ACHTAÍTEAR AG AN OIREACHTAS MAR LEANAS:—
CUID I.
Reamhraiteach agus Ginearalta.

1.—Féadfar an tAcht Forbartha Móna, 1946, a ghairm den Acht seo.
Mínithe.
2.—San Acht seo—
ciallaíonn an abairt “an Bord” Bord na Móna a bunaítear leis an Acht seo;
ciallaíonn an abairt “an chuideachta scortha” an chuideachta, dá ngairmtear an Turf Development Board, Limited, a scoirtear leis an Acht seo;
ciallaíonn an abairt “dáta an bhunuithe” an dáta a ceapfar ina dháta bunuithe chun críocha an Achta seo le hordú ón Aire arna dhéanamh faoi alt 3 den Acht seo;
ciallaíonn an focal “feadhma”, maidir leis an mBord, na dualgais agus na cumhachta a cuirtear nó a bronntar ar an mBord leis an Acht seo;

3.—Féadfaidh an tAire, le hordú, lá a cheapadh ina dháta bunuithe chun críocha an Achta seo.
Rialacháin.
4.—Féadfaidh an tAire rialacháin a dhéanamh maidir le haon ní nó rud dá dtagartar san Acht seo mar ní nó rud atá ordaithe.

5.—Athghairmtear leis seo ailt 21 agus 22 den Acht Móna (Usáid agus Forbairt), 1936 (Uimh. 23 de 1936), amhail ar dháta an bhunuithe agus uaidh sin amach.
Costais an Aire.
6.—Na costais faoina raghaidh an tAire chun an tAcht seo a riaradh déanfar, a mhéid a cheadós an tAire Airgeadais, iad a íoc as airgead a sholáthrós an tOireachtas.
CUID II.
Bord na Móna.
An Bord a bhunú.
7.—(1) Déanfar, de bhuaidh an ailt seo, bord a bhunú ar dháta an bhunuithe ar a dtabharfar mar ainm agus mar theideal Bord na Móna.
(2) Beidh an Bord ina chomhlacht corprach agus síorchomharbas aige agus séala oifigiúil (ar a dtabharfar áird i gcúrsaí breithiúnais) agus beidh an dlí intsaothruithe aige agus air faoina ainm chorprach agus beidh cumhacht aige talamh a shealbhú.
Comhdhéanamh an Bhuird.
8.—(1) Beidh an Bord comhdhéanta de chathaoirleach agus stiúrthóir bainisteoireachta agus pé uimhir (nach mó ná cúigear) de chomhaltaí eile a chinnfeas an Rialtas ó am go ham.
(2) Is é a bheas ina Chathaoirleach ar an mBord an comhalta sin den Bhord a ndéanfaidh an Rialtas, tráth a cheaptha ina chomhalta den Bhord nó dá éis sin, é a cheapadh ina chathaoirleach ar an mBord.
(3) Is é bheas ina stiúrthóir bainisteoireachta don Bhord an comhalta sin den Bhord a ndéanfaidh an Rialtas, tráth a cheaptha ina chomhalta den Bhord nó dá éis sin, é a cheapadh ina stiúrthóir bainisteoireachta don Bhord.
Forála maidir le ceapadh, téarmaí oifige, seirbhís agus luach saothair comhaltaí an Bhuird.
9.—(1) Ceapfaidh an Rialtas comhaltaí an Bhuird ó am go ham do réir mar is gá.
(2) (a) Gach duine a ceapfar ina chomhalta den Bhord beidh sé, mura dtárlaí roimhe sin é a éag, é a chur as oifig, é a éirí as oifig nó é a theacht chun bheith dícháilithe, i seilbh oifige go ceann pé tréimhse (nach sia ná cúig bliana) a chinnfeas an Rialtas tráth a cheaptha,
(b) Comhalta den Bhord a dtiocfaidh deireadh lena théarma oifige trí imeacht aimsire, beidh sé inathcheaptha.
(3) Beidh gach comhalta den Bhord i seilbh oifige ar pé téarmaí (ach amháin maidir le híoc luach saothair agus liúntas in aghaidh costas) a chinnfeas an Rialtas tráth a cheaptha.
(4) Íocfar le gach comhalta den Bhord, as cistí a bheas faoina réir ag an mBord, pé luach saothair agus pé liúntais in aghaidh costas a chinnfeas an tAire le toiliú an Aire Airgeadais.
Comhaltaí den Bhord a chur as oifig.
10.—(1) Má chítear don Rialtas tráth ar bith gur gá gach duine nó aon duine de chomhaltaí an Bhuird a chur as oifig d'fhonn go gcomhlíonfaí feadhma an Bhuird go héifeachtach agus go tíobhasach, féadfaidh an Rialtas gach duine de chomhaltaí an Bhuird, nó pé méid díobh a mheasfas an Rialtas is gá, a chur as oifig chun na gcríoch sin.
(2) Féadfaidh an Rialtas tráth ar bith aon chomhalta den Bhord a chur as oifig a éireos éagumasach de dheascaibh easláinte ar a dhualgais mar chomhalta den tsórt sin a chomhlíonadh go héifeachtúil nó a bheas (ar chúis seachas cúis a mheasfas an Rialtas is leor) as láthair ó gach cruinniú den Bhord i gcaitheamh tréimhse de shé mhí as a chéile.
(3) Má dhéanann agus aon uair a dhéanfas an Rialtas comhalta ar bith den Bhord a chur as oifig faoin alt seo, leagfaidh an Rialtas faoi bhráid gach Tighe den Oireachtas ráiteas i scríbhinn á rá gur cuireadh an comhalta sin as oifig agus ag luadh na gcúis a bhí lena chur as oifig.
Comhaltaí den Bord a éirí as oifig agus a dhícháiliú.
11.—(1) Féadfaidh comhalta den Bhord tráth ar bith éirí as a oifig mar chomhalta den tsórt sin trí litir arna díriú agus arna cur chun an Rialtais.
(2) Má thárlann agus aon uair a thárlós go mbreithiúnófar comhalta den Bhord ina fhéimhí, nó go ndéanfaidh sé comhréiteach nó socrú lena chreidiúnaithe, nó go ndaorfaidh cúirt dlínse inniúla é chun príosúntachta nó pian-tseirbhíse, nó go scoirfidh sé de bheith ina ghnáth-chomhnaí sna críocha náisiúnta, beidh sé dícháilithe chun bheith, agus scoirfidh de bheith, i seilbh oifige mar chomhalta den Bhord.
Comhaltaí den Bhord do nochtadh leasa i gconradh a beartófar a dhéanamh.
12.—Aon chomhalta den Bhord ag a mbeidh—
(a) leas ar bith in aon chuideachta nó gnólacht lena mbeartóidh an Bord aon chonradh a dhéanamh, nó
(b) leas ar bith in aon chonradh a bheartós an Bord a dhéanamh,
nochtfaidh don Bhord an leas sin a bheith aige agus nochtfaidh cineál an leasa, agus ní ghlacfaidh aon pháirt in aon bhreithniú ná cinneadh a bheas á dhéanamh ag an mBord maidir leis an gconradh sin, agus cuirfear ar breacadh i miontuairiscí an Bhuird go ndearnadh an nochtadh sin.
Séala an Bhuird.
13.—(1) Soláthróidh agus sealbhóidh an Bord comhshéala agus déanfar an séala sin a dhílse-dheimhniú le síniú Chathaoirleach an Bhuird nó chomhalta éigin eile den Bhord a mbeidh údarás aige ón mBord gníomhú chuige sin maraon le síniú oifigigh don Bhord a mbeidh údarás cuibhe aige ón mBord gníomhú chuige sin.
(2) Bhéarfaidh gach cúirt bhreithiúnais áird i gcúrsaí breithiúnais ar shéala an Bhuird agus glacfar i bhfianaise gach doiciméid a airbheartós bheith ina hordú nó ina hionstraim eile arna déanamh ag an mBord agus bheith séalaithe le séala an Bhuird arna dhílsedheimhniú do réir an ailt seo agus is tuigthe, mura gcruthaítear a mhalairt, gur ordú nó ionstraim den tsórt sin í.
Cruinnithe agus nós imeachta an Bhuird.
14.—(1) Beidh ag an mBord pé cruinnithe agus pé méid cruinnithe is gá chun a fheadhma a chomhlíonadh go cuibhe.
(2) Déanfar nós imeachta an Bhuird ag a chruinnithe agus ar shlite eile a sheoladh do réir forál rialacha a dhéanfas an Bord chuige sin faoin Acht seo.
(3) Is é is córam do chruinniú den Bhord ná pé uimhir (nach lú ná triúr) a chinnfeas an Bórd ó am go ham.
(4) Féadfaidh an Bord gníomhú d'ainneoin folúntas a bheith ina chomhaltas.
Oifigigh agus seirbhísigh don Bhord.
15.—(1) Ceapfaidh an Bord pé oifigigh agus seirbhísigh agus pé méid díobh is cuibhe leis an mBord ó am go ham.
(2) Féadfaidh an Bord tráth ar bith aon oifigeach nó seirbhíseach don Bhord a chur as bheith ina oifigeach nó ina sheirbhíseach den tsórt sin.
(3) Íocfaidh an Bord lena oifigigh agus a sheirbhísigh, as cistí a bheas faoina réir, pé luach saothair agus liúntais a chinnfeas an Bord.
(4) Más oiriúnach leis an mBord é, féadfaidh an Bord, chun críocha ceapacháin faoi fho-alt (1) den alt seo, a iarraidh ar na Coimisinéirí um Cheapacháin Áitiúla duine a mholadh dhó i gcóir an cheapacháin sin, agus déanfaidh na Coimisinéirí sin, ar an iarratas sin a fháil, duine amháin a roghnú agus a mholadh don Bhord i gcóir an cheapacháin sin, agus déanfaidh an Bord ar an moladh sin a fháil ó na Coimisinéirí sin an duine a bheas molta amhlaidh a cheapadh don phost sin.
(5) Íocfaidh an Bord leis na Coimisinéirí um Cheapacháin Áitiúla, as cistí a beas faoina réir, pé costais, i leith roghnú agus moladh daoine ag na Coimisinéirí sin faoi fho-alt (4) den alt seo, a cinnfear trí chomhaontú idir an Bord agus na Coimisinéirí sin le toiliú an Aire Airgeadais nó, cheal comhaontuithe, a chinnfeas an tAire sin.
Feadhma an Bhuird a fheidhmiú tríd an stiúrthóir bainisteoircachta nó trí oifigigh nó seirbhísigh an Bhuird.
16.—Féadfaidh an Bord aon chuid dá fheadhma a fheidhmiú agus a chomhlíonadh tríd an stiúrthóir bainisteoireachta nó trí aon oifigigh nó seirbhísigh don Bhord a bheas údaraithe ag an mBord chuige sin.
CUID III.
Dualgais agus Cumhachta an Bhuird.
Caibidil I.
Dualgais an Bhuird.
Dualgais ghinearálta an Bhuird.
17.—Beidh de dhualgas ar an mBord—
(a) móin agus táirgthe móna a tháirgeadh agus a mhargú, agus
(b) táirgeadh agus úsáid móna agus táirgthe móna a chur ar aghaidh,
(c) portaigh agus tailte eile a thógaint, agus
(d) portaigh agus tailte eile a bheas dílsithe sa Bhord a bhainistí, a fhorbairt agus a oibriú,
(e) go ginearálta gach ní eile a dhéanamh a thiocfas nó a leanfas as na dualgais a luaitear sna míreanna sin roimhe seo den alt seo.
(2) Má dhéanann an Bord, i gcomhlíonadh na ndualgas dá dtagartar i mír (d) d'fho-alt (1) den alt seo, cur isteach, gan déanamh do réir forál ailt 31 den Acht seo, ar aon talamh nó ar aon éasáid, cead slí, ceart uisce nó ceart eile ar aon talamh nó uisce nó ina leith, féadfaidh an duine ag a mbeidh eastáit nó leasa ann, nó féadfaidh a únaer, aicsean le haghaidh damáiste a sheasamh i gcoinne an Bhuird amhail is ná beadh an Bord ag gníomhú de bhun reachta.
An Bord do thabhairt tuarascála agus eolais.
18.—(1) Bhéarfaidh an Bord gach bliain, ar pé dáta agus i pé foirm a ordós an tAire, tuarascáil don Aire ar a imeachta faoin Acht seo ar feadh na bliana roimhe sin.
(2) Bhéarfaidh an Bord don Aire, pé trátha agus i pé foirm agus slí a ordós an tAire, pé eolas, maidir le feidhmiú agus comhlíonadh a fheadhm, a iarrfas an tAire.
(3) Leagfaidh an tAire faoi bhráid gach Tighe den Oireachtas cóip de gach tuarascáil a bhéarfas an Bord dó faoin alt seo maraon le cóip de chuntas caipitil, cuntas ioncaim, cuntas sochair agus dochair, agus fuíoll-chlár deiridh an Bhuird agus cóip de thuarascáil na n-iniúchóirí ar na cuntais agus ar an bhfuíoll-chlár sin agus i dteannta gach tuarascáil den tsórt sin ón mBord leagfaidh faoi bhráid gach Tighe den Oireachtas cóipeanna de pé eolas, tuairisceáin agus cuntais a tugadh dó faoin Acht seo agus is gá chun an tuarascáil sin a thuigsint i gceart.
Caibidil II.
Cumhachta Ilghnéitheacha an Bhuird.
An Bord do dhéanamh trialach agus taighde maidir le móin agus táirgthe móna.
19.—Féadfaidh an Bord, d'fhonn feabhas a chur ar an táirgeadh a bheas á dhéanamh ar mhóin agus ar tháirgthe móna agus d'fhonn úsáid móna agus táirgthe móna a leathnú, pé trialacha agus taighde a dhéanamh is oiriúnach leis, agus féadfaidh aon eolas a gheobhfar de thoradh na dtrialach agus an taighde sin a chraobhscaoileadh i pé slí is oiriúnach leis.
Cumhachta ginearálta áirithe a bheas ag an mBord.
20.—(1) Féadfaidh an Bord, i bhfeidhmiú agus i gcomhlíonadh a fheadhm, gach ní nó aon ní acu seo leanas a dhéanamh:—
(a) aon ghléasra, inneall, goireas nó fearas a dhéanamh,
(b) foirgintí a thógáil,
(c) scéimeanna fost-cheannaigh a ghabháil de láimh,
(d) conartha a dhéanamh,
(e) siopaí agus seomraí taispeána a bhunú agus a oibriú,
(f) taibhseáin, taispeántais agus léiris a chur ar bun nó cuidiú lena gcur ar bun.
(2) Ní dhéanfaidh an Bord, chun a ndíolta, aon ghléasra, inneall, goireas ná fearas ach amháin le toiliú an Aire.
Conarthóirí a fhostú.
21.—(1) Aon uair a húdaraítear don Bhord leis an Acht seo aon obair innealltóireachta nó tógála, nó aon obair eile ar bith, a dhéanamh, féadfaidh an Bord, in ionad iad féin do dhéanamh na hoibre sin trína n-oifigigh agus a seirbhísigh féin, conradh a dhéanamh le duine ar bith (dá ngairmtear conarthóir san Acht seo) chun an duine sin do dhéanamh iomláin na hoibre sin nó aon choda dhi agus féadfaid chun na críche sin pé conartha agus comhaontuithe is gá a dhéanamh.
(2) Aon uair a dhéanfas an Bord conradh faoin alt seo le duine ar bith chun an duine sin do dhéanamh aon oibre, féadfaidh an Bord, trí aon chonradh nó comhaontú leis an duine sin, an ceart chun an obair sin a dhéanamh faoin Acht seo a tharmligean chuige agus air sin beidh ag an duine sin, i gcomhréim leis an mBord, an ceart chun an obair sin a dhéanamh agus chun pé cumhachta a fheidhmiú, de na cumhachta a bheirtear don Bhord leis an Acht seo, is gá chun an obair sin a dhéanamh agus a sonrófar chuige sin sa chonradh nó sa chomhaontú sin.
(3) Aon tagairtí atá san Acht seo don Bhord do dhéanamh aon oibre nó ruda léireofar iad agus beidh éifeacht acu mar thagairtí a fholaíos déanamh na hoibre nó an ruda sin ag conarthóir arna fhostú agus arna údarú chuige sin ag an mBord faoin alt seo.
Cur isteach ar bhóithre poiblí, iarnróid agus uisce-bhealaí.
22.—(1) Faoi réir fo-alt (2) agus (3) den alt seo féadfaidh an Bord, chun aon chuid dá fheadhma a fheidhmiú nó a chomhlíonadh, pé oibreacha (lena n-áirítear oibreacha a chuirfeas isteach ar bhóithre poiblí, droichid phoiblí, iarnróid agus uisce-bhealaí intíre agus lena n-áirítear droichid thar uisce-bhealaí intíre) a dhéanamh a chífear don Bhord is gá chun na feadhma sin a fheidhmiú nó a chomhlíonadh.
(2) Ní fheidhmeoidh an Bord aon chuid dá chumhachta faoin alt seo ach amháin le toiliú an Aire.
(3) Má bhíonn an Bord ar intinn aon oibreacha a dhéanamh, i bhfeidhmiú a gcumhacht faoin alt seo, a chuirfeas isteach ar bhóthar nó droichead poiblí nó iarnród nó uisce-bhealach intíre nó droichead thar uisce-bhealach intíre, déanfaidh an Bord, sar a dtosnóid ar na hoibreacha sin a dhéanamh, fógra mí ar a laghad á fhógairt go bhfuil sin ar intinn acu a thabhairt i scríbhinn—
(a) i gcás ina mbeidh na hoibreacha a bheas beartaithe ag cur isteach ar bhóthar nó droichead poiblí, don údarás áitiúil ar a mbeidh cúram cothabhála an bhóthair nó an droichid, nó
(b) i gcás ina mbeidh na hoibreacha a bheas beartaithe ag cur isteach ar iarnród, don chuideachta a oibriós an t-iarnród, nó
(c) i gcás ina mbeidh na hoibreacha a bheas beartaithe ag cur isteach ar uisce-bhealach intíre nó droichead thar uiscebhealach intíre, don duine a oibríos an t-uisce-bhealach intíre.
(4) Má dhéanann an Bord, i bhfeidhmiú a chumhacht faoin alt seo, droichead a thógáil thar uisce-bhealach intíre, is le gnóthaire canála, do réir bhrí Caibidle VI de Chuid den Acht Iompair, 1944 (Uimh. 21 de 1944), beidh éifeacht ag na forála seo a leanas:—
(a) ní bheidh aon chúiteamh iníoctha faoin Acht seo ná in aon tslí eile leis an ngnóthaire canála sin i leith aon chaillteanais a bhainfeas nó is dócha a bhainfeas don ghnóthaire canála toisc go ndéanfar nó gur dócha go ndéanfar, uaidh sin amach, trácht a bheadh á iompar ag an ngnóthaire canála ar an uisce-bhealach intíre, mura mbeadh sin, a iompar thar an droichead;
(b) más droichead so-ghluaiste an droichead sin, féadfaidh an tAire rialacháin a dhéanamh maidir lena úsáid agus comhlíonfaidh an Bord na rialacháin sin;
(c) má chítear don Aire gur bhain damáiste don uiscebhealach intíre sin de dheascaibh an droichead sin a bheith ann, nó de dheascaibh a úsáide, ceanglóidh an tAire ar an mBord an damáiste sin a shlánú ar a gcostas féin, agus déanfaidh an Bord do réir an cheanglais sin.
Dualgais an Bhuird maidir le bóithre agus droichid phoiblí.
23.—(1) I gcás ina gcumhachtaítear don Bhord leis an Acht seo dúnadh, claonadh, díchur nó cur isteach eile a dhéanamh ar bhóthar nó droichead poiblí chun aon obair a dhéanamh nó chur aon chríche eile faoin Acht seo, beidh éifeacht ag na forála seo leanas, sé sin le rá:—
(a) más gá, chun na hoibreacha sin a dhéanamh, an bóthar nó an droichead sin a dhúnadh i gcoinne tráchta, ansin, do réir mar a mheasfaid is ceart, déanfaidh an Bord (mura saortar iad uaidh sin faoi fho-alt (2) den alt seo), agus (faid a bheas an bóthar nó an droichead sin dúnta amhlaidh i gcoinne tráchta) cothabhálfaid, bóthar nó droichead sealadach is leor chun an méid agus an saghas tráchta a iompar a bhíos ar an mbóthar nó ar an droichead dúnta sin de ghnáth, nó d'eile, ceapfaid, le toiliú an Aire Rialtais Áitiúil agus Sláinte Poiblí, cúrsa eile chun a úsáidte faid a bheas an bóthar nó an droichead sin dúnta amhlaidh i gcoinne tráchta;
(b) déanfaidh an Bord (mura saortar iad uaidh sin faoi fho-alt (2) den alt seo), ar na hoibreacha sin a bheith críochnaithe nó roimhe sin, pé ní acu seo leanas is cuibhe leo, sé sin le rá:—
(i) déanfaid an bóthar nó an droichead dúnta sin a athchóiriú, nó
(ii) tar éis dul i gcomhairle leis an Aire Rialtais Áitiúil agus Sláinte Poiblí, déanfaidh buan-bhóthar nó buan-droichead nua is leor chun an cothrom céanna tráchta (maidir le méid agus saghas) a iompar d'fhéad an bóthar nó an droichead dúnta sin a iompar sar ar dúnadh é, agus gan é mórán níos neamhchaothúla maidir le fána agus cuar ná an bóthar nó an droichead dúnta sin, nó
(iii) le toiliú an Aire Rialtais Áitiúil agus Sláinte Poiblí, déanfaid bóthar ionaid láithreach nó droichead ionaid láithreach a fheabhsú (trína athdhéanamh, a neartú, a leathnú nó eile) i slí gur leor é chun an trácht is dócha a bheas air a iompar agus ná beidh sé mórán níos neamhchaothúla ná an bóthar nó an droichead dúnta sin;
(c) má dhéanann an Bord buan-bhóthar nua agus gur dóigh leis an Aire Rialtais Áitiúil agus Sláinte Poiblí gur feabhas substainteach ar bhóthar a bhí ann cheana an bóthar sin, déanfaidh an t-údarás áitiúil nó na húdaráis áitiúla sin a ordós an tAire sin pé cuid de chostas déanta an bhóthair sin a ordós an tAire sin a imfhulaing agus a íoc leis an mBord agus sin (i gcás dhá údarás nó níos mó den tsórt sin) do réir pé coibhneasa a ordós an tAire sin;
(d) más gá, de dhruim an Bord do dhéanamh bóthair nua, cladhphort nó obair dá shamhail nó droichead a dhéanamh agus gur dóigh leis an Aire Rialtais Áitiúil agus Sláinte Poiblí go mba cheart imfhulaing coda de chostas cothabhála na hoibre nó an droichid sin (seachas foraghaidh an bhóthair) a bheith ar an mBord, déanfaidh an Bord pé cuid den chostas cothabhála sin a ordós an tAire sin a imfhulaing agus a íoc;
(e) má dhéanann an Bord buan-droichead nua agus gur mó go substainteach na buntáistí a bheireann an droichead sin do phobal aon chontae nó bailecheantair ná mar a thug an sean-droichead, pé acu trí shlí chumarsáide níos fearr a thabhairt dóibh nó trí éinní eile é, teastasóidh an Bord costas an droichid nua sin agus teastasóidh an tAire Rialtais Áitiúil agus Sláinte Poiblí cad é an chuid den chostas sin ar dóigh leis go mba chóir do réir réasúin a himfhulaing a bheith ar chomhairle na contae nó an bhaile-cheantair sin, agus air sin déanfaidh an chomhairle sin suim is comhionann leis an gcuid a bheas teastasaithe amhlaidh den chostas sin a chruinniú mar chuid de na costais a bhainfeas le bóithre a chothabháil agus íocfaidh an chomhairle sin leis an mBord í;
(f) má éiríonn aon amhras, díospóid nó ceist i dtaobh cé acu chomhlíon nó nár chomhlíon an Bord na forála iomchuibhe den alt seo maidir le haon bhóthar nó droichead sealadach a dhéanamh nó a chothabháil nó aon bhuanbhóthar nó buan-droichead a dhéanamh nó bóthar nó droichead láithreach a athchóiriú nó bóthar ionaid láithreach nó droichead ionaid láithreach a fheabhsú (pé acu sin é) de bhun an ailt seo, nó i dtaobh cé acu bheireann nó ná tugann buan-droichead nua a rinne an Bord buntáistí do phobal aon chontae nó bailecheantair is mó go substainteach ná mar a thug an sean-droichead, is é an tAire Rialtais Áitiúil agus Sláinte Poiblí a bhéarfas breith ar an amhras, an díospóid nó an cheist sin agus beidh a bhreith sin ina breith dheiridh gan aon dul thairsi.
(2) I gcás ina gcumhachtaítear don Bhord leis an Acht seo bóthar nó droichead poiblí a dhúnadh nó a dhíchur go buan chun aon oibreacha a dhéanamh nó chun aon chríche eile faoin Acht seo, agus inar deimhin leis an Aire, tar éis dul i gcomhairle leis an Aire Rialtais Áitiúil agus Sláinte Poiblí, ná fuil gá, ag féachaint do chúrsaí uile an cháis, le bóthar nó droichead nua (pé acu é) in ionad an bhóthair nó an droichid a dúnadh nó a díchuireadh amhlaidh, féadfaidh an tAire, le hordú, a dhearbhú ná beidh feidhm ná éifeacht ag fo-alt (1) den alt seo maidir leis an mbóthar nó an droichead sin (pé acu é), agus ar an ordú sin a dhéanamh ní bheidh feidhm ná éifeacht ag an bhfo-alt sin (1) maidir leis an mbóthar nó an droichead sin (pé acu é) agus beidh an Bord saor ó gach oblagáid maidir leis an mbóthar nó an droichead sin (pé acu é) a cuirfí orthu, mura mbeadh an t-ordú sin, leis an bhfo-alt sin (1).
(3) Féadfaidh an Bord comhaontú leis an údarás áitiúil iomchuibhe chun an t-údarás áitiúil sin do dhéanamh éinní a ceangaltar ar an mBord nó a húdaraítear dó le fo-alt (1) den alt seo a dhéanamh agus féadfaidh freisin comhaontú chun airgead a íoc leis an údarás áitiúil sin chun nó mar chabhair chun íoctha costais dhéanta na nithe sin ag an údarás áitiúil sin.
(4) Nuair a bheas athchóiriú bóthair nó droichid dhúnta nó déanamh buan-bhóthair nó buan-droichid nua nó feabhsú bóthair ionaid láithrigh nó droichid ionaid láithrigh críochnaithe de bhun an ailt seo ag an mBord, bhéarfaidh an Bord i seilbh an údaráis áitiúil iomchuibhe agus glacfaidh an t-údarás áitiúil sin an bóthar nó an droichead a hathchóiríodh, a rinneadh, nó a feabhsaíodh amhlaidh (pé acu é), agus air sin beidh an Bord saor go buan (lasmuigh de chás dá bhforáltar a mhalairt go folas leis an alt seo) ó gach dliteanas nó freagarthacht maidir leis an mbóthar nó an droichead sin (pé acu é) a chothabháil.
Cumhacht ghinearálta an Bhuird chun dul isteach ar thalamh.
24.—(1) Beidh an Bord agus a n-oifigigh agus a seirbhísigh agus daoine eile a bheas údaraithe chuige sin ag an mBord i dteideal dul isteach ar aon talamh chun gach ní nó éinní a dhéanamh ar an talamh sin nó ar aon talamh eile a húdaraítear don Bhord a dhéanamh tríd an Acht seo nó chun aon fhiosrú, iniúchadh, nó scrúdú a dhéanamh i dtosach ar éinní den tsórt sin a dhéanamh.
(2) Duine ar bith a dhéanfas cosc nó toirmeasc nó cur isteach ar fheidhmiú aon chumhachta ag an mBord nó ag aon oifigeach nó seirbhíseach don Bhord nó ag duine ar bith a bheas údaraithe ag an mBord is cumhacht a bheirtear dóibh nó dhó le fo-alt (1) den alt seo, beidh sé ciontach i gcion faoin alt seo agus ar a chiontú ann ar an slí achomair dlífear fíneáil nach mó ná deich bpuint a chur air.
Ceart ag an mBord chun eolais as leabhair rátaí.
25.—Aon uair a theastós eolas as leabhar rátaí nó as doiciméid eile dá shamhail ón mBord chun a fheadhma a fheidhmiú nó a chomhlíonadh, déanfaidh an t-údarás áitiúil a mbeidh an leabhar nó an doiciméid sin ina gcoimeád, ar an mBord dá iarraidh sin orthu—
(a) cead a thabhairt d'aon oifigeach don Bhord a bheas údaraithe chuige sin ag an mBord cóip d'iomlán an leabhair nó na doiciméide sin nó d'aon chuid de a iniúchadh in aisce, agus
(b) cóip den leabhar nó den doiciméid sin nó d'aon chuid áirithe dhe a shonrós an Bord chuige sin a thabhairt don Bhord, ar an mBord d'íoc pé táille ar a gcomhaontóidh an Bord agus an t-údarás áitiúil sin nó, mura gcomhaontaítear amhlaidh, a cheapfas an tAire Rialtais Áitiúil agus Sláinte Poiblí.
Seirbhísí poist agus telegrafa a chaomhaint.
26.—Ní dhéanfaidh an Bord ná aon chonarthóir a bheas ag déanamh aon oibreacha faoin Acht seo aon tailte, áitribh, foirgintí, oibreacha, gléasra, abhair ná maoin eile leis an Aire Poist agus Telegrafa a thógaint chucu ná dul isteach orthu ná iad a dhíchur ná cur isteach orthu ar shlí eile de bhuaidh an Achta seo ná ní thógfaidh aon oibreacha ná ní dhéanfaidh aon ní ná rud eile, de bhuaidh an Achta seo, is dóigh leis an Aire Poist agus Telegrafa a choiscfeadh, a mhoilleodh, a bhacfadh nó a dhocharódh ar shlí eile feidhmiú cuibhe seirbhísí poiblí na Roinne Poist agus Telegrafa.
Iascaigh a chaomhaint.
27.—Nuair a bheas aon oibreacha á ndéanamh faoin Acht seo ní bheidh d'oblagáid ar an mBord ná ar aon chonarthóir a bheas ar fostú ag an mBord na hAchta Iascaigh, 1842 go 1944, a chomhlíonadh, ach déanfaidh an Bord nó, i gcás oibreacha a bheas á ndéanamh ag conarthóir, cuirfid faoi ndear go ndéanfaidh an conarthóir pé forchúraim a ghlacadh agus pé socruithe a cheapadh a mheasfas an tAire Talmhaíochta is leor chun iascaigh a chaomhaint agus díobháil dóibh a sheachaint le linn nó de dhruim na hoibreacha sin a dhéanamh, ach déanfaidh an tAire sin, i gcomhairle leis an mBord, deimhin de ná bainfidh dochar substainteach do na hoibreacha ná ná cuirfear bac substainteach orthu ná ná tabharfar méadú substainteach ar a gcostas de dhruim na forchúraim sin a ghlacadh agus na socruithe sin a dhéanamh.

