industries or in relation to any officer or servant appointed by any such committee or joint committee, means the Minister for Lands and Agriculture, and
(b) in relation to a committee or joint committee appointed by one or more councils of counties or urban districts under the Acts or section aforesaid to perform duties in connection with technical instruction or in relation to any officer or servant appointed by any such committee or joint committee, means the Minister for Education, and
(c) in relation to a school attendance committee or any officer appointed by any such committee, means the Minister for Education, and
(d) in relation to any other local authority or any officer appointed by any such other local authority, means the Minister for Local Government and Public Health.
Offices to which Act applies.
2.—(1) In this Act the expression “office to which this Act applies” means and includes—
(a) the chief executive office under every local authority, and
(b) every office and every employment (not being an office or employment as a teacher) under a local authority the qualifications for which are wholly or in part professional or technical, and
(c) all such other offices and employments under a local authority as the Minister shall from time to time with the concurrence of the Commissioners declare to be offices to which this Act applies.
(2) Every question or dispute as to whether any particular office or employment is or is not an office to which this Act applies shall be decided by the Minister after consultation with the Commissioners and such decision shall be final and conclusive.
Appointment of Local Appointments Commissioners.
3.—(1) It shall be lawful for the Executive Council from time to time to appoint fit and proper persons to be Local Appointments Commissioners (in this Act referred to as “the Commissioners”) to fulfil the functions assigned to such Commissioners by this Act.
(2) A person shall not be ineligible for appointment as a Commissioner under this Act by reason only of his being a Civil Service Commissioner under the Civil Service Regulation Act, 1924 (No. 5 of 1924).
(3) The Commissioners shall not at any time exceed three in number.
(4) Every person appointed under this section to be a Local Appointments Commissioner shall hold office during the pleasure of the Executive Council.
(5) Every appointment and every removal of a Commissioner under this section shall be published immediately in the Iris Oifigiúil.
Remuneration and staff of Commissioners.
4.—(1) Every person appointed to be a Commissioner under this Act shall receive such remuneration as the Minister for Finance shall determine.
(2) The Minister for Finance may appoint such and so many persons as he shall consider necessary to be officers of the Commissioners, and such persons shall hold office upon such terms and be remunerated at such rates and in such manner as the Minister for Finance shall direct.
Appointments by local authorities.
5.—(1) An appointment of a person to fill an office to which this Act applies may, subject to the sanction of the Minister, be made by a local authority without requesting or obtaining a recommendation from the Commissioners under the subsequent provisions of this Act if but only if the appointment is made within three months after such office became vacant or (in the case of an appointment to a new office) was created and the person so appointed is a person who at the time when such office became vacant or was created (as the case may be) either—
(a) held a pensionable office under the said or any other local authority or any two or more local authorities the duties of which related to matters the same as or similar to the matters to which, the duties of the vacant office relate, or
(b) was in receipt of an allowance from the said or any other local authority or any two or more local authorities in respect of his having ceased to hold an office under the said or any other local authority or any two or more local authorities the duties of which related to matters the same as or similar to the matters to which the duties of the vacant office relate.
(2) Whenever an office to which this Act applies becomes vacant or (in the case of a new office) is created the local authority, if satisfied that the circumstances of the case so require, may with the consent of the Minister appoint and without requesting or obtaining a recommendation from the Commissioners under the subsequent provisions of this Act any person to fill such office temporarily, and every person so appointed shall hold office until a person is appointed to such office under the provisions (other than this sub-section) of this Act or the expiration of six months from such office becoming vacant whichever first occurs.
Appointments by the Minister.
6.—(1) Save as is otherwise authorised by this Act, every local authority shall, before making an appointment to an office to which this Act applies, request the Commissioners to recommend to them a person for appointment to such office.
(2) Whenever a local authority does not, within three months after an office to which this Act applies becomes vacant or (in the case of a new office) is created, either request the Commissioners to recommend to them a person for appointment to such office or make an appointment (other than a temporary appointment) to such office under and in accordance with a provision of this Act dispensing with such request, the Minister may on behalf of such local authority request the Commissioners to recommend to such local authority a person for appointment to such office.
(3) On receiving such request as aforesaid from the local authority or the Minister (as the case may be) the Commissioners shall select in accordance with this Act and recommend to the local authority one person for appointment to the said office or shall, if they so think proper, select in accordance with this Act and recommend to the local authority two or more persons for such appointment.
(4) On receiving from the Commissioners their recommendation under this section, the local authority shall appoint to the said office the person recommended by the Commissioners or, where more than one person is so recommended, such one of the persons so recommended as they shall think proper.
Qualifications for appointments.
