CUID I
Réamhráiteach agus Ginearálta
Gearrtheideal.
1.—Féadfar an tAcht um Thruailliú Aeir, 1987, a ghairm den Acht seo.
Tosach feidhme.
2.—Tiocfaidh an tAcht seo i ngníomh cibé lá nó laethanta a cheapfar le hordú nó le horduithe ón Aire go ginearálta nó faoi threoir críocha nó forála áirithe nó faoi threoir limistéir nó limistéar áirithe, agus féadfar laethanta éagsúla a shocrú chun críocha éagsúla agus le haghaidh forálacha éagsúla den Acht seo agus le haghaidh limistéar éagsúil.
Neamhfheidhm an Achta.
3.—Ní bheidh feidhm ag an Acht seo maidir le hastaíocht a éireoidh—
(i) as substaint a dhiúscairt ar muir trína dó d'aon turas d'fhonn í a dhíothú go teirmeach, nó
(ii) as aon substaint nó feiste radaighníomhach a úsáid.
Truailliú aeir.
4.—Ciallaíonn “truailliú aeir” san Acht seo staid ina bhfuil oiread áirithe de thruailleán san atmaisféar gur dóigh dó—
(i) díobháil a dhéanamh do shláinte an phobail, nó
(ii) éifeacht dhochrach a bheith aige ar flora nó fauna nó damáiste a dhéanamh do mhaoin, nó
(iii) lagú nó cur isteach a dhéanamh ar thaitneamhachtaí nó ar an timpeallacht.
An dóigh is fearr is féidir.
5.—(1) Faoi réir fho-alt (3), aon tagairt san Acht seo do leas a bhaint as an dóigh is fearr is féidir chun astaíocht a chosc nó a theorannú, forléireofar gur tagairt í a chiallaíonn saoráidí a sholáthar agus a chothabháil, a úsáid, a oibriú agus a mhaoirsiú go cuí arb iad na saoráidí iad, ag féachaint do na himthosca go léir, is oiriúnaí le haghaidh an choisc nó an teorannaithe sin.
(2) Nuair a bheifear ag breithniú, maidir le saoráidí, cibé acu arb iad na saoráidí is oiriúnaí iad chun astaíocht a chosc nó a theorannú, tabharfar aird ar na nithe seo a leanas—
(a) i gcás gléasra tionscail, seachas gléasra tionscail láithreach—
(i) staid reatha an eolais theicniúil, agus
(ii) riachtanais na timpeallachta, agus
(iii) na costais a thabhófaí ag cur na saoráidí lena mbaineann ar fáil, á gcothabháil, á n-úsáid, á n-oibriú agus á maoirsiú, agus
(b) in aon chás eile, i dteannta na nithe a shonra ítear i mír (a) (i), (ii) agus (iii)—
(i) cineál, méid agus éifeacht na hastaíochta lena mbaineann, agus
(ii) aois an ghléasra tionscail láithrigh nó an áitribh eile, an cineál saoráidí atá suiteáilte ann agus an tréimhse ar dócha gur lena linn a úsáidfear an gléasra nó an t-áitreabh eile nó a leanfar á oibriú, agus
(iii) na costais a thabhófaí ag athchóiriú an ghléasra nó an áitribh eile, nó ag athchóiriú na saoráidí ann nó ag cur saoráidí eile ina n-ionadsan, i ndáil leistaid eacnamúil gnóthas nó fiontar den aicme lena mbaineann.
(3) Féadfaidh an tAire, ó am go ham de réir mar is gá sa chás, treoracha a eisiúint a shonróidh an dóigh is fearr is féidir chun cibé astaíocht a chosc nó a theorannú de réir mar a bheidh sonraithe sa treoir, go ginearálta nó ó áitribh d'aicme nó de thuairisc faoi leith, agus tabharfar aird ar aon treoracha den sórt sin nuair a bheifear ag riaradh an Achta seo.
(4) Aon uair a eiseoidh an tAire treoir faoi fho-alt (3) cuirfidh sé faoi deara a luaithe is féidir—
(a) cóip den treoir sin a chur chuig gach údarás áitiúil agus chuig an mBord Pleanála,
(b) fógra i dtaobh eisiúint na treorach a fhoilsiú san Iris Oifigiúil, agus
(c) cóip den treoir a chur ar fáil, ar cibé táille (más ann) a íoc a shocróidh an tAire, do gach duine a dhéanann iarratas ar chóip den sórt sin.
(5) San alt seo ciallaíonn “saoráidí” innealra, gléasra, trealamh, fearais, gairis, foirgnimh agus déanmhais eile.
Gléasra tionscail agus gléasra tionscail láithreach.
6.—(1) Ciallaíonn “gléasra tionscail” san Acht seo aon ghléasra, trealamh, fearas, gaireas, innealra, oibreacha, foirgneamh nó déanmhas eile nó aon talamh nó aon chuid d'aon talamh a úsáidtear i gcúrsa trádála, gnó nó tionscail chun críocha aon phróisis tionscail a shonraítear sa Tríú Sceideal nó chun críocha a bhaineann le haon phróiseas den sórt sin.
(2) San Acht seo ciallaíonn “gléasra tionscail láithreach” gléasra tionscail—
(a) a ndéantar ina leith cead faoi Chuid IV den Acht Rialtais Áitiúil (Pleanáil agus Forbairt), 1963, a dheonú roimh cibé lá (dá ngairtear “an lá iomchuí” san fho-alt seo) a fhorordóidh an tAire, nó
(b) atá, an lá díreach roimh an lá iomchuí, nó a bhí, tráth ar bith le linn na tréimhse dhá mhí dhéag dar críoch an lá díreach roimh an lá iomchuí, á úsáid chun críocha aon phróisis tionscail a shonraítear sa Tríú Sceideal, nó chun críocha a bhaineann le haon phróiseas den sórt sin, seachas gléasra tionscail is déanmhas neamhúdaraithe nó arb úsáid neamhúdaraithe a úsáid.
(3) Féadfaidh an tAire, le rialacháin, an Tríú Sceideal a athrú trí aon phróiseas tionscail a chur leis nó a scriosadh as.
(4) San alt seo tá le “déanmhas neamhúdaraithe” agus “úsáid neamhúdaraithe” na bríonna a shanntar dóibh leis an Acht Rialtais Áitiúil (Pleanáil agus Forbairt), 1963.
Léiriú i gcoitinne.
7.—(1) San Acht seo—
tá le “plean bainisteoireachta aercháilíochta” an bhrí a shonraítear in alt 46;
ciallaíonn “caighdeán aercháilíochta” caighdeán a fhorordóidh an tAire chun críocha an Achta seo de bhun alt 50;
ciallaíonn “tinteán údaraithe” tinteán a ndearbhaíonn an tAire maidir leis i rialacháin faoi alt 40 (2) gur tinteán údaraithe é;
ciallaíonn “breosla údaraithe” breosla a ndearbhaíonn an tAire maidir leis i rialacháin faoi alt 40 (3) gur breosla údaraithe é;
ciallaíonn “duine údaraithe” duine—
(a) a bheidh ceaptha i scríbhinn ag údarás áitiúil chun bheith ina dhuine údaraithe chun críocha an Achta seo, nó
(b) a bheidh ceaptha i scríbhinn ag duine a shonrófar i rialacháin faoin Acht seo chun bheith ina dhuine údaraithe de bhun na rialachán sin;
ciallaíonn “astaíocht” ach amháin mar a n-éilíonn an comhthéacs a mhalairt, truailleán a astú isteach san atmaisféar;
ciallaíonn “luach teorann astaíochta” teorainn a fhorordóidh an tAire faoi alt 51;
folaíonn “tinteán” aon fhoirnéis, loisceoir, gráta nó sornóg cibé acu oscailte nó dúnta iad nó aon áit dóite eile;
folaíonn “feidhmeanna” cumhachtaí agus dualgais;
folaíonn “próiseas tionscail” aon phróiseas a sheoltar i gcúrsa trádála, gnó nó tionscail agus ar próiseas é a bheartaítear chun aon earra, cuid d'earra, substaint, fuinneamh nó ní a dhéanamh nó a tháirgeadh nó a bheartaítear chun críocha a bhaineann leis an gcéanna nó a bheartaítear chun aon earra, substaint nó ní a athrú, a dheisiú, a ornáidiú, a mhaisiú, a ghlanadh, a ní, a phacáil nó a stánú, nó a oiriúnú lena dhíol nó a bhriseadh suas nó a scartáil nó a bheartaítear chun críocha a bhaineann leis an gcéanna; lena n-áirítear, go háirithe, mianraí a fháil, a ardú, a thógáil, a bhreith chun siúil agus a phróiseáil (lena n-áirítear a méid a laghdú, iad a ghrádú agus iad a théamh), fuíll mhianraí a stóráil agus fuíll eile a dhó, a chóireáil nó a aisghabháil;
folaíonn “ceadúnas”, i ndáil le ceadúnas a dheonaítear faoi alt 32, ceadúnas den sórt sin arna athbhreithniú de bhun alt 33, i gcás go gceadaíonn nó go n-éilíonn an comhthéacs amhlaidh;
ciallaíonn “údarás áitiúil”—
(a) i gcás chontae riaracháin Bhaile Átha Cliath, seachas buirg Dhún Laoghaire, comhairle chontae Bhaile Átha Cliath,
(b) i gcás bhuirg Dhún Laoghaire, bardas na buirge,
(c) i gcás contaebhuirge, bardas na contaebhuirge, agus
(d) i gcás aon chontae riaracháin eile, comhairle an chontae,
agus déanfar tagairtí do limistéar feidhme údaráis áitiúil a fhorléiriú dá réir;
ciallaíonn “an tAire” an tAire Comhshaoil;
folaíonn “monatóireacht” aon astaíocht in aon ionad nó aer na timpeallachta in aon ionad a iniúchadh, a thomhas, a shampláil nó a anailísiú, chun críocha an Achta seo, i gceann tréimhsí nó go leanúnach;
folaíonn “áititheoir” i ndáil le haon áitreabh, léasaí, aon duine atá i dteideal an t-áitreabh a áitiú agus aon duine eile a bhfuil rialú aige ar an áitreabh de thuras na huaire;
ciallaíonn “truailleán” aon substaint a shonraítear sa Chéad Sceideal nó aon substaint nó fuinneamh eile a d'fhéadfadh a bheith ina chúis le truailliú aeir nuair a astaítear é isteach san atmaisféar, as féin nó in éineacht le haon substaint eile;
folaíonn “áitreabh” aon mheasáiste, foirgneamh, déanmhas nó talamh (cibe acu atá aon déanmhais ar an talamh nó nach bhfuil nó cibé acu atá talamh faoi uisce nó nach bhfuil) nó aon oidhreachtán faoi aon tionacht mar aon le haon tithe lasmuigh agus aon chúirtealáiste;
ciallaíonn “forordaithe” forordaithe le rialacháin arna ndéanamh ag an Aire;
ciallaíonn “teaghais phríobháideach” aon fhoirgneamh nó déanmhas nó aon chuid d'aon fhoirgneamh nó déanmhas (lena n-áirítear aon fhoirgneamh nó déanmhas coimhdeach) nach n-úsáidtear nó nach mbeartaítear a úsáid ach amháin mar áit chónaithe ag daoine ach ní fholaíonn sé—
(a) cúirtealáiste nó gairdín, ná
(b) foirgneamh nó déanmhas coimhdeach, nó cuid d'fhoirgneamh nó de dhéanmhas, ina bhfuil tinteán a bhfuil toilladh téite uasta aige is mó ná 45kW agus a dhéanann freastal ar bhreis agus aon teaghais amháin;
ciallaíonn “áit phoiblí” aon sráid, bóthar, cladach nó áit eile ar a bhfuil rochtain ag an bpobal cibé acu de cheart nó le cead é agus cibé acu faoi réir muirir nó saor ó mhuirear é;
ciallaíonn “an clár” an clár a choimeádtar de bhun alt 17;
ciallaíonn “feidhm fhorchoimeádta”—
(a) i ndáil le comhairle contae nó bardas Dhún Laoghaire, feidhm fhorchoimeádta chun críocha na nAchtanna um Bainistí Chontae, 1940 go 1985;
(b) i ndáil le bardas contaebhuirge, feidhm fhorchoimeádta chun críocha na nAchtanna a bhaineann le bainistí na contaebhuirge;
folaíonn “deatach” súiche, luaith, grean, agus aon cháithnín eile a astaítear i ndeatach;
ciallaíonn “limistéar faoi rialú speisialta” limistéar a bhfuil ordú um limistéar faoi rialú speisialta i ngníomh i ndáil leis;
tá le “ordú um limistéar faoi rialú speisialta” an bhrí a shanntar di le halt 39.
(2) San Acht seo, tagairt d'alt, do Sceideal nó do Chuid is tagairt í d'alt, do Sceideal nó do Chuid den Acht seo mura bhfuil sé léirithe gur tagairt d'achtachán éigin eile atá beartaithe.
(3) San Acht seo, tagairt d'fho-alt, do mhír nó d'fhomhír is tagairt í d'fho-alt, do mhír nó d'fhomhír na forála ina bhfuil an tagairt mura bhfuil sé léirithe gur tagairt d'fhoráil éigin eile atá beartaithe.
(4) Déanfar tagairt san Acht seo d'aon achtachán a fhorléiriú mar thagairt don achtachán sin arna leasú nó arna oiriúnú le haon achtachán ina dhiaidh sin.
Feidhm an Achta maidir le háitribh ar leis an Stát iad.
8.—Beidh feidhm ag an Acht seo maidir le háitribh ar leis an Stát iad nó atá ar áitiú ag an Stát.
Aisghairm.
9.—(1) Déantar leis seo gach achtachán a luaitear i gcolún (2) de Chuid I den Dara Sceideal a aisghairm a mhéid a shonraítear i gcolún (3) den Chuid sin den Sceideal sin.
(2) Déantar leis seo gach Ionstraim Reachtúil a luaitear i gcolún (2) de Chuid II den Dara Sceideal a aisghairm a mhéid a shonraítear i gcolún (3) den Chuid sin den Sceideal sin.
Rialacháin.
10.—(1) Féadfaidh an tAire rialacháin a dhéanamh—
(a) chun aon ábhar a dtagraítear dó san Acht seo mar ábhar forordaithe, a fhorordú,
(b) i ndáil le haon ábhar a dtagraítear dó san Acht seo mar ábhar is ábhar do rialacháin, agus
(c) chun críche lánéifeacht a thabhairt don Acht seo.
(2) Féadfaidh rialacháin arna ndéanamh faoin Acht seo forálacha éagsúla a dhéanamh i ndáil le limistéir éagsúla, imthosca éagsúla agus aicmí éagsúla cásanna.
(3) I gcás go mbeartaítear rialacháin a dhéanamh faoi alt 6, leagfar dréacht de na rialacháin faoi bhráid gach Tí den Oireachtas agus ní dhéanfar na rialacháin go dtí go mbeidh rún ag ceadú an dréachta rite ag gach Teach acu sin.
(4) Déanfar gach rialachán a dhéanfaidh an tAire faoin Acht seo (seachas rialachán arna dhéanamh faoi alt 6) a leagan faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus má dhéanann ceachtar Teach acu sin, laistigh den lá is fiche a shuífidh an Teach sin tar éis an rialachán a leagan faoina bhráid, rún a rith ag neamhniú an rialacháin, beidh an rialachán ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin rialachán.
Cionta.
11.—(1) Duine ar bith a sháróidh aon fhoráil den Acht seo nó d'aon rialachán arna dhéanamh faoin Acht seo nó d'aon fhógra arna sheirbheáil faoin Acht seo, beidh sé ciontach i gcion.
(2) I gcás comhlacht corpraithe nó duine ag gníomhú thar ceann comhlachta chorpraithe do dhéanamh ciona faoin Acht seo agus go gcruthófar go ndearnadh amhlaidh é le toiliú, le cúlcheadú nó le ceadú, nó gur urasaíodh é le haon fhaillí ar thaobh, aon duine is stiúrthóir ar an gcomhlacht nó arb é bainisteoir nó rúnaí an chomhlachta é nó ar oifigeach eile don chomhlacht sin é, beidh an duine sin ciontach i gcion freisin.
(3) San alt seo, tagairt do shárú forála, folaíonn sí, de réir mar is iomchuí, tagairt do dhiúltú, nó do mhainneachtain, déanamh de réir na forála sin.
Pionóis.
12.—(1) Maidir le duine a bheidh ciontach i gcion faoin Acht seo—
(a) dlífear, ar é a chiontú go hachomair, fíneáil nach mó ná £1,000 (mar aon, i gcás ciona leanúnaigh, le fíneáil nach mó ná £100 in aghaidh gach lae a leanfar den chion agus nach mó san iomlán ná méid is comhionann le £1,000 nuair a chuirtear í le haon fhíneáil eile faoin mír seo i ndáil leis an gcion lena mbaineann), nó príosúnacht ar feadh aon téarma nach faide ná sé mhí nó, de rogha na cúirte, an fhíneáil sin agus an phríosúnacht sin le chéile, a chur air,
(b) dlífear, ar é a chiontú ar díotáil, fíneáil nach mó ná £10,000 (mar aon, i gcás ciona leanúnaigh, le fíneáil nach mó ná £1,000 in aghaidh gach lae a leanfar den chion), nó príosúnacht ar feadh téarma nach faide ná dhá bhliain nó, de rogha na cúirte, an fhíneáil sin agus an phríosúnacht sin le chéile, a chur air.
(2) Beidh feidhm ag alt 13 den Acht um Nós Imeachta Coiriúil, 1967, maidir le cion lena mbaineann fo-alt (1) amhail is dá mba rud é, in ionad na bpionós dá bhforáiltear i bhfo-alt (3) den alt sin 13, gur sonraíodh ann na pionóis dá bhforáiltear i bhfo-alt (1) (a), agus déanfar an tagairt i bhfo-alt (2)(a) den alt sin 13 do na pionóis dá bhforáiltear san fho-alt sin (3) a fhorléiriú, agus beidh éifeacht leo, dá réir sin.
Cionta a ionchúiseamh.
13.—(1) (a) Maidir le cion faoin Acht seo, féadfaidh an t-údarás áitiúil ar ina limistéar feidhme a rinneadh an cion nó, i gcás ciona a d'éirigh as ordú a rinne, nó fógra a sheirbheáil, údarás áitiúil, féadfaidh an t-údarás áitiúil lena mbaineann, é a ionchúiseamh go hachomair.
(b) I gcás gur dóigh le húdarás áitiúil go bhféadfadh astaíocht ó aon áitreabh a bheith ina chúis le truailliú aeir a d'fhearfadh ar aon chuid dá limistéar feidhme, féadfaidh an t-údarás áitiúil, d'ainneoin gur ó áitreabh atá suite lasmuigh de limistéar feidhme an údaráis áitiúil lena mbaineann don astaíocht, imeachtaí achoimre a thionscnamh i leith ciona faoin Acht seo i ndáil leis an astaíocht lena mbaineann.
(2) Féadfaidh an tAire, le rialacháin faoin alt seo, a fhorordú go bhféadfaidh cibé duine (lena n-áirítear an tAire) a bheidh sonraithe sna rialacháin de bhreis ar an údarás áitiúil nó ina ionad, cibé cion a bheidh sonraithe amhlaidh a ionchúiseamh go hachomair.
(3) D'ainneoin fhorálacha alt 10 (4) den Petty Sessions (Ireland) Act, 1851, féadfar imeachtaí achoimre mar gheall ar chion faoin Acht seo a thosú—
(a) tráth ar bith laistigh de dhá mhí dhéag ón dáta a rinneadh an cion, nó
(b) tráth ar bith laistigh de thrí mhí ón dáta a dtagann fianaise ar iúl an duine a thionscnóidh na himeachtaí, ar fianaise í is leor, i dtuairim an duine sin, chun gur cóir na himeachtaí a thabhairt,
cibé acu is déanaí: ar choinníoll nach dtionscnófar aon imeachtaí den sórt sin tráth is déanaí ná cúig bliana ón dáta a rinneadh an cion lena mbaineann.
(4) Chun críocha an ailt seo, beidh deimhniú a shínigh an duine a thionscnóidh na himeachtaí, nó a síníodh thar a cheann, maidir leis an dáta a tháinig fianaise a bhaineann leis an gcion ar a iúl, ina fhianaise prima facie ar an méid sin agus maidir le doiciméad a airbheartóidh gur deimhniú é a eisíodh chun críocha an fho-ailt seo agus a bheith sínithe amhlaidh, measfar, in aon imeachtaí dlíthiúla, gur síníodh amhlaidh é agus glacfar leis i bhfianaise gan cruthúnas ar shíniú an duine a airbheartaíonn gurb é a shínigh an deimhniú, mura suífear a mhalairt.
Cumhachtaí duine údaraithe.
14.—(1) Faoi réir fho-alt (2), beidh duine údaraithe, chun aon chríche a bhaineann leis an Acht seo, i dteideal, gach tráth réasúnach, dul isteach in aon áitreabh agus aon daoine nó trealamh eile is dóigh leis is gá chun na críche a thabhairt leis ann.
(2) Ní dhéanfaidh duine údaraithe, seachas le toiliú an áititheora, dul isteach i dteaghais phríobháideach mura mbeidh fógra 24 uaire an chloig ar a laghad go bhfuil sé beartaithe aige dul isteach tugtha aige i scríbhinn d'áititheoir na teaghaise.
(3) Tabharfar deimhniú dá cheapachán do gach duine údaraithe agus, nuair a bheidh aon chumhacht a thugtar dó leis an Acht seo nó faoi á feidhmiú aige déanfaidh an duine údaraithe, má iarrann aon duine dá ndéanann sé difear air é, an deimhniú a thabhairt ar aird don duine sin.
(4) Aon uair a rachaidh duine údaraithe isteach in aon áitreabh de bhun an ailt seo, féadfaidh sé san áitreabh sin—
(a) cibé pleananna agus cibé iniúchtaí a dhéanamh,
(b) cibé tástálacha a dhéanamh agus cibé samplaí a thógáil,
(c) cibé faisnéis a éileamh ar úinéir nó ar áititheoir an áitribh nó r aon duine eile san áitreabh, nó
(d) cibé taifid nó cibé doiciméid a iniúchadh,
is dóigh leis, ag féachaint do na himthosca uile, is gá chun críocha an Acht seo.