28.—Féadfaidh an Bord aon talamh a dhíol nó a chur ar léas a bheas dílsithe iontu agus ná beidh ag teastáil a thuilleadh chun críocha a bhfeadhm.

An Bord do thógaint tailimh, etc.
29.—(1) Féadfaidh an Bord, chun aon chuid dá fheadhma a fheidhmiú nó a chomhlíonadh, gach ní nó éinní acu seo leanas a dhéanamh:—
(a) aon talamh a thógaint go buan nó go sealadach agus trí chomhaontú nó go héigeanta;
(b) aon éasúint, cead slí, ceart uisce nó ceart eile ar bith ar aon talamh nó uisce nó ina leith a thógaint (go buan nó go sealadach agus trí chomhaontú nó go héigeanta);
(c) forceannadh, srianadh, nó cur isteach eile a dhéanamh (go buan nó go sealadach agus trí chomhaontú nó go héigeanta) ar aon éasúint, cead slí, ceart uisce nó ceart eile ar bith ar aon talamh nó uisce nó ina leith;
(d) claonadh, dúnadh, díchur nó cur isteach eile a dhéanamh (go buan nó go sealadach agus trí chomhaontú nó go héigeanta) ar aon bhóthar, slí nó droichead príobháideach nó ar aon chanáil nó uisce-bhealach saorga eile nó ar aon uisce-chúrsa saorga;
(e) cur isteach ar aon talamh go buan nó go sealadach agus trí chomhaontú nó go héigeanta.
(2) Ní léireofar éinní i bhfo-alt (1) den alt seo mar ní a dhéanann difir d'oibriú ailt 130 den Acht Iompair, 1944 (Uimh. 21 de 1944).
Dul isteach ar thalamh, etc., roimh é a leithliú.
30.—(1) Aon uair roimh an leithliú nó fionnadh an phraghais nó an chúitimh a bheith déanta, féadfaidh an Bord, faoi réir na bhforál ina dhiaidh seo den alt seo agus chun aon chuid dá fheadhma a fheidhmiú nó a chomhlíonadh, gach ní nó aon ní acu seo leanas a dhéanamh:—
(a) dul isteach agus seilbh a ghlacadh ar aon talamh;
(b) aon cheart a fheidhmiú a húdaraítear leis an Acht seo don Bhord a thógaint;
(c) forceannadh, srianadh nó cur isteach eile a dhéanamh ar aon éasúint nó maoin nó ceart eile a n-údaraítear don Bhord leis an Acht seo forceannadh, srianadh nó cur isteach eile a dhéanamh air;
(d) claonadh, dúnadh, díchur nó cur isteach eile a dhéanamh ar aon bhóthar, bealach, nó droichead príobháideach nó ar aon chanáil nó uisce-bhealach saorga eile nó ar aon uisce-chúrsa saorga a n-údaraítear don Bhord leis an Acht seo claonadh, dúnadh, díchur nó cur isteach eile a dhéanamh air.
(2) Aon uair a fheidhmeos an Bord aon chumhacht dá dtugtar dó le fo-alt (1) den alt seo, dlífidh an Bord ús a íoc, le háititheoir an tailimh nó le húnaer na héasúna, an chirt nó na maoine eile a raghfar isteach air nó a gcuirfear isteach air i bhfeidhmiú na cumhachta sin, ar mhéid an phraghais nó an chúitimh is iníoctha faoin Acht seo leis an áititheoir nó leis an únaer sin, do réir trí faoin gcéad sa bhliain ó dháta an dulta isteach nó an churtha isteach sin go dtí dáta íoctha an phraghais nó an chúitimh sin.
(3) Ní dhéanfaidh an Bord—
(a) dul isteach ná seilbh a ghlacadh ar aon talamh faoin alt seo gan fógra mí ar a laghad nó, i gcás tighe chomhnaithe ina bhfuil comhnaí, fógra trí mhí ar a laghad, a thabhairt i scríbhinn roimh ré d'áititheoir an tailimh sin go bhfuilid ar intinn sin a dhéanamh, ná
(b) aon éasúint ná ceart eile a fheidhmiú ná cur isteach ar aon cheart ná maoin faoin alt seo gan fógra mí ar a laghad a thabhairt i scríbhinn roimh ré d'únaer na héasúinte, an chirt, nó na maoine sin go bhfuilid ar intinn sin a dhéanamh.
(4) Féadfar fógra faoi fho-alt (3) den alt seo a sheirbheáil ar dhuine ar bith tríd an bhfógra sin a chur leis an bpost réamhíoctha i gclúdach arna dhíriú chun an duine sin ag an seoladh is gnáth nó is déanaí is eol a bheith aige agus is tuigthe gur seirbheáladh é ar an duine sin an uair a déanfaí an clúdach sin a sheachadadh i ngnáth-chúrsa an phoist.
(5) Mura féidir, ar aon chúis áirithe, an clúdach a luaitear i bhfo-alt (4) den alt seo a dhíriú mar a foráltar leis an bhfo-alt sin, féadfar an clúdach sin a dhíriú chun an duine dá mbeidh sé beartaithe i gceachtar slí nó sa dá shlí acu seo leanas:—
(a) faoin tuairisc “an t-únaer” nó “an t-áititheoir” (pé acu é) gan a ainm a luadh,
(b) ag an talamh nó ag suíomh na maoine lena mbainfidh an fógra a bheas sa chlúdach.
Léarscála, pleananna, etc., a lóisteáil.
31.—(1) Bhéarfaidh an Bord, tráth nach déanaí ná mí roimh iad a dhul isteach ar aon talamh nó áitreabh nó roimh iad a chur isteach ar aon mhaoin nó ceart faoin gCaibidil seo, go lóisteálfar do réir an ailt seo léarscála, pleananna agus leabhair eolais maidir leis an talamh, an t-áitreabh, an mhaoin nó an ceart sin (pé acu é).
(2) Na léarscála agus na pleananna a ceangaltar leis an alt seo ar an mBord a lóisteáil beid líonmhar a ndóthain agus de shaghas is leor chun go dtaispeánfaid ar leor-scálaí an mhaoin, corprach nó neamhchorprach, a bheas beartaithe a thógaint agus gach curisteach (a mhéid is féidir sin a thaispeáint ar tharraingeoireacht) a bheas beartaithe a dhéanamh ar aon mhaoin, corprach nó neamhchorprach, nó ar aon bhóthar nó droichead poiblí.
(3) Beidh sna leabhair eolais a ceangaltar ar an mBord leis an alt seo a lóisteáil ainmneacha na ndaoine is únaeraí nó únaeraí toimhdean, léasaithe nó léasaithe toimhdean agus áititheoirí ar an talamh go léir a mbeidh beartaithe é a thógaint nó baint leis ar shlí eile faoin Acht seo agus ar an maoin go léir, corprach nó neamhchorprach (lena n-áirítear bóithre agus droichid phoiblí) a mbeidh beartaithe cur isteach uirthi in aon tslí faoin Acht seo.
(4) Is i bpríomh-oifig an Bhuird i gCathair Bhaile Atha Cliath agus i pé áiteanna eile a bheas ordaithe a lóisteálfar na léarscála, na pleananna agus na leabhair eolais a ceangaltar leis an alt seo ar an mBord a lóisteáil agus coimeádfar ar lóisteáil amhlaidh iad go ceann pé tréimhse a bheas sonraithe agus, faid a bheid ar lóisteáil amhlaidh, beid ar fáil chun a n-iniúchta ag duine ar bith, in aisce, idir a deich a chlog ar maidin agus a ceathair a chlog tráthnóna gach lá ach amháin an Satharn, an Domhnach agus laethanta saoire bainc.
(5) A luaithe is féidir tar éis aon léarscála, pleananna, nó leabhair eolais a lóisteáil de bhun an ailt seo, bhéarfaidh an Bord fógra poiblí i dtaobh na lóisteála sin trí fhógrán a fhoilsiú faoi dhó i ngach ceann de dhá nuachtán laethúla nó níos mó a léitear i gCathair Bhaile Atha Cliath agus i pé nuachtáin eile (más ann) a bheas ordaithe.
(6) Déarfar i ngach fógra poiblí a bhéarfas an Bord de bhun fo-ailt (5) den alt seo go bhfuil na léarscála, na pleananna, nó na leabhair eolais lena mbaineann an fógra sin ar fáil chun a n-iniúchta ag an bpobal do réir an ailt seo agus luafar ann na trátha agus na háiteanna ina mbeid ar fáil amhlaidh chun a n-iniúchta.
Praghas nó cúiteamh a mheisiúnú.
32.—(1) An praghas nó an cúiteamh a bheas le n-íoc ag an mBord, as aon talamh a thógfas an Bord (go buan nó go sealadach) faoin gCaibidil seo, leis na daoine uile agus faoi seach a mbeidh teideal acu chuige nó eastáit nó leasa acu ann, nó as aon éasúint, cead slí, ceart uisce, nó ceart eile nó i leith aon cheann acu sin a thógfas an Bord (go buan nó go sealadach) faoin Acht seo lena únaer nó leis na daoine uile agus faoi seach a mbeidh teideal acu chun an tailimh nó eastáit nó leasa acu sa talamh ar air nó ina leith a tógfar an ceart sin amhlaidh, déanfar, cheal comhaontuithe, a mhéid a cheapadh faoi réim agus do réir an Acquisition of Land (Assessment of Compensation) Act, 1919.
(2) An cúiteamh a bheas le n-íoc ag an mBord, as forceannadh nó srianadh nó cur isteach eile (buan nó sealadach) ag an mBord faoin Acht seo ar aon éasúint, cead slí, ceart uisce nó ceart eile ar aon talamh nó uisce nó ina leith, nó as claonadh, dúnadh, díchur nó cur isteach eile (buan nó sealadach) ag an mBord faoin Acht seo ar aon bhóthar, bealach, nó droichead príobháideach nó ar aon chanáil nó uisce-bhealach saorga eile nó ar aon uisce-chúrsa saorga nó as cur isteach (buan nó sealadach) ag an mBord faoin Acht seo ar aon talamh, déanfar, cheal comhaontuithe, a mhéid a cheapadh faoi réim agus do réir an Acquisition of Land (Assessment of Compensation) Act, 1919, amhail is dá mba é a bheadh sa chúiteamh sin an praghas ar thalamh a tógfaí go héigeanta.
(3) Nuair a bheas aon phraghas nó cúiteamh á mheisiúnú de bhun an ailt seo i leith aon mhaoine corprach nó neamhchorprach, a bheas á háitiú nó á húsáid nó á teachtadh i dteannta aon mhaoine eile nó is cuid d'aon mhaoin eile, bhéarfar áird ar aon tsochar i bhfoirm siltin nó i bhfoirm feabhsú ar sholáthar uisce a mbeadh sé réasúnach súil a bheith lena theacht don mhaoin eile sin de bhíthin aon oibreacha a bheas déanta nó á ndéanamh nó ar tí a ndéanta ag an mBord faoin Acht seo.
(4) Beidh feidhm ag ailt 69 go 83 den Lands Clauses Consolidation Act, 1845 (arna oiriúnú nó arna leasú le haon Acht iardain nó faoi) maidir le haon phraghas nó cúiteamh is iníoctha ag an mBord faoin alt seo agus maidir le maoin, corprach nó neamhchorprach, a bheas tógtha ag an mBord faoin Acht seo a leithliú chun an Bhuird, agus chun críche na feidhme sin is tuigthe gurb iad an Bord bunaitheoirí an ghnóthais.
(5) Ní luífidh aon aicsean dlí ná cothromais i gcoinne an Bhuird ná aon chonarthóra ná aon oifigigh ná seirbhísigh don Bhord nó d'aon chonarthóir i dtaobh ná i leith aon ghnímh, ní nó ruda a mbeidh cúiteamh iníoctha ina leith de bhuaidh an ailt seo.

33.—Gach éileamh ar an bpraghas le haghaidh, nó an cúiteamh i leith, aon éasúna, cirt nó maoine eile (corprach nó neamhchorprach) a thógfas an Bord nó a gcuirfidh an Bord isteach air faoin gCaibidil seo, déanfar é laistigh de bhliain tar éis don Bhord dul isteach, feidhmiú nó cur isteach a dhéanamh faoin gCaibidil seo den chéad uair ar an talamh, ar an éasúint, ar an gceart, nó ar an maoin sin.
Oibreacha a dhéanamh in ionad cúiteamh a íoc.
34.—(1) Ma bhíonn teideal, iarbhír nó go hionchasach, ag duine chun cúitimh i leith éinní a bheas déanta go dleathach nó a bheas beartaithe a dhéanamh amhlaidh ag an mBord faoin Acht seo, féadfaidh an Bord pé oibreacha a dhéanamh chun tairbhe don duine sin, mar shásamh nó mar shásamh leathrannach in éileamh an duine sin ar chúiteamh, is cuibhe leis an mBord agus a aontós an duine sin a ghlacadh.
(2) Féadfaidh an Bord pé téarmaí agus coinníollacha (lena n-áirítear téarmaí i dtaobh únaerachta, seilbhe, agus stiúrtha na n-oibreacha sin), ar a gcomhaontóidh an Bord agus an duine ar chun tairbhe dhó a déanfar na hoibreacha amhlaidh, a chur ag gabháil le déanamh aon oibreacha faoin alt seo.
Talamh a thógaint in ionad cúiteamh a íoc.
35.—Aon uair is dóigh leis an mBord go mbeadh sé neamheacnamúil nó go mbeadh sé neamhfhóirstineach ar aon chúis eile cúiteamh a íoc as cur-isteach ag an mBord ar aon talamh faoin gCaibidil seo, féadfaidh an Bord an talamh sin a thógaint go buan faoin Acht seo trí chomhaontú nó go héigeanta.
Cumhachta agus dualgais i gcás talamh tógtha a bheith faoi bhlianacht talamh-cheannaigh, etc.
36.—Aon uair a thógfas an Bord go buan faoin gCaibidil seo aon talamh a bheas, as féin nó i dteannta tailimh eile, faoi bhlianacht talamh-cheannaigh, íocaíocht in ionad cíosa, nó suim bhliantúil eile (nach é amháin atá inti cíos faoi chonradh tionóntachta) is iníoctha le Coimisiún Talún na hÉireann nó Coimisinéirí na nOibreacha Poiblí in Éirinn, ansin, amhail ón dáta ar a raghaidh an Bord isteach agus a ghlacfaidh seilbh ar an talamh a bheas tógtha amhlaidh—
(a) tiocfaidh chun bheith agus beidh de dhliteanas ar an mBord an tsuim bhliantúil sin, no pé cuid di a chionroinnfeas Coimisiún Talún na hÉireann nó na Coimisinéirí sin (pé acu é) ar an talamh sin, a íoc le Coimisiún Talún na hÉireann nó na Coimisinéirí sin (pé acu é), amhail is dá mbeadh an talamh sin arna aistriú chun an Bhúird ag a únaer ar an dáta sin, agus
(b) beidh an Bord i dteideal, más oiriúnach leis an mBord é, an tsuim bhliantúil sin nó an chuid di adúradh a fhuascailt, agus
(c) beidh d'oblagáid ar an mBord, má cheanglann Coimisiún Talún na hÉireann nó na Coimisinéirí sin (pé acu é) air é, an tsuim bhliantúil sin nó an chuid di adúradh a fhuascailt.
Cumhacht an Bhuird chun talamh a cheannach ó Choimisiún Talún na hÉireann.
37.—(1) Féadfaidh an Bord aon talamh a cheannach ó Choimisiún Talún na hÉireann a bheas dílsithe i gCoimisiún Talún na Éireann agus a theastós ón mBord chun gach ceann nó aon cheann dá fheadhma a fheidhmiú nó a chomhlíonadh.
(2) Beidh éifeacht ag na forála seo leanas maidir le gach ceannach talún faoin alt seo:—
(a) ceannófar an talamh sin amhlaidh ar pé praghas agus ar pé téarmaí agus coinníollacha eile ar a gcomhaontóidh an Bord agus Coimisiún Talún na hÉireann, faoi réir an tsrianta ná déanfar, nuair a bheas an praghas sin á mheisiúnú, aon áird a thabhairt, ná aon mheadú praghais a lomháil, ar fheabhsuithe ar bith a rinneadh ar an talamh sin le hairgead arna íoc nó arna áirleacan as an mPríomh-Chiste nó as airgead arna sholáthar ag an Oireachtas;
(b) déanfaidh Coimisiún Talún na hÉireann an talamh sin a leithliú chun an Bhuird nó a dhílsiú ann;
(c) soláthróidh agus íocfaidh an Bord an praghas a bheas le n-íoc ag an mBord le Coimisiún Talún na hÉireann;
(d) íocfaidh an Bord costas agus caiteachas uile an Bhuird agus Choimisiún Talún na hÉireann i dtaobh nó i leith an cheannaigh sin.
(3) San alt seo (ach amháin sa bhfo-alt seo) folaíonn an focal “talamh” aon éasúint, profit-à-prendre, nó ceart eile ar aon talamh nó maidir leis agus folóidh an chumhacht cheannaigh a bheirtear leis an alt seo cumhacht chun aon cheart den tsórt sin a cheannach pé acu i dteannta nó d'éagmais talamh a cheannach é.

38.—Sa Chaibidil seo—
ciallaíonn an abairt “oibreacha iompair” aon oibreacha is—
(a) iarnród, nó

