ACHT NA dTITHE (GAELTACHT), 1929.
Mínithe.
1.—San Acht so—
cialluíonn an abairt “an tAire” an tAire Tailte agus Iascaigh;
cialluíonn an abairt “na Coimisinéirí” Coimisinéirí na nOibreacha Puiblí in Éirinn;
nuair a húsáidtear an focal “cúram” maidir le sealbhaire tighe chomhnaithe cialluíonn agus foluíonn sé na daoine uile chomhnuíonn do ghnáth sa tigh chomhnaithe sin in éintigheas leis an sealbhaire sin, pe'ca tá gaol fola no cleamhnais acu leis an sealbhaire sin no ná fuil;
cialluíonn an focal “orduithe” orduithe le rialacháin a dhéanfaidh an tAire fén Acht so.
Fairsinge na Gaeltachta.
2.—(1) Chun crícheanna an Achta so, ach ní níos sia ná san ná chun aon chríche eile, tuigfear gurb ionann an Ghaeltacht agus na togha-ranna ceanntair uile agus fé seach a luaidhtear sa Sceideal a ghabhann leis an Acht so.
(2) Pé uair a mheasfaidh an tAire go bhfuil sé oiriúnach san a dhéanamh toisc atharú do theacht ar líon no ar shlí roinnte na nGaedhilgeoirí in áiteanna áirithe, féadfa sé, le hordú, an Sceideal a ghabhann leis an Acht so do leasú tré aon togha-roinn cheanntair ná luaidhtear ann, no ná beidh curtha isteach ann an uair sin tré leasú, do chur leis no tré aon togha-roinn cheanntair a luaidhtear ann, no a bheidh curtha isteach ann cheana, do scriosa dhe, agus pé uair a déanfar aon leasú den tsórt san ar an Sceideal san amhlaidh léireofar an tAcht so agus beidh éifeacht aige i dteanta agus fé réir an leasuithe sin maidir le deontaisí ceadófar fén Acht so le linn an leasú san do bheith i ngníomh agus maidir le gach ní déanfar de dhruim aon deontas den tsórt san do dheona no do cheadú.
(3) Gach ordú dhéanfaidh an tAire fén alt so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a dhéanta agus má dhineann ceachtar Tigh acu san, laistigh den lá is fiche shuidhfidh an Tigh sin tar éis an tOrdú san do leaga fé n-a bhráid, rún do rith ag cur an orduithe sin i nea-mbrí, beidh an t-ordú san curtha i nea-mbrí dá réir sin ach beidh san gan dochar do dhleathacht éinní do dineadh roimhe sin fén ordú san.
Deontaisí i gcóir tithe comhnaithe.
3.—(1) Má sé tuairim an Aire tigh comhnaithe sa Ghaeltacht do bheith neamh-oiriúnach ar fad chun cóiríocht cheart shláintiúil do thabhairt dá shealbhaire agus dá chúram san féadfaidh an tAire, fé réir forálacha an Achta so agus fé réir rialachán a dhéanfaidh an tAire fé, deontas (dá ngairmtear deontas tógála san Acht so) do dheona do shealbhaire an tighe chomhnaithe sin mar chabhair chun tigh nua comhnaithe do chur suas ar ionad an tighe chomhnaithe sin, no ar ionad eile, in áit an chéad tighe chomhnaithe sin a luaidhtear.
(2) Má sé tuairim an Aire tigh comhnaithe sa Ghaeltacht do bheith neamh-oiriúnach, ar an staid ar a bhfuil sé, chun cóiríocht cheart shláintiúil do thabhairt dá shealbhaire agus dá chúram san, agus san mar gheall ar a laighead, no toisc cóiríocht shláinte, aer, solus, no cóir eile do bheith in easnamh ann no ar aon réasún eile, agus gur deimhin leis an Aire go bhfuil an tigh comhnaithe ar a leithéid sin de staid gur fiú dul fé chostas a fheabhsuithe, féadfaidh an tAire, fé réir forálacha an Achta so agus fé réir rialachán a dhéanfaidh an tAire fé, deontas (dá ngairmtear deontas feabhsúcháin san Acht so) do dheona do shealbhaire an tighe chomhnaithe sin mar chabhair chun an tigh comhnaithe sin do chur i bhfeabhas no i méid.
Deontaisí i gcóir cróite cearc,
4.—(1) Más rud é, maidir le tigh comhnaithe sa Ghaeltacht—
(a) ná beidh aon chóiríocht d'éanlaithe clóis ag gabháil leis,
no
(b) go mbeidh cóiríocht d'éanlaithe clóis ag gabháil leis, ach gurb é tuairim an Aire go bhfuil an chóiríocht san neamh-oiriúnach ar fad no nách leor í,
féadfaidh an tAire, fé réir forálacha an Achta so agus fé réir rialachán a dhéanfaidh an tAire fé, deontas (dá ngairmtear san Acht so deontas chun cró cearc do thógáil) do dheona do shealbhaire an tighe chomhnaithe sin, mar chabhair chun cóiríocht d'éanlaithe clóis do chur suas a bheidh ag gabháil leis an tigh comhnaithe sin, agus a bheidh, i gcás aon chóiríocht den tsort san do bheith ann cheana, in ionad na cóiríochta san.
(2) Má sé tuairim an Aire nách oiriúnach no nách leor an chóiríocht d'éanlaithe clóis atá ag gabháil le tigh comhnaithe sa Ghaeltacht agus gur deimhin leis an Aire aon déanmhas ina bhfuil an chóiríocht san do bheith ar a leithéid sin de staid gur fiú dul fé chostas a fheabhsuithe, féadfaidh an tAire, fé réir forálacha an Achta so agus fé réir rialachán a dhéanfaidh an tAire fé, deontas (dá ngairmtear san Acht so deontas chun cró cearc d'fheabhsú) do dheona do shealbhaire an tighe chomhnaithe sin mar chabhair chun an chóiríocht san do chur i bhfeabhas no i méid.
