CUID I.
Reamhraiteach agus Generalta.

1.—(1) Féadfar an tAcht Arachais (Breac-Dhíomhaointeas), 1942, do ghairm den Acht so.
(2) Tiocfaidh an tAcht so (lasmuich d'ailt 18 agus 28) i ngníomh díreach tar éis a rithte.
(3) Tiocfaidh alt 18 den Acht so i ngníomh an lá ceapfar chuige sin le hordú ón Aire.
(4) Tiocfaidh alt 28 den Acht so i ngníomh an lá ceapfar chuige sin le hordú ón Aire.
Lóiriú i gcoitinne.
2.—(1) San Acht so—
cialluíonn an abairt “an tAire” an tAire Tionnscail agus Tráchtála;
cialluíonn an abairt “oifig áitiúil” malartán fostaíochta no oifig eile is oifig áitiúil chun crícheanna rialachán ar n-a ndéanamh fé alt 6 den Unemployment Insurance Act, 1920, maidir le bailiú síntiús fén Acht san;
cialluíonn an abairt “oifigeach áitiúil” oifigeach a bheidh de thurus na huaire i bhfeighil oifige áitiúla;
cialluíonn an abairt “seachtain chaileandair” an tréimhse de sheacht lá thosnuíonn ar uair an mheáin oíche idir an Domhnach agus an Luan;
cialluíonn rud do bheith “orduithe” é bheith orduithe le rialacháin a dhéanfaidh an tAire fén Acht so.
(2) Is tuigthe chun crícheanna an Achta so gan a shé bliana déag do bheith slán ag duine go dtí tosach an séú lá déag de laethe cothruim a bhreithe agus mar sin d'aoiseanna eile.
(3) Déanfar na tagairtí atá san Acht so d'aon achtachán do léiriú mar thagairtí don achtachán san ar n-a leasú no ar n-a leathnú le haon achtachán iar-aimseardha.
Fostaíocht sa bhfoirgneoireacht.
3.—San Acht so cialluíonn an abairt “fostaíocht sa bhfoirgneoireacht” fostaíocht ar obair de chinéal is gnáth le foirgneoirí no connarthóirí foirgneoireachta do ghlacadh de láimh no do dhéanamh, agus foluíonn fostaíocht ar obair de na cinéil seo leanas, sé sin le rá:—
(a) gach obair a bhaineann le foirgnimh do dhéanamh, d'ath-dhéanamh, d'athrú, do dheisiú, do phínteáil, d'óirnéaladh no do leagadh;
(b) gach obair a bhaineann le hearraí feistis, píopaí, coimeádáin, feadáin, miotal-shranga no ionstruimí (le n-a n-áirmhítear fearas no inneallra meán-téidhimh no coimeádáin tein-abhair i gceangal leis an gcéanna), le haghaidh téidheamh, soillsiú, soláthar comhachta no uisce aon fhoirgnimh, do shuidheamh, d'athrú, d'fheistiú, do dheisiú, do phínteáil, d'óirnéaladh, do chothabháil no do leagadh sa bhfoirgneamh san no ar a láithreán ach gan aon obair d'áireamh a bhaineann le mór-phíopaí puiblí soláthair uisce, gáis no leictreachais do dhéanamh no do leagadh síos no le foirgnimh agus a láithreáin do cheangal le mórphíopaí den tsórt san;
(c) gach obair is gnáth le foirgneoir no connarthóir foirgneoireachta do dhéanamh no do ghlacadh de láimh—
(i) chun láithreáin i gcóir foirgneamh do ghlanadh agus do leagadh amach,
(ii) chun fothaí do dhéanamh ar na láithreáin sin,
(iii) chun gach camra no dréin no obair eile, bheidh le húsáid maidir le sláintíocht foirgneamh no díochur cosamair, do dhéanamh, d'ath-dhéanamh, do dheisiú agus do chothabháil sna láithreáin sin,
(iv) chun fallaí no fáil teorann do thógáil ar na láithreáin sin chun úsáide no cosanta no órnáidithe foirgneamh,
(v) chun bóithre agus cosáin do dhéanamh laistigh de theoranta na láithreán san;
(d) gach obair a bhaineann le déanamh, athrú, feistiú no deisiú earraí adhmaid, cloiche oibrithe, marmair, slinne, plástair, stroighne (le n-a áirmhítear bluic coincréid) no mianaigh stroighniúil bheidh le húsáid chun foirgnimh do dhéanamh, d'ath-dhéanamh, d'athrú, d'fheistiú, do dheisiú, d'óirnéaladh no do chothabháil, agus iad de chinéal is gnáth do dhéanamh i gceárdlanna no i gclóis foirgneoirí, ach ní fholuíonn—
(i) aon earra no séadchomhartha bheidh ceaptha mar chuimhneachán ar dhaoine beo no ar dhaoine marbha do dhéanamh no d'athrú no do dheisiú,
(ii) slinn do bhaint agus do ghearradh i gcoiréal,
(iii) garbh-bhluic mharmair no chloiche do bhaint,
(iv) baill troscáin sho-ghluaiste do dhéanamh,
(v) earraí do dhéanamh is gá do chóireáil in oigheann no i dteiníl i gcúrsa a ndéanta,
(vi) píopaí camra, píopaí dréineála, bríceanna, tíleacha urláir, agus tíleacha dín do dhéanamh,
(vii) earraí do dhéanamh arb é atá ionta ar fad no go furmhór ná cumasc stroighne agus aisbeiste.
Fostaíocht ionúrachuithe.
4.—San Acht so cialluíonn an abairt “fostaíocht ionárachuithe” fostaíocht lámh-oibre—
(a) is—
(i) fostaíocht sa bhfoirgneoireacht, no
(ii) fostaíocht in aon chéird eile bheidh dearbhuithe le hordú ar n-a dhéanamh ag an Aire fén Acht so do bheith ina fostaíocht ionárachuithe chun crícheanna an Achta so, agus
(b) nach fostaíocht a luaidhtear sa Chéad Sceideal a ghabhann leis an Acht so.
Daoine eiscithe.
5.—(1) Aon uair is deimhin leis an Aire, maidir le haon aicme daoine ar fostú ag aon fhostóir áirithe i bhfostaíocht ionárachuithe,—
(a) gur buan-fhostaíocht fostaíocht na haicme sin daoine, ag féachaint do ghnáth-chleachtadh an fhostóra san, agus
(b) ná baintear éinní as págh na haicme sin daoine mar gheall ar aimsir do chailliúint de dheascaibh doininne, agus
(c) go dtagann de thosca eile fostaíocht na haicme sin daoine nach gá daoine den aicme sin d'árachú fén Acht so,
féadfaidh deimhniú (dá ngairmtear deimhniú eisceachta san Acht so) do thabhairt amach don fhostóir sin á rá gur deimhin leis amhlaidh.
(2) Má déantar deimhniú eisceachta i dtaobh aicme daoine do thabhairt amach d'fhostóir, ansan, duine ar bith a bheidh ar fostú ag an bhfostóir sin a bhainfidh leis an aicme sin agus a mbeidh trí bliana no níos mó caithte aige i mbuan-tseirbhís an fhostóra san, beidh sé ina dhuine eiscithe chun crícheanna an Achta so faid a bheidh an deimhniú san i bhfeidhm agus a bheidh an duine sin ar fostú ag an bhfostóir sin, agus léireofar an abairt “duine eiscithe” dá réir sin san Acht so.
(3) Féadfaidh an tAire aon deimhniú eisceachta do chúlghairm tráth ar bith.
Daoine árachuithe.
6.—San Acht so cialluíonn an abairt “duine árachuithe” duine ar bith in aois a shé mblian déag no níos mó bheidh ar fostú i bhfostaíocht ionárachuithe fé chonnradh sheirbhíse no phrintíseachta, scríobhtha no ráite, pé aca follas no tuigthe dhó agus pé aca an fostóir no duine éigin eile íocann an duine sin, agus pé aca do réir ama no an phíosa oibre no i bpáirt do réir ama agus i bpáirt do réir an phíosa oibre no ar shlí eile, no gan aon íocaíocht. airgid, a híoctar é, ach ní fholuíonn duine ar fostú fé chonnradh phrintíseachta fé ná fuil airgead ar bith iníoctha ag an bhfostóir ná duine is duine eiscithe de thurus na huaire.
Aicmí de dhaoine árachuithe.
7.—(1) San Acht so—
cialluíonn an abairt “oibridhe oilte”—
(a) maidir le fostaíocht sa bhfoirgneoireacht, duine árachuithe ar fostú fé chonnradh sheirbhíse no phrintíseachta (i) mar chearpantóir, siúinéir, meaisíneach gearrtha adhmaid, saor bríce, saor cloiche, gearrthóir cloiche, cloch-shuíodóir, oibridhe terrazzo agus mósaic, tíleoir urláir agus falla, pláistéir, slinneadóir, dín-tíleoir, pínteoir, páipéarthóir, óirnéalaidhe, gloineadóir, luadóir, feisteoir teas-fhearais, gás-fheisteoir, líomhnóir adhmaid no leictreoir, no (ii) in aon fheidhmeannas eile a chinnfidh an tAire, go generálta no in aon chás áirithe, do bheith ina fhostaíocht oibridhe oilte,
(b) maidir le fostaíocht in aon chéird eile bheidh dearbhuithe le hordú ar n-a dhéanamh ag an Aire fén Acht so do bheith ina fostaíocht ionárachuithe chun crícheanna an Achta so, duine árachuithe ar fostú fé chonnradh sheirbhíse no phrintíseachta (i) i bhfeidhmeannas a bheir gur oibridhe oilte, mar a mínítear san leis an ordú san, an duine sin no (ii) in aon fheidhmeannas eile a chinnfidh an tAire, go generálta no in aon chás áirithe, do bheith ina fhostaíocht oibridhe oilte;
cialluíonn an abairt “oibridhe neamh-oilte” duine árachuithe nach oibridhe oilte;
cialluíonn an abairt “duine óg” duine árachuithe a mbeidh sé bliana déag slán aige ach ná beidh bliain is fiche slán aige.
(2) Ní déanfar duine (seachas duine a mbeidh bliain is fiche slán aige roimh dháta thosach feidhme ailt 18 den Acht so) d'áireamh ina oibridhe oilte ná ina oibridhe neamh-oilte go dtí an chéad lá tar éis deireadh na bliana árachais ina slánóidh sé bliain is fiche.
(3) Duine shlánóidh bliain is fiche tar éis dáta thosach feidhme ailt 18 den Acht so, áirmheofar é ina dhuine óg go lá deiridh na bliana árachais ina slánóidh an aois sin.
(4) Duine árachuithe is oibridhe oilte agus a n-athróidh a ghnáth-shlí bheatha i riocht go ndéanfaidh oibridhe neamh-oilte dhe, áirmheofar é ina oibridhe oilte go dtí an dáta cruthófar chun sástacht an Aire gur athruigh gnáth-shlí bheatha an duine árachuithe sin amhlaidh.
(5) Duine árachuithe is oibridhe neamh-oilte agus a n-athróidh a ghnáth-shlí bheatha i riocht go ndéanfaidh oibridhe oilte dhe, áirmheofar é ina oibridhe neamh-oilte go dtí an dáta cruthófar chun sástacht an Aire gur athruigh gnáth-shlí bheatha an duine árachuithe sin amhlaidh.
Doineann agus breac-dhíomhaointeas.
8.—San Acht so—
cialluíonn an focal “doineann” aimsir dá dtiocfaidh, toisc báisteach, stoirm, sneachta, cloich-shneachta, sioc, tuile no míshíon eile é bheith nea-shábhálta no neamh-fhéideardha go sealadach obair i bhfostaíocht ionárachuithe áirithe do dhéanamh ag féachaint do shláinte no sábháltacht na ndaoine bheidh sa bhfostaíocht san no do nádúir no riachtanais teicniúla na hoibre;
cialluíonn an focal “breac-dhíomhaointeas” díomhaointeas agus cailliúint iarmartach páigh de dheascaibh stad oibre, is dosheachanta mar gheall ar dhoininn, i bhfostaíocht ionárachuithe, agus léireofar an focal “breac-dhíomhaoin” dá réir sin.
Bliain árachais.
9.—(1) San Acht so cialluíonn an abairt “bliain árachais” pé tréimhse bheidh orduithe.
(2) Go dtí go ndéanfaidh an tAire rialacháin á ordú cadé an tréimhse is bliain árachais, is bliain árachais chun crícheanna an Achta so gach tréimhse aca so leanas, sé sin le rá:—
(a) an tréimhse (dá ngairmtear an chéad bhliain árachais san Acht so) dar tosach dáta tosach feidhme ailt 18 den Acht so agus dar críoch an chéad Domhnach den mhí Dheireadh Fómhair díreach tar éis dáta tosach feidhme an ailt sin 18,
(b) tréimhse ar bith (is tréimhse tar éis na céad bhliana árachais) dar tosach an Luan tar éis an chéad Domhnaigh de gach mí Dheireadh Fómhair agus dar críoch an chéad Domhnach de mhí Dheireadh Fómhair na bliana ina dhiaidh sin.
An tAire do thabhairt bhreithe ar cheisteanna.
10.—(1) Má eiríonn ceist ar bith—
(a) i dtaobh aon fhostaíocht áirithe no aon chinéal áirithe fostaíochta do bheith ina fostaíocht do bhéarfadh gur duine árachuithe do réir bhrí an Achta so an duine ar fostú inti no i dtaobh duine do bheith ina dhuine árachuithe do réir bhrí an Achta so no gan a bheith, no
(b) i dtaobh duine árachuithe do bheith ina oibridhe oilte no ina oibridhe neamh-oilte no ina dhuine óg do réir bhrí an Achta so, no
(c) i dtaobh cé hé no cérbh é fostóir aon duine árachuithe áirithe, no
(d) i dtaobh ráta an tsíntiúis seachtainiúil is iníoctha fén Acht so maidir le duine árachuithe,
bhéarfaidh an tAire breith ar an gceist, ach in ionad é féin do thabhairt bhreithe uirthi féadfaidh an tAire, más oiriúnach leis é, an cheist do chur fé bhráid na hArd-Chúirte chun breith do thabhairt uirthi.
(2) Féadfaidh duine ar bith a bheidh mí-shásta leis an mbreith do bhéarfaidh an tAire fén alt so athchomharc chun na hArd-Chúirte i gcoinnibh na breithe sin.
(3) Féadfaidh an tAire, ar fháil fios fíoras nua dhó, aon bhreith a bheith tugtha aige fén alt so d'athscrúdú no d'ais-iompódh nach breith a mbeidh athchomharc ina coinnibh ar feitheamh no a mbeidh an t-am chun athchomharc ina coinnibh gan caitheamh, agus féadfar athchomharc i gcoinnibh aon bhreithe athscrúduithe no aisiompuithe den tsórt san fé mar a féadfaí i gcoinnibh bun-bhreithe.
(4) Na rialacha cúirte le n-a rialáltar athchomhairc agus reifeartha chun na hArd-Chúirte fé fho-alt (3) d'alt 10 den Unemployment Insurance Act, 1920, bainfid le hathchomhairc agus reifeartha chun na hArd-Chúirte fén alt so.
(5) Beidh an tAire i dteideal teacht i láthair agus éisteacht d'fháil le linn aon athchomharc no reifreadh fén alt so do bheith á éisteacht.
(6) D'ainneoin éinní atá in Acht ar bith is chun breithimh aonair den Ard-Chúirt a hainmneofar chuige sin ag an bPrímh-Bhreitheamh a déanfar athchomharc no reifreadh fén alt so, agus ní bheidh dul thar breith na hArd-Chúirte ar athchomharc no ar reifreadh fén alt so.
(7) Féadfaidh an tAire a ordú le rialacháin cadé an nós imeachta is leanta nuair a bheidh ag breithniú ceisteanna a mbeidh air breith do thabhairt ortha fén Acht so.
An tAcht so do bhaint le daoine ar fostú ag an Stát.
11.—Baineann an tAcht so le daoine ar fostú i bhfostaíocht ionárachuithe ag an Stát le n-a mbainfeadh an tAcht so dá mba dhuine príobháideach an fostóir, lasmuich den mhéid de na daoine sin atá ag fónamh i bhfeidhmeannas bhunuithe i mbuantseirbhís an Stáit no atá, tar éis deimhnithe bheith deonta dhóibh ag Coimisinéirí na Stát-Sheirbhíse, ag cur tréimhse promhtha dhíobh roimh a mbunú.
Rialacháin i gcoitinne.
12.—Féadfaidh an tAire rialacháin do dhéanamh chun aon chríche no crícheanna aca so leanas, sé sin le rá:—
(a) chun aon chríche chun a n-údaruítear go soiléir le haon cheann d'fhorálacha an Achta so rialacháin do dhéanamh;
(b) chun éinní d'ordú dá dtagartar san Acht so mar ní atá orduithe no le hordú; agus
(c) i gcoitinne chun an Achta so do chur in éifeacht.
Rialacháin do leagadh fé bhráid Tithe an Oireachtas.
13.—Gach rialachán a dhéanfaidh an tAire fén Acht so leagfar fé bhráid gach Tighe den Oireachtas é chó luath agus is féidir tar éis a dhéanta agus má dhéanann aon Tigh aca san, fé cheann an lá is fiche shuidhfidh an Tigh sin tar éis an rialacháin sin do leagadh fé n-a bhráid, rún do rith ag cur an rialacháin sin ar nea-mbrí beidh an rialachán san curtha ar neambrí dá réir sin ach san gan dochar do bhailíocht éinní do rinneadh roimhe sin fén rialachán san.
Costais an Aire.
14.—Sa mhéid go gceadóidh an tAire Airgeadais é, is as airgead a sholáthróidh an tOireachtas a híocfar na costais fé n-a raghaidh an tAire chun an Achta so do riaradh.
Brí na n-abairtí “fostaíocht ionárachuithe” agus “oibridhe oilte” do leathnú.
15.—(1) Le haontú an Aire Airgeadais féadfaidh an tAire, le hordú, aon uair agus a mhinice is oiriúnach leis é—
(a) a dhearbhú fostaíocht in aon chéird áirithe (ar n-a míniú mar is oiriúnach leis an Aire) do bheith ina fostaíocht ionárachuithe chun crícheanna an Achta so,
(b) míniú do thabhairt, tré thagairt d'fhostaíocht sna feidhmeannais sin a mheasfaidh an tAire do bheith ceart agus a luadhfaidh san ordú san, ar an abairt “oibridhe oilte” maidir leis an bhfostaíocht a dearbhófar leis an ordú san do bheith ina fostaíocht ionárachuithe.
(2) Ní thiocfaidh aon ordú déanfar fén alt so i bhfeidhm mara ndéantar ná go dtí go ndéanfar é leagadh fé bhráid gach Tighe den Oireachtas agus é dhaingniú le rún o gach Tigh aca san.
CUID II.
Arachas Eigeanta in Aghaidh Breac-Dhiomhaointis.

