ACHT UM CHONGNAMH DHÍOMHAOINTIS, 1933.
CUID I.
Roimhraiteach agus Generalta.
Gearr-theideal.
1.—Féadfar an tAcht um Chongnamh Dhíomhaointis, 1933, do ghairm den Acht so.
Mínithe.
2.—(1) San Acht so—
cialluíonn an abairt “an tAire” an tAire Tionnscail agus Tráchtála;
cialluíonn an focal “orduithe” orduithe le rialacháin ar n-a ndéanamh ag an Aire fén Acht so.
(2) Is baile-líomatáiste chun crícheanna an Achta so gach líomatáiste fé leith acu so leanas, sé sin le rá:—
(a) gach contae-bhuirg,
(b) buirg Dhún Laoghaire,
(c) gach bailecheanntar go líon daoine (do réir an mhóráirimh dhaoine bheidh ina mhór-áireamh is déanaí den tsórt san de thurus na huaire) is mó ná seacht míle.
Tosach feidhme.
3.—(1) Tiocfaidh an tAcht so (ach amháin an méid sin de údaruíonn do dhaoine deimhnithe cáilíochta d'iarraidh no congnamh díomhaointis d'iarraidh) i bhfeidhm díreach ar é do rith.
(2) An méid sin den Acht so údaruíonn do dhaoine deimhnithe cáilíochta d'iarraidh tiocfa sé i bhfeidhm, maidir le gach bailelíomatáiste, pé lá ceapfar alos an líomatáiste sin le hordú ón Aire fén bhfo-alt so, agus féadfar laetheanta deifriúla do cheapadh amhlaidh maidir le baile-líomatáistí deifriúla no maidir le cuid de sna líomatáistí sin.
(3) An méid sin den Acht so údaruíonn do dhaoine deimhnithe cáilíochta d'iarraidh tiocfa sé i bhfeidhm, maidir le gach páirt de Shaorstát Éireann nách cuid d'aon bhaile-líomatáiste, pé lá ceapfar le hordú ón Aire fén bhfo-alt so.
(4) An méid sin den Acht so údaruíonn do dhaoine congnamh díomhaointis d'iarraidh tiocfa sé i bhfeidhm, maidir le gach bailelíomatáiste, pé lá ceapfar alos an líomatáiste sin le hordú ón Aire fén bhfo-alt so, agus féadfar laetheanta deifriúla do cheapadh amhlaidh maidir le baile-líomatáistí deifriúla no maidir le cuid de sna líomatáistí sin.
(5) An méid sin den Acht so údaruíonn do dhaoine congnamh díomhaointis d'iarraidh tiocfa sé i bhfeidhm, maidir le gach páirt de Shaorstát Éireann nách cuid d'aon bhaile-líomatáiste, pé lá ceapfar le hordú ón Aire fén bhfo-alt so.
(6) Is le haontú an Aire Airgid a déanfar gach ordú dhéanfaidh an tAire fén alt so.
Míniú ar dhíomhaointeas.
4.—(1) Ní tuigfear duine do bheith díomhaoin do réir bhrí an Achta so—
(a) aon lá oibríonn sé ar págh no ar luach saothair eile, pe'ca in airgead no in earraí no i slí eile ar bith a híocfar san, ná
(b) i rith aon tréimhse is tréimhse fostaíochta do réir bhrí an ailt seo maidir leis an duine sin.
(2) Chun crícheanna an Achta so déanfar dhá thréimhse dhíomhaointis nách giorra ná dhá lá an ceann, 'na mbeidh tréimhse eatorra nách sia ná dhá lá agus gur ceithre huaire fichead ar a mhéid a bheidh duine ar fostú le n-a linn, déanfar san d'áireamh mar thréimhse leanúnach dhíomhaointis maidir leis an duine sin, agus beidh brí dá réir sin leis an abairt “díomhaoin go leanúnach.”
(3) Féadfaidh an tAire, le rialacháin ar n-a ndéanamh aige fén Acht so, a ordú, go generálta no alos aon aicme no aicmí áirithe daoine no alos aon cheanntair no ceanntar áirithe, tréimhse ar bith do bheith ina tréimhse fostaíochta, agus dá réir sin ní déanfar duine ar bith den acime sin no bheidh ina chomhnaí sa cheanntar san d'áireamh, le linn na tréimhse fostaíochta san, mar dhuine díomhaoin do réir bhrí an Achta so.
Cleithiúnaithe.
5.—Chun crícheanna an Achta so isiad na daoine seo leanas agus ní haon daoine eile is cleithiúnaithe aon duine áirithe, sé sin le rá:—
(a) bean chéile an duine sin, i gcás í do bheith in éin-tigheas leis an duine sin agus gan í bheith ag obair (ar shlí seachas bheith ag gabháil dá gnáth-dhualgaisí tighe) de ghnáth ar págh no ar luach saothair eile agus sa chás san amháin, agus
(b) fear céile an duine sin, i gcás é do bheith in éin-tigheas leis an duine sin agus á chothú ag an duine sin agus nách féidir do de dheascaibh laige cuirp no aigne é féin do chothú agus sa chás san amháin, agus
(c) clann díomhaoin an duine sin (ar a n-áirmhítear leaschlann agus clann go ndearna sé no sí é féin no í féin do chur i loco parentis dóibh) ná fuil ocht mbliana déag slán acu agus gurb é an duine sin a dheineann iad do chothú ar fad no nách mór ar fad, agus
(d) máthair an duine sin, i gcás an duine sin do ghabháil air féin a bheith freagarthach ina cothú agus gan seachtó blian do bheith slán aice ach gur baintreach í agus nách féidir di de dheascaibh laige cuirp no aigne í féin do chothú no gur breoiteacháin í féin agus a fear céile agus nách féidir dóibh de dheascaibh laige cuirp no aigne iad féin do chothú agus sa chás san amháin, agus
(e) athair an duine sin, i gcás an duine sin do ghabháil air féin bheith freagarthach ina chothú agus gan seachtó blian do bheith slán aige ach gur breoiteachán é agus nách féidir do de dheascaibh laige cuirp no aigne é féin do chothú agus sa chás san amháin, agus
(f) driotháracha agus driofúracha an duine sin atá ina ndílleachtaithe agus ná fuil ocht mbliana déag slán acu agus gurb é an duine sin a dheineann de ghnáth iad do chothú no go bhfuil ocht mbliana déag slán acu agus ná fuil seachtó blian slán acu ach nách féidir dóibh, de dheascaibh laige cuirp no aigne, iad féin do chothú agus gurb é an duine sin a dheineann de ghnáth iad do chothú.
Oifigigh um chongnamh dhíomhaointis.
6.—(1) Féadfaidh an tAire, le ceadú an Aire Airgid, pé daoine agus pé méid daoine is dóich leis is ceart do cheapadh chun bheith ina n-oifigigh um chongnamh dhíomhaointis chun crícheanna an Achta so, agus beidh gach duine ceapfar amhlaidh i seilbh a oifige mar oifigeach den tsórt san ar pé téarmaí agus coinníollacha, agus ar pé luach saothair, a chinnfidh an tAire le ceadú an Aire Airgid.
(2) Féadfar, le rialacháin ar n-a ndéanamh ag an Aire fén Acht so, a ordú, fé réir forálacha an Achta so, cadé an cleachta agus an nós-imeachta gur dá réir a dhéanfaidh oifigigh um chongnamh dhíomhaointis feidhmiú ar a bhfeidhmeanna fén Acht so.
(3) San Acht so cialluíonn an abairt “oifigeach um chongnamh dhíomhaointis” oifigeach um chongnamh dhíomhaointis ar n-a cheapadh fén alt so.
Rialacháin.
7.—(1) Féadfaidh an tAire le hordú rialacháin do dhéanamh ag ordú éinní no aon ruda dá dtagartar san Acht so mar ní no mar rud atá orduithe no le hordú no ag ordú éinní no aon ruda a húdaruítear go soiléir leis an Acht so a ordú le rialacháin ar n-a ndéanamh ag an Aire fén Acht so.
(2) Féadfar, le rialacháin ar n-a ndéanamh ag an Aire fén alt so ag ordú fuirme iarratais chun críche ar bith fén Acht so, a cheangal ar an iarratasóir na ráitisí uile no aon cheann de sna ráitisí dhéanfaidh sa bhfuirm sin d'fhíorú le dearbhú reachtúil.
(3) Gach rialachán a déanfar fén Acht so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a dhéanta, agus má dheineann ceachtar Tigh den Oireachtas, laistigh den lá is fiche shuidhfidh an Tigh sin tar éis an rialacháin sin do leagadh fé n-a bhráid, rún do rith ag cur an rialacháin sin ar nea-mbrí, beidh an rialachán san curtha ar nea-mbrí dá réir sin, ach beidh san gan dochar do dhleathacht éinní do rinneadh roimhe sin fén rialachán san.
Oifigigh um chongnamh dhíomhaointis, etc., do thógaint dearbhú reachtúil.
8.—Má dheineann aon rialacháin a déanfar fén alt deiridh sin roimhe seo a cheangal ar an iarratasóir fíorú do dhéanamh le dearbhú reachtúil ar na ráitisí uile no ar aon cheann de sna ráitisí dhéanfaidh i bhfuirm iarratais a bheidh orduithe leis na rialacháin sin chun críche ar bith fén Acht so, féadfaidh oifigeach um chongnamh dhíomhaointis no aon oifigeach eile don Aire go n-údarás ón Aire chuige sin an dearbhú reachtúil sin do thógaint agus do ghlacadh.
CUID II.
Deimhnithe Cailiochta.
An Coiste Athchomharc Díomhaointis.
9.—(1) Chó luath agus bheidh caoi ann chuige sin tar éis an Achta so do rith bunóidh an tAire Coiste Athchomharc Díomhaointis chun crícheanna na Coda so den Acht so.
(2) Beidh ar an gCoiste Athchomharc Díomhaointis pé daoine agus pé méid daoine is rogha leis an Aire o am go ham a cheapadh chun bheith ina mbaill de.