(3) Má ceaduítear deontas tógála fén Acht so féadfaidh an tAire, fé réir forálacha an Achta so agus fé réir rialachán a dhéanfaidh an tAire fé, deontas (a foluítear san Acht so san abairt deontas chun cró cearc do thógáil) do dheona, don té gur ceaduíodh an deontas tógála san do, mar chabhair chun cóiríocht d'éanlaithe clóis do chur suas no deontas (a foluítear san Acht so san abairt deontas chun cró cearc d'fheabhsú) do dheona dho mar chabhair chun cóiríocht d'éanlaithe clóis do chur i bhfeabhas no i méid a bheidh ag gabháil leis an tigh comhnaithe gur mar chabhair chun é thógáil do ceaduíodh an deontas tógála san.
Deontaisí i gcóir cróite muc.
5.—(1) Más rud é, maidir le tigh comhnaithe sa Ghaeltacht—
(a) ná beidh aon chóiríocht do mhuca ag gabháil leis, no
(b) go mbeidh cóiríocht do mhuca ag gabháil leis ach gurb é tuairim an Aire go bhfuil an chóiríocht san neamhoiriúnach ar fad no nách leor í,
féadfaidh an tAire, fé réir forálacha an Achta so agus fé réir rialachán a dhéanfaidh an tAire fé, deontas (dá ngairmtear san Acht so deontas chun cró muc do thógáil) do dheona do shealbhaire an tighe chomhnaithe sin mar chabhair chun cóiríocht do mhuca do chur suas a bheidh ag gabháil leis an tigh comhnaithe sin agus a bheidh, i gcás aon chóiríocht den tsort san do bheith ann cheana, in ionad na cóiríochta san.
(2) Má sé tuairim an Aire nách oiriúnach no nách leor an chóiríocht do mhuca atá ag gabháil le tigh comhnaithe sa Ghaeltacht agus gur deimhin leis an Aire aon déanmhas ina bhfuil an chóiríocht san do bheith ar a leithéid sin de staid gur fiú dul fé chostas a fheabhsuithe, féadfaidh an tAire, fé réir forálacha an Achta so agus fé réir rialachán a dhéanfaidh an tAire fé, deontas (dá ngairmtear san Acht so deontas chun cró muc d'fheabhsú) do dheona do shealbhaire an tighe chomhnaithe sin mar chabhair chun an chóiríocht san do chur i bhfeabhas no i méid.
(3) Má ceaduítear deontas tógála fén Acht so féadfaidh an tAire, fé réir forálacha an Achta so agus fé réir rialachán a dhéanfaidh an tAire fé, deontas (a foluítear san Acht so san abairt deontas chun cró muc do thógáil) do dheona, don té gur ceaduíodh an deontas tógála san do, mar chabhair chun cóiríocht do mhuca do chur suas no deontas (a foluítear san Acht so san abairt deontas chun cró muc d'fheabhsú) do dheona dho mar chabhair chun cóiríocht do mhuca do chur i bhfeabhas no i méid a bheidh ag gabháil leis an tigh comhnaithe gur mar chabhair chun é thógáil do ceaduíodh an deontas tógála san.
Forálacha generálta i dtaobh deontaisí.
6.—(1) Is chun oifigeach orduithe an Aire a cuirfear gach iarratas ag lorg deontais fén Acht so agus is sa bhfuirm agus sa tslí orduithe a déanfar é agus luadhfar ann na mion-innste orduithe ar neach iarrtha an deontais, ar an tigh comhnaithe gur ina chóir a bheidh an deontas á iarraidh agus ar an obair a bheidh beartuithe do dhéanamh le congnamh an deontais.
(2) Féadfar deontas a deonfar fén Acht so d'íoc in aon tsuim amháin no ina choda fé mar a mheasfaidh an tAire is ceart i ngach cás agus féadfaidh an tAire a chur mar choiníoll go ndéanfar, roimh aon deontas den tsort san no aon chuid áirithe dhe d'íoc, a thaisbeáint chun a shástachta gur dineadh an obair no cuid áirithe den obair gur mar chabhair chúichi a deonadh an deontas.
(3) Má deontar deontas tógála, deontas chun cró cearc do thógáil, no deontas chun cró muc do thógáil, mar chabhair chun tigh nua comhnaithe no cóiríocht nua do chur suas in ionad tighe chomhnaithe no cóiríochta bheidh ann cheana, tuigfear, mara n-orduighidh an tAire a mhalairt, gur cuid den obair gur mar chabhair chúichi a deontar an deontas an tigh comhnaithe no an chóiríocht san a bheidh ann cheana do leaga.
(4) Pé uair a ceadófar deontas do dheona do dhuine fén Acht so no a dheimhneoidh an tAire gur féidir iasacht do thabhairt do dhuine fén Acht so agus do gheobhaidh an duine sin bás sara n-íoctar suim an deontais no na hiasachta san leis, féadfaidh an tAire duine ar bith eile is oiriúnach leis do cheapa chun an deontas no an iasacht san no a mbeidh gan íoc an uair sin de do ghlaca fé réir pé coiníollacha is oirúnach leis an Aire d'fhorchur agus nuair a déanfar aon cheapa den tsort san amhlaidh beidh an deontas no an iasacht le n-a mbaineann an ceapa, no a mbeidh gan íoc de, iníoctha fén Acht so leis an té do ceapadh amhlaidh ar gach slí díreach mar do bheadh san iníoctha leis an gcéad duine sin a luaidhtear dá mba ná fuigheadh sé bás.
