AN tACHT RIALTAIS ÁITIÚIL (PLEANÁIL AGUS FORBAIRT), 1982

Léiriú.
1.—San Acht seo—
ciallaíonn “Acht 1976” an tAcht Rialtais Áitiúil (Pleanáil agus Forbairt), 1976;
ciallaíonn “deimhniú forbartha” deimhniú arna eisiúint faoi alt 29 d'Acht 1976;
ciallaíonn “fógra tarscaoilidh” fógra arna eisiúint faoi alt 29 d'Acht 1976.
Teorainn le ré cead pleanála.
2.—(1) Faoi réir fho-alt (2) den alt seo, aon chead a tugadh faoi Chuid IV den Phríomh-Acht roimh dháta an Achta seo a rith nó dá éis sin, scoirfidh sé, ar éag don tréimhse iomchuí (ach sin gan dochar do bhailíocht aon ní a rinneadh dá bhun roimh éag don tréimhse sin), d'éifeacht a bheith leis—
(a) i gcás gan an fhorbairt lena mbaineann an cead a bheith tosaithe i rith na tréimhse sin, maidir leis an bhforbairt go léir, agus
(b) i gcás an fhorbairt sin a bheith tosaithe i rith na tréimhse sin, maidir leis an méid sin di nach mbeidh críochnaithe laistigh den tréimhse sin.
(2) (a) Ní bheidh feidhm ag fo-alt (1) den alt seo—
(i) maidir le cead ar bith aon déanmhas a choinneáil ar thalamh,
(ii) maidir le cead ar bith arna thabhairt ar feadh tréimhse teoranta amháin nó faoi réir coinníll de chineál a thuairiscítear in alt 26 (2) (j) nó 27 (2) (f) den Phríomh-Acht,
(iii) maidir le cead ar bith d'aicme nó de thuairisc a shonraítear i rialacháin arna ndéanamh ag an Aire chun críocha an ailt seo,
(iv) i gcás teach, siopa, oifig nó foirgneamh eile atá críochnaithe é féin, i ndáil le soláthar aon déanmhais nó oibreacha atá ar áireamh sa chead iomchuí agus atá riachtanach nó cumhalda nó foghabhálach i ndáil le húsáid an fhoirgnimh de réir an cheada sin,
(v) i gcás forbairt a chuimsíonn uimhir foirgneamh nach bhfuil ach cuid acu críochnaithe, i ndáil le bóithre, seirbhísí agus spásanna oscailte a sholáthar atá ar áireamh sa chead iomchuí agus atá riachtanach nó cumhalda i ndáil leis na foirgnimh chríochnaithe sin.
(b) Ní dhéanfaidh fo-alt (1) den alt seo difear—
(i) do leanúint de thalamh a úsáid ar aon slí, de réir ceada,
(ii) i gcás ina mbeidh forbairt críochnaithe (an oiread sin a thuairiscítear i mír (a) den fho-alt seo nó ar a mhalairt de dhóigh), don oibleagáid a bheidh ar aon duine aon choinníoll a chomhlíonadh a ghabhann leis an gcead iomchuí lena gceanglaítear rud éigin a dhéanamh nó a fhágáil gan déanamh.
(3) (a) I gcás ina mbeartófar rialacháin a dhéanamh faoin alt seo, cuirfidh an tAire faoi deara go leagfar dréacht díobh faoi bhráid dhá Theach an Oireachtais agus ní dhéanfar na rialacháin go dtí go mbeidh rún ag ceadú an dréachta rite ag gach Teach díobh sin.
(b) Ní bheidh feidhm ag alt 10 (2) den Phríomh-Acht maidir le rialacháin a dhéanfar faoin alt seo.
(4) Measfar gur tháinig an t-alt seo i ngníomh an 1ú lá de Shamhain 1981.
(5) San alt seo agus in alt 4 den Acht seo, ciallaíonn “an tréimhse iomchuí”—
(a) i ndáil le cead ar bith a tugadh roimh an 1ú lá de Shamhain, 1976, an tréimhse dar thosach an dáta a tugadh an cead sin agus dar críoch an 31ú lá de Dheireadh Fómhair, 1983,
(b) i ndáil le cead ar bith a tugadh nó a thugtar tráth nach túisce ná an 1ú lá de Shamhain, 1976, nó nach déanaí ná an 31ú lá de Dheireadh Fómhair, 1982—
(i) i gcás, i ndáil leis an gcead, go sonraítear tréimhse de bhun alt 3 den Acht seo, an tréimhse sin, agus
(ii) in aon chás eile, an tréimhse dar críoch an lá ar lá é seacht mbliana tar éis an dáta ar tugadh an cead sin nó an 31ú lá de Dheireadh Fómhair, 1987, cibé acu is túisce,
(c) maidir le cead ar bith a tugadh nó a thugtar an 1ú lá de Shamhain, 1982, nó dá éis—
(i) i gcás, i ndáil leis an gcead, go sonraítear tréimhse de bhun alt 3 den Acht seo, an tréimhse sin, agus
(ii) in aon chás eile, an tréimhse cúig bliana dar thosach an dáta a tugadh an cead sin:
Ar choinníoll, i gcás ina mbeidh údarás pleanála, roimh thosach feidhme an ailt seo, tar éis ordú a dhéanamh faoi alt 29 (9) d'Acht 1976 agus de bhua an ordaithe go scoirfeadh an cead lena mbaineann an t-ordú, dá mba rud é nár achtaíodh an t-alt seo, d'éifeacht a bheith leis ar dháta is déanaí ná an dáta ar a scoirfeadh sé, ar leith ón gcoinníoll seo, d'éifeacht a bheith leis, ansin, d'ainneoin na bhforálacha sin roimhe seo den alt seo agus alt 15 den Acht seo, go dtiocfaidh an tréimhse iomchuí maidir leis an gcead chun críche ar an dáta is déanaí sin.