16.—Ní foláir gach duine árachuithe d'árachú in aghaidh breacdhíomhaointis sa tslí foráltar leis an Acht so.
CUID III.
Sintiuis o Fhostoiri agus Daoine Arachuithe.
Bun-tsrutha na síntiús.
17.—Na eistí is gá chun sochar foirlíontach do thabhairt agus chun aon íocaíochta eile do dhéanamh a bheidh, fén Acht so, le n-íoc as an gCiste Díomhaointis Fhoirlíontaigh a bunófar fén Acht so is amhlaidh do gheobhfar iad go leathrannach as sintiúis seachtainiúla o dhaoine árachuithe agus go leathrannach as síntiúis seachtainiúla o fhostóirí na ndaoine sin.
Fostóirí agus daoine árachuithe d'íoc síntiús.
18.—(1) Dlighfidh gach duine árachuithe de na haicmí luaidhtear sa chéad cholún den Dara Sceideal a ghabhann leis an Acht so agus gach fostóir ar aon duine árachuithe den tsórt san síntiúis (dá ngairmtear síntiúis seachtainiúla san Acht so) d'íoc go seachtainiúil do réir na rátaí fé seach a luaidhtear sa dara colún agus sa tríú colún den Sceideal san no, má déantar fén Acht so rátaí eile do chur in ionad na rátaí sin a céad-luaidhtear, do réir na rátaí bheidh curtha in ionad amhlaidh de thurus na huaire.
(2) Lasmuich de chás dá bhforálfar a mhalairt le rialacháin fén Acht so, dlighfidh fostóir duine árachuithe, den chéad ásc, an síntiús seachtainiúil is iníoctha aige féin (dá ngairmtear síntiús an fhostóra san Acht so) d'íoc agus fós, thar ceann agus d'éamais an duine árachuithe sin, an síntiús seachtainiúil is iníoctha ag an duine árachuithe sin (dá ngairmtear síntiús an duine árachuithe san Acht so), agus is tuigthe chun crícheanna an Achta so na síntiúis seachtainiúla íocfaidh fostóir thar ceann duine árachuithe do bheith ina síntiúis seachtainiúla ón duine árachuithe.
(3) Beidh síntiús seachtainiúil iníoctha in aghaidh gach seachtaine caileandair a mbeidh duine árachuithe ar fostú ag fostóir ar a feadh uile no ar feadh aon choda dhi, ach beidh san fé réir na bhforálacha so leanas:—
(a) má híoctar síntiús seachtainiúil maidir le duine árachuithe in aon tseachtain chaileandair, ní bheidh aon tsíntiús seachtainiúil eile iníoctha maidir leis in aghaidh na seachtaine caileandair céanna, agus
(b) má bhíonn duine árachuithe seachtain chaileandair ar bith gan aon tseirbhís do dhéanamh agus ná híocfar aon luach saothair in aghaidh na seachtaine caileandair sin, ní dhlighfidh an fostóir aon tsíntiús seachtainiúil d'íoc thar a cheann féin ná thar ceann an duine árachuithe in aghaidh na seachtaine caileandair sin.
(4) Má bhíonn duine ar fostú in aon tseachtain chaileandair fén aon fhostóir amháin, go leathrannach i bhfostaíocht ionárachuithe agus go leathrannach i bhfostaíocht éigin eile, ansan, d'ainneoin éinní atá i bhfo-alt (3) den alt so, ní bheidh aon tsintiús seachtainiúil iníoctha maidir leis an duine sin in aghaidh na seachtaine caileandair sin maran am sa bhfostaíocht ionárachuithe leath an ama no breis agus leath an ama bheidh sé ar fostú amhlaidh.
Gan síntiús an fhostóra do bheith ionbhainte den duine árachuithe.
19.—D'ainneoin aon chonnartha contrárdha dhó san, ní bheidh fostóir duine árachuithe i dteideal síntiús an fhostóra d'as-bhaint as págh an duine árachuithe sin ná do bhaint de ar aon tslí eile.
Fostóir do bhaint amach síntiús an duine árachuithe.
20.—(1) Fé réir forálacha an ailt seo agus fé réir aon rialachán a dhéanfaidh an tAire fén Acht so, beidh fostóir duine árachuithe i dteideal méid aon tsíntiús seachtainiúla íocfaidh thar ceann an duine árachuithe sin do bhaint den duine árachuithe sin do réir forálacha an ailt seo.
(2) Má gheibheann duine árachuithe págh no luach saothair eile in airgead o n-a fhostóir féadfar, d'ainneoin forálacha aon Achta no aon chonnartha contrárdha dhó san, méid aon tsíntiúis seachtainiúil íocfaidh an fostóir thar ceann an duine árachuithe sin do bhaint amach tré as-bhaintí as págh an duine árachuithe sin no as aon luach saothair eile bheidh iníoctha ag an bhfostóir leis an duine árachuithe sin agus ní ar aon tslí eile, ach ní cead aon as-bhaintí den tsórt san do bhaint as aon phágh no luach saothair seachas págh no luach saothair a híocfar in aghaidh na tréimhse no na coda de thréimhse a mbeidh an síntiús seachtainiúil iníoctha ina haghaidh, ná thar an suim is ionann agus méid na síntiús seachtainiúla in aghaidh na tréimhse a n-íocfar an págh no an luach saothair eile ina haghaidh.
(3) I gcás síntiús seachtainiúil íocfaidh fostóir duine árachuithe thar ceann an duine árachuithe sin do bheith ionbhainte den duine árachuithe sin ach gan é bheith ionbhainte amach tré as-bhaintí mar adubhradh, beidh sé ionbhainte amach (gan dochar d'aon tslí eile chun é bhaint amach) mar fhiacha gnáth-chonnartha i gcúirt dlighinse inniúla ach ní bheidh aon tsíntiús seachtainiúil den tsórt san ionbhainte amach mara ndéantar imeachta chuige sin do bhunú fé cheann tré mhí ón dáta ar a raibh an síntiús iníoctha.
(4) I gcás gan págh ná íocaíochta eile airgid d'íoc le duine árachuithe ag a fhostóir no ag duine ar bith eile, dlighfidh an fostóir na síntiúis seachtainiúla is iníoctha aige féin agus ag an duine árachuithe sin d'íoc agus ní bheidh sé i dteideal aon chuid díobh do bhaint den duine árachuithe sin.
(5) Suim ar bith a as-bhainfidh fostóir as págh no luach saothair eile fén alt so is tuigthe í chur ar a iontaoibh chun íoctha an tsíntiúis seachtainiúil gur ina thaobh a has-bhaineadh í.

21.—I gcás duine árachuithe do bheith ar fostú ag níos mó ná aon duine amháin in aon tseachtain chaileandair áirithe, is tuigthe gurb é an chéad duine a mbeidh sé ar fostú aige sa tseachtain sin fostóir an duine árachuithe sin chun crícheanna na bhforálacha den Acht so a bhaineann le síntiúis seachtainiúla d'íoc.

22.—(1) I gcás an tAire dá chinneadh sa tslí foráltar leis an Acht so gan síntiúis seachtainiúla fén Acht so do bheith iníoctha maidir le haon duine no aicme daoine áirithe agus an tAire no, ar athchomharc, an Ard-Chúirt do dhéanamh athscrúduithe no claochló ar an gcinneadh sin ina dhiaidh sin i slí do bhéarfaidh síntiúis seachtainiúla do bheith iníoctha maidir leis an duine no an aicme daoine sin, ní bheidh síntiúis seachtainiúla iníoctha amhlaidh ach amháin ón dáta ar a ndearnadh athscrúdú no claochló ar an gcinneadh.
(2) I gcás an tAire dá chinneadh síntiúis seachtainiúla maidir le duine no aicme daoine áirithe do bheith iníoctha do réir ráta áirithe fén Acht so agus an tAire no, ar athchomharc, an Ard. Chúirt do dhéanamh athscrúduithe no claochló ar an gcinneadh sin ina dhiaidh sin i slí do bhéarfaidh síntiúis seachtainiúla do bheith iníoctha do réir ráta eile maidir leis an duine no an aicme daoine sin, ní bheidh síntiúis seachtainiúla iníoctha amhlaidh do réir an ráta eile sin ach amháin ón dáta ar a ndearnadh athscrúdú no claochló ar an gcinneadh.
Síntiúis d'aisíoc i gcásanna áirithe.
23.—Aon tsíntiúis seachtainiúla bheidh íoctha ag duine agus ag a fhostóir fé seach ar an mí-thuigsint go raibh na síntiúis seachtainiúla iníoctha maidir leis an duine sin fé fhorálacha an Achta so, féadfaidh an tAire iad do thabhairt thar n-ais dói ar iarratas do dhéanamh chuige dá lorg i pé fuirm ordóidh sé sara mbeidh dhá mhí dhéag caithte o dháta íoctha na síntiús seachtainiúla, ach, i gcás síntiúisí an duine árachuithe, as-bhainfear aon mhéid sochair fhoirlíontaigh a bheidh faighte aige agus ná beadh sé i dteideal d'fháil dá mba ná híocfaí na síntiúis seachtainiúla san.

24.—Féadfaidh an tAire rialacháin do dhéanamh ag déanamh socruithe i dtaobh nithe ar bith a ghabhann le híoc agus bailiú síntiús seachtainiúla agus go sonnrach i dtaobh—
(a) síntiúis seachtainiúla d'íoc
(i) tré stampaí greamathacha no eile (dá ngairmtear stampaí árachais fhoirlíontaigh san Acht so) a bheidh greamuithe no múnluithe ar leabhair no cártaí (dá ngairmtear fé seach san Acht so leabhair dhíomhaointis fhoirlíontaigh agus cártaí díomhaointis fhoirlíontaigh) no ar shlí eile, agus i dtaobh na slí ina mbeidh, na dtráthanna bheidh agus na gcoinníollacha fé n-a mbeidh stampaí árachais fhoirlíontaigh le greamú no le múnlú; no
(ii) tré fhostóirí daoine árachuithe do dhéanamh íocaíochtaí go díreach leis an Aire sa tslí sin agus na tráthanna san agus fé na coinníollacha san ordóidh an tAire; no
(iii) tré pé meán eile ordóidh an tAire leis na rialacháin sin;
(b) mion-innste d'iontráil i leabhair no cártaí díomhaointis fhoirlíontaigh maidir le síntiúis seachtainiúla bheidh íoctha in aghaidh aon tréimhse áirithe no pé mion-innste eile d'iontráil is gá 1 gcás daoine le n-a mbainfidh na leabhair no cártaí díomhaointis fhoirlíontaigh, agus i dtaobh glacadh leis an iontráil sin mar leor-fhianaise ar an uimhir de shíntiúis seachtainiúla bheidh íoctha amhlaidh no ar na mion-innste eile bheidh iontrálta amhlaidh;
(c) leabhair no cártaí díomhaointis fhoirlíontaigh d'iarraidh, do thabhairt amach, do dhíol, do choimeád, do thaisbeáint agus do thabhairt suas agus leabhair no cártaí díomhaointis fhoirlíontaigh bheidh caillte no díothuithe no agha-loitthe d'athsholáthar;
(d) fostóirí do thabhairt pé mion-innste don Aire maidir le daoine ar fostú aca éileoidh an tAire no ordóidh leis na rialacháin sin.
Stampaí árachais fhoirlíontaigh do thabhairt amach.
25.—Déanfar stampaí árachais fhoirlíontaigh d'ullmhú agus do thabhairt amach sa tslí sin ordóidh na Coimisinéirí Ioncuim le ceadú an Aire Airgeadais agus féadfaidh na Coimisinéirí sin socrú do dhéanamh le rialacháin chun feidhm do thabhairt, gus na hoiriúnuithe is gá, maidir le stampaí árachais fhoirlíontaigh, do gach ceann no aon cheann no cinn d'fhorálacha, agus forálacha peannaideacha d'áireamh, na n-achtachán so leanas, sé sin le rá, ailt 21, 35 agus 36 den Inland Revenue Regulation Act, 1890, an Stamp Duties Management Act, 1891, alt 9 den Stamp Act, 1891, agus alt 65 den Post Office Act, 1908, agus féadfaid, le ceadú an Aire Puist agus Telegrafa, socrú do dhéanamh chun stampaí árachais fhoirlíontaigh do dhíol i bPost-Oifigí.

26.—(1) Féadfaidh an Riaghaltas a fhoráil le hordú go ndéanfaidh an tAire Puist agus Telegrafa aon chomhachta agus dualgais de chuid na gCoimisinéirí Ioncuim maidir le stampaí árachais fhoirlíontaigh d'fheidhmiú agus do chólíonadh d'éamais na gCoimisinéirí Ioncuim no in éineacht leis na Coimisinéirí Ioncuim, agus is cead pé forálacha bheith in aon ordú den tsórt san a chífear don Riaghaltas is gá no is oiriúnach chun lán-éifeacht do thabhairt d'fheidhmiú agus cólíonadh na ndualgas le n-a mbainfidh an t-ordú san sa tslí forálfar leis an ordú san.
(2) Beidh feidhm dlí ag gach ordú déanfar fén alt so.