Srian le deontaisí do dheona.
7.—(1) Ní deonfar deontas tógála ná deontas feabhsúcháin ar bith fén Acht so i gcóir tighe chomhnaithe 'na mbeidh deontas á dheona ina chóir, no 'nar deonadh deontas ina chóir aon uair laistigh de sheacht mbliana roimh an Acht so do rith, as airgead puiblí fé aon Acht eile den Oireachtas no fé aon reacht Briotáineach.
(2) Ní deonfar deontas tógála ná deontas feabhsúcháin ar bith fén Acht so mar chabhair chun tigh comhnaithe do chur suas no do chur i bhfeabhas no i méid (pe'ca aca é) maran rud é—
(a) go mbeidh ann cheana, no go soláthrófar le congnamh deontais fén Acht so no ar shlí eile, cóiríocht d'éanlaithe clóis a bheidh ag gabháil leis an tigh comhnaithe sin agus is oiriúnach agus is leor do do réir tuairim an Aire, no
(b) gurb é tuairim an Aire, ag féachaint do gach taobh den scéal, nár cheart bheith ag súil le héanlaithe clóis do bheith ag sealbhaire an tighe chomhnaithe sin.
(3) Ní deonfar deontas tógála ná deontas feabhsúcháin ar bith fén Acht so maran rud é—
(a) go mbeidh ann cheana, no go soláthrófar le congnamh deontais fén Acht so no ar shlí eile, cóiríocht do mhuca bheidh ag gabháil leis an tigh comhnaithe sin agus is oiriúnach agus is leor do do réir tuairim an Aire, no
(b) gurb é tuairim an Aire, ag féachaint do gach taobh den scéal, nár cheart bheith ag súil le muca do bheith ag sealbhaire an tighe chomhnaithe sin.
Iasachtaí i dteanta deontaisí.
8.—(1) Pé uair is deimhin leis an Aire go bhfuil an scéal ar a leithéid sin de chuma ag duine dar dheon sé deontas fén Acht so nách féidir do, gan a thuille congnamh airgid, an obair do dhéanamh gur mar chabhair chúichi a tugadh an deontas san do féadfaidh an tAire, fé réir forálacha an Achta so agus fé réir rialachán a déanfar fé, deimhniú sa bhfuirm orduithe do thabhairt amach do sna Coimisinéirí á rá gur féidir iasacht suime nách mó ná méid an deontais sin do dheona don duine sin fén Acht so, pé suim is dó leis an Aire is ceart agus a luadhfa sé sa deimhniú san.
(2) Pé uair a dhéanfaidh an tAire deimhniú do thabhairt amach do sna Coimisinéirí fén bhfo-alt san roimhe seo, déanfaidh na Coimisinéirí, fé réir forálacha an Achta so agus fé réir rialachán a dhéanfaidh an tAire Airgid fén alt so, an méid a bheidh luaidhte sa deimhniú san do thabhairt ar iasacht don té bheidh ainmnithe sa deimhniú san agus beidh an iasacht san ionaisíoctha leis na Coimisinéirí do réir na rialachán san, maraon le hús do réir pé ráta a shocróidh an tAire Airgid.
(3) Féadfaidh an tAire Airgid rialacháin do dhéanamh i dtaobh gach ní no éinní acu so leanas, sé sin le rá:—
(a) iasachtaí a tabharfar fén alt so do thabhairt amach, rud le n-a n-áirítear na hiasachtaí sin do thabhairt amach in aon tsuim amháin no i gcoda;
(b) orduithe muirir do dhéanamh agus fuirm na n-orduithe sin;
(c) na hiasachtaí sin d'aisíoc, rud le n-a n-áirítear an tráth no na trátha agus na coda ina ndéanfar an t-aisíoc san;
(d) coiníollacha chun a chur in áirithe gur chun na gcrícheanna chun a dtabharfar iad a cuirfear na hiasachtaí sin.
Orduithe muirir i dtaobh iasachtaí.
9.—(1) Pé uair a thabharfaidh na Coimisinéirí iasacht uatha fén Acht so déanfaid, sara roimh-íocfaid aon chuid den iasacht san, ordú (dá ngairmtear ordú muirir san alt so) do réir rialachán a dhéanfaidh an tAire Airgid fén Acht so, ag cur méid na hiasachta san, agus an úis uirthi, mar mhuirear ar an tigh comhnaithe gur ina chóir a beifear ar aigne an iasacht do thabhairt agus ar gach áitreabh a bheidh ar seilbh ina theanta do réir na sealbhaíochta céanna no fén tionóntacht chéanna, agus oibreoidh gach ordú den tsort san chun an iasacht san, fé mar agus nuair a roimh-íocfar í, agus an t-ús san do mhuirearú ar an tigh comhnaithe sin agus ar na háitreabhacha eile sin i bhfabhar do sna Coimisinéirí agus i dtosach ar gach muirear agus eire eile, reachtúil no eile, ach amháin cíos no ní eile bhaineann le sealbhaíocht agus suimeanna is iníoctha, fé sna hAchtanna Talamh-Cheannaigh no ar shlí eile, le Coimisiún Talmhan na hÉireann.
(2) Tuigfear ordú muirir do bheith ina mhorgáiste ar n-a dhéanamh tré dhintiuir do réir bhrí na Conveyancing Acts, 1881 to 1911, agus isiad na Coimisinéirí bheidh mar mhorgáistithe chun crícheanna na nAcht san agus beidh acu dá réir sin, maidir le gach ordú muirir, na comhachta uile bronntar leis na hAchtanna san ar mhorgáistithe fé mhorgáistí dintear tré dhintiuir.
