Mínithe.
1.—San Acht seo—
folaíonn “onnmhuiriú” onnmhuiriú earraí a tugadh isteach sa Stát lena dtarloingsiú, pé acu faoi bhanna nó ar shlí eile é;
ní fholaíonn “earraí” táirge talmhaíochta ná táirge iascaigh mar mínítear iad sin in alt 1 den Acht Táirgí Talmhaíochta agus Iascaigh (Onnmhuiriú a Rialú), 1947 (Uimh. 18 de 1947);
ciallaíonn “ceadúnas” ceadúnas arna eisíúint faoi ordú faoi alt 2 den Acht seo;
ciallaíonn “an tAire” an tAire Tionscail agus Tráchtála.
Toirmeasc ar earraí d'onnmhuiriú.
2.—(1) Féadfaidh an tAire, aon uair agus gach uair is cuí leis, onnmhuiriú earraí d'aon tsórt sonraithe, ach amháin faoi réim agus do réir cheadúnais, a thoirmeasc le hordú, faoi réir pé eisceacht, más aon eisceacht é, is oiriúnach leis.
(2) Féadfaidh an tAire, tar éis dó dul i gcomhairle leis an Aire Gnóthaí Eachtracha, onnmhuiriú earraí d'aon tsórt sonraithe go dtí ceann scríbe sonraithe, ach amháin faoi réim agus do réir cheadúnais, a thoirmeasc le hordú, faoi réir pé eisceacht, más aon eisceacht é, is oiriúnach leis.
(3) Féadfaidh ordú faoin alt seo foráil a dhéanamh i dtaobh pé nithe eile is dóigh leis an Aire is gá chun a thabhairt go ndéanfar an t-ordú d'oibriú agus a chur i bhfeidhm go cuí.
(4) Féadfaidh an tAire ordú faoin alt seo, lena n-áirítear an fo-alt seo, a chúlghairm nó a leasú.
(5) Scoirfidh ordú faoin alt seo d'éifeacht a bheith aige i gceann dhá mhí dhéag óna thosach feidhme.
(6) Gach ordú a déanfar faoin alt seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus má dhéanann ceachtar Teach acu sin, tráth ar bith le linn an t-ordú sin a bheith i bhfeidhm, rún a rith ag neamhniú an orduithe sin, beidh an t-ordú sin ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin ordú sin.
Ceadúnais.
3.—(1) Féadfaidh an tAire dá rogha féin ceadúnas d'eisiúint nó a dhiúltú.
(2) Féadfaidh an tAire pé coinníollacha is cuí leis agus a shonrós sé sa cheadúnas a chur ag gabháil le ceadúnas.
(3) Féadfaidh an tAire ceadúnas a chúlghairm.
(4) Gach duine a dhéanfas, d'fhonn ceadúnas d'fháil dó féin nó d'aon duine eile, aon ráiteas nó faisnéis is eol dó a bheith bréagach nó míthreorach in aon phone ábhartha beidh sé ciontach i gcion faoin alt seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná céad punt a chur air.
(5) Féadfaidh an tAire inchúiseamh a dhéanamh i leith ciona faoin alt seo.
Cumhachta an Aire d'aistriú chun Aire eile.
4.—(1) Féadfaidh an Rialtas ó am go ham, le hordú, na cumhachta uile a bheirtear don Aire leis an Acht seo d'aistriú chun Aire eile agus a dhílsiú ann, chomh fada agus atá feidhm nó baint ag na cumhachta sin maidir le haon earraí áirithe a sonraítear san ordú sin.
(2) Aon uair a bheas cumhachta an Aire faoin Acht seo maidir le haon earraí áirithe dílsithe de thuras na huaire in Aire eile de bhuaidh orduithe faoi fho-alt (1) den alt seo, féadfaidh an Rialtas le hordú na cumhachta sin d'athaistriú chun an Aire agus d'athdhílsiú ann, chomh fada agus atá feidhm nó baint ag na cumhachta sin maidir leis na hearraí áirithe sin.
(3) Féadfaidh an Rialtas tráth ar bith le hordú aon ordú a rinneadh roimhe sin faoin alt seo, lena n-áirítear an fo-alt seo, a leasú.
(4) Aon uair a bheas, agus an fhaid a bheas, na cumhachta a bheirtear don Aire leis an Acht seo, chomh fada agus atá feidhm nó baint acu maidir le haon earraí áirithe, dílsithe in Aire eile de bhuaidh orduithe faoin alt seo, ansin, déanfar na tagairtí atá in ailt 2 agus 3 den Acht seo don Aire d'fhorléiriú maidir leis na hearraí áirithe sin mar thagairtí don Aire ina mbeidh na cumhachta sin dílsithe amhlaidh.
