CUID I.
Roimhraiteach agus Generalta.
Gearr-theideal, luadh agus léiriú.
1.—(1) Féadfar an tAcht Rialtais Áitiúla (Leasú) (Uimh. 2), 1934, do ghairm den Acht so.
(2) Féadfar na hAchtanna Rialtais Áitiúla, 1925 go 1934, do ghairm de sna Príomh-Achtanna agus den Acht so le chéile.
(3) Léireofar an tAcht so mar éinní amháin leis na Príomh-Achtanna.
Mínithe.
2.—San Acht so—
cialluíonn an abairt “an tAire” an tAire Rialtais Áitiúla agus Sláinte Puiblí;
cialluíonn an abairt “na Príomh-Achtanna” na hAchtanna Rialtais Áitiúla, 1925 go 1933;
cialluíonn an abairt “Acht 1925” an tAcht Rialtais Áitiúla, 1925 (Uimh. 5 de 1925).
Costaisí an Aire.
3.—Sa mhéid go gceadóidh an tAire Airgid é is amach as airgead a sholáthróidh an tOireachtas a híocfar gach costas fé n-a raghaidh an tAire chun an Achta so do chur i bhfeidhm.
Fiosrúcháin phuiblí.
4.—(1) Féadfaidh an tAire, sara bhfeidhmeoidh aon chomhacht dá mbronntar air leis an Acht so, fiosrúchán puiblí do dhéanamh i dtaobh an ní go mbeidh an chomhacht san le feidhmiú ina thaobh amhlaidh.
(2) Beidh feidhm ag Airtiogal 32 den Sceideal a ghabhann leis an Local Government (Application of Enactments) Order, 1898, maidir le gach fiosrúchán puiblí déanfar fén alt so den Acht so fé mar atá feidhm ag an Airtiogal san maidir leis na fiosrúcháin áitiúla luaidhtear ann.
CUID II.
Contaethe do Roinnt ina dha gCeanntar Slainte Contae no nios mo.
Orduithe roinnte.
5.—(1) Ar n-a iarraidh sin do chomhairle chontae uair ar bith (roimh an Acht so do rith no dá éis) féadfaidh an tAire, más oiriúnach leis é, ordú do dhéanamh (dá ngairmtear ordú roinnte san Acht so)—
(a) á dhearbhú go mbeidh, o thosach feidhme an orduithe sin, líon áirithe (nách lugha ná dhá cheann) de thuathcheanntair shláintíochta sa chontae sin, agus
(b) ag luadh na coda den chontae sin a bheidh i ngach tuathcheanntar sláintíochta fé leith dhíobh san agus is ionann agus gach tuath-cheanntar sláintíochta fé leith dhíobh agus, sa mhéid gur gá san, ag síneadh amach teorann gach tuath-cheanntair shláintíochta fé leith dhíobh, agus
(c) ag ceapadh lae, nách luaithe ná trí mhí tar éis dáta an orduithe sin, chun bheith ina lá cheaptha chun crícheanna an orduithe sin.
(2) Tiocfaidh gach ordú roinnte i ngníomh an lá ceapfar leis an ordú san chun bheith ina lá cheaptha chun crícheanna an chéanna.
Líon ball chomhairle contae d'atharú.
6.—(1) Pé uair a bheidh ordú roinnte déanta ag an Aire féadfa sé, más oiriúnach leis é, ar n-a iarraidh sin do chomhairle na contae le n-a mbainfidh an t-ordú roinnte sin, líon ball na comhairle sin d'atharú, i pé slí is oiriúnach leis, le hordú déanfar tráth ar bith roimh an lá is lá ceaptha chun crícheanna an orduithe roinnte sin.
(2) Gan an tOireachtas do dhaingniú orduithe dhéanfaidh an tAire fén alt so tiocfaidh an t-ordú san i ngníomh nuair a déanfar an chéad toghadh bheidh ann tar éis an lae cheaptha do bhaill na comhairle le n-a mbainfidh an t-ordú san agus beidh éifeacht ag an ordú san as san amach.
Togh-líomatáistí contae d'atharú.
7.—(1) Má bhíonn ordú roinnte déanta ag an Aire agus an scéal ar shlí no ar an dá shlí acu so leanas, sé sin le rá:—
(a) ceann no cinn de sna togh-líomatáistí contae sa chontae le n-a mbainfidh an t-ordú roinnte sin do bheith, ar dháta an orduithe sin, go leathrannach i gceann agus go leathrannach i gceann no i gcinn eile de sna tuathcheanntair shláintíochta nua bunófar leis an ordú san, agus
(b) atharú do bheith déanta ag an Aire, fén gcomhacht a bronntar air chuige sin leis an Acht so, ar líon ball comhairle na contae sin,
déanfaidh an tAire, i bhfeidhmiú na gcomhacht a dílsítear ann chuige sin le halt 1 den Local Government (Ireland) Act, 1919, an chontae sin do roinnt as an nua ina togh-líomatáistí contae agus déanfaidh an roinnt sin i slí go mbeidh iomlán gach toghlíomatáiste contae sa chontae sin laistigh de cheann éigin de sna tuath-cheanntair shláintíochta nua san.
(2) Pé uair a dhéanfaidh an tAire, do réir an ailt seo, contae do roinnt ina togh-líomatáistí contae ceapfa sé an líon de bhaill chomhairle na contae sin a bheidh le toghadh do gach toghlíomatáiste contae fé leith acu.
Eifeacht Orduithe roinnte.
8.—Pé uair a bheidh ordú roinnte déanta ag an Aire beidh éifeacht ag na forálacha so leanas, an lá is lá ceaptha chun crícheanna an orduithe sin agus dá éis, maidir leis an gcontae le n-a mbainfidh an t-ordú san, sé sin le rá:—
(a) an méid den chontae sin is tuath-cheanntar sláintíochta ar dháta an orduithe sin scuirfe sé de bheith ina thuath-cheanntar sláintíochta;
(b) bunófar sa chontae sin, de bhuadh an orduithe sin, an méid tuath-cheanntar sláintíochta bheidh luaidhte san ordú san, agus beidh i ngach tuath-cheanntar sláintíochta fé leith acu san an chuid den chontae sin a bheidh luaidhte chuige sin san ordú san;
(c) isí comhairle na contae sin a bheidh mar údarás sláintíochta do gach tuath-cheanntar sláintíochta fé leith dá mbunófar amhlaidh;
(d) beidh gach tuath-cheanntar sláintíochta fé leith acu san ina cheanntar shláinte chontae do réir bhrí na bPríomh-Achtanna agus bhéarfar mar ainm air “Ceanntar Sláinte . . .” (maraon le hainm na contae agus pé ainm aitheantais ordóidh an tAire);
(e) fé réir forálacha an Achta so beidh feidhm agus éifeacht ag na Príomh-Achtanna i ngach tuath-cheanntar sláintíochta agus ceanntar sláinte contae den tsórt san agus maidir leo fé is dá mba le hordú déanfaí fé fho-alt (2) d'alt 9 d'Acht 1925 a bunófaí an ceanntar san;
(f) má bhíonn bord sláinte puiblí sa chontae sin agus don chontae sin ar dháta an orduithe sin scuirfear an bord san agus ní bheidh sé ann feasta.
Búird sláinte cheanntracha nua.
9.—(1) Ní bheidh feidhm ná éifeacht ag Rialacha 1, 2, 6, 7 agus 8 den Dara Sceideal a ghabhann le hAcht 1925 maidir le bord sláinte ceanntair shláinte chontae a bunófar fén Acht so.
