Mínithe.
1.—San Acht so, cialluíonn an focal “na Coimisinéirí” Coimisinéirí na nOibreacha Puiblí in Éirinn agus na focail uile go dtugtar bríonna speisialta dhóibh sa Local Government (Ireland) Act, 1898, tá leo na bríonna speisialta a tugtar amhlaidh dóibh fé seach.
Féadfidh na Coimisinéirí oibreacha dréineála do dheisiú.
2.—(1) Féadfidh na Coimisinéirí o am go ham mar is oiriúnach leo agus nuair is oiriúnach leo é, innealtóir no duine inniúil eile do cheapa chun cigireacht do dhéanamh agus tuarasgabháil do thabhairt ar staid na n-oibreacha dréineála in aon cheanntar dréineála.
(2) Má chítar do sna Coimisinéirí ó thuarasgabháil aon innealtóra den tsórt san no duine eile den tsórt san, go bhfuil na hoibreacha dréineála in aon cheanntar dréineála gan bheith ina leithéid sin de dhea-ordú, do threo agus de riocht go bhfuilid ceart agus oiriúnach, dar leis na Coimisinéirí, i gcóir na críche a ceapadh dóibh, féadfidh na Coimisinéirí pé oibreacha a dhéanamh is dó leo is gá chun na hoibreacha dréineála sa cheanntar dréineála san do dheisiú go ceart agus go héifeachtúil, agus mar chuid de sna hoibreacha san féadfar aon fheabhsuithe, is gá no is ceart dar leis na Coimisinéirí agus ná raghaidh chun díobhála d'einne, do dhéanamh ar na hoibreacha dréineála san.
(3) Gach ceann no aon cheann de sna comhachta a bronnadh ar na Coimisinéirí leis an Drainage Maintenance Act, 1866, fé mar a hoiriúnuíodh no a hatharuíodh é le haon achtachán is déanaí ná san, i dtaobh oibreacha a dhineadar fén Acht san, beidh sé ag na Coimisinéirí agus féadfid é fheidhmiú í dtaobh aon oibreacha a dhéanfid fén Acht so.
Gnó dréineála d'aistriú chun comhairlí contae.
3.—(1) Má dhinid na Coimisinéirí aon oibreacha fén Acht so in aon cheanntar dréineála nár dineadh gnó an bhúird dréineála no na n-iontaobhaithe ann d'aistriú chun comhairle chontae fé alt 20 den Local Government (Ireland) Act, 1898, féadfidh an tAire Rialtais Áitiúla agus Sláinte Puiblí, ar chríochnú na n-oibreacha san, gnó bórd dréineála no iontaobhaithe an cheanntair dréineála san d'aistriú go dtí an chomhairle chontae cheart no go dtí na comhairlí contae cearta tré ordú a dhéanfa sé i bhfeidhmiú na gcomhacht a bronntar air chuige sin leis an alt san 20, mar a leasuítear leis an alt so é, agus ní gá chuige sin an bórd dréineála ná na hiontaobhaithe sin do thoiliú leis an aistriú san.
(2) Aon ordú a dhéanfidh an tAire Rialtais Áitiúla agus Sláinte Puiblí do réir an fho-ailt sin roimhe seo, ní gá é dhaingniú mar Ordú Sealadach.
Airgead do sholáthar i gcóir oibreacha fén Acht so.
4.—(1) An t-airgead is gá i gcóir costas aon oibreacha a dhéanfidh na Coimisinéirí fén Acht so in aon cheanntar dréineála, is mar leanas a soláthrófar é:—
(a) amach as airgead a sholáthróidh an tOireachtas féadfidh an tAire Airgid oiread agus is dó leis is ceart den chostas san d'íoc ach gan san a bheith níos mó in aon chás ná leath costas iomlán na n-oibreacha a déanfar fén Acht so sa cheanntar dréineála san;
(b) féadfidh comhairle na contae ina luíonn an ceanntar dréineála no aon chuid de íoc do dhéanamh ar an gcuma a foráltar ina dhiaidh seo anso, i pé méid den chostas san is dó leis an gcomhairle sin is ceart agus an tAire Rialtais Áitiúla agus Sláinte Puiblí ag aontú leo, ach an tsuim a íocfidh an chomhairle sin no, más i níos mó ná aon chontae amháin a luíonn an ceanntar, an tsuim iomlán a íocfidh comhairlí na gcontae uile ina luíonn an ceanntar, ní ragha sí thar leath costas iomlán na n-oibreacha a déanfar fén Acht so sa cheanntar san;
(c) roimh-íocfidh na Coimisinéirí ar an gcuma a foráltar ina dhiaidh seo anso an bhreis a bheidh ag an gcostas san ar na suimeanna (más ann dóibh) a soláthrófar fé sna míreanna san roimhe seo.