(5) Aon duine a bhacfadh duine údaraithe le linn dó a chumhachtaí faoin alt seo a fheidhmiú nó a mhainneoidh déanamh de réir éilimh ó dhuine údaraithe nó a choinneoidh siar go toiliúil aon fhaisnéis a éileoidh an duine údaraithe, beidh sé ciontach i gcion.
(6) Más rud é, le linn do dhuine údaraithe a chumhachtaí a fheidhmiú faoin alt seo, go gcoiscfear é ó dhul isteach in aon áitreabh, féadfaidh an duine údaraithe nó an duine a cheap é, iarratas a dhéanamh chun na Cúirte Dúiche ar bharántas ag údarú an dul isteach sin.
(7) Féadfaidh an tAire rialacháin a dhéanamh chun críocha an ailt seo.
(8) Gan dochar do ghinearáltacht fho-alt (7), féadfaidh rialacháin faoin alt seo foráil a dhéanamh le haghaidh aon cheann nó gach ceann de na hábhair seo a leanas:
(a) samplaí a thógáil agus tástálacha, scrúduithe agus anailísí a dhéanamh ar shamplaí;
(b) na haicmí daoine a bheidh freagrach i dtógáil, na samplaí sin agus i ndéanamh na dtástálacha, na scrúduithe agus na n-anailísí sin a shonrú;
(c) an deimhniú nó an fhianaise eile a bheidh le tabhairt i dtaobh toraidh aon tástála, scrúdaithe nó anailíse den sórt sin agus an aicme nó na haicmí daoine a thabharfaidh an deimhniú nó an fhianaise sin a shonrú;
(d) maidir le haon deimhniú nó fianaise a thugtar nó a thabharfar i leith aon tástála, scrúdú nó anailíse ar aon sampla, go mbeidh an deimhniú nó an fhianaise sin ina bhfianaise in ndáil leis an sampla sin, gan tuilleadh cruthúnais, ar thoradh na tástála, an scrúdaithe nó na hanailíse go dtí go suífear a mhalairt.
Fógraí a sheirbheáil.
15.—(1) Aon fhógra a cheanglaítear a sheirbheáil nó a thabhairt leis an Acht seo nó faoi, díreofar é chuig an duine lena mbaineann agus seirbheálfar air é nó tabharfar dó é ar dhóigh de na dóigheanna seo a leanas—
(a) trína dhíriú chuige faoina ainm agus trína sheachadadh air,
(b) trína fhágáil ag an seoladh ina bhfuil cónaí air de ghnáth,
(c) trína chur leis an bpost i litir chláraithe réamhíoctha arna díriú chuige ag an seoladh ina bhfuil cónaí air de ghnáth,
(d) má thug sé seoladh le haghaidh seirbheáil fógraí, trína fhágáil ag an seoladh sin nó trína chur leis an bpost cláraithe réamhíoctha, agus é dírithe chuige, chuig an seoladh sin,
(e) i gcás nach féidir seoladh ina bhfuil cónaí air de ghnáth a fhionnadh trí fhiosrúchán réasúnach a dhéanamh agus gur gá fógra a sheirbheáil air nó a thabhairt dó i leith aon áitribh, trína sheachadadh ar dhuine os cionn 16 bliana d'aois a chónaíonn, nó a fhostaítear, san áitreabh nó trína dhaingniú in ionad feiceálach san áitreabh nó gar dó.
(2) Mura féidir ainm áititheora áitribh a fhionnadh trí fhiosrúchán réasúnach a dhéanamh, féadfaidh fógra faoin Acht seo a bheith dírithe chuig “an t-áititheoir”.
(3) Chun críocha an ailt seo, measfar, maidir le cuideachta atá cláraithe faoi Achtanna na gCuideachtaí, 1963 go 1986, cónaí a bheith uirthi de ghnáth ina hoifig chláraithe, agus measfar, maidir le gach comhlacht corpraithe eile agus maidir le gach comhlacht neamhchorpraithe, cónaí a bheith air ina phríomhoifig, nó ina phríomháit ghnó.
Oibleagáid faisnéis a thabhairt.
16.—(1) Féadfaidh údarás áitiúil, chun aon chríche a bhaineann lena fheidhmeanna faoin Acht seo, trí fhógra i scríbhinn—
(a) a cheangal ar áititheoir aon áitribh laistigh dá limistéar feidhme, cibé sonraí—
(i) maidir le haon ghníomhaíocht nó próiseas a bhíonn á sheoladh san áitreabh,
(ii) maidir le haon tinteáin san áitreabh, agus
(iii) maidir leis na breoslaí nó na hábhair eile a bhíonn á ndó san áitreabh,
a bheidh sonraithe san fhógra a thabhairt i scríbhínn don údarás laistigh de cibé tréimhse (nach luaithe ná ceithre lá dhéag tar éis dháta seirbheála an fhógra) a bheidh sonraithe amhlaidh,
(b) a cheangal ar áititheoir aon áitribh (seachas teaghais phríobháideach) laistigh dá limistéar feidhme, cibé faisnéis i dtaobh aon astaíochta ón áitreabh a bheidh sonraithe san fhógra a thabhairt i scríbhinn, cibé acu trí thuairisceáin thréimhsiúla nó ar shlí eile, laistigh de cibé tréimhse a bheidh sonraithe amhlaidh,
(c) a cheangal ar aon duine a ghabhann d'aon bhreosla a tháirgeadh, a chóireáil, a allmhairiú, a chur ar an margadh, a dháileadh nó a dhíol, cibé sonraí, a bheidh sonraithe san fhógra maidir le cineál agus cainníocht an bhreosla a tháirg an duine sin, a chóireáil sé, a d'allmhairigh sé, a chuir sé ar an margadh, a dháil sé nó a dhíol sé, de réir mar a bheidh, laistigh de limistéar feidhme an údaráis lena mbaineann, a thabhairt i scríbhinn don údarás.
(2) Maidir le fógra faoin alt seo, cibé acu a éilítear tuairisceáin thréimhsiúla ann nó nach n-éilítear, ní éileoidh sé faisnéis a chur ar fáil—
(a) faoi cheann tréimhsí is lú ná trí mhí, nó
(b) i leith tréimhse is faide ná dhá mhí dhéag.
(3) Aon duine ar seirbheáladh fógra air faoin alt seo agus a thabharidh, mar fhreagra ar an bhfógra, aon fhaisnéis is eol dó a bheith bréagach nó míthreorach i bponc ábhartha beidh sé ciontach i gcion.
(4) Ní dhéanfaidh údarás áitiúil aon fhaisnéis a thabharfar dó de bhun fógra faoin alt seo a thabhairt d'aon duine seachas do dhuine a bheidh forordaithe.
An clár.
17.—(1) Déanfaidh gach údarás áitiúil a luaithe is féidir tar éis thosach feidhme an Achta seo clár (dá ngairtear “an clár” san Acht seo) a bhunú agus a chothabháil chun críocha an Achta seo agus déanfaidh sé ann na taifid agus na breisithe sin go léir a bheidh forordaithe ó am go ham.
(2) Coimeádfar an clár in oifigí an údaráis áitiúil agus cuirfear ar fáil é lena iniúchadh ag aon duine le linn uaireanta oifige.
(3) Aon uair a iarrfar cóip de thaifead sa chlár ar údarás áitiúil eiseofar an chóip don iarratasóir ar é d'íoc cibé táille (más ann) leis an údarás áitiúil a shocróidh an t-údarás áitiúil, is suim nach rachaidh thar an gcostas réasúnach a bhaineann leis an gcóip a dhéanamh.
(4) Gach doiciméad a airbheartaíonn gur cóip é de thaifead sa chlár agus a airbheartaíonn a bheith deimhnithe mar chóip dhílis den taifead ag oifigeach d'údarás áitiúil, glacfar leis, gan cruthúnas ar shíniú an duine a airbheartaíonn gurb é a dheimhnigh é amhlaidh nó gurbh é an t-oifigeach sin é, mar fhianaise in aon imeachtaí dlíthiúla agus measfar, go dtí go gcruthófar a mhalairt, gur cóip dhílis é den taifead gus gur fianaise é ar théarmaí an taifid.
(5) Féadfar fianaise ar thaifead sa chlár a thabhairt trí chóip de a thabhairt ar aird agus í deimhnithe de bhun an ailt seo agus ní call an clár féin a thabhairt ar aird.
Taighde ar thruailliú aeir.
18.—(1) Féadfaidh údarás áitiúil taighde, suirbhéanna nó imscrúduithe a eagrú agus a stiúradh ar chineál agus ar mhéid an truaillithe aeir, ar an gcúis agus ar an éifeacht atá leis agus ar chosc nó ar theorannú an truaillithe aeir agus féadfaidh sé cláir oideachais i ndáil leis na hábhair sin a bhunú agus a chothabháil agus féadfaidh sé aon fhaisnéis a gheofar ó aon taighde, suirbhéanna, imscrúduithe nó cláir oideachais den sórt sin a fhoilsiú nó a chur faoi deara í a fhoilsiú.
(2) Féadfaidh údarás áitiúil tacú nó cuidiú trí airgead a thabhairt nó ar shlí eile, le haon duine, nó comhlacht daoine, a bheidh ag gabháil, nó a bheartóidh gabháil, d'aon taighde, suirbhé nó imscrúdú ar chineál agus ar mhéid an truaillithe aeir, ar an gcúis agus ar an éifeacht atá leis agus ar chosc nó ar theorannú an truaillithe aeir nó d'aon chlár oideachais i ndáil leis na hábhair sin.
(3) Is feidhm fhorchoimeádta é airgead a thabhairt de bhun fho-alt (2).
(4) Féadfaidh an tAire, le toiliú an Aire Airgeadais, airgead a thabhairt d'aon duine, nó comhlacht daoine, a bheidh ag gabháil, nó a bheartóidh gabháil, do thaighde, suirbhéanna nó imscrúduithe ar chineál agus ar mhéid an truaillithe aeir, ar an gcúis agus ar an éifeacht atá leis agus ar chosc agus ar theorannú an truaillithe aeir nó d'aon chlár oideachais i ndáil leis na hábhair sin.
Caiteachais.
19.—Déanfar na caiteachais a thabhóidh an tAire ag riaradh an Achta seo a íoc as airgead a sholáthróidh an tOireachtas a mhéid a cheadóidh an tAire Airgeadais.
Údaráis áitiúla do dhul i gcomhairle.
20.—Féadfaidh an tAire rialacháin a dhéanamh á cheangal ar údarás áitiúil dul i gcomhairle le cibé comhlachtaí nó daoine a shonrófar i ndáil le comhlíonadh cibé feidhmeanna d'fheidhmeanna an údaráis áitiúil faoin Acht seo a fhorordófar.
Feidhmeanna a aistriú.
21.—(1) Féadfaidh an tAire, le rialacháin, a fhoráil maidir le haon fheidhm a thugtar d'údarás áitiúil faoin Acht seo go bhféadfaidh cibé duine eile (lena n-áirítear an tAire nó údarás áitiúil eile) nó cibé comhlacht daoine eile a bheidh sonraithe í a chomhlíonadh de bhreis ar údarás áitiúil nó ina ionad.
(2) Go háirithe agus gan dochar do ghinearáltacht fho-alt (1), féadfaidh rialacháin faoin alt seo foráil a dhéanamh maidir le haon fheidhm a thugtar d'údarás áitiúil leis an Acht seo do chomhlíonadh ag comhlacht arna bhunú chun na críche sin faoin Acht um Sheirbhísí Rialtais Áitiúil (Comhlachtaí Corpraithe), 1971.
(3) Aon uair a bheidh rialacháin faoin alt seo i bhfeidhm, forléireofar tagairt san Acht seo d'údarás áitiúil mar thagairt a fholaíonn tagairt don duine nó don chomhlacht a bheidh sonraithe sna rialacháin agus is feidhm de chuid an duine nó an chomhlachta sin an fheidhm lena mbaineann na rialacháin.
(4) Maidir le rialacháin faoin alt seo féadfaidh cibé forálacha foghabhálacha, forlíontacha, iarmhartacha agus idirlinne (lena n-áirítear forálacha ag modhnú aon fhorála den Acht seo) a bheith iontu is dóigh leis an Aire is gá chun críocha na rialachán, dá ndroim nó chun lánéifeacht a thabhairt dóibh.
Cumhacht muirir a ghearradh i ndáil le hastaíochtaí.
22.—(1) Féadfaidh údarás áitiúil, de réir rialachán arna ndéanamh ag an Aire faoin alt seo, muirir a ghearradh i ndáil le cibé astaíochtaí a bheidh sonraithe sna rialacháin.
(2) Gan dochar do ghinearáltacht fho-alt (1), féadfaidh rialacháin faoin alt seo foráil a dhéanamh le haghaidh aon cheann nó gach ceann de na hábhair seo a leanas:
(a) na hastaíochtaí a shonrú a bhféadfar muirear faoin alt seo a fhorchur i ndáil leo;
(b) an modh a shonrú ar a bhforchuirfear muirear den sórt sin;
(c) an modh a shonrú ar a ríomhfar méid muirir den sórt sin;
(d) a chumasú d'údarás áitiúil muirir éagsúla a ghearradh faoin alt seo i leith astaíochtaí éagsúla agus in imthosca éagsúla;
(e) an modh a shonrú ar a bhféadfar uiríll a dhéanamh chuig údarás áitiúil maidir le muirear a fhorchur faoin alt seo agus foráil a dhéanamh maidir leis an nós imeachta a bheidh le leanúint i leith na n-uiríoll sin;
(f) foráil a dhéanamh maidir le muirir a fhorchuirfear faoin alt seo a leasú, a chúlghairm nó a athbhreithniú.
(3) Féadfaidh údarás áitiúil méid aon mhuirear a ghearrfaidh sé faoin alt seo a ghnóthú ón duine a mbeidh siad iníoctha aige mar fhiach conartha shimplí in aon chúirt dlínse inniúla.
CUID II
Forálacha Ginearálta a Bhaineann le Truailliú Aeir
Cosc ar astaíochtaí áirithe.
23.—Chun truailliú aeir a chosc nó a theorannú féadfaidh an tAire, le rialacháin—
(a) cibé astaíochtaí a bheidh sonraithe,
(b) táirgeadh, cóireáil, úsáid, allmhairiú, cur ar an margadh, dáileadh nó díol aon substainte (seachas breosla) a d'fhéadfadh a bheith ina cúis le truailliú aeir,
a thoirmeasc, go hiomlán, nó faoi réir cibé eisceachtaí a bheidh sonraithe sna rialacháin.
Oibleagáid truailliú aeir a chosc.
24.—(1) Ní mór d'áititheoir aon áitribh, seachas teaghais phríobháideach, leas a bhaint as an dóigh is fearr is féidir le hastaíocht ón áitreabh sin a theorannú agus, más féidir, a chosc.
(2) Ní chuirfidh áititheoir aon áitribh faoi deara ná ní cheadóidh sé astaíocht a theacht as an áitreabh sin i gcainníocht a d'fhágfadh nó ar shlí a d'fhágfadh gur núis í.
(3) In aon ionchúiseamh mar gheall ar shárú ar an alt seo, is cosaint mhaith é a shuíomh—
(a) gur baineadh leas as an dóigh ab fhearr ab fhéidir leis an astaíocht lena mbaineann a chosc nó a theorannú, nó
(b) go raibh an astaíocht lena mbaineann de réir ceadúnais faoin Acht seo, nó
(c) go raibh an astaíocht lena mbaineann de réir luach teorann astaíochta, nó
(d) go raibh an astaíocht lena mbaineann de réir ordú um limistéar faoi rialú speisialta a bhí i ngníomh i ndáil leis an limistéar lena mbaineann, nó
(e) i gcás astaíocht deataigh, go raibh an astaíocht lena mbaineann de réir rialacháin faoi alt 25, nó
(f) nach raibh an astaíocht ina cúis le truailliú aeir.
Toirmeasc ar dheatach a astú.
25.—(1) Chun truailliú aeir a chosc nó a theorannú féadfaidh an tAire, le rialacháin, astaíocht deataigh isteach san atmaisféar ó aon áitreabh a thoirmeasc nó a shrianadh.
(2) Gan dochar do ghinearáltacht fho-alt (1), fédfaidh rialacháin faoin alt seo—
(a) na háitribh a mbaineann na rialacháin leo a shonrú,
(b) an cineál deataigh a mbaineann na rialacháin leis a shonrú,
(c) toirmeasc a dhéanamh, go hiomlán nó faoi réir eisceachtaí sonraithe, ar astaíocht deataigh ó áitribh shonraithe ag tráthanna nó ag tréimhsí sonraithe,
(d) astaíochtaí deataigh ó áitribh shonraithe ar feadh tréimhsí sonraithe a dhíolmhú, faoi réir coinníollacha nó gan choinníollacha, ó aon fhoráil d'fhorálacha na rialachán,
(e) toirmeasc nó srianadh a dhéanamh, faoi réir cibé eisceachtaí a bheidh sonraithe, ar dhó tuí, fuíll nó aon substainte eile i cibé áitribh nó ag cibé tráthanna a bheidh sonraithe.
(3) In aon ionchúiseamh mar gheall ar shárú ar an alt seo nó ar rialacháin arna ndéanamh faoin alt seo, is cosaint mhaith é a shuíomh—

26.—(1) Aon uair is dóigh le húdarás áitiúil gur gá déanamh amhlaidh chun truailliú aeir a chosc nó a theorannú, féadfaidh an t-údarás áitiúil fógra faoin alt seo a sheirbheáil ar áititheoir aon áitribh óna dtagann astaíocht.
(2) Nuair a bheidh údarás áitiúil ag breithniú an cóir fógra a sheirbheáil faoin alt seo, beidh aird aige ar na nithe seo a leanas—
(a) aon phlean bainisteoireachta aercháilíochta i ndáil leis an limistéar ina bhfuil an t-áitreabh suite,
(b) aon ordú um limistéar faoi rialú speisialta atá i ngníomh i ndáil leis an limistéar ina bhfuil an t-áitreabh suite,
(c) aon luach teorann astaíochta iomchuí,
(d) aon chaighdeán aercháilíochta iomchuí,
(e) na deiseanna a bheith ar fáil is gá chun an fógra a chomhlíonadh, agus
(f) an caiteachas a thabhófaí ag comhlíonadh an fhógra.
(3) Maidir le fógra de bhun an ailt seo—
(a) sonrófar ann na bearta is dóigh leis an údarás áitiúil a sheirbheáil an fógra a bheith riachtanach chun truailliú aeir a chosc nó a theorannú,
(b) ordóidh sé don duine ar seirbheáladh an fógra air cibé bearta a dhéanamh chun truailliú aeir a chosc nó a theorannú a bheidh sonraithe san fhógra, agus
(c) sonróidh sé tréimhse (nach lú ná ceithre lá dhéag ag tosú ar dháta seirbheála an fhógra) ar laistigh di a bheidh na bearta sin le déanamh.
(4) Maidir le fógra faoin alt seo—
(a) féadfar é a sheirbheáil cibé acu a bhí nó nach raibh ionchúiseamh ann mar gheall ar chion faoin Acht seo i ndáil leis an astaíocht lena mbaineann;
(b) ní dhéanfaidh sé dochar do thionscnamh ionchúisimh faoin Acht seo mar gheall ar chion i ndáil leis an astaíocht lena mbaineann.
(5) Duine ar seirbheáladh fógra faoin alt seo air féadfaidh sé, laistigh de cibé tréimhse a bheidh sonraithe san fhógra cibé uiríll i scríbhinn is cuí leis a dhéanamh chuig an údarás áitiúil i dtaobh théarmaí an fhógra agus féadfaidh an t-údarás áitiúil, tar éis dó aon uiríll den sórt sin a bhreithniú, an fógra a leasú nó a chúlghairm.
(6) Duine ar seirbheáladh fógra faoin alt seo air déanfaidh sé, laistigh den tréimhse shonraithe, ceanglais an fhógra, nó de réir mar a bheidh, an fhógra arna leasú, a chomhlíonadh.
(7) Mura ndéanann duine ar seirbheáladh fógra faoin alt seo air, ceanglais an fhógra a chomhlíonadh laistigh den tréimhse a bheidh sonraithe san fhógra nó san fhógra arna leasú, de réir mar a bheidh, féadfaidh an t-údarás áitiúil a sheirbheáil an fógra cibé bearta a dhéanamh is dóigh leis a bheith réasúnach agus riachtanach chun a áirithiú go gcomhlíonfar an fógra agus féadfaidh sé aon chaiteachas a thabhóidh sé leis sin a ghnóthú ón duine ar ar seirbheáladh an fógra mar fhiach conartha shimplí in aon chúirt dlínse inniúla.
Cumhacht údaráis áitiúil bearta a dhéanamh chun truailliú aeir a chosc nó a theorannú.
27.—(1) Aon uair is dóigh le húdarás áitiúil go bhfuil gá le bearta práinneacha chun cosc nó teorannú a dhéanamh ar thruailliú a fhearann ar aon chuid dá limistéar feidhme nó ar limistéar tadhlach, féadfaidh an t-údarás áitiúil cibé bearta a dhéanamh, cibé oibríochtaí a sheoladh nó cibé cúnamh a thabhairt is dóigh leis is gá chun an truailliú sin a chosc nó a theorannú nó chun iardraí aon truaillithe den sórt sin a leigheas.
(2) I gcás údarás áitiúil do dhéanamh beart, do sheoladh oibríochtaí nó do thabhairt cúnaimh faoin alt seo, féadfaidh an t-údarás áitiúil costais na mbeart, na n-oibríochtaí nó an chúnaimh sin a ghnóthú mar fhiach conartha shimplí in aon chúirt dlínse inniúla ó cibé duine a ndeimhneoidh an t-údarás áitiúil don chúirt gurb é an duine é arb é a ghníomh nó a neamhghníomh ba chúis leis na bearta, leis na hoibríochtaí nó leis an gcúnamh sin.
Cumhacht na hArd-Chúirte i ndáil le truailliú aeir.