(2) Isé bheidh i mbord sláinte gach ceanntair shláinte chontae fé leith a bunófar fén Acht so—
(a) an lá is lá ceaptha chun crícheanna an orduithe roinnte bhaineann leis an gcás agus d'éis an lae sin go dtí an chéad chruinniú cinn bliana, a comórfar tar éis dáta an orduithe roinnte sin, de chomhairle na contae ina mbeidh an ceanntar sláinte contae sin suidhte, ná pé baill agus pe méid ball ordóidh an chomhairle sin agus a thoghfaid as a mbaill féin, agus
(b) ón gcéad chruinniú cinn bliana san agus dá éis, ná na baill den chomhairle sin a toghfar don togh-líomatáiste no do sna togh-líomatáistí contae bheidh sa cheanntar shláinte chontae sin.
CUID III.
Foralacha de dhruim Contae do roinnt ina Ceanntair Shlainte Chontae.
Feidhm agus léiriú na Coda so den Acht so.
10.—(1) Pé uair a bheidh ordú roinnte déanta ag an Aire tiocfaidh an Chuid seo den Acht so i ngníomh agus beidh feidhm agus éifeacht aige, maidir leis an gcontae le n-a mbainfidh an t-ordú san, an lá is lá ceaptha chun crícheanna an orduithe sin agus d'éis an lae sin agus, dá réir sin, tá leis na habairtí seo leanas, sna haltanna ina dhiaidh seo den Chuid seo den Acht so, na bríonna ceaptar dóibh fé seach anso ina dhiaidh seo, sé sin le rá:—
cialluíonn an abairt “an t-ordú roinnte” an t-ordú roinnte sin gurb é a dhéanamh fé ndeár an Chuid seo den Acht so do theacht i ngníomh;
cialluíonn an abairt “an chontae” an chontae le n-a mbainfidh an t-ordú roinnte sin;
cialluíonn an abairt “an chomhairle” comhairle na contae sin;
cialluíonn an abairt “an seana-cheanntar” an ceanntar sláinte contae bheidh sa chontae sin ar dháta an orduithe roinnte sin;
cialluíonn an abairt “an seana-bhord” an bord sláinte puiblí no an bord sláinte agus conganta phuiblí (pe'ca aca é) don cheanntar shláinte chontae bheidh sa chontae sin mar adubhradh;
cialluíonn an focal “ceanntar nua” ceanntar sláinte contae bheidh bunuithe do réir an orduithe roinnte sin;
cialluíonn an abairt “an lá ceaptha” an lá is lá ceaptha chun crícheanna an orduithe roinnte sin.
(2) Gan dochar ná díobháil d'oibriú agus d'éifeacht na forála den Acht so le n-a bhforáltar an tAcht so do léiriú mar éinní amháin leis na Príomh-Achtanna dearbhuítear leis seo go bhfuil an bhrí chéanna leis an bhfocal “có-cheanntar” sa Chuid seo den Acht so a cuirtear leis i bhfo-alt (2) d'alt 1 den Acht Rialtais Áitiúla, 1927 (Uimh. 3 de 1927), agus go mbeidh éifeacht dá réir sin ag an bprovíso a ghabhann leis an bhfo-alt san.
Maoin seana-bhúird d'aistriú.
11.—(1) Gach maoin, réalta no pearsanta (agus rudaí-arfiunraoi d'áireamh), a bheidh, díreach roimh an lá ceaptha, dílsithe sa tseana-bhord no dá gcuid féin acu no i seilbh ar iontaoibh dóibh agus gach ceart, comhacht, agus príbhléid a bhaineann no a ghabhann le haon mhaoin den tsórt san, tiocfaid chun bheith agus beid, ar an lá ceaptha, lasmuich de chás dá bhforáltar a mhalairt leis an alt so, dílsithe sa chomhairle agus dá gcuid féin acu no i seilbh ar iontaoibh dóibh, gan leithliú ná sannadh ar bith do dhéanamh ortha ach amháin go ndéanfar, i gcás inar gá é, iad d'aistriú i leabhair aon bhaine, corpráide, no cuideachtan, agus san uile chun an estáit, an téarma, no an leasa uile chun a mbeid, díreach roimh an lá ceaptha, dílsithe sa tseanabhord no dá gcuid féin acu no i seilbh ar iontaoibh dóibh, ach fé réir na n-iontaobhas agus na gcothrom uile dheineann deifir don chéanna agus a bheidh ar marthain agus ionchólíonta an tráth san.
(2) Aon mhaoin, ceart, comhacht no príbhléid a thiocfaidh chun bheith dílsithe sa chomhairle no dá gcuid féin acu no i seilbh ar iontaoibh dóibh, féadfaidh an chomhairle, le hordú fé n-a séala, san do leithliú no d'aistriú, an lá ceaptha no dá éis, chun an bhúird sláinte phuiblí no chun an bhúird sláinte agus chonganta phuiblí (pe'ca aca é) do cheanntar nua agus oibreoidh gach ordú den tsórt san mar leithliú no mar aistriú éifeachtúil ar an maoin, ar an gceart, ar an gcomhacht no ar an bpríbhléid sin do réir téarmaí an orduithe sin ach ní gá an t-ordú san do stampáil mar leithliú no mar aistriú ar mhaoin.
(3) Más bord sláinte agus conganta phuiblí an seana-bhord ní oibreoidh an t-alt so chun aon mhaoin, ceart, comhacht no príbhléid, do bhí in úsáid ag an seana-bhord i bhfeidhmiú a bhfeidhmeanna maidir le fóirithin na mbocht no do bhí dílsithe sa bhord san no i seilbh ar iontaoibh acu le húsáid sa bhfeidhmiú san, do leithliú ná d'aistriú chun na comhairle.
(4) Má eiríonn aon amhras, aighneas, no ceist i dtaobh ce'ca dheineann no ná deineann an fo-alt deiridh sin roimhe seo den alt so aon mhaoin, ceart, comhacht no príbhléid áirithe d'eisceacht ón leithliú no ón aistriú dheineann an t-alt so isé an tAire bhéarfaidh breith ar an amhras, ar an aighneas no ar an gceist sin agus ní bheidh dul thar a bhreith ar an gcéanna.
Fiachaisí seana-bhúird d'aistriú.
12.—(1) Lasmuich de chás dá bhforáltar a mhalairt leis an alt so, na fiacha agus na fiachaisí go léir (ar a n-áimhítear stoc agus fiacha morgáiste agus fós fiachaisí nea-shocruithe d'éirigh as tortanna no as sáruithe connartha) a bheidh, díreach roimh an lá ceaptha, dlite ar an seana-bhord no fé n-a ndeachadar agus a bheidh gan íoc no gan glanadh acu, tiocfaid chun bheith agus beid, ar an lá ceaptha agus dá éis, ina bhfiacha no ina bhfiachaisí ar an gcomhairle agus déanfaidh an chomhairle iad d'íoc no do ghlanadh agus féadfar iad do bhaint díobh no a chur fhiachaint ortha iad d'íoc dá réir sin.
(2) Más bord sláinte agus conganta phuiblí an seana-bhord ní oibreoidh an t-alt so chun aon fhiacha ná fiachas, fé n-a ndeachaidh an seana-bhord i bhfeidhmiú a bhfeidhmeanna maidir le fóirithin na mbocht, d'aistriú chun na comhairle.
(3) Má eiríonn aon amhras, aighneas, no ceist i dtaobh ce'ca dheineann no ná deineann an fo-alt deiridh sin roimhe seo den alt so aon fhiacha no fiachas áirithe d'eisceacht ón aistriú chun na comhairle dheineann an t-alt so isé an tAire bhéarfaidh breith ar an amhras, ar an aighneas no ar an gceist sin agus ní bheidh dul thar a bhreith ar an gcéanna.