(6) Ní dhéanfaidh údarás pleanála, i bhfeidhmiú na cumhachta a thugtar dóibh le halt 3 den Acht seo i ndáil le cead dá dtagraítear i bhfo-alt (5) (b) den alt seo, an chumhacht a fheidhmiú chun tréimhse a shonrú ar tréimhse í is giorra ná an tréimhse a mbeadh feidhm aici, de bhua an fho-ailt sin (5) (b), i ndáil leis an gcead dá mba rud é nár feidhmíodh an chumhacht amhlaidh.
Cumhacht tréimhse iomchuí a athrú.
3.—Gan dochar do na cumhachtaí a thugtar dóibh le Cuid IV den Phríomh-Acht cead a thabhairt talamh a fhorbairt ar feadh tréimhse teoranta amháin, féadfaidh údarás pleanála nó an Bord, de réir mar is iomchuí, nuair a bheidh siad ag cinneadh cead a thabhairt faoi alt 26 den Phríomh-Acht, agus tar éis féachaint do chineál agus do mhéid na forbartha iomchuí agus d'aon ní ábhartha eile, an tréimhse a shonrú, ar tréimhse í is faide ná cúig bliana, ina mbeidh éifeacht leis an gcead agus i gcás ina bhfeidhmeoidh an t-údarás pleanála an chumhacht a thugtar dóibh leis an alt seo, nó ina ndiúltóidh siad í a fheidhmiú, measfar gur cuid de chinneadh iomchuí an údaráis sin faoin alt sin 26 an feidhmiú nó an diúltú sin.
Cumhacht tréimhse iomchuí a shíneadh.
4.—(1) Ar iarratas a dhéanamh chucu chun na críche sin, déanfaidh údarás pleanála, maidir le cead áirithe, an tréimhse iomchuí a shíneadh feadh cibé tréimhse bhreise a mheasfaidh an t-údarás is gá chun go bhféadfar an fhorbairt lena mbaineann an cead a chríochnú, má chomhlíontar, agus ar an gcoinníoll amháin go gcomhlíonfar, gach ceann de na ceanglais seo a leanas:
(a) go mbeidh an t-iarratas de réir cibé rialacháin faoin Acht seo a bhainfidh leis,
(b) go gcomhlíonfar aon cheanglais de chuid na rialachán sin, nó aon cheanglais a dhéanfar fúthu, maidir leis an iarratas, agus
(c) gur deimhin leis an údarás i ndáil leis an gcead—
(i) gur thosaigh an fhorbairt lena mbaineann an cead sin roimh éag don tréimhse iomchuí atáthar ag iarraidh a shíneadh, agus
(ii) go ndearnadh mór-oibreacha de bhun an cheada sin i rith na tréimhse sin, agus
(iii) go gcríochnófar an fhorbairt laistigh d'achar réasúnach.
(2) Más rud é—
(a) go ndéanfar iarratas go cuí faoin alt seo chun údaráis phleanála,
(b) go gcomhlíonfar aon cheanglais de chuid rialachán faoi alt 11 den Acht seo, nó aon cheanglais arna ndéanamh fúthu, maidir leis an iarratas, agus
(c) nach dtabharfaidh an t-údarás pleanála fógra don iarratasóir faoina gcinneadh maidir leis an iarratas laistigh den tréimhse dhá mhí dar tosach—
(i) i gcás na ceanglais réamhráite ar fad dá dtagraítear i mír (b) den fho-alt seo a bheith comhlíonta an lá, nó roimh an lá, a bhfaighidh an t-údarás pleanála an t-iarratas, an lá sin, agus
(ii) in aon chás eile, an lá a mbeidh na ceanglais sin ar fad comhlíonta,
faoi réir alt 10 (2) den Acht seo, i gcás cinneadh ón údarás pleanála an tréimhse, arb í an tréimhse iomchuí í maidir leis an gcead iomchuí, a shíneadh nó a shíneadh tuilleadh, de réir mar is iomchuí, feadh cibé tréimhse bhreise a shonrófar san iarratas, measfar an cinneadh sin a bheith tugtha ag an údarás pleanála ar an lá deiridh den tréimhse dhá mhí sin.
(3) (a) I gcás ina dtabharfar cinneadh faoi fho-alt (1) den alt seo tréimhse iomchuí a shíneadh nó ina measfar cinneadh a bheith tugtha de bhun fho-alt (2) den alt seo, ní dhéanfaidh an t-údarás pleanála an tréimhse iomchuí a shíneadh tuilleadh, mura gcomhlíonfar gach ceann de na ceanglais seo a leanas:
(i) go ndéanfar iarratas chucu chun na críche sin de réir cibé rialacháin faoin Acht seo a bhainfidh leis,
(ii) go gcomhlíonfar aon cheanglais de chuid na rialachán sin, nó aon cheanglais arna ndéanamh fúthu, maidir leis an iarratas, agus
(iii) gur deimhin leis an údarás nár críochnaíodh an fhorbairt iomchuí de bharr imthosca nach raibh neart ar bith ag an duine a bhí ag déanamh na forbartha orthu.
(b) Ní dhéanfar tréimhse iomchuí a shíneadh tuilleadh faoin bhfo-alt seo ach amháin feadh cibé tréimhse is dóigh leis an údarás pleanála iomchuí is gá chun go bhféadfar an fhorbairt iomchuí a chríochnú.
