2.—Láithreach tar éis rithe an Achta so, beidh Coimisinéirí Dhún Laoghaire agus Coimisinéirí Dhúin Mhóir scurtha, agus leis sin déanfar gach oifigeach agus duine a bheidh an uair sin ar fostú ag Coimisinéirí Dhún Laoghaire no ag Coimisinéirí Dhúin Mhóir d'aistriú chun fostaíocht Choimisinéirí na nOibreacha Puiblí.

3.—(1) Láithreach tar éis rithe an Achta so, gan aon leithliú do dhéanamh ortha, tiocfidh gach talamh, tionóntachán, agus ionoighreachta, atá anois dílsithe i gCoimisinéirí Dhún Laoghaire no i gcimeád ar iontaoibh dóibh no dílsithe i gCoimisinéirí Dhúin Mhóir no i gcimeád ar iontaoibh dóibh, tiocfid chun bheith dílsithe agus dílseofar iad i gCoimisinéirí na nOibreacha Puiblí chun gach estáit agus leasa gur chúcha fé seach atá na tailte, na tionóntacháin, agus na hionoighreachtaí céanna ar seilbh ag Coimisinéirí Dhún Laoghaire agus ag Coimisinéirí Dhúin Mhóir fé seach no dhóibh fé seach, ach beidh san fé réir gach cíosa agus cumhnaint (más ann dóibh) atá ceangailte ar Choimisinéirí Dhún Laoghaire no ar Choimisinéirí Dhúin Mhóir anois ina dtaobh.
(2) Láithreach tar éis rithe an Achta so, gach maoin agus sócmhainn riamh dá bhfuil dílsithe anois i gCoimisinéirí Dhún Laoghaire no i gCoimisinéirí Dhúin Mhóir no dá gcuid féin acu (lasmuich de thailte, tionóntacháin, agus ionoighreachtaí), dílseoid siad fé seach i gCoimisinéirí na nOibreacha Puiblí agus tiocfid chun bheith dá gcuid féin acu, ach beid, i ngach cás in ar gá é, fé réir a n-aistrithe i leabhair aon chuideachtan, bainc, no corpráide.

4.—Gach ceart agus sochar atá ag Coimisinéirí Dhún Laoghaire no ag Coimisinéirí Dhúin Mhóir agus gach fiachas agus oblagáid atá ortha fé aon bhanna, connra, no có-aontú a dhin éinne le Coimisinéirí Dhún Laoghaire no le Coimisinéirí Dhúin Mhóir no a dhin aon chólucht acu san le héinne beid aistrithe láithreach tar éis rithte an Achta so, agus aistrítear iad leis seo, chun Coimisinéirí na nOibreacha Puiblí, agus as so amach féadfidh Coimisinéirí na nOibreacha Puiblí gach banna, connra, no có-aontú den tsórt san d'fheidhmiú no féadfar an céanna d'fheidhmiú ortha chó hiomlán agus d'fhéadfadh Coimisinéirí Dhún Laoghaire no Coimisinéirí Dhúin Mhóir é fheidhmiú no chó hiomlán agus féadfí é fheidhmiú ar aon chólucht acu san dá mba ná rithfí an tAcht so.

5.—Gach ceart, príbhléid, comhacht, údarás, agus dualgas a deonadh no a bronnadh do Choimisinéirí Dhún Laoghaire no do Choimisinéirí Dhúin Mhóir, no a forchuireadh ortha, le haon reacht atá i bhfeidhm anois, beid aistrithe láithreach tar éis rithte an Achta so agus aistrítear iad leis seo chun Coimisinéirí na nOibreacha Puiblí agus as so amach beid infheidhmithe agus có-líonfar iad ag Coimisinéirí na nOibreacha Puiblí.