(4) An t-aistriú chun na comhairle dheineann an t-alt so ar aon fhiacha no fiachas ní dhéanfa sé deifir d'ionmhuirearacht chostaisí íoctha no glanta na bhfiacha no an fhiachais sin.
(5) I gcás an líomatáiste muirir do sna costaisí fé n-a raghaidh an chomhairle in íoc no i nglanadh fiacha no fiachais de chuid an tseana-bhúird do bheith có-theorannach le ceanntar nua no ar fad laistigh de cheanntar nua is tré bhord sláinte an cheanntair nua sin a déanfar agus isé an bord san a dhéanfaidh gach íocaíocht a dhéanfaidh an chomhairle in íoc no i nglanadh na bhfiacha no an fhiachais sin.
Líomatáistí muirir d'fhiachaisí seana-bhúird.
13.—(1) Beidh feidhm ag na forálacha so leanas maidir leis an líomatáiste muirir d'aon chostaisí fé n-a raghaidh an chomhairle in íoc fiachais de chuid an tseana-bhúird fé n-a ndeachthas i bhfeidhmiú Achtanna na Sclábhaithe (Éirinn), 1883 go 1931, (agus costaisí aisíoctha iasachtaí do fuarthas chun crícheanna na nAchtanna san d'áireamh), sé sin le rá:—
(a) más roimh an 1adh lá d'Abrán, 1933, do chuadhthas fén bhfiachas san cuirfear na costaisí sin de mhuirear ar an gceanntar nua ina mbeidh an líomatáiste ar ar muirearadh na costaisí sin ar an dáta ar a ndeachthas fútha amhlaidh; no, i gcás an líomatáiste sin do bheith i níos mó ná aon cheanntar nua amháin, ar na ceanntair nua san ina gcionúireachtaí do réir luacháil na coda den líomatáiste sin a bheidh i ngach ceanntar nua fé leith acu san fé seach;
(b) más ar an 1adh lá d'Abrán, 1933, no dá éis do chuadhthas fén bhfiachas san, ansan, an méid sin de sna costaisí sin fé n-a ndeachthas chun iostán do chur ar fáil i líomatáiste is cuid de cheanntar nua no maidir le haon iostáin do cuireadh ar fáil amhlaidh i líomatáiste den tsórt san, cuirfear iad de mhuirear ar an gceanntar nua san.
(2) Fé réir forálacha an fho-ailt deiridh sin roimhe seo den alt so agus fé réir aon choigeartuithe ar a gcó-aontófar fén Acht so agus gan dochar d'aon chomhacht chun líomatáiste mhuirir d'atharú is infheidhmithe de thurus na huaire fé aon Acht eile (pe'ca roimh an Acht so no dá éis do ritheadh é) déanfar, an lá ceaptha agus dá éis, costaisí aisíoctha aon fhiachais de chuid an tseana-bhúird a haistrítear chun na comhairle leis an gCuid seo den Acht so do chur de mhuirear ar an líomatáiste ar a raibh sé de mhuirear díreach roimh an lá ceaptha.
(3) Má eiríonn aon amhras, aighneas, no ceist i dtaobh an líomatáiste mhuirir do chostaisí aisíoctha aon fhiachais de chuid an tseana-bhúird a haistreofar chun na comhairle fén Acht so isé an tAire bhéarfaidh breith ar an amhras, ar an aighneas no an gceist sin agus ní bheidh dul thar a bhreith ar an gcéanna.
Orduithe íocaíochta seana-bhúird.
14.—Aon ordú íocaíochta bheidh tugtha amach ag an seanabhord agus ná beidh tíolaicthe chun a íoctha roimh an lá ceaptha no aon údarás a bheidh tugtha uaidh ag seana-bhord chun méid an orduithe íocaíochta san d'íoc ní bheidh sé nea-dhleathach ná ní déanfar deifir do toisc deireadh do chur leis an seana-bhord no aon cheann dá gcomhachta d'aistriú leis an Acht so agus déanfaidh an chomhairle socrú chun go n-íocfar gach ordú íocaíochta den tsórt san no, más bord sláinte agus conganta phuiblí an seana-bhord, gach ordú íocaíochta den tsórt san do bhéarfar amach chun fiachais do ghlanadh fé n-a ndeachthas chun críche ar bith eile seachas fóirithin na mbocht, ar é thíolacadh go cuibhe laistigh d'am réasúnta tar éis an lae cheaptha.
Comhachta speisialta seana-bhúird d'aistriú.
15.—(1) Gach comhacht, ceart, príbhléid, no údarás do bronnadh ar an seana-bhord no do dílsíodh ionta le haon chonnradh, có-aontú, no ceadúnas no fén gcéanna agus a bheidh ann díreach roimh an lá ceaptha tiocfa sé chun bheith agus beidh sé, lasmuich de chás dá bhforáltar a mhalairt leis an alt so, ar an lá ceaptha agus sa mhéid go mbeidh sé le feidhmiú i gceanntar nua no maidir le ceanntar nua no sa chó-cheanntar no maidir leis an gcó-cheanntar a bheidh có-theorannach le ceanntar nua no ina mbeidh ceanntar nua, aistrithe chun búird sláinte agus conganta phuiblí an cheanntair nua san agus dílsithe ionta agus as san amach beidh sé infheidhmithe ag an mbord san.
(2) Más bord sláinte agus conganta phuiblí an seana-bhord ní oibreoidh an t-alt so chun aistrithe do dhéanamh ar aon chomhacht, ceart, príbhléid no údarás a bheidh bronnta ar an seanabhord no dílsithe ionta i dtaobh feidhmiú a bhfeidhmeanna maidir le fóirithin na mbocht.
(3) Má éiríonn aon amhras, aighneas no ceist i dtaobh ce'ca dheineann no ná deineann an fo-alt deiridh sin roimhe seo den alt so aon chomhacht, ceart, príbhléid no údarás áirithe d'eisceacht ón aistriú dheineann an t-alt so, isé an tAire bhéarfaidh breith ar an amhras, ar an aighneas no ar an gceist sin agus ní bheidh dul thar a breith ar an gcéanna.
Connartha leanúnacha do choimeád i bhfeidhm.
16.—(1) Lasmuich de chás dá bhforáltar a mhalairt leis an alt so, gach banna, urraíocht, no urrús eile de shaghas leanúnach do rinne an seana-bhord no do thugadar do dhuine eile no do rinne duine ar bith no do thug sé don tseana-bhord agus a bheidh i bhfeidhm díreach roimh an lá ceaptha agus gach connradh no có-aontú i scríbhinn do rinneadh idir an seana-bhord agus duine eile agus ná beidh feidhmithe go hiomlán an lá ceaptha, leanfaid i bhfeidhm an lá ceaptha agus dá éis d'ainneoin deireadh do chur leis an seana-bhord no comhachta d'aistriú ón seana-bhord (pe'ca aca é) leis an Acht so, ach sa mhéid go mbainfid le ceanntar nua no le có-cheanntar a bheidh có-theorannach le ceanntar nua no ina mbeidh ceanntar nua léireofar iad agus beidh éifeacht acu fé is dá gcuirtí ainm bhúird sláinte an cheanntair nua san isteach ionta in ionad ainme an tseana-bhúird agus beidh an t-urrús, an connradh no an có-aontú san ionfhoirfheidhmithe ag bord sláinte an cheanntair nua san agus ortha dá réir sin.
