AN tACHT AERIOMPAIR, 1986

ACHTAÍTEAR AG AN OIREACHTAS MAR A LEANAS:
Mínithe.
1.—San Acht seo—
ciallaíonn “Acht 1965” an tAcht Aerloingseoireachta agus Aeriompair, 1965;
ciallaíonn “aeriompróir lena mbaineann an tAcht seo” duine—
(a) a oibríonn aersheirbhís de chineál atá údaraithe de thuras na huaire faoi alt 7 d'Acht 1965, nó
(b) a bhfuil údarás faoi alt 8 d'Acht 1965 ar údarás é atá i bhfeidhm de thuras na huaire deonaithe dó;
ciallaíonn “taraif aerlíne” na táillí, na rátaí nó na muirir eile is iníoctha le haeriompróir, nó arna ndéanamh ag aeriompróir, lena mbaineann an tAcht seo, nó le hidirghabhálaí, nó ag idirghabhálaí, lena mbaineann alt 6 den Acht seo, maidir le paisinéirí (bíodh bagáiste acu nó ná bíodh), post nó lasta eile a iompar d'aer agus na coinníollacha (lena n-áirítear, go háirithe, coinníollacha maidir le gníomhaireacht nó seirbhísí cumhalda eile) nó na téarmaí eile ar dá réir nó faoina réir a bheidh na muirir sin le híoc nó le déanamh.

2.—Baineann an tAcht seo le haon táille, ráta nó muirear eile, téarma nó coinníoll atá ar áireamh i dtaraif aerlíne is taraif aerlíne lena mbaineann fógra faoi alt 3 den Acht seo a bhfuil feidhm aige de thuras na huaire.
Fógra ag ceangal sonraí a thabhairt i dtaobh taraifí aerlíne beartaithe.
3.—(1) (a) Féadfaidh an tAire, trí fhógra i scríbhinn a thabhairt d'aeriompróir lena mbaineann an tAcht seo, a cheangal ar an iompróir sin fad a fhanfaidh an fógra i bhfeidhm, sonraí i dtaobh aon taraife aerlíne a bheartaíonn an t-aeriompróir sin a chur i bhfeidhm, is taraif aerlíne lena mbaineann an fógra, a chur nó a chur faoi deara iad a chur thar a cheann, i scríbhinn agus roimh fheidhmiú na taraife sin, faoi bhráid an Aire.
(b) I gcás go dtabharfar fógra faoin alt seo, ansin, fad a fhanfaidh an fógra i bhfeidhm, comhlíonfaidh an duine dá dtabharfar é ceanglais an fhógra.
(2) I gcás go gcuirfear taraif aerlíne faoi bhráid an Aire de bhun ceanglas fógra faoin alt seo, féadfaidh an tAire an taraif, nó aon ní ar áireamh inti a cheadú, fara nó in éagmais modhnú, nó féadfaidh sé diúltú an taraif, nó aon ní ar áireamh amhlaidh, a cheadú: ar choinníoll nach ndéanfaidh an tAire cinneadh faoin alt seo i ndáil leis an taraif aerlíne roimh an lá atá lá is fiche tar éis an lae a dtaifeadfar sonraí i dtaobh na taraife aerlíne sa chlár de bhun alt 5 den Acht seo, nó roimh an lá díreach tar éis dheireadh na tréimhse a shonraítear san fhógra cuí faoi fho-alt (4) den alt seo, cibé acu is déanaí.
(3) Le linn don Aire taraif aerlíne a chuirfear faoina bhráid faoin alt seo a mheas déanfaidh sé, chomh maith le haird a thabhairt ar leasanna an aeriompróra a dhéanfaidh, nó ar thar a cheann a dhéanfar, an cur-faoi-bhráid, aird a thabhairt—
(a) ar leasanna réasúnacha—
(i) na n-aeriompróirí eile lena mbaineann an tAcht seo, agus
(ii) na ndaoine a mheasfaidh sé a úsáidfidh an tseirbhís phaisinéara, nó an tseirbhís phoist nó an tseirbhís lasta eile, de réir mar is iomchuí, lena mbainfidh an taraif aerlíne bheartaithe,
(b) ar an méid a d'fhéadfadh an tionscal turasóireachta dul chun leasa don eacnamaíocht mar gheall ar tharaifí aerlíne a sholáthar (faoi réir an riachtanais tionscal aeriompair a chothabháil) atá iomaíoch ó thaobh na dtáillí, na rátaí nó na muirear eile agus na dtéarmaí agus na gcoinníollacha is infheidhme,
(c) ag féachaint go háirithe do leas an phobail, ar an ngá atá le leanúnachas, réimse, minicíocht agus caighdeán gach ní, nó aon ní, díobh seo a leanas a chothabháil, is é sin le rá, aersheirbhísí áirithe go dtí an Stát, ón Stát nó laistigh de, aersheirbhísí den sórt sin i gcoitinne nó saoráidí aerfoirt a ghabhann le haersheirbhísí den sórt sin,
(d) ar aon uiríll nó agóidí maidir leis an taraif aerlíne a dhéanfar chuige laistigh den tréimhse a luaitear i bhfo-alt (2) den alt seo (agus údaraítear leis seo na huiríll agus na hagóidí sin a dhéanamh), agus
(e) ar aon chomhaontú aeriompair nó aon chomhaontú idirnáisiúnta eile atá i bhfeidhm de thuras na huaire agus ar páirtí ann an Stát.