28.—(1) Féadfaidh an Ard-Chúirt, le hordú, ar iarratas ó údarás áitiúil nó ó aon duine eile astaíocht a thoirmeasc nó a shrianadh ó aon áitreabh más deimhin leis an gCúirt—
(a) go dtiocfadh mórphriacal truaillithe aeir ón astaíocht sin (nach astaíocht atá de réir ceadúnais arna dheonú faoin Acht seo) do leanúint ar aghaidh, nó
(b) gur astaíocht í an astaíocht ó ghléasra tionscail de shárú ar théarmaí ceadúnais faoin Acht seo, nó
(c) gur astaíocht í an astaíocht ó ghléasra tionscail dá n-éilítear ceadúnas faoin Acht seo agus nár deonaíodh aon cheadúnas den sórt sin i ndáil léi.
(2) Maidir le hordú a dhéanfaidh an Ard-Chúirt ar iarratas faoin alt seo, féadfaidh cibé forálacha a bheith ann is cuí leis an gCúirt agus féadfar, go háirithe, forálacha a bheith ar áireamh ann—
(a) á cheangal bearta sonracha a dhéanamh chun priacal truaillithe aeir a dhíbirt nó a laghdú;
(b) á cheangal ar aon duine aon ní a dhéanamh, nó gan é a dhéanamh, nó scor de bheith á dhéanamh, de réir mar a bheidh, is ní is dóigh leis an gCúirt is gá agus a shonróidh sí san ordú chun a chinntiú go bhfoirceannfar nó go srianfar an astaíocht lena mbaineann nó, de réir mar a bheidh, go mbeidh sí de réir aon cheadúnais iomchuí faoin Acht seo;
(c) i ndáil le híoc costas.
(3) Is trí fhoriarratas a dhéanfar iarratas ar ordú faoin alt seo agus nuair a bheidh an Ard-Chúirt ag breithniú an ábhair féadfaidh sí cibé ordú eatramhach nó idirbhreitheach a dhéanamh is cuí léi.
(4) Beidh éifeacht le hordú de chuid na hArd-Chúirte arna dhéanamh de bhun an ailt seo d'ainneoin théarmaí aon cheada arna thabhairt faoi aon achtachán eile i ndáil leis an áitreabh lena mbaineann.
Scéala a thabhairt faoi eachtra is cúis le truailliú aeir.
29.—(1) Ní mór d'áititheoir aon áitribh, seachas teaghais phríobháideach, a luaithe is féidir tar éis aon eachtra a d'fhéadfadh a bheith ina chúis le truailliú aeir scéala i dtaobh na heachtra a thabhairt don údarás áitiúil iomchuí.
(2) San alt seo folaíonn “eachtra” astaíocht thionóisceach.
CUID III
Gléasra Tionscail a Cheadúnú
Ceadúnas chun gléasra tionscail a oibriú.
30.—(1) Ní oibreoidh duine gléasra tionscail seachas gléasra tionscail láithreach, ar cibé lá a bheidh forordaithe nó dá éis mura mbeidh ceadúnas faoin Acht seo i bhfeidhm i ndáil leis an ngléasra.
(2) Féadfaidh an tAire, le rialacháin, a fhoráil nach ndéanfar gléasra tionscail láithreach de cibé aicme a bheidh sonraithe sna rialacháin a oibriú ar cibé dáta a bheidh sonraithe amhlaidh nó dá éis mura mbeidh ceadúnas faoin Acht seo i bhfeidhm i ndáil leis an ngléasra.
(3) I gcás go dtiocfaidh rialacháin faoi fho-alt (2) i ngníomh, ansin, maidir le gléasra tionscail láithreach, lena mbaineann na rialacháin, a oibriú, measfar sa tréimhse sula ndeonaítear nó sula ndiúltaítear ceadúnas i ndáil leis an ngléasra, nár shárú é ar fhorálacha an Achta seo: ar choinníoll gurb amhlaidh, roimh an dáta a bheidh sonraithe sna rialacháin sin, go ndearnadh iarratas ar cheadúnas i leith an ghléasra sin agus gur chomhlíon an t-iarratasóir ar an gceadúnas ceanglais rialachán arna ndéanamh faoi alt 31 i ndáil leis an iarratas ar an gceadúnas.
Rialacháin maidir le ceadúnais.
31.—(1) Déanfaidh an tAire foráil, le rialacháin, maidir le húdaráis áitiúla do dheonú ceadúnas do dhaoine a dhéanann iarratas chuig an údarás áitiúil lena mbaineann agus a chomhlíonann ceanglais na rialachán i ndáil le hiarratais den sórt sin nó a chomhlíonann na ceanglais a rinneadh de bhun na rialachán sin.
(2) Gan dochar do ghinearáltacht fho-alt (1), féadfar foráil a dhéanamh le rialacháin faoin alt seo maidir le gach ceann nó aon cheann de na nithe seo a leanas:
(a) foirm an iarratais agus an cheadúnais;
(b) iarratasóirí d'fhoilsiú cibé fógraí a bheidh sonraithe;
(c) na pleananna, na doiciméid agus an fhaisnéis agus na sonraí eile a bheidh le cur isteach ag iarratasóirí a shonrú;
(d) a cheangal ar iarratasóirí cibé faisnéis nó, sonraí breise a thabhairt i ndáil lena n-iarratais a iarrfaidh an t-údarás áitiúil;
(e) a cheangal go dtabharfar fianaise ar aird chun aon fhaisnéis agus sonraí a thug iarratasóir a fhíorú;
(f) a cheangal ar údaráis áitiúla aon fhaisnéis shonraithe i ndáil le haon iarratais agus leis an modh inar déileáladh leo a thabhairt don Aire agus d'aon daoine sonraithe eile, nó aon fhógraí sonraithe a fhoilsiú i ndáil le hiarratais ar cheadúnais agus i ndáil le ceadúnais a dheonú nó a dhiúltú;
(g) an tréimhse a shonrú ar laistigh di a dhéileálfaidh údaráis áitiúla le hiarratais;
(h) a cheangal ar iarratasóir costas aon imscrúdaithe a sheol údarás áitiúil i ndáil le hiarratas a ghlanadh nó a pháirtghlanadh.
(3) (a) Más rud é, i ndáil le hiarratas ar cheadúnas, nó ar athbhreithniú ar cheadúnas faoin Acht seo, nó i ndáil le hachomharc ag éirí as iarratas den sórt sin, go ndéanfaidh duine ráiteas i scríbhinn is eol dó a bheith bréagach nó míthreorach i bponc ábhartha, beidh sé ciontach i gcion.
(b) Má chiontaítear duine i gcion faoin bhfo-alt seo, beidh aon cheadúnas a eisíodh chuig an duine sin de dhroim an iarratais nó an achomhairc ar i ndáil leis a tugadh an fhaisnéis arna chúlghairm ó dháta an chiontaithe.
(4) Maidir le glanadh nó páirtghlanadh costais a cheanglaítear a dhéanamh faoi rialacháin arna ndéanamh faoin alt seo, beidh an céanna iníoctha ar é á iarraidh agus, mura n-íocfar amhlaidh é, beidh sé inghnóthaithe mar fhiach conartha shimplí in aon chúirt dlínse inniúla.
Ceadúnais a dheonú.
32.—(1) Más rud é—
(a) go ndéantar iarratas ar cheadúnas faoin Acht seo chuig údarás áitiúil de réir rialachán faoi alt 31,
(b) gur comhlíonadh ceanglais na rialachán sin nó na ceanglais a rinneadh de bhun na rialachán sin,
féadfaidh an t-údarás áitiúil, faoi réir alt 35 (2), a chinneadh an ceadúnas a dheonú faoi réir coinníollacha nó gan choinníollacha nó an t-iarratas a dhiúltú.
(2) Nuair a bheidh údarás áitiúil ag breithniú iarratais ar cheadúnas faoin Acht seo, beidh aird aige ar na nithe seo—
(a) aon phlean bainisteoireachta aercháilíochta a bheidh i bhfeidhm i ndáil leis an limistéar lena mbaineann, agus
(b) aon ordú um limistéar faoi rialú speisialta a bheidh i ngníomh i ndáil leis an limistéar sin.
(3) Ní dheonóidh údarás áitiúil ceadúnas i ndáil le gléasra tionscail mura deimhin leis—
(a) go mbainfear leas as an dóigh is fearr is féidir le haon astaíochtaí ón ngléasra a chosc nó a theorannú,
(b) go gcomhlíonfaidh aon astaíochtaí ón ngléasra aon luach teorann astaíochta iomchuí,
(c) nach dtiocfaidh de thoradh aon astaíochtaí ón ngléasra go sárófar aon chaighdeán aercháilíochta iomchuí,
agus, más iomchuí, cuirfidh an t-údarás áitiúil coinníollacha i ndáil leis na hábhair a shonraítear i míreanna (a), (b) agus (c) i gceangal leis an gceadúnas.
(4) Gan dochar go ghinearáltacht fho-ailt (1) agus (3), féadfaidh coinníollacha a bheidh i gceangal le ceadúnas faoin Acht seo—
(a) cineál, comhdhéanamh, teocht, toirt, ráta agus suíomh astaíochta a shonrú;
(b) na tréimhsí a shonrú a bhféadfar, nó nach bhféadfar, astaíocht a dhéanamh lena linn;
(c) tiúchan truailleáin in aer na timpeallachta, nó ráta taiscthe, nach sárófar, a shonrú;
(d) aon ábhair a shonrú a bhaineann le dearadh, déanamh agus airde na simléar, na múchán, na gcruach nó na n-easraisí eile trína ndéanfar astaíocht;
(e) na dóigheanna a shonrú (lena n-áirítear gléasra, trealamh agus saoráidí eile a sholáthar, a oibriú, a chothabháil agus a mhaoirsiú agus nósanna imeachta sonraithe a úsáid) a mbeidh leas le baint astu chun astaíocht a rialú;
(f) a cheangal go ndéanfar méadair, tomhsairí agus gairis agus deiseanna eile chun monatóireacht a dhéanamh ar chineál, méid agus iardraí astaíochtaí a sholáthar, a oibriú agus a chothabháil;
(g) a cheangal go dtógfar agus go n-anailíseofar samplaí, go ndéanfar tomhais, go gcoimeádfar taifid agus go dtabharfar faisnéis don údarás áitiúil nó d'aon duine eile a bheidh sonraithe;
(h) na bearta a shonrú a thógfar má tharlaíonn cliseadh do ghléasra tionscail a d'fhéadfadh difear a dhéanamh d'astaíochtaí ón ngléasra;
(i) an cineál breosla a shonrú a úsáidfear nó nach n-úsáidfear, de réir mar a bheidh;
(j) a cheangal go ndéanfar íocaíochtaí leis an údarás áitiúil lena mbaineann i ndáil le costais a thabhófar ag monatóireacht astaíochtaí nó ar shlí eile i ndáil le hastaíochtaí;
(k) an dáta is déanaí a shonrú chun aon choinníollacha atá i gceangal leis an gceadúnas a chomhlíonadh.
(5) Más rud é, tar éis d'údarás áitiúil iarratas ar cheadúnas faoin Acht seo a bhreithniú, go gcinnfidh sé—
(a) go ndeonófar an ceadúnas, tabharfaidh sé scéala láithreach don iarratasóir i dtaobh an chinnidh agus i dtaobh aon choinníollacha a bheidh i gceangal leis an gceadúnas agus i dtaobh na bhfáthanna a bhí le haon choinníollacha den sórt sin a chur i gceangal amhlaidh, nó
(b) nach ndeonófar an ceadúnas, tabharfaidh sé scéala láithreach don iarratasóir i dtaobh an chinnidh agus i dtaobh na bhfáthanna a bhí leis an gcinneadh.
Ceadúnais a athbhreithniú.
33.—(1) Féadfaidh údarás áitiúil ceadúnas faoin Acht seo a athbhreithniú tráth ar bith le toiliú an cheadúnaí, nó tráth nach luaithe n afada/> trí bliana ón dáta a deonaíodh an ceadúnas nó, de réir mar a bheidh, ón dáta a athbhreithníodh an ceadúnas don uair dheiridh.
(2) A luaithe is féidir tar éis dó athbhreithniú faoin alt seo a chur i gcrích, féadfaidh údarás áitiúil a chinneadh ceadúnas athleasaithe a dheonú de bhun an Achta seo in ionad an cheadúnais a athbhreithníodh.
(3) D'ainneoin aon fhorála eile den Acht seo nó aon fhorála i gceadúnas faoin Acht seo—
(a) déanfaidh an t-údarás áitiúil a dheonaigh ceadúnas den sórt sin é a athbhreithniú—
(i) má bhíonn foras réasúnach ag an údarás áitiúil chun a chreidiúint go bhfuil aon astaíocht ón ngléasra tionscail lena mbaineann an ceadúnas ina mórphriacal truaillithe aeir, nó
(ii) má tháinig athrú ábhartha ar chineál nó ar mhéid na hastaíochta, nó
(iii) má tháinig athrú ábhartha, nárbh fhéidir coinne a bheith leis an tráth a deonaíodh an ceadúnas, ar an aercháilíocht sa limistéar ina bhfuil an gléasra tionscail lena mbaineann an ceadúnas, nó
(iv) má bhíonn fianaise bhreise agus níos fearr, nach raibh ar fáil an tráth a deonaíodh an ceadúnas, ar fáil maidir le truailleán atá i láthair san astaíocht lena mbaineann nó maidir le hiardraí an truailleáin sin, nó
(v) má dhéanann an ceadúnaí iarratas chuig an údarás áitiúil lena mbaineann chun an ceadúnas a athbhreithniú;
(b) más rud é—
(i) go mbeidh luach teorann astaíochta iomchuí sonraithe i rialacháin faoi alt 51 i ndáil le haon truailleán a astaítear ón ngléasra tionscail lena mbaineann an ceadúnas, nó
(ii) go mbeidh caighdeán aercháilíochta iomchuí sonraithe i rialacháin arna ndéanamh faoi alt 50 i ndáil le haon truailleán a astaítear ón ngléasra tionscail lena mbaineann an ceadúnas, nó
(iii) go dtiocfaidh ordú um limistéar faoi rialú speisialta a fhearann ar aon truailleán a astaítear ón ngléasra tionscail lena mbaineann an ceadúnas i ngníomh i ndáil leis an limistéar ina bhfuil an gléasra tionscail suite, nó
(iv) go n-eiseoidh an tAire aon treoracha ina sonróidh sé an dóigh is fearr is féidir chun astaíocht lena mbaineann an ceadúnas a chosc nó a theorannú,
déanfaidh an t-údarás áitiúil, a luaithe is féidir tar éis na rialacháin a dhéanamh, an t-ordú a theacht i ngníomh nó na treoracha a thabhairt, de réir mar a bheidh, an ceadúnas a athbhreithniú,
agus beidh feidhm ag fo-alt (2) maidir le hathbhreithniú faoin bhfo-alt seo.
(4) (a) Féadfaidh an tAire rialacháin a dhéanamh chun críche an ailt seo.
(b) Gan dochar do ghinearáltacht mhír (a), féadfar foráil a dhéanamh le rialacháin faoin bhfo-alt seo i ndáil le haon cheann nó gach ceann de na hábhair seo a leanas—
(i) an t-údarás áitiúil do thabhairt fógra go bhfuil sé i gceist aige ceadúnas a athbhreithniú,
(ii) a cheangal ráiteas a thabhairt i bhfógra den sórt sin go bhféadfar uiríll i ndáil leis an athbhreithniú a dhéanamh laistigh de thréimhse shonraithe, agus
(iii) a cheangal ar údaráis áitiúla aon fhógraí sonraithe a fhoilsiú maidir le cinneadh ceadúnas athleasaithe a dheonú.
(5) Nuair a bheidh ceadúnas á athbhreithniú faoin alt seo, beidh aird ag údarás áitiúil ar na nithe seo a leanas—
(a) aon athrú ar aercháilíocht ina limistéar feidhme, agus
(b) forbairt an eolais teicniúil i ndáil le truailliú aeir agus iardraí truailleán.
Achomhairc.
34.—(1) Féadfaidh aon duine, tráth ar bith sula rachaidh an tréimhse fhorordaithe in éag, achomharc a dhéanamh chun an Bhoird Pleanála i ndáil le ceadúnas a dheonú nó a dhiúltú faoi alt 32, nó i ndáil le ceadúnas athleasaithe a dheonú faoi alt 33.
(2) Tar éis don Bhord Pleanála achomharc a bhreithniú faoin alt seo, déanfaidh sé (de réir mar is cuí leis) an t-achomharc a dhiúltú nó treoracha cuí a thabhairt don údarás áitiúil lena mbaineann i ndáil le ceadúnas a dheonú nó a dhiúltú agus, i gcás treoracha den sórt sin a thabhairt, ní mór don údarás áitiúil lena mbaineann déanamh de réir na dtreoracha a luaithe is féidir tar éis iad a fháil.
(3) Féadfaidh an tAire le rialacháin, foráil a dhéanamh le haghaidh aon ábhar gnáthaimh i ndáil le hachomharc faoin alt seo.
(4) Maidir le rialacháin faoin alt seo féadfaidh cibé forálacha foghabhálacha, forlíontacha, iarmhartacha agus idirlinne (lena n-áirítear modhnú ar aon fhoráil de na hAchtanna Rialtais Áitiúil (Pleanáil agus Forbairt), 1963 go 1983, nó cur chun feidhme aon fhorála de na hAchtanna sin) a bheith iontu is dóigh leis an Aire is gá.
Táillí.
35.—(1) Féadfaidh an tAire rialacháin a dhéanamh a dhéanfaidh foráil—
(a) maidir le táillí forordaithe a íoc le húdaráis áitiúla i ndáil le hiarratais—
(i) ar cheadúnais faoin Acht seo, nó
(ii) ar athbhreithnithe ar cheadúnais faoi alt 33.
(b) maidir le táillí forordaithe a íoc leis an mBord Pleanála i ndáil le hachomhairc faoi alt 34,
agus féadfar foráil a dhéanamh leis na rialacháin maidir le táillí éagsúla i ndáil le cásanna d'aicmí nó de thuairiscí éagsúla, maidir le díolmhú ó tháillí a íoc in imthosca sonraithe, maidir le táillí a tharscaoileadh, a loghadh nó a aisíoc (go hiomlán nó go páirteach) in imthosca sonraithe agus maidir leis an modh ina ndiúscrófar táillí.
(2) Más rud é faoi rialacháin faoin alt seo go mbeidh táille iníoctha le húdarás áitiúil ag iarratasóir i leith iarratais dá dtagraítear i bhfo-alt (1), ní chinnfidh an t-údarás an t-iarratas mura mbeidh an táille faighte ag an údarás.
(3) Más rud é faoi rialacháin faoin alt seo go mbeidh táille iníoctha leis an mBord Pleanála ag achomharcóir i leith achomhairc aige chuig an mBord Pleanála, beidh an t-achomharc neamhbhailí mura bhfaighidh An Bord Pleanála an táille fhorordaithe roimh éag don tréimhse fhorordaithe chun an t-achomharc a dhéanamh.
Teorainn le ré ceadúnais.
36.—(1) Faoi réir fho-alt (2), más rud é, maidir le gléasra tionscail lena mbaineann ceadúnas faoin Acht seo—
(a) nach mbeidh oibríochtaí tosaithe aige laistigh de thrí bliana ón dáta a deonaíodh an ceadúnas, nó
(b) go mbeidh scortha d'oibríochtaí aige ar feadh tréimhse tri bliana ar a laghad,
scoirfidh an ceadúnas d'éifeacht a bheith leis.
(2) Ní bheidh éifeacht le fo-alt (1) má deonaíodh ceadúnas sular foirgníodh gléasra tionscail nó sular thosaigh gléasra tionscail ar na hoibríochtaí, agus i gcás gur deimhin leis an údarás áitiúil, ag féachaint do chineál agus do mhéid na n-oibreacha foirgníochta agus d'aon chúinsí iomchuí eile, gur chóir don cheadúnas leanúint i bhfeidhm go ceann cibé tréimhse is dóigh leis an údarás áitiúil is réasúnach, ag féachaint do na himthosca uile.
Athrú ar úinéireacht gléasra tionscail.
37.—(1) I gcás ceadúnas a dheonú faoin Acht seo ansin, ach amháin mar a fhoráiltear a mhalairt leis an gceadúnas, faibhreoidh deonú an cheadúnais chun tairbhe don ghléasra tionscail agus do gach duine a mbeidh leas aige ann de thuras na huaire, ach sin gan dochar d'fhorálacha alt 33 i ndáil le hathbhreithniú an cheadúnais.
(2) Más rud é maidir le duine dár deonaíodh ceadúnas faoin Acht seo, go scoirfidh sé dá leas sa ghléasra tionscail lena mbaineann an ceadúnas a shealbhú nó go n-aistreoidh sé an leas sin chuig duine eile, tabharfaidh sé fógra láithreach don údarás áitiúil a dheonaigh an ceadúnas—
(a) á rá nach sealbhaíonn sé leas feasta sa ghléasra tionscail lena mbaineann, agus
(b) i dtaobh ainm an duine ar aistríodh a leas sa ghléasra chuige.
Athruithe i ngléasra tionscail.
38.—(1) Ní mór d'áititheoir gléasra tionscail—
(a) is gléasra a bhfuil ceadúnas i bhfeidhm ina leith faoin Acht seo, nó
(b) is gléasra tionscail láithreach nach gceanglaítear a oibriú a cheadúnú faoi rialacháin arna ndéanamh faoi alt 30,
fógra a thabhairt i scríbhinn don údarás áitiúil ar ina limistéar feidhme atá an gléasra tionscail suite má bheartaíonn sé—
(i) aon athrú nó athfhoirgniú a dhéanamh ar an ngléasra, nó
(ii) aon athrú a dhéanamh ar na próisis a bheidh á seoladh ann,
agus go gcuirfeadh nó gur dócha go gcuirfidh an t-athrú nó an t-athfhoirgniú sin go suntasach le hastaíochtaí ón ngléasra nó go dtiocfadh, nó gur dócha go dtiocfaidh, astaíochtaí nua ón ngléasra dá mbarr.
