ACHT DO DHÉANAMH SOCRÚ LE GO nEISEOIDH AN tAIRE AIRGEADAIS MONAÍ D'AINMLUACH PUINT AMHÁIN AGUS MONAÍ IN AINMLUACH AONAD AIR-GEADAÍOCHTA EORPACH, DO LEASÚ NA nACHT-ANNA UM AIRGEAD REATHA DEACHÚIL, 1969 GO 1989, AGUS DO DHÉANAMH SOCRÚ I dTAOBH NITHE COMHGHAOLMHARA. [20 Márta, 1990]
ACHTAÍTEAR AG AN OIREACHTAS MAR A LEANAS:
“An Príomh-Acht”.
1.—San Acht seo ciallaíonn “an Príomh-Acht” an tAcht um Airgead Reatha Deachúil, 1969.
An tAire do sholáthar agus d'eisiúint monaí in ainmluach aonad airgeadaíochta Eorpach.
2.—(1) Féadfaidh an tAire monaí a sholáthar de cibé ainmluachanna in ionaid airgeadaíochta Eorpacha, de cibé dearaí, toisí, meáchain agus miotal, nó de cibé miotail agus comhshuíomh, a chinnfidh sé.
(2) Féadfaidh an tAire tríd an mBanc Ceannais monaí a sholáthrófar faoin alt seo a eisiúint agus a chur ar díol don phobal.
(3) Is é an tAire a chinnfidh praghsanna na monaí a chuirfear ar díol faoi fho-alt (2).
(4) Ní bheidh tairiscint mona a eiseofar faoin alt seo ina dhlíthairiscint chun aon suim a íoc agus ní bheidh sealbhóir mona den sórt sin i dteideal aon luach a thaispeántar air nó cóimhéid an luacha sin in airgead reatha aon stáit a éileamh.
(5) Beidh feidhm ag ailt 6 agus 13 den Phríomh-Acht maidir le monaí a sholáthrófar faoin alt seo.
(6) Beidh feidhm ag ailt 7, 11 agus 20 den Phríomh-Acht maidir le monaí a eiseofar faoin alt seo.
(7) Beidh feidhm ag alt 57 den Acht Cóipchirt, 1963, maidir le monaí a eiseofar faoin alt seo.
Leasú ar an bPríomh-Acht.
3.—Leasaítear leis seo an Príomh-Acht—
(a) tríd an alt seo a leanas a chur isteach i ndiaidh alt 4:
“Monaí copair ina bhfuil miotail eile a sholáthar. | 4A.—(1) Féadfaidh an tAire, i dteannta nó in ionad monaí cré-umha a sholáthar de na hainmluachanna faoi seach a údaraítear le halt 3 den Acht seo, monaí de na hainmluachanna sin a sholáthar arb é a bheidh iontu, i ngach cás, croí miotail nó miotal (seachas copar) a bheith clúdaithe i gcopar. |
(2) Gach mona a sholáthrófar faoin alt seo beidh an meáchan caighdeánach agus an comhshuíomh caighdeánach ann a fhorordóidh an tAire le rialacháin. | |
(3) Lamhálfar i leith monaí a sholáthrófar faoin alt seo an tualaing (nó an claonadh ón meáchan caighdeánach agus ón gcomhshuíomh caighdeánach) a fhorordóidh an tAire le rialacháin. | |
(4) Mona d'aon ainmluach a sholáthrófar faoin alt seo beidh na toisí agus an dearadh céanna ann a bheidh sna toisí agus sa dearadh a bheidh forordaithe de thuras na huaire faoi alt 3(6) den Acht seo maidir le mona den ainmluach sin. | |
(5) Bainfidh ailt 5 agus 6 den Acht seo le monaí a sholáthrófar faoin alt seo agus bainfidh alt 7 den Acht seo le gach eisiúint monaí a sholáthrófar amhlaidh.”, |
(b) in alt 14, trí “nó faoin Acht um Airgead Reatha Deachúil, 1990,” a chur isteach i ndiaidh “faoin Acht seo,” i bhfo-alt (1), agus
(c) sa Chéad Sceideal, tríd an méid seo a leanas a chur isteach sa chuid faoi “Monaí Cupra-nicile”:

4.—(1) Féadfar an tAcht um Airgead Reatha Deachúil, 1990, a ghairm den Acht seo.
(2) Féadfar na hAchtanna um Airgead Reatha Deachúil, 1969 go 1990, a ghairm de na hAchtanna um Airgead Reatha Deachúil, 1969 go 1989, agus den Acht seo le chéile agus forléireofar le chéile iad mar aon Acht amháin.

DECIMAL CURRENCY ACT, 1990
“Principal Act”.
1.—In this Act “the Principal Act” means the Decimal Currency Act, 1969.
Provision and issue by Minister of coins denominated in European currency units.
2.—(1) The Minister may provide coins of such denominations in European currency units, of such designs, of such dimensions, of such weights and of such metal, or of such metals and composition, as he may determine.
(2) Coins provided under this section may be issued and put on sale to the public by the Minister through the Central Bank.
(3) The prices of coins put on sale under subsection (2) shall be determined by the Minister.
(4) A tender of a coin issued under this section shall not be legal tender for the payment of any amount and a holder of such a coin shall not be entitled to demand any value denoted thereon or the equivalent of that value in the currency of any state.
(5) Sections 6 and 13 of the Principal Act shall apply to coins provided under this section.
(6) Sections 7, 11 and 20 of the Principal Act shall apply to coins issued under this section.
(7) Section 57 of the Copyright Act, 1963, shall apply to coins issued under this section.
Amendment of Principal Act.
3.—The Principal Act is hereby amended—
(a) by the insertion of the following section after section 4:
“Provision of copper coins containing other metals.
4A.—(1) The Minister may, in addition to or in lieu of providing bronze coins of the several denominations authorised by section 3 of this Act, provide coins of those denominations consisting, in each case, of a core of metal or metals (other than copper) covered in copper.
(2) Every coin provided under this section shall be of the standard weight and standard composition prescribed by the Minister by regulations.
(3) There shall be allowed in respect of coins provided under this section the remedy (or variation from the standard weight and standard composition) prescribed by the Minister by regulations.
(4) A coin of any denomination provided under this section shall be of the same dimensions and design as the dimensions and design standing prescribed for the time being under section 3 (6) of this Act in respect of a coin of that denomination.
(5) Sections 5 and 6 of this Act shall apply to coins provided under this section and section 7 of this Act shall apply to every issue of coins so provided.”,
(b) in section 14, by the insertion in subsection (1) after “this Act” of “or the Decimal Currency Act, 1990,”, and
(c) in the First Schedule, by the insertion in the part headed “Cupro-nickel Coins” of the following:
“

”.
Short title and construction.
4.—(1) This Act may be cited as the Decimal Currency Act, 1990.
(2) The Decimal Currency Acts, 1969 to 1989, and this Act may be cited together as the Decimal Currency Acts, 1969 to 1990, and shall be construed together as one Act.