(4) Más rud é go mbeartóidh an tAire faoin alt seo taraif aerlíne a cheadú fara modhnuithe, nó diúltú í a cheadú, tabharfaidh sé don aeriompróir nó don duine eile óna bhfuarthas an cur-faoi-bhráid cuí faoin alt seo, fógra i scríbhinn faoina bhfuil beartaithe aige agus faoi na cúiseanna leis sin agus luafar san fhógra go bhféadfaidh an t-aeriompróir sin, laistigh de cibé tréimhse, dar tús dáta an fhógra, a shonrófar san fhógra (is tréimhse nach giorra ná seacht lá), uiríll agus agóidí a dhéanamh chuig an Aire maidir leis an diúltú nó an modhnú atá beartaithe (agus údaraítear leis seo na huiríll agus na hagóidí sin a dhéanamh).
(5) Féadfaidh fógra faoin alt seo a bheith bainteach le taraifí aerlíne i gcoitinne nó le cibé taraifí ar d'aicme nó de thuairisc iad a shonrófar san fhógra agus, in aon chás ina mbeidh fógra den sórt sin bainteach le taraifí aerlíne d'aicme nó de thuairisc a bheidh sonraithe amhlaidh, tabharfar an fógra do gach aeriompróir lena mbaineann an tAcht seo a chuireann taraifí aerlíne den aicme nó den tuairisc sin i bhfeidhm nó a bheartaíonn iad a chur i bhfeidhm.
(6) Fanfaidh fógra faoin alt seo i bhfeidhm go dtí go dtarraingeoidh an tAire siar é le fógra i scríbhinn.
Ordú sealadach fad a bheifear ag fanacht le cinneadh faoi alt 3.
4.—(1) I gcás go gcuirfidh aeriompróir taraif aerlíne faoi bhráid an Aire, nó go gcuirfear faoi bhráid an Aire thar a cheann í, de bhun alt 3 den Acht seo, féadfaidh an tAire ordú a thabhairt faoin alt seo i leith an aeriompróra sin don duine óna bhfuarthas an cur-faoi-bhráid á thoirmeasc ar an aeriompróir sin an taraif a chur i bhfeidhm (cibé acu go díreach nó trí ghníomhaire) nó, de réir mar a shonrófar san ordú, aon cheann nó níos mó de na táillí, de na rátaí nó de na muirir eile, de na téarmaí nó de na coinníollacha a bheidh ar áireamh i dtaraif den sórt sin agus sonraithe amhlaidh a bhailiú, a mhuirearú, a dhéanamh, a chur i bhfeidhm nó a fhorchur, agus tiocfaidh ordú den sórt sin i bhfeidhm ar dhul in éag don tréimhse seacht lá dar tús an lá a sheolfaidh an tAire cóip den ordú mura rud é, tráth nach déanaí ná an seachtú lá tar éis an lae a sheolfar amhlaidh cóip den sórt sin, go suífidh an duine óna bhfuarthas an cur-faoi-bhráid don Aire nach ceart don ordú teacht i bhfeidhm.
(2) I gcás go seolfaidh an tAire cóip d'ordú taoin alt seo, seolfaidh an tAire, an tráth céanna, fógra i scríbhinn chuig an duine óna bhfuarthas an cur-faoi-bhráid cuí faoin alt seo á rá go bhféadfaidh an t-aeriompróir lena mbaineann, laistigh den teorainn ama a shonraítear i bhfo-alt (1) den alt seo, uiríll a dhéanamh chuig an Aire á rá cad ina thaobh nach ceart don ordú teacht i bhfeidhm.
(3) Fanfaidh ordú faoin alt seo i bhfeidhm go dtí deireadh na tréimhse ocht lá is fiche dar tús an lá a thabharfar é nó go dtí go ndéanfaidh an tAire cinneadh faoi alt 3 den Acht seo maidir leis an taraif aerlíne chuí, cibé acu sin is túisce a tharlóidh.
(4) Féadfaidh an tAire, trí fhógra i scríbhinn a thabharfar don duine óna bhfuarthas an cur-faoi-bhráid cuí faoin alt seo, an tréimhse a bhfanfaidh ordú áirithe faoin alt seo i bhfeidhm lena linn a fhadú nó a fhadú tuilleadh go ceann tréimhse nach faide ná ocht lá is fiche i gceachtar cás.
An clár.