Iarratais ar ordú oibreacha iompair.
39.—(1) Féadfaidh an Bord ordú oibreacha iompair a iarraidh ar an Aire á údarú don Bhord oibreacha iompair de chineál áirithe a dhéanamh, a chothabháil agus a oibriú chun críocha a fheadhm.
(2) Beidh ag gabháil le gach iarratas ar ordú oibreacha iompair—
(a) dréacht den ordú a bheas beartaithe,
(b) plean de na hoibreacha iompair a bheas beartaithe, agus
(c) leabhar eolais don phlean sin,
agus beidh an dréacht, an plean agus an leabhar eolais sin i pé foirm a ordós an tAire.
An dréachtordú, an plean agus an leabhar eolaisa lóisteáil agus fógra a thabhairt i dtaobh an iarratais.
40.—(1) Aon uair a hiarrfar ordú oibreacha iompair déanfaidh an Bord, a luaithe is féidir, na nithe seo leanas, sé sin le rá:—
(a) cóip den dréacht-ordú, den phlean agus den leabhar eolais don phlean sin a bhí ag gabháil leis an iarratas a lóisteáil agus a choimeád ar lóisteáil, san áit nó i ngach ceann de na háiteanna a ordós an tAire;
(b) fógra a fhoilsiú, i pé nuachtán nó nuachtáin a ordós an tAire, i dtaobh an t-iarratas sin a dhéanamh agus i dtaobh cóip den dréacht-ordú, den phlean, agus den leabhar eolais sin a lóisteáil agus i dtaobh na háite nó na n-áiteanna inar lóisteáladh amhlaidh iad;
(c) cóip den dréacht-ordú, den phlean agus den leabhar eolais sin a chur go dtí pé daoine (más ann) a ordós an tAire.
(2) Féadfaidh duine ar bith an chóip d'aon dréacht-ordú, plean nó leabhar eolais a bheas arna lóisteáil faoin alt seo a iniúchadh gach tráth réasúnach.
Táille ar iarratais.
41.—(1) Íocfar leis an Aire ar gach iarratas ag lorg orduithe oibreacha iompair pé táille (más ann) a chinnfeas an tAire, le toiliú an Aire Airgeadais.
(2) Beidh éifeacht ag na forála seo leanas maidir leis na táillí uile is iníoctha faoin alt seo, sé sin le rá:—
(a) déanfar na táillí sin a bhailiú in airgead agus a ghlacadh i pé slí a ordós an tAire Airgeadais ó am go ham, agus íocfar isteach sa Stát-Chiste nó cuirfear chun tairbhe don Stát-Chiste iad do réir ordachán an Aire Airgeadais;
(b) ní bheidh feidhm ag an Public Offices Fees Act, 1879, maidir leis na táillí sin.
Fiosrúcháináitiúla i dtaobh iarratas ar orduithe oibreacha iompair.
42.—(1) (a) Má cuirtear iarratas chun an Aire ag lorg orduithe oibreacha iompair, féadfaidh an tAire, más oiriúnach leis, a ordú fiosrúchán poiblí a dhéanamh i dtaobh an iarratais sin sa cheantar a mbeidh beartaithe na hoibreacha iompair is abhar don iarratas a dhéanamh ann.
(b) Má ordaíonn an tAire fiosrúchán poiblí a dhéanamh i dtaobh iarratais ar ordú oibreacha iompair, ceapfaidh sé oifigeach don Aire chun an fiosrúchán sin a dhéanamh, agus beidh an Bord, agus gach únaer, léasaí agus áititheoir ar an talamh a mbeidh beartaithe na hoibreacha iompair is abhar don iarratas a dhéanamh air nó thairis, agus gach údarás áitiúil a mbeidh beartaithe na hoibreacha sin a ghabháil trína líomatáiste, agus gach duine eile ar dóigh leis an oifigeach sin leas substainteach a bheith aige in abhar an fhiosrúcháin sin, i dteideal teacht i láthair agus éisteacht a fháil ag an bhfiosrúchán sin.
(2) Fianaise a bhéarfar os comhair oifigigh don Aire a bheas ceaptha chun fiosrúchán a dhéanamh faoin alt seo, déanfar, má iarrann an t-oifigeach sin é, í a thabhairt faoi mhionn (a gcumhachtaítear leis seo don oifigeach sin daoine a chur faoi) agus aon duine a bhéarfas fianaise bhréagach os comhair aon oifigigh den tsórt sin beidh sé ciontach i mionn éithigh agus beidh sé inphionóis dá réir sin.
Ordú oibreacha iompair a dheonadh.
43.—Má thárlann, tar éis don Aire breithniú a dhéanamh ar iarratas ag lorg orduithe oibreacha iompair agus, i gcás in a ndearnadh fiosrúchán faoi alt 42 den Acht seo i dtaobh an iarratais, ar thuarascáil an oifigigh a rinne an fiosrúchán agus tar éis dó dul i gcomhairle leis an Aire Rialtais Áitiúil agus Sláinte Poiblí, gur dóigh leis an Aire gur ceart géilleadh don iarratas, déanfaidh sé ordú á údarú don Bhord na hoibreacha iompair a bheas sonraithe san ordú a dhéanamh, a chothabháil agus a oibriú i pé slí, faoi réir pé srianta agus forál, agus ar pé téarmaí agus coinníollacha is cuibhe leis an Aire agus a shonrós sé san ordú.
Forála maidir le hordú oibreacha iompair.
44.—Beidh éifeacht ag na forála seo leanas maidir le hordú oibreacha iompair, sé sin le rá:—
(a) beidh san ordú sin pé forála a mheasfas an tAire is gá nó is fóirstineach chun críche an orduithe sin;
(b) gan dochar do ghinearáltacht mhíre (a) den fho-alt seo—
(i) féadfaidh forála a bheith san ordú sin á údarú don Bhord aon talamh a thógaint go héigeanta is dóigh leis an Aire is gá chun éifeacht a thabhairt don ordú sin,
(ii) féadfaidh an t-ordú sin aon chearta a dheonadh don Bhord i dtalamh nó uisce nó thar talamh nó uisce, nó in aon bhóthar poiblí nó thairis, is dóigh leis an Aire is gá a dheonadh chun éifeacht a thabhairt don ordú sin,
(iii) forálfaidh an t-ordú sin, maidir le haon talamh a tógfar amhlaidh nó aon cheart thar talamh nó uisce a deonfar amhlaidh, go n-íocfaidh an Bord cúiteamh leis na daoine uile agus faoi seach ag a mbeidh eastáit nó leasa sa talamh nó san uisce sin, agus forálfaidh go ndéanfar aon cheist nó aon chúiteamh díospóidithe a chinneadh faoi réim agus do réir an Asquisition of Land (Assessment of Compensation), Act, 1919,
(iv) féadfaidh an t-ordú sin gach ceann nó aon cheann d'fhorála Acht na gClásal Talún a chorprú, fara pé modhnuithe agus oiriúnuithe is cuibhe leis an Aire,
(v) sonróidh an tordú sin an modh ar a mbeidh na hoibreacha iompair lena mbainfidh an t-ordú sin le déanamh,
(vi) féadfaidh an t-ordú sin an tréimhse a chinneadh ar laistigh di a caithfear déanamh na n-oibreacha iompair sin a chríochnú,
(vii) féadfaidh forála a bheith san ordú sin i dtaobh an mhodha ar a mbeidh na hoibreacha iompair sin le hoibriú agus le cothabháil,
(viii) beidh san ordú sin forála ag teorannú úsáide na n-oibreacha iompair sin chun críocha a bhainfeas le feadhma an Bhuird agus chun pé críocha eile (más ann) a sonrófar san ordú sin,
(ix) beidh san ordú sin na forála uile is cuibhe leis an Aire chun an pobal i gcoitinne agus aon daoine lena mbainfidh an t-ordú sin a chosaint,
(x) féadfaidh an t-ordú sin a fhoráil go mbeidh an Bord, má sháraíonn sé aon fhoráil shonraithe den ordú (trí ghníomh nó neamhghníomh), ciontach i gcion faoin ordú sin agus go ndlífear ar a chiontú ann ar an slí achomair pé fíneáil (nach mó ná céad punt) a chur air a sonrófar san ordú sin i leith an chiona sin agus, i gcás ciona leanúnaigh, pé fíneáil bhreise (nach mó ná fiche punt) a sonrófar san ordú sin i leith an chiona sin in aghaidh gach lae a leanfar den chion sin tar éis an chiontuithe,
(xi) féadfaidh an t-ordú sin aon fhorála (lena n-áirítear forála pionósacha) a chorprú a bheas in aon achtachán a bhaineas le hiarnróid, fara pé oiriúnuithe agus modhnuithe is cuibhe leis an Aire,
(xii) maidir le feidhmiú na gcumhacht chun talamh a thógaint go héigeanta, féadfaidh forála sa chéill chéanna leis na forála atá in ailt 30 agus 36 den Acht seo a bheith san ordú sin,
(xiii) féadfaidh an t-ordú sin a fhoráil go ndéanfar aon cheisteanna sonraithe a éireos faoin ordú a chinneadh trí eadráin,
(xiv) féadfaidh pé forála a ghabhfas nó a bhainfeas le héinní de na nithe adúradh, agus a mheasfas an tAire is gá agus is cuibhe, a bheith san ordú sin.
Rialacháin maidir le hoibreacha iompair a chothabháil agus a oibriú.
45.—I gcás ordú oibreacha iompair a bheith déanta ag an Aire á údarú don Bhord oibreacha iompair de chineál áirithe a dhéanamh, a chothabháil agus a oibriú, beidh éifeacht ag na forála seo leanas, sé sin le rá:—
(a) féadfaidh an tAire rialacháin (ná beidh ar neamhréir leis an ordú sin) a dhéanamh maidir leis an modh ar a mbeidh na hoibreacha iompair sin le cothabháil agus le n-oibriú ag an mBord agus ag aon duine eile a bheas ag oibriú na n-oibreacha sin thar ceann an Bhuird;
(b) má sháraíonn an Bord nó an duine eile sin na rialacháin sin (trí ghníomh nó neamhghníomh), beidh an Bord ciontach i gcion faoin alt seo agus ar a chiontú ann ar an slí achomair dlífear fíneáil nach mó ná deich bpuint a chur air agus, i gcás ciona leanúnaigh, fíneáil bhreise nach mó ná cúig puint in aghaidh gach lae a leanfar den chion sin tar éis an chiontuithe.
Rialacháin maidir le cumhacht leictreachais a úsáid.
46.—I gcás ordú oibreacha iompair a bheith déanta ag an Aire á údarú don Bhord oibreacha iompair de chineál áirithe a dhéanamh, a chothabháil agus a oibriú agus é a bheith údaraithe aige leis an ordú sin na hoibreacha iompair sin a oibriú le cumhacht leictreachais, beidh éifeacht ag na forála seo leanas, sé sin le rá:—
(a) féadfaidh an tAire, tar éis dul i gcomhairle le Bord Soláthair an Leictreachais, pé rialacháin a dhéanamh is oiriúnach leis chun a áirithiú go ndéanfaidh an Bord agus aon duine eile a bheas ag oibriú na n-oibreacha sin thar ceann an Bhuird, nuair a bheas an chumhacht leictreachais á húsáid aige, gach forchúram a ghlacadh is réasúnach agus is cuibhe chun contúirt don phobal nó damáiste do mhaoin aon duine a sheachaint;
(b) nuair a bheas na rialacháin sin á ndéanamh ag an Aire, bhéarfaidh sé áird ar an gcostas a chuirfeas sin ar an mBord agus ar a éifeacht ar ionchais airgeadais an Bhuird;
(c) má dhéanann an Bord nó aon duine eile a bheas ag oibriú na n-oibreacha iompair sin thar ceann an Bhuird an chumhacht leictreachais sin a úsáid contrártha do na rialacháin sin, beidh an Bord ciontach i gcion faoin alt seo agus ar a chiontú ann ar an slí achomair dlífear fíneáil nach mó ná deich bpuint a chur air agus, i gcás ciona leanúnaigh, fíneáil bhreise chúig punt in aghaidh gach lae a leanfar den chion tar éis an chiontuithe;
(d) más dóigh leis an Aire go ndearna an Bord nó aon duine a bhí ag oibriú na n-oibreacha iompair sin thar ceann an Bhuird an chumhacht leictreachais sin a úsáid contrártha do na rialacháin sin, pé acu ciontaíodh an Bord i gcion nó nár ciontaíodh, nó más deimhin leis an Aire gur contúirt don phobal an chumhacht sin a bheith á húsáid, féadfaidh sé, le hordú, a cheangal ar an mBord scor de na cumhachta a fheidhmiú a tugadh leis an ordú oibreacha iompair sin maidir le cumhacht leictreachais a úsáid agus air sin scoirfidh an Bord de na cumhachta sin a fheidhmiú ach amháin le toiliú an Aire agus faoi réir pé téarmaí agus coinníoll is oiriúnach leis.
Bord Soláthair an Leictreachais do dhéanamh oibreacha iompair mar chonarthóirí don Bhord.
47.—Má húdaraítear don Bhord, le hordú oibreacha iompair, oibreacha iompair a dhéanamh, féadfaidh Bord Soláthair an Leictreachais, mar chonarthóirí don Bhord, na hoibreacha iompair sin a dhéanamh.
Ordú oibreacha iompair a leasú
48.—Féadfaidh an tAire ó am go ham ordú oibreacha iompair a leasú.

49.—Beidh feidhm dlí ag gach ordú a dhéanfas an tAire faoin gCaibidil seo.
Costais an Air i bhfeidhmiú cumhacht faoi ordú oibreacha iompair.
50.—Na costais faoina raghaidh an tAire i bhfeidhmiú a chumhacht agus a fheadhm faoi ordú oibreacha iompair, déanfaidh an Bord, a mhéid a chinnfeas an tAire Airgeadais, iad a íoc leis an Aire.

Forála Airgeadais.
Deontas don Bhord i leith costas trialach agus taighde.
52.—(1) Sa bhliain airgeadais ina mbeidh dáta an bhunuithe agus i ngach bliain de na naoi mbliana ina dhiaidh sin, féadfaidh an tAire, as airgead a sholáthrós an tOireachtas, deontas de pé méid a chinnfeas an tAire, le toiliú an Aire Airgeadais, a íoc, faoi réir na teorann a forchuirtear le fo-alt (2) den alt seo, leis an mBord i leith na gcostas faoina raghaidh an Bord faoi alt 19 (a bhaineas le trialacha agus taighde ag an mBord maidir le móin agus táirgthe móna) den Acht seo.
(2) Ní mó ná céad agus fiche míle punt méid iomlán na ndeontas a deonfar faoin alt seo.
(3) Aon deontais a bhéarfar faoin alt seo, is chuige amháin a úsáidfeas an Bord iad chun costais faoina raghaidh an Bord faoin alt seo a íoc.
Airleacain don Bhord as an bPríomh-Chiste.
53.—(1) Chun a chumasú don Bhord a fheadhma a chomhlíonadh nó a fheidhmiú, féadfaidh an tAire Airgeadais, ar mholadh an Aire, pé suimeanna (nach mó san iomlán ná trí mhilliún seacht gcéad agus caoga míle punt) a iarrfas an Bord ó am go ham a áirleacan don Bhord ó am go ham as an bPríomh-Chiste nó as a thoradh fáis.
(2) Na suimeanna a háirleacfar faoin alt seo, is chuige amháin a úsáidfeas an Bord iad chun críche feadhm an Bhuird.
(3) Beidh na suimeanna a háirleacfar faoin alt seo inaisíoctha fara ús do réir na bhforál ina dhiaidh seo den Acht seo.
Airgead a sholáthar le haghaidh áirleacan don Bhord as an bPríomh-Chiste.
54.—(1) Féadfaidh an tAire Airgeadais, chun airgead a sholáthar le haghaidh áirleacan suimeanna as an bPríomh-Chiste faoi alt 53 den Acht seo, pé suimeanna a theastós chun na críche sin a fháil ar iasacht ar urrús an Phríomh-Chiste nó a thoradh fáis, agus féadfaidh an tAire sin, chun críocha na hiasachta sin, urrúis a chruthnú agus a eisiúint ar pé ráta úis agus faoi réir pé coinníoll i dtaobh aisíoca, fuascailte, nó eile is oiriúnach leis, agus íocfaidh isteach sa Stát-Chiste an t-airgead go léir a gheobhfar ar iasacht amhlaidh.
(2) Is ar an bPríomh-Chiste nó ar a thoradh fáis a bheas muirear agus íoc bun-airgid agus úis gach urrúis a heiseofar faoin alt seo.
Us a íoc aráirleacain inaisíoctha.
55.—(1) Faoi réir ailt 57 den Acht seo, íocfaidh an Bord leis an Aire Airgeadais, ar gach suim a háirleacfar don Bhord as an bPríomh-Chiste faoi alt 53 den Acht seo agus a bheas inaisíoctha, ús ó dháta na suime sin a áirleacan go dtí go n-aisíocfar an tsuim sin, do réir pé ráta a cheapfas an tAire Airgeadais ó am go ham maidir leis an suim sin, agus íocfar an t-ús sin amhlaidh trí íocaíochta leath-bhliantúla ar pé laethanta gach bliain a cheapfas an tAire Airgeadais ó am go ham.
(2) Mura n-íoca an Bord leis an Aire Airgeadais aon ús is iníoctha ag an mBord faoin alt seo an tráth a ceapfar chuige sin faoin alt seo, íocfaidh an Bord leis an Aire sin ús do réir an ráta a cheapfas an tAire sin ar an ús a bheas gan íoc amhlaidh ón tráth a bheas ceaptha mar adúradh go dtí go n-íocfar an céanna iarbhír.
(3) An t-ús go léir a íocfas an Bord leis an Aire Airgeadais faoin alt seo, íocfar isteach sa Stát-Chiste nó cuirfear chun tairbhe don Stát-Csiste é i pé slí a ordós an tAire sin.
Airleacain inaisíoctha a aisíoc.
56.—(1) Chun an Bord d'aisíoc na n-áirleacan a bheas tugtha dhó as an bPríomh-Chiste faoi alt 53 den Acht seo agus a bheas inaisíoctha, íocfaidh an Bord leis an Aire Airgeadais íocaíochta leath-bhliantúla a thosnós ar pé dáta, agus a leanfas ar feadh pé uimhir de bhlianta agus a bheas de pé méideanna agus a bheas iníoctha pá trátha, a cheapfas an tAire sin, tar éis dul i gcomhairle leis an Aire, agus féadfar dátaí, uimhreacha de bhlianta, méideanna, agus trátha éagsúla den tsórt sin a cheapadh amhlaidh i leith coda éagsúla de na háirleacain sin.
(2) Na híocaíochta leath-bhliantúla uile agus faoi seach a bheas le déanamh leis an Aire Airgeadais ag an mBord faoin alt seo, úsáidfidh an tAire sin iad mar chistí fiach-mhúchta chun na coda uile agus faoi seach a aisíoc de na háirleacain ar ina leith a déanfar na híocaíochta leath-bhliantúla sin agus nuair a bheas an uimhir iomlán de na híocaíochta leath-bhliantúla a bheas ceaptha faoin alt seo i leith aon choda de na háirleacain sin íoctha ag an mBord leis an Aire sin (maille le haon ús a bheas arna theacht chun bheith iníoctha faoin alt seo i leith aon íocaíochta leath-bhliantúla dhíobh sin) is tuigthe an chuid sin de na háirleacain sin a bheith aisíoctha go hiomlán ag an mBord, gan dochar do dhliteanas an Bhuird maidir le haon ús a bheas gan íoc an tráth sin i leith na coda sin de na háirleacain sin.
(3) Mura n-íoca an Bord leis an Aire Airgeadais aon íocaíocht leath-bhliantúil nó aon chuid d'íocaíocht leath-bhliantúil is iníoctha aige leis an Aire sin faoin alt seo an tráth a bheas ceaptha chuige sin faoin alt seo, íocfaidh an Bord leis an Aire sin, ar an íocaíocht leath-bhliantúil sin nó ar an gcuid sin d'íocaíocht leathbhliantúil, ús do réir pé ráta a cheapfas an tAire sin ó am go ham ina leith sin ón tráth a bheas ceaptha mar adúradh go dtí go mbeidh an céanna íoctha iarbhír.
(4) An t-airgead go léir a íocfas an Bord leis an Aire Airgeadais faoin alt seo do dhéanamh aisíoca ar áirleacain, íocfar isteach sa Stát-Chiste é.
(5) Gach suim a íocfas an Bord leis an Aire Airgeadais faoin alt seo ar scór úis, íocfar isteach sa Stát-Chiste nó cuirfear chun tairbhe don Stát-Chiste í i pé slí a ordós an tAire Airgeadais.
Us ar áirleacain áirithe don Bhord a ligean i gceal.
57.—(1) Beidh feidhm ag na forála seo leanas maidir le haon áirleacain (dá ngairmtear na háirleacain sin sa bhfo-alt seo) a bhéarfar don Bhord faoi alt 53 den Acht seo i rith na tréimhse (dá ngairmtear an tréimhse chúig-bhlianach sa bhfo-alt seo) de chúig bliana dar tosach dáta an bhunuithe, sé sin le rá:—
(a) ní bheidh aon ús iníoctha ag an mBord ar na háirleacain sin in aghaidh aon tréimhse dar chríoch an lá díreach roimh an dáta ar a ndéanfaidh an tAire Airgeadais ordú faoi mhír (c) den alt seo,
(b) déanfaidh an tAire Airgeadais, díreach tar éis an tréimhse chúig-bhlianach a bheith caite, cúrsaí airgeadais an Bhuird a scrúdú,
(c) tar éis an scrúduithe sin, déanfaidh an tAire sin, ag féachaint don staid ina mbeidh cúrsaí airgeadais an Bhuird an tráth sin agus d'ionchais an Bhuird ó thaobh airgeadais san am le teacht,—
(i) an Bord a shaoradh, le hordú (dá ngairmtear an t-ordú saoirse san alt seo), ó bheith faoi dhliteanas maidir le hús a íoc ar na háirleacain sin in aghaidh na tréimhse a mbeidh an t-ordú saoirse i bhfeidhm ar a feadh, nó
(ii) a dhearbhú, le hordú, go ndlífidh an Bord ús a íoc ar na háirleacain sin in aghaidh aon tréimhse dar tosach dáta an orduithe nó dáta dá éis sin,
(d) má dhéanann an tAire sin an t-ordú saoirse, féadfaidh sé tráth ar bith ina dhiaidh sin an t-ordú saoirse a chulghairm trí ordú.
(2) Sar a ndéanfaidh an tAire Airgeadais aon ordú faoi fho-alt (1) den alt seo raghaidh sé i gcomhairle leis an Aire i dtaobh an orduithe a bheas bheartaithe.
(3) Má déantar an t-ordú saoirse, leagfar é faoi bhráid Dháil Éireann a luaithe is féidir tar éis a dhéanta agus, má dhéanann Dáil Éireann, laistigh den lá agus fiche a shuífeas Dáil Éireann tar éis an t-ordú a leagadh faoina bhráid, rún a rith ag cur an orduithe ar neamhbhrí, beidh an t-ordú arna chur ar neamhbhrí dá réir sin.
Cumhacht an Bhuird chun airgead a fháil ar iasacht go sealadach.
58.—Féadfaidh an Bord, le toiliú an Aire, arna thabhairt tar éis dó dul i gcomhairle leis an Aire Airgeadais, pé suimeanna, a theastós uaidh chun soláthar a dhéanamh le haghaidh caiteachais reatha, a fháil ar iasacht go sealadach trí shocrú le bancaeraí.
Cuntais agus Iniúchta.
59.—(1) Coimeádfaidh an Bord i pé foirm a cheadós an tAire tar éis dó dul i gcomhairle leis an Aire Airgeadais gach cuntas is cuibhe agus is gnáth ar an airgead go léir a gheobhfas nó a chaithfeas an Bord, ar a n-áirítear cuntas caipitil, cuntas ioncaim, cuntas sochair agus dochair, agus fuíoll-chlár, agus go háirithe coimeádfaidh sa bhfoirm adúradh gach cuntas speisialta a ordós an tAire ó am go ham, as a threoir féin nó ar iarratas an Aire Airgeadais.
(2) Cuirfear cuntais an Bhuird do gach bliain á n-iniúchadh laistigh de nócha lá nó pé tréimhse is sia ná sin a cheadós an tAire in aon chás áirithe tar éis deireadh na bliana sin agus beid ina n-abhar tuarascála ag iniúchóirí cuibhe-cháilithe a cheapfas an tAire gach bliain chuige sin, le toiliú an Aire Airgeadais, agus íocfaidh an Bord táillí na n-iniúchóirí sin agus costais ghinearálta na n-iniúchta sin.
(3) Féadfaidh an tAire, le toiliú an Aire Airgeadais, am agus áit agus modh stiúrtha an iniúchta ar chuntais an Bhuird faoin alt seo a cheapadh, agus féadfaidh freisin na cuntais a shonrú a mbeidh cóipeanna dhíobh le tabhairt don Aire faoin alt seo agus fós na cuntais a bheas le foilsiú agus le cur ar díol faoin alt seo maraon le ham agus modh an fhoilsithe agus an díola sin.
(4) Díreach tar éis gach iniúchta faoin alt seo ar chuntais an Bhuird, cuirfidh an Bord chun an Aire cóip den chuntas caipitil, den chuntas ioncaim, den chuntas sochair agus dochair agus den fhuíoll-chlár amhail mar bheid teastasaithe ag na hiniúchóirí, cóip de thuarascáil na n-iniúchóirí, agus cóipeanna de pé méid a ceapfar chuige sin faoin alt seo nó a iarrfas an tAire go speisialta de na cuntais a cuireadh faoi bhráid na n-iniúchóirí, agus foilseoidh an Bord agus cuirfidh ar díol pé méid a cheapfas an tAire chuige sin de na cuntais a cuireadh faoi bhráid na n-iniúchóirí.

