ACHT TOGHCHÁN AN UACHTARÁIN (FORÁLACHA SEALADACHA), 1959.

Léiriú.
1.—San Acht seo—
ciallaíonn “an príomh-alt” alt 34 d'Acht Toghcháin an Uachtaráin, 1937;
ciallaíonn “an toghchán uachtaráin, 1959” an toghchán uachtaráin a bheidh ann sa bhliain 1959;
ciallaíonn “reifreann 1959” an reifreann i ndáil leis an mBiile um an Tríú Leasú ar an mBunreacht, 1958.
An príomh-alt a leasú i ndáil leis an toghchán uachtaráin, 1959.
2.—(1) Nuair a bheidh feidhm á thabhairt don phríomh-alt maidir leis an toghchán uachtaráin, 1959, déanfar an tagairt i bhfo-alt (1) den chéanna do scríbhinn nach mbaineann ach leis an toghchán sin amháin a fhorléiriú mar thagairt do scríbhinn nach mbaineann ach leis an toghchán sin amháin nó a bhaineann leis an toghchán sin agus le reifreann 1959.
(2) I gcás ina mbeidh, de bhun na Rialachán um Postas in Aisce i leith Toghchán an Uachtaráin, 1959, dearbhú le déanamh i ndeimhniú faoi na Rialacháin sin maidir le scríbhinní dá dtagartar i bhfo-alt (1) den alt seo agus a bhaineann leis an toghchán uachtaráin, 1959 agus le reifreann 1959, féadfar an dearbhú a dhéanamh, a shíniú agus a ghlacadh ionann is nach mbaineann na scríbhinní ach leis an toghchán uachtaráin, 1959 amháin.
(3) Aon ní a rinneadh tráth ar bith sular ritheadh an tAcht seo agus a bheadh ceart dá mbeadh an tAcht seo i ngníomh san am, beidh sé, agus measfar go raibh sé ariamh, ceart.

PRESIDENTIAL ELECTIONS (TEMPORARY PROVISIONS) ACT, 1959.
Interpretation.
1.—In this Act—
“the principal section” section 34 means of the Presidential Elections Act, 1937;
“the 1959 presidential election” means the presidential election held in the year 1959;
“the 1959 referendum” means the referendum in relation to the Third Amendment of the Constitution Bill, 1958.
Amendment of principal section in relation to 1959 presidential election.
2.—(1) In applying the principal section to the 1959 presidential election, the reference in subsection (1) thereof to a communication relating only to that election shall be construed as a reference to a communication relating only to that election or relating to that election and to the 1959 referendum.
(2) Where, pursuant to the Presidential Elections Free Postage Regulations, 1959, a declaration falls to be made in a certificate under those Regulations with respect to communications referred to in subsection (1) of this section which relate to the 1959 presidential election and to the 1959 referendum, the declaration may be made, signed and accepted as if the communications did in fact relate only to the 1959 presidential election.
(3) Anything which was effected at any time before the passing of this Act and which would have been proper if this Act had then been in operation shall be and shall be deemed always to have been proper.
Short title.
3.—This Act may be cited as the Presidential Elections (Temporary Provisions) Act, 1959.