(4) Déanfar sonraí faoi aon iarratas chun údaráis phleanála faoin alt seo agus faoi chinneadh an údaráis phleanála i leith iarratas den sórt sin a thaifeadadh ar an taifead iomchuí sa chlár.
(5) I gcás ina dtabharfar cinneadh faoin alt seo tréimhse a shíneadh nó a shíneadh tuilleadh nó ina measfar an cinneadh sin a bheith tugtha de bhun fho-alt (2) den alt seo, déanfar alt 2 den Acht seo, i ndáil leis an gcead lena mbaineann an cinneadh, a fhorléiriú agus beidh éifeacht leis faoi réir agus de réir théarmaí an chinnte.
(6) Ní dhéanfar an t-alt seo a fhorléiriú mar alt a choisceann tréimhse iomchuí a shíneadh nó a shíneadh tuilleadh de bharr an tréimhse do dhul in éag.
Cumhacht a dhearbhú go bhfuil tarchuir, achomhairc agus iarratais tarraingthe siar.
5.—(1) Más dóigh leis an mBord go bhfuil tarchur nó achomharc chun an Bhoird, nó iarratas ar chead nó ar cheadú lena mbaineann achomharc den sórt sin, tréigthe, féadfaidh an Bord fógra a sheirbheáil ar an duine a rinne an tarchur, an t-achomharc nó an t-iarratas, de réir mar is iomchuí, á rá sin agus á cheangal ar an duine sin, laistigh de thréimhse a bheidh sonraithe san fhógra (ar tréimhse í nach giorra ná ceithre lá dhéag dar tosach dáta seirbheála an fhógra) aighneacht i scríbhinn a dhéanamh chun an Bhoird i dtaobh cad chuige nach mbeadh sé le meas gur tarraingíodh siar an tarchur, an t-achomharc nó an t-iarratas, cibé acu é.
(2) I gcás fógra a bheith seirbheáilte faoi fho-alt (1) den alt seo féadfaidh an Bord a dhearbhú, tráth ar bith tar éis an tréimhse a bheidh sonraithe san fhógra do dhul in éag, agus tar éis breithniú a dhéanamh ar an aighneacht (más ann) a rinneadh chun an Bhoird de bhun an fhógra—
(i) i gcás ina dtagróidh an fógra do tharchur, go measfar an tarchur a bheith tarraingthe siar,
(ii) i gcás ina dtagróidh an fógra d'iarratas a thuairiscítear i bhfo-alt (1) den alt seo, go measfar an t-iarratas a bheith tarraingthe siar, agus
(iii) i gcás ina dtagróidh an fógra d'achomharc chun an Bhoird, go measfar an t-achomharc a bheith tarraingthe siar.
(3) I gcás, de bhun an ailt seo, go ndearbhóidh an Bord go measfar iarratas a thuairiscítear i bhfo-alt (1) den alt seo a bheith tarraingthe siar, beidh feidhm ag na forálacha seo a leanas maidir leis an iarratas:
(a) measfar aon achomharc i ndáil leis an iarratas a bheith tarraingthe siar agus, dá réir sin, ní dhéanfaidh an Bord an t-achomharc a chinneadh, agus
(b) d'ainneoin aon chinneadh a bheith déanta roimhe sin faoi alt 26 nó 27 den Phríomh-Acht ag údarás pleanála maidir leis an iarratas, ní thabharfaidh an t-údarás cead ná ceadú ar bith faoi cheachtar de na hailt sin ar scór an iarratais.
(4) I gcás ina ndéanfaidh an Bord dearbhú faoin alt seo, d'ainneoin alt 15 (2) d'Acht 1976, féadfaidh an Bord, más oiriúnach leis, a ordú go ndéanfar an éarlais a bheidh taiscthe i ndáil leis an achomharc iomchuí, nó i ndáil le haon achomharc lena mbaineann an t-iarratas iomchuí, cibé acu é, a fhorghéilleadh don Bhord.
Bailíocht ceadanna agus ceaduithe áirithe.
6.—(1) Aon chead nó ceadú a bheidh tugtha ar achomharc faoi Chuid IV den Phríomh-Acht roimh an 15ú lá de Mhárta, 1977, ní bheidh sé, agus ní mheasfar go raibh sé riamh, neamhbhailí de bhíthin amháin gur sháraigh, nó go sáródh an fhorbairt áirithe, ar mhodh ábhartha, an plean forbartha a bhaineann le limistéar an údaráis phleanála ar lena gcinneadh a bhain an t-achomharc.
(2) Más rud é, de bharr aon cheann nó gach ceann dá fhorálacha, go mbeadh, murach an fo-alt seo, fo-alt (1) den alt seo ar neamhréir le ceart bunreachtúil aon duine, beidh cibé teorainn is gá ag gabháil le forálacha an fho-ailt sin chun a áirithiú nach mbeidh siad ar neamhréir amhlaidh ach, thairis sin, beidh lánfheidhm agus lánéifeacht leo.
Treoracha ginearálta polasaí maidir le pleanáil agus forbairt.
7.—(1) Tabharfaidh an tAire, ó am go ham, cibé treoracha ginearálta is dóigh leis is gá maidir le polasaí i ndáil le pleanáil agus forbairt.
(2) Beidh aird ar aon treoir faoin alt seo ag údarás pleanála agus ag an mBord ag comhlíonadh a fheidhmeanna dó.
(3) Ní fhorléireofar aon ní san alt seo mar ní a chumasaíonn don Aire aon chumhacht nó rialú a fheidhmiú i ndáil le haon chás áirithe a mbeidh baint, nó a bhféadfaidh baint a bheith, ag údarás pleanála nó ag an mBord leis.
