Leiriú.
1.—San Acht seo
tá le “límistéir chreidiúnaithe” an bhrí a sonraítear i mír (b) d'fho-alt (1) d'alt 2;
tá le “límistéir atá le glanadh” an bhrí a sonraítear i mír (a) d'fho-alt (1) d'alt 2;
ciallaíonn “an tAire” an tAire Talmhaíochta;
ciallaíonn “an Príomh-Acht” an Diseases of Animals Act 1894, arna leasú nó arna oiriúnú le hachtacháin ina dhiaidh sin nó fúthu.
Orduithe maidir le heitinn bhólachta.
2.—(1) An chumhacht chun orduithe a dhéanamh a bheirtear le halt 22 den Phríomh-Acht agus a dílsítear anois san Aire sroichfidh sí agus folóidh sí déanamh gach orduithe nó aon orduithe acu seo a leanas ag an Aire i gcás inar dealraitheach dó gur gá sin chun an eitinn bhólachta a scrios go céimnitheach:
(a) orduithe á dhearbhú gur límistéirí ina bhfuil an eitinn bhólachta le scrios límistéirí áirithe (dá ngairmtea límistéirí atá le glanadh san Acht seo);
(b) orduithe á dhearbhú gur límistéirí ina bhfuil an eitinn bhólachta scriosta límistéirí áirithe (dá ngairmtear límistéirí creidiúnaithe san Acht seo) ar deimhin leis an Aire ina dtaobh gur ar éigin má tá an eitinn bhólachta iontu;
(c) maidir le haon límistéir atá le glanadh nó aon límistéir chreidiúnaithe, orduithe chun gach críche nó aon chríche acu seo a leanas:
(i) a cheangal go ndéanfar tástála eitinne ar bhólacht agus go dtabharfar toradh na dtástála don Aire,
(ii) maidir le bólacht a bhfuil an eitinn orthu nó a bhfuiltear in amhras go bhfuil sí orthu nó d'fhéadfadh í a thabhairt do bhólacht—
(I) a údarú go nglacfaidh an tAire seilbh, nó go nglacfar seilbh thar a cheann, trí chomhaontú, ar an mbólacht agus go ndéanfar leo mar is cuí leis an Aire,
(II) mura ndéantar comhaontú mar adúradh, aistriú na bólachta amach as an límistéir nó a marú d'áirithiú agus a rialú,
(III) leithlisiú agus cothabháil na bólachta d'áirithiú agus a rialú go nglacfaidh an tAire seilbh orthu nó go nglacfar seilbh orthu thar a cheann nó go dtí go ndéanfar iad d'aistriú amach as an límistéir nó iad a mharú,
(iii) cosc nó srian a chur le gluaiseacht ainmhithe isteach sa límistéir nó amach aisti nó tríthi nó inti,
(iv) deisiú nó atógáil bóthithe nó airbhí tórann d'áiríthiú agus a rialú,
(v) glanadh agus dí-aicídiú áitreabh, agus aistriú aoiligh, easrach, farae nó aon ruda eile amach as áitribh agus a dhiúscairt ina dhiaidh sin d'áirithiú agus a rialú,
(vi) toirmeasc nó srian a chur le gluaiseacht aon ábhair bheatha nó ábhair eile isteach sa límistéir nó isteach ar thalamh nó in áitreabh sa límistéir nó istigh sa chéanna nó amach as an gcéanna,
(vii) i gcás ainmhithe a bhfuil an eitinn orthu nó a bhfuiltear in amhras go bhfuil an eitinn orthu nó go bhféadfaidís an eitinn a thabhairt do bhólacht, leithlisiú éifeachtach na n-ainmhithe sin ar thalamh nó in áitreabh, agus toirmeasc nó srian ar a ngluaiseacht isteach ar thalamh nó cuid de thalamh nó isteach in áitreabh nó cuid d'áitreabh nó amach as an gcéanna d'áirithiú agus a rialú,
(viii) leithlisiú agus tástáil ó am go ham ar bhólacht a bhéarfar isteach ar thalamh nó in áitreabh d'áirithiú agus a rialú,
(ix) coimeád taifead i dtaobh bólachta, agus tabhairt ar aird agus iniúchadh na dtaifead sin d'áirithiú agus a rialú,
(x) foirm an fhógra a shonrú i gcásanna ina mbeidh fógraí le seirbheáil í dtaobh ceanglas faoi orduithe arna ndéanamh de bhuaidh na míre seo,