(2) Más bord sláinte agus conganta phuiblí an seana-bhord ní dhéanfaidh an t-alt so aon deifir do léiriú ná d'fhoirfheidhmiú aon urrúis, connartha, no có-aontuithe áirithe do rinne no le n-ar ghlac no fé n-a ndeachaidh an seana-bhord i bhfeidhmiú a bhfeidhmeanna maidir le fóirithin na mbocht.
(3) Má eiríonn aon amhras, aighneas no ceist i dtaobh ce'ca dheineann no ná deineann an fo-alt deiridh sin roimhe seo den alt so cosc do chur leis an alt so do dhéanamh deifreach do léiriú no d'fhoirfheidhmiú aon urrúis, connartha no có-aontuithe áirithe isé an tAire bhéarfaidh breith ar an amhras, ar an aighneas no ar an gceist sin agus ní bheidh dul thar a bhreith ar an gcéanna.

17.—(1) Lasmuich de chás dá bhforáltar a mhalairt leis an alt so, gach fo-dhlí, riail no rialachán a bheidh déanta go dleathach ag an seana-bhord roimh an lá ceaptha maidir le haon líomatáiste a bheidh no 'na mbeidh aon chuid de i gceanntar nua no i gcócheanntar a bheidh có-theorannach le ceanntar nua no ina mbeidh ceanntar nua agus a bheidh i bhfeidhm sa líomatáiste sin díreach roimh an lá ceaptha leanfa sé i bhfeidhm agus beidh éifeacht aige an lá ceaptha agus dá éis sa méid sin den líomatáiste sin a bheidh laistigh den cheanntar nua no den chó-cheanntar san (pe'ca aca é) mar fho-dhlí, mar riail no mar rialachán (pe'ca aca é) do dhéanfadh bord sláinte an cheanntair sin an lá ceaptha maidir leis an líomatáiste sin no leis an gcuid sin fé seach go ceann a mbeidh gan caitheamh an uair sin den tréimhse dá ndearna an seana-bhord an céanna, agus dá réir sin féadfaidh bord sláinte an cheanntair nua san gach fo-dhlí, riail, agus rialachán den tsórt san do bhuanú, d'atharú, no do cheiliúradh agus pionóisí agus geallbhruideanna eireoidh dá ndruim an lá ceaptha no dá éis do bhaint amach agus d'fhoirfheidhmiú sa tslí chéanna ina bhféadfadh agus chó hiomlán agus d'fhéadfadh an seana-bhord an céanna do bhunú, d'atharú, do cheiliúradh, do bhaint amach, no d'fhoirfheidhmiú dá mba ná tiocfadh an t-ordú roinnte i bhfeidhm.

(3) Má eiríonn aon amhras, aighneas no ceist i dtaobh ce'ca dheineann no ná deineann an fo-alt deiridh sin roimhe seo den alt so cosc do chur leis an alt so do dhéanamh deifreach d'oibriú aon fho-dhlí, rialach no rialacháin áirithe isé an tAire bhéarfaidh breith ar an amhras, ar an aighneas no ar an gceist sin agus ní bheidh dul thar a bhreith ar an gcéanna.
Rúin, etc., do bhuanú.
18.—Gach rún a bheidh rithte agus gach ordú bheidh déanta agus gach fógra bheidh seirbheálta ag an seana-bhord roimh an lá ceaptha i dtaobh ní ar bith seachas fóirithin na mbocht agus go mbeidh a n-oibriú no a n-éifeacht no a dtéarma gan bheith scurtha no caithte roimh an lá san, leanfaidh gach ceann acu i bhfeidhm agus beidh éifeacht aige an lá ceaptha agus dá éis, sa mhéid go mbainfidh le haon cheanntar nua no le haon chó-cheanntar a bheidh có-theorannach le ceanntar nua no ina mbeidh ceanntar nua no sa mhéid go mbeidh éifeacht aige sa chéanna, fé is dá mba rún é do rithfeadh no ordú do dhéanfadh no fógra do sheirbheálfadh bord sláinte an cheanntair nua san ar an dáta ar ar rith no ar a ndearna no ar ar sheirbheáil an seana-bhord an céanna agus fé is dá mbeadh comhachta agus feidhmeanna an tseana-bhúird, maidir le nithe seachas fóirithin na mbocht, aistrithe cheana féin chun búird sláinte an cheanntair nua san ar an dáta deiridh a luaidhtear.
Imeachta dlí ar feitheamh do bhuanú.
19.—(1) I ngach aicsean, agra, cúiseamh no imeacht eile, maidir le haon chomhachta no feidhmeanna de chuid an tseanabhúird seachas comhachta agus feidhmeanna bhaineann le fóirithin na mbocht, a bheidh ar feitheamh an lá ceaptha in aon chúirt no bínse agus inar páirtí an seana-bhord tiocfaidh comharba no comharbaí an tseana-bhúird do réir bhrí an ailt seo chun bheith agus beidh sé no siad, an lá ceaptha, ina pháirtí no ina bpáirtithe (do réir mar a bheidh) san imeacht san in ionad an tseana-bhúird agus leanfar den imeacht san idir an comharba no na comharbaí sin agus na páirtithe eile inti dá réir sin agus ní thuitfidh aon imeacht den tsórt san ar lár ná ní heireofar aisti ná ní déanfar dochar di toisc deireadh do chur leis an seana-bhord.
(2) Chun crícheanna an ailt seo isí an chomhairle comharba an tseana-bhúird, agus gach bord sláinte do cheanntar nua bheidh, de bhuadh aon aistrithe déanfar ar chomhachta no ar fheidhmeanna leis an Acht so no fé, tagtha chun baint do bheith aige leis na himeachta bheidh i gceist agus dá dtagartar sa bhfo-alt deiridh sin roimhe seo den alt so no chun bheith i mbaol na himeachta san do dhéanamh deifreach do beidh sé sin freisin, chun na gcrícheanna san, ina chomharba don tseana-bhord.
(3) Isiad a bhéarfaidh breith ar gach amhras, aighneas no ceist i dtaobh ce'ca tá no ná fuil duine áirithe ina chomharba don tseana-bhord do réir bhrí an ailt seo ná an chúirt no an bínse ina mbeidh no gur ina láthair a bheidh an imeacht san ar feitheamh gur eirigh an t-amhras, an t-aighneas no an cheist sin ina taobh agus ní bheidh dul thar breith na cúirte no an bhínse sin ar an gcéanna.
Leabhair an tseana-bhúird do bheith ionghlactha i bhfianaise.
20.—(1) Gach leabhar agus scríbhinn eile go mbeidh orduithe no údaruithe don tseana-bhord, le haon reacht no fé, iad do choimeád agus do bheadh ionghlactha i bhfianaise díreach roimh an lá ceaptha déanfar, d'ainneoin deireadh do chur leis an seana-bhord no feidhmeanna d'aistriú ón seana-bhord leis an Acht so no fé, iad do ghlacadh i bhfianaise tar éis an lae cheaptha chó hiomlán is dá mba ná déanfaí an t-ordú roinnte.