(3) Féadfar, le rialacháin ar n-a ndéanamh ag an Aire fén Acht so, a ordú cadé an tsealbhuíocht agus an ré oifige bheidh ag baill den Choiste Athchomharc Díomhaointis agus cadé an cleachta agus an nós-imeachta gur dá réir a dhéanfaidh an Coiste sin feidhmiú ar a bhfeidhmeanna fén Acht so.
Deimhnithe cáilíochta.
10.—(1) Féadfaidh duine ar bith, fé réir forálacha an ailt so, deimhniú cáilíochta d'iarraidh sa tslí orduithe.
(2) Má iarrann duine deimhniú cáilíochta go cuibhe agus é de thurus na huaire i dteideal fén bhfo-alt deiridh sin roimhe seo san d'iarraidh agus má thaisbeánann an duine sin sa tslí orduithe go bhfuil sé do réir na gcoinníollacha, sa mhéid go mbainid leis an gcás, a luaidhtear sa chéad fho-alt ina dhiaidh seo den alt so beidh an duine sin i dteideal deimhnithe d'fháil (dá ngairmtear deimhniú cáilíochta san Acht so) á dheimhniú é do bheith do réir na gcoinníollacha san.
(3) Isiad na coinníollacha dá dtagartar sa bhfo-alt san roimhe seo den alt so mar na coinníollacha nách foláir do dhuine bheith dá réir agus é ag iarraidh deimhnithe cháilíochta ná:—
(a) gur náisiúnach de Shaorstát Éireann é;
(b) go bhfuil ocht mbliana déag slán aige ach ná fuil seachtó blian slán aige;
(c) ná fuil a acfuinn, ar n-a háireamh do réir an Achta so, níos mó, i gcás gur i gcontae-bhuirg no i mbuirg Dhún Laoghaire atá comhnaí air, ná dhá phúnt chaogad no, i gcás gur in aon áit eile i Saorstát Éireann atá comhnaí air, naoi bpúnt triochad sa bhliain;
(d) i gcás mná pósta—
(i) go bhfuil a fear céile mar chleithiúnaí dhi, no
(ii) ná fuil sí féin na a fear céile mar chleithiúnaí don duine eile agus go bhfuil cleithiúnaí no níos mó aice sin:
(e) i gcás baintrighe no mná single, go bhfuil cleithiúnaí no níos mó aice;
(f) i gcás baintrighe no mná single ná fuil aon chleithiúnaí aice, nách lugha ná dhá shíntiús chaogad a híocadh ina taobh, fé sna hAchtanna um Arachas Díomhaointis, 1920 go 1930, mar a leasuítear san le haon achtachán ina dhiaidh sin, i rith na tréimhse de cheithre bliana díreach roimh dháta an iarratais.
(4) Is sa bhfuirm orduithe bheidh gach deimhniú cáilíochta agus luadhfar ann cad is ráta seachtainiúil, do réir an ráta bhliantúla ar n-a áireamh san do réir an Achta so, d'acfuinn an duine le n-a mbaineann an deimhniú san.
(5) Ní dhéanfaidh duine ar bith aon deimhniú cáilíochta d'iarraidh mara dtagaidh an méid sin den Acht so, údaruíonn do dhaoine deimhnithe cáilíochta d'iarraidh, mara dtagaidh ná go dtí go dtiocfaidh an méid sin i bhfeidhm maidir leis an líomatáiste gur laistigh de chomhnuíonn an duine sin.
(6) Chun crícheanna an ailt seo is náisiúnach de Shaorstát Éireann gach duine acu so leanas, sé sin le rá:—
(a) duine do rugadh i Saorstát Éireann no sa líomatáiste gurb é Saorstát Éireann anois é;
(b) duine do rugadh lasmuich de Shaorstát Éireann no den líomatáiste gurb é Saorstát Éireann anois é ach gur i Saorstát Éireann no sa líomatáiste sin do bhí gnáthchomhnaí ar a mháthair nuair do rugadh an duine sin;
(c) duine bheidh ina ghnáth-chomhnaí i Saorstát Éireann le linn an ama bhaineann leis an gcás agus a bheidh tar éis bheith ina ghnáth-chomhnaí i Saorstát Éireann ar feadh cúig mblian ar a laighead as a chéile díreach roimh an am san.
Breith do thabhairt ar iarrataisí ar dheimhnithe cáilíochta.
11.—(1) Isé dhéanfaidh gach iarratas ar dheimhniú cáilíochta do ghlacadh agus do bhreithniú, agus isé bhéarfaidh breith ar gach iarratas den tsórt san agus ar gach ceist eireoidh ina thaobh, ná oifigeach um chongnamh dhíomhaointis, agus gach ceist eireoidh maidir le deimhniú cáilíochta tar éis an deimhnithe sin do thabhairt amach is oifigeach um chongnamh dhíomhaointis do bhéarfaidh breith uirthi sin freisin.
(2) Féadfaidh oifigeach um chongnamh dhíomhaointis, más dóich leis san do bheith ceart, aon iarratas no ceist a thiocfaidh fé n-a bhráid chun breithe do thabhairt air fén alt so do chur ar aghaidh chun an Choiste Athchomharc Díomhaointis sa tslí orduithe in ionad é féin do thabhairt breithe air.
(3) Einne ar a ngoillfe sé oifigeach um chongnamh dhíomhaointis do dhiúltú do ghéilleadh d'iarratas ón duine sin ar dheimhniú cáilíochta no ar a ngoillfidh an bhreith do bhéarfaidh oifigeach um chongnamh dhíomhaointis fén alt so ar aon chúrsa, féadfaidh, laistigh de lá is fiche tar éis an diúltuithe sin do dhéanamh no na breithe sin do thabhairt no laistigh de pé am breise (más ann do) a lomhálfaidh an tAire i gcás an duine sin, agus sa tslí orduithe, a cheangal ar an oifigeach san an diúltú no an bhreith sin do thuairisciú don Choiste Athchomharc Díomhaointis agus leis sin déanfaidh an t-oifigeach san an diúltú no an bhreith sin do thuairisciú don Choiste sin sa tslí orduithe.
(4) Déanfaidh an Coiste Athchomharc Díomhaointis gach iarratas, ceist agus breith a cuirfear ar aghaidh chúcha no tuairisceofar dóibh fén alt so do bhreithniú sa tslí orduithe agus cinneadh ina thaobh agus beidh cinneadh an Choiste sin, maidir le haon iarratas, ceist no breith den tsórt san, ina chinneadh dheiridh gan aon dul thairis.
Deimhnithe cáilíochta do cheiliúradh agus do leasú.
12.—(1) Pé uair a scuirfidh duine is sealbhóir ar dheimhniú cáilíochta de bheith do réir na gcoinníollacha luaidhtear sa deimhniú san, beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) déanfaidh an sealbhóir sin laistigh de sheacht lá tar éis an scurtha san an scur san agus an chúis do bhí leis do chur in úil d'oifigeach um chongnamh dhíomhaointis;
(b) má thárlann don tsealbhóir sin go dteipfidh air no go dtabharfaidh faillí maidir le déanamh do réir forálacha na míre deiridh sin roimhe seo beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fineáil ná raghaidh thar fiche púnt do chur air agus, i gcás cionta leanúnaigh, fíneáil bhreise ná raghaidh thar dhá phúnt in aghaidh gach lae leanfar den chionta.
(2) Pé uair is deimhin le hoifigeach um chongnamh dhíomhaointis go bhfuil duine is sealbhóir ar dheimhniú cáilíochta tar éis scur de bheith do réir na gcoinníollacha luaidhtear sa deimhniú san, déanfaidh an deimhniú san do cheiliúradh agus beidh éifeacht ag an gceiliúradh san o dháta an scurtha san.
(3) Pé uair is deimhin le hoifigeach um chongnamh dhíomhtaointis—
(a) gur tré chalaois no tré chamthuairisc chalaoisigh do fuarthas deimhniú cáilíochta, no
(b) gur tré aon chamthuairisc neamh-urchóidigh no dearmhad bona fide eile do fuarthas no do tugadh amach deimhniú cáilíochta,
déanfaidh an t-oifigeach san um chongnamh dhíomhaointis an deimhniú san do cheiliúradh agus beidh éifeacht ag an gceiliúradh san o dháta an deimhnithe sin do thabhairt amach i gcás an deimhnithe sin d'fháil tré chalaois no tré chamthuairisc chalaoisigh no o dháta an cheiliúrtha in aon chás eile.
(4) Pé uair is deimhin le hoifigeach um chongnamh dhíomhaointis go bhfuil méid acfuinne duine is sealbhóir ar dheimhniú cáilíochta tar éis atharú o tugadh amach an deimhniú san, ach ná fuil an acfuinn sin níos mó, i gcás gur i gcontae-bhuirg no i mbuirg Dhún Laoghaire atá comhnaí ar an duine sin, ná dhá phúnt chaogad no, i gcás gur in aon áit eile i Saorstát Éireann atá comhnaí ar an duine sin, naoi bpúnt triochad sa bhliain, féadfaidh an t-oifigeach san um chongnamh dhíomhaointis an deimhniú san do leasú i pé slí is gá.
(5) Pé uair a déanfar deimhniú cáilíochta do cheiliúradh fén alt so de bhithin an deimhnithe sin d'fháil tré chalaois no tré chamthuairisc chalaoisigh beidh an duine dar tugadh amach an deimhniú san dí-cháilithe, go ceann sé mhí tar éis an cheiliúrtha san, chun deimhnithe cháilíochta d'fháil no do shealbhú.
(6) Pé uair a dhéanfaidh oifigeach um chongnamh dhíomhaointis deimhniú cáilíochta do cheiliúradh no do leasú fén alt so, ansan, an duine ba shealbhóir ar an deimhniú san díreach roimh an gceiliúradh san no le linn an leasuithe sin féadfaidh, laistigh de lá is fiche tar éis an cheiliúrtha no an leasuithe sin no laistigh de pé am breise (más ann do) a lomhálfaidh an tAire i gcás an duine sin, agus sa tslí orduithe, a cheangal ar an oifigeach san an ceiliúradh san no an leasú san (pe'ca aca é) do thuairisciú don Choiste Athchomharc Díomhaointis, agus leis sin tuairisceoidh an t-oifigeach san an ceiliúradh san no an leasú san don Choiste sin sa tslí orduithe agus breithneoidh an Coiste sin an céanna.