60.—(1) Beidh an Chuideachta scortha arna scor, de bhuaidh an ailt seo agus faoi réir na bhforál atá sa Sceideal a ghabhas leis an Acht seo, ar dháta an bhunuithe.
(2) Beidh feidhm ag na forála atá sa Sceideal a ghabhas leis an Acht seo maidir leis an gCuideachtain scortha.

61.—Ar dháta an bhunuithe nó a luaithe is féidir dá éis, íocfaidh an Bord le gach duine a bhí, an lá díreach roimh dháta an bhunuithe, ina shealbhóir cláraithe ar aon scair nó scaireanna sa chuideachtain scortha, suim puint in aghaidh gach scaire a bhí aige sa chuideachtain scortha, agus glacfaidh an duine sin leis an íocaíocht sin mar mhalairt agus mar shásamh ar gach ceart agus éileamh i leith gach scaire den tsórt sin a ndéanfar an íocaíocht sin ina leith.

62.—(1) Faoi réir forál an ailt seo, an mhaoin uile, réadach nó pearsanta (agus rudaí-ar-fionraí a áireamh), a bhí, díreach roimh dháta an bhunuithe, dílsithe sa chuideachtain scortha nó dá cuid féin aici nó i seilbh ar iontaoibh di agus gach ceart, cumhacht agus príbhléid a bhain nó a ghabh le haon mhaoin den tsórt sin, tiocfaid chun bheith agus beid, ar dháta an bhunuithe agus gan leithliú ná sannadh ar bith ach faoi réir a n-aistrithe, más gá sin, i leabhair aon bhainc nó corparáide nó cuideachtan, dílsithe sa Bhord nó dá chuid féin aige nó i seilbh ar iontaoibh dó (do réir mar is gá sa chás) chun an eastáit, na hiontaoibhe nó an leasa uile chun a raibh an céanna, díreach roimh dháta an bhunuithe, dílsithe sa chuideachtain scortha nó dá cuid féin aici nó i seilbh ar iontaoibh di.
(2) An mhaoin uile a haistrítear leis an alt seo agus a bhí, díreach roimh dháta an bhunuithe, ar seasamh i leabhair aon bhainc nó cláraithe i leabhair aon bhainc, corparáide nó cuideachtan, déanfaidh an banc, an chorparáid nó an chuideachta sin, ar an mBord dá iarraidh sin ar dháta an bhunuithe nó dá éis, í a aistriú sna leabhair sin chun ainme an Bhuird.
(3) Gach rud-ar-fionraí a haistrítear leis an alt seo chun an Bhuird, féadfaidh an Bord, ar dháta an bhunuithe agus dá éis, an dlí a shaothrú mar gheall air nó é a aisghabháil nó é a fhorfheidhmiú ina ainm féin agus ní gá don Bhord fógra i dtaobh an aistrithe a déantar leis an alt seo a thabhairt don té ar a mbeidh an rud-arfionraí sin ina cheangal.

63.—Na fiacha agus na dliteanais eile go léir (lena n-áirítear dliteanais neamhleachtaithe de dhruim torta nó sáruithe conartha) a bhí, díreach roimh dháta an bhunuithe, amuigh ar an gcuideachtain scortha agus gan íoc aici nó dlite uirthi agus gan comhlíonadh aici, tiocfaid chun bheith agus beid, ar dháta an bhunuithe, ina bhfiacha nó ina ndliteanais ar an mBord, agus dá réir sin íocfaidh nó comhlíonfaidh an Bord iad agus féadfar iad a aisghabháil uaidh nó a fhorfheidhmiú ina choinne.

64.—(1) Más léir ó fhuíoll-chlár na cuideachtan scortha, amhail mar bheas sé teastasaithe ag iniúchóirí na cuideachtan scortha, breis a bheith, díreach roimh dháta an bhunuithe, ag féichiúnais (agus an fiach Stáit a áireamh) na cuideachtan scortha ar a sócmhainní (breis a ngairmtear an t-easnamh dá méid sa bhfo-alt seo), ansin, déanfaidh an tAire Airgeadais an Bord a fhuascailt, le héifeacht amhail ar dháta an bhunuithe agus ón dáta sin amach, ón méid sin den fhiach Stáit is comhionann leis an easnamh nó le caoga míle punt, pé acu sin is lú.
(2) San alt seo, ciallaíonn an abairt “an fiach Stáit” an tsuim a bhí, díreach roimh dháta an bhunuithe, dlite den chuideachtain scortha ag an Aire Airgeadais.

65.—Gach banna, ráthaíocht, nó urrús eile de shaghas leanúnach a thug an chuideachta scortha do dhuine ar bith, nó a thug duine ar bith don chuideachtain scortha sin, agus a bhí i bhfeidhm díreach roimh dháta an bhunuithe, agus gach conradh nó comhaontú i scríbhinn a rinneadh idir an chuideachta scortha agus duine eile agus ná raibh forghníomhaithe agus críochnaithe go hiomlán roimh dháta an bhunuithe leanfaid d'ainneoin an chuideachta scortha a bheith scortha, de bheith i bhfeidhm ar dháta an bhunuithe agus dá éis, ach léireofar iad agus beidh éifeacht acu amhail is dá gcuirtí ainm an Bhuird iontu in ionad ainme na cuideachtan scortha, agus beidh an t-urrús, an conradh, nó an comhaontú sin infhorfheidhmithe ag an mBord nó ina choinne dá réir sin.

66.—Gach aicsean, agra nó imeacht a bheas ar feitheamh ar dháta an bhunuithe in aon chúirt nó bínse agus a mbeidh an chuideachta scortha ina páirtí ann, tiocfaidh an Bord chun bheith agus beidh, ar dháta an bhunuithe ina pháirtí ann in ionad na cuideachtan scortha agus leanfar den imeacht sin idir an Bord agus na páirtithe eile ann dá réir sin agus ní thuitfidh aon imeacht den tsórt sin ar lár ná ní thiocfaidh deireadh leis ná ní déanfar dochar dó de dhruim an chuideachta scortha a scor.

67.—Gach conradh seirbhíse, sainráite nó intuigthe, a rinneadh agus a bheas i bhfeidhm díreach roimh dháta an bhunuithe idir an chuideachta scortha agus duine ar bith is oifigeach tuarastail nó fostaí don chuideachtain scortha, leanfaidh sé i bhfeidhm ar dháta an bhunuithe agus dá éis, ach léireofar é agus beidh éifeacht aige amhail is dá gcuirtí an Bord ann in ionad na cuideachtan scortha, agus beidh gach conradh den tsórt sin infhorfheidhmithe ag an mBord nó ina choinne dá réir sin.

68.—(1) Ní oibreoidh alt 12 den Finance Act, 1895, chun a cheangal ar an mBord cóip den Acht seo a sheachadadh do na Coimisinéirí Ioncaim ná aon diúite stampa a íoc faoin alt sin ar aon chóip den Acht seo.
(2) Ní bheidh diúité stampa inéilithe ar aon aistriú, leithliú, ná ionstraim eile a comhlánófar chun dílsiú sócmhainní na cuideachtan scortha sa Bhord a fhorlíonadh nó chun éifeacht a thabhairt don dílsiú sin.

1. Chun críocha an Sceidil seo ach ní chun aon chríche eile ná ar aon tslí eile, is tuigthe an chuideachta scortha a leanúint ar marthain ar dháta an bhunuithe agus dá éis.
2. Ar an mBord dá iarraidh sin, comhlánfaidh an chuideachta scortha na hionstraimí sin uile agus déanfaidh na nithe sin uile is gá chun a chumasú don Bhord aon stoic, scaireanna nó urrúis a bheas i seilbh na cuideachtan scortha díreach roimh dháta an bhunuithe a chur á n-aistriú chun ainme an Bhuird, agus chuige sin is tuigthe na daoine is stiúrthóirí ar an gcuideachtain scortha díreach roimh dháta an bhunuithe a leanúint in oifig.
3.—(1) Sa mhír seo ciallaíonn an abairt “an dáta ceaptha”—
(a) i gcás dáta an bhunuithe a thuitim ar an 5ú lá d'Aibreán, dáta an bhunuithe;
(b) in aon chás eile, an 5ú lá d'Aibreán is túisce a thiocfas i ndiaidh dáta an bhunuithe.
(2) Ar dháta an bhunuithe agus dá éis, leanfaidh an chuideachta scortha de bheith faoi dhliteanas, faoi na hAchta Cánach Ioncaim, chun aon ráiteas, tuairisceán nó sonraí a ullmhú agus a sheachadadh is gá chun críocha na nAcht sin in aghaidh aon bhliana meisiúnachta dar críoch an dáta ceaptha nó dáta roimhe sin.
(3) Féadfar meisiúnachta chun cánach ioncaim in aghaidh aon bhliana meisiúnachta dar críoch an dáta ceaptha nó dáta roimhe sin a dhéanamh ar an gcuideachtain scortha ar dháta an bhunuithe nó dá éis, agus, maidir le cáin ioncaim i leith aon mheisiúnachta den tsórt sin a déanfar amhlaidh agus a thiocfas chun bheith ina meisiúnacht deiridh gan dul thairsi, is tuigthe, ar í a theacht chun bheith dlite agus iníoctha, í a theacht chun bheith dlite agus iníoctha roimh dháta an bhunuithe.
(4) Chun críocha fo-mhíreanna (2) agus (3) den mhír seo, is tuigthe príomh-oifigeach an Bhuird nó oifigeach eile a bheas ag comhlíonadh dualgas príomh-oifigigh an Bhuird a bheith ina rúnaí don chuideachtain scortha nó ina oifigeach eile ag comhlíonadh dualgas rúnaí na cuideachtan scortha.
4.—(1) Sa mhír seo ciallaíonn an abairt “an dáta ceaptha”—
(a) i gcás dáta an bhunuithe a thuitim ar an 31ú lá de Mhárta, dáta an bhunuithe,
(b) in aon chás eile, an 31ú lá de Mhárta is túisce a thiocfas i ndiaidh dáta an bhunuithe.
(2) Ar dháta an bhunuithe agus dá éis, leanfaidh an chuideachta scortha de bheith faoi dhliteanas, faoi na hachtacháin a bhaineas le cáin bhrabúis chorpráide, chun aon ráiteas, tuairisceán nó sonraí a ullmhú agus a sheachadadh is gá chun críocha na n-achtachán sin in aghaidh aon tréimhse cuntasaíochta dar críoch an dáta ceaptha nó dáta roimhe sin.
(3) Féadfar meisiúnachta chun cánach brabúis chorpráide in aghaidh aon tréimhse cuntasaíochta dar críoch an dáta ceaptha nó dáta roimhe sin a dhéanamh ar an gcuideachtain scortha ar dháta an bhunuithe nó dá éis, agus, maidir le cáin bhrabúis chorpráide i leith aon mheisiúnachta den tsórt sin a déanfar amhlaidh agus a thiocfas chun bheith ina meisiúnacht deiridh gan dul thairsi, is tuigthe, ar í a theacht chun bheith dlite agus iníoctha, í a theacht chun bheith dlite agus iníoctha roimh dháta an bhunuithe.