(2) Pé uair a bheadh sliocht as lánas no deimhniú ar lánas aon leabhair no scríbhinne eile, go mbeidh orduithe no údaruithe don tseana-bhord, le haon reacht no fé, é do choimeád, i bhfeidhmiú aon fheidhmeanna seachas fóirithin na mbocht, ionghlactha mar fhianaise ar an lánas san díreach roimh an lá ceaptha ach an sliocht no an deimhniú san do bheith fíoruithe ar shlí áirithe ag oifigeach áirithe don tseana-bhord, déanfar sliocht as lánas no deimhniú ar lánas an leabhair no na scríbhinne sin, ach san do bheith fíoruithe ar an slí áirithe sin ag an oifigeach don chomhairle no do bhord sláinte ceanntair nua is có-ionann leis an oifigeach áirithe sin, do ghlacadh an lá ceaptha agus dá éis mar fhianaise ar an lánas san sa mhéid chéanna go ndéanfaí an sliocht no an deimhniú san a céad-luaidhtear do ghlacadh amhlaidh dá mba ná déanfaí an t-ordú roinnte.
Cuntaisí an tseana-bhúird d'iniúchadh.
21.—(1) Déanfar na cuntaisí ar fháltaisí agus ar chaiteachas uile an tseana-bhúird agus oifigeacha fé seach an tseana-bhúird go dtí an lá ceaptha d'iniúchadh chó luath agus is féidir é tar éis an lae sin agus déanfar, bainfear amach agus foirfheidhmeofar nea-lomhála, formhuirir, muirir agus pionóisí maidir leis na cuntaisí, leis na fáltaisí agus leis an gcaiteachas san sa tslí céanna, sa mhéid gur féidir é, ina ndéanfaí san dá mba ná déanfaí an t-ordú roinnte.
(2) Gach oifigeach don tseana-bhord dar dualgas aon chuntaisí ar fháltaisí no ar chaiteachas an tseana-bhúird do dhéanamh suas no cuntas do thabhairt in aon chuid díobh tuigfear, go dtí go gcríochnófar iniúchadh cuntaisí na bhfáltas agus an chaiteachais sin go dtí an lá ceaptha agus chun crícheanna an iniúchta san, é do leanúint in oifig agus é bheith de cheangal air na dualgaisí céanna do chólíonadh agus na cuntaisí céanna do thabhairt uaidh agus an fhreagarthacht chéanna do bheith air fé is ná déanfaí an t-ordú roinnte.
Forálacha i dtaobh oifigeacha don tseana-bhord.
22.—(1) Déanfaidh an seana-bhord scéim (dá ngairmtear an scéim san alt so) d'ullamhú, lá nách déanaí ná dhá mhí roimh an lá ceaptha, ag déanamh socruithe, i gcás gach oifigigh don tseana-bhord, chun a sheirbhíse do bhunú no chun deireadh do chur léi an lá ceaptha no dá éis agus nuair a bheidh an scéim ullamhuithe amhlaidh cuirfidh an seana-bhord chun an Aire í agus cuirfid in úil do gach oifigeach den tsórt san na nithe bheidh beartuithe ina thaobh sa scéim.
(2) Déanfar socrú leis an scéim i dtaobh gach oifigigh le n-a mbainfidh—
(a) chun an oifigigh sin do bhuanú i seirbhís bhúird sláinte cheanntair de sna ceanntair nua san oifig do bhí aige díreach roimh an lá ceaptha no in oifig chó-réire go ndualgaisí có-réire, no
(b) chun an oifigigh sin do cheapadh, do réir dlí agus le n-a thoil, chun oifige i seirbhís bhúird sláinte cheanntair nua no i seirbhís na Comhairle, no
(c) chun an oifigigh sin do chur as oifig.
(3) Má deintear leis an scéim oifigeach do bhuanú in oifig i seirbhís bhúird sláinte cheanntair nua no é do cheapadh chun oifige i seirbhís aon bhúird den tsórt san no i seirbhís na Comhairle agus ná tógfaidh dualgaisí na hoifige sin a chuid aimsire go léir féadfar freisin, fé réir forálacha an fho-ailt deiridh sin roimhe seo den alt so, an t-oifigeach san do bhuanú in oifig no oifigí eile no é do cheapadh chun oifige no oifigí eile i seirbhís an bhúird sin no i seirbhís aon bhúird sláinte eile cheanntair nua no i seirbhís na Comhairle agus féadfar socrú do dhéanamh dá réir sin leis an scéim.
(4) Isé an tAire bhéarfaidh breith ar gach aighneas i dtaobh ce'ca tá no ná fuil oifig i gcó-réir le hoifig eile no dualgaisí oifige i gcó-réir le dualgaisí oifige eile no i dtaobh ce'ca thógann no ná tógann dualgaisí oifige aimsir uile oifigigh do réir bhrí an ailt seo agus ní bheidh dul thar a bhreith ar an gcéanna.
(5) Féadfaidh oifigeach ar bith don tseana-bhord, lá nách déanaí ná mí roimh an lá ceaptha, a chur in úil don Aire go bhfuil sé i gcoinnibh na nithe atá beartuithe ina thaobh sa scéim.
(6) Daingneoidh an tAire an scéim, roimh an lá ceaptha, go pé atharuithe (más aon cheann é) is dóich leis is ceart do dhéanamh uirthi (tré chur léi no tré fhágaint ar lár no ar shlí eile).
(7) Beidh éifeacht ag an scéim, mar a bheidh sí daingnithe ag an Aire fén alt so, an lá ceaptha agus dá éis, agus dá réir sin déanfar gach oifigeach le n-a mbainfidh an scéim do bhuanú in oifig no do cheapadh chun oifige no do chur as oifig do réir a mbeidh beartuithe sa scéim agus í daingnithe amhlaidh.
(8) Chun crícheanna na n-achtachán a bhaíneann le haoisliúntas agus le cúiteamh mar gheall ar chailiúint oifige tuigfear, roimh an lá ceaptha, gach oifigeach a cuirfear as oifig do réir an ailt seo do bheith curtha as oifig ag an seana-bhord agus, tar éis an lae cheaptha, é do bheith curtha as oifig ag an gcomhairle agus san (i ngach cás) ar chúis eile seachas mí-iompar no mí-ábaltacht.
Orduithe coigeartuithe.
23.—(1) Má bhíonn aon fheidhm de chuid an tseana-bhúird á fheidhmiú roimh an lá ceaptha maidir le líomatáiste ná beidh ar fad in aon cheanntar nua amháin agus, chun go bhféadfar an fheidhm sin d'fheidhmiú go cuibhe tar éis an lae cheaptha, gur gá éinní no aon rud do choigeartú agus ná deintear aon tsocrú ar aon tslí eile leis an Acht so i dtaobh an choigeartuithe sin féadfaidh an tAire ordú coigeartuithe (dá ngairmtear ordú coigeartuithe san Acht so) do dhéanamh ag coigeartú an ní no an ruda san.
(2) Féadfar ordú coigeartuithe do dhéanamh roimh an lá ceaptha no dá éis ach ní thiocfaidh aon ordú coigeartuithe i ngníomh roimh an lá ceaptha.
(3) Féadfaidh forálacha d'aon tsórt acu so leanas bheith in ordú coigeartuithe, sé sin le rá:—
(a) forálacha chun dhá bhord sláinte no níos mó do cheanntair nua do chó-úsáid mhaoine;
(b) forálacha chun búird sláinte cheanntair nua d'fheidhmiú feidhmeanna maidir le ceanntar nua eile ar pé téarmaí is dóich leis an Aire is réasúnta;
(c) forálacha chuirfidh mar cheangal ar bhord sláinte ceanntair nua íocaíochtaí do dhéanamh le bord sláinte ceanntair nua eile;
(d) forálacha chun na comhairle féin d'fheidhmiú aon fheidhme de chuid an tseana-bhúird agus ag ceapadh an líomatáiste mhuirir maidir leis an bhfeidhmiú san;
(e) i gcás comhacht do bheith ag an seana-bhord no dualgas do bheith ortha daoine do thoghadh no d'ainmniú chun bheith ina mbaill de chólucht phuiblí eile, forálacha chun na comhachta no an dualgais sin do roinnt idir dhá bhord sláinte no níos mó do cheanntair nua agus chun a chinneadh cadé an méid daoine den tsórt san a thoghfaidh no ainmneoidh gach bord fé leith den tsórt san fé seach;
(f) ag déanamh socruithe i dtaobh éinní no aon ruda eile is dóich leis an Aire is gá chun na feidhme sin de chuid an tseana-bhúird le n-a mbainfidh an t-ordú coigeartuithe d'fheidhmiú go cuibhe agus go héifeachtúil tar éis an lae cheaptha.