(3) Pé uair a dhéanfaidh na Coimisinéirí ordú muirir déanfaid láithreach a chur fé ndeár an t-ordú san do chlárú in Oifig Chlárathachta na nDintiuirí no in Oifig Chlárathachta na Talmhan (pe'ca aca is gá sa chás) agus ní bheidh aon táille ná éileamh eile iníoctha ar son ná i dtaobh an chláruithe sin.
(4) Beidh ordú muirir a dhineann deifir do thalamh a bheidh cláruithe in Oifig Chlárathachta na Talmhan ionchláruithe san Oifig sin mar ualach a dhineann deifir don talamh san is cuma an té bheidh ainmnithe san ordú san mar únaer no mar shealbhaire an talaimh sin, no mar ghlacadóir na hiasachta le n-a mbaineann an t-ordú san, do bheith cláruithe san Oifig sin mar únaer an talaimh sin no gan a bheith.
(5) Nuair a dhéanfaidh Coimisiún Talmhan na hÉireann, fé aon chomhacht reachtúil a bheidh dílsithe ionta chuige sin, talamh no tionóntacht i dtalamh do chur in áirde agus a bheidh an talamh no an tionóntacht san fé réir orduithe mhuirir, díolfar an talamh no an tionóntacht san fé réir an mhuirir do cruthnuíodh leis an ordú muirir sin maraon le haon mhuirear, eire, no fiachas eile gur gá do réir dlí an talamh no an tionóntacht san do dhíol fé n-a réir.
Iasachtaí do bhaint amach.
10.—(1) An méid a bheidh dlite agus ag dul do sna Coimisinéirí de thurus na huaire pe'ca ar son colna no úis é, ar scór orduithe mhuirir, beidh sé ina fhiacha síbhialta bheidh ag na Coimisinéirí ar an té is sealbhaire de thurus na huaire ar an áitreabh a bheidh fé mhuirear ag an ordú muirir sin agus féadfaidh na Coimisinéirí (i dteanta aon tslí eile chun é bhaint amach) é bhaint den tsealbhaire sin dá réir sin in aon chúirt dlighinse inniúla gan dochar do cheart an tsealbhaire sin, nuair nách é an duine dar tugadh an iasacht é, i gcoinnibh an duine sin.
(2) In aon imeachta bhunóidh na Coimisinéirí fén alt so no ar shlí eile in aon chúirt dlí chun an méid no aon chuid den mhéid a bheidh dlite, pe'ca ar son colna no úis é, ar scór orduithe mhuirir do bhaint amach beidh deimhniú dheabhróidh bheith séaluithe le séala na gCoimisinéirí agus bheith ag deimhniú an mhéide bheidh dlite ar scór an orduithe mhuirir sin ina fhianaise, go dtí go gcruthófar a mhalairt, ar an méid a bheidh á dheimhniú amhlaidh do bheith dlite agus ag dul do sna Coimisinéirí.
Teoranta le méideanna na ndeontas agus na n-iasacht.
11.—(1) Ní raghaidh méid iomlán na ndeontas agus na n-iasacht a tabharfar fén Acht so thar suim dhá chéad go leith míle punt.
(2) Ní raghaidh méid aon deontais aonair a deonfar fén Acht so—
(a) thar suim cheithre fichid punt i gcás deontais thógála, ná
(b) thar suim dachad punt i gcás deontais fheabhsúcháin, ná
(c) thar suim cúig bpunt i gcás deontais chun cró cearc do thógáil no deontais chun cró muc do thógáil, ná
(d) thar suim dhá phunt agus deich scillinge i gcás deontais chun cró cearc d'fheabhsú no deontais chun cró muc d'fheabhsú.
(3) Ag deona deontaisí tógála agus deontaisí feabhsúcháin do tabharfaidh an tAire tosach do shealbhairí tithe comhnaithe ina mbíonn an Ghaedhilg mar theangain teaghlaigh ag an líntighe do ghnáth agus, imeasc sealbhairí a leithéidí sin de thithe comhnaithe, tabharfaidh an tAire tosach do shealbhairí na dtithe comhnaithe is cumhainge dá líon agus is mí-fholláine agus is ísle luacháil fé sna hAchtanna Luachála.
(4) Sa mhéid gur féidir é, ag féachaint don líon agus don mhéid in áiteanna fé leith de chásanna ina bhfeicfear don Aire gur ceart deontaisí do dheona fén Acht so agus do sna forálacha san roimhe seo den alt so, déanfar trí chúigiú ar a laighead den airgead a bheidh ar fáil chun deontaisí do dheona fén Acht so do chur chun deontaisí do dheona do shealbhairí tithe comhnaithe atá suidhte i dtogha-ranna ceanntair sa Ghaeltacht ina bhfaighfí suim nár mhó ná scilling is fiche de thora as luacháil na n-ionoighreachtaí uile sa togha-roinn cheanntair fé sna hAchtanna Luachála (lasmuich d'ionoighreachtaí is fiú níos mó ná fiche punt do réir luachála) do roinnt ar an méid daoine bhí sa togha-roinn cheanntair do réir mhoráireamh 1926.
Socrú chun có-cheannach do dhéanamh.
12.—(1) Más oiriúnach agus sa mhéid gur oiriúnach leis san do dhéanamh féadfaidh an tAire, le toiliú an Aire Airgid, socrú do dhéanamh chun a chur in usacht do dhaoine dá ndeonfar deontaisí fén Acht so abhair agus feistisí do cheannach a theastóidh uatha chun na hoibreacha do dhéanamh gur mar chabhair chúcha a deonfar na deontaisí sin.