(2) Aon uair a gheobhaidh údarás áitiúil fógra faoin alt seo, féadfaidh an t-údarás, d'ainneoin aon fhorála eile den Acht seo—
(a) má bhíonn ceadúnas i bhfeidhm maidir leis an ngléasra tionscail lena mbaineann, an ceadúnas a athbhreithniú faoi alt 33 nó a ordú don áititheoir iarratas a dhéanamh ar cheadúnas nua, nó
(b) mura mbeidh aon cheadúnas den sórt sin i bhfeidhm, a ordú don áititheoir iarratas a dhéanamh ar cheadúnas,
agus ní dhéanfaidh an t-áititheoir an t-athrú nó an t-athfhoirgniú go dtí go mbeidh an t-athbhreithniú curtha i gcrích nó go mbeidh an ceadúnas nua nó an ceadúnas, de réir mar a bheidh, deonaithe.
(3) I gcás go gcinnfidh údarás áitiúil de bhun fho-alt (2) ar cheadúnas a athbhreithniú nó ar ordú a thabhairt don áititheoir lena mbaineann, iarratas a dhéanamh ar cheadúnas nua nó, de réir mar a bheidh, ar cheadúnas, cuirfidh an t-údarás áitiúil an méid sin i bhfios don áititheoir lena mbaineann laistigh de mhí amháin ón dáta a fuair sé an fógra faoin alt seo agus mura gcuirfear an méid sin i bhfios don áititheoir sin, scoirfidh fo-alt (2) d'éifeacht a bheith leis i ndáil leis an athrú nó leis an athfhoirgniú a shonraítear san fhógra.
CUID IV
Limistéir faoi Rialú Speisialta
Limistéir faoi rialú speisialta.
39.—(1) Aon uair a dhealraíonn sé d'údarás áitiúil gur chóir, d'fhonn truailliú aeir a chosc nó a theorannú, a dhearbhú maidir le hiomlán a limistéir feidhme nó aon chuid de gur limistéar faoi rialú speisialta é, féadfaidh sé ordú a dhéanamh faoin alt seo (dá ngairtear “ordú um limistéar faoi rialú speisialta” san Acht seo).
(2) Nuair a bheidh údarás áitiúil ag cinneadh an gá nó an fóirsteanach ordú um limistéar faoi rialú speisialta a dhéanamh i ndáil le haon limistéar, beidh aird aige ar na nithe seo a leanas—
(a) minicíocht an truaillithe aeir sa limistéar agus an chúis atá leis, agus
(b) aon phlean bainisteoireachta aercháilíochta a bheidh i bhfeidhm i ndáil leis an limistéar, agus
(c) aon chaighdeán aercháilíochta iomchuí, agus
(d) na deiseanna is gá chun an t-ordú a chomhlíonadh a bheith ar fáil, agus
(e) an caiteachas a thabhófaí ag comhlíonadh an ordaithe.
(3) Sonrófar in ordú um limistéar faoi rialú speisialta—
(a) an limistéar lena mbaineann sé,
(b) an truailleán a mbaineann sé leis, agus
(c) na bearta a bheidh le déanamh agus na ceanglais a mbeidh éifeacht leo sa limistéar lena mbaineann an t-ordú.
(4) Féadfaidh an tAire, más dóigh leis gur fóirsteanach déanamh amhlaidh d'fhonn truailliú aeir a chosc nó a theorannú, ag féachaint d'fhorálacha mhíreanna (a), (b), (c), (d) agus (e) d'fho-alt (2), treoir a thabhairt d'údarás áitiúil ordú um limistéar faoi rialú speisialta a dhéanamh i ndáil le cibé limistéar agus cibé truailleán a bheidh sonraithe sa treoir agus féadfaidh an tAire, más cuí leis, treoir bhreise a thabhairt gur chóir a shonrú leis an ordú go ndéanfar bearta áirithe agus go mbeidh éifeacht le ceanglais áirithe sa limistéar sin agus comhlíonfaidh an t-údarás áitiúil lena mbaineann aon treoir de chuid an Aire a thabharfar faoin bhfo-alt seo laistigh de cibé tréimhse a bheidh sonraithe sa treoir.
(5) Féadfaidh údarás áitiúil, le toiliú aon údaráis áitiúil eile lena mbaineann, ordú um limistéar faoi rialú speisialta a dhéanamh i ndáil le limistéar atá laistigh de limistéar feidhme an údaráis eile.
(6) (a) Faoi réir mhí (b), féadfaidh údarás áitiúil, le hordú faoi fho-alt (1), ordú um limistéar faoi rialú speisialta a chúlghairm nó a leasú.
(b) Ní fhéadfaidh údarás áitiúil ordú um limistéar faoi rialú speisialta a dhéanfar de bhun treorach ón Aire faoi fho-alt (4) a chúlghairm nó a leasú ach amháin le toiliú an Aire.
(7) Déanfaidh údarás áitiúil, ó am go ham agus uair amháin ar a laghad gach cúig bliana, gach ordú um limistéar faoi rialú speisialta a rinne sé, agus a bheidh fós i ngníomh, a athbhreithniú d'fhonn a chinneadh an gá nó an inmhianaithe an t-ordú a chúlghairm nó a leasú.
(8) Is feidhm fhorchoimeádta a bheidh ann ordú um limistéar faoi rialú speisialta a dhéanamh, a chúlghairm nó a leasú agus toiliú a thabhairt faoi fho-alt (5) le hordú den sórt sin a dhéanamh.
Orduithe um limistéar faoi rialú speisialta.
40.—(1) Gan dochar d'fhorálacha alt 39 (3), féadfar foráil a dhéanamh le hordú um limistéar faoi rialú speisialta le haghaidh na nithe seo a leanas:
(a) toirmeasc a chur, faoi réir cibé eisceachtaí nó teorainneacha a shonrófar, ar thruailleán sonraithe a astú ó aicmí nó ó thuairiscí sonraithe áitreabh;
(b) toirmeasc a chur, faoi réir cibé eisceachtaí nó teorainneacha a shonrófar, ar aon bhreosla seachas breosla údaraithe a dhó seachas i dtinteán údaraithe;
(c) toirmeasc a chur, faoi réir cibé eisceachtaí nó teorainneacha a shonrófar, ar thuí, fuíoll nó aon substaint eile a dhó;
(d) forálacha éagsúla a dhéanamh, ag féachaint do na himthosca go léir, le haghaidh codanna éagsúla den limistéar lena mbaineann an t-ordú agus le haghaidh áitreabh éagsúil nó aicmí éagsúla áitreabh;
(e) cibé áitribh nó cibé aicmí áitreabh a shonrófar, a dhíolmhú, fara nó d'uireasa coinníollacha, ó cheanglais uile an ordaithe nó ó aon cheanglais acu;
(f) cibé tinteáin nó cibé aicmí tinteán a shonrófar, a dhíolmhú, fara nó d'uireasa coinníollacha, ó cheanglais uile an ordaithe nó ó aon cheanglais acu;
(g) na cineálacha nó na cáilíochtaí breoslaí a shonrú a dhófar nó nach ndófar i cibé tinteáin nó aicmí tinteán a shonrófar;
(h) na coinníollacha a shonrú ar faoina réir, nó na críocha a shonrú ar lena n-aghaidh, a fhéadfar breoslaí nó aicmí breoslaí sonraithe a dhó sa limistéar faoi rialú speisialta;
(i) toirmeasc a chur ar cibé oibríochtaí nó próisis a bheidh sonraithe a sheoladh sa limistéar faoi rialú speisialta nó an seoladh sin a theorannú nó na coinníollacha a shonrú a bhféadfar na hoibríochtaí nó na próisis sin a sheoladh fúthu;
(j) toirmeasc nó srianadh a chur ar bhreoslaí sonraithe nó ar aicmí breoslaí sonraithe a dhíol nó a sheachadadh i limistéar faoi rialú speisialta.
(2) Féadfaidh an tAire, le rialacháin, a dhearbhú maidir le haon aicme áirithe tinteán gur tinteán údaraithe chun críocha ordú um limistéar faoi rialú speisialta a bheidh ann, faoi réir cibé coinníollacha a shonrófar sna rialacháin.
(3) Féadfaidh an tAire, le rialacháin, a dhearbhú maidir le haon chineál áirithe breosla gur breosla údaraithe é chun críocha ordú um limistéar faoi rialú speisialta.
(4) Aon duine a sháróidh aon fhoráil de chuid ordú um limistéar faoi rialú speisialta a bheidh i ngníomh beidh sé ciontach i gcion.
(5) In aon imeachtaí maidir le sárú ar ordú um limistéar faoi rialú speisialta agus lena mbaineann astaíocht truailleáin, is cosaint mhaith é a shuíomh—
(a) nárbh é ba chúis le hastaíocht an truailleáin breosla seachas breosla údaraithe a úsáid;
(b) gurbh é ba chúis le hastaíocht an truailleáin breosla seachas breosla údaraithe a dhó i dtinteán údaraithe de réir na gcoinníollacha (más ann) ar faoina réir a dearbhaíodh gur tinteán údaraithe an tinteán.
Ordú um limistéar faoi rialú speisialta a dhaingniú.
41.—(1) A luaithe is féidir tar éis d'údarás áitiúil ordú um limistéar faoi rialú speisialta a dhéanamh, foilseoidh sé, i nuachtán nó i nuachtafada/>in a bheidh i gcúrsaíocht sa limistéar lena mbaineann an t-ordú, fógra—
(a) á rá go ndearnadh ordú um limistéar faoi rialú speisialta agus a shonróidh an limistéar lena mbaineann an t-ordú;
(b) ag ainmniú áite ina bhféadfaidh aon duine leasmhar cóip den ordú agus aon léarscáil nó plean dá dtagraítear ann a iniúchadh saor in aisce;
(c) a shonróidh na tráthanna agus an tréimhse, is tréimhse míosa ar a laghad, ar lena linn a fhéadfar an t-ordú, an léarscáil agus an plean (más ann) a iniúchadh amhlaidh;
(d) a shonróidh an tréimhse, is tréimhse míosa ar a laghad, ar laistigh di a fhéadfaidh aon duine ar a bhfearann an -ordú agóidí a dhéanamh ina choinne agus an modh ar a bhféadfaidh duine den sórt sin agóidí a dhéanamh amhlaidh;
(e) á rá nach dtiocfaidh an t-ordú i ngníomh go dtí go ndaingneoidh an tAire é;
(f) á rá go ndéanfaidh an tAire, sa chás go ndéanfar agóidí go cuí in aghaidh an ordaithe agus nach dtarraingeofar siar iad, a chur faoi deara, sula ndaingneoidh sé an t-ordú nó sula ndiúltóidh sé é a dhaingniú, éisteacht ó bhéal a thionól ina dtabharfar an deis éisteacht a fháil d'aon duine a mbeidh, laistigh den tréimhse a sonraíodh san fhógra, agóid déanta aige in aghaidh an ordaithe.
(2) A luaithe is féidir tar éis don tréimhse chun agóidí a dhéanamh a bheith caite, déanfaidh an t-údarás áitiúil lena mbaineann an t-ordú um limistéar faoi rialú speisialta a tharchur chuig an Aire lena dhaingniú agus, nuair a bheidh sé ag tarchur an ordaithe amhlaidh, tarchuirfidh sé chuig an Aire freisin aon agóidí a rinneadh laistigh den tréimhse shonraithe agus nach mbeidh tarraingthe siar.
(3) I gcás nach mbeidh aon agóidí déanta, laistigh den tréimhse shonraithe, in aghaidh an t-ordú um limistéar faoi rialú speisialta a dhéanamh nó i gcás gach agóid den sórt sin a bheith tarraingthe siar, féadfaidh an tAire—
(a) an t-ordú um limistéar faoi rialú speisialta a dhaingniú le hordú, fara nó d'uireasa modhnuithe, nó
(b) diúltú an t-ordú a dhaingniú, nó
(c) más dóigh leis go bhfuil sé inmhianaithe sin a dhéanamh, a chur faoi deara éisteacht ó bhéal a thionól i ndáil leis an ordú sula ndaingneoidh sé an t-ordú nó sula ndiúltóidh sé é a dhaingniú.
(4) I gcás agóidí a bheith déanta, laistigh den tréimhse shonraithe, in aghaidh an t-ordú um limistéar faoi rialú speisialta a dhéanamh agus nach mbeidh na hagóidí sin tarraingthe siar cuirfidh an tAire faoi deara éisteacht ó bhéal a thionól i ndáil leis an ordú agus tabharfaidh sé deis do gach duine a rinne agóid go cuí in aghaidh an ordaithe éisteacht a fháil.
(5) Nuair a bheidh tuarascáil (lena n-áirítear aon mholadh inti) an duine a thionól an éisteacht ó bhéal breithnithe ag an Aire, féadfaidh sé, le hordú, an t-ordú um limistéar faoi rialú speisialta a dhaingniú, fara nó d'uireasa modhnuithe, nó féadfaidh sé diúltú é a dhaingniú.
(6) Nuair a bheidh an tAire ag cinneadh cibé acu a dhaingneoidh sé ordú um limistéar faoi rialú speisialta nó nach ndaingneoidh, beidh aird aige ar fhorálacha mhíreanna (a), (b), (c), (d) agus (e) d'alt 39 (2).
(7) Gach ordú a dhéanfaidh an tAire faoin alt seo ag daingniú ordú um limistéar faoi rialú speisialta sonróidh sé dáta, nach déanaí ná sé mhí tar éis dháta déanta an ordaithe daingniúcháin, ar a dtiocfaidh an t-ordú um limistéar faoi rialú speisialta i ngníomh: ar choinníoll i gcónaí maidir leis an dáta a bheidh sonraithe amhlaidh i ndáil le hordú um limistéar faoi rialú speisialta—
(a) a chúlghaireann ordú um limistéar faoi rialú speisialta roimhe sin, nó
(b) a dhíolmhaíonn limistéir shonraithe nó foirgnimh shonraithe nó aicmí sonraithe foirgneamh ó gach ceann nó ó aon cheann de cheanglais an ordaithe um limistéar faoi rialú speisialta,
go bhféadfadh gurb ionann an dáta sin agus dáta déanta an ordaithe daingniúcháin nó aon dáta tar éis an dáta sin.
(8) Déanfaidh an t-údarás áitiúil lena mbaineann fógra i dtaobh ordú a dhéanamh ag daingniú ordú um limistéar faoi rialú speisialta agus i dtaobh an dáta a thiocfaidh an t-ordú um limistéar faoi rialú speisialta i ngníomh a fhoilsiú, a thabhairt nó a sheirbheáil i cibé slí a ordóidh an tAire.
Éisteachtaí ó bhéal.
42.—(1) Is duine arna cheapadh ag an Aire chun na críche sin a stiúrfaidh éisteacht ó bhéal i ndáil le hordú um limistéar faoi rialú speisialta a thionólfar de bhun alt 41 (3) nó (4).
(2) Féadfaidh duine a bheidh ag stiúradh éisteachta ó bhéal a cheangal ar aon oifigeach de chuid údaráis áitiúil lena mbaineann aon fhaisnéis a éileoidh sé go réasúnach chun críche na héisteachta a thabhairt dó agus beidh sé mar dhualgas ar an oifigeach lena mbaineann déanamh de réir an cheanglais.
(3) (a) Féadfaidh duine a bheidh ag stiúradh éisteachta ó bhéal cuairt a thabhairt ar áitreabh agus é a iniúchadh chun aon chríche is dóigh leis is gá i ndáil leis an ordú um limistéar faoi rialú speisialta arb é is ábhar don éisteacht.
(b) Beidh aon duine ciontach i gcion a bhacfaidh feidhmiú cumhachta a thugtar leis an bhfo-alt seo.
(4) Féadfaidh duine a bheidh ag stiúradh éisteachta ó bhéal fianaise a ghlacadh faoi mhionn agus féadfaidh sé chun na críche sin daoine a chur faoi mhionn, agus beidh duine a bheidh ag tabhairt fianaise i dteideal na ndíolúintí agus na bpribhléidí céanna a mbeadh sé ina dteideal dá mba fhinné os comhair na hArd-Chúirte é.
(5) (a) Faoi réir mhír (b), féadfaidh duine a bheidh ag stiúradh éisteachta ó bhéal, trí fhógra i scríbhinn sa chéill sin chuig duine ar bith, a cheangal ar an duine sin freastal cibé tráth agus ionad a bheidh sonraithe san fhógra chun fianaise a thabhairt i ndáil le haon ábhar a bheidh i gceist ag an éisteacht nó aon leabhair, gníomhais, conarthaí, léarscáileanna, pleananna, nó doiciméid eile a thabhairt ar aird a bheidh ina sheilbh, faoina choimeád nó faoina rialú agus a bhaineann le haon ábhar den sórt sin.
(b) Beidh éifeacht ag na forálacha seo a leanas chun críocha na míre sin roimhe seo:
(i) ní gá do dhuine freastal de réir fógra in ionad a bheidh níos mó ná deich míle slí óna ghnáth-áit chónaithe mura mbeifear tar éis cibé suim a chlúdóidh na costais réasúnacha agus riachtanacha a bhaineann leis an bhfreastal a íoc leis nó a thairiscint dó;
(ii) déanfaidh an t-údarás áitiúil, ar iarratas ón duine a bheidh ag stiúradh na héisteachta ó bhéal, cibé suim a íoc le haon duine nó a thairiscint d'aon duine a gceanglaítear air freastal is suim a mheasfaidh an duine a bheidh ag stiúradh na héisteachta a chlúdóidh na costais réasúnacha agus riachtanacha a bhaineann leis an bhfreastal;
(iii) maidir le haon duine a d'fhreastail de réir fógra ar aon áit déanfaidh an t-údarás áitiúil, ach amháin sa mhéid gur íocadh leis cheana na costais réasúnacha agus riachtanacha a bhain leis an bhfreastal, na costais sin a íoc leis, agus beidh na costais sin ach amháin mar a dúradh, mura n-íocfar amhlaidh iad, inghnóthaithe mar fhiach conartha shimplí in aon chúirt dlínse inniúla;
(iv) gach duine dár tugadh fógra agus a dhiúltóidh nó a fhailleoidh go toiliúil freastal de réir an fhógra nó a dhéanfaidh go toiliúil aon doiciméad lena mbaineann an fógra a athrú, a cheilt, a fholú nó a scriosadh nó tar éis dó freastal amhlaidh, a dhiúltóidh fianaise a thabhairt nó a dhiúltóidh nó a mhainneoidh go toiliúil aon doiciméad lena mbaineann an fógra a thabhairt ar aird, beidh sé ciontach i gcion.
(6) I gcás go ndéanfar éisteacht ó bhéal a stiúradh thar ceann an Aire faoin Acht seo ag duine a bheidh arna cheapadh chun na críche ag an Aire, tabharfaidh an duine a bheidh ceaptha amhlaidh don Aire tuarascáil i scríbhinn ar an éisteacht agus áireoidh sé ina thuarascáil moladh i dtaobh an ábhair lenar bhain an éisteacht.
Ordú um limistéar faoi rialú speisialta a mhaolú nó a fhionraí.
43.—(1) Más rud é, tráth ar bith, gur dóigh leis an Aire gur gá sin a dhéanamh, féadfaidh sé, le hordú, oibriú ordaithe um limistéar faoi rialú speisialta a fhionraí nó a mhaolú i ndáil le hiomlán limistéir faoi rialú speisialta nó i ndáil le haon chuid de, go ceann cibé tréimhse a shonrófar san ordú.
(2) Sula ndéanfaidh an tAire ordú faoi fho-alt (1), rachaidh sé i gcomhairle leis an údarás áitiúil lena mbaineann, ach amháin sa chás nárbh fhéidir dul i gcomhairle amhlaidh de bharr phráinn na hócáide.
(3) Féadfaidh an tAire ordú faoin alt seo (lena n-áirítear faoin bhfo-alt seo) a leasú nó a chúlghairm le hordú.
(4) Ní mór d'údarás áitiúil fógra a fhoilsiú ar cibé modh a ordóidh an tAire, á rá go ndearnadh ordú faoin alt seo.
Cumhacht údaráis áitiúil a cheangal athruithe a dhéanamh ar áitribh.
44.—(1) Féadfaidh údarás áitiúil, trí fhógra i scríbhinn a sheirbheálfar ar an duine ar dóigh leis gurb é is úinéir nó áititheoir ar áitreabh—
(a) atá laistigh de limistéar faoi rialú speisialta, nó
(b) a bheidh, nuair a thiocfaidh an t-ordú um limistéar faoi rialú speisialta a dhaingnigh an tAire i ngníomh, laistigh de limistéar den sórt sin,
a cheangal ar úinéir nó áititheoir an áitribh cibé athruithe ar an áitreabh a dhéanamh a bheidh sonraithe san fhógra.
(2) Maidir le fógra faoi fho-alt (1)—
(a) sonrófar ann na hoibreacha is dóigh leis an údarás áitiúil a bheith riachtanach chun go gcomhlíonfar an t-ordú um limistéar faoi rialú speisialta;
(b) ordóidh sé don duine ar a seirbheálfar an fógra cibé oibreacha a bheidh sonraithe san fhógra a sheoladh nó a chur faoi deara iad a sheoladh;
(c) sonrófar ann tréimhse (is tréimhse nach giorra ná ocht lá is fiche dar tús dáta seirbheála an fhógra agus dar críoch tráth nach luaithe ná an dáta a thiocfaidh an t-ordú um limistéar faoi rialú speisialta i ngníomh) ar laistigh di a bheidh na hoibreacha sin le cur i gcrích;
(d) sonrófar ann go bhféadfaidh an duine ar ar seirbheáladh an fógra uiríll i scríbhinn i ndáil le téarmaí an fhógra a dhéanamh chun an údaráis áitiúil laistigh den tréimhse a bheidh luaite san fhógra.
(3) Ní mór don údarás áitiúil breithniú a dhéanamh ar aon uiríll a dhéanfar chuige go cuí laistigh den tréimhse a bheidh sonraithe san fhógra agus más dóigh leis, tar éis dó na huiríll sin a bhreithniú, go bhfuil sé réasúnach déanamh amhlaidh, féadfaidh sé an fógra a leasú nó a chúlghairm.