(7) Déanfaidh an Coiste Athchomharc Díomhaointis gach ceiliúradh no leasú tuairisceofar dóibh fén alt so do bhreithniú sa tslí orduithe, agus féadfaid, do réir mar is dóich leo is ceart, aon cheiliúradh den tsórt san do dhaingniú, no é do chur ar neambrí agus féadfaid, do réir mar is dóich leo is ceart, aon leasú den tsórt san do dhaingniú, no é do chur ar nea-mbrí, no é d'atharú, agus i ngach cás den tsórt san beidh breith an Choiste sin ina breith dheiridh gan aon dul tháirsi.
(8) Má ceiliúrtar deimhniú cáilíochta déanfaidh sealbhóir an deimhnithe sin, ar n-a éileamh san air d'oifigeach um chongnamh dhíomhaointis, an deimhniú san do sheachadadh láithreach don oifigeach san agus coimeádfaidh seisean é.
(9) Gach duine dá dtárlóidh, ar oifigeach um chongnamh dhíomhaointis d'éileamh air fén bhfo-alt deiridh sin roimhe seo a dheimhniú cáilíochta do sheachadadh, é do theip air an deimhniú san do sheachadadh láithreach don oifigeach san beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air.
(10) Má ciontuítear duine i gcionta fén alt so féadfaidh an chúirt a chiontóidh é, más gá san sa chás, pé ordú do dhéanamh, is ceart dar leis an gcúirt, chun a chur in áirithe go ndéanfar an deimhniú cáilíochta gur ina thaobh do rinneadh an cionta san do sheachadadh d'oifigeach um chongnamh dhíomhaointis.
Acfuinn daoine d'áireamh.
13.—(1) Nuair a bheidh acfuinn duine á háireamh chun crícheanna an Achta so isiad na nithe seo leanas agus ní haon nithe eile tuigfear is acfuinn an duine sin, sé sin le rá:—
(a) luach bliantúil, ar n-a dhéanamh amach sa tslí orduithe, na maoine uile is leis an duine sin (nách maoin a bhíonn á húsáid aige féin) agus a bheidh suncálta no curtha chun tairbhe ar shlí eile no is féidir do shuncáil no do chur chun tairbhe ach ná beidh san déanta léi;
(b) gach ioncum go bhféadfaidh an duine sin go réasúnta súil a bheith aige le n-a fháil in airgead i rith na bliana ina dhiaidh sin, agus áireamhófar air sin méid no méid mheasta aon ioncuim go bhféadfaidh an duine sin go réasúnta súil a bheith aige le n-a fháil i rith na bliana san ina dhiaidh sin mar cheann an teaghlaigh, pe'ca i bhfuirm síntiúisí mar chabhair in aghaidh caiteachaisí an teaghlaigh no ar shlí eile é, ach fágfar gan áireamh—
(i) aon ioncum no airgead le n-a mbaineann aon mhír eile den fho-alt so,
(ii) an t-airgead uile bheidh á thuilleamh ag an duine sin alos fostaíochta pearsanta i láthair na huaire fé chonnradh seirbhíse,
(iii) aon airgead do gheobhfar i bhfuirm sochair fé sna hAchtanna um Arachas Sláinte Náisiúnta, 1911 go 1933,
(iv) aon airgead do gheobhfar i bhfuirm sochair dhíomhaointis fé sna hAchtanna um Arachas Díomhaointis, 1920 go 1930,
(v) aon airgead do gheobhfar i bhfuirm chongnaimh dhíomhaointis fén Acht so,
(vi) aon airgead do gheobhfar i bhfuirm chongnaimh theaghlaigh;
(c) luach bliantúil, ar n-a dhéanamh amach sa tslí orduithe, aon bhuntáiste bhíonn ag an duine sin as úsáid mhaoine (seachas troscán agus áirnéis phearsanta) bhíonn á húsáid aige féin;
(d) gach ioncum maraon le luach bliantúil, ar n-a dhéanamh amach sa tslí orduithe, na maoine uile le n-ar scar an duine sin go díreach no go nea-dhíreach chun go mbeadh sé cáilithe chun congnaimh dhíomhaointis d'fháil;
(e) luach bliantúil aon tsochair no príbhléide bhíonn ag an duine sin.

CUID III.
Congnamh Diomhaointis.
Ceart chun congnaimh dhíomhaointis d'fháil.
14.—(1) Duine ar bith is sealbhóir ar dheimhniú cáilíochta feadfaidh, fé réir forálacha an ailt seo, congnamh díomhaointis d'iarraidh sa tslí orduithe.
(2) Má dheineann duine congnamh díomhaointis d'iarraidh go cuibhe agus an duine sin i dteideal de thurus na huaire, fén bhfo-alt deiridh sin roimhe seo, san d'iarraidh, agus má dheineann an duine sin a dheimhniú cáilíochta do sheachadadh d'oifigeach um chongnamh dhíomhaointis agus a chur ina luighe ar an oifigeach san sa tslí orduithe go bhfuil sé do réir ná gcoinníollacha reachtúla, beidh an duine sin, faid a leanfa sé de bheith do réir na gcionníollacha reachtúla agus ná beidh sé dí-cháilithe fén Acht so chun congnaimh dhíomhaointis d'fháil, i dteideal, fé réir forálacha an Achta so, íocaíochtaí (dá ngairmtear congnamh díomhaointis san Acht so) d'fháil sna tráthanna, sa tslí agus do réir an ráta ceaptar leis an Acht so no ceapfar fé.
(3) Ní dhéanfaidh duine ar bith aon chongnamh díomhaointis d'iarraidh mara dtagaidh an méid sin den Acht so, údaruíonn do dhaoine congnamh díomhaointis d'iarraidh, mara dtagaidh ná go dtí go dtiocfaidh an méid sin i bhfeidhm maidir leis an líomatáiste gur laistigh de chomhnuíonn an duine sin.
(4) Nuair a bheidh duine ag fáil chongnaimh dhíomhaointis de thurus na huaire déanfar deimhniú cáilíochta an duine sin do choimeád, ar feadh an ama orduithe agus sa tslí orduithe, san áit orduithe.
Na coinníollacha reachtúla.
15.—(1) Gairmtear na coinníollacha reachtúla san Acht so de sna coinníollacha so leanas, coinníollacha bheidh, fé réir forálacha an Achta so (ar a n-áirmhítear an t-alt so), mar na coinníollacha nách foláir do shealbhóir ar dheimhniú cáilíochta bheith dá réir d'fhonn bheith i dteideal congnaimh dhíomhaointis d'fháil, sé sin le rá:—
(a) gur duine é an sealbhóir sin a chruthuíonn sa tslí orduithe go raibh sé díomhaoin ar feadh na haimsire go léir ón dáta ar ar iarr sé congnamh díomhaointis;
(b) gur duine é an sealbhóir sin atá ábalta ar obair do dhéanamh agus atá ar fáil i gcóir fostaíochta do bheadh oiriúnach do, ag féachaint dá aois, dá inscin, dá neart cuirp, dá oideachas, dá ghnáth-shlí bheatha, dá áit chomhnaithe agus do chúrsaí a líntighe, agus atá ag lorg fostaíochta den tsaghas san dáiríribh ach atá gan bheith ábalta ar a leithéid d'fháil;
(c) o tugadh amach a dheimhniú cáilíochta don duine sin ná dearna sé aon rud agus nár thárla aon atharú i gcúrsaí a cháis ná aon teagmhas eile do dhéanfadh an deimhniú san nea-dhleathach no do chuirfeadh an duine sin o theideal chun an deimhnithe sin do shealbhú;
(d) más duine é ar ar cheangal oifigeach um chongnamh dhíomhaointis go cuibhe cúrsa teagaisc d'fhreastal a bhí ceaptha no ceaduithe le rialacháin ar n-a ndéanamh fén gCuid seo den Acht so, go mbeidh sé tar éis an chúrsa san d'fhreastal go cuibhe do réir an cheangail sin;
(e) i gcás duine bheidh ag iarraidh congnaimh dhíomhaointis i mbaile-líomatáiste gur duine é do bhí ina ghnáthchomhnaí sa bhaile-líomatáiste sin ar feadh bliana ar a laighead roimh dháta an iarratais is déanaí uaidh ar chongnamh dhíomhaointis no do bhí ag obair ar feadh trí mhí ar a laighead sa bhaile-líomatáiste sin laistigh de bhliain roimh dháta an iarratais sin is déanaí;
(f) i gcás baintrighe no mná single ná fuil aon chleithiúnaí aice, gur duine í nár híocadh níos lugha ná dhá shintiús chaogad ina taobh fé sna hAchtanna um Arachas Díomhaointis, 1920 go 1930, mar a leasuítear san le haon achtachán ina dhiaidh sin, i rith na tréimhse de cheithre bliana díreach roimh dháta a hiarratais ar chongnamh dhíomhaointis.
(2) Ní tuigfear é do theip ar dhuine bheith do réir na gcoinníollacha reachtúla de bhithin é do dhiúltú do thairiscint fhostaíochta do ghlacadh i bpost do bhí folamh mar gheall ar stopadh oibre toisc aighnis chéirde agus de bhithin an diúltuithe sin amháin.
Dí-cháilíochtaí maidir le congnamh díomhaointis d'fháil.