5.—(1) Coimeádfaidh an tAire clár (dá ngairtear “an clár” san Acht seo) chun críocha an Achta seo agus, a luaithe is féidir, taifeadfaidh sé sonraí ann i dtaobh na nithe seo a leanas—
(a) aon iarratas chuig an Aire ó aeriompróir nó thar a cheann ar údarás faoi alt 7 nó 8 d'Acht 1965 chun aersheirbhís a oibriú go dtí críoch an Stáit nó uaithi nó laistigh di agus ar oibriú é a mbeartódh an tAire, i gcás an t-údarás a dheonú, fógra a eisiúint ina leith faoi alt 3 den Acht seo,
(b) aon chinneadh a dhéanfaidh an tAire faoi mhír (a) den fho-alt seo,
(c) aon taraif aerlíne a chuirfear faoi bhráid an Aire de bhun ceanglas fógra faoi alt 3 den Acht seo agus ainm an aeriompróra a dhéanfaidh, nó ar thar a cheann a dhéanfar, an cur-faoi-bhráid,
(d) aon chinneadh a dhéanfaidh an tAire faoin alt sin 3, agus
(e) aon ordú sealadach a thabharfar faoi alt 4 den Acht seo.
(2) Coimeádfar an clár i cibé áit a ordóidh an tAire agus beidh sé ar fáil lena iniúchadh le linn cibé uaireanta an chloig oifige a bheidh sonraithe de thuras na huaire ag an Aire.
Cionta.
6.—(1) Más rud é—
(a) go ndéanfaidh duine aon táille, ráta nó muirear eile, aon téarma nó coinníoll lena mbaineann an tAcht seo a bhailiú, a mhuirearú, a dhéanamh, a chur i bhfeidhm nó a fhorchur, agus
(b) (i) nach bhfuil an táille, an ráta nó an muirear eile, an téarma nó an coinníoll ar áireamh i dtaraif aerlíne a chuir an t-aeriompróir lena mbaineann, nó a cuireadh thar a cheann, faoi bhráid an Aire roimh ré de bhun cheanglais alt 3 den Acht seo, nó
(ii) gur cuireadh amhlaidh taraif aerlíne den sórt sin faoi bhráid an Aire ach gur dhiúltaigh an tAire an táille, an ráta nó an muirear eile, an téarma nó an coinníoll a cheadú, ar é a chur faoina bhráid amhlaidh, nó
(iii) gur cuireadh amhlaidh taraif aerlíne den sórt sin faoi bhráid an Aire agus gur cheadaigh an tAire í faoi réir modhnú, ach go ndearna an duine, le linn dó an muirear, an téarma nó an coinníoll a bhailiú, a mhuirearú, a chur i bhfeidhm nó a fhorchur, neamhaird den mhodhnú,
beidh an duine ciontach i gcion.
(2) Ní dhéanfaidh duine a oibríonn aersheirbhís ná idirghabhálaí lena mbaineann an t-alt seo—
(a) aon fhógrán a chló nó a fhoilsiú nó a chur faoi deara aon fhógrán a chló nó a fhoilsiú nó cló nó foilsiú aon fhógráin a thabhairt chun críche ar fógrán é a fhógraíonn aon táille, ráta nó muirear—
(i) is táille, ráta nó muirear lena mbaineann an tAcht seo, agus
(ii) is táille, ráta nó muirear ar chion faoin Acht seo a leithéid a bhailiú, a mhuirearú nó a dhéanamh i gcás go ndéanfaí amhlaidh, nó
(b) aon doiciméad a dháileadh nó a chur ar fáil don phobal ar shlí eile, ar doiciméad é—
(i) ina bhfuil fógrán a thuairiscítear i mír (a) den fho-alt seo, nó
(ii) ina bhfuil aon tagairt do tháille, do ráta nó do mhuirear a thuairiscítear i bhfomhíreanna (i) agus (ii) den mhír sin (a).
(3) Beidh aon duine a sháróidh fo-alt (2) den alt seo ciontach i gcion.
(4) Má tharlaíonn gur duine seachas an t-aeriompróir ar ina tharaif aerlíne atá an táille, an ráta nó an muirear eile, an téarma nó an coinníoll cuí, ar áireamh, a dhéanfaidh cion faoi fho-alt (1) nó (3) den alt seo, measfar, faoi réir fho-alt (5) den alt seo, go ndearna an t-aeriompróir sin cion faoin bhfo-alt (1) nó (3) sin, de réir mar is iomchuí.
(5) In aon imeachtaí i leith ciona faoin alt seo is cosaint don chosantóir a chruthú—
(i) go raibh, tráth an chiona líomhnaithe, an táille, an ráta nó an muirear eile, an téarma nó an coinníoll lena mbaineann an cion líomhnaithe, socraithe le hordú faoi alt 9 (arna leasú le halt 10 den Acht seo) d'Acht 1965, nó
(ii) gur d'éagmais toiliú, cúlcheadú nó mainneachtain dá chuid a rinneadh an sárú ábhartha nó gur ghlac sé bearta réasúnacha, nó gur chuir sé faoi deara bearta réasúnacha a ghlacadh, chun an sárú a chosc nó a sheachaint.