6.—Gach cúis, ní, agus imeacht ina bhfuil Coimisinéirí Dhún Laoghaire no Coimisinéirí Dhúin Mhóir páirteach agus atá ag feitheamh in aon chúirt i Saorstát Éireann le linn rithte an Achta so, tiocfidh Coimisinéirí na nOibreacha Puiblí chun bheith páirteach agus beid páirteach ionta tar éis rithte an Achta so in ionad Coimisinéirí Dhún Laoghaire no Coimisinéirí Dhúin Mhóir (pe'ca aca é) agus is idir Coimisinéirí na nOibreacha Puiblí agus na daoine eile atá páirteach ionta a leanfar de gach cúis, ní no imeacht den tsórt san dá réir sin.
Féadfidh Coimisinéirí na nOibreacha Puiblí méid custum, etc., do cheapa.
7.—Sa chás ina mbeidh ag Coimisinéirí na nOibreacha Puiblí de bhua an Achta so, no ina bhfuil acu de bhua aon Achta atá i bhfeidhm anois, comhacht chun aon chustuim, rátaí, dleachtanna, no éilithe eile d'éileamh no do ghearra ar aon phiara, céibh, dug no cuan no ann no ina thaobh, tar éis dul i gcomhairle leis an Aire Tionnscail agus Tráchtála, agus d'ainneoin aon fhorála in aon Acht atá i bhfeidhm anois i dtaobh aon chustuim, rátaí, dleachtanna, no éilithe eile den tsórt san do cheapa, do theoranú, do shriana, do chó-réiteach no do luíodú, beidh sé dleathach do Choimisinéirí na nOibreacha Puiblí méid aon chustum, rátaí, dleachtanna agus éilithe den tsórt san no méid aon chó-réitigh no íoca eile ar a scór do regleáil.

8.—Gach cuan a bheidh, de bhua an Achta so, no atá, de bhua aon Achta atá i bhfeidhm anois, fé chúram agus fé bhainistí Coimisinéirí na nOibreacha Puiblí, bainfidh an Harbours, Docks and Piers Clauses Act, 1847, leis chó hiomlán agus dá ndintí an tAcht san, sa mhéid ná fuil sé bunoscionn leis na hAchtanna tré n-a mbeidh an cuan san á regleáil de thurus na huaire, d'ionchorprú leis na hAchtanna san.

9.—Aon deimhniú a dheabhruíonn bheith fé chó-shéala Coimisinéirí na nOibreacha Puiblí á rá, i dtaobh suime a luaidhtear sa deimhniú san, go bhfuil sí dlite ag na Coimisinéirí sin ar an té a luaidhtear sa deimhniú san mar gheall ar aon chustuim, rátaí, dleachtanna, no éilithe eile is inéilithe ag na Coimisinéirí maidir le haon phiar, céibh, dug, no cuan atá de thurus na huaire fé n-a gcúram agus fé n-a mbainistí, beidh sé ina fhianaise ar an suim a luaidhtear sa deimhniú san do bheith dlite mar adubhradh mara gcruthuítear a mhalairt.
Cuan Dún Laoghaire is ainm do Kingstown Harbour feasta.
10.—An cuan a bunuíodh fén ainm agus fén teideal “Kingstown Harbour” tré alt 6 den Acht a rith Páirlimint na Ríochta Aontuithe an 20adh lá de Lúnasa, 1836, agus dar teideal “An Act to amend several Acts relating to the Harbour of Kingstown,” beidh “Cuan Dún Laoghaire” mar theideal agus mar ainm air feasta.

STATE HARBOURS ACT, 1924.
Definitions.
1.—In this Act,
the expression “the Kingstown Commissioners” means the Commissioners of Kingstown Harbour appointed under an Act passed by the United Kingdom Parliament on the 11th day of July, 1815, and entitled “An Act to authorise the appointment of Commissioners for erecting an harbour for ships to the eastward of Dunleary within the Port and Harbour of Dublin”;
the expression “the Dunmore Commissioners” means the Commissioners of Dunmore Harbour appointed under an Act passed by the United Kingdom Parliament on the 3rd day of June, 1818, and entitled “An Act for improving and completing the Harbour of Dunmore, in the County of Waterford, and rendering it a fit situation for His Majesty's packets”;
the expression “the Public Works Commissioners” means the Commissioners of Public Works in Ireland.
Dissolution of Kingstown Commissioners and Dunmore Commissioners.
2.—Immediately upon the passing of this Act, the Kingstown Commissioners and the Dunmore Commissioners shall stand dissolved, and thereupon every officer and person then in the employment of the Kingstown Commissioners or of the Dunmore Commissioners shall be transferred to the employment of the Public Works Commissioners.
Transfer of property from Kingstown and Dunmore Commissioners to Commissioners of Public Works.
3.—(1) Immediately upon the passing of this Act all lands, tenements, and hereditaments now vested in or held in trust for the Kingstown Commissioners or vested in or held in trust for the Dunmore Commissioners shall, without any conveyance thereof, become and be vested in the Public Works Commissioners for all the estate and interest for which the same lands, tenements, and hereditaments are now respectively held by or for the Kingstown Commissioners and the Dunmore Commissioners respectively, but subject to all (if any) rents and covenants for which the Kingstown Commissioners or the Dunmore Commissioners are now liable in respect thereof.
(2) Immediately upon the passing of this Act all property and assets whatsoever now vested in or belonging to the Kingstown Commissioners or the Dunmore Commissioners (other than and except lands, tenements, and hereditaments) shall respectively vest in and become the property of the Public Works Commissioners, but subject where necessary to transfer in the books of any company, bank, or corporation.