16.—(1) Beidh duine dí-cháilithe chun congnaimh dhíomhaointis d'fháil—
(a) faid a bheidh sé ina chomhnaí, pe'ca go sealadach no go buan é, lasmuich de Shaorstát Éireann, agus
(b) faid a bheidh sé fé phríosúntacht no fé choinneáil in aon phríosún no áit choinneála eile coimeádtar suas ar fad no go leathrannach as cistí puiblí, agus
(c) faid a bheidh sé ina iostaí in aon fhundúireacht a coimeádtar suas ar fad no go leathrannach as airgead puiblí no as airgead údaráis áitiúla, agus
(d) faid a bheidh sé ag fáil no i dteideal pinsin fé alt 6 d'Acht na bPinsean Sean-Aoise, 1932 (Uimh. 18 de 1932), no aon liúntais bhreoiteachta no mhí-ábaltachta fé sna hAchtanna um Arachas Sláinte Náisiúnta, 1911 go 1933, no sochair dhíomhaointis fé sna hAchtanna um Arachas Díomhaointis, 1920 go 1930, no aon tsochair fé scéim speisialta fé alt 18 den Unemployment Insurance Act, 1920, no fé alt 19 den Acht san no fé scéim bhreise fé alt 20 den Acht san.
(2) Má chailleann duine a fhostaíocht tré n-a mhí-iompar féin no má fhágann sé a fhostaíocht dá dheoin féin gan cúis chóir, ansan—
(a) i gcás an duine sin do bheith ina shíntiúsaire fé árachas fé sna hAchtanna um Arachas Díomhaointis, 1920 go 1930, agus é do bheith i dteideal sochair dhíomhaointis ar dhul in éag don tréimhse dhí-cháilíochta chun sochair dhíomhaointis d'fháil a socruítear le fo-alt (2) d'alt 8 den Unemployment Insurance Act, 1920, beidh an duine sin dí-cháilithe chun congnaimh dhíomhaointis d'fháil ar feadh na tréimhse gur le n-a linn a bheidh sé dí-cháilithe chun sochair dhíomhaointis d'fháil agus fós ar feadh na tréimhse de shé seachtaine o dháta dhul in éag dá cheart chun sochair dhíomhaointis d'fháil, agus
(b) in aon chás eile, beidh an duine sin dí-cháilithe chun congnaimh dhíomhaointis d'fháil ar feadh na tréimhse de thrí mhí ón dáta ar ar chaill sé a fhostaíocht no ar ar fhág sé amhlaidh í.
(3) Má ciontuítear duine in aon chionta fé alt ar bith den Acht so, beidh an duine sin dí-cháilithe chun congnaimh dhíomhaointis d'fháil ar feadh na tréimhse de thrí mhí, no ar feadh pé tréimhse is giorra ná san (nách giorra ná sé seachtaine) a hordófar, o dháta a chiontuithe amhlaidh.
(4) Má ciontuítear duine in aon choir no in aon chionta (seachas cionta fé alt den Acht so) agus má deintear, ar a chiontú amhlaidh, príosúntacht ar feadh aon téarma nách giorra ná coicís do ghearradh air, beidh an duine sin dí-cháilithe chun congnaimh dhíomhaointis d'fháil ar feadh na tréimhse de thrí mhí o dháta a chiontuithe amhlaidh no ar feadh tréimhse a phríosúntachta, pe'ca tréimhse acu san is sia.
(5) Duine chaillfidh fostaíocht de dheascaibh stopadh oibre toisc aighnis chéirde sa mhonarchain, sa siopa oibre no san áitreabh eile ina mbeidh sé ar fostú, beidh sé dí-cháilithe chun congnaimh dhíomhaointis d'fháil faid a leanfaidh an stopadh oibre ach amháin i gcás ina dtiocfa sé, le linn an stopadh oibre, chun bheith ar fostú bona fide in áit eile sa tslí bheatha leanann sé de ghnáth no ina dtiocfa sé chun bheith ag gabháil de ghnáth d'obair éigin eile.
Má bhíonn brainsí oibre ar leithligh, is gnáth do bheith ar siúl mar ghnóthaí ar leithligh in áitreibh ar leithligh, má bhíd, in aon chás, ar siúl i ranna ar leithligh den áitreabh chéanna tuigfear, chun crícheanna an fho-ailt seo, gach roinn acu san do bheith ina monarchain no ina siopa oibre ar leithligh no ina háitreabh ar leithligh, do réir mar bheidh.
(6) San alt so foluíonn an focal “príosúntacht” piantseirbhís.
Rátaí congnaimh dhíomhaointis.
17.—(1) San alt so cialluíonn an abairt “ráta sceidealta” an ráta congnaimh dhíomhaointis a luaidhtear sa Sceideal a ghabhann leis an Acht so agus a bhaineann, toisc cúrsaí an cháis de thurus na huaire, leis an duine gur ina thaobh a húsáidtear an abairt.
(2) Pé uair a bheidh duine i dteideal, fén Acht so, congnaimh dhíomhaointis d'fháil bhéarfar an congnamh san do i bhfuirm íocaíochta airgid do réir pé ráta acu so leanas a bhaineann leis an gcás, sé sin le rá:—
(a) má bhíonn sé gan acfuinn ar bith no má bhíonn acfuinn aige nách mó ná dhá scilling sa tseachtain, do réir an ráta sceidealta; agus
(b) má bhíonn acfuinn aige is mó ná dhá scilling sa tseachtain, do réir ráta is có-ionann leis an ráta sceidealta ar n-a laigheadú scilling sa tseachtain in aghaidh gach scillinge no coda de scilling gur mó ná dhá scilling sa tseachtain acfuinn an duine sin.
(3) Pé uair, agus an ráta á áireamh gur dá réir a bheidh congnamh díomhaointis iníoctha le duine, a bheidh an méid seachtainiúil a bheidh an ráta sceidealta le laigheadú có-ionann le méid seachtainiúil an ráta sceidealta no níos mó ná an méid sin, ní bheidh aon chongnamh díomhaointis iníoctha leis an duine sin.
(4) Tuigfear gurb í is acfuinn duine ar bith chun críche an ailt seo ná acfuinn an duine sin fé mar bheidh san luaidhte sa deimhniú cáilíochta bheidh aige de thurus na huaire.
Na rátaí congnaimh dhíomhaointis d'atharú.
18.—Féadfaidh an tAire, le haontú an Aire Airgid, laigheadú do dhéanamh le hordú, aon tráth no tráthanna, ar gach ceann no ar aon cheann de sna rátaí congnaimh dhíomhaointis a luaidhtear sa Sceideal a ghabhann leis an Acht so no bheidh laigheaduithe cheana fén alt so, agus má deintear aon ordú den tsórt san amhlaidh déanfar gach tagairt san Acht so do sna rátaí congnaimh dhíomhaointis a luaidhtear sa Sceideal a ghabhann leis an Acht so do léiriú mar thagairt do sna rátaí sin go sna laigheaduithe agus fé réir na laigheaduithe ar na rátaí sin fén alt so bheidh i bhfeidhm de thurus na huaire.
Congnamh díomhaointis d'íoc.
19.—Beidh éifeacht ag na forálacha so leanas maidir le congnamh díomhaointis d'íoc, sé sin le rá:—
(a) ní bheidh aon chongnamh díomhaointis iníoctha alos na sé lá tosaigh de dhíomhaointeas leanúnach in aon tréimhse leanúnaigh dhíomhaointis;
(b) ní híocfar aon chongnamh díomhaointis in aghaidh aon tréimhse is giorra ná lá;
(c) chun crícheanna na Coda so den Acht so ní déanfar aon am, roimh dhéanamh iarratais ar chongnamh dhíomhaointis alos tréimhse áirithe díomhaointis, d'áireamh mar thréimhse dhíomhaointis ná mar chuid de thréimhse dhíomhaointis;
(d) ní déanfar aon am, go mbeidh duine dí-cháilithe ar a feadh chun congnaimh dhíomhaointis d'fháil, d'áireamh nuair a bheidh aon tréimhse bhí an duine sin díomhaoin á déanamh amach;
(e) fé réir forálacha an Achta so (ar a n-áirmhítear an t-alt so) is ar na tráthanna orduithe agus sa tslí orduithe a híocfar congnamh díomhaointis.
Breith do thabhairt ar iarrataisí ar chongnamh dhíomhaointis.
20.—(1) Isé dhéanfaidh gach iarratas ar chongnamh dhíomhaointis do ghlacadh agus do bhreithniú ná oifigeach um chongnamh dhíomhaointis, agus gach iarratas den tsórt san agus gach ceist eireoidh ina thaobh no maidir leis (le n-a n-áirmhítear go sonnrách an cheist sin, an rabhthas do réir na gcoinníollacha reachtúla no an bhfuiltear ag leanúint de bheith dá réir, agus an cheist sin, an bhfuil duine dí-cháilithe chun congnaimh dhíomhaointis d'fháil no ná fuil) is oifigeach um chongnamh dhíomhaointis do bhéarfaidh breith air agus, fé réir forálacha an ailt seo, ní bheidh dul thar breith sin an oifigigh sin.
(2) Féadfaidh oifigeach um chongnamh dhíomhaointis, más dóich leis san do bheith ceart, aon iarratas no ceist a thiocfaidh fé n-a bhráid chun breithe do thabhairt air fén alt so do chur ar aghaidh chun cúirte réiteoirí in ionad é féin do thabhairt breithe air.
(3) Éinne ar a ngoillfe sé oifigeach um chongnamh dhíomhaointis do dhiúltú do ghéilleadh d'iarratas ón duine sin ar chongnamh dhíomhaointis no aon oifigeach den tsórt san de lomháil chongnaimh dhíomhaointis don duine sin do réir ráta is lugha ná an ráta d'éilimh sé no aon oifigeach den tsórt san do stop congnaimh dhíomhaointis do híocadh go dtí san leis an duine sin no do laigheadú ráta an chongnaimh dhíomhaointis sin féadfaidh, laistigh de lá is fiche tar éis an diúltuithe no na lomhála no an stopadh no an laigheaduithe sin do dhéanamh no laistigh de pé am breise (más ann do) a lomhálfaidh an tAire i gcás an duine sin, agus sa tslí orduithe, a cheangal ar an oifigeach san an diúltú, an lomháil, an stopadh, no an laigheadú san do thuairisciú do chúirt réiteoirí agus leis sin tuairisceoidh an t-oifigeach san sa tslí orduithe do réir an cheangail sin.