(2) Chun crícheanna an Achta so, áireofar mar chuid de chostas aon oibreacha do dhéanamh gach fo-chostas a bhainfidh le déanamh na n-oibreacha san.
Rann-íoc o chomhairlí contae.
5.—(1) Chun crícheanna an mhéid den Acht so le n-a n-údaruítear do chomhairle chontae cuid de chostas oibreacha a dhéanfidh na Coimisinéirí fén Acht so d'íoc féadfidh comhairle chontae airgead d'fháil ar iasacht fé Airtiogal 22 den Local Government (Application of Enactments) Order, 1898, fé is dá mbeadh na crícheanna san luaidhte san airtiogal san, agus airgead a gheobhfar ar iasacht chun na gcrícheanna roimhráite, ní háireofar é mar chuid d'fhiacha na contae chun crícheanna an airtiogail sin.
(2) Fé réir forálacha an ailt seo, is tríd an ráta dealbhais mar mhuirear ar an gcontae iomlán a soláthrófar costas aon iasachta a gheobhfar fén alt so agus an t-airgead chun an iasacht san d'aisíoc agus chun an t-ús uirthe d'íoc, ach féadfidh an chomhairle chontae rún do rith go ndéanfar, in ionad an costas agus an t-airgead san do ghearra mar mhuirear contae iomláine, an costas agus an t-airgead san do ghearra mar mhuirear baile no mar mhuirear ceanntair ar aon bhailecheanntar no bailecheanntair, tuathcheanntar no tuathcheanntair, dar dineadh tairfe go speisialta de bharr na n-oibreacha gur soláthruíodh an iasacht ina gcóir.
(3) Aon rún a rithfidh comhairle chontae do réir an fho-ailt sin roimhe seo ní ragha sé in éifeacht mara ndinidh ná go dtí go ndéanfidh an tAire Rialtais Áitiúla agus Sláinte Puiblí é dhaingniú, ach má dhineann agus nuair a dhéanfidh an tAire sin é dhaingniú, tar éis é atharú no gan é atharú, pe'ca tré chur leis no baint as, raghaidh an rún san in éifeacht, agus é daingnithe amhlaidh, ar an dáta agus ón dáta a luadhfar ann chun na críche sin agus mara luaidhtear aon dáta den tsórt san ann ar an gcuma san, is ón dáta ar ar rith an chomhairle chontae an rún a raghaidh an rún in éifeacht.
(4) Ní dhaingneoidh an tAire Rialtais Áitiúla agus Sláinte Puiblí aon rún den tsórt san roimhráite go dtí—
(a) gur deimhin leis gur dhin an chomhairle chontae laistigh de sheachtain tar éis rithte an rúin, fógra ina thaobh do chur chun comhairle gach ceanntair chontae le n-a mbaineann an rún, agus
(b) go mbreithneoidh an tAire sin aon aithris cúise i dtaobh an rúin a leagfidh aon chomhairle cheanntair den tsórt san fé n-a bhráid laistigh de mhí tar éis an fógra ina thaobh bheith curtha chúcha amhlaidh.
(5) Sara ndaingnighidh an tAire Rialtais Áitiúla agus Sláinte Puiblí aon rún den tsórt san, féadfa sé, más oiriúnach leis é fiosrúchán áitiúil do chur ar bun i dtaobh an rúin sin agus le gach fiosrúchán áitiúil den tsórt san bainfidh Airtiogal 32 den Sceideal a ghabhann leis an Local Government (Application of Enactments) Order, 1898.
Roimh-íocanna o sna Coimisinéirí.
6.—(1) An cion a bheidh le soláthar ag na Coimisinéirí de chostas aon oibreacha a déanfar fén Acht so in aon cheanntar dréineála déanfidh na Coimisinéirí é roimh-íoc amach as airgead atá fé n-a gcúram agus is ceaduithe a thabhairt ar iasacht agus beidh sé ionaisíoctha leis na Coimisinéirí, maraon le hús do réir an ráta a ordóidh an tAire Airgid—
(a) más in aon chontae amháin a luíonn an ceanntar dréineála go léir, ag comhairle na contae sin; agus
(b) más i dhá gcontae no níos mó a luíonn an ceanntar dréineála, ag comhairlí na gcontaethe sin sna cionúireachtaí a cheapfidh na Coimisinéirí.