(4) Ní mór do dhuine ar a seirbheálfar fógra faoin alt seo ceanglais an fhógra nó, de réir mar a bheidh, ceanglais an fhógra arna leasú a chomhlíonadh laistigh den tréimhse shonraithe.
(5) I gcás nach ndéanfaidh duine ar ar seirbheáladh fógra faoin alt seo ceanglais an fhógra nó, de réir mar a bheidh, ceanglais an fhógra arna leasú, a chomhlíonadh laistigh den tréimhse a sonraíodh, féadfaidh an t-údarás áitiúil a sheirbheáil an fógra cibé bearta a dhéanamh is dóigh leis a bheith réasúnach agus riachtanach chun an comhlíonadh sin a urrú.
(6) Féadfaidh údarás áitiúil aon chaiteachais a tabhaíodh de bhíthin fheidhmiú na gcumhachtaí a thugtar dóibh le fo-alt (5) a ghnóthú ón duine ar ar seirbheáladh fógra faoin alt seo mar fhiach conartha shimplí in aon chúirt dlínse inniúla.
Cúnamh airgid le haghaidh oibreacha áirithe.
45.—(1) Féadfaidh an tAire, le toiliú an Aire Airgeadais, scéim nó scéimeanna a dhéanamh chun cúnamh airgid a thabhairt i ndáil le hiomlán na gcostas, nó i ndáil le haon chuid de na costais, a thabhóidh úinéir nó áititheoir áitribh a bheidh suite laistigh de limistéar faoi rialú speisialta chun go gcomhlíonfaidh an t-áitreabh ceanglais ordaithe um limistéar faoi rialú speisialta nó fógra faoi alt 44.
(2) Gan dochar do ghinearáltacht fho-alt (1) beidh feidhm ag na forálacha seo a leanas maidir le scéim faoin alt seo:
(a) féadfar a fhoráil le scéim den sórt sin go ndéanfaidh údarás áitiúil nó cibé duine nó comhlacht eile (lena n-áirítear an tAire) a shonrófar sa scéim í a riaradh go hiomlán nó go páirteach;
(b) féadfar a fhoráil le scéim den sórt sin go gcinnfidh an tAire nó aon duine eile (lena n-áirítear eadránaí) aon díospóid a éireoidh maidir le teideal aon duine chun aon chúnaimh airgid is iníoctha faoin scéim nó maidir le méid aon chúnaimh airgid den sórt sin;
(c) foilseofar fógra ar cibé modh is dóigh leis an Aire is iomchuí á rá go ndearnadh scéim den sórt sin.
(3) Féadfaidh an tAire, le toiliú an Aire Airgeadais, scéim a rinne sé faoin alt seo a leasú nó a chúlghairm.
CUID V
Pleananna Bainisteoireachta Aercháilíochta agus Caighdeáin Aercháilíochta
Pleananna bainisteoireachta aercháilíochta.
46.—(1) Féadfaidh údarás áitiúil, agus i gcás go n-ordaíonn an tAire amhlaidh ní mór dó, plean (dá ngairtear “plean bainisteoireachta aercháilíochta” san Acht seo) a dhéanamh, i ndáil le hiomlán a limistéir feidhme nó i ndáil le cuid de chun an aercháilíocht sa limistéar lena mbaineann an plean sin a chaomhnú nó a fheabhsú.
(2) Féadfaidh údarás áitiúil, ó am go ham de réir mar is gá de réir na hócáide, agus ní mór dó uair amháin ar a laghad gach cúig bliana tar éis an dáta a ndéanfar plean bainisteoireachta aercháil ifada/>ochta, an plean a athbhreithniú agus aon chlaochluithe a dhéanamh ann (cibé acu ar mhodh athrú, breisiú nó scriosadh) is dóigh leis is cuí nó plean nua a chur ina ionad.
(3) Féadfaidh dhá údarás áitiúla nó níos mó, i ndáil le hiomlán a limistéar feidhme nó le haon chuid díobh, plean bainisteoireachta aercháilíochta a dhéanamh i gcomhpháirt agus beidh feidhm ag forálacha fho-alt (2) maidir le haon phlean den sórt sin.
(4) Beidh i bplean bainisteoireachta aercháilíochta cibé cuspóirí is dóigh leis an údarás áitiúil lena mbaineann a bheith réasúnach agus riachtanach chun truailliú aeir a chosc nó a theorannú nó chun an aercháilíocht sa limistéar lena mbaineann an plean sin a chaomhnú nó a fheabhsú ach ní bheidh ann aon chuspóir a bheadh ar neamhréir le haon rialachán arna dhéanamh faoi ailt 50 nó 51 nó le haon ordú um limistéar faoi rialú speisialta a bheidh i ngníomh i ndáil leis an limistéar sin.
(5) Is feidhm fhorchoimeádta é plean bainisteoireachta aercháilíochta a dhéanamh, a athbhreithniú, a chlaochlú nó plean bainisteoireachta aercháilíochta eile a chur ina ionad.
Cumhacht an Aire i ndáil le plean bainisteoireachta aercháilíochta.
47.—Féadfaidh an tAire—
(a) a ordú d'údarás áitiúil, nó do dhá údarás áitiúla nó níos mó i gcomhpháirt, plean bainisteoireachta aercháilíochta a dhéanamh;
(b) a cheangal ar údarás áitiúil nó de réir mar a bheidh, ar dhá údarás áitiúla nó níos mó, plean bainisteoireachta aercháilíochta a rinne siad nó a rinne siad i gcomhpháirt a chlaochlú (cibé acu trí athrú, breisiú nó scriosadh) ar cibé modh a shonróidh an tAire nó plean nua a chur in ionad an phlean;
(c) a cheangal maidir le plean bainisteoireachta aercháilíochta a rinne dhá údarás áitiúla nó níos mó nó a bheidh le déanamh ag dhá údarás áitiúla nó níos mó, go ndéanfaí é a chomhordú ar cibé modh agus i ndáil le cibé nithe a shonróidh an tAire;
agus déanfaidh údarás áitiúil gach ordú nó ceanglas den sórt sin ón Aire a chomhlíonadh.
Fógraí a fhoilsiú i ndáil le pleananna bainisteoireachta aercháilíochta.
48.—(1) Más rud é go mbeartaíonn údarás áitiúil plean bainisteoireachta aercháilíochta a dhéanamh nó a chlaochlú nó go mbeartaíonn sé plean bainisteoireachta aercháilíochta eile a chur ina ionad, cuirfidh an t-údarás áitiúil faoi deara fógra á rá go bhfuil sé ar intinn an plean a dhéanamh nó a chlaochlú nó plean eile a chur ina ionad, de réir mar a bheidh, a fhoilsiú i nuachtán amháin ar a laghad a bheidh i gcúrsaíocht ina limistéar feidhme.
(2) Maidir le fógra faoi fho-alt (1), luafar ann—
(a) go bhféadfar cóip den phlean beartaithe nó, de réir mar a bheidh, den chlaochlú ar an bplean a iniúchadh in ionad a bheidh luaite agus ag tráthanna a bheidh luaite le linn tréimhse a bheidh luaite;
(b) go ndéanfar uiríll i ndáil leis an bplean beartaithe, nó i ndáil leis an gclaochlú beartaithe ar an bplean, a bheidh déanta chun an údaráis áitiúil laistigh den tréimhse shonraithe a chur san áireamh sula ndéanfar an plean nó, de réir mar a bheidh, an claochlú ar an bplean (agus cuirfear aon uiríll en sórt sin san áireamh dá réir sin).
(3) Nuair a bheidh breithniú déanta ag an údarás áitiúil ar aon uiríll a rinneadh go cuí chuige laistigh den tréimhse a bhí luaite san fhógra faoi fho-alt (2), féadfaidh an t-údarás áitiúil de réir mar is cuí leis, an plean a dhéanamh, a chlaochlú nó plean eile a chur ina ionad, fara nó d'uireasa leasú.
(4) (a) Féadfaidh aon duine cóip de phlean bainisteoireachta aercháilíochta nó sliocht as a iarraidh ar údarás áitiúil agus déanfaidh an t-údarás áitiúil de réir na hiarrata sin.
(b) Doiciméad a airbheartaíonn gur cóip é de phlean bainisteoireachta aercháilíochta nó gur sliocht é as plean den sórt sin agus a bheith deimhnithe mar chóip dhílis ag oifigeach d'údarás áitiúil, beidh sé ina fhianaise prima facie ar an bplean nó ar an sliocht, de réir mar a bheidh, agus ní gá síniú an oifigigh sin a chruthú ná a chruthú gurbh é an t-oifigeach sin é.

(d) I gcás go n-iarrfar cóip faoin bhfo-alt seo ar údarás áitiúil, eiseofar an chóip chuig an iarratasóir ar é d'íoc leis an údarás áitiúil cibé táille (más ann) a shocróidh siad ar táille í nach rachaidh thar an gcostas réasúnach a bhainfidh leis an gcóip a dhéanamh.

49.—A luaithe is féidir tar éis d'údarás áitiúil plean bainisteoireachta aercháilíochta a dhéanamh, a chlaochlú nó plean bainisteoireachta aercháilíochta eile a chur ina ionad, tarchuirfidh an t-údarás áitiúil cóip den phlean nó den phlean nua, de réir mar a bheidh, chuig n Aire agus chuig cibé daoine eile a bheidh forordaithe.
Caighdeáin aercháilíochta.
50.—(1) Féadfaidh an tAire, chun críocha an Achta seo, caighdeáin (dá ngairtear “caighdeáin aercháilíochta” san Acht seo) a shonrú le rialacháin, agus féadfar caighdeáin aercháilíochta éagsúla a shonrú le haghaidh limistéar éagsúil nó aicmí éagsúla limistéar, le haghaidh imthosca éagsúla nó aicmí éagsúla imthosca nó le haghaidh tréimhsí ama éagsúla.
(2) Gan dochar d'fhorálacha fho-alt (1), féadfaidh rialacháin faoin alt seo foráil a dhéanamh le haghaidh gach ceann nó aon cheann de na hábhair seo a leanas—
(a) caighdeán aercháilíochta a chur i mbaint le truailleán faoi leith nó le teaglaim truailleán;
(b) caighdeán aercháilíochta a lua mar thiúchan san aer, nó mar mhais ag sil-leagan ar limistéar áirithe, den truailleán áirithe nó den teaglaim truailleán áirithe is tiúchan nó mais nach cead a shárú ar feadh tréimhsí sonraithe agus faoi dhálaí sonraithe;
(c) a fhoráil go bhféadfaidh an tAire caighdeán aercháilíochta a fhionraí, a mhaolú nó a mhodhnú go ceann cibé tréimhse agus i cibé imthosca a bheidh sonraithe go ginearálta nó i ndáil le limistéar áirithe.
(3) Más rud é gur cosúil, de thoradh monatóireachta a rinneadh faoi alt 54 nó ar shlí eile, go sáraítear, nó gur dócha go sárófar caighdeán aercháilíochta in aon chuid dá limistéar feidhme ní mór d'údarás áitiúil—
(a) cibé cuspóirí is dóigh leis an údarás áitiúil is iomchuí chun cáilíocht an aeir a fheabhsú agus chun truailliú aeir sa limistéar i gceist a chosc nó a theorannú a chur ar áireamh in aon phlean bainisteoireachta aercháilíochta a bheidh arna ullmhú acu, ionas nach ndéanfar, laistigh de cibé tréimhse is dóigh leis an údarás áitiúil is réasúnach, nó laistigh de cibé tréimhse a ordóidh an tAire, an caighdeán aercháilíochta a shárú, agus
(b) cibé bearta eile a dhéanamh is iomchuí i bhfeidhmiú a bhfeidhmeanna dóibh faoin Acht seo chun a áirithiú go gcomhlíonfar an caighdeán aercháilíochta.
Luachanna teorann astaíochta.
51.—(1) Féadfaidh an tAire, chun críocha an Achta seo, teorainneacha (dá ngairtear “luachanna teorann astaíochta” san Acht seo) le haghaidh astaíochtaí a shonrú le rialacháin agus féadfar luachanna teorann astaíochta éagsúla a shonrú le haghaidh limistéar éagsúil nó aicmí éagsúla limisteár, le haghaidh áitreabh éagsúil nó aicmí éagsúla áitreabh, le haghaidh imthosca éagsúla nó aicmí éagsúla imthosca nó le haghaidh tréimhsí ama éagsúla.
(2) Féadfaidh luach teorann astaíochta baint a bheith aige le truailleán faoi leith nó le teaglaim truailleán.
(3) Aon uair go mbeidh luach teorann astaíochta ábhartha sonraithe i rialacháin faoin alt seo, ní mór d'áititheoir aon áitribh óna mbeidh an truailleán nó, de réir mar a bheidh, an teaglaim truailleán á astú isteach san atmaisféar cibé bearta a dhéanamh is gá chun a áirithiú nach sáróidh na hastaíochtaí sin an luach teorann astaíochta lena mbaineann.
(4) Féadfaidh an tAire treoracha a thabhairt d'údarás áitiúil i ndáil leis na modhanna samplaithe, anailísithe agus tomhais a bheidh le húsáid nuair a bheifear á chinneadh an bhfuil astaíochtaí aon truailleáin nó aon teaglaime truailleán de réir luach teorann astaíochta arna shonrú i ndáil leis an truailleán nó leis an teaglaim truailleán sin agus beidh sé de dhualgas ar an údarás áitiúil lena mbaineann déanamh de réir aon treoracha den sórt sin.
(5) Féadfar le rialacháin faoin alt seo a fhoráil go bhféadfaidh an tAire luach teorann astaíochta a fhionraí, a mhaolú nó a mhodhnú go ceann cibé tréimhse agus i cibé imthosca a bheidh sonraithe go ginearálta nó i ndáil le háitribh d'aicme áirithe nó i ndáil le limistéar áirithe.
Treoracha ón Aire i ndáil le truailliú aeir.
52.—(1) Eiseoidh an tAire ó am go ham, de réir mar is gá sa chás, cibé treoracha ginearálta is dóigh leis is gá maidir le beartas i ndáil le truailliú aeir a chosc agus a theorannú.
(2) Nuair a bheidh siad ag comhlíonadh a bhfeidhmeanna faoin Acht seo, tabharfaidh údarás áitiúil agus An Bord Pleanála aird ar aon treoracha a eiseoidh an tAire faoin alt seo.
(3) Aon uair a thabharfaidh an tAire treoir faoin alt seo, cuirfidh é faoi deara—
(a) cóip den treoir a tharchur chun gach údaráis áitiúil agus chun n Bhoird Pleanála,
(b) fógra á rá gur eisíodh an treoir a fhoilsiú san Iris Oifigiúil.
(4) Aon uair a chuirfidh an tAire faoi deara fógra a fhoilsiú de bhun fho-alt (3) (b), sonrófar san fhógra sin cá bhféadfar cóip den treoir lena mbaineann sé a fháil agus cad í an táille (más ann) a bheidh iníoctha i leith cóipe den sórt sin.
Rialacháin i ndáil le breosla.
53.—(1) Féadfaidh an tAire, d'fhonn truailliú aeir, a chosc nó a theorannú, rialacháin a dhéanamh i ndáil leis na nithe seo a leanas—
(a) caighdeán, sonraíocht, comhdhéanamh agus ábhar aon bhreosla de chineál a úsáidtear i bhfeithiclí inneallghluaiste nó i bhfeithiclí inneallghluaiste d'aicme nó de thuairisc áirithe nó i bhfeithiclí inneallghluaiste i limistéar áirithe nó in aicme áirithe limistéar;
(b) caighdeán, sonraíocht, comhdhéanamh agus ábhar aon chineáil breosla a dhóitear i dtinteáin nó i dtinteáin d'aicme nó de thuairisc áirithe nó i dtinteáin i limistéar áirithe nó in aicme áirithe limistéar;
(c) breosla de chineál nó de thuairisc ar bith a tháirgeadh, a chóireáil, a allmhairiú, a chur ar an margadh, a dháileadh nó a dhíol;
(d) breosla, nó breosla nach gcomhlíonann cibé ceanglais a bheidh sonraithe, a dhó i dtinteáin, nó i dtinteáin d'aicme nó de thuairisc áirithe, nó a dhó amhlaidh a chosc;

(a) cosc a chur ar dhíol, dáileadh, úsáid nó dó breosla nach gcomhlíonann cibé caighdeáin a bheidh sonraithe go ginearálta nó i limistéar nó in aicme limistéar sonraithe;
(b) caighdeáin éagsúla a shonrú i ndáil le breoslaí éagsúla;
(c) na tástálacha a shonrú a bheidh le seoladh d'fhonn a fhionnadh an gcomhlíonann breosla forálacha rialachán arna ndéanamh faoin alt seo;
(d) foráil a dhéanamh maidir le diolmhú a thabhairt ó aon cheann nó ó gach ceann d'fhorálacha na rialachán i cibé imthosca nó i cibé cásanna a bheidh sonraithe;
(e) a cheangal go ndéanfar faisnéis shonraithe i ndáil le breoslaí a thaispeáint i cibé ionaid agus i cibé slí a bheidh sonraithe;
(f) a fhoráil go gcuirfidh daoine a bheidh sonraithe sna rialacháin na rialacháin (nó aon fhoráil de na rialacháin) i bhfeidhm agus foráil a dhéanamh maidir le cumhachtaí na ndaoine in agus aon duine a bheidh údaraithe ag na daoine sin;
(g) a fhoráil go ndéanfaidh cibé daoine a bheidh sonraithe deimhnithe a eisiúint;
(h) foráil a dhéanamh maidir le daoine sonraithe do choimeád taifead agus maidir leis na taifid sin a scrúdú;
(i) foráil a dhéanamh maidir le cibé áitribh, taifid agus feithiclí a bheidh sonraithe a scrúdú agus maidir leis na ceanglais a fhéadfar a chur ar an úinéir nó ar an duine eile a bheidh i gceannas ar na háitribh, ar na taifid nó ar na feithiclí a bheidh arna sonrú amhlaidh chun críche an scrúdaithe sin;
(j) foráil a dhéanamh maidir le samplaí breoslaí a thógáil in áitribh shonraithe nó ó fheithiclí sonraithe;
(k) foráil a dhéanamh maidir le dathú a dhéanamh ar bhreoslaí éagsúla a bheidh le húsáid i bhfeithiclí inneallghluaiste éagsúla nó in aicmí éagsúla feithiclí inneallghluaiste;
(l) a fhoráil, maidir le haon deimhniú nó fianaise eile a thabharfar nó a bheidh le tabhairt i ndáil le haon tástáil, scrúdú nó anailísiú ar aon sampla a tógadh nó a seoladh de bhun na rialachán, gur fianaise é, gan tuilleadh cruthúnais, ar thoradh na tástála, an scrúdaithe nó an anailísithe, go dtí go suífear a mhalairt.
CUID VI
Ilghnéitheach
Monatóireacht ar aercháilíocht agus ar astaíochtaí.
54.—(1) Déanfaidh údarás áitiúil, nó cuirfidh sé faoi deara go ndéanfar, cibé monatóireacht—
(a) ar aercháilíocht, agus
(b) ar chineál, ar mhéid agus ar thionchar astaíochtaí,
is dóigh leis an údarás áitiúil is gá chun a fheidhmeanna faoin Acht seo a fheidhmiú nó a ordóidh an tAire dó a dhéanamh.
(2) Déanfaidh údarás áitiúil nó cuirfidh sé faoi deara go ndéanfar, cibé taifid ar aon mhonatóireacht a bheidh déanta faoi fho-alt (1) a cheapfaidh sé a bheith réasúnach agus riachtanach, a choimeád agus a chothabháil.
(3) Féadfaidh údarás áitiúil a cheangal ar áititheoir aon áitribh, seachas teaghais phríobháideach, óna bhfuil astaíocht, cibé monatóireacht a dhéanamh ar chineál, ar mhéid agus ar éifeacht na hastaíochta agus ar an aercháilíocht is dóigh leis an údarás áiti ufada/>il is gá agus cibé taifid ar an monatóireacht a choimeád agus a chur ar fáil don údarás áitiúil is dóigh leis an údarás áitiúil is gá.
(4) Déanfaidh údarás áitiúil, má ordaíonn an tAire dó amhlaidh, taifid ar aon mhonatóireacht a bheidh déanta faoin alt seo a chur ar fáil dósan nó d'aon duine a shonróidh sé, i gceann cibé tréimhsí agus i cibé slí a ordóidh an tAire.
(5) I gcás go mbainfidh caighdeán aercháilíochta lena limistéar feidhme nó le haon chuid de, déanfaidh an t-údarás áitiúil, i ndáil leis an limistéar lena mbaineann an caighdeán aercháilíochta, cibé comhshocraíochtaí le haghaidh monatóireachta is gá ionas go bhféadfaidh an t-údarás áitiúil a chinneadh an bhfuil an caighdeán aercháilíochta á chomhlíonadh.
(6) Féadfaidh an tAire orduithe a thabhairt d'údarás áitiúil i ndáil leis na nithe seo a leanas—
(a) líon agus suíomh na n-ionad laistigh de limisteár ar iontu a bheidh monatóireacht le déanamh,
(b) an modh ar a ndéanfar samplú, tomhas agus anailísiú chun críocha an ailt seo,
(c) an trealamh a bheidh le húsáid chun críocha an tsamplaithe, an tomhais nó an anailísithe sin,
agus déanfaidh an t-údarás áitiúil de réir gach ordaithe den sórt sin ón Aire.
(7) Féadfaidh an tAire monatóireacht a dhéanamh, nó cibé comhshocraíochtaí a dhéanamh chun monatóireacht a dhéanamh, ar thruailliú aeir is dóigh leis is gá nó is inmhianaithe.
Cumhacht cúirte chun oibreacha a údarú.
55.—(1) Más rud é maidir le háititheoir aon áitribh, nach bhfuil ar a chumas, gan toiliú duine éigin eile, oibreacha a dhéanamh a gceanglaítear air iad a dhéanamh chun forálacha an Achta seo a chomhlíonadh, agus go ndiúltaíonn an duine eile sin toiliú leis na hoibreacha a dhéanamh, féadfaidh an t-áititheoir iarratas a dhéanamh chun na Cúirte Dúiche ar ordú faoin alt seo.