27.—(1) Ar na fiacha is gá fé alt 209 den Companies Consolidation Act, 1908, d'íoc, le linn sóchmhainní cuideachtan foirceannta d'iomdháil, i dtosach ar na fiacha eile go léir beidh na síntiúis seachtainiúla uile is iníoctha fén Acht so ag an gcuideachtain maidir le daoine árachuithe in aghaidh an cheithre mhí roimh theacht i bhfeidhm don fhoirceannadh no don ordú foirceannta, agus beidh éifeacht dá réir sin ag an Acht san agus ní gá na fiacha dá dtugtar tús fén alt so do chruthú go fuirmiúil ach amháin i gcásanna ina mbeidh a mhalairt forálta leis na rialacha ar n-a ndéanamh fén Acht san.

Sochar Foirliontach.
Ceart chun sochair fhoirlíontaigh agus na tréimhsí a mbeidh sé iníoctha ina n-aghaidh.
28.—(1) Gach duine árachuithe a bheidh breac-dhíomhaoin lá ar bith (seachas Domhnach no lá saoire puiblí do réir bhrí an Achta um Choinníollacha Fostaíochta, 1936 (Uimh. 2 de 1936), no an chéad lá de sheal fostaíochta ionárachuithe leis an duine gurbh é a fhostóir é nuair a thárla an breac-dhíomhaointeas san) agus a mbeidh a chás do réir na gcoinníollacha reachtúla beidh sé a dteideal, fé réir forálacha an Achta so, íocaíocht (dá ngairmtear sochar foirlíontach san Acht so) d'fháil in aghaidh gach uaire a chluig de bhreac-dhíomhaointeas a thárlóidh an lá san le linn uaireanna oibre.

29.—Fé réir forálacha an Achta so, is amhlaidh a bheidh sochar foirlíontach i gcás duine árachuithe d'aon aicme atá leagtha amach sa chéad cholún den Tríú Sceideal a ghabhann leis an Acht so do réir an ráta uairiúil atá leagtha amach sa dara colún den Sceideal san os coinne luadh na haicme sin no má déantar fén Acht so ráta uairiúil eile do chur in ionad an ráta san a céad-luaidhtear, do réir an ráta bheidh curtha ina ionad amhlaidh de thurus na huaire.

30.—(1) Isé céad choinníoll (dá ngairmtear an chéad choinníoll reachtúil san Acht so) chun duine árachuithe d'fháil sochair fhoirlíontaigh in aghaidh breac-dhíomhaointis in aon bhliain árachais áirithe ná dhá cheann déag ar a laghad de shíntiúis seachtainiúla do bheith íoctha roimh an seachtain ina dtárlóidh an breac-dhíomhaointeas san maidir leis an duine sin mar dhuine árachuithe—
(a) másí an chéad bhliain árachais an bhliain árachais sin, o thosach na bliana árachais sin,
(b) in aon chás eile, o thosach na bliana árachais díreach roimh an mbliain árachais ina dtárlóidh an breacdhíomhaointeas.
(2) Isé dara coinníoll (dá ngairmtear an dara coinnioll reachtúil san Acht so) chun duine árachuithe d'fháil sochair fhoirlíontaigh in aghaidh breac-dhíomhaointis ar aon lá áirithe ná an leabhar díomhaointis reatha bheidh tugtha amach dó fén Unemployment Insurance Act, 1920, do bheith i seilbh a fhostóra an lá san.
(3) Isé tríú coinníoll (dá ngairmtear an tríú coinníoll reachtúil san Acht so) chun duine árachuithe d'fháil sochair fhoirlíontaigh in aghaidh aon tréimhse breac-dhíomhaointis ná an duine chun a gcuirfear tuarascbháil i dtaobh na tréimhse sin fén gcéad alt eile d'fháil na tuarascbhála fé cheann trí lá (no pé tréimhse is sia ná san a cheadóidh an tAire in aon chás áirithe) tar éis an lae do thárla an breac-dhíomhaointeas agus an duine sin do bheith tar éis a admháil go bhfuair an tuarascbháil sin.
(4) I gcás gan leabhar díomhaointis reatha dhuine árachuithe ar n-a thabhairt amach fén Unemployment Insurance Act, 1920, do bheith i seilbh a fhostóra lá áirithe, agus oifigeach áitiúil dá dheimhniú nár seachadadh an leabhar san d'oifig áitiúil maidir le héileamh ag lorg sochair dhíomhaointis fén Unemployment Insurance Act, 1920, no le hiarratas ag lorg conganta dhíomhaointis fén Acht um Chongnamh Dhíomhaointis, 1933 (Uimh. 46 de 1933), in aghaidh an lae sin, is tuigthe, chun crícheanna an dara coinníll reachtúil, an leabhar san do bheith i seilbh an fhostóra san an lá san.
(5) San Acht so cialluíonn an abairt “na coinníollacha reachtúla” an chéad choinníoll reachtúil, an dara coinníoll reachtúil agus an tríú coinníoll reachtúil.

31.—(1) I gcás stad oibre do thárlachtaint aon lá áirithe agus fostóir dhuine árachuithe no an duíne árachuithe sin dá rá gur breac-dhíomhaointeas an stad san, déanfaidh an fostóir an lá san tuarascbháil do chur chun pé duine ordóidh an tAire in aon chás áirithe no, mara n-orduighidh amhlaidh, chun oifigigh áitiúil á chur in úil gur thárla an stad san agus cá fhaid do mhair sé agus cadé an saghas aimsire adeirtear ba chúis leis.
(2) I gcás duine árachuithe dá rá go raibh sé breac-dhíomhaoin aon lá áirithe, féadfa sé tuarascbháil do chur chun pé duine ordóidh an tAire in aon chás áirithe no, mara n-orduighidh amhlaidh, chun oifigigh áitiúil á chur in úil gur thárla an breac-dhíomhaointeas san agus cá fhaid do mhair sé agus cadé an saghas aimsire adeirtear ba chúis leis ach ní léireofar an fhoráil seo mar fhoráil a shaorann fostóir an duine sin ón oblagáid a forchuirtear air le fo-alt (1) den alt so.
(3) I gcás duine d'fháil tuarascbhála fén alt so ní foláir dó a admháil chó luath agus is féidir é go bhfuair sé í.
Fostóirí d'íoc sochair fhoirlíontaigh.
32.—(1) Fé réir forálacha an Achta so agus pé ordachán do bhéarfaidh an tAire go generálta no in aon chás áirithe, íocfaidh fostóir duine árachuithe aon mhéid no méideanna de shochar fhoirlíontach chun a mbeidh teideal ag an duine árachuithe, agus déanfaidh an duine árachuithe agus a fhostóir, maidir le gach íocaíocht fé leith den tsórt san, pé mion-innste bheidh orduithe do thabhairt don Aire agus pé fuirmeacha, ar a n-áirmhítear admháil an duine árachuithe ar an méid do fuair sé, a bheidh orduithe do chríochnú agus do tharchur.
(2) Duine árachuithe nach dóigh leis gurb é méid an tsochair fhoirlíontaigh d'íoc a fhostóir leis an méid atá sé i dteideal d'fháil fé fhorálacha an Achta so féadfa sé no féadfaidh a fhostóir, ar an duine sin dá iarraidh, a iarraidh ar oifigeach árachais a chinneadh, do réir na bhforálacha den Acht so bhaineann le cinneadh ceist eanna i dtaobh sochar foirlíontach d'íoc, cadé méid an tsochair fhoirlíontaigh chun a bhfuil teideal aige.
(3) Má dhéanann oifigeach áitiúil no duine eile chun a gcuirfear tuarascbháil maidir le breac-dhíomhaointeas duine árachuithe do réir an ailt deiridh sin roimhe seo fógra do chur go dtí fostóir an duine árachuithe sin á rá nach deimhin leis gur mar gheall ar dhoininn do thárla an stad oibre le n-a mbaineann an tuarascbháil no gur cólíonadh na forálacha eile den Acht so bhaineann le sochar foirlíontach d'íoc, no má bhíonn fostóir in amhras in aon chás áirithe i dtaobh sochar foirlíontach do bheith iníoctha no i dtaobh méid no ráta an tsochair fhoirlíontaigh is iníoctha, iarrfaidh an fostóir láithreach ar oifigeach árachais an cheist do chinneadh do réir na bhforálacha den Acht so bhaineann le cinneadh ceisteanna i dtaobh sochar foirlíontach d'íoc.
(4) Má thárlann i gcás ar bith ná fuighidh duine árachuithe aon íocaíocht sochair fhoirlíontaigh a gcreideann sé teideal do bheith aige chuige fén Acht so agus nach deimhin leis gur cuireadh an cheist i dtaobh é bheith i dteideal an tsochair sin fé bhráid oifigigh árachais fé fhorálacha fo-ailt (3) den alt so, beidh sé i dteideal a iarraidh ar a fhostóir í chur fé n-a bhráid amhlaidh no é féin do chur na ceiste fé bhráid oifigigh árachais chun í chinneadh.
(5) Fostóir a gheobhaidh iarratas o dhuine árachuithe á iarraidh go gcuirfí ceist i dtaobh a theidil chun sochair fhoirlíontaigh fé bhráid oifigigh árachais chun í chinneadh déanfa sé, mara mbeidh san déanta cheana aige, an cheist do chur láithreach fé bhráid oifigigh árachais chun í chinneadh.
(6) I gcás inar gá do réir forálacha fo-ailt (3) no fo-ailt (4) den alt so ceist ar bith do chur fé bhráid oifigigh árachais, ní bheidh an duine árachuithe i dteideal íocaíocht d'fháil o n-a fhostóir fé fho-alt (1) den alt so mara gcinnidh ná go dtí go gcinnfidh an t-oifigeach árachais teideal do bheith aige chuige, agus ní dhéanfaidh an fostóir an íocaíocht san go dtí go ndéanfar an cinneadh sin ná ní dhéanfaidh í ach do réir an chéanna.

33.—In aon chás speisialta inarb é tuairim an Aire nárbh fhéidir no go mba ró-dheacair d'fhostóir an méid de shochar fhoirlíontach a bheidh dlite do dhuine árachuithe d'íoc fé fhorálacha an Achta so, féadfaidh an tAire an fostóir sin do shaoradh o dhualgas a íoctha amhlaidh agus i gcás fostóir do shaoradh amhlaidh íocfaidh an tAire no cuirfidh fé ndear go n-íocfar as an gCiste Díomhaointis Fhoirlíontaigh aon mhéid de shochar fhoirlíontach dob iníoctha leis an duine árachuithe ag an bhfostóir sin dá mba ná saorfaí amhlaidh é.

34.—Déanfaidh an tAire méid aon tsochair fhoirlíontaigh a bheidh íoctha go cuibhe do réir forálacha an Achta so ag fostóir d'aisíoc leis an bhfostóir sin as an gCiste Díomhaointis Fhoirlíontaigh ar an bhfostóir do dhéanamh iarratais, i pé fuirm a hordófar, ag lorg an aisíoca san.
Gan aisíoca do dhéanamh le fostóirí as an gCiste Díomhaointis Fhoirlíontaigh i gcásanná áirithe.
35.—Aon uair íocfaidh fostóir aon mhéid sochair fhoirlíontaigh le duine ná beidh i dteideal sochar foirlíontach d'fháil fé fhorálacha an Achta so no íocfaidh breis thar an méid sochair fhoirlíontaigh chun a mbeidh teideal ag an duine sin ní bheidh an méid no an bhreis a bheidh íoctha amhlaidh ion-aisíoctha leis an bhfostóir as an gCiste Díomhaointis Fhoirlíontaigh.
Méideanna bheidh íoctha go mí-chóir do bhaint amach.
36.—(1) Aon mhéid sochair fhoirlíontaigh do gheobhaidh duine árachuithe o n-a fhostóir agus ná beidh ion-aisíoctha leis an bhfostóir as an gCiste Díomhaointis Fhoirlíontaigh mar gheall ar fhorálacha an ailt deiridh sin roimhe seo, beidh sé ion-aisíoctha ag an duine árachuithe sin leis an bhfostóir ar an bhfostóir dá éileamh agus, mara n-aisíoctar amhlaidh é, féadfaidh an fostóir é bhaint amach mar fhiacha gnáth-chonnartha in aon chúirt dlighinse inniúla no tré n-a asbhaint as aon íocaíocht no íocaíochta sochair fhoirlíontaigh chun a mbeidh teideal ag an duine árachuithe sin ina dhiaidh sin.
(2) Gach íocaíocht sochair fhoirlíontaigh do gheobhaidh duine árachuithe ón Aire agus ná beidh sé i dteideal d'fháil fé fhorálacha an Achta so beidh sí ion-aisíoctha aige leis an Aire ar an Aire dá éileamh agus, mara n-aisíoctar amhlaidh í, féadfar í bhaint amach mar fhiacha gnáth-chonnartha in aon chúirt dlighinse inniúla no tré n-a hasbhaint as aon íocaíocht no íocaíochta sochair fhoirlíontaigh chun a mbeidh teideal ag an duine árachuithe sin ina dhiaidh sin.
(3) I gcás inar féidir fé fho-alt (2) den alt so méid d'asbhaint as an sochar foirlíontach a dtiocfaidh duine árachuithe chun bheith ina theideal, beidh sé de dhualgas ar fhostóir pé méid no méideanna ordóidh an tAire d'asbhaint as aon tsochar foirlíontach is iníoctha leis an duine árachuithe fé fhorálacha an Achta so agus aon mhéid no méideanna a hasbhainfear amhlaidh d'íoc leis an Aire.
(4) Aon mhéid a híocfar le fostóir as an gCiste Díomhaointis Fhoirlíontaigh agus ná beidh teideal aigc chuige fé fhorálacha an Achta so beidh sé ion-aisíoctha ag an bhfostóir ar an Aire dá éileamh agus, mara n-aisíoctar amhlaidh é, féadfar é bhaint amach mar fhiacha gnáth-chonnartha in aon chúirt dlighinse inniúla no tré n-a asbhaint as aon mhéid no méideanna thiocfaidh chun bheith iníoctha ina dhiaidh sin leis an bhfostóir sin as an gCiste Díomhaointis Fhoirlíontaigh.

37.—I gcás ina mbeifear tar éis a chinneadh sa tslí foráltar sa Chuid seo den Acht so gan méid áirithe bheidh íoctha ag fostóir do bheith ion-aisíoctha as an gCiste Díomhaointis Fhoirlíontaigh cuirfidh an t-oifigeach árachais an cinneadh in úil don fhostóir d'íoc an méid sin agus don duine do fuair é.
Moltóir agus cúirteanna réiteoirí.
38.—(1) An moltóir a bheidh ceaptha agus ag gníomhú de thurus na huaire fé réim agus chun crícheanna an Unemployment Insurance Act, 1920, isé bheidh ina mholtóir chun crícheanna na Coda so den Acht so, agus dá réir sin cialluíonn an abairt “an moltóir” san Acht so an moltóir a bheidh ceaptha agus ag gníomhú amhlaidh.

(c) i dtaobh teideal duine árachuithe chun sochair fhoirlíontaigh no i dtaobh ráta no méid an tsochair sin; no
(d) i dtaobh teideal fostóra chun aisíoc d'fháil as an gCiste Díomhaointis Fhoirlíontaigh; no
(e) i dtaobh cólíonadh aon fhorála den Chuid seo den Acht so bhaineann le híoc sochair fhoirlíontaigh no le haisíoc as an gCiste Díomhaointis Fhoirlíontaigh;

(6) Cinnfidh an moltóir gach cúrsa cuirfear fé n-a bhráid fén alt so agus ní bheidh dul thar a chinneadh air.
(7) Ní léireofar éinní atá san alt so mar ní a choscann oifigeach árachais no moltóir no cúirt réiteoirí, má cuirtear fíorais nua in úil dó no di, ar chinneadh no moladh bheidh déanta in aon chás áirithe do chlaochló no d'athscrúdú.

41.—I gcás ar bith—
(a) ina gceanglófar ar dhuíne teacht i láthair cúirte réiteoirí agus ina dtiocfa sé amhlaidh; no
(b) ina dtárlóidh, ar athchomharc chun an mholtóra i gcoinnibh cinneadh cúirte réiteoirí, go n-iarrfaidh an moltóir ar dhuine dá ndéanfaidh an cinneadh deifir teacht ina láthair le linn an athchomhairc do breithniú agus go dtiocfa sé ina láthair amhlaidh;
íocfar leis an duine sin as airgead a sholáthróidh an tOireachtas pé liúntais taistil agus eile, agus cúiteamh i gcailliúint aimsire tuillimh d'áireamh, a chinnfidh an tAire le ceadú an Aire Airgeadais.

