PACKAGED GOODS (QUANTITY CONTROL) ACT, 1980
PART I
Preliminary and General
Short title and commencement.
1.—(1) This Act may be cited as the Packaged Goods (Quantity Control) Act, 1980.
(2) This Act shall come into force on such day as the Minister may fix by order.
Interpretation.
2.—(1) In this Act—
“the Act of 1970” means the Merchandise Marks Act, 1970;
“container” includes a bag, bottle, box, case, carton, envelope, net, sack or wrapper and also an inner container;
“equipment” includes any electrical or other appliance or equipment (or any part thereof) or any other machine or machinery (or any part thereof);
“goods” means anything which is the subject of trade, manufacture or merchandise and, in relation to a package, excludes the container included in the package;
“importer” in relation to a package means, subject to subsection (3) of this section, the person by whom or on whose behalf the package is entered for customs purposes on importation;
“inspector” means, except in section 3 (2) (h) of this Act, a person who is appointed under section 13 of this Act by the Minister to be an inspector for the purposes of this Act;
“the e-mark” has the meaning assigned to it by section 11 of this Act;
“the Minister” means the Minister for Industry, Commerce and Tourism;
“package” means a container containing goods together with the goods in the container;
“packer” means, in relation to a package, the person who in the course of carrying on a business placed or caused to be placed in the container included in the package the goods so included;
“prescribed” means prescribed by regulations under this Act.
(2) If two or more different quantities are expressed on a package to which section 8 of this Act applies, of those quantities all except the one which indicates the larger or largest quantity shall be disregarded for the purposes of this Act.
(3) Where a package which is marked with the e-mark is brought into the State from another member state of the European Economic Community, then for the purposes of this Act the package shall be regarded as not having been imported.
(4) In case a notice described in section 3 (2) (i) of this Act is for the time being in force, then as regards the person on whom the notice is served section 11 (3) of this Act shall be construed and have effect subject to the terms of the notice.
Regulations.
3.—(1) The Minister may make regulations for prescribing any matter referred to in this Act as prescribed; provided that in so far as any such regulations provide for the charging of fees they shall only be made with the consent of the Minister for Finance.
(2) Regulations under this Act may—
(a) apply to packages generally or to packages of a particular class or description,
(b) provide that where a package includes an outer container and one or more inner containers, such of the containers as is prescribed shall for all or any prescribed purposes of this Act be disregarded,
(c) provide that, for the purposes of section 9 (3) of this Act, equipment shall not be regarded as being suitable unless it is made from specified materials or according to or with regard to a prescribed specification or a prescribed principle,
(d) provide for the inspection, testing and certification of equipment which may be used to make up or to check packages to which section 8 of this Act applies,
(e) provide for the payment to the Minister of prescribed fees as regards such inspection, testing and certification,
(f) provide that, where an inspector as a result of the exercise of a power conferred on him by section 14 of this Act finds that a person has failed to perform a duty imposed on him by section 9 of this Act—
(i) the inspector may give to the person a notice requiring him to take, within such period as may be specified in the notice (which period shall be a period of not less than twenty-one days), such steps as are necessary to ensure that the requirements of the said section 9 are complied with in relation to the matter, and
(ii) in case for the purpose of ascertaining whether or not the requirements of the notice have been complied with, an inspector at any time after the expiration of the said period exercises any such power, there shall be payable to the Minister by the person such fee as may be prescribed for the purposes of this subparagraph,
(g) provide that in deciding whether or not—
(i) for the purposes of this Act equipment is suitable or has been appropriately used, or
(ii) checks or records are adequate for the said purposes, or
(iii) information is adequate to show that a person is likely to have discharged the duty imposed on him by section 9 (1) of this Act, regard may be had to prescribed documents (which documents may be or include codes or parts of codes of practical guidance),
(h) provide that the Weights and Measures Acts, 1878 to 1961, shall not, by reason only of the fact that a weight, measure or measuring instrument of a prescribed class or description is used for or in connection with the discharge of a duty imposed by section 9 of this Act, be construed as requiring that weight, measure or measuring instrument to be verified and stamped by an inspector of weights and measures,
(i) enable an inspector to give to any person a notice providing that, until an inspector informs the person in writing that the notice is cancelled, none, or only such one or more as may be specified in the notice, of the following paragraphs, that is to say, paragraphs (a), (b) and (c) of section 11 (3) of this Act shall apply to him as respects packages of a kind specified in the notice or a place so specified,
(j) contain such provisions as the Minister considers appropriate with respect to the dimensions of a mark prescribed for the purposes of section 11 of this Act and the manner and position in which it is to be applied to the container included in a package to which section 8 of this Act applies.
(3) Every regulation made under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the regulation is passed by either such House within the next twenty-one days on which that House has sat after the regulation is laid before it, the regulation shall be annulled accordingly but without prejudice to the validity of anything previously done thereunder.
Service of notices.
4.—(1) A notice under this Act to be served on or given to a person shall be addressed to the person on or to whom it is to be served or given and it may be served on or given to him in any of the following ways:
(a) where it is addressed to him by name, by delivering it to him;
(b) by leaving it at the address at which he ordinarily resides or at which he carries on business, or in a case in which an address for service has been furnished, at that address;
(c) by sending it by post in a prepaid registered letter addressed to him at the address at which he ordinarily resides or at which he carries on business, or in a case in which an address for service has been furnished, at that address.
(2) For the purposes of this section, a company within the meaning of the Companies Act, 1963, shall be deemed to be ordinarily resident at its registered office, and every other body corporate and every unincorporated body shall be deemed to be ordinarily resident at its principal office or place of business.
Extension of Act.
5.—(1) The Minister may by regulations declare that such provisions of this Act as are prescribed shall apply, with such modifications (if any) as may be prescribed, to packages of a prescribed class or description, being packages which—
(a) have been made up otherwise than in the presence of the person purchasing the package, and
(b) have expressed thereon a quantity expressed in units of weight or volume, and
(c) are not packages to which section 8 of this Act otherwise applies.
(2) In case regulations under this section are for the time being in force a reference in this Act to a package to which section 8 of this Act applies shall, in case the application of the provision in which the reference occurs is extended by the regulations, for the purpose of giving effect to the regulation be construed as including a reference to a package to which the application of the provision is so extended.
Exemptions.
6.—(1) Where, on an application being made to him in that behalf, the Minister is satisfied that because of—
(a) a difficulty in obtaining or providing any appliance, equipment, machine or machinery,
(b) an inability to or a difficulty in recruiting or training staff,
(c) the holding of stocks of containers or of labels or other documents,
(d) any other consideration which in the particular circumstances of the case is relevant,
it would be unreasonable to require the applicant to comply with all or any of the requirements of this Act without being given a period within which to prepare for such compliance, then subject to subsection (2) of this section he may grant to the applicant an exemption under this section.
(2) An exemption under this section shall be given by the Minister in writing and shall remain in force for such period as shall be specified therein provided that a period so specified shall not end on any day which is later than the 31st day of December, 1985.
(3) An exemption under this section may—
(a) be expressed to relate to any package made up or imported by the applicant or to packages so made up or imported which are of a specified class or description,
(b) be granted subject to such conditions (if any) as the Minister shall specify therein when granting the exemption.
(4) The following provisions shall apply in relation to an exemption granted under this section:
(a) in case the exemption is granted subject to a condition, if the condition is not complied with the exemption shall upon such non-compliance cease to have effect, and
(b) for so long as the exemption remains in force this Act shall, as regards any package which is a package to which the exemption relates, be construed and have effect subject to the terms of the exemption.
Expenses.
7.—The expenses incurred by the Minister in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
PART II
Packaged Goods
Packages.
8.—(1) Subject to subsection (2) of this section, this section applies to any package which has in the course of carrying on a business either been made up in the Sate or imported and which—
(a) has been made up otherwise than in the presence of the person purchasing the package, and
(b) has expressed thereon, or, in case regulations under section 3 (2) (b) of this Act and relating to the package are for the time being in force, on the relevant container, a quantity purporting to be the quantity of goods included in the package and expressed in units of weight or volume being, in case the quantity is expressed in units of weight, a quantity not less than 5 grams, or, in case the quantity is expressed in units of volume, a quantity not less than 5 millilitres, and
(c) is a package the contents of which, or any part of such contents, cannot be removed without opening it.
(2) The Minister may by regulations declare that this section shall not apply, or shall only apply with prescribed modifications, in relation to any package (being a package to which this section would otherwise apply, or, as may be appropriate, would otherwise apply without modification) which is of a prescribed class or description, and for so long as regulations under this subsection are in force this section shall be construed and have effect subject to their terms.
Duties of packers and importers as regards quantity of goods included in packages.
9.—(1) It shall be the duty of a person who is the packer or importer of packages to which section 8 of this Act applies to ensure that when a group of the packages, being packages each of which is marked with the same quantity, is selected in the prescribed manner and the packages in the group or such a portion of the group as is so selected are tested in the prescribed manner by an inspector—
(a) the total quantity of the goods shown by the test to be included in the packages tested divided by the number of those packages is not less than the quantity expressed on each of those packages; and
(b) the number of non-standard packages among those tested is not greater than the number prescribed as acceptable in relation to the number tested.