(2) Más rud é, ar iarratas a éisteacht faoi fho-alt (1), go gcinnfidh an Chúirt Dúiche gur dhiúltaigh an duine eile go míréasúnach a thoiliú a thabhairt, féadfaidh an Chúirt Dúiche dá rogha a mheas gur tugadh an toiliú agus a ordú d'áititheoir an áitribh na hoibreacha a dhéanamh.
(3) Má cheanglaítear ar áititheoir aon áitribh oibreacha a dhéanamh de bhun an Achta seo ar an áitreabh, agus má mheasann an t-áititheoir sin gur chóir d'úinéir an áitribh sin nó do dhuine éigin eile a bhfuil leas aige ann, nó d'úinéir nó d'áititheoir áitribh thadhlaigh iomlán an chostais nó cuid den chostas a bhaineann leis na hoibreacha sin a ghlanadh, féadfaidh sé iarratas a dhéanamh chuig cúirt dlínse inniúla ar ordú á ordú go ndéanfaidh úinéir an áitribh, an duine eile a bhfuil leas aige ann nó úinéir nó áititheoir an áitribh thadhlaigh, de réir mar a bheidh, iomlán an chostais nó cibé cuid de chostas na n-oibreacha a bheidh sonraithe san ordú, a ghlanadh; agus déanfaidh an chúirt cibé ordú ar éisteacht an iarratais is dóigh léi a bheith cóir ag féachaint d'imthosca uile an cháis.
Feidhm an Achta Rialtais Áitiúil (Pleanáil agus Forbairt), 1963.
56.—(1) I gcás go ndeonaítear ceadúnas faoin Acht seo i ndáil le gléasra tionscail agus go dtugtar cead faoi Chuid IV den Acht Rialtais Áitiúil (Pleanáil agus Forbairt), 1963, i leith an ghléasra chéanna, ansin maidir le haon choinníollacha a bhí i gceangal leis an gcead sin, scoirfidh siad, a mhéid a bhaineann siad ar bhealach ar bith le truailliú aeir, d'éifeacht a bheith leo.
(2) Má thugtar cead faoi Chuid IV den Acht Rialtais Áitiúil (Pleanáil agus Forbairt), 1963, i ndáil le haon áitreabh ní dhéanfaidh sé sin aon dochar, difear ná srianadh ar bhealach ar bith ar fheidhmiú aon fhorála den Acht seo maidir leis an áitreabh sin.

57.—(1) Maidir le forálacha an Alkali, etc. Works Regulation Act, 1906, i ndáil le hastaíochtaí, beidh feidhm acu, d'ainneoin aisghairm an Achta sin leis an Acht seo, maidir le gach obair iomchuí, go dtí go ndéanfar ceadúnas faoin Acht seo a dheonú i leith na hoibre.

Cosaint.
59.—(1) Aon ní san Acht seo ní dhéanfaidh sé dleathach aon ghníomh nó mainneachtain a measfaí, murach an tAcht seo, é a bheith ina núis nó a bheith, ar shlí eile, contrártha don dlí, nó a choiscfeadh ar aon duine aon leigheas a mbeadh sé ina theideal murach gur ritheadh an tAcht seo.
(2) Ní bheidh duine i dteideal gléasra tionscail a fhoirgniú, a athrú nó a oibriú nó aon oibríocht nó gníomhaíocht eile a sheoladh de bhíthin amháin gur deonaíodh ceadúnas faoin Acht seo.
(3) Taobh amuigh d'alt 28 (4), ní dhéanfaidh aon ní san Acht seo difear d'oibriú na nAchtanna um Shábháilteacht i dTionscal, 1955 agus 1980, i ndáil le monarchana nó le haon áitribh eile lena mbaineann na hAchtanna sin.

AIR POLLUTION ACT, 1987
PART I
Preliminary and General
Short title.
1.—This Act may be cited as the Air Pollution Act, 1987.
Commencement.
2.—This Act shall come into operation on such day or days as may be appointed by order or orders of the Minister, either generally or with reference to a particular purpose or provision, or with reference to a particular area or areas, and different days may be fixed for different purposes and different provisions of this Act and for different areas.
Non application of Act.
3.—This Act shall not apply in relation to an emission arising from—
(i) the disposal at sea of a substance by deliberate combustion for thermal destruction, or
(ii) the use of any radioactive substance or device.
Air pollution.
4.—“Air pollution” in this Act means a condition of the atmosphere in which a pollutant is present in such a quantity as to be liable to—
(i) be injurious to public health, or
(ii) have a deleterious effect on flora or fauna or damage property, or
(iii) impair or interfere with amenities or with the environment.
Best practicable means.
5.—(1) Subject to subsection (3), a reference in this Act to the use of the best practicable means to prevent or limit an emission shall be construed as meaning the provision and proper maintenance, use, operation and supervision of facilities which, having regard to all the circumstances, are the most suitable for such prevention or limitation.
(2) In considering whether facilities are the most suitable for the prevention or limitation of an emission, regard shall be had—
(a) in the case of industrial plant, other than existing industrial plant, to—
(i) the current state of technical knowledge, and
(ii) the requirements of the environment, and
(iii) the costs which would be incurred in providing, maintaining, using, operating and supervising the facilities concerned, and
(b) in any other case, in addition to the matters specified in paragraph (a) (i), (ii) and (iii), to—
(i) the nature, extent and effect of the emission concerned, and
(ii) the age of the existing industrial plant or other premises, the nature of the facilities installed therein and the period during which the plant or other premises is likely to be used or to continue in operation, and
(iii) the costs which would be incurred in renovating the plant or other premises, or of renovating or replacing the facilities therein, in relation to the economic situation of undertakings or enterprises of the class concerned.
(3) The Minister may, from time to time as occasion demands, issue directions specifying the best practicable means for preventing or limiting such emission as may be specified in the direction either generally, or from premises of a particular class or description, and regard shall be had, in the administration of this Act, to any such directions.
(4) Whenever the Minister issues a direction under subsection (3), he shall cause as soon as may be—
(a) a copy of such direction to be sent to each local authority and to An Bord Pleanála,
(b) notice of the issue of the direction to be published in Iris Oifigiúil, and
(c) a copy of the direction to be made available, on payment of such fee (if any) as may be fixed by the Minister, to every person who makes application for such a copy.
(5) In this section “facilities” means machinery, plant, equipment, appliances, apparatus, buildings and other structures.
Industrial plant and existing industrial plant.
6.—(1) “Industrial plant” in this Act means any plant, equipment, appliance, apparatus, machinery, works, building or other structure or any land or any part of any land which is used in the course of trade, business or industry for the purposes of, or incidental to, any industrial process specified in the Third Schedule.
(2) In this Act “existing industrial plant” means industrial plant—
(a) in respect of which a permission under Part IV of the Local Government (Planning and Development) Act, 1963, is granted prior to such day (in this subsection referred to as “the relevant day”) as may be prescribed by the Minister, or
(b) which is, on the day immediately prior to the relevant day, or was, at any time during the period of twelve months ending on the day immediately prior to the relevant day, used for the purposes of, or incidental to, any industrial process specified in the Third Schedule, other than industrial plant which is an unauthorised structure or the use of which constitutes an unauthorised use.
(3) The Minister may, by regulations, vary, by the addition or deletion of any industrial process, the Third Schedule.
(4) In this section “unauthorised structure” and “unauthorised use” have the meanings assigned to them by the Local Government (Planning and Development) Act, 1963.
Interpretation generally.
7.—(1) In this Act—
“air quality management plan” has the meaning specified in section 46;
“air quality standard” means a standard prescribed for the purposes of this Act by the Minister pursuant to section 50;
“authorised fireplace” means a fireplace declared to be an authorised fireplace by the Minister in regulations under section 40 (2);
“authorised fuel” means a fuel declared to be an authorised fuel by the Minister in regulations under section 40 (3);
“authorised person” means a person who is—
(a) appointed in writing by a local authority to be an authorised person for the purposes of this Act, or
(b) appointed in writing to be an authorised person pursuant to regulations under this Act by a person specified in those regulations;
“emission” means, save where the context otherwise requires, an emission of a pollutant into the atmosphere;
“emission limit value” means a limit prescribed by the Minister under section 51;
“fireplace” includes any furnace, incinerator, grate or stove whether open or closed or any other place of combustion;
“functions” includes powers and duties;
“industrial process” includes any process which is carried on in the course of trade, business or industry and which is for, or incidental to, the making or production of any article, part of an article, substance, energy or thing or the altering, repairing, ornamenting, finishing, cleaning, washing, packing or canning, or the adapting for sale, or breaking up or demolition of any article, substance or thing; including, in particular, the getting, raising, taking, carrying away and processing (including size reduction, grading and heating) of minerals, the storage of mineral wastes and the incineration, treatment or recovery of other wastes;
“licence”, in relation to a licence granted under section 32, includes, where the context so admits or requires, such a licence as revised pursuant to section 33;
“local authority” means—
(a) in the case of the administrative county of Dublin, other than the borough of Dún Laoghaire, the council of the county of Dublin,
(b) in the case of the borough of Dún Laoghaire, the corporation of the borough,
(c) in the case of a county borough, the corporation of the county borough, and
(d) in the case of any other administrative county, the council of the county,
and references to the functional area of a local authority shall be construed accordingly;
“the Minister” means the Minister for the Environment;
“monitoring” includes the inspection, measurement, sampling or analysis, for the purposes of this Act, of any emission or of the ambient air in any locality, whether periodically or continuously;
“occupier”, in relation to any premises, includes a lessee, any person entitled to occupy the premises and any other person having, for the time being, control of the premises;
“pollutant” means any substance specified in the First Schedule or any other substance or energy which, when emitted into the atmosphere, either by itself or in combination with any other substance, may cause air pollution;
“premises” includes any messuage, building, structure or land (whether or not there are structures on the land or whether or not the land is covered with water) or any hereditament of any tenure, together with any out-buildings and curtilage;
“prescribed” means prescribed by regulations made by the Minister;
“private dwelling” means any building or structure or any part of any building or structure (including any ancillary building or structure) which is used, or intended to be used, solely for human habitation but does not include—
(a) a curtilage or garden, or
(b) an ancillary building or structure, or part of a building or structure, having a fireplace with a maximum heating capacity exceeding 45kW which serves more than one dwelling;
“public place” means any street, road, seashore or other place to which the public have access, whether by right or by permission, or whether subject to, or free of charge;
“the register” means the register kept pursuant to section 17;
“reserved function” means—
(a) in relation to the council of a county or the corporation of Dún Laoghaire, a reserved function for the purposes of the County Management Acts, 1940 to 1985,
(b) in relation to the corporation of a county borough, a reserved function for the purposes of the Acts relating to the management of the county borough;
“smoke” includes soot, ash, grit, and any other particle emitted in smoke;
“special control area” means an area in relation to which a special control area order is in operation;
“special control area order” has the meaning assigned to it by section 39.
(2) In this Act, a reference to a section, Schedule or Part is a reference to a section, Schedule or Part of this Act unless there is an indication that a reference to any other enactment is intended.
(3) In this Act, a reference to a subsection, paragraph or subparagraph is a reference to the subsection, paragraph or subparagraph of the provision in which the reference occurs unless there is an indication that a reference to some other provision is intended.
(4) A reference in this Act to any enactment shall be construed as a reference to that enactment as amended or adapted by any subsequent enactment.
Application of Act to premises belonging to State.
8.—This Act shall apply to premises belonging to or in the occupation of the State.
Repeals.
9.—(1) Each enactment mentioned in column (2) of Part I of the Second Schedule is hereby repealed to the extent specified in column (3) of that Part of that Schedule.
(2) Each Statutory Instrument mentioned in column (2) of Part II of the Second Schedule is hereby repealed to the extent specified in column (3) of that Part of that Schedule.
Regulations.
10.—(1) The Minister may make regulations—
(a) for prescribing any matter referred to in this Act as prescribed,
(b) in relation to any matter referred to in this Act as the subject of regulations, and
(c) for the purpose of giving full effect to this Act.
(2) Regulations made under this Act may make different provisions in relation to different areas, different circumstances and different classes of cases.
(3) Where it is proposed to make regulations under section 6, a draft of the regulations shall be laid before each House of the Oireachtas and the regulations shall not be made until a resolution approving of the draft has been passed by each House.
(4) Every regulation made by the Minister under this Act (other than a regulation made under section 6) shall be laid before each House of the Oireachtas soon as may be after it is made and, if a resolution annulling the regulation is passed by either such House within the next twenty-one days on which that House has sat after the regulation is laid before it, the regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done under it.
Offences.
11.—(1) Any person who contravenes any provision of this Act or of any regulation made under this Act or of any notice served under this Act shall be guilty of an offence.
(2) Where an offence under this Act is committed by a body corporate or by a person acting on behalf of a body corporate and is proved to have been so committed with the consent, connivance or approval of, or to have been facilitated by any neglect on the part of, any director, manager, secretary or other official of such body, such person shall also be guilty of an offence.
(3) In this section, a reference to the contravention of a provision includes, where appropriate, a reference to a refusal, or a failure, to comply with that provision.
Penalties.
12.—(1) A person guilty of an offence under this Act shall be liable—
(a) on summary conviction, to a fine not exceeding £1,000 (together with, in the case of a continuing offence, a fine not exceeding £100 for every day on which the offence is continued and not exceeding in total an amount which, when added to any other fine under this paragraph in relation to the offence concerned, equals £1,000), or to imprisonment for any term not exceeding six months or, at the discretion of the court, to both such fine and such imprisonment,
(b) on conviction on indictment, to a fine not exceeding £10,000 (together with, in the case of a continuing offence, a fine not exceeding £1,000 for every day on which the offence is continued), or to imprisonment for any term not exceeding two years or, at the discretion of the court, to both such fine and such imprisonment.
(2) Section 13 of the Criminal Procedure Act, 1967, shall apply in relation to an offence to which subsection (1) relates as if, in lieu of the penalties provided for in subsection (3) of the said section 13, there were specified therein the penalties provided for in subsection (1) (a), and the reference in subsection (2) (a) of the said section 13 to the penalties provided for in the said subsection (3) shall be construed and have effect accordingly.
Prosecution of offences.
13.—(1) (a) An offence under this Act may be prosecuted summarily by the local authority in whose functional area the offence is committed or, in the case of an offence arising from an order made, or a notice served, by a local authority, by the local authority concerned.
(b) Where a local authority are of opinion that an emission from any premises may cause air pollution affecting any part of their functional area, the local authority may, notwithstanding that the emission is from a premises which is situate outside the functional area of the local authority concerned, initiate summary proceedings for an offence under this Act in relation to the emission concerned.
(2) The Minister may, by regulations under this section, prescribe that such offence as may be specified in the regulations may be prosecuted summarily by such person (including the Minister) as may be so specified in addition to, or in lieu of, the relevant local authority.
(3) Notwithstanding the provisions of section 10(4) of the Petty Sessions (Ireland) Act, 1851, summary proceedings for an offence under this Act may be commenced—
(a) at any time within twelve months from the date on which the offence was committed, or
(b) at any time within three months from the date on which evidence sufficient, in the opinion of the person by whom the proceedings are initiated, to justify the proceedings comes to such person's knowledge,
whichever is the later: provided that no such proceedings shall be initiated later than five years from the date on which the offence concerned was committed.
(4) For the purposes of this section, a certificate signed by or on behalf of the person initiating the proceedings as to the date on which evidence relating to the offence came to his knowledge shall be prima facie evidence thereof and in any legal proceedings a document purporting to be a certificate issued for the purposes of this subsection and to be so signed shall be deemed to be so signed and shall be admitted as evidence without proof of the signature of the person purporting to sign the certificate, unless the contrary is shown.
Powers of authorised person.
14.—(1) Subject to subsection (2), an authorised person shall, for any purpose connected with this Act, be entitled, at all reasonable times, to enter into any premises and to bring therein such other persons or equipment as he may consider necessary for the purpose.
(2) An authorised person shall not, other than with the consent of the occupier, enter into a private dwelling unless he has given to the occupier of the dwelling not less than 24 hours notice in writing of his intended entry.
(3) Every authorised person shall be furnished with a certificate of his appointment and when exercising any power conferred on him by or under this Act, the authorised person shall, if requested by any person affected, produce the certificate to that person.
(4) Whenever an authorised person enters into any premises pursuant to this section, he may therein—
(a) make such plans and carry out such inspections,
(b) make such tests and take such samples,
(c) require from the owner or occupier of the premises or from any other person on the premises such information, or
(d) inspect such records or such documents,
as he, having regard to all the circumstances, considers necessary for the purposes of this Act.
(5) Any person who obstructs an authorised person in the exercise of his powers under this section or who fails to comply with a requisition of an authorised person or who wilfully withholds any information which the authorised person requires shall be guilty of an offence.
(6) Where an authorised person in the exercise of his powers under this section is prevented from entering any premises, the authorised person or the person by whom he was appointed may apply to the District Court for a warrant authorising such entry.
(7) The Minister may make regulations for the purposes of this section.
(8) Without prejudice to the generality of subsection (7), regulations under this section may provide for all or any of the following matters:
(a) the taking of samples and the carrying out of tests, examinations and analysis of samples;
(b) the specification of the classes of persons to be responsible for taking such samples and for the carrying out of such tests, examinations and analysis;
(c) the specification of the certificate or other evidence to be given of the result of any such test, examination or analysis and the class or classes of person by whom such certificate or evidence is to be given;
(d) that any certificate or other evidence given or to be given in respect of any test, examination or analysis of any sample shall in relation to that sample be evidence, without further proof, of the result of the test, examination or analysis until the contrary is shown.
Service of notices.
15.—(1) Any notice required to be served or given by or under this Act shall be addressed to the person concerned and served or given in one of the following ways—
(a) by addressing it to him by name and delivering it to him,
(b) by leaving it at the address at which he ordinarily resides,
(c) by sending it by post in a prepaid registered letter addressed to him at the address at which he ordinarily resides,
(d) if an address for the service of notices has been furnished by him, by leaving it at, or sending it by prepaid registered post addressed to him to, that address,
(e) where the address at which he ordinarily resides cannot be ascertained by reasonable inquiry and notice is required to be served on, or given to, him in respect of any premises, by delivering it to a person over the age of 16 years of age resident in, or employed on, the premises or by affixing it in a conspicuous position on or near the premises.
(2) Where the name of the occupier of a premises cannot be ascertained by reasonable inquiry, a notice under this Act may be addressed to “the occupier”.
(3) For the purposes of this section, a company registered under the Companies Acts, 1963 to 1986, shall be deemed to be ordinarily resident at its registered office, and every other body corporate and every unincorporated body shall be deemed to be ordinarily resident at its principal office or place of business.
Obligation to give information.
16.—(1) A local authority may, for any purpose relating to their functions under this Act, by notice in writing, require—
(a) the occupier of any premises within their functional area, within such period (being not less than fourteen days after the date of the service of the notice) as may be specified in the notice, to furnish in writing to the authority such particulars as to—
(i) any activity or process being carried out on the premises,
(ii) any fireplaces in the premises, and
(iii) the fuels or other materials being burned on the premises,
as may be so specified,
(b) the occupier of any premises (other than a private dwelling) within their functional area, within such period as may be specified in the notice, to furnish in writing whether by periodic returns or otherwise, such information concerning any emission from the premises as may be so specified, and
(c) any person engaged in the production, treatment, importation, placing on the market, distribution or sale of any fuel to furnish in writing to the authority such particulars as to the type and quantity of fuel produced, treated, imported, placed on the market, distributed or sold by such person, as the case may be, within the functional area of the authority concerned as may be specified in the notice.
(2) A notice under this section, whether or not requiring periodic returns, shall not require the provision of information—
(a) at intervals of less than three months, or
(b) in respect of a period in excess of twelve months.
(3) Any person who has been served with a notice under this section and who furnishes any information in reply to the notice which he knows to be false or misleading in a material particular shall be guilty of an offence.
(4) Information furnished to a local authority pursuant to a notice under this section shall not be given by the local authority to any person other than a person prescribed.
The register.
17.—(1) Every local authority shall as soon as may be after the commencement of this Act establish and maintain a register (in this Act referred to as “the register”) for the purposes of this Act and shall make therein all such entries and additions as may, from time to time, be prescribed.
(2) The register shall be kept at the offices of the local authority and shall be made available for inspection by any person during office hours.
(3) When a request is made to a local authority for a copy of an entry in the register, the copy shall be issued to the applicant on the payment by him to the local authority of such fee (if any) as they shall fix not exceeding the reasonable cost of making the copy.
(4) Every document purporting to be a copy of an entry in the register and purporting to be certified by an officer of a local authority to be a true copy of the entry shall, without proof of the signature of the person purporting so to certify or that he was such officer, be received in evidence in any legal proceedings and shall, until the contrary is proved, be deemed to be a true copy of the entry and to be evidence of the terms of the entry.
(5) Evidence of an entry in the register may be given by production of a copy thereof certified pursuant to this section and it shall not be necessary to produce the register itself.
Research into air pollution.
18.—(1) A local authority may organise and conduct research, surveys or investigations into the nature and extent, the cause and effect, and the prevention or limitation, of air pollution and may establish and maintain educational programmes relating to such matters and may publish, or cause to be published, any information derived from any such research, surveys, investigations or educational programmes.
(2) A local authority may support or assist, by means of a financial contribution or otherwise, any person, or body of persons, engaged, or proposing to engage, in any research, survey or investigation into the nature and extent, the cause and effect, and the prevention or limitation, of air pollution or in any educational programme relating to such matters.
(3) The making of a financial contribution pursuant to subsection (2) shall be a reserved function.
(4) The Minister, with the consent of the Minister for Finance, may make a financial contribution to any person, or body of persons, engaged, or proposing to engage, in research, surveys or investigations into the nature and extent, the cause and effect, and the prevention or limitation, of air pollution or in any educational programme relating to such matters.
Expenses.
19.—The expenses incurred by the Minister in the administration of this Act shall be paid out of moneys provided by the Oireachtas to such extent as may be sanctioned by the Minister for Finance.
Consultation by local authorities.
20.—The Minister may make regulations requiring a local authority to consult with such bodies or persons as may be specified in relation to the performance of such of their functions under this Act as may be prescribed.
Transfer of functions.