(4) Nuair a thabharfaidh an tAire treoir faoin alt seo, beidh feidhm ag na forálacha seo a leanas:
(a) cuirfidh an tAire faoi deara, a luaithe is féidir, cóip den treoir a leagan faoi bhráid gach Tí den Oireachtas,
(b) foilseofar an treoir san Iris Oifigiúil, agus
(c) cuirfidh an tAire faoi deara cóip den treoir a sheoladh go dtí gach údarás pleanála agus go dtí an Bord.
Pionóis áirithe faoin bPríomh-Acht nó faoi Acht 1976 a athrú.
8.—(1) Aon duine a chiontóidh an Chúirt Dúiche i gcion dá bhforáiltear pionós in aon alt den Phríomh-Acht a shonraítear i gcolún (2) den Tábla a ghabhann leis an alt seo ag aon uimhir thagartha dlífear, in ionad an phionóis a fhoráiltear amhlaidh, an pionós a shonraítear i gcolún (3) den Tábla sin ag an uimhir thagartha sin a chur air, agus déanfar an t-alt sin a fhorléiriú agus beidh éifeacht leis dá réir sin.
(2) (a) Aon duine a chiontófar i gcion faoi fho-alt (9) d'alt 32 d'Acht 1976 dlífear, in ionad cibé méid den phionós a shonraítear san fho-alt sin ar fíneáil é, fíneáil nach mó ná £800 a chur air, agus déanfar an fo-alt sin (9) a fhorléiriú agus beidh éifeacht leis dá réir sin.
(b) Aon duine a chiontófar i gcion faoi fho-alt (10) d'alt 33 d'Acht 1976 dlífear, in ionad cibé méid den phionós a shonraítear san fho-alt sin ar fíneáil é, fíneáil nach mó ná £800 a chur air, agus déanfar an fo-alt sin (10) a fhorléiriú agus beidh éifeacht leis dá réir sin.
(3) Aon duine a bheidh ciontach i gcion faoi alt 24 (3) den Phríomh-Acht nó faoi alt 26 (4) d'Acht 1976 dlífear, ar é a chiontú ar díotáil, fíneáil nach mó ná £10,000, nó, de rogha na cúirte, príosúnacht ar feadh téarma nach faide ná dhá bhliain, nó an fhíneáil agus an phríosúnacht le chéile, a chur air.
(4) (a) I gcás ina gciontófar duine i gcion dá dtagraítear i bhfo-alt (3) den alt seo agus go leanfaidh sé den chion tar éis a chiontaithe beidh sé ciontach i gcion breise agus dlífear, ar é a chiontú ar díotáil, fíneáil nach mó ná £1,000 in aghaidh gach lae a leanfar amhlaidh den chion, nó príosúnacht ar feadh téarma nach faide ná dhá bhliain, nó an fhíneáil agus an phríosúnacht le chéile, a chur air.
(b) In aon imeachtaí maidir le cion faoin alt seo ina líomhnaítear gur lean an cosantóir de chion faoi fho-alt (3) d'alt 24 den Phríomh-Acht, beidh feidhm, maidir leis na himeachtaí, ag fo-alt (4) den alt sin 24, mar atá feidhm aige maidir le hionchúiseamh i leith ciona faoin alt sin.
(c) In aon imeachtaí maidir le cion faoin alt seo ina líomhnaítear gur lean an cosantóir de chion faoi fho-alt (4) d'alt 26 d'Acht 1976—
(i) beidh feidhm, i ndáil leis na himeachtaí, ag fo-alt (7) den alt sin 26 mar atá feidhm aige i ndáil le himeachtaí a luaitear san fho-alt sin, agus
(ii) beidh feidhm, maidir leis na himeachtaí, ag fo-alt (8) den alt sin 26 mar atá feidhm aige maidir le hionchúiseamh i leith ciona faoin alt sin.
(5) Beidh éifeacht leis an alt seo maidir le cionta a dhéanfar tar éis tosach feidhme an ailt seo.

Féadfar cionta áirithe a thriail go hachomair.
9.—(1) Beidh dlínse ag Breitheamh den Chúirt Dúiche cion dá dtagraítear in alt 8 (3) den Acht seo, nó cion faoi alt 8 (4) den Acht seo, a thriail go hachomair—
(a) más é tuairim an Bhreithimh gur mionchion is intriailte go hachomair na fíorais a cruthaíodh nó a líomhnaíodh in aghaidh cosantóir a cúisíodh i gcion den sórt sin,
(b) má thoilíonn an Stiúrthóir Ionchúiseamh Poiblí leis, agus
(c) mura ndiúltóidh an cosantóir (ar bheith curtha in iúl dó ag an mBreitheamh gurb é a cheart dul ar a thriail roimh ghiúiré) dul ar a thriail go hachomair,
agus, ar é a chiontú faoin bhfo-alt seo, dlífear—
(i) i gcás é a chiontú i gcion dá dtagraítear amhlaidh, fíneáil nach mó ná £800, nó, de rogha na cúirte, príosúnacht ar feadh téarma nach faide ná sé mhí, nó an fhíneáil agus an phríosúnacht le chéile, a chur ar an gcosantóir sin,
(ii) i gcás é a chiontú i gcion faoin alt sin 8 (4), fíneáil (nach mó ná £800 san iomlán) nach mó ná £150 in aghaidh gach lae a leanfar den chion, nó, de rogha na cúirte, príosúnacht ar feadh téarma nach faide ná sé mhí, nó an fhíneáil agus an phríosúnacht le chéile, a chur ar an gcosantóir sin.
