AN tACHT UM OBAIR OÍCHE (BÁCÚIS) (LEASÚ), 1981

Léiriú.
1.—San Acht seo—
ciallaíonn “cigire” duine arna cheapadh ag an Aire chun bheith ina chigire chun críocha an Achta seo;
ciallaíonn “an Príomh-Acht” an tAcht um Obair Oíche (Bácúis), 1936.
É bheith neamhdhleathach monarú a bheith ar siúl i mbácús i rith tréimhse na hoíche ach amháin faoi cheadúnas.
2.—Leasaítear leis seo an Príomh-Acht tríd an alt seo a leanas a chur in ionad alt 3:
“3.—(1) Ach amháin faoi réim agus de réir cheadúnas faoin alt seo, ní bheidh sé dleathach d'aon duine a sheolann bacús lena mbaineann an tAcht seo aon phróis mhonaraíochta, nach monaraíocht brioscaí lena mórdhíol ná obair neamhchoitianta a bheith ar siúl aige ná a cheadú d'aon oibrí é bheith ar siúl aige sa bhácús sin aon tráth i dtréimhse na hoíche.
(2) Ar iarratas a dhéanfaidh aon duine i cibé foirm agus ina mbeidh cibé sonraí a ordóidh an tAire, féadfaidh an tAire, tar éis dó dul i gcomhairle le daoine atá, dar leis, ionadaitheach d'fhostóirí ag a bhfuil leas i mbácúis agus le daoine atá, dar leis, ionadaitheach d'oibrithe ag a bhfuil leas amhlaidh, más é a thuairim go mbeidh sé ar leas an phobail sin a dhéanamh, ceadúnas a eisiúint chuig an duine sin aon phróis mhonaraíochta atá toirmiscthe le fo-alt (1) den alt seo a bheith ar siúl aige i dtréimhse na hoíche i mbácús lena mbaineann an tAcht seo.
(3) Ceadúnas a eiseofar faoin alt seo is ceadúnas é in aghaidh cibé tréimhse, nach mó ná dhá bhliain, a chinnfidh an tAire.
(4) Beidh ceadúnas a eiseofar faoin alt seo faoi réir cibé coinníollacha (más ann) a shonróidh an tAire sa cheadúnas.
(5) Féadfaidh an tAire ceadúnas a eisíodh faoin alt seo a chúlghairm.
(6) Duine nach gcomhlíonfaidh forálacha fho-alt (1) den alt seo beidh sé ciontach i gcion agus dlífear ar é a chiontú go hachomair fíneáil nach mó ná £500 agus, i gcás ciona leanúnaigh, fíneáil bhreise (nach mó san iomlán ná £600) nach mó ná £50 in aghaidh gach lae a leanfar den chion, a chur air.
(7) Aon duine a dhéanfaidh—
(a) chun ceadúnas faoin alt seo a fháil dó féin nó d'aon duine eile, aon ráiteas nó uiríoll is eol dó a bheith bréagach nó míthreorach, nó
(b) nach gcomhlíonfaidh coinníoll a bheidh sonraithe i gceadúnas faoin alt seo,
beidh sé ciontach i gcion agus dlífear ar é a chiontú go hachomair fíneáil nach mó ná £250 a chur air.”
Leasú ar alt 5 den Phríomh-Acht.
3.—Leasaítear leis seo alt 5 den Phríomh-Acht trí fho-alt (2) a scriosadh.
Cumhachtaí chun dul isteach agus imscrúdú a dhéanamh.
4.—(1) Is cigire a fheidhmeoidh na cumhachtaí chun dul isteach agus cigireacht a dhéanamh a thugtar do chomhalta den Gharda Síochána le halt 9 den Phríomh-Acht, agus, dá réir sin, beidh éifeacht leis an alt sin amhail is dá gcuirfí tagairt do chigire in ionad gach tagartha ansin do bhall den Gharda Síochána agus tagairt don Aire in ionad na tagartha do Chigire den Gharda Síochána.
(2) Tabharfaidh an tAire deimhniú a cheapacháin do gach cigire agus, ar iarratas a dhéanamh chun é a ligean isteach in aon áitreabh nó áit chun críocha an Achta seo, déanfaidh an cigire, má iarrtar air é, an deimhniú a thabhairt ar aird d'áititheoir an áitribh agus d'aon duine a bheidh á cheistiú aige.