(xi) foráil a dhéanamh, i gcásanna ina mainneofar déanamh do réir ceanglas aon fhógra den tsórt sin maidir le—
(I) i gcás ina gceanglóidh an fógra bólacht d'aistriú amach as an límistéir nó a marú, seilbh a ghlacadh ar an mbólacht ag an Aire nó thar a cheann, a ndiúscairt mar is cuí leis an Aire agus an costas a ghabhfas le seilbh a ghlacadh ar an mbólacht agus a gcothabháil agus a ndiúscairt dá éis sin d'aisghabháil (gan dochar d'aon phionós faoina ndeachthas),
(II) in aon chás eile, ceanglais an fhógra a chomhlíonadh ag an Aire nó thar a cheann agus costas na gceanglas a chomhlíonadh d'aisghabháil (gan dochar d'aon phionós faoina ndeachthas),
(xii) críocha a ghabhfas nó a bhainfeas le haon cheann de na críocha sin roimhe seo (lena n-áirítear údarás chun dul isteach ar thalamh nó in áitreabh);
(d) orduithe chun gach críche nó aon chríche acu seo a leanas:
(i) aistriú agus liasradh bólachta a rialú,
(ii) seoladh margaí, aontaí, taispeántas nó díolachán ainmhithe, agus taispeáint ainmhithe ina láthair, a rialú,
(iii) glanadh agus dí-aicídiú feithiclí, áiteanna, loc agus feisteas a húsáidtear le haghaidh bólachta d'ordú agus a rialú,
(iv) na coinníollacha d'ordú faoina bhféadfar bólacht d'onnmhuiriú, lena n-áirítear calafoirt, nó coda de chalafoirt, nó bealaigh don onnmhuiriú sin, d'ainmniú,
(v) eisiúint agus tabhairt ar aird ceadúnas i leith gluaiseacht agus aistriú bólachta agus nithe d'ordú agus a rialú,
(vi) tástála eitinne ar ainmhithe a shonrú agus a rialú,
(vii) tástála eitinne ar ainmhithe (nach tástála faoi alt 7 den Acht seo nó tástála is gá a dhéanamh le horduithe, nó faoi orduithe, arna ndéanamh le bhuaidh an ailt seo) a thoirmeasc ach amháin le toiliú an Aire,
(viii) oisniú bólachta in aghaidh na heitinne a thoirmeasc ach amháin le toiliú an Aire,
(ix) marcáil bólachta lena n-aithint d'áirithiú agus a rialú agus aghlot, scrios, athrú nó baint anuas aon mharcála den tsórt sin a thoirmeasc,
(x) críocha a ghabhfas nó a bhainfeas le haon cheann de na críocha réamhráite.
(2) Gabháltas a bhfuil cuid de laistigh agus cuid de lasmuigh de límistéir atá le glanadh nó de límistéir chreidiúnaithe, measfar é go léir a bheith laistigh den límistéir sin, ach, i gcás gabháltais atá go léir nó a bhfuil cuid de laistigh de dhá límistéir nó níos mó den tsórt sin, measfar é go léir a bheith laistigh den límistéir is túisce a ndearbhófar gur límistéir chreidiúnaithe í nó, mura bhfuil aon chuid de laistigh de límistéir chreidiúnaithe, measfar ansin é go léir a bheith laistigh den límistéir is túisce a ndearbhófar gur límistéir atá le glanadh í,
(3) Is galar í an eitinn chun críocha alt 43, 44, 65 agus 74 den Phríomh-Acht agus freisin chun críocha gach ailt eile den Acht sin (lena n-áirítear ailt a bhaineas le cionta agus le himeachta dlíthiúla) ina bhfuil forála i leith nó de dhroim forál na n-alt sin agus na n-orduithe de bhuaidh an ailt seo.
Marú agus cúiteamh i límistéirí seachas límistéirí atá le glanadh agus límistéirí creidiúnaithe.
3.—(1) Féadfaidh an tAire, más cuí leis é, fógra poiblí a thabhairt, i pé slí is dóigh leis is oiriúnach, go bhfuil ar intinn aige ordú a dhéanamh faoina mbeidh límistéir shonraithe ina límistéir atá le glanadh.