42.—(1) Féadfaidh an tAire le rialacháin—
(a) a ordú cadé an fhianaise bheidh ag teastáil i dtaobh cólíonadh na gcoinníollacha reachtúla agus na bhforálacha eile den Chuid seo den Acht so bhaineann le teideal duine árachuithe chun sochair fhoirlíontaigh, agus chuige sin a cheangal ar dhaoine árachuithe teacht i láthair ag pé oifigí no áiteanna agus amanna a luadhfar agus a cheangal ar fhostóirí freagra do thabhairt ar fhiosruithe bhainfidh le nithe ar bith a mbeidh eolas ag teastáil ina dtaobh chun go bhféadfar teideal duine árachuithe chun sochair fhoirlíontaigh do chinneadh;
(b) a ordú cadé an t-am agus an tslí agus an fhuirm—
(i) ina ndéanfaidh fostóirí sochar foirlíontach a bheidh dlite do dhaoine árachuithe d'íoc leo,
(ii) ina ndéanfar méideanna sochair fhoirlíontaigh a bheidh íoctha ag fostóirí d'aisíoc leo as an gCiste Díomhaointis Fhoirlíontaigh,
(iii) ina dtógfar ceisteanna chun oifigigh árachais dá gcinneadh,
(iv) ina ndéanfar éinní eile bhainfidh le breac-dhíomhaointeas do thuairisciú, le fáil tuarascbhála i dtaobh breac-dhíomhaointis d'admháil agus le sochar foirlíontach d'íoc agus le sochar foirlíontach a bheidh íoctha ag fostóirí d'aisíoc as an gCiste Díomhaointis Fhoirlíontaigh;
(c) a cheangal ar fhostóirí agus daoine árachuithe agus daoine eile pé eolas do thabhairt a mheasfaidh an tAire is inmhianuithe maidir le híocaíochta sochair fhoirlíontaigh agus le tárlachtaint breac-dhíomhaointis;
(d) a ordú cadé an cleachtadh agus an nós imeachta is leanta nuair a beifear ag breithniú agus ag scrúdú ceisteanna bheidh le breithniú agus le cinneadh ag an moltóir, ag cúirteanna réiteoirí agus ag oifigigh árachais;
(e) socrú do dhéanamh chun duine do cheapadh chun go nglacfadh sé, thar ceann duine no mar ionadaidhe do dhuine a raghaidh dá mheabhair no gheobhaidh bás, suimeanna ar bith is iníoctha as an gCiste Díomhaointis Fhoirlíontaigh leis an duine sin no ina thaobh.
(2) Rialacháin a dhéanfaidh an tAire de bhuadh míre (a) d'fho-alt (1) den alt so ní léireofar iad mar rialacháin a dhéanann deifir d'oibriú an chéad ailt ina dhiaidh seo.

(b) gurbh uaireanna oibre na huaireanna gur ar a bhfeadh a bhí an duine árachuithe sin breac-dhíomhaoin an lá san,
(c) nár Dhomhnach ná lá saoire puiblí do réir bhrí an Achta um Choinníollacha Fostaíochta, 1936 (Uimh. 2 de 1936), an lá san,
(d) nárbh é an lá san an chéad lá de sheal fostaíochta ionárachuithe leis an duine arbh é fostóir an duine árachuithe sin é,
beidh san ina leor-fhianaise, chun crícheanna na Coda so den Acht so, ar na fíorais a deimhneofar amhlaidh mara ndéantar agus go dtí go ndéanfar a mhalairt do chruthú.
(2) I gcás sochar foirlíontach do bheith íoctha le duine árachuithe beidh deimhniú, sa bhfuirm orduithe, ón duine árachuithe sin á dheimhniú gurb é sealbhóir dleathach leabhair áirithe díomhaointis fhoirlíontaigh no, neachtar aca, deimhniú, sa bhfuirm orduithe, ón duine arbh é fostóir an duine sin é tráth íoctha an tsochair fhoirlíontaigh sin á dheimhniú gur deimhin leis gurb é an duine árachuithe sin sealbhóir dleathach an leabhair sin, beidh san ina leor-fhianaise, chun crícheanna na Coda so den Acht so, ar chéannacht an duine árachuithe sin mara ndéantar agus go dtí go ndéanfar a mhalairt do chruthú.
(3) I gcás síntiúis seachtainiúla maidir le duine árachuithe d'íoc tré stampaí árachais fhoirlíontaigh do ghreamú dá leabhar díomhaointis fhoirlíontaigh, agus sochar foirlíontach do bheith íoctha leis an duine árachuithe sin in aon bhliain árachais áirithe, beidh éifeacht ag na forálacha so leanas chun crícheanna an chéad choinníll reachtúil, sé sin le rá:—
(a) beidh deimhniú, sa bhfuirm orduithe agus na mion-innste orduithe ann, ón duine (dá ngairmtear an fostóir sa bhfo-alt so) arbh é fostóir an duine árachuithe sin é tráth íoctha an tsochair fhoirlíontaigh sin á dheimhniú go ndearnadh, roimh an seachtain inar thárla an breacdhíomhaointeas dár híocadh an sochar foirlíontach san, uimhir shonnruithe de shíntiúis seachtainiúla d'íoc maidir leis an duine sin in aghaidh na bliana árachais sin, beidh san ina leor-fhianaise ar na fíorais a deimh neofar amhlaidh mara ndéantar agus go dtí go ndéanfar a mhalairt do chruthú;
(b) beidh deimhniú, sa bhfuirm orduithe agus na mion-innste orduithe ann, ón bhfostóir á dheimhniú go ndearnadh, do réir rialachán ar n-a ndéanamh fé Chuid III den Acht so, ráiteas d'iontráil ar leabhar díomhaointis fhoirlíontaigh reatha an duine árachuithe sin á rá gur híocadh uimhir shonnruithe de shíntiúis seachtainiúla maidir leis an duine árachuithe sin in aghaidh na bliana árachais deiridh roimhe sin, beidh san, mara ndéantar agus go dtí go ndéanfar a mhalairt do chruthú, ina leorfhianaise gur híocadh an uimhir de shíntiúis seachtainiúla deimhneofar amhlaidh do hiontráladh amhlaidh.
(4) I gcás sochar foirlíontach do bheith íoctha le haon duine árachuithe in aghaidh aon lae no coda de lá, beidh deimhniú, sa bhfuirm orduithe, ón duine arbh é fostóir an duine sin é an lá san á dheimhniú go raibh leabhar díomhaointis reatha (ar n-a thabhairt amach fén Unemployment Insurance Act, 1920) an duine árachuithe sin ina sheilbh an lá san beidh san, chun crícheanna an dar coinníll reachtúil, ina leor-fhianaise ar na fíorais a deimhneofar amhlaidh mara ndéantar agus go dtí go ndéanfar a mhalairt do chruthú.

44.—Ní bheidh sochar díomhaointis fén Unemployment Insurance Act, 1920, ná congnamh díomhaointis fén Acht um Chongnamh Dhíomhaointis, 1933 (Uimh. 46 de 1933), iníoctha in aghaidh aon lae a mbeidh sochar foirlíontach íoctha no iníoctha fén Acht so ina aghaidh no in aghaidh coda dhe.
CUID V.
An Ciste Diomhaointis Fhoirliontaigh.
An Ciste Díomhaointis Fhoirlíontaigh do bhunú.
45.—(1) Chun críche an Achta so bunófar, fé urláimh agus bainstighe an Aire, ciste ar a dtabharfar mar ainm agus mar theideal an Ciste Díomhaointis Fhoirlíontaigh, agus íocfar isteach sa Chiste sin na síntiúis seachtainiúla uile is iníoctha ag fostóirí agus ag daoine árachuithe agus aon airgead eile bheidh le n-íoc fén Acht so isteach so Chiste sin, agus íocfar amach as an gCiste sin na híocaíochta uile bheidh le déanamh fén Acht so as an gCiste sin.
(2) Coimeádfar euntais an Chiste Dhíomhaointis Fhoirlíontaigh sa bhfuirm sin ordóidh no cheadóidh an tAire Airgeadais.
(3) Déanfar cuntais an Chiste Dhíomhaointis Fhoirlíontaigh in aghaidh gach bliana cuntasaíochta do chur dá n-iniúchadh ag an Ard-Reachtaire Cunntas agus Ciste agus ar bheith scrúduithe agus deimhnithe dhóibh leagfar iad fé bhráid gach Tighe den Oireachtas.
(4) Féadfar airgead ar bith is cuid den Chiste Dhíomhaointis Fhoirlíontaigh d'íoc anonn o am go ham leis an Aire Airgeadais agus féadfa seisean a shuncáil agus a choimeád suncálta fé mar is rogha leis thar ceann an Chiste sin i ngach slí no in aon tslí no slite aca so leanas, sé sin le rá, do cheannach aon stuic, ciste no urrúis ina mbeidh údaruithe d'iontaobhaithe leis an dlí bheidh i bhfeidhm de thurus na huaire cistí iontaobhais do shuncáil, no do cheannach aon stuic, scaireanna no urrúis a mbeidh an cholann agus t-ús urruithe fé údarás reachtúil ag an Riaghaltas, agus íocfar isteach sa Chiste sin aon ús do gheobhfar as an suncáil sin.
(5) Is airgead Riaghaltais do réir bhrí an Achta um Shuncáil Cheaduithe, 1933 (Uimh. 34 de 1933), airgead a bheidh ar fáil chun a shuncála fén bhfo-alt deiridh sin roimhe seo den alt so agus beidh feidhm ag an Acht san maidir leis dá réir sin.

46.—(1) Aon uair agus a mhinice a chífear don Aire go bhfuil no gur deallrathach go mbeidh an Ciste Díomhaointis Fhoirlíontaigh nea-dhóthanach no iomarcach chun glanta na bhfiachas a bheidh curtha no le cur ar an gCiste sin fén Acht so no go bhfuil no gur deallrathach go mbeidh rátaí na síntiús seachtainiúla iomarcach no nea-dhóthanach, féadfaidh an tAire, le haontú an Aire Airgeadais, éinní no an dá ní aca so leanas do dhéanamh le rialacháin, sé sin le rá:—
(a) an Dara Sceideal a ghabhann leis an Acht so do leasú tré pé rátaí eile síntiús seachtainiúla is oiriúnach leis do chur in ionad rátaí fé seach na síntiús seachtainiúla atá leagtha amach sa dara colún agus sa tríú colún den Sceideal san, ach ní hi slí d'atharódh rátaí na síntiús seachtainiúla go mí-chothrom idir fostóirí agus daoine árachuithe,
(b) an Tríú Sceideal a ghabhann leis an Acht so do leasú tré pé rátaí uairiúla eile sochair fhoirlíontaigh is oiriúnach leis do chur in ionad na rátaí uairiúla sochair fhoirlíontaigh atá leagtha amach sa dara colún den Sceideal san.
(2) Déanfar na tagairtí atá i bhfo-alt (1) den alt so don Dara Sceideal a ghabhann leis an Acht so agus don Tríú Sceideal a ghabhann leis an Acht so do léiriú mar thagairtí do na Sceidil sin fé seach ar n-a leasú le rialacháin ar bith a bheidh déanta fén bhfo-alt san (1).
Réimhíoca as an bPrímh-Chiste.
47.—(1) Féadfaidh an tAire Airgeadais aon tsuimeanna is gá chun glanta fiachas an Chiste Dhíomhaointis Fhoirlíontaigh do réimhíoc as an bPrímh-Chiste no as a thoradh fáis, agus chun na suimeanna bheidh le réimhíoc amhlaidh do chur ar fáil féadfaidh an tAire Airgeadais airgead do thógaint ar iasacht ar pé slí is dóigh leis is ceart agus íocfar isteach sa Stát-Chiste an t-airgead uile tógfar ar iasacht amhlaidh.
(2) Is ar an gCiste Díomhaointis Fhoirlíontaigh a bheidh muirear agus aisíoc aon tsuimeanna réimhíocfar fén bhfo-alt san roimhe seo maraon le muirear agus aisíoc aon úis (más ann) ortha san do réir an ráta san a shocróidh an tAire Airgeadais agus nuair a bheid aisíoctha amhlaidh íocfar isteach sa Stát-Chiste iad.
(3) Is ar an bPrímh-Chiste no ar a thoradh fáis a bheidh muirear agus íoc colna agus úis aon urrúsanna do bhéarfaidh an tAire Airgeadais amach chun airgead do thógaint ar iasacht fén alt so agus fós muirear agus íoc na gcostas fé n-a raghfar maidir leis na hurrúsanna san do thabhairt amach.

49.—(1) Beidh ag cigire, chun an Achta so d'fheidhmiú, comhacht chun gach ní no aon ní no nithe aca so leanas do dhéanamh eadhon—
(a) dul isteach gach tráth réasúnach in aon áitreabh no áit a mbeidh cúis réasúnach aige chun a cheapadh daoine ar bith fostú i bhfostaíocht ionárachuithe do bheith ar fostú ann no breacacháin ar bith i dtaobh aon daoine den tsórt san do bheith á gcoimeád ann;
(b) pé scrúdú agus fiosrú do dhéanamh is gá chun a fháil amach an bhfuil forálacha an Achta so á gcólíonadh in aon áitreabh no áit áirithe den tsórt san;
(c) scrúdú do dhéanamh, ina aonar no i bhfianaise duine eile, fé mar is oiriúnach leis, maidir le nithe ar bith fén Acht so, ar gach duine do gheobhaidh sé in aon áitreabh no áit den tsórt san no a mbeidh cúis réasúnach aige chun a chreidiúint gur duine fostuithe no gur dhuine fostuithe é, agus a cheangal ar gach duine den tsórt san dul fén scrúdú san agus dearbhú do shighniú i dtaobh fírinne na nithe a scrúdófar ina dtaobh é amhlaidh;
(d) pé comhachta eile d'fheidhmiú is gá chun an Achta so do chur in éifeacht.
(2) Bhéarfaidh sealbhaire aon áitreibh no áite den tsórt san agus duine ar bith eile ag á mbeidh aon duine árachuithe ar fostú, agus seirbhísigh agus gníomhairí aon tsealbhaire no duine eile den tsórt san, agus aon duine fostuithe, bhéarfaidh do chigire ar bith gach eolas agus bhéarfaidh ar áird chun a n-iniúchta gach clár, leabhar, cárta, duille páigh, breacachán páigh agus scríbhinn eile theastóidh ón gcigire do réir réasúin.
(3) Má dhéanann duine ar bith cigire do mhoilliú no do chose go toiliúil agus é ag feidhmiú aon chomhachta fén alt so no má fhaillíonn an t-eolas san adubhradh do thabhairt no na scríbhinní sin adubhradh do thabhairt ar áird, no má dhéanann duine ar bith do cheilt no do bhac no má fhéachann le n-a cheilt no le n-a bhac ar theacht i láthair cigire no ar chigire dá scrúdú, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil nach mó ná cúig púint do chur air.
(4) Ní eeanglófar ar dhuine ar bith fén alt so aon cheist do fhreagairt ná aon fhianaise do thabhairt a raghadh chun é féin do choiriú.
(5) Bhéarfar deimhniú a cheaptha do gach cigire, agus nuair a bheidh sé á iarraidh é leigean isteach in áitreabh no áit ar bith chun crícheanna an Achta so déanfaidh, má hiarrtar san air, an deimhniú san do thaisbeáint don tsealbhaire.
CUID VII.