(4) Breithneoidh gach cúirt réiteoirí gach ní cuirfear ar aghaidh chúcha no tuairisceofar dóibh fén alt so, agus cuirfid chun an oifigigh um chongnamh dhíomhaointis le n-a mbaineann pé molta i dtaobh an ní sin is dóich leo is ceart, agus leis sin cuirfidh an t-oifigeach san na molta san in éifeacht maran rud é ná haontóidh sé leo.
(5) Mara n-aontuighidh oifigeach um chongnamh dhíomhaointis le moladh chuirfidh cúirt réiteoirí chuige fén alt so, déanfaidh an t-oifigeach san an ní do chur ar aghaidh chun an Mholtóra sa tslí orduithe má iarrann an chúirt réiteoirí air san do dhéanamh.
(6) I gcás cúirte réiteoirí do chur molta chun oifigigh um chongnamh dhíomhaointis fén alt so féadfaidh aon chomhlachas de dhaoine fostaithe gur ball de an duine le n-a mbaineann an moladh san no (le cead na cúirte réiteoirí) féadfaidh an duine sin féin, laistigh de lá is fiche tar éis an mholta san no laistigh de pé am breise (más ann do) a lomhálfaidh an tAire i gcás an duine sin, a cheangal ar an oifigeach san an ní do chur ar aghaidh chun an Mholtóra, agus leis sin cuirfidh an t-oifigeach san an ní sin ar aghaidh chun an Mholtóra sa tslí orduithe.
(7) Bhéarfaidh an Moltóir breith ar gach ní cuirfear ar aghaidh chuige fén alt so agus beidh an bhreith do bhéarfaidh seisean air ina breith dheiridh gan aon dul tháirsi.
(8) Féadfaidh oifigeach um chongnamh dhíomhaointis, tráth ar bith, toisc fianaise nua do chur fé n-a bhráid no toisc fíora nua do chur in úil do, aon bhreith bheidh tugtha roimhe sin aige fén alt so do chlaochló no d'athscrúdú, agus na forálacha den alt so i dtaobh nithe do chur ar aghaidh no do thuairisciú chun cúirte réiteoirí no chun an Mholtóra beidh feidhm acu maidir leis an gclaochló no leis an athscrúdú san fé mar do bhí feidhm acu maidir leis an mbreith bhunaidh.
(9) Féadfaidh an Moltóir, tráth ar bith, toisc fianaise nua do chur fé n-a bhráid, aon bhreith bheidh tugtha roimhe sin aige fén alt so do chlaochló no d'athscrúdú.
(10) Gach gníomh a dhéanfaidh oifigeach um chongnamh dhíomhaointis do réir molta chuirfidh cúirt réiteoirí chuige, agus gach breith bhéarfaidh an Moltóir, agus gach claochló no athscrúdú dhéanfaidh aon oifigeach den tsórt san no an Moltóir ar bhreith bheidh tugtha roimhe sin beidh aige, má thagann as an ngníomh, as an mbreith, as an gclaochló no as an athscrúdú san congnamh díomhaointis do lomháil dar diúltuíodh roimhe sin no congnamh díomhaointis do lomháladh roimhe sin do mhéadú, éifeacht ón dáta ar ar thug an t-oifigeach um chongnamh dhíomhaointis an bhreith bhunaidh no o pé dáta is déanaí ná san (más ann do) a shocróidh an Moltóir, i gcás breithe do thug no claochló no athscrúduithe do rinne an Moltóir, no shocróidh an t-oifigeach um chongnamh dhíomhaointis in aon chás eile.

21.—(1) Gach cúirt réiteoirí bheidh ar bith de thurus na huaire fén Unemployment Insurance Act, 1920, agus chun crícheanna an Achta san, fé mar a bheidh san leasuithe no leathnuithe le hachtacháin ina dhiaidh sin, beidh sí ina cúirt réiteoirí chun crícheanna an Achta so, agus dá réir sin cialluíonn an abairt “cúirt réiteoirí” san Acht so cúirt réiteoirí bheidh ar bith amhlaidh.
(2) Isé an Moltóir a bheidh ceaptha agus ag gníomhú de thurus na huaire fén Unemployment Insurance Act, 1920, agus chun crícheanna an Achta san, fé mar a bheidh san leasuithe no leathnuithe le hachtacháin ina dhiaidh sin, a bheidh mar Mholtóir chun crícheanna an Achta so, agus dá réir sin cialluíonn an abairt “an Moltóir” san Acht so an Moltóir a bheidh ceaptha agus ag gníomhú amhlaidh.
(3) Féadfar, le rialacháin ar n-a ndéanamh ag an Aire fén Acht so, an cleachta agus an nós-imeachta d'ordú gur dá réir a dhéanfaidh cúirteanna réiteoirí agus an Moltóir fé seach feidhmiú ar a bhfeidhmeanna fé seach fén Acht so, agus féadfar, leis na rialacháin sin, gach ceann no aon cheann de sna forálacha, den Common Law Procedure Amendment Act (Ireland), 1856, a bhaineann le eadrascán, do chur i mbaint le himeachta os cóir cúirte réiteoirí no os cóir an Mholtóra.

22.—Féadfaidh an tAire, le rialacháin ar n-a ndéanamh aige fén alt so tar éis do dul i gcomhairle leis an Aire Oideachais, socrú do dhéanamh chun daoine díomhaoine d'fhreastal cúrsaí teagaisc do réir mar a cheanglóidh oifigigh um chongnamh dhíomhaointis san ortha agus féadfaidh, leis na rialacháin sin, cúrsaí teagaisc chun na críche sin do cheapadh no do cheadú.

23.—Fé réir forálacha an Achta so, beidh gach sannadh a déanfar no muirear a cuirfear ar chongnamh dhíomhaointis, agus fós gach co-aontú chun sannadh do dhéanamh no chun muirir do chur ar chongnamh dhíomhaointis, beidh san gan bhrí, agus ar ghnó-bhriseadh do thárlachtaint do dhuine ar bith bheidh i dteideal congnaimh dhíomhaointis ní raghaidh an ceart chun an chongnaimh dhíomhaointis sin, ní ragha sé chun aon iontaobhaí ná chun éinne eile bheidh ag gníomhú thar ceann a fhiach-éilitheoirí.
CUID IV.
Foralacha Airgeadais.
Costaisí.
24.—(1) Is amach as airgead a sholáthróidh an tOireachtas a híocfar an congnamh díomhaointis uile bheidh iníoctha fén Acht so.
(2) Sa mhéid go gceadóidh an tAire Airgid é, is amach as airgead a sholáthróidh an tOireachtas a híocfar gach costas eile fé n-a raghfar chun an Achta so do chur i bhfeidhm.
Iocaíochtaí don Aire amach as an gCiste Díomhaointis.
25.—Déanfar, i ngach bliain airgeadais a thosnóidh tar éis an 31adh lá de Mhárta, 1934, suim de £250,000 (dhá chéad agus caoga míle púnt) d'aistriú chun an Aire amach as an gCiste Díomhaointis atá bunuithe agus á choinneáil suas fé sna hAchtanna um Arachas Díomhaointis, 1920 go 1930, fé mar atáid san leasuithe le haon achtachán ina dhiaidh sin.
Údaráis áitiúla d'íoc suimeanna leis an Aire.
26.—(1) Íocfar leis an Aire gach bliain airgeadais a thosnóidh tar éis an 31adh lá de Mhárta, 1934, i pé slí ordóidh an tAire, na suimeanna so leanas, sé sin le rá:—
(a) íocfaidh comhairle gach contae-bhuirge agus comhairle buirge Dhún Laoghaire suim a bheidh có-ionann le méid ráta scillinge agus reul an púnt ar luach ionrátuithe na contae-bhuirge sin no buirge Dhún Laoghaire, do réir mar bheidh, i dtosach na bliana airgeadais díreach roimhe sin;
(b) íocfaidh comhairle gach baile-líomatáiste (seachas bailelíomatáiste is contae-bhuirg no is buirg Dhún Laoghaire) suim a bheidh có-ionann le méid ráta naoi bpingne an púnt ar luach ionrátuithe an bhaile-líomatáiste sin i dtosach na bliana airgeadais díreach roimhe sin.
(2) Beidh sé de dhualgas ar gach comhairle ag á mbeidh airgead iníoctha leis an Aire fén alt so i mbliain airgeadais an t-airgead san d'íoc leis an Aire ina cheithre tráth-choda cothroma, an 30adh lá de Mheitheamh, an 30adh lá de Mheán Fhómhair, an 31adh lá de Mhí na Nodlag, agus an 31adh lá de Mhárta an bhliain sin.
(3) Déanfar aon airgead a bheidh iníoctha ag comhairle leis an Aire fén alt so do chruinniú tríd an ráta cathardha, i gcás comhairle contae-bhuirge Bhaile Atha Cliath agus comhairle buirge Dhún Laoghaire, ach mar ítim ar leithligh den ráta san, no tríd an ráta dealbhais, i gcás aon chomhairle eile, ach mar ítim ar leithligh den ráta san.

UNEMPLOYMENT ASSISTANCE ACT, 1933.
PART I.
Preliminary and General.
Short title.
1.—This Act may be cited as the Unemployment Assistance Act, 1933.
Definitions.
2.—(1) In this Act—
the expression “the Minister” means the Minister for Industry and Commerce;
the word “prescribed” means prescribed by regulations made by the Minister under this Act.
(2) Each of the following shall be an urban area for the purposes of this Act, that is to say :—
(a) every county borough,
(b) the borough of Dun Laoghaire,
(c) every urban district the population of which (as shown by the census of population which is for the time being the latest such census) exceeds seven thousand.
Commencement.
3.—(1) This Act (except so much thereof as authorises persons to apply for qualification certificates or to apply for unemployment assistance) shall come into operation immediately upon the passing thereof.
(2) So much of this Act as authorises persons to apply for qualification certificates shall come into operation in relation to every urban area on such day as may be appointed in respect of such area by an order of the Minister under this sub-section, and different days may be so appointed in relation to different urban areas or some of such areas.