TURF DEVELOPMENT ACT, 1946.
PART I.
Preliminary and General.
Short title.
1.—This Act may be cited as the Turf Development Act, 1946.
Definitions.
2.—In this Act—
the expression “the Board” means Bord na Móna established by this Act;
the expression “the dissolved company” means the company known as the Turf Development Board, Limited, dissolved by this Act;
the expression “the establishment date” means the date appointed to be the establishment date for the purposes of this Act by order of the Minister made under section 3 of this Act;
the word “functions”, in relation to the Board, means the duties and powers imposed or conferred on the Board by this Act;
the expression “local authority” means any authority being—
(a) the council of a county, or
(b) the corporation of a county or other borough, or
(c) the council of an urban district;
the expression “the Minister” means the Minister for Industry and Commerce;
the word “prescribed” means prescribed by regulations made by the Minister under this Act;
the expression “turf products” includes turf by-products and the products and by-products of bogs.
Establishment date.
3.—The Minister may by order appoint a day to be the establishment date for the purposes of this Act.
Regulations.
4.—The Minister may make regulations in relation to any matter or thing referred to in this Act as prescribed.
Repeal of sections 21 and 22 of the Turf (Use and Development) Act, 1936.
5.—Sections 21 and 22 of the Turf (Use and Development) Act, 1936 (No. 23 of 1936), are hereby repealed as on and from the establishment date.
Expenses of the Minister.
6.—The expenses incurred by the Minister in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of the moneys provided by the Oireachtas.
PART II.
Bord na Móna.
Establishment of the Board.
7.—(1) There shall, by virtue of this section, be established on the establishment date a board to be styled and known as Bord na Móna.
(2) The Board shall be a body corporate with perpetual succession and an official seal (which shall be judicially noticed) and power to sue and be sued in its corporate name and to hold land.
Constitution of the Board.
8.—(1) The Board shall consist of a chairman and a managing director, and such number (not being more than five) of other members as the Government shall from time to time determine.
(2) The Chairman of the Board shall be that member of the Board who, at the time of his appointment to be a member of the Board or subsequently, is appointed by the Government to be such chairman.
(3) The managing director of the Board shall be that member of the Board who, at the time of his appointment to be a member of the Board or subsequently, is appointed by the Government to be such managing director.
Provisions in relation to appointment, terms of office, service and remuneration of members of the Board.
9.—(1) The members of the Board shall be appointed by the Government from time to time as occasion requires.
(2) (a) Every person appointed to be a member of the Board shall, unless he sooner dies, is removed from office, resigns or becomes disqualified, hold office for such period (not exceeding five years) as shall be fixed by the Government when appointing him,
(b) A member of the Board whose term of office expires by effluxion of time shall be eligible for re-appointment.
(3) Each member of the Board shall hold office on such terms (other than the payment of remuneration and allowances for expenses) as shall be fixed by the Government at the time of his appointment.
(4) Every member of the Board shall be paid out of funds at the disposal of the Board such remuneration and such allowances for expenses as shall be determined by the Minister with the consent of the Minister for Finance.
Removal from office of members of the Board.
10.—(1) If at any time it appears to the Government that the removal from office of all or any of the members of the Board is necessary in the interests of the effective and economical performance of the functions of the Board, the Government may remove from office all or so many of the members of the Board as the Government considers necessary in the interests aforesaid.
(2) The Government may at any time remove from office any member of the Board who has become incapable through ill-health of performing efficiently his duties as such member or who has (otherwise than for a reason considered by the Government to be sufficient) been absent from all meetings of the Board during a period of six consecutive months.
(3) If and whenever the Government removes from office under this section any member of the Board, the Government shall lay before each House of the Oireachtas a statement in writing of the fact of the removal from office of such member and of the reasons for such removal.
Resignation and disqualification of members of the Board.
11.—(1) A member of the Board may at any time resign his office as such member by letter addressed and sent to the Government.
(2) If and whenever a member of the Board is adjudged bankrupt, or makes a composition or arrangement with his creditors, or is sentenced by a court of competent jurisdiction to suffer imprisonment or penal servitude, or ceases to be ordinarily resident in the national territory, he shall be disqualified from holding and shall cease to hold office as a member of the Board.