(2) Beidh feidhm ag alt 13 den Acht um Nós Imeachta Coiriúil, 1967, i ndáil le cion dá dtagraítear i bhfo-alt (1) den alt seo amhail is dá ndéanfaí, in ionad na bpionós a shonraítear i bhfo-alt (3) den alt sin 13, an pionós dá bhforáiltear le fo-alt (1) den alt seo i ndáil leis an gcion a shonrú ann, agus déanfar an tagairt i bhfo-alt (2) (a) den alt sin 13 do na pionóis dá bhforáiltear san fho-alt sin (3) a fhorléiriú agus beidh éifeacht léi dá réir sin.

10.—(1) Féadfaidh an tAire, le toiliú an Aire Airgeadais, rialacháin a dhéanamh d'fhoráil—
(a) táillí forordaithe a íoc le húdaráis phleanála i ndáil le hiarratais ag iarraidh—
(i) cead faoi Chuid IV den Phríomh-Acht,
(ii) ceaduithe a cheanglaítear le rialacháin cheada,
(iii) ceaduithe a cheanglaítear a fháil faoi choinníoll ar faoina réir a thugtar cead nó ceadú faoin bPríomh-Acht, nó
(iv) síneadh nó síneadh breise faoi alt 4 den Acht seo,

(4) I gcás, faoi rialacháin faoin alt seo, go mbeidh táille iníoctha le húdarás pleanála nó leis an mBord agus maidir leis an duine arb aige is iníoctha an táille—

(7) Is forálacha i dteannta, agus ní forálacha in ionad, fhorálacha alt 22 d'Acht 1976 forálacha fho-alt (3) den alt seo.
Rialacháin.
11.—(1) Féadfaidh an tAire rialacháin a dhéanamh ina mbeidh foráil i ndáil le haon ní a bhaineann le nós imeachta maidir le hiarratais faoi alt 4 den Acht seo agus cibé socrú foghabhálach, iarmhartach nó forlíontach a dhéanamh iontu is dóigh leis is gá nó is cuí chun lánéifeacht a thabhairt d'aon cheann d'fhorálacha alt 2, 3 nó 4 den Acht seo.
(2) Go sonrach agus gan dochar do ghinearáltacht fho-alt (1) den alt seo, féadfaidh rialacháin faoin alt seo—
(a) an tráth a bhféadfar iarratais a dhéanamh faoi alt 4 den Acht seo, an modh ina ndéanfar na hiarratais sin agus na sonraí a bheidh iontu a shonrú,

LOCAL GOVERNMENT (PLANNING AND DEVELOPMENT) ACT, 1982
Interpretation.
1.—In this Act—
“the Act of 1976” means the Local Government (Planning and Development) Act, 1976;
“development certificate” means a certificate issued under section 29 of the Act of 1976;
“waiver notice” means a notice issued under section 29 of the Act of 1976.
Limit of duration of planning permission.
2.—(1) Subject to subsection (2) of this section, a permission granted under Part IV of the Principal Act, whether before or after the passing of this Act, shall on the expiration of the appropriate period (but without prejudice to the validity of anything done pursuant thereto prior to the expiration of that period) cease to have effect as regards—
(a) in case the development to which the permission relates is not commenced during that period, the entire development, and
(b) in case such development is commenced during that period, so much thereof as is not completed within that period.
(2) (a) Subsection (1) of this section shall not apply—
(i) to any permission for the retention on land of any structure,
(ii) to any permission granted either for a limited period only or subject to a condition which is of a kind described in section 26 (2) (j) or 27 (2) (f) of the Principal Act,
(iii) to any permission which is of a class or description specified in regulations made by the Minister for the purposes of this section,
(iv) in the case of a house, shop, office or other building which itself has been completed, in relation to the provision of any structure or works included in the relevant permission and which are either necessary for or ancillary or incidental to the use of the building in accordance with that permission,
(v) in the case of a development comprising a number of buildings of which only some have been completed, in relation to the provision of roads, services and open spaces included in the relevant permission and which are necessary for or ancillary to such completed buildings.
(b) Subsection (1) of this section shall not affect—
(i) the continuance of any use, in accordance with a permission, of land,
(ii) where a development has been completed (whether to an extent described in paragraph (a) of this subsection or otherwise), the obligation of any person to comply with any condition attached to the relevant permission whereby something is required either to be done or not to be done.
(3) (a) Where regulations under this section are proposed to be made, the Minister shall cause a draft thereof to be laid before both Houses of the Oireachtas and the regulations shall not be made until a resolution approving of the draft has been passed by each such House.
(b) Section 10 (2) of the Principal Act shall not apply in relation to regulations made under this section.
(4) This section shall be deemed to have come into operation on the 1st day of November, 1981.
(5) In this section and in section 4 of this Act, “the appropriate period” means—
(a) in relation to any permission which was granted before the 1st day of November, 1976, the period beginning on the date of such grant and ending on the 31st day of October, 1983,
(b) in relation to any permission which was or is granted not earlier than the 1st day of November, 1976, nor later than the 31st day of October, 1982—
(i) in case in relation to the permission a period is specified pursuant to section 3 of this Act, that period, and
(ii) in any other case, the period ending either on the day which is seven years after the date of such grant or the 31st day of October, 1987, whichever is the earlier,
(c) in relation to any permission which was or is granted on or after the 1st day of November, 1982—
(i) in case in relation to the permission a period is specified pursuant to section 3 of this Act, that period, and
(ii) in any other case, the period of five years beginning on the date of such grant:
Provided that where a planning authority have, before the commencement of this section, made an order under section 29 (9) of the Act of 1976 and by virtue of the order the permission to which the order relates would, if this section had not been enacted, cease to have effect on a date which is later than that on which it would, apart from this proviso, cease to have effect, then, notwithstanding the foregoing provisions of this section and section 15 of this Act, the appropriate period in relation to the permission shall end on such later date.