(3) So much of this Act as authorises persons to apply for qualification certificates shall come into operation in relation to every part of Saorstát Eireann not included in any urban area on such day as may be appointed by order of the Minister under this sub-section.
(4) So much of this Act as authorises persons to apply for unemployment assistance shall come into operation in relation to every urban area on such day as may be appointed in respect of such area by order of the Minister under this sub-section, and different days may be so appointed in relation to different urban areas or some of such areas.
(5) So much of this Act as authorises persons to apply for unemployment assistance shall come into operation in relation to every part of Saorstát Eireann not included in any urban area on such day as may be appointed by order of the Minister under this sub-section.
(6) Every order made by the Minister under this section shall be made with the concurrence of the Minister for Finance.
Definition of unemployment.
4.—(1) A person shall not be deemed to be unemployed within the meaning of this Act—
(a) on any day on which he works for wages or other remuneration, whether paid in money or in goods or otherwise howsoever, nor
(b) during any period which is in respect of such person an employment period within the meaning of this section.
(2) For the purposes of this Act two periods of unemployment of not less than two days each, separated by a period of not more than two days during which a person has not been employed for more than twenty-four hours, shall in relation to such person be treated as a continuous period of unemployment, and the expression “continuously unemployed” shall have a corresponding meaning.
(3) The Minister may by regulations made by him under this Act prescribe, either generally or in respect of any particular class or classes of persons or any particular district or districts, any period to be an employment period and accordingly no person of such class or resident in such district shall during such employment period be regarded as unemployed within the meaning of this Act.
Dependants.
5.—For the purposes of this Act the following and no other persons shall be the dependants of any particular person, that is to say:—
(a) such person's wife, if but only if she is living with such person and does not work (otherwise than at her usual household duties) regularly for wages or other remuneration, and
(b) such person's husband, if but only if he is living with and supported by such person and is prevented by physical or mental infirmity from supporting himself, and
(c) such person's unemployed children (including stepchildren and children in respect of whom he or she has placed himself or herself in loco parentis) who have not attained the age of eighteen years and are wholly or mainly supported by such person, and
(d) such person's mother, if but only if such person has undertaken responsibility for her support and she has not attained the age of seventy years and either she is a widow and is prevented by physical or mental infirmity from supporting herself or both she and her husband are invalids and prevented by physical or mental infirmity from supporting themselves, and
(e) such person's father, if but only if such person has undertaken liability for his support and he has not attained the age of seventy years and is an invalid and prevented by physical or mental infirmity from supporting himself, and
(f) such person's orphan brothers and sisters who either have not attained the age of eighteen years and are normally supported by such person or have attained the age of eighteen years and have not attained the age of seventy years and are, through physical or mental infirmity, prevented from supporting themselves and are normally supported by such person.
Unemployment assistance officers.
6.—(1) The Minister may, with the sanction of the Minister for Finance, appoint such and so many persons as he thinks proper to be unemployment assistance officers for the purposes of this Act, and every person so appointed shall hold his office as such officer upon such terms and conditions and at such remuneration as the Minister shall, with the sanction of the Minister for Finance, determine.
(2) Regulations made by the Minister under this Act may, subject to the provisions of this Act, prescribe the practice and procedure to be observed by unemployment assistance officers in the performance of their functions under this Act.
(3) In this Act the expression “unemployment assistance officer” means an unemployment assistance officer appointed under this section.
Regulations.
7.—(1) The Minister may by order make regulations prescribing any matter or thing which is referred to in this Act as prescribed or to be prescribed or any matter or thing which is expressly authorised by this Act to be prescribed by regulations made by the Minister under this Act.
(2) Regulations made by the Minister under this section prescribing a form of application for any purpose under this Act may require that all or any of the statements made by the applicant in such form be verified by statutory declaration.
(3) Every regulation made under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling such regulation is passed by either House of the Oireachtas within the next subsequent twenty-one days on which that House has sat after such regulation is laid before it, such regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done under such regulation.
Taking of statutory declarations by unemployment assistance officers, etc.
8.—Where any regulations made under the immediately preceding section require all or any of the statements made by an applicant in a form of application prescribed by such regulations for any purpose under this Act to be verified by statutory declaration, such statutory declaration may be taken and received by an unemployment assistance officer or by any other officer of the Minister authorised by the Minister in that behalf.
PART II.
Qualification Certificates.
The Unemployment Appeals Committee.
9.—(1) As soon as conveniently may be after the passing of this Act the Minister shall constitute an Unemployment Appeals Committee for the purposes of this Part of this Act.
(2) The Unemployment Appeals Committee shall consist of such and so many persons as the Minister shall from time to time at his discretion appoint to be members thereof.
(3) Regulations made by the Minister under this Act may prescribe the tenure and duration of office of members of the Unemployment Appeals Committee and the practice and procedure to be observed by such Committee in the performance of their functions under this Act.
Qualification certificates.
10.—(1) Any person may, subject to the provisions of this section, apply in the prescribed manner for a qualification certificate.
(2) Where an application for a qualification certificate is duly made by a person for the time being entitled under the immediately preceding sub-section to make such application and such person shows in the prescribed manner that he fulfils the conditions, so far as they are applicable, stated in the next following sub-section of this section he shall be entitled to receive a certificate (in this Act referred to as a qualification certificate) certifying that he fulfils the said conditions.
(3) The conditions referred to in the foregoing sub-section of this section as the conditions to be fulfilled by a person applying for a qualification certificate are:—
(a) that he is a national of Saorstát Eireann;
(b) that he has attained the age of eighteen years and has not attained the age of seventy years;
(c) that his means, calculated in accordance with this Act, do not exceed, in case he is resident in a county borough or the borough of Dun Laoghaire, fifty-two pounds or, in case he is resident elsewhere in Saorstát Eireann, thirty-nine pounds per annum;
(d) in the case of a married woman either—
(i) that her husband is a dependant of her, or
(ii) that neither she nor her husband is a dependant of the other and she has one or more dependants;
(e) in the case of a widow or spinster, that she has one or more dependants;
(f) in the case of a widow or spinster who has no dependant, that not less than fifty-two contributions have been paid in respect of her under the Unemployment Insurance Acts, 1920 to 1930, as amended by any subsequent enactment, during the period of four years immediately preceding the date of the application.
(4) Every qualification certificate shall be in the prescribed form and shall contain a statement of the weekly rate corresponding to the annual rate calculated in accordance with this Act of the means of the person to whom such certificate relates.
(5) No application for a qualification certificate shall be made by any person unless and until so much of this Act as authorises persons to apply for qualification certificates has come into force in relation to the area within which such person resides.
(6) Each of the following persons shall for the purposes of this section be a national of Saorstát Eireann, that is to say:—
(a) a person born in Saorstát Eireann or in the area now comprised in Saorstát Eireann;
(b) a person born outside Saorstát Eireann or the area now comprised in Saorstát Eireann whose mother at the time of his birth was ordinarily resident in Saorstát Eireann or such area;
(c) a person who at the relevant time is and for not less than five consecutive years immediately preceding that time has been ordinarily resident in Saorstát Eireann.
Determination of applications for qualification certificates.
11.—(1) Every application for a qualification certificate shall be received and considered and every such application and every question arising thereon shall be determined by an unemployment assistance officer, and every question arising in relation to a qualification certificate after the issue of such certificate shall also be determined by an unemployment assistance officer.
(2) An unemployment assistance officer may, if he so thinks proper, instead of determining it himself, refer in the prescribed manner any application or question which falls to be determined by him under this section to the Unemployment Appeals Committee.
(3) Any person aggrieved by the refusal by an unemployment assistance officer of an application by such person for a qualification certificate or by the determination under this section by an unemployment assistance officer of any matter may, within twenty-one days after such refusal or determination or such further time (if any) as may in his case be allowed by the Minister, and in the prescribed manner, require such officer to report such refusal or determination to the Unemployment Appeals Committee and thereupon such officer shall report such refusal or determination to the said Committee in the prescribed manner.
(4) The Unemployment Appeals Committee shall consider in the prescribed manner and decide every application, question, and determination referred or reported to them under this section, and the decision of the said Committee on any such application, question, or determination shall be final and conclusive.
Revocation and amendment of qualification certificates.
12.—(1) Whenever the holder of a qualification certificate has ceased to fulfil the conditions specified in such certificate, the following provisions shall have effect, that is to say:—
(a) such holder shall within seven days after such cesser inform an unemployment assistance officer of such cesser and the reason therefor;
(b) if such holder fails or neglects to comply with the provisions of the immediately preceding paragraph he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds and in the case of a continuing offence to a further fine not exceeding two pounds for each day during which the offence is continued.
(2) Whenever an unemployment assistance officer is satisfied that the holder of a qualification certificate has ceased to fulfil the conditions specified in such certificate, he shall revoke such certificate and such revocation shall have effect as from the date of such cesser.
(3) Whenever an unemployment assistance officer is satisfied—
(a) that a qualification certificate was obtained by fraud or fraudulent misrepresentation, or
(b) that a qualification certificate was obtained or issued by any innocent misrepresentation or other bona fide mistake,
such unemployment assistance officer shall revoke such certificate and such revocation shall have effect as from, in case such certificate was obtained by fraud or fraudulent misrepresentation, the date of the issue of such certificate or, in any other case, the date of revocation.
(4) Whenever an unemployment assistance officer is satisfied that the means of a person who is the holder of a qualification certificate have altered in amount since such certificate was issued, but do not exceed in case he is resident in a county borough or the borough of Dun Laoghaire, fifty-two pounds, or, in case he is resident elsewhere in Saorstát Eireann, thirty-nine pounds per annum, such unemployment assistance officer may amend such certificate in such manner as is requisite.
(5) Whenever a qualification certificate is revoked under this section on account of such certificate having been obtained by fraud or fraudulent misrepresentation, the person to whom such certificate was issued shall, for six months after such revocation, be disqualified for obtaining or holding a qualification certificate.