(2) I gcás ina dtabharfar fógra faoin alt seo maidir le límistéir, féadfaidh an tAire, le toiliú an Aire Airgeadais, cúiteamh d'íoc, i leith na límistéire sin, i mbólacht nach n-éireoidh leo i dtástáil eitinne a bheas formheasta ag an Aire agus a marófar faoi réim chomhshocraíochta idir an tAire agus únaer na bólachta.
Bainne deighilte a phasteuráil.
4.—Leasaítear leis seo alt 30 den Acht Toradh Déiríochta, 1924 (Uimh. 58 de 1924), trí na fo-ailt seo a leanas a chur leis:
“(5) Féadfaidh an tAire rialacháin a dhéanamh á cheangal go mbeidh i ngach áitreabh nó in aon áitreabh atá cláraithe i gclár na n-uachtarlann nó i ngach áitreabh nó in aon áitreabh atá cláraithe i gclár na stáisiún deighilte uachtair gléasra chun bainne deighilte a phasteuráil agus féadfaidh sé, leis na rialacháin sin, a ordú cad é an modh agus cad é an chuma, ar gach slí, ina ndéanfar bainne deighilte a phasteuráil agus cad iad na taifid a bheas le coimeád maidir leis sin agus a cheangal go gcoimeádfar na taifid sin chun a n-iniúchta agus go gcuirfear ar fáil iad chun a n-iniúchta.
(6) I gcás ina mbeifear tar éis rialacháin a dhéanamh faoi fho-alt (5) den alt seo maidir le háitreabh atá cláraithe i gclár na n-uachtarlann, déanfar an bainne deighilte go léir is gá do réir na rialachán sin a phasteuráil san áitreabh sin a phasteuráil do réir na rialachán sin.
(7) I gcás ina mbeifear tar éis rialacháin a dhéanamh faoi fho-alt (5) den alt seo maidir le háitreabh atá cláraithe i gclár na stáisiún deighílte uachtair, déanfar an bainne deighilte go léir is gá do réir na rialachán sin a phasteuráil san áitreabh sin a phasteuráil do réir na rialachán sin.
(8) I bhfo-ailt (5), (6) agus (7) den alt seo ciallaíonn ‘bainne deighilte’ an chuid sin den bhainne a bhíos fágtha tar éis an gheir nó formhór na geire a bhaint as.
(9) Forléireofar na tagairtí do rialacháin atá i bhfo-ailt (2) agus (3) den alt seo mar thagairtí nach bhfolaíonn tagairtí do rialacháin fhaoi fho-alt (5) den alt seo.”
Clár na mBólacht Creidiúnaithe.
5.—(1) Féadfaidh an tAire clár bólacht a bhunú agus a chothabháil (dá ngairmtear an clár san alt seo) dá ngairmfear Clár na mBólacht Creidiúnaithe.
(2) Bhéarfar bólachta creidiúnaithe ar bhólachta a bheas cláraíthe sa chlár.
(3) Ní thabharfaidh aon duine le tuiscint—
(a) gur bólacht chreidiúnaithe aon bhólacht áirithe mura bhfuil an bhólacht sin cláraithe sa chlár, ná
(b) gur de bhólacht chreidiúnaithe aon bhólacht áirithe muran de bhólacht atá cláraithe sa chlár iad.
(4) Aon duine a shárós fo-alt (3) den alt seo beidh sé ciontach i gcion i gcoinne an Phríomh-Achta.
(5) Féadfaidh an tAire rialacháin do rialú an chláir a dhéanamh lena n-áirítear rialacháin maidir le gach ní no aon ní acu seo a leanas:
(a) clárú d'iarraidh,
(b) cáilíochtaí agus coinníollacha chun cláruithe,
(c) ceanglais a bheas le comhlíonadh chun coimeád ar an gclár,
(d) clárú a chealú,
(e) coimeád an chláir agus fianaise faoina bhfuil ann.
Cúiteamh.
6.—(1) Faoi réir fo-ailt (2) den alt seo, íocfaidh an tAire cúiteamh i mbólacht ar ghlac sé seilbh orthu nó ar glacadh seilbh orthu thar a cheann de bhun aon orduithe de bhuaidh an Achta seo.