50.—I gcás duine (dá ngairmtear an fostóir sa bhfo-alt so) d'fhoirceannadh na fostaíochta i bhfostaíocht ionárachuithe bheidh ag duine (dá ngairmtear an fostaidhe sa bhfo-alt so) ba dhuine eiscithe díreach roimh an bhfoirceannadh san, beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) i gcás an fostaidhe do bheith ina dhuine eiscithe ar feadh an dá sheachtain déag díreach roimh an bhfoirceannadh san, íocfaidh an fostóir leis an Aire, in aghaidh an dá sheachtain déag san, suim is có-ionann le méid na síntiús seachtainiúla do bheadh iníoctha, dá mba nár dhuine eiscithe an fostaidhe ar feadh an dá sheachtain déag san, maidir leis an bhfostaidhe fén Acht so in aghaidh an dá sheachtain déag san;
(b) i gcás gan an fostaidhe do bheith ina dhuine eiscithe ar feadh an dá sheachtain déag díreach roimh an bhfoirceannadh san, íocfaidh an fostóir leis an Aire, in aghaidh na seachtainí díreach roimh an bhfoirceannadh san a raibh an fostaidhe ina dhuine eiscithe ar a bhfeadh, suim is có-ionann le méid na síntiús seachtainiúla do bheadh iníoctha, dá mba nár dhuine eiscithe an fostaidhe ar feadh na seachtainí sin, maidir leis an bhfostaidhe fén Acht so in aghaidh na seachtainí sin;
(c) ní bheidh aon chuid de shuim ar bith íocfaidh an fostóir fén bhfo-alt so ion bhainte ag an bhfostóir den fhostaidhe;
(d) suim ar bith is iníoctha leis an Aire ag an bhfostóir fén alt so is tuigthe, chun crícheanna na bhforálacha eile (agus na forálacha peannaideacha d'áireamh) den Acht so, í bheith ina síntiúis seachtainiúla, agus beidh feidhm dá réir sin ag na forálacha san;
(e) íocfar isteach sa Chiste Díomhaointis Fhoirlíontaigh suim ar bith a bhainfidh an tAire amach no a híocfar leis fén alt so;
(f) suimeanna ar bith a bhainfidh an tAire amach no a híocfar leis fén alt so in aghaidh seachtainí ar bith is tuigthe, chun crícheanna an chéad choinníll reachtúil, iad do bheith ina síntiúis seachtainiúla ar n-a n-íoc fé Chuid III den Acht so maidir leis an bhfostaidhe in aghaidh na seachtainí sin.
Ciontaí.
51.—(1) Má dhéanann duine ar bith go feasach, d'fhonn aon tsochar foirlíontach no íocaíocht no aisíocaíocht d'fháil fén Acht so dó féin no do dhuine ar bith eile no d'fhonn dul o aon íocaíocht a bheidh le déanamh aige féin fén Acht so no d'fhonn a chumasú do dhuine ar bith eile dul o aon íocaíocht den tsórt san, aon ráiteas bréagach do thabhairt uaidh no cúis bhréagach do phlé no ponc tábhachtach do cheilt, beidh an duine sin ciontach i gcionta fén bhfo-alt so agus ar a chiontú ann ar an slí achmair dlighfear príosúntacht ar feadh téarma nach sia ná trí mhí no fíneáil nach mó ná cúig púint fhichead do chur air.
(2) Más rud é—
(a) go bhfailleoidh no go mainneoidh aon fhostóir no duine árachuithe aon tsíntiúis seachtainiúla d'íoc a dhlighfe sé fén Acht so d'íoc, no
(b) go mbeidh aon fhostóir no duine árachuithe no aon duine eile ciontach in aon tsárú no nea-chólíonadh, ar aon cheann de cheanglais an Achta so no de na rialacháin a bheidh déanta fé, ná beidh aon phionós speisialta ceaptha ina thaobh, no
(c) go ndéanfaidh fostóir ar bith síntiús iomlán an fhostóra no aon chuid de do bhaint, no go dtabharfaidh fé n-a bhaint, de phágh no de luach saothair eile duine árachuithe,
beidh an duine sin ciontach i gcionta fén bhfo-alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil nach mó ná deich bpúint do chur air.
(3) I gcás fostóir do chiontú fé fho-alt (2) den alt so sa chionta san faillighe no mainneachtain in íoc aon tsíntiús seachtainiúla dhlighfe sé fén Acht so d'íoc, dlighfe sé íoc do dhéanamh leis an gCiste Díomhaointis Fhoirlíontaigh i suim is có-ionann leis an méid d'fhailligh no do mhainnigh sé amhlaidh d'íoc, agus ar é chiontú amhlaidh féadfar, má rinneadh fógra i dtaobh a bheith beartuithe san do dhéanamh do sheirbheáil i dteanta na gairme no an bharántais, fianaise do thabhairt i dtaobh an fhostóra dá fhaillighe no dá mhainneachtain síntiúis seachtainiúla eile d'íoc maidir leis an duine céanna i rith na dtrí mblian roimh dháta déanta na haisnéise amhlaidh, agus ar an bhfaillighe no an mhainneachtain sin do chruthú dlighfidh an fostóir íoc do dhéanamh leis an gCiste Díomhaointis Fhoirlíontaigh i suim is co-ionann le hiomlán na síntiús seachtainiúla cruthófar amhlaidh d'fhailligh no do mhainnigh sé d'íoc.
Deighleálfar le suim ar bith íocfaidh fostóir fén bhfo-alt so mar íoc i nglanadh na síntiús seachtainiúla neamh-íoctha, agus ní bheidh cuid an duine árachuithe de na síntiúis seachtainiúla san ionbhainte ag an bhfostóir den duine árachuithe.
(4) Gach duine—
(a) a dhéanfaidh aon chárta díomhaointis fhoirlíontaigh, leabhar díomhaointis fhoirlíontaigh no stampa árachais fhoirlíontaigh úsáidthe do cheannach, do dhíol no do thairgsint chun a dhíolta, do thógaint no do thabhairt ar malairt, no do chur no do ghlacadh i ngeall, no
(b) bhéarfaidh fé dhul o íoc síntiúis seachtainiúil tré stampa árachais fhoirlíontaigh úsáidthe, do bhain sé féin no duine ar bith eile as aon leabhar díomhaointis fhoirlíontaigh no cárta díomhaointis fhoirlíontaigh no d'aon abhar eile dá raibh sé greamuithe no do húsáideadh roimhe sin in aon tslí eile, do ghreamú no tabhairt fé n-a ghreamú d'aon leabhar díomhaointis fhoirlíontaigh no cárta díomhaointis fhoirlíontaigh,
beidh sé ciontach i gcionta fén bhfo-alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil nach mó ná fiche punt do chur air agus is tuigthe, in aon imeachta fén bhfo-alt so maidir le stampaí úsáidthe, gur húsáideadh stampa má rinneadh é chealú no é aghaloit in aon tslí no é bhaint as aon leabhar díomhaointis fhoirlíontaigh no cárta díomhaointis fhoirlíontaigh no d'aon abhar eile dá raibh sé greamuithe agus pé aca a húsáideadh é iarbhfír chun síntiús seachtainiúil d'íoc no nár húsáideadh.
(5) Ní léireofar éinní atá san alt so mar ní a choscann an tAire ar aon tsuimeanna bheidh dlite don Chiste Díomhaointis Fhoirlíontaigh do bhaint amach tré imeachta síbhialta agus féadfar na suimeanna uile den tsórt san do bhaint amach mar fhiacha bheidh dlite don Stát agus gan dochar d'aon leigheas eile féadfaidh an tAire iad do bhaint amach mar fhiacha gnáth-chonnartha in aon chúirt dlighinse inniúla.
(6) In aon imeachta fén alt so no in aon imeachta ina mbeidh ceist i dtaobh íoc síntiús seachtainiúla fén Acht so le socrú no chun aon tsuimeanna bheidh dlite don Chiste Díomhaointis Fhoirlíontaigh do bhaint amach, is breith gan dul tháirsi, chun crícheanna na n-imeacht san, an bhreith do bhéarfaidh an tAire ar cheist ar bith i dtaobh duine do bheith ina dhuine árachuithe do réir bhrí an Achta so no gan a bheith no i dtaobh cérbh é fostóir duine árachuithe no i dtaobh ráta an tsíntiúis seachtainiúil is iníoctha maidir le duine árachuithe marab amhlaidh a bheidh athchomharc i gcoinnibh na breithe ar feitheamh no an tréimhse chun athchomharc do dhéanamh i gcoinnibh na breithe gan caitheamh, agus, mara mbeidh breith den tsórt san faighte agus gur gá an cheist do chinneadh chun na n-imeacht do chríochnú, cuirfear an cheist fé bhráid an Aire chun a cinnte do réir forálacha an Achta so agus, i gcás aon athchomharc den tsórt san do bheith ar feitheamh no an tréimhse chun athchomharc do dhéanamh amhlaidh do bheith gan caitheamh no ceist ar bith do bheith curtha amhlaidh fé bhráid an Aire, déanfaidh an chúirt a bheidh ag deighleáil leis an gcás na himeachta do chur ar athló go dtí go mbeidh breith chinnte faighte ar an gceist.
(7) Suim ar bith a dlighfidh fostóir d'íoc fé fho-alt (3) den alt so no suim ar bith a bheidh dlite don Chiste Díomhaointis Fhoirlíontaigh agus a mbeidh cúirt tar éis ordú íoca do dhéanamh ina taobh, féadfaidh an tAire, gan dochar d'aon mhodhanna eile chun í bhaint amach, í asbhaint as aon tsuimeanna is iníoctha as an gCiste Díomhaointis Fhoirlíontaigh leis an bhfostóir sin fén Acht so agus déanfaidh an tAire aon tsuimeanna a hasbhainfear amhlaidh d'íoc isteach sa Chiste Díomhaointis Fhoirlíontaigh.

52.—(1) Ní déanfar imeachta i dtaobh cionta fén Acht so do bhunú ach amháin ag an Aire no le toiliú an Aire no ag cigire no oifigeach eile bheidh ceaptha chun críche an Achta so agus a bheidh údaruithe chuige sin le hordacháin speisialta no generálta ón Aire.
(2) Féadfar cúiseamh i dtaobh cionta fé alt ar bith den Acht so do bhunú ar agra an Aire.
(3) Féadfar cúiseamh i dtaobh cionta fé alt ar bith den Acht so do bhunú aon tráth laistigh de pé tréimhse aca so leanas is déanaighe raghaidh in éag, sé sin le rá:—
(a) trí mhí ón dáta ar a ndeimhneofar i scríbhinn fé shéala oifigiúil an Aire seilbh no fáil do bheith ag an Aire ar fhianaise is leor chun a dhéanamh cóir an cúiseamh san do bhunú, no
(b) bliain o am an chionta do dhéanamh.
Imeachta síbhialta i gcoinnibh fostóra.
53.—(1) Má fhaillíonn no má mhainníonn fostóir ar bith aon tsíntiúis seachtainiúla d'íoc a dhlighfe sé fén Acht so d'íoc maidir le haon duine árachuithe ar fostú aige no má fhaillíonn no má mhainníonn sé géilleadh maidir le haon duine den tsórt san d'aon cheanglais eile de chuid an Achta so agus do na rialacháin a bheidh déanta fé agus go gcaillfidh an duine sin, dá dheascaibh sin, iomlán an tsochair fhoirlíontaigh no cuid den tsochar fhoirlíontach chun a mbeadh teideal aige fén Acht so, beidh sé i dteideal suim is cóionann le méid an tsochair fhoirlíontaigh a chaillfidh amhlaidh do bhaint den fhostoir mar fhiacha gnáth-chonnartha.
(2) Féadfar imeachta do bhunú fén alt so d'ainneoin gur bunuíodh imeachta fé aon fhoráil eile den Acht so mar gheall ar an bhfaillighe no ar an mainneachtain chéanna.
Aois agus bás do chruthú.
54.—I gcás inar gá chun crícheanna an Achta so aois no bás duine ar bith do chruthú tré dheimhniú beireatais no báis do thabhairt ar áird, beidh duine ar bith, ar iarratas i scríbhinn do thíolacadh i pé fuirm agus ina mbeidh pé mion-innste ordóidh an tAire Riaghaltais Aiteamhail agus Sláinte Poiblidhe agus ar íoc táille sé pingne i gcás deimhnithe bheireatais agus táille scillinge i gcás deimhnithe bháis, i dteideal cóip dheimhnithe d'fháil d'iontráil beireatais no báis (pé aca é) an duine sin a céad-luaidhtear i gclár na mbeireatas no na mbásanna (pé aca é) agus an chóip sin fé láimh an chlárathóra no an cheann-chlárathóra no an duine eile ar a mbeidh cúram an chláir sin, agus déanfaidh gach clárathóir beireatas agus básanna agus gach ceann-chlárathóir no duine eile ar a mbeidh cúram an chláir fuirmeacha i gcóir an iarratais sin do chur ar fáil in aisce má hiarrtar iad.

55.—Ní bheidh diúitéthe stampa inéilithe ar scríbhinní a húsáidfear maidir le gnó fén Acht so.

56.—(1) Má eiríonn aon deacracht i slí ar bith i dtaobh an Achta so no aon fhorála dhe do chur i ngníomh, féadfaidh an tAire, le toiliú an Aire Airgeadais, éinní do dhéanamh le hordú a chífear dó do bheith riachtanach no oiriúnach chun an Achta so no na forála san do chur i ngníomh, agus féadfaidh aon ordú den tsórt san forálacha an Achta so do mhodhnú sa mhéid a chífear don Aire do bheith riachtanach no oiriúnach chun an orduithe do chur in éifeacht.
(2) Ní cead aon ordú do dhéanamh fén alt so tar éis dhá bhliain ón dáta ar a dtiocfaidh iomlán an Achta so i ngníomh.