12.—A member of the Board who has—
(a) any interest in any company or concern with which the Board proposes to make any contract, or
(b) any interest in any contract which the Board proposes to make,
shall disclose to the Board the fact of such interest and the nature thereof, and shall take no part in any deliberation or decision of the Board relating to such contract, and such disclosure shall be recorded in the minutes of the Board.
Seal of the Board.
13.—(1) The Board shall provide and have a common seal, and such seal shall be authenticated by the signature of the Chairman of the Board or some other member thereof authorised by the Board to act in that behalf and the signature of an officer of the Board duly authorised by the Board to act in that behalf.
(2) All courts of justice shall take judicial notice of the seal of the Board, and every document purporting to be an order or other instrument made by the Board and to be sealed with the seal of the Board authenticated in accordance with this section shall be received in evidence and be deemed to be such order or instrument without further proof unless the contrary is shown.
Meetings and procedure of the Board.
14.—(1) The Board shall hold such and so many meetings as may be necessary for the due fulfilment of its functions.
(2) The procedure of the Board at its meetings and otherwise shall be conducted in accordance with the provisions of rules in that behalf made by the Board under this Act.
(3) The quorum for a meeting of the Board shall be such number (not less than three) as the Board may from time to time determine.
(4) The Board may act notwithstanding a vacancy in its membership.
Officers and servants of the Board.
15.—(1) The Board shall appoint such and so many officers and servants as the Board from time to time think proper.
(2) The Board may at any time remove any officer or servant of the Board from being such officer or servant.
(3) There shall be paid by the Board to its officers and servants out of funds at its disposal such remuneration and allowances as the Board shall determine.
(4) The Board may, if it thinks fit, for the purposes of an appointment under subsection (1) of this section request the Local Appointments Commissioners to recommend to it a person for that appointment, and the said Commissioners on receiving that request shall select and recommend to the Board one person for that appointment, and the Board on receiving from the said Commissioners such recommendation shall appoint to such situation the person so recommended.
(5) The Board shall pay to the Local Appointments Commissioners out of funds at its disposal such expenses in respect of the selection and recommendation by the said Commissioners of persons under subsection (4) of this section, as shall be fixed by agreement between the Board and the said Commissioners with the consent of the Minister for Finance or, in default of agreement, by the said Minister.
Exercise of functions of the Board through managing director or its officers or servants.
16.—The Board may exercise and perform any of its functions through or by the managing director or through or by any of its officers or servants authorised by the Board in that behalf.
PART III.
Duties and Powers of the Board.
Chapter I.
Duties of the Board.
General duties of the Board.
17.—(1) It shall be the duty of the Board—
(a) to produce and market turf and turf products, and
(b) to foster the production and use of turf and turf products, and
(c) to acquire bogs and other lands, and
(d) to manage, develop and work bogs and other lands vested in the Board, and
(e) generally to do all such other things as arise out of, or are consequential upon, the duties mentioned in the preceding paragraphs of this section.
(2) In case the Board in the performance of the duties referred to in paragraph (d) of subsection (1) of this section, interferes, without complying with the provisions of section 31 of this Act, with any land or any easement, wayleave, waterright or other right existing over or in respect of any land or water, the person having estates or interests therein, or the owner thereof, may maintain an action for damages against the Board as if the Board were not acting pursuant to a statute.
Reports and information by the Board.
18.—(1) The Board shall in each year, at such date and in such form as the Minister may direct, make to the Minister a report of its proceedings under this Act during the preceding year.
(2) The Board shall furnish to the Minister at such times and in such form and manner as the Minister may direct such information, with regard to the exercise and performance of its functions, as the Minister may require.
(3) The Minister shall lay before each House of the Oireachtas a copy of every report made to him by the Board under this section together with a copy of the last capital account, revenue account, profit and loss account, and balance sheet of the Board and a copy of the auditors' report on such accounts and balance sheet and shall with every such report by the Board lay before each House of the Oireachtas copies of such information, returns and accounts furnished to him under this Act as may be necessary for the proper understanding of such report.
Chapter II.
Miscellaneous Powers of the Board.
Experimental and research work by the Board in relation to turf and turf products.
19.—The Board may, for the purpose of improving the production of turf and turf products and of extending the use of turf and turf products, conduct such experiments and researches as it thinks fit, and may disseminate in such manner as it thinks fit any information obtained as the result of such experiments and researches.
Certain general powers of the Board.
20.—(1) In the performance and exercise of its functions, the Board may do all or any of the following:—
(a) manufacture any plant, machine, apparatus or appliance,
(b) erect buildings,
(c) undertake hire-purchase schemes,
(d) enter into contracts,
(e) establish and operate shops and showrooms,
(f) promote or aid in the promotion of displays, exhibitions and demonstrations.
(2) The Board shall not manufacture for sale any plant, machine, apparatus or appliance except with the consent of the Minister.
Employment of contractors.
21.—(1) Whenever the Board are authorised by this Act to execute any engineering, building, or other work whatsoever, the Board may, in lieu of executing such work themselves by their own officers and servants, contract with any person (in this Act referred to as a contractor) for the execution of the whole or any part of such work by such person and may for that purpose enter into such contracts and agreements as may be requisite.
(2) Whenever the Board contract under this section with any person for the execution by him of any work, the Board may, by any contract or agreement with such person, delegate to him the right to execute such work under this Act, and thereupon such person shall have, concurrently with the Board, the right to do such work and to exercise such of the powers conferred on the Board by this Act as are necessary for the purpose of doing such work and are specified in that behalf in such contract or agreement.
(3) References in this Act to the doing of any work or thing by the Board shall be construed and have effect as including the doing of such work or thing by a contractor employed and authorised in that behalf by the Board under this section.
Interference with public roads, railways and water-ways.
22.—(1) Subject to subsections (2) and (3) of this section the Board, for the purpose of exercising or performing any of its functions, may construct such works (including works interfering with public roads, public bridges, railways and inland waterways and including bridges over inland waterways) as appear to the Board necessary for the exercise or performance of those functions.
(2) The Board shall not exercise any of its powers under this section except with the consent of the Minister.
(3) Where the Board intend to construct, in exercise of its powers under this section, any works interfering with a public road or bridge or a railway or an inland waterway or a bridge over an inland waterway, the Board shall, before commencing to construct such works, give at least one month's notice in writing of their intention to—
(a) in case the proposed works will interfere with a public road or bridge, the local authority charged with the maintenance of the road or bridge, or
(b) in case the proposed works will interfere with a railway, the company by whom the railway is operated, or
(c) in case the proposed works will interfere with an inland waterway or a bridge over an inland waterway, the person by whom the inland waterway is operated.
(4) Where the Board, in exercise of its powers under this section, erect a bridge over an inland waterway, the property of a canal undertaker, within the meaning of Chapter VI of Part VI of the Transport Act, 1944 (No. 21 of 1944), the following provisions shall have effect:—
(a) no compensation shall be payable under this Act or otherwise to such canal undertaker in respect of any loss suffered or likely to be suffered by the canal undertaker by reason of the fact that traffic which would otherwise be carried by the canal undertaker by means of the inland waterway is thereafter carried or is likely to be carried over the bridge;
(b) if such bridge is a movable bridge, the Minister may make regulations in relation to its user and the Board shall comply with such regulations;
(c) if it appears to the Minister that such inland waterway has sustained damage by reason of the existence or user of such bridge, the Minister shall require the Board to make good at their own cost such damage and the Board shall comply with such requisition.
Duties of the Board in regard to public roads and bridges.
23.—(1) Where the Board is empowered by this Act to close, divert, remove or otherwise interfere with a public road or bridge for the purpose of the execution of any work or otherwise under this Act, the following provisions shall have effect, that is to say:—
(a) where the execution of such works involves the closing of such road or bridge to traffic, the Board (unless relieved therefrom under subsection (2) of this section) shall either, as they shall think proper, construct and (while such road or bridge is so closed to traffic) maintain a temporary road or bridge sufficient to carry traffic of such quantity and character as normally uses the said closed road or bridge, or appoint, with the consent of the Minister for Local Government and Public Health, an alternative route to be used while such road or bridge is so closed to traffic;
(b) the Board (unless relieved therefrom under subsection (2) of this section) shall, at or before the completion of the execution of such works, do whichever of the following things they shall think proper, that is to say:—
(i) restore the said closed road or bridge, or
(ii) after consultation with the Minister for Local Government and Public Health, construct a new permanent road or bridge sufficient to carry the like amount (in quantity and character) of traffic as the said closed road or bridge was, before its closure, able to carry and not substantially less convenient in gradient and curve than the said closed road or bridge, or
(iii) with the consent of the Minister for Local Government and Public Health, so improve (by reconstruction, strengthening, widening, or otherwise) an existing alternative road or bridge that it will be sufficient to carry the traffic which will be likely to use it and will not be substantially less convenient than the said closed road or bridge;
(c) where the Board constructs a permanent new road and such road is, in the opinion of the Minister for Local Government and Public Health, substantially an improvement of a pre-existing road, such local authority or local authorities as the said Minister shall direct shall bear and pay to the Board such portion of the cost of the construction of such road and (in the case of two or more such authorities) in such proportions as the said Minister shall direct;
(d) where the construction of a new road by the Board involves the construction of an embankment or similar work or of a bridge and the Minister for Local Government and Public Health is of opinion that portion of the cost of the maintenance of such work or bridge (other than the road surface) should be borne by the Board, the Board shall bear and pay such portion of the said cost of maintenance as the said Minister shall direct;
(e) where the Board constructs a permanent new bridge and such bridge confers substantially greater advantages on the public of any county or urban district than the original bridge, whether by affording an improved means of communication or otherwise, the Board shall certify the cost of such new bridge and the Minister for Local Government and Public Health shall certify what part of such cost, in his opinion, ought reasonably to be borne by the council of such county or urban district, and thereupon a sum equal to the part so certified of such cost shall be raised by such council as part of the expenses of road maintenance and shall be paid by such council to the Board;
(f) if any doubt, dispute or question shall arise as to whether the Board, in the construction or maintenance of any temporary road or bridge or the construction of any permanent road or bridge or the restoration of an existing road or bridge or the improvement of an existing alternative road or bridge (as the case may be) pursuant to this section have complied with the relevant provisions of this section, or as to whether a permanent new bridge constructed by the Board confers substantially greater advantages on the public of any county or urban district than the original bridge, such doubt, dispute or question shall be decided by the Minister for Local Government and Public Health whose decision shall be final and conclusive.
(2) Where the Board is empowered by this Act to close, or remove permanently a public road or bridge for the purpose of the execution of any works or otherwise under this Act, and the Minister, after consultation with the Minister for Local Government and Public Health, is satisfied that, having regard to all the circumstances of the case, a new road or bridge (as the case may be) in lieu of the road or the bridge so closed, or removed is not required, the Minister may by order declare that subsection (1) of this section shall not apply or have effect in relation to such road or bridge (as the case may be), and upon such order being made the said subsection (1) shall not apply or have effect in relation to such road or bridge (as the case may be) and the Board shall be relieved from all obligations in relation to such road or bridge (as the case may be) which, but for such order, would be imposed on them by the said subsection (1).
(3) The Board may agree with the appropriate local authority for the doing by such local authority of anything which the Board is required or authorised by subsection (1) of this section to do and may further agree to make to such local authority payment for or towards the cost of the doing of such things by such local authority.
(4) When the Board has completed in pursuance of this section the restoration of a closed road or bridge or the construction of a new permanent road or bridge or the improvement of an existing alternative road or bridge, the Board shall hand over to the appropriate local authority and such local authority shall accept the road or bridge so restored, constructed, or improved (as the case may be), and thereupon the Board shall be permanently relieved (save as is otherwise expressly provided by this section) from all liability or responsibility for the maintenance of such road or bridge (as the case may be).
General power of entry on land by the Board.
24.—(1) The Board and their officers and servants and other persons authorised by the Board in this behalf shall be entitled to enter on any land for the purpose of doing thereon or on any other land all or any of the things which the Board is authorised by this Act to do or making any inquiry, investigation, or examination preliminary to the doing of any such thing.
(2) Any person who obstructs, prevents, or interferes, with the exercise by the Board or any officer or servant of the Board or any person authorised by the Board of any power conferred on them or him by subsection (1) of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.
Right of the Board to information from rate books.
25.—Whenever the Board, for the purpose of the exercise or performance of its functions, requires information from a rate book or other similar document, the local authority having custody of such book or document shall, on the request of the Board—
(a) permit any officer of the Board authorised in that behalf by the Board to inspect free of charge a copy of the whole or any part of such book or document, and
(b) furnish to the Board, upon payment by the Board of such fee as shall be agreed upon by the Board and such local authority or, in default of such agreement, shall be fixed by the Minister for Local Government and Public Health, a copy of such book or document or of any particular part thereof specified in that behalf by the Board.
Protection of postal and telegraphic services.
26.—Neither the Board nor any contractor executing any works under this Act shall by virtue of this Act acquire, enter on, remove, or otherwise interfere with any lands, premises, buildings, works, plant, materials, or other property of the Minister for Posts and Telegraphs or erect any works or do any other matter or thing which, in the opinion of the Minister for Posts and Telegraphs, would obstruct, delay, hinder, or otherwise injuriously affect the due execution of the public services of the Department of Posts and Telegraphs.
Protection of fisheries.
27.—In executing any works under this Act it shall not be obligatory on the Board or any contractor employed by the Board to comply with the Fisheries Acts, 1842 to 1944, but the Board shall take and make or, in the case of works executed by a contractor, procure that the contractor shall take and make such precautions and provisions as the Minister for Agriculture may consider adequate for the protection of, and avoidance of injury to, fisheries during or in consequence of the execution of the works, provided that the Minister shall, in consultation with the Board, satisfy himself that taking such precautions and making such provisions will not cause substantial detriment to the works or substantial hindrance to, or substantial increase to the cost of, the works.
Disposal of surplus land.
28.—The Board may sell or lease any land vested in them which is no longer required for the purposes of its functions.
Chapter III.
Acquisition of Land, Etc.
Acquisition of land, etc., by the Board.
29.—(1) The Board, for the purpose of exercising or performing any of its functions may do all or any of the following things:—
(a) acquire any land either permanently or temporarily and either by agreement or compulsorily;
(b) acquire (either permanently or temporarily and either by agreement or compulsorily) any easement, wayleave, water right or other right whatsoever over or in respect of any land or water;
(c) terminate, restrict, or otherwise interfere with (either permanently or temporarily and either by agreement or compulsorily) any easement, way-leave, water right, or other right whatsoever existing over or in respect of any land or water;
(d) divert, close, remove or otherwise interfere with (either permanently or temporarily and either by agreement or compulsorily) any private road, way or bridge or any canal or other artificial waterway or any artificial watercourse;
(e) interfere with any land either permanently or temporarily and either by agreement or compulsorily.
(2) Nothing in subsection (1) of this section shall be construed as affecting the operation of section 130 of the Transport Act, 1944 (No. 21 of 1944).
Entry on land, etc., before conveyance.
30.—(1) At any time before conveyance or ascertainment of price or compensation, the Board may, subject to the subsequent provisions of this section and for the purpose of exercising or performing any of its functions, do all or any of the following things:—
(a) enter on and take possession of any land;
(b) exercise any right which the Board is authorised by this Act to acquire;
(c) terminate, restrict, or otherwise interfere with any easement or other property or right which the Board is authorised by this Act to terminate, restrict or otherwise interfere with;
(d) divert, close, remove or otherwise interfere with any private road, way, or bridge or any canal or other artificial waterway or any artificial watercourse which the Board is authorised by this Act to divert, close, remove, or otherwise interfere with.
(2) Whenever the Board exercises any of the powers conferred on it by subsection (1) of this section, the Board shall be liable to pay to the occupier of the land or the owner of the easement, right, or other property entered upon or interfered with by the exercise of such power, interest on the amount of the price or compensation payable under this Act to such occupier or owner at the rate of three per cent. per annum from the date of such entry or interference until payment of such price or compensation.
(3) The Board shall not—
(a) enter on or take possession of any land under this section without giving to the occupier of such land at least one month's or, in the case of an occupied dwellinghouse, three months' previous notice in writing of its intention so to do, or
(b) exercise any easement or other right or interfere with any right or property under this section without giving to the owner of such easement, right, or property at least one month's previous notice in writing of their intention so to do.