(2) Beidh éifeacht ag na forála seo a leanas maidir le cúiteamh in ainmhí faoin alt seo:
(a) is é cúiteamh a híocfar margadh-luach an ainmhí mar chomhaontós únaer an ainmhí agus an tAire nó, mura gcomhaontaítear amhlaidh, a shocrós luachálaí a cheapfas an t-únaer agus an tAire trí chomhaontú nó, mura gcomhaontaítear i dtaobh an luachálaí, a cheapfas an tAire,
(b) d'ainneoin na míre sin roimhe seo, ní bheidh an cúiteamh níos mó ná mar chinnfeas an tAire ó am go ham le toiliú an Aire Airgeadais,
(c) is é an tAire a íocfas táillí aon luachálaí den tsórt sin, faoi réir toiliú an Aire Airgeadais maidir lena méid,
(d) beidh teideal ag an Aire an cúiteamh go léir nó cuid de a choimeád siar, más rud é go raibh únaer an ainmhí nó an duine a bhí i bhfeighil an ainmhí ciontach, i mbreithiúnas an Aire, i gcion i gcoinne an Phríomh-Achta maidir leis an ainmhí nó, d'eile, nár ghlac se a dhóthain cúraim chun an eitinn bhólachta a chosc ó leathadh.
(3) I bhfo-alt (2) den alt seo, ciallaíonn “margadh-luach” an praghas d'fhéadfaí le réasún d'fháil ar an ainmhí, díreach sarar ghlac an tAire seilbh air nó sarar glacadh seilbh air thar a cheann, ó cheannaitheoir ar an margadh oscailte nach mbeadh aon eolas aige go raibh an eitinn san ainmhí ná go raibh amhras ann go raibh an eitinn san ainmhí nó go bhféadfadh sé an eitinn a thabhairt do bhólacht ach amháin pé eolas d'fhéadfaí le réasún d'fháil ón ainmhí d'iniúchadh.
Ainmhithe a scrúdú, etc.
7.—(1) Féadfaidh duine údaraithe, ar a údarás a thabhairt ar aird má hiarrtar sin air, gach ní nó aon ní acu seo a leanas a dhéanamh aon tráth réasúnach:
(a) maidir le haon ainmhithe, aon tsórt scrúduithe agus aon tsórt tástála a dhéanamh, agus aon tsórt samplaí a thógáint agus aon tsórt marcanna a chur, is gá do réir réasúin chun críocha an Achta seo nó aon orduithe a déanfar de bhuaidh an Achta seo,
(b) dul isteach ar aon talamh nó in aon áitreabh chun críche aon scrúduithe, tástála, samplála nó marcála den tsórt sin,
(c) a cheangal ar aon duine, is únaer ainmhithe nó duine i bhfeighil ainmhithe nó is únaer nó áititheoir tailte nó áitribh nó is duine atá fostaithe ar thailte nó in áitreabh a raghfar isteach orthu nó ann amhlaidh, pé cúnamh a thabhairt nó déanamh do réir pé treoracha is gá le réasún chun críche aon scrúduithe, tástála, samplála nó marcála den tsórt sin nó pé eolas a thabhairt is gá le reasún chun an tAcht seo nó aon ordú a déanfar de bhuaidh an Achta seo a riaradh.
(2) Aon duine—
(a) a bhacfas nó a choiscfeas duine údaraithe agus é ag feidhmiú aon chumhachta a bheirtear leis an alt seo,
(b) a gceanglófar air faoin alt seo aon chúnamh a thabhairt nó déanamh do réir aon treorach ar feadh a chumhachta agus a dhiúltós nó a mhainneos an cúnamh a thabhairt nó déanamh do réir na treorach, nó
(c) a gceanglófar air faoin alt seo aon eolas atá aige a thabhairt agus a dhiúltós nó a mhainneos an t-eolas a thabhairt nó a bhéarfas, go toiliúil nó go faillíoch, eolas bréagach nó eolas míthreorach, beidh sé ciontach i gcion i gcoinne an Phríomh-Achta.
(3) San alt seo—
ciallaíonn “duine údaraithe”—
(a) cigire tréidliachta, nó
(b) tréidlia cláraithe nach cigire tréidliachta,
arna údarú i scríbhinn ag an Aire chun na cumhachta a bheirtear leis an alt seo d'fheidhmiú;
folaíonn “ainmhithe” éanlaithe clóis mar mínítear sin in alt 1 den Acht Eanlaithe Clóis (Galair), 1934 (Uimh. 25 de 1934), arna leasú le halt 2 den Acht um Ghalair Ainmhíthe, 1949 (Uimh. 10 de 1949).
Cosaint.
8.—Ní dhéanfaidh aon ní san Acht seo ná in aon ordú a déanfar de bhuaidh an Achta seo difir d'aon orduithe a rinneadh, roimh an Acht seo a rith, faoi na hAchta um Ghalair Ainmhithe, 1894 go 1954.