21.—(1) The Minister may, by regulations, provide that any function conferred on a local authority under this Act shall, in addition to or in lieu of, being performed by a local authority, be performed by such other person (including the Minister or another local authority) or body of persons as may be specified.
(2) In particular and without prejudice to the generality of subsection (1), regulations under this section may provide for the performance of any function conferred on a local authority by this Act by a body established under the Local Government Services (Corporate Bodies) Act, 1971, for that purpose.
(3) Whenever regulations under this section are in force, a reference in this Act to a local authority shall be construed as including a reference to the person or body specified in the regulations and the function to which the regulations relate shall be a function of that person or body.
(4) Regulations under this section may contain such incidental, supplementary, consequential and transitional provisions (including provisions modifying any provision of this Act) as appear to the Minister to be necessary for the purpose of, in consequence of, or to give full effect to the regulations.
Power to make charges in relation to emissions.
22.—(1) A local authority may, in accordance with regulations made by the Minister under this section, make charges in relation to such emissions as may be specified in the regulations.
(2) Without prejudice to the generality of subsection (1), regulations under this section may make provision for all or any of the following matters:
(a) specify the emissions in relation to which a charge under this section may be imposed;
(b) specify the manner in which such a charge is to be imposed;
(c) specify the method in which the amount of such charge is to be calculated;
(d) enable a local authority to make different charges under this section in respect of different emissions and in different circumstances;
(e) specify the manner in which representations may be made to a local authority regarding the imposition of a charge under this section and provide for the procedure to be followed in respect of such representations;
(f) provide for the amendment, revocation or review of charges imposed under this section.
(3) A local authority may recover the amount of any charges made by them under this section from the person by whom they are payable as a simple contract debt in any court of competent jurisdiction.
PART II
General Provisions relating to Air Pollution
Prohibition on certain emissions.
23.—For the purpose of preventing or limiting air pollution, the Minister may, by regulations, prohibit either absolutely, or subject to such exceptions as may be specified in the regulations—
(a) such emissions as may be specified,
(b) the production, treatment, use, import, placing on the market, distribution or sale of any substance (other than a fuel) which may cause air pollution.
Obligation to prevent air pollution.
24.—(1) The occupier of any premises, other than a private dwelling, shall use the best practicable means to limit and, if possible, to prevent an emission from such premises.
(2) The occupier of any premises shall not cause or permit an emission from such premises in such a quantity, or in such a manner, as to be a nuisance.
(3) In any prosecution for a contravention of this section, it shall be a good defence to establish that—
(a) the best practicable means have been used to prevent or limit the emission concerned, or
(b) the emission concerned was in accordance with a licence under this Act, or
(c) the emission concerned was in accordance with an emission limit value, or
(d) the emission concerned was in accordance with a special control area order in operation in relation to the area concerned, or
(e) in the case of an emission of smoke, the emission concerned was in accordance with regulations under section 25, or
(f) the emission did not cause air pollution.
Prohibition on emission of smoke.
25.—(1) For the purpose of preventing or limiting air pollution, the Minister may, by regulations, prohibit or restrict the emission into the atmosphere of smoke from any premises.
(2) Without prejudice to the generality of subsection (1), regulations under this section may—
(a) specify the premises to which the regulations apply,
(b) specify the kind of smoke to which the regulations apply,
(c) prohibit, either absolutely or subject to specified exceptions, the emission of smoke from specified premises at specified times or periods,
(d) exempt, subject to or without conditions, from any of the provisions of the regulations emissions of smoke from specified premises for specified periods,
(e) prohibit or restrict, subject to such exceptions as may be specified, the burning of straw, waste or any other substance at such premises or at such times as may be specified.
(3) In any prosecution for a contravention of this section or of regulations made under this section, it shall be a good defence to establish that—
(a) the best practicable means have been used to prevent or to limit the emission concerned, or
(b) the emission concerned was in accordance with a licence under this Act, or
(c) the emission concerned was in accordance with an emission limit value, or
(d) the emission concerned was in accordance with a special control area order in operation in relation to the area concerned.
Power of local authority to require measures to be taken to prevent or limit air pollution.
26.—(1) Where it appears to a local authority that it is necessary so to do in order to prevent or to limit air pollution, the local authority may serve a notice under this section on the occupier of any premises from which there is an emission.
(2) In considering whether a notice should be served under this section, a local authority shall have regard to—
(a) any air quality management plan in relation to the area in which the premises are situate,
(b) any special control area order in operation in relation to the area in which the premises are situate,
(c) any relevant emission limit value,
(d) any relevant air quality standard,
(e) the availability of the means necessary for compliance with the notice, and
(f) the expense which would be incurred in complying with the notice.
(3) A notice pursuant to this section shall—
(a) specify the measures which appear to the local authority serving the notice to be necessary in order to prevent or to limit air pollution,
(b) direct the person on whom the notice is served to take such measures as may be specified in the notice to prevent or to limit air pollution, and
(c) specify a period (being not less than fourteen days commencing on the date of the service of the notice) within which such measures are to be taken.
(4) A notice under this section—
(a) may be served whether or not there has been a prosecution for an offence under this Act in relation to the emission concerned;
(b) shall not prejudice the initiation of a prosecution under this Act for an offence relating to the emission concerned.
(5) A person on whom a notice under this section has been served may, within such period as may be specified in the notice, make such representations in writing as he thinks fit to the local authority concerning the terms of the notice, and the local authority, having considered any such representations, may amend or revoke the notice.
(6) A person on whom a notice under this section has been served shall, within the period specified, comply with the requirements of the notice, or, as the case may be, the notice as amended.
(7) If a person on whom a notice under this section has been served does not, within the period specified in the notice or in the notice as amended, as the case may be, comply with the requirements of the notice, the local authority who served the notice may take such steps as they consider reasonable and necessary to secure compliance with the notice and may recover any expense thereby incurred from the person on whom the notice was served as a simple contract debt in any court of competent jurisdiction.
Power of local authority to take steps to prevent or limit air pollution.
27.—(1) Where it appears to a local authority that urgent measures are necessary to prevent or to limit air pollution affecting any part of their functional area or any adjoining area, the local authority may take such steps, carry out such operations or give such assistance as they consider necessary to prevent or to limit such pollution or to remedy the effects of any such pollution.
(2) Where a local authority take steps, carry out operations or give assistance under this section, the local authority may recover the costs of such steps, operations or assistance as a simple contract debt in a court of competent jurisdiction from such person as the local authority satisfy the court is the person whose act or omission necessitated such steps, operations or assistance.
Power of High Court in relation to air pollution.
28.—(1) The High Court may, on the application of a local authority or any other person, by order, prohibit or restrict an emission from any premises where the Court is satisfied that—
(a) the continuance of the emission (not being an emission which is in compliance with a licence granted under this Act) would give rise to a serious risk of air pollution, or
(b) the emission is an emission from industrial plant in contravention of the terms of a licence under this Act, or
(c) the emission is an emission from industrial plant for which a licence under this Act is required and in relation to which no such licence has been granted.
(2) An order made by the High Court on an application under this section may contain such provisions as to the Court seem appropriate and may, in particular, include provisions—
(a) requiring specific measures to be taken to eliminate or reduce the risk of air pollution;
(b) requiring any person to do, or not to do, or cease from doing, as the case may be, anything which the Court considers necessary and specifies in the order to ensure that the emission concerned is terminated or restricted or, as the case may be, complies with any relevant licence under this Act;
(c) in relation to the payment of costs.
(3) An application for an order under this section shall be by motion and the High Court when considering the matter may make such interim or interlocutory order as it considers appropriate.
(4) An order of the High Court made pursuant to this section shall have effect notwithstanding the terms of any permission given under any other enactment in relation to the premises concerned.
Notification of incident causing air pollution.
29.—(1) The occupier of any premises, other than a private dwelling, shall as soon as practicable after the occurrence of any incident which may cause air pollution notify the relevant local authority of the incident.
(2) In this section “incident” includes an accidental emission.
PART III
Licensing of Industrial Plant
Licence to operate industrial plant.
30.—(1) A person shall not operate industrial plant, other than existing industrial plant, on or after such day as may be prescribed unless a licence under this Act is in force in relation to the plant.
(2) The Minister may, by regulations, provide that existing industrial plant of such class as may be specified in the regulations shall not be in operation on or after such date as may be so specified unless a licence under this Act is in force in relation to the plant.
(3) Where regulations under subsection (2) come into operation, the operation of existing industrial plant to which the regulations relate shall, in the period before a licence in relation to the plant is granted or refused, be deemed not to have contravened the provisions of this Act: provided that, before the date specified in those regulations, an application has been made for a licence in respect of that plant and the requirements of regulations made under section 31 in relation to the application for the licence have been complied with by the applicant therefor.
Regulations regarding licences.
31.—(1) The Minister shall, by regulations, provide for the grant of licences by local authorities to persons who apply to the local authority concerned and who comply with the requirements of, or made pursuant to, the regulations in relation to such applications.
(2) Without prejudice to the generality of subsection (1), regulations under this section may make provision for all or any of the following:
(a) the form of application and of licence;
(b) the publication by applicants of such notices as may be specified;
(c) specifying the plans, documents and other information and particulars to be submitted by applicants;
(d) requiring applicants to furnish such additional information or particulars relating to their applications as the local authority may request;
(e) requiring the production of evidence to verify any information and particulars given by an applicant;
(f) requiring local authorities to furnish to the Minister and to any other specified persons any specified information in relation to any applications and the manner in which they have been dealt with, or to publish any specified notices in relation to applications for, and the granting or refusing of, licences;
(g) specifying the period within which applications shall be dealt with by local authorities;
(h) requiring an applicant to defray or contribute towards the cost of any investigation carried out by a local authority in relation to an application.
(3) (a) A person who, in relation to an application for a licence, or for a review of a licence, under this Act, or in relation to an appeal arising from such an application, makes a statement in writing which to his knowledge is false or misleading in a material respect, shall be guilty of an offence.
(b) Where a person is convicted of an offence under this subsection, any licence issued to that person consequent on the application or appeal in relation to which the information was furnished shall stand revoked from the date of the conviction.
(4) A defrayment or contribution the payment of which is required under regulations made under this section shall be payable on demand and, in default of being so paid, shall be recoverable as a simple contract debt in a court of competent jurisdiction.
Grant of licences.
32.—(1) Where
(a) an application is made to a local authority in accordance with regulations under section 31 for a licence under this Act,
(b) the requirements of, or made pursuant to, such regulations have been complied with,
the local authority may, subject to section 35 (2), decide to grant the licence subject to, or without, conditions or to refuse the application.
(2) In considering an application for a licence under this Act, the local authority shall have regard to—
(a) any air quality management plan in force in relation to the area concerned, and
(b) any special control area order in operation in relation to that area.
(3) A local authority shall not grant a licence in relation to industrial plant unless they are satisfied that—
(a) the best practicable means will be used to prevent or limit any emissions from the plant,
(b) any emissions from the plant will comply with any relevant emission limit value,
(c) any emissions from the plant will not result in the contravention of any relevant air quality standard,
and, where appropriate, the local authority shall attach conditions relating to the matters specified in paragraphs (a), (b) and (c) to the licence.
(4) Without prejudice to the generality of subsections (1) and (3), conditions attached to a licence under this Act may—
(a) specify the nature, composition, temperature, volume, rate and location of an emission;
(b) specify the periods during which an emission may, or may not, be made;
(c) specify a concentration of a pollutant in the ambient air, or a deposition rate, which shall not be exceeded;
(d) specify any matters relating to the design, construction and height of the chimneys, flues, stacks or other outlets through which an emission is to be made;
(e) specify the means (including the provision, operation, maintenance and supervision of plant, equipment and other facilities and the use of specified procedures) to be used for controlling an emission;
(f) require the provision, operation and maintenance of meters, gauges and other apparatus and other means for monitoring the nature, extent and effects of emissions;
(g) require the taking and analysis of samples, the making of measurements, the keeping of records and the furnishing of information to the local authority or to any other person who may be specified;
(h) specify the measures to be taken if there is a breakdown at industrial plant which may affect emissions from the plant;
(i) specify the type of fuel to be, or not to be, used, as the case may be;
(j) require the making of payments to the local authority concerned in relation to costs which may be incurred in monitoring, or otherwise in relation to, emissions;
(k) specify the latest date for complying with any conditions which are attached.
(5) Whenever a local authority, having considered an application for a licence under this Act, decide that—
(a) the licence shall be granted, they shall forthwith notify the applicant of the decision and of any conditions which may be attached to the licence and of the reasons for the attachment of any such conditions, or
(b) the licence shall not be granted, they shall forthwith notify the applicant of the decision and of the reasons for the decision.
Review of licences.
33.—(1) A local authority may review a licence under this Act at any time with the consent of the licensee, or at a time not less than three years from the date on which the licence was granted or, as the case may be, the date of the latest review of the licence.
(2) As soon as may be after they have completed a review under this section, a local authority may decide to grant pursuant to this Act a revised licence in substitution for the licence reviewed.
(3) Notwithstanding any other provision of this Act or any provision in a licence under this Act—
(a) such licence shall be reviewed by the local authority which granted it if—
(i) the local authority have reasonable grounds for believing that any emission from the industrial plant to which the licence relates constitutes a serious risk of air pollution, or
(ii) there has been a material change in the nature or the extent of the emission, or
(iii) there has been a material change, which could not have reasonably been foreseen when the licence was granted, in the air quality in the area in which the industrial plant to which the licence relates is situate, or
(iv) further and better evidence, which was not available when the licence was granted, has become available relating to a pollutant present in the emission concerned or the effects of such pollutant, or
(v) the licensee applies to the local authority concerned to review the licence;
(b) if—
(i) a relevant emission limit value is specified in regulations under section 51 in relation to any pollutant emitted from the industrial plant to which the licence relates, or
(ii) a relevant air quality standard is specified in regulations made under section 50 in relation to any pollutant emitted from the industrial plant to which the licence relates, or
(iii) a special control area order affecting any pollutant emitted from the industrial plant to which the licence relates comes into operation in relation to the area in which the industrial plant is situate, or
(iv) any directions are issued by the Minister specifying the best practicable means for the prevention or limitation of an emission to which the licence relates,
the local authority shall, as soon as may be after the regulations are made, the order comes into operation or the directions are given, as the case may be, review the licence,
and subsection (2) shall apply to a review under this subsection.
(4) (a) The Minister may make regulations for the purpose of this section.
(b) Without prejudice to the generality of paragraph (a), regulations under this subsection may make provision in relation to all or any of the following matters—
(i) the giving of notice by a local authority of their intention to review a licence,
(ii) requiring a statement in such a notice that representations relating to the review may be made within a specified period, and
(iii) requiring local authorities to publish any specified notices with respect to a decision to grant a revised licence.
(5) In the review of a licence under this section, a local authority shall have regard to—
(a) any change in air quality in their functional area, and
(b) the development of technical knowledge in relation to air pollution and the effect of pollutants.
Appeals.
34.—(1) Any person may, at any time before the expiration of the prescribed period, appeal to An Bord Pleanála in relation to the granting or refusing of a licence under section 32, or to the granting of a revised licence under section 33.
(2) An Bord Pleanála, after consideration of an appeal under this section, shall either (as it thinks proper) refuse the appeal or give appropriate directions to the local authority concerned relating to the granting or refusing of a licence, and, where such directions are given, the local authority concerned shall, as soon as may be after the receipt of the directions, comply with them.
(3) The Minister may, by regulations, make provision for any matter of procedure in relation to an appeal under this section.
(4) Regulations under this section may contain such incidental, supplemental, consequential and transitional provisions (including modification or application of any provision of the Local Government (Planning and Development) Acts, 1963 to 1983) as appear to the Minister to be necessary.
Fees.
35.—(1) The Minister may make regulations providing for—
(a) the payment to local authorities of prescribed fees in relation to applications for—
(i) licences under this Act, or
(ii) reviews of licences under section 33,
(b) the payment to An Bord Pleanála of prescribed fees in relation to appeals under section 34,
and the regulations may provide for different fees in relation to cases of different classes or descriptions, for exemption from the payment of fees in specified circumstances, for the waiver, remission or refund (in whole or in part) of fees in specified circumstances and for the manner in which fees are to be disposed of.
(2) Where under regulations under this section a fee is payable to a local authority by an applicant in respect of an application referred to in subsection (1), the application shall not be decided by the authority unless the authority are in receipt of the fee.
(3) Where under regulations under this section a fee is payable to An Bord Pleanála by an appellant in respect of an appeal by him to An Bord Pleanála, the appeal shall be invalid unless the prescribed fee is received by An Bord Pleanála before the expiration of the prescribed period for making the appeal.
Limit on duration of licence.
36.—(1) Subject to subsection (2), where industrial plant to which a licence under this Act relates—
(a) has not commenced operations within three years after the date on which the licence was granted, or
(b) has ceased operations for a period of not less than three years,
the licence shall cease to have effect.
(2) Subsection (1) shall not have effect if a licence was granted prior to the construction, or to the commencement of the operations, of industrial plant and the local authority, having regard to the nature and extent of the construction works and any other relevant consideration, are satisfied that the licence should continue to be in force for such period as the local authority consider reasonable, having regard to all the circumstances.
Change of ownership of industrial plant.
37.—(1) Where a licence is granted under this Act, then, except as may be otherwise provided by the licence, the grant of the licence shall enure for the benefit of the industrial plant and of all persons for the time being interested therein, but without prejudice to the provisions of section 33 in relation to the review of the licence.
(2) Where a person to whom a licence was granted under this Act ceases to hold, or transfers to another person, his interest in the industrial plant to which the licence relates, he shall forthwith give notice to the local authority by whom the licence was granted—
(a) that he no longer holds an interest in the industrial plant concerned, and
(b) of the name of the person to whom his interest in the plant has been transferred.
Alterations at industrial plant.
38.—(1) The occupier of industrial plant—
(a) in respect of which a licence is in force under this Act, or
(b) which is existing industrial plant the operation of which is not required to be licensed under regulations made under section 30,
shall give notice in writing to the local authority in whose functional area the industrial plant is situate if he proposes to—
(i) effect any alteration to, or reconstruction of, the plant, or
(ii) effect any alteration in the processes being carried out therein,
and such alteration or reconstruction would, or is likely to, materially increase emissions from the plant or cause new emissions therefrom.
(2) Whenever a local authority receive a notice under this section, the local authority, notwithstanding any other provision of this Act, may—
(a) if there is a licence in force in respect of the industrial plant concerned, either review the licence under section 33 or direct the occupier to apply for a new licence, or
(b) if there is no such licence in force, direct the occupier to apply for a licence,
and the occupier shall not effect the alteration or reconstruction until the review has been completed or the new licence or licence, as the case may be, has been granted.
(3) Where a local authority decide pursuant to subsection (2) to review a licence or to direct the occupier concerned to apply for a new licence or, as the case may be, a licence, the local authority shall, within one month of the receipt by them of the notice under this section, inform the occupier concerned accordingly and, if such occupier is not so informed, subsection (2) shall cease to have effect in relation to the alteration or reconstruction specified in the notice.
PART IV
Special Control Areas
Special control areas.
39.—(1) Where it appears to a local authority that the whole or any part of their functional area should, in order to prevent or limit air pollution, be declared to be a special control area, they may make an order (in this Act referred to as a “special control area order”) under this section.
(2) In deciding whether it is necessary or expedient to make a special control area order in relation to any area, the local authority shall have regard to—
(a) the incidence and cause of air pollution in the area, and
(b) any air quality management plan in force in relation to the area, and
(c) any relevant air quality standard, and
(d) the availability of the means necessary for compliance with the order, and
(e) the expense which would be incurred in complying with the order.
(3) A special control area order shall specify—
(a) the area to which it relates,
(b) the pollutant with which it is concerned, and
(c) the measures to be taken and the requirements which shall have effect in the area to which the order relates.
(4) The Minister may, if he considers it expedient so to do in order to prevent or limit air pollution, having regard to the provisions of paragraphs (a), (b), (c), (d) and (e) of subsection (2), direct a local authority to make a special control area order in relation to such area and such pollutant as may be specified in the direction and may, if he thinks fit, further direct the order should specify that particular measures shall be taken and that particular requirements shall have effect in such area and the local authority concerned shall comply with any direction of the Minister given under this subsection within such period as may be specified in the direction.
(5) A local authority may, with the consent of any other local authority concerned, make a special control area order in relation to an area which is within the functional area of the other authority.
(6) (a) Subject to paragraph (b), a local authority may, by order under subsection (1), revoke or amend a special control area order.
(b) A local authority may revoke or amend a special control area order which is made pursuant to a direction of the Minister under subsection (4) only with the consent of the Minister.
(7) A local authority shall, from time to time and at least once in every five years, review every special control area order made by them, and which is in operation, for the purpose of deciding whether it is necessary or desirable to revoke or amend the order.
(8) The making, revoking or amending of a special control area order and the giving of consent under subsection (5) to the making of such an order shall be a reserved function.
Special control area orders.
40.—(1) Without prejudice to the provisions of section 39 (3), a special control area order may make provision for the following:
(a) prohibit, subject to such exceptions or limitations as may be specified, the emission of a specified pollutant from specified classes or descriptions of premises;
(b) prohibit, subject to such exceptions or limitations as may be specified, the burning other than in an authorised fireplace of any fuel other than an authorised fuel;
(c) prohibit, subject to such limitations and exceptions as may be specified, the burning of straw, waste or any other substance;
(d) make, having regard to all the circumstances, different provisions for different parts of the area to which the order relates and for different premises or classes of premises;
(e) exempt, with or without conditions, such premises or classes of premises as may be specified from all or any of the requirements of the order;
(f) exempt, with or without conditions, such fireplaces or such classes of fireplaces as may be specified from all or any of the requirements of the order;
(g) specify the types or qualities of fuels to be, or not to be, burnt in such fireplaces or such classes of fireplaces as may be specified;
(h) specify the conditions subject to which, or the purposes for which, specified fuels or classes of fuels may be burnt in the special control area;
(i) prohibit or limit the carrying on of such operations or processes as may be specified in the special control area or specify the conditions under which such operations or processes may be carried on;
(j) prohibit or restrict the sale or delivery in a special control area of specified fuels or classes of fuels.