(2) Where, as a result of a test in respect of a group of packages which is carried out when the packages are in the possession of the packer or importer of the packages or another person, it is shown that the packer or importer of the packages has failed to perform the duty imposed on him by subsection (1) of this section in respect of the packages, then, without prejudice to the liability of the packer or importer under section 17 of this Act in respect of the failure, it shall be the duty of the person in possession of the packages to keep them in his possession until—
(a) he is authorised by an inspector to dispose of them, or
(b) if he is the packer or importer of them, he has performed his duty under subsection (1) of this section in respect of the group.
(3) It shall be the duty of a person who makes up packages to which section 8 of this Act applies either—
(a) to use in an appropriate manner in making up the packages equipment which is both suitable and of a prescribed kind, or
(b) (i) to carry out, at the prescribed time, a check which is adequate to show whether he has performed the duty imposed on him by subsection (1) of this section as regards the packages, and—
(ii) so to use suitable equipment of the prescribed kind in carrying out the check, and
(iii) to make, and to keep for the prescribed period, an adequate record of the check.
(4) It shall be the duty of a person who is the importer of packages to which section 8 of this Act applies either—
(a) to carry out at the prescribed time a check of the kind mentioned in paragraph (b) of subsection (3) of this section and to comply with subparagraph (ii) and (iii) of that paragraph as regards the check; or
(b) (i) to obtain, within the prescribed period and as regards the packages, documents containing such information concerning the packages as will be adequate to show that the packer is likely to have discharged, as regards the packages, the duty which would have been imposed on him by subsection (1) of this section had the packages been made up in the State, and
(ii) to retain for the prescribed period such documents.
(5) For the purposes of this section a package to which section 8 of this Act applies shall be regarded as being non-standard if the quantity of the goods included in the package is less, by more than an amount prescribed for the purposes of this section, or, as may be appropriate, an amount calculated in the manner so prescribed, than the quantity expressed on the package and referred to in section 8 (1) (b) of this Act.
Duties of packers and importers as regards marking packages.
10.—(1) Subject to subsection (2) of this section, it shall be the duty of the person who is the packer of, or by whom in the course of a business is imported, a package to which section 8 of this Act applies to ensure—
(a) that the quantity expressed on the package and referred to in section 8 (1) (b) of this Act is so expressed in the prescribed units of weight or volume, and
(b) that such quantity is expressed in the prescribed manner, and
(c) that there are so expressed such other particulars (if any) as may be prescribed, and
(d) that such quantity and, where appropriate, such other particulars are so expressed in a manner as will enable them easily to be read without opening the package.
(2) (a) The Minister may, if he thinks fit, for the purposes of identifying—
(i) the packer by whom and the place at which a package to which section 8 of this Act applies is made up, or
(ii) the name of the importer by whom such a package is imported and the address in the State at which he carries on business as an importer,
arrange with any person for the application by the person to packages of a class or description specified in the arrangement of a mark so specified.
(b) Where there is for the time being an arrangement under this subsection, if a package which is of a class or description specified in the arrangement is marked with the mark so specified, then, in so far as regulations under this section require the packer and place or the importer and address referred to in paragraph (a) of this subsection to be expressed on the package they shall be regarded as having been complied with.
(3) The provisions of subsection (1) of this section are in addition to and not in substitution for those of any other enactment; provided that in case—
(a) a package to which section 8 of this Act applies includes goods specified in an order under section 2 (1) of the Act of 1970, and
(b) the duties imposed by this section are complied with in relation to the package,
then if such order is made pursuant to paragraph (a) or (c) of the said section 2 (1), the requirements included in the order by virtue of either or both of those paragraphs, as may be appropriate, shall be regarded as having been complied with as regards the package.
e-mark.
11.—(1) This section applies to any package which is of a class or description prescribed for the purposes of this section.
(2) A person shall not in the course of carrying on a business—
(a) mark with the e-mark any package which is not a package to which this section applies,
(b) so mark any package which is a package to which this section applies unless he is either the packer or the importer of the package or is acting on behalf of such packer or importer,
(c) mark any package with a mark so closely resembling the e-mark as to be likely to deceive.
(3) Subject to section 3 (2) (i) of this Act, it shall be the duty of—
(a) the packer of packages which are marked with the e-mark and which he intends to export from the State; and
(b) a person who intends to import packages which are so marked and to export them from the State to a place in another member state of the European Economic Community; and
(c) a person who intends to import packages, to mark them with the e-mark and to export them in the manner mentioned in paragraph (b) of this subsection,
to give, within the prescribed period and in the prescribed manner, to the Minister a notice containing such information about the packages as is prescribed and, in the case of a person described in paragraph (b) or (c) of this subsection, such further information about the packages in question as an inspector may specify in a notice in writing served on the person by the inspector.
(4) In this Act “the e-mark” means such mark as may be for the time being prescribed for the purposes of this section.
PART III
Miscellaneous
Certain statements not to be regarded as trade descriptions, etc.
12.—(1) A statement of quantity expressed on a package in pursuance of section 10 (1) (a) of this Act shall not be regarded as being a trade description within the meaning of the Merchandise Marks Act, 1887, as amended by section 2 (2) of the Consumer Information Act, 1978.
(2) For the purposes of section 5 of the Act of 1970 the weight or measure of the goods included in a package to which section 8 of this Act applies shall be regarded as being equal to the quantity expressed on the package.
Inspectors.
13.—(1) The Minister may appoint any person who is either—
(a) an officer of the Minister, or
(b) a person who for the time being stands appointed under the Weights and Measures Acts, 1878 to 1961, as an inspector of weights and measures,
to be an inspector for the purposes of this Act.
(2) Every person appointed under subsection (1) of this section by the Minister to be an inspector shall be furnished with a certificate of his appointment and when exercising a power under this Act shall, if requested by any person thereby affected, produce such certificate for inspection by the person.
(3) Without prejudice to any power apart from this subsection of the Minister as regards the revocation of appointments, the Minister may at any time revoke an appointment under this section, and in case the Minister revokes an appointment under this section, the person whose appointment is so revoked shall forthwith give to the Minister the certificate furnished to him under this section.
Powers of inspectors.
14.—(1) For the purposes of giving effect to this Act, an inspector may—
(a) at all reasonable times enter any premises, other than a dwelling, in which he reasonably believes there are for the time being packages to which section 8 of this Act applies,
(b) inspect such premises and examine any packages found thereon which he reasonably believes to be packages to which the said section 8 applies,
(c) subject to subsection (4) of this section, open any such package and examine, test (including testing to destruction) and measure any goods or container included in such package,
(d) subject to subsection (4) of this section, take away from the premises for examination, testing and measuring any such package,
(e) test any equipment which he reasonably believes may be used to make up or to check packages to which section 8 of this Act applies,
(f) require any person, other than an officer of Customs and Excise, whom he finds on such premises to produce for inspection by such inspector any books, records or other documents which are in that person's power or control and which relate to such packages or to the goods included therein and to give to him such information (being information in the person's possession) as he may require in relation to any entries in such books, records or other documents,
(g) inspect and copy or take extracts from any such books, records, or other documents,
(h) in case he finds on such premises any such package, require any person whom he so finds to give to him, if known to such person, the name of the person by whom the package was made up, imported or distributed,
and, if an inspector has reasonable grounds for suspecting that a person has failed or is failing to perform the duty imposed on him by section 9 or 10 of this Act as regards any package found on premises entered by the inspector pursuant to this section, or that any such package is, for the purposes of section 17 (5) of this Act, inadequate, he may seize and retain the package and anything else so found and which appears to him to be something which might be required as evidence in proceedings for an offence under this Act.
(2) If an inspector has reasonable cause to believe that a person has failed to perform the duty imposed on him by section 9 of this Act in relation to a group of packages, the inspector may serve on the person in possession of the packages a notice in writing specifying the packages and requiring him to keep the packages at a place specified in the notice and at the disposal of the inspector for a period so specified (being a period not greater than one month).
(3) An inspector may in the course of exercising a power conferred on him by subsection (1) of this section require a person whom he finds on premises entered by him in exercise of such a power to—
(a) enable such inspector to use anything which is then under the person's control and is required by the inspector for the purpose of making an examination, test or measurement, under the said subsection (1),
(b) render, or cause to be rendered, for or in connection with such purpose, such personal assistance as the inspector shall reasonably specify.
(4) If an inspector—
(a) breaks open a package in pursuance of subsection (1) (c) of this section otherwise than on premises occupied by the packer or importer of the package and, for the purposes of section 17 (5) of this Act, the package is not inadequate,
(b) takes away a package in pursuance of subsection (1) (d) of this section,
it shall be the duty of the inspector, if the owner of the package requests him so to do, to buy the package on behalf of the Minister.
Appeal against seizures.
15.—Any person who is aggrieved by a seizure and retention under this Act may appeal to a Justice of the District Court and in determining the appeal the Justice may—
(a) if he is satisfied that the package or other thing was properly seized, confirm the seizure and retention, and
(b) if he is not so satisfied, order the person who made the seizure to return to the person the package or other thing seized and order the Minister to pay to the person such compensation (if any), costs (if any) and expenses (if any) as he considers reasonable having regard to any loss, costs and expenses incurred by the person by reason of the seizure and retention.