(6) Whenever a qualification certificate is revoked or amended by an unemployment assistance officer under this section, the person who was the holder of such certificate immediately before such revocation or at the time of such amendment may, within twenty-one days after such revocation or amendment or such further time (if any) as in his case may be allowed by the Minister, and in the prescribed manner, require such officer to report such revocation or such amendment (as the case may be) to the Unemployment Appeals Committee, and thereupon such officer shall report to the said Committee in the prescribed manner and the said Committee shall consider such revocation or such amendment.
(7) The Unemployment Appeals Committee shall consider in the prescribed manner every revocation or amendment reported to them under this section and may either, as they think proper, confirm or annul any such revocation and may either, as they think proper, confirm, annul, or vary any such amendment, and in every such case the decision of the said Committee shall be final and conclusive.
(8) Where a qualification certificate is revoked, the holder of such certificate shall on demand of an unemployment assistance officer forthwith deliver such certificate to such officer who shall retain it.
(9) Every person who on demand being made on him by an unemployment assistance officer under the immediately preceding sub-section for delivery of his qualification certificate fails to deliver forthwith such certificate to such officer shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
(10) Where a person is convicted of an offence under this section the court by which he is convicted may, where the circumstances so require, make such order as the court shall think proper for securing the delivery of the qualification certificate in respect of which such offence was committed to an unemployment assistance officer.
Calculation of the means of persons.
13.—(1) In the calculation of the means of a person for the purpose of this Act the following things and no others shall be deemed to constitute the means of such person, that is to say:—
(a) the yearly value ascertained in the prescribed manner of all property belonging to such person (not being property personally used or enjoyed by him) which is invested or is otherwise put to profitable use or is capable of being but is not invested or put to profitable use;
(b) all income which such person may reasonably expect to receive during the succeeding year in cash, including the actual or estimated amount of any income which such person may reasonably expect to receive during such succeeding year as head of the household, whether as contributions to the expenses of the household or otherwise, but excluding—
(i) any income or money coming within any other paragraph of this sub-section,
(ii) all moneys earned by such person in respect of current personal employment under a contract of service,
(iii) any moneys received by way of benefit under the National Health Insurance Acts, 1911 to 1933,
(iv) any moneys received by way of unemployment benefit under the Unemployment Insurance Acts, 1920 to 1930,
(v) any moneys received by way of unemployment assistance under this Act,
(vi) any moneys received by way of home assistance;
(c) the yearly value ascertained in the prescribed manner of any advantage accruing to such person from the use of property (other than furniture and personal effects) which is personally used or enjoyed by him;
(d) all income and the yearly value ascertained in the prescribed manner of all property of which such person has directly or indirectly deprived himself in order to qualify himself for the receipt of unemployment assistance;
(e) the yearly value of any benefit or privilege enjoyed by such person.
(2) For the purposes of paragraph (b) of the immediately preceding sub-section, the income of a person shall, in the absence of other means for ascertaining it, be taken to be the income actually received during the year immediately preceding the date of calculation.
PART III.
Unemployment Assistance.
Right to receive unemployment assistance.
14.—(1) Any person who is the holder of a qualification certificate may, subject to the provisions of this section, apply in the prescribed manner for unemployment assistance.
(2) Where an application for unemployment assistance is duly made by a person for the time being entitled under the immediately preceding sub-section to make such application and such person delivers to an unemployment assistance officer his qualification certificate and satisfies such officer in the prescribed manner that he complies with the statutory conditions, such person shall, so long as he continues to comply with the statutory conditions and is not disqualified under this Act for receiving unemployment assistance, be entitled, subject to the provisions of this Act, to receive payments (in this Act referred to as unemployment assistance) at such times, in such manner, and at such rate as is or are or shall be appointed by or under this Act.
(3) No application for unemployment assistance shall be made by any person unless and until so much of this Act as authorises persons to apply for unemployment assistance has come into force in relation to the area within which such person resides.
(4) When a person is for the time being in receipt of unemployment assistance the qualification certificate of such person shall be retained at the prescribed place, during the prescribed time and in the prescribed manner.
The statutory conditions.
15.—(1) The following conditions are referred to in this Act as the statutory conditions and shall, subject to the provisions of this Act (including this section) be the conditions to be complied with by the holder of a qualification certificate in order to entitle him to receive unemployment assistance, that is to say:—
(a) that such holder proves in the prescribed manner that since the date of his application for unemployment assistance he has been continuously unemployed;
(b) that such holder is capable of work and is available for and genuinely seeking but is unable to obtain employment suitable for him having regard to his age, sex, physique, education, normal occupation, place of residence, and family circumstances;
(c) that since his qualification certificate was issued to him he has not done anything and no change of circumstances or other event has occurred which would invalidate such certificate or would disentitle him to hold such certificate;
(d) if he has been duly required by an unemployment assistance officer to attend a course of instruction appointed or approved by regulations made under this Part of this Act, that he has duly attended such course in accordance with such requisition;
(e) in the case of a person applying for unemployment assistance in an urban area that either he has been ordinarily resident in such urban area for at least one year before his latest application for unemployment assistance or has had at least three months' employment in such urban area within one year before such latest application;
(f) in the case of a widow or spinster who has no dependant, that not less than fifty-two contributions have been paid in respect of her under the Unemployment Insurance Acts, 1920 to 1930, as amended by any subsequent enactment, during the period of four years immediately preceding the date of her application for unemployment assistance.
(2) A person shall not be deemed to have failed to comply with the statutory conditions by reason only that he has declined an offer of employment in a situation vacant in consequence of a stoppage of work due to a trade dispute.
Disqualifications for receiving unemployment assistance.
16.—(1) A person shall be disqualified for receiving unemployment assistance—
(a) while he is resident, whether temporarily or permanently, outside Saorstát Eireann, and
(b) while he is undergoing imprisonment or detention in any prison or other place of detention maintained wholly or partly out of public funds, and
(c) while he is an inmate of any institution maintained wholly or partly out of public moneys or by a local authority, and
(d) while he is in receipt of or entitled to a pension under section 6 of the Old Age Pensions Act, 1932 (No. 18 of 1932), or any sickness or disablement allowance under the National Health Insurance Acts, 1911 to 1933, or unemployment benefit under the Unemployment Insurance Acts, 1920 to 1930, or any benefit under a special scheme under section 18 of the Unemployment Insurance Act, 1920, or under section 19 of that Act or under a supplementary scheme under section 20 of that Act.
(2) Where a person loses his employment through his misconduct, or voluntarily leaves his employment without just cause, such person shall—
(a) in case he is an insured contributor under the Unemployment Insurance Acts, 1920 to 1930, and is entitled to unemployment benefit on the expiration of the period of disqualification for receiving unemployment benefit fixed by sub-section (2) of section 8 of the Unemployment Insurance Act, 1920, be disqualified for receiving unemployment assistance for the period during which he is disqualified for receiving unemployment benefit and also for the period of six weeks as from the date on which his right to receive unemployment benefit expires, and
(b) in any other case, be disqualified for receiving unemployment assistance for the period of three months from the date on which he lost or so left his employment.
(3) Where a person has been convicted of any offence under any section of this Act, such person shall be disqualified for receiving unemployment assistance during the period of three months, or such lesser period (not being less than six weeks) as may be prescribed, from the date on which he is so convicted.
(4) Where a person has been convicted of any crime or offence (other than an offence under a section of this Act) and has on such conviction been sentenced to imprisonment for any term not less than one fortnight, such person shall be disqualified for receiving unemployment assistance for the period of three months from the date on which he is so convicted or for the period of his imprisonment, whichever is the longer.
(5) A person who lost employment by reason of a stoppage of work which was due to a trade dispute at the factory, workshop or other premises at which he was employed, shall be disqualified for receiving unemployment assistance so long as the stoppage of work continues, except in the case where he has, during the stoppage of work, become bona fide employed elsewhere in the occupation which he usually follows or has become regularly engaged in some other occupation
Where separate branches of work which are commonly carried on as separate businesses in separate premises are in any case carried on in separate departments of the same premises, each of those departments shall, for the purposes of this sub-section, be deemed to be a separate factory or workshop or separate premises, as the case may be.
(6) In this section the word “imprisonment” includes penal servitude.
Rates of unemployment assistance.
17.—(1) In this section the expression “scheduled rate” means the rate of unemployment assistance stated in the Schedule to this Act which is, in the circumstances for the time being existing, applicable to the person in respect of whom the expression is used.
(2) Whenever a person is entitled under this Act to receive unemployment assistance, such assistance shall be given to him in the form of a money payment at whichever of the following rates is applicable, that is to say:—
(a) if he has no means or if he has means not exceeding two shillings per week, at the scheduled rate; and
(b) if he has means exceeding two shillings per week, at a rate equal to the scheduled rate reduced by one shilling per week for every shilling or part of a shilling by which the means of such person exceeds two shillings per week.
(3) Whenever in the calculation of the rate at which unemployment assistance is payable to a person, the weekly amount by which the scheduled rate is to be reduced is equal to or exceeds the weekly amount of the scheduled rate, no unemployment assistance shall be payable to such person.
(4) The means of any person for the purpose of this section shall be taken to be the means of such person as stated in the qualification certificate for the time being held by him.
Variation of the rates of unemployment assistance.
18.—The Minister, with the concurrence of the Minister for Finance, may at any time or times by order reduce all or any of the rates of unemployment assistance stated in the Schedule to this Act or previously reduced under this section, and if any such order is so made all references in this Act to the rates of unemployment assistance stated in the Schedule to this Act shall be construed as referring to those rates with and subject to the reductions thereof under this section for the time being in force.
Payment of unemployment assistance.
19.—The following provisions shall have effect in relation to the payment of unemployment assistance, that is to say:—
(a) no unemployment assistance shall be payable in respect of the first six days of continuous unemployment in any continuous period of unemployment;
(b) no unemployment assistance shall be paid for any period less than one day;
(c) for the purposes of this Part of this Act, no time prior to the relevant application for unemployment assistance shall be reckoned as or as part of a period of unemployment;
(d) no time during which a person is disqualified for receiving unemployment assistance shall be reckoned in the computation of any period of unemployment of such person;
(e) subject to the provisions of this Act (including this section), unemployment assistance shall be paid at the prescribed times and in the prescribed manner.