INSURANCE (INTERMITTENT UNEMPLOYMENT) ACT, 1942.
PART I.
Preliminary and General.
Short title and commencement.
1.—(1) This Act may be cited as the Insurance (Intermittent Unemployment) Act, 1942.
(2) This Act (except sections 18 and 28) shall come into operation immediately upon the passing thereof.
(3) Section 18 of this Act shall come into operation on such day as shall be fixed for the purpose by order of the Minister.
(4) Section 28 of this Act shall come into operation on such day as shall be fixed for the purpose by order of the Minister.
Interpretation generally.
2.—(1) In this Act—
the expression “the Minister” means the Minister for Industry and Commerce;
the expression “local office” means an employment exchange or other office which is a local office for the purposes of regulations made under section 6 of the Unemployment Insurance Act, 1920, in relation to the collection of contributions under that Act; the expression “local officer”means an officer who for the time being is in charge of a local office;
the expression “calendar week” means the period of seven days commencing from midnight between Sunday and Monday;
the word “prescribed” means prescribed by regulations made by the Minister under this Act.
(2) A person shall for the purposes of this Act be deemed not to have attained the age of sixteen until the commencement of the sixteenth anniversary of the day of his birth and similarly with respect to other ages.
(3) References in this Act to any enactment shall be construed as references to that enactment as amended or extended by any subsequent enactment.
Employment in the building trade.
3.—In this Act the expression “employment in the building trade” means employment on work of a kind commonly undertaken or carried out by builders or building contractors, and includes employment on work of the following descriptions, that is to say:—
(a) all work in the construction, reconstruction, alteration, repair, painting, decoration or demolition of buildings;
(b) all work in the installation, alteration, fitting, repair, painting, decoration, maintenance or demolition in any building or its site of articles, fittings, pipes, containers, tubes, wires or instruments (including central heating apparatus or machinery or fuel containers connected thereto), for the heating, lighting, power or water supply of such building, but excluding work in the construction or laying of public mains for the supply of water, gas, or electricity or the connection of buildings and their sites with such mains;
(c) all work usually carried out or undertaken by a builder or building contractor—
(i) in the clearing and laying out of sites for buildings,
(ii) in the construction of foundations on such sites,
(iii) in the construction, reconstruction, repair and maintenance within such sites of all sewers, drains or other works for use in connection with the sanitation of buildings or the disposal of waste,
(iv) in the erection on such sites of boundary walls or fences for the use, protection or ornamentation of buildings,
(v) in the making of roads and paths within the boundaries of such sites;
(d) all work in the manufacture, alteration, fitting or repair of articles of wood, worked stone, marble, slate, plaster, cement (including concrete blocks) or of cement-like material, for use in the construction, reconstruction, alteration, fitting, repair, decoration or maintenance of buildings and of a type commonly made in builders' workshops or yards, but excluding—
(i) the manufacture, alteration or repair of any article or monument designed as a memorial to living or dead persons,
(ii) the quarrying and cutting of slate at a quarry,
(iii) the quarrying in rough blocks of marble or stone,
(iv) the manufacture of articles of movable furniture,
(v) the manufacture of articles requiring treatment in an oven or kiln in the process of manufacture,
(vi) the manufacture of sewer pipes, drain pipes, bricks, floor tiles, roof tiles,
(vii) the manufacture of articles composed wholly or mainly of a combination of cement and asbestos.
Insurable employment.
4.—In this Act the expression “insurable employment” means employment by way of manual labour that—
(a) is either—
(i) employment in the building trade, or
(ii) employment in any other trade that is declared by an order made by the Minister under this Act to be insurable employment for the purposes of this Act, and
(b) is not an employment specified in the First Schedule to this Act.
Excepted persons.
5.—(1) Whenever the Minister is satisfied, in respect of any class of persons employed by a particular employer in an insurable employment, that—
(a) having regard to the normal practice of such employer, the employment of such class of persons is permanent in character, and
(b) no deductions are made on account of time lost owing to inclement weather from wages of such class of persons, and
(c) the other circumstances of the employment of such class of persons render it unnecessary that persons belonging to such class should be insured under this Act,
he may issue to such employer a certificate (in this Act referred to as a certificate of exception) that he is so satisfied.
(2) Where a certificate of exception in respect of a class of persons has been issued to an employer, then, any person employed by such employer who belongs to such class and who has completed three years or more permanent service with such employer shall, so long as such certificate is in force and such person remains in the employment of such employer, be an excepted person for the purposes of this Act, and the expression “excepted person” shall in this Act be construed accordingly.
(3) The Minister may at any time revoke any certificate of exception.
Insured persons.
6.—In this Act the expression “insured person” means any person of the age of sixteen years or upwards who is employed in insurable employment under a contract of service or apprenticeship, written or oral, whether expressed or implied and whether such person is paid by the employer or some other person, and whether paid by time or by the piece or partly by time and partly by the piece, or otherwise, or without any money payment, but does not include a person employed under a contract of apprenticeship under which no money is payable by the employer, or a person who is for the time being an excepted person.
Classes of insured persons.
7.—(1) In this Act—
the expression “skilled worker” means—
(a) as respects employment in the building trade, an insured person who is employed under a contract of service or apprenticeship in (i) the capacity of carpenter, joiner, wood-cutting machinist, bricklayer, mason, stonecutter, stonelayer, terrazzo and mosaic worker, floor and wall tiler, plasterer, slater, roof-tiler, painter, paperhanger, decorator, glazier, plumber, heating-fitter, gas-fitter, french-polisher or electrician, or (ii) such other capacity as the Minister may decide generally or in a particular case to be employment as a skilled worker,
(b) as respects employment in any other trade that is declared by an order made by the Minister under this Act to be insurable employment for the purposes of this Act, an insured person who is employed under a contract of service or apprenticeship in (i) a capacity which constitutes such person a skilled worker as defined by such order or (ii) such other capacity as the Minister may decide generally or in a particular case to be employment as a skilled worker;
the expression “unskilled worker” means an insured person who is not a skilled worker;
the expression “young person” means an insured person who has attained the age of sixteen years but has not attained the age of twenty-one years.
(2) A person (other than a person who has attained the age of twenty-one years before the date of the commencement of section 18 of this Act) shall not be regarded as a skilled worker or an unskilled worker until the first day after the termination of the insurance year in which he has attained the age of twenty-one years.
(3) A person who attains the age of twenty-one years after the date of the commencement of section 18 of this Act shall be regarded as a young person until the last day of the insurance year in which he attains that age.
(4) An insured person who is a skilled worker and whose normal occupation alters in such way as to make him an unskilled worker shall be regarded as a skilled worker until such date as it is proved to the satisfaction of the Minister that the normal occupation of the insured person has so altered.
(5) An insured person who is an unskilled worker and whose normal occupation alters in such way as to make him a skilled worker shall be regarded as an unskilled worker until such date as it is proved to the satisfaction of the Minister that the normal occupation of the insured person has so altered.
Inclement weather and intermittent unemployment.
8.—In this Act—
the expression “inclement weather” means weather that, owing to rain, storm, snow, hail, frost, flood, or other adverse climatic condition, renders temporarily unsafe or impracticable the performance of work in an insurable employment, having regard to the health or safety of the persons engaged therein or to the nature or technical requirements of the work;
the expression “intermittent unemployment” means unemployment and consequent loss of wages due to stoppage of work which is unavoidable owing to inclement weather, in an insurable employment, and the expression, “intermittently unemployed” shall be construed accordingly.
Insurance year.
9.—(1) In this Act the expression “insurance year” means such period as may be prescribed.
(2) Until regulations are made by the Minister prescribing the period which is to be an insurance year, each of the following periods shall be an insurance year for the purposes of this Act, that is to say:—
(a) the period (in this Act referred to as the first insurance year) commencing on the date of the commencement of section 18 of this Act and ending on the first Sunday in the month of October next following the commencement of the said section 18,
(b) any period (being a period subsequent to the first insurance year) commencing on the Monday following the first Sunday in each October and ending on the first Sunday in October in the next following year.
Decision of questions by Minister.
10.—(1) If any question arises—
(a) as to whether any employment or any class of employment is, was or will be such employment as to make the person employed therein an insured person within the meaning of this Act or whether a person is or was an insured person within the meaning of this Act, or
(b) as to whether an insured person is or was a skilled worker or an unskilled worker or a young person within the meaning of this Act, or
(c) as to who is or was the employer of any insured person, or
(d) as to the rate of weekly contribution to be paid under this Act in respect of an insured person,
the question shall be decided by the Minister, but the Minister may, if he thinks fit, instead of himself deciding any such question, refer the question for decision to the High Court.
(2) Any person aggrieved by the decision of the Minister under this section may appeal from that decision to the High Court.
(3) The Minister may, on new facts being brought to his notice, revise or reverse any decision given by him under this section, other than a decision against which an appeal is pending or as respects which the time for appealing has not expired, and an appeal shall lie against any such revised or reversed decision in the same manner as against an original decision.
(4) The rules of court for regulating appeals and references to the High Court under sub-section (3) of section 10 of the Unemployment Insurance Act, 1920, shall apply to appeals and references to the High Court under this section.
(5) The Minister shall be entitled to appear and be heard on any appeal or reference under this section.
(6) Notwithstanding anything in any Act an appeal or reference under this section shall be to a single judge of the High Court to be nominated by the Chief Justice for the purpose, and the decision of the High Court on an appeal or reference under this section shall be final and conclusive.
(7) The Minister may by regulations prescribe the procedure to be followed on the consideration of questions to be decided by him under this Act.
Application of this Act to persons employed by the State.
11.—This Act shall apply to persons employed in insurable employment by the State to whom this Act would apply if the employer were a private person, except to such of those persons as are serving in an established capacity in the permanent service of the State or having been granted certificates by the Civil Service Commissioners are serving a probationary period preliminary to establishment.
Regulations generally.
12.—The Minister may make regulations for any of the following purposes, that is to say:—
(a) for any purpose for which regulations are expressly authorised to be made by any of the provisions of this Act;
(b) for prescribing any matter or thing which is referred to in this Act as prescribed or to be prescribed; and
(c) generally for carrying this Act into effect.
Laying of regulations before Houses of the Oireachtas.
13.—Every regulation made by the Minister under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling such regulation is passed by either such House within the next subsequent twenty-one days on which such House has sat after such regulation is laid before it, such regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done under such regulation.
Expenses of the Minister.
14.—The expenses incurred by the Minister in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Extension of meaning of “insurable employment” and “skilled worker”.
15.—(1) The Minister, with the consent of the Minister for Finance, may, whenever and so often as he thinks fit by order—
(a) declare that employment in any trade (defined in such manner as the Minister thinks fit) shall be insurable employment for the purposes of this Act,
(b) define, by reference to employment in such capacities as the Minister thinks proper and specifies in such order, the expression “skilled worker” in relation to the employment declared by such order to be insurable employment.
(2) No order made under this section shall come into force unless and until it has been laid before each House of the Oireachtas and has been confirmed by resolution of each such House.
PART II.
Compulsory Insurance Against Intermittent Unemployment.
Insured persons to be insured against intermittent unemployment.
16.—Every insured person shall be insured in the manner provided by this Act against intermittent unemployment.
PART III.
Contributions by Employers and Insured Persons.
Sources of contributions.
17.—The funds required for providing supplementary benefit and for making any other payments that under this Act are to be made out of the Supplementary Unemployment Fund established under this Act shall be derived partly from weekly contributions by insured persons, and partly from weekly contributions by the employers of those persons.
Liability of employers and insured persons for contributions.
18.—(1) Every insured person of the classes set out in the first column of the Second Schedule to this Act and every employer of any such insured person shall be liable to pay contributions (in this Act referred to as weekly contributions) weekly at the respective rates set out in the second and third columns of that Schedule or, if other rates are under this Act substituted for such first-mentioned rates, the rates for the time being so substituted.
(2) Except where otherwise prescribed by regulations under this Act, the employer of an insured person shall in the first instance be liable to pay both the weekly contribution payable by himself (in this Act referred to as the employer's contribution) and also on behalf of and to the exclusion of such insured person, the weekly contribution payable by such insured person (in this Act referred to as the insured person's contribution), and for the purposes of this Act weekly contributions paid by an employer on behalf of an insured person shall be deemed to be weekly contributions by the insured person.
(3) A weekly contribution shall be payable for each calendar week during the whole or any part of which an insured person has been employed by an employer, subject however as follows:—
(a) where one weekly contribution has been paid in respect of an insured person in any calendar week, no further weekly contribution shall be payable in respect of him for the same calendar week, and
(b) where no services are rendered by an insured person during any calendar week and no remuneration is paid in respect of that calendar week, the employer shall not be liable to pay any weekly contribution either on his own behalf or on behalf of the insured person in respect of that calendar week.
(4) Where a person is employed in any calendar week under the same employer partly in insurable employment and partly in other employment, then, notwithstanding anything contained in sub-section (3) of this section, no weekly contribution shall be payable in respect of that person for that calendar week unless half or more than half of the time during which he is so employed is in the in-surable employment.
Employer's contribution irrecoverable from insured person.
19.—Notwithstanding any contract to the contrary, the employer of an insured person shall not be entitled to deduct from the wages of, or otherwise to recover from such insured person, the employer's contribution.
Recovery by employer of insured person's contribution.
20.—(1) Subject to the provisions of this section and subject to any regulations which the Minister may make under this Act, the employer of an insured person shall be entitled to recover from such insured person in accordance with the provisions of this section the amount of any weekly contributions paid by him on behalf of such insured person.
(2) Where an insured person receives wages or other pecuniary remuneration from his employer, the amount of any weekly contribution paid by the employer on behalf of such insured person shall, notwithstanding the provisions of any Act or any contract to the contrary, be recoverable by means of deductions from the wages of such insured person or from any other remuneration due from the employer to such insured person and not otherwise, but no such deductions may be made from any wages or remuneration other than such as are paid in respect of the period or part of the period in respect of which the weekly contribution is payable, or in excess of the sum which represents the amount of the weekly contributions for the period in respect of which the wages or other remuneration are paid.
(3) Where a weekly contribution paid by the employer of an insured person on behalf of such insured person is recoverable from such insured person, but is not recoverable by means of deductions as aforesaid, it shall (without prejudice to any other means of recovery) be recoverable as a simple contract debt in a court of competent jurisdiction but no such weekly contribution shall be recoverable unless proceedings for the purpose are instituted within three months from the date when the contribution was payable.
(4) Where an insured person is not paid wages or other money payments by his employer or any other person, the employer shall be liable to pay the weekly contributions payable both by himself and such insured person and shall not be entitled to recover any part thereof from such insured person.
(5) Any sum deducted by an employer from wages or other remuneration under this section shall be deemed to have been entrusted to him for the purpose of paying the weekly contribution in respect of which it was deducted.
Persons to be treated as employers in certain cases.
21.—Where an insured person is employed by more than one person in any calendar week, the first person employing him in that week shall be deemed to be the employer of such insured person for the purposes of the provisions of this Act relating to the payment of weekly contributions.
Date from which contributions are payable in certain cases.
22.—(1) Where it has been decided by the Minister in manner provided by this Act that weekly contributions under this Act are not payable in respect of any person or class of persons and that decision is subsequently revised or reversed by him or, on appeal, by the High Court so as to make weekly contributions payable in respect of that person or that class of persons, weekly contributions shall be so payable only as from the date on which the decision was revised or reversed.
(2) Where it has been decided by the Minister that weekly contributions in respect of a person or class of persons are payable at a particular rate under this Act and that decision is subsequently revised or reversed by him or, on appeal, by the High Court so as to make weekly contributions payable at another rate in respect of that person or class of persons, weekly contributions shall be so payable at such other rate only as from the date on which the decision was revised or reversed.
Repayment in certain cases of contributions.
23.—Any weekly contributions paid by a person and his employer respectively under the erroneous belief that the weekly contributions were payable in respect of that person under the provisions of this Act may be returned to them by the Minister on application being made to him in that behalf in such form as he may require before the expiration of twelve months from the date the weekly contributions were paid, subject, in the case of the insured person's contributions, to the deduction of any amount of supplementary benefit received by him to which he would not have been entitled if these weekly contributions had not been paid.
Power to make regulations as to payment of contributions by stamps, etc.
24.—The Minister may make regulations providing for any matters incidental to the payment and collection of weekly contributions and in particular for—
(a) the payment of weekly contributions
(i) by means of adhesive or other stamps (in this Act referred to as supplementary insurance stamps) affixed to or impressed upon books or cards (in this Act respectively referred to as supplementary unemployment books and supplementary unemployment cards) or otherwise, and for regulating the manner, times and conditions in, at, or under which supplementary insurance stamps are to be affixed or impressed; or
(ii) by direct payments by the employers of insured persons to the Minister in such manner, at such times and under such conditions as the Minister may prescribe; or
(iii) by such other means as the Minister may by such regulations prescribe;