Disposal of things seized.
16.—(1) An inspector who, in accordance with this Act, has seized any package or other thing shall not dispose of it without the consent in writing of the owner or the person in apparent charge or control of it, but in the case of any thing other than a document, it may be disposed of if a direction is given pursuant to this section by a Peace Commissioner for its disposal.
(2) A person who under this Act has seized any package may, on giving notice in writing to the owner or to the person who, when the seizure was made, was in apparent charge or control of it of his intention to do so, apply to a Peace Commissioner for a direction that the package be disposed of (by destruction or otherwise) in a manner specified in the direction.
(3) A Peace Commissioner to whom an application in that behalf is duly made under this section shall, if he is satisfied that the goods included in any package in respect of which the application is made are, or are likely, before it can be used as evidence in proceedings for an offence under this Act, to become, unfit for human consumption, or if he is satisfied for any other reason that the package ought not to be further retained, give a direction under this section authorising its disposal (by destruction or otherwise).
(4) Where a direction is given under this section, the person who applied for the direction shall, as soon as may be, give notice of the making of the direction to the person to whom notice was given in pursuance of subsection (2) of this section.
(5) Any person who is aggrieved by a direction under this section may, not later than seven days after the making of the direction, appeal to a Justice of the District Court against the direction and in determining the appeal the Justice may—
(a) if he is satisfied that the direction was properly given and that, having regard to the circumstances of the case, the direction should be confirmed, confirm the direction, and
(b) if he is not so satisfied, annul the direction.
(6) (a) Subject to paragraphs (c) and (d) of this subsection, a direction under this section shall not have effect until the expiration of seven days from the date of its making.
(b) If an appeal to the District Court is taken against a direction under this section, the order shall, if the District Court confirms the direction, have effect at such time as that court determines.
(c) If a Peace Commissioner is satisfied that for any reason a direction given by him under this section should have effect before the expiration of seven days from the date of its making and he specifies in the direction the time when it should so have effect, the direction shall have effect at the time so specified.
(d) Where a thing is disposed of in accordance with a direction under this section and, on appeal, the District Court annuls the direction, the District Court may order the payment by the Minister to the owner of such compensation (if any), costs (if any) and expenses (if any) as it considers reasonable having regard to any loss, costs and expenses incurred by the owner by reason of the disposal under this section.
(7) Where a Peace Commissioner gives a direction pursuant to this section, he shall, on the production to him of the thing to which the direction relates by the person applying for the direction, give to that person a certificate in the prescribed form describing the thing and stating that a direction under this section has been given by him in respect of it.
(8) Moneys payable pursuant to a disposal under this section shall be paid to the Minister.
Offences.
17.—(1) A person who fails to perform a duty imposed on him by subsection (1), (3) or (4) of section 9 or subsection (1) of section 10 of this Act shall be guilty of an offence.
(2) A person who contravenes section 9 (2) of this Act shall be guilty of an offence.
(3) A person who obstructs or impedes an inspector in the exercise of a power, or who does not comply with a requirement made by an inspector under this Act, shall be guilty of an offence.
(4) Any person who—
(a) purports to perform the duty imposed on him by paragraph (b) of section 9 (3) of this Act, or paragraph (a) of section 9 (4) of this Act, by making a record which he knows is false in a material particular, or
(b) purports to perform the duty imposed on him by paragraph (b) of the said section 9 (4) by reference to a document containing information which he knows is false in a material particular; or
(c) with intent to deceive, alters or destroys any record kept for the purposes of this Act or any document kept for the purposes of section 9 (4) (b) of this Act,
shall be guilty of an offence.
(5) (a) If a person has in his possession for sale, agrees to sell or sells a package to which section 8 of this Act applies which is inadequate and either—
(i) he is the packer or importer of the package, or
(ii) he knows that the package is inadequate,
he shall be guilty of an offence.
(b) Where—
(i) a package to which section 8 of this Act applies is made up pursuant to an agreement or arrangement between the relevant packer and another person, and
(ii) the package is inadequate, and
(iii) such packer delivers the package to or to the order of a person to whom, under the agreement or arrangement, it falls to be delivered,
such packer shall be guilty of an offence.
(c) For the purposes of this subsection a package to which section 8 of this Act applies shall be regarded as being inadequate if the quantity of the goods included in the package is less, by more than twice the amount prescribed for the purposes of section 9 (5) of this Act, or, as may be appropriate, twice the relevant amount calculated in the manner so prescribed, than the quantity marked in pursuance of this Act on the package.
(6) Where an offence under this Act is committed by a body corporate or an unincorporated body of persons or by a person purporting to act on behalf of such a body and is proved to have been committed with the consent, connivance or approval of, or to have been facilitated by any neglect on the part of, any director, manager, secretary or other officer of such body or a member of the committee or other controlling authority of such body or any person acting as such a director, manager, secretary or other official, such person shall also be guilty of the offence.
(7) Summary proceedings for an offence under this Act may be prosecuted by the Minister.
(8) Notwithstanding section 10 (4) of the Petty Sessions (Ireland) Act, 1851, summary proceedings for an offence under this Act may be instituted within twelve months from the date of the offence.
Defence.
18.—In any proceedings for an offence under this Act in which it is proved that the defendant failed to discharge the duty imposed on him either—
(a) by subsection (3) of section 9 of this Act, as to the keeping of records, or
(b) by subsection (4) of the said section 9 as to the obtaining or retention of documents,
the defendant shall not be convicted of an offence under this Act by reason only of such failure if he satisfies the court that he took reasonable steps to discharge such duty.
Penalties.
19.—(1) A person guilty of an offence under subsection (1) or (5) of section 17 of this Act shall be liable, on conviction on indictment,
(a) in the case of a first offence, to a fine not exceeding £1,000, and
(b) in the case of a second or subsequent offence, to a fine not exceeding £10,000.
(2) A person guilty of an offence under this Act, other than an offence under subsection (1) or (5) of section 17, shall be liable on summary conviction to a fine not exceeding £500.
(3) A Justice of the District Court shall have jurisdiction to try summarily an offence under subsection (1) or (5) of section 17 of this Act if—
(a) the Justice is of opinion that the facts proved or alleged against a defendant charged with such an offence constitute a minor offence fit to be tried summarily,
(b) the Director of Public Prosecutions consents, and
(c) the defendant (on being informed by the Justice of his right to be tried by jury) does not object to being tried summarily,
and, upon conviction under this subsection, the said defendant shall be liable to a fine not exceeding £500.
(4) Section 13 of the Criminal Procedure Act, 1967, shall apply in relation to an offence under subsection (1) or (5) of section 17 of this Act as if, in lieu of the penalties specified in subsection (3) of that section, there were specified therein the penalty provided for by subsection (3) of this section, and the reference in subsection (2) (a) of that section to the penalties provided for by subsection (3) of that section shall be construed accordingly.
Application of section 3 of the Act of 1970 restricted.
20.—Where, in any proceedings for breach of a warranty of the kind specified in section 3 (1) of the Act of 1970 and in which there is raised an issue as to whether the packing of goods was in contravention of an order under paragraph (b) or (d) of section 2 (1) of that Act, the defendant proves—
(a) that the goods to which the proceedings relate were comprised either in, and only in, a package to which section 8 of this Act applies, or in, and only in, two or more such packages, and
(b) (i) in case the defendant is the packer or importer of the package or packages, as may be appropriate, mentioned in paragraph (a) of this subsection, that the duty imposed on him by section 9 of this Act has, in so far as it applies to such package or packages, been performed by him, and that such package, or, as may be appropriate, any of such packages is, for the purposes of section 17 (5) of this Act, not inadequate,
(ii) in the case of any other defendant, that such package, or, as may be appropriate, any of such packages is for the said purposes not inadequate,
then, as regards the proceedings in so far as they relate to such issue, the weight or volume of the goods included in the package or packages shall be regarded as being equal to the quantity marked on the package, or, in case there are two or more such packages, the aggregate of the quantities marked on them.

CUID I
Réamhraíteach agus Ginearálta
Gearrtheideal agus tosach feidhme.
1.—(1) Féadfar an tAcht um Earraí Pacáistithe (Cainníochtaí a Rialú), 1980, a ghairm den Acht seo.
(2) Tiocfaidh an tAcht seo i ngníomh cibé lá a shocróidh an tAire le hordú.
Léiriú.
