ACHT UM THOGHACHÁIN ÁITIÚLA (LEASÚ), 1940.

An Príomh-Acht.
1.—San Acht so cialluíonn an abairt “an Príomh-Acht” an tAcht um Thoghacháin Áitiúla, 1937 (Uimh. 14 de 1937).
Léiriú agus mínithe.
2.—(1) Déanfar an tAcht so agus an Príomh-Acht do léigheamh agus do léiriú mar éinní amháin.
(2) San Acht so cialluíonn an abairt “an tAire” an tAire Riaghaltais Aiteamhail agus Sláinte Poiblidhe.
(3) Beidh gach cólucht is údarás áitiúil chun crícheanna Coda II den Phríomh-Acht, agus fós (ach sa leasú deintear leis an Acht so ar alt 5 den Phríomh-Acht) comhairle chontae-bhuirge Chorcaighe, ina údarás áitiúil chun crícheanna an Achta so, agus is dá réir sin a léireofar an abairt “údarás áitiúil” san Acht so.

3.—(1) Deintear leis seo alt 5 den Phríomh-Acht do leasú tré fho-alt (1) den alt san do scriosadh agus tríd an bhfo-alt so leanas do chur san alt san in ionad an fho-ailt a scriostar amhlaidh, sé sin le rá:—
“(1) Déanfaidh an tAire le hordú, roimh an 30adh lá de Mheán Fhómhair, 1941, lá nach déanaighe ná an 30adh lá san de Mheán Fhómhair, 1941, do cheapadh, maidir le gach údarás áitiúil, chun bheith ina lá cheaptha chun crícheanna na Coda so den Acht so alos an údaráis áitiúil sin.”
(2) Déanfar Cuid II den Phríomh-Acht (le n-a n-áirmhítear alt 5 di) do léiriú ag féachaint go cuibhe don leasú dheineann an fo-alt san roimhe seo den alt so ar an alt san 5 agus, chun lán-éifeacht do thabhairt don leasú san, déanfar an dáta an 30adh lá de Mheán Fhómhair, 1941, do chur in ionad an dáta an 30adh lá de Mheán Fhómhair, 1940, san áit ina luaidhtear, i bhfo-alt (3) den alt san 5 agus i bhfo-alt (2) d'alt 7 den Phríomh-Acht, an dáta san is déanaighe luaidhtear.

4.—(1) Deintear leis seo alt 16 den Phríomh-Acht do leasú tré fho-alt (1) den alt san do scriosadh agus tríd an bhfo-alt so leanas do chur san alt san in ionad an fho-ailt a scriostar amhlaidh, sé sin le rá:—
“(1) Déanfaidh an tAire le hordú, roimh an 30adh lá de Mheán Fhómhair, 1941, lá nach déanaighe ná an 30adh lá san de Mheán Fhómhair, 1941, do cheapadh chun bheith ina lá cheaptha chun crícheanna na Coda so den Acht so alos na Comhairle.”
(2) Déanfar Cuid III den Phríomh-Acht (le n-a n-áirmhítear alt 16 di) do léiriú ag féachaint go cuibhe don leasú dheineann an fo-alt san roimhe seo den alt so ar an alt san 16.
Cruinnithe d'údaráis áitiúla i 1940.
5.—(1) Beidh an bhliain 1940, maidir le gach údarás áitiúil le n-a mbaineann alt 8 no alt 9 no alt 10 den Acht um Thoghacháin Áitiúla, 1927 (Uimh. 39 de 1927), agus is tuigthe í bheith riamh ina bliain ná comórfar aon toghachán cinn trí mblian chun daoine do thoghadh chun an údaráis áitiúil sin.
(2) Chun deireadh do chur le hamhrais, dearbhuítear agus achtuítear leis seo ná beidh aon chruinniú d'údarás áitiúil, ná éinní do rinneadh ag cruinniú d'údarás áitiúil, le n-a mbaineann alt 8 no alt 9 no alt 10 den Acht um Thoghacháin Áitiúla, 1927 (Uimh. 39 de 1927), agus a comóradh roimh an Acht so do rith ar dháta do bheadh, fén alt san aca san a bhaineann leis an gcás, ina dháta cheart chun an chruinnithe sin do chomóradh dá mbeadh an tAcht so i bhfeidhm an tráth san, nea-dhleathach ná ionchonspóidthe ar an bhforas go raibh an bhliain 1940, an tráth a comóradh an cruinniú san, ina bliain inar ghá do réir dlí toghachán cinn trí mblian do chomóradh chun daoine do thoghadh chun an údaráis áitiúil sin.
Comhacht chun deacrachtaí do réiteach.
6.—Má eirigh no más deallrathach dar leis an Aire go n-eireoidh aon deacracht, maidir le cruinniú ar bith d'aon údarás áitiúil no d'aon chólucht eile do chomóradh, de bhíthin aon leasuithe dheineann an tAcht so ar an bPríomh-Acht no de bhíthin aon fhorála eile den Acht so, féadfaidh an tAire, le hordú, aon ní no rud do dhéanamh a chífear dó do bheith riachtanach chun gur féidir an cruinniú san do chomóradh no chun an údaráis áitiúil no an chóluchta eile sin do chó-dhéanamh i gceart no chun dleathacht do thabhairt do nós imeachta an údaráis áitiúil no an chóluchta eile sin no chun na deacrachta san do réiteach ar shlí eile (do réir mar a bheidh) agus féadfaidh, leis an ordú san, aon oiriúnuithe no atharuithe is gá do dhéanamh ar aon reacht no ordú no rialachán.