(6) Aon duine a sháróidh ordú faoi alt 4 den Acht seo cibé acu go díreach nó mar ghníomhaire d'aeriompróir, beidh sé ciontach i gcion.
(7) I gcás cion faoi fho-alt (1), (3) nó (6) den alt seo a bheith déanta nó, de bhua fho-alt (4) den alt seo, a bheith measta a bheith déanta, ag comhlacht corpraithe agus go gcruthófar go ndearnadh an cion sin le toiliú nó le cúlcheadú, nó gur urasaíodh a dhéanamh trí mhainneachtain thoiliúil ar thaobh, aon stiúrthóra, bainisteora, rúnaí nó oifigigh eile den chomhlacht, measfar go ndearna seisean, chomh maith leis an gcomhlacht, an cion céadluaite.
(8) San alt seo ciallaíonn “idirghabhálaí lena mbaineann an t-alt seo” duine a dhéanfaidh mar ghníomhaire—
(a) socrú chun cóiríocht a dhíol nó a thairiscint lena díol, nó
(b) cóiríocht a dhíol nó a thairiscint lena díol, nó
(c) cóiríocht a cheannach nó a thairiscint í a cheannach,
ar cóiríocht í le haghaidh paisinéirí, post nó lasta eile a iompar d'aer nó a thabharfaidh le fios, trí fhógraíocht nó ar shlí eile, gur duine é a dtig leis cóiríocht den sórt sin a chur ar fáil, cibé acu inti féin nó in éineacht le cóiríocht eile, nó maille le saoráidí nó seirbhísí.
Luach fianaiseach deimhnithe áirithe.
7.—In aon imeachtaí i leith ciona faoin Acht seo, má thugtar deimhniú ar aird a airbheartaíonn a bheith sínithe ag oifigeach don Aire agus a dheimhníonn gur táille, ráta nó muirear eile, téarma nó coinníoll de réir mar is cuí lena mbaineann an tAcht seo táille, ráta nó muirear eile, téarma nó coinníoll a shonraítear sa deimhniú agus—
(a) nach raibh an táille, an ráta nó an muirear eile, an téarma nó an coinníoll a shonrófar amhlaidh ar áireamh in aon taraif aerlíne a cuireadh faoi bhráid an Aire de bhun cheanglais alt 3 den Acht seo, nó
(b) go ndearna an tAire, tar éis an táille, an ráta nó an muirear eile, an téarma nó an coinníoll a bheith curtha faoina bhráid amhlaidh, é a cheadú faoi réir modhnú (ar modhnú é a dheimhneofar sa deimhniú), nó
(c) cé gur cuireadh an táille, an ráta nó an muirear eile, an téarma nó an coinníoll faoi bhráid an Aire amhlaidh gur dhiúltaigh sé é a cheadú,
beidh, go dtí go gcruthófar a mhalairt, tabhairt ar aird an deimhnithe sin ina fhianaise ar aon fhíoras a dheimhneofar leis an deimhniú gan cruthúnas ar aon síniú air nó gur síniú oifigigh den sórt sin aon síniú den sórt sin.
Pionóis.
8.—(1) Gach duine a bheidh ciontach i gcion faoi fho-alt (2) d'alt 12 d'Acht 1965 i leith sárú ar ordú faoi alt 9 den Acht sin nó i leith faillí ordú faoin alt sin a chomhlíonadh nó gach duine a bheidh ciontach i gcion faoi fho-alt (1) nó (6) d'alt 6 den Acht seo nó a mheasfar, de bhua fho-alt (4) nó (7) den alt sin, a rinne cion den sórt sin dlífear—
(a) ar é a chiontú go hachomair, fíneáil nach mó ná £1,000 a chur air, nó
(b) ar é a chiontú ar díotáil, fíneáil nach mó ná £50,000 a chur air.
(2) Gach duine a bheidh ciontach i gcion faoi alt 6 (3) den Acht seo nó a mheasfar de bhua fho-alt (4) nó (7) den alt sin, a rinne cior den sórt sin, dlífear, ar é a chiontú go hachomair, fíneáil nach mó ná £1,000 a chur air.
Fógraí a thabhairt.
9.—(1) I gcás go gceanglaíonn an tAcht seo fógra a thabhairt do dhuine, díreofar chuige é agus tabharfar dó é ar shlí éigin díobh seo a leanas:
(a) i gcás go mbeidh sé dírithe chuige faoina ainm, trína shea chadadh air;
(b) trína chur le telex nó le teachtaireacht teileachumarsáide eile chuig an seoladh ag a bhfuil gnáthchónaí air nó trína fhágáil ag an seoladh sin nó, i gcás seoladh le haghaidh seirbheála a bheith tugtha, chuig an seoladh sin nó aige;
(c) trína chur leis an bpost i litir chláraithe réamhíoctha a bheidh dírithe chuige ag an seoladh ag a bhfuil gnáthchónaí air nó, i gcás a mbeidh seoladh le haghaidh seirbheála tugtha, ag an seoladh sin.