2.—(1) San Acht seo—
ciallaíonn “Acht 1970” an tAcht Marcanna Earraí Ceannaíochta, 1970;
folaíonn “coimeádán” mála, buidéal, bosca, cás, cartán, clúdach, eangach, sac nó fillteán agus coimeádán laistigh freisin;
folaíonn “trealamh” aon fhearas nó trealamh, leictreach nó eile (nó aon chuid den chéanna), nó aon inneall nó innealra (nó aon chuid den chéanna);
ciallaíonn “earraí” aon ní is ábhar trádála, monaraíochta nó marsantais agus, i ndáil le pacáiste, ní fholaíonn sé an coimeádán is cuid den phacáiste;
ciallaíonn “allmhaireoir” i ndáil le pacáiste, faoi réir fho-alt (3) den alt seo, an duine a rinne, nó a ndearnadh thar a cheann, an pacáiste a thaifeadadh chun críocha custam ar é a allmhairiú;
ciallaíonn “cigire”, ach amháin in alt 3 (2) (h) den Acht seo, duine arna cheapadh ag an Aire faoi alt 13 den Acht seo le bheith ina chigire chun críocha an Achta seo;
tá le “an e-mharc” an bhrí a shanntar dó le halt 11 den Acht seo;
ciallaíonn “an tAire” an tAire Tionscail, Tráchtála agus Turasóireachta;
ciallaíonn “pacáiste” coimeádán ina bhfuil earraí i dteannta na n-earraí sa choimeádán;
ciallaíonn “pacálaí”, i ndáil le pacáiste, an duine a rinne, le linn dó gnó a sheoladh, na hearraí sa choimeádán is cuid den phacáiste a chur sa choimeádán, nó a chuir faoi deara iad a chur ann;
ciallaíonn “forordaithe” forordaithe le rialacháin faoin Acht seo.
(2) Má bhíonn dhá chainníocht éagsúla nó níos mó sainráite ar phacáiste lena mbaineann alt 8 den Acht seo, tabharfar neamhaird orthu go léir chun críocha an Achta seo ach amháin an ceann a chuireann an chainníocht is mó in iúl.
(3) I gcás a dtabharfar pacáiste a bheidh marcáilte leis an e-mharc isteach sa Stát ó bhallstát eile de Chomhphobal Eacnamaíochta na hEorpa, ansin chun críocha an Achta seo measfar gur pacáiste é nár allmhairíodh.
(4) I gcás fógra a thuairiscítear in alt 3 (2) (i) den Acht seo a bheith i bhfeidhm de thuras na huaire, ansin maidir leis an duine a seirbheálfar an fógra air forléireofar alt 11 (3) den Acht seo agus beidh éifeacht leis faoi réir théarmaí an fhógra.
Rialacháin.
3.—(1) Féadfaidh an tAire rialacháin a dhéanamh chun aon ní a fhorordú dá dtagraítear san Acht seo mar ní a fhorordaítear; ar choinníoll a mhéid a dhéanann aon rialacháin den sórt sin socrú chun táillí a mhuirearú nach ndéanfar iad ach le toiliú an Aire Airgeadais.
(2) Féadfaidh rialacháin faoin Acht seo—
(a) feidhm a bheith acu maidir le pacáistí i gcoitinne nó le pacáistí d'aicme nó de thuairisc áirithe,
(b) a fhoráil, i gcás a bhfolaíonn pacáiste coimeádán lasmuigh agus coimeádán nó coimeádáin laistigh, go dtabharfar neamhaird, chun gach críche nó chun aon chríche de chríocha forordaithe an Achta seo, ar cibé ceann de na coimeádáin a bheidh forordaithe,
(c) a fhoráil nach measfar, chun críocha alt 9 (3) den Acht seo, trealamh a bheith oiriúnach mura mbeidh sé déanta d'ábhair shonraithe nó de réir sonraíochta forordaithe nó de réir prionsabail fhorordaithe, nó ag féachaint dóibh,
(d) socrú a dhéanamh chun trealamh a úsáidfear chun pacáistí lena mbaineann alt 8 den Acht seo a dhéanamh suas nó a sheiceáil a iniúchadh, a thástáil agus a dheimhniú,
(e) socrú a dhéanamh chun táillí forordaithe a íoc leis an Aire maidir leis an iniúchadh, leis an tástáil agus leis an deimhniú sin,
(f) socrú a dhéanamh, i gcás a bhfaighidh cigire amach de bharr cumhacht a fheidhmiú a thugtar dó le halt 14 den Acht seo gur mhainnigh duine dualgas a cuireadh air le halt 9 den Acht seo a chomhlíonadh—
(i) go bhféadfaidh an cigire fógra a thabhairt don duine á cheangal air cibé bearta a dhéanamh, laistigh de cibé tréimhse a bheidh sonraithe san fhógra (is tréimhse nach giorra ná lá is fiche), is gá chun a chinntiú go ndéanfar ceanglais an ailt sin 9 a comhlíonadh i ndáil leis an ábhar, agus
(ii) i gcás a bhfeidhmeoidh cigire tráth ar bith tar éis dul in éag don tréimhse sin aon chumhacht den sórt sin chun a fháil amach cibé acu ar comhlíonadh nó nár comhlíonadh ceanglais an fhógra, go mbeidh cibé táille a bheidh forordaithe chun críocha na fomhíre seo iníoctha ag an duine leis an Aire,
(g) a fhoráil go bhféadfar le linn bheith á chinneadh—
(i) chun críocha an Achta seo cibé acu atá nó nach bhfuil trealamh oiriúnach nó ar úsáideadh nó nár úsáideadh go hoiriúnach é, nó
(ii) an leor nó nach leor seiceáil nó taifid chun na gcríocha sin, nó
(iii) an leor nó nach leor faisnéis chun a thaispeáint gur dóigh go ndearna duine an dualgas a cuireadh air le halt 9 (1) den Acht seo a chomhlíonadh,
go dtabharfar aird ar dhoiciméid fhorordaithe (is doiciméid ar féidir gurb é atá iontu nó go bhfolaíonn siad cóid nó codanna de chóid ar de threoir phraiticiúil iad),
(h) a fhoráil nach ndéanfar, de bhíthin amháin go n-úsáidtear meáchan, tomhas nó ionstraim tomhais d'aicme nó de thuairisc fhorordaithe chun dualgas a cuireadh le halt 9 den Acht seo a chomhlíonadh nó i ndáil leis sin, na hAchtanna Meáchan agus Tomhas, 1878 go 1961, a fhorléiriú mar Achtanna lena gceanglaítear gur gá an meáchan, an tomhas nó an ionstraim tomhais sin a fhíorú agus a stampáil ag cigire meáchan agus tomhas,
(i) a chumasú do chigire fógra a thabhairt d'aon duine á fhoráil, go dtí go gcuirfidh cigire in iúl don duine i scríbhinn go bhfuil an fógra curtha ar ceal, nach mbeidh feidhm ina leith ag aon cheann, nó nach mbeidh feidhm ina leith ach ag cibé ceann nó níos mó, de na míreanna seo a leanas a shonrófar san fhógra, is é sin le rá, míreanna (a), (b) agus (c) d'alt 11 (3) den Acht seo, maidir le pacáistí de chineál a bheidh sonraithe san fhógra nó maidir le háit a bheidh sonraithe amhlaidh,
(j) cibé forálacha a bheith iontu a mheasfaidh an tAire is iomchuí maidir le toisí mharc a bheidh forordaithe chun críocha alt 11 den Acht seo agus an tslí agus an t-ionad a mbeidh sé le cur ar an gcoimeádán is cuid de phacáiste lena mbaineann alt 8 den Acht seo.
(3) Gach rialachán a dhéanfar faoin Acht seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus, má dhéanann ceachtar Teach díobh sin laistigh den lá is fiche a shuífidh an Teach sin tar éis an rialachán a leagan faoina bhráid rún a rith ag neamhniú an rialacháin, beidh an rialachán ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin rialachán.
Fógraí a sheirbheáil.
4.—(1) Déanfar fógra faoin Acht seo a bheidh le seirbheáil ar dhuine nó le tabhairt do dhuine a sheoladh chuig an duine a bhfuil sé le seirbheáil air nó le tabhairt dó agus féadfar é a sheirbheáil air nó a thabhairt dó ar aon slí díobh seo a leanas:
(a) i gcás é a bheith seolta chuige faoina ainm, trína sheachadadh dó;
(b) trína fhágáil ag an seoladh ag a bhfuil gnáthchónaí air no ag a seolann sé gnó, nó i gcás seoladh le haghaidh seirbheála a bheith tugtha, ag an seoladh sin;
(c) trína chur leis an bpost i litir reámhíoctha chláraithe a sheolfar chuige ag an seoladh ag a bhfuil gnáthchónaí air nó ag a seolann sé gnó, nó i gcás seoladh le haghaidh seirbheála a bheith tugtha, ag an seoladh sin.
(2) Chun críocha an ailt seo measfar, maidir le cuideachta de réir bhrí Acht na gCuideachtaí, 1963, gnáthchónaí a bheith uirthi ina hoifig chláraithe, agus measfar gnáthchónaí a bheith ar gach comhlacht corpraithe eile agus ar gach comhlacht neamhchorpraithe ina phríomh-oifig nó ina phríomh-ionad gnó.
Leathnú ar an Acht.
5.—(1) Féadfaidh an tAire le rialacháin a dhearbhú go mbeidh feidhm ag cibé forálacha de chuid an Achta seo a bheidh forordaithe, fara cibé modhnuithe (más ann) a fhorordófar, maidir le pacáistí d'aicme nó de thuairisc fhorordaithe, ar pacáistí iad—
(a) a bheidh déanta suas ar shlí eile seachas i láthair an duine a bheidh ag ceannach an phacáiste, agus
(b) a mbeidh cainníocht sainráite orthu a bheidh sainráite ina aonaid meáchain nó toirte, agus
(c) nach pacáistí a mbainfidh alt 8 den Acht seo leo ar shlí eile.