Iocaíochtaí, caiteachais agus airgead a fuarthas.
9.—(1) Is as airgead a sholáthrós an tOireachtas a híocfar, a mhéid a cheadós an tAire Airgeadais, na híocaíochtaí a dhéanfas an tAire agus na caiteachais faoina raghaidh sé ag tabhairt éifeachta don Acht seo agus á riaradh.
(2) Aon airgead a gheobhas an tAire faoin Acht seo íocfar isteach sa Stát-Chiste é nó cuirfear chun tairbhe don Stát-Chiste é i pé slí a ordós an tAire Airgeadais.
Orduithe agus rialacháin a leagadh faoi bhráid Tithe an Oireachtais.
10.—Gach ordú agus rialachán a déanfar de bhuaidh an Achta seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir é tar éis a dhéanta agus má dhéanann ceachtar Teach acu sin, laistigh den lá agus fiche a shuífeas an Teach sin tar éis an t-ordú nó an rialachán a leagadh faoina bhráid, rún a rith ag neamhniú an orduithe nó an rialacháin, beidh an t-ordú nó an rialachán ar neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoi.
Gearrtheideal, comhlua agus forléiriú.
11.—(1) Féadfar an tAcht um Ghalair Ainmhithe (Eitinn Bhólachta), 1957, a ghairm den Acht seo.
(2) Féadfar na hAchta um Ghalair Ainmhithe, 1894 go 1957, a ghairm de na hAchta um Ghalair Ainmhithe, 1894 go 1954, agus den Acht seo le chéile.
(3) Léifear agus forléireofar an tAcht seo agus na hAchta um Ghalair Ainmhithe, 1894 go 1954, mar aon ní amháin.

DISEASES OF ANIMALS (BOVINE TUBERCULOSIS) ACT, 1957.
Interpretation.
1.—In this Act
“accredited area” has the meaning specified in paragraph (b) of subsection (1) of section 2;
“clearance area” has the meaning specified in paragraph (a) of subsection (1) of section 2;
“the Minister” means the Minister for Agriculture;
“the Principal Act” means the Diseases of Animals Act, 1894, as amended or adapted by or under subsequent enactments.
Orders in relation to bovine tuberculosis.
2.—(1) The power of making orders conferred by section 22 of the Principal Act and now vested in the Minister shall extend to and include the making by the Minister, where it appears to him to be necessary for the purpose of the progressive eradication of bovine tuberculosis, of all or any of the following orders:
(a) orders declaring areas (in this Act referred to as clearance areas) to be areas in which bovine tuberculosis is to be eradicated;
(b) orders declaring areas (in this Act referred to as accredited areas), being areas in which the Minister is satisfied that bovine tuberculosis is virtually non-existent, to be areas in which bovine tuberculosis has been eradicated;
(c) in relation to any clearance area or accredited area, orders for all or any of the following purposes:
(i) requiring the carrying out of tests of cattle for tuberculosis and the furnishing to the Minister of the results of the tests,
(ii) with respect to cattle affected or suspected of being affected or capable of infecting cattle with tuberculosis—
(I) authorising the taking possession, by agreement, of the cattle by or on behalf of the Minister and their disposal as the Minister thinks fit,
(II) in default of agreement as aforesaid, securing and regulating the removal out of the area or slaughter of the cattle,
(III) securing and regulating isolation and maintenance of the cattle pending their being taken possession of by or on behalf of the Minister or removed out of the area or slaughtered,
(iii) prohibition or restriction of the movement of animals into, out of, through or within the area,
(iv) securing and regulating repair or reconstruction of cow byres or boundary fences,
(v) securing and regulating cleansing and disinfection of premises and removal therefrom and subsequent disposal of dung, litter, fodder or any other thing,
(vi) prohibition or restriction of the movement of any feeding stuff or other material into, out of, or within the area or land or premises in the area,
(vii) securing and regulating effective isolation on land or premises, and prohibition or restriction of movement into or out of land or premises or part thereof, of animals affected or suspected of being affected or capable of infecting cattle with tuberculosis,
(viii) securing and regulating isolation and testing from time to time of cattle brought on to land or premises,
(ix) securing and regulating the keeping of records in relation to cattle and the production and inspection of the records,
(x) specifying, where notices are to be served of requirements under orders made by virtue of this paragraph, the form of notice,
(xi) providing, in cases in which there has been failure to comply with requirements of any such notice, for—
(I) in case the notice requires removal out of the area or slaughter of cattle, the taking possession of the cattle by or on behalf of the Minister, their disposal as the Minister thinks fit and the recovery (without prejudice to any penalty that may have been incurred) of the cost of taking possession of the cattle and of thereafter maintaining them and disposing of them,
