1.—San Acht seo—

ciallaíonn “na hAchtanna” na hAchtanna um Scrúdóireacht Scannán, 1923 go 1930;

ciallaíonn “an Príomh-Acht” an tAcht um Scrúdóireacht Scannán, 1923.

Feidhm na nAchtanna maidir le pictiúir a bhreithnigh an Scrúdóir Oifigiúil cheana féin.

2.—(1) I gcás ina ndéanfar iarratas faoi alt 7 den Phríomh-Acht maidir le pictiúr ab ábhar breithe a thug an Scrúdóir Oifigiúil faoin alt sin nó, má rinneadh achomharc i gcoinne na breithe sin, ab ábhar breithe a thug an Bord Achomhairc faoi alt 8 den Acht sin agus gur tugadh an bhreith sin, nó, má tugadh níos mó ná breith amháin, gur tugadh an bhreith is déanaí roimh an 18ú lá d'Eanáir, 1965, nó tráth nár ghiorra ná seacht mbliana roimh dháta an iarratais—

(a) glacfaidh an Scrúdóir Oifigiúil leis an iarratas agus tabharfaidh sé breith air,

(b) glacfaidh an Bord Achomhairc le haon achomharc, agus tabharfaidh sé breith ar aon achomharc, i gcoinne breithe a thug an Scrúdóir Oifigiúil, agus

(c) má iarrann an duine é a rinne an t-iarratas, deonófar nó coimeádfar siar deimhniú faoin bPríomh-Acht, nó diúltófar é a dheonú, de réir breithe an Scrúdóra Oifigiúil nó an Bhoird Achomhairc, de réir mar a bheidh,

ionann is nárbh ábhar breithe faoin alt sin 7 nó faoin alt sin 8 roimh dháta an iarratais an pictiúr, agus beidh feidhm agus éifeacht ag na hAchtanna dá réir sin.

(2) I gcás ina ndeonófar nó ina gcoimeádfar siar deimhniú faoin bPríomh-Acht nó ina ndiúltófar deimhniú den sórt sin a dheonú, scoirfidh aon deimhniú, diúltú nó coimeád siar den sórt sin roimhe sin d'éifeacht a bheith aige.

Gearrtheideal, forléiriú agus comhlua.

3.—(1) Féadfar an tAcht um Scrúdóireacht Scannán (Leasú), 1970, a ghairm den Acht seo.

(2) Forléireofar an tAcht seo agus na hAchtanna mar aon ní amháin agus féadfar na hAchtanna um Scrúdóireacht Scannán, 1923 go 1970, a ghairm leis díobh le chéile.

CENSORSHIP OF FILMS (AMENDMENT) ACT, 1970

Interpretation.

1.—In this Act—

“the Acts” means the Censorship of Films Acts, 1923 to 1930;

“the Principal Act” means the Censorship of Films Act, 1923.

Application of Acts to pictures previously considered by Official Censor.

2.—(1) Where an application is made under section 7 of the Principal Act in respect of a picture which was the subject of a decision of the Official Censor under that section or, if there was an appeal from that decision, a decision of the Appeal Board under section 8 of that Act and the decision, or, if there was more than one decision, the latest decision, was made before the 18th day of January, 1965, or not less than seven years before the date of the application—

(a) the application shall be entertained and decided by the Official Censor,

(b) any appeal to the Appeal Board from the decision of the Official Censor shall be entertained and decided by the Appeal Board, and

(c) a certificate under the Principal Act shall, if the person who brought the application so requests, be granted or withheld or the grant thereof shall be refused, in accordance with the decision of the Official Censor or the Appeal Board, as the case may be,

as if the picture had not been the subject of a decision under the said section 7 or the said section 8 before the date of the application, and the Acts shall apply and have effect accordingly.

(2) Where a certificate under the Principal Act is granted or withheld or the grant thereof is refused in respect of a picture, any previous such certificate or refusal or withholding in respect of the picture shall cease to have effect.

Short title, construction and collective citation.

3.—(1) This Act may be cited as the Censorship of Films (Amendment) Act, 1970.

(2) This Act shall be construed as one with the Acts and may be cited together therewith as the Censorship of Films Acts, 1923 to 1970.