(2) Pé uair is dó leis an Aire go bhfuil ana-dheacracht ag gabháil le haol no gainimh no iasacht scafaill agus ghléasra eile d'fháil agus go gcuireann san cosc no bac le hoibreacha do dhéanamh gur dineadh, no go mbeifear ar aigne, deontaisí no iasachtaí fén Acht so do cheadú mar chabhair chúcha, féadfaidh an tAire, le toiliú an Aire Airgid, pé socrú do dhéanamh a mheasfa sé, leis an toiliú roimhráite, do bheith ceart chun aol no gainimh no iasacht scafaill no ghléasra eile do chur ar fáil no chun a chur in usacht iad d'fháil (pe'ca is gá sa chás) ar fhiacha réasúnta.
Faoiseamh o rátaí.
13.—(1) Chun aon ráta do mheas agus do ghearra a chruinneoidh údarás áitiúil chun seirbhíse aon bhliana airgeadais áitiúla chríochnóidh laistigh d'fhiche bliain o chríochnú aon oibre gur deonadh deontas fén Acht so mar chabhair chun a déanta, tuigfidh an t-údarás áitiúil sin gurb é an luacháil fé sna hAchtanna Luachála atá ar an tigh comhnaithe gur mar chabhair chun é do chur suas, do chur i bhfeabhas no do chur i méid a deonadh an deontas san no le n-a ngabhann an cró cearc no an cró muc gur mar chabhair chun é do chur suas, do chur i bhfeabhas no do chur i méid a deonadh an deontas san ná an luacháil do bhí i bhfeidhm don tigh comhnaithe sin, no don tigh comhnaithe 'nar cuireadh an tigh comhnaithe sin ina ionad, díreach roimh thosach na hoibre sin.
(2) San alt so cialluíonn agus foluíonn an abairt “údarás áitiúil” comhairle chontae, comhairle chontae-bhuirge no bhuirge eile, comhairle bhailecheanntair, agus coimisinéirí baile.
Dul i gcomhairle leis an Aire Talmhaíochta.
14.—Ní dhéanfaidh an tAire aon chomhacht d'fheidhmiú ná éinní do chinne ná teacht ar aon tuairim fén Acht so, maidir le cóiríocht d'éanlaithe clóis no do mhuca, gan dul i gcomhairle leis an Aire Talmhaíochta ina thaobh roimh ré.
Airgeadas.
15.—(1) Is amach as airgead a sholáthróidh an tOireachtas a tabharfar gach deontas agus iasacht a tabharfar fén Acht so.
(2) Sa mhéid go gceadóidh an tAire Airgid é, is amach as airgead a sholáthróidh an tOireachtas a híocfar gach costas fé n-a raghfar ag cur an Achta so i bhfeidhm.
Rialacháin.
16.—(1) Féadfaidh an tAire, tré rialacháin a déanfar fén Acht so le toiliú an Aire Airgid, gach ní no éinní acu so leanas d'ordú, sé sin le rá:—
(a) crot agus déanmhas tithe comhnaithe, cróite cearc, agus cróite muc go ndeonfar deontaisí fén Acht so mar chabhair chun a gcurtha suas, agus na coiníollacha cólíonfar maidir le hionad agus le haghaidh na dtithe comhnaithe, na gcróite cearc agus na gcróite muc san;
(b) cineál, carachtar, agus méid na n-oibreacha déanfar le congnamh na ndeontas so fé seach: deontaisí feabhsúcháin, deontaisí chun cróite cearc d'fheabhsú, agus deontaisí chun cróite muc d'fheabhsú;
(c) na habhair a húsáidfear ag déanamh oibreacha (pe'ca cur-suas, feabhsú no méadú iad) chun a ndeonfar deontaisí fén Acht so;
(d) coiníollacha chun a chur in áirithe gur chun na gcrícheanna chun a ndeonfar deontaisí fén Acht so a cuirfear iad;
(e) coiníollacha bhainfidh le deontaisí d'íoc fén Acht so agus go sonnrách an fhianaise tabharfar roimh aon deontas den tsort san no aon chuid áirithe dhe d'íoc;
(f) sa mhéid ná foráltar san ar shlí eile leis an Acht so, an saghas cáis ina bhféadfaidh agus na coiníollacha ar a bhféadfaidh an tAire deontaisí do dheona agus deimhnithe i gcóir iasachtaí do thabhairt amach fén Acht so;
(g) éinní no aon rud dá dtagartar san Acht so mar ní no mar rud atá orduithe no le hordú.
(2) Na forálacha d'aon Acht áitiúil no d'aon fho-dhlithe, rialacha, rialacháin, no scéim, pé údarás fé n-ar dineadh iad, i dtaobh foirgintí nua no sráideanna nua do dhéanamh, do leaga amach, no do dhréineáil, sa mhéid go mbeid buiniscionn le rialachán a dhéanfaidh an tAire fén Acht so ní bhainfidh na forálacha san le tigh le n-a mbainfidh an rialachán san agus a bheidh do réir an rialacháin sin.
(3) Gach rialachán a dhéanfaidh an tAire fén Acht so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a dhéanta, agus má dhineann ceachtar Tigh acu san, laistigh den lá is fiche shuidhfidh an Tigh sin tar éis an rialachán san do leaga fé n-a bhráid, rún do rith ag cur an rialacháin sin i nea-mbrí, beidh an rialachán san curtha i nea-mbrí dá réir sin ach beidh san gan dochar do dhleathacht éinní do dineadh roimhe sin fén rialachán san.