(4) A notice under subsection (3) of this section may be served on any person by sending such notice by prepaid post in an envelope addressed to such person at his usual or last known address and shall be deemed to have been served on such person at the time at which such envelope would be delivered in the ordinary course of post.
(5) Where, for any reason, the envelope mentioned in subsection (4) of this section cannot be addressed in the manner provided by that subsection, that envelope may be addressed to the person for whom it is intended in either or both of the following ways:—
(a) by the description “the owner” or “the occupier” (as the case may be) without stating his name,
(b) at the land or the situation of the property to which the notice contained in the envelope relates.
Deposit of maps, plans, etc.
31.—(1) Not later than one month before the Board enters on any land or premises or interferes with any property or right under this Chapter, the Board shall cause maps, plans, and books of reference in relation to such land, premises, property, or right (as the case may be) to be deposited in accordance with this section.
(2) The maps and plans required by this section to be deposited by the Board shall be sufficient in quantity and character to show on adequate scales the property, corporeal or incorporeal proposed to be acquired and every interference (so far as the same can be shown on a drawing) proposed to be made with any property, corporeal or incorporeal, or any public road or bridge.
(3) The books of reference required by this section to be deposited by the Board shall contain the names of the owners or reputed owners, lessees or reputed lessees, and occupiers of all land proposed to be acquired or otherwise affected under this Act and of all property, corporeal or incorporeal (including public roads and bridges), proposed to be in any way interfered with under this Act.
(4) The maps, plans, and books of reference required by this section to be deposited by the Board shall be deposited at the head office of the Board in the City of Dublin and at such other places as shall be prescribed and shall remain so deposited for such period as may be prescribed and shall, while so deposited, be open to inspection by any person, free of charge, between the hours of ten o'clock in the morning and four o'clock in the afternoon on every day except Saturdays, Sundays, and bank holidays.
(5) As soon as may be after the deposit of any maps, plans, or books of reference in pursuance of this section, the Board shall give public notice of such deposit by advertisement published twice in each of two or more daily newspapers circulating in the City of Dublin and in such (if any) other newspapers as shall be prescribed.
(6) Every public notice given by the Board in pursuance of subsection (5) of this section shall state that the maps, plans, or books of reference to which such notice relates are open to public inspection in accordance with this section and shall state the times and places at which they are so open to inspection.
Assessment of price or of compensation.
32.—(1) The amount of the price or compensation to be paid by the Board for any land acquired (whether permanently or temporarily) by the Board under this Chapter to the several persons entitled thereto or having estates or interests therein, or for or in respect of any easement, way-leave, water-right, or other right acquired (whether permanently or temporarily) by the Board under this Act to the owner thereof or to the several persons entitled to or having estates or interests in the land over or in respect of which such right is so acquired shall, in default of agreement, be fixed under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919.
(2) The amount of the compensation to be paid by the Board on account of the termination, restriction or other interference (whether permanent or temporary) by the Board under this Act of or with any easement, way-leave, water-right, or other right over or in respect of any land or water or the diversion, closing, removal or other interference (whether permanent or temporary) by the Board under this Act of or with any private road, way, or bridge, or any canal, or other artificial waterway or any artificial watercourse or the interference (whether permanent or temporary) with any land by the Board under this Act shall, in default of agreement, be fixed under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919, in like manner as if such compensation were the price of land compulsorily acquired.
(3) Where any price or compensation is being assessed in pursuance of this section in respect of any property, corporeal or incorporeal, which is occupied, used, or enjoyed with or forms part of any other property, regard shall be had to any benefit in the nature of drainage or improvement of water supply which may reasonably be expected to accrue to such other property by reason of any works executed or in the course of execution or about to be executed by the Board under this Act.
(4) Sections 69 to 83 of the Lands Clauses Consolidation Act, 1845 (as adapted or amended by or under any subsequent Act) shall apply to any price or compensation payable by the Board under this section and to the conveyance to the Board of property, corporeal or incorporeal, acquired by the Board under this Act, and for the purpose of such application the Board shall be deemed to be the promoters of the undertaking.
(5) No action shall lie at law or in equity against the Board or any contractor or any officer or servant of the Board or of any contractor for or on account of any act, matter, or thing in respect of which compensation is payable by virtue of this section.
Time for claims for price or compensation.
33.—All claims for the price of or compensation in respect of any land, easement, right, or other property (whether corporeal or incorporeal) acquired or interfered with by the Board under this Chapter shall be made within one year after such land, easement, right, or property is first entered on, exercised, or interfered with by the Board under this Chapter.
Execution of works in lieu of compensation.
34.—(1) Where a person is entitled, actually or prospectively, to compensation in respect of anything lawfully done or intended to be done by the Board under this Act, the Board may execute for the benefit of such person such works, in satisfaction or partial satisfaction of the claim of such person for compensation, as the Board shall think proper and such person shall agree to accept.
(2) The Board may attach to the execution of any works under this section such terms and conditions (including terms as to the ownership, possession, and control of such works) as shall be agreed upon by the Board and the person for whose benefit the works are so executed.
Acquisition of land in lieu of payment of compensation.
35.—Whenever the Board is of opinion that the payment of compensation for the interference by the Board with any land under this Chapter would be uneconomic or for any other reason inexpedient, the Board may acquire the land permanently under this Act either by agreement or compulsorily.
Powers and duties where acquired land is subject to a land purchase annuity, etc.
36.—Whenever the Board acquires permanently under this Chapter any land which is subject, either alone or in conjunction with other land, to a land purchase annuity, payment in lieu of rent, or other annual sum (not being merely rent under a contract of tenancy) payable to the Irish Land Commission or to the Commissioners of Public Works in Ireland, the Board shall, as from the date on which the Board enters on and takes possession of the land so acquired—
(a) become and be liable for the payment to the Irish Land Commission or the said Commissioners (as the case may be) of such annual sum, or such portion thereof as shall be apportioned by the Irish Land Commission or the said Commissioners (as the case may be) on such land, as if such land had been transferred to the Board by the owner thereof on that date, and
(b) be entitled, if the Board so thinks fit, to redeem such annual sum or such portion thereof as aforesaid, and
(c) be obliged, if required by the Irish Land Commission or the said Commissioners (as the case may be) so to do, to redeem such annual sum or such portion thereof as aforesaid.
Power of Board to purchase land from the Irish Land Commission.
37.—(1) The Board may purchase from the Irish Land Commission any land, vested in the Irish Land Commission, which is required by the Board for the exercise or performance of all or any of its functions.
(2) The following provisions shall have effect in respect of every purchase of land under this section:—
(a) such land shall be so purchased at such price and upon such other terms and conditions as shall be agreed upon by the Board and the Irish Land Commission, subject to the restriction that in assessing such price no regard shall be had to, nor any enhancement of price allowed for, any improvements executed on such land with moneys paid or advanced out of the Central Fund or out of moneys provided by the Oireachtas;
(b) such land shall be conveyed to or vested in the Board by the Irish Land Commission;
(c) the price to be paid by the Board to the Irish Land Commission shall be provided and paid by the Board;
(d) the Board shall defray all the costs and expenses of the Board and the Irish Land Commission of or incidental to such purchase.
(3) In this section (except this subsection) the word “land” includes any easement, profit-a-prendre, or other right over or in relation to any land, and the power of purchase conferred by this section shall extend to the purchase of any such right whether in conjunction with or apart from the purchase of land.
Chapter IV.
Transport Works.
Definitions for purposes of Chapter IV of Part III.
38.—In this Chapter—
the expression “transport works” means any works being—
(a) a railway, or
(b) a tramway, or
(c) an aerial ropeway, or
(d) a pipe line, or
(e) a belt conveyor;
the expression “transport works order” means an order made under section 43 of this Act.
Applications for transport works order.
39.—(1) The Board may apply to the Minister for a transport works order authorising the Board to construct, maintain and operate, for the purposes of its functions, transport works of a particular kind.
(2) Every application for a transport works order shall be accompanied by—
(a) a draft of the proposed order,
(b) a plan of the proposed transport works, and
(c) a book of reference to such plan,
and such draft, plan and book of reference shall be in such form as the Minister may direct.
Deposit of draft order, plan and book of reference and notice of application.
40.—(1) Whenever an application is made for a transport works order the Board shall, as soon as may be, do the following things, that is to say:—
(a) deposit and keep deposited, at the place or each of the places appointed by the Minister, a copy of the draft order, the plan and the book of reference to such plan which accompanied the application;
(b) publish, in such newspaper or newspapers as the Minister may direct, a notice of the making of such application and of the deposit of a copy of such draft order, plan and book of reference and of the place or places of such deposit;
(c) send to such persons (if any) as the Minister may direct a copy of such draft order, plan and book of reference.
(2) Any person may inspect at all reasonable hours the copy of any draft order, plan or book of reference deposited under this section.
Fees on applications.
41.—(1) There shall be paid to the Minister on every application for a transport works order such fee (if any) as the Minister, with the consent of the Minister for Finance, may fix.
(2) The following provisions shall have effect in relation to all fees payable under this section, that is to say:—
(a) such fees shall be collected in money and taken in such manner as the Minister for Finance may from time to time direct, and shall be paid into or disposed of for the benefit of the Exchequer in accordance with the directions of the Minister for Finance;
(b) the Public Offices Fees Act, 1879, shall not apply in respect of such fees.
Local inquiries into applications for transport works order.
42.—(1) (a) Where an application is made to the Minister for a transport works order, the Minister may, if he thinks fit, direct a public inquiry to be held into such application in the locality in which it is proposed to construct the transport works the subject of the application.
(b) Where the Minister directs a public inquiry to be held into an application for a transport works order, he shall appoint an officer of the Minister to hold such inquiry, and the Board, every owner, lessee and occupier of the land on or over which it is proposed to construct the transport works the subject of the application, every local authority within whose area such works are intended to pass, and every other person who, in the opinion of such officer, is substantially interested in the subject matter of such inquiry shall be entitled to appear and be heard at such inquiry.
(2) Evidence given before an officer of the Minister appointed to hold an inquiry under this section shall, if such officer so requires, be given on oath (which such officer is hereby empowered to administer) and any person who gives false evidence before any such officer shall be guilty of perjury and punishable accordingly.
Grant of transport works order.
43.—Where the Minister, after, consideration of an application for a transport works order and, in case an inquiry was held, under section 42 of this Act, into the application, the report of the officer who held it and after consultation with the Minister for Local Government and Public Health, is of opinion that the application should be granted, he shall make an order authorising the Board to construct, maintain and operate the transport works specified in the order in such manner, subject to such restrictions and provisions and on such terms and conditions as the Minister thinks proper and specifies in the order.
Provisions in relation to transport works order.
44.—The following provisions shall have effect in relation to a transport works order, that is to say:—
(a) such order shall contain such provisions as the Minister thinks necessary or expedient for the purpose of such order;
(b) without prejudice to the generality of paragraph (a) of this subsection—
(i) such order may contain provisions authorising the Board to acquire compulsorily any land the acquisition of which is, in the opinion of the Minister, necessary for giving effect to such order,
(ii) such order may grant to the Board any rights in or over land or water, or in or over any public road the grant of which is, in the opinion of the Minister, necessary for giving effect to such order,
(iii) such order shall, in respect of any land so acquired or any right over land or water so granted, provide for the payment of compensation by the Board to the several persons having estates or interests in such land or water, and shall provide that any question or disputed compensation shall be determined under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919,
(iv) such order may incorporate all or any of the provisions of the Lands Clauses Acts, with such modifications and adaptations as the Minister thinks proper,
(v) such order shall specify the manner in which the transport works to which such order relates are to be constructed,
(vi) such order may fix the period within which the construction of such transport works is to be completed,
(vii) such order may contain provisions as to the manner in which such transport works are to be operated and maintained,
(viii) such order shall contain provisions limiting the use of such transport works to purposes relating to the functions of the Board and to such other purposes (if any) as may be specified in such order,
(ix) such order shall contain all such provisions as the Minister thinks proper for the protection of the public generally and any persons affected by such order,
(x) such order may provide that where the Board acts in contravention (whether by commission or omission) of any specified provision of such order, the Board shall be guilty of an offence under such order and shall be liable on summary conviction thereof to such fine (not exceeding one hundred pounds) as may be specified in such order in respect of such offence and, in the case of a continuing offence, such further fine (not exceeding twenty pounds) as may be specified in such order in respect of such offence for each day during which such offence is continued after conviction thereof,
(xi) such order may incorporate any provisions (including penal provisions) contained in any enactment relating to railways, with such adaptations and modifications as the Minister thinks proper,
(xii) such order may, in relation to the exercise of the powers of acquiring land compulsorily, contain provisions to the like effect as those contained in sections 30 and 36 of this Act,
(xiii) such order may provide for the determination by arbitration of any specified questions arising thereunder,
(xiv) such order may contain such provisions ancillary or incidental to any of the matters aforesaid as the Minister considers necessary and proper.
Regulations in relation to maintenance and operation of transport works.
45.—Where the Minister has made a transport works order authorising the Board to construct, maintain and operate transport works of a particular kind, the following provisions shall have effect, that is to say:—
(a) the Minister may make regulations (not inconsistent with such order) in relation to the manner in which such transport works are to be maintained and operated by the Board and by any other person operating such works on behalf of the Board;
(b) if the Board or such other person acts in contravention (by omission or commission) of such regulations, the Board shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds and, in the case of a continuing offence, a further fine not exceeding five pounds for each day during which the offence is continued after conviction thereof.
Regulations in relation to use of electrical power.
46.—Where the Minister has made a transport works order authorising the Board to construct, maintain and operate transport works of a particular kind and has by such order authorised such transport works to be operated by electrical power, the following provisions shall have effect, that is to say:—
(a) the Minister may, after consultation with the Electricity Supply Board, make such regulations as he may think fit for securing that the electrical power shall be used by the Board and by any other person operating such works on behalf of the Board with all reasonable and proper precautions against danger to the public or damage to the property of any person;
(b) in making such regulations the Minister shall have regard to the expense occasioned thereby to the Board and to the effect thereof on the financial prospects of the Board;
(c) if the Board or any other person operating such transport works on behalf of the Board uses such electrical power in contravention of such regulations, the Board shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds and, in the case of a continuing offence, a further fine of five pounds for each day during which the offence is continued after conviction thereof;
(d) if in the opinion of the Minister the Board or any person operating such transport works on behalf of the Board has used such electrical power in contravention of such regulations, whether the Board has or has not been convicted of an offence, or the Minister is satisfied that the use of such power is a danger to the public, he may by order require the Board to cease to exercise the powers conferred by such transport works order with respect to the use of electrical power and thereupon the Board shall cease to exercise such powers except with the consent of the Minister and subject to such terms and conditions as he thinks fit.
Construction of transport works by Electricity Supply Board as contractors for the Board.
47.—Where the Board is authorised by a transport works order to construct transport works, the Electricity Supply Board may, as contractors for the Board, construct the said transport works.
Amendment of transport works order.
48.—The Minister may from time to time amend a transport works order.
Effect of orders under Chapter IV of Part III.
49.—Every order made by the Minister under this Chapter shall have the force of law.
Expenses of Minister in exercise of powers tinder a transport works order.
50.—The expenses incurred by the Minister in the exercise of his powers and functions under a transport works order shall, to such extent as may be determined by the Minister for Finance, be paid to the Minister by the Board.
Provisions in relation to certain orders made under the Emergency Powers (No. 92) Order, 1941.
51.—(1) This section applies to the following orders (which were made by the Minister under the Emergency Powers (No. 92 Order, 1941 (S.R. & O., No. 293 of 1941) ) namely—
(a) the Emergency Powers (No. 92) Order, 1941 (Transport Works) (No. 1) Order, 1941 (S.R. & O., No. 410 of 1941),
(b) the Emergency Powers (No. 92) Order, 1941 (Transport Works) (No. 2) Order, 1941 (S.R. & O., No. 494 of 1941),
(2) The Orders to which this section applies are hereby confirmed and shall continue in force on and after the expiration of the Emergency Powers Act, 1939 (No. 28 of 1939).
(3) On and after the establishment date—
(a) the references to the dissolved company, in the Orders to which this section applies, shall be construed as references to the Board,
(b) sections 45, 46 and 47 of this Act shall apply in respect of any transport works constructed under either of the Orders to which this section applies as if those Orders had been made under section 43 of this Act, and
(c) sections 48 and 49 of this Act shall apply in respect of the Orders to which this section applies as if they had been made under section 43 of this Act.
PART IV.
Financial Provisions.
