AGUS DE BHRÍ gur chinn Dáil Éireann le rún, an 24adh lá d'Eanair, 1923, go lomhálfí suim £30 sa mhí do gach duine dá baill i gcóir costaisí agus go dtabharfí dho saoráidí den chéad ghrád chun taisteal do dhéanamh ar an mbóthar iarainn idir Bhaile Atha Cliath agus a dháilcheanntar gan íoc as:

AGUS DE BHRÍ go bhfuil sé oiriúnach soláthar do dhéanamh do réir Airtiogail 23 sin den Bhunreacht chun na liúntaisí a luaidhtear sna Rúin sin d'íoc le baill den Oireachtas agus chun saoráidí chun taisteal gan íoc as do sholáthar dóibh do réir na Rún gcéanna:

ACHTUIGHEADH OIREACHTAS SHAORSTÁIT ÉIREANN AR AN ÁBHAR SAN MAR LEANAS:—

Baill den Oireachtas d'fháil liúntais agus saoraidí taistil.

1.—Beidh gach ball den Oireachtas i dteideal, fé réir forálacha an Achta so, an liúntas agus na saoráidí taistil a áirítear san Acht so d'fháil agus iad d'íoc leis as airgead a sholáthróidh an tOireachtas.

Méid an liúntais do bhaill den Oireachtas.

2.—(1) Isé liúntas a íocfar le gach ball den Oireachtas fén Acht so ná liúntas do réir £30 sa mhí.

(2). An tuarastal a bheidh do bhall den Oireachtas de thurus na huaire de bhua aon oifig díobh so a leanas do bheith ar seilbh aige, sé sin le rá—

(a) Ceann Comhairle Dháil Éireann,

[EN]

(b) Leas-Cheann Comhairle Dháil Éireann,

[EN]

(c) Cathaoirleach Sheanaid Éireann,

[EN]

(d) Leas-Chathaoirleach Sheanaid Éireann,

(e) Uachtarán na hArd-Chomhairle,

(f) Aon oifig go bhfuil a sealbhaíocht ag brath ar an móráireamh i nDáil Éireann d'fhanúint ina dtaca le hUachtarán na hArd-Comhairle,

(g) Aon oifig go bhfuil a sealbhaíocht ag brath ar théarma saoil aon Dála áirithe,

tuigfear é do bheith ag folú an liúntais a bheadh le n’ íoc leis an mball san fén Acht so agus, dá réir sin, faid a bheidh aon bhall den Oireachtas ag fáil tuarastail mar gheall ar aon cheann de sna hoifigí roimh-ráite, ní bheidh sé i dteideal aon liúntais thairis sin fén Acht so.

Cur síos ar shaoráidí taistil do bhaill den Oireachtas.

3.—(1) Isiad saoráidí taistil a gheobhaidh gach ball den Oireachtas fén Acht so ná—

(a) i gcás ball de Dháil Éireann, saoráidí taistil, mar a mínítear leis an Acht so, idir Bhaile Atha Cliath agus aon áit sa dáilcheanntar dar ball é, agus

[EN]

(b) i gcás ball de Sheanad Éireann, saoráidí taistil, mar a mínitear leis an Acht so, idir Bhaile Atha Cliath agus an áit 'na mbeidh gnáth-chomhnaí air de thuras na huaire: Ach an áit chomhnaithe sin do bheith i Saorstát Éireann ach amháin in aon chás gur deimhin leis an Aire Airgid go bhfuil nithe fé leith i Saorstát Éireann is leor do réir réasúin chun an ball san do chosc de thuras na huaire ar chomhnaí do dhéanamh i Saorstát Éireann agus do dhéanfadh é do bheith dleathach saoráidí do lomháil don bhall san, go hiomlán no go leathrannach, chun taisteal do dhéanamh chun na háite no ón áit ina mbeadh comhnaí air.

(2) Soláthrófar na saoráidí taistil roimh-ráite agus íocfar asta ar pé cuma a ordófar ó am go ham le rialacháin a dhéanfidh an tAire Airgid tar éis comhairle do ghlaca le Ceann Comhairle Dháil Éireann agus le Cathaoirleach Sheanaid Éireann.

An t-am a tosnófar ar liúntaisí agus saoráidí taistil d'íoc.

4.—An liúntas atá le n' íoc le gach ball den Oireachtas agus na saoráidí taistil atá le fáil aige fén Acht so, tosnóid agus beid iníoctha leis (fé réir na bhforálacha den Acht so i dtaobh balla i seilbh oifigí áirithe) ón lá a thug no a thabharfa sé an mhóid tar éis na huaire is déanaí a toghadh chun an Oireachtais é.