(b) the entry in or upon supplementary unemployment books or cards of particulars of weekly contributions paid in respect of any specified period or of such other particulars as may be required in the case of the persons to whom the supplementary unemployment books or cards relate, and for the acceptance of such entry as sufficient evidence of the number of weekly contributions so paid, or of the other particulars so entered;
(c) the application for, the issue, sale, custody, production and delivery up of supplementary unemployment books or cards and the replacement of supplementary unemployment books or cards which have been lost, destroyed or defaced;
(d) the rendering by employers to the Minister of such particulars relating to persons employed by them as the Minister may require or by such regulations prescribe.
Issue of supplementary insurance stamps.
25.—Supplementary insurance stamps shall be prepared and issued in such manner as the Revenue Commissioners, with the consent of the Minister for Finance, may direct and the said Commissioners may, by regulations, provide for applying, with the necessary adaptations, as respects supplementary insurance stamps, all or any of the provisions, including penal provisions, of the following enactments, that is to say, sections 21, 35, and 36 of the Inland Revenue Regulation Act, 1890, the Stamp Duties Management Act, 1891, section 9 of the Stamp Act, 1891, and section 65 of the Post Office Act, 1908, and may, with the consent of the Minister for Posts and Telegraphs, provide for the sale of supplementary insurance stamps at Post Offices.
Provision for enabling Minister for Posts and Telegraphs to exercise powers in relation to supplementary insurance stamps.
26.—(1) The Government may by order provide that any powers and duties of the Revenue Commissioners with reference to supplementary insurance stamps shall be exercised and performed by the Minister for Posts and Telegraphs, either to the exclusion of the Revenue Commissioners or concurrently with the Revenue Commissioners, and any such order may contain such provisions as appear to the Government to be necessary or expedient for giving full effect to the exercise and performance of the duties to which such order relates in the manner provided by such order.
(2) Every order under this section shall have the force of law.
Priority of claims for contributions due by a bankrupt employer.
27.—(1) There shall be included among the debts that under section 209 of the Companies Consolidation Act, 1908, are in the distribution of assets of a company being wound up to be paid in priority to all other debts all weekly contributions payable under this Act by the company in respect of insured persons during the four months before the commencement of the winding-up or the winding-up order, and that Act shall have effect accordingly and formal proof of the debts to which priority is given under this section shall not be required except in cases where it may otherwise be provided by the rules made under that Act.
(2) Sub-section (1) of this section shall not apply where a company is wound up voluntarily merely for the purposes of reconstruction or of amalgamation with another company.
(3) There shall be included among the debts that under section 4 of the Preferential Payments in Bankruptcy (Ireland) Act, 1889, are in the distribution of the property of a bankrupt or arranging debtor to be paid in priority to all other debts all weekly contributions payable by the bankrupt or arranging debtor in respect of insured persons during the four months before the date of the order of adjudication in the case of a bankrupt or the filing of the petition for arrangement in the case of an arranging debtor and that Act shall have effect accordingly and formal proof of the debts to which priority is given under this sub-section shall not be required except in cases where it may otherwise be provided by general orders made under the said Act.
PART IV.
Supplementary Benefit.
Right to supplementary benefit and periods in respect of which it is payable.
28.—(1) Every insured person who is intermittently unemployed on any day (other than a Sunday or a public holiday within the meaning of the Conditions of Employment Act, 1936 (No. 2 of 1936), or the first day of a spell of insurable employment with the person who was his employer when such intermittent unemployment occurred) and in whose case the statutory conditions are fulfilled shall, subject to the provisions of this Act, be entitled to receive payment (in this Act referred to as supplementary benefit) in respect of each hour of intermittent unemployment occurring on such day during working hours.
(2) Where the duration of a period of intermittent unemployment occurring during working hours on any day is a fraction of an hour only or is one or more hours and a fraction of an hour, supplementary benefit shall not be payable in respect of such fraction of an hour and, for the purposes of this sub-section, where two or more periods of intermittent unemployment occur during working hours on any day such periods shall be deemed to be one continuous period.
(3) In this section the expression “working hours” means, in relation to an insured person, the hours, exclusive of overtime and mealtime, during which, if there was not inclement weather, work in an insurable employment would have been performed by such insured person.
Hourly rates of supplementary benefit.
29.—Subject to the provisions of this Act, supplementary benefit in the case of an insured person of any class set out in the first column of the Third Schedule to this Act shall be at the hourly rate set out in the second column of the said Schedule opposite the mention of that class or, if another hourly rate is under this Act substituted for such first-mentioned rate, the rate for the time being so substituted.
Statutory conditions for the receipt of supplementary benefit.
30.—(1) The first condition (in this Act referred to as the first statutory condition) for the receipt of supplementary benefit in respect of intermittent unemployment by an insured person in any insurance year is that prior to the week in which such intermittent unemployment occurs at least twelve weekly contributions have been paid in respect of him as an insured person since—
(a) in case such insurance year is the first insurance year, the beginning of that insurance year,
(b) in any other case, the beginning of the insurance year next preceding the insurance year in which the intermittent unemployment occurs.
(2) The second condition (in this Act referred to as the second statutory condition) for the receipt by an insured person of supplementary benefit in respect of intermittent unemployment on any day is that the current unemployment book issued to him under the Unemployment Insurance Act, 1920, is in the possession of his employer on that day.
(3) The third condition (in this Act referred to as the third statutory condition) for the receipt by an insured person of supplementary benefit in respect of any period of intermittent unemployment is that the person to whom a report relating to that period is sent under the next following section has received the report within three days (or such longer period as the Minister may in a particular case accept) after the day on which the intermittent unemployment occurred and that that person has acknowledged the receipt of such report.
(4) Where the current unemployment book issued under the Unemployment Insurance Act, 1920, of an insured person is not in the possession of his employer on a particular day, and a local officer certifies that such book was not delivered to a local office in connection with a claim to unemployment benefit under the Unemployment Insurance Act, 1920, or an application for unemployment assistance under the Unemployment Assistance Act, 1933 (No. 46 of 1933), in respect of that day, such book shall, for the purposes of the second statutory condition, be deemed to have been in the possession of such employer on that day.
(5) In this Act the expression “the statutory conditions” means the first statutory condition, the second statutory condition and the third statutory condition.
Notification of intermittent unemployment.
31.—(1) Where a stoppage of work has occurred on any day and the employer of an insured person or such insured person claims that such stoppage constitutes intermittent unemployment, the employer shall on that day transmit to such person as the Minister may in any particular case direct or, in the absence of such direction, to a local officer a report stating that such stoppage has occurred, the duration thereof, and the nature of the weather conditions alleged to have caused it.
(2) Where an insured person claims that he has been intermittently unemployed on any day, he may send to such person as the Minister may in any particular case direct or, in the absence of such direction, to a local officer a report stating that such intermittent unemployment has occurred, the duration thereof and the nature of the weather conditions alleged to have caused it but this provision shall not be construed as relieving the employer of such person of the obligation imposed on him by sub-section (1) of this section.
(3) Where a person receives a report under this section he shall as soon as may be acknowledge the receipt thereof.
Payment of supplementary benefit by employers.
32.—(1) Subject to the provisions of this Act and to such directions as may be given by the Minister either generally or in any particular case, any amount or amounts of supplementary benefit to which an insured person becomes entitled shall be paid to him by his employer, and the insured person and his employer shall, in respect of each such payment, supply to the Minister such particulars, and complete and transmit such forms, including the insured person's acknowledgment of the amount received by him, as may be prescribed.
(2) An insured person who is not satisfied that the amount of supplementary benefit paid to him by his employer is the amount which he is entitled to receive under the provisions of this Act or his employer, at his request, shall be entitled to apply to an insurance officer to determine, in accordance with the provisions of this Act relating to the determination of questions as to payment of supplementary benefit, the amount of supplementary benefit to which he is entitled.
(3) Where a local officer or other person to whom a report in relation to the intermittent unemployment of an insured person has been sent in accordance with the immediately preceding section sends to the employer of such insured person a notification that he is not satisfied that the stoppage of work to which the report relates was due to inclement weather or that the other provisions of this Act governing the payment of supplementary benefit are fulfilled, or where in any case an employer is in doubt whether supplementary benefit is payable or as to the amount or rate of supplementary benefit payable the employer shall forthwith apply to an insurance officer to determine the question in accordance with the provisions of this Act relating to determination of questions as to payment of supplementary benefit.
(4) If in any case an insured person has not received payment of any supplementary benefit to which he believes he is entitled under this Act and is not satisfied that the question of his title to receive such benefit has been referred to an insurance officer under the provisions of sub-section (3) of this section he shall be entitled either to request his employer so to refer it or himself to refer the question to an insurance officer for determination.
(5) An employer who receives an insured person's request to refer a question of his title to supplementary benefit for an insurance officer's determination shall, unless he has already done so, forthwith refer the question to an insurance officer for determination.
(6) Where in accordance with the provisions of sub-section (3) or sub-section (4) of this section any question has to be referred to an insurance officer, the insured person shall not be entitled to receive payment from his employer under sub-section (1) of this section unless and until it is determined by the insurance officer that he is so entitled, and the employer shall not make such payment pending such determination or except in accordance therewith.
Payment of supplementary benefit by the Minister.
33.—In any special case in which the Minister is of opinion that it would be impossible or unduly burdensome for an employer to pay under the provisions of this Act the amount of supplementary benefit due to an insured person, the Minister may excuse such employer from the duty of so paying and where an employer is so excused the Minister shall pay or cause to be paid from the Supplementary Unemployment Fund any amount of supplementary benefit payable to the insured person by such employer if he were not so excused.
Repayment by the Minister of supplementary benefit paid by employers.
34.—The amount of any supplementary benefit duly paid in accordance with the provisions of this Act by an employer shall be repaid to such employer by the Minister out of the Supplementary Unemployment Fund on application being made, in such manner as may be prescribed, by the employer for such repayment.
Repayments not to be made to employers from the Supplementary Unemployment Fund in certain cases.
35.—Whenever an employer makes a payment of supplementary benefit to a person not entitled to receive supplementary benefit under the provisions of this Act or in excess of the amount to which he was entitled the amount or the excess so paid shall not be repayable to the employer out of the Supplementary Unemployment Fund.
Recovery of amounts improperly paid.
36.—(1) Any amount of supplementary benefit received by an insured person from his employer that is not repayable to the employer out of the Supplementary Unemployment Fund by reason of the provisions of the immediately preceding section shall be repayable by such insured person to the employer on demand made in that behalf by the employer and, if not so repaid, may be recovered by the employer as a simple contract debt in any court of competent jurisdiction or by deduction from any payment or payments of supplementary benefit to which such insured person subsequently becomes entitled.
(2) Every payment of supplementary benefit received by an insured person from the Minister that he was not entitled to receive under the provisions of this Act shall be repayable by him to the Minister on demand made in that behalf by the Minister and, if not so repaid, may be recovered as a simple contract debt in any court of competent jurisdiction or by deduction from any payment or payments of supplementary benefit to which such insured person subsequently becomes entitled.
(3) Where under sub-section (2) of this section an amount may be deducted from the supplementary benefit to which an insured person becomes entitled it shall be the duty of an employer to make such deduction as the Minister may direct from any supplementary benefit payable to the insured person by that employer under the provisions of this Act, and to pay to the Minister any amount or amounts so deducted.
(4) Any amount paid to an employer out of the Supplementary Unemployment Fund to which, under the provisions of this Act, he was not entitled shall be repayable by the employer on demand made in that behalf by the Minister and, if not so repaid, may be recovered as a simple contract debt in any court of competent jurisdiction or by deduction from any amount or amounts that subsequently become payable to that employer out of the Supplementary Unemployment Fund.
(5) Every sum recovered by or repaid to the Minister under the provisions of this section shall be paid into the Supplementary Unemployment Fund.
Notification to employers and insured persons of amounts improperly paid in certain cases.
37.—Where it has been determined in the manner provided in this Part of this Act that an amount paid by an employer is not repayable out of the Supplementary Unemployment Fund the employer who paid the amount and the person who received it shall be informed by the insurance officer of the determination.
Umpire and courts of referees.
38.—(1) The umpire for the time being appointed and acting under and for the purposes of the Unemployment Insurance Act, 1920, shall be the umpire for the purposes of this Part of this Act, and accordingly in this Act the expression “the umpire” means the umpire so appointed and acting.
(2) Every court of referees for the time being subsisting under and for the purposes of the Unemployment Insurance Act, 1920, shall be a court of referees for the purposes of this Part of this Act and accordingly in this Act the expression “court of referees” means a court of referees so subsisting.
(3) There shall be paid out of moneys provided by the Oireachtas to the umpire and members of courts of referees such salaries or remuneration as the Minister for Finance may determine.
Insurance officers.
39.—(1) The Minister may, with the sanction of the Minister for Finance, appoint such and so many persons as he thinks fit to be insurance officers for the purposes of this Part of this Act.
(2) In this Act, the expression “insurance officer” means a person who is either—
(a) a person appointed to be an insurance officer under sub-section (1) of this section, or
(b) a person who is an insurance officer for the purposes of the Unemployment Insurance Act, 1920.
(3) There shall be paid out of moneys provided by the Oireachtas to insurance officers such salaries or remuneration as the Minister for Finance may determine.
Determination of questions as to the payment of supplementary benefit.
40.—(1) If any question arises—
(a) as to whether a stoppage of work in an insurable employment was due to inclement weather; or
(b) as to the fulfilment of the statutory conditions for the receipt of supplementary benefit by an insured person; or
(c) as to the title to supplementary benefit of an insured person or as to the rate or the amount of such benefit; or
(d) as to the title of an employer to repayment from the Supplementary Unemployment Fund; or
(e) as to the fulfilment of any provision of this Part of this Act relating to payment of supplementary benefit or to repayment from the Supplementary Unemployment Fund;
the question shall, subject to the provisions of this Part of this Act, be determined by an insurance officer.
(2) Where under the provisions of sub-section (1) of this section any question has been or is to be determined by an insurance officer—
(a) any person aggrieved by the determination of the insurance officer may, within twenty-four days from the date of the insurance officer's decision or within such further time as the Minister may in any particular case for special reasons allow, require the insurance officer to refer the matter to a court of referees and the insurance officer, unless he can revise his determination, shall so refer it; and
(b) the insurance officer may, if he thinks fit, instead of himself determining the question refer it to a court of referees.
(3) On any question referred to it by an insurance officer the court of referees shall make to the insurance officer such recommendations as it thinks fit and the insurance officer unless he disagrees shall give effect to those recommendations.
(4) If an insurance officer disagrees with a recommendation made by a court of referees under this section he shall refer the recommendation, with his reasons for disagreement, to the umpire.
(5) Where a recommendation has been made under this section by a court of referees any association of employers or insured persons of which a person aggrieved by the recommendation is a member, or with the consent of the court, that person may require the insurance officer to refer the question to the umpire and the insurance officer, if so required, shall refer the question accordingly.
(6) The umpire shall determine every matter referred to him under this section and his determination thereon shall be final and conclusive.
(7) Nothing in this section shall be construed as preventing an insurance officer or umpire or a court of referees, on new facts being brought to his or its knowledge, from reversing or revising a decision or recommendation given in any particular case.
(8) Where an insurance officer or the umpire reverses or revises a previous determination by such officer or by the umpire and the reversal or revision has the effect of refusing or decreasing the amount of supplementary benefit previously allowed such reversal or revision shall have effect in regard to such dates or hours as the insurance officer or the umpire may determine.
Expenses of persons attending before courts of referees or umpire.
41.—In any case where—
(a) a person is required to attend before a court of referees and so attends; or
(b) on an appeal to the umpire from a decision of a court of referees a person affected by the decision is requested by the umpire to attend before him on the consideration of the appeal and so attends;
that person shall be paid out of moneys provided by the Oireachtas such travelling and other allowances, including compensation for loss of remunerative time, as the Minister with the sanction of the Minister for Finance may determine.
General provisions as to procedure under Part IV.
42.—(1) The Minister may by regulations—
(a) prescribe the evidence to be required as to the fulfilment of the statutory conditions and the other provisions of this Part of this Act relating to an insured person's title to supplementary benefit, and for that purpose require the attendance of insured persons at such offices or places and at such times as may be required, and require employers to answer inquiries relating to any matters in connection with which information is required to enable an insured person's title to supplementary benefit to be determined;
(b) prescribe the time, manner and form of—
(i) the payment by employers to insured persons of supplementary benefit due to them,
(ii) the repayment out of the Supplementary Unemployment Fund to employers of amounts of supplementary benefit paid by them,
(iii) raising questions for determination by insurance officers,
(iv) the doing of any other thing incidental to the reporting of intermittent unemployment, the acknowledgment of the receipt of reports of intermittent unemployment, and the paying of supplementary benefit and the repayment out of the Supplementary Unemployment Fund of supplementary benefit paid by employers;
(c) require employers, insured persons and others to furnish such information as the Minister may consider desirable in connection with payments of supplementary benefit and the occurrence of intermittent unemployment;
(d) prescribe the practice and procedure to be followed on the consideration and examination of questions to be considered and determined by the umpire, courts of referees and insurance officers;
(e) provide for the appointment of a person to receive, on behalf of or as representative of a person who becomes of unsound mind or dies, any sums payable out of the Supplementary Unemployment Fund to or in respect of him.