(4) Sara ndéanfaidh an tAire ordú coigeartuithe bhéarfa sé fógra míosa ar a laighead don chomhairle agus (más tar éis an lae cheaptha déanfar an t-ordú coigeartuithe) do gach bord sláinte ceanntair nua dá ndéanfaidh an t-ordú san deifir á rá go bhfuil sé chun an t-ordú coigeartuithe do dhéanamh, agus breithneoidh aon chúis a phléifidh an chomhairle no aon bhord den tsórt san leis i rith an mhí sin.
(5) Gach foráil a cuirfear go dleathach in ordú coigeartuithe beidh lán-fheidhm agus lán-éifeacht reachtúil aici ar theacht i ngníomh don ordú choigeartuithe sin agus dá éis.

LOCAL GOVERNMENT (AMENDMENT) (NO. 2) ACT, 1934.
PART I.
Preliminary and General.
Short title, citation, and construction.
1.—(1) This Act may be cited as the Local Government (Amendment) (No. 2) Act, 1934.
(2) The Principal Acts and this Act may be cited together as the Local Government Acts, 1925 to 1934.
(3) This Act shall be construed as one with the Principal Acts.
Definitions.
2.—In this Act—
the expression “the Minister” means the Minister for Local Government and Public Health;
the expression “the Principal Acts” means the Local Government Acts, 1925 to 1933;
the expression “the Act of 1925” means the Local Government Act, 1925 (No. 5 of 1925).
Expenses of the Minister.
3.—All expenses incurred by the Minister in the execution of this Act shall, to such extent as shall be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Public inquiries.
4.—(1) The Minister may before exercising any power conferred on him by this Act hold a public inquiry into the matter which is the subject of such exercise of such power.
(2) Article 32 of the Schedule to the Local Government (Application of Enactments) Order, 1898, shall apply in respect of every public inquiry held under this section of this Act in like manner as the said Article applies in respect of the local inquiries mentioned therein.
PART II.
Division of Counties into two or more County Health Districts.
Dividing orders.
5.—(1) On the request at any time (whether before or after the passing of this Act) of the council of a county, the Minister may, if he so thinks fit, make an order (in this Act referred to as a dividing order)—
(a) declaring that there shall be, as from the commencement of such order, a specified number (not less than two) of rural sanitary districts in such county, and
(b) specifying the portion of such county which is to be included in and constitute each such rural sanitary district and, so far as may be requisite, defining the boundaries of each such rural sanitary district, and
(c) appointing a day, not less than three months after the date of such order, to be the appointed day for the purposes of such order.
(2) Every dividing order shall come into operation on the day which is appointed by such order to be the appointed day for the purposes thereof.
Alteration of number of members of the county council.
6.—(1) Whenever the Minister has made a dividing order, he may, if he so thinks fit on the request of the council of the county to which such dividing order relates, by order, made at any time before the day which is the appointed day for the purposes of such dividing order, alter in such manner as he shall think fit the number of members of such council.
(2) An order made by the Minister under this section shall, without any confirmation by the Oireachtas, come into operation and have effect on and after the first election of the members of the council to which such order relates held after the said appointed day.
Alteration of county electoral areas.
7.—(1) Where the Minister has made a dividing order and either or both of the following circumstances exist, that is to say:—
(a) one or more of the county electoral areas in the county to which such dividing order relates is, at the date of such order, situate partly in one and partly in another or others of the new rural sanitary districts constituted by such order, and
(b) the Minister has altered, under the power in that behalf conferred on him by this Act, the number of members of the council of such county,
the Minister shall, in exercise of the powers in that behalf vested in him by section 1 of the Local Government (Ireland) Act, 1919, make a new division of the said county into county electoral areas and shall so make such division that every county electoral area in such county shall be wholly within one or other of the said new rural sanitary districts.
(2) Whenever the Minister, in pursuance of this section, divides a county into county electoral areas he shall fix the number of the members of the council of such county to be elected for each such county electoral area.
Effect of a dividing Order.
8.—Whenever the Minister has made a dividing order the following provisions shall, on and from the day which is the appointed day for the purposes of such order, have effect in relation to the county to which such order relates, that is to say:—
(a) the area of such county which is, at the date of such order, a rural sanitary district shall cease to be a rural sanitary district;
(b) there shall be constituted by virtue of such order in such county the number of rural sanitary districts specified in such order, and each such rural sanitary district shall contain the portion of such county specified in that behalf in such order;
(c) the council of such county shall be the sanitary authority for each of the said rural sanitary districts so constituted;
(d) each of the said rural sanitary districts shall be a county health district within the meaning of the Principal Acts and shall be called by the name of the “county Health District of_____________” (with the addition of the name of the county and such distinguishing name as the Minister shall direct);
(e) subject to the provisions of this Act, the Principal Acts shall apply and have effect in and in relation to every such rural sanitary district and county health district as if such district had been constituted by an order made under sub-section (2) of section 9 of the Act of 1925;
(f) if there is a board of public health in and for such county at the date of such order, such board shall be dissolved and cease to exist.
The boards of health of new districts.
9.—(1) Rules 1, 2, 6, 7, and 8 of the Second Schedule to the Act of 1925 shall not apply or have effect in relation to the board of health of a county health district constituted under this Act.
(2) The board of health of every county health district constituted under this Act shall—
(a) on and from the day which is the appointed day for the purposes of the relevant dividing order until the first annual meeting of the council of the county in which such county health district is situate held after the election of the members of such council held next after the date of the said dividing order, consist of such and so many members as such council shall direct and shall elect from amongst their members, and
(b) from and after the said first annual meeting, consist of the members of such council elected for the county electoral area or areas comprised in such county health district.
PART III.
Provisions Consequential on the Division of a County Into County Health Districts.
Application and interpretation of this Part of this Act.
10.—(1) Whenever the Minister has made a dividing order, this Part of this Act shall, as on and from the day which is the appointed day for the purposes of such order, come into operation and apply and have effect in relation to the county to which such order relates, and accordingly the following expressions have in the subsequent sections of this Part of this Act the meanings hereinafter assigned to them respectively, that is to say:—
the expression “the dividing order” means the said dividing order the making of which occasions the coming into operation of this Part of this Act;
the expression “the county” means the county to which the said dividing order relates;
the expression “the council” means the council of the said county;
the expression “the existing district” means the county health district existing in the said county at the date of the said dividing order;
the expression “the existing board” means the board of public health or the board of health and public assistance (as the case may be) for the said county health district so existing as aforesaid;
the expression “new district” means a county health district constituted in pursuance of the said dividing order;
the expression “the appointed day” means the day which is the appointed day for the purposes of the said dividing order.
(2) Without prejudice to or derogation from the operation and effect of the provision contained in this Act requiring this Act to be construed as one with the Principal Acts, it is hereby declared that the expression “joint district” has in this Part of this Act the meaning given to it in sub-section (2) of section 1 of the Local Government Act, 1927 (No. 3 of 1927), and that the proviso to that sub-section shall have effect accordingly.