(2) Ar bheith críochnuithe d'aon oibreacha a dhéanfidh na Coimisinéirí fén Acht so i gceanntar dréineála no, más oiriúnach leis na Coimisinéirí é, ar bheith críochnuithe d'aon chuid fé leith de sna hoibreacha san, gheobhaidh na Coimisinéirí amach costas na n-oibreacha san no na coda san díobh a bheidh críochnuithe amhlaidh agus cadé an cion den chostas san atá le roimh-íoc ag na Coimisinéirí fén alt so, agus déanfid ordú muirir fén Drainage Maintenance Act, 1866, maidir leis an gcion san agus leis an ús air do réir an ráta roimhráite.
(3) Beidh gach ordú muirir den tsórt san i pé fuirm a horduítear leis an Drainage Maintenance Act, 1866, tar éis pé atharuithe dhéanamh uirri is gá a dhéanamh de bharr forálacha an Achta so agus, fé réir aon atharuithe no oiriúnuithe a dineadh ar an Acht san le haon Acht ina dhiaidh sin agus fé réir forálacha an Achta so, bainfidh le hordú muirir a déanfar do réir an ailt seo gach foráil den Acht san a bhainfadh le hordú muirir a déanfí fén Acht san.
Chun suimeanna fé ordú muirir fén Acht so do bhailiú.
7.—(1) Na suimeanna uile agus fé seach a muirearófar le hordú muirir a déanfar fén Acht so, ar na tailte sa cheanntar le n-a mbaineann an t-ordú, beid iníoctha, agus déarfar san ordú iad do bheith iníoctha, le comhairle na contae ina luíonn an talamh agus, chun na suimeanna san d'fháil, beidh ag an gcomhairle sin gach aon cheann riamh de sna comhachta, na cearta, agus na leighseanna a bronntar leis an Drainage Maintenance Act, 1866, ar na Coimisinéirí chun suimeanna d'fháil a muirearófaí le hordú muirir a déanfí fé, agus féadfidh an chomhairle iad d'fheidhmiú chuige sin.
(2) Gach suim a leagfar ar aon únaer le hordú muirir no do réir ordú muirir a déanfar fén Acht so, beidh sí iontógtha o shealbhaire an tailimh agus iníoctha aige agus ionbhainte dhe marab é an t-únaer féin is sealbhaire ar an talamh agus déanfidh na Coimisinéirí pé roinnte is gá chun an fo-alt so do chur in éifeacht, ach an fiachas a bheidh ar shealbhaire fén alt so beidh sé gan dochar d'aon cheart chun aon tsuim den tsórt san dá n-íocfa sé do bhaint as an gcíos is iníoctha aige.
(3) Beidh sé de dhualgas ar chomhairle aon chontae ina luíonn ceanntar dréineála no aon chuid de cheanntar dréineála le n-a mbaineann ordú muirir a dineadh fén Acht so gach suim iníoctha do bhailiú o unaerí no (marab é an t-únaer féin an sealbhaire) o shealbhairí oiread agus luíonn sa chontae sin de sna tailte a cuireadh fé mhuirear leis an ordú san, sé sin, gach suim is iníoctha ag únaerí na dtailte sin leis an gcomhairle sin fén ordú muirir, agus déanfar agus féadfar aon tsuim den tsórt san do bhailiú agus do bhaint amach ar an gcuma na ndintar no 'nar féidir ráta dealbhais do bhailiú agus do bhaint amach.
(4) Bainfidh alt 54 den Drainage and Improvement of Lands Act (Ireland), 1863, le gach airgead a leagfar agus a cuirfar mar ráta agus mar cháin ar únaerí agus ar a dtailte do réir aon ordú muirir a déanfar fén Acht so.
An fiachas a bheidh ag na Coimisinéirí ar chomhairlí contae.