(6) A planning authority in exercising, in relation to a permission referred to in subsection (5) (b) of this section, the power conferred on them by section 3 of this Act shall not exercise the power so as to specify a period which is shorter than that which, by virtue of the said subsection (5) (b), would apply in relation to the permission if the power were not so exercised.
Power to vary appropriate period.
3.—Without prejudice to the powers conferred on them by Part IV of the Principal Act to grant a permission to develop land for a limited period only, in deciding to grant a permission under section 26 of the Principal Act, a planning authority or the Board, as may be appropriate, may, having regard to the nature and extent of the relevant development and any other material consideration, specify the period, being a period of more than five years, during which the permission is to have effect, and in case the planning authority exercise, or refuse to exercise, the power conferred on them by this section, such exercise or refusal shall be regarded as forming part of the relevant decision of such authority under the said section 26.
Power to extend appropriate period.
4.—(1) On an application being made to them in that behalf, a planning authority shall, as regards a particular permission, extend the appropriate period, by such additional period as the authority consider requisite to enable the development to which the permission relates to be completed, if, and only if, each of the following requirements is complied with:
(a) the application is in accordance with such regulations under this Act as apply to it,
(b) any requirements of, or made under, such regulations are complied with as regards the application, and
(c) the authority are satisfied in relation to the permission that—
(i) the development to which such permission relates commenced before the expiration of the appropriate period sought to be extended, and
(ii) substantial works were carried out pursuant to such permission during such period, and
(iii) the development will be completed within a reasonable time.
(2) Where—
(a) an application is duly made under this section to a planning authority,
(b) any requirements of, or made under, regulations under section 11 of this Act are complied with as regards the application, and
(c) the planning authority do not give notice to the applicant of their decision as regards the application within the period of two months beginning on—
(i) in case all of the aforesaid requirements referred to in paragraph (b) of this subsection are complied with on or before the day of receipt by the planning authority of the application, that day, and
(ii) in any other case, the day on which all of the said requirements stand complied with,
subject to section 10 (2) of this Act, a decision by the planning authority to extend, or to further extend, as may be appropriate, the period, which in relation to the relevant permission is the appropriate period, by such additional period as is specified in the application shall be regarded as having been given by the planning authority on the last day of the said two month period.
(3) (a) Where a decision to extend an appropriate period is given under subsection (1) of this section, or, pursuant to subsection (2) of this section, such a decision is to be regarded as having been given, the planning authority shall not further extend the appropriate period, unless each of the following requirements is complied with:
(i) an application in that behalf is made to them in accordance with such regulations under this Act as apply to it,
(ii) any requirements of, or made under, such regulations are complied with as regards the application, and
(iii) the authority are satisfied that the relevant development has not been completed due to circumstances beyond the control of the person carrying out the development.
(b) An appropriate period shall be further extended under this subsection only for such period as the relevant planning authority consider requisite to enable the relevant development to be completed.
(4) Particulars of any application made to a planning authority under this section and of the decision of the planning authority in respect of such application shall be recorded on the relevant entry in the register.
(5) Where a decision to extend, or to further extend, is given under this section, or, pursuant to subsection (2) of this section, such a decision is to be regarded as having been given, section 2 of this Act shall, in relation to the permission to which the decision relates, be construed and have effect subject to and in accordance with the terms of the decision.
(6) This section shall not be construed as precluding the extension, or the further extension, of an appropriate period by reason of the fact that the period has expired.
Power to declare references, appeals and applications withdrawn.
5.—(1) Where the Board is of opinion that a reference or appeal to the Board, or an application for permission or approval to which such an appeal relates, has been abandoned, the Board may serve on the person who made the reference, appeal or application, as may be appropriate, a notice stating that fact and requiring that person, within a period specified in the notice (being a period of not less than fourteen days beginning on the date of service of the notice) to make to the Board a submission in writing as to why the reference, appeal or application, as the case may be, should not be regarded as having been withdrawn.
(2) Where a notice has been served under subsection (1) of this section the Board may, at any time after the expiration of the period specified in the notice, and after considering the submission (if any) made to the Board pursuant to the notice, declare—
(i) in case the notice refers to a reference, that the reference shall be regarded as having been withdrawn,
(ii) in case the notice refers to an application described in subsection (1) of this section, that the application shall be regarded as having been withdrawn, and
(iii) in case the notice refers to an appeal to the Board, that the appeal shall be regarded as having been withdrawn.
(3) Where pursuant to this section the Board declares that an application described in subsection (1) of this section is to be regarded as having been withdrawn, the following provisions shall apply as regards the application:
(a) any appeal in relation to the application shall be regarded as having been withdrawn and accordingly shall not be determined by the Board, and
(b) notwithstanding any previous decision under section 26 or 27 of the Principal Act by a planning authority as regards the application, no permission or approval shall be granted under either of those sections by the authority on foot of the application.
(4) Where the Board makes a declaration under this section, not-withstanding section 15 (2) of the Act of 1976, the Board may, if it thinks fit, direct that the deposit lodged in relation to the relevant appeal, or in relation to any appeal to which the relevant application relates, as may be appropriate, shall be forfeited to the Board.
Validity of certain permissions and approvals.
6.—(1) A permission or approval granted on appeal under Part IV of the Principal Act prior to the 15th day of March, 1977, shall not be, and shall not be regarded as ever having been, invalid by reason only of the fact that the development concerned contravened, or would contravene, materially the development plan relating to the area of the planning authority to whose decision the appeal related.