Transfer of property of existing board.
11.—(1) Save as is otherwise provided by this section, all property whether real or personal (including choses-in-action) which immediately before the appointed day is vested in or belongs to or is held in trust for the existing board and all rights, powers, and privileges relating to or connected with any such property shall, on the appointed day and without any conveyance or assignment but subject where necessary to transfer in the books of any bank, corporation, or company, become and be vested in or the property of or held in trust for the council, for all the estate, term or interest for which the same immediately before the appointed day was vested in or belonged to or was held in trust for the existing board, but subject to all trusts and equities affecting the same and then subsisting and capable of being performed.
(2) Any property, right, power, or privilege which becomes vested in or the property of or held in trust for the council under this section may, on or after the appointed day, be conveyed or transferred by the council by order under their seal to the board of public health or the board of health and public assistance (as the case may be) of a new district, and every such order shall operate as an effective conveyance or transfer of such property, right, power, or privilege, according to the terms of such order, but such order shall not require to be stamped as a conveyance or transfer of property.
(3) Where the existing board is a board of health and public assistance, this section shall not operate to convey or transfer to the council any property, right, power, or privilege used by the existing board in the performance of its functions for the relief of the poor, or vested in or held in trust by that board for use in such performance.
(4) If any doubt, dispute, or question shall arise whether any particular property, right, power or privilege is excluded by the next preceding sub-section of this section from the conveyance or transfer effected by this section, such doubt, dispute or question shall be decided by the Minister, whose decision thereon shall be final.
Transfer of liabilities of existing board.
12.—(1) Save as is otherwise provided by this section, every debt and other liability (including stock and mortgage debts and also including unliquidated liabilities arising from torts or breaches of contract) which, immediately before the appointed day, is owing and unpaid or has been incurred and is undischarged by the existing board shall, on and from the appointed day, become and be the debt or liability of the council and shall be paid or discharged by and may be recovered from or enforced against the council accordingly.
(2) Where the existing board is a board of health and public assistance, this section shall not operate to transfer to the council any debt or liability which was incurred by the existing board in the performance of its functions for the relief of the poor.
(3) If any doubt, dispute, or question shall arise whether any particular debt or liability is excluded by the next preceding sub-section of this section from the transfer to the council effected by this section, such doubt, dispute or question shall be decided by the Minister, whose decision thereon shall be final.
(4) The transfer to the council by this section of any debt or liability shall not affect the chargeability of the expenses of paying or discharging such debt or liability.
(5) Where the area of charge for the expenses incurred by the council in the payment or discharge of a debt or liability of the existing board is co-terminous with or wholly within a new district, all payments made by the council in payment, or discharge of such debt or liability shall be made through and by the board of health for such new district.
Areas of charge for liabilities of existing board.
13.—(1) The following provisions shall apply in respect of the area of charge for any expenses incurred by the council in the payment of a liability of the existing board incurred in the execution of the Labourers (Ireland) Acts, 1883 to 1931, (including the expenses of repaying loans borrowed for the purposes of those Acts), that is to say:—
(a) where such liability was incurred before the 1st day of April, 1933, such expenses shall be charged on the new district in which is situate the area upon which such expenses were charged at the date on which they were so incurred; or, if such area is situate in more than one new district, on such new districts in proportion to the valuation of the portion of such area situate in each such new district respectively;
(b) where such liability was incurred on or after the 1st day of April, 1933, so much of such expenses as was incurred for the purpose of the provision of cottages in an area forming part of a new district or in relation to any cottages so provided in such an area shall be charged on such new district.
(2) Subject to the provisions of the next preceding sub-section of this section and to any agreed adjustments made under this Act and without prejudice to any power of altering an area of charge for the time being exercisable under any other Act (whether passed before or after this Act) the expenses of repaying any liability of the existing board which is transferred to the council by this Part of this Act shall, on and after the appointed day, be charged on the area on which it was charged immediately before the appointed day.
(3) If any doubt, dispute, or question shall arise as to the area of charge for the expenses of repaying any liability of the existing board which is transferred to the council under this Act, such doubt, dispute or question shall be decided by the Minister whose decision thereon shall be final.
Paying orders of existing board.
14.—The abolition of the existing board or the transfer of any of its powers by this Act shall not invalidate or affect any paying order which may have been issued by the existing board and not presented for payment before the appointed day nor any authority given by the existing board for the payment of the amount of such paying order, and the council shall make arrangements for the payment of every such paying order or, where the existing board is a board of health and public assistance, of every such paying order which is issued in settlement of a liability incurred for any purpose other than the relief of the poor, upon due presentation within a reasonable time after the appointed day.
Transfer of special powers of existing board.
15.—(1) Save as is otherwise provided by this section, every power, right, privilege, or authority conferred on or vested in the existing board by or under any contract, agreement, or licence and in existence immediately before the appointed day shall, on the appointed day and in so far as it is to be exercised in or in relation to a new district or the joint district which is coterminous with or includes a new district, become and be transferred to and vested in and shall thenceforth be exercisable by by the board of health for such new district.
(2) Where the existing board is a board of health and public assistance this section shall not operate to transfer any power, right, privilege, or authority conferred on or vested in the existing board in relation to the performance of its functions for the relief of the poor.
(3) If any doubt, dispute, or question shall arise whether any particular power, right, privilege, or authority is excluded by the next preceding sub-section of this section from the transfer effected by this section, such doubt, dispute, or question shall be decided by the Minister, whose decision thereon shall be final.
Preservation of continuing contracts.
16.—(1) Save as is otherwise provided by this section, every bond, guarantee, or other security of a continuing character made or given by the existing board to another person or by any person to the existing board and in force immediately before the appointed day and every contract or agreement in writing made between the existing board and another person and not fully executed on the appointed day shall, notwithstanding the abolition of the existing board or the transfer of powers from the existing board (as the case may be) by this Act, continue in force on and after the appointed day but shall, in so far as it relates to a new district or to a joint district which is coterminous with or includes a new district, be construed and have effect as if the name of the board of health of such new district were substituted therein for the name of the existing board, and such security, contract, or agreement shall be enforceable by or against the board of health of such new district accordingly.
(2) Where the existing board is a board of health and public assistance this section shall not affect the construction or enforcement of any particular security, contract, or agreement made or accepted or entered into by the existing board in the performance of its functions for the relief of the poor.
(3) If any doubt, dispute, or question shall arise whether the construction or enforcement of any particular security, contract or agreement is prevented by the next preceding sub-section of this section from being affected by this section, such doubt, dispute, or question shall be decided by the Minister whose decision thereon shall be final.
Continuance of bye-laws, etc.
17.—(1) Save as is otherwise provided by this section, every bye-law, rule or regulation lawfully made by the existing board before the appointed day in respect of any area which, or any part of which, is included in a new district or in a joint district which is coterminous with or includes a new district and in force in such area immediately before the appointed day shall, on and after the appointed day continue in force and have effect in so much of such area as is within such new district or joint district (as the case may be) as a bye-law, rule or regulation (as the case may be) made by the board of health for such new district on the appointed day in respect of such area or part respectively for the residue then unexpired of the period for which the same was actually made by the existing board, and accordingly every such bye-law, rule, and regulation may be continued, varied, or revoked and penalties and forfeitures arising thereunder on or after the appointed day may be recovered and enforced by the board of health of such new district in the like manner and as fully as the same could have been continued, varied, revoked, recovered, or enforced by the existing board if the dividing order had not come into force.