Definitions.
1.—In this Act—
the expression “the Minister” means the Minister for Lands and Fisheries;
the expression “the Commissioners” means the Commissioners of Public Works in Ireland;
the word “family” when used in relation to the occupier of a dwelling-house means and includes all persons usually residing in such dwelling-house with such occupier, whether related or not related by blood or marriage to such occupier;
the word “prescribed” means prescribed by regulations made by the Minister under this Act.
Extent of Gaeltacht.
2.—(1) For the purposes of this Act but no further or otherwise the Gaeltacht shall be deemed to comprise the several district electoral divisions mentioned in the Schedule to this Act.
(2) The Minister may by order, whenever he considers it expedient so to do on account of local variations in the numbers or distribution of Irish-speaking persons, amend the Schedule to this Act by adding thereto any district electoral division neither mentioned nor then included by amendment therein or deleting therefrom any district electoral division mentioned therein or previously added thereto, and whenever any such amendment of the said Schedule is so made this Act shall as respects grants under this Act sanctioned while such amendment is in operation and everything done in consequence of the making or sanctioning of any such grant be construed and have effect with and subject to such amendment.
(3) Every order made by the Minister under this section shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution is passed by either such House within the next subsequent twenty-one days on which that House has sat after such order is laid before it annulling such order, such order shall be annulled accordingly but without prejudice to the validity of anything previously done under such order.
Grants in relation to dwelling-houses.
3.—(1) Where, in the opinion of the Minister, a dwelling-house in the Gaeltacht is wholly unsuitable for the proper and healthy accommodation of the occupier thereof and his family, the Minister may, subject to the provisions of this Act and regulations made by the Minister thereunder, make to the occupier of such dwelling-house a grant (in this Act referred to as a building grant) towards the erection, on the site of such dwelling-house or on another site, of a new dwelling-house in substitution for such first-mentioned dwelling-house.
(2) Where, in the opinion of the Minister, a dwelling-house in the Gaeltacht is on account of its small size or its lack of sanitary accommodation, ventilation, light, or other amenity or for any other reason unsuitable in its existing condition for the proper and healthy accommodation of the occupier thereof and his family and the Minister is satisfied that the condition of the dwelling-house is such that the expense of improvement can be economically incurred, the Minister may, subject to the provisions of this Act and regulations made by the Minister thereunder, make to the occupier of such dwelling-house a grant (in this Act referred to as an improving grant) towards the improvement or extension of such dwelling-house.
Grants in relation to poultry-houses.
4.—(1) Where a dwelling-house in the Gaeltacht either—
(a) is not provided with any accommodation ancillary thereto for domestic poultry, or
(b) is provided with accommodation ancillary thereto for domestic poultry, but such accommodation is, in the opinion of the Minister, wholly unsuitable or insufficient,
the Minister may, subject to the provisions of this Act and regulations made by the Minister thereunder, make to the occupier of such dwelling-house a grant (in this Act referred to as a poultry-house building grant) towards the erection of accommodation for domestic poultry, ancillary to such dwelling-house and, where any such accommodation already exists, in substitution therefor.
(2) Where the accommodation for domestic poultry ancillary to a dwelling-house in the Gaeltacht is, in the opinion of the Minister, unsuitable or insufficient, and the Minister is satisfied that the state of any structure providing such accommodation is such that the expense of improvement can be economically incurred, the Minister may, subject to the provisions of this Act and regulations made by the Minister thereunder, make to the occupier of such dwelling-house a grant (in this Act referred to as a poultry-house improving grant) towards the improvement or extension of such accommodation.
(3) Where a building grant has been sanctioned under this Act, the Minister may, subject to the provisions of this Act and regulations made by the Minister thereunder, make to the person to whom such building grant has been sanctioned either a grant (in this Act included in the expression poultry-house building grant) towards the erection of accommodation for domestic poultry or a grant (in this Act included in the expression poultry-house improving grant) towards the improvement or extension of accommodation for domestic poultry, ancillary to the dwelling-house towards the erection of which such building grant was sanctioned.
Grants in relation to piggeries.
5.—(1) Where a dwelling-house in the Gaeltacht either—
(a) is not provided with any accommodation ancillary thereto for pigs, or
(b) is provided with accommodation ancillary thereto for pigs but such accommodation is, in the opinion of the Minister, wholly unsuitable or insufficient,
the Minister may, subject to the provisions of this Act and regulations made by the Minister thereunder, make to the occupier of such dwelling-house a grant (in this Act referred to as a piggery building grant) towards the erection of accommodation for pigs, ancillary to such dwelling-house and, where any such accommodation already exists, in substitution therefor.
(2) Where the accommodation for pigs ancillary to a dwelling-house in the Gaeltacht is, in the opinion of the Minister, unsuitable or insufficient, and the Minister is satisfied that the state of any structure providing such accommodation is such that the expense of improvement can be economically incurred, the Minister may, subject to the provisions of this Act and regulations made by the Minister thereunder, make to the occupier of such dwelling-house a grant (in this Act referred to as a piggery improving grant) towards the improvement or extension of such accommodation.
(3) Where a building grant has been sanctioned under this Act, the Minister may, subject to the provisions of this Act and regulations made by the Minister thereunder, make to the person to whom such building grant has been sanctioned either a grant (in this Act included in the expression piggery building grant) towards the erection of accommodation for pigs, or a grant (in this Act included in the expression piggery improving grant) towards the improvement or extension of accommodation for pigs, ancillary to the dwelling-house towards the erection of which such building grant was sanctioned.
General provisions as to grants.