(2) If, because of any or all of its provisions, subsection (1) of this section, would, but for this subsection, conflict with a constitutional right of any person, the provisions of that subsection shall be subject to such limitation as is necessary to secure that they do not so conflict but shall be otherwise of full force and effect.
General policy directives as to planning and development.
7.—(1) The Minister shall, from time to time, issue such general directives as to policy in relation to planning and development as he considers necessary.
(2) A planning authority and the Board shall in performing its functions have regard to any directive under this section.
(3) Nothing in this section shall be construed as enabling the Minister to exercise any power or control in relation to any particular case with which a planning authority or the Board is or may be concerned.
(4) Where the Minister gives a directive under this section, the following provisions shall apply:
(a) as soon as may be the Minister shall cause a copy of the directive to be laid before each House of the Oireachtas,
(b) the directive shall be published in the Iris Oifigiúil, and
(c) the Minister shall cause a copy of the directive to be sent to each planning authority and to the Board.
Alteration of certain penalties under Principal Act or Act of 1976.
8.—(1) A person convicted by the District Court of an offence for which a penalty is provided in any section of the Principal Act specified in column (2) of the Table to this section at any reference number shall, in lieu of the penalty so provided, be liable to the penalty specified in column (3) of the said Table at that reference number, and that section shall be construed and have effect accordingly.
(2) (a) A person convicted of an offence under subsection (9) of section 32 of the Act of 1976 shall, in lieu of so much of the penalty specified in that subsection as consists of a fine, be liable to a fine not exceeding £800, and the said subsection (9) shall be construed and have effect accordingly.
(b) A person convicted of an offence under subsection (10) of section 33 of the Act of 1976 shall, in lieu of so much of the penalty specified in that subsection as consists of a fine, be liable to a fine not exceeding £800, and the said subsection (10) shall be construed and have effect accordingly.
(3) A person who is guilty of an offence under section 24 (3) of the Principal Act or section 26 (4) of the Act of 1976 shall be liable, on conviction on indictment, to a fine not exceeding £10,000, or, at the discretion of the court, to imprisonment for a term not exceeding two years, or to both the fine and the imprisonment.
(4) (a) Where a person is convicted of an offence referred to in subsection (3) of this section and there is a continuation by him of the offence after his conviction, he shall be guilty of a further offence and shall be liable, on conviction on indictment, to a fine not exceeding £1,000 for each day on which the offence is so continued or to imprisonment for a term not exceeding two years, or to both the fine and the imprisonment.
(b) In any proceedings for an offence under this section in which it is alleged that there was a continuation by the defendant of an offence under subsection (3) of section 24 of the Principal Act, subsection (4) of the said section 24 shall, as regards the proceedings, apply as it applies to a prosecution for an offence under that section.
(c) In any proceedings for an offence under this section in which it is alleged that there was a continuation by the defendant of an offence under subsection (4) of section 26 of the Act of 1976—
(i) subsection (7) of the said section 26 shall, in relation to the proceedings, apply as it applies in relation to proceedings mentioned in that subsection, and
(ii) subsection (8) of the said section 26 shall, as regards the proceedings, apply as it applies to a prosecution for an offence under that section.
(5) This section shall have effect as respects offences committed after the commencement of this section.

Certain offences may be tried summarily.
9.—(1) A Justice of the District Court shall have jurisdiction to try summarily an offence referred to in section 8 (3) of this Act, or an offence under section 8 (4) of this Act if—
(a) the Justice is of opinion that the facts proved or alleged against a defendant charged with such an offence constitute a minor offence fit to be tried summarily,
(b) the Director of Public Prosecutions consents, and
(c) the defendant (on being informed by the Justice of his right to be tried by a jury) does not object to being tried summarily,
and, upon conviction under this subsection, the said defendant shall be liable—
(i) in case he is convicted of an offence so referred to, to a fine not exceeding £800, or, at the discretion of the court, to imprisonment for a term not exceeding six months, or to both the fine and the imprisonment,
(ii) in case he is convicted of an offence under the said section 8 (4), to a fine (not exceeding £800 in all) not exceeding £150 for each day during which the offence is continued, or, at the discretion of the court, to imprisonment for a term not exceeding six months, or to both the fine and the imprisonment.
(2) Section 13 of the Criminal Procedure Act, 1967, shall apply in relation to an offence referred to in subsection (1) of this section as if, in lieu of the penalties specified in subsection (3) of the said section 13, there were specified therein the penalty provided for by subsection (1) of this section in relation to the offence, and the reference in subsection (2) (a) of the said section 13 to the penalties provided for in the said subsection (3) shall be construed and have effect accordingly.
Fees.
10.—(1) The Minister may, with the consent of the Minister for Finance, make regulations providing for—
(a) the payment to planning authorities of prescribed fees in relation to applications for—
(i) permission under Part IV of the Principal Act,
(ii) approvals required by permission regulations,
(iii) approvals required to be obtained under a condition subject to which a permission or approval is granted under the Principal Act, or
(iv) extensions or further extensions under section 4 of this Act,
(b) the payment to the Board of prescribed fees in relation to appeals or references to, or determinations by, the Board,
and the regulations may provide for the payment of different fees in relation to cases of different classes or descriptions, for exemption from the payment of fees in specified circumstances, for the waiver, remission or refund (in whole or in part) of fees in specified circumstances and for the manner in which fees are to be disposed of.