(2) Regulations made by the Minister by virtue of paragraph (a) of sub-section (1) of this section shall not be construed as affecting the operation of the next following section.
Additional methods of proving fulfilment of statutory conditions, etc.
43.—(1) Where supplementary benefit has been paid to an insured person in respect of any day or part thereof a certificate, in the prescribed form, signed by such insured person or the person who was the employer of such insured person on such day certifying any one or more of the following matters—
(a) that such insured person was intermittently unemployed on such day,
(b) that the hours during which such insured person was intermittently unemployed on such day were working hours,
(c) that such day was not a Sunday or a public holiday within the meaning of the Conditions of Employment Act, 1936 (No. 2 of 1936),
(d) that such day was not the first day of a spell of insurable employment with the person who was the employer of such insured person,
shall, for the purposes of this Part of this Act, be sufficient evidence of the facts so certified, unless and until the contrary is shown to be the case.
(2) Where supplementary benefit has been paid to an insured person a certificate, in the prescribed form, by such insured person that he is the rightful holder of a particular supplementary unemployment book or a certificate, in the prescribed form, by the person who was the employer of such person at the time such supplementary benefit was paid that he is satisfied that such insured person is the rightful holder of such book shall, for the purposes of this Part of this Act, be sufficient evidence of the identity of such insured person, unless and until the contrary is shown to be the case.
(3) Where weekly contributions in respect of an insured person are paid by affixing supplementary insurance stamps to his supplementary unemployment book, and supplementary benefit has been paid to such insured person in any insurance year, the following provisions shall, for the purposes of the first statutory condition, have effect, that is to say:—
(a) a certificate, in the prescribed form and containing the prescribed particulars, by the person (in this sub-section referred to as the employer) who was the employer of such insured person at the time such supplementary benefit was paid that, prior to the week in which occurred the intermittent unemployment for which such supplementary benefit was paid, a specified number of weekly contributions had been paid for such person in respect of such insurance year shall be sufficient evidence of the facts so certified, unless and until the contrary is shown to be the case;
(b) a certificate, in the prescribed form and containing the prescribed particulars, by the employer that there was entered, in accordance with regulations made under Part III of this Act, on the current supplementary unemployment book of such insured person a statement that a specified number of weekly contributions had been paid for such insured person in respect of the immediately preceding insurance year shall, unless and until the contrary is shown to be the case, be sufficient evidence that there were paid the number of weekly contributions so certified to be so entered.
(4) Where supplementary benefit has been paid to any insured person in respect of a particular day or part thereof, a certificate, in the prescribed form, by the person who was the employer of such person on that day, that the current unemployment book issued under the Unemployment Insurance Act, 1920, of such insured person was in his possession on that day shall, for the purposes of the second statutory condition, be sufficient evidence of the facts so declared, unless and until the contrary is shown to be the case.
Restriction on payment of unemployment benefit and unemployment assistance.
44.—Unemployment benefit under the Unemployment Insurance Act, 1920, or unemployment assistance under the Unemployment Assistance Act, 1933 (No. 46 of 1933), shall not be payable for a day in respect of which or part of which supplementary benefit is paid or payable under this Act.
PART V.
The Supplementary Unemployment Fund.
Establishment of Supplementary Unemployment Fund.
45.—(1) For the purpose of this Act there shall be established, under the control and management of the Minister, a fund to be called and known as the Supplementary Unemployment Fund into which shall be paid all weekly contributions payable by employers and insured persons and any other moneys which under this Act are to be paid into the said Fund and out of which shall be paid all payments which under this Act are to be made out of the said Fund.
(2) The accounts of the Supplementary Unemployment Fund shall be kept in such form as the Minister for Finance may direct or approve.
(3) The accounts of the Supplementary Unemployment Fund for every year of account shall be submitted for audit to the Comptroller and Auditor-General and when examined and certified shall be laid before each House of the Oireachtas.
(4) Any moneys forming part of the Supplementary Unemployment Fund may from time to time be paid over to the Minister for Finance and by him invested and kept invested at his discretion on behalf of the said Fund in all or any of the following ways, that is to say, in the purchase of any stock, fund or security in which trustees are authorised by the law for the time being in force to invest trust funds or in the purchase of any stock, shares or security the principal and interest of which are guaranteed under statutory authority by the Government and any interest received from such investment shall be paid into the said Fund.
(5) Moneys available for investment under the immediately preceding sub-section of this section shall be Government money within the meaning of the Approved Investments Act, 1933 (No. 34 of 1933), and that Act shall apply in regard thereto accordingly.
Provisions for securing solvency of Supplementary Unemployment Fund, etc.
46.—(1) Whenever and so often as it appears to the Minister that the Supplementary Unemployment Fund is or is likely to be either insufficient or more than sufficient to discharge the liabilities imposed or about to be imposed upon the said Fund under this Act or that the rates of weekly contributions are or are likely to be excessive or deficient the Minister may, with the concurrence of the Minister for Finance, by regulations do either or both of the following things, that is to say:—
(a) amend the Second Schedule to this Act by substituting for the respective rates of weekly contributions set out in the second and third columns of that Schedule such other rates of weekly contributions as he thinks fit but not so as to vary the rates of weekly contributions unequally as between employers and insured persons,
(b) amend the Third Schedule to this Act by substituting for the hourly rates of supplementary benefit set out in the second column of that Schedule such other hourly rates of supplementary benefit as he thinks fit.
(2) References in sub-section (1) of this section to the Second Schedule to this Act and to the Third Schedule to this Act shall be construed as references to the said Schedules respectively as amended by any regulations previously made under the said sub-section (1).
Advances out of the Central Fund.
47.—(1) The Minister for Finance may out of the Central Fund or the growing produce thereof advance any sums required for the purpose of discharging the liabilities of the Supplementary Unemployment Fund, and for the purpose of providing the sums to be so advanced the Minister for Finance may borrow money in such manner as he may think proper and all moneys so borrowed shall be paid into the Exchequer.
(2) Any sums advanced under the foregoing sub-section together with interest (if any) thereon at such rate as may be fixed by the Minister for Finance shall be charged on and be repayable out of the Supplementary Unemployment Fund and when so repaid shall be paid into the Exchequer.
(3) The principal of and interest on any securities issued by the Minister for Finance for the purpose of borrowing under this section and the expenses incurred in connection with the issue of such securities shall be charged on and payable out of the Central Fund or the growing produce thereof.
PART VI.
Inspection.
Inspectors.
48.—(1) The Minister may, with the sanction of the Minister for Finance, appoint such and so many persons as he thinks fit to be inspectors for the purposes of this Part of this Act.
(2) In this Act, the word “inspector” means a person who is either—
(a) a person appointed to be an inspector under sub-section (1) of this section, or
(b) a person who is an inspector for the purposes of the Unemployment Insurance Act, 1920.
(3) There shall be paid out of moneys provided by the Oireachtas to inspectors such salaries or remuneration as the Minister for Finance may determine.
Powers of inspectors.
49.—(1) An inspector shall, for the purposes of the execution of, this Act, have power to do all or any of the following things, namely—
(a) to enter at all reasonable times any premises or place, where he has reasonable grounds for supposing that any persons employed in an insurable employment are employed or any records in relation to any such persons are kept;
(b) to make such examination and inquiry as may be necessary for ascertaining whether the provisions of this Act are complied with in any such premises or place;
(c) to examine, either alone or in the presence of any other person, as he thinks fit, with respect to any matters under this Act, every person whom he finds in any such premises or place, or whom he has reasonable cause to believe to be or to have been an employed person, and to require every such person to be so examined and to sign a declaration of the truth of the matters in respect of which he is so examined;
(d) to exercise such other powers as may be necessary for carrying this Act into effect.
(2) The occupier of any such premises or place, and any other person employing any insured person, and the servants and agents of any such occupier or other person, and any employed person shall furnish to any inspector all such information and shall produce for inspection all such registers, books, cards, wages sheets, records of wages, and other documents as the inspector may reasonably require.
(3) If any person wilfully delays or obstructs an inspector in the exercise of any power under this section or fails to give such information or to produce such documents as aforesaid, or conceals or prevents or attempts to conceal or prevent any person from appearing before or being examined by an inspector, he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding five pounds.
(4) No one shall be required under this section to answer any question or give any evidence tending to incriminate himself.
(5) Every inspector shall be furnished with a certificate of his appointment, and on applying for admission to any premises or place for the purposes of this Act shall, if so required, produce the said certificate to the occupier.
PART VII.
Miscellaneous Provisions.
Provisions in relation to excepted persons whose employment is terminated.
50.—Where a person (in this sub-section referred to as the employer) terminates the employment in an insurable employment of a person (in this sub-section referred to as the employee) who immediately before such termination was an excepted person, the following provisions shall have effect, that is to say:—
(a) in case the employee was an excepted person during the twelve weeks immediately preceding such termination, the employer shall pay to the Minister, in respect of such twelve weeks, a sum equal to the amount of the weekly contributions which would, if the employee had not been an excepted person during the said twelve weeks, have been payable in respect of the employee under this Act for the said twelve weeks;
(b) in case the employee was not an excepted person during the twelve weeks immediately preceding such termination, the employer shall pay to the Minister, in respect of the weeks immediately preceding such termination during which the employee was an excepted person, a sum equivalent to the amount of the weekly contributions which would, if the employee had not been an excepted person during those weeks, have been payable under this Act in respect of the employee for those weeks;
(c) no part of any sum paid by the employer under this sub-section shall be recoverable by the employer from the employee;
(d) any sum payable to the Minister by the employer under this section shall, for the purposes of the other provisions (including penal provisions) of this Act, be deemed to be weekly contributions, and those provisions shall apply accordingly;
(e) any sum recovered by or paid to the Minister under this section shall be paid into the Supplementary Unemployment Fund;
(f) any sums recovered by or paid to the Minister under this section in respect of any weeks shall, for the purposes of the first statutory condition, be deemed to be weekly contributions paid under Part III of this Act in respect of the employee for those weeks.
Offences.
51.—(1) If for the purpose of obtaining any supplementary benefit or payment or repayment under this Act, either for himself or for any other person or for the purpose of avoiding any payment to be made by himself under this Act or enabling any other person to avoid any such payment, any person knowingly makes any false statement or false representation, or conceals any material fact, such person shall be guilty of an offence under this sub-section and shall be liable on summary conviction thereof to imprisonment for a term not exceeding three months or to a fine not exceeding twenty-five pounds.
(2) If—
(a) any employer or insured person has failed or neglected to pay any weekly contributions which he is liable under this Act to pay, or
(b) any employer or insured person or any other person is guilty of any contravention of or non-compliance with any of the requirements of this Act or the regulations made thereunder in respect of which no special penalty is provided, or
(c) any employer deducts or attempts to deduct from the wages or other remuneration of an insured person, the whole or any part of the employer's contribution,
such person shall be guilty of an offence under this sub-section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.
(3) Where an employer has been convicted under sub-section (2) of this section of the offence of failing or neglecting to pay any weekly contributions which he is liable under this Act to pay, he shall be liable to pay to the Supplementary Unemployment Fund a sum equal to the amount which he has so failed or neglected to pay, and on such a conviction, if notice of the intention to do so has been served with the summons or warrant, evidence may be given of the failure or neglect on the part of the employer to pay other weekly contributions in respect of the same person during the three years preceding the date when the information was so laid, and on proof of such failure or neglect the employer shall be liable to pay to the Supplementary Unemployment Fund a sum equal to the total of all the weekly contributions which he is so proved to have failed or neglected to pay.
Any sum paid by an employer under this sub-section shall be treated as a payment in satisfaction of the unpaid weekly contributions, and the insured person's portion of those weekly contributions shall not be recoverable by the employer from the insured person.
(4) Every person—
(a) who buys, sells, or offers for sale, takes or gives in exchange or pawns or takes in pawn any supplementary unemployment card, supplementary unemployment book or used supplementary insurance stamp, or
(b) who attempts to evade payment of a weekly contribution by affixing or attempting to affix to any supplementary unemployment book or supplementary unemployment card a used supplementary insurance stamp which has been removed either by him or by some other person from any supplementary unemployment book or supplementary unemployment card or from any other material to which it was affixed or which has been previously used in any other manner,
shall be guilty of an offence under this sub-section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds, and in any proceedings under this sub-section with respect to used stamps, a stamp shall be deemed to have been used if it has been cancelled or defaced in any way whatever or if it has been removed from any supplementary unemployment book or supplementary unemployment card or any other material to which it was affixed and whether it has been actually used for the purpose of payment of a weekly contribution or not.
(5) Nothing in this section shall be construed as preventing the Minister from recovering by means of civil proceedings any sums due to the Supplementary Unemployment Fund and all such sums shall be recoverable as debts due to the State and without prejudice to any other remedy may be recovered by the Minister as a simple contract debt in any court of competent jurisdiction.
(6) In any proceedings under this section or in any proceedings involving any question as to the payment of weekly contributions under this Act or for the recovery of any sums due to the Supplementary Unemployment Fund, the decision of the Minister on any question whether a person is or was an insured person within the meaning of this Act or not or as to who was the employer of an insured person, or as to the rate of weekly contribution to be paid in respect of an insured person shall, unless an appeal against the decision is pending or the time for appealing against the decision has not expired, be conclusive for the purpose of those proceedings and, if such a decision has not been obtained and the decision of the question is necessary for the determination of the proceedings, the question shall be referred to the Minister for decision in accordance with the provisions of this Act and where any such appeal is pending or the time for so appealing has not expired or any question has been so referred to the Minister, the court dealing with the case shall adjourn the proceedings until such time as a final decision on the question has been obtained.
(7) Any sum that an employer is liable to pay under sub-section (3) of this section or any sum due to the Supplementary Unemployment Fund for which a court has made an order for payment may, without prejudice to other methods of recovery, be deducted by the Minister from any sums payable out of the Supplementary Unemployment Fund to such employer under this Act and any amounts so deducted shall be paid by the Minister into the Supplementary Unemployment Fund.
Prosecutions.
52.—(1) Proceedings for an offence under this Act shall not be instituted except by or with the consent of the Minister or by an inspector or other officer appointed for the purpose of this Act and authorised in that behalf by special or general directions of the Minister.
(2) A prosecution for an offence under any section of this Act may be brought at the suit of the Minister.
(3) A prosecution for an offence under any section of this Act may be brought at any time within whichever of the following periods later expires, that is to say:—
(a) three months after the date on which it is certified in writing sealed with the official seal of the Minister, that evidence sufficient to justify the institution of such prosecution came into the possession or procurement of the Minister, or
(b) one year after the commission of the offence.
Civil proceedings against employer.
53.—(1) Where any employer has failed or neglected to pay any weekly contributions which under this Act he is liable to pay in respect of any insured person in his employment or has failed or neglected to comply in relation to any such person with any other requirements of this Act and the regulations made thereunder and by reason thereof that person has lost in whole or in part the supplementary benefit to which he would have been entitled under this Act he shall be entitled to recover from the employer as a simple contract debt a sum equal to the amount of the supplementary benefit so lost.
(2) Proceedings may be taken under this section notwithstanding that proceedings have been taken under any other provision of this Act in respect of the same failure or neglect.
Proof of age and death.
54.—Where for the purposes of this Act the age or death of any person is required to be proved by the production of a certificate of birth or death, any person shall, on presenting a written requisition in such form and containing such particulars as the Minister for Local Government and Public Health may direct and on payment of a fee, in the case of a birth certificate, of sixpence and, in the case of a death certificate, of one shilling, be entitled to obtain a certified copy of the entry of the birth or death as the case may be of such first-mentioned person in the register of births or deaths as the case may be, under the hand of the registrar or superintendent registrar or other person having custody thereof and forms for such requisition shall, on request, be supplied without any charge by every registrar of births and deaths and by every superintendent registrar or other person having custody of the register.
Exemption of documents from stamp duty.
55.—Stamp duties shall not be chargeable upon documents used in connection with business under this Act.
Power to remove difficulties.
56.—(1) If in any respect any difficulty arises in bringing into operation this Act or any provision thereof, the Minister, with the consent of the Minister for Finance, may by order do anything which appears to him necessary or expedient for bringing this Act or such provision into operation, and any such order may modify the provisions of this Act so far as may appear to the Minister necessary or expedient for carrying the order into effect.
(2) No order may be made under this section after two years from the date on which the whole of this Act has come into operation.
FIRST SCHEDULE.
Excluded Employments.
1.—Employment under any local or other public authority or public board excluded for the time being from the provisions of the Unemployment Insurance Act, 1920, by the operation of a special order made under paragraph (c) of Part I of the First Schedule to the said Act.
2.—Employment excepted for the time being from the provisions of the Unemployment Insurance Act, 1920, by the operation of a certificate of exception under paragraph (d) of Part II of the First Schedule to the said Act.
3.—Employment in the military service of the State
4.—Employment of unskilled workers and of young persons on works undertaken by or on behalf of the Irish Land Commission for the improvement of lands purchased or agreed to be purchased under the Land Purchase Acts.