(2) Chun críocha an ailt seo, measfar gnáthchónaí a bheith ina hoifig chláraithe ar chuideachta is cuideachta de réir bhrí Acht na gCuideachtaí, 1963, agus measfar gnáthchónaí a bheith ina phríomhoifig nó ina phríomh-áit ghnó ar gach comhlacht corpraithe eile agus ar gach comhlacht neamhchorpraithe.

10.—Leasaítear leis seo Acht 1965—
(a) trí na mínithe seo a leanas a chur isteach roimh an míniú ar “an tAire” i bhfo-alt (1) d'alt 1:
“folaíonn ‘táillí’ táillí tar éis lascaine;
folaíonn ‘rátaí’ rátaí tar éis lascaine;”;
(b) trí na fomhíreanna seo a leanas a chur in ionad fhomhíreanna (i) agus (ii) d'alt 6 (1) (b):
“(i) má bhíonn ordú faoi alt 9 (arna leasú le halt 10 den Acht Aeriompair, 1986), den Acht seo i bhfeidhm ag socrú na dtáillí, na rátaí nó na muirear eile, na dtéarmaí nó na gcoinníollacha a mhuirearófar, a dhéanfar, a fheidhmeofar nó a fhorchuirfear maidir le paisinéirí, lasta agus post a iompar ar an tseirbhís, go ndéanfar na táillí, na rátaí nó na muirir eile, na téarmaí nó na coinníollacha a socraíodh amhlaidh a mhuirearú, a dhéanamh, a fheidhmiú nó a fhorchur, de réir mar is iomchuí, maidir leis an tseirbhís, nó
(ii) más táillí, rátaí nó muirir eile, téarmaí nó coinníollacha lena mbaineann an tAcht Aeriompair, 1986, na táillí na rátaí nó na muirir eile, na téarmaí nó na coinníollacha a mhuirearófar, a dhéanfar, a fheidhmeofar nó a fhorchuirfear amhlaidh—
(I) go bhfuil na táillí, na rátaí nó na muirir eile, na téarmaí nó na coinníollacha ar áireamh i dtaraif aerlíne a cuireadh faoi bhráid an Aire roimh ré lena ceadú de bhun alt 3 den Acht sin, agus
(II) nach táille, ráta nó muirear eile, téarma nó coinníoll aon cheann de na táillí, na rátaí nó na muirir eile, na téarmaí nó na coinníollacha, ar maidir leis a dhiúltaigh an tAire tar éis é a chur faoina bhráid a cheadú a thabhairt, nó ar maidir leis, i gcás ceadú den sórt sin a bheith tugtha ag an Aire faoi réir modhnú, a thugtar aird ar an modhnú.”;
(c) trí “, na rátaí nó na muirir eile, na téarmaí nó na coinníollacha a shocrú a mhuirearófar, a dhéanfar, a fheidhmeofar nó a fhorchuirfear as paisinéirí, lasta, nó post a iompar, nó i ndáil leis an iompar sin,” a chur in ionad “nó na rátaí a shocrú a mhuirearófar as paisinéirí, lasta nó post a iompar” i bhfo-alt (1) d'alt 9;
(d) trí “, rátaí nó muirir eile, téarmaí nó coinníollacha” a chur in ionad “nó rátaí” i bhfo-alt (2) d'alt 9;
(e) trí “, rátaí nó muirir eile, téarmaí nó coinníollacha a mhuirearaítear, a dhéantar, a fheidhmítear nó a fhorchuirtear as paisinéirí, lasta agus post a iompar, nó i ndáil leis an iompar sin, ar na seirbhísí sin, nó a bheartaítear a mhuirearú, a dhéanamh, a fheidhmiú nó a fhorchur amhlaidh,” a chur in ionad “nó rátaí a mhuirearaítear nó a bheartaítear a mhuirearú as paisinéirí, lasta agus post a iompar ar na seirbhísí sin” i bhfomhír (vi) d'alt 11 (a);
(f) trí “, seachas i gcás sárú ar ordú arna dhéanamh faoi alt 9 den Acht seo nó i gcás faillí a dhéanamh ina chomhlíonadh,” a chur isteach roimh “dlífear” i bhfo-alt (2) d'alt 12 d'Acht 1965; agus
(g) trí “£1,000” agus “£100,000” a chur in ionad “céad punt” agus “míle punt”, faoi seach i bhfo-alt (2) d'alt 12;

AIR TRANSPORT ACT, 1986
Definitions.
1.—In this Act—
“the Act of 1965” means the Air Navigation and Transport Act, 1965;
“air carrier to which this Act applies” means a person—
(a) who operates an air service of a kind for the time being authorised under section 7 of the Act of 1965, or
(b) to whom an authorisation under section 8 of the Act of 1965 has been granted and which is for the time being in force;
“airline tariff” means the fares, rates or other charges which are payable to or made by either an air carrier to which this Act applies or an intermediary to whom section 6 of this Act applies as regards the transport by air of passengers (either with or without luggage or baggage), mail or other cargo and the conditions (including in particular conditions as regards agency or other auxiliary services) or other terms on or subject to which those charges are to be paid or made;
“fare” includes a fare net of discount;
“the Minister” means the Minister for Communications;
“the register” has the meaning assigned to it by section 5;
“rate” includes a rate net of discount.