8.—(1) Déanfar le gach ordú muirir a dhéanfid na Coimisinéirí do réir an Achta so, i dteanta aon mhuirir a déanfar leis do réir an Drainage Maintenance Act, 1866, no do réir aon ailt eile den Acht so—
(a) más ag aon chomhairle chontae amháin atá an tsuim, le n-a mbaineann an t-ordú, ionaisíoctha leis na Coimisinéirí de bhua an Achta so, an tsuim sin agus an t-ús uirthi do chur mar mhuirear ar chiste chontae na comhairle sin; agus
(b) más ag dhá chomhairle chontae no níos mó atá an tsuim sin íonaisíoctha leis na Coimisinéirí de bhua an Achta so, a fhaisnéis cadiad na cionúireachtaí ina bhfuil an tsuim sin ionaisíoctha ag na comhairlí sin agus an tsuim sin agus an t-ús uirthi do chur mar mhuirear ar chistí contae fé seach na gcomhairlí sin sna cionúireachtaí a faisnéiseadh amhlaidh; agus
(c) a fhaisnéis i gcás ar bith cadiad na tráthanna agus cadé an chuma go bhfuil na suimeanna san agus an t-ús ortha iníoctha ag an gcomhairle contae no ag na comhairlí contae fé seach leis na Coimisinéirí.
(2) Gach suim agus ús a muirearófar ar chiste chontae le haon ordú muirir a déanfar fén Acht so, isí an chomhairle chontae 'na muirearófar an céanna ar a gciste contae a íocfidh é leis na Coimisinéirí, agus san ar na tráthanna agus ar an gcuma a faisnéiseadh leis an ordú muirir, agus is amach as an airgead a bhaileoid o únaerí no o shealbhairí na dtailte ar ar muirearadh an céanna a íocfidh an chomhairle sin é agus marar leor an t-airgead san agus sa mhéid nách leor é, amach as an gciste contae, agus soláthrófar é tríd an ráta dealbhais mar mhuirear contae iomláine.
(3) Gach airgead is iníoctha leis na Coimisinéirí ag comhairle chontae do réir an ailt seo, féadfidh na Coimisinéirí é fháil ón gcomhairle sin le haicsean dlí.

9.—(1) Baineann an t-alt so le gach suim atá, no a bheidh ina dhiaidh seo, ionbhailithe ag comhairle chontae, pe'ca mar ráta chun dréineáil do choinneáil suas é no fé ordú muirir no ar aon tslí eile, o sna tailte i gceanntar dréineála no o únaerí na dtailte sin de dheascaibh gnó bord dréineála no iontaobhaithe an cheanntair dréineála san do bheith aistrithe, no do bheith á aistriú ina dhiaidh seo, chun na comhairle contae sin.
(2) Gach suim le n-a mbaineann an t-alt so agus a leagadh ar únaer, marab é an t-únaer féin is sealbhaire ar an talamh beidh sí iontógtha o shealbhaire an tailimh agus iníoctha aige agus ionbhainte dhe thar ceann únaer an tailimh, agus féadfidh na Coimisinéirí pé roinnte do dhéanamh is gá chun an fo-alt so do chur in éifeacht, ach an fiachas a bheidh ar shealbhaire fén alt so beidh sé gan dochar d'aon cheart chun aon tsuim den tsórt san dá n-íocfa sé do bhaint as an gcíos is iníoctha aige.
(3) Déanfidh agus féadfidh an chomhairle chontae aon tsuim le n-a mbaineann an t-alt so do bhailiú agus do bhaint amach ar an gcuma 'na ndintar no 'nar féidir ráta dealbhais do bhailiú agus do bhaint amach.
(4) Bainfidh alt 54 den Drainage and Improvement of Lands Act (Ireland), 1863, le gach airgead a baileofar o shealbhaire tailimh, no a bainfar de, agus a íocfa sé do réir an ailt seo.

DRAINAGE MAINTENANCE ACT, 1924.
Definitions.
1. In this Act, the expression “the Commissioners” means the Commissioners of Public Works in Ireland, and all expressions to which special meanings are assigned by the Local Government (Ireland) Act, 1898, have the special meanings so assigned to them respectively.
Commissioners may repair drainage works.
2.—(1) The Commissioners may from time to time as and when they think fit, appoint an engineer or other competent person to inspect and report upon the state of the drainage works in any drainage district.
(2) If it shall appear to the Commissioners, from the report of any such engineer or other person, that the drainage works in any drainage district are not in such good order, repair, and condition as to be fit and proper in the opinion of the Commissioners for their intended purpose, the Commissioners may execute such works as they shall consider necessary for the proper and effective repair of the drainage works in that drainage district, and such works may include any improvements to such drainage works which in the opinion of the Commissioners are necessary or proper and will not injuriously affect any person.