(2) The Minister may, by regulations, declare that any particular class of fireplace shall, subject to such conditions as may be specified in the regulations, be an authorised fireplace for the purposes of a special control area order.
(3) The Minister may, by regulations, declare that any particular type of fuel shall be an authorised fuel for the purposes of a special control area order.
(4) Any person who contravenes any provision of a special control area order which is in operation shall be guilty of an offence.
(5) In any proceedings relating to the contravention of a special control area order and involving the emission of a pollutant, it shall be a good defence to establish that—
(a) the emission of the pollutant was not caused by the use of a fuel other than an authorised fuel;
(b) the emission of the pollutant was caused by the burning of a fuel other than an authorised fuel in an authorised fireplace in accordance with the conditions (if any) subject to which the fireplace was declared to be an authorised fireplace.
Confirmation of special control area order.
41.—(1) As soon as may be after they have made a special control area order, a local authority shall publish in one or more newspapers circulating in the area to which the order relates a notice—
(a) stating that a special control area order has been made and specifying the area to which the order relates;
(b) naming a place where a copy of the order and any map or plan referred to therein may be inspected free of charge by any interested person;
(c) specifying the times and the period, being not less than one month, during which the order and the map and plan (if any) can be so inspected;
(d) specifying the period, being not less than one month, within which, and the manner in which, any person affected by the order may make objections thereto;
(e) stating that the order will not come into operation until it has been confirmed by the Minister;
(f) stating that if objections are duly made to the order and are not withdrawn, the Minister, before confirming or refusing to confirm the order, will cause an oral hearing to be held at which any person who has, within the period specified in the notice, made an objection to the order will be afforded an opportunity of being heard.
(2) As soon as may be after the period for the making of objections has expired, the local authority concerned shall transmit the special control area order to the Minister for confirmation and, when so transmitting the order, they shall also transmit to the Minister any objections which have, within the specified period, been made and have not been withdrawn.
(3) Where no objections have, within the specified period, been made to the making of the special control area order or all such objections have been withdrawn, the Minister may—
(a) by order confirm the special control area order with or without modifications, or
(b) refuse to confirm the order, or
(c) if he considers it desirable so to do, before confirming, or refusing to confirm, the order, cause an oral hearing to be held in relation to the order.
(4) Where objections have, within the specified period, been made to the making of the special control area order and such objections have not been withdrawn, the Minister shall cause an oral hearing to be held in relation to the order and shall afford each person who duly made an objection to the order the opportunity of being heard.
(5) When he has considered the report (including any recommendation contained therein) of the person who held the oral hearing, the Minister may, by order, confirm the special control area order, with or without modifications, or he may refuse to confirm it.
(6) In deciding whether or not to confirm a special control area order, the Minister shall have regard to the provisions of paragraphs (a), (b), (c), (d) and (e) of section 39 (2).
(7) Every order made by the Minister under this section confirming a special control area order shall specify a date, being not less than six months after the date of the making of the confirming order, on which the special control area order shall come into operation: provided always that the date so specified in relation to a special control area order which—
(a) revokes a previous special control area order, or
(b) exempts specified areas or specified buildings or classes of buildings from all or any of the requirements of a special control area order,
may be the date of the making of the confirming order or any date subsequent to that date.
(8) Notice of the making of an order confirming a special control area order and of the date on which the special control area order shall come into operation shall be published, given or served by the local authority concerned in such manner as the Minister may direct.
Oral hearings.
42.—(1) An oral hearing in relation to a special control area order held pursuant to section 41 (3) or (4) shall be conducted by a person appointed for that purpose by the Minister.
(2) A person conducting an oral hearing may require any officer of a local authority concerned to give to him any information which he reasonably requires for the purpose of the hearing, and it shall be the duty of the officer concerned to comply with the requirement.
(3) (a) A person conducting an oral hearing may visit and inspect premises for any purpose he considers necessary in relation to the special control area order which is the subject of the hearing.
(b) Any person who obstructs the exercise of the power conferred by this subsection shall be guilty of an offence.
(4) A person conducting an oral hearing may take evidence on oath and for that purpose may administer oaths, and a person giving evidence shall be entitled to the same immunities and privileges as if he were a witness before the High Court.
(5) (a) Subject to paragraph (b), a person conducting an oral hearing may, by giving notice in that behalf in writing to any person, require that person to attend at such time and place as is specified in the notice to give evidence in relation to any matter in question at the hearing or to produce any books, deeds, contracts, maps, plans, or other documents in his possession, custody or control which relate to any such matter.
(b) The following provisions shall have effect for the purposes of the foregoing paragraph:
(i) it shall not be necessary for a person to attend in compliance with a notice at a place more than ten miles from his ordinary place of residence unless such sum as will cover the reasonable and necessary expenses of the attendance have been paid or tendered to him;
(ii) the local authority shall, at the request of the person conducting the oral hearing, pay or tender to any person whose attendance is required such sum as the person conducting the hearing considers will cover the reasonable and necessary expenses of the attendance;
(iii) any person who in compliance with a notice has attended at any place shall, save in so far as the reasonable and necessary expenses of the attendance have already been paid to him, be paid those expenses by the local authority, and those expenses, save as aforesaid, shall, in default of being so paid, be recoverable as a simple contract debt in any court of competent jurisdiction;
(iv) every person to whom a notice has been given who refuses or who wilfully neglects to attend in accordance with the notice or who wilfully alters, suppresses, conceals or destroys any document to which the notice relates or who, having so attended, refuses to give evidence or refuses or wilfully fails to produce any document to which the notice relates shall be guilty of an offence.
(6) Where an oral hearing is conducted on behalf of the Minister under this Act by a person appointed for the purpose by the Minister, the person so appointed shall make to the Minister a written report on the hearing and shall include in his report a recommendation relating to the matter with which the hearing was concerned.
Relaxation or suspension of special control area order.
43.—(1) If, at any time, it appears to the Minister to be necessary so to do, he may, by order, suspend or relax the operation of a special control area order in relation to the whole or any part of a special control area for such period as may be specified in the order.
(2) Before making an order under subsection (1), the Minister shall, unless because of the urgency of the situation such consultation is not practicable, consult the local authority concerned.
(3) The Minister may by order amend or revoke an order under this section (including this subsection).
(4) A local authority concerned shall publish, in such manner as the Minister may direct, notice of the making of an order under this section.
Power of local authority to require alterations to premises.
44.—(1) A local authority may, by notice in writing served on the person who appears to them to be the owner or occupier of a premises which—
(a) is within a special control area, or
(b) will be, when a special control area order which has been confirmed by the Minister comes into operation, within such an area,
require the owner or occupier of the premises to carry out such alterations to the premises as may be specified in the notice.
(2) A notice under subsection (1) shall—
(a) specify the works which appear to the local authority to be necessary in order to comply with the special control area order;
(b) direct the person on whom the notice is served to carry out, or to cause to be carried out, such works as are specified in the notice;
(c) specify a period (being not less than twenty-eight days beginning on the date of service of the notice and ending not sooner than the date on which the special control area order comes into operation) within which such works are to be completed;
(d) specify that representations in writing in relation to the terms of the notice may be made by the person on whom the notice is served to the local authority within the period stated in the notice.
(3) The local authority shall consider any representations duly made to them within the period specified in the notice and, having considered such representations if they consider it reasonable so to do, may amend or revoke the notice.
(4) A person on whom a notice under this section is served shall, within the period specified, comply with the requirements of the notice or, as the case may be, the notice as amended.
(5) Where a person on whom a notice has been served under this section does not, within the period specified, comply with the requirements of the notice or, as the case may be, the notice as amended, the local authority that served the notice may take such steps as they consider reasonable and necessary to secure such compliance.
(6) A local authority may recover any expenses incurred by reason of the exercise of the powers conferred on them by subsection (5) from the person on whom a notice under this section was served as a simple contract debt in any court of competent jurisdiction.
Financial assistance for certain works.
45.—(1) The Minister may, with the consent of the Minister for Finance, make a scheme or schemes for the granting of financial assistance in relation to the whole or any part of the costs incurred by the owner or occupier of a premises situate within a special control area in order to enable the premises to comply with the requirements of a special control area order or a notice under section 44.
(2) Without prejudice to the generality of subsection (1), the following provisions shall apply to a scheme under this section:
(a) such scheme may provide for its administration in whole or in part by a local authority or by such other person or body (including the Minister) as may be specified in the scheme;
(b) such scheme may provide for the determination by the Minister or by any other person (including an arbitrator) of any dispute which arises as to the entitlement of any person to, or the amount of, any financial assistance payable under the scheme;
(c) notice of the making of such a scheme shall be published in such a manner as to the Minister seems appropriate.
(3) The Minister may, with the consent of the Minister for Finance, amend or revoke a scheme made by him under this section.
PART V
Air Quality Management Plans and Standards
Air quality management plans.
46.—(1) A local authority may, and shall if the Minister so directs, make, in relation to all or any part of their functional area, a plan (in this Act referred to as an “air quality management plan”) for the preservation or the improvement of the air quality in the area to which such plan relates.
(2) A local authority may, from time to time as occasion demands, and shall at least once in every five years after the date of the making of an air quality management plan, review the plan and make in it any variations (whether by way of alteration, addition or deletion) which they consider proper or replace it by a new plan.
(3) Two or more local authorities may, in relation to all or any part of their functional areas, jointly make an air quality management plan and the provisions of subsection (2) shall apply to any such plan.
(4) An air quality management plan shall contain such objectives as seem to the local authority concerned to be reasonable and necessary for the prevention or limitation of air pollution or the preservation or improvement of air quality in the area to which such plan relates but shall not contain any objective which would be inconsistent with any regulations made under sections 50 or 51 or with any special control area order in operation in relation to such area.
(5) The making, review, variation or replacement of an air quality management plan shall be a reserved function.
Power of Minister in relation to an air quality management plan.
47.—The Minister may—
(a) direct a local authority, or two or more local authorities jointly, to make an air quality management plan;
(b) require a local authority or, as the case may be, two or more local authorities, to vary (whether by alteration, addition or deletion) an air quality management plan made or jointly made by them in such manner as the Minister may specify or to replace the plan by a new plan;
(c) require that an air quality management plan made or to be made by two or more local authorities be co-ordinated in such manner and in relation to such matters as the Minister may specify;
and a local authority shall comply with every such direction or requisition of the Minister.
Publication of notices in relation to air quality management plans.
48.—(1) Where a local authority propose to make, vary or replace an air quality management plan, the local authority shall cause to be published in at least one newspaper circulating in their functional area a notice of the proposal, as the case may be, to make, vary or replace the plan.
(2) A notice under subsection (1) shall state that—
(a) a copy of the proposed plan or, as the case may be, of the variation to the plan may be inspected at a stated place and at stated times during a stated period;
(b) representations in relation to the proposed plan or to the proposed variation of the plan made to the local authority within the stated period will be taken into consideration before the making of the plan or, as the case may be, the variation of the plan (and any such representations shall be taken into consideration accordingly).
(3) When the local authority have considered any representations duly made to them within the period stated in the notice under subsection (2), the local authority may, as they think fit, make, vary or replace the plan with or without amendment.
(4) (a) Any person may request a local authority for a copy, or extract, of an air quality management plan and the local authority shall comply with such request.
(b) A document purporting to be a copy of an air quality management plan or to be an extract from such plan and to be certified by an officer of a local authority as a true copy shall be prima facie evidence of the plan or extract, as the case may be, and it shall not be necessary to prove the signature of such officer or that he was in fact such officer.
(c) Evidence of an air quality management plan or of an extract from such plan may be given by production of a copy thereof certified pursuant to this subsection and it shall not be necessary to produce the plan itself.
(d) Where a request is made to a local authority for a copy under this subsection, the copy shall be issued to the applicant on payment by him to the local authority of such fee (if any) as they shall fix not exceeding the reasonable cost of making the copy.
Duty of local authority on making, varying or replacing an air quality management plan.
49.—As soon as may be after a local authority have made, varied or replaced an air quality management plan, the local authority shall transmit a copy of the plan or the new plan, as the case may be, to the Minister and to such other persons as may be prescribed.
Air quality standards.
50.—(1) The Minister may, for the purposes of this Act, by regulations specify standards (in this Act referred to as “air quality standards”) and different air quality standards may be specified for different areas or classes of areas, different circumstances or classes of circumstances or for different periods of time.
(2) Without prejudice to the provisions of subsection (1), regulations under this section may make provision for all or any of the following matters—
(a) relate an air quality standard to a particular pollutant or to a combination of pollutants;
(b) express an air quality standard as a concentration in the air, or as a mass depositing on a specified area, of the particular pollutant or combination of pollutants which is not to be exceeded for specified periods and under specified conditions;
(c) provide that the Minister may suspend, relax or modify an air quality standard for such period and in such circumstances as may be specified either generally or in relation to a particular area.
(3) Where it appears as a result of monitoring carried out under section 54, or otherwise, that an air quality standard is being, or is likely to be, exceeded in any part of their functional area, a local authority shall—
(a) include in any air quality management plan prepared by them such objectives as the local authority consider appropriate for the improvement of the quality of the air and for the prevention or limitation of air pollution in the affected area so that within such period as the local authority consider reasonable, or such period as the Minister may direct, the air quality standard will not be exceeded, and
(b) take such other steps as may be appropriate in discharge of their functions under this Act to secure compliance with the air quality standard.
Emission limit values.
51.—(1) The Minister may, for the purposes of this Act, by regulations specify limits (in this Act referred to as “emission limit values”) for emissions and different emission limit values may be specified for different areas or classes of areas, different premises or classes of premises, different circumstances or classes of circumstances or for different periods of time.
(2) An emission limit value may relate to a particular pollutant or to a combination of pollutants.
(3) Where a relevant emission limit value is specified in regulations under this section, the occupier of any premises from which the pollutant or, as the case may be, the combination of pollutants, is emitted into the atmosphere shall take such steps as may be necessary to ensure that such emissions do not exceed the emission limit value concerned.
(4) The Minister may give directions to a local authority in relation to the sampling, analysis and measurement methods to be used in determining whether emissions of any pollutant or combination of pollutants comply with an emission limit value specified in relation to that pollutant or combination of pollutants and it shall be the duty of the local authority concerned to comply with any such directions.
(5) Regulations under this section may provide that the Minister may suspend, relax or modify an emission limit value for such period and in such circumstances as may be specified either generally or in relation to premises of a particular class or in relation to a particular area.
Directions by Minister in relation to air pollution.
52.—(1) The Minister shall, from time to time as occasion demands, issue such general directions as to policy in relation to the prevention and limitation of air pollution as he considers necessary.
(2) In performing their functions under this Act, a local authority and An Bord Pleanála shall have regard to any directions issued by the Minister under this section.
(3) Whenever the Minister gives a direction under this section, he shall—
(a) cause a copy of the direction to be transmitted to each local authority and to An Bord Pleanála,
(b) cause to be published in Iris Oifigiúil a notice of the issue of the direction.
(4) Whenever the Minister causes a notice to be published pursuant to subsection (3) (b), such notice shall specify where a copy of the direction to which it relates may be obtained and the fee (if any) payable in respect of such copy.
Regulations in relation to fuel.
53.—(1) The Minister, for the purpose of preventing or limiting air pollution, may make regulations in relation to—
(a) the standard, specification, composition and contents of any fuel of a type which is used in mechanically propelled vehicles or in mechanically propelled vehicles of a particular class or description or mechanically propelled vehicles in a particular area or a particular class of areas;
(b) the standard, specification, composition and contents of any type of fuel which is burnt in fireplaces or in fireplaces of a particular class or description or in fireplaces in a particular area or particular class of areas;
(c) the production, treatment, importation, placing on the market, distribution or sale of fuel of any type or description;
(d) the burning, or the prohibition of burning, in fireplaces, or in fireplaces of a particular class or description of a fuel, or of a fuel which does not comply with such requirements as may be specified;
(e) the use, or the prohibition of the use, in mechanically propelled vehicles, or in mechanically propelled vehicles of a particular class or description of a fuel, or of a fuel which does not comply with such requirements as may be specified.
(2) Without prejudice to the generality of subsection (1), regulations under this section may—
(a) prohibit the sale, distribution, use or burning of a fuel which does not conform with such standards as may be specified either generally or in a specified area or class of areas;
(b) specify different standards in relation to different fuels;
(c) specify the tests which shall be conducted to establish whether a fuel complies with the provisions of regulations made under this section;
(d) provide for exemption in such circumstances or in such cases as may be specified from all or any of the provisions of the regulations;
(e) require that specified information in relation to fuels be displayed at such places and in such a manner as may be specified;
(f) provide for the enforcement of the regulations (or of any provision thereof) by persons specified in the regulations and provide for the powers of such persons and any person authorised by such persons;
(g) provide for the issue of certificates by such persons as may be specified;
(h) provide for the keeping of records by specified persons and for the examination of such records;
(i) provide for the examination of such premises, records and vehicles as may be specified and for the requirements that may be made of the owner or other person in charge of premises, records or vehicles so specified for the purpose of such examination;
(j) provide for the taking of samples of fuels at specified premises or from specified vehicles;
(k) provide for the colouring of different fuels to be used in different mechanically propelled vehicles or classes of mechanically propelled vehicles;
(l) provide that any certificate or other evidence given or to be given in respect of any test, examination or analysis of any sample taken or conducted pursuant to the regulations shall be evidence, without further proof, of the result of the test, examination or analysis, until the contrary is shown.
PART VI
Miscellaneous
Monitoring of air quality and emissions.
54.—(1) A local authority shall carry out, or cause to be carried out, such monitoring of—
(a) air quality, and
(b) the nature, extent and effects of emissions,
as the local authority may consider necessary for the performance of their functions under this Act or as they may be directed by the Minister to carry out.
(2) A local authority shall keep and maintain. or cause to be kept and maintained, such records of any monitoring carried out under subsection (1) as they consider reasonable and necessary.
(3) A local authority may require the occupier of any premises, other than a private dwelling, from which there is an emission to carry out such monitoring of the nature, extent and effect of the emission and of the air quality as the local authority consider necessary and to keep and to supply to the local authority such records of the monitoring as the local authority consider necessary.
(4) A local authority shall, if so directed by the Minister, supply to him or to any person specified by him at such intervals and in such manner as the Minister may direct records of any monitoring carried out under this section.
(5) Where an air quality standard applies to their functional area or to any part thereof, the local authority shall, in relation to the area of application of the air quality standard, make such arrangements for monitoring as may be necessary so that the local authority can determine if the air quality standard is being complied with.
(6) The Minister may give directions to a local authority in relation to—
(a) the number and location of places within an area at which monitoring is to be carried out,
(b) the manner in which sampling, measuring and analysing for the purposes of this section is to be carried out,
(c) the equipment to be used for the purposes of such sampling, measuring or analysing,
and the local authority shall comply with every such direction of the Minister.
(7) The Minister may monitor, or make such arrangements for the monitoring of, air pollution as seem to him to be necessary or desirable.
Power of court to authorise works.
55.—(1) If the occupier of any premises is unable, without the consent of some other person, to carry out works which he is required to carry out in order to comply with the provisions of this Act, and such other person withholds his consent to the carrying out of the works, the occupier may apply to the District Court for an order under this section.
(2) If, on the hearing of an application under subsection (1), the District Court determines that the consent of the other person has been unreasonably withheld, the District Court may, in its discretion, deem the consent to have been given and direct the occupier of the premises to carry out the works.
(3) If the occupier of any premises is required to carry out, pursuant to this Act, works on the premises, and such occupier considers that the cost of such works should be borne, in whole or in part, by the owner of the premises or some other person who has an interest therein, or by the owner or occupier of an adjoining premises, he may apply to a court of competent jurisdiction for an order directing that the whole, or such part as may be specified in the order, of the cost of the works be borne by, as the case may be, the owner of the premises, the other person interested therein or the owner or occupier of the adjoining premises; and the court shall make such order on the hearing of the application as it considers just having regard to all the circumstances of the case.
Application of Local Government (Planning and Development) Act, 1963.
56.—(1) Where a licence under this Act is granted in relation to industrial plant and a permission under Part IV of the Local Government (Planning and Development) Act, 1963, has been granted in respect of the same plant, any conditions attached to that permission shall, in so far as they relate in any way to air pollution, cease to have effect.
(2) The grant of a permission under Part IV of the Local Government (Planning and Development) Act, 1963, in relation to any premises shall not prejudice, affect or restrict in any way the application of any provision of this Act to such premises.
Transitional provisions in relation to alkali, etc. work.
57.—(1) The provisions of the Alkali, etc. Works Regulation Act, 1906, in relation to emissions shall, notwithstanding the repeal of that Act by this Act, apply to every relevant work until a licence under this Act is granted in respect of the work.
(2) Notwithstanding the provisions of subsection (1), the provisions of section 9 of the Alkali, etc. Works Regulation Act, 1906, in relation to the registration of works shall not apply to a relevant work.
(3) A local authority in whose functional area a relevant work is situated shall, on and after the commencement of this section, be responsible for ensuring that it is carried on in accordance with the provisions of subsection (1).
(4) In this section “relevant work” means existing industrial plant which is either—
(a) an alkali work within the meaning of the Alkali, etc. Works Regulation Act, 1906, or
(b) a work listed in the First Schedule to that Act.
Transitional provisions in relation to certain licensable works.
58.—The provisions of section 10 of the Local Government (Sanitary Services) Act, 1962, and of the Control of Atmospheric Pollution, (Licensing) Regulations, 1985, shall, notwithstanding the repeal by this Act of that Act and those regulations, apply to existing industrial plant which is used for the purpose of any trade, works or process within the meaning of those regulations until a licence under this Act is granted in respect of the plant concerned.
Savers.
59.—(1) Nothing in this Act shall legalise any act or default that would, but for this Act, be deemed to be a nuisance, or otherwise be contrary to law, or deprive any person of any remedy to which he would have been entitled if this Act had not been passed.
(2) A person shall not be entitled solely by reason of the grant of a licence under this Act to construct, alter or operate industrial plant or to carry on any other operation or activity.
(3) Save for section 28 (4), nothing in this Act shall affect the operation of the Safety in Industry Acts, 1955 and 1980, in relation to factories or to any other premises to which those Acts apply.