7.—(1) Whenever a local authority or the Minister requests the Commissioners to recommend a person for appointment to an office to which this Act applies the Commissioners shall with the consent of the Minister prescribe the qualifications as to age, health, character, education, training, experience and (where in the opinion of the Commissioners the duties of the office so require) sex for such office.
(2) The Commissioners if they so think fit may at any time, with the consent of the Minister and after such consultation as may be possible or convenient with such associations or bodies as the Minister for Local Government and Public Health may consider to be representative of local authorities, prescribe generally the qualifications for all offices comprised in any particular description, class, or grade of offices to which this Act applies and may so prescribe generally any qualification which they could prescribe specially under sub-section (1) of this section in respect of any particular office comprised in such description, class or grade.
(3) Before recommending a person to a local authority for appointment to an office to which this Act applies the Commissioners shall satisfy themselves in such manner as they think proper that such person possesses the qualifications prescribed under this section for such office.
Selection by competitive examination.
8.—(1) Subject to such exceptions as are or may be made by or under this Act, the Commissioners shall select every person to be recommended by them to a local authority under this Act solely by means of competitive examination conducted according to regulations made by the Commissioners.
(2) Every such competitive examination shall be open to all persons desiring to attend the same who possess or claim to possess the qualifications prescribed by or under this Act for the office in respect of which the examination is held and pay the fees prescribed by the Commissioners in respect of such examination.
(3) The Commissioners may, after consultation with the Minister, make regulations for the conduct (including time and place and subjects) of competitive examinations to be held by them for the purpose of this section, and such regulations may relate to such examinations generally or to one or more classes of such examinations or to one or more particular examinations.
Selection for appointments requiring professional experience.
9.—Whenever a local authority or the Minister requests the Commissioners to recommend a person for appointment to an office to which this Act applies and the Commissioners with the concurrence of the Minister are of opinion that, having regard to the nature of the duties of that office, the knowledge and experience necessary for the efficient performance of those duties, and the qualifications prescribed under this Act for that office, the person or persons to be recommended for appointment to that office cannot be satisfactorily selected by competitive examination, the Commissioners may dispense with the competitive examination required by this Act and may select the person or persons to be recommended by them to the local authority by such means and in such manner as they think proper.
Charging of fees by Commissioners.
10.—(1) The Commissioners may charge every person presenting himself to the Commissioners as a candidate for selection (whether by competitive examination or otherwise) for recommendation under this Act such fee as the Commissioners, after consultation with the Minister, shall think proper.
(2) All fees collected by the Commissioners under this section shall be paid into or disposed for the benefit of the Exchequer by the Commissioners in such manner as the Minister for Finance shall direct.
Suspension of officers and servants.
11.—(1) Whenever there is in the opinion of any local authority or of the Minister reason to believe that an officer or servant of such local authority has failed to perform satisfactorily the duties of his position or has misconducted himself in relation thereto or is otherwise unfit to hold such position, such local authority or the Minister (as the case may be) may suspend such officer or servant from the performance of his duties while such alleged failure, misconduct or unfitness is being inquired into and the disciplinary action (if any) to be taken in regard thereto is being determined.
(2) The suspension of an officer or servant who is suspended under this section by a local authority or the Minister shall continue until terminated by the Minister.
(3) An officer who is suspended under this section shall not receive any remuneration from the local authority during the continuance of his suspension, and at the termination of his suspension the remuneration which he would have received during the period of suspension if he had not been suspended shall be wholly or partly forfeited, or paid to him, or otherwise disposed of, as the Minister shall direct.
Financial provisions.
12.—(1) The remuneration of the Commissioners and their officers and all expenses incurred by the Commissioners or otherwise in carrying this Act into effect shall, to such amount as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
(2) Within one month after the end of every local financial year the Commissioners shall certify to the Minister for Local Government and Public Health—
(a) the total amount expended in the preceding local financial year in paying the remuneration of the Commissioners and the expenses incurred by the Commissioners in carrying this Act into effect, and
(b) the total amount received by the Commissioners in such preceding local financial year in fees paid to them under this Act, and
(c) the amount (if any) (hereinafter referred to as “the said excess”) by which the said total amount expended exceeds the said total amount received.
(3) The Minister for Local Government and Public Health shall by order under his seal assess the said excess on the several counties and county boroughs in Saorstát Eireann rateably in proportion to the net annual value of the property rateable for poor rate in such counties and county boroughs respectively and shall send to the council of every such county and county borough a copy of such order.
(4) The council of every county and county borough shall raise by means of the poor rate as a county-at-large charge the proportion of the said excess assessed on their county or county borough by such order and shall pay such proportion when raised into the Exchequer in such manner as the Minister for Finance shall direct.
Short title.
13.—This Act may be cited as the Local Authorities(Officers and Employees) Act 1926.