(II) in any other case, the carrying out of the requirements of the notice by or on behalf of the Minister and the recovery (without prejudice to any penalty which may have been incurred) of the cost of carrying out the requirements,
(xii) purposes ancillary or incidental to any of the foregoing purposes (including authorisation of entry on land or premises);
(d) orders for all or any of the following purposes:
(i) regulating the transit and lairage of cattle,
(ii) regulating the holding of markets, fairs, exhibitions or sales of animals and the exposure of animals thereat,
(iii) prescribing and regulating the cleansing and disinfection of vehicles, places, pens and fittings used for cattle,
(iv) prescribing the conditions under which cattle may be exported, including designating ports, or parts of ports, or routes for such export,
(v) prescribing and regulating the issue and production of licences respecting movement and removal of cattle and things,
(vi) specifying and regulating tests of animals for tuberculosis,
(vii) prohibition, except with the consent of the Minister, of tests of animals for tuberculosis (not being tests under section 7 of this Act or tests required to be carried out by or under orders made by virtue of this section),
(viii) prohibition, except with the consent of the Minister, of vaccination of cattle against tuberculosis,
(ix) securing and regulating marking of cattle for purposes of identification and prohibition of effacement, obliteration, alteration or removal of any such marking,
(x) purposes ancillary or incidental to any of the foregoing purposes.
(2) A holding situate partly within and partly without any clearance area or accredited area shall be deemed to be wholly within that area, but where a holding is situate wholly or partly within two or more such areas, it shall be deemed to be wholly within the area first declared to be an accredited area or, if no part is within an accredited area, then wholly within the area first declared to be a clearance area.
(3) Tuberculosis shall be a disease for the purposes of sections 43, 44, 65 and 74 of the Principal Act, and also for the purposes of all other sections of that Act (including sections relating to offences and legal proceedings) containing provisions relative to or consequent on the provisions of those sections and the orders made by virtue of this section.
Slaughter and compensation in areas other than clearance and accredited areas.
3.—(1) The Minister, if he so thinks fit, may give public notice in such manner as he considers suitable of his intention to make an order under which a specified area will be a clearance area.
(2) Where notice is given under this section in relation to an area, the Minister, with the consent of the Minister for Finance, may, with respect to that area, pay compensation for cattle which, having failed to pass a test for tuberculosis approved of by the Minister, are slaughtered by arrangement between the Minister and the owner of the cattle.
Pasteurising of separated milk.
4.—Section 30 of the Dairy Produce Act, 1924 (No. 58 of 1924), is hereby amended by the addition thereto of the following subsections:
“(5) The Minister may make regulations requiring that all or any premises registered in the register of creameries or all or any premises registered in the register of cream separating stations shall be equipped with plant for pasteurising separated milk, and may by such regulations prescribe the mode and manner in all respects of pasteurising separated milk and the records to be kept in relation thereto and require the retention of such records for inspection and their being made available for inspection.
(6) Where regulations have been made under subsection (5) of this section in respect of premises registered in the register of creameries, all separated milk required by those regulations to be pasteurised on those premises shall be pasteurised in accordance with such regulations.
(7) Where regulations have been made under subsection (5) of this section in respect of premises registered in the register of cream separating stations, all separated milk required by those regulations to be pasteurised on those premises shall be pasteurised in accordance with such regulations.
(8) In subsections (5), (6) and (7) of this section ‘separated milk’ means that part of milk remaining after removal therefrom of the fat, or most of the fat.
(9) The references to regulations contained in subsections (2) and (3) of this section shall be construed as not including references to regulations under subsection (5) of this section.”
Register of Accredited Herds.
5.—(1) The Minister may set up and maintain a register of herds of cattle (in this section referred to as the register) to be known as the Register of Accredited Herds.
(2) Herds of cattle registered in the register shall be known as accredited herds.
(3) A person shall not—
(a) hold out a herd of cattle as being an accredited herd unless it is registered in the register, or
(b) hold out cattle as being of an accredited herd unless they are of a herd registered in the register.