(2) Where the existing board is a board of health and public assistance this section shall not affect the operation of any bye-law, rule or regulation made by the existing board in the performance of its functions for the relief of the poor.
(3) If any doubt, dispute, or question shall arise whether the operation of any particular bye-law, rule or regulation is prevented by the next preceding sub-section of this section from being affected by this section, such doubt, dispute, or question shall be decided by the Minister whose decision thereon shall be final.
Continuance of resolutions, etc.
18.—Every resolution passed, order made, and notice served by the existing board before the appointed day relating to any matter other than the relief of the poor, the operation, effect, or term of which has not ceased or expired before that day shall, on and after the appointed day and in so far as it relates to or has effect in any new district or any joint district which is coterminous with or includes a new district, continue in force and have effect as if it were a resolution passed, order made, or notice served by the board of health of such new district on the date on which the same was actually passed, made, or served by the existing board and as if the powers and functions of the existing board relating to matters other than the relief of the poor were on the last mentioned date already transferred to the board of health of such new district.
Continuance of pending legal proceedings.
19.—(1) In every action, suit, prosecution or other proceeding relating to any powers or functions of the existing board, other than powers and functions relating to the relief of the poor, which is pending on the appointed day in any court or tribunal and to which the existing board is a party, the successor or successors of the existing board within the meaning of this section shall, on the appointed day, become and be a party or parties (as the case may be) to such proceeding in the place of the existing board, and such proceeding shall be continued between such successor or successors and the other parties thereto accordingly, and no such proceeding shall abate or be discontinued or prejudicially affected by reason of the abolition of the existing board.
(2) For the purposes of this section the council shall be the successor of the existing board, and for those purposes every board of health of a new district which, by virtue of any transfer of powers or functions by or under this Act, has become concerned in or liable to be affected by the relevant proceedings referred to in the foregoing sub-section of this section shall also be a successor of the existing board.
(3) Every doubt, dispute, or question as to whether any particular person is or is not a successor of the existing board within the meaning of this section shall be determined by the court or tribunal in or before which the proceeding in relation to which such doubt, dispute, or question has arisen is pending, and the decision of such court or tribunal thereon shall be final.
Admissibility in evidence of books of existing board.
20.—(1) All books and other documents directed or authorised by or under any statute to be kept by the existing board and which immediately before the appointed day would be receivable in evidence shall, notwithstanding the abolition of the existing board or the transfer of functions from the existing board by or under this Act, be admitted in evidence after the appointed day as fully as if the dividing order had not been made.
(2) Whenever an extract from or certificate of the contents of any book or other document directed or authorised by or under any statute to be kept by the existing board in the exercise of any functions other than the relief of the poor would, if verified in a particular manner by a particular officer of the existing board, have been admissible immediately before the appointed day as evidence of such contents, an extract from or certificate of the contents of such book or document shall, if verified in such particular manner by the officer of the council or of the board of health of a new district corresponding to such particular officer, be admitted on or after the appointed day as evidence of such contents to the same extent as such first mentioned extract or certificate would have been so admitted if the dividing order had not been made.
Audit of accounts of existing board.
21.—(1) The accounts of all receipts and expenditure of the existing board and of the respective officers of the existing board up to the appointed day shall, as soon as may be after that day, be audited and disallowances, surcharges, charges, and penalties in relation to such accounts, receipts, and expenditure shall be made, recovered and enforced in like manner as nearly as may be as if the dividing order had not been made.
(2) Every officer of the existing board whose duty it is to make up any accounts of or to account for any portion of the receipts or expenditure of the existing board shall, until the audit of the accounts of such receipts and expenditure up to the appointed day is completed, be deemed for the purposes of such audit to continue in office and to be bound to perform the same duties and render the same accounts and to be subject to the same liabilities as if the dividing order had not been made.
Provisions in regard to officers of existing board.
22.—(1) A scheme (in this section referred to as “the scheme”) making provision in the case of every officer of the existing board for the continuance or discontinuance of his service on and after the appointed day shall be prepared not later than two months before the appointed day by the existing board, and the existing board shall transmit the scheme when so prepared to the Minister and shall notify every such officer of the proposals relating to him contained in the scheme.
(2) The scheme shall provide in respect of every officer to which it relates either—
(a) for the continuance of such officer in the service of the board of health of one of the new districts, either in the office he held immediately before the appointed day or in an analogous office with analogous duties, or
(b) for the appointment of such officer according to law and with his consent to an office in the service of the board of health of a new district or in the service of the Council, or
(c) for the removal of such officer from office.
(3) Where by the scheme an officer is continued in an office in the service of the board of health of a new district or is appointed to an office in the service of any such board or in the service of the Council and the whole of his time is not occupied by the duties of such office, such officer may also, subject to the provisions of the next preceding sub-section of this section, be continued in or appointed to another office or to other offices in the service of such board or in the service of any other board of health of a new district or in the service of the Council, and the scheme may make provision accordingly.
(4) Every dispute as to whether an office is analogous to another office, or as to whether the duties of an office are analogous to the duties of another office, or whether the whole of an officer's time is occupied within the meaning of this section by the duties of an office, shall be determined by the Minister whose decision thereon shall be final.
(5) Any officer of the existing board may, not later than one month before the appointed day, notify the Minister that he objects to the proposals relating to him contained in the scheme.
(6) The Minister shall, before the appointed day, confirm the scheme, with such (if any) alterations (whether by addition, omission or variation) as he may think fit to make therein.
(7) The scheme as confirmed by the Minister under this section shall have effect on and from the appointed day, and accordingly every officer to whom the scheme relates shall be either continued in or appointed to an office or removed from office in accordance with the proposals in the scheme as so confirmed.
(8) Every officer who is removed from office in pursuance of this section shall, for the purposes of the enactments relating to superannuation and to compensation for loss of office, be deemed before the appointed day to have been removed from office by the existing board and after the appointed day to have been removed from office by the council for (in each case) a cause other than misconduct or incapacity.
Adjustment Orders.
23.—(1) Where before the appointed day any function of the existing board is exercised in relation to an area the whole of which is not included in one new district, and in order that such function may be duly performed after the appointed day any matter or thing requires to be adjusted and no provision for such adjustment is otherwise made by this Act, the Minister may make an order (in this Act referred to as an adjustment order) adjusting such matter or thing.
(2) An adjustment order may be made either before or after the appointed day, but no adjustment order shall come into operation before the appointed day.
(3) An adjustment order may include provisions of any of the following kinds, that is to say:—
(a) provisions for the joint user of property by two or more boards of health of new districts;
(b) provisions for the performance by the board of health of one new district of functions in relation to another new district on such terms as the Minister thinks reasonable;
(c) provisions requiring the board of health of one new district to make payments to the board of health of another new district;
(d) provisions for the performance of any of the functions of the existing board directly by the council and fixing the area of charge for such performance;
(e) in the case of a power or duty of the existing board to elect or nominate persons to be members of another public body, provisions for the division of such power or duty between two or more boards of health of new districts and for determining the number of such persons to be elected or nominated by each such board respectively;
(f) providing for any other matter or thing which the Minister considers necessary for the due and effective performance after the appointed day of the function of the existing board to which the adjustment order relates.
(4) Before making an adjustment order the Minister shall give to the council and (where the adjustment order is made after the appointed day) to every board of health of a new district affected by such order, not less than one month's notice of his intention to make the adjustment order, and shall consider any representations received by him during such month from the council or any such board.
(5) Every provision validly included in an adjustment order shall, on and after the coming into operation of such adjustment order, have full statutory force and effect.