Foráil i gcóir balla do coisceadh no a coiscfar tré bhreoiteocht, etc., ar an móid do thabhairt.

5.—(1) Má dineadh aon bhall den Oireachtas, a toghadh chun an Oireachtais roimh rith an Achta so, do chosc ar an móid do thabhairt an chéad lá tar éis a thoghtha a shuidh an Tigh chun ar toghadh é agus gurb é rud a choisc air é ná breoiteacht no rud éigin eile nárbh í a thoil ná a chionta féin fé ndeár é, agus má thug no má thugann sé an mhóid an chéad lá a shuidh no a shuidfidh an Tigh sin tar éis deire do bheith leis an mbreoiteacht san no le haon rud eile den tsórt san roimh-ráite, tuigfar chun crícheanna an Achta so gur thug an ball san an mhóid an chéad lá, tar éis a thoghtha, do shuidh an Tigh sin.

(2) Má dintar aon bhall den Oireachtas, a toghfar chun an Oireachtais tar éis rith an Achta so, do chosc ar an móid do thabhairt an chéad lá tar éis a thoghtha a shuidfidh an Tigh chun ar toghadh é agus gurb é rud a choiscfidh air é ná breoiteacht, no rud éigin eile nách í a thoil ná a chionta féin fé ndéar é, agus má thugann sé an mhóid an chéad lá a shuidhfidh an Tigh sin tar éis deire do bheith leis an mbreoiteacht san no le haon rud eile den tsórt san roimh-ráite tuigfar chun crícheanna an Achta so gur thug an ball san an mhóid sin an chéad lá do shuidh an Tigh sin tar éis a thoghtha chun an Tighe sin.

(3) Má eiríonn aon cheist no aighneas i dtaobh ce'ca tá no ná fuil no i dtaobh a mhéid atá ball den Oireachtas i dteideal chun sochar an ailt seo socrófar an cheist no an t-aighneas san—

(a) i gcás ball de Dhá l Éireann ag an gCeann Comhairle, agus

(b) i gcás ball de Sheanad Éireann, ag an gCathaoirleach,

agus ní bheidh dul thar socrú an Chinn Chomhairle no an Chathaoirligh (pe'ca aca san e) in aon chás den tsórt san.

6.—(1) San Acht so—

cialluíonn an abairt “saoráidí taistil” soláthar chun taisteal céad-ghráid do dhéanamh ar bhóithre iarainn gan íoc as agus aisíoc pé costaisí taistil eile gur deimhin leis an Aire Airgid gur rud réasúnta dul fútha;

THE OIREACHTAS (PAYMENT OF MEMBERS) ACT, 1923.


AN ACT TO PROVIDE FOR THE PAYMENT OF ALLOWANCES TO MEMBERS OF THE OIREACHTAS AND TO AUTHORISE THE PROVISION OF CERTAIN FREE TRAVELLING FACILITIES FOR SUCH MEMBERS. [18th June, 1923.] WHEREAS it is enacted by Article 23 of the Constitution of Saorstát Eireann that the Oireachtas shall make provision for the payment of its members and may in addition provide them with free travelling facilities in Ireland:

AND WHEREAS on the 10th day of January, 1923, Seanad Eireann resolved that the remuneration payable to members of Seanad Eireann should be the same as might be fixed by Dáil Eireann for its members and that first class vouchers or season tickets to or from the houses of Senators should be provided:

AND WHEREAS on the 24th day of January, 1923, Dáil Eireann resolved that each of its members should be allowed a sum of £30 per month towards expenses and be provided with free first class railway travelling facilities between Dublin and his constituency:

AND WHEREAS it is expedient that provision should be made pursuant to the said Article 23 of the Constitution for the payment to members of the Oireachtas of the allowances mentioned in the said Resolutions and for providing them with free travelling facilities in accordance with the same Resolutions:

BE IT THEREFORE ENACTED BY THE OIREACHTAS OF SAORSTAT EIREANN AS FOLLOWS:—

Members of the Oireachtas to receive allowance and travelling facilities.

1.—Each member of the Oireachtas shall, subject to the provisions of this Act, be entitled to receive and be paid out of moneys to be provided by the Oireachtas the allowance and travelling facilities specified in this Act.

Amount of allowance to members of the Oireachtas.

2.—(1) The allowance to be paid to each member of the Oireachtas under this Act shall be an allowance at the rate of £30 a month.