Charges etc. to which Act applies.
2.—This Act applies to any fare, rate or other charge, term or condition contained in an airline tariff which is an airline tariff to which a notice under section 3 of this Act which is for the time being in forces relates.
Notice requiring particulars of proposed airline tariffs.
3.— (1) (a) The Minister may, by a notice in writing given to an air carrier to which this Act applies, for so long as the notice remains in force, require such carrier to submit, or cause to be submitted on his behalf, to the Minister, in writing and before its implementation, particulars of any airline tariff proposed to be applied by such air carrier, being an airline tariff to which the notice relates.
(b) Where a notice under this section is given, then, for so long as the notice remains in force, the person to whom it is given shall comply with the requirements of the notice.
(2) Where an airline tariff is submitted to the Minister pursuant to the requirements of a notice under this section, the Minister may approve of the tariff, or of anything contained therein, with or without modification or refuse to approve of the tariff or of anything so contained: provided that the Minister shall not make a decision under this section in relation to the airline tariff before the day which is twenty-one days after the day on which particulars of the airline tariff are entered in the register pursuant to section 5 of this Act, or the day immediately following the expiration of the period specified in the relevant notification under subsection (4) of this section, whichever is the later.
(3) In considering an airline tariff submitted under this section, in addition to having regard to the interests of the air carrier by or on whose behalf the submission is made, the Minister shall have regard to—
(a) the reasonable interests of—
(i) the other air carriers to which this Act applies, and
(ii) the persons whom he considers will use the passenger service, or the mail or other cargo service, as may be appropriate, to which the proposed airline tariff will relate,
(b) the contribution capable of being made to the economy by the tourist industry by reason of the provision (subject to the need to maintain an air transport industry) of airline tariffs which are competitive in the fares, rates or other charges and in the terms and conditions applicable,
(c) the necessity, having regard in particular to the public interest, of maintaining the continuity, range, frequency and standard of all or any of the following, namely, particular air services to, from or within the State, such air services generally or airport facilities associated with such air services,
(d) any representations or objections regarding the airline tariff which are made to him within the period mentioned in subsection (2) of this section (which representations and objections are hereby authorised to be made), and
(e) any air transport or other international agreement for the time being in force, to which the State is a party.
(4) Where under this section the Minister proposes either to approve of with modifications or to refuse to approve of an airline tariff, he shall notify in writing the air carrier or other person from whom the relevant submission was received under this section of his intention and of the reasons therefor and the notification shall state that within such period, beginning on the date of the notification as is specified in the notification (being a period of not less than seven days), representations and objections as regards the proposed refusal or modification may be made to the Minister by such air carrier (which representations and objections are hereby authorised to be made).
(5) A notice under this section may relate to airline tariffs generally or to such tariffs which are of a class or description specified in the notice and, in any case where such a notice relates to airline tariffs of a class or description so specified, the notice shall be given to all air carriers to which this Act applies, which apply or propose to apply airline tariffs of that class or description.
(6) A notice under this section shall remain in force until it is withdrawn by the Minister by a notice in writing.
Temporary direction pending decision under section 3.
4.—(1) Where an airline tariff is submitted to the Minister pursuant to section 3 of this Act by or on behalf of an air carrier, the Minister may give to the person from whom the submission is received a direction under this section in respect of that air carrier prohibiting such air carrier's applying (whether directly or through an agent) the tariff, or, as may be specified in the direction, his collecting, charging, making, applying or imposing any one or more of the fares, rates or other charges, terms or conditions contained in such tariff and so specified, and such direction shall come into force on the expiration of the period of seven days beginning on the day on which a copy of the direction is sent by the Minister unless, not later than the seventh day following the day on which such copy is so sent, the person from whom the submission was received satisfies the Minister that the direction should not come into force.
(2) In case a copy of a direction under this section is sent by the Minister, the Minister shall at the same time send to the person from whom the relevant submission under this section was received a notice in writing stating that the air carrier concerned may, within the time limit specified in subsection (1) of this section, make representations to the Minister stating why the direction should not come into force.
(3) A direction under this section shall remain in force until the expiration of the period of twenty-eight days beginning on the day on which it is given or until the Minister makes a decision under section 3 of this Act as regards the relevant airline tariff, whichever first occurs.
(4) The Minister may, by a notice in writing given to the person from whom the relevant submission under this section was received, extend or further extend, in either case for a period not exceeding twenty-eight days, the period during which a particular direction under this section is to remain in force.
Register.