7.—(1) Féadfar an tAcht um Thoghacháin Áitiúla (Leasú), 1940, do ghairm den Acht so.
(2) Féadfar na hAchtanna um Thoghacháin Áitiúla, 1937 agus 1940, do ghairm den Phríomh-Acht agus den Acht so le chéile.

LOCAL ELECTIONS (AMENDMENT) ACT, 1940.
The Principal Act.
1.—In this Act the expression “the Principal Act” means the Local Elections Act, 1937 (No. 14 of 1937).
Construction and definitions.
2.—(1) This Act shall be read and construed as one with the Principal Act.
(2) In this Act the expression “the Minister” means the Minister for Local Government and Public Health.
(3) Every body which is a local authority for the purposes of Part II of the Principal Act and also (except in the amendment made by this Act of section 5 of the Principal Act) the council of the county borough of Cork shall be a local authority for the purposes of this Act, and the expression “local authority” shall be construed accordingly in this Act.
Amendment of sections 5 and 7 of the Principal Act.
3.—(1) Section 5 of the Principal Act is hereby amended by the deletion of sub-section (1) of that section and the insertion in the said section of the following sub-section in lieu of the sub-section so deleted, that is to say:—
“(1) The Minister shall, before the 30th day of September, 1941, by order appoint in respect of every local authority a day not later than the 30th day of September, 1941, to be the appointed said day for the purposes of this Part of this Act in respect of such local authority.”
(2) Part II of the Principal Act (including section 5 thereof) shall be construed with due regard to the amendment made in the said section 5 by the foregoing sub-section of this section and, for the purpose of giving full effect to that amendment, the date the 30th day of September, 1941, shall be substituted for the date the 30th day of September, 1940, where the latter date is mentioned in sub-section (3) of the said section 5 and in sub-section (2) of section 7 of the Principal Act.
Amendment of section 16 of the Principal Act.
4.—(1) Section 16 of the Principal Act is hereby amended by the deletion of sub-section (1) of that section and the insertion in the said section of the following sub-section in lieu of the sub-section so deleted, that is to say:—
“(1) The Minister shall, before the 30th day of September, 1941, by order appoint a day not later than the said 30th day of September, 1941, to be the appointed day for the purposes of this Part of this Act in respect of the Council.”
(2) Part III of the Principal Act (including section 16 thereof) shall be construed with due regard to the amendment made in the said section 16 by the foregoing sub-section of this section.
Meetings of local authorities in 1940.
5.—(1) The year 1940 shall, in relation to every local authority to which section 8 or section 9 or section 10 of the Local Elections Act, 1927 (No. 39 of 1927), applies, be and be deemed always to have been a year in which no triennial election to such local authority is to be held.
(2) In order to remove doubts it is hereby declared and enacted that no meeting and nothing done at a meeting of a local authority to which section 8, section 9, or section 10 of the Local Elections Act, 1927 (No. 39 of 1927), applies held before the passing of this Act on a date which would, under whichever of those sections is applicable, have been a proper date for the holding of such meeting if this section had then been in force, shall be invalid or be questioned on the ground that when such meeting was held the year 1940 was a year in which a triennial election to such local authority was required by law to be held.
Power to resolve difficulties.
6.—Where any difficulty has arisen or is, in the opinion of the Minister, likely to arise in regard to the holding of any meeting of any local authority or other body by reason of any amendment of the Principal Act made by this Act or by reason of any other provision of this Act, the Minister may by order do any matter or thing which shall appear to him to be necessary (as the case may be) to enable such meeting to be held, or to constitute properly such local authority or other body, or to validate the procedure of such local authority or other body, or otherwise to resolve such difficulty, and may by such order make any necessary adaptations or modifications of any statute, order, or regulation.
Short title and collective citation.
7.—(1) This Act may be cited as the Local Elections (Amendment) Act, 1940.
(2) The Principal Act and this Act may be cited together as the Local Elections Acts, 1937 and 1940.