4.—All rights and benefits and all liabilities and obligations of the Kingstown Commissioners or of the Dunmore Commissioners under any bond, contract, or agreement made by or with any person with or by the Kingstown Commissioners or with or by the Dunmore Commissioners shall immediately upon the passing of this Act be and the same are hereby transferred to the Public Works Commissioners, and every such bond, contract, or agreement may henceforth be enforced by or against the Public Works Commissioners as fully as the same could have been enforced by or against the Kingstown Commissioners or the Dunmore Commissioners if this Act had not been passed.

5.—Immediately upon the passing of this Act all the rights, privileges, powers, authorities, and duties granted, conferred, or imposed by any statute now in force to or on the Kingstown Commissioners or the Dunmore Commissioners shall be and the same are hereby transferred to the Public Works Commissioners and shall henceforth be exercisable and performed by the Public Works Commissioners.
Continuation of pending legal proceedings.
6.—In all suits, matters, and proceedings to which the Kingstown Commissioners or the Dunmore Commissioners are a party and which at the passing of this Act are pending in any court in Saorstát Eireann, the Public Works Commissioners shall on the passing of this Act become and be a party in place of the Kingstown Commissioners or the Dunmore Commissioners (as the case may be), and every such suit, matter, or proceeding shall be continued between the Public Works Commissioners and the other parties thereto accordingly.
Public Works Commissioners may fix amount of tolls, etc.
7.—Where the Public Works Commissioners shall have by virtue of this Act or have by virtue of any Act now in force power to charge or levy any tolls, rates, dues, or other charges on, in, or in relation to, any pier, wharf, dock, or harbour it shall be lawful for the Public Works Commissioners, after consultation with the Minister for Industry and Commerce, and notwithstanding any provision in any Act now in force in relation to the fixing, limiting, restricting, compounding, or commuting of any such tolls, rates, dues, or other charges, to regulate the amount of any such tolls, rates, dues, and other charges or of any composition or other payment in respect thereof.
Harbours, etc., Act, 1847, to apply to harbours managed by Public Works Commissioners.
8.—The Harbours, Docks, and Piers Clauses Act, 1847, shall apply to every harbour which shall be, by virtue of this Act, or is, by virtue of any Act now in force, under the control and management of the Public Works Commissioners as fully as if the said Act, so far as it is not inconsistent with the Acts for the time being regulating such harbour, had been incorporated with those Acts.
Certificate of Public Works Commissioners to be evidence.
9.—A certificate purporting to be under the common seal of the Public Works Commissioners stating that a sum specified in such certificate is due and owing by the person named in such certificate to the said Commissioners in respect of any tolls, rates, dues, or other charges chargeable by the said Commissioners in relation to any pier, wharf, dock, or harbour for the time being under their control and management shall, unless the contrary is proved, be evidence that the sum stated in such certificate is so due as aforesaid.
Kingstown Harbour to be called Dun Laoghaire Harbour.
10.—The harbour which, by section 6 of the Act of the United Kingdom Parliament passed on the 20th day of August, 1836, and entitled “An Act to amend several Acts relating to the Harbour of Kingstown” was constituted under the name and title of “Kingstown Harbour” shall henceforth be entitled and known as “Dun Laoghaire Harbour.”
Short title.
11.—This Act may be cited as the State Harbours Act, 1924.