6.—(1) Every application for a grant under this Act shall be made to the prescribed officer of the Minister in the prescribed form and manner and shall state the prescribed particulars in relation to the person applying for the grant, the dwelling-house in respect of which the grant is applied for and the work proposed to be executed with the aid of the grant.
(2) A grant made under this Act may be paid in one instalment or in several instalments as the Minister shall in each case think proper and the Minister may require as a condition precedent to the payment of any such grant or any particular instalment thereof that it shall be shown to his satisfaction that the work towards which the grant was made or a specified proportion thereof has been executed.
(3) Where a building grant, a poultry-house building grant, or a piggery building grant is made towards the erection of a new dwelling-house or new accommodation in substitution for an existing dwelling-house or existing accommodation, the demolition of such existing dwelling-house or existing accommodation shall, unless the Minister otherwise directs, be deemed to be part of the work towards the execution of which the grant is made.
(4) Whenever the making of a grant to a person under this Act is sanctioned or the making of a loan to a person under this Act is certified for by the Minister and such person dies before the amount of such grant or such loan has been actually paid to him, the Minister may appoint any other person whom he may think fit to receive, subject to such conditions as the Minister may think fit to impose, such grant or loan or so much thereof as is then unpaid, and when any such appointment is so made, the grant or loan to which the appointment relates or the unpaid portion thereof shall be payable under this Act to the person so appointed in like manner in all respects as the same would have been payable to such first-mentioned person if he had not died.
Restriction on the making of grants.
7.—(1) No building grant or improving grant shall be made under this Act in respect of a dwelling-house in respect of which a grant out of public moneys is being or has at any time within seven years before the passing of this Act been made under any other Act of the Oireachtas or any British statute.
(2) No building grant or improving grant shall be made under this Act towards the erection or the improvement or extension (as the case may be) of a dwelling-house unless either—
(a) there is in existence or will be provided with the aid of a grant under this Act or otherwise accommodation for domestic poultry ancillary to and suitable and sufficient in the opinion of the Minister for such dwelling-house, or
(b) the Minister is of opinion that, having regard to all the circumstances, the occupier of such dwelling-house could not be expected to keep domestic poultry.
(3) No building grant or improving grant shall be made under this Act unless either—
(a) there is in existence or will be provided with the aid of a grant under this Act or otherwise accommodation for pigs ancillary to and suitable and sufficient in the opinion of the Minister for such dwelling-house, or
(b) the Minister is of opinion that, having regard to all the circumstances, the occupier of such dwelling-house could not be expected to keep pigs.
Loans in amplification of grants.
8.—(1) Whenever the Minister is satisfied that a person to whom he has made a grant under this Act is so circumstanced that he is not able to execute the work towards which such grant was made to him without further monetary assistance, the Minister may, subject to the provisions of this Act and regulations made thereunder, issue to the Commissioners a certificate in the prescribed form that such person may be granted a loan under this Act of such sum, not exceeding the amount of such grant, as the Minister shall think proper and shall specify in such certificate.
(2) Whenever the Minister issues to the Commissioners a certificate under the foregoing sub-section, the Commissioners shall, subject to the provisions of this Act and regulations made by the Minister for Finance under this section, make to the person named in such certificate a loan of the amount specified in such certificate and repayable to the Commissioners in accordance with the said regulations, with interest at such rate as may be fixed by the Minister for Finance.
(3) The Minister for Finance may make regulations in relation to all or any of the following matters, that is to say:—
(a) the issue of loans made under this section, including the issue of such loans in one or more instalments;
(b) the making of charging orders and the form of such orders;
(c) the repayment of such loans, including the time or times at which and the instalments in which such repayment is to be made;
(d) conditions for securing the due application of such loans to the purposes for which such loans are made.
Charging orders in relation to loans.
9.—(1) Whenever the Commissioners make a loan under this Act they shall, before actually advancing any portion of such loan, make an order (in this section referred to as a charging order) in accordance with regulations made by the Minister for Finance under this Act charging the amount of such loan and the interest thereon on the dwelling-house in relation to which the loan is intended to be made and on all premises held therewith by the same tenure or under the same tenancy, and every such order shall operate to charge the said loan as and when the same is actually advanced and the said interest on the said dwelling-house and other premises in favour of the Commissioners in priority to all other charges and incumbrances whether statutory or otherwise except rent or other incident of tenure and sums payable under the Land Purchase Acts or otherwise to the Irish Land Commission.
(2) A charging order shall be deemed to be a mortgage made by deed within the meaning of the Conveyancing Acts, 1881 to 1911, and the Commissioners shall be the mortgagees for the purposes of those Acts and shall accordingly have, in relation to every charging order, all the powers conferred by those Acts on mortgagees under mortgages made by deed.
(3) Whenever the Commissioners make a charging order they shall forthwith cause such order to be registered in the Registry of Deeds or the Land Registry (as the case may require) and no fee or other charge shall be payable for or in respect of such registration.
(4) A charging order affecting land registered in the Land Registry shall be registerable in that Registry as a burden affecting such land whether the person named in such order as the owner or the occupier of such land or as the recipient of the loan to which such order relates is or is not registered in the said Registry as the owner of such land.
(5) When land or a tenancy in land is put up for sale by the Irish Land Commission under any statutory power in that behalf vested in them, and such land or tenancy is subject to a charging order such land or tenancy shall be sold subject to the charge created by such charging order in addition to any other charge, incumbrance, or liability subject to which such land or tenancy is required by law to be sold.
Recovery of loans.