(2) I gcás rialacháin faoin alt seo a bheith i bhfeidhm de thuras na huaire déanfar tagairt san Acht seo do phacáiste lena mbaineann alt 8 den Acht seo, i gcás feidhm na forála ina bhfuil an tagairt a leathnú leis na rialacháin, a fhorléiriú, chun éifeacht a thabhairt don rialachán, mar thagairt a fholaíonn tagairt do phacáiste a ndéantar feidhm na forála a leathnú chuige amhlaidh.
Díolúine.
6.—(1) I gcás ar deimhin leis an Aire, ar iarratas chuige sin a bheith déanta chuige, go mbeadh sé míréasúnach—
(a) mar gheall ar dheacracht a bheith ann aon fhearas, trealamh, inneall nó innealra a fháil nó a sholáthar,
(b) toisc nárbh fhéidir nó gur dheacair foireann a earcú nó a oiliúint,
(c) mar gheall ar stoic coimeádán nó lipéad nó doiciméad eile a shealbhú,
(d) mar gheall ar aon chúis eile is cuí in imthosca áirithe an cháis,
a cheangal ar an iarratasóir ceanglais uile, nó aon chuid de cheanglais, an Achta seo a chomhlíonadh gan tréimhse a thabhairt dó le hullmhú don chomhlíonadh sin, ansin faoi réir fho-alt (2) den alt seo féadfaidh sé díolúine a dheonú don iarratasóir faoin alt seo.
(2) Tabharfaidh an tAire díolúine faoin alt seo i scríbhinn agus fanfaidh an díolúine i bhfeidhm ar feadh cibé tréimhse a shonrófar inti ar choinníoll nach gcríochnóidh tréimhse a shonrófar amhlaidh lá ar bith is déanaí ná an 31ú lá de Nollaig, 1985.
(3) Féadfaidh díolúine faoin alt seo—
(a) é a bheith sainráite inti go mbaineann sí le haon phacáiste a rinne an t-iarratasóir suas nó d'allmhairigh sé nó le pacáistí a rinneadh suas nó a allmhairíodh amhlaidh agus is d'aicme nó de thuairisc shonraithe,
(b) a dheonú faoi réir cibé coinníollacha (más ann) a shonróidh an tAire inti nuair a bheidh sé ag deonú na díolúine.
(4) Beidh feidhm ag na forálacha seo a leanas i ndáil le díolúine a dheonófar faoin alt seo:
(a) i gcás an díolúine a dheonú faoi réir coinníll, más rud é nach gcomhlíonfar an coinníoll scoirfidh an díolúine d'éifeacht a bheith léi ar an neamhchomhlíonadh sin, agus
(b) fad a fhanfaidh an díolúine i bhfeidhm forléireofar an tAcht seo agus beidh éifeacht leis faoi réir théarmaí na díolúine maidir le haon phacáiste ar pacáiste é lena mbaineann an díolúine.
Caiteachais.
7.—Déanfar na caiteachais a thabhóidh an tAire ag riaradh an Achta seo a íoc, a mhéid a cheadóidh an tAire Airgeadais, as airgead a sholáthróidh an tOireachtas.
CUID II
Earraí Pacáistithe
Pacáistí.
8.—(1) Faoi réir fho-alt (2) den alt seo, baineann an t-alt seo le haon phacáiste a dhéanfar suas sa Stát nó a allmhaireofar, i gcúrsa gnó a sheoladh, agus—
(a) a bheidh déanta suas ar shlí eile seachas i láthair an duine a bheidh ag ceannach an phacáiste, agus
(b) a mbeidh sainráite air nó, i gcás rialacháin faoi alt 3 (2) (b) den Acht seo a bhaineann leis an bpacáiste a bheith i bhfeidhm de thuras na huaire, ar an gcoimeádán iomchuí, cainníocht a airbheartaíonn gurb í an chainníocht earraí í atá sa phacáiste agus go mbeidh sin sainráite in aonaid meáchain nó toirte, agus arb éard í, i gcás í a bheith sainráite in aonaid meáchain, cainníocht nach lú ná 5 ghram, nó, i gcás í a bheith sainráite in aonaid toirte, cainníocht nach lú ná 5 mhillilítear, agus
(c) ar pacáiste é nach féidir a bhfuil ann ná aon chuid dá bhfuil ann a bhaint as gan é a oscailt.
(2) Féadfaidh an tAire, le rialacháin, a dhearbhú nach mbeidh feidhm ag an alt seo, nó nach mbeidh feidhm aige ach amháin fara modhnuithe forordaithe, i ndáil le haon phacáiste (ar pacáiste é a mbainfeadh an t-alt seo leis ar shlí eile, nó, de réir mar is iomchuí, a mbainfeadh sé leis ar shlí eile gan mhodhnú) ar d'aicme nó de thuairisc fhorordaithe é, agus fad a bheidh rialacháin faoin bhfo-alt seo i bhfeidhm forléireofar an t-alt seo agus beidh éifeacht leis faoi réir a dtéarmaí.
Dualgais pacálaithe agus allmhaireoirí maidir leis an gcainníocht earraí i bpacáistí.
9.—(1) Beidh sé de dhualgas ar dhuine arb é pacálaí nó allmhaireoir pacáistí é lena mbaineann alt 8 den Acht seo a chinntiú, nuair a dhéanfar grúpa de na pacáistí, ar pacáistí iad a mbeidh an chainníocht chéanna marcáilte ar gach ceann díobh, a roghnú ar an modh forordaithe agus go ndéanfaidh cigire na pacáistí sa ghrúpa nó cibé cuid den ghrúpa a roghnófar amhlaidh a thástáil ar an modh forordaithe—
(a) nach lú ná an chainníocht a bheidh sainráite ar gach ceann de na pacáistí sin an chainníocht iomlán earraí a dtaispeánfar leis an tástáil go bhfuil siad sna pacáistí a tástáladh arna roinnt ar líon na bpacáistí sin; agus
(b) nach mó ná an líon a bhfhorordfar gur líon inghlactha é i ndáil leis an líon a tástáladh an líon pacáistí neamhchaighdeánacha i measc na bpacáistí sin a tástáladh.
(2) I gcás a dtaispeánfar, de bharr tástáil a dhéantar i leith grúpa pacáistí nuair a bhíonn na pacáistí i seilbh pacálaí nó allmhaireoir na bpacáistí nó duine eile, nár chomhlíon pacálaí nó allmhaireoir na bpacáistí an dualgas a chuirtear air le fo-alt (1) den alt seo i leith na bpacáistí, ansin, gan dochar do dhliteanas an phacálaí nó an allmhaireora faoi alt 17 den Acht seo i leith na mainneachtana, beidh sé de dhualgas ar an duine a bheidh i seilbh na bpacáistí iad a choimeád ina sheilbh—
(a) go dtí go mbeidh sé údaraithe ag cigire iad a dhiúscairt, nó
(b) más rud é gurb é pacálaí nó allmhaireoir na bpacáistí é, go dtí go mbeidh a dhualgas faoi fho-alt (1) den alt seo comhlíonta aige maidir leis an ngrúpa.
(3) Beidh sé de dhualgas ar dhuine a dhéanann suas pacáistí lena mbaineann alt 8 den Acht seo—
(a) trealamh a bheidh oiriúnach agus ar de chineál forordaithe é a úsáid ar shlí iomchuí nuair a bheidh na pacáistí á ndéanamh suas aige, nó
(b) (i) seiceáil a dhéanamh, an tráth forordaithe, is leor chun a thaispeáint gur chomhlíon sé an dualgas a chuirtear air le fo-alt (1) den alt seo maidir leis na pacáistí, agus—
(ii) trealamh oiriúnach den chineál forordaithe a úsáid amhlaidh nuair a bheidh an tseiceáil á déanamh aige, agus
(iii) leor-thaifead ar an tseiceáil a dhéanamh, agus a choimeád go ceann na tréimhse forordaithe.
(4) Beidh sé de dhualgas ar dhuine ar allmhaireoir pacáistí lena mbaineann alt 8 den Acht seo é—
(a) seiceáil den chineál a luaitear i mír (b) d'fho-alt (3) den alt seo a dhéanamh an tráth forordaithe agus fomhír (ii) agus (iii) den mhír sin a chomhlíonadh maidir leis an tseiceáil; nó
(b) (i) doiciméid a fháil maidir leis na pacáistí laistigh den tréimhse fhorordaithe ina mbeidh cibé eolas i dtaobh na bpacáistí is leor chun a thaispeáint gur dóigh gur chomhlíon an pacálaí an dualgas maidir leis na pacáistí a chuirfí air le fo-alt (1) den alt seo dá mba rud é gur sa Stát a rinneadh suas na pacáistí, agus
(ii) na doiciméid sin a choinneáil go ceann na tréimhse forordaithe.