Determination of applications for unemployment assistance.
20.—(1) Every application for unemployment assistance shall be received and considered by an unemployment assistance officer and every such application and every question arising thereon or in relation thereto (including in particular the question whether the statutory conditions have been or continue to be complied with and the question whether a person is or is not disqualified for receiving unemployment assistance) shall be determined by an unemployment assistance officer and such determination by such officer shall, subject to the provisions of this section, be final.
(2) An unemployment assistance officer may, if he so thinks proper, instead of determining it himself, refer in the prescribed manner any application or question which falls to be determined by him under this section to a court of referees.
(3) Any person aggrieved by the refusal by an unemployment assistance officer of an application by such person for unemployment assistance or by the allowance by any such officer of unemployment assistance to such person at a lesser rate than was claimed by him, or, by the stoppage or reduction in rate by any such officer of unemployment assistance theretofore paid to such person may within twenty-one days after such refusal, allowance stoppage or reduction, or such further time (if any) as may in his case be allowed by the Minister, and in the prescribed manner, require such officer to report such refusal, allowance, stoppage, or reduction to a court of referees and thereupon such officer shall report in the prescribed manner in accordance with such requisition.
(4) Every court of referees shall consider every matter referred or reported to them under this section and shall make to the unemployment assistance officer concerned such recommendations in regard thereto as they think proper, and thereupon such officer shall give effect to such recommendations unless he disagrees therewith.
(5) Whenever an unemployment assistance officer disagrees with a recommendation made by a court of referees to him under this section, such officer shall, if so requested by such court, refer the matter in the prescribed manner to the Umpire.
(6) Where a recommendation has been made under this section by a court of referees to an unemployment assistance officer, any association of employed persons of which the person to whom such recommendation relates is a member or (with the leave of the court of referees) the said person may himself within twenty-one days after such recommendation or such further time (if any) as may in his case be allowed by the Minister require such officer to refer the matter to the Umpire, and thereupon such officer shall refer the matter in the prescribed manner to the Umpire.
(7) The Umpire shall determine every matter referred to him under this section and his determination thereon shall be final and conclusive.
(8) An unemployment assistance officer may at any time, on account of new evidence being submitted to him or new facts coming to his knowledge, reverse or revise any determination previously made by him under this section, and the provisions of this section in relation to the reference or report of matters to a court of referees or to the Umpire shall apply to such reversal or revision in like manner as they applied to the original determination.
(9) The Umpire may at any time, on account of new evidence having been submitted to him, reverse or revise any determination previously made by him under this section.
(10) Every action of an unemployment assistance officer in pursuance of a recommendation made to him by a court of referees, every determination by the Umpire, and every reversal or revision of a previous determination by any such officer or by the Umpire shall, if such action, determination, reversal, or revision has the effect of allowing unemployment assistance previously refused or increasing unemployment assistance previously allowed, have effect as from the date of the original determination by the unemployment assistance officer or such later date (if any) as may, in case of a determination, reversal or revision by the Umpire, be fixed by the Umpire or, in any other case, by the unemployment assistance officer
Courts of referees and the Umpire.
21.—(1) Every court of referees for the time being subsisting under and for the purposes of the Unemployment Insurance Act, 1920, as amended or extended by subsequent enactments shall be a court of referees for the purposes of this Act, and accordingly in this Act the expression “court of referees” means a court of referees so subsisting.
(2) The Umpire for the time being appointed and acting under and for the purposes of the Unemployment Insurance Act, 1920, as amended or extended by subsequent enactments shall be the Umpire for the purposes of this Act, and accordingly in this Act the expression “the Umpire” means the Umpire so appointed and acting.
(3) Regulations made by the Minister under this Act may prescribe the practice and procedure to be observed by courts of referees and the Umpire respectively in the performance of their respective functions under this Act, and may apply to proceedings before a court of referees or before the Umpire all or any of the provisions of the Common Law Procedure Amendment Act (Ireland), 1856, relating to arbitration.
Regulations in respect of courses of instruction.
22.—The Minister may by regulations made by him under this section after consultation with the Minister for Education, make provision for the attendance of unemployed persons at courses of instruction in pursuance of requisitions by unemployment assistance officers and may by such regulations appoint or approve of courses of instruction for that purpose.
Unemployment assistance to be inalienable.
23.—Subject to the provisions of this Act, every assignment of, or charge on, and every agreement to assign or charge unemployment assistance shall be void, and on the bankruptcy of, any person entitled to unemployment assistance, the rights to such unemployment assistance shall not pass to any trustee or other person acting on behalf of his creditors.
PART IV.
Financial Provisions.
Expenses.
24.—(1) All unemployment assistance payable under this Act shall be paid out of moneys provided by the Oireachtas.
(2) All other expenses incurred in carrying this Act into execution shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Payments to Minister out of Unemployment Fund.
25.—In every financial year commencing after the 31st day of March, 1934, there shall be transferred to the Minister out of the Unemployment Fund established and maintained under the Unemployment Insurance Acts, 1920 to 1930, as amended by any subsequent enactment, the sum of £250,000 (two hundred and fifty thousand pounds).
Payments to Minister by local authorities.
26.—(1) In every financial year commencing after the 31st day of March, 1934, there shall be paid to the Minister, in such manner as the Minister may direct, the following sums, that is to say:—
(a) by the council of every county borough and the council of the borough of Dun Laoghaire, a sum equal to the amount of a rate of one shilling and sixpence in the pound on the rateable value at the beginning of the immediately preceding financial year of such county borough or the borough of Dun Laoghaire, as the case may be;
(b) by the council of every urban area (other than an urban area which is a county borough or the borough of Dun Laoghaire), a sum equal to the amount of a rate of ninepence in the pound on the rateable value at the beginning of the immediately preceding financial year of such urban area.
(2) It shall be the duty of every council by whom money is payable to the Minister under this section in a financial year to pay such money to the Minister in four equal instalments, on the 30th day of June, the 30th day of September, the 31st day of December, and the 31st day of March in such year.
(3) Any money payable by a council to the Minister under this section shall be raised by means of, in the case of the council of the county borough of Dublin and the council of the borough of Dun Laoghaire, the municipal rate, but as a separate item thereof, or, in the case of any other council, the poor rate, but as a separate item thereof.
(4) Where any money is payable to the Minister under this section by a council, the amount thereof may in default of payment by such Council be deducted from sums payable from the Local Taxation (Ireland) Account directly or indirectly to such council, and be paid to the Minister in discharge of such money.
(5) In this section the expression “rateable value” means—
(a) in relation to the county borough of Dublin, the valuation under the Valuation Acts, as deemed to be reduced by section 69 of the Local Government (Dublin) Act, 1930 (No. 27 of 1930), of the hereditaments and tenements situate in such county borough rateable to the municipal rate;
(b) in relation to the borough of Dun Laoghaire, the valuation under the Valuation Acts, as deemed to be reduced by the said section 69, of the hereditaments and tenements situate in such borough rateable to the municipal rate;
(c) in relation to any other urban area, the valuation under the Valuation Acts of the hereditaments and tenements situate in such area rateable to the poor rate.
Application of moneys transferred or paid to Minister.
27.—Any moneys transferred or paid to the Minister under the two immediately preceding sections shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance shall direct.
PART V.
Miscellaneous.
Repayment of unemployment assistance improperly received.
28.—(1) Every payment of unemployment assistance received by any person while he was disqualified for receiving unemployment assistance or the statutory conditions were not complied with by him or which he was otherwise disentitled to receive shall be repayable by such person to the Minister on demand made in that behalf by an unemployment assistance officer, and, if not so repaid, may be recovered by the Minister as a simple contract debt in any court of competent jurisdiction or by deduction from any payment or payments of unemployment assistance to which such person subsequently becomes entitled.
(2) Every sum repaid to or recovered by the Minister under this section shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance shall direct.
Penalty for false statements, etc.
29.—If, for the purpose of obtaining for himself or any other person a qualification certificate or any payment of unemployment assistance or of avoiding the making by himself or any other person of any repayment under this Act, any person makes any statement or representation (whether written or verbal) which is to his knowledge false or misleading in any material respect, he shall be guilty of an offence under this Act and shall be liable on summary conviction thereof to a fine not exceeding twenty-five pounds or, at the discretion of the Court, to imprisonment for any term not exceeding three months.
Prosecutions.
30.—(1) Proceedings for an offence under any section of this Act shall not be instituted except by or with the consent of the Minister.
(2) A prosecution for an offence under any section of this Act may be brought at the suit of the Minister.
(3) A prosecution for an offence under any section of this Act may be brought at any time within whichever of the following periods latest expires, that is to say:—
(a) three months after the date on which it is certified in writing sealed with the official seal of the Minister that evidence sufficient to justify the institution of such prosecution came into the possession or procurement of the Minister, or
(b) six months after the commission of the offence.
Birth, marriage, and death certificates.
31.—Where, for the purpose of this Act, the age, marriage, or death of any person is required to be proved by the production of a certificate of birth, marriage, or death, any person shall, on presenting a written requisition in such form and containing such particulars as may be prescribed and, on payment of a fee in the case of a birth certificate of sixpence, and in the case of a marriage or death certificate, of one shilling, be entitled to obtain a certified copy of the entry of the birth, marriage, or death, as the case may be, of that person in the register of births, marriages, or deaths, as the case may be, under the hand of the registrar or superintendent registrar or other person having the custody thereof, and forms for such requisition shall on request be supplied without any charge by every registrar of births and deaths, and by every superintendent registrar or other person having the custody of the register.
Exemption from stamp duty.
32.—Stamp duty shall not be chargeable on any cheque, pay order, or other document by which a payment of unemployment assistance is made, nor on any receipt given for any such payment, nor on any statutory declaration made under and for the purposes of this Act.