10.—(1) The amount for the time being due and owing, whether for principal or interest, to the Commissioners on foot of a charging order shall be a civil debt due to the Commissioners by the occupier for the time being of the premises charged by such charging order and shall (in addition to any other mode of recovery) be recoverable accordingly from such occupier by the Commissioners in any court of competent jurisdiction, without prejudice to the rights of such occupier, where he is not the person to whom the loan was made, against such person.
(2) In any proceedings by the Commissioners under this section or otherwise in any court of law to recover the amount or any part of the amount due, whether for principal or interest, on foot of a charging order, a certificate purporting to be sealed with the seal of the Commissioners and to certify the amount due on foot of such charging order shall, until the contrary is proved, be evidence that the amount so certified is so due and owing.
Limitations on the amounts of grants and loans.
11.—(1) The aggregate amount of the grants and loans to be made under this Act shall not exceed the sum of two hundred and fifty thousand pounds.
(2) The amount of an individual grant made under this Act shall not exceed—
(a) in the case of a building grant, the sum of eighty pounds, or
(b) in the case of an improving grant, the sum of forty pounds, or
(c) in the case of a poultry-house building grant or a piggery building grant, the sum of five pounds, or
(d) in the case of a poultry-house improving grant or a piggery improving grant, the sum of two pounds and ten shillings.
(3) In the making of building grants and improving grants the Minister shall give a preference to the occupiers of dwelling-houses in which the Irish language is habitually used as the home language of the household, and amongst occupiers of such dwelling-houses the Minister shall give a preference to the occupiers of dwelling-houses having the greater overcrowding, the worse sanitary conditions and the lower valuation under the Valuation Acts.
(4) So far as may be practicable having regard to the number and local distribution of the cases in which it appears to the Minister to be proper to make grants under this Act and to the foregoing provisions of this section, at least three-fifths of the moneys available for making grants under this Act shall be applied in making grants to occupiers of dwelling-houses situate in district electoral divisions in the Gaeltacht in which the valuation under the Valuation Acts of all hereditaments (other than hereditaments valued at more than twenty pounds) in the district electoral division when divided by the population of the district electoral division according to the census of 1926 yields a sum not exceeding twenty-one shillings.
Arrangements for joint purchasing.
12.—(1) The Minister may, if and so far as he thinks it expedient so to do, make, with the consent of the Minister for Finance, arrangements for facilitating the purchase by persons to whom grants are made under this Act of materials and fittings required by them for the execution of the works towards which such grants are made.
(2) Whenever the execution of works towards which grants or loans under this Act have been or are intended to be sanctioned is in the opinion of the Minister prevented or hindered by undue difficulty in obtaining supplies of lime or sand or the use of scaffolding and other plant the Minister may, with the consent of the Minister for Finance, make such arrangements as he with the consent aforesaid shall think proper for providing or facilitating the obtaining (as the circumstances may require) at reasonable prices supplies of lime or of sand or the use of scaffolding or other plant
Relief from rates.
13.—(1) For the purposes of the assessment and levying of any rate raised by a local authority for the service of any local financial year ending within twenty years from the completion of any work towards the execution of which a grant was made under this Act, the valuation under the Valuation Acts of the dwelling-house towards the erection, improvement or extension of which such grant was made or to which is ancillary the poultry-house or piggery towards the erection, improvement, or extension of which such grant was made shall be deemed by such local authority to be the valuation which was in force in respect of such dwelling-house or of the dwelling-house for which such dwelling-house was substituted immediately before the commencement of such work.
(2) In this section the expression “local authority” means and includes the council of a county, the council of a county or other borough, the council of an urban district, and the commissioners of a town.
Consultation with the Minister for Agriculture.
14.—The Minister shall not exercise any power, determine any matter, or form any opinion under this Act in relation to accommodation for domestic poultry or pigs without previously consulting the Minister for Agriculture in regard thereto.
Finance.
15.—(1) All grants and loans made under this Act shall be made out of moneys provided by the Oireachtas.
(2) All expenses incurred in the carrying of this Act into execution shall, to such extent as shall be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Regulations.
16.—(1) The Minister may by regulations made under this Act with the consent of the Minister for Finance prescribe all or any of the following matters, that is to say:—
(a) the design and construction of dwelling-houses, poultry-houses and piggeries towards the erection of which grants are made under this Act, and the conditions to be observed in regard to the site and aspect of such dwelling-houses, poultry-houses and piggeries;
(b) the nature, character, and extent of the works to be executed with the aid of improving grants, poultry-house improving grants, and piggery improving grants respectively;
(c) the materials to be used in the execution of works (whether erection, improvement, or extension) for which grants are made under this Act;
(d) conditions for securing the due application of grants under this Act to the purposes for which such grants are made;
(e) conditions governing the payment of grants under this Act and in particular the evidence to be furnished as a condition precedent to the payment of any such grant or any particular instalment thereof;
(f) so far as not otherwise provided by this Act the circumstances in which and conditions on which grants may be made and certificates for loans may be issued by the Minister under this Act;
(g) any matter or thing referred to in this Act as prescribed or to be prescribed.
(2) In so far as the provisions of any local Act or of any bye-laws, rules, regulations, or scheme, under whatever authority made, relating to the construction, laying-out, or drainage of new buildings or new streets are inconsistent with a regulation made by the Minister under this Act, those provisions shall not apply to a house to which such regulation applies and which complies with such regulation.
(3) Every regulation made by the Minister under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution is passed by either such House within the next subsequent twenty-one days on which that House has sat after such regulation is laid before it annulling such regulation such regulation shall be annulled accordingly but without prejudice to the validity of anything previously done under such regulation.
Short title.
17.—This Act may be cited as the Housing (Gaeltacht) Act, 1929.