(5) Chun críocha an ailt seo measfar pacáiste lena mbaineann alt 8 den Acht seo a bheith neamhchaighdeánach más lú cainníocht na n-earraí sa phacáiste, de mhéid is mó ná méid a bheidh forordaithe chun críocha an ailt seo, nó, de réir mar is iomchuí, de mhéid arna ríomh ar an modh a bheidh forordaithe amhlaidh, ná an chainníocht a bheidh sainráite ar an bpacáiste agus dá dtagraítear in alt 8 (1) (b) den Acht seo.
Dualgais pacálaithe agus allmhaireoirí maidir le pacáistí a mharcáil.
10.—(1) Faoi réir fho-alt (2) den alt seo, beidh sé de dhualgas ar an duine arb é pacálaí pacáiste é lena mbaineann alt 8 den Acht seo, nó a dhéanann, i gcúrsa gnó, pacáiste den sórt sin a allmhairiú, a chinntiú—
(a) go mbeidh an chainníocht a bheidh sainráite ar an bpacáiste agus dá dtagraítear in alt 8 (1) (b) den Acht seo sainráite amhlaidh sna haonaid fhorordaithe meáchain nó toirte, agus
(b) go mbeidh an chainníocht sin sainráite ar an modh forordaithe, agus
(c) go mbeidh cibé sonraí eile (más ann) a bheidh forodaithe sainráite amhlaidh, agus
(d) go mbeidh cibé cainníocht agus, i gcás ar iomchuí sin, cibé sonraí eile, sainráite amhlaidh ar mhodh go bhféadfar iad a léamh go héasca gan an pacáiste a oscailt.
(2) (a) Féadfaidh an tAire, más cuí leis é—
(i) chun an pacálaí a rinne suas, agus an áit a ndearnadh suas, pacáiste lena mbaineann alt 8 den Acht seo a aithint, nó
(ii) chun ainm an allmhaireora a d'allmhairigh pacáiste den sórt sin agus an seoladh sa Stát ag a seolann sé gnó mar allmhaireoir a aithint,
socrú a dhéanamh le haon duine go gcuirfidh an duine marc a bheidh sonraithe amhlaidh ar phacáistí d'aicme nó de thuairisc a bheidh sonraithe sa socrú.
(b) I gcás a mbeidh comhshocraíocht ann de thuras na huaire faoin bhfo-alt seo, má bhíonn pacáiste is d'aicme nó de thuairisc a bheidh sonraithe sa chomhshocraíocht marcáilte leis an marc a bheidh sonraithe amhlaidh, ansin, a mhéid a cheanglóidh rialacháin faoin alt seo go mbeidh an pacálaí agus an áit nó an t-allmhaireoir agus an seoladh dá dtagraítear i mír (a) den fho-alt seo sainráite ar an bpacáiste measfar na rialacháin a bheith comhlíonta.
(3) Is forálacha i dteannta, agus ní forálacha in ionad, fhorálacha aon achtacháin eile forálacha fho-alt (1) den alt seo; ar choinníoll—
(a) i gcás a bhfolaíonn pacáiste lena mbaineann alt 8 den Acht seo earraí a bheidh sonraithe in ordú faoi alt 2 (1) d'Acht 1970, agus
(b) i gcás na dualgais a fhorchuirtear leis an alt seo a bheith comhlíonta i ndáil leis an bpacáiste,
ansin más de bhun mhír (a) nó (c) den alt sin 2 (1) a rinneadh an t-ordú, go measfar na ceanglais a bheidh san ordú de bhua cheachtar de na míreanna sin nó de bhua an dá mhír sin, de réir mar is iomchuí, a bheith comhlíonta maidir leis an bpacáiste.

11.—(1) Baineann an t-alt seo le haon phacáiste is d'aicme nó de thuairisc atá forordaithe chun críocha an ailt seo.
(2) Ní dhéanfaidh duine i gcúrsa gnó a sheoladh—
(a) aon phacáiste nach pacáiste lena mbaineann an t-alt seo a mharcáil leis an e-mharc,
(b) aon phacáiste a mharcáil amhlaidh ar pacáiste é lena mbaineann an t-alt seo mura rud é gurb é pacálaí nó allmhaireoir an phacáiste é nó go bhfuil sé ag gníomhú thar ceann an phacálaí nó an allmhaireora sin,
(c) aon phacáiste a mharcáil le marc a bheidh chomh cosúil sin leis an e-mharc gur dóigh dó meabhlú.
(3) Faoi réir alt 3 (2) (i) den Acht seo beidh sé de dhualgas—
(a) ar phacálaí pacáistí a bheidh marcáilte leis an e-mharc agus a bheartaíonn sé a onnmhairiú as an Stát; agus
(b) ar dhuine a bheartaíonn pacáistí a allmhairiú a bheidh marcáilte amhlaidh agus iad a onnmhairiú as an Stát go dtí áit i mballstát eile de Chomhphobal Eacnamaíochta na hEorpa; agus
(c) ar dhuine a bheartaíonn pacáistí a allmhairiú iad a mharcáil leis an e-mharc agus iad a onnmhairiú ar an modh a luaitear i mír (b) den fho-alt seo,
fógra a thabhairt don Aire, laistigh den tréimhse fhorordaithe agus ar an modh forordaithe, ina mbeidh cibé eolas faoi na pacáistí atá forordaithe agus, i gcás duine a thuairiscítear i mír (b) nó (c) den fho-alt seo, cibé eolas breise faoi na pacáistí atá i gceist a shonróidh cigire i bhfógra i scríbhinn a sheirbheálfaidh an cigire ar an duine.
(4) San Acht seo ciallaíonn “an e-mharc” cibé marc a bheidh forordaithe de thuras na huaire chun críocha an ailt seo.
CUID III
Ilghnéitheach
Ní mheasfar gur tuairiscí trádála ráitis áirithe, etc.
12.—(1) Ní mheasfar maidir le ráiteas cainníochta a bheidh sainráite ar phacáiste de bhun alt 10 (1) (a) den Acht seo, gur tuairisc thrádála é de réir bhrí an Merchandise Marks Act, 1887, arna leasú le halt 2 (2) den Acht um Fhaisnéis do Thomhaltóirí, 1978.
(2) Chun críocha alt 5 d'Acht 1970 measfar meáchan nó tomhas na n-earraí i bpacáiste lena mbaineann alt 8 den Acht seo a bheith comhionann leis an gcainníocht a bheidh sainráite ar an bpacáiste.
Cigirí.
13.—(1) Féadfaidh an tAire aon duine a cheapadh—
(a) ar oifigeach don Aire é, nó
(b) ar duine é a bheidh de thuras na huaire arna cheapadh faoi na hAchtanna Meáchan agus Tomhas, 1878 go 1961, mar chigire meáchan agus tomhas,
le bheith ina chigire chun críocha an Achta seo.
(2) Gach duine a bheidh ceaptha ag an Aire faoi fho-alt (1) den alt seo le bheith ina chigire tabharfar deimhniú a cheaptha dó agus déanfaidh sé, le linn dó bheith ag feidhmiú cumhachta faoin Acht seo, má iarrann aon duine dá ndéanann sin difear air é, an deimhniú sin a thabhairt ar aird don duine lena iniúchadh.
(3) Gan dochar d'aon chumhacht atá, ar leith ón bhfo-alt seo, ag an Aire maidir le ceapacháin a chúlghairm, féadfaidh an tAire tráth ar bith ceapachán faoin alt seo a chúlghairm, agus i gcás a gcúlghairfidh an tAire ceapachán faoin alt seo, déanfaidh an duine a mbeidh a cheapachán cúlghairthe amhlaidh an deimhniú a tugadh dó faoin alt seo a thabhairt láithreach don Aire.
Cumhachtaí cigirí.