(3) The Commissioners shall have and may exercise in relation to any works executed by them under this Act, all or any, such powers as are conferred on them by the Drainage Maintenance Act, 1866, as adapted or modified by any later enactment in relation to works executed by them under that Act.
Transfer of drainage business to county councils.
3.—(1) Where the Commissioners execute any works under this Act in any drainage district in which the business of the drainage board or the trustees has not been transferred to a county council under section 20 of the Local Government (Ireland) Act, 1898, the Minister for Local Government and Public Health upon the completion of such works shall by order made in exercise of the powers in that behalf conferred on him by the said section 20, as amended by this section, transfer the business of the drainage board or the trustees of that drainage district to the proper county council or county councils, and for that purpose the consent of such drainage board or trustees to such transfer shall not be necessary.
(2) No order made by the Minister for Local Government and Public Health, pursuant to the foregoing sub-section, shall require confirmation as a Provisional Order.
Provision of money for works under this Act.
4.—(1) The money required to meet the cost of the execution of any works under this Act by the Commissioners in any drainage district shall be provided as follows:—
(a) the Minister for Finance may pay out of moneys to be provided by the Oireachtas so much as he shall think proper of such cost but not more in any case than one-half of the total cost of the works executed under this Act in that drainage district;
(b) the council of the county in which the drainage district or any part thereof is situate may contribute in manner hereinafter provided, so much of such cost as such council shall, with the approval of the Minister for Local Government and Public Health think proper, but the sum contributed by such council, or where the district is situate in more than one county, the total sum contributed by the councils of the several counties in which the district is situate, shall not exceed one-half of the total cost of the works executed under this Act in that district;
(c) the balance of such cost over and above the amounts (if any) provided under the foregoing paragraphs shall be advanced by the Commissioners in manner hereinafter provided.
(2) For the purposes, of this Act, the cost of the execution of any works shall include all expenses incidental to the execution of such works.
Contribution by county councils.
5.—(1) For the purposes of so much of this Act as authorises a county council to make a contribution to the cost of works executed by the Commissioners under this Act, a county council may borrow money under Article 22 of the Local Government (Application of Enactments) Order, 1898, in like manner as if those purposes were mentioned in that article, and money borrowed for the purposes aforesaid shall not be reckoned as part of the debt of the county for the purposes of the said article.
(2) The cost of any loan borrowed under this section and the moneys for the repayment thereof and for payment of the interest thereon shall, subject to the provisions of this section, be raised by means of the poor rate as a county-at-large charge, but the county council may resolve that such cost and moneys shall, instead of being levied as a county-at-large charge, be levied as an urban charge or a district charge off any urban or rural district or districts specially benefited by the works in respect of which the loan was raised.
(3) A resolution passed by a county council pursuant to the foregoing sub-section shall not take effect unless and until confirmed by the Minister for Local Government and Public Health, but if and when confirmed, whether with or without modification, whether by way of addition or omission by that Minister such resolution as so confirmed shall take effect as on and from the date specified therein for that purpose or if no such date is so specified as from the date on which the resolution was passed by the county council.
(4) The Minister for Local Government and Public Health shall not confirm any such resolution as aforesaid until—
(a) he is satisfied that notice of the resolution was sent by the county council within one week after the passing thereof to the council of every county district affected by the resolution, and
(b) the said Minister has considered any representations made to him in regard to the resolution by any such district council within one month after the notice thereof was so sent to them.
(5) The Minister for Local Government and Public Health before confirming any such resolution may if he thinks fit hold a local inquiry in regard to such resolution and Article 32 of the Schedule to the Local Government (Application of Enactments) Order, 1898, shall apply to every such local inquiry.
Advances by the Commissioners.
6.—(1) The proportion to be provided by the Commissioners of the cost of any works executed under this Act in any drainage district shall be advanced by the Commissioners out of moneys under their control and applicable to loans and shall be repay able to the Commissioners with interest at the rate directed by the Minister for Finance—
(a) where the drainage district is wholly situate in one county, by the council of that county; and
(b) where the drainage district is situate in two or more counties, by the councils of those counties in the proportions fixed by the Commissioners.
(2) Upon the completion of any works executed under this Act by the Commissioners in a drainage district, or if the Commissioners so think proper on the completion of any distinct part of such works, the Commissioners shall ascertain the cost of such works or of the part-thereof so completed, and the proportion: of such cost to be advanced by the Commissioners under this section, and shall make in respect of such proportion and the interest thereon at the rate aforesaid a charging order under the Drainage Maintenance Act, 1866.