[GA]

(2) The salary for the time being payable to a member of the Oireachtas by virtue of his holding any of the offices following, that is to say—

(a) Ceann Comhairle of Dáil Eireann,

[GA]

(b) Leas-Cheann Comhairle of Dáil Eireann,

[GA]

(c) Cathaoirleach of Seanad Eireann,

[GA]

(d) Leas-Chathaoirleach of Seanad Eireann,

[GA]

(e) President of the Executive Council,

[GA]

(f) Any office the tenure of which is dependent on the President of the Executive Council retaining the support of a majority in Dáil Eireann,

[GA]

(g) Any office the tenure of which is dependent on the term of existence of a particular Dáil Eireann,

[GA]

shall be deemed to include the allowance payable to such member under this Act and accordingly no member of the Oireachtas shall, while he is in receipt of salary in respect of any of the offices aforesaid, be entitled to any further allowance under this Act.

Particulars of travelling facilities for members of the Oireachtas.

3.—(1) The travelling facilities to be received by each member of the Oireachtas under this Act shall be—

(a) in the case of a member of Dáil Eireann, travelling facilities as defined by this Act between Dublin and any place in the constituency for which he is a member, and

[GA]

(b) in the case of a member of Seanad Eireann, travelling facilities as defined by this Act between Dublin and his usual place of residence for the time being: Provided that such place of residence be in Saorstát Eireann unless in any case in which the Minister for Finance shall be satisfied that special circumstances existing in Saorstát Eireann reasonably deter such member from residence for the time being in Saorstát Eireann and justify the allowance in whole or part of travelling facilities to or from such member's actual place of residence.

(2) The travelling facilities aforesaid shall be provided and paid in such manner as shall from time to time be prescribed by regulations to be made by the Minister for Finance after consultation with the Ceann Comhairle of Dáil Eireann and the Cathaoirleach of Seanad Eireann.

Commencement of allowances and travelling facilities.

4.—The allowance and travelling facilities to be paid to and received by each member of the Oireachtas under this Act shall (subject to the provisions of this Act in relation to members holding certain offices) commence and be payable as from the day on which he took or shall take the oath next after his then last election to the Oireachtas.

Provision for members prevented by illness, etc., from taking the oath.

5.—(1) If any member of the Oireachtas who was elected thereto before the passing of this Act was prevented by illness or by some other involuntary and innocent cause from taking the oath on the first day on which the House to which he was elected sat after his election, and has taken or shall take the oath on the first day on which such House sat or shall sit after such illness or such other cause as aforesaid ceased or shall cease, such member shall be deemed for the purposes of this Act to have taken the oath on the first day on which such House sat after he was elected.

(2) If any member of the Oireachtas who shall be elected thereto after the passing of this Act shall be prevented by illness or by some other involuntary and innocent cause from taking the oath on the first day on which the House to which he shall have been elected shall sit after his election, and shall take the oath on the first day on which such House shall sit after such illness or such other cause as aforesaid shall have ceased, such member shall be deemed for the purposes of this Act to have taken the oath on the first day on which such House sat after his election thereto.

(3) If any question or dispute shall arise as to whether, or the extent to which, a member of the Oireachtas is entitled to the benefit of this section such question or dispute shall be determined—

(a) in the case of a member of Dáil Eireann, by the Ceann Comhairle, and

[GA]

(b) in the case of a member of Seanad Eireann, by the Cathaoirleach,

[GA]

and in every such case the determination of the Ceann Comhairle or the Cathaoirleach (as the case may be) shall be final.

Definitions.

6.—(1) In this Act—

the expression “travelling facilities” means the provision of free first class railway travelling and the re-payment of such other travelling expenses as the Minister for Finance shall be satisfied to have been reasonably incurred;

the words “election” and “elected” when used in relation to a member of Seanad Eireann respectively include election and elected by a vote of Seanad Eireann, and when used in relation to a person who became a member of Seanad Eireann before the passing of this Act, also respectively include nomination and nominated;

the expression “the oath” means the oath prescribed by the Constitution of Saorstát Eireann as the oath to be taken by members of the Oireachtas, and the expression “take the oath” and other like expressions mean taking the oath aforesaid in the manner prescribed by the Constitution;

(2) Every member of the present Dáil Eireann who was a member thereof on the 6th day of December, 1922, shall for the purposes of this Act be deemed to have been elected thereto on that day.

7.—This Act may be cited as The Oireachtas (Payment of Members) Act, 1923.