14.—(1) Chun éifeacht a thabhairt don Acht seo, féadfaidh cigire—
(a) dul isteach gach tráth réasúnach in aon áitreabh, seachas teaghais, a gcreideann sé le réasún go bhfuil pacáistí ann de thuras na huaire lena mbaineann alt 8 den Acht seo,
(b) an t-áitreabh sin a iniúchadh agus aon phacáistí a gheofar ann agus a gcreideann sé le réasún gur pacáistí iad lena mbaineann an t-alt sin 8 a scrúdú,
(c) faoi réir fho-alt (4) den alt seo, aon phacáiste den sórt sin a oscailt agus aon earraí nó coimeádán sa phacáiste sin a scrúdú, a thástáil (lena n-áirítear tástáil go dtí a mhilleadh) agus a thomhas,
(d) faoi réir fho-alt (4) den alt seo, aon phacáiste den sórt sin a thabhairt chun siúil as an áitreabh lena scrúdú, lena thástáil agus lena thomhas,
(e) aon trealamh a thástáil a gcreideann sé le réasún go bhféadfaí é a úsáid chun pacáistí lena mbaineann alt 8 den Acht seo a dhéanamh suas nó a sheiceáil,
(f) a cheangal ar aon duine, seachas oifigeach Custam agus Máil, a gheobhaidh sé san áitreabh sin aon leabhair, taifid nó doiciméid eile a bheidh faoi chumhacht nó rialú an duine sin agus a bhainfidh leis na pacáistí sin nó leis na hearraí iontu a thabhairt ar aird lena n-iniúchadh ag an gcigire sin agus cibé eolas a thabhairt dó (ar eolas é atá ag an duine) a iarrfaidh sé i ndáil le haon sonraí sna leabhair, sna taifid nó sna doiciméid eile sin,
(g) aon leabhair, taifid nó doiciméid eile den sórt sin a iniúchadh agus cóipeanna a dhéanamh díobh nó sleachta a thógáil astu,
(h) i gcás a bhfaighidh sé san áitreabh sin aon phacáiste den sórt sin, a cheangal ar aon duine a gheobhaidh sé amhlaidh ainm an duine a rinne suas, a d'allmhairigh nó a dháil an pacáiste a thabhairt dó más eol don duine sin é,
agus, má bhíonn foras réasúnach ag cigire lena cheapadh gur mhainnigh duine nó go mainníonn sé fós an dualgas a chuirtear air le halt 9 nó 10 den Acht seo a chomhlíonadh maidir le haon phacáiste a fuarthas in áitreabh a ndeachaigh an cigire isteach ann de bhun an ailt seo, nó go bhfuil aon phacáiste den sórt sin uireasach chun críocha alt 17 (5) den Acht seo, féadfaidh sé an pacáiste agus aon ní eile a fuarthas amhlaidh a urghabháil agus a choinneáil, ar ní é ar dealraitheach dó go bhféadfadh sé a bheith ag teastáil mar fhianaise in imeachtaí maidir le cion faoin Acht seo.
(2) Má bhíonn cúis réasúnach ag cigire chun a chreidiúint gur mhainnigh duine dualgas a chuirtear air le halt 9 den Acht seo a chomhlíonadh i ndáil le grúpa pacáistí, féadfaidh an cigire fógra i scríbhinn a sheirbheáil ar an duine atá i seilbh na bpacáistí ina sonrófar na pacáistí agus a cheanglóidh air na pacáistí a choinneáil in áit a bheidh sonraithe san fhógra agus a bheidh faoina réir ag an gcigire go ceann tréimhse a shonrófar amhlaidh (ar tréimhse í nach faide ná mí amháin).
(3) Féadfaidh cigire le linn dó cumhacht a fheidhmiú a thugtar dó le fo-alt (1) den alt seo a cheangal ar dhuine a gheobhaidh sé in áitreabh a rachaidh sé isteach ann i bhfeidhmiú cumhachta den sórt sin—
(a) a chumasú don chigire sin aon ní a úsáid a bheidh an tráth sin faoi rialú an duine agus a theastóidh ón gcigire chun scrúdú, tástáil nó tomhas a dhéanamh faoin bhfo-alt sin (1),
(b) cibé cúnamh pearsanta a thabhairt, nó a chur faoi deara é a thabhairt, chun na críche sin nó i ndáil léi a shonróidh an cigire le réasún.
(4) Má dhéanann cigire—
(a) pacáiste a bhriseadh de bhun fho-alt (1) (c) den alt seo in áit seachas áitreabh a bheidh ar áitiú ag pacálaí nó ag allmhaireoir an phacáiste agus nach pacáiste uireasach chun críocha alt 17 (5) den Acht seo an pacáiste,
(b) pacáiste a thabhairt leis de bhun fho-alt (1) (d) den alt seo.
beidh sé de dhualgas ar an gcigire, má iarrann úinéir an phacáiste air sin a dhéanamh, an pacáiste a cheannach thar ceann an Aire.
Achomharc in aghaidh urghabhálacha.
15.—Aon duine arb éagóir leis urghabháil agus coinneáil a rinneadh faoin Acht seo féadfaidh sé achomharc a dhéanamh chun Breitheamh den Chúirt Dúiche agus féadfaidh an Breitheamh le linn dó an t-achomharc a chinneadh—
(a) más deimhin leis go ndearnadh an pacáiste nó an ní eile a urghabháil go cuí, an urghabháil agus an choinneáil a dhaingniú, agus
(b) mura deimhin leis amhlaidh, a ordú don duine a rinne an urghabháil an pacáiste nó an ní eile a urghabhadh a thabhairt ar ais don duine agus a ordú don Aire cibé cúiteamh (más ann), costais (más ann) agus caiteachais (más ann) a íoc leis an duine a mheasfaidh sé a bheith réasúnach ag féachaint d'aon chaillteanas, costais agus caiteachais a thabhaigh an duine de bharr na hurghabhála agus na coinneála.
Nithe a urghabhadh a dhiúscairt.
16.—(1) Cigire a rinne, de réir an Achta seo, aon phacáiste nó ní eile a urghabháil ní dhéanfaidh sé é a dhiúscairt gan toiliú i scríbhinn ó úinéir an phacáiste nó ón duine ar dealraitheach é a bheith i gcúram nó i bhfeighil an phacáiste nó an ní eile, ach i gcás aon ní seachas doiciméad, féadfar é a dhiúscairt má thugann Feidhmeannach Síochána ordachán de bhun an ailt seo lena dhiúscairt.
(2) Duine a rinne, de réir an Achta seo, aon phacáiste a urghabháil féadfaidh sé, tar éis fógra i scríbhinn a thabhairt d'úinéir an phacáiste nó don duine ar dealraitheach é a bheith i gcúram nó i bhfeighil an phacáiste nuair a rinneadh an urghabháil, á rá go bhfuil ar intinn aige sin a dhéanamh, iarratas a dhéanamh chun Feidhmeannaigh Shíochána ar ordachán go ndéanfaí an pacáiste a dhiúscairt (trína mhilleadh nó ar shlí eile) ar mhodh a shonrófar san ordachán.
(3) Feidhmeannach Síochána a mbeidh iarratas chuige sin déanta chuige go cuí faoin alt seo déanfaidh sé, más deimhin leis, maidir leis na hearraí in aon phacáiste ar ina leith a rinneadh an t-iarratas, go bhfuil siad, nó gur dóigh dóibh sula bhféadfar an pacáiste a úsáid mar fhianaise in imeachtaí i leith cion faoin Acht seo, a bheith neamhoiriúnach mar bhia don duine, nó más deimhin leis ar aon chúis eile nár cheart an pacáiste a choinneáil a thuilleadh, ordachán a thabhairt faoin alt seo á údarú an pacáiste a dhiúscairt (trína mhilleadh nó ar shlí eile).
(4) I gcás a dtabharfar ordachán faoin alt seo, déanfaidh an duine a d'iarr an t-ordachán, a luaithe is féidir, fógra faoin ordachán a dhéanamh a thabhairt don duine ar tugadh fógra dó de bhun fho-alt (2) den alt seo.
(5) Aon duine arb éagóir leis ordachán a tugadh faoin alt seo féadfaidh sé, tráth nach déanaí ná seacht lá tar éis an t-ordachán a thabhairt, achomharc a dhéanamh chun Breitheamh den Chúirt Dúiche in aghaidh an ordacháin agus féadfaidh an Breitheamh le linn dó an t-achomharc a chinneadh—
(a) an t-ordachán a dhaingniú más deimhin leis gur tugadh an t-ordachán go cuí agus gur cheart, ag féachaint d'imthosca an cháis, an t-ordachán a dhaingniú, agus
(b) mura deimhin leis amhlaidh, an t-ordachán a neamhniú.
(6) (a) Faoi réir mhíreanna (c) agus (d) den fho-alt seo, ní bheidh éifeacht le hordachán faoin alt seo go dtí go mbeidh seacht lá caite ó dháta a dhéanta.
(b) Má dhéantar achomharc chun na Cúirte Dúiche in aghaidh ordachán faoin alt seo, beidh éifeacht leis an ordú, má dhaingníonn an Chúirt Dúiche an t-ordachán, cibé tráth a chinnfidh an chúirt sin.
(c) Más deimhin le Feidhmeannach Síochána gur chóir ar chúis ar bith go mbeadh éifeacht le hordachán a thug sé faoin alt seo sula mbeadh seacht lá caite ó dháta a dhéanta agus go sonróidh sé san ordachán an tráth ar chóir éifeacht a bheith leis amhlaidh, beidh éifeacht leis an ordachán an tráth a shonrófar amhlaidh.
(d) I gcás ní a dhiúscairt de réir ordachán faoin alt seo agus go ndéanfaidh an Chúirt Dúiche, ar achomharc, an t-ordachán a neamhniú, féadfaidh an Chúirt Dúiche a ordú go n-íocfaidh an tAire leis an úinéir cibé cúiteamh (más ann), costais (más ann) agus caiteachais (más ann) a mheasfaidh sí a bheith réasúnach ag féachaint d'aon chaillteanas, costais agus caiteachais a thabhaigh an t-úinéir i ngeall ar an diúscairt faoin alt seo.
(7) I gcás a dtabharfaidh Feidhmeannach Síochána ordachán de bhun an ailt seo déanfaidh sé, ar an duine a d'iarr an t-ordachán do thabhairt ar aird dó an ní lena mbaineann an t-ordachán, deimhniú san fhoirm fhorordaithe a thabhairt don duine sin ina mbeidh tuairisc ar an ní agus a dhearbhóidh go bhfuil ordachán faoin alt seo tugtha aige maidir leis.