(4) A person who contravenes subsection (3) of this section shall be guilty of an offence against the Principal Act.
(5) The Minister may make regulations governing the register, including regulations with respect to all or any of the following matters:
(a) application for registration,
(b) qualifications and conditions for registration,
(c) requirements to be complied with for retention of registration,
(d) cancellation of registration,
(e) custody of the register and evidence of the contents thereof.
Compensation.
6.—(1) The Minister shall, subject to subsection (2) of this section, pay compensation for cattle taken possession of by him or on his behalf pursuant to any order made by virtue of this Act.
(2) The following provisions shall have effect in relation to compensation under this section for an animal:
(a) the compensation shall be the market value of the animal as agreed upon between the owner of the animal and the Minister or, in default of such agreement, as fixed by a valuer appointed by agreement between the owner and the Minister or, in default of agreement as to the valuer, appointed by the Minister,
(b) notwithstanding the foregoing paragraph, the compensation shall not exceed such limit as may from time to time be determined by the Minister with the consent of the Minister for Finance,
(c) the fees of any such valuer shall, subject to the consent of the Minister for Finance with respect to their amount, be paid by the Minister,
(d) the Minister shall be entitled to withhold the compensation, wholly or partially, where, in the judgment of the Minister, the owner, or the person having charge, of the animal has been guilty in relation to the animal of an offence against the Principal Act or otherwise has not taken adequate precautions to prevent the spread of bovine tuberculosis.
(3) In subsection (2) of this section “market value” means the price which might reasonably have been obtained for the animal, immediately before the taking possession thereof by or on behalf of the Minister, from a purchaser in the open market who had no knowledge that the animal was affected or suspected of being affected or capable of infecting cattle with tuberculosis except such knowledge as might reasonably have been obtained by inspection of the animal.
Examination of animals, etc.
7.—(1) An authorised person, on production, if requested, of his authorisation, may at all reasonable times do all or any of the following things:
(a) with respect to any animals, make any such examinations, apply any such tests, take any such samples and apply any such marks as may be reasonably necessary for the purposes of this Act or any order made by virtue of this Act,
(b) enter on any land or premises for the purpose of any such examining, testing, sampling or marking,
(c) require any person, being the owner or in charge of animals or the owner or occupier of or employed on lands or premises so entered, to give any such assistance or to carry out any such instructions as may be reasonably necessary for the purpose of any such examining, testing, sampling or marking or to give any such information as may be reasonably necessary for the administration of this Act or any order made by virtue of this Act.
(2) Any person—
(a) who obstructs or impedes an authorised person in the exercise of any power conferred by this section,
(b) who, being required under this section to give any assistance or carry out any instruction within his power, refuses or fails to give the assistance or carry out the instruction, or
(c) who, being required under this section to give any information within his knowledge, refuses or fails to give the information or wilfully or negligently gives false or misleading information, shall be guilty of an offence against the Principal Act.
(3) In this section—
“authorised person” means—
(a) a veterinary inspector, or
(b) a registered veterinary surgeon other than a veterinary inspector,
authorised by the Minister in writing to exercise the powers conferred by this section;
“animals” includes poultry as defined in section 1 of the Poultry (Diseases) Act, 1934 (No. 25 of 1934), as amended by section 2 of the Diseases of Animals Act, 1949 (No. 10 of 1949).
Saver.
8.—Nothing in this Act or any order made by virtue of this Act shall affect any orders made before the passing of this Act under the Diseases of Animals Acts, 1894 to 1954.
Payments, expenses and moneys received.
9.—(1) The payments made and expenses incurred by the Minister in giving effect to this Act and in the administration thereof shall, to such extent as may be sanctioned by the Minister for Finance, be defrayed out of moneys provided by the Oireachtas.
(2) Moneys received by the Minister under this Act shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance shall direct.
Laying of orders and regulations.
10.—Every order and regulation made by virtue of this Act shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the order or regulation is passed by either such House within the next twenty-one days on which that House has sat after the order or regulation is laid before it, the order or regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Short title, collective citation and construction.
11.—(1) This Act may be cited as the Diseases of Animals (Bovine Tuberculosis) Act, 1957.
(2) The Diseases of Animals Acts, 1894 to 1954, and this Act may be cited together as the Diseases of Animals Acts, 1894 to 1957.
(3) This Act shall be read and construed as one with the Diseases of Animals Acts, 1894 to 1954.