(2) Where under regulations under this section a fee is payable to a planning authority by an applicant in respect of an application referred to in subsection (1) (a) of this section, the following provisions shall have effect:
(a) the application shall not be decided by the authority unless the authority is in receipt of the fee, and
(b) notwithstanding anything contained in section 26 (4) or 27 (3) of the Principal Act or in section 4 (2) of this Act, a decision of a planning authority shall not be regarded, pursuant to any of those sections, as having been given on a day which is earlier than that which is two months after the day on which the authority is in receipt of the fee, and the said sections 26 (4), 27 (3) and 4 (2) shall be construed subject to and in accordance with the provisions of this paragraph.
(3) Where—
(a) under regulations under this section a fee (other than a fee referred to in subsection (6) of this section) is payable to the Board by an appellant in respect of an appeal by him to the Board, and
(b) the provision of the Local Government (Planning and Development) Acts, 1963 and 1976, authorising the appeal enables the appeal only to be made within, or before the expiration of, a specified period or before a specified day, that provision shall be construed as including—
(i) a requirement that the fee is to be received by the Board within, or before the expiration of, that period, or before that day (or, if the fee is sent by post, not later than the third day after that period or day), and
(ii) a provision that if the fee is not so received, the appeal shall be invalid.
(4) Where under regulations under this section a fee is payable either to a planning authority or to the Board and the person by whom the fee is payable is not—
(a) the applicant for a permission, approval or licence, or
(b) an appellant to the Board, or
(c) the person making a reference to, or a request for a determination by, the Board,
submissions or observations made, as regards the relevant application, appeal, reference or determination, by or on behalf of the person by whom such fee is payable, shall not be considered by the planning authority or the Board, as may be appropriate, if the fee has not been received by the authority or the Board.
(5) Where under regulations under this section a fee is payable to the Board by a person making a reference to, or a request for a determination by, the Board, the relevant question or matter shall not be decided or determined by the Board unless the fee is received by the Board.
(6) Where under regulations under this section fees are payable to the Board in respect of requests for oral hearings of appeals or references to the Board, such a request shall not be considered by the Board if the fee so payable in respect of the request is not received by the Board.
(7) The provisions of subsection (3) of this section are in addition to, and not in substitution for, the provisions of section 22 of the Act of 1976.
Regulations.
11.—(1) The Minister may make regulations providing for any matter of procedure in relation to applications under section 4 of this Act and making such incidental, consequential or supplementary provision as may appear to him to be necessary or proper to give full effect to any of the provisions of sections 2, 3 or 4 of this Act.
(2) In particular and without prejudice to the generality of subsection (1) of this section, regulations under this section may—
(a) specify the time at which applications under section 4 of this Act may be made, the manner in which such applications shall be made and the particulars they shall contain,
(b) require applicants to furnish to the planning authority any specified information with respect to their applications (including any information regarding any estate or interest in or right over land),
(c) require applicants to submit to a planning authority any further information relative to their applications (including any information as to any such estate, interest or right),
(d) require the production of any evidence to verify any particulars or information given by any applicant,
(e) require the notification (in a prescribed manner) by planning authorities of decisions on such applications.
Amendment of section 8 of Principal Act.
12.—Paragraph (c) of section 8 (4) of the Principal Act is hereby amended by the substitution of “the prescribed fee” for “a fee of ten shillings”, and the said paragraph (c), as so amended, is set out in the Table to this section.

(c) Where application is made to a planning authority for a copy under this section, the copy shall be issued to the applicant on payment by him to the planning authority of the prescribed fee in respect of each entry.
Amendment of section 80 of Principal Act.
13.—Section 80 of the Principal Act is hereby amended by the insertion of “summarily” after “prosecuted” in subsection (1), and the said subsection (1), as so amended, is set out in the Table to this section.

(1) An offence under this Act may be prosecuted summarily by the planning authority in whose area the offence is committed.
Savers.
14.—(1) Neither section 15 nor the proviso to section 2 (5) of this Act shall be construed as affecting the exercise by the Circuit Court or the Board, in relation to any application referred to in section 15 (4) (b) of this Act, of any power conferred on it by section 29 of the Act of 1976.
(2) Where before the commencement of this section an application was made to a planning authority for a permission or for an approval, a decision of the authority as regards the application shall not, by reason only of the enactment of section 2 of this Act, be regarded, pursuant to section 26 (4) or 27 (3) of the Principal Act, as having been given.
Repeals.
15.—(1) In subsection (3) of section 24 of the Principal Act all the words between “guilty of an offence” and the end of the subsection are hereby repealed.
(2) Subject to subsection (3) of this section, the following provisions of the Act of 1976 are hereby repealed:
(a) sections 6, 15 (1), 26 (5) and 38,
(b) subsections (1), (2), (3), (4), (7) and (9) of section 29,
(c) “and shall be liable on summary conviction to a fine not exceeding two hundred and fifty pounds” in section 26 (4).
(3) This section, in so far as it repeals section 15 (1) of the Act of 1976, shall come into operation on such day as the Minister shall fix by order.
(4) Notwithstanding subsection (2) of this section—
(a) any waiver notice or any development certificate shall continue in force and to have effect,
(b) a planning authority may after the commencement of this section issue a waiver notice or a development certificate if, but only if, an application made to them in that behalf has been received by them before such commencement.
Short title, collective citation and construction.
16.—(1) This Act may be cited as the Local Government (Planning and Development) Act, 1982.
(2) The Local Government (Planning and Development) Acts, 1963 and 1976, and this Act may be cited together as the Local Government (Planning and Development) Acts, 1963 to 1982.
(3) This Act and the Local Government (Planning and Development) Acts, 1963 and 1976, shall be construed together as one Act.