Grant to the Board in respect of expenses of experimental and research work.
52.—(1) In the financial year current at the establishment date and in each of the nine subsequent financial years, the Minister may, out of moneys provided by the Oireachtas, pay, subject to the limitation imposed by subsection (2) of this section to the Board a grant, towards the expenses incurred by the Board under section 19 (which relates to experimental and research work by the Board in relation to turf and turf products) of this Act, of such amount as the Minister, with the consent of the Minister for Finance, may fix.
(2) The total amount of grants to be made under this section shall not exceed the sum of one hundred and twenty thousand pounds.
(3) Any grants made under this section shall be applied by the Board solely towards defraying expenses incurred by the Board under section 19 of this Act.
Advances to the Board out of the Central Fund.
53.—(1) For the purpose of enabling the Board to exercise or perform its functions, the Minister for Finance may, on the recommendation of the Minister, advance from time to time to the Board, out of the Central Fund or the growing produce thereof, such sums (not exceeding in the aggregate three million seven hundred and fifty thousand pounds) as the Board may from time to time request.
(2) The sums advanced under this section shall be expended by the Board solely for the purpose of the functions of the Board.
(3) The sums advanced under this section shall be repayable with interest in accordance with the subsequent provisions of this Act.
Provision of money for advances to the Board out of Central Fund.
54.—(1) The Minister for Finance may, for the purpose of providing for the advance of sums out of the Central Fund under section 53 of this Act borrow on the security of the Central Fund or the growing produce thereof such sums as shall be required for that purpose, and the said Minister may, for the purposes of such borrowing, create and issue securities bearing such rate of interest and subject to such conditions as to repayment, redemption, or otherwise as he thinks fit, and shall pay all moneys so borrowed into the Exchequer.
(2) The principal of and interest on all securities issued under this section shall be charged on and payable out of the Central Fund or the growing produce thereof.
Payment of interest on repayable advances.
55.—(1) Subject to section 57 of this Act, the Board shall pay to the Minister for Finance on every sum advanced to the Board out of the Central Fund under section 53 of this Act and which is repayable interest from the date of the advance of such sum until the same is repaid at such rate as shall from time to time be appointed by the Minister for Finance in respect of such sum, and such interest shall be so paid by half-yearly payments on such days in every year as the Minister for Finance shall from time to time appoint.
(2) If the Board fails to pay to the Minister for Finance any interest payable by it under this section at the time appointed in that behalf under this section, the Board shall pay to the said Minister interest at the rate appointed by the said Minister on the interest so unpaid from the time appointed as aforesaid until the same is actually paid.
(3) All interest paid to the Minister for Finance by the Board under this section shall be paid into or disposed of for the benefit of the Exchequer in such manner as the said Minister may direct.
Repayment of repayable advances.
56.—(1) For the purpose of providing for the repayment by the Board of the advances made to it out of the Central Fund under section 53 of this Act which are repayable, the Board shall make to the Minister for Finance half-yearly payments commencing on such date, and continuing for such number of years and being of such amounts and payable at such times as the said Minister, after consultation with the Minister, shall appoint, and different such dates, numbers of years, amounts, and times may be so appointed in respect of different portions of such advances.
(2) The several half-yearly payments to be made to the Minister for Finance by the Board under this section shall be applied by the said Minister as sinking funds for the repayment of the several portions of the advances in respect of which such half-yearly payments are made and when the Board has paid to the said Minister the full number of the half-yearly payments appointed under this section in respect of any portion of such advances (together with any interest which may have become payable under this section in respect of any of such half-yearly payments) such portion of such advances shall be deemed to be fully repaid by the Board, without prejudice to the liability of the Board for any interest then unpaid in respect of such portion of such advances.
(3) If the Board fails to pay to the Minister for Finance any half-yearly payment or portion of a half-yearly payment payable by it to the said Minister under this section at the time appointed in that behalf under this section, the Board shall pay to the said Minister on such half-yearly payment or portion of a half-yearly payment interest at such rate as shall from time to time be appointed by the said Minister in respect thereof from the time appointed as aforesaid until the same is actually paid.
(4) All moneys paid by the Board to the Minister for Finance under this section in repayment of advances shall be paid into the Exchequer.
(5) All sums paid by the Board to the Minister for Finance under this section on foot of interest shall be paid into or disposed of for the benefit of the Exchequer in such manner as the said Minister may direct.
Waiver of interest on certain advances to the Board.
57.—(1) The following provisions shall apply in respect of any advances (in this subsection referred to as the said advances) made to the Board under section 53 of this Act during the period (in this subsection referred to as the quinquennial period) of five years commencing on the establishment date, that is to say:—
(a) no interest shall be payable by the Board on the said advances in respect of any period ending on the day immediately preceding the date on which the Minister for Finance makes an order under paragraph (c) of this section,
(b) the Minister for Finance shall, immediately after the expiration of the quinquennial period, examine the finances of the Board,
(c) after such examination, the said Minister shall, having regard to the existing state of the finances of the Board and its future financial prospects, either—
(i) by order (in this section referred to as the exemption order) exempt the Board from the liability to pay interest on the said advances in respect of the period during which the exemption order is in force, or
(ii) by order declare the Board liable to pay interest on the said advances in respect of any period commencing on or after the date of the order,
(d) where the said Minister makes the exemption order, he may at any time thereafter by order revoke the exemption order.
(2) The Minister for Finance shall before making any order under subsection (1) of this section consult the Minister with regard to the proposed order.
(3) If the exemption order is made it shall be laid before Dáil Éireann as soon as may be after it is made and, if a resolution is passed by Dáil Éireann within the next subsequent twenty-one days on which Dáil Éireann has sat after the order is laid before it annulling the order, the order shall be annulled accordingly.
Power of the Board to borrow temporarily.
58.—The Board may, with the consent of the Minister, given after consultation with the Minister for Finance, borrow temporarily by arrangement with bankers such sums as it may require for the purpose of providing for current expenditure.
Accounts and Audits.
59.—(1) The Board shall keep in such form as shall be approved by the Minister after consultation with the Minister for Finance all proper and usual accounts of all moneys received or expended by them, including a capital account, revenue account, profit and loss account, and a balance sheet, and in particular shall keep in such form as aforesaid all such special accounts as the Minister on his motion or at the request of the Minister for Finance shall from time to time direct.
(2) The accounts of the Board for each year shall be audited within ninety days or such longer time as the Minister may in any particular case allow after the end of that year and shall be the subject of a report by duly qualified auditors appointed annually for the purpose by the Minister, with the consent of the Minister for Finance, and the fees of such auditors and the expenses generally of such audits shall be paid by the Board.
(3) The Minister may, with the consent of the Minister for Finance appoint the time, place, and method of conducting the audit of the accounts of the Board under this section and may also appoint the accounts of which copies are to be furnished to the Minister under this section and the accounts which are to be published and put on sale under this section and the time and method of such publication and sale.
(4) Immediately after every audit under this section of the accounts of the Board, the Board shall send to the Minister a copy of the capital account, revenue account, profit and loss account and balance sheet as certified by the auditors, a copy of the auditors' report, and copies of such of the accounts submitted to the auditors as are appointed in that behalf under this section or may be specially called for by the Minister, and shall publish and put on sale such of the accounts submitted to the auditors as are appointed in that behalf by the Minister.
PART V.
Dissolution of the Turf Development Board, Limited.
Dissolution of the dissolved company.
60.—(1) On the establishment date the dissolved Company shall, subject to the provisions set out in the Schedule to this Act, be, by virtue of this section, dissolved.
(2) The provisions set out in the Schedule to this Act shall apply in respect of the dissolved Company.
Payments to holders of shares of the dissolved company.
61.—On or as soon as may be after the establishment date, the Board shall pay to each person who was, on the day immediately preceding the establishment day, the registered holder of any share or shares of the dissolved company, the sum of one pound for each share of the dissolved company held by him, and such payment shall be accepted by him in lieu of and in satisfaction of all rights and claims in respect of each such share in respect of which such payment is made.
Transfer of property of the dissolved company to the Board.
62.—(1) Subject to the provisions of this section all property whether real or personal (including choses-in-action) which immediately before the establishment date was vested in, or belonged to or was held in trust for the dissolved company and all rights, powers and privileges relating to or connected with any such property shall, on the establishment date and without any conveyance or assignment but subject where necessary to transfer in the books of any bank, corporation or company, become and be vested in or the property of or held in trust for (as the case may require) the Board for all the estate, trust or interest for which the same immediately before the establishment date was vested in or belonged to or was held in trust for the dissolved company.
(2) All property transferred by this section which, immediately before the establishment date, was standing in the books of any bank or was registered in the books of any bank, corporation, or company shall, upon the request of the Board made on or after the establishment date, be transferred in such books by such bank, corporation, or company into the name of the Board.
(3) On and after the establishment date, every chose-in-action transferred by this section to the Board may be sued upon, recovered or enforced by the Board in its own name and it shall not be necessary for the Board to give notice to the person bound by such chose-in-action of the transfer effected by this section.
Transfer of liabilities of the dissolved company.
63.—Every debt and other liability (including unliquidated liabilities arising from torts or breaches of contract) which immediately before the establishment date is owing and unpaid or has been incurred and is undischarged by the dissolved company shall, on the establishment date, become and be the debt or liability of the Board and shall be paid or discharged by and may be recovered from or enforced against the Board accordingly.
Release of the Board from certain State debts.
64.—(1) If it appears from the balance sheet of the dissolved company, as certified by the auditors of the dissolved company, that, immediately before the establishment date, the liabilities (including the State debt) of the dissolved company exceeded its assets (the amount of which excess is in this subsection referred to as the deficit), then, the Minister for Finance shall, with effect as on and from the establishment date, release the Board from so much of the State debt as equals the deficit or fifty thousand pounds, whichever is the lesser.
(2) In this section, the expression “the State debt” means the sum which, immediately before the establishment date, was owing by the dissolved company to the Minister for Finance.
Preservation of continuing contracts of the dissolved company.
65.—Every bond, guarantee, or other security of a continuing nature made or given by the dissolved company to any person, or by any person to such dissolved company, and in force immediately before the establishment date, and every contract or agreement in writing made between the dissolved company and another person and not fully executed and completed before the establishment date shall, notwithstanding the dissolution of the dissolved company, continue in force on and after the establishment date, but shall be construed and have effect as if the name of the Board were substituted therein for the name of the dissolved company, and such security, contract, or agreement shall be enforceable by or against the Board accordingly.
Continuance of pending legal proceedings.
66.—In every action, suit or proceedings which is pending on the establishment date in any court or tribunal and to which the dissolved company is a party, the Board shall on the establishment date become and be a party in the place of the dissolved company and such proceedings shall be continued between the Board and the other parties thereto accordingly and no such proceedings shall abate or be discontinued or prejudicially affected by reason of the dissolution of the dissolved company.
Preservation of contracts of service.
67.—Every contract of service express or implied which was entered into and is in force immediately before the establishment date between the dissolved company and any person being a salaried officer or employee of the dissolved company shall continue in force on and after the establishment date, but shall be construed and have effect as if the Board were substituted therein for the dissolved company, and every such contract shall be enforceable by or against the Board accordingly.
Exemption from stamp duties.
68.—(1) Section 12 of the Finance Act, 1895, shall not operate so as to require the Board to deliver to the Revenue Commissioners a copy of this Act or to pay any stamp duty under that section on any copy of this Act.
(2) Stamp duty shall not be chargeable on any transfer, conveyance or other instrument executed for the purpose of supplementing or giving effect to the vesting of the assets of the dissolved company in the Board.
PART VI.
Miscellaneous Provisions.
Restriction on compulsory acquisition of land held by the Board.
69.—Notwithstanding anything contained in any enactment, no person shall, without the previous consent of the Minister, acquire compulsorily any land or premises held by the Board or acquire, terminate, restrict or otherwise interfere with compulsorily any easement, wayleave or other right whatsoever over or in respect of any such land.
Adaptation of references to the dissolved company in the Turf (Use and Development) Act, 1936.
70.—Every reference in the Turf (Use and Development) Act, 1936 (No. 23 of 1936), to the dissolved company shall, on and after the establishment date, be construed as a reference to the Board.
Suspension of operation of subsection (1) of section 9 of the Road Transport Act, 1933 in relation to the carriage of turf by road.
71.—(1) At any time while the suspendable provisions are, whether by virtue of an order made under subsection (2) of this section or otherwise, in force, the Minister may by order (in this section referred to as a suspending order) declare that the suspendable provisions shall cease to be in force, in relation to the carriage of turf by road, as on and from such date as the Minister thinks fit and specifies in the order.
(2) At any time while the suspendable provisions are, by virtue of a suspending order, not in force, the Minister may, by order (in this section referred to as a reviving order), declare that the suspendable provisions shall again come into force, in relation to the carriage of turf by road, as on and from such date (not being earlier than one month after the date on which the reviving order is made) as the Minister thinks fit and specifies in the order.
(3) Whenever and so often as the Minister makes a suspending order, the following provisions shall have effect:—
(a) subject to the operation of a reviving order, the suspendable provisions shall cease to be in force, in relation to the carriage of turf by road, as on and from the date specified in that behalf in the suspending order;
(b) subsections (1) and (2) of section 21 of the Interpretation Act, 1937 (No. 38 of 1937), shall apply to and have effect in relation to such cesser as if such cesser were a repeal by an Act of the Oireachtas passed on the day on which such cesser takes effect and the suspendable provisions were repealed by such Act of the Oireachtas as on and from that day.
(4) Whenever and so often as the Minister makes a reviving order the suspendable provisions shall, as on and from the date specified in that behalf in such reviving order again come into force in relation to the carriage of turf by road, and shall, subject to the operation of a subsequent suspending order, continue in force.
(5) In this section the expression “the suspendable provisions” means subsection (1) of section 9 of the Road Transport Act, 1933 (No. 8 of 1933).
SCHEDULE.
Transitory Provisions in Relation to Dissolved Company.
Continuance of dissolved company for certain purposes.
1. For the purposes of this Schedule but not further or otherwise, the dissolved company shall be deemed to continue in existence on and after the establishment date.
Transfer of stocks, shares and securities.
2. The dissolved company shall, at the request of the Board, execute all such instruments and do all such acts as may be necessary to enable the Board to have transferred into its name any stocks, shares or securities held by the dissolved company immediately before the establishment date and for this purpose the persons who are immediately before the establishment date the directors of the dissolved company shall be deemed to continue in office.
Provisions in relation to income tax chargeable on the dissolved company.
3.—(1) In this paragraph the expression “the appointed date” means—
(a) in case the establishment date falls on the 5th day of April, the establishment date;
(b) in any other case, the 5th day of April next following the establishment date.
(2) The dissolved company shall, on and after the establishment date, continue to be liable under the Income Tax Acts to prepare and deliver any statement, return or particulars required for the purposes of those Acts for any year of assessment ending on or before the appointed date.
(3) Assessments to income tax for any year of assessment ending on or before the appointed date may be made on the dissolved company on or after the establishment date, and income tax in respect of any such assessment so made, which shall become final and conclusive, shall, when it becomes due and payable, be deemed to have become due and payable before the establishment date.
(4) For the purposes of subparagraphs (2) and (3) of this paragraph, the chief officer of the Board or other officer performing the duties of chief officer of the Board shall be deemed to be secretary of the dissolved company or other officer performing the duties of secretary of the dissolved company.
Provisions in relation to corporation profits tax chargeable on the dissolved company.
4.—(1) In this paragraph the expression “the appointed date” means—
(a) in case the establishment date falls on the 31st day of March, the establishment date,
(b) in any other case, the 31st day of March next following the establishment date.
(2) The dissolved company shall, on and after the establishment date, continue to be liable under the enactments relating to corporation profits tax to prepare and deliver any statement, return or particulars required for the purposes of those enactments for any accounting period ending on or before the appointed date.
(3) Assessments to corporation profits tax for any accounting period ending on or before the appointed date may be made on or after the establishment date on the dissolved company and corporation profits tax in respect of any such assessment so made, which shall have become final and conclusive, shall, when it becomes due and payable, be deemed to have become due and payable before the establishment date.
(4) For the purposes of subparagraphs (2) and (3) of this paragraph, the chief officer of the Board or other officer performing the duties of chief officer of the board shall be deemed to be secretary of the dissolved company or other officer performing the duties of secretary of the dissolved company.
(5) In this paragraph references to corporation profits tax shall be construed as including references to excess corporation profits tax.