(8) Íocfar leis an Aire airgead is iníoctha de bhun diúscartha faoin alt seo.
Cionta.
17.—(1) Duine a mhainneoidh dualgas a chomhlíonadh a chuirtear air le fo-alt (1), (3) nó (4) d'alt 9 nó le fo-alt (1) d'alt 10 den Acht seo beidh sé ciontach i gcion.
(2) Beidh duine a sháróidh alt 9 (2) den Acht seo ciontach i gcion.
(3) Duine a choiscfidh nó a bhacfaidh cigire agus é ag feidhmiú cumhachta, nó nach ndéanfaidh de réir cheanglas a chuir cigire faoin Acht seo, beidh sé ciontach i gcion.
(4) Duine ar bith—
(a) a airbheartóidh an dualgas a chuirtear air le mír (b) d'alt 9 (3) den Acht seo nó le mír (a) d'alt 9 (4) den Acht seo a chomhlíonadh trí thaifead a dhéanamh is eol dó a bheith bréagach i bponc ábhartha, nó
(b) a airbheartóidh an dualgas a chuirtear air le mír (b) den alt sin 9 (4) a chomhlíonadh faoi threoir doiciméad ina bhfuil eolas is eol dó a bheith bréagach i bponc ábhartha; nó
(c) le hintinn mheabhlaireachta, a athróidh nó a mhillfidh aon taifead a choinnítear chun críocha an Achta seo nó aon doiciméad a choinnítear chun críocha alt 9 (4) (b) den Acht seo,
beidh sé ciontach i gcion.
(5) (a) Má bhíonn pacáiste lena mbaineann alt 8 den Acht seo agus atá uireasach ina sheilbh ag duine lena dhíol, nó má chomhaontaíonn sé go ndíolfaidh sé nó má dhíolann sé pacáiste den sórt sin agus—
(i) gurb é pacálaí nó allmhaireoir an phacáiste é, nó
(ii) gurb eol dó go bhfuil an pacáiste uireasach,
beidh sé ciontach i gcion.
(b) I gcás—
(i) pacáiste lena mbaineann alt 8 den Acht seo a bheith déanta suas de bhun comhaontaithe nó socraithe idir an pacálaí iomchuí agus duine eile, agus
(ii) go mbeidh an pacáiste uireasach, agus
(iii) a seachadfaidh an pacálaí sin an pacáiste do dhuine nó ar ordú duine ar dó a bheidh sé le seachadadh faoin gcomhaontú nó faoin gcomhshocraíocht,
beidh an pacálaí sin ciontach i gcion.
(c) Chun críocha an fho-ailt seo measfar pacáiste lena mbaineann alt 8 den Acht seo a bheith uireasach más lú cainníocht na n-earraí sa phacáiste, de mhéid is mó ná dhá oiread an mhéid a bheidh forordaithe chun críocha alt 9 (5) den Acht seo, nó, de réir mar is iomchuí, dhá oiread an mhéid iomchuí arna ríomh ar an modh a bheidh forordaithe amhlaidh, ná an chainníocht a bheidh marcáilte de bhun an Achta seo ar an bpacáiste.
(6) I gcás cion faoin Acht seo a bheith déanta ag comhlacht corpraithe nó ag comhlacht neamhchorpraithe daoine nó ag duine a d'airbheartaigh a bheith ag gníomhú thar ceann comhlachta den sórt sin agus go gcruthófar go ndearnadh an cion le toiliú, le cúlcheadú nó le ceadú, nó gur urasaíodh a dhéanamh le haon fhaillí ar thaobh, aon stiúrthóra, bainisteora, rúnaí nó oifigigh eile de chuid comhlachta den sórt sin nó comhalta den choiste nó d'údarás rialaithe eile de chuid comhlachta den sórt sin nó aon duine ag gníomhú mar stiúrthóir, bainisteoir, rúnaí nó feidhmeannach eile, beidh an duine sin freisin ciontach sa chion.
(7) Féadfaidh an tAire imeachtaí achomaire i leith cion faoin Acht seo a ionchúiseamh.
(8) D'ainneoin alt 10 (4) den Petty Sessions (Ireland) Act, 1851, féadfar imeachtaí achomaire mar gheall ar chion faoin Acht seo a thionscnamh laistigh de dhá mhí dhéag ó dháta an chiona.
Cosaint.
18.—In aon imeachtaí mar gheall ar chion faoin Acht seo ina gcruthófar gur mhainnigh an cosantóir an dualgas a chomhlíonadh a chuirtear air—
(a) le fo-alt (3) d'alt 9 den Acht seo, maidir le taifid a choimeád, nó
(b) le fo-alt (4) den alt sin 9 maidir le doiciméid a fháil nó a choinneáil,
ní dhéanfar an cosantóir a chiontú i gcion faoin Acht seo de bharr na mainneachtana sin amháin má dheimhníonn sé don chúirt go ndearna sé beart réasúnach chun an dualgas sin a chomhlíonadh.
Pionóis.
19.—(1) Duine a bheidh ciontach i gcion faoi fho-alt (1) nó (5) d'alt 17 den Acht seo dlífear ar é a chiontú ar díotáil,
(a) i gcás an chéad chiona, fíneáil nach mó ná £1,000 a chur air, agus
(b) i gcás an dara cion nó cion dá éis sin, fíneáil nach mó ná £10,000 a chur air.
(2) Duine a bheidh ciontach i gcion faoin Acht seo, seachas cion faoi fho-alt (1) nó (5) d'alt 17, dlífear ar é a chiontú go hachomair fíneáil nach mó ná £500 a chur air.
(3) Beidh dlínse ag Breitheamh den Chúirt Dúiche cion a thriail go hachomair faoi fho-alt (1) nó (5) d'alt 17 den Acht seo más rud é—
(a) gurb é tuairim an Bhreithimh gur mionchion a fhéadfar a thriail go hachomair na fíorais a cruthaíodh nó a líomhnaíodh in aghaidh chosantóir a bheidh cúisithe i gcion den sort sin,
(b) go dtoileoidh an Stiúrthóir Ionchúiseamh Poiblí leis sin, agus
(c) nach ndéanfaidh an cosantóir (tar éis don Bhreitheamh a chur in iúl dó go bhfuil de cheart aige go dtrialfadh giúiré é) agóid in aghaidh a thriail go hachomair,
agus, ar é a chiontú faoin bhfo-alt seo, dlífear fíneáil nach mó ná £500 a chur ar an gcosantóir sin.
(4) Beidh feidhm ag alt 13 den Acht um Nós Imeachta Coiriúil, 1967, i ndáil le cion faoi fho-alt (1) nó (5) d'alt 17 den Acht seo ionann is dá mba rud é, in ionad na bpionós a shonraítear i bhfo-alt (3) den alt sin, gur sonraíodh ann an pionós dá bhforáiltear le fo-alt (3) den alt seo, agus déanfar an tagairt i bhfo-alt (2) (a) den alt sin do na pionóis dá bhforáiltear le fo-alt (3) den alt sin a fhorléiriú dá réir sin.

20.—Más rud é, in aon imeachtaí mar gheall ar bharánta a shárú den chineál a shonraítear in alt 3 (1) d'Acht 1970 agus ina n-éireoidh saincheist an de shárú ar ordú faoi mhír (b) nó (d) d'alt 2 (1) den Acht sin a pacáladh earraí, go gcruthóidh an cosantóir—
(a) go raibh na hearraí lena mbaineann na himeachtaí ar áireamh i bpacáiste, agus nach raibh siad ar áireamh ach i bpacáiste, lena mbaineann alt 8 den Acht seo nó go raibh siad ar áireamh in dhá phacáiste den sórt sin nó níos mó agus nach raibh siad ar áireamh ach in dhá phacáiste den sórt sin nó níos mó, agus
(b) (i) i gcás arb é an cosantóir pacálaí nó allmhaireoir an phacáiste nó na bpacáistí, de réir mar is iomchuí, a luaitear i mír (a) den fho-alt seo, gur chomhlíon sé an dualgas a chuirtear air le halt 9 den Acht seo a mhéid a bhaineann sé le pacáiste nó pacáistí den sórt sin, agus nach bhfuil an pacáiste sin, nó, de réir mar is iomchuí, aon cheann de na pacáistí sin, uireasach chun críocha alt 17 (5) den Acht seo,
(ii) i gcás aon chosantóra eile, nach bhfuil an pacáiste sin, nó, de réir mar is iomchuí, aon cheann de na pacáistí sin, uireasach chun na gcríocha sin,
ansin, maidir leis na himeachtaí a mhéid a bhaineann siad leis an tsaincheist sin, measfar meáchan nó toirt na n-earraí sa phacáiste nó sna pacáistí a bheith comhionann leis an gcainníocht a bheidh marcáilte ar an bpacáiste, nó, i gcás a mbeidh dhá phacáiste nó níos mó den sórt sin ann, le comhiomlán na gcainníochtaí a bheidh marcáilte orthu.