(3) Leasaítear leis seo alt 9 den Phríomh-Acht trí “£250” a chur in ionad “deich bpúint” i bhfo-alt (3).
Ionchúiseamh i gcionta.
5.—(1) Féadfaidh an tAire imeachtaí i ndáil le cion faoin bPríomh-Acht a thionscnamh agus a thabhairt ar aghaidh.
(2) D'ainneoin alt 10 (4) den Petty Sessions (Ireland) Act, 1851, féadfar imeachtaí achomaire maidir le cion faoin bPríomh-Acht a thionscnamh laistigh de dhá mhí dhéag ó dháta an chiona.
Gearrtheideal, forléiriu agus comhlua.
6.—(1) Féadfar an tAcht um Obair Oíche (Bácúis) (Leasú), 1981, a ghairm den Acht seo.
(2) Déanfar an tAcht um Obair Oíche (Bácúis), 1936, agus an tAcht seo a fhorléiriú le chéile agus féadfar na hAchtanna um Obair Oíche (Bácúis), 1936 agus 1981, a ghairm díobh le chéile.

NIGHT WORK (BAKERIES) (AMENDMENT) ACT, 1981
Interpretation.
1.—In this Act—
“inspector” means a person appointed by the Minister to be an inspector for the purposes of this Act;
“the Principal Act” means the Night Work (Bakeries) Act, 1936.
Unlawful to manufacture in bakery during period of night save under licence.
2.—The Principal Act is hereby amended by the substitution for section 3 of the following section:
“3.—(1) Save under and in accordance with a licence under this section, it shall not be lawful for any person who carries on a bakery to which this Act applies to carry on or to permit any worker to carry on in such bakery at any time in the period of night any process of manufacture which is neither the manufacture of biscuits for sale wholesale nor exceptional work.
(2) On the application of any person made in such form and containing such particulars as the Minister may direct, the Minister, after consultation with persons who in his opinion are representative of employers interested in bakeries and with persons who in his opinion are representative of workers so interested, may, if he is of the opinion that it is in the public interest so to do, issue to such person a licence to carry on, in a bakery to which this Act applies, in the period of night, any process of manufacture which is prohibited by subsection (1) of this section.
(3) A licence issued under this section shall be for such period, not exceeding two years, as the Minister may decide.
(4) A licence issued under this section shall be subject to such conditions (if any) as the Minister may specify in the licence.
(5) The Minister may revoke a licence issued under this section.
(6) A person who fails to comply with the provisions of subsection (1) of this section shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £500 and, in the case of a continuing offence, a further fine (not exceeding in total £600) not exceeding £50 for each day during which the offence is continued.
(7) Any person who—
(a) for the purpose of obtaining, for himself or any other person, a licence under this section, makes any statement or representation which is to his knowledge false or misleading, or
(b) fails to comply with a condition specified in a licence under this section,
shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £250.”
Amendment of section 5 of Principal Act.
3.—Section 5 of the Principal Act is hereby amended by the deletion of subsection (2).
Powers of entry and investigation.
4.—(1) The powers of entry and inspection conferred on a member of the Garda Síochána by section 9 of the Principal Act shall be exercised by an inspector and, accordingly, that section shall have effect as if for every reference therein to “a member of the Garda Síochána” there were substituted a reference to “an inspector” and for the reference to “Inspector of the Garda Síochána” there were substituted a reference to “the Minister”.
(2) Every inspector shall be furnished by the Minister with a certificate of his appointment and, on applying for admission to any premises or place for the purposes of this Act, shall, if so required, produce the certificate to the occupier of the premises and any person being questioned by him.
(3) Section 9 of the Principal Act is hereby amended by the substitution in subsection (3) for “ten pounds” of “£250”.
Prosecution of offences.
5.—(1) Proceedings in relation to an offence under the Principal Act may be brought and prosecuted by the Minister.
(2) Notwithstanding section 10 (4) of the Petty Sessions (Ireland) Act, 1851, summary proceedings for an offence under the Principal Act may be instituted within twelve months from the date of the offence.
Short title, construction and collective citation.
6.—(1) This Act may be cited as the Night Work (Bakeries) (Amendment) Act, 1981.
(2) The Night Work (Bakeries) Act, 1936, and this Act shall be construed together and may be cited together as the Night Work (Bakeries) Acts, 1936 and 1981.