(3) Every such charging order shall be in such form as is prescribed by the Drainage Maintenance Act, 1866, with such modifications as may be rendered necessary by the provisions of this Act, and all the provisions of that Act in relation to a charging order made thereunder shall, subject to any modifications; or adaptations of that Act effected by any later Act and subject to the provisions of this Act, apply to a charging order made in pursuance of this section.
Collection of sums under charging order under this Act.
7.—(1) The several sums charged by a charging order made under this Act on the lands in the district to which the order relates shall be payable, and shall be expressed in the order to be payable, to the council of the county in which the land is situate, and that-council shall have and may exercise for the recovery of such sums all and every of the rights, powers, and remedies conferred by the Drainage Maintenance Act, 1866, on the Commissioners for the recovery of sums charged by a charging order made thereunder.
(2) Every sum assessed on any proprietor by or in pursuance of a charging order made under this Act shall where the proprietor is not also the occupier of the land be leviable on, payable by, and recoverable from the occupier of the land, and the Commissioners shall make such apportionments as may be necessary to give effect to this sub-section, but the liability of an occupier under, this section shall be without prejudice to any right to deduct any such sum paid by him from the rent payable by him.
(3) It shall be the duty of the council of any county in which is situate a drainage district or any part of a drainage district to which a charging order made under this Act applies to collect from the proprietors or (where the proprietor is not also the occupier) the occupiers of so much of the lands charged by such order as is situate in such county all sums payable by the proprietors of such lands to such council under the charging order, and any such sum shall and may be collected and recovered in the like manner as poor rate is or may be collected and recovered.
(4) Section 54 of the Drainage and Improvement of Lands Act (Ireland), 1863, shall apply to all moneys assessed, rated, and taxed on proprietors and their lands pursuant to any charging order made under this Act.
Liability of county councils to Commissioners.
8.—(1) Every charging order made by the Commissioners in pursuance of this Act shall, in addition to any charge made thereby in pursuance of the Drainage Maintenance Act, 1866, or any other section of this Act—
(a) if the sum to which the order relates is repayable to the Commissioners by virtue of this Act by one county council, charge such sum and the interest thereon on the county fund of that council; and
(b) if such sum is repayable to the Commissioners by virtue of this Act by two or more county councils, declare the proportions in which such sum is repayable by such councils and charge such sum and the interest thereon on the respective county funds of such councils in the proportions so declared; and
(c) in any case declare the times and manner at and in which such sums and the interest thereon are payable by the county council or respective county councils to the Commissioners.
(2) All sums and interest charged on a county fund by any charging order made under this Act shall be paid to the Commissioners by the county council on whose county fund the same is charged, at the times and in the manner declared by the charging order, and shall be paid by such council out of the moneys collected by them from the proprietors or the occupiers of the lands on which the same is charged and, if and so far as such moneys are not sufficient, out of the county fund and shall be raised by means of the poor rate as a county-at-large charge.
(3) All moneys payable to the Commissioners by the council of a county pursuant to this section may be recovered by the Commissioners from such council by action at law.
Collection of drainage maintenance rates, etc., by county councils.
9.—(1) This section applies to every sum which is or shall hereafter be collectable, whether by way of drainage maintenance rate, or under a charging order, or otherwise, by a county council from the lands in a drainage district or the proprietors of such, lands by reason of the business of the drainage board or trustees of that drainage district having been or being hereafter transferred to such county council.
(2) Every sum to which this section applies assessed on a proprietor shall where the proprietor is not also the occupier of the land be leviable on, payable by, and recoverable from the occupier of the land on behalf of the proprietor thereof, and the Commissioners shall make such apportionments as may be necessary to give effect to this sub-section, but the liability of an occupier under this section shall be without prejudice to any right to deduct any such sum paid by him from the rent payable by him.
(3) Any sum to which this section applies shall and may be collected and recovered by the county council in the like manner as poor rate is or may be collected and recovered.
(4) Section 54 of the Drainage and Improvement of Lands Act (Ireland), 1863, shall apply to all moneys collected or recovered from and paid by an occupier of land pursuant to this section.
Short title and commencement.
10.—(1) This Act may be cited as the Drainage Maintenance Act, 1924.
(2) This Act shall be construed as one with the Drainage Maintenance Act, 1866, and that Act and this Act may be cited together as the Drainage Maintenance Acts, 1866 and 1924.
(3) This Act shall be deemed to have come into force on the 1st day of April, 1924, and shall take effect as on and from that date.