(5) Ní dhéanfaidh aon aistriú ná athaistriú cumhacht faoin alt seo dochar ná difir do bhailíocht, d'oibriú ná do ré feidhme aon orduithe ná aon ruda a bheas déanta i bhfeidhmiú na gcumhacht sin roimh an aistriú nó an athaistriú sin (pé acu é) ag an Aire ina raibh na cumhachta sin dílsithe de thuras na huaire, agus forléireofar tagairtí in aon ordú den tsórt sin don Aire a rinne an t-ordú sin, agus beidh éifeacht acu, mar thagairtí don Aire ina mbeidh na cumhachta sin dílsithe de thuras na huaire.
Caiteachais.
5.—Déanfar na caiteachais uile faoina raghaidh an tAire nó aon Aire eile faoin Acht seo d'íoc, a mhéid a cheadós an tAire Airgeadais é, as airgead a sholáthrós an tOireachtas.
Athghairm.
6.—(1) Athghairmtear leis seo na hachtacháin a luaitear sa Sceideal a ghabhas leis an Acht seo.
(2) Tiocfaidh fo-alt 1 den alt seo i ngníomh an 1ú lá d'Aibreán, 1956.
Gearrtheideal agus ré feidhme
7.—(1) Féadfar an tAcht chun Onnmhaire a Rialú (Forála Sealadacha), 1956, a ghairm den Acht seo.
(2) Leanfaidh an tAcht seo i bhfeidhm go ceann tréimhse trí mblian agus raghaidh in éag ansin.

CONTROL OF EXPORTS (TEMPORARY PROVISIONS) ACT, 1956.
Definitions.
1.—In this Act—
“exportation” includes the exportation of goods brought into the State for transhipment, whether under bond or otherwise;
“goods” does not include an agricultural product or fishery product as defined in section 1 of the Agricultural and Fishery Products (Regulation of Export) Act, 1947 (No. 18 of 1947);
“licence” means a licence issued under an order made under section 2 of this Act;
“the Minister” means the Minister for Industry and Commerce.
Prohibition of exportation of goods.
2.—(1) The Minister may, whenever and so often as he thinks fit, by order prohibit, subject to such exceptions, if any, as he may think proper, the exportation of goods of any specified description, save under and in accordance with a licence.
(2) The Minister may, after consultation with the Minister for External Affairs, by order prohibit, subject to such exceptions, if any, as he may think proper, the exportation of goods of any specified description to a specified destination, save under and in accordance with a licence.
(3) An order made under this section may make provision for such other matters as appear to the Minister necessary for securing the due operation and enforcement of the order.
(4) The Minister may revoke or amend an order made under this section including this subsection.
(5) An order made under this section shall cease to have effect on the expiration of twelve months from its commencement.
(6) Every order made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling such order is passed by either such House at any time during the currency of such order, such order shall be annulled accordingly, but without prejudice to the validity of anything previously done under such order.
Licences.
3.—(1) The Minister may issue or refuse a licence at his discretion.
(2) The Minister may attach to a licence such conditions as he shall think proper and shall specify in the licence.
(3) The Minister may revoke a licence.
(4) Every person who, for the purpose of obtaining for himself or any other person a licence, makes any statement or representation which is to his knowledge false or misleading in any material respect shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding one hundred pounds.
(5) An offence under this section may be prosecuted by the Minister.
Transfer of powers of Minister to another Minister.
4.—(1) The Government may, from time to time, by order transfer to and vest in another Minister all the powers conferred by this Act on the Minister, so far as such powers relate to or are concerned with any particular goods specified in such order.
(2) Whenever the powers of the Minister under this Act in relation to any particular goods are for the time being vested in another Minister by virtue of an order under subsection (1) of this section, the Government may by order retransfer to and revest in the Minister the said powers, so far as the same relate to or are concerned with the said particular goods.
(3) The Government may at any time by order amend any order previously made under this section including this subsection.
(4) Whenever and so long as the powers conferred on the Minister by this Act, are, so far as they relate to or are concerned with any particular goods, vested in another Minister by virtue of an order made under this section, then the references in sections 2 and 3 of this Act to the Minister shall in relation to the said particular goods be construed as references to the Minister in whom such powers are so vested.
(5) No transfer or retransfer under this section of powers shall prejudice or affect the validity, operation or duration of any order made or thing done in exercise of such powers before such transfer or retransfer (as the case may be) by the Minister in whom such powers were for the time being vested, and references in any such order to the Minister by whom such order was made shall be construed and have effect as references to the Minister in whom such powers are for the time being vested.
Expenses.
5.—All expenses incurred by the Minister or by any other Minister under this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Repeals.
6.—(1) The enactments mentioned in the Schedule to this Act are hereby repealed.
(2) Subsection (1) of this section shall come into operation on the 1st day of April, 1956.
Short title and duration.
7.—(1) This Act may be cited as the Control of Exports (Temporary Provisions) Act, 1956.
(2) This Act shall continue in force for a period of three years and shall then expire.