5.—(1) The Minister shall keep a register (in this Act referred to as “the register”) for the purposes of this Act and shall, as soon as may be, enter therein particulars of—
(a) any application to the Minister by or on behalf of an air carrier for authorisation under section 7 or 8 of the Act of 1965 to operate an air service to, from or within the territory of the State and in respect of which operation the Minister would, if the authorisation were granted, propose to issue a notice under section 3 of this Act,
(b) any decision given by the Minister under paragraph (a) of this subsection,
(c) any airline tariff submitted pursuant to the requirements of a notice under section 3 of this Act and the name of the air carrier by or on whose behalf the submission was made,
(d) any decision given by the Minister under the said section 3, and
(e) any temporary direction given under section 4 of this Act.
(2) The register shall be kept at such place as the Minister shall direct and shall be available for inspection during such office hours as shall for the time being be specified by the Minister.
Offences.
6.—(1) Where—
(a) a person collects, charges, makes, applies or imposes any fare, rate or other charge, term or condition to which this Act applies, and
(b) (i) the fare, rate or other charge, term or condition is not contained in an airline tariff previously submitted by or on behalf of the air carrier concerned to the Minister pursuant to the requirements of section 3 of this Act, or
(ii) such an airline tariff has been so submitted but the Minister has refused to approve of the fare, rate or other charge, term or condition, on such submission, or
(iii) such an airline tariff has been so submitted and has, been approved of by the Minister subject to a modification, but in collecting, charging, applying or imposing the charge, term or condition the modification is disregarded by the person,
the person shall be guilty of an offence.
(2) A person who operates an air service or an intermediary to whom this section applies shall neither—
(a) print, publish, cause or procure to be printed or published any advertisement advertising any fare, rate or charge which is both—
(i) a fare, rate or charge to which this Act applies, and
(ii) a fare, rate or charge, the collection, charging or making of which would, if made, constitute an offence under this Act, nor
(b) distribute or otherwise make available to the public any document containing—
(i) an advertisement described in paragraph (a) of this subsection, or
(ii) any reference to a fare, rate or charge described in subparagraphs (i) and (ii) of the said paragraph (a).
(3) A person who contravenes subsection (2) of this section shall be guilty of an offence.
(4) In the event of a person, other than the air carrier in whose airline tariff the relevant fare, rate or other charge, term or condition is contained, committing an offence under subsection (1) or (3) of this section, that air carrier shall, subject to subsection (5) of this section, be deemed to have committed an offence under the said subsection (1) or (3), as may be appropriate.
(5) In any proceedings for an offence under this section it shall be a defence for the defendant to prove—
(i) that at the time of the alleged offence, the fare, rate or other charge, term or condition to which the alleged offence relates stood fixed by an order under section 9 (as amended by section 10 of this Act) of the Act of 1965, or
(ii) that the relevant contravention was committed without his consent, connivance or default or that he took, or caused to be taken, reasonable steps to prevent or avoid the contravention.
(6) Any person who contravenes, whether directly or as an agent of an air carrier, a direction under section 4 of this Act shall be guilty of an offence.
(7) Where an offence under subsection (1), (3) or (6) of this section is, or, by virtue of subsection (4) of this section, is deemed to have been, committed by a body corporate and the offence is proved to have been committed with the consent or connivance of, or to have been facilitated by the wilful default on the part of, any director, manager, secretary or other officer of the body, he, as well as the body, shall be deemed to have committed the first-mentioned offence.
(8) In this section “intermediary to whom this section applies” means a person who as agent—
(a) arranges for the purpose of selling or offering for sale, or
(b) sells or offers for sale, or
(c) purchases or offers to purchase,
accommodation for the transport by air of passengers, mail or other cargo or who holds himself out, by advertising or otherwise, as one who may make available such accommodation, whether alone or in association with other accommodation, or with facilities or services.
Evidential value of certain certificates.
7.—In any proceedings for an offence under this Act, the production of a certificate purporting to be signed by an officer of the Minister and certifying that a fare, rate or other charge, term or condition specified in the certificate is a fare, rate or other charge, term or condition, as may be appropriate, to which this Act applies and that—
(a) the fare, rate or other charge, term or condition so specified was not contained in any airline tariff submitted to the Minister pursuant to the requirements of section 3 of this Act, or
(b) that on being so submitted the fare, rate or other charge, term or condition was approved of by the Minister subject to a modification (which modification shall be certified in the certificate), or
(c) that, though it was so submitted, the Minister refused to approve of the fare, rate or other charge, term or condition,
shall, until the contrary is proved, be evidence of any fact certified by the certificate without proof of any signature thereon or that any such signature is that of such an officer.
Penalties.
8.—(1) Every person guilty of an offence under subsection (2) of section 12 of the Act of 1965 in respect of a contravention of or failure to comply with an order under section 9 of that Act or every person guilty of an offence under subsection (1) or (6) of section 6 of this Act or who, by virtue of subsection (4) or (7) of that section, is deemed to have committed such an offence, shall be liable—
(a) on summary conviction, to a fine not exceeding £1,000, or
(b) on conviction on indictment, to a fine not exceeding £50,000.
(2) Every person guilty of an offence under section 6 (3) of this Act or who, by virtue of subsection (4) or (7) of that section, is deemed to have committed such an offence, shall be liable on summary conviction to a fine not exceeding £1,000.
Giving of notices.
9.—(1) Where a notice is required by this Act to be given to a person, it shall be addressed to him and shall be given to him in some one of the following ways:
(a) where it is addressed to him by name, by delivering it to him;
(b) by sending it by telex or other telecommunications message to, or leaving it at, the address at which he ordinarily resides or, in a case in which an address for service has been furnished, that address;
(c) by sending it by post in a prepaid registered letter addressed to him at the address at which he ordinarily resides or, in a case in which an address for service has been furnished, at that address.
(2) For the purposes of this section, a company within the meaning of the Companies Act, 1963, shall be deemed to be ordinarily resident at its registered office, and every other body corporate and every unincorporated body shall be deemed to be ordinarily resident at its principal office or place of business.
Amendment of Act of 1965.
10.—The Act of 1965 is hereby amended by—
(a) the insertion of the following definitions before the definition of “the Minister” in subsection (1) of section 1:
“‘fares’ includes fares net of discount;
‘rates’ includes rates net of discount;”;
(b) the substitution of the following subparagraphs for subparagraphs (i) and (ii) of section 6 (1) (b):
“(i) if an order under section 9 (as amended by section 10 of the Air Transport Act, 1986) of this Act fixing the fares, rates or other charges, terms or conditions to be charged, made, applied or imposed as regards the carriage of passengers, cargo and mail on the service is in force, the fares, rates or other charges, terms or conditions so fixed are charged, made, applied or imposed, as may be appropriate, as regards the service, or
(ii) if the fares, rates or other charges, terms or conditions to be so charged, made, applied or imposed are fares, rates or other charges, terms or conditions to which the Air Transport Act, 1986, applies—
(I) the fares, rates or other charges, terms or conditions are contained in an airline tariff previously submitted to the Minister for his approval pursuant to section 3 of that Act, and
(II) none of the fares, rates or other charges, terms or conditions is one as regards which on such submission the Minister has refused his approval, or, in case the Minister has given such approval subject to a modification, regard is had to the modification.”;
(c) the substitution of “, rates or other charges, terms or conditions to be charged, made, applied or imposed in respect of or in relation to the carriage” for “or rates to be charged for the carriage” in subsection (1) of section 9;
(d) the substitution of “, rates or other charges, terms or conditions” for “or rates” in subsection (2) of section 9;
(e) the substitution of “, rates or other charges, terms or conditions charged, made, applied or imposed in respect of or in relation to the carriage of passengers, cargo and mail on those services, or proposed so to be charged, made, applied or imposed,” for “or rates charged or proposed to be charged in respect of the carriage of passengers, cargo and mail on those services” in subparagraph (vi) of section 11 (a);
(f) the insertion before “shall be liable” in subsection (2) of section 12 of the Act of 1965 of “, except for a contravention of or failure to comply with an order made under section 9 of this Act,”; and
(g) the substitution in subsection (2) of section 12 of “£1,000” and “£100,000” for “one hundred pounds” and “one thousand pounds”, respectively;
and the said subsection (1), the said subsection (2) of the said section 9, the said subparagraph (vi) of the said section 11 (a), and the said subsection (2) of the said section 12, as so amended, are set out in paragraphs 1, 2, 3 and 4, respectively, of the Table to this section.

1. (1) The Minister may, by order, fix the fares, rates or other charges, terms or conditions to be charged, made, applied or imposed in respect of or in relation to the carriage of passengers, cargo or mail on air services to, from or within the territory of the State.
2. (2) An order under this section may fix different fares, rates or other charges, terms or conditions in respect of different air services or different categories of passengers, cargo or mail and may apply in relation to all air services to, from or within the territory of the State or in relation only to a specified air service or specified air services to, from or within such territory.
3. (vi) to furnish to the Minister such information in relation to fares, rates or other charges, terms or conditions charged, made, applied or imposed in respect of or in relation to the carriage of passengers, cargo and mail on those services, or proposed so to be charged, made, applied or imposed, as the Minister may specify, and
4. (2) A person who contravenes or fails to comply with or who is deemed by this section to have contravened or failed to comply with a provision of this Act or an order, regulation or direction under this Act shall be guilty of an offence and, except for a contravention of or failure to comply with an order made under section 9 of this Act, shall be liable—
(a) on summary conviction to imprisonment for a term not exceeding six months or to a fine not exceeding £1,000 or, at the discretion of the Court, to both the imprisonment and the fine, or
(b) on conviction on indictment to imprisonment for a term not exceeding six months or to a fine not exceeding £100,000 or, at the discretion of the Court, to both the imprisonment and the fine.
Expenses.
11.—The expenses incurred by the Minister in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Repeal.
12.—Section 10 of the Act of 1965 is hereby repealed.
Short title and collective citation.
13.—(1) This Act may be cited as the Air Transport Act, 1986.
(2) The Air Navigation and Transport Acts, 1936 to 1975, and this Act may be cited together as the Air Navigation and Transport Acts, 1936 to 1986.
